SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty in the morning on tres de octubre de dos mil veinticinco.
Petition for constitutional relief (recurso de amparo) being processed under expediente number 24-035754-0007-CO, filed by Nombre49739, identity card CED39648, against the MINISTERIO DE SALUD, the CONSEJO NACIONAL DE VIALIDAD, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
FINDINGS:
Justice Cruz Castro drafts the opinion; and,
Considering:
Before examining the merits—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545, issued at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes over whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, both for issuing a final administrative act resolving an administrative proceeding initiated ex officio or at the request of a party and for deciding the applicable administrative appeals. This case presents precisely such an exception because it concerns a complaint filed with the authorities of the Área Rectora de Salud de Grecia of the Ministerio de Salud and the Consejo Nacional de Vialidad regarding a sewerage problem affecting the environment and residents’ health. That point having been clarified, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
The appellant files an amparo action (recurso de amparo) and states that, despite having known for nearly two years about the obstruction of a culvert alongside a national highway, the Dirección del Área de Salud de Grecia and the Dirección de CONAVI have neither resolved the problem nor provided an effective response to the complaints filed (with documentary and photographic evidence submitted). The appellant states that the situation has caused multiple adverse effects in the community: the proliferation of standing water that constitutes a breeding ground for dengue-carrying mosquitoes—which prompted visits by the C.C.S.S. for preventive campaigns—and harm to the physical and mental health of residents, who suffer from colds, allergies, skin infections, and discomfort from foul odors that cause headaches, insomnia, nausea, and respiratory problems. The appellant further recounts that children and young people must walk to educational institutions with wet footwear and under unsanitary conditions.
The appellant also complains of noise pollution caused by vehicles driving through the water, which disrupts the rest and concentration of those engaged in remote work or academic activities. Likewise, the appellant warns of the serious risk of traffic accidents, since pedestrians are forced to encroach upon the roadway or move dangerously close to its edge, and motor vehicles have skidded on various occasions. The appellant even reports recent incidents in which vehicles have left the roadway, collided with utility poles, and caused prolonged interruptions of electricity service and closure of the road. The appellant states that, although the Ministerio de Salud and CONAVI claim to have intervened, their actions have merely been palliative and have not definitively resolved the problem. The most recent formal response from the Ministerio de Salud dates from October of the current year, while some emails addressed to CONAVI have not even been answered.
In light of the foregoing, the appellant considers that the fundamental rights to life and to a healthy environment, enshrined in Articles 21 and 50 of the Constitución Política, have been violated and requests that the respondent authorities be ordered to adopt immediate and definitive measures to resolve the reported problem.
The following facts are deemed duly established and relevant to the adjudication of this matter, either because they have been proven as such or because the respondent authority failed to address them, as required in the initial order:
Regarding the facts related to the Área Rectora de Salud de Grecia of the Ministerio de Salud:
1. On January 24, 2024, Ms. Nombre49739 filed a complaint with the Área Rectora de Salud de Grecia, stating that in the community of El Poró, 200 meters south of Palí, along the main road, a culvert was overflowing, causing foul odors, the presence of flies, and danger to vehicular and pedestrian traffic, a situation she considered detrimental to public health (see report submitted by the respondent authorities).
2. On January 31, 2024, Licda. Nombre46454, Environmental Manager, inspected the site and confirmed the poor condition of the storm sewer system (sistema de alcantarillado pluvial), with buried and broken sections and inadequate infrastructure. As a palliative measure, she applied larvicide to the standing water to prevent the proliferation of disease vectors (vectores) (see report submitted by the respondent authorities).
3. On February 06, 2024, through official letter MS-DRRSCN-DARSG-0254-2024, the Área Rectora de Salud requested that the Consejo Nacional de Vialidad (CONAVI) intervene at the site and repair the storm sewer system (see report submitted by the respondent authorities).
4. On March 08, 2024, through official letter DIE-07-2024-0299 (029), the Director of CONAVI, Eng. Nombre50850, acknowledged the deterioration of the system and stated that the sewer system would be replaced in April 2024, adding that sewage (aguas negras) had been detected at the site and that addressing it was the responsibility of the Ministerio de Salud (see report submitted by the respondent authorities).
5. On March 11, 2024, the Área Rectora de Salud requested the assistance of a Civil Engineer from the Unidad de Rectoría de la Dirección Regional de Rectoría de la Salud Central Norte to conduct a technical assessment of the situation (see report submitted by the respondent authorities).
6. On April 08, 2024, Eng. Nombre73124 conducted a technical inspection at the site and, on May 07, 2024, issued report MS-DRRSCN-URS-IT-470-2024, concluding that a section of stormwater pipe had been destroyed, causing flooding on the roadway and adjoining properties and creating risks to public health, road safety, and nearby homes. He recommended issuing a health order (orden sanitaria) to CONAVI for the immediate repair of the damaged pipe (see report submitted by the respondent authorities).
7. In October 2024, although CONAVI had stated that the repair would be performed in April of that same year, the work had not been undertaken. The Área Rectora de Salud therefore resubmitted the technical report to CONAVI, urging it to implement the necessary measures as a matter of urgency to resolve the problem (see report submitted by the respondent authorities).
8. On December 20, 2024, in view of CONAVI’s failure to act, the Área Rectora de Salud issued health order N° MS-DRRSCN-DARSGRC-OS-2997-2024, ordering that institution to perform the work necessary to repair the damaged sewer system on national route N°118, in order to prevent unsanitary conditions, flooding, and road hazards in the community (see report submitted by the respondent authorities).
Regarding the facts related to the Consejo Nacional de Vialidad:
1. On January 07, 2025, the Zone Engineer and the Dirección Regional Región Central, both of CONAVI’s Gerencia de Conservación de Vías y Puentes, issued technical report N.° DRC-06-2025-0013 (0189), which concluded that the permanent presence of water in the reported culvert was due to the discharge of sewage or wastewater (aguas negras o servidas), rather than stormwater, causing the sewer system to become saturated. It stated that a crew had already cleaned the culvert for that purpose and that jurisdiction over the disposal of wastewater rests with the Ministerio de Salud, not CONAVI (see report submitted by the respondent authorities).
2. Also on January 07, 2025, technical report DRC-06-2025-0013 (0189) stated that rainwater, although it should not function in this manner, served in this case as a means of carrying wastewater along the roadway and into the culvert, reiterating that the problem was not attributable to CONAVI because its jurisdiction is limited to the construction and maintenance of the national road network (see report submitted by the respondent authorities).
Regarding the facts related to the Instituto Costarricense de Acueductos y Alcantarillados:
1. On June 10, 2025, Engineer Nombre73126, an official of AyA’s UEN Gestión de Acueductos Rurales, reported through official letter GSD-UEN-GAR-2025-02162 that the drinking-water operator at the reported site is the ASADA de Puente Piedra de Grecia and that there is no sanitary sewer network (red de alcantarillado sanitario) in the area. She stated that the problem concerns improper management of the stormwater collection and conveyance system, since an unfinished drainage ditch (cuneta) was found, with discontinuous sections and no storm drains (tragantes), causing water to pool and overflow onto the public roadway. She also observed discharges from pipes leading from single-family homes into the drainage ditch and detected a continuous discharge of water, probably wastewater, because it had not rained that day. She recommended an inspection by the Ministerio de Salud to determine the nature of those discharges (see report submitted by the respondent authorities).
2. The Instituto Costarricense de Acueductos y Alcantarillados does not provide service in the area. The problem involves unlawful wastewater discharges into roadside drains (caños), which must be controlled by the Ministerio de Salud, since there is no effective oversight of contaminated-water discharges and the homes lack authorization to make untreated discharges into a public watercourse (cauce público) (see report submitted by the respondent authorities).
On repeated occasions, this Court has developed the substance of this right, set forth in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, which makes intervention by the Public Authorities necessary with respect to factors that may disturb the environment’s balance and hinder people from developing and conducting their lives in a healthy environment. The State serves as the guarantor of the protection and safeguarding of the environment and natural resources. In this regard, the supervision and enforcement of environmental matters and activities constitute an essential function of the State; therefore, when environmental protection is concerned, the functions of governance, supervision, and enforcement in environmental matters rest with the State through its various administrative agencies.
As has been repeatedly stated in the case law of this Chamber, constitutional jurisdiction in environmental matters cannot be extended to the point that the Chamber becomes a reviewer of the technical criteria embodied in regulations or issued by administrative authorities in environmental matters; rather, it is limited to determining whether the competent state agencies have fulfilled the obligation imposed upon them by Article 50 of the Constitución Política to act responsibly and promptly with respect to environmental protection. It has also been held that the admissibility of an amparo action is contingent upon proof of an interference with or threat to one or more of the rights or guarantees set forth in the Constitution or in the international human-rights instruments signed by the country. This latter circumstance underscores the inherently summary nature of amparo proceedings (proceso de amparo), whose procedure is ill-suited to slow and complex evidentiary measures or to the need to examine beforehand—in declaratory proceedings—whether rights below the constitutional level cited by the parties as part of the factual basis of the amparo action or the statutory report (informe de ley), as applicable, actually exist, since it is evident that this Chamber lacks jurisdiction over that matter.
In this situation, it is not appropriate for the Chamber to issue any ruling, whether favorable or unfavorable, in such cases, because determining whether fundamental rights have been infringed first requires that the dispute be resolved as a matter of ordinary law.
This Constitutional Court has recognized the State’s objective obligation to safeguard human life and has ruled on administrative omissions that jeopardize road safety and people’s physical integrity. In this regard, reference should be made to the provisions of judgment Nº2008-18443 at 18:01 hours on December 11, 2008, which stated:
“Before analyzing the specific case, it is appropriate to note what this Chamber has stated regarding the State’s objective obligation to protect human life. The right to life, frequently analyzed together with the right to physical integrity, has traditionally been understood as a right with negative content; that is, its purpose was limited to a claim against the State that it refrain from taking actions aimed at ending the physical existence of persons, such as torture or the death penalty, or that it punish, through the criminal justice system, public and private persons who attack the life and integrity of others. Nevertheless, the current trend is to impose various positive duties upon the State, in the sense that it must not disturb the physical existence of persons and, moreover, must act to protect them from the many dangers that threaten them, whether those dangers arise from actions of the State itself, from other persons, or even from nature itself.
Hence, for example, environmental matters have become, at least in our country, matters of a constitutional nature, since the right to a healthy and ecologically balanced environment was elevated to the status of a fundamental right. It must be clarified, however, that the objective existence of a State obligation regarding protection of the right to life does not necessarily entail a subjective right of persons to demand, through judicial bodies, that a particular measure be adopted; it does, however, entail the right to have suitable measures adopted to protect that right when public authorities act with manifest negligence. Consequently, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, whether through statutes, regulations, agreements, or other measures relating to administrative organization and procedures, and persons have the subjective right to require that it proceed diligently in this regard.
Thus, the possibility of judicially demanding, through a constitutional protection proceeding (amparo), a specific type of affirmative action from the State in fulfillment of its duty to protect the life and physical integrity of its inhabitants is limited to cases in which a clear and imminent danger to those rights is verified. Accordingly, if, for example, a particular community deemed it necessary to have a hospital to serve its residents—or any other public works project—it should not demand it through an amparo, but rather through previously established mechanisms and before the competent bodies and entities, which must consider the petition and determine its technical feasibility, without this necessarily implying a favorable response. It follows from the foregoing that intervention by the constitutional jurisdiction is viable only when the State’s failure to act, through its competent bodies, in addressing demands made by the country’s inhabitants in the exercise of their rights has been established (see, to this effect, judgment number 2003-11519, issued at ten thirty a.m. on October tenth, two thousand three).”
The established facts show that the health authority learned of the complaint on January 24, 2024; conducted an inspection on January 31, 2024; and identified deficient stormwater infrastructure and standing water posing a risk of vector proliferation. It coordinated with CONAVI on February 6, 2024, and obtained a technical report from the civil engineer on May 7, 2024, recommending the immediate issuance of a sanitary order (orden sanitaria) to repair the damaged pipe. Nevertheless, despite the continuing unsanitary conditions, foul odors, dengue risk, respiratory and skin conditions, and traffic hazards reported by the protected party (parte amparada), the sanitary order against CONAVI was not issued until December 20, 2024. Between January and December 2024, the measures taken were palliative and insufficient—application of larvicides, referrals, and official communications—and there was no evidence that proceedings had been diligently opened and pursued to identify and eliminate unlawful discharges from residences, impose corrective measures and penalties, or urgently require the execution of permanent works.
Under Article 50 of the Political Constitution, the State, through its specialized bodies, must guarantee a healthy and ecologically balanced environment and adopt preventive and control measures in response to public-health risks. The General Health Law (Ley General de Salud) grants the Ministerio de Salud powers of governance, oversight, inspection, regulation, and enforcement regarding discharges and unsanitary conditions, including the wastewater and sewage regime, vector control, issuance of sanitary orders, and commencement of enforcement proceedings (procedimientos sancionatorios). This Chamber’s case law has clarified that environmental monitoring and enforcement are essential functions of the State and that protection of life and integrity requires positive, timely, and effective action when definite risks are established (see judgments n.° 2008-18443 and 2003-11519).
Nevertheless, this Court observes that the health authority’s actions were largely palliative and delayed, allowing the adverse effects on the neighbors’ health and environment to continue, even though Articles 21 and 50 of the Constitution impose an obligation to act diligently and effectively to protect public health and the environment. Accordingly, a material administrative omission (omisión administrativa) has been established because, although some actions were taken, they were insufficient to contain the imminent risk. Therefore, as to this authority, the petition is granted.
With respect to CONAVI, it was established that, beginning in March 2024, it acknowledged the deterioration of the drainage system and undertook to make repairs in April of that year. Nevertheless, when that date arrived, and through October 2024, the work had not been performed, and the reported problem persisted. Subsequently, in its January 2025 technical report, the institution itself sought to disclaim responsibility by alleging that the culvert was overflowing because of sewage discharges, a matter within the jurisdiction of the Ministerio de Salud. That argument does not justify the established failure to act because, under Law N.° 7798, CONAVI is responsible for maintaining national roads and their associated roadway infrastructure. This Chamber has held that the State’s objective obligation to protect life and road safety requires its bodies to act diligently in response to manifest dangers (see judgments No. 2008-18443 and 2003-11519). In this case, CONAVI’s inactivity constituted an unconstitutional omission that exposed the community to risks of accidents, unsanitary conditions, and environmental harm. Consequently, as to this authority, the petition is granted.
According to the information provided by its Executive President and the inspection conducted by its official, it was established that AyA does not provide service in the area, as the area is administered by the ASADA de Puente Piedra. It was also confirmed that no sanitary sewer system exists at the location, making it impossible to attribute direct responsibility to that institution. Nevertheless, AyA’s diligence in conducting an inspection and documenting unlawful discharges originating from residences provides additional evidentiary support for establishing the other authorities’ failure to act. Consequently, as to AyA, the petition is denied.
Based on the foregoing, this Court concludes that the respondent authorities’ failure to act violated the fundamental rights of the protected party and the community, particularly the rights to life, health, and a healthy environment enshrined in Articles 21 and 50 of the Political Constitution. The Ministerio de Salud and CONAVI failed to act with the diligence required by the Constitution and this Chamber’s case law, prolonging a dangerous and harmful situation that should have been resolved immediately. As to AyA, the petition is dismissed because it lacks direct jurisdiction over the area.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Tribunales de lo Contencioso-Administrativo, rather than by this Chamber. However, the recent enactment of Law n.° 9097, Ley de Regulación del Derecho de Petición, established that this right may receive judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases in which petitioners believe that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Court to alter its line of precedent, since, under section 7 of its Law, this Court alone is responsible for defining its own jurisdiction.
Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding, all other cases—for the reasons stated by this Court in judgment N° 2008-02545, issued at 8:55 a.m. on February 22, 2008—fall within the jurisdiction of the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the American Convention on Human Rights, Constitutional Law (Derecho de la Constitución)—its values, principles, and rules—and the applicable statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
Although I agree with the majority of the Chamber that the amparo petition (recurso) should be granted, I disagree as to where the enforcement phase (fase de ejecución) of the matter should be conducted, due to the absence of adequate mechanisms under the regulations governing this constitutional jurisdiction for monitoring a judgment involving highly complex technical aspects, such as providing an effective solution to the water overflows on the at Dirección4339, near El Poró, across from the Interago establishment, 200 metros south of Supermercado Palí. It should be noted that, in the sub judice matter, the respondent authorities are ordered to take action regarding the unfinished drainage ditches (cunetas) and the discontinuous sections lacking storm drains (tragantes), which cause water to pool and overflow onto the public roadway, as well as to intervene with respect to pipe discharges from single-family homes into the drainage ditch or drains.
In view of the foregoing, in my judgment, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (artículo 155 y siguientes) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, oversee compliance stages, etc. Therefore, pursuant to artículo 56 de la Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of said Code.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 del 22 de agosto del 2011, artículo XXVI and published in Boletín Judicial número 19 del 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
The petition is hereby declared PARTIALLY GRANTED, solely against the authorities of the Área Rectora de Salud de Grecia del Ministerio de Salud and the Consejo Nacional de Vialidad. Consequently, Nombre46457, in her capacity as Directora del Área Rectora de Salud de Grecia del Ministerio de Salud, and Nombre5221, in his capacity as Director Ejecutivo a.i. del Consejo Nacional de Vialidad, or whoever may hold those offices, are ordered, within SIX MONTHS from notification of this decision, each authority acting within the scope of its powers, to coordinate and take the measures necessary to provide an effective solution to the water overflows on the at Dirección4339, near El Poró, across from the Interago establishment, 200 metros south of Supermercado Palí. The foregoing also means that they must take action regarding the unfinished drainage ditches, the discontinuous sections lacking storm drains that cause water to pool and overflow onto the public roadway, and intervene with respect to pipe discharges from single-family homes into the drainage ditch or drains.
The respondent authorities are warned that, pursuant to artículo 71 de la Ley de esta jurisdicción, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this declaration, which shall be assessed during enforcement of the judgment in the contentious-administrative jurisdiction. The petition is denied with respect to the Instituto Costarricense de Acueductos y Alcantarillados. Justice Nombre301 adds a note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to artículo 56 de la Ley de la Jurisdicción Constitucional, determines that it must be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in artículos 155 y siguientes del Código Procesal Contencioso Administrativo. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de octubre de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente número 24-035754-0007-CO interpuesto por Nombre49739, cédula de identidad CED39648, contra el MINISTERIO DE SALUD Y EL CONSEJO NACIONAL DE VIALIDAD Y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante una denuncia interpuesta ante las autoridades del Área Rectora de Salud de Grecia del Ministerio de Salud y del Consejo Nacional de Vialidad por un problema de alcantarillado que afecta el ambiente y la salud de los vecinos. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
La parte recurrente interpone recurso de amparo y expone que, la Dirección del Área de Salud de Grecia y la Dirección de CONAVI, pese a tener conocimiento desde hace casi dos años de la obstrucción de una alcantarilla frente a una carretera nacional, no han resuelto el problema ni brindado respuesta efectiva a las denuncias planteadas (aportando prueba documental y fotográfica). Expone que la situación ha generado múltiples afectaciones en la comunidad: proliferación de agua estancada que constituye criadero de mosquitos transmisores de dengue —lo que motivó visitas de la C.C.S.S. con campañas preventivas—; perjuicios a la salud física y mental de los vecinos, quienes padecen resfríos, alergias, infecciones en la piel, así como malestares por olores fétidos que ocasionan dolores de cabeza, insomnio, náuseas y problemas respiratorios. Relata además que niños y jóvenes deben caminar hacia los centros educativos con el calzado mojado y en condiciones insalubres.
Denuncia también la contaminación sonora generada por los vehículos al atravesar el agua, lo que afecta el descanso y la concentración de quienes realizan teletrabajo o actividades académicas. Igualmente, advierte el grave riesgo de accidentes de tránsito, pues peatones se ven obligados a invadir la vía o a orillarse peligrosamente, y los automotores han derrapado en diversas ocasiones. Incluso refiere incidentes recientes donde vehículos se han salido de la carretera, colisionando contra postes eléctricos y ocasionando interrupción prolongada del servicio de electricidad y cierre de la vía. Señala que, aunque el Ministerio de Salud y CONAVI afirman haber intervenido, sus acciones han sido únicamente paliativas y no han resuelto de forma definitiva el problema. La última respuesta formal del Ministerio de Salud data de octubre del año en curso, mientras que algunos correos dirigidos a CONAVI ni siquiera han sido contestados.
En razón de lo expuesto, estima vulnerados sus derechos fundamentales a la vida y a un ambiente sano, consagrados en los artículos 21 y 50 de la Constitución Política, solicitando que se ordene a las autoridades recurridas adoptar medidas inmediatas y definitivas para solucionar la problemática denunciada.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Sobre los hechos relacionados con el Área Rectora de Salud de Grecia del Ministerio de Salud:
1. El 24 de enero de 2024, la señora Nombre49739 presentó denuncia ante el Área Rectora de Salud de Grecia, en la que indicó que en la comunidad de El Poró, 200 metros al sur del Palí, sobre la carretera principal, se rebalsaba una alcantarilla ocasionando malos olores, presencia de moscas y peligro para el tránsito vehicular y peatonal, situación que consideró atentaba contra la salud de las personas (ver informe rendido por parte de las autoridades accionadas).
2. El 31 de enero de 2024, la Licda. Nombre46454, Gestora Ambiental, realizó inspección al sitio y comprobó el mal estado del sistema de alcantarillado pluvial, con tramos enterrados, quebrados y sin infraestructura adecuada. Como medida paliativa, aplicó larvicida en las aguas estancadas para prevenir la proliferación de vectores (ver informe rendido por parte de las autoridades accionadas).
3. El 06 de febrero de 2024, mediante oficio MS-DRRSCN-DARSG-0254-2024, el Área Rectora de Salud solicitó al Consejo Nacional de Vialidad (CONAVI) la intervención en el sitio y la reparación del sistema de alcantarillado pluvial (ver informe rendido por parte de las autoridades accionadas).
4. El 08 de marzo de 2024, mediante oficio DIE-07-2024-0299 (029), el Director del CONAVI, Ing. Nombre50850, reconoció el deterioro del sistema y señaló que se procedería a reemplazar el alcantarillado en abril de 2024, agregando que se detectaron aguas negras en el sitio, lo cual correspondía atender al Ministerio de Salud (ver informe rendido por parte de las autoridades accionadas).
5. El 11 de marzo de 2024, el Área Rectora de Salud solicitó la colaboración de un Ingeniero Civil de la Unidad de Rectoría de la Dirección Regional de Rectoría de la Salud Central Norte para valorar técnicamente la situación (ver informe rendido por parte de las autoridades accionadas).
6. El 08 de abril de 2024, el Ing. Nombre73124 realizó inspección técnica en el sitio y el 07 de mayo de 2024 rindió informe MS-DRRSCN-URS-IT-470-2024, en el que concluyó que existía una sección de tubería pluvial destruida que ocasionaba inundaciones en la vía y propiedades aledañas, generando riesgos a la salud pública, a la seguridad vial y a las viviendas cercanas. Recomendó girar orden sanitaria a CONAVI para la reparación inmediata de la tubería dañada (ver informe rendido por parte de las autoridades accionadas).
7. En el mes de octubre de 2024, pese a que CONAVI había indicado que en abril de ese mismo año se realizaría la reparación, no se había procedido con las obras. Por ello, el Área Rectora de Salud remitió nuevamente el informe técnico a CONAVI, instando a ejecutar las medidas necesarias de manera urgente para solucionar la problemática (ver informe rendido por parte de las autoridades accionadas).
8. El 20 de diciembre de 2024, ante la falta de acción por parte de CONAVI, el Área Rectora de Salud giró orden sanitaria N° MS-DRRSCN-DARSGRC-OS-2997-2024, ordenando a esa institución realizar las obras necesarias para reparar el alcantarillado dañado en la ruta nacional N°118, a fin de evitar los riesgos de insalubridad, inundaciones y peligros viales en la comunidad (ver informe rendido por parte de las autoridades accionadas).
Sobre los hechos relacionados con el Consejo Nacional de Vialidad:
1. El 07 de enero de 2025, el Ingeniero de la Zona y la Dirección Regional Región Central, ambos de la Gerencia de Conservación de Vías y Puentes del CONAVI, emitieron el informe técnico N.° DRC-06-2025-0013 (0189), en el cual se concluyó que la presencia permanente de aguas en la alcantarilla denunciada obedecía a la disposición de aguas negras o servidas, no a aguas pluviales, lo cual provocaba la saturación del alcantarillado. Se indicó que la limpieza de la alcantarilla ya se había realizado con cuadrilla para ese fin y que la competencia en la disposición de aguas servidas corresponde al Ministerio de Salud, no al CONAVI (ver informe rendido por parte de las autoridades accionadas).
2. El mismo 07 de enero de 2025, en el informe técnico DRC-06-2025-0013 (0189), se señaló que el agua de lluvia, aunque no debería ser así, funcionaba en este caso como un medio de arrastre de las aguas servidas en la carretera y en la alcantarilla, reiterando que la problemática no era atribuible al CONAVI, dado que su competencia se limita a la construcción y conservación de la red vial nacional (ver informe rendido por parte de las autoridades accionadas).
Sobre los hechos relacionados con el Instituto Costarricense de Acueductos y Alcantarillados:
1. El 10 de junio de 2025, la Ingeniera Nombre73126, funcionaria de la UEN Gestión de Acueductos Rurales del AyA, mediante oficio GSD-UEN-GAR-2025-02162, informó que el operador de agua potable en el sitio denunciado es la ASADA de Puente Piedra de Grecia y que en la zona no existe red de alcantarillado sanitario. Señaló que el problema corresponde al mal manejo del sistema de recolección y transporte de aguas pluviales, pues se encontró una cuneta sin terminar, con secciones discontinuas y sin tragantes, lo cual provoca estancamiento y desbordamiento hacia la vía pública. Además, observó descargas de tuberías provenientes de viviendas unifamiliares hacia la cuneta y detectó una descarga continua de agua, probablemente residual, ya que ese día no llovió. Recomendó una inspección del Ministerio de Salud para verificar la naturaleza de dichas descargas (ver informe rendido por parte de las autoridades accionadas).
2. El Instituto Costarricense de Acueductos y Alcantarillados, no presta el servicio en el área. El problema se trata de descargas ilícitas de aguas residuales en caños, lo cual debe ser controlado por el Ministerio de Salud, ya que no existe un control efectivo sobre el vertido de aguas contaminadas y las viviendas carecen de permiso para realizar descargas sin tratamiento en un cauce público (ver informe rendido por parte de las autoridades accionadas).
En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
Tal y como ha sido reiterado en la jurisprudencia de esta Sala, la competencia constitucional en materia ambiental no puede extenderse al punto en que se convierta en un verificador de los criterios técnicos vertidos en las normas o por las autoridades administrativas en materia ambiental, sino que se limita a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política, de asumir una actuación responsable y oportuna respecto a la protección del ambiente. Se ha sostenido también, que la procedencia del recurso de amparo está condicionada a que se acredite la existencia de una perturbación o amenaza a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se aviene bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, toda vez que es evidente que esa es una competencia de la que esta Sala carece.
Ante esta situación, no resulta procedente que la Sala vierta pronunciamiento alguno (positivo o negativo) en estos casos, porque para dilucidar si ha habido infracción o no de derechos fundamentales primero se debe resolver dicho conflicto en el plano de la legalidad.
Este Tribunal Constitucional ha reconocido la obligación objetiva del Estado de tutelar la vida humana y se ha pronunciado sobre las omisiones administrativas que atentan contra la seguridad vial y la integridad física de las personas. Sobre el particular, cabe referir lo dispuesto en sentencia Nº2008-18443 de las 18:01 horas del 11 de diciembre de 2008, donde se indicó:
“Previo análisis del caso concreto, conviene indicar lo dicho por esta Sala en cuanto a la obligación objetiva del Estado de tutelar la vida humana, en el sentido que ha sido usual que el derecho a la vida, frecuentemente analizado junto con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, que su objeto se limitaba a la pretensión contra el Estado de que se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo, la tortura o la pena de muerte, o bien, que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal. No obstante, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido de que no debe perturbar la existencia física de las personas y, además, debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza.
De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. En consecuencia, se trata de que el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos y del derecho subjetivo de las personas a que así se proceda, en forma diligente.
Así, la posibilidad de exigir judicialmente, a través de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas, de forma tal que si, por ejemplo, una determinada comunidad estimara necesario contar con un hospital para la atención de sus pobladores (o de cualquier otra obra pública) no es por la vía del amparo que se debe exigir, sino a través de los mecanismos previamente establecidos y ante los órganos y entes competentes, quienes deberán atender la petición y resolver su procedencia técnica, que no implica necesariamente una respuesta positiva. De lo anterior, se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver en este sentido la sentencia número 2003-11519 de las diez horas con treinta minutos del diez de octubre de dos mil tres)”.
De los hechos probados se desprende que la autoridad sanitaria conoció la denuncia desde el 24 de enero de 2024, inspeccionó el 31 de enero de 2024, identificó infraestructura pluvial deficiente y presencia de aguas estancadas con riesgo de proliferación de vectores; gestionó coordinación con CONAVI (6 de febrero de 2024) y obtuvo un informe técnico del ingeniero civil (7 de mayo de 2024) que recomendó girar orden sanitaria inmediata para reparar la tubería dañada. Sin embargo, pese a la persistencia de insalubridad, malos olores, riesgo de dengue, afectaciones respiratorias y dérmicas y a los riesgos de tránsito relatados por la parte amparada, solo hasta el 20 de diciembre de 2024 se dictó la orden sanitaria contra CONAVI. Entre enero y diciembre de 2024 las actuaciones fueron paliativas e insuficientes (aplicación de larvicidas, remisiones y oficios), sin que se acreditara la apertura y prosecución diligente de procedimientos para identificar y suprimir descargas ilícitas desde viviendas, imponer medidas correctivas y sanciones ni exigir, con carácter urgente, la ejecución de obras definitivas.
Conforme al artículo 50 de la Constitución Política, el Estado, a través de sus órganos especializados, debe garantizar un ambiente sano y ecológicamente equilibrado y adoptar medidas de prevención y control ante riesgos a la salud pública. La Ley General de Salud atribuye al Ministerio de Salud potestades de rectoría, vigilancia, inspección, ordenación y sanción frente a vertidos y condiciones insalubres (régimen de aguas residuales y servidas, control de vectores, emisión de órdenes sanitarias y apertura de procedimientos sancionatorios). La jurisprudencia de esta Sala ha precisado que el control y fiscalización ambientales son función esencial del Estado, y que la tutela de la vida y la integridad exige conductas positivas, oportunas y eficaces cuando se verifican riesgos ciertos (ver sentencias n.° 2008-18443 y 2003-11519).
No obstante, este Tribunal observa que las actuaciones de la autoridad sanitaria fueron en gran medida paliativas y dilatadas, lo cual permitió la continuidad de la afectación a la salud de los vecinos y a su ambiente, pese a que los artículos 21 y 50 constitucionales imponen la obligación de actuar con diligencia y eficacia en la protección de la salud pública y el ambiente. Así las cosas, se constata una omisión administrativa relevante, pues aun cuando existieron gestiones, estas no resultaron suficientes para contener el riesgo inminente. Por tanto, en relación con esta autoridad, el recurso resulta con lugar.
En lo que respecta al CONAVI, se acreditó que reconoció desde marzo de 2024 el deterioro del alcantarillado, comprometiéndose a realizar reparaciones en abril de ese año. Sin embargo, llegada esa fecha y hasta octubre de 2024, no se ejecutó la obra, persistiendo la problemática denunciada. Posteriormente, mediante el informe técnico de enero de 2025, la propia institución pretendió deslindar responsabilidad alegando que la saturación de la alcantarilla se debía a descargas de aguas servidas, competencia del Ministerio de Salud. Tal alegato no justifica la inacción constatada, pues conforme a la Ley N.° 7798, es competencia del CONAVI la conservación de las vías nacionales y la infraestructura vial asociada. Esta Sala ha sostenido que la obligación objetiva del Estado de tutelar la vida y la seguridad vial impone a sus órganos actuar diligentemente frente a peligros manifiestos (ver sentencias No. 2008-18443 y 2003-11519). En este caso, la inactividad del CONAVI configuró una omisión inconstitucional, que expuso a la comunidad a riesgos de accidentes, insalubridad y afectación ambiental. En consecuencia, respecto de esta autoridad, el recurso resulta con lugar.
De lo informado por el Presidente Ejecutivo y la inspección realizada por su funcionaria, se constató que el AyA no presta el servicio en la zona, pues esta se encuentra bajo administración de la ASADA de Puente Piedra. Se corroboró también la inexistencia de alcantarillado sanitario en el lugar, lo cual imposibilita atribuirle responsabilidad directa a esa institución. No obstante, la diligencia desplegada por el AyA al practicar inspección y evidenciar descargas ilícitas provenientes de viviendas constituye un refuerzo probatorio para demostrar la omisión de las demás autoridades. En consecuencia, en relación con el AyA, el recurso se declara sin lugar.
De lo expuesto, este Tribunal concluye que la omisión de las autoridades recurridas ha generado una vulneración a los derechos fundamentales de la parte amparada y de la comunidad, particularmente el derecho a la vida, a la salud y a un ambiente sano, consagrados en los artículos 21 y 50 de la Constitución Política. El Ministerio de Salud y el CONAVI no actuaron con la diligencia exigida por la Constitución y la jurisprudencia de esta Sala, prolongando una situación de riesgo y afectación que debió ser resuelta con inmediatez. En cuanto al AyA, se desestima la gestión por falta de competencia directa en el área.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es la de dar solución efectiva a los rebalses de aguas sobre la en la Dirección4339, a la altura de El Poró, frente al establecimiento Interago, 200 metros sur del Supermercado Palí. Nótese que, en el sub lite se ordena a las Autoridades recurridas actuar en relación con las cunetas sin terminar y las secciones discontinuas y sin tragantes que provocan el estancamiento y desbordamiento de agua hacia la vía pública, así como intervenir en relación con las descargas de tuberías provenientes de viviendas unifamiliares hacia la cuneta o los desagües.
Dado lo anterior, a mi juicio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara PARCIALMENTE CON LUGAR el recurso, únicamente, en contra de las autoridades del Área Rectora de Salud de Grecia del Ministerio de Salud y del Consejo Nacional de Vialidad. Consecuentemente, se ordena a Nombre46457, en condición de Directora del Área Rectora de Salud de Grecia del Ministerio de Salud y a Nombre5221, en condición de Director Ejecutivo a.i. del Consejo Nacional de Vialidad o a quienes ocupen esos cargos que, en el plazo de SEIS MESES, contado a partir de la notificación de esta resolución, cada autoridad en el ejercicio de sus competencias, coordinen y tomen las medidas necesarias para dar solución efectiva a los rebalses de aguas sobre la en la Dirección4339, a la altura de El Poró, frente al establecimiento Interago, 200 metros sur del Supermercado Palí. Lo anterior, implica también que deberán actuar en relación con las cunetas sin terminar, las secciones discontinuas y sin tragantes, que provocan el estancamiento y desbordamiento de agua hacia la vía pública, así como, intervenir en relación con las descargas de tuberías provenientes de viviendas unifamiliares hacia la cuneta o los desagües.
Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En relación con el Instituto Costarricense de Acueductos y Alcantarillados se desestima el recurso. El Magistrado Nombre301 pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
