Constitutional protection action (recurso de amparo) processed under expediente número 24-030881-0007-CO, filed by Nombre01, identity card CED01, on behalf of Nombre02, identity card CED02, against the MUNICIPALIDAD DE SANTA ANA, EL MINISTERIO DE SALUD, EL INSTITUTO MIXTO DE AYUDA SOCIAL Y LA DEFENSORÍA DE LOS HABITANTES.
RESULTS:
Accordingly, the cited legislation and line of case law demonstrate that under no circumstances has the Defensoría de los Habitantes violated the human rights of the appellant, since the Defensoría de los Habitantes did not neglect the appellant’s situation; rather, it was precluded from exercising jurisdiction by an express provision of its enabling law, given that the matter raised by Ms. Nombre01 was, at that time, under consideration by the Sala Constitucional in expediente N°24-019779-0007-CO, which, pursuant to Article 19.2 of Ley N°7319, prevented this Ombudsman Body (Órgano Defensor) from hearing and intervening in the matter.”

ON THE MERITS (SOBRE EL FONDO): The Instituto Mixto de Ayuda Social is subject to the principle of legality (principio de legalidad) prevailing under our rule of law (Estado de Derecho). Accordingly, pursuant to the legal system (ordenamiento jurídico), it must verify that the beneficiaries for whom public funds are intended are eligible for our benefits and must also distribute those public funds, which are limited, in the manner that best serves the public purpose (fin público).
In this case, the property belongs to IMAS and, as part of the titling benefit (beneficio de la titulación), a series of requirements must be met before ownership of the property may be granted in a person’s name—here, in the name of Ms. Nombre08.
The Regulations to Laws N°4760 and their Amendments and Laws N° 7083, 7151 and 7154 for Granting Property Deeds to Awardees of IMAS Housing Projects (Reglamento a las Leyes N°4760 y sus Reformas y Leyes N° 7083, 7151 y 7154 para el Otorgamiento de Escrituras de Propiedad a los Adjudicatarios de Proyectos de Vivienda IMAS), in Article 4—Beneficiaries of Titling, provide:
The following shall be beneficiaries of titling, in the order listed and with priority:
In all such cases, where circumstances are equal, IMAS shall seek above all to protect the best interests of the children residing on the property, older adults, and persons with disabilities.”

Article 19.—Registry of professionals and program oversight and monitoring: The Land Titling Area (Área de Titulación de Tierras) shall establish oversight and monitoring mechanisms and procedures to ensure the prompt, timely, and effective implementation of the titling of IMAS properties, the acquisition of properties, and the preparation of topographic plans and, for that purpose, shall:
• Carry out the procedures to publicly tender the procurement of professional services in Social Work, Notarial Services, and Surveying, in accordance with administrative procurement (contratación administrativa) procedures.
• Establish mechanisms and procedures for the oversight, monitoring, and registration of deeds, cadastral plans (planos de catastro), and socioeconomic studies (estudios socioeconómicos) that ensure prompt, timely, and effective implementation.
• Inform the General Management of failures by professionals in Notarial Services, Social Work, and Surveying to prepare, process, and register the documents assigned to them under the Program.
• Coordinate with community organizations, organized sectors, and local public entities on all matters relating to the implementation of the IMAS Titling Program, in accordance with the policies and guidelines issued by this Instituto.
Based on these rules, which apply to this specific case, it follows that there is a procedure that must be observed before titling may be granted to a user. This is the response that was provided to the appellant, Nombre01, on behalf of Nombre02. (The responses are attached to this report.)
However, Ms. Nombre08 has responsibilities and must refrain from damaging the adjoining property; our Institution’s sole responsibility is to grant ownership through titling to the person who proves entitlement to it. This must be done through the corresponding legal proceeding and by means of a resolution of the Consejo Directivo after the matter has passed through the Departamento Socioproductivo and the Dirección Desarrollo Social and has been submitted to the Consejo Directivo for resolution.
The local government of Santa Ana and the Ministerio de Salud must participate in this matter and, within the scope of their respective powers, examine the issues relevant to the complaint submitted by the appellant, Nombre01, on behalf of Nombre02.
It must likewise be made clear to the Sala Constitucional that this is a legality protection action (amparo de legalidad), which must be filed before the Contentious-Administrative Court (instancia Contenciosa Administrativa), and that it is not admissible as an amparo action (recurso de amparo). This is because, since 2008, the legality protection action has provided that disputes between public institutions and citizens concerning prompt and effective justice, as well as matters referring to Article 41 of the Constitution, are no longer adjudicated by the Sala Constitucional. The new legislation, through the Code of Contentious-Administrative Procedure (Código Procesal Contencioso-Administrativo) (Ley No. 8508 de 24 de abril de 2006), establishes that such matters must be filed before the Tribunal Contencioso Administrativo.”
Justice Cruz Castro drafts the opinion; and,
Whereas:
Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since judgment No. 2008-02545 of 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, both for concluding an administrative proceeding—initiated ex officio or at the request of a party—by means of a final administrative act and for adjudicating the applicable administrative appeals. This case specifically presents an exception, because it concerns a complaint filed on behalf of an older adult regarding unsanitary conditions affecting her home. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding (amparo).
Pursuant to article 45 of the Ley de la Jurisdicción Constitucional, if the respondent authority (autoridad recurrida) does not submit its report, the facts alleged by the petitioner are deemed true. The Chamber proceeds to examine whether the amparo is warranted on the basis of the facts presented, which does not mean that the petition is automatically granted. In this specific case, the President of the Concejo Municipal de Santa Ana did not submit the requested report. Accordingly, the report is deemed not to have been submitted, and this Chamber decides the case by assessing the other reports provided, the facts alleged, the evidence attached to the petition for amparo, and the case law of this Court applicable to the specific case.
The petitioner files a petition for amparo and states that the protected party is an older adult who has been diagnosed with bipolar disorder and emotional difficulties, has been a victim of abuse and abandonment by her children, and is living in precarious health and housing conditions. She currently attends a day center in Santa Ana, but her home, located at Dirección04 and adjoining a property owned by IMAS, suffers constant flooding and damage caused by that property, which is used as substandard lodging (cuartería) with poor sanitary and electrical conditions. The petitioner has unsuccessfully sought solutions from the Municipalidad de Santa Ana, the Ministerio de Salud, IMAS, and other institutions such as CONAPAM, the Defensoría de los Habitantes, and even the Presidencia de la República, without any effective measures being adopted. She requests the installation of gutters and the construction of a boundary wall to prevent seepage and risks to her mother’s physical safety. She alleges that the omissions of the respondent authorities have violated the protected party’s fundamental rights and requests that the petition be granted.
The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent authority failed to address them, as warned in the initial order:
Facts related to the Municipalidad de Santa Ana:
1. On 03 de mayo de 2024, municipal inspector Carlos Obando Azofeifa conducted an inspection at Dirección01, Santa Ana, following the complaint filed by Ms. Nombre01. The complainant reported unsanitary conditions, including improper graywater and stormwater outlets, inadequate electrical installations, the use of old and rotting metal sheets as a shared boundary wall, and encroachment upon her mother’s property. The inspection established that the reported neighbors had neither gutters nor downspouts and that the shared boundary wall was in very poor condition; however, the existence of substandard lodging units, the condition of the electrical installations, and the graywater situation could not be verified. It was stated that allegations of encroachment had to be addressed in court and before the Ministerio de Salud, except for the matter involving gutters, which falls within municipal and health jurisdiction (see report submitted by the respondent authority).
2. The petitioner received assistance and a response through the document entitled “Responses to Ms. Nombre01’s Applications,” which reflects the follow-up given to her requests. There are no records showing that the protected party or her representative received assistance from the Red de Cuido or any other social program administered through the Municipalidad’s Vulnerability and Social Risk process (see report submitted by the respondent authority).
Facts related to the Defensoría de los Habitantes de la República:
3. On 23 de agosto de 2024, the petitioner appeared at the Oficina Regional Central de la Defensoría de los Habitantes, located in Barrio México, San José. On that occasion, intervention record N.° 451923-2024-RI was opened, in which the petitioner verbally stated that she had lived under a bridge for 22 years, that she was responsible for caring for her older adult mother, and that the adjoining home, owned by IMAS, was causing damage to her mother’s house because it lacked gutters, creating a risk of falls. She further stated that she had received no response from the competent institutions and that she had applied to the Sala Constitucional (see report submitted by the respondent authority).
4. On that same date, 23 de agosto de 2024, the admissibility officer of the Defensoría de los Habitantes provided the petitioner with assistance and oral advice, informing her that the applicable rules—article 19.2 of Ley N.° 7319 and article 34 of its Regulations—precluded the institution from considering matters pending judicial resolution. She was advised that she had to await the decision on the petition for amparo and that, if the outcome was unfavorable, she could return to the Defensoría with documentation and evidence so that a possible intervention could be assessed (see report submitted by the respondent authority).
5. The petitioner received in-person, individualized assistance; her inquiry was answered orally in accordance with the manner in which it was presented, and she received the corresponding guidance. The report added that the interested party has not provided additional documents or requested a new intervention, and therefore the process has not been reopened (see report submitted by the respondent authority).
Facts related to the Área Rectora de Salud de Santa Ana:
6. On 02 de mayo de 2024, at 14:50 hours, complaint sequence N.°124-2024, filed by Ms. Nombre02 against the property adjoining the south side of her home, was received by the Área Rectora de Salud de Santa Ana. She attached additional documentation to that complaint, including a written submission dated 29 de mayo, an inspection record from the Gobierno Local de Santa Ana, and a municipal report concerning the problem (see report submitted by the respondent authority).
7. On 17 de mayo de 2024, at 19:45 hours, officials from the Área Rectora conducted an initial inspection (Record GSA-52-2024), confirming the discharge of sewage (aguas servidas) into the roadside gutter along the public roadway. A joint inspection with an engineer from the Ministerio de Salud was recommended because of the visible deterioration of the home (see report submitted by the respondent authority).
8. On 17 de junio de 2024, at 10:40 hours, a visit was made to the reported house, but the owner could not be located. Neighbors stated that Ms. Nombre06 lived there, but the property was closed (see report submitted by the respondent authority).
9. On 15 de julio de 2024, at 9:05 hours, another visit was made to the property occupied by Ms. Nombre06, but no one responded (see report submitted by the respondent authority).
10. On 07 de agosto de 2024, at 13:20 hours, another follow-up visit was made to the reported home, but once again no one responded (see report submitted by the respondent authority).
11. On 23 de agosto de 2024, the reported home was formally inspected pursuant to Authorization of Entry Certificate KAHG-16-2024 (see report submitted by the respondent authority).
12. On 20 de septiembre de 2024, Technical Report N.° MS-DRRSCS-DARSSA-IT-0407-2024 was issued, concluding that the home presented unsanitary and hazardous conditions, deficiencies in the electrical system, structural defects, inadequate ventilation, and improper wastewater disposal, creating a public-health risk and contravening articles 313 et seq. of the Ley General de Salud (see report submitted by the respondent authority).
13. Consequently, Health Order (Orden Sanitaria) N.° MS-DRRSCS-DARSSA-OS-123-2024 was issued, granting the occupant, Nombre06, a period of 45 business days to vacate the home located in Santa Ana, Pozos, Dirección01, which had been declared uninhabitable because it was unsanitary and hazardous (see report submitted by the respondent authority).
14. The Ministerio de Salud sent official letters MS-DRRSCS-DARSSA-1658-2024 through MS-DRRSCS-DARSSA-1662-2024 to various institutions—the Municipalidad de Santa Ana, BANHVI, CONAPAM, MIVAH, and IMAS—requesting social-assistance assessments for the occupant of the reported home (see report submitted by the respondent authority).
15. Through official letter MS-DRRSCS-DARSSA-1663-2024, the Ministerio de Salud provided Ms. Nombre02 with a formal response concerning the actions taken in processing her complaint (see report submitted by the respondent authority).
Facts related to the Unidad Local de Desarrollo Social Pavas del Instituto Mixto de Ayuda Social:
16. The protected party, Nombre02, is 79 years old (see report submitted by the respondent authorities).
17. In julio de 2023, according to a field visit referenced by IMAS, it was established that the adjoining lot (Dirección05 of IMAS) was occupied by Nombre08 (see report submitted by the respondent authorities).
18. On 16 de agosto de 2024, through official letter IMAS-DDS-ARDSH-ULDSH-0287-2024, IMAS stated that the adjoining property belongs to IMAS and that a land-registry discrepancy (situación registral) concerning the area of 30,40 m² must be corrected before any titling procedure; it further stated that the process must begin by considering the occupants in the first instance, pursuant to Decreto Ejecutivo N.° 29531-MTSS (see report submitted by the respondent authorities).
19. On 16 de agosto de 2024, through official letter IMAS-DDS-ARDSH-ULDSH-0288-2024, notice was given that the case had been transferred to the Área Regional de Desarrollo Social Suroeste (ARDS Suroeste) (see report submitted by the respondent authorities).
20. On 17 de septiembre de 2024, through official letter IMAS-DDS-ARDSS-ULDSPV-0592-2024, IMAS responded to the applicant by email, providing information on the applicable titling procedure (see report submitted by the respondent authorities).
21. On 01 de octubre de 2024, through official letter IMAS-DDS-ARDSS-ULDSPV-0627-2024, IMAS sent the applicant a new response, reiterating the information previously provided regarding the titling process and requirements (see report submitted by the respondent authorities).
On repeated occasions, this Court has elaborated upon the content of this right, enshrined in Article 50 of the Political Constitution. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, which makes intervention by the branches of government necessary with respect to factors that may disrupt its balance and hinder individuals from developing and thriving in a healthy environment. The State is the guarantor of the protection and safeguarding of the environment and natural resources. In this regard, the oversight and enforcement of environmental matters and activities constitute an essential function of the State; therefore, where environmental protection is concerned, the functions of governance, oversight, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.
As consistently held in this Chamber’s case law, constitutional jurisdiction over environmental matters cannot extend so far as to turn this Chamber into a reviewer of the technical criteria set forth in regulations or issued by administrative authorities in environmental matters. Rather, it is limited to determining whether the competent state agencies have fulfilled the obligation imposed on them by Article 50 of the Political Constitution to act responsibly and promptly in protecting the environment. It has also been held that the admissibility of a constitutional relief proceeding (recurso de amparo) is conditioned upon proof of interference with or a threat to one or more of the rights or guarantees enshrined in the Political Charter or in the international human-rights instruments signed by the country. This latter circumstance highlights the distinctly summary nature of the amparo proceeding (proceso de amparo), whose procedure is ill-suited to slow and complex evidentiary measures or to the need first to examine—with declaratory effect—whether rights below constitutional rank cited by the parties as part of the factual basis of the constitutional relief proceeding or the legally required report (informe de ley), as applicable, actually exist, since this Chamber plainly lacks jurisdiction to do so.
In this situation, it is not appropriate for the Chamber to issue any ruling, whether favorable or unfavorable, in such cases, because in order to determine whether fundamental rights have been violated, that dispute must first be resolved as a matter of ordinary law.
This Constitutional Court has recognized the State’s objective obligation to safeguard human life and has ruled on administrative omissions that jeopardize road safety and the physical integrity of individuals. In this regard, reference should be made to judgment Nº2008-18443 at 18:01 hours on December 11, 2008, which stated:
“Before analyzing the specific case, it is appropriate to note what this Chamber has said regarding the State’s objective obligation to safeguard human life. The right to life, frequently analyzed together with the right to physical integrity, has commonly been understood as a right having negative content; that is, its purpose was limited to a claim against the State requiring it to refrain from actions intended to end the physical existence of individuals, such as torture or the death penalty, or requiring it to punish, through the criminal justice system, public and private persons who harmed the life and physical integrity of others. Nevertheless, the current tendency is to impose various positive duties on the State, in the sense that it must not interfere with the physical existence of individuals and must also act to protect them from the many dangers threatening them, whether those dangers arise from actions by the State itself, by other persons, or even from nature itself.
Hence, for example, environmental matters have become, at least in our country, issues of constitutional concern, since the right to a healthy and ecologically balanced environment has been elevated to the status of a fundamental right. It must now be clarified that the objective existence of a State obligation regarding protection of the right to life does not inescapably entail a subjective right of individuals to demand, through judicial bodies, that a particular measure be taken; it does, however, entail a right to have appropriate measures taken to safeguard that right in the face of manifestly negligent conduct by public authorities. Consequently, the State assumes the obligation to regulate areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, whether through statutes, regulations, agreements, or other measures relating to administrative organization and procedures, as well as the corresponding subjective right of individuals to have the State act accordingly and diligently.
Thus, the possibility of judicially demanding, through amparo, a specific type of affirmative State action in fulfillment of its duty to protect the life and physical integrity of its inhabitants is limited to cases in which an imminent danger to those individual rights is clearly established. Accordingly, if, for example, a particular community considered it necessary to have a hospital to serve its residents, or any other public work, that demand should not be pursued through amparo but through the previously established mechanisms and before the competent bodies and entities, which must consider the request and determine its technical feasibility, without this necessarily implying a favorable response. It follows from the foregoing that intervention by the constitutional jurisdiction is permissible only where the State, acting through the bodies competent to address the requests made by the country’s inhabitants in the exercise of their rights, has demonstrably failed to act (see, to this effect, judgment number 2003-11519 at ten thirty hours on October ten, two thousand three).”
Public institutions must act promptly and efficiently, particularly when providing the services within their purview. In the case of municipalities, the general task assigned to them of addressing local interests and services encompasses a broad range of activities. Judgment No. 2011-012886, at 12:44 hours on September 23, 2011, addressed this matter, and on that occasion the Chamber stated:
“…As established by Article 169 of the Political Constitution and the Municipal Code (Código Municipal), municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy in accordance with the applicable law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electricity and communications services; sound systems for supplying drinking water and disposing of wastewater; adequate aqueduct and sewerage systems; and systems for urban lighting and beautification. It must also provide services for the construction, repair, and cleaning of streets and other public thoroughfares and, in general, concrete and practical plans to make life safe and comfortable for the population. (…) Consequently, in this Court’s view, through its omission the Municipality has endangered the appellants’ and the relevant community residents’ freedom of movement, as well as their right to enjoy a healthy and balanced environment, as recognized in Articles 27 and 50 of the Political Constitution. Accordingly, as to this entity, the present constitutional relief proceeding must be granted….”
After analyzing the evidence submitted, this Court finds that the protected party’s fundamental rights were violated. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, subject to the consequences, including criminal penalties, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that, although the inspection of May 03, 2024, found that gutters were absent and the adjoining wall was in a dilapidated condition, the Municipality disclaimed responsibility on the grounds that these were “problems between private parties” and that installing gutters could amount to “indirect approval” of an alleged tenement building (cuartería). In this regard, that position is deemed to disregard its local administrative police duty (deber de policía administrativa local) concerning construction work, structural safety, and urban sanitation, as well as its duty to coordinate with the health authority.
Even though the building does not adjoin a public roadway, which is the limit established by art. 84 CM regarding gutters, the Municipality retains authority to inspect and penalize construction performed without a permit; order mitigation and safety measures; shut down, where appropriate, unauthorized or hazardous uses; and require and supervise corrective work in coordination with the Ministry of Health and the owner. It must be recalled that the Administration does not satisfy the right of petition or the standard established by constitutional provision 50 through mere notices of “referral” or “follow-up” while the danger persists. Where municipal authority concerning construction enforcement, oversight of uses and works, and enforcement of basic urban requirements; health authority concerning governance, public-health enforcement, and corrective orders; and ownership authority concerning the public owner of the property creating the risk overlap, the obligation is joint: to identify the cause of the harm, order and carry out corrective work, and verify its effectiveness until the risk has been eliminated, while creating a technical record thereof.
Accordingly, the municipal omission is deemed to have perpetuated the risk and impaired the protected party’s rights to health, a healthy environment, and physical integrity. Consequently, the constitutional relief proceeding must be granted against this authority, as indicated in the operative portion (parte dispositiva) of this judgment.
After analyzing the evidence submitted, this Court finds a violation of the fundamental rights of the protected party (parte amparada). From the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter, it has been duly established that, although initial action was taken (opening of a complaint, visits, inspection, and Technical Report MS-DRRSCS-DARSSA-IT-0407-2024), declaring the dwelling adjoining the protected party’s property to be unsanitary and dangerous, discharges of wastewater (aguas servidas) onto the public roadway were also established; this culminated in the issuance of Health Order MS-DRRSCS-DARSSA-OS-123-2024 requiring evacuation because the dwelling was uninhabitable, as well as official communications concerning social-service coordination.
In this regard, it must be stated that the mere issuance of the administrative act (acto) does not satisfy the duty of protection if the order is not served, enforced, and monitored until the source of the risk and its effects on the protected party’s property have been eliminated. The evidentiary record shows that, as of the date of these proceedings, runoff and the dilapidated condition persisted; therefore, the action taken is insufficient. Consequently, the constitutional amparo proceeding (proceso de amparo) against the Ministry of Health must be granted, and the Ministry must be ordered to complete, implement, and supervise the corrective health measures until the risk has been eliminated, in coordination with IMAS and the Municipality, in accordance with the operative portion of this judgment.
After analyzing the evidence submitted, this Court finds a violation of the fundamental rights of the protected party. From the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter, it has been duly established that IMAS itself acknowledges that it is the registered owner of the adjoining property (Dirección05), that the property is occupied by third parties (Nombre08), and that internal title-transfer proceedings (titulación) remain pending due to the “registry status.” Its status as owner is not diminished by the occupancy or by any eventual title-transfer proceeding: IMAS retains duties to safeguard the property and prevent harm arising from public ownership (safeguarding the property, preventing its property from becoming a source of unsanitary conditions/discharges, carrying out minimum corrective and safety work, permitting inspections, and facilitating health-order enforcement).
Accordingly, the existence of a current health order reinforces its obligation to perform the corrective work for which it is responsible as owner, without prejudice to the occupant’s rights. In this case, the official communications sent by IMAS do not establish effective physical measures to eliminate the source of the harm (e.g., temporary channeling of stormwater, roof repairs, replacement of dilapidated enclosures, correction of discharges), or technical coordination to enforce the health order. In view of the foregoing, the constitutional amparo proceeding against the Instituto Mixto de Ayuda Social must be granted, as stated in the operative portion of this judgment.
After analyzing the evidence submitted, this Court finds no violation of the fundamental rights of the protected party. From the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter, it has been duly established that the Defensoría provided information and guidance in person, noting that it was legally barred from hearing the matter while a judicial decision remained pending (art. 19.2 Ley N.° 7319 and art. 34 of its Regulations). In that regard, no unlawful omission has been established. Consequently, the amparo must be denied with respect to the Defensoría de los Habitantes.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the Administrative Litigation Courts, rather than this Chamber, must hear the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo remedy (recurso de amparo) established by article 32 of the Ley de la Jurisdicción Constitucional, in relation to article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s physical acts, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction.
Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases and that may indeed be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases, and for the reasons stated by this Court (judgment N° 2008-02545 at 8:55 a.m. on 22 de febrero de 2008), jurisdiction lies with the Judges of the administrative litigation jurisdiction (jurisdicción de lo contencioso-administrativo), all of which is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
POR TANTO:
The amparo is PARTIALLY GRANTED, solely against the Municipalidad de Santa Ana, the Área Rectora de Salud de Santa Ana, and the Instituto Mixto de Ayuda Social. Consequently, JUAN JOSÉ VARGAS FALLAS, in his capacity as Mayor of the Municipalidad de Santa Ana, and the PRESIDENTE DEL CONCEJO MUNICIPAL DE SANTA ANA; RICARDO OCAMPO SALAS, in his capacity as Director of the Área Rectora de Salud de Santa Ana; and VANESSA HIDALGO CÁRDENAS, in her capacity as head of the Unidad Local de Desarrollo Social Pavas of the Instituto Mixto de Ayuda Social, or whoever may hold those positions, are ordered, within TRES MESES from service of this judgment, to coordinate and carry out the actions necessary to ensure full compliance with Health Order MS-DRRSCS-DARSSA-OS-123-2024, making the corresponding and necessary improvements to prevent harm to the safety and sanitary condition of the dwelling in which the protected party resides.
Furthermore, should obstacles arise due to occupancy of the property, IMAS must coordinate with the social agencies identified in its own official communications (BANHVI, CONAPAM, MIVAH, Municipality, etc.) regarding alternative housing, without halting the performance of the health-related work. The respondent authorities are advised that, pursuant to article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. With respect to the Defensoría de los Habitantes de la República, the amparo is denied. The Municipalidad de Santa Ana, the Instituto Mixto de Ayuda Social, and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the administrative litigation judgment. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiseis de setiembre de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente número 24-030881-0007-CO interpuesto por Nombre01, cédula de identidad CED01, a favor de Nombre02, cédula de identidad CED02, contra la MUNICIPALIDAD DE SANTA ANA, EL MINISTERIO DE SALUD, EL INSTITUTO MIXTO DE AYUDA SOCIAL Y LA DEFENSORÍA DE LOS HABITANTES.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante una denuncia interpuesta a favor de una persona adulta mayor por problemas de insalubridad provocados a su vivienda. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
De conformidad con lo dispuesto en el artículo 45 de la Ley de la Jurisdicción Constitucional, si la autoridad recurrida no rinde su informe, se tienen por ciertos los hechos alegados por la parte recurrente. La Sala entra a estudiar la procedencia del amparo, con la base fáctica expuesta, lo que no implica que automáticamente se acoja el recurso. En el caso concreto, Presidente del Concejo Municipal de Santa Ana no rindió el informe solicitado. Por lo anterior, se tiene por no rendido el informe y esta Sala resuelve el caso valorando los otros informes aportados los hechos denunciados, la prueba que se adjunta al escrito de interposición del amparo y la jurisprudencia de este Tribunal aplicable al caso concreto.
La parte recurrente interpone recurso de amparo y expone que, la amparada es una persona adulta mayor con diagnóstico de bipolaridad y problemas de afectividad, ha sido víctima de abuso y abandono por parte de sus hijos, encontrándose en condiciones precarias de salud y vivienda. Actualmente asiste a un hogar diurno en Santa Ana, pero su casa ubicada en Dirección04, colindante con una propiedad del IMAS, sufre constantes inundaciones y daños ocasionados por ese inmueble, utilizado como cuartería en malas condiciones sanitarias y eléctricas. La recurrente ha gestionado soluciones sin éxito ante la Municipalidad de Santa Ana, el Ministerio de Salud, el IMAS y otras instituciones como CONAPAM, la Defensoría de los Habitantes y hasta la Presidencia de la República, sin que se adoptaran medidas efectivas. Reclama la instalación de canoas y la construcción de una tapia para evitar filtraciones y riesgos a la integridad de su madre. Alega que las omisiones de las autoridades recurridas han vulnerado los derechos fundamentales de la amparada y solicita que se declare con lugar el recurso.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Hechos relacionados con la Municipalidad de Santa Ana:
1. El 03 de mayo de 2024, el inspector municipal Carlos Obando Azofeifa realizó una inspección en Dirección01, Santa Ana, a raíz de la denuncia presentada por la señora Nombre01. La denunciante señaló problemas de insalubridad como malas salidas de aguas grises y pluviales, instalaciones eléctricas inadecuadas, uso de latas viejas y podridas como pared colindante, así como invasión a la propiedad de su madre. En la inspección se constató que los vecinos denunciados no contaban con canoas ni bajantes, y que la pared colindante estaba en muy mal estado; sin embargo, no se pudo comprobar la existencia de cuarterías, el estado de las instalaciones eléctricas ni de las aguas grises. Se indicó que las denuncias sobre invasión debían ventilarse en sede judicial y ante el Ministerio de Salud, salvo lo relativo a canoas que sí constituye competencia municipal y sanitaria (ver informe rendido por parte de la autoridad recurrida).
2. La recurrente recibió atención y respuesta mediante el documento denominado “Respuestas a Trámites de la Sra. Nombre01”, en el que se refleja el seguimiento de sus gestiones. No existen registros de que la amparada ni su representante hayan sido atendidas por la Red de Cuido u otro programa social a cargo del proceso de Vulnerabilidad y Riesgo Social de la Municipalidad (ver informe rendido por parte de la autoridad recurrida).
Hechos relacionados con la Defensoría de los Habitantes de la República:
3. El 23 de agosto de 2024, la recurrente se presentó en la Oficina Regional Central de la Defensoría de los Habitantes, ubicada en Barrio México, San José. En esa ocasión se procedió a la apertura del registro de intervención N.° 451923-2024-RI, en el cual la recurrente expuso de manera verbal que desde hace 22 años ha vivido debajo de un puente, que está a cargo del cuido de su madre adulta mayor y que la vivienda colindante, propiedad del IMAS, provoca daños a la casa de su madre al carecer de canoas, generando riesgo de caídas. Indicó además que no había recibido respuesta de las instituciones competentes y que había acudido a la Sala Constitucional (ver informe rendido por parte de la autoridad recurrida).
4. En esa misma fecha, 23 de agosto de 2024, la profesional de admisibilidad de la Defensoría de los Habitantes brindó atención y asesoría verbal a la recurrente, informándole que la normativa aplicable —artículo 19.2 de la Ley N.° 7319 y artículo 34 de su Reglamento— impide conocer asuntos que estén pendientes de resolución judicial. Se le indicó que debía esperar la resolución del recurso de amparo y que, en caso de resultar desfavorable, podría acudir nuevamente a la Defensoría con documentación y pruebas para valorar una eventual intervención (ver informe rendido por parte de la autoridad recurrida).
5. La atención a la recurrente fue presencial y personal, se evacuó verbalmente su consulta conforme a la forma en que fue planteada, y se le brindó la orientación correspondiente. Agregó que la interesada no ha aportado documentos adicionales ni solicitado una nueva intervención, por lo que no se ha reactivado el proceso (ver informe rendido por parte de la autoridad recurrida).
Hechos relacionados con el Área Rectora de Salud de Santa Ana:
6. El 02 de mayo de 2024, a las 14:50 horas, ingresó ante el Área Rectora de Salud de Santa Ana la denuncia consecutivo N.°124-2024, presentada por la señora Nombre02 contra la propiedad colindante al costado sur de su vivienda. En dicha denuncia adjuntó documentación adicional, entre ellos un escrito del 29 de mayo, un acta de inspección del Gobierno Local de Santa Ana y un informe municipal sobre la problemática (ver informe rendido por parte de la autoridad recurrida).
7. El 17 de mayo de 2024, a las 19:45 horas, funcionarios del Área Rectora realizaron una primera inspección (Acta GSA-52-2024), corroborando la disposición de aguas servidas al cordón de caño vía pública. Se recomendó una inspección conjunta con ingeniero del Ministerio de Salud, ante el deterioro visible de la vivienda (ver informe rendido por parte de la autoridad recurrida).
8. El 17 de junio de 2024, a las 10:40 horas, se efectuó visita a la casa denunciada, sin lograr ubicar a la propietaria. Vecinos indicaron que allí habitaba la señora Nombre06, pero el inmueble se encontraba cerrado (ver informe rendido por parte de la autoridad recurrida).
9. El 15 de julio de 2024, a las 9:05 horas, se realizó nueva visita al inmueble ocupado por la señora Nombre06, sin obtener atención (ver informe rendido por parte de la autoridad recurrida).
10. El 07 de agosto de 2024, a las 13:20 horas, se efectuó otra visita de seguimiento a la vivienda denunciada, nuevamente sin ser atendida (ver informe rendido por parte de la autoridad recurrida).
11. El 23 de agosto de 2024, mediante Constancia de Autorización de Ingreso KAHG-16-2024, se efectuó la inspección formal de la vivienda denunciada (ver informe rendido por parte de la autoridad recurrida).
12. El 20 de septiembre de 2024, se emitió el Informe Técnico N.° MS-DRRSCS-DARSSA-IT-0407-2024, concluyendo que la vivienda presenta condiciones de insalubridad y peligrosidad, deficiencia en el sistema eléctrico, fallas estructurales, ventilación inadecuada y disposición incorrecta de aguas residuales, generando riesgo para la salud pública y contraviniendo los artículos 313 y siguientes de la Ley General de Salud (ver informe rendido por parte de la autoridad recurrida).
13. Como consecuencia, se dictó la Orden Sanitaria N.° MS-DRRSCS-DARSSA-OS-123-2024, otorgando un plazo de 45 días hábiles a la ocupante Nombre06 para desalojar la vivienda ubicada en Santa Ana, Pozos, Dirección01, declarada inhabitable por insalubre y peligrosa (ver informe rendido por parte de la autoridad recurrida).
14. El Ministerio de Salud remitió oficios MS-DRRSCS-DARSSA-1658-2024 a MS-DRRSCS-DARSSA-1662-2024 a distintas instituciones —Municipalidad de Santa Ana, BANHVI, CONAPAM, MIVAH e IMAS— solicitando estudios de ayuda social para la ocupante de la vivienda denunciada (ver informe rendido por parte de la autoridad recurrida).
15. Mediante oficio MS-DRRSCS-DARSSA-1663-2024, el Ministerio de Salud brindó respuesta formal a la señora Nombre02 sobre lo actuado en el trámite de su denuncia (ver informe rendido por parte de la autoridad recurrida).
Hechos relacionados con la Unidad Local de Desarrollo Social Pavas del Instituto Mixto de Ayuda Social:
16. La amparada Nombre02, tiene 79 años (ver informe rendido por parte de las autoridades accionadas).
17. En julio de 2023, según visita de campo referida por el IMAS, se constató que el lote colindante (Dirección05 del IMAS) está ocupado por Nombre08 (ver informe rendido por parte de las autoridades accionadas).
18. El 16 de agosto de 2024, mediante oficio IMAS-DDS-ARDSH-ULDSH-0287-2024, el IMAS indicó que la propiedad colindante pertenece al IMAS y que existe situación registral (área 30,40 m²) que debe rectificarse antes de cualquier trámite de titulación; además, que el proceso debe iniciarse considerando en primera instancia a las personas ocupantes conforme al Decreto Ejecutivo N.° 29531-MTSS (ver informe rendido por parte de las autoridades accionadas).
19. El 16 de agosto de 2024, por oficio IMAS-DDS-ARDSH-ULDSH-0288-2024, se informó el traslado del caso al Área Regional de Desarrollo Social Suroeste (ARDS Suroeste) (ver informe rendido por parte de las autoridades accionadas).
20. El 17 de septiembre de 2024, por oficio IMAS-DDS-ARDSS-ULDSPV-0592-2024, el IMAS respondió a la gestionante vía correo electrónico, con alcances sobre el procedimiento de titulación aplicable (ver informe rendido por parte de las autoridades accionadas).
21. El 01 de octubre de 2024, por oficio IMAS-DDS-ARDSS-ULDSPV-0627-2024, el IMAS remitió nueva respuesta a la gestionante, manteniendo lo señalado sobre el trámite y requisitos de titulación (ver informe rendido por parte de las autoridades accionadas).
En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
Tal y como ha sido reiterado en la jurisprudencia de esta Sala, la competencia constitucional en materia ambiental no puede extenderse al punto en que se convierta en un verificador de los criterios técnicos vertidos en las normas o por las autoridades administrativas en materia ambiental, sino que se limita a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política, de asumir una actuación responsable y oportuna respecto a la protección del ambiente. Se ha sostenido también, que la procedencia del recurso de amparo está condicionada a que se acredite la existencia de una perturbación o amenaza a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se aviene bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, toda vez que es evidente que esa es una competencia de la que esta Sala carece.
Ante esta situación, no resulta procedente que la Sala vierta pronunciamiento alguno (positivo o negativo) en estos casos, porque para dilucidar si ha habido infracción o no de derechos fundamentales primero se debe resolver dicho conflicto en el plano de la legalidad.
Este Tribunal Constitucional ha reconocido la obligación objetiva del Estado de tutelar la vida humana y se ha pronunciado sobre las omisiones administrativas que atentan contra la seguridad vial y la integridad física de las personas. Sobre el particular, cabe referir lo dispuesto en sentencia Nº2008-18443 de las 18:01 horas del 11 de diciembre de 2008, donde se indicó:
“Previo análisis del caso concreto, conviene indicar lo dicho por esta Sala en cuanto a la obligación objetiva del Estado de tutelar la vida humana, en el sentido que ha sido usual que el derecho a la vida, frecuentemente analizado junto con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, que su objeto se limitaba a la pretensión contra el Estado de que se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo, la tortura o la pena de muerte, o bien, que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal. No obstante, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido de que no debe perturbar la existencia física de las personas y, además, debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza.
De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. En consecuencia, se trata de que el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos y del derecho subjetivo de las personas a que así se proceda, en forma diligente.
Así, la posibilidad de exigir judicialmente, a través de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas, de forma tal que si, por ejemplo, una determinada comunidad estimara necesario contar con un hospital para la atención de sus pobladores (o de cualquier otra obra pública) no es por la vía del amparo que se debe exigir, sino a través de los mecanismos previamente establecidos y ante los órganos y entes competentes, quienes deberán atender la petición y resolver su procedencia técnica, que no implica necesariamente una respuesta positiva. De lo anterior, se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver en este sentido la sentencia número 2003-11519 de las diez horas con treinta minutos del diez de octubre de dos mil tres)”.
La actuación de las instituciones públicas debe ser célere y eficiente, sobre todo cuando se trata de proveer los servicios que les competen. En el caso de las municipalidades, al asignárseles la labor genérica de atender los intereses y servicios locales, se abarca un amplio conjunto de actividades. En la sentencia No. 2011-012886, de las 12:44 horas del 23 de setiembre de 2011, se abordó esta materia, y en esa oportunidad la Sala indicó:
“…Conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población. (…) Por consiguiente, a juicio de este Tribunal, con su omisión, la Municipalidad ha puesto en situación de peligro el libre transitar de los recurrentes y vecinos de la comunidad en cuestión, así como el derecho a disfrutar de un ambiente sano y equilibrado, reconocidos en los artículos 27 y 50 de la Constitución Política, por lo que, en cuanto a esta entidad, el presente recurso deberá ser declarado con lugar…”.
Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, aunque la inspección del 03 de mayo de 2024 constató ausencia de canoas y estado ruinoso de la pared colindante, la Municipalidad se desentendió alegando tratarse de “problemas entre privados” y que la colocación de canoas podría implicar “aprobación indirecta” de una supuesta cuartería. En ese sentido, se estima que tal postura desconoce el deber de policía administrativa local sobre obras, seguridad constructiva y salubridad urbana y su deber de coordinación con la autoridad sanitaria.
Aun cuando la edificación no colinde con la vía pública (límite del art. 84 CM respecto de canoas), la Municipalidad conserva potestades para: fiscalizar y sancionar obras sin permiso ordenar medidas de mitigación y seguridad; clausurar, en su caso, usos clandestinos o peligrosos; requerir y supervisar obras correctivas coordinadas con Salud y con el propietario. Debe recordarse que, la Administración no satisface el derecho de petición ni el estándar del ordinal 50 constitucional con meros oficios de “traslado” o “seguimiento” si el peligro persiste. Cuando concurren potestades municipales (policía de construcción, control de usos y obras, fiscalización de cánones urbanos básicos), sanitarias (rectoría, policía sanitaria, órdenes correctivas) y dominicales (propietario público del inmueble generador del riesgo), la obligación es conjunta: identificar la causa del daño, ordenar y ejecutar las obras correctivas, y verificar su eficacia hasta la remoción del riesgo, dejando constancia técnica.
Así las cosas, se estima que la omisión municipal mantuvo el riesgo y afectó los derechos a la salud, a un ambiente sano y a la integridad física de la amparada. En consecuencia, el amparo debe declararse con lugar contra esta autoridad, tal como se indica en la parte dispositiva de esta sentencia.
Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, si bien consta actuación inicial (apertura de denuncia, visitas, inspección e Informe Técnico MS-DRRSCS-DARSSA-IT-0407-2024), que declara la vivienda insalubre y peligrosa, la vivienda colindante a la propiedad de la amparada, también se acreditan vertidos de aguas servidas a la vía pública; lo que culminó en la emisión de la Orden Sanitaria MS-DRRSCS-DARSSA-OS-123-2024 para desalojar por inhabitabilidad y oficios de articulación social. Al respecto, debe indicarse que, la sola emisión del acto no satisface el deber de tutela si la orden no se notifica, ejecuta y verifica hasta remover la fuente de riesgo y sus efectos en la propiedad de la amparada.
Del acervo se desprende que, a la fecha de autos, persistían los escurrimientos y el estado ruinoso; por tanto, la actuación resulta insuficiente. Consecuentemente, debe declararse con lugar el proceso de amparo en contra el Ministerio de Salud, ordenándole completar, ejecutar y supervisar las medidas sanitarias correctivas hasta la eliminación del riesgo, en coordinación con el IMAS y la Municipalidad, lo anterior de conformidad con lo indicado en la parte dispositiva de esta sentencia.
Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, el propio IMAS reconoce ser propietario registral de la finca colindante (Dirección05) y la ocupación por terceros (Nombre08), así como trámites internos de titulación pendientes por “situación registral”. La condición de propietario no se diluye por la ocupación ni por el eventual proceso de titulación: el IMAS mantiene deberes de custodia y prevención del daño derivados de la propiedad pública (custodia del bien, evitar que su bien sea foco de insalubridad/vertidos, ejecutar obras mínimas de corrección y seguridad, permitir inspecciones y facilitar la ejecución sanitaria).
De esta manera, la existencia de una orden sanitaria vigente refuerza su obligación de realizar las obras correctivas que le correspondan como dueño, sin perjuicio de los derechos de la ocupante. En el caso, los oficios remitidos por el IMAS no acreditan acciones materiales eficaces para suprimir la fuente del daño (p. ej., canalización provisoria de pluviales, reparación de cubiertas, sustitución de cerramientos ruinosos, corrección de descargas), ni coordinación técnica para ejecutar la orden sanitaria. Por lo anterior, procede declarar con lugar contra el proceso de amparo en contra del Instituto Mixto de Ayuda Social, tal como se indica en la parte dispositiva de esta sentencia.
Después de analizar los elementos probatorios aportados, este Tribunal descarta la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, la Defensoría informó y orientó de manera presencial, advirtiendo impedimento legal de conocer mientras pendía resolución judicial (art. 19.2 Ley N.° 7319 y art. 34 de su Reglamento). En ese sentido, no se acredita omisión ilegítima. En consecuencia, el amparo debe declararse sin lugar respecto de la Defensoría de los Habitantes.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara PARCIALMENTE CON LUGAR el recurso, únicamente, en contra de la Municipalidad de Santa Ana, el Área Rectora de Salud de Santa Ana y el Instituto Mixto de Ayuda Social. Consecuentemente, se ordena a JUAN JOSÉ VARGAS FALLAS, en condición de Alcalde de la Municipalidad de Santa Ana y al PRESIDENTE DEL CONCEJO MUNICIPAL DE SANTA ANA, a RICARDO OCAMPO SALAS, en condición de Director del Área Rectora de Salud de Santa Ana, y a VANESSA HIDALGO CÁRDENAS, en condición de jefa de la Unidad Local de Desarrollo Social Pavas del Instituto Mixto de Ayuda Social o a quienes ocupen esos cargos que, en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, coordinen y ejecuten las acciones necesarias a efectos de dar cabal cumplimiento a la Orden Sanitaria MS-DRRSCS-DARSSA-OS-123-2024, realizando las mejoras correspondientes y necesarias para evitar la afectación de seguridad y salubridad de la vivienda en la cual reside la amparada.
Asimismo, si surgieren obstáculos por la ocupación del inmueble, el IMAS deberá coordinar con las instancias sociales indicadas en sus propios oficios (BANHVI, CONAPAM, MIVAH, Municipalidad, etc.) para alternativas habitacionales sin paralizar en la ejecución de las obras sanitarias. Se advierte a la autoridades recurridas que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. En relación con la Defensoría de los Habitantes de la República, se desestima el recurso. Se condena a la Municipalidad de Santa Ana, al Instituto Mixto de Ayuda Social y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo pone nota. Notifíquese.
