Document Review Decision No. 2025030966 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty-five a.m. on September twenty-six, two thousand twenty-five.

Amparo proceeding (recurso de amparo) filed by Nombre01, identity card CED05, and Nombre02, identity card CED06, against the ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO.

Findings of Fact:

  1. 1By a filing submitted to the Office of the Clerk of this Chamber at 17:58 on July 27, 2025, the petitioners filed an amparo proceeding against the ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO. They state: “FIRST: We, the petitioners herein, acquired in good faith and under lawful title three lots in the community of Palmitos de Naranjo, which were purchased separately and are not part of any development or joint undertaking among the current owners. SECOND: From the time of acquisition, the procedures to obtain potable water service from the ASADA de Palmitos de Naranjo were initiated. All documentation required by the regulations was submitted, and the applicable administrative requirements were met. Nevertheless, the ASADA persists in denying the right to a connection without valid technical justification. The Administrative Board, however, has clearly stated that the problem concerns those lots and that water is provided to anyone else except the owners of those lots.THIRD: Notwithstanding the foregoing, the ASADA has repeatedly denied the service connection based on events involving previous owners and on a case file from the year two thousand eighteen, to which we have no legal or administrative connection. FOURTH: That denial has been applied only to the lots belonging to the petitioners herein. By contrast, other legal entities, including a company directly linked to the president of the ASADA, obtained a connection on the same day that the petitioners herein were denied one. FIFTH: Access was requested to the case file cited by the ASADA as grounds for denying the service, but it was provided in incomplete form, with numerous pages omitted, including page 62, which purportedly contains the revocation of the right to a connection. The ASADA justified the omission by alleging ‘confidential information,’ which violates the principle of administrative transparency (principio de publicidad administrativa).SIXTH: The ASADA administrator has verbally stated that the right to a connection will be revoked without prior proceedings, a written decision, or technical grounds. These statements are recorded in a digital recording submitted as evidence, in which that intention is expressed at eight hours and thirty minutes. SEVENTH: These actions seriously violate the rights to due process (debido proceso), a defense, equality, and access to water as an essential human right. They also demonstrate discriminatory and arbitrary administrative conduct involving a potential conflict of interest.” (sic). They add that, by email, on May 22, 2025, they requested the “list of water taps (potable water connections) provided by that ASADA, indicating their general location or installation address, during the period from January 2020 to May 2025,” a request referring solely to information of a public nature, since it seeks to obtain personal or sensitive data protected by Ley 8968.They contend that, on June 06, 2025, the respondent informed them that, before responding, they must clarify the legitimate interest they have under the law in requesting the indicated information because, according to the respondent’s records, they are neither users of the water-supply system nor members, pursuant to Article 100 of the Reglamento de Asadas, decree number 42582-S-MINAE. They were further informed that this provision “is a special provision that prevails over any other regulatory provision conflicting with it and, accordingly, it is improper for any citizen without a legitimate interest to request information from a private organization, even if it is intended to provide a public service.” (sic). Based on the allegations set forth, they consider that the challenged actions are violating fundamental rights. They request that the petition be granted with the consequences prescribed by law.In addition, the respondent authority shall report whether the email address to which the petitioning party sent the information request is designated as an official channel for receiving submissions from users.
  2. 2By decision issued at 14:25 on August 20, 2025, the present amparo proceeding was admitted for processing, and notice thereof was served on JOSÉ MANUEL DEL CARMEN QUIROS CHINCHILLA, identity card CED07, in his capacity as president and judicial and extrajudicial representative, vested with the powers of an unrestricted general attorney-in-fact without monetary limitation, of the ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO (see electronic record).
  3. 3JOSÉ MANUEL QUIRÓS CHINCHILLA, in his capacity as president, vested with the powers of an unrestricted General Attorney-in-Fact without monetary limitation, of the ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO (see electronic record), responds to the hearing as follows: “It is important to emphasize that all ASADAS are required to conduct an Assessment Study to determine the water-resource and hydraulic capacity of the potable water supply system administered by the ASADA. This study is based on Article 44 of the REGULATIONS GOVERNING ASSOCIATIONS THAT ADMINISTER COMMUNITY WATER-SUPPLY AND SEWERAGE SYSTEMS, which, insofar as relevant, provides:

“Article 44. Technical Study of potable water and wastewater sanitation systems. ASADAS shall maintain a current study determining the water-resource and hydraulic capacity of the system they administer. For these purposes, the following provisions shall be observed: a. Performance of Technical Studies: The technical studies of these systems shall be performed by the ASADA with the technical support of a responsible professional duly admitted to the Professional Association for the respective field. b. Responsibility for the Technical Study: The ASADA and the responsible professional share responsibility for ensuring the proper application of the technical regulations, policies, and guidelines issued by AyA, which are mandatory both in carrying out the study and in designing and constructing the resulting works…” TECHNICAL STUDIES OF THE WATER BALANCE OF OUR WATER-SUPPLY SYSTEM. In our case, there is a study from 2018 approved by A y A, another study from 2020, and, recently, we have conducted a new Water Balance analysis. All analyses performed concern the water resources available to our water-supply system and are attached to this response.

OUR WATER-SUPPLY SYSTEM HAS A FLOW-RATE DEFICIT. According to the aforementioned studies, a significant deficit had been projected since 2018 unless new sources were obtained. According to the 2025 study, the maximum available water flow rate is only 10.20 liters per second, while 14.37 liters per second are currently required; consequently, with each passing year, we are experiencing a significant deficit (see Table 17, page 42, 2025 Water Balance study). It is important to clarify that we are making an effort to incorporate new sources to increase the available flow rate. As a result, the deficit began to become apparent in 2019 and has obviously continued to grow.

The studies cited show that our water-supply system has a water deficit; therefore, it is currently impossible to grant any further service-availability approvals until new water intakes (captaciones) are added to our water-supply system.

Indeed, by official letter number GSD-UEN-GAR-2021-04822 from Eng. Giovanni García Flores, head of the UEN Gestión de Acueductos Rurales, we were expressly informed as follows:

“In response to the inquiry submitted by you in official letter APCALNAR-CE-ADM-15-2021 concerning the scope of the recommendations issued in our Memorandum N°GSD-UEN-GAR-2021-0095, we hereby clarify that, due to the limited water-resource capacity of the water-supply system administered by the Asada de Palmitos de Naranjo, we do not recommend approving water applications for new developments or for homes requiring extensions of the currently existing distribution network until new supply sources are available. This recommendation is based on the results of the technical study prepared in March 2020 by Eng. Gustavo Adolfo Chacón Aguilar, the report submitted by you having been reviewed and approved by our office…” As the entity administering the public potable water supply service, we are required to issue certificates of service availability and certificates of water-resource capacity; however, such actions may be taken only when permitted by the water-resource balance and analysis.

The regulations clearly provide that such certificates are issued when technically feasible. In view of the foregoing and according to the attached study, the water-supply system is technically incapable of providing any service in that area. We are not authorized to provide services when the system’s capacity is in a critical condition or when the provision of new services would clearly be detrimental to other users; for that purpose, a technical opinion from Acueductos y Alcantarillados is required.

Our ASADA is required to ensure the continued application of the fundamental principles of public service, namely continuity, efficiency, adaptability, and equal treatment of users. To safeguard those principles, the regulations impose a series of mandatory obligations upon us, including the obligation to provide water service to anyone who requests it after fulfilling the established requirements, which must logically be reasonable and capable of fulfillment.

We consider it lawful to deny service where there is a technical impossibility or technical feasibility analysis (análisis de factibilidad técnica), as in this case, pursuant to Article 14 of the current Reglamento para la Prestación de los Servicios del A y A, in relation to Articles 7.49 and 7.12 of the cited regulations, which address technical feasibility as follows:

“7.12. Technical feasibility analysis for the provision of services: The process of verifying the real and current existence of sufficient water, hydraulic, material, technical, legal, and environmental resources to grant service availability and an eventual service connection. For these purposes, the following conditions shall be observed: a. The distribution and collection networks must run along the boundaries of the property, or there must be direct access by public road or a right-of-way easement (servidumbre de paso) serving the property for which service is requested. b. The systems must have sufficient water-resource, hydraulic, purification, and treatment capacity to provide new services. c. The system must meet the established quality standards. d. It must comply with the applicable environmental regulations.” In general, a service-availability certification is granted when the works and overall infrastructure required, as well as the water-supply capacity needed to meet the service requirements of a given population, actually and currently exist, rather than being future or potential. Article 14 of the aforementioned regulations requires any service provider to supply drinking water when:

Article 14—Conditions for the provision of services. AyA shall provide its services once technical feasibility (factibilidad técnica) has been verified for developed or undeveloped properties intended for residential, commercial, or industrial activities that meet the requirements and permitted uses set forth in these regulations …” REGARDING THE TECHNICAL STUDY IN THE CASE OF LOT SUBDIVISIONS The other important aspect applicable to this case is the duty to comply with the legislation established in the Reglamento Prestación de Servicios A y A, Articles 14 and 39, and pursuant to Article 44 of the Reglamento de ASADAS; consequently, the following provision applies:

“Studies for residential developments, lot subdivisions, segregations, or condominiums: For the development of residential developments, lot subdivisions (lotificaciones), segregations (segregaciones), or condominiums, the ASADA is responsible for ensuring that the corresponding diagnostic studies are performed. The interested party shall bear the costs thereof, but shall not conduct them, as their performance shall always fall within the authority of the Association. If the diagnostic study determines that a project to improve, expand, or modernize the system is required, the interested party shall be responsible for preparing the final designs and construction plans, as well as constructing the works previously approved by AyA, whenever the flow rates are modified. All of the foregoing shall be subject to the ASADA’s ongoing supervision, without prejudice to the Institution’s oversight powers…” Thus, several years ago, the interested parties concerning the aforementioned lots, including the appellants, were informed that, to obtain a drinking-water service-availability certification, they would have to pay for a Technical Study assessing the water-resource and hydraulic requirements (necesidades Hídricas e Hidráulicas) for supplying water to that particular project and clearly specifying the requirements and works to be constructed, the cost of which would also be borne by the interested parties.

In summary, a technical study is required, which the interested parties must pay for, while the ASADA must select the company or professional who will perform the analysis. In our case, because the ASADA lacks sufficient water-supply capacity, the interested parties would be responsible for remedying that deficiency by providing the water source that will supply drinking water to the current and future population of that lot subdivision. The ASADA would be responsible for hiring the professional to conduct the Technical Study and verifying that the professional is duly registered with the CFIA. Once that Study has been completed, it will be sent to AyA for the corresponding review and ratification.

Furthermore, in the most recent Water Balance Study (Estudio de Balance Hídrico), the professional responsible for it clearly made the following recommendation:

“Maintain strict controls over residential developments, lot subdivisions, or projects requiring high peak flow rates. Before issuing a drinking-water availability letter, it is extremely important for the ASADA to impose the corresponding regulations so that, before undertaking the project, each developer conducts a technical study that includes a system assessment and proposes the improvements required to supply the project. The foregoing must adhere to the aqueduct’s actual design parameters. Said study must be reviewed and approved by the aqueduct’s Board of Directors and AyA. All residential developments and similar projects must comply with the technical and legal legislation currently in force…” HISTORY OF A LOT SUBDIVISION The appellants portray themselves merely as purchasers of two individual parcels. However, they have been informed on several occasions that those properties form part of a lot subdivision created in 2019, whose former owners refused to conduct the corresponding technical study. For that reason, the case file concerning this lot subdivision is submitted; it establishes that both appellants’ parcels originated from a subdivision (fraccionamiento) carried out several years ago and that their former owners refused to conduct the corresponding technical study.

The fact that the appellants were unaware of the history of the parcels they acquired does not require the ASADA to treat the matter as an ordinary-growth application or as an application unrelated to the aforementioned lot subdivision. The law prohibits abuse of rights (abuso del derecho). This is not the first instance in which lot subdivisions or subdivisions have been created without meeting the requirements for granting water-availability certifications, after which the original owner sells the lots and the new owners immediately submit individual availability applications, claiming ignorance of the history. Accepting the foregoing would circumvent the existing regulations.

There is no legal provision allowing drinking-water service operators to dispense with the technical study in cases where lots resulting from a lot subdivision have been transferred.

REGARDING THE FACTS OF THE APPLICATION RESPONSE: Because the lots are not identified, and because the documents accessible through the online filing system do not include land-registry certificates or cadastral plans (planos catastrados), the response must be negative. Despite the omission of the lot identifications, according to our records and public land-registry information, the appellants own the following properties in Palmitos de Naranjo, under the following registrations: Nombre01 owns registration , with an area of 619 square meters, and Nombre03 owns registration , with an area of 667 meters. It is no coincidence that the registrations differ only in their final number, because both lots resulted from a consolidation and subdivision that produced 9 lots bearing the following identifications: , , , , , , according to the document submitted to the Registry under volume 2019-752811.

The corresponding deed is attached to this response, together with the land-registry studies, the property history, and the ASADA case file. It is untrue that these lots do not form part of a “residential development”; it was not a residential development but rather a lot subdivision, which has a different meaning from an urban-planning perspective. The applications submitted by the appellants sought service availability for the properties registered in Alajuela under numbers: and . Both properties form part of the lot subdivision created in 2019, as explained above (see land-registry studies). Pages 20 through 24 of the submitted case file contain 5 of the plans obtained by the registered owners through the segregation. These documents establish that the 5 lots are contiguous and that the adjoining landowners are Nombre04 and Nombre05, who owned the parcels and carried out the lot subdivision.

From the outset, the persons who carried out the lot subdivision were informed that they had to conduct the technical study; however, they never did so. Consequently, both of these properties are within a lot subdivision comprising nine properties or lots, and, for a subdivision of this nature, this ASADA must comply with the legislation currently in force, which entails compliance with the rules governing lot subdivisions and the requirement to conduct a technical study.

SECOND FACT RESPONSE: The statements made regarding this fact are untrue. It is true that the interested parties have made certain filings, as shown in the attached case file. The availability application was denied for technical reasons. First, several years ago, the interested parties were informed of the need to conduct the corresponding technical study, which they have consistently refused to do. Second, under the current conditions of our aqueduct, we are experiencing a significant water-production deficit. One of the attached Water Balance Studies states verbatim:

“With the appropriate technical and conservation measures, the total available water resource is practically exhausted. The search for, concession of, and interconnection with new water sources is a priority…” (see 2020 Water Balance Study, page 32).

Another part of the study also states:

“Based on the estimates made, it is not currently possible to supply applications relating to real-estate development…” This Water Balance Study already includes a reference to the lot subdivision encompassing the appellants’ parcels. Page 28 states as follows:

5.1.4 Residential developments.

According to the statements made by those responsible for the aqueduct, the following significant pending applications for water availability relating to real-estate development exist:

Nombre06. 40 connections.

Inversiones Familia Herrera Muñoz S.A: 70 users.

Nombre07: 8 planned connections Nombre05 and Nombre04: 40 housing units.

Total applications: 158.

The reference to Nombre05 and Nombre04 concerns the owners who carried out the lot subdivision and subsequently sold the lots. It bears repeating that the appellants’ parcels are located within that lot subdivision, which was created in 2019.

The final assertion that the Board stated that drinking-water service would never be provided to those lots is entirely false.

THIRD FACT RESPONSE: The statement concerning the denial of the submitted applications is true. It is also true that one of the grounds for denial is that the parcels form part of a lot subdivision whose owners refused to conduct the corresponding technical study. However, the other circumstance concerns the critical flow-rate deficit affecting the supply to our aqueduct. The subjective disconnection that the appellants allege between themselves and the lot subdivision that produced the lots does not entitle them to disregard the omissions of their former owners. The requirements governing water-resource availability and compliance with the applicable legislation do not distinguish between former and current owners. Water availability does not relate to persons; water-resource availability relates to land and, above all, to the service operator’s actual and current water-resource and hydraulic capacity.

FOURTH FACT RESPONSE: This is untrue; no preference exists in the granting of availability certifications. The reasons why availability was denied have been explained at length. Regarding the assertion that availability was granted to a company affiliated with the president, I clarify that, despite the current situation, the ASADA continues to grant availability certifications for ordinary, organic, or maximum growth, as authorized by law. The issue with the appellants’ parcels is that they form part of a lot subdivision.

FIFTH FACT:

RESPONSE: That is true; this is due to the Law on the Protection of Individuals with Regard to the Processing of Their Personal Data, number 8968, which concerns sensitive data (datos sensibles), personal data (datos personales), or restricted-access data (datos de acceso restringido). It is clear that although the ASADAS are private associations incorporated under Ley N° 218 and its regulations, they serve a public purpose and are therefore subject to the rules governing the provision of the public service (servicio público) they perform; they must provide the information requested of them, provided that doing so does not violate the confidentiality of the information. Accordingly, when providing the requested data, personal data must be protected. The omitted information relates to identification numbers and information that was not relevant to the appellants. The ASADA was required to conduct an analysis to determine which information was public and which was sensitive and restricted, hence the absence of certain pages.

SIXTH FACT RESPONSE: I do not know what the appellant is referring to, and therefore deny it. Without prejudice to the foregoing, it is evident that the recording submitted is entirely unlawful, as the administrator herself confirmed to me; they never asked her permission to record her voice. Furthermore, I am unaware of any statements or interpretations that the former administrator may have made regarding this matter. In any event, it is the Board of Directors that makes decisions in any organization of this nature, not the administrator. Notwithstanding the foregoing, the administrator was referring to the situation in which availability to build was granted but the owner did not build within the one-year period specified by the regulations; this inevitably results in revocation of the availability without further proceedings. That is what the administrator was referring to.

SEVENTH FACT RESPONSE: The assertions in this fact are not mere assessments, opinions, or conjecture lacking any factual basis, and therefore I deny them. Once again, these statements harm the honor of our Board of Directors insofar as assumptions are made without any evidence substantiating such conduct.

TECHNICAL REASONS FOR DENYING THE SERVICE. It is not true that the Asociación Administradora that I represent unjustifiably denied service to the appellants. First, the lots are located in a subdivision development (lotificación); they never agreed to have the technical study conducted, and there is a technical impossibility: there is an insufficient supply of water resources. Consequently, our ASADA grants availability only for so-called ordinary, vegetative, or maximum growth, as provided by the relevant definition in the Reglamento para la Prestación de los Servicios del A Y A, compliance with which is mandatory in our case.

“129. Maximum growth zone (Zona de crecimiento máximo): Geographic area within a supply-deficient zone where the public-service provider authorizes the issuance of positive service-availability certificates (constancias de disponibilidad de servicios) or water-capacity certificates (constancias de capacidad hídrica), as applicable, for any of the following cases: a) Individual single-family dwelling; b) Individual commercial establishment. The following cases only when new flows exist that optimize the water and hydraulic capacity of the respective zone and the ‘Percentage-Based Flow Allocation Methodology’ established by the UEN de Optimización de Sistemas GAM and the UEN de Optimización de Sistemas Periféricos is applied: c) Real-estate developments, d) Social-interest housing projects, e) Community-oriented establishments and projects, and f) Government establishments and projects.

The Asociación that I represent must comply with the governing authority, and we are not empowered to disregard its guidelines, provisions, or the rules established in the Reglamento de Prestación de los Servicios de A Y A and the reglamento de Asadas. There is unquestionably a technical impediment to supplying water to the appellants’ lots, unless the governing authority determines otherwise or this Chamber orders the entity I represent to provide the service.

It is important to clarify that the party also did not avail itself of the ordinary remedies (recursos ordinarios) available in this matter to challenge the decisions of the entity I represent.

To conclude these responses, I partially transcribe a decision of the Sala Constitucional, which has long been inclined to hold as follows in similar cases:

RELATED DECISIONS OF THE SALA CONSTITUCIONAL. “This Court has held that associations administering water-supply and sewer systems, municipalities, and other institutions providing drinking-water service may validly deny such requests or impose conditions on them when technical or legal reasons justify doing so. Thus, in judgment n.°2016-006027 at 09:05 hours on May 6, 2016, this Chamber held as follows:

“ In judgment 2014-9134 at 14:05 hours on June 19, 2014, which addressed an issue very similar to the one raised in this appeal for constitutional protection (recurso de amparo), this Constitutional Court ruled: ‘(...) In repeated judgments on this subject, this Chamber has stated that the supply of drinking water is regarded under the Costa Rican legal system as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under equal conditions, and with adaptation to technological changes (see, in this regard, judgment 2001-09676 at eleven twenty-five hours on September twenty-six, two thousand one, and judgment 2004-08161 at ten fifty-three hours on July twenty-three, two thousand four). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public drinking-water service, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.

However, the case law of this Constitutional Court has also held that, where there is a legal impossibility (imposibilidad jurídica)—namely, failure to comply with requirements established in the applicable regulations—or a formal impossibility (imposibilidad formal)—namely, the absence of a Water Distribution Network—it is reasonable not to grant service requests or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be built. Thus, in these cases, it has been clear that this does not constitute a denial of access to drinking-water service, but rather an inability to provide it or the interested party’s necessary participation in remedying a technical impossibility, namely the lack of infrastructure. In other words, provided that the failure to supply drinking-water service is not capricious, arbitrary, or unfounded conduct, but is instead justified by a legal or physical impossibility, there is no violation of fundamental rights.

In this particular case, the evidence submitted and the report rendered under oath confirm that AyA did not arbitrarily deny the appellant’s request; rather, the request was denied because not all the technical and legal requirements set forth in the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services had been satisfied.” I reiterate to this honorable Sala Constitucional and also to the appellants that, pursuant to the legislation governing the ASADAS, for every subdivision (fraccionamiento) project, whether intended for social welfare purposes or the sale of lots, the interested party must request a Drinking-Water Service Availability Certificate (Constancia de Disponibilidad de servicio de Agua Potable) and attach the established requirements. Thereafter, the ASADA Board of Directors must respond with the appropriate technical and legal determination, evaluating current and actual capacities.

Consequently, because this is a subdivision-development, urban-development (…) project, a technical study conducted by a professional in the field and paid for by the interested party is required. That study determines the infrastructure improvements or works, contribution of a water source, and other measures in which investment must be made and which must be carried out to implement the project; it also evaluates the feasibility of future construction on the property in question. This means that no formal application for this subdivision development has been filed with the ASADA and, accordingly, no technical study exists either. Notwithstanding the foregoing, we once again advise the appellants that, if they wish to have the denial converted into a favorable decision, they must state in writing whether they agree to pay for a Technical Feasibility Study (Estudio Técnico de Factibilidad), which would be commissioned by the Asada and reviewed by AyA. (Reglamento de ASADAS article 44, subsection d).” He requests that the appeal be dismissed.

  1. 4By a decision issued at sixteen hundred hours on September five, two thousand twenty-five, the reporting justice requested, as EVIDENCE TO ASSIST IN RENDERING A DECISION, a report from JOSÉ MANUEL QUIRÓS CHINCHILLA, IN HIS CAPACITY AS PRESIDENT WITH POWERS OF GENERAL ATTORNEY-IN-FACT WITHOUT LIMITATION AS TO AMOUNT OF THE ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO, so that he could clarify what information contained in the minutes of the session held on April 01 of the current year, as well as in the case file in which the application for water service is being processed, is considered confidential (see electronic record).
  2. 5JOSÉ MANUEL QUIRÓS CHINCHILLA, in his capacity as president with powers of General Attorney-in-Fact without limitation as to amount of the ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO, responds to the hearing (see electronic record) in the following terms: “1.- BACKGROUND OF THE BOARD OF DIRECTORS’ SESSION AND ITS CONTENT. In response to the decision of September 5, 2025, I inform the honorable Sala Constitucional, within the prescribed period, that the content of the session of April 1, 2025, is similar to the official letter contained in the case file at pages 197 and 198. Specifically, the following was agreed at the session:

The foregoing was done in accordance with the parameters communicated by A Y A by email dated September 12, 2025, in which we were informed that personal or sensitive data could not be provided; from this, we understood that we should not attach copies of identity cards, powers of attorney, or similar documents. The aforementioned email is attached, clarifying that, based on the information provided by A y A, we understood that certain data should not be supplied because doing so could breach the confidentiality of the information. The information declared confidential or omitted relates to powers of attorney, identification numbers, identity cards, and information that was not relevant to the petitioners. I also detail below the pages of the case file that were not provided: pages 2 and 3, copies of identity cards; 14, copy of identity card CED01; 17 and 18, copies of identity cards CED02; 36, copy of identity card CED03; 51, copy of identity card CED04; 68, 69, 70, 71 AND 72, copies of an identity card, special power of attorney, and payment receipt; 88, copy of identity card; 92, copy of identity card; 104, copy of identity card; 116, copy of identity card; 124, copy of identity card; 143 and 144, copies of identity cards; 170, copy of identity card.

To prevent misunderstandings, I am attaching all the pages that were omitted and that, as will be seen, are not relevant to this matter. 2.- NEW DOCUMENT CONCERNING THE WATER-RESOURCE DEFICIT. In addition, in an attached file we are submitting a new opinion from A y A concerning the deficit affecting our aqueduct, in which it even recommends NOT APPROVING new services or renewing the currently valid water-availability certificates (constancias de disponibilidad). DOCUMENTS SUBMITTED. In summary, the following are attached: a copy of the April 1 board of directors’ meeting, images from the administrative case file showing the information that was not provided to the petitioners, and a document issued by A y A concerning the deficit affecting our aqueduct.”

  1. 6In a written submission filed with the Clerk’s Office of this Chamber at 21:40 hours on September 24, 2025, the petitioners state as follows: “I. PURPOSE OF THE SUBMISSION. In due time and proper form, we hereby submit observations, which were not requested from me, regarding the responses submitted by the respondent party (Nombre08 and its president, José Manuel Quirós Chinchilla), in compliance with the directive issued by this Honorable Court. The responses do not fully comply with what the Chamber requested, contain significant omissions, and include incomplete or subsequently issued documentation, thereby affecting our right of defense and the transparency of the proceedings. II. REGARDING THE IMPROPERLY ASSERTED CONFIDENTIALITY. The respondent justified the omission of entire pages by alleging that they contained copies of identity cards, powers of attorney, or other “confidential” documents.However: • The Chamber had requested an explanation of precisely what information was confidential and in which case file; that explanation was never provided. • On that pretext, entire pages and the requested minutes were omitted, for which there is no legal basis. III. NEWLY INTRODUCED ELEMENTS. A September 2025 report from AyA was submitted, advising against authorizing new services due to a water deficit. We note that: • This document postdates our initial application, which was submitted months earlier. • Seeking to apply it retroactively violates the principles of non-retroactivity and administrative good faith. • Our application met all requirements when it was submitted. IV. NECESSARY CLARIFICATION. The respondent party has repeatedly sought to portray this application as involving a residential development (urbanización). This is entirely incorrect. Our request concerns only two individual lots, acquired in good faith by their current owners, with no legal relationship to former owners or prior urban developments.V. CONDUCT OF THE RESPONDENT PARTY. The repeated failure to comply with the directive, the omission of key documents, the incomplete pagination, and the use of subsequently issued information reveal conduct that undermines administrative transparency. Such acts may constitute disobedience of the orders issued by this Constitutional Chamber, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. VI. RELIEF REQUESTED. In view of the foregoing, we respectfully request that this Honorable Chamber: 1. Deem these observations duly submitted. 2. Declare that the respondent party has not adequately complied with the directive issued. 3. Reiterate the order requiring submission of the complete, paginated, and certified case file, specifically including the minutes of the April 1, 2025 meeting. 4. Reject the retroactive application of the September 2025 AyA report because it postdates the original application. 5.Take into consideration that the application concerns only two lots and not a residential development. 6. Assess whether the respondents may have disobeyed this Court’s orders” (see electronic record).
  2. 7The statutory requirements have been observed in the proceedings conducted.

Justice Cruz Castro drafts the opinion; and,

Considering:

I. PRELIMINARY MATTER

Pursuant to Article 57 of the Ley de la Jurisdicción Constitucional, an amparo proceeding (recurso de amparo) against the acts or omissions of private-law entities is admissible when such entities act or are required to act in the exercise of public functions or powers, or when, as a matter of law or fact, they occupy a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely for guaranteeing the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In the present case, this Chamber finds the amparo proceeding admissible because the respondent ASADA, although a private-law entity, provides a public service.

II. SUBJECT MATTER OF THE PROCEEDING

The petitioners allege that the respondent Asada denied them water service without any justification. They add that they requested a copy of the case file but received only a partial copy on the ground that it contained “confidential information.”

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent authority failed to address them:

  • a)The petitioners are the registered owners of the following properties in the locality of Palmitos de Naranjo, under the following registry numbers: Nombre01 owns the property registered under , with an area of 619 square meters, and Nombre03 owns the property registered under , with an area of 667 meters (see report of the respondent authority).
  • b)The Palmitos de Naranjo aqueduct is experiencing a water deficit (see report of the respondent authority).
  • c)In official letter number GSD-UEN-GAR-2021-04822, signed by Eng. Giovanni García Flores, head of the UEN Gestión de Acueductos Rurales, the following was stated: “In response to the inquiry submitted in your official letter APCALNAR-CE-ADM-15-2021 concerning the scope of the recommendations issued in our Memorandum N°GSD-UEN-GAR-2021-0095, we wish to clarify that, due to the limited water capacity of the aqueduct administered by the Asada de Palmitos de Naranjo, we do not recommend approving water applications for new developments or homes requiring extensions of the existing distribution network until new supply sources are available. This recommendation is based on the results of the technical study prepared in March 2020 by Eng. Gustavo Adolfo Chacón Aguilar, the report submitted by you having been reviewed and approved by our office…” (see report of the respondent authority).
  • d)The persons interested in the lots—including the petitioners—were informed that, to obtain a drinking-water service-availability certificate (constancia de disponibilidad de servicio de agua potable), they would have to pay for a technical study (Estudio Técnico) assessing the water-supply and hydraulic needs for providing water to that particular project, clearly specifying the requirements and the works to be constructed, the costs of which would likewise be borne by the interested parties (see report of the respondent authority).
  • e)The respondent authority explained to the petitioners that the acquired properties form part of a lot subdivision (lotificación) created in 2019 and that the former owners had refused to undertake the corresponding technical study (see report of the respondent authority).
  • f)The petitioner was provided with a partial copy of the ASADA case file (see report of the respondent authority).
  • g)The petitioners were not provided with pages 2, 3, 14, 15, 16, 17, 18, 25, 26, 36, 42, 43, 51, 55, 56, 57, 68, 69, 70, 71, 72, 88, 92, 104, 116, 124, 1143, 144 and 170—pages containing identity cards and special powers of attorney (see report of the respondent authority).
  • h)On May 22, 2025, by official letters E-0001-05-2025 and E-0002-05-2025, the petitioners sent an email requesting the following information: “a list of the service connections (pajas) (drinking-water connections) provided by that ASADA, indicating their general location or installation address, during the period from January 2020 to May 2025” (see report of the respondent authority).
  • i)By official letter ACPALNAR-CE-JD-25-2025 dated June 06, 2025, the respondent authority replied to official letters E-0001-05-2025 and E-0002-05-2025 submitted by the petitioners, stating: “In accordance with Article 100 of the Reglamento de Asadas, before responding to the request made, you must clarify the legitimate interest that you possess under the law in requesting the information specified in your official letter. This is because, according to our records, you are neither a user of our aqueduct nor a member; however, the cited regulations permit persons with a legitimate interest to submit requests of this nature” (see electronic record).

IV. REGARDING THE SPECIFIC CASE

On repeated occasions, this Chamber has held that, although the fundamental right to water and access thereto under equal conditions is recognized because it is an essential service for life and health, this right does not entail unrestricted access to water, since the Administration may validly establish general conditions and requirements for accessing this service. Likewise, it is valid for the entities—whether public or private—that administer the service to reject applications for water service or for a water-availability letter (carta de disponibilidad de agua) when the interested party does not meet the requirements or when technical or legal reasons justify the rejection. Thus, for example, in judgment number 2016-006027 issued at 09:05 hours on May 6, 2016, this Chamber held as follows:

“This Constitutional Court, in judgment 2014-9134 at 14:05 hours on 19 de junio de 2014, which addressed an issue very similar to that raised in the present amparo proceeding (recurso), held: ‘(...) In repeated judgments on this matter, this Chamber has indicated that the supply of drinking water is considered a public service (servicio público) under the Costa Rican legal system (ordenamiento jurídico), and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under equal conditions, and in a manner that adapts to technological changes (see, in this regard, judgment 2001-09676 at once horas veinticinco minutos on veintiséis de setiembre del dos mil uno and judgment 2004-08161 at diez horas con cincuenta y tres minutos on veintitrés de julio del dos mil cuatro). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public drinking-water service, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.

Nevertheless, the case law (jurisprudencia) of this Constitutional Court has also indicated that, where there is legal impossibility (imposibilidad jurídica)—meaning failure to satisfy the requirements established in the applicable regulations—or formal impossibility (imposibilidad formal)—meaning the absence of a Water Distribution Network (Red de Distribución de Aguas)—it is reasonable not to grant service applications or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases, it has been made clear that this does not constitute a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in remedying a technical impossibility (imposibilidad técnica), namely, the lack of infrastructure. In other words, provided that the failure to supply drinking-water service is not capricious, arbitrary, or unfounded, but is instead justified by a legal or material impossibility (imposibilidad material), there is no violation of fundamental rights (derechos fundamentales).

In this particular case, the evidence submitted and the report rendered under oath confirm that AyA did not arbitrarily reject the application filed by the appellant, but did so because not all the technical and legal requirements imposed by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for the approval of new services had been satisfied.’” Those arguments are fully applicable to this particular case, in which the protected parties were denied a drinking-water availability letter (carta de disponibilidad de agua potable) for technical reasons, based, first, on the need for a prior technical study—which must be conducted by the interested parties—and, second, on the existence of a significant water-production deficit. Consequently, this Court finds that the respondent’s denial of water availability is based on a material impossibility and therefore does not constitute arbitrary conduct.

It should be noted, however, that whether the water service at issue should be provided, the relevance or accuracy of the technical grounds supporting the respondent’s decision, and whether the requirements imposed for the provision of the service are appropriate are not matters to be litigated in this jurisdiction, because they involve a dispute concerning ordinary legality (legalidad ordinaria) that falls outside this Chamber’s jurisdiction. Finally, regarding the alleged violation of the principles of equality and nondiscrimination (principio de igualdad y no discriminación), it should be emphasized that this Chamber has repeatedly held that it is not enough for an appellant merely to assert that two persons received different treatment in a given case in order to establish such a violation. On the contrary, the party alleging the violation must provide elements permitting a full comparison between the persons treated differently.

Nevertheless, given the essentially summary nature of amparo proceedings (proceso de amparo), it is clear that the comparator must be such that it is unnecessary first to analyze the affected party’s situation under ordinary legality. In this case, the appellants provide no additional evidence that would lead this Chamber to presume the alleged inequality, since merely asserting that the properties adjacent to theirs do have drinking-water service does not, per se, establish discrimination, because the provision of services depends not only on compliance with requirements and the number of users, but also on other technical and legal considerations. In any event, assessing whether the alleged inequality occurred would require this Chamber first to rule on a dispute involving mere legality; that is, it would have to examine each case individually in order to analyze technical studies, application dates, requirements, and the applicable regulations.

Such a task is not for this Chamber to undertake through amparo proceedings, as it properly belongs to the administration. Accordingly, the appellants must submit their objections or claims to the respondent authorities or through the competent judicial channel, where they may fully litigate the merits of the matter and assert their claims. The proceeding is therefore dismissed with respect to this issue.

V. REGARDING ACCESS TO THE CASE FILE (EXPEDIENTE)

It was established that the appellants were provided with a partial copy of the ASADA case file and that the following folios constitute the information that was not provided: folios 2, 3, 14, 15, 16, 17, 18, 25, 26, 36, 42, 43, 51, 55, 56, 57, 68, 69, 70, 71, 72, 88, 92, 104, 116, 124, 1143, 144 and 170—folios containing identity cards and special powers of attorney (poderes especiales). The respondent authority states: “This was done in accordance with the parameters communicated by A Y A via email dated 12 de setiembre de 2025, in which we were informed that personal or sensitive data could not be provided, and we interpreted this to mean that we should not attach copies of identity cards, powers of attorney, or similar documents.” In this regard, it is apparent that the information requested by the appellant constitutes public information (información pública), and therefore the refusal to provide copies of the identity cards and powers of attorney violates the petitioner’s fundamental rights. In view of the foregoing, because it has not been verified that the requested information was provided by the respondent authorities, the proceeding must be granted on the terms set forth in the operative portion (parte dispositiva) of this judgment.

VI. REGARDING THE FAILURE TO RESPOND TO THE OFFICIAL LETTERS SUBMITTED ON 22 DE MAYO DE 2025

With respect to this issue, it was established that on 22 de mayo de 2025, through official letters E-0001-05-2025 and E-0002-05-2025, the appellants sent an email requesting the following information: “a list of the water service connections (pajas) delivered by that ASADA, indicating their general location or installation address, during the period from enero de 2020 to mayo de 2025”; and that, through official letter ACPALNAR-CE-JD-25-2025 dated 06 de junio de 2025, the respondent authority answered official letters E-0001-05-2025 and E-0002-05-2025 submitted by the appellants, stating: “Pursuant to the provisions of article 100 of the Reglamento de Asadas, before responding to the request submitted, you must clarify the lawful legitimate interest (interés legítimo) that you possess in requesting the information specified in your official letter. This is because, according to our records, you are not a user of our water-supply system and are not a member; nevertheless, the cited regulations permit persons with a legitimate interest to submit requests of this nature.” In other words, the information requested by the appellants has not been provided.

This is because they are first required to demonstrate a legitimate interest in order to obtain access to the “list of the water service connections delivered by that ASADA, indicating their general location or installation address, during the period from enero de 2020 to mayo de 2025.” Based on the foregoing, the proceeding is well-founded with respect to this issue. This is because it is abundantly clear that, although the requested data are plainly and unequivocally matters of public interest, given that they are intrinsically related to the provision of a public service—namely, the supply of drinking water—they have not yet been provided to the petitioner, without any valid justification. It is unacceptable for the representative of the respondent association to have replied that the request was inadmissible because the appellant was not a member, since the fundamental right of access to public information (derecho fundamental de acceso a la información pública), enshrined in Article 30 of the Constitución Política, does not permit arbitrary and unfounded distinctions of this kind.

Because the data are public in nature and are held by a public institution or by a private-law entity (sujeto de derecho privado), as in the present case, any member of the public may access them, and conditions such as those imposed upon the protected party—in this instance, as stated, being a user or member of the Asada—may not validly be made a prerequisite for access (see, to similar effect, judgment number 2019-014760 at nueve horas veinte minutos on nueve de agosto de dos mil diecinueve).

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on an electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notice of this judgment. The parties are warned that any material not retrieved within this period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in article XXVI of session nro. 27-11 of 22 de agosto de 2011, published in the Boletín Judicial nro. 19 of 26 de enero de 2012, as well as pursuant to the agreement of the Consejo Superior del Poder Judicial, approved in article LXXXI of session nro. 43-12 held on 3 de mayo de 2012.

Por tanto:

The petition for constitutional relief (recurso de amparo) is partially granted. JOSÉ MANUEL QUIRÓS CHINCHILLA, in his capacity as president vested with the powers of a general attorney-in-fact without limitation as to amount of the ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO, or whoever may hold that office in his stead, is ordered to coordinate the appropriate actions and carry out all measures falling within the scope of their respective authority so that, within a maximum period of THREE DAYS from notification of this judgment, the request submitted by the petitioner that is the subject of this proceeding, concerning access to the case file cited by the ASADA as grounds for denying service, as well as the information requested on May 22, 2025, is addressed as required by law. The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional-relief proceeding that they must comply with or enforce and who fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or fined twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment in the contentious-administrative courts (vía contencioso-administrativa). As regards the installation of the water service, the petition is denied. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiseis de setiembre de dos mil veinticinco .

Recurso de amparo presentado por Nombre01, cédula de identidad CED05, Nombre02, cédula de identidad CED06, contra la ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO.

Resultando:

  1. 1Por escrito presentado en la Secretaría de esta Sala a las 17:58 horas del 27 de julio de 2025 las recurrentes presentan recurso de amparo contra la ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO. Manifiestan que “PRIMERO: Los aquí recurrentes adquirimos de buena fe, y bajo títulos legítimos, tres lotes en la comunidad de Palmitos de Naranjo, los cuales fueron comprados por separado y no forman parte de ninguna urbanización ni gestión conjunta entre los actuales propietarios. SEGUNDO: Desde el momento de la adquisición, se iniciaron los trámites para obtener el servicio de agua potable ante la ASADA de Palmitos de Naranjo. Se presentó toda la documentación exigida por el reglamento y se cumplieron los requisitos administrativos correspondientes. Sin embargo, la ASADA insiste a negar el derecho de conexión, sin justificación técnica válida.Pero la Junta Administradora ha dicho claramente que el problema es con esos lotes que a cualquier otra persona si se le da agua menos a los de dichos lotes. TERCERO: A pesar de lo anterior, la ASADA ha denegado reiteradamente la conexión del servicio, fundamentándose en hechos relacionados con propietarios anteriores y en un expediente del año dos mil dieciocho, al cual no estamos vinculados ni jurídica ni administrativamente. CUARTO: Dicha negativa se ha aplicado únicamente a los lotes de los aquí recurrentes. En contraste, otras personas jurídicas, entre ellas una sociedad vinculada directamente al presidente de la ASADA, obtuvieron la conexión el mismo día en que los aquí recurrentes fueron rechazados. QUINTO: Se ha solicitado acceso al expediente invocado por la ASADA para denegar el servicio, pero este fue entregado de forma incompleta, con múltiples folios omitidos, incluyendo el folio 62, en el cual supuestamente consta la revocatoria del derecho de conexión.La ASADA justificó la omisión alegando “información confidencial”, lo cual viola el principio de publicidad administrativa. SEXTO: La administradora de la ASADA ha manifestado verbalmente que se revocará el derecho de conexión sin procedimiento previo, resolución escrita ni fundamento técnico. Estas declaraciones se encuentran registradas en una grabación digital que se aporta como prueba, en la cual, en la hora ocho con treinta minutos, se expresa dicha intención. SÉPTIMO: Estas acciones vulneran gravemente el derecho al debido proceso, a la defensa, a la igualdad, y al acceso al agua como derecho humano esencial. Asimismo, se evidencia una conducta administrativa discriminatoria, arbitraria y con potencial conflicto de intereses.” (sic). Aporta que, por medio de correo electrónico, el 22 de mayo de 2025 se solicitó: el “listado de las pajas (conexiones de agua potable) entregadas por esa ASADA, indicando su ubicación general o dirección de instalación, durante el período de enero de 2020 a mayo de 2025”, solicitud que se refiere únicamente a información de naturaleza pública, ya que se persigue obtener datos personales o sensibles protegidos por la Ley 8968.Sostiene que, el 06 de junio de 2025, la recurrida le indicó que previo a responder debe aclarar cuál es el interés legitimo conforme a la ley que ostentan para solicitar la información indicada, ya que, en virtud de los registros de la recurrida no son usuarias del acueducto ni asociadas, de conformidad con el artículo 100 del Reglamento de Asadas, decreto número 42582-S-MINAE, y se le indica que, dicho numeral “es una disposición especial, que está por encima de cualquier otra disposición reglamentaria que se le oponga y en ese sentido no es procedente que cualquier ciudadano sin un interés legítimo pida información de una organización privada, aunque este destinada a satisfacer un servicio público.” (sic). Con base en los alegatos expuestos, estima que, con las actuaciones acusadas, se están vulnerando derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley.Además, la autoridad recurrida deberá informar si el correo electrónico al cual la parte recurrente remitió la solicitud de información está previsto como mecanismo oficial para la recepción de gestiones de los usuarios.
  2. 2Por resolución de las 14:25 horas del 20 de agosto de 2025 se dio curso al presente amparo y se le brindo traslado a JOSÉ MANUEL DEL CARMEN QUIROS CHINCHILLA, cédula de identidad CED07, en calidad de presidente y representante judicial y extrajudicial con facultados de apoderado generalísimo sin límite de suma de la ASOCIACION ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO (ver registro electrónico).
  3. 3Contesta audiencia JOSÉ MANUEL QUIRÓS CHINCHILLA, en su condición de presidente con facultades de Apoderado Generalísimo sin limitación de suma de la ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO (ver registro electrónico) en los siguientes términos: “Es importante destacar que es obligación de todas las ASADAS en general realizar un Estudio de Evaluación para determinar la capacidad hídrica e hidráulica del sistema de suministro de agua potable que administra la ASADA. Este estudio se fundamenta en el artículo 44 de REGLAMENTO DE LAS ASOCIACIONES ADMINISTRADORAS DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADOS COMUNALES que en lo que interesa dispone:

“Artículo 44. Estudio Técnico de los sistemas de agua potable y saneamiento de aguas residuales. Las ASADAS deberán contar con un estudio actualizado mediante el cual se determine la capacidad hídrica e hidráulica del sistema administrado, para estos efectos deberán observarse las siguientes disposiciones: a. Ejecución de los Estudios Técnicos: Los estudios técnicos de estos sistemas, deberán ser realizados por la ASADA con el respaldo técnico de un profesional responsable, debidamente incorporado al Colegio Profesional de su área respectiva. b. Responsabilidad del Estudio Técnico: Es responsabilidad compartida de la ASADA y el profesional responsable velar por la correcta aplicación de la normativa técnica, políticas y directrices emitidas por AyA, siendo éstas de acatamiento obligatorio tanto en la ejecución del estudio, como en el diseño y construcción de las obras resultantes…” ESTUDIOS TÉCNICOS SOBRE BALANCE HÍDRICO EN NUESTRO ACUEDUCTO. En nuestro caso existe un estudio del año 2018 aprobado por el A y A, otro estudio del año 2020 y en fecha reciente hemos realizado un nuevo análisis de Balance Hídrico, todos los análisis efectuados se refieren al recurso hídrico disponible de nuestro acueducto, los cuales se adjuntan a esta contestación.

NUESTRO SISTEMA DE ACUEDUCTO CON CAUDAL DEFICITARIO. De acuerdo con los estudios mencionados, desde el año 2018 se proyectaba un déficit importante, salvo que se obtuvieran nuevas fuentes. El caudal de agua máximo disponible de acuerdo con el estudio del año 2025 es de apenas 10.20 litros por segundo y se requiere en este momento de 14.37 litros por segundo, por lo que cada año que pasa estamos teniendo un déficit importante (véase cuadro 17, página 42, estudio de Balance Hídrico del año 2025). Es importante aclarar que estamos haciendo un esfuerzo por incorporar nuevas fuentes para aumentar el caudal disponible. Eso ha provocado que el déficit ya se empezó a visualizar desde el año 2019 y obviamente ha ido acrecentando.

De los estudios referidos se desprende que nuestro acueducto se encuentra con déficit hídrico, por lo que no es posible en este momento otorgar más disponibilidades, hasta tanto no se realicen nuevas captaciones de nuestro sistema de acueducto.

De hecho mediante el oficio número GSD-UEN-GAR-2021-04822 de parte del Ing. Giovanni García Flores, encargado de la UEN Gestión de Acueductos Rurales, se nos indicó expresamente lo siguiente:

“En atención a la consulta presentada por usted en oficio APCALNAR-CE-ADM-15-2021 referente a los alcances de las recomendaciones emitidas en nuestro Memorando N°GSD-UEN-GAR-2021-0095, nos permitimos aclararle que, debido a la limitada capacidad hídrica del acueducto administrado por la Asada de Palmitos de Naranjo, no recomendamos que se aprueben solicitudes de agua para nuevos desarrollos ni para viviendas que requieran de extensiones de la red de distribución existente actualmente, hasta que no se cuente con nuevas fuentes de abastecimiento. Esta recomendación se fundamenta en los resultados del estudio técnico elaborado en marzo del año 2020 por el Ing. Gustavo Adolfo Chacón Aguilar, del cual en nuestra oficina se revisó y aprobó el informe remitido por ustedes…” Como ente administrador del servicio público de suministro de agua potable, tenemos la obligación de emitir las constancias de disponibilidad del servicio y constancias de capacidad hídrica; sin embargo, tales actos solamente se pueden cumplir cuando el balance y análisis del recurso hídrico así lo permite.

Está claramente indicado en los reglamentos que dichas constancias se emiten cuando técnicamente sea factible. Conforme a lo expuesto y según el estudio adjunto, técnicamente el Acueducto no está en capacidad de ofrecer ningún servicio en esa zona. No estamos facultados para otorgar servicios cuando la capacidad del sistema tenga una situación crítica o, el otorgamiento de los nuevos servicios perjudique evidentemente a los demás usuarios y para ello se requiere el dictamen técnico de Acueductos y Alcantarillados.

Nuestra ASADA tiene la obligación de garantizar la vigencia de los principios fundamentales del servicio público, a saber: continuidad, eficiencia, adaptación e igualdad en el trato de los usuarios, de allí que en resguardo de esos principios, el reglamento nos otorga una serie de obligaciones ineludibles dentro de las que se encuentra la de suministrar el servicio de agua a quien lo solicite previo cumplimiento de los requisitos establecidos, los cuales lógicamente deben ser racionales y posibles.

Consideramos que es legal denegar el servicio, si estamos ante una imposibilidad técnica o análisis de factibilidad técnica, como ocurre en este caso, según artículo 14 del Reglamento para la Prestación de los Servicios del A y A vigente, en relación con el artículo 7.49 y 7.12 del reglamento citado, que se refieren a la factibilidad técnica de la siguiente forma:

“7.12. Análisis de factibilidad técnica para el otorgamiento de los servicios: Proceso de verificación de la existencia real y actual de los recursos hídricos, hidráulicos, materiales, técnicos, legales y ambientales suficientes para otorgar la disponibilidad y eventual conexión del servicio. Para tales efectos se deberán de observar las siguientes condiciones: a. Que las redes de distribución y de recolección pasan frente a linderos del inmueble o tenga acceso directo por vía pública o servidumbre de paso del inmueble para el cual se solicita un servicio. b. Que los sistemas cuenten con capacidad hídrica, hidráulica, de potabilización y de tratamiento, suficientes para otorgar nuevos servicios. c. Que el sistema cumple con los atributos de calidad establecidos. d. Que cumple con la normativa ambiental correspondiente.” En general, una disponibilidad de servicio se otorga cuando hay la existencia real y actual, no futura ni potencial, de las obras e infraestructura global necesaria y capacidad hídrica de abastecimiento para solventar las necesidades de servicios de una población determinada. El artículo 14 del reglamento citado obliga a cualquier prestador de servicio a conceder agua potable cuando:

Artículo 14- De las condiciones para la prestación de los servicios. AyA prestará sus servicios una vez comprobada la factibilidad técnica en inmuebles construidos o por edificar, dedicados a la residencia de personas, para actividades comerciales o industriales que cumplan con los requisitos y usos autorizados en este reglamento …” SOBRE EL ESTUDIO TÉCNICO EN EL CASO DE LOTIFICACIONES El otro aspecto importante y que aplica en este caso es el deber de obediencia a la legislación ordenada en la normativa que establece el Reglamento Prestación de Servicios A y A, artículos 14 y 39, y de conformidad con el Reglamento de ASADAS en su artículo 44, por lo que corresponde aplicar lo siguiente:

“Estudios para urbanizaciones, lotificaciones, segregaciones o condominios: Para el desarrollo de urbanizaciones, lotificaciones, segregaciones o condominios, la ASADA tiene la responsabilidad de garantizar que se realicen los estudios diagnósticos correspondientes para lo cual la persona interesada deberá asumir los costos, pero no la ejecución de los mismos, los que estarán siempre bajo competencia de la Asociación. Si como resultado del estudio diagnóstico se requiere la elaboración de un proyecto de mejoras, ampliación o modernización del sistema, le corresponderá a la persona interesada la confección de los diseños definitivos y los planos constructivos, así como la construcción de las obras previamente aprobados por el AyA, siempre que se modifique los caudales, todo lo anterior bajo la supervisión permanente de la ASADA, sin perjuicio de las competencias fiscalizadoras de la Institución…” De esta forma desde hace varios años se le planteó a los interesados de los lotes aludidos, incluyendo a las recurrentes, que para obtener una constancia de disponibilidad de servicio de agua potable debían de costear un Estudio Técnico en el que se evalúen las necesidades Hídricas e Hidráulicas para dotar de agua a ese proyecto en particular, especificando claramente cuáles son los requerimientos, obras a construir, mismas que también serán asumidas económicamente por los interesados (as).

En resumen, se requiere de un estudio técnico que los interesados deberán sufragar y la elección de la empresa o profesional que hará el análisis debe de elegirlo la ASADA. En nuestro caso y debido a que la ASADA no cuenta con capacidad hídrica le correspondería a los interesados subsanar esa deficiencia aportando la fuente de agua que servirá de agua potable a la actual y futura de esa lotificación. El profesional a contratar para realizar el Estudio Técnico sería competencia de la ASADA verificando que se encuentre debidamente incorporado al Colegio CFIA, una vez concluido dicho Estudio será enviado al A y A para su respectiva revisión y ratificación.

Por otra parte, en el último estudio de Balance Hídrico el profesional encargado del mismo claramente indicó la siguiente recomendación:

“Mantener un estricto control para los desarrollos urbanísticos, lotificaciones o proyectos que demanden altos gastos puntuales. Antes de otorgar la carta de disponibilidad de agua potable, es de suma importancia que la ASADA imponga las regulaciones correspondientes de manera que cada desarrollador, previo a su proyecto, realice un estudio técnico, donde se incluya un diagnóstico del sistema y se plantee las mejoras necesarias para el abastecimiento del proyecto. Lo anterior, en apego, a los parámetros de diseño reales del acueducto. Dicho estudio deberá ser analizado y aprobado por la Junta Directiva del acueducto y el AyA. Todos los desarrollos urbanísticos y similares deben de cumplir con legislación técnica y legal vigente…” HISTORIA DE UNA LOTIFICACIÓN Las recurrentes se presentan como simples adquirentes de dos terrenos individuales, sin embargo, en varias oportunidades se les ha explicado que dichos inmuebles forman parte de una lotificación generada en el año 2019 y cuyos dueños anteriores se negaron a realizar el estudio técnico respectivo. Por esa razón se aporta el expediente relacionado con esta lotificación donde consta que los terrenos de ambas recurrentes provienen de un fraccionamiento que se hizo hace algunos años y que sus dueños anteriores se negaron a realizar el estudio técnico respectivo.

La circunstancia de que las recurrentes desconocieran los antecedentes de los terrenos que adquirieron, tampoco obliga a la ASADA para que considere el caso como una simple gestión de crecimiento ordinario o que se trata de una solicitud no relacionada con la lotificación aludida. La ley prohíbe el abuso del derecho, no es el primer caso de que se hacen lotificaciones o fraccionamientos sin cumplir los requisitos para otorgar disponibilidades de agua, posteriormente el dueño original vende y de seguido los nuevos propietarios presentan solicitudes de disponibilidades en forma individual, alegando desconocer los antecedentes. De acogerse lo anterior estaríamos burlando la reglamentación existente.

No existe ninguna disposición legal que le permita a los operadores del servicio de agua potable que no es necesario realizar el estudio técnico en aquellos casos cuyos lotes producto de una lotificación se hubiesen traspasado.

SOBRE LOS HECHOS DEL RECURSO RESPUESTA: Debido a que no se identifican los lotes y tampoco en la documentación a la que se tuvo acceso en gestión en línea aparecen certificaciones registrales o planos catastrados se debe responder en forma negativa. Pese a la omisión en la identificación de los lotes, de acuerdo con nuestros registros y publicidad registral, los recurrentes son dueños de los siguientes inmuebles en la localidad de Palmitos de Naranjo, según las siguientes matrículas: Nombre01 es dueña de la matrícula con un área de 619 metros cuadrados y Nombre03 es dueña de la matrícula , con un área de 667 metros. No es casualidad que las matrículas si diferencien por el último número, debido a que ambos lotes son producto de una reunión y fraccionamiento del cual en su momento surgieron 9 lotes con las siguientes identificaciones: , , , , , , según documento presentado al registro al tomo 2019-752811, cuya escritura se adjunta a esta contestación, además se agregan los estudios registrales, histórico de finca y expediente de la ASADA.

No es cierto que esos lotes no formen parte de alguna “urbanización”, no fue una urbanización sino una lotificación, cuyo significado es distinto desde el punto de vista urbanístico. Las solicitudes que hicieron las recurrentes se dirigía a la disponibilidad de un servicio para las propiedades inscritas matrículas de Alajuela números: y . Ambos inmuebles son parte de la lotificación que se hizo en el 2019, según la explicación anterior (véase estudios registrales). En folios 20 al 24 del expediente que se aporta se encuentran 5 de los planos que los propietarios registrales obtuvieron de la segregación, se podrá comprobar que los 5 lotes están contiguos y que los colindantes son Nombre04 y Nombre05, quienes fueron los dueños de los terrenos y quienes hicieron la lotificación.

Desde un primer momento se les indicó a las personas que lotificaron que debían realizar el estudio técnico, sin embargo, nunca lo hicieron. De esta forma, la situación de estas dos propiedades es que ambos se encuentran dentro de una lotificación de nueve propiedades o lotes y para un fraccionamiento de esta naturaleza esta ASADA debe acatar la legislación vigente, lo cual implica cumplir con la normativa relacionada con las lotificaciones, referente a la necesidad de realizar un estudio técnico.

HECHO SEGUNDO RESPUESTA: Lo expresado en este hecho no es cierto. Es cierto que los interesados han realizado algunas gestiones, según se aprecia en el expediente que se adjunta. Se ha negado la solicitud de disponibilidad por cuestiones técnicas, en primer lugar, desde hace varios años se les indicó a los interesados sobre la necesidad de realizar el estudio técnico respectivo, aspecto al que se han negado en forma sistemática. En segundo lugar, en las condiciones actuales de nuestro acueducto nos encontramos con un déficit importante en la producción de agua. En uno de los estudios de Balance Hídrico que se adjunta indica textualmente lo siguiente:

“Tomando las medidas técnicas y de conservación adecuadas, el recurso hídrico total disponible, se encuentra prácticamente agotado. Es prioridad la búsqueda, concesión e interconexión de nuevas fuentes de agua…” (véase estudio de Balance Hídrico del año 2020, página 32).

En otra parte del estudio también se indica:

“Con base en las estimaciones realizadas, no es posible abastecer actualmente las solicitudes de índole inmobiliaria…” En este estudio de Balance Hídrico ya se encuentra una referencia a la lotificación relacionada con los terrenos de las recurrentes, en la página 28 se lee lo siguiente:

5.1.4 Desarrollos urbanísticos.

De conformidad con lo manifestado por los encargados del acueducto se tienen las siguientes solicitudes pendientes de disponibilidad de agua de índole inmobiliario significativos:

Nombre06. 40 conexiones.

Inversiones Familia Herrera Muñoz S.A: 70 usuarios.

Nombre07: 8 previstas Nombre05 e Nombre04: 40 soluciones habitacionales.

Total de solicitudes: 158.

La mención de Nombre05 e Nombre04 corresponde a los dueños que lotificaron y que posteriormente vendieron. Se insiste que los terrenos de las recurrentes se encuentran dentro de esa lotificación que se hizo desde el año 2019.

Es absolutamente falsa la última afirmación en el sentido de que la Junta hubiese manifestado que a esos lotes nunca se le brindaría el servicio de agua potable.

HECHO TERCERO RESPUESTA: Es cierto lo relacionado con la negatoria de las solicitudes realizadas, es cierto que uno de los argumentos para la denegatoria es que los terrenos forman parte de una lotificación que se negó a realizar el estudio técnico respectivo, pero se agrega que la otra circunstancia está relacionada con el déficit crítico del caudal que abastece nuestro acueducto. La desconexión subjetiva que alegan los recurrentes entre la lotificación que generó los lotes y ellas, no les otorga un derecho para no considerar las omisiones de sus anteriores propietarios. Los requisitos para la disponibilidad del recurso hídrico y el cumplimiento de la legislación sobre la materia, no discriminan entre propietarios antiguos o propietarios actuales, la disponibilidad de agua no está relacionada con personas, la disponibilidad del recurso hídrico se relaciona con terrenos y sobre todo con la capacidad hídrica e hidráulica real y actual del operador del servicio público.

HECHO CUARTO RESPUESTA: No es cierto, no existe ninguna preferencia en el otorgamiento de disponibilidades. Se ha explicado ampliamente las razones por las cuales se ha denegado la disponibilidad. En cuanto a la afirmación de que se otorgó una disponibilidad a favor de una sociedad vinculada con el presidente, aclaro que la ASADA pese a la situación actual sigue otorgando disponibilidades para efectos de crecimiento ordinario, vegetativo o máximo, según lo autoriza la legislación. El inconveniente con los terrenos de las recurrentes es que forman parte de una lotificación.

HECHO QUINTO:

RESPUESTA: Es cierto, ello obedece a la Ley de Protección de la Persona frente al Tratamiento de sus datos personales, número 8968, que se refiere a datos sensibles, datos personales o de acceso restringido. Está claro que las ASADAS aunque son asociaciones privadas constituidas bajo la Ley N° 218 y su reglamento, tienen un fin público, por lo cual, están sujetas a la normativa que concierne a la prestación del servicio público que realizan, debiendo brindar la información que les soliciten, siempre que con ello no transgreda el ámbito de confidencialidad de la información, por lo que al momento de brindar los datos requeridos, se debe de resguardar los datos personales. Lo omitido está relacionado con números de identificación e información que no era de interés para las recurrentes. La ASADA estaba obligada a realizar un análisis para determinar cuál era información pública y cuál era de carácter sensible y restringida, y de ahí la ausencia de algunos folios.

HECHO SEXTO RESPUESTA: Ignoro a que se refiere la recurrente, por lo que respondo en forma negativa. Sin perjuicio de lo expuesto es evidente que la grabación aportada es absolutamente ilegal y la propia administradora así me lo ratificó, nunca le pidieron permiso para grabar su voz. Por otra parte, desconozco las posibles afirmaciones o interpretaciones que la anterior administradora pudo haber emitido con respecto a este asunto. En todo caso, es la Junta Directiva la que toma las decisiones en cualquier organización de esta naturaleza, no la administradora. No obstante lo expuesto, la administradora se refería al caso de que se otorgara la disponibilidad para construir y el propietario no lo hacía dentro del año que indica el reglamento, eso provoca indefectiblemente la revocatoria de la disponibilidad sin mayor trámite, era a eso que se refería la administradora.

HECHO SÉPTIMO RESPUESTA: Lo afirmado en este hecho no simples apreciaciones, opiniones o conjeturas que carecen de elementos fácticos, por lo que respondo en forma negativa. Lo indicado nuevamente lesiona el honor de nuestra Junta Directiva en el tanto se hacen presunciones sin ningún elemento probatorio que acredite ese tipo de comportamientos.

RAZONES TÉCNICAS PARA DENEGAR EL SERVICIO. No es cierto que la Asociación Administradora que represento le hubiese negado el servicio a las recurrentes de forma injustificada. En primer lugar, los lotes se encuentran en una lotificación, nunca quisieron hacer el estudio técnico y existe imposibilidad técnica, hay un faltante del recurso hídrico, por lo que nuestra ASADA únicamente otorga disponibilidades para el crecimiento denominado ordinario, vegetativo o máximo, según lo dispone la definición existente al respecto en el Reglamento para la Prestación de los Servicios del A Y A, que es de obligado acatamiento en nuestro caso.

“129. Zona de crecimiento máximo: Área geográfica dentro de una zona deficitaria, donde el prestador de servicio público autoriza la emisión de constancias de disponibilidad de servicios positivas o constancias de capacidad hídrica según corresponda, para cualquiera de los siguientes casos: a) Vivienda unifamiliar individual; b) Comercio individual. Los siguientes supuestos únicamente cuando existan caudales nuevos que optimicen la capacidad hídrica e hidráulica de la zona respectiva y se aplique la "Metodología de Repartición Porcentual de Caudales" establecida por la UEN de Optimización de Sistemas GAM y la UEN de Optimización de Sistemas Periféricos: c) Desarrollos inmobiliarios, d) Proyectos de vivienda de interés social, e) Establecimientos y proyectos de proyección comunal, y f) Establecimientos y proyectos estatales.

La Asociación que represento, debe obediencia al ente rector y no estamos facultados para conculcar sus directrices, disposiciones o la normativa que se establece en el Reglamento de Prestación de los Servicios de A Y A y reglamento de Asadas. Definitivamente, existe un impedimento técnico para abastecer de agua a los lotes de las recurrentes, salvo mejor criterio del ente rector, o que esta Sala le ordene a mi representada conceder el servicio.

Es importante aclarar que tampoco la parte hizo uso de los recursos ordinarios en esta materia para impugnar las decisiones de mi representada.

Para finalizar estas respuestas, transcribo parcialmente una resolución de la Sala Constitucional, que desde vieja data, en casos similares, se ha inclinado por considerar lo siguiente RESOLUCIONES DE LA SALA CONSTITUCIONAL RELACIONADAS. “Este Tribunal ha señalado que las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar válidamente esas solicitudes o condicionarlas si existen razones técnicas o legales que así lo justifican. Así, en la sentencia n.°2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró lo siguiente:

“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.

Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales.

En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.

Reitero a esta honorable Sala Constitucional y también a las recurrentes que acatando la legislación que regula a las ASADAS, todo proyecto de fraccionamiento, sea con fines de bien social o venta de lotes, la parte interesada debe solicitar la Constancia de Disponibilidad de servicio de Agua Potable y adjuntar los requisitos establecidos, posteriormente la Junta Directiva de la ASADA debe responder con el criterio técnico y legal que procede evaluando las capacidades actuales y reales, en consecuencia al tratarse de un proyecto de lotificación, urbanización (…) se requiere un estudio técnico realizado por el profesional en la materia y costeado por el interesado, dicho estudio es el que dictamina las mejoras u obras de infraestructura, aporte de fuente de agua, entre otros que conlleva invertir y ejecutar para hacer efectivo el proyecto, como también se evalúa la viabilidad de las futuras construcciones en el inmueble deseado, lo que significa que para esta lotificación no existe ninguna solicitud formal en la ASADA, de modo que tampoco existe el estudio técnico.

No obstante lo expuesto, nuevamente le indicamos a las recurrentes que si desean convertir la denegatoria en una decisión positiva deberán manifestar por escrito, si están de acuerdo en costear un Estudio Técnico de Factibilidad, que sería contratado por la Asada y revisado por el AyA. (Reglamento de ASADAS artículo 44, inciso d)”. Solicita que se declare sin lugar el recurso.

  1. 4Por resolución de las dieciséis horas cero minutos del cinco de setiembre de dos mil veinticinco el magistrado instructor solicitó como PRUEBA PARA MEJOR RESOLVER informe a JOSÉ MANUEL QUIRÓS CHINCHILLA, EN SU CONDICIÓN DE PRESIDENTE CON FACULTADES DE APODERADO GENERALÍSIMO SIN LIMITACIÓN DE SUMA DE LA ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO a fin de que aclare cuál es la información contenida en el acta de la sesión realizada el 01 de abril del año en curso así como del expediente en el que se tramita la solicitud del servicio de agua que es considerada como confidencial (ver registro electrónico).
  2. 5Contesta audiencia JOSÉ MANUEL QUIRÓS CHINCHILLA, en su condición de presidente con facultades de Apoderado Generalísimo sin limitación de suma de la ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO (ver registro electrónico) en los siguientes términos: “1.- ANTECEDENTE SESIÓN DE JUNTA DIRECTIVA Y SU CONTENIDO. En atención a la resolución del 5 de setiembre de 2025, informo a la honorable Sala Constitucional, dentro del plazo establecido, que el contenido de la sesión del 1 de abril del 2025 es similar al oficio que consta en el expediente visible a folio 197 y 198, concretamente en la sesión se acordó lo siguiente:

Lo anterior se hizo siguiendo los parámetros comunicados por el A Y A, mediante correo electrónico del 12 de setiembre de 2025 donde se nos menciona que no se podía brindar datos personales o sensibles y de ello interpretamos que no debíamos de adjuntar las copias de cédulas, poderes o documentos similares. Se adjunta el correo electrónico mencionado, aclarando que de acuerdo con la información suministrada por el A y A interpretamos que ciertos datos no se debían a suministrar por considerar que podían transgredir el ámbito de confidencialidad de la información. Lo que fue declarado confidencial u omitido está relacionado con poderes, números de identificación, cédulas de identidad e información que no era de interés para las recurrentes y que además a continuación detallo los folios o páginas del expediente que no fueron suministrados: folios 2 y 3 copias de cédulas de identidad 14 copia de cédula CED01 17 y 18 copias de cédulas CED02 36 copia de cédula CED03 51 copia de cédula CED04 68, 69, 70, 71 Y 72 copias de cédula, poder especial y entero. 88 copia de cédula 92 copia de cédula 104 copia de cédula 116 copia de cédula 124 copia de cédula 143 y 144 copias de cédula 170 copia de cédula Para evitar erróneos entendidos adjunto todos los folios que fueron omitidos y que como se verá no son relevantes en este asunto. 2.- NUEVO DOCUMENTO SOBRE LA SITUACIÓN DEFICITARIA DEL RECURSO HÍDRICO Además, en archivo adjunto aportamos un nuevo criterio del A y A sobre la situación deficitaria de nuestro acueducto e incluso hacen la recomendación de NO APROBAR nuevos servicios y tampoco renovar las constancias de disponibilidad actualmente vigentes.

DOCUMENTOS QUE SE APORTAN. En resumen se adjuntan: copia de sesión de junta directiva del 1 de abril, imágenes del expediente administrativo sobre la información que no fue suministrada a los recurrentes, documento emitido por el A y A sobre la condición deficitaria de nuestro acueducto”.

  1. 6Por escrito presentado en la Secretaría de esta Sala a las 21:40 horas del 24 de setiembre de 2025 las recurrentes manifiestan lo siguiente: “I. OBJETO DEL ESCRITO En tiempo y forma, venimos a presentar observaciones que no me solicitaron respecto de las respuestas remitidas por la parte recurrida (Nombre08 y su presidente José Manuel Quirós Chinchilla), en cumplimiento de la prevención ordenada por este Honorable Tribunal. Las contestaciones no cumplen cabalmente con lo solicitado por la Sala, contienen omisiones significativas y aportan documentación incompleta o posterior, lo cual afecta nuestro derecho de defensa y la transparencia del proceso. II. SOBRE LA CONFIDENCIALIDAD MAL INVOCADA La recurrida justificó la omisión de folios completos alegando que se trataba de copias de cédulas, poderes u otros documentos “confidenciales”. Sin embargo: • La Sala había solicitado explicar qué información concreta era confidencial y en qué expediente; esa explicación nunca se brindó. • Bajo esa excusa, se omitieron folios enteros y el acta requerida, lo cual no tiene sustento legal.III. NUEVOS ELEMENTOS INTRODUCIDOS Se incorporó un informe del AyA de septiembre de 2025, que desaconseja la autorización de nuevos servicios por déficit hídrico. Señalamos que: • Este documento es posterior a nuestra solicitud inicial, presentada meses antes. • Pretender aplicarlo retroactivamente viola los principios de irretroactividad y buena fe administrativa. • Nuestra gestión cumplía con todos los requisitos al momento de su presentación. IV. ACLARACIÓN NECESARIA La parte recurrida ha insistido en presentar esta gestión como si se tratara de una urbanización. Ello es absolutamente incorrecto. Nuestra petición se refiere únicamente a dos lotes individuales, adquiridos de buena fe por los actuales propietarios, sin relación jurídica con antiguos dueños ni con desarrollos urbanísticos previos. V. CONDUCTA DE LA PARTE RECURRIDA El reiterado incumplimiento de la prevención, la omisión de documentos claves, la foliatura incompleta y el uso de información posterior revelan una conducta que afecta la transparencia administrativa.Tales hechos constituyen una posible desobediencia a lo ordenado por esta Sala Constitucional, conforme al artículo 71 de la Ley de la Jurisdicción Constitucional. VI. PETITORIO Por lo expuesto, solicitamos respetuosamente a esta Honorable Sala: 1. Tener por presentadas estas observaciones. 2. Declarar que la prevención ordenada no ha sido cumplida adecuadamente por la parte recurrida. 3. Reiterar la orden de que se remita el expediente completo, foliado y certificado, incluyendo específicamente el acta de la sesión del 1 de abril de 2025. 4. Desestimar la aplicación retroactiva del informe del AyA de septiembre de 2025, por ser posterior a la solicitud original. 5. Tomar en consideración que la gestión corresponde únicamente a dos lotes, y no a una urbanización. 6. Valorar la posible desobediencia a las órdenes de este Tribunal por parte de los recurridos” (ver registro electrónico).
  2. 7En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. DE PREVIO

Al tenor de lo dispuesto por el artículo 57 de la Ley de la Jurisdicción Constitucional, es admisible el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el presente caso estima esta Sala que el recurso de amparo es admisible, pues la ASADA recurrida, siendo un sujeto de derecho privado, presta un servicio público.

II. OBJETO DEL RECURSO

Las recurrentes alegan que la Asada recurrida les negó el servicio de agua sin justificación alguna. Agregan que solicitaron copia del expediente, sin embargo les fue entregado en forma parcial alegando que contenía “información confidencial”.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos:

  • a)Que las recurrentes son dueñas registrales de los siguientes inmuebles en la localidad de Palmitos de Naranjo, según las siguientes matrículas: Nombre01 es dueña de la matrícula con un área de 619 metros cuadrados y Nombre03 es dueña de la matrícula , con un área de 667 metros (ver informe de la autoridad recurrida).
  • b)Que el acueducto de Palmitos de Naranjo se encuentra con déficit hídrico (ver informe de la autoridad recurrida).
  • c)Que mediante el oficio número GSD-UEN-GAR-2021-04822 suscrito por el Ing. Giovanni García Flores, encargado de la UEN Gestión de Acueductos Rurales, se indicó: “En atención a la consulta presentada por usted en oficio APCALNAR-CE-ADM-15-2021 referente a los alcances de las recomendaciones emitidas en nuestro Memorando N°GSD-UEN-GAR-2021-0095, nos permitimos aclararle que, debido a la limitada capacidad hídrica del acueducto administrado por la Asada de Palmitos de Naranjo, no recomendamos que se aprueben solicitudes de agua para nuevos desarrollos ni para viviendas que requieran de extensiones de la red de distribución existente actualmente, hasta que no se cuente con nuevas fuentes de abastecimiento. Esta recomendación se fundamenta en los resultados del estudio técnico elaborado en marzo del año 2020 por el Ing. Gustavo Adolfo Chacón Aguilar, del cual en nuestra oficina se revisó y aprobó el informe remitido por ustedes…” (ver informe de la autoridad recurrida).
  • d)Que a los interesados en los lotes -incluidas las recurrentes- se les indicó que para obtener una constancia de disponibilidad de servicio de agua potable debían de costear un Estudio Técnico en el que se evalúen las necesidades Hídricas e Hidráulicas para dotar de agua a ese proyecto en particular, especificando claramente cuáles son los requerimientos, obras a construir, mismas que también serán asumidas económicamente por los interesados (as) (ver informe de la autoridad recurrida).
  • e)Que la autoridad recurrida les explicó a las recurrentes que los inmuebles adquiridos forman parte de una lotificación generada en el año 2019 y cuyos dueños anteriores se negaron a realizar el estudio técnico respectivo (ver informe de la autoridad recurrida).
  • f)Que al recurrente le entregaron una copia parcial del expediente de la ASADA (ver informe de la autoridad recurrida).
  • g)Que a las recurrentes no les entregaron los folios 2, 3, 14, 15, 16, 17, 18, 25, 26, 36, 42, 43, 51, 55, 56, 57, 68, 69, 70, 71, 72, 88, 92, 104, 116, 124, 1143, 144 y 170 -folios en los que se consignan cédulas de identidad y poderes especiales- (ver informe de la autoridad recurrida).
  • h)Que en fecha 22 de mayo de 2025 mediante oficio E-0001-05-2025 y E-0002-05-2025 las recurrentes remitieron un correo electrónico para que les entregaran la siguiente información: “listado de las pajas (conexiones de agua potable) entregadas por esa ASADA, indicando su ubicación general o dirección de instalación, durante el período de enero de 2020 a mayo de 2025” (ver informe de la autoridad recurrida).
  • i)Que mediante oficio ACPALNAR-CE-JD-25-2025 de fecha 06 de junio de 2025 la autoridad recurrida respondió los oficios E-0001-05-2025 y E-0002-05-2025 remitidos por las recurrentes indicándoles: “De acuerdo a la disposición del artículo 100 del Reglamento de Asadas, previo a responder la solicitud planteada se requiere que aclare cuál es el interés legítimo, conforme a la ley que ostenta su persona para solicitar la información indicada en su oficio. Ello por cuanto de acuerdo con nuestros registros su persona no es usuaria de nuestro acueducto y tampoco es asociada, sin embargo, la normativa citada permite que personas con un interés legítimo puede realizar peticiones de esa naturaleza” (ver registro electrónico).

IV. SOBRE EL CASO CONCRETO

En reiteradas ocasiones, esta Sala ha sostenido que, si bien se reconoce el derecho fundamental al agua y su acceso en igualdad de condiciones, por cuanto se trata de un servicio esencial para la vida y la salud; también, ha indicado que este derecho no implica un acceso irrestricto al agua, toda vez que, la Administración puede válidamente, establecer condiciones y requisitos generales para acceder a este servicio. Asimismo, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes de agua, o bien, de la carta de disponibilidad de agua, cuando el interesado no cumple los requisitos o cuando existen razones técnicas o legales que los justifiquen. Así, por ejemplo, en sentencia número 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró lo siguiente:

“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.

Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales.

En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”.

Tales argumentos resultan plenamente aplicables al caso concreto, en el cual, a las amparadas se le negó la carta de disponibilidad de agua potable, por razones técnicas, con fundamento en primer lugar que se requiere de previo un estudio técnico -estudio que deben realizar los interesados- y en segundo lugar que existe un déficit importante en la producción de agua. En consecuencia, estima este Tribunal que la negativa de disponibilidad de agua emitida por la recurrida se encuentra sustentada en una imposibilidad material, por lo que el acto no constituye una actuación arbitraria. Ahora bien, cabe señalar que la procedencia o no del servicio de agua en cuestión, así como la pertinencia o veracidad de las razones técnicas que sustentaron la decisión de la parte recurrida, así como de la procedencia de los requisitos solicitados para que se le brinde el servicio, no son cuestiones que deban discutirse en esta Jurisdicción, por tratarse de un conflicto de legalidad ordinaria ajeno al ámbito de competencia de esta Sala.

Finalmente, en cuanto a la alegada violación al principio de igualdad y no discriminación, cabe destacar que, en reiteradas ocasiones, esta Sala ha establecido que no le basta a la parte recurrente afirmar, sin más, que en un caso dado se ha producido un trato distinto entre dos sujetos, para tener por demostrado ese quebranto. Por el contrario, quien alega la violación, está obligado a aportar elementos que permitan efectuar una comparación plena entre los sujetos tratados en forma diferente. Sin embargo, dado el carácter eminentemente sumario del proceso de amparo, es obvio que el elemento de comparación debe ser de tal naturaleza que no haga necesario entrar a analizar, de previo, cuál es la situación de la parte afectada en el plano de la legalidad ordinaria. En el presente caso, las recurrentes no ofrecen mayores elementos de juicio que hagan presumir a esta Sala la presunta desigualdad, pues el solo hecho de aducir que las propiedades contiguas a la suya sí cuentan con el servicio de agua potable, no supone -per se- una discriminación, ya que la dotación de servicios depende no solo del cumplimiento de requisitos, la cantidad de usuarios, así como otras razones técnicas y legales.

En todo caso, para evaluar si se ha producido o no la presunta desigualdad invocada, es necesario que, de previo, esta Sala se pronuncie sobre un diferendo de mera legalidad, es decir, tendría que estudiar caso por caso a fin de analizar estudios técnicos, fechas de las solicitudes, requisitos y la normativa aplicable, lo cual no corresponde a esta Sala conocer por la vía del amparo, por ser una labor propia de la administración. En virtud de lo anterior, deberá la parte recurrente plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas se declara sin lugar el recurso en cuanto a este extremo.

V. EN CUANTO AL ACCESO DEL EXPEDIENTE

Se demostró que a las recurrentes les entregaron una copia parcial del expediente de la ASADA y que los siguientes folios conforman la información no entregada: folios 2, 3, 14, 15, 16, 17, 18, 25, 26, 36, 42, 43, 51, 55, 56, 57, 68, 69, 70, 71, 72, 88, 92, 104, 116, 124, 1143, 144 y 170 -folios en los que se consignan cédulas de identidad y poderes especiales-. La autoridad recurrida afirma que “Lo anterior se hizo siguiendo los parámetros comunicados por el A Y A, mediante correo electrónico del 12 de setiembre de 2025 donde se nos menciona que no se podía brindar datos personales o sensibles y de ello interpretamos que no debíamos de adjuntar las copias de cédulas, poderes o documentos similares”. Al respecto, se observa que lo requerido por la recurrente constituye información pública, de manera que la negativa a brindar las copias de cédulas y poderes constituye una lesión a los derechos fundamentales de la persona petente. En virtud de lo expuesto, al no corroborarse que la información solicitada haya sido brindada por las autoridades recurridas, procede la estimatoria del recurso, en los términos que se indican en la parte dispositiva de este pronunciamiento.

VI. SOBRE LA FALTA DE RESPUESTA A LOS OFICIOS PRESENTADOS EL 22 DE MAYO DE 2025

En cuanto a este extremo se demostró que en fecha 22 de mayo de 2025 mediante oficio E-0001-05-2025 y E-0002-05-2025 las recurrentes remitieron un correo electrónico para que les entregaran la siguiente información: “listado de las pajas (conexiones de agua potable) entregadas por esa ASADA, indicando su ubicación general o dirección de instalación, durante el período de enero de 2020 a mayo de 2025” y que, mediante oficio ACPALNAR-CE-JD-25-2025 de fecha 06 de junio de 2025 la autoridad recurrida respondió los oficios E-0001-05-2025 y E-0002-05-2025 remitidos por las recurrentes indicándoles: “De acuerdo a la disposición del artículo 100 del Reglamento de Asadas, previo a responder la solicitud planteada se requiere que aclare cuál es el interés legítimo, conforme a la ley que ostenta su persona para solicitar la información indicada en su oficio. Ello por cuanto de acuerdo con nuestros registros su persona no es usuaria de nuestro acueducto y tampoco es asociada, sin embargo, la normativa citada permite que personas con un interés legítimo puede realizar peticiones de esa naturaleza”.

Es decir, la información requerida por las recurrentes no ha sido entregada. Lo anterior porque -previo- requieren demostrar el interés legítimo para tener acceso al “listado de las pajas entregadas por esa ASADA, indicando su ubicación general o dirección de instalación, durante el período de enero de 2020 a mayo de 2025”. Partiendo de lo anterior el recurso deviene procedente en cuanto a este extremo. Esto, por cuanto se observa con meridiana claridad que, pese a que los datos requeridos revisten un claro e inequívoco interés público, habida cuenta que se encuentran intrínsecamente relacionados con la prestación de un servicio público como lo es el suministro de agua potable, estos últimos no han sido proporcionados a la fecha al promovente sin que medie justificación válida alguna. No resulta admisible el hecho que el representante de la asociación recurrida haya contestado que la gestión deviene en improcedente porque el recurrente no ostenta la condición asociada, en el tanto el derecho fundamental de acceso a la información pública consagrado en el ordinal 30 de la Constitución Política no admite realizar este tipo de arbitrarias e infundadas distinciones.

Al tratarse de datos de índole pública en poder de una institución pública o bien, de un sujeto de derecho privado (como sucede en el presente caso), cualquier administrado puede acceder a estos sin que, para tal efecto, resulte válido anteponer condiciones como las que han sido exigidas al tutelado, en el particular, como se dijo, ser usuaria o asociada de la Asada (ver en similar sentido sentencia número 2019-014760 de las nueve horas veinte minutos del nueve de agosto de dos mil diecinueve).

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso. Se ordena a JOSÉ MANUEL QUIRÓS CHINCHILLA, en su condición de presidente con facultades de Apoderado Generalísimo sin limitación de suma de la ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO o a quien en su lugar ocupe el cargo que coordine lo correspondiente, y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, dentro del plazo máximo de TRES DÍAS, contado a partir de la notificación de esta sentencia, se atienda como en derecho corresponde la gestión formulada por la recurrente objeto de este proceso de amparo relacionada con el acceso al expediente invocado por la ASADA para denegar el servicio, así como la información solicitada el 22 de mayo de 2025. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la ASOCIACIÓN ADMINISTRADORA DE SISTEMAS DE ACUEDUCTOS Y ALCANTARILLADO SANITARIO DE PALMITOS DE NARANJO al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. En cuanto a la instalación del recurso hídrico se declara sin lugar el recurso. Notifíquese.
