Randall Vega Blanco, in his capacity as Mayor of the Municipality of Naranjo, or whoever holds that office, is ordered to issue the appropriate directives and arrange whatever is necessary within the scope of municipal authority so that, within a maximum period of FIFTEEN DAYS from notice of this decision, the corresponding measures are carried out to provide drinking-water service to La Esperanza Vertical Residential Condominium. The respondent authority is warned that, pursuant to Article 71 of the Constitutional Jurisdiction Law, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be punished by imprisonment from three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipality of Naranjo is ordered to pay the costs and the damages caused by the facts underlying this declaration, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. BACKGROUND:
It concludes that, in the case of the Proyecto de Condominio Vertical Residencial La Esperanza, several fundamental rights would be violated unless the Municipalidad de Naranjo provides an efficient, effective, and prompt solution regarding the drinking-water interconnection before the housing units are formally delivered. It states that the right to decent and adequate housing prevails, given the vulnerable circumstances and imminent risk faced by the project’s beneficiary families. It warns of a possible risk that the Ministry may be sued in administrative litigation and/or constitutional proceedings, which could result in an adverse judgment for administrative inaction and/or lack of coordination among the public institutions responsible for providing an adequate and timely solution. It indicates that the refusal of the respondent municipality to authorize the drinking-water interconnection creates an unnecessary expense for the State.
It specifies that this expense arises from the need to continue financing the maintenance and security of a housing project that has already been completed but cannot be delivered or occupied for the reasons stated above. In its prayer for relief (petitoria), the petitioner expressly stated: “Pursuant to Articles 11, 48, 50, 51, 65, 169 and 173 of the Political Constitution (Constitución Política), I request that the amparo proceeding (recurso de amparo) filed herein be granted in all respects and that the Municipalidad de Naranjo be ordered to undertake immediately the drinking-water interconnection process required by the 120 beneficiary families of the Proyecto de Condominio Vertical, Residencial La Esperanza, in the canton of Naranjo, so that the housing units that have already been completed may be delivered.” Furthermore, in the filing initiating the proceeding, the petitioner did not request the issuance of any extremely urgent interim measure (medida cautelar urgentísima) to consider or order, once the admissibility ruling had been issued, the provisional connection of water service at the Proyecto Condominio La Esperanza.
The requested interim relief (medida cautelar) entails, it bears repeating, that, provisionally and until the final judgment (sentencia en firme), the Municipalidad de Naranjo be expressly authorized to refrain from taking any action aimed at authorizing, carrying out, or implementing the interconnection of the Project: Condominio Residencial Vertical La Esperanza, to the Municipalidad de Naranjo water-supply system (sistema de acueducto), located in Naranjo, San Miguel, Dirección05 , for its drinking-water supply through the Acueducto Municipal.” The foregoing is based on the fact that, as a result of the technical analysis conducted on the study “Interconnection Design for Condominio Vertical La Esperanza-Dirección02 Acueducto Municipal de Naranjo,” submitted by Consultoría Mar Azul S.A., in relation to the technical and specialized study entitled: “DESIGN OF THE DRINKING-WATER DISTRIBUTION AND CONVEYANCE NETWORK IN THE Dirección03 SECTORS OF NARANJO CENTRO,” commissioned by the Municipalidad de Naranjo under procurement procedure 2024LD-000004-0023200001, it was concluded that: Under typical population-growth conditions, the Acueducto Municipal has sufficient water resources to supply its current user population (specifically, that of the Naranjo Centro-Casco Central subsystem and the San Francisco, Dirección02, La Radial, and El Águila sectors) for a 25-year design horizon, which is consistent with the Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial, section 4.2.5, “Conveyance Pipeline,” of the Instituto Costarricense de Acueductos y Alcantarillado, which establishes a mandatory 25-year period for treated-water conveyance pipelines.
Technically, the foregoing means that drinking-water service must be capable of accommodating projected population growth over 25 years without a water deficit (déficit hídrico). However, both technical studies also transparently reveal that, when the mathematical exercise is performed to assess the interconnection of the Condominio Residencial Vertical La Esperanza project for the provision of drinking-water service through the Acueducto Municipal, the hydraulic calculation report (memoria de cálculo hidráulico) shows that a water deficit would arise beginning in 2034, that is, 09 years after the potential connection in the current year, 2025, thereby shortening the design period by approximately 64%, as demonstrated in section “4.5 Water Balance. Table 4-6 Water Balance for Acueducto Naranjo.” On page 32, the technical and specialized study concluded: “Having analyzed the water-supply system design data and the variables for improvements to the water-supply system, the current supply sources for the water-supply system can accommodate the normal growth of the Naranjo system UNTIL THE YEAR 2035, at which point a source with a flow rate of 7 l/s must be found for the entire design period; it currently has the capacity to supply Dirección02, San Francisco, and the area influenced by the Calle Muñoz project.” As of the date of this report, the Municipalidad de Naranjo is awaiting the corresponding decision from the Tribunal Contencioso Administrativo y Civil de Hacienda so that it may proceed as required by law and in accordance with whatever that Tribunal may order.
The response to each of the allegations makes it completely and absolutely clear that, in this specific case, we are not dealing with a matter of constitutional law, BUT RATHER WITH A MATTER PROPERLY BELONGING IN ORDINARY PROCEEDINGS (vía ordinaria), in which, at this very moment, under court case file n°25- 004998-1027-CA, the absolute nullity (nulidad absoluta) of official letter MNDAM- 0175-2022—the administrative act (acto administrativo) through which water availability (disponibilidad de agua) was granted to the property where the Condominio Residencial Vertical La Esperanza project is located—is being litigated, along with the request for interim relief so that, provisionally and until a final judgment is issued, the project will not be interconnected with the municipal water-supply system, for the technical reasons supporting the interim relief and to safeguard the cantonal public interest by fulfilling the obligation to ensure that drinking-water service is not diminished in quality or quantity for existing subscribers, as provided in Article 4, second paragraph, of the “Reglamento para la Operación y Administración del Acueducto de la Municipalidad de Naranjo.” Likewise, from the appellant’s submission and this report, the Justices of the Sala Constitucional will be able to determine that the facts supporting the amparo appeal (recurso de amparo) against the entity I represent are identical to those that supported the amparo appeal processed under case file n°25-023744-0007-CO, which, according to decision No. 2025026068.
Justice Cruz Castro writes the opinion; and,
Considering:
In judgment number 2025026068 issued at 9:20 hours on 14 de agosto de 2025, this Chamber ruled on a prior amparo proceeding (recurso de amparo) concerning facts similar to those raised in the present proceeding, and on that occasion it held:
“I.- In this specific case, the petitioners challenge the Municipalidad de Naranjo’s refusal to allow the developer of the La Esperanza condominium to interconnect that project with the municipal waterworks system. A review of the record shows that the La Esperanza residential vertical condominium is intended to be built in the canton of Naranjo as a housing project for low-income persons. As a result, the company responsible for the project applied to the Municipalidad de Naranjo for the corresponding permits, including a request for drinking water service. That request was addressed through official letter MN-ALC-3924-2023 dated 14 de febrero del 2023, which granted water availability for 125 residential water service connections (pajas de agua domiciliaria). Subsequently, on 30 de mayo de 2025, the development company requested that the process of interconnecting the condominium with the municipal waterworks system be initiated; however, that request was denied by the respondent municipal corporation on the grounds that, following a new study, it had been determined that interconnecting the condominium would result in a water deficit beginning in the year 2034, affecting nearly twelve thousand users of the waterworks system.
Consequently, it was decided to initiate proceedings for a declaration of injury to the public interest (proceso de lesividad) before the Administrative and Civil Court of the Treasury, suspending the interconnection process until those proceedings were resolved. Now, in view of the foregoing, the claim raised is deemed to concern a matter outside the jurisdiction of this Court, because it is not for the Chamber to determine the propriety of the decision adopted by the respondent authority as to whether conditions exist to permit the interconnection of the La Esperanza condominium with the municipal waterworks system. Doing so would require a series of technical measures that fall outside the purview of this Court and, in any event, exceed the summary nature of amparo proceedings. Under these circumstances, the petitioners must bring the relevant claims through ordinary proceedings so that the legally appropriate ruling may be issued there.” Notwithstanding the foregoing, upon further consideration, this Court finds that, given the facts alleged, the present proceeding is admissible and that the reported situation warrants renewed review. This is in accordance with Article 13 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional).
The petitioner, in her capacity as Minister of Housing and Human Settlements, states that the La Esperanza Condominium Project was developed through the National Financial System for Housing (Sistema Financiero Nacional para la Vivienda), with the objective of assisting 120 families in extreme need. She states that the project seeks to eliminate the La Radial informal settlement, located at the entrance to Naranjo on Dirección01, and represents an investment of ¢4.741,9 million. She explains that these funds were used to purchase the undeveloped land, develop the infrastructure works, and construct the housing units. She specifies that the design includes 120 apartments distributed among 10 three-story towers, each containing 12 housing units, as well as children’s play areas, perimeter fencing, sidewalks, paved streets, a treatment plant, and public utilities. She says that this housing solution is intended for 95 female heads of household, 16 large families, 4 persons with disabilities, and 3 older adults. She states that Coopenae R.L. is the authorized entity responsible for supervising the project and that the developer is Consultoría Mar Azul S.A. She explains that the project has the corresponding geological, environmental, and construction permits and complies with national technical regulations.
She explains that, through official letter MN-ALC-3924-2023 dated 14 de febrero de 2023, the then mayor of Naranjo, Juan Luis Chaves Vargas, informed the developer that water was available for the project, authorizing 125 ½” (12.55mm) residential water service connections for the property located at Dirección02, Naranjo. She states that, through official letter MN-ALC-4150-2023 dated 4 de mayo de 2023, the same mayor reported that the municipal waterworks system in front of the property had a pressure of 100 psi, sufficient for the project’s development. She explains that, through official letter MN-ALC-4405-2023 dated 6 de julio de 2023, the mayor informed the canton’s residents and the general public that water availability had been granted within the bounds of the law and in accordance with municipal authority. She states that the Concejo de Naranjo, through certification of resolution SO-28-0657-2023 dated 10 de julio de 2023, declared the resolution of the housing problem at the La Radial settlement to be of municipal interest because the settlement posed an ongoing risk to its residents and had been declared uninhabitable by the Ministerio de Salud.
She states that the project obtained construction permit N°1181-2023 on 29 de noviembre de 2023, issued by the Municipalidad de Naranjo. She reports that, through resolution N°7 of the BANHVI Board of Directors dated 31 de octubre de 2023, financing was approved for the purchase of the land, infrastructure works, and construction of the 120 housing solutions, for a total amount of ¢4.Telf01, with Coopenae R.L. acting as the authorized entity and Consultoría Mar Azul S.A. as the developer. She says that, on 30 de mayo de 2025, the developer submitted a request to the Municipalidad de Naranjo for interconnection with the drinking water system.
She states that, through official letter MN-ALCDAM- OF-168-2025 dated 3 de julio de 2025, the Coordinator of the Waterworks Department, Gerardo Chacón Agüero, informed the project’s supervising engineer that Consultoría Mar Azul S.A. was not authorized to submit the interconnection request. She states that, nevertheless, the technical study entitled “La Esperanza Vertical Condominium-Calle Muñoz Municipal Waterworks System of Naranjo Interconnection Design” is under review because the projected water balance would show a deficit by the year 2034. She maintains that, on 18 de julio de 2025, the developer resubmitted the interconnection request, this time attaching the relevant authorizations from Banco Improsa S.A., as the registered owner of the land and trustee. She continues by stating: 11.- Finally, through official letter MN-ALC-DAM-OF-188-2025 dated 29 de julio del 2025, Mr. Gerardo Chacón Agüero, Coordinator of the Waterworks Department of the Municipalidad de Naranjo, informed the legal representative of Consultoría Mar Azul S.A. that, as a result of the technical analysis conducted on the study “La Esperanza-Dirección02 Vertical Condominium Municipal Waterworks System of Naranjo Interconnection Design,” submitted by Consultoría Mar Azul S.A., in relation to the technical and specialized study entitled “DESIGN OF THE DRINKING WATER DISTRIBUTION AND CONVEYANCE NETWORK IN THE Dirección03 SECTORS OF CENTRAL NARANJO,” commissioned by the Municipalidad de Naranjo under contracting procedure 2024LD-000004-0023200001, it was concluded that: Under typical population growth conditions, the Municipal Waterworks System has sufficient water resources to supply its current user population—specifically that of the Naranjo Centro-Casco Central subsystem and the San Francisco, Dirección02, La Radial, and El Águila sectors—over a 25-year design projection, which is consistent with the Technical Standard for the Design and Construction of Drinking Water Supply, Sanitation, and Stormwater Systems, section 4.2.5, “Conveyance Pipeline,” of the Instituto Costarricense de Acueductos y Alcantarillado, which establishes a mandatory 25-year period for treated-water conveyance pipelines.
Technically, the foregoing means that drinking water service must be capable of accommodating projected population growth over 25 years without a water deficit. He states that both technical studies show that, when the mathematical analysis is performed to assess the interconnection of the La Esperanza Residential Vertical Condominium Project for the provision of drinking water service through the Municipal Waterworks System, the hydraulic calculations demonstrate that a water deficit would arise beginning in the year 2034, that is, 09 years after the potential connection in the current year 2025, thereby shortening the design period by approximately 64%, as demonstrated in section “4.5 Water Balance. Table 4-6 Naranjo Waterworks System Water Balance.” This would affect approximately 11864 thousand users residing in Alto El Sitio, San Francisco, Dirección02, Candelaria, and Casco Central—current subscribers to the municipal waterworks system—who are supplied by the municipal waterworks system of Naranjo Centro, which would also have to provide drinking water to the condominium project.
He adds that the matter is the subject of proceedings for a declaration of injury to the public interest before the Administrative and Civil Court of the Treasury. They further state that, until progress is made in those proceedings, the drinking-water interconnection process required by the 120 beneficiary families of the La Esperanza housing project remains suspended.” She clarifies that the authorized entity has exclusive responsibility for processing and qualifying the housing subsidy (bono) before the Banco Hipotecario de la Vivienda, as well as for selecting the project developer. She states that, although the Ministerio de Vivienda y Asentamientos Humanos (MIVAH) identifies communities whose social profiles meet the parameters for poverty, extreme poverty, and social vulnerability, and issues formal approval or recommendations for projects that align with the State’s housing priorities, responsibility for the entire process of processing, approving, implementing, and monitoring the contracting of the work and its construction phase always lies with BANHVI and the authorized entity selected for that purpose.
She specifies that MIVAH has no authority or involvement in those phases, as established in the Law on the National Financial System for Housing (Ley del Sistema Financiero Nacional para la Vivienda).
She alleges inaction by the Municipalidad de Naranjo, because the refusal to carry out the drinking-water interconnection has contributed to the violation of the fundamental rights of the protected persons, since the drinking-water interconnection is necessary before the housing solutions can be formally delivered. She believes that the right to decent and adequate housing must prevail, considering the vulnerability and imminent risk faced by the project’s beneficiary families.
The following facts relevant to deciding the present amparo proceeding are deemed established:
The study must be duly approved by the Municipalidad de Naranjo. The infrastructure works specified in the required study must be performed. Regarding fire hydrants, the fire-hydrant engineering division of Bomberos de Costa Rica, the entity responsible for regulating and overseeing this matter, must be consulted so that the hydrants may be included in the design. The current A y A regulations governing the design of distribution lines must be observed, as specified in the required feasibility study” (report of the respondent authority).
Official letter MN-DAM-0175-2022 dated 21 de junio de 2022, through which the Municipalidad de Naranjo addressed the water-availability application submitted by the entity Nombre25, was issued within the legal framework and on the basis of the Municipality’s subject-matter and territorial jurisdiction. 4. Official letter MN-DAM-0175-2022 does not entail the granting of any water service connection to the legal entity Nombre25.; it is limited to determining the existence of water availability in the locality where the housing project is proposed. Therefore. With respect to official letter MN-DAM-0175-2022 and the construction process that the legal entity Nombre25. is pursuing before the Municipalidad de Naranjo, both the Municipality and the undersigned have acted in accordance with the legal system; therefore, there is no conflict of interest or improper favoritism toward that legal entity.
Any unfounded comment or accusation intended to create confusion among public opinion in Naranjo and the country generally, with a view to negatively portraying the municipal administration regarding the matters discussed in this official letter, is categorically rejected because, as demonstrated, the local government’s actions have always been, and will remain until the end of its term on 30 de abril de 2024, directed toward ensuring the administration of the interests and services of the canton of Naranjo in accordance with the law” (report of the respondent authority).
Technically, the foregoing means that potable-water service must be capable of accommodating projected population growth for 25 years without a water deficit. However, both technical studies also transparently reveal that, when the mathematical calculation is performed to assess the interconnection of the La Esperanza vertical residential condominium project for purposes of providing it with potable-water service through the Municipal Aqueduct, the hydraulic calculation report (memoria de cálculo hidráulico) shows that a water deficit would arise beginning in 2034, that is, 09 years after the potential connection in the current year, 2025, thereby shortening the design period by approximately 64%, as shown in section ‘4.5 Water Balance. Table 4-6 Naranjo Aqueduct Water Balance.’ This would affect approximately 11864 thousand users residing in Alto El Sitio, San Francisco, Dirección02, Candelaria, and Casco Central (current subscribers to the municipal aqueduct system), who are supplied by the Naranjo Centro municipal aqueduct system, which would also be the system required to supply potable water to the condominium project.
SIXTH. In view of this objective situation, supported by the 2 technical and specialized studies referenced above, the Municipal Mayor’s Office, in the pleading commencing the proceeding for a declaration of injuriousness to the public interest (proceso de lesividad) before the Tribunal Contencioso Administrativo y Civil de Hacienda, concerning the declaration that Administrative Act-Official Letter MN-DAM-0175-2022, dated June 21, 2022, signed by former Mayor Juan Luis Chaves Vargas, was injurious to the public interest, through which the Municipalidad de Naranjo, as you are aware, granted the company you represent potable-water availability for the project involving 125 water service connections on the real property under registration number , filed an application for an interim measure (medida cautelar). SEVENTH. As of the date of this official letter, the Municipalidad de Naranjo is awaiting a ruling on the application, which, in principle and in due course, must be served by the Tribunal upon the participating parties to the proceedings; accordingly, at the direction of the Municipal Mayor’s Office, you are hereby informed that the interconnection application contained in municipal form n°236944 remains subject to the corresponding judicial ruling, with which the Municipalidad de Naranjo will comply as required by law.
Name26. Accordingly, and for all applicable purposes, notice is hereby given that the judicial case number assigned by the Tribunal to the matter at issue is: 25-004998-1027-CA” (report of the respondent authority).
The Chamber’s case law has repeatedly recognized the so-called fundamental right to water, under which all persons must be afforded the opportunity to access potable-water services on equal terms, since water is essential to human life and health. Nevertheless, its status as a fundamental right does not entail unrestricted access to water services, because the administration may validly establish general requirements that every applicant must satisfy in order for the applicant’s particular request to be assessed. Thus, in judgment number 2006-1898, issued at nine fifty-three in the morning on February 17, 2006—reiterated, among others, in judgments numbers 2007-13310, issued at ten fifty-seven in the morning on September 14, 2007, and 2008- 16311, issued at five thirty in the afternoon on October 30, 2008—the Chamber held:
“The petitioner alleges (…) that, despite the applications submitted and efforts made, the respondent Institute has refused to provide them with potable-water service on the grounds that the settlement is informal and that its inhabitants do not possess a subdivision plan (plano de segregación) establishing that they own the properties. In that regard, the record establishes, based on the sworn report submitted by the respondent authority, that potable-water service cannot be installed in the homes of the community in which the petitioner resides for two specific reasons: the lack of adequate infrastructure and the failure of the interested parties to submit applications satisfying the legal requirements (...). In judgment No. 2004- 12185, issued at 13:31 hours on October 29, 2004, in a case similar to the present one, this Chamber held that the Instituto Costarricense de Acueductos y Alcantarillados could not be compelled to disregard the provisions of its Reglamento de Prestación de Servicios a los Clientes or the Ley General de Agua Potable.
Therefore, unless and until the protected party satisfies the conditions and requirements established therein, although potable-water service must be accessible to every person because it is an essential service, it cannot be provided to him on a regular basis. Given the existence of these two objective reasons why regular potable-water service cannot be supplied to the claimant—his failure to satisfy the requirements for connection of a new service, beginning with submission of the application, and the absence of adequate infrastructure in the area—there is no basis for concluding that the respondent Institute’s refusal to provide regular service is attributable to the fact that the protected party and his neighbors do not hold title to the properties they possess. It should also be added that, under article 33 of the aforementioned Reglamento, the absence of title to the property does not appear to constitute an obstacle to applying for connection of a new potable-water service, provided that the requirements set forth in that provision are satisfied.
In any event, it has also been established that, although regular potable-water service has not been provided, the petitioner and the other residents have access to a public water source installed by the Institute so that they may obtain water for their basic needs. Accordingly, this Tribunal finds that it was the omission of the petitioner and the residents of the locality themselves—who have not demonstrated that they submitted applications for the installation of a new potable-water service in the community where they reside—that prevented their situation from being assessed in order to determine whether, upon satisfying, above all, the requirements of article 33 of the Reglamento de Prestación de Servicios a los Clientes, the infrastructure limitations could be overcome in their case and regular potable-water service could be provided to them.” It is therefore understood that, although there is a fundamental right to water that may be asserted against the corresponding administration, provision of the service may properly be made subject to compliance with the requirements established for granting it and to the existence of a material capacity to supply it; that is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide potable-water service.
Consequently, the administration is under no obligation to provide potable-water service when technical reasons make doing so inadvisable or impossible, but it must adequately inform the applicant of the reasons why the application cannot be granted” (see judgment N° 2018-8650 of 09:15 hrs. on June 1, 2018, 2018-7369 of 9:45 hours on May 11, 2018, and N° 2016-18026 of 9:05 hours on December 7, 2016).
In resolution No. 2018-002910, issued at 09:15 hours on February 23, two 2018, this Chamber ruled as transcribed below:
“IV.- Regarding this principle, it was previously assumed as axiomatic that, without exception, any unlawful favorable act (acto ilegal de contenido favorable) could be nullified by the Administration in any type of situation, without regard to any particular circumstance. Nevertheless, beginning in the mid-fifties, both legal scholarship and case law began to recognize that a blind and rigid application of the aforementioned rule seriously undermined the trust placed in the Administration by those subject to it, as well as good faith (buena fe) and legal certainty (seguridad jurídica). Thus, in a judgment dated 14 de mayo de 1956, the Berlin Administrative Court developed the principle of legitimate expectations (principio de confianza legítima), which was later adopted by the Court of Justice of the European Community in its rulings of 22 de marzo de 1961 and 13 de julio de 1965 (Lemmerz-Werk), and which essentially safeguards citizens’ trust insofar as, under certain circumstances of a particular case, considerations of equity and good faith prevent the Administration from taking measures contrary to the expectations induced by the reasonable stability of its decisions, in reliance on which private parties have taken certain measures.
On our continent, merely by way of example, the Constitutional Court of Colombia, in Judgment T- 308/11 of 28 de abril de 2011, stated: “The principle of legitimate expectations seeks to foster an atmosphere of reassurance in the relationships that members of society establish with public authorities or private parties, such that they may expect, in good faith, that their actions will not be altered abruptly unless a constitutionally legitimate purpose takes precedence. Legal scholarship has maintained that legitimate expectations entail that certain expectations generated by one legal person vis-à-vis another by reason of specific conduct produce consistent results within an environment of trust that may be disrupted only to give way to the public interest. Within the framework of relations between the Administration and those subject to it, legal scholarship has defined legitimate expectations as an ethical value that forms part of good faith and encompasses ‘the need for loyal and honest conduct, the type of conduct that, according to ordinary judgment, may be expected of a person.’ (…) ‘The application of the principle of good faith will allow persons subject to the Administration to regain confidence that the Administration will not require more of them than is strictly necessary to achieve the public purposes pursued in each particular case.
And that compliance will not be required of them in the most inappropriate place, at the most inappropriate time, or in the most inappropriate manner, having regard to their personal and social circumstances and to public needs themselves.’ Accordingly, legitimate expectations must be understood as the firm expectation that a legal or material situation, addressed in a particular manner in the past, will not be treated in an extremely unequal manner during another period, unless there is a constitutionally acceptable reason legitimizing that change. In this regard, this Court has held that ‘the person subject to the Administration is not the holder of a vested right (derecho adquirido), but merely has an expectation that a particular factual situation or legal regulation will not be modified unexpectedly; consequently, that person’s legal situation may be modified by the Administration. As an element incorporated into good faith, legitimate expectations may be reflected in the expectation that specific regulatory conditions governing a situation will continue, or that requirements more burdensome than those already imposed to achieve a purpose will not be applied, unless constitutionally valid reasons exist for doing so.’ Indeed, the ratio iuris of the principle protecting legitimate expectations lies in the fact that the development of legal relations requires an environment of trust in which the rules of the game, once established, are respected.
The foregoing is even more relevant in relations with the Administration because, in that context, the relational legal instrument is the administrative act (acto administrativo), which is simply a unilateral expression of the State’s will. Ergo, citizens need legal instruments to defend themselves against the unilateral power and superiority of the Administration (see Judgment N° 2016-008000 at 11:52 hours on 10 de junio de 2016).”
In resolving the present case, it is very important to consider the ruling issued by this Constitutional Chamber (Sala Constitucional) in judgment nro. 2024010181 at 9:20 hours on 19 de abril de 2024, which established:
“III.- ON THE MERITS. After analyzing the evidence submitted and the report rendered under oath by the respondent authority, following due warning of the consequences set forth in article 44 of the Ley de la Jurisdicción Constitucional, this Court finds it established that the appellant owns a property located in San Ramón de Alajuela, specifically in Piedades Norte, recorded under real-property folio No. 571180-000. It may be inferred that on 26 de marzo de 2022 the claimant submitted to the respondent authority an application for potable water service for an unimproved property designated for agricultural use, access to which is provided by an agricultural easement (servidumbre) extending to Dirección09; application No. SIGDD-2022-00006761. Nevertheless, the basic assessment of application No. SIGDD-2022-00006761-1-AP determined that it would not be appropriate for the institute to approve the application for potable-water and sanitary-sewer availability for the prospective project because the technical feasibility required for approving availability applications located within the CO-A-35-San Ramón system was lacking.
The technical-feasibility determination was based on the Potable-Water Feasibility Inspection SIGDD-2022-00006761-1-1-1 submitted by the Technical Head of Operation and Maint. of the Cantonal Water Sys. of San Ramón in the Central Western Region, which states: ‘No distribution or collection infrastructure exists in front of the property, according to technical criteria.’ The foregoing was communicated to the appellant through the Certification of NON-AVAILABILITY decision dated 04 de agosto del 2022. In view of the circumstances described, it is confirmed that the protected party filed a motion for reconsideration (recurso de revocatoria) and/or a subsidiary appeal (apelación en subsidio) against the decision of the ICAA; however, by decision issued at 7: 00 hours on 12 doce de agosto del 2022, the motion for reconsideration was denied. Likewise, by decision GG-R-2022-0727 issued at 10:00 hours on 21 de septiembre del 2022, the appeal was denied.
It was established that on 21 de setiembre de 2022 the claimant submitted new potable-water application No. SIGDD- 2022-00020625 to the respondent authority. In that regard, it was shown that the ICAA issued official communication No. SIGDD2022-0000625-1-1-1 dated 16 de noviembre de 2023, stating as follows: ‘POTABLE WATER IS AVAILABLE ON THE PUBLIC ROAD; NO SEWERAGE SYSTEM IS AVAILABLE.’ The foregoing was communicated to the interested party in the official communication dated 16 de noviembre de 2023, under the following terms: ‘In response to the availability application, I hereby enclose Positive Potable-Water Availability and Negative Sanitary-Sewer Availability Certification N°2022-00020625-1, which states in summary as follows: The sanitary-sewer network is not operational in the area.’ It is confirmed that on 07 de febrero de 2024 the applicant filed new potable-water service application No. P21112024020005; however, upon receiving the matter for processing, the cantonal office identified an error and proceeded to conduct an investigation, taking into account the prior evidence and reassessing whether the circumstances of the application had actually changed, as well as the conditions that had led to the denial of Availability Application SIGDD-2022-00006761-1-1-1.
Finally, it was confirmed that, in official communication No. SG-GSP-RC-2024-00132 dated 05 de marzo de 2024, the respondent authority notified the interested party that it could not process new-service application No. P21112024020005. In essence, it stated: ‘On 07 de febrero del 2024, application 21112024020005 was issued in the name of Nombre27 of [Nombre27 001], identity card [Valor CED62], for the Housing Construction project, concerning the application for connection of a new potable-water service that would be located on the property recorded under real-property folio number, the designated use of which is PASTURELAND, with access through an agricultural easement located in Distrito Piedades Norte, Cantón de San Ramón, Provincia de Alajuela, according to Cadastral Plan No. A-2032273-2018, with the address 115 metros al NW y 260 metros W de las Cabinas del Bosque Lodge (…) according to a search of the Registro Nacional de la propiedad, the distance from the public road to the land via the agricultural easement is approximately 190 metros (…) To provide services within the easement, it must be registered in favor of AYA, and the criteria stated above must also be met.
In conclusion, under these circumstances the Institution is unable to grant the request. The documents contained in the administrative record (expediente administrativo) are conclusive; accordingly, the Institution would act improperly by granting a new service contrary to the Principle of Legality (Principio de Legalidad) and to the scientific and technical principles identified in articles 11 and 16 of the Ley General de la Administración Pública. Therefore, AyA must comply with the regulations governing it; otherwise, it would be violating the legal system (…) Finally, as demonstrated, new-service application No. P21112024020005 cannot be processed.’ This Chamber, in judgment No. 2012-016181 at 9:05 hours on 27 de noviembre de 2012, reiterated in judgment No. 2015002749 at 09:05 hours on 27 de febrero de 2015, when hearing a matter similar to that in this case file, ruled in the following terms:
“V.- SPECIFIC CASE. It has been established that the protected party had been issued an initial service-availability letter (carta de disponibilidad), dated 24 de octubre de 2011, for the purpose of obtaining approval (visado) of registered cadastral plan No. SJ-919550-0; that document was valid for no more than six months and expired in abril de 2012. On the basis of that document, among other permits and authorizations, the petitioner built her home and requested that the respondent Association issue her a service-availability letter so that potable-water service could be provided to the property. This request was denied because, according to the latest flow measurement (aforo) conducted by personnel of the Instituto de Acueductos y Alcantarillados, the captured springs (nacientes) were insufficient to supply the current population—a finding recorded in memorandum No. SUB-G-GSC-UEN-AP-EBD-2012-686 de 25 de mayo de 2012—and the protected party was informed of this situation.
Based on these facts, this Court finds that the principle of legitimate expectations (principio de confianza legítima) was violated in this matter to the detriment of the protected party. Indeed, although the initial service-availability letter was issued to her in 2011, the protected party legitimately relied on the respondent Association—which, as stated above, is exercising public powers—and built her home, incurring the significant expenditure of resources that this entails, with the expectation that potable-water service would be supplied to her. Certainly, pursuant to article 21, subsection 19), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No.32529, the ASADAS may grant a water-availability endorsement (sello disponibilidad hídrica)—valid for 6 months for single-family homes and for one year for other developments, subject to extension—‘provided that it is technically feasible, does not impair the quality of the service being provided, and infrastructure exists’ (emphasis added).
Nevertheless, in accordance with the principles of legitimate expectations and good faith (buena fe), the respondent Association must be advised that, before issuing a potable-water service-availability letter, it must perform the measurements necessary to verify whether water is available, thereby preventing members of the public from making substantial and futile investments if, after their homes or buildings have been constructed, potable water cannot be supplied to them.
As a corollary to the foregoing, the application must be granted, with the consequences detailed in the operative part (parte dispositiva) of this judgment.” In the case at bar (sub lite), the established facts show that, by official letter No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, the ICAA issued a positive potable-water availability certificate (constancia de disponibilidad de agua potable positivo) for the property registered under real-property folio (folio real) No. 571180-000, located in San Ramón de Alajuela, specifically in Piedades Norte, in the name of Nombre27, the petitioner, subject to the following conditions: “POTABLE WATER IS AVAILABLE ON THE PUBLIC ROAD; NO SEWERAGE SYSTEM IS AVAILABLE.” The protected party was notified of this by official letter del 16 de noviembre de 2023 in the following terms: “In response to the availability request, I am attaching Positive Potable-Water Availability and Negative Sanitary-Sewerage Certificate No.2022-00020625-1, which states in summary as follows: The sanitary-sewerage network is not operational in the area.” On the basis of that document, among other permits and authorizations, such as land-use authorization (uso de suelo) and construction permit No. PC-079-2024 issued by the Municipalidad de San Ramón, the protected party began the process of building her home.
Subsequently, on 07 de febrero de 2024, she filed new potable-water service request No. P21112024020005 with the respondent institution; however, it was denied by official letter No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024 because of a technical impossibility, as it was determined that no sewerage system was available along the boundary of the property. In this instance, this Court finds that, in the case at hand, the ICAA violated the principle of legitimate expectations to the detriment of the protected party. In this regard, the petitioner’s own statement establishes that she legitimately relied on the respondent authority and built her home, incurring the significant expenditure of resources that this entails, with the expectation that potable-water service would be supplied to her. Nevertheless, almost three months after official letter No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023 was issued, her new-service request was denied.
In light of the foregoing, the Court finds that the protected party’s principle of legal certainty (principio de seguridad jurídica), as well as her right to prompt and effective justice (derecho a obtener justicia pronta y cumplida), was also infringed. It should be noted that a potable-water request entails an administrative proceeding (procedimiento administrativo), which must be reviewed and decided by the respondent institute. In this case, it is clear that the respondent issued the positive potable-water availability certificate but later denied the request for new potable-water service because of an error. In that regard, it is necessary to recall the following relevant portion emphasized by the ICAA in its report: “On 21 de setiembre de 2022, she again submitted the availability request, as shown at folios 62 and 63 of the administrative record (expediente administrativo), and the decision thereon appears at folios 68 to 69.
The new proceeding was initiated again under number SIGDD- 2022- 00020625. It is reported that, on this occasion, the cantonal office received assistance in deciding availability requests, and on this occasion the request was decided favorably without taking into account that the easement (servidumbre) was agricultural or everything that this case entailed. This was because, up to that time, the circumstances existing since the prior decision had not changed. That favorable availability decision became effective on 16 de noviembre del año 2023. Because this last decision fell outside the handling of the San Ramón cantonal office, it was decided by other collaborating offices outside the Dirección Región Central and processed favorably directly for the user, through an incorrect decision, because the initial condition had not changed and access by agricultural easement remained in place; as of the date of this report, there is no evidence that infrastructure has been installed pursuant to any additional request or Water Capacity letter (carta de Capacidad Hídrica) authorizing it.” It adds: “Upon receiving this application, the cantonal office became aware of the error and conducted an investigation, taking the prior evidence into account and reassessing whether the circumstances of the request had actually changed, specifically the conditions for which availability request SIGDD-2022-00006761-1-1-1 had been denied.
For that reason, Ms. [Nombre27 001] was sent document SG-GSP-RC-2024-00132 el 05 de marzo, explaining why the new-service request could not be processed.” This Chamber has ruled on access to potable water as a service that, in turn, enables the realization and safeguarding of other fundamental rights, such as the rights to quality of life and health (see, to similar effect, judgment No. 2017002404 de las 09:45 horas del 17 de febrero de 2017). It has also recognized, however, that when technical reasons make the supply of potable water absolutely impossible, no fundamental right is infringed (see, to similar effect, judgment No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019, among others). In the case at hand, before the ICAA mistakenly issued the positive potable-water availability certificate, it had already determined that approving the potable-water and sanitary-sewerage availability request would be inappropriate because the technical feasibility required to approve availability requests located within system CO-A-35-San Ramón was lacking.
From this perspective, although it is important to note that this Court lacks jurisdiction to determine whether the water availability sought by the claimant should be granted, because that determination depends on technical criteria issued by the ICAA authorities—an institution vested with regulatory authority to perform such acts—in the case under review (sub examine), the Court does find that the protected party’s principle of legitimate expectations and principle of legal certainty, as well as her right to prompt and effective justice, were violated. The application must therefore be granted, with the consequences detailed in the operative part. (…)
The report submitted under oath by the respondent authority, subject even to the criminal consequences provided for in numeral 44 of the Ley de la Jurisdicción Constitucional, establishes an infringement of the petitioner’s fundamental rights, based on the considerations set forth below. In this regard, it has been established that Proyecto Condominio La Esperanza, located in Naranjo, was developed through the Sistema Financiero Nacional para la Vivienda with the objective of assisting 120 families in circumstances of extreme need. This housing solution is intended for 95 female heads of household, 16 large families, 4 persons with disabilities, and 3 older adults. The design provided for the construction of approximately 120 apartments distributed among 10 three-story towers, each containing 12 housing units, as well as children’s play areas, perimeter fencing, sidewalks, paved streets, a treatment plant, and public utilities.
Coopenae R.L. is the authorized entity responsible for supervising the project, and the developer is Consultoría Mar Azul S.A. The project holds the respective geological, environmental, and construction permits and complies with national technical regulations On 14 de abril del 2021, Mr. Carlos Manuel Calvo Quesada, holder of identity card n°CED03, in his capacity as legal representative of the legal entity Consultoría Mar Azul S.A, legal entity registration number CED02, through municipal form n°170841, submitted to the service platform of the Municipalidad de Naranjo an application for potable-water availability for 125 water service connections (pajas de agua) on the land (property) owned by the entity he represents, real property record CED04, with survey plan A-2237210-2020, located in the province of Alajuela, canton of Naranjo, district of San Miguel, Dirección05. In official letter (oficio) DSPM-MN-DA-088-2021 dated 21 de abril de 2021, official Chacón Agüero of the Acueducto de la Municipalidad de Naranjo informed Consultoría Mar Azul S. A., legal entity identification number No. CED02, as follows: “The application for water availability for the property located in Naranjo, Dirección05, 500 metros southeast of the bridge over the río Pilas, registered in the Registro Nacional under property number 2-600010-000, GIS No. Telf02, with cadastral survey plan number 2-2237210-2020, is hereby granted conditionally.
There are no distribution lines of adequate diameter in front of the parcel, nor does the Municipalidad de Naranjo have appropriate feasibility documentation for responsible urban development that guarantees an adequate potable-water supply for both current and future subscribers. Accordingly, the following is determined: Water availability is granted subject to the submission of a feasibility study for providing potable-water service in order to carry out the project involving 125 domestic water service connections of 12.5. mm), which must include factors such as water balance (balance hídrico), supply allocation, topography, design, projected population growth, and all other aspects necessary for urban development; the project to be developed would form part of the Naranjo Centro water-supply system. That study must be duly approved by the Municipalidad de Naranjo. The infrastructure works specified in the requested study must be performed.
With respect to hydrants, the hydrant engineering division of Bomberos de Costa Rica, the regulatory and oversight body for this matter, must be consulted so that they may be included in the design. The current A y A regulations governing the design of distribution lines must be complied with, as indicated in the requested feasibility study.” Subsequently, in official letter MN-DAM-0175- 022 dated 21 de junio del 2022, the Mayor of the Municipalidad de Naranjo, in relation to the project involving 125 domestic water service connections on the land (property) recorded under real property record 2-600010- 000, survey plan A-2237210-2020, located in the province of Alajuela, canton of Naranjo, district of San Miguel, Dirección05, in favor of Consultoría Mar Azul S.A., determined: “(…) “The application for water availability for the property located in Naranjo, Dirección05 , Dirección07, registered in the Registro Nacional under real property record number 2-600010-000, GIS #02-008-003- 02, with cadastral survey plan number A-2237210-2022, qualifies and is hereby granted.
Accordingly, the following is determined: • Water availability is granted to carry out the project involving 125 domestic water service connections of 1/2” (12.5mm). • Use for any other unspecified purpose is prohibited. The Municipalidad de Naranjo is authorized to take the time necessary to respond to the installation application. This certification is valid for one calendar year from its date of issuance.” In view of the foregoing, on 12 de julio del 2022, according to the Plataforma Administradora de Proyectos de Construcción (APC) of the Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA)—digital case file; Consultoría Mar Azul S.A., as the registered owner of the land (property) recorded under real property record 2-600010-000, survey plan A-2237210-2020, located in the province of Alajuela, canton of Naranjo, district of San Miguel, Dirección05 , submitted official letter MN-DAM-0175-2022, signed by the Mayor of the Municipalidad de Naranjo, as part of the documentation accompanying the application for the construction permit for the condominium development on that land, which was approved.
Subsequently, on 13 de febrero del 2023, Mr. Allan Calvo Muñoz, legal representative of Consultoría Mar Azul S.A., through official letter DT-YE-019-2023, requested that the Departamento de Acueducto Municipal “…renew official letter MN-DAM-0175 2022 concerning the availability of 125 water service connections for the social-interest project Condominio Vertical La Esperanza, granted on 21 de junio del 2022, for the property with cadastral survey plan 2-9207-2022 and real property record 2- 600010-000…” In official letter MN-ALC-3924-2023 dated 14 de febrero de 2023, the Mayor of the Municipalidad de Naranjo informed Consultoría Mar Azul S.A., Identification No: CED02, insofar as relevant: “I hereby certify the decision on your application for Water Availability. In accordance with the regulations governing the operation and administration of the Acueducto de la Municipalidad de Naranjo, the following report is issued.
The application for water availability for the property located in Naranjo, Dirección05, Dirección07, registered in the Registro Nacional under property Number 2-600010-000, Gis N°02-008-003-02, with cadastral survey plan number 2-9207-2022, qualifies and is hereby granted. Accordingly, the following is determined: • Water availability is granted to carry out the project involving 125 domestic water service connections of ½” (12.5mm) each. • Use for any other unspecified purpose is prohibited. The Municipalidad de Naranjo is authorized to take the time necessary to respond to the installation application. This Certification is valid for one calendar year from its date of issuance.” Subsequently, in official letter MN-ALCDAM- OF-168-2025 dated 3 de julio de 2025, the Coordinator of the Departamento de Acueducto, Gerardo Chacón Agüero, informed the engineer serving as construction manager that Consultoría Mar Azul S.Nombre24. was not authorized to submit the interconnection application.
On 18 de julio de 2025, the developer resubmitted the interconnection application, this time attaching the pertinent authorizations from Banco Improsa S.A., in its capacity as registered owner of the land and trustee. In official letter MN-ALC-DAM-OF-188-2025 dated 29 de julio de 2025, Gerardo Chacón Agüero of the Departamento Acueducto de la Municipalidad de Naranjo informed the Legal Representative of Consultoría Mar Azul S.A., in relation to the Processing of municipal form n°236944, Application for Interconnection of the Condominio Residencial Vertical “La Esperanza” Project, insofar as relevant: “(…) FIFTH. As a result of the technical analysis conducted on the study entitled ‘Interconnection Design for Condominio Vertical La Esperanza-Dirección02 Acueducto Municipal de Naranjo,’ submitted by Consultoría Mar Azul S.A., in relation to the specialized technical study entitled: ‘DESIGN OF THE POTABLE-WATER DISTRIBUTION AND CONVEYANCE NETWORK IN THE Dirección03 SECTORS OF NARANJO CENTRO,’ commissioned by the Municipalidad de Naranjo pursuant to procurement procedure 2024LD-000004-0023200001, it is concluded that: Under typical population-growth conditions, the Acueducto Municipal has sufficient water resources to supply the current user population (specifically, that of the Naranjo Centro-Casco Central subsystem and the San Francisco, Dirección02, La Radial, and El Águila sectors) for a design projection of 25 años, which is consistent with the Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial, point 4.2.5 ‘Conveyance Pipeline (Tubería de conducción),’ of the Instituto Costarricense de Acueductos y Alcantarillado, which establishes a mandatory period of 25 años for treated-water conveyance pipelines.
Technically, the foregoing means that potable-water service must be capable of accommodating projected population growth over 25 años without a water deficit (déficit hídrico). However, both technical studies also transparently reveal that, when the mathematical calculation is performed to assess the interconnection of the Condominio Residencial Vertical La Esperanza project for the provision of potable-water service through the Acueducto Municipal, the hydraulic calculation report (memoria de cálculo hidráulico) demonstrates that a water deficit would arise beginning in 2034, that is, 09 años after the potential connection in the current year 2025, thereby shortening the design period by approximately 64%, as demonstrated in point ‘4.5 Water Balance. Table 4-6 Water Balance for the Acueducto Naranjo.’ This would affect approximately 11864 mil users residing in Alto El Sitio, San Francisco, Dirección02, Candelaria, and Casco Central (current subscribers to the municipal water-supply system), who are supplied by the Naranjo Centro municipal water-supply system, which would, in turn, be the same system required to provide potable water to the condominium project.
SIXTH. In view of that objective situation, supported by the 2 specialized technical studies cited above, the Alcaldía Municipal, in the pleading instituting proceedings for a declaration of injury to the public interest (proceso de lesividad) before the Tribunal Contencioso Administrativo y Civil de Hacienda, arising from the declaration that Administrative Act–Official Letter MN-DAM-0175-2022, dated 21 de junio de 2022, was injurious to the public interest (declaratoria de lesividad), signed by former Mayor Mr. Juan Luis Chaves Vargas, through which the Municipalidad de Naranjo, as you are aware, granted the entity you represent potable-water availability for the project involving 125 water service connections on the real property registered under , filed an application for an interim measure (medida cautelar). Nombre28. As of the date of this official letter, the Municipalidad de Naranjo is awaiting a ruling on the request, which, in principle and in due course, must be served by the Tribunal on the parties to the proceedings; accordingly, pursuant to instructions from the Alcaldía Municipal, you are hereby informed that the interconnection application contained in municipal form n°236944 is subject to the corresponding judicial ruling, which the Municipalidad de Naranjo will comply with as required by law.
Nombre26. Accordingly, and for all pertinent purposes, notice is hereby given that the judicial case number assigned by the Tribunal to the matter at issue is: 25-004998-1027-CA.” It should be noted that, in the present case, in official letter DSPM-MN-DA-088-2021 of 21 de abril de 2021, Chacón Agüero, an official of the Municipalidad de Naranjo Water Utility, and, in official letters MN-DAM-0175- 022 of 21 de junio del 2022 and MN-ALC-3924-2023 of 14 de febrero de 2023, the Mayor of the Municipalidad de Naranjo issued confirmation of water availability for the project involving 125 residential water connections (pajas de agua domiciliarias), in relation to the project involving 125 residential water connections, on the land (property) registered under real property folio 2-600010- 000, survey plan A-2237210-2020, located in Alajuela Province, Naranjo Canton, San Miguel District, Dirección05, in favor of Consultoría Mar Azul S.A. In view of the foregoing and the case law cited above, the refusal by the respondent municipal corporation to perform or approve the interconnection of the water service for the project in question infringed the human right to water, the principle of legitimate expectations (confianza legítima), and legal certainty (seguridad jurídica), to the detriment of the petitioner, because on three separate occasions, beginning in 2021, the municipal corporation confirmed water availability for a social-interest project, and the governed party cannot be required to bear the abrupt change in position by the respondent municipal administration after the development has been built.
Moreover, all matters relating to the administrative adverse-interest proceeding (proceso de lesividad) conducted under expediente 25-004998-1027-CA, which seeks the annulment of Administrative Act–Official Letter MN-DAM-0175-2022 of 21 de junio de 2022, through which the Municipalidad de Naranjo confirmed the availability of potable water, constitute a matter of legality on which this Chamber declines to rule. Accordingly, this amparo action (recurso de amparo) must be granted on the terms set forth in the operative portion of this decision.
VIII.Documents submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, Article LXXXI.
POR TANTO:
The action is granted. Randall Vega Blanco, in his capacity as Mayor of the Municipalidad de Naranjo, or whoever holds that office, is ordered to issue the appropriate directives and make all necessary arrangements within the scope of his authority so that, within a maximum period of FIFTEEN DAYS counted from notification of this decision, he implements the measures required to provide potable water service to Condominio Residencial Vertical La Esperanza. The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo action that they must comply with or enforce and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Naranjo is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). Let notice be given.

RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
En la sentencia número 2025026068 de las 9:20 horas del 14 de agosto de 2025, esta Sala resolvió un anterior recurso de amparo por hechos similares a los planteados en el presente recurso, y en esa oportunidad se determinó:
“I.-En el caso concreto, los recurrentes cuestionan que la Municipalidad de Naranjo se niegue a que la empresa desarrolladora del condominio La Esperanza, interconecte dicho proyecto con el acueducto municipal. Del estudio de los autos, se denota que en el cantón de Naranjo se pretende construir el condominio vertical residencial La Esperanza, como un proyecto de vivienda para personas de escasos recursos. A raíz de lo anterior, la empresa encargada del proyecto gestionó ante la Municipalidad de Naranjo los permisos respectivos, entre los que se encontraba la solicitud de agua potable. Dicha petición fue atendida mediante oficio MN-ALC-3924-2023 del 14 de febrero del 2023, en el que se otorgó la disponibilidad de agua para 125 pajas de agua domiciliaria. Posteriormente, el 30 de mayo de 2025 la compañía desarrolladora solicitó que iniciara el proceso de interconexión del condominio con el acueducto municipal, no obstante, dicha solicitud fue negada por la corporación accionada, bajo el argumento de que, tras realizar un nuevo estudio, se había determinado que el proceso de interconexión del condominio generaría un déficit hídrico a partir del año 2034, afectando a casi doce mil personas usuarias del acueducto.
Ante ello, se dispuso iniciar un proceso de lesividad ante el Tribunal Contencioso Administrativo y Civil de Hacienda, suspendiendo el proceso de interconexión hasta que dicho procedimiento se resolviera. Ahora bien, con vista en lo expuesto anteriormente, se estima que el reclamo planteado constituye un tema que escapa del ámbito de competencias de esta jurisdicción, pues no corresponde a la Sala determinar la procedencia de la decisión adoptada por la autoridad recurrida, en el sentido de si existen o no condiciones para permitir la interconexión del condominio La Esperanza al acueducto municipal, pues para ello sería necesario realizar una serie de diligencias de carácter técnico que son ajenas a este Tribunal y que, en todo caso, exceden el carácter sumario del amparo. Ante dicha situación, lo procedente es que los recurrentes planteen los reclamos del caso en la vía ordinaria, con el fin de que se resuelva ahí lo que en derecho corresponda”.
No obstante lo anterior, este Tribunal considera bajo una mejor ponderación, que por los hechos denunciados el presente recurso resulta admisible y la situación denunciada amerita ser conocida nuevamente. Lo anterior, de conformidad con lo dispuesto en el artículo 13 de la Ley de la Jurisdicción Constitucional.
La recurrente en su condición de Ministra de Vivienda y Asentamientos Humanos manifiesta que el Proyecto Condominio La Esperanza fue desarrollado mediante el Sistema Financiero Nacional para la Vivienda, con el objetivo de atender a 120 familias en situación de extrema necesidad. Señala que el proyecto busca erradicar el asentamiento informal La Radial, ubicado a la entrada de Naranjo sobre la Dirección01, y representa una inversión de ¢4.741,9 millones. Expone que con estos recursos se adquirió el terreno en verde, se desarrollaron las obras de infraestructura y se construyeron las unidades de vivienda. Precisa que el diseño contempla 120 apartamentos distribuidos en 10 torres de tres niveles, cada una con 12 unidades habitacionales, además de áreas de juegos infantiles, cerramiento perimetral, aceras, calles asfaltadas, planta de tratamiento y servicios públicos. Dice que esta solución habitacional está destinada a 95 mujeres jefas de hogar, 16 familias numerosas, 4 personas con discapacidad y 3 adultos mayores. Afirma que Coopenae R.L. es la entidad autorizada encargada de la supervisión del proyecto y que la desarrolladora es Consultoría Mar Azul S.A. Expone que el proyecto cuenta con los permisos respectivos en materia geológica, ambiental y constructiva, así como con el cumplimiento de la normativa técnica nacional.
Señala que mediante oficio MN-ALCDAM- OF-168-2025 del 3 de julio de 2025, el Coordinador del Departamento de Acueducto, Gerardo Chacón Agüero, comunicó al ingeniero director de obra que Consultoría Mar Azul S.A. la no tiene autorización para realizar la solicitud de interconexión. Afirma que, no obstante, el estudio técnico denominado “Diseño de Interconexión Condominio Vertical La Esperanza-Calle Muñoz Acueducto Municipal de Naranjo” se encuentra en análisis, ya que el balance hídrico proyectado es deficitario al año 2034. Sostiene que el 18 de julio de 2025, la desarrolladora volvió a presentar la solicitud de interconexión, esta vez adjuntando las autorizaciones pertinentes por parte del Banco Improsa S.A., en calidad de propietario registral del terreno y fiduciario. Continúa diciendo que: 11.- Finalmente, mediante oficio MN-ALC-DAM-OF-188-2025 del 29 de julio del 2025, el Sr. Gerardo Chacón Agüero, Coordinador del Departamento de Acueducto de la Municipal de Naranjo, comunica a la representante legal de Consultoría Mar Azul S.A. que como resultado del análisis técnico efectuado al estudio “Diseño de Interconexión Condominio Vertical La Esperanza-Dirección02 Acueducto Municipal de Naranjo”, aportado por Consultoría Mar Azul S.A., en relación con el estudio técnico y especializado denominado: “DISEÑO DE LA RED DE DISTRIBUCIÓN Y CONDUCCIÓN DE AGUA POTABLE EN LOS SECTORES DE Dirección03 EN NARANJO CENTRO”, contratado por la Municipalidad de Naranjo, según procedimiento contractual 2024LD-000004-0023200001, se concluye que: Con las condiciones de crecimiento poblacionales típico, el Acueducto Municipal cuenta con el recurso hídrico para abastecer a la actual población usuaria (específicamente del subsistema de Naranjo Centro-Casco Central y sectores San Francisco, Dirección02, La Radial, El Águila), a una proyección de diseño de 25 años, lo que resulta acorde con la Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial, punto 4.2.5 “Tubería de conducción”, del Instituto Costarricense de Acueductos y Alcantarillado, el cual establece como obligación para líneas de tubería de conducción de agua tratada, el periodo es de 25 años.
Lo anterior técnicamente implica que el servicio de agua potable debe poder ofrecerse a una proyección de crecimiento poblacional a 25 años, sin presentarse déficit hídrico. Indica que ambos estudios técnicos revelan que al realizarse el ejercicio matemático, valorando la interconexión del Proyecto Condominio Residencial Vertical La Esperanza, para brindarle el servicio de agua potable, a través del Acueducto Municipal, la memoria de cálculo hidráulico demuestra que se generaría déficit hídrico a partir del año 2034, es decir, 09 años después de la eventual conexión en el presente año 2025, acortando así el periodo de diseño en aproximadamente un 64%, tal y como se demuestra en el punto “4.5 Balance Hídrico. Tabla 4-6 Balance Hídrico Acueducto Naranjo”. Lo que afectaría aproximadamente a 11864 mil personasusuarias, vecinas de Alto El Sitio, San Francisco, Dirección02, Candelaria y Casco Central (abonados actuales del sistema de acueducto municipal), quienes son abastecidas con el sistema de acueducto municipal de Naranjo Centro, que a su vez, sería el mismo que tendría que dotar de agua potable al proyecto de condominio y agrega que el tema es objeto de un proceso de lesividad ante el Tribunal Contencioso Administrativo y Civil de Hacienda.
Manifiestan además que hasta que no se avance con el proceso de lesividad, el proceso de interconexión de agua potable que requieren las 120 familias beneficiarias del Proyecto de vivienda La Esperanza, que suspendido”.
Aclara que la entidad autorizada ostenta de manera exclusiva la tramitación y calificación del bono ante el Banco Hipotecario de la Vivienda, así como la selección del desarrollador de la obra. Señala que, si bien el Ministerio de Vivienda y Asentamientos Humanos (MIVAH) realiza una identificación de las comunidades que presentan perfiles sociales acordes con los parámetros de pobreza, pobreza extrema y vulnerabilidad social, y brinda aval o recomendación formal de aquellos proyectos que cumplen con las prioridades del Estado en materia de vivienda, corresponde siempre al BANHVI y a la Entidad Autorizada seleccionada para tal fin, todo el proceso de tramitación, aprobación, ejecución y seguimiento de la contratación de la obra y su fase constructiva. Precisa que en dichas fases el MIVAH carece de competencias o intervención, por estar así establecido en la Ley del Sistema Financiero Nacional para la Vivienda.
Acusa la inercia de la Municipalidad de Naranjo, pues la negativa a efectuar la interconexión de agua potable ha contribuido a lesionar sus derechos fundamentales de los amparados, pues es necesaria la interconexión de agua potable, antes de proceder con la entrega formal de las soluciones habitacionales. Considera que debe prevalecer el derecho a una vivienda digna y adecuada, considerando la situación de vulnerabilidad y el riesgo inminente que enfrentan las familias beneficiarias del proyecto.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
Estudio que deberá de ser debidamente aprobado por parte de la Municipalidad de Naranjo. Se deberá de realizar las obras de infraestructura indicada en el estudio solicitado. Para el tema de hidrantes deberá de realizar la consulta a ingeniería de hidrantes de Bomberos de Costa Rica, ente regulador y fiscalizador en este tema, para la inclusión en el diseño. Deberán de cumplir con la normativa vigente del A y A para el diseño de las líneas de distribución según lo índice que estudio de factibilidad solicitado” (informe de la autoridad recurrida).
El oficio MN-DAM-0175-2022 del 21 de junio de 2022, por medio del cual, la Municipalidad de Naranjo Atendió la solicitud de disponibilidad de agua planteada por la persona Nombre25. fue emitida dentro del marco de la legalidad y con fundamento en las competencias que le corresponden por la materia y territorialmente. 4. El oficio MN-DAM-0175-2022 no implica el otorgamiento de ninguna paja de agua a favor de la persona jurídica Nombre25., se limita a determina la existencia de disponibilidad de agua en la localidad que se plantea el proyecto habitacional. Por tanto. En el caso del oficio MN-DAM-0175-2022 y del proceso constructivo que la persona jurídica Nombre25. tramita ante la Municipalidad de Naranjo, la municipalidad como el suscrito han actuado conforme al ordenamiento jurídico por lo que no existe conflicto de intereses, ni favorecimiento indebido a la citada persona jurídica. Se rechaza categóricamente cualquier comentario o acusación infundada que tenga como finalidad generar confusión en la opinión pública naranjeña y del país en general, con miras a posiciones negativamente la gestión municipal al respecto de los temas expuestos en el presente oficio, ya que como quedó demostrado, el accionar del gobierno local, siempre ha sido y lo será finalizar su gestión el 30 de abril de 2024, orientada a garantizar la administración de los intereses y servicio del cantón de Naranjo, conforme a derecho (informe de la autoridad recurrida).
Lo anterior técnicamente implica que el servicio de agua potable, debe poder ofrecerse a una proyección de crecimiento poblacional a 25 años, sin presentarse déficit hídrico. Sin embargo, ambos estudios técnicos, de manera transparente también revelan que al realizarse el ejercicio matemático, valorando la interconexión del proyecto condominio residencial vertical La Esperanza, para brindarle el servicio de agua potable, a través del Acueducto Municipal, la memoria de cálculo hidráulico demuestra que se generaría déficit hídrico a partir del año 2034, es decir, 09 años después de la eventual conexión en el presente año 2025, acortando así el periodo de diseño en aproximadamente un 64%, tal y como se demuestra en el punto “4.5 Balance Hídrico. Tabla 4-6 Balance Hídrico Acueducto Naranjo”. Lo que afectaría aproximadamente a 11864 mil personas usuarias, vecinas de Alto El Sitio, San Francisco, Dirección02, Candelaria y Casco Central (abonados actuales del sistema de acueducto municipal), quienes son abastecidas con el sistema de acueducto municipal de Naranjo Centro, que a su vez, sería el mismo que tendría que dotar de agua potable al proyecto de condominio.
SEXTO. Que ante ese panorama objetivo, sustentado en los 2 estudios técnicos y especializados antes referenciados, la Alcaldía Municipal en el escrito de presentación del proceso de lesividad ante el Tribunal Contencioso Administrativo y Civil de Hacienda, con motivo de la declaratoria de lesividad del Acto Administrativo-Oficio MN-DAM-0175-2022, del 21 de junio de 2022, suscrito por el ex Alcalde, señor Juan Luis Chaves Vargas, por medio del cual la Municipalidad de Naranjo, como es de su conocimiento, le otorgó a su representada la disponibilidad de agua potable, para el proyecto de 125 pajas de agua, en el bien inmueble matrícula , planteó solicitud de medida cautelar. SÉTIMO. Que a la fecha del presente oficio, la Municipalidad de Naranjo está a la espera de la resolución del requerimiento, lo cual, en principio y oportunamente debe ser notificado por el Tribunal a las partes procesales intervinientes; en ese sentido, con instrucción de la Alcaldía Municipal se informa que la solicitud de interconexión contenida en la boleta municipal n°236944, que la misma queda sujeta a la resolución judicial correspondiente, resolución que será atendida por la Municipalidad de Naranjo, como en derecho corresponda.
Nombre26. Que así las cosas y para lo que corresponda, se comunica que el número de expediente judicial asignado, por el Tribunal al caso de marras es: 25-004998-1027-CA” (informe de la autoridad recurrida).
La jurisprudencia de la Sala es reiterada en reconocer el denominado derecho fundamental al agua, por el cual debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, toda vez que la misma resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Así, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del 17 de febrero de 2006 – reiterada, entre otras, por sentencias números 2007-13310, de las diez horas cincuenta y siete minutos del 14 de setiembre de 2007, y 2008- 16311, de las diecisiete horas treinta minutos del 30 de octubre de 2008- estableció la Sala que:
“El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...). Esta Sala, en la sentencia No. 2004- 12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable.
De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma.
En todo caso, se encuentra acreditado también que aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.” Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud» (véase sentencia N° 2018-8650 de las 09:15 hrs. del 1° de junio de 2018, 2018-7369 de las 9:45 horas de 11 de mayo de 2018 y la N° 2016-18026 de las 9:05 horas del 7 de diciembre de 2016).
Esta Sala, en la resolución No. 2018-002910 de las 09:15 horas del 23 de febrero de dos 2018, dispuso lo que de seguido se transcribe:
“IV.- Sobre este principio, anteriormente se asumió de manera axiomática que, irremediablemente, todo acto ilegal de contenido favorable podía ser dejado sin efecto por parte de la Administración en cualquier tipo de situación, sin atender a ninguna circunstancia en particular. No obstante, desde mediados de los cincuentas, tanto la doctrina como la jurisprudencia empezaron a detectar que una aplicación ciega y rígida de la regla antedicha lesionaba seriamente la confianza depositada por los administrados en la Administración, así como la buena fe y la seguridad jurídica. De este modo, mediante sentencia de 14 de mayo de 1956, el Tribunal Contencioso- Administrativo de Berlín desarrolló el principio de confianza legítima, que luego fue adoptado por el Tribunal de Justicia de la Comunidad Europea en sus pronunciamientos de 22 de marzo de 1961 y 13 de julio de 1965 (Lemmerz-Werk), y que básicamente apuntala la confianza de los ciudadanos en la medida que, en ciertas circunstancias del caso concreto, razones de equidad y buena fe le impiden a la Administración tomar medidas contrarias a la esperanza inducida por la razonable estabilidad de sus decisiones, en función de las cuales los particulares han adoptado determinadas medidas.
En nuestro continente, tan solo a manera de ejemplo, el Tribunal Constitucional de Colombia, por Sentencia T- 308/11 de 28 de abril de 2011, ha precisado: “El principio de confianza legítima propugna por la edificación de un ambiente de tranquilidad en las relaciones que construyen los asociados frente a las autoridades públicas o los particulares, de forma tal que puedan esperar, de buena fe, que sus actuaciones no sean variadas de manera abrupta a menos de que prime un fin constitucionalmente legítimo. Doctrinariamente se ha defendido que la confianza legítima implica que determinadas expectativas generadas por un sujeto de derecho frente a otro en razón a un comportamiento específico produzcan resultados uniformes en un ambiente de confianza que sólo puede ser quebrantada para dar paso al interés público. En el marco de la relaciones entre la administración y los administrados, la doctrina ha definido la confianza legítima como un valor ético que integra la buena fe y que comprende “la necesidad de una conducta leal, honesta, aquella conducta que, según la estimación de la gente, puede esperarse de una persona.” (…) “La aplicación del principio de la buena fe permitirá al administrado recobrar la confianza en que la administración no va a exigirle más de lo que estrictamente sea necesario para la realización de los fines públicos que en cada caso concreto persiga.
Y en que no le va a ser exigido en su lugar, en el momento ni en la forma más inadecuados, en atención a sus circunstancias personales y sociales, y a las propias necesidades públicas.” Así las cosas, la confianza legítima ha de entenderse como la expectativa cierta de que una situación jurídica o material, abordada de cierta forma en el pasado, no sea tratada de modo extremadamente desigual en otro periodo, salvo que exista una causa constitucionalmente aceptable que legitime su variación. En este sentido, esta Corporación ha sostenido que “el administrado no es titular de un derecho adquirido sino que simplemente tiene una mera expectativa en que una determinada situación de hecho o regulación jurídica no serán modificadas intempestivamente, y en consecuencia su situación jurídica puede ser modificada por la Administración. Como elemento incorporado al de buena fe, la confianza legítima puede proyectarse en el hecho de que se espere la perpetuación de específicas condiciones regulativas de una situación, o la posibilidad de que no se apliquen exigencias más gravosas de las ya requeridas para la realización de un fin, salvo que existan razones constitucionalmente válidas para ello.” En efecto, la ratio iuris del principio de protección a la confianza legítima consiste en que el desarrollo de las relaciones jurídicas requiere de un ambiente de confianza, en el que las reglas de juego, una vez dadas, se respetan.
Lo anterior resulta de mayor relevancia en el caso de las relaciones para con la Administración, toda vez que, en este caso, el instrumento jurídico relacional es el acto administrativo, el cual no es sino una manifestación unilateral de voluntad del Estado. Ergo, el ciudadano necesita de instrumentos jurídicos para defenderse de la unilateralidad y superioridad de la Administración (ver Sentencia N° 2016-008000 de las 11:52 horas del 10 de junio de 2016)”.
En la resolución del presente caso, es de gran importancia tomar en cuenta lo resuelto por ésta Sala Constitucional en la sentencia nro. 2024010181 de las 9:20 horas del 19 de abril de 2024, donde se estableció:
“III.- SOBRE EL FONDO. Después de analizar los elementos probatorios aportados y el informe rendido bajo juramento por la autoridad recurrida, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, este Tribunal tiene por acreditado que la recurrente es dueña de un inmueble ubicado en San Ramón de Alajuela, propiamente en Piedades Norte, inscrita en el folio real No. 571180-000. Se colige que el 26 de marzo de 2022 la accionante presentó ante la autoridad recurrida una solicitud de agua potable para un inmueble sin construir de vocación agrícola cuyo acceso es mediante servidumbre de naturaleza agrícola que se ubica hasta Dirección09; solicitud No. SIGDD-2022-00006761. No obstante, del estudio básico de la solicitud No. SIGDD-2022-00006761-1-AP se determinó que no resultaba congruente para el instituto aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario para el eventual proyecto debido a que no cuenta con factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
La factibilidad técnica se fundamentó en la Inspección de Factibilidad de Agua Potable SIGDD-2022-00006761-1-1-1 remitido por el Jefe técnico de Operación y Mant. Sist. de Agua Cantonal de San Ramón de la Región Central Oeste, donde se indica “Inexistencia de infraestructura de distribución y recolección frente al inmueble según criterio técnico”. Lo anterior fue notificado a la recurrente mediante resolución de Constancia de NO DISPONIBILIDAD del 04 de agosto del 2022. Ante el escenario descrito, se coteja que la tutelada interpuso un recurso de revocatoria y/o apelación en subsidio contra lo dispuesto por el ICAA; empero, mediante resolución de las 7: 00 horas del 12 doce de agosto del 2022 se declaró sin lugar el recurso de revocatoria. Asimismo, mediante resolución GG-R-2022-0727 de las 10:00 horas del 21 de septiembre del 2022 se rechazó el recurso de apelación.
Quedó demostrado que el 21 de setiembre de 2022 la accionante presentó ante la autoridad recurrida la nueva la solicitud de agua potable No. SIGDD- 2022-00020625. En ese sentido, se demostró que el ICAA generó el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, en el cual indicó lo siguiente: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Lo anterior fue notificado a la interesada en el oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”. Se coteja que el 07 de febrero de 2024 la promovente gestionó la solicitud del nuevo servicio de agua potable No. P21112024020005, pero al recibir el trámite en cuestión la cantonal se percató de un error y procedió a realizar una investigación; ello, tomando en cuenta la evidencia pasada, valorando nuevamente sí la condición de la solicitud realmente había cambiado y las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1.
Finalmente, se confirmó que en oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024, la autoridad recurrida le notificó a la interesada que no podía dar trámite a la solicitud del nuevo servicio No. P21112024020005. En lo medular, se indicó: “En fecha 07 de febrero del 2024, se emite solicitud 21112024020005 a Nombre27 de [Nombre27 001], cédula de identidad [Valor CED62], para el proyecto de Construcción de vivienda, ante la solicitud de conexión de nuevo servicio de agua potable, el cual se ubicaría en la propiedad, matrícula da folio real , cuya naturaleza señala TERRENO DE POTRERO, acceso a través de servidumbre agrícola localizada en Distrito Piedades Norte, Cantón de San Ramón, Provincia de Alajuela, según Plano Catastrado No. A-2032273-2018, con dirección 115 metros al NW y 260 metros W de las Cabinas del Bosque Lodge (…) según consulta en el Registro Nacional de la propiedad, la distancia de la vía pública al terreno por la servidumbre agrícola es de 190 metros aproximado (…) Para prestar servicios a lo interno de la servidumbre debe inscribirla a favor de AYA, así como cumplir con los criterios antes señalados.
En conclusión, ante esta circunstancia la Institución se ve imposibilitada de otorgar lo pedido. Los documentos que contiene el expediente administrativo son concluyentes, en este sentido mal haría la Institución otorgando un nuevo servido, contraria al Principio de Legalidad, a la ciencia y la técnica que señalan los artículos 11 y 16 de la Ley General de la Administración Pública. Siendo entonces que AyA debe respetar la normativa que lo rige, en caso contrario estaría transgrediendo el ordenamiento jurídico (…) Finalmente, como se comprueba no se puede dar trámite a la solicitud de nuevo servicio No. P21112024020005”.
Esta Sala, mediante sentencia No. 2012-016181 de las 9:05 horas de 27 de noviembre de 2012, reiterado en la sentencia No. 2015002749 de las 09:05 horas del 27 de febrero de 2015, al conocer un asunto similar al de este expediente, se pronunció en los siguientes términos:
“V.- CASO CONCRETO. Queda acreditado que a la amparada se le había otorgado una primera carta de disponibilidad, extendida el 24 de octubre de 2011, a efecto de tramitar el visado del plano catastrado No. SJ-919550-0, documento que tenía de vigencia un plazo no mayor a seis meses que venció en abril de 2012. Con base en ese documento, entre otros permisos y autorizaciones, la recurrente construyó su vivienda y solicitó a la Asociación recurrida, que le extendiera la carta de disponibilidad para que se le otorgue el servicio de agua potable en el inmueble. No obstante, esto le fue rechazado pues, según el último aforo realizado por personeros del Instituto de Acueductos y Alcantarillados, las nacientes captadas son insuficientes para abastecer a la población actual —criterio recogido en el memorando No. SUB-G-GSC-UEN-AP-EBD-2012-686 de 25 de mayo de 2012—; situación que le fue comunicada a la tutelada.
Partiendo de este esquema fáctico, en criterio de este Tribunal, en el presente asunto se violentó el principio de confianza legítima en perjuicio de la amparada. En efecto, si bien, la primera carta de disponibilidad se le extendió en el 2011, la amparada confió legítimamente en la Asociación recurrida —la que, como se dijo supra, está ejerciendo potestades públicas— y construyó su casa de habitación, con el gasto importante de recursos que eso conlleva, con la expectativa que se le suministraría el servicio de agua potable. Ciertamente, conforme el artículo 21, inciso 19), del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo No.32529, las ASADAS pueden otorgar el sello disponibilidad hídrica —con vigencia de 6 meses para viviendas unifamiliares y de un año para otros desarrollos, prorrogable— “siempre que exista viabilidad técnica, no vaya en detrimento de la calidad del servicio que se presta y exista infraestructura” (el énfasis es agregado).
No obstante, en concordancia con el principio de confianza legítima y de buena fe, debe advertirse a la Asociación recurrida que antes de emitir una carta de disponibilidad de agua potable, deben realizarse las mediciones necesarias para verificar si existe agua disponible y así evitar hacer incurrir a los administrados en fuertes e inútiles inversiones si después de construidas sus viviendas o edificaciones, no se les puede dotar de agua potable.
Como corolario de lo expuesto, se impone acoger el recurso planteado con las consecuencias que se detallan en la parte dispositiva de esta sentencia”.
En el sub lite del elenco de hechos probados se desprende que mediante oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023 el ICAA emitió la constancia de disponibilidad de agua potable positivo para la propiedad inscrita en el folio real No. 571180-000 localizada en San Ramón de Alajuela, propiamente en Piedades Norte a Nombre27 de la recurrente, en las siguientes condiciones: "SI HAY DISPONIBILIDAD DE AGUA POTABLE EN LA VÍA PÚBLICA, NO HAY DISPONIBILIDAD DE SISTEMA DE ALCANTARILLADO”. Esto fue notificado a la parte amparada en oficio del 16 de noviembre de 2023 en las siguientes condiciones: “En atención a la solicitud de disponibilidad, me permito hacerle llegar adjunto la Constancia de Disponibilidad de Agua Potable Positivo y Alcantarillado Sanitario Negativo N°2022-00020625-1, el cuál en resumen señala lo siguiente: La red de Alcantarillado Sanitario no se encuentra en funcionamiento en la zona”.
Con base en ese documento, entre otros permisos y autorizaciones, tales como el uso de suelo y el permiso de construcción No. PC-079-2024 emitido por la Municipalidad de San Ramón, la tutelada inició el proceso de construcción de su vivienda. Posteriormente, sea el 07 de febrero de 2024, gestionó ante la institución accionada la solicitud del nuevo servicio de agua potable No. P21112024020005; empero, le fue rechazada mediante el oficio No. SG-GSP-RC-2024-00132 del 05 de marzo de 2024; esto, debido a la existencia de una imposibilidad técnica, pues se determinó que no existe frente al lindero del inmueble disponibilidad de sistema de alcantarillado. En la especie, en criterio de este Tribunal, en el caso de marras el ICAA violó el principio de confianza legítima en perjuicio de la parte amparada. En esa línea de ideas, adviértase que del propio dicho de la recurrente se determina que confió legítimamente en la autoridad recurrida y construyó su casa de habitación con el gasto importante de recursos que eso conlleva y con la expectativa que se le suministraría el servicio de agua potable.
No obstante, casi tres meses después de que se emitiera el oficio No. SIGDD2022-0000625-1-1-1 de 16 de noviembre de 2023, la solicitud de nuevo servicio le fue rechazada. Por lo expuesto, se considera que también lesionó el principio de seguridad jurídica de la tutelada, así como su derecho a obtener justicia pronta y cumplida. Nótese que la solicitud de agua potable conlleva un procedimiento administrativo, el cual debe ser analizado y resuelto por el instituto accionado. En este caso, resulta claro que la recurrida emitió la disponibilidad de agua potable positivo, pero luego denegó la solicitud del nuevo servicio de agua potable debido a un error. En ese sentido, es menester traer a colación lo subrayado por el ICAA en su informe, en lo conducente: “El 21 de setiembre de 2022, vuelve a presentar la solitud de disponibilidad como se demuestra en los folios 62 y 63 del expediente administrativo y su resolución en los folios del 68 al 69, la nueva gestión se inicia de nuevo con el numero SIGDD- 2022- 00020625, se informa, que, en esta ocasión, la oficina cantonal recibió colaboración para la resolución de disponibilidades en donde en esta ocasión resolvieran de manera positiva sin tomar en cuenta que la servidumbre era agrícola y todo lo que implica este caso.
Ya que hasta ese momento no había cambiado la situación que se presentaba desde la resolución anterior. Dicha resolución de disponibilidad positiva se hizo efectiva el 16 de noviembre del año 2023. Esta última resolución al quedar fuera de la gestión de la oficina cantonal de San Ramón, fue resulta por otras oficina colaboradoras fuera de la Dirección Región Central y se gestiona de forma positiva hacia el usuario directamente, con una resolución incorrecta, debido a que la condición inicial no tuvo ningún cambio y el acceso por servidumbre agrícola se mantuvo y a la fecha de este informe, no se evidencia colocación de infraestructura, por medio de alguna solicitud adicional o carta de Capacidad Hídrica que lo autorice”. Agrega: “La cantonal al recibir este trámite, se percata del error, y realiza la investigación, tomando en cuenta la evidencia pasada y valorando nuevamente, la condición de la solicitud si realmente había cambiado, las condiciones por la que fue negada la solicitud de Disponibilidad SIGDD-2022-00006761-1-1-1; Por tal motivo se responde a la señora [Nombre27 001], con el documento SG-GSP-RC-2024-00132 el 05 de marzo, explicando los argumentos del porque no se puede dar trámite a la solicitud del nuevo servicio”.
Ahora, esta Sala se ha pronunciado sobre el acceso al agua potable como un servicio que permite, a su vez, la realización y garantía de otros derechos fundamentales como a la calidad de vida y la salud (véase en similar sentido la sentencia No. 2017002404 de las 09:45 horas del 17 de febrero de 2017) pero también ha reconocido que cuando existen razones técnicas que imposibiliten, de forma absoluta, el suministro de agua potable, no se presenta una lesión a un derecho fundamental (véase en similar sentido la sentencia No. 07779-2019 de las 09:15 horas del 03 de mayo de 2019, entre otras). En el caso de marras, previo a que el ICAA emitiera la constancia de disponibilidad de agua potable positivo por error, ya había determinado que no resultaba congruente aprobar la solicitud de disponibilidad de agua potable y alcantarillado sanitario debido a que no se cuenta con la factibilidad técnica requerida para la aprobación de las solicitudes de disponibilidad ubicadas en el sistema CO-A-35-San Ramón.
Bajo esta óptica, si bien es importante señalar que este Tribunal no cuenta con la competencia para determinar si procede o no otorgar la disponibilidad de agua que pretende la accionante, pues esto obedece a criterios técnicos emitidos por las autoridades del ICAA, institución con la potestad normativa para realizar tales actos, en el sub examine sí se estima violentado el principio de confianza legítima de la amparada, así como el principio de seguridad jurídica y su derecho a obtener justicia pronta y cumplida, por lo que se impone acoger el recurso con las consecuencias que se detallan en la parte dispositiva. (…)
Del informe rendido bajo juramento por la autoridad recurrida, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que el Proyecto Condominio La Esperanza ubicado en localidad de Naranjo fue desarrollado mediante el Sistema Financiero Nacional para la Vivienda, con el objetivo de atender a 120 familias en situación de extrema necesidad, la cual esta solución habitacional está destinada a 95 mujeres jefas de hogar, 16 familias numerosas, 4 personas con discapacidad y 3 adultos mayores. El diseño contempló la construcción de aproximadamente 120 apartamentos distribuidos en 10 torres de tres niveles, cada una con 12 unidades habitacionales, además de áreas de juegos infantiles, cerramiento perimetral, aceras, calles asfaltadas, planta de tratamiento y servicios públicos.
Coopenae R.L. es la entidad autorizada encargada de la supervisión del proyecto y que la desarrolladora es Consultoría Mar Azul S.A. El proyecto cuenta con los permisos respectivos en materia geológica, ambiental y constructiva, así como con el cumplimiento de la normativa técnica nacional El 14 de abril del 2021, el señor Carlos Manuel Calvo Quesada, portador de la cédula de identidad n°CED03, en su calidad de representante legal de la persona jurídica Consultoría Mar Azul S.A, número de personería jurídica CED02, por medio de la boleta municipal n°170841, presentó en la plataforma de servicios de la Municipalidad de Naranjo, solicitud de disponibilidad de agua potable para 125 pajas de agua, en el terreno (finca) propiedad de su representada, folio real CED04, con plano A-2237210-2020, localizado en la provincia de Alajuela, cantón Naranjo, distrito San Miguel, Dirección05. En oficio DSPM-MN-DA-088-2021 del 21 de abril de 2021, el funcionario Chacón Agüero del Acueducto de la Municipalidad de Naranjo le indicó a la Consultoría Mar Azul S. A. cédula jurídica No. CED02, lo siguiente: “La solicitud de disponibilidad de agua ubicada en Naranjo, Dirección05, 500 metros sureste del puente sobre el río Pilas, propiedad inscrita en el Registro Nacional con número de finca 2-600010-000, GIS No. Telf02, con número de plano de catastro 2-2237210-2020, misma que se otorga de manera condicionada.
Al no existir frente al predio líneas de distribución de diámetros adecuados, ni contar la Municipalidad de Naranjo con documentación idónea de factibilidad para el desarrollo urbanístico de forma responsable, donde se garantice la dotación del servicio de agua potable de manera adecuada tanto para los abonados actuales como para los futuros. Así las cosas, se determina lo siguiente: Se otorga la disponibilidad de agua condicionada a la presentación de un estudio de factibilidad para la dotación del servicio de agua potable para llevar a cabo el proyecto de 125 pajas de agua domiciliarias de 12.5. mm), donde se deberán incluir factores como balance hídrico, dotación, topografía, diseño, protección de crecimiento poblacional y demás aspectos necesarios para el desarrollo urbanístico, el proyecto a desarrollar, formaría para del sistema de acueducto de Naranjo Centro. Estudio que deberá de ser debidamente aprobado por parte de la Municipalidad de Naranjo.
Se deberá de realizar las obras de infraestructura indicada en el estudio solicitado. Para el tema de hidrantes deberá de realizar la consulta a ingeniería de hidrantes de Bomberos de Costa Rica, ente regulador y fiscalizador en este tema, para la inclusión en el diseño. Deberán de cumplir con la normativa vigente del A y A para el diseño de las líneas de distribución según lo índice que estudio de factibilidad solicitado”. Posteriormente, en oficio MN-DAM-0175- 022 del 21 de junio del 2022, el Alcalde de la Municipalidad de Naranjo en relación al proyecto de 125 pajas de agua domiciliarias, en el terreno (finca) folio real 2-600010- 000, plano A-2237210-2020, localizado en la provincia de Alajuela, cantón Naranjo, distrito San Miguel, Dirección05, a favor de Consultoría Mar Azul S.A. determinó: “(…) “La solicitud de disponibilidad de agua en la propiedad ubicada en Naranjo, Dirección05 , Dirección07, propiedad inscrita en el Registro Nacional con el número de folio real 2-600010-000, GIS #02-008-003- 02, con número de plano de catastro A-2237210-2022, misma que califica se concede de manera conforme.
Así las cosas, se determina lo siguiente: • Se otorga la disponibilidad de agua para llevar a cabo el proyecto de 125 pajas de agua domiciliarias de 1/2” (12.5mm). • Se prohíbe el uso para otro fin no especificado. La Municipalidad de Naranjo queda facultada para dar tiempo de respuesta necesario a la solicitud de instalación. Esta certificación tiene validez un año calendario a partir de la fecha de emisión.”. En virtud de lo anterior, el 12 de julio del 2022, según la Plataforma Administradora de Proyectos de Construcción (APC) del Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA)-expediente digital; Consultoría Mar Azul S.A. en calidad de propietario registral del terreno (finca) folio real 2-600010-000, plano A-2237210-2020, localizado en la provincia de Alajuela, cantón Naranjo, distrito San Miguel, Dirección05 presentó el oficio MN-DAM-0175-2022, suscrito por el Alcalde de la Municipalidad de Naranjo, como parte de la documentación con la que se solicitó el permiso de construcción para la obra condominio, en dicho terreno, el cual fue autorizado.
Posteriormente, el 13 de febrero del 2023, el señor Allan Calvo Muñoz, representante legal de Consultoría Mar Azul S.A., por medio del oficio DT-YE-019-2023, solicitó al Departamento de Acueducto Municipal la “…renovación del oficio MN-DAM-0175 2022 correspondiente a la disponibilidad de 125 pajas de agua para el proyecto de interés social Condominio Vertical La Esperanza, otorgado en la fecha 21 de junio del 2022,en la propiedad con plano catastro 2-9207-2022 y finca con folio real 2- 600010-000…” En oficio MN-ALC-3924-2023 del 14 de febrero de 2023, el Alcalde de la Municipalidad de Naranjo informó a la Consultoría Mar Azul S.A. Cédula No: CED02, en lo que interesa: “En este documento hago constar la resolución a la solicitud realizada por su persona de Disponibilidad de Agua. De acuerdo al reglamento para la operación y Administración del Acueducto de la Municipalidad de Naranjo, se emite el siguiente reporte.
La Solicitud de disponibilidad de agua en la propiedad ubicada en Naranjo, Dirección05, Dirección07, Propiedad inscrita en el registro Nacional con el Número de finca 2-600010-000, Gis N°02-008-003-02, con número de plano catastro 2-9207-2022, misma que califica se concede de manera conforme. Así las cosas, se determina lo siguiente: • Se otorga la disponibilidad de agua para llevar a cabo el proyecto de 125 pajas de agua domiciliarias de ½” (12.5mm) cada una. • Se prohíbe el uso para otro fin no especificado. La Municipalidad de Naranjo queda facultada para dar tiempo de respuesta necesario a la solicitud de instalación. Esta Certificación tiene validez un año calendario a partir de la fecha de emisión”.
Posteriormente, en oficio MN-ALCDAM- OF-168-2025 del 3 de julio de 2025, el Coordinador del Departamento de Acueducto, Gerardo Chacón Agüero, comunicó al ingeniero director de obra que Consultoría Mar Azul S.Nombre24. no tiene autorización para realizar la solicitud de interconexión. El 18 de julio de 2025, la desarrolladora volvió a presentar la solicitud de interconexión, esta vez adjuntando las autorizaciones pertinentes por parte del Banco Improsa S.A., en calidad de propietario registral del terreno y fiduciario. En oficio MN-ALC-DAM-OF-188-2025 del 29 de julio de 2025, el Gerardo Chacón Agüero del Departamento Acueducto de la Municipalidad de Naranjo le informó a la Representante Legal Consultoría Mar Azul S.A. que en relación Atención boleta municipal n°236944. Solicitud de Interconexión del Proyecto Condominio Residencial Vertical “La Esperanza”, en lo que interesa: “(…) QUINTO. Que como resultado del análisis técnico efectuado al estudio “Diseño de Interconexión Condominio Vertical La Esperanza-Dirección02 Acueducto Municipal de Naranjo”, aportado por Consultoría Mar Azul S.A., en relación con el estudio técnico y especializado denominado: “DISEÑO DE LA RED DE DISTRIBUCIÓN Y CONDUCCIÓN DE AGUA POTABLE EN LOS SECTORES DE Dirección03 EN NARANJO CENTRO”, contratado por la Municipalidad de Naranjo, según procedimiento contractual 2024LD-000004-0023200001, se concluye que: Con las condiciones de crecimiento poblacionales típico, el Acueducto Municipal cuenta con el recurso hídrico para abastecer a la actual población usuaria (específicamente del subsistema de Naranjo Centro-Casco Central y sectores San Francisco, Dirección02, La Radial, El Águila), a una proyección de diseño de 25 años, lo que resulta acorde con la Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial, punto 4.2.5 “Tubería de conducción”, del Instituto Costarricense de Acueductos y Alcantarillado, el cual establece como obligación para líneas de tubería de conducción de agua tratada, el periodo es de 25 años.
Lo anterior técnicamente implica que el servicio de agua potable, debe poder ofrecerse a una proyección de crecimiento poblacional a 25 años, sin presentarse déficit hídrico. Sin embargo, ambos estudios técnicos, de manera transparente también revelan que al realizarse el ejercicio matemático, valorando la interconexión del proyecto condominio residencial vertical La Esperanza, para brindarle el servicio de agua potable, a través del Acueducto Municipal, la memoria de cálculo hidráulico demuestra que se generaría déficit hídrico a partir del año 2034, es decir, 09 años después de la eventual conexión en el presente año 2025, acortando así el periodo de diseño en aproximadamente un 64%, tal y como se demuestra en el punto “4.5 Balance Hídrico. Tabla 4-6 Balance Hídrico Acueducto Naranjo”. Lo que afectaría aproximadamente a 11864 mil personas usuarias, vecinas de Alto El Sitio, San Francisco, Dirección02, Candelaria y Casco Central (abonados actuales del sistema de acueducto municipal), quienes son abastecidas con el sistema de acueducto municipal de Naranjo Centro, que a su vez, sería el mismo que tendría que dotar de agua potable al proyecto de condominio.
SEXTO. Que ante ese panorama objetivo, sustentado en los 2 estudios técnicos y especializados antes referenciados, la Alcaldía Municipal en el escrito de presentación del proceso de lesividad ante el Tribunal Contencioso Administrativo y Civil de Hacienda, con motivo de la declaratoria de lesividad del Acto Administrativo-Oficio MN-DAM-0175-2022, del 21 de junio de 2022, suscrito por el ex Alcalde, señor Juan Luis Chaves Vargas, por medio del cual la Municipalidad de Naranjo, como es de su conocimiento, le otorgó a su representada la disponibilidad de agua potable, para el proyecto de 125 pajas de agua, en el bien inmueble matrícula , planteó solicitud de medida cautelar. Nombre28. Que a la fecha del presente oficio, la Municipalidad de Naranjo está a la espera de la resolución del requerimiento, lo cual, en principio y oportunamente debe ser notificado por el Tribunal a las partes procesales intervinientes; en ese sentido, con instrucción de la Alcaldía Municipal se informa que la solicitud de interconexión contenida en la boleta municipal n°236944, que la misma queda sujeta a la resolución judicial correspondiente, resolución que será atendida por la Municipalidad de Naranjo, como en derecho corresponda. Nombre26. Que así las cosas y para lo que corresponda, se comunica que el número de expediente judicial asignado, por el Tribunal al caso de marras es: 25-004998-1027-CA”.
Nótese que en el presente caso, en oficio DSPM-MN-DA-088-2021 del 21 de abril de 2021, el funcionario Chacón Agüero del Acueducto de la Municipalidad de Naranjo y en los oficios de MN-DAM-0175- 022 del 21 de junio del 2022 y MN-ALC-3924-2023 del 14 de febrero de 2023, el Alcalde de la Municipalidad de Naranjo emitieron la disponibilidad de agua para llevar a cabo el proyecto de 125 pajas de agua domiciliarias en relación al proyecto de 125 pajas de agua domiciliarias, en el terreno (finca) folio real 2-600010- 000, plano A-2237210-2020, localizado en la provincia de Alajuela, cantón Naranjo, distrito San Miguel, Dirección05, a favor de Consultoría Mar Azul S.A. En virtud de lo anterior y la jurisprudencia supra citada, la negativa de la corporación municipal recurrida de realizar o rechazar la interconexión del servicio de agua en el proyecto en cuestión, provocó una lesión al derecho humano al agua, al principio de confianza legítima y seguridad jurídica en perjuicio de la parte recurrente, pues, justamente, en tres diferentes oportunidades, la corporación municipal otorgó desde el 2021 la disponibilidad de agua a un proyecto de interés social y no le corresponde al administrado soportar el abrupto cambio de criterio de la administración municipal recurrida cuando la obra está construida.
Por lo demás, todo lo referente al proceso de lesividad tramitado bajo expediente 25-004998-1027-CA donde se pretende la nulidad del Acto Administrativo-Oficio MN-DAM-0175-2022, del 21 de junio de 2022 por medio del cual la Municipalidad de Naranjo otorgó la disponibilidad de agua potable, constituye un tema de legalidad sobre el cual esta Sala omite pronunciamiento alguno. En consecuencia, corresponde acoger este amparo en los términos que se dirán en la parte dispositiva de este pronunciamiento.
VIII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se le ordena a Randall Vega Blanco, en su calidad de Alcalde de la Municipalidad de Naranjo, o a quien ocupe ese cargo, que gire las órdenes pertinentes y disponga lo necesario dentro del ámbito de sus competencias, para que, en el plazo máximo de QUINCE DÍAS, contados a partir de la notificación de este pronunciamiento, ejecute las medidas que correspondan para dotar del servicio de agua potable Al Condominio Residencial Vertical La Esperanza. Se advierte a la autoridad recurrida que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Naranjo al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la jurisdicción contencioso-administrativa. Notifíquese.
