Document Review Decision No. 2025030948 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on veintiseis de setiembre de dos mil veinticinco.
Amparo action (recurso de amparo) filed by Nombre01, identity card CED08, against EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL MINISTERIO DE SALUD, AND LA MUNICIPALIDAD DE SANTA CRUZ.
FINDINGS OF FACT:
• Ley General de Salud (Articles 285 to 292): Requires the Ministerio de Salud to order the developer to correct health-related problems immediately.
• Ley General de la Administración Pública (Article 66): Clarifies that public powers are nonwaivable and nontransferable.
• Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA, Agreement No. 2022-354 of the AyA Board of Directors, published in SUPPLEMENT No. 171 to LA GACETA No. 151 of Wednesday, 10 de agosto del 2022: Establishes the technical, legal, and operational procedures and requirements that must be met before AyA may accept and operate sanitation systems.
The health authority was emphatically advised that the developer must formally submit an application to transfer the PTAR to AyA, complying with all regulatory requirements, and that the Ministerio de Salud must enforce the health orders and require the developer to correct the deficiencies immediately. AyA is not responsible for assuming obligations that do not legally or operationally apply to it. FOURTH: Regarding the allegation: “On 16 de abril de 2025, a formal complaint was filed with the Municipalidad de Santa Cruz describing a serious problem. According to an approved paving project, while the successful bidder was performing drainage work, and according to the report of the municipal engineer, whom I quote verbatim: ‘while trenching at a depth of approximately 3 meters, they discovered foul-smelling water seeping out and determined that it came from the pipeline carrying water treated by the sewage Treatment Plant of the Residencial EL cacao Project.
The plant had ceased operating properly at least 15 days before that date because it had become blocked, causing sewage to overflow from the tank, with fecal waste exposed in the open air and a strong foul odor, thereby posing a direct and imminent threat to the health of the community’s residents and others, as well as harming the environment and the quality of life of those of us who live here. Although the Municipalidad immediately began taking action, the process has been excessively slow, and the harmful and severe effects persist as of today, 08 de julio, because the situation remains as it was on the first day and has become much worse, as the waste rots and floods more each day without any outlet. We cannot bear it any longer, and our Quebrada Campero is becoming more polluted and completely destroyed each day because all the waste is discharged there. The portion of the paving project through which the treatment-plant pipeline runs has now been suspended until the problem is resolved…’” Based on Report SG-GSP-RT-2025-00114, which was attached to official letter SG-GSP-RT-2025-00115, an inspection determined that the company hired by the Municipalidad, which was responsible for the paving work, caused breaks in both the drinking-water pipeline and the wastewater pipeline.
The break in the wastewater pipeline was confirmed because the residents themselves stated, in connection with this matter, that the company broke “the orange pipe”; that this occurred in March while the company hired by the Municipalidad was performing the work; and that, several days later, the same company that caused the damage “covered the damaged pipeline with concrete.” It further states: “(…) BACKGROUND. According to the information available to AyA, the project obtained endorsement of its basic plans (visado de planos básicos) in 2009 as Conjunto Residencial de Interés Social El Cacao, with Social-Interest Declaration (Declaratoria de Interés Social) BCR-CSO-05-2009 and Promociones de Viviendas Económicas S.A., Identification Number CED05, as the registered owner. In 2012, the developer submitted a letter undertaking that Construcciones Modulares de Costa Rica S.A. would operate the PTAR; this was done in order to process modification N°1.
The resolution approving the modification procedure stated that approval of the 2009 original-plan procedure (official letter URB-2013-021) was rendered null and void and that the project would treat its wastewater by means of a wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR). In 2019, a new application was filed with the Urban Development Directorate under OC873766, which was not approved because it concerned an update to the plans for the PTAR, which had already been built and was operating. Through Health Order MS-RCH-ARS-SC-ERS-OS-037-2024, the Chorotega Region was informed that the El Caco PTAR was operating improperly. Report MS-RCH-ARS-SC-ERST-IT-067-2024 referred to problems with the operation of the PTAR since 2022, and because of noncompliance with effluent-discharge parameters (parámetros de vertido), several health orders (órdenes sanitarias) have been issued to the project administration (a matter for which it is responsible as the operator of the PTAR).
The Developer has not ensured the proper functioning of the infrastructure, nor has it implemented any mitigation plan (plan de mitigación) to prevent harmful environmental effects, such as those now being caused by the Cacao system; however, according to prior inspections conducted by the institution, neither the residential development’s sanitary sewer network (alcantarillado sanitario) nor the outfall (desfogue) has exhibited any blockages. The Municipalidad de Santa Cruz, for its part, began a street-paving project by hiring a company, and the dates of that work coincide with the worsening condition of the El Cacao System Wastewater Treatment Plant, specifically the malfunctioning of the outfall due to a blockage, which in turn prevents the wastewater from being treated and causes it to accumulate in the PTAR.
ANALYSIS An inspection visit was made to the El Cacao sanitation system (sistema de saneamiento) on 18 August of the current year, and it was confirmed that the PTAR was not operating; the sanitary sewer had blockages in the line leading to the discharge into the receiving water body (cuerpo receptor); and the PTAR was shut down and completely abandoned, with raw sewage flooding the site to approximately 60 cm above natural ground level, as shown in the photographic record. The site is privately owned and is enclosed by perimeter fencing protected with barbed wire and by gates secured with chains and padlocks; no operating personnel were present at the time of the visit. During the inspection, three local residents were interviewed in an attempt to locate the person responsible for providing access to the PTAR; however, that person could not be located. In addition, the residents are uncertain as to who is actually responsible for the administration, operation, and maintenance of the PTAR because, according to them, the keys are held by Grupo Mutual.
They stated that this is because Banco Improsa is no longer responsible for the project; they further stated that the Developer ceased taking responsibility for the PTAR a long time ago and that Grupo Mutual has taken over the project. The residents said that a member of the community had previously been responsible for maintaining the PTAR; however, that person is no longer in charge, and they do not know whether anyone else currently performs those duties. The residents also reported that, despite the presence of an apparently functional electricity meter, the equipment has been disconnected, and there is no certainty as to who made that decision; they assume it was taken as a precaution because of the flooding currently affecting the site. The location of the PTAR is clearly abandoned and neglected, with no maintenance whatsoever of either the infrastructure or the green areas (…) At the time of the inspection visit, the PTAR was completely flooded with wastewater, to approximately 60 cm above natural ground level, causing foul odors in the area.
(…) As shown in Image 4, the aeration tanks and settling tank (tanque sedimentador) are completely submerged, as are the walkways and part of the drying beds (lechos de secado), with the water even reaching the floor level of the machinery building and warehouse. For reference and comparison purposes, several photographs taken in 2019 during an inspection by institutional personnel are attached, showing the PTAR structures in operation (…) It should be noted that, during the inspection, the route to the PTAR discharge point (punto de vertido) was also inspected in the company of several local residents. During the inspection, the residents identified the locations where the company hired by the municipality, which was responsible for the paving work, caused breaks in both the potable-water pipe and the wastewater pipe; the break in the wastewater pipe was confirmed because the residents themselves stated in this regard that the company broke “the orange-colored pipe.” Ms.
Nombre02, identification card CED06, a local resident, stated that this occurred in March during the performance of the work by the company hired by the Municipalidad and that the water flowing out looked and smelled very bad. Ms. Chavarría also stated that she was directly affected because her home is located almost directly across from the damage and that, several days later, the same company that caused the damage “covered the damaged pipe with concrete.” The same account was provided by Mr. Nombre03, identification card CED07, who stated that the problems with the PTAR began after this event. It is important to note that Ms. Nombre02 was asked whether, before this event, she had ever noticed or detected an outbreak of this wastewater or foul odors. She replied that nothing like that had ever happened and that she was affected only while the orange pipe remained broken, because once the company sealed it with concrete, she no longer detected foul odors.
The receiving water body for the wastewater from the PTAR in question was also visited. The discharge point was found to be completely dry, indicating that the sewer is blocked upstream of that point, which is consistent with the residents’ accounts that the network is obstructed (…)
INSPECTION RESULTS • The collection system (sanitary sewer) is blocked along the section that discharges into Río Campero.
• Access to the PTAR was not obtained; nevertheless, it was confirmed that the plant is not being operated, and neither the operator nor anyone monitoring the equipment was present at the site.
• Neither the PTAR infrastructure nor its green areas are being maintained.
• The PTAR is not operating, the equipment is shut down, and the PTAR treatment systems, in both the primary and secondary treatment processes, are abandoned and flooded with wastewater.
• The PTAR operating logbook (bitácora de operación) could not be accessed.
• It was confirmed that roadway-preparation work has been carried out, as well as the installation of stormwater pipes and the construction of storm drains and stormwater manholes.
The wastewater collection and treatment system of the Conjunto Residencial de Interés Social El Cacao is neither administered nor owned by AyA, and therefore its operation and maintenance do not fall within the Instituto’s authority. If any harm to health exists, it would not arise from any act falling within AyA’s authority or responsibility, but would instead be attributable to the Developer, as established by current legislation. It is important to note that the PTAR of the Residencial de Interés Social El Cacao has not been accepted for administration by AyA, and its operation and maintenance therefore remain the responsibility of its owners. The transfer of the works to the Instituto is an act undertaken at the Developer’s discretion. Once the requirements of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA have been met, the Developer must submit a formal request expressing its desire to transfer the PTAR so that the Instituto may verify compliance and accept, operate, and maintain it.
The Ley General de Administración Pública, in Article 66, clearly states that governmental powers and their exercise, and public duties and their performance, shall be nonwaivable, nontransferable, and not subject to any statute of limitations as of that provision and in supplementation of what it provides. The Ley General de Salud, in Articles 285 through 292, states that the Ministerio de Salud has an unavoidable duty to address the matter directly and compel the Developer to immediately correct the problem caused by the improper disposal of wastewater, a situation that is creating health problems affecting the community adjacent to the project.
In this regard, AyA is NOT required to resolve the technical problem affecting the operation of the PTAR, because the Institution cannot arbitrarily take over private infrastructure without complying with the proper procedures for the acceptance and operation of works (pursuant to Chapter III of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, which governs the requirements and procedures for assuming the administration, operation, and maintenance of sanitation systems).
During the procedure for acceptance of the project by AyA, the Developer must fully comply with Article 12 of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados. To date, no request has been submitted by the person responsible for the El Cacao residential development to transfer the sanitation works to AyA.
Accordingly, the Developer is responsible for maintaining the collection and treatment system of the El Cacao PTAR. The Developer is also responsible for ensuring that the systems are operated optimally and for complying with the health orders issued by the Ministerio de Salud, which in turn is responsible for ensuring that those orders are mandatory and for fulfilling its duties under the Ley General de Salud.
Finally, it should be stated that compliance with legal, technical, and operational requirements is necessary before AyA may accept wastewater sanitation systems. Those requirements must be met by the private party so that the Instituto can efficiently provide the required services, without accepting systems that would become a burden and create an additional need for investment of public funds, the cost of which should have been borne by the party that developed the construction project.
RECOMMENDATIONS • Request that the Municipalidad de Santa Cruz arrange for the El Cacao PTAR facilities to be cleaned by having all wastewater pooled at the site suctioned out through a collection service provided by an authorized company, thereby preventing the discharge of raw sewage into Río Campero.
• Request that the Municipalidad de Santa Cruz remove the blockage and repair the damaged section of sanitary sewer pipe in its capacity as the contracting party of the company responsible for the damage.
CONCLUSIONS
• The sanitation infrastructure in the Cacao project has not been formally transferred in accordance with the procedure established for that purpose.
• There is no record of a formal request from the interested parties (the Developer) for AyA to begin the process of taking over this sanitation system in accordance with the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA.
• Compelling AyA to take over the system under its current conditions would be contrary to law and would constitute a mechanism for exempting the Developer from making the required investment.
This would mean charging the State, through public funds, with carrying out the works that the Developer should have guaranteed would be built from the project’s inception. • There is evidence of apparent noncompliance by the infrastructure operators, since records from years ago already document operational problems and the discharge of apparently untreated water into the river. • The sanitation infrastructure is privately owned and is not currently being operated; it does not even have operating technicians. • It must be clarified that both the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) and the system for collecting and discharging treated water into the receiving water body must be in good operating condition before any commissioning and acceptance process can be completed. • It was not possible to contact the persons responsible for the PTAR to gain access and conduct a detailed assessment of its components.
Consequently, no thorough and accurate diagnosis of the current condition of the works is available. • Compelling the investment of public resources to remedy deficiencies in infrastructure that must be designed, built, and operated in compliance with applicable regulations would provide an easy and questionable means for some developers to evade their fundamental statutory obligations. • The Municipalidad de Santa Cruz must be held responsible for the damage caused to the sanitary sewer system (alcantarillado sanitario) in the discharge section leading to Río Campero, to the PTAR, and to the environment as a result of the pipe blockage, which has caused the stagnation and flooding of PTAR El Cacao. • Regarding the request that “such waste” be transferred to the PTAR in Dirección01, Santa Cruz, science and engineering indicate that certain conditions prevent the request from being carried out, as it entails transferring the waste to another PTAR located 2 kilometers away.
First, the elevation levels of both properties and their respective slopes are unknown, which would require a topographical survey of the area; second, a separate design would be required to convey such wastewater to the new PTAR; third, the collection and treatment capacity of the Barrio las Maravillas Treatment Plant would have to be assessed; fourth, this investment would have to be borne by the Developer and owner of the current PTAR El Cacao and would be more costly than rehabilitating the existing facilities and correcting their operation. (…)” SUBSTANTIVE CONSIDERATIONS Local Governments have the authority, through urban planning, to impose a series of restrictions on construction and development projects. It should be emphasized that, if the conditions they impose are breached, they possess various enforcement mechanisms to secure compliance with their orders, mechanisms that AyA lacks.
In addition, it is clear that the Municipalities are the entities that collect the corresponding amounts for the maintenance and proper operation of the stormwater drainage network, as provided in Código Municipal No. 7794, Title IV, Municipal Treasury, Chapter II, Municipal Revenue. In the present case, it cannot be overlooked that, when Municipalities collect municipal taxes, they include the corresponding charge for maintaining and operating the stormwater drainage network, as well as the sanitation systems under their administration and public roads. This underscores municipal jurisdiction in this field; moreover, it is evident that this charge should be used for the maintenance and operation of each Municipality’s stormwater drainage network and treatment plants, as stated by Sala Constitucional in Voto 2001-2320, Considerando IV (…) Likewise, Ley General de Salud No. 5395, specifically with respect to the matter at issue, provides as follows in Articles 285 and 292: “ARTICLE 292.—The discharge of sewage, wastewater, and industrial waste into stormwater sewers is prohibited in all cases.
The Ministry is authorized to restrict, regulate, or prohibit the disposal of nonbiodegradable synthetic products through systems for collecting excreta, sewage, and wastewater. ARTICLE 285.—Excreta, sewage, wastewater, and stormwater shall be disposed of properly and under sanitary conditions so as to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution through conditions that compromise its purity or quality.” In the same regard, Article 1 of Ley de Construcciones N° 833 provides as follows: “The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary standards of safety, sanitation, convenience, and beauty in their public roads and in the buildings and structures erected on their land, without prejudice to the powers granted by law in these matters to other administrative bodies.” The foregoing demonstrates the connection between municipal obligations concerning stormwater and sanitary sewerage and the obligation noted above, which are interrelated and fall under the administration of Local Governments as part of the services they are required to provide.
Article 60 of Ley Orgánica del Ambiente, concerning the prevention and control of pollution, provides: “To prevent and control environmental pollution, the State, the municipalities, and other public institutions shall give priority, among other matters, to establishing and operating adequate services in areas fundamental to environmental health, such as: a) The supply of water for human consumption. b) The sanitary disposal of excreta, wastewater, and stormwater. c) Waste collection and management. d) Control of air pollution. e) Control of noise pollution. f) Control of chemical and radioactive substances. These services shall be provided in the manner prescribed by specific laws and regulations, while seeking the participation of the population and its organizations.” Based on the cited provisions, it is concluded that Municipalidad de Santa Cruz bears direct responsibility for determining the measures required to resolve the problem involving repairs to the discharge pipes and administration of the wastewater treatment plant, since it was also the entity that approved the urban development in that area at the relevant time.
The Registered Owner is likewise responsible. If it is decided to transfer administration to AyA so that AyA may, in turn, delegate it to an ASADA where appropriate, the owner-developer must comply with Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022. This is without prejudice to coordinating with entities capable of arranging for the sewer system to be brought into proper condition and likewise ensuring that owners use the system appropriately, once the components and the land on which the treatment plant is located have been accepted under its administration. The Municipality is also responsible for making the corresponding repairs to any damage caused to the sanitation systems during the works undertaken as part of Proyecto de Pavimentación El Cacao in Santa Cruz, Guanacaste, where the awarded contractor uncovered a serious problem while excavating a trench approximately three meters deep, ruptured the main pipe, and chose to seal it with concrete, thereby preventing gravity-driven hydraulic discharge at the discharge point.
In this regard, Municipalidad de Santa Cruz is obligated to enforce the laws governing land-use planning (ordenamiento territorial) and to guarantee the right of the area’s residents to enjoy a healthy and ecologically balanced environment, given the health consequences for those persons arising from the nature of the sanitation problem affecting them. Although the Municipality has full knowledge of the problem affecting residents of its canton, it has confined itself to confirming the problem’s existence and evading its responsibility, without taking timely action to mitigate or control it. Likewise, if acceptance for administration is required, both the Registered Owner and the Municipality must ensure compliance with the requirements set forth in Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022, so that AyA may accept the system after the requirements established by the regulations have been met and may then delegate it to the ASADA, if appropriate.
Consideration must also be given to the prior assessment by Procuraduría General de la República in opinion C-257-2003 San José, 27 de agosto de 2003 (consistent with the substantive assessment conducted by Sala Constitucional in Expediente 16-002436-0007-CO, decision 2016-006368) regarding the requirement that AyA and Ministerio de Salud verify the technical suitability of sewage treatment plants. For the transfer to be authorized, the requirements established by this Institute must be satisfied so as to authorize the transfer to Instituto Costarricense de Acueductos y Alcantarillados of the corresponding portion of the public-use area where the plant is located, enabling the Institute to administer and operate it. In this regard, the aforementioned Opinion states: “…Instituto Costarricense de Acueductos y Alcantarillados is the entity that determines, pursuant to the transcribed provision, when urban developments must have sewage treatment plants.
In this matter, the municipalities are responsible for ensuring that urban-development projects to be carried out in their canton comply with the standards established by AyA concerning aqueducts and sewer systems, including the requirement to provide for sewage treatment plants when AyA has so ordered. Once the works have been built and at the time of their acceptance, the municipalities exercise oversight regarding compliance with the corresponding regulatory provisions, including those concerning drinking-water facilities and the collection and discharge of sewage as required by Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities, all in accordance with Article VI.6. of Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, which provides: “VI.6. Acceptance of works: The works and public areas shall be accepted in accordance with the regulations in force in the municipality of the canton and in the other public agencies that exercise oversight functions in this regard.
No omission of details from the approved plans shall release the developer or the responsible professional from their obligations concerning the complete and satisfactory delivery of the works, as established in these regulations.
The developer and the responsible professional who sign the application for approval of the construction plans are guarantors of the works’ strict conformity with the applicable regulatory requirements, in accordance with the applicable laws.” In other words, although the municipalities do not operate or maintain sewage collection and disposal systems (sistemas de recolección y evacuación de aguas negras), they ensure that residential developments (urbanizaciones), and the buildings constructed therein, comply with the provisions established by the Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities in relation to those systems, thereby fulfilling their role of safeguarding health and the environment within their canton (…) (…) although section 40 of the Ley de Planificación Urbana states that municipalities may authorize the indicated transfer, the fact is that, unless a municipality is exercising the residual authority discussed above and, consequently, directly manages and operates the respective drinking-water and sewage collection and disposal system, it is required to authorize that conveyance to the competent entity, which, as we have already stated and will conclude below, is the Instituto Costarricense de Acueductos y Alcantarillados, so that the latter may manage and operate the system once it has been verified, when the builder—whether a public-law or private-law entity—delivers the works, that the technical provisions set forth in the regulations and issued by AyA itself and the Ministerio de Salud have been satisfied, as already explained.
That is, once AyA and the Ministerio de Salud have verified the technical suitability of the sewage treatment plants (plantas de tratamiento de aguas negras), the municipality must accept the works and authorize the transfer to the Instituto Costarricense de Acueductos y Alcantarillados of the corresponding portion of the public-use area where the plant is located, pursuant to the already-cited provisions assigning that Institute authority to manage and operate drinking-water systems and sewage and wastewater collection and disposal systems, unless the municipality concerned will operate and manage the system in the exercise of the residual authority already referenced….” It must be taken into account that this Sala Constitucional has previously ruled ( Exp: 11-010057-0007-CO Res. Nº 2012017743 at nine thirty in the morning on the fourteenth of December of two thousand twelve) that this Institute assumes responsibility once the acceptance requirements have been verified and that, until those requirements are satisfied, the Municipality and, in this case, the Registered Owner–Project Developer must continue to bear responsibility for correcting the operational deficiencies so that it may become feasible for this Institute to assume management: (…) Likewise, in the decision issued in Exp: 24-021588-0007-CO Res. Nº 2025002002, it was stated: (…) Likewise, because the infrastructure is located on private property REGISTRATION: , PROVINCE: GUANACASTE PROPERTY: TYPE: LAND INTENDED FOR COMMUNITY FACILITIES FOR TREATMENT PLANT LOT ONE HUNDRED SEVENTY, LOCATED IN Dirección02 3-SANTA CRUZ IN THE PROVINCE OF GUANACASTE AREA: NINE HUNDRED FORTY-ONE SQUARE METERS, SURVEY PLAN:G1901139-2016, OWNER: BANCO IMPROSA SOCIEDAD ANONIMA LEGAL ENTITY ID 3-101-079006 ACTING AS TRUSTEE, which was also the project developer.
Pursuant to sections 17 and 19 of Ley 2726 and the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales Nº 42582-S-MINAE, AyA and the ASADAS not only lack authority to make donations of any kind, but are also required to invest resources exclusively in the water-supply and wastewater sanitation systems under their management; therefore, given the existence of a specific and special provision, they would be barred from contributing or allocating resources, prior to acceptance, to cover the repair and operating costs of the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) located on private property, as quoted below: “Article 17.- The Instituto Costarricense de Acueductos y Alcantarillados may not make donations without the approval of the Asamblea Legislativa...” “Article 19.- The Institute’s financial policy shall be to capitalize the net income obtained from the sale of services and from any other source in order to carry out national plans for drinking-water supply and wastewater and stormwater disposal.
For that purpose, rates for the sale of drinking water and wastewater disposal shall be calculated so that sufficient funds are available at all times for the following: a) Paying the cost of maintaining, repairing, and operating water-supply and sewerage systems; and b) Paying interest on debts incurred and a percentage for capitalization and development. The Government shall not derive any portion of the Institute’s net profits, since the Institute shall not be regarded as a source of revenue for the Treasury. The State, municipalities, and any natural or legal persons, whether public or private, may make donations of any kind to the Instituto Costarricense de Acueductos y Alcantarillados, without the need for a law or express acceptance.” Previously, the Dirección de Planificación Estratégica, through official letter PREPLA-2022-00549, similarly clarified that: “AyA’s rate-derived resources must be used exclusively for developing the service from which they originated; accordingly, the Contraloría General de la República, in official letter DFOE-AE-0550 dated 12 de diciembre de 2016, classifies them as earmarked rather than unrestricted resources.
This is because, pursuant to the Ley de la Autoridad Reguladora de los Servicios Públicos, public-service rates are set under the service-at-cost principle; likewise, resources corresponding to Capital and Financing Revenue resulting from loans, transfers, donations, and surpluses are also earmarked resources…because they are earmarked, they must be used solely for the purposes for which they were created…” Along the same lines concerning this inability and the investment decision, the TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN OCTAVA, SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. ANEXO A, in Decision No.112-2018 at nine thirty in the morning on the nineteenth of December of two thousand eighteen.- ruled as follows (…) The REGISTERED OWNER, as a Legal Entity, bears responsibility for maintaining the system located on its private property and correcting the deficiencies found therein; accordingly, the Ministerio de Salud must compel the owners to perform the necessary works immediately in order to eliminate the health problem affecting them.
In this regard, that Constitutional Court has already ruled on the responsibility of that Ministry to require private parties to comply; see, for this purpose, decision Nº 2024004725 of the Sala Constitucional de Costa Rica, issued on 23 de febrero de 2024, in expediente 24-000376-0007-CO; Exp: 10-015653-0007-CO decision Nº 2011014596, issued on 26 de octubre del dos mil once; Exp: 13-006114-0007- CO decision Nº 2013010718 of 13 de agosto 2013; Exp: 04-010820 0007 CO decision Nº 2006002973 of seven de marzo del dos mil seis and decision Nº 2016006368 of thirteen de mayo del dos mil dieciséis Expediente 16-002436-0007- CO. Although the Instituto Costarricense de Acueductos y Alcantarillados is responsible for providing the inhabitants of the Republic with sewage collection and disposal services in urban areas, as established in sections 1 and 2 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados No. 2726, that provision is not unrestricted.
On numerous occasions, that same Chamber has defined the scope of that legislation, because sanitation entails public investment, which exceeds the Institution’s financial capacity and involves the State itself. Furthermore, it is assumed that, because there is no sanitary-sewer collection system provided by an authorized public-service provider, those homes were authorized with a system whose construction was approved by the Local Government and the Ministerio de Salud (at this point, it is reiterated that the modification of the wastewater treatment plant, under CFIA contract number 873766, is in Rejected status pursuant to official letter PTAR-AyA-2019-70, dated 11 de junio de 2019), and that oversight and monitoring of the operation of that private system likewise fall to the Local Government and the Ministerio de Salud. Nevertheless, immediate mechanisms are provided in the Ley General de Salud and in the Ley General de la Administración Púbica itself that the Ministerio de Salud may use to compel the Association and residents to treat their wastewater.
By way of example, reference is made to Exp. 16-2436-0007-CO, in which judgment N° 2016006368, at nine thirty in the morning on the thirteenth of May of two thousand sixteen, was issued and provided, insofar as relevant: (…) The Ministerio de Salud de Costa Rica has clear and specific authority concerning operating permits (permisos de funcionamiento) and operational reports (reportes operacionales) for residential-use Wastewater Treatment Plants (Plantas de Tratamiento de Aguas Residuales, PTAR), within the framework of the Ley General de Salud (Ley N.º 5395) and the Reglamento General para Permisos Sanitarios de Funcionamiento (Decreto Ejecutivo N.º 43432-S). Every wastewater treatment plant, including those intended for residential use, must hold a Health Operating Permit (Permiso Sanitario de Funcionamiento) issued by the Ministerio de Salud. This permit is mandatory for lawful operation in the country.
It is processed through the Área Rectora de Salud corresponding to the project’s location, where technical, legal, and environmental requirements must be met, including submission of a technical inspection report for the wastewater treatment system. It should also be taken into consideration that the Ministry requires the submission of periodic technical reports demonstrating that the plant is operating properly; these reports must include: Treated-water quality parameters, System maintenance and operation, Compliance with environmental and health standards, and Assessments of impacts on public health and the environment. Supervision and enforcement fall within the authority of the Ministerio de Salud, acting through its Áreas Rectoras, rather than the Institute, for purposes of verifying compliance with the permit conditions, monitoring corrective actions in cases of noncompliance, and assessing health risks according to the establishment’s classification (risk A, B, or C) RESPONSE TO THE REQUESTS 1.
That this amparo proceeding (recurso de amparo) be granted, and consequently: Response: In accordance with the response to the facts and the considerations provided, this request is inadmissible; the Treatment Plant is located on private property, and it is the responsibility of the registered owner (Propietario Registral) to make the corresponding improvements and likewise to repair the damage caused to the systems in connection with the El Cacao Paving Project in Santa Cruz, Guanacaste, where the awarded contractor caused a serious problem by carrying out trenching work (labores de zanjeo) approximately three meters deep. Such damage must be assumed by the Local Government, not by this Institute, in view of the principle and liability arising from Articles 1045 of the Código Civil and 190 of the Ley General de la Administración Pública, as well as the legal reasons stated concerning the impossibility of investing in systems that are not under AyA administration and have not been accepted by AyA.
The company alleges an improper defense, concealing the fact that it caused the damage to the discharge pipe (tubería de desfogue); had this pipe not been damaged, the Treatment Plant would be discharging at the authorized site and the existing flooding would not have occurred. Likewise, MINSA, through the health area, is responsible for inspecting and issuing the corresponding orders to ensure the proper operation of the Treatment Plant. 2. That A y A be ordered, immediately and within the scope of its authority, to take the necessary actions to restore proper operation and assume responsibility for the Treatment Plant, since to date no one has taken responsibility for the Project, thereby guaranteeing the right to public health and to a healthy and ecologically balanced environment (ambiente sano y equilibrado). Response: This request is inadmissible because the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) is located on private property, and its maintenance and proper operation are the responsibility of the registered owner and the project developer.
As stated in the substantive considerations, there is a legality mandate (mandato de legalidad) that does not allow this Institute to make investments in private property. Likewise, the Ministerio de Salud is the competent entity, through the operating permit (permiso de funcionamiento) and operational reports (reportes operacionales), for ensuring that the Treatment Plant complies with the applicable parameters in safeguarding the right to public health and to a healthy and ecologically balanced environment. AyA did not cause the damage to the Treatment Plant’s discharge pipe; it was caused by the company awarded the contract by the Municipality when it carried out trenching work approximately three meters deep. Accordingly, the Local Government and the awarded contractor must bear the repair and all resulting consequences. For this Institute to assume the administration, operation, and maintenance of this Treatment Plant, the owner-developer must comply with the existing regulations, Reglamento de Aprobación y Recepción de Sistemas de Saneamiento, Acuerdo No. 2022-354 of the Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022. 3.
That the competent authorities—SETENA, Municipalidad de Santa Cruz, and Ministerio de Salud—be immediately urged to coordinate actions to expedite a prompt solution to this problem, as it is unbearable and worsens each day because the pump house (casa de máquinas) has ceased operating; if this continues, the level will overflow, since the people living in the residential development continue discharging their wastewater even under these conditions. Response: This request is not admissible against AyA, as explained in Exp. 16-2436-0007-CO, in which judgment N° 2016006368 was issued at nueve horas treinta minutos del trece de mayo del dos mil dieciséis; Exp: 11- 010057-0007-CO Res. Nº 2012017743 a las nueve horas treinta minutos del catorce de diciembre de dos mil doce. The parties primarily responsible for implementing the corresponding solution are the Municipality and the contracted company (this Institute verified in the field that the roadworks caused the damage to this plant’s discharge pipe leading to the receiving water body (cuerpo receptor)).
The registered owner and the project developer must continue administering and maintaining the Treatment Plant until the requirements and procedure under Reglamento de Aprobación y Recepción de Sistemas de Saneamiento, Acuerdo No. 2022-354 of the Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022, have been satisfied. The institutions possessing the respective authority are responsible for issuing the corresponding corrective and maintenance orders. 4. This Treatment Plant is located diagonally across from the sports field and opposite many homes on the main road, and it is unfair that everyone must pass through that location and see the indecent facility placed there with a serious lack of oversight by the relevant authorities. We request that this waste be transferred to the Treatment Plant in Dirección01 de Santa Cruz, located approximately 2 kilometers from this community, because it is contaminating our only natural water source, which many of us used for recreation and fishing, namely the QUEBRADA de Campero, whose name was changed to Rio de Campero so that it could be used to discharge the very poorly “treated” water there.
We are aware of proceedings that have been filed, yet to date no one has appeared to resolve our serious problem. Response: Scientific, technical, and operational conditions make the request to transfer the waste 2 kilometers to another Treatment Plant unfeasible. Consider what is stated in technical report SG-GSP-RT-2025-00114: “…there are conditions that prevent this request from being fulfilled, which consists of transferring the waste 2 kilometers away to another PTAR. First, the elevation benchmarks (cotas de elevación) of both properties and their respective slope are unknown, which would require a topographic study of the area; second, an independent design would be required to convey this wastewater to the new PTAR; third, the capacity of the Barrio las Maravillas Treatment Plant would have to be assessed, both for collection and treatment; fourth, this investment would have to be assumed by the developer and owner of the current PTAR El Cacao and would be more costly than rehabilitating and restoring the proper operation of the current facilities…” 5, That an investigation be conducted to establish liability, that we may have a healthy and wholesome environment, and that our paving project may consequently be successfully completed, because there is noncompliance and delay in resolving the problem.
Response: Conducting investigations to determine the liability of those who have failed to fulfill their obligation to maintain and ensure the proper operation of PTAR el Cacao does not fall within this Institute’s authority; nor does identifying those directly responsible for the damage caused to the Treatment Plant’s discharge-system pipe, or addressing the lack of oversight and control of proper operation, operational reports, and the failure to issue the corresponding health orders. REQUEST FOR RELIEF (PETITORIA) The Sala Constitucional should take into account the actions carried out by the Instituto Costarricense de Acueductos y Alcantarillados in fulfillment of its purposes and within the scope of its authority. It is therefore evident that it has not disobeyed or violated any constitutional or environmental rules, guarantees, or principles, and the proceeding filed against AyA must accordingly be dismissed in its entirety.
The pipe repairs must be assumed by the Municipality and the Contractor, which, while carrying out the El Cacao Paving Project in Santa Cruz, Guanacaste and performing trenching work approximately three meters deep, damaged the PTAR discharge pipe and, instead of notifying the Local Government and making the corresponding repairs, decided to pour concrete and block its outlet to the receiving water body. Likewise, responsibility for the maintenance and proper operation of the Treatment Plant must remain with the registered owner, BANCO IMPROSA SOCIEDAD ANONIMA CEDULA JURIDICA 3-101-079006 EN CALIDAD DE FIDUCIARIO, and the developer of Proyecto Residencial El Cacao, as jointly responsible for PTAR el Cacao, until a resolution is issued accepting the plant for administration by this Institute, following compliance with the applicable procedures (…)”.
Justice Araya García writes the opinion; and,
CONSIDERING:
The applicant, in her capacity as President of the ADI de El Cacao de Santa Cruz de Guanacaste, alleges that the residents of the residential development located in that area are experiencing a serious pollution and public-health problem because the wastewater treatment plant is not functioning properly. She claims that the problem worsened as a result of paving work contracted by the local municipality, which caused sewage to flow irregularly and stagnate in the open air, producing a foul odor. She further alleges that this untreated wastewater is discharged directly into Quebrada Campero.
The following facts relevant to deciding this application for amparo (recurso de amparo) are deemed established:

“(…) I. Executive Summary The Conjunto Residencial de Interés Social El Cacao is a social-housing project comprising 170 units, located in the province of Guanacaste, Cantón Santa Cruz, and Distrito Santa Cruz. Its wastewater collection and treatment system is administered and operated by its developer, a private-law entity, while the drinking-water system is administered by this Institution. As indicated in sanitary order N° MS-RCH-ARS-SC-ERS-OS-037-2024 dated 18 de marzo del 2024, due to deficiencies in the operation of the wastewater collection and treatment infrastructure (which is nearly abandoned), the Área Rectora del Ministerio de Salud requested that AyA take the necessary actions to assume the operation and functioning of the treatment system. This is to remain in effect until the matter in expediente N° 23-000013- 1791-PE is resolved, and constitutes a decision based on the Ley Constitutiva del AYA.
Inspections were conducted of the El Cacao sanitation system, confirming that the PTAR was not operating and that the sanitary sewer system (alcantarillado sanitario) had no obstructions in the residential complex’s network; the PTAR also lacked an electricity meter for public utility service and was therefore shut down, with untreated wastewater (aguas crudas) being discharged directly into Río Campero (that is, wastewater receiving no treatment). The project has had plans approved by AYA since 2013, with a drinking-water system installed, operating, and administered by this Instituto; this is not the case, however, for the privately administered collection and treatment system. To date, the Developer has not initiated the procedure before AyA for the delivery and transfer of the system for administration, as required under the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA.
The Instituto Costarricense de Acueductos y Alcantarillados (AyA) is fully willing to receive, operate, and maintain the El Cacao sanitation system, provided that the developer completes the appropriate procedures under the aforementioned regulation (…) V. Conclusions - The sanitary infrastructure at the El Cacao project that is experiencing operational problems has not been formally transferred in accordance with the procedure established for that purpose. - There is no record of a formal request by the interested parties (Developer) for AYA to begin the process of assuming responsibility for this Sanitary system, in accordance with the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA. - The sanitary order directing AyA to assume responsibility for the system under its current conditions constitutes a mechanism that would relieve the developer of the obligation to make the required investment.
This would place upon the State the burden of using public funds to carry out work that the developer should have ensured was performed at the project’s inception. - There is evidence of apparent noncompliance by the infrastructure operators, since records from previous years already document the operational problems and the apparent discharge of untreated water into the river. - The sanitation infrastructure is located on private property and is not currently being operated; it does not even have an electricity meter or operating technicians. - AyA personnel were unable to enter the PTAR and therefore do not have a detailed assessment of its components. It must be clarified that both the PTAR and the effluent collection and disposal system (sistema de recolección y disposición del efluente) must be in good operating condition for any eventual commissioning and acceptance process (puesta en marcha y recepción) to be completed. - The undersigned attempted on two occasions to contact those responsible for the PTAR in order to enter and conduct a detailed assessment of its components (18 y 19 de marzo de 2024), but authorization could not be obtained.
For that reason, there is no detailed and accurate assessment of the current condition of the works, nor any monetary estimate of the work that may be required to bring them into compliance. - Compelling the investment of public resources through sanitary orders to remedy deficiencies in infrastructure that must be designed, constructed, and operated in accordance with applicable standards would provide an easy and questionable means for certain developers to avoid complying with their fundamental, legally prescribed obligations (…)” (see evidence).
“(…) ANALYSIS (…) the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) was not operating; the sanitary sewer system (alcantarillado sanitario) had obstructions in the line leading to the discharge into the receiving water body (cuerpo receptor); the PTAR was shut down and completely abandoned, with the site flooded by untreated wastewater to approximately 60 cm above natural ground level (…) The site is privately owned and is enclosed by perimeter fencing protected with barbed wire and by gates secured with chains and padlocks; no operating personnel were present at the time of the visit. During the inspection, three local residents were interviewed in an attempt to locate the person responsible for providing access to the PTAR; however, that person could not be located. Furthermore, the residents are uncertain as to who is actually responsible for administering, operating, and maintaining the PTAR because, according to them, the keys are held by Grupo Mutual since, as they understand it, Banco Improsa is no longer responsible for the project.
They further stated that the Developer ceased to be responsible for the PTAR long ago and that Grupo Mutual has taken over the project. The residents stated that a member of the community had previously been responsible for maintaining the PTAR; however, that person is no longer in charge, and they do not know whether anyone else currently performs this work. The residents further reported that, although there appears to be a functioning electricity meter, the equipment has been disconnected and it is unclear who made that decision; they assume that it was done as a precautionary measure in response to the flooding currently affecting the site. The location of the PTAR is clearly abandoned and neglected, with no maintenance whatsoever of either the infrastructure or the landscaped areas (…) At the time of the inspection visit, the PTAR was completely flooded with wastewater, to approximately 60 cm above natural ground level, causing foul odors in the area (…) the aeration tanks and settling tank were entirely submerged, as were the walkways and part of the drying beds, with the water even reaching the floor level of the machinery building and storage facility (…) It should be noted that, during the inspection, the discharge point of the PTAR was also visited in the company of several local residents.
During the visit, the residents identified the locations where the company hired by the municipality, which was responsible for the paving work, had broken both the potable-water pipe and the wastewater pipe. The break in the wastewater pipe was confirmed because the residents themselves stated, in connection with this matter, that the company broke “the orange-colored pipe.” Ms. Nombre02, identification card CED06, a local resident, stated that this occurred in March while the company hired by the Municipalidad was carrying out the work, and that the water flowing out had a very unpleasant appearance and odor. Ms. Chavarría further stated that she was directly affected because her home is located almost directly across from the damaged area and that, several days later, the same company that caused the damage “sealed the damaged pipe with concrete.” The same account was provided by Mr. Nombre03, identification card CED07, who stated that the problems with the PTAR began after this incident.
It is important to note that Ms. Nombre02 was asked whether, before this incident, she had ever noticed or detected any discharge of this water or any foul odors. She replied that nothing like that had ever happened and that she was affected only while the orange pipe remained broken, because once the company sealed it with concrete, she no longer detected any foul odors. The receiving water body for the water discharged from the PTAR in question was also visited. The discharge point was found to be completely dry, indicating that the sewer system is obstructed upstream of that point, consistent with the residents’ statements that the sewer network is blocked (…) INSPECTION RESULTS • The collection system, or sanitary sewer system, is obstructed along the discharge section leading to Río Campero. • Access to the PTAR was not obtained; nevertheless, it was confirmed that the plant is not being operated and that neither an operator nor anyone safeguarding the equipment was present at the site. • The infrastructure and landscaped areas of the PTAR are not being maintained. • The PTAR is not operating; its equipment is shut down, and its treatment systems, in both the primary and secondary treatment processes, are abandoned and flooded with wastewater. • Access to the PTAR operating log was not obtained. • It was confirmed that roadbed preparation work has been performed, along with the installation of stormwater pipes and the construction of storm drains and stormwater manholes.
The wastewater collection and treatment system of Conjunto Residencial de Interés Social El Cacao is neither administered nor owned by AyA; consequently, its operation and maintenance do not fall within the Instituto’s jurisdiction. If any harm to health exists, it would not arise from any act falling within AyA’s jurisdiction or responsibility, but would instead be attributable to the Developer, as established by current legislation. It is important to note that AyA has not accepted the PTAR of Residencial de Interés Social El Cacao for administration; therefore, its operation and maintenance are the responsibility of its owners. The transfer of the works to the Instituto is an act undertaken at the Developer’s discretion. Once the requirements of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA have been met, the Developer must submit a formal request expressing its intent to transfer the PTAR so that the Instituto may verify compliance and accept, operate, and maintain it.
The Ley General de Administración Pública, in Article 66, clearly provides that sovereign powers and their exercise, as well as public duties and their performance, may not be waived or transferred and are not subject to limitation periods, pursuant to that provision and as a complement to its terms. The Ley General de Salud, in Articles 285 through 292, establishes that the Ministerio de Salud has an unavoidable duty to address the matter directly and compel the Developer to correct immediately the problem caused by the improper disposal of wastewater, a situation that is creating health problems affecting the community neighboring the project. In this regard, AyA is NOT required to resolve the technical problem affecting the operation of the PTAR because the Institution may not arbitrarily take over private infrastructure without following the proper procedures for the acceptance of works and their operation, pursuant to Chapter III of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, which governs the requirements and procedures for assuming the administration, operation, and maintenance of sanitation systems (sistemas de saneamiento).
During the procedure for AyA’s acceptance of the project, the Developer must comply fully with Article 12 of the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados. To date, no request has been submitted by the person responsible for residencial El Cacao to transfer the sanitation works to AyA. Accordingly, the Developer is responsible for maintaining the collection and treatment system of PTAR El Cacao. The Developer is also responsible for ensuring that the systems are operated optimally and for complying with the sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud, which, in turn, is responsible for ensuring that they are mandatory, in fulfillment of its duties under the Ley General de Salud. Finally, it must be stated that compliance with legal, technical, and operational requirements is necessary for AyA to accept wastewater sanitation systems.
Those requirements must be met by the private party so that the Instituto may provide the required services efficiently and avoid accepting systems that become a burden and create an additional need for investment of public funds, the cost of which should have been borne by the party that developed the construction project. RECOMMENDATIONS • Request that the Municipalidad de Santa Cruz clean the facilities of PTAR El Cacao by pumping out all wastewater pooled at the site through a collection service provided by an authorized company, while preventing the discharge of untreated wastewater into Río Campero. • Request that the Municipalidad de Santa Cruz remove the blockage and repair the damaged section of sanitary sewer pipe, in its capacity as the contracting party that hired the company responsible for the damage. CONCLUSIONS • The sanitation infrastructure of the El Cacao project has not been formally transferred in accordance with the procedure established for that purpose. • No formal request has been recorded from the interested parties—the Developer—for AyA to initiate the process of assuming responsibility for this sanitation system in accordance with the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA. • Compelling AyA to assume responsibility for the system under its current conditions would be contrary to the law and would provide a mechanism for exempting the Developer from making the required investment.
This would place upon the State, through public funds, the burden of completing works whose construction the Developer should have ensured from the outset of the project. • There is evidence of apparent noncompliance by the infrastructure operators, because records dating back several years already document operational problems and the discharge of apparently untreated wastewater into the river. • The sanitation infrastructure is located on private property and is not currently being operated; it does not even have operating technicians. • It must be clarified that both the PTAR and the collection and disposal system for treated wastewater in the effluent must be in good operating condition before any eventual commissioning and acceptance process can be completed. • The persons responsible for the PTAR could not be contacted to obtain access and conduct a detailed assessment of its components.
Consequently, no thorough and accurate diagnosis of the current condition of the works is available. • Forcing the investment of public resources to remedy deficiencies in infrastructure that must be designed, constructed, and operated in compliance with the applicable regulations would create an easy and questionable means for certain developers to evade their fundamental, legally prescribed obligations. • The Municipalidad de Santa Cruz must be held responsible for the damage caused to the sanitary sewer system along the discharge section leading to Río Campero, to the PTAR, and to the environment as a result of the pipe blockage, which has caused wastewater to stagnate and PTAR El Cacao to become flooded. • Regarding the request that “that waste” be transported to the PTAR at Dirección01 in Santa Cruz, scientific and technical considerations indicate that conditions exist that preclude granting this request, which entails transporting the waste 2 kilometers to another PTAR.
First, the elevation benchmarks (cotas de elevación) of both properties and their respective slopes are unknown, which would require a topographic survey (estudio topográfico) of the area; second, an independent design is required to convey the wastewater (aguas residuales) to the new wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR); third, the capacity of the Barrio las Maravillas Treatment Plant would need to be assessed, both for collection and treatment; fourth, this investment would have to be borne by the developer and owner of the current El Cacao wastewater treatment plant, and would be more costly than rehabilitating the existing facilities and correcting their operation (…)” (see report).
Facts related to the Municipalidad de Santa Cruz:
“(…) Analysis: The residents of Residencial Nuevo El Cacao have repeatedly reported to the municipal authorities the foul odor emanating from the Residencial Nuevo El Cacao treatment plant and the discharge of dark, soapy, foul-smelling water into the Campero stream. There is a record of the residents’ complaint dated 21 de febrero stating that the treatment plant was not operating, and as of this date the situation has not been corrected. It is presumed that the wastewater discharged into the Campero stream is not receiving proper treatment, thereby posing a threat to the receiving water body and to the health of the residents, who state that the foul odors cause headaches and nausea, prevent them from eating normally, and interfere with their sleep. Moreover, during three field visits conducted at the site, both in octubre del año 2021 and in febrero del corriente, foul odors were perceived at the plant and at the discharge point (punto de desfogue), and a dark coloration and foamy/soapy appearance were observed in the effluent.
Furthermore, it is unknown whether the aforementioned treatment system has been monitored by the Ministerio de Salud as provided in Article 27 of the Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales N.º 39887-S-MINAE, or whether it complies with the requirements established by AyA in Article 28 of that regulation (…) Por tanto, under the applicable regulations, the Ministerio de Salud and AyA are key stakeholders that must be called upon to ensure the best resolution of the public-health problem and the contamination of the stream waters arising from the deficient operation, or lack of operation, of the Residencial Nuevo El Cacao Wastewater Treatment System. It is therefore essential that both institutions respond to an urgent summons from the municipal administration in order to determine the procedure they will follow to address the stated problem with the required immediacy (…) 8.
Recommendations: • Urgently request accountability from the Ministerio de Salud and AyA to ensure the best resolution of the harm to public health and contamination of the Campero stream channel caused by the deficient operation, or lack of operation, of the Residencial Nuevo El Cacao Treatment Plant. • Analyze the appropriateness of making a unilateral amendment to current contract 2021LA-000015-0021000001, described as OPERATION AND MAINTENANCE OF THE WASTEWATER TREATMENT PLANT OF THE MECHANIZED LANDFILL AT THE PARQUE TECNOLÓGICO AMBIENTAL DE SANTA CRUZ, with the aim of resolving, in the short term and for a defined period, the public-health problem and contamination of the Campero stream channel (…)” (see evidence).
“(…) 6. Analysis: The residents of Residencial Nuevo El Cacao have repeatedly reported to the municipal authorities the foul odor emanating from a sewer within Residencial Nuevo El Cacao and the discharge of dark, soapy, foul-smelling water into the Campero stream. Accordingly, the Environmental Protection Department appeared at the reported location, 200 metros east of the main entrance to this residential development, where a sewer was observed discharging soapy water that emitted a foul odor and caused contamination within the residential development. In addition, this Department visited the housing project’s treatment plant, which was operating at the time, and inspected the discharge site located at the Campero stream, where wastewater and soapy water were observed flowing with a foul odor into the channel of the stream, contaminating this spring (naciente). Regarding all the foregoing, this Department has previously issued reports that resulted in a complaint filed by the Ministerio de Salud with the environmental prosecutor’s office. 7.
Recommendations: Based on the foregoing, this Department recommends: 1- Send this report to the Ministerio de Salud so that it may be added to the corresponding judicial case file (expediente judicial). 2- It is suggested that the Ministerio de Salud forward this report to AyA so that it may intervene in the sewerage system (sistema de alcantarillado), ensuring that wastewater is conveyed to the treatment plant and does not flow untreated over the roadway (…)” (see evidence).
“(…) Based on the assessment conducted at the Residencial El Cacao wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR), conclusions can be drawn regarding its current condition. With respect to the general condition of the PTAR, it is concluded that: • The PTAR is not in a satisfactory state of repair; the tank structure and metal components appear to be in poor physical condition. In addition, essential sludge-treatment components, such as drying beds and digesters, are present; however, they do not have sufficient capacity for the plant’s flow rate. • The PTAR is not operating and therefore cannot fulfill the objective of treating wastewater from Residencial El Cacao, a circumstance that causes deterioration of the receiving water body and adversely affects the community. • In the secondary treatment train, the installed capacity of all units (available tank volumes) is satisfactory for the flow rate calculated through the population census, but not for the flow rate used in the design according to the calculation report; it should be noted that the settling tanks have a very short settling length and are therefore allowing fine solids to pass into the effluent. • The sludge generated in the secondary settling tank accumulates over time, and to prevent a reduction in its usable volume, it must be purged to the drying beds (which are visibly deteriorated); implementation of the sludge treatment train at the PTAR is important.
With respect to the capacity of the treatment units: • The preliminary treatment train has a bar screen chamber to prevent coarse solids from passing through; however, the screens are unsuitable, the spacing between the bars is too wide, and they are corroded. It does not have a drainage tray, and therefore the solids are not drained before being taken for final disposal. • Aeration in the biological reactor is sufficient; however, only one blower is operating, at more than 90% of its capacity. This situation is inadequate because, if it fails, the plant will have to cease operating, as there is no backup. Redundancy in the blower unit is necessary to prevent this situation and extend its service life. According to the electromechanical report, the existing blower is operational but requires extensive preventive maintenance. • The secondary settling tank has an outlet channel with a serrated weir to prevent preferential flow; however, substantial disturbances occur at the inlet because agitation from the aeration tank reaches the settling tank channel.
A secondary settling tank is ordinarily longer than it is wide, usually at a ratio of between 3:1 and 5:1, in order to provide sufficient distance for fine particles to settle and prevent them from passing into the treated effluent and, consequently, into the receiving water body. A square or very short configuration does not allow effective settling and causes solids carryover. • The drying beds do not have sufficient area to dewater the sludge that should be treated in the sludge digester. Regarding the PTAR’s electromechanical installation, it is concluded that: • The overall condition of the piping is inadequate; most of it is not labeled, and the wastewater, sludge, and air lines have clamps and anchors that are in poor condition or entirely absent, resulting in instability and flexing of the pipes. • Regarding the aeration system, it is concluded that it meets the PTAR’s oxygen requirements; however, only one blower is operating, which could cause future problems if it fails and no backup is available to ensure aeration.
Currently, the blower has sufficient capacity to provide the flow needed to supply the organisms in the aeration tank with the oxygen required for their normal functioning, but it requires maintenance. • Leaks were detected in the air piping in each aeration tank and in one secondary settling tank, resulting in pressure loss and greater agitation than necessary. There should be no disturbances in the settling tank, and therefore the leak impairs the operation of this unit. • Likewise, the plant’s pipes are made of PVC and are directly exposed to the Sun, which may cause significant problems, including sudden failures. Regarding the discharge into the receiving water body of effluent that does not comply with the discharge limits, it is concluded that: • As shown in Table 7, the values of the mandatory parameters analyzed in the effluent are far above the permitted limit established in the Reglamento de Vertido y Reuso de Aguas Residuales, which may cause social, environmental, and legal problems. • The discharge of wastewater that does not meet the parameters established in the Reglamento de Vertido y Reuso de Aguas Residuales may cause serious environmental harm, affecting aquatic biodiversity and causing eutrophication.
It also jeopardizes public health by contaminating nearby water sources and harming recreational and economic activities. These discharges significantly alter ecosystems and pose serious risks both to the environment and to the human communities that depend on those water resources. Specifically, the following is recommended: • Improvement of the bar screen chamber and installation of a screen with a drainage tray. • Construction of a top slab on aeration tank 1. • Conversion of the sludge digester into a sludge thickener. • Installation of a 22 m³ plastic tank for the sludge digester. • Expansion of secondary settling tank 1. • Demolition of drying beds 1. • Construction of 3 drying-bed units. • Preventive maintenance of the current blower. • Installation of a new rotary-vane blower and the required piping. • Inspection and replacement of PVC piping with HG piping in locations exposed to the Sun. • General refurbishment of the mechanical installation, paintwork, and equipment.
To conclude this assessment, in order to resume effective operation and maintenance of the PTAR and thereby produce treated effluent that complies with the discharge limits established by the Ministry of Health, the recommended measures should be implemented, the proposed improvements should be carried out, the plant should receive proper operation and regular maintenance, operational reports should be prepared, and samples should be taken and mandatory parameters measured (BOD, COD, TSS, O&G, etc.) at the intervals required under national regulations (…)” (see evidence).
“(…) This is to report that, at the El Cacao Paving Project, the presence of water of unknown origin has been identified at coordinates 10°17'07.3"N 85°34'12.4"W. Although no break in the sanitary sewer pipe has been observed, this water gives off an unpleasant odor and appears to be contaminating the soil, particularly in the area excavated for the installation of a stormwater manhole. It should be noted that, running parallel to this excavation, there is a sanitary sewer pipe that apparently originates from Residencial El Cacao Nuevo, located at coordinates 10°17'20.2"N 85°34'07.5"W. It is presumed that the water in question may originate from that residential development’s treatment plant. In view of this situation, this Department expresses its concern from an environmental standpoint. It is understood that this matter is registered under case file N.° 23-000013-1791-PE. For this reason, the Municipal Mayor’s Office is requested to coordinate a meeting with Licda. Annia Melina Rodríguez Garro, Assistant Prosecutor at the Environmental Deputy Prosecutor’s Office, to analyze the case and determine the actions to be taken. We appreciate your prompt attention to this request and await your confirmation (…)” (see evidence).
“(…) in connection with the El Cacao Paving Project, the presence of water of unknown origin has been identified at the coordinates (…) Although no break in the sanitary sewer pipes has been observed, this water gives off an unpleasant odor and appears to be contaminating the soil, particularly in the area excavated for the installation of a stormwater manhole and in other identified areas. In view of this situation, this Department expresses its concern from an environmental standpoint and requests (…) Scheduling a joint inspection on Monday, April 13 (…) Preparing a detailed report (…)” (see evidence).
“(…) the Technical Road Management Unit instructed the contractor awarded Public Tender No. 2021LN-000002-0021000001, corresponding to the project titled “On-Demand Delivery Contract for Public Works, Road Maintenance, and Road Improvements in Santa Cruz,” to implement the following actions: • Suspend work on the section between Dirección04 (bridge over the stream) and Dirección05 (pipe discharge), due to possible seepage of water from the treatment plant detected in excavations near Dirección04. • Continue work only on the sections from PK 0+000 to PK 0+200 and PK 1+025 to PK 1+350, which are not affected by the situation described. • A joint inspection with officials from the Ministry of Health is being coordinated for Monday, 07 April at 1:30 p.m., in order to verify through technical testing whether the water does in fact originate from the wastewater treatment system. This information is therefore being forwarded so that, in your capacity as municipal inspector, you may verify what was agreed and the corresponding compliance therewith (…)” (see evidence).
“(…) • A site inspection is conducted at the Residencial El Cacao Nuevo Treatment Plant • The treatment plant described above can be heard operating • Overflowing water is observed around the treatment plant infrastructure, although it is not as abundant as in the video sent by the complainant (See image 1 and photograph 1 in the annexes). • A 250m inspection was conducted in the quebrada campero-Dirección06 direction along the gravel road on which the Municipality of Santa Cruz carried out work to improve the road and install pavement infrastructure (See photographs 2 and 3 in the annexes) • On the road section where work has been suspended since 7 April (Official Letter DDUR-DGV-ING-13-M-2025), no machinery or work in progress was observed; however, water surfacing and a discharge were observed at two different locations. (See table 1) • The treatment plant’s discharge point into quebrada Campero was inspected, and it was determined that the discharge is constant; the water has a dark coloration that differs from the water in the channel and gives off a very strong foul odor.
(See photographs 5 and 6 in the annexes).” The section titled “Analysis” expressly stated the following: “(…) on the morning of 17 April, the officials (…) inspected the conditions of the El Nuevo Cacao Treatment Plant and the adjacent road section where the Municipality of Santa Cruz has installed a storm sewer system (alcantarillado pluvial) for the subsequent installation of pavement infrastructure. The existing sanitary sewer pipeline (tubería de alcantarillado sanitario) on the road section described above has not been disturbed; excavations were performed solely to install the storm sewer system. When the first excavation was made to install the storm sewer system, greenish-colored water smelling of wastewater surfaced, and the project was halted on 7 April of this year at the instruction of official Eng. Mary Paz Castillo Rodríguez (…). The treatment plant’s discharge point into quebrada campero was also inspected, and it was determined that the discharge is constant, with dark-colored water that differs from the coloration of the water in the channel and has a strong foul odor.
This last issue has been brought to the attention of the health authorities and discussed in meetings of the Interinstitutional Wastewater Commission; the matter has even been referred to the courts, and the case file is held by the Ministry of Health. A monitoring proceeding has been conducted and reports have been compiled detailing the existing contamination problem in quebrada campero resulting from the non-operation or improper operation of the Residencial El Nuevo Cacao treatment plant. Recommendations: That the Office of the Municipal Mayor request that the Environmental Prosecutor’s Office order the owners of this treatment plant to take immediate action to ensure its proper and functional operation, as well as to ensure the perfect condition of the sanitary sewer network (red de alcantarillado sanitario) that channels the sewage from said treatment plant beneath the public road and toward the discharge site at Quebrada Campero, in compliance with sanitary technical standards, so that contamination of quebrada campero is completely eliminated, Article 50 of the Political Constitution is complied with (…), and it is ensured that the Municipality of Santa Cruz may continue with the project to install asphalt pavement and stormwater systems, pursuant to the Public Tender (…) at the El Cacao site, Santa Cruz district (…)” (see evidence).
“(…) AGREEMENT: It was established that untreated wastewater is being discharged into the Campero river channel, a situation confirmed by the “Diagnostic Report on the Wastewater Treatment Plant of Residencial El Cacao,” commissioned by the Municipality of Santa Cruz through an administrative procurement procedure and submitted under official letter MDC-PTAST-107SC-2024. This report was delivered by email to Mr. Olman Alexandre Murillo Azofeifa, representative of Grupo Mutual, on Friday, 2 May 2025 at 14:47 hours. This situation was also referenced in official letter DDUR-DGV-ING-24-M-2025, issued by the Technical Road Management Unit Department. During the virtual meeting held with representatives of Grupo Mutual, concern regarding the poor condition of the treatment plant was reiterated, as detailed in the diagnostic report. It was also indicated that the pipeline responsible for conveying water from the plant to quebrada Campero may be damaged.
Consequently, it was agreed that Grupo Mutual would submit a remediation plan (plan remedial) to address this situation no later than 03 June 2025 (…)”. The document likewise stated: “(…) Regarding operation of the plant, the following is noted: • Grupo Mutual states for the record that operation of the Wastewater Treatment Plant (PTAR) is the direct responsibility of the Developer. It is further noted that the property on which this infrastructure is located is held in trust (fideicomiso) in the name of Banco Improsa, the entity with which the relevant coordination has been undertaken to date. • The Municipality of Santa Cruz and the Ministry of Health have made this initial formal approach to Grupo Mutual in order to explore possible mechanisms for collaboration, given the Developer’s failure to respond to the measures previously undertaken. This effort responds to the need to address a matter of public-health and environmental importance. • In this context, as part of its commitment to corporate social responsibility, and also considering the Developer’s failure to respond to the measures undertaken by Grupo Mutual itself, Grupo Mutual reports that it is currently following up on the matter.
It is also preparing a technical proposal that will be submitted to the competent authorities for evaluation and possible approval. • It should be noted that Mr. Ramón Prado Monterrey was summoned to the meeting but was absent from the session (…)” Ramón Prado Monterrey was summoned as the representative of Construcciones Modulares de Costa Rica S.A. (see evidence).
“(…) It is reported that various institutions have been contacted, including AyA, the Ministerio de Salud, and the Fiscalía, and that initial contact has also been made with Grupo Mutual because the developer responsible for operating the wastewater treatment plant (Planta de Tratamiento de Aguas Residuales, PTAR) has not responded to the actions taken. The property where the plant is located is held in trust (fideicomiso) in the name of Banco Improsa. The Municipalidad de Santa Cruz and the Ministerio de Salud are coordinating with Grupo Mutual to find interinstitutional solutions to this environmental situation. It is acknowledged that this situation constitutes a technical unforeseen circumstance (imprevisibilidad técnica), since, when the project began, it was not known that sewage (aguas negras) was flowing through the public street or that the conveyance systems might be damaged. Continuing the work under these conditions would have posed a high risk of contaminating the road structure and inefficient use of public resources, given the potential need to remove the asphalt surface (carpeta asfáltica) to carry out repairs.
Before the suspension, drainage structures (estructuras de drenaje), including pipes, manholes, and storm drains, were partially installed. Nevertheless, these installations could be compromised if the problem is not addressed promptly. It is stated that the project funds are available only until 31 de junio de 2025, which will make it possible to complete the work on the unaffected sections, but not on the remaining 825 meters. Grupo Mutual will submit its remedial plan (plan remedial) by June, making it impossible to meet the completion deadlines for the remainder of the project. In light of the foregoing, the following is agreed: 1. A change control (control de cambios) for the project authorizing dust-mitigation work on the suspended section (PK 0+200 a PK 1+025) is not approved, in order to preserve the existing drainage systems and prevent loose material from being washed into the pipes already installed. 2.
It is agreed to include the corresponding amount in upcoming municipal budgets once the public-health situation has been resolved, for the purpose of replenishing the funds invested in dust mitigation and completing the project’s paving. It is further established that the remaining 825 meters must be budgeted again once new funds become available, which is expected to occur between October and December 2025, when the extraordinary budgets (presupuestos extraordinarios) are approved by the Contraloría General de la República. 3. Continue interinstitutional monitoring of the environmental situation at Residencial El Cacao, in coordination with the institutions involved, until a definitive solution is achieved (…)” (see report and evidence).
“(…) Ms. Villalobos states that, at the end of June, Grupo Mutual submitted the draft resource-administration agreement for review and approval so that it could be signed and the corresponding procurement process could begin. To date, this agreement has not been signed, as Mr. Walter indicated, and Grupo Mutual is awaiting this approval so that it can be signed and the remedial plan can begin in stages: First: Put the treatment plant into operation. Second: Assessment. There is no clarity regarding the blockage and what is happening, which is necessary to determine the scope of the works. Mr. Villalobos states that this is indeed as they discussed with BANHVI: this first addresses the most urgent component, which is the plant, and then the assessment stage would begin. Mr. Murillo states that this is the line of work. Eng. Castillo asks whether a schedule will be prepared so that the municipal government will know the anticipated timeframe for completing these steps.
Ms. Sibaja states that, once BANHVI approves the agreement and it is signed, the dates can be specified. Estimated timeframes are available for the first stage, but a schedule with specific dates can be prepared, because everything depends on the signing of the agreement, which will mark the start of the process. It is important to present these time estimates. Once it has been signed, it will be possible to indicate how long implementation will take. Mr. Warren Chavarría, director of the Área Rectora de Salud de Santa Cruz, states that this meeting was held 2 months ago and essentially the same thing was said. Ministerio de Salud and the Municipalidad are the ones facing pressure from the Community. He states that they understand that these processes may take some time and that they often do not depend on them. Nevertheless, he emphasizes the need to provide an urgent response to this matter.
He asks whether there is any way in which they, as Ministerio de Salud, can help expedite this process, since this problem has existed for 4 years and, despite all the meetings, no progress can be seen. The objective is to determine how they can help or, if they cannot help in any way, at least to have certainty that the matter is being processed and will actually begin. Both the Municipalidad and we, as Ministerio de Salud, are under pressure, and practically every day emails and complaints about the issue are received. He requests that Grupo Mutual and BANHVI show empathy regarding this situation, since implementing a solution to the issue is not, as such, within our control. Eng. Castillo states that, even though they are dependent on someone’s signature, dates can still be estimated in a work schedule; if those dates are not met, it will be understood that BANHVI has not issued the respective approvals, but at least it will be clear that the matter is already being processed.
Something concrete is needed so that they can attend the meetings without the same thing being said again. This is affecting the Municipalidad because it cannot inform the Community or take any action whatsoever. At the previous meeting, it was agreed that activities would be carried out that would take one day, occur during that same week, or be completed within a certain period, but they were not carried out. She states that this is very serious, because one thing is said when in fact it has not been done or will not be pursued, and the Municipalidad must manage the matter before the Community. It was even embarrassing to have the President of the Republic visit and for us to tell him that the actions agreed upon at the previous session—which was recorded—would be taken, yet as of this date there is no schedule and nothing has been established or reported. This schedule is requested out of respect for the Municipalidad, out of respect for the Community, and because of the public-health issue.
Eng. Castillo REITERATES that this is not a normal and simple matter; it is a delicate issue. It is requested that a schedule be prepared with a timeframe for the signature and approval, and that the processes be established so that this is not merely empty talk and the Municipalidad knows which processes must be followed and can inform the mayor’s office, the Municipalidad, or the Ministerio de Salud, thereby determining whether assistance or follow-up can be provided. Eng. Sánchez states that he fully agrees with Eng. Castillo and says that this is very important for the Municipalidad because the Community is requesting hard-copy information on the progress of the process and, if there is not even a report, it cannot be stated that Grupo Mutual is taking action or that BANHVI is processing the signature. This information is required to substantiate the processes. Eng. Monge states that the essential point he noticed they were seeking to avoid was a joint schedule.
The responsible course of action is to prepare a joint and concurrent schedule for the treatment plant and the drainage system, because the conveyance system is an inseparable part of the solution, since there is no technical explanation of how the plant could be put into operation without conveyance from the source. This is concerning, and it is reiterated that the Municipalidad is undertaking a project that cannot proceed, because if repairs must be made to the conveyance system after the paving project has already been completed, that would damage the project currently underway. The concern is that this could prevent implementation of the planned project; therefore, it is requested that the entire process be carried out as soon as possible and that efforts be made to address the two problems jointly—the plant and the conveyance system—because they are part of the same system. (…) Mr. Muñoz states that the issue involving this project, or the situation arising in this housing project, is quite complex because the developer does bear direct responsibility here.
This is because it failed to complete the work that must be performed at the plant. This is BANHVI’s presumption to date, and for this reason the decisions that have had to be made or implemented have been complex. Grupo Mutual and BANHVI have worked jointly to provide a solution. This required an in-depth legal and technical analysis in order to produce an initial deliverable: signatures on the Resolution Addressing the Problem. It must be understood that BANHVI must adhere to the applicable regulations, the law, and the required procedures. The bank does not wish to evade responsibility; quite the opposite, it is seeking to comply with the applicable regulations in order to move this matter forward because it is a wholly atypical situation. (…) Ms. Salas states that, without a work plan, Eng. Castillo is right. What is not measured cannot be assessed to determine whether there has been a failure or a lack of progress.
She states that this is an important step; however, it is somewhat premature to develop a construction schedule. The idea is to present a dated work plan for follow-up purposes. This work plan will be continually updated and reviewed and will be adaptive, because it will be adjusted according to the needs identified. She states that Eng. Castillo’s point is important and that the best approach is to develop this joint work plan. Ms. Salas will coordinate with the authorized entity so that it and BANHVI can submit a draft work plan or action plan as a basis. Based on this, a meeting can be held among the parties most directly involved in the process, rather than the entire team, forming a subcommittee to define and set dates and other details. Afterward, follow-up work can begin and progress can be presented at each of these sessions. (…) Eng. Obando states that this is a matter in which human rights are being violated and that the situation is exceeding all bounds because these people are exposed to entirely unsanitary conditions.
This must also be brought to light. It is understood that everything has its due process and schedule; for example, the Municipalidad is behind schedule on the project that must be implemented, but above all else, the human aspect is the most important. These work plans and everything to be developed are useful for measurement, as this is the only way to measure progress; nevertheless, that priority must always be kept in mind. It is clear that there are procedures and formalities that must be followed, but there must also be an assessment of which formalities can be expedited further in order to shorten the timeframes as much as possible. This is to prevent the community from continuing to face this completely unsanitary situation and being exposed to deplorable conditions and disease. It is stated that the ultimate objective is to reach a solution and for that solution to be implemented as soon as possible.
(…) Mr. Muñoz also states that the types of financing must be defined, since financing for addressing the needs of a plant differs from financing for housing. It must therefore be understood that these types of circumstances will gradually be resolved as the process moves forward. In conclusion, the meeting produced the following deliverables: * The resolution signed by the general management, which will allow the entity to begin the first stage and the assessment. No later than 06/08/2025. * A working group to develop a roadmap or work plan with a range of dates. * A visit by the bank, whenever required, to meet with the community and families and explain the relevant matters to them. * Reports of inspections, meetings, or other activities by Grupo Mutual and BANHVI, in order to create a case file (expediente). In closing, Eng. Sanchez states that the important points were established and that what is needed is to provide the requested deliverables.
Likewise, the Community must be informed that the bank is taking the necessary steps, recognizes the importance of the community, and is working on the solution. All this work is intended to tell the community that the team will resolve the problem. It is also stated that the idea is not to prolong the process and hold a weekly meeting for 5 or 6 years, but to resolve the matter as soon as possible and within the required timeframes. (…)” (see evidence).
Facts related to the Ministerio de Salud (Área Rectora de Salud de Santa Cruz):
The petitioner, in her capacity as legal representative of the Asociación de Desarrollo Integral de El Cacao, located in Santa Cruz, Guanacaste, brings this amparo proceeding (amparo). She explains that a residential development and a treatment plant were built at that location to serve approximately 168 homes. She states that, in April of this year, 2025, a serious problem was reported to the Municipalidad de Santa Cruz, insofar as sewage began to emerge from the piping connected to the treatment plant as a result of paving work that had been carried out.
She states that the plant ceased operating for several days, causing a blockage that, in turn, resulted in sewage overflowing and fecal fluids being deposited in the open air, producing a foul odor and threatening the health of the community’s residents.
She mentions that, although the municipality initiated proceedings, the process has been very slow, and the harmful effects of this situation persisted as of the date the amparo was filed (since everything remained as it had been on the first day). She adds that Dirección08 is becoming increasingly contaminated each day because all the waste is deposited there.
For all the foregoing reasons, she requests the intervention of this Court so that the sewage problem may be resolved and the proper operation of the treatment plant restored. She also requests that the necessary steps be taken to transfer the waste to another treatment plant located in Las Maravillas de Santa Cruz.
Now, to begin the examination of the merits of this matter, it should be noted that, after reviewing the arguments presented by the petitioner, all the reports submitted by the respondent authorities (Instituto Costarricense de Acueductos y Alcantarillados, Municipalidad de Santa Cruz, and Área Rectora de Salud de Santa Cruz), as well as all the evidence entered into the record, this Constitutional Court has conclusively found the following relevant facts to be established:
First, that a social-interest residential development called El Cacao was built in Santa Cruz de Guanacaste, consisting of 170 homes and housing an approximate population of 600 people. Furthermore, that a private-law entity named Construcciones Modulares de Costa Rica S.A. is listed as the owner of that residential development.
Second, that, because of this urban development, it was necessary to construct a wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) for wastewater management. Furthermore, it has been established that Banco IMPROSA S.A., acting as trustee (fiduciario), is the developer and the party responsible for constructing and operating the plant. The record also shows that Construcciones Modulares de Costa Rica S.A. was responsible for constructing the aforementioned plant and that this infrastructure is located on private property belonging to the aforementioned banking entity.
Third, that the permits to construct the plant were granted by the Ministerio de Salud in 2011 and that the construction plans for this infrastructure were approved by ICAA in July 2013.
Fourth, that the plant is not operated by ICAA or by an ASADA (nor is it located within an ASADA service area). All the plant’s infrastructure is privately owned.
Fifth, that the aforementioned plant has not been transferred to ICAA in accordance with the procedure established in the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento (because the requirements established for that purpose by the legal system have not been met). The developer has not submitted any request for ICAA to assume administration of the sanitation system.
Sixth, that, since at least 2021, the aforementioned treatment plant has experienced a series of operational problems, which have resulted, among other things, in the irregular discharge of sewage and the generation of foul odors. The irregular flow of untreated wastewater into Quebrada Campero was even verified. Furthermore, the record shows that, in May 2024, a private company conducted a diagnostic assessment of the plant and found a series of technical deficiencies in it.
Seventh, that, in March 2025, as a result of paving work performed by a company hired by the Municipalidad de Santa Cruz near the aforementioned residential development, a potable-water pipe and a wastewater pipe ruptured, worsening the aforementioned state of affairs. As a result of this situation, inspections have been conducted by ICAA officials and by officials of the respondent municipality. When the events occurred, the respondent municipal authorities conducted an inspection and determined that sewage was generating foul odors and contaminating the soil, particularly in the area excavated by the aforementioned company to install a stormwater inspection chamber (caja de registro de aguas pluviales). Furthermore, on April 17, 2025, the plant’s discharge point at Quebrada Campero was inspected, and it was determined that “the discharge is constant, the water has a dark coloration that distinguishes it from the water present in the channel, and it emits a very strong foul odor.” On August 18, 2025, ICAA verified that the treatment plant was not operating and had been completely abandoned; that the sanitary sewer system had blockages in the line carrying the discharge to the receiving body, Rio Campero (because the construction company had sealed the damaged pipe with concrete); that this had resulted in untreated wastewater flooding the site to approximately 60 cm above natural ground level; and that strong, foul odors could be detected.
Eighth, that the three authorities named as respondents in this amparo—namely, the Municipalidad de Santa Cruz, the Área Rectora de Salud de Santa Cruz, and the Instituto Costarricense de Acueductos y Alcantarillados—have been fully aware of the situation described above for several months or years. Indeed, the record shows that several complaints have been filed with the municipality and the health governing area. The petitioner, for example, reported the matter to the respondent municipal corporation in April 2025.
Ninth, that the foregoing state of affairs (the improper operation of the treatment plant, the irregular discharge and stagnation of sewage, the discharge of untreated sewage into a stream, and the generation of foul odors) unquestionably and indisputably causes a serious environmental pollution problem and adversely affects the health primarily of the hundreds of people living near the site in question. All persons who live, work, or study near the aforementioned treatment plant, or who travel through the site where this infrastructure is located, are exposed to wholly and utterly unsanitary and deplorable conditions. Furthermore, it must not be overlooked that Quebrada Campero is also being seriously polluted because it is exposed to discharges of untreated or raw sewage.
IV.Having stated the foregoing, it is necessary to examine the actions taken by the respondent authorities in addressing the aforementioned pollution problem.
A. With regard to the Municipalidad de Santa Cruz, it has been established that those authorities have been aware of the problem under examination since 2021 (by virtue of an initial complaint concerning foul odors emitted by the treatment plant) and that, despite the several years that have elapsed, they have not taken clear and decisive action aimed at resolving it permanently. It should be noted that, according to the section on facts established in this amparo, the only documented actions taken in connection with that complaint were the issuance of a report in October 2021 (recording verification of the alleged facts) and a series of recommendations, although it is unknown whether those recommendations were followed. The same situation—a complaint and municipal intervention—recurred in March 2022 and June 2023; however, in both cases, the only actions again shown to have taken place were an inspection (which confirmed the foul odors and the discharge of sewage into a stream) and the issuance of recommendations, compliance with which was likewise not established in this amparo.
Now, regarding the events that occurred in March of this year (the discharge of sewage resulting from work performed by the company paving the streets), the record shows that, in April 2025, the municipal Departamento de Gestión Vial did in fact issue a large number of official communications to other public bodies both within and outside that municipal corporation, seeking to arrange meetings, obtain opinions, conduct tests, carry out inspections, and so forth. However, the report and evidence submitted to this Chamber made no reference to the outcome of these subsequent efforts. Additionally, it was shown that an inspection of the site was conducted on April 17, 2025, during which the environmental problem under examination was verified and the sole recommendation issued was to request the intervention of the environmental prosecutor’s office, without recommending any other urgent action by the municipality itself to safeguard and protect the health of the community’s residents and prevent the serious pollution that persisted at that time (and continues to this date).
It was subsequently determined that, in May, July, and August 2025, the municipality merely held meetings and working sessions with officials from the same municipal corporation, other public bodies, and representatives of both Grupo Mutual and BANHVI, in an effort to find a solution to the problem in question. The fact remains, however, that these working groups have not resulted in any decisive action capable of mitigating the aforementioned negative effects associated with the operation of the treatment plant.
Accordingly, this Constitutional Chamber has no doubt that the authorities of the respondent municipality have committed serious omissions that have contributed to the continuation, to this date, of the public-health and environmental problem under examination, which was detected as early as approximately 2021.
B. With regard to the Área Rectora de Salud de Santa Cruz of the Ministerio de Salud, it has been established that these authorities have known about the problem under examination since 2022 and that, since then, they have also conducted inspections at the site and, after verifying the reported facts, issued several health orders (órdenes sanitarias), primarily to the owner of the treatment plant (the representative of Construcciones Modulares de Costa Rica S.A.) and to Banco IMPROSA S.A. (in its capacity as trustee of the project), both private-law entities. It was likewise shown that, due to noncompliance with those measures, the case was ultimately referred that same year, 2022, to the Fiscalía Ambiental. It was also reported that the case was referred to the Tribunal Ambiental Administrativo. Thereafter, the record shows only that, in April 2023, the respondent health governing area recommended submitting a “request for assistance” to comply with a requirement issued by the Fiscalía Adjunta Agrario Ambiental; however, it was neither reported nor demonstrated whether this final action was carried out.
It is also established that more than one year after this last-mentioned action was taken, specifically, in mayo de 2023, that Governing Health Area (Área Rectora de Salud) merely sent an official letter (oficio) to the Asociación de Desarrollo Integral de El Cacao, in which it stated that the administrative remedies had been exhausted and that, because those responsible had not found a solution, the case had been referred for judicial proceedings (Fiscalía Ambiental).
It was likewise demonstrated that one year later, in marzo de 2024, that Governing Health Area issued a sanitary order (orden sanitaria) to the Municipalidad de Santa Cruz (so that it would take “(…) the necessary measures or actions and conduct a diagnosis, characterization, and evaluation of the wastewater treatment system (sistema de tratamiento de aguas residuales) of Residencial Nuevo El Cacao, in order to verify its operation (…)”. However, it was neither reported nor established that appropriate follow-up had been given to this latter order.
It is also established that in marzo del año anterior a sanitary order was issued to ICAA, requesting that it assume operation of the wastewater treatment system of Residencial El Cacao until the criminal proceedings were resolved. Nevertheless, through official letter No. GSP-RCHO-2024-01377 de mayo de 2024, ICAA stated the reasons why it was not possible to assume responsibility for or comply with the order. In response to this situation, the Governing Health Area requested an opinion on how to proceed with respect to the response provided by ICAA, but this Chamber was not informed what occurred after that opinion was issued or what was ultimately decided in that regard.
In addition to the foregoing, it was demonstrated that a new order was also issued to Banco IMPROSA S.A. en el año 2024, which once again was not complied with, as stated in a report de agosto de ese mismo año.
Likewise, according to the information provided, those authorities requested that the aforementioned Fiscalía Ambiental impose precautionary measures (medidas cautelares) in response to the problem described. However, the report did not explain what that judicial body had ordered or decided in this regard.
Thus, it follows that for nearly a year (agosto de 2024), the Ministry of Health has neither ordered any measure nor undertaken any specific and forceful action aimed at addressing the serious pollution problem established in these amparo proceedings (proceso de amparo). This is despite the fact that, as stated, these authorities are fully aware that the situation persists to date and that it was even aggravated by the events that occurred en marzo de este año as a result of the work performed by a company hired by the respondent municipality.
At this point, it is important to remind the authorities of the Ministry of Health that referring the case to the Ministerio Público or any other authority does not relieve or exempt the Ministry from continuing to address it and providing the appropriate follow-up by ordering and carrying out all relevant actions, in accordance, in turn, with the provisions of the Ley General de Salud and its regulations. In this regard, in Voto No. 2016-6368 de las 09:30 hrs. de 13 de mayo de 2016, this jurisdiction stated as follows:
“(…) V. THE AMPARO AGAINST THE MINISTRY OF HEALTH. MERITS: It follows from the foregoing facts that, although the Ministry of Health acted promptly, issued the sanitary orders, and even filed criminal complaints, the fact remains that the public-health problem persists, as its representative stated in the report submitted under oath. The Chamber does not find that the Ministry adopted extraordinary measures, such as closing the premises, obtaining assistance from the Fuerza Pública to secure the location, or even potentially evacuating the residential development, or any other effective measures. The provision of a public service such as that entrusted to the Ministry of Health requires a degree of efficiency and diligence perhaps exceeding that required of other public bodies, because of the fundamental rights to health and to a healthy environment, insofar as its powers are concerned. The Chamber considers that the actions taken by the Ministry of Health have been insufficient and violate the petitioner’s fundamental right to health and to a healthy environment; accordingly, the amparo must be granted against it, and it must be ordered to implement the necessary measures, including drastic measures, and adopt the pertinent decisions to eliminate the existing public-health problem in the area bordering Dirección09, Río Liberia, and Residencial El Río, within a period of two months from notice of the judgment. (…)” (Emphasis not in the original).
Likewise, in Sentencia No. 2022-10613 de las 09:40 hrs. de 13 de mayo de 2022, this Chamber stated:
“(…) IV.- THE SPECIFIC CASE.- After analyzing the evidence submitted, this Court finds that the respondent authorities violated fundamental rights. This is because the report submitted by the representative of that authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, established in artículo 44, de la Ley que rige esta Jurisdicción—and the evidence submitted for resolution of the matter duly establish that el 16 de agosto del 2021, the respondent received the complaint filed by the petitioner against his neighbors for discharging sewage (aguas servidas) onto his property. El 27 de agosto del 2021, the Environmental Manager of the Área Rectora de Salud Alajuela 1 inspected the site, where the health authority found that stormwater and wastewater (sewage and gray water) were being discharged onto the petitioner’s property, causing foul odors and a risk of proliferation of insects and rodents that could affect the health of the people living in the residence.
El 03 de setiembre del 2021, the respondent issued and served sanitary order N° 0188, ordering Nombre06 to correct the problem found and, within two months, to provide for the sanitary and proper disposal of stormwater, wastewater, and sewage that were not properly channeled at the residence owned by that person. El 10 de noviembre del 2021, the respondent conducted an inspection to verify compliance with the aforementioned sanitary order and confirmed that stormwater and wastewater continued to be discharged onto the protected party’s property, thereby establishing noncompliance with the order. Through official letter MS-DRRSCN-DARSA1-3001-2021, the respondent referred a complaint to the Fiscalía Adjunta de Alajuela against Nombre06 for the offense of disobedience of authority, but no decision has been issued to date. El 09 de diciembre del 2021, the petitioner filed a complaint against Nombre07, stating that the accused channeled stormwater and wastewater (gray water) onto his property, and therefore requested that the neighbor be instructed to channel that water properly.
El 06 de enero del 2022, the respondent conducted the inspection and, although no one was present on the accused person’s property, it was confirmed that stormwater and gray water were directed onto the petitioner’s property; sanitary order 0030 was therefore prepared, ordering Nombre07 to provide for the sanitary and proper disposal of stormwater that was not channeled at his residence. However, service has not been possible because no one can be found at the premises.
Accordingly, this Chamber considers that, although the respondent argues that it has taken actions aimed at resolving the situation affecting the protected party, the fact remains that it has not succeeded in resolving it conclusively. The mere filing of a criminal complaint for failure to comply with a sanitary order, and the excuse that the other sanitary order could not be served, are insufficient for this Chamber, considering that there is a serious and substantiated problem involving improperly managed rainwater and wastewater, all of which flow onto the petitioner’s property because the neighbors have failed to construct drainage works. This has caused serious flooding and pollution problems for a long time, and the matter remains unresolved. It should be noted that the Ministry of Health has broad powers to act pursuant to the Ley General de Salud and the corresponding Reglamento, as the governing authority responsible for health monitoring and control, including: special sanitary measures (medidas sanitarias especiales) for the evacuation of a dwelling (artículo 1 inciso c del Reglamento), a declaration of uninhabitability, demolition, and fines.
This is because it is clear that, pursuant to Ley General de Salud artículos 39 y 286, every owner and person responsible for movable and immovable property has a duty to prevent nuisances and harm to health, as well as sources of contamination or infection, and must carry out drainage works; in the event of refusal, the administration may even perform them at the expense of the noncompliant party, while safeguarding due process (debido proceso) throughout. The appropriate course is therefore to grant the amparo, with the consequences to be stated in the operative part (…)” (Emphasis not in the original).
More recently, in Voto No. 2025-583 de las 09:20 hrs. de 10 de enero de 2025, this constitutional body stated:
“(…) Regarding the Ministry of Health. Although the reports submitted and the evidence in the case file establish that the respondent authorities of the Ministry of Health—Área Rectora de Salud de Puntarenas – Chacarita—have taken steps to comply with the orders previously issued by this Court, as reflected in the proven facts of this judgment, and that, following the Municipalidad de Puntarenas’s failure to comply with sanitary order 0112-REG-2024, el 4 de diciembre del 2024, a criminal complaint was filed against the Municipalidad de Puntarenas before the Fiscalía Adjunta del Ministerio Público en Puntarenas for the alleged offense of disobedience of authority; the fact remains that, in this Chamber’s view, that Ministry’s performance of its duty has been insufficient, because it is required to ensure compliance and guarantee the protection of public health and the environment (…)” (Emphasis not in the original).
Under these circumstances, it is clear that the respondent authorities of the Ministry of Health have also failed to address the serious environmental situation facing the community of El Cacao de Santa Cruz de Guanacaste.
C. Finally, with regard to the Instituto Costarricense de Acueductos y Alcantarillados, it was reported and established by the evidence submitted that the treatment plant belongs to a private-law entity (sujeto de derecho privado) and has not been transferred to ICAA in accordance with the procedure established in the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento (because the requirements specified for that purpose have not been met). It was asserted that the developer has not submitted any request for ICAA to assume administration of the sanitation system and that, because the plant is privately owned, “its operation, maintenance, and compliance with the sanitary orders are the exclusive responsibility of the developer.” It was also demonstrated that en marzo de 2024 the Ministry of Health issued a sanitary order directing ICAA to assume operation of the aforementioned plant; however, the order was not complied with, based on the reasoning set forth in technical report No. GSP-RCHO-2024-01377 de 9 de mayo de 2024. Both in that report and in the report submitted to this Chamber, ICAA clearly explained the following:
“(…) The sanitation infrastructure (infraestructura sanitaria) in the El Cacao project, which has operational problems, has not been formally transferred in accordance with the procedure established for that purpose. - There is no record of a formal request by the interested parties (Developer) for AyA to begin the process of taking over this sanitation system, in compliance with the AyA Regulation on the Approval and Acceptance of Sanitation Systems. – The sanitary order (orden sanitaria) directing AyA to take over the system under its current conditions constitutes a mechanism that would exempt the developer from making the required investment. This would mean burdening the State with using public funds to carry out the works that the developer should have ensured were constructed at the inception of the project. (…) It must be clarified that both the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) and the effluent collection and disposal system must be in good operating condition for any eventual commissioning and acceptance process to be completed.
- Compelling the investment of public resources through sanitary orders to remedy deficiencies in infrastructure that must be designed, constructed, and operated in compliance with the applicable regulations would constitute an easy and questionable means for certain developers to avoid fulfilling their fundamental, legally prescribed obligations (…)” (Emphasis not in the original).
Following this last action, the record contains only an inspection conducted by the ICAA at the site under review on 18 de agosto de 2025 (in connection with the filing of this amparo action [recurso de amparo]), through which the alleged facts were verified, it was reiterated that the operation and maintenance of the plant do not fall within that institute’s jurisdiction for the reasons stated above, and a series of recommendations were issued directly to the respondent municipality.
It should now be noted that, although this Constitutional Chamber is aware of and understands the objective reasons explained by the ICAA authorities for not using public funds to assume responsibility for a problem attributable to a private-law entity, it is also true that this state of affairs neither should nor can exempt it from cooperating with the other respondent authorities in order to find a solution to the established environmental and public-health problem. Given the seriousness of the facts demonstrated and, principally, the harm being caused by the treatment plant’s malfunction, this Constitutional Court considers that the ICAA must intervene (by virtue of its clear and extensive expertise in the matter) and undertake the appropriate coordination measures with both the Municipalidad de Santa Cruz and the Área Rectora de Salud de Santa Cruz so that, acting jointly, they may find a response and address the situation under review. Although, as stated, the ICAA is not required to assume operation of the plant or invest public funds in it, it may cooperate and coordinate with the other aforementioned public bodies under the terms indicated. However, such efforts are lacking in this matter, since the ICAA merely issued report No. GSP-RCHO-2024-01377 and provided no other form of cooperation or alternative solution, all to the detriment of the affected population.
* It is evident that the situation described above clearly violates the fundamental rights not only of the petitioner but also of the other residents of the aforementioned human settlement, since the situation has been known since 2021 and has not been definitively resolved, with the aggravating circumstance that it entails harm not only to the environment but also to public health itself.
As explained, despite the efforts undertaken primarily by the respondent municipal government and the Área Rectora de Salud de Santa Cruz, effective and efficient interinstitutional cooperation has not materialized to determine how to resolve the problem in question. Nor was it shown that the ICAA authorities intervened and assisted in finding a solution to this state of affairs.
This Court finds that there has been little joint action among the respondents, since they have failed to definitively resolve the environmental-pollution problem, to the detriment of public health. By virtue of the foregoing, it is appropriate to grant the action for violation of Articles 21 and 50 of the Constitución Política, under the terms set forth in the operative portion (parte dispositiva) of this judgment.
In environmental matters, it is also the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Constitución Política), as is the case here, where, despite the filing of an environmental-pollution complaint, it has not been definitively resolved, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
V.Documentation submitted to the case file (expediente). The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be retrieved from the court clerk’s office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, Article XXVI, and published in the Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, Article LXXXI.
POR TANTO:
The action is granted. Jorge Arturo Alfaro Orias, in his capacity as Mayor, and Didier Monge Jiménez, in his capacity as Coordinator of the Departamento de Gestión Vial, both of the Municipalidad de Santa Cruz de Guanacaste; Warren Chavarría Venegas, in his capacity as Director of the Área Rectora de Salud del Ministerio de Salud en Santa Cruz de Guanacaste; and Rafael Alberto Barboza Topping, in his capacity as Deputy Manager of Gestión Sistemas Delegados of the Instituto Costarricense de Acueductos y Alcantarillados—or whoever may hold those positions in their stead—are ordered, IMMEDIATELY upon notification of this judgment, to act jointly and in coordination to take all necessary measures to temporarily ensure that the health of the persons residing in the Residencial de Interés Social El Cacao is not adversely affected while a definitive solution is reached regarding the problem at issue in these proceedings.
Those authorities are likewise ordered to coordinate among themselves as necessary, issue the pertinent orders, and carry out all actions falling within the scope of their authority so that, within a maximum period of TWO MONTHS from notification of this judgment, a definitive solution is provided to the established environmental and public-health problem. All of the foregoing shall be carried out under the terms set forth in this judgment. The respondent authorities are warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo action that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or to a fine of twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty.
The Municipalidad de Santa Cruz de Guanacaste, the State, and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation courts. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiseis de setiembre de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED08, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL MINISTERIO DE SALUD Y LA MUNICIPALIDAD DE SANTA CRUZ.
RESULTANDO:
Redacta el Magistrado Araya García; y,
CONSIDERANDO:
La recurrente, en su condición de Presidenta de la ADI de El Cacao de Santa Cruz de Guanacaste, aduce que los vecinos del residencial ubicado en dicha zona sufren un grave problema de contaminación y de afectación a la salud, debido a que la planta de tratamiento de aguas residuales no funciona adecuadamente. Acusa que dicha problemática se agravó a raíz de unos trabajos de pavimentación contratados por el municipio de la localidad que produjeron un discurrir irregular y estancamiento de aguas negras a cielo abierto, que generan un olor fétido. Asimismo, alega que dichas aguas sin tratar se depositan directamente en la Quebrada Campero.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

Hechos relacionados con el ICAA:
“(…) I. Resumen ejecutivo El Conjunto Residencial de Interés Social El Cacao corresponde a un proyecto habitacional de bien social de 170 unidades, localizado en la provincia de Guanacaste, Cantón Santa Cruz y Distrito Santa Cruz. Su sistema de recolección y tratamiento de aguas residuales es administrado y operado por su desarrollador, una figura de derecho privado, mientras que el sistema de agua potable es administrado por esta Institución. Según indica la orden sanitaria N° MS-RCH-ARS-SC-ERS-OS-037-2024 de fecha 18 de marzo del 2024, por falencias en operación de la infraestructura de recolección y tratamiento de aguas residuales (casi en estado de abandono), el Área Rectora del Ministerio de Salud solicitó a AyA realizar las acciones necesarias con el fin de asumir el funcionamiento y operatividad del sistema de tratamiento. Lo anterior hasta que se resuelva el caso del expediente N° 23-000013- 1791-PE, lo cual constituye una decisión fundamentada en la Ley Constitutiva del AYA.
Se realizaron las inspecciones al sistema de saneamiento El Cacao y de las mismas se constató que la Planta de Tratamiento de Aguas Residuales (PTAR) no se encontraba operando y que el alcantarillado sanitario no presentaba obstrucciones en la red del residencial; la PTAR tampoco contaba con el medidor eléctrico de los servicios públicos y, por ende, se encontraba apagada, con descarga directa de aguas crudas al Río Campero (es decir, aguas sin tratamiento). El proyecto cuenta con planos aprobados por parte de AYA desde el año 2013, con sistema de agua potable instalado, operando y administrado por este Instituto; no así el sistema de recolección y tratamiento, de administración privada. A la fecha el Desarrollador no ha tramitado ante el AyA la entrega y traspaso para administración del servicio, según procede con base en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA.
El Instituto Costarricense de Acueductos y Alcantarillados (AyA) se encuentra en la mejor disposición de recibir, operar y mantener el sistema de saneamiento de El Cacao, siempre y cuando el desarrollador realice las gestiones pertinentes según el reglamento antes mencionado (…) V. Conclusiones - La Infraestructura sanitaria en el proyecto del Cacao que presenta problemas operativos no ha sido entregada formalmente siguiendo el procedimiento indicado para este fin. - No se registra una solicitud formal por parte de los interesados (Desarrollador) para que AYA inicie el proceso para asumir este sistema Sanitario, en apego del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA. - La orden sanitaria que se dirige a AyA para que asuma el sistema en las condiciones actuales, representa un mecanismo que eximiría al desarrollador para realizar la inversión requerida. Esto implicaría que se cargue al Estado que mediante fondos públicos se realicen las obras que el desarrollador debería haber garantizado que se construyeran en la génesis del proyecto. - Se evidencia un aparente desacato por parte de los operadores de la infraestructura, pues ya hay antecedentes de años atrás documentando los problemas operativos y por descarga de agua aparentemente cruda al río. - La infraestructura de saneamiento está en propiedad privada y en la actualidad no es objeto de operación, ni siquiera cuenta con medidor eléctrico o técnicos de operación. - El personal de AyA no logró ingresar dentro de la PTAR y, por ende, no se tiene un diagnóstico detallado de sus componentes.
Es necesario aclarar que tanto la PTAR, como el sistema de recolección y disposición del efluente deben encontrarse en buen estado operativo para que el eventual proceso de puesta en marcha y recepción se concrete. - El suscrito intentó en dos oportunidades contactar a los encargados de la PTAR para ingresar y hacer una valoración detallada de sus componentes (18 y 19 de marzo de 2024), pero no fue posible obtener la autorización. Por esa razón, no se tiene un diagnóstico minucioso y real del estado presente de las obras ni una cuantificación monetaria de las labores que podrían requerirse para su normalización. - Forzar mediante ordenes sanitarias la inversión de recursos públicos para subsanar falencias en infraestructura que debe ser diseñada, construida y operada en apego a la normativa, representaría una vía fácil y cuestionable, para que ciertos desarrolladores no cumplan con sus obligaciones fundamentales y normadas (…)” (ver prueba).
“(…) ANÁLISIS (…) la PTAR no se encontraba operando, el alcantarillado sanitario presentaba obstrucciones en la línea que conduce hacia el vertido al cuerpo receptor; la PTAR se encontraba apagada y en total abandono, con inundación de aguas crudas en el sitio de aproximadamente 60 cm sobre el nivel del terreno natural (…) El sitio es propiedad privada, se encuentra con malla perimetral con protección de alambre de púa y portones cerrados con cadena y candado; no se encontraba personal operativo en el momento de la visita. En la inspección realizada se conversó con tres vecinos de lugar para ubicar a la persona responsable de dar acceso a la PTAR, sin embargo, no fue posible localizarlo. Adicionalmente, los vecinos no tienen certeza con respecto a quien es realmente el responsable de la administración, operación y mantenimiento de la PTAR, ya que según indican, las llaves se encuentran en posesión del Grupo Mutual, esto por cuanto, según ellos, el Banco Improsa ya no es el responsable del proyecto, indican además que el Desarrollador dejó de hacerse cargo de la PTAR hace mucho tiempo y que el Grupo Mutual es quien ha retomado el proyecto.
Los vecinos comentan que antes existía una persona de la comunidad encargada del mantenimiento de la PTAR, sin embargo, ya esta persona no se encuentra a cargo y desconocen si alguien más se encarga actualmente de estas labores. Adicionalmente, se informa por parte de los vecinos que, a pesar de contar con un medidor eléctrico en apariencia funcional, se han desconectado los equipos y no hay certeza de quien tomó la decisión, suponen fue como medida de precaución ante la situación actual de inundación que sufre el lugar. El lugar donde se encuentra la PTAR se ve claramente abandonado y descuidado, sin ningún tipo de mantenimiento, tanto en la infraestructura como en las zonas verdes (…) En el momento de la visita de inspección, la PTAR se encontraba completamente inundada de aguas residuales, aproximadamente 60 cm sobre el nivel del terreno natural, lo que causa malos olores en la zona (…) los tanques de aireación y el tanque sedimentador se encuentran totalmente sumergidos, al igual que las pasarelas y parte los lechos de secado, alcanzando incluso el nivel de piso de la casa de máquinas y bodega (…) Cabe destacar, que durante la inspección también se realizó recorrido hacia el punto de vertido de la PTAR en compañía de algunos vecinos del lugar.
Durante el recorrido los vecinos indicaron los puntos donde la empresa contratada por la municipalidad (encargada del asfaltado) ocasionó unas rupturas, tanto de la tubería de agua potable como la de aguas residuales; se confirma la rotura de la tubería de aguas residuales ya que los mismos vecinos manifestaron con respecto a este tema que la empresa rompió “el tubo de color anaranjado”. La señora Nombre02, cédula CED06, vecina del lugar, indicó que esto sucedió en el mes de marzo durante la ejecución de las obras por parte de la empresa contratada por la Municipalidad y que las aguas que salían eran de muy mal aspecto y olor; además, la señora Chavarría señala que se vio afectada directamente, ya que su vivienda se encuentra casi al frente del daño y que días después la misma empresa que ocasionó el daño “tapó con concreto la tubería dañada”. La misma versión se recibió por parte del señor Nombre03, cédula CED07, el cual indica que después de este acontecimiento iniciaron los problemas con la PTAR.
Es importante señalar que, se le consultó a la señora Nombre02, si con anterioridad a este acontecimiento ella notó o había percibido en algún momento el brote de estas aguas o malos olores, a lo cual ella contestó que nunca había pasado algo así, y que la duración de su afectación fue durante el tiempo en que el tubo anaranjado estuvo quebrado, ya que una vez que la empresa lo selló con concreto ella no volvió a percibir malos olores. Además, se visitó el cuerpo receptor de las aguas provenientes de la PTAR en cuestión. Se encontró que el punto de vertido está totalmente seco, lo que indica que el alcantarillado se encuentra obstruido previo a este punto, coincidiendo con las versiones de los vecinos de que existe un taponamiento en la red (…) RESULTADOS DE LA INSPECCION • El sistema de recolección (alcantarillado sanitario) se encuentra obstruido en el tramo de descarga al Río Campero. • No se obtuvo ingreso a la PTAR; no obstante, se constata que la misma no está siendo operada, en el sitio no había presencia del operador o vigilancia de los equipos. • La PTAR no cuenta con mantenimiento de la infraestructura ni de zonas verdes. • La PTAR no está en operación, los equipos se encuentran apagados, los sistemas de tratamiento de la PTAR (tanto en su proceso primario como secundario) están en abandono e inundados de aguas residuales. • No se tuvo acceso a la bitácora de la operación de la PTAR. • Se constata que se han llevado a cabo obras de preparación de la calzada, así como la colocación de tuberías de aguas pluviales, construcción de tragantes y pozos de aguas pluviales.
El sistema de recolección y tratamiento de aguas residuales del Conjunto Residencial de Interés Social El Cacao no es administrado ni pertenece a AyA, razón por la cual su operación y mantenimiento no son competencia del Instituto; en caso de que existiera afectación a la salud, la misma no sería derivada de ningún acto que sea competencia o responsabilidad de AyA, sino que es propia del Desarrollador, tal y como lo establece la legislación actual. Es importante señalar que la PTAR del Residencial de Interés Social El Cacao, no ha sido recibida en administración por parte de AyA y por lo tanto su operación y mantenimiento corresponde a sus propietarios. La entrega de las obras al Instituto es un acto propio a voluntad del Desarrollador, quien debe presentar una solicitud formal de deseo de entregar la PTAR una vez que cumpla con los requisitos del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA, para que el Instituto verifique su cumplimiento y pueda recibir, operar y mantener la PTAR.
La Ley General de Administración Pública, en su Artículo 66, señala con claridad que las potestades de imperio y su ejercicio, y los deberes públicos y su cumplimiento, serán irrenunciables intransmisibles e imprescriptibles a partir de esa disposición y en complemento a lo que expresa. La Ley General de Salud, en sus Artículos del 285 al 292, indica que existe un deber ineludible de parte del Ministerio de Salud, por atender de forma directa y obligar al Desarrollador a corregir de forma inmediata el problema ocasionado por la incorrecta disposición de las aguas residuales, situación que está generando problemas de salud que afectan a la comunidad aledaña al proyecto. En este sentido, AyA NO está obligado a resolver el problema técnico que presenta la operación de PTAR, puesto que la Institución no puede absorber infraestructuras privadas de forma antojadiza sin respetar los debidos procedimientos para recepción de obras y operación (según el Capítulo III del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados, donde se regulan los requisitos y procedimientos para asumir la administración, operación y mantenimiento de sistemas de saneamiento).
Durante el procedimiento de recepción del proyecto por AyA, el Desarrollador deberá cumplir en todos sus extremos el Artículo 12 del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados; hasta el momento no existe ninguna solicitud planteada por el encargado del residencial El Cacao para traspasar las obras de saneamiento a AyA. Así las cosas, en consecuencia, resulta responsabilidad del Desarrollador dar el mantenimiento al sistema de recolección y tratamiento de la PTAR El Cacao. Es responsabilidad del Desarrollador también el procurar porque los sistemas se operen de manera óptima y acatar las órdenes sanitarias que emite el Ministerio de Salud, que, a su vez, es el responsable de velar por su obligatoriedad, cumpliendo tal y como le compete según la Ley General de Salud. Finalmente, debe indicarse que se vuelve necesario el cumplimiento de requisitos de índole legal, técnico y operativo que permitan al AyA recibir sistemas de saneamiento de aguas residuales.
Esos requisitos deberán ser cumplidos por el particular, con el propósito de que el Instituto pueda brindar los servicios que requiere, de manera eficiente, y no aceptando sistemas que se conviertan en una carga y una necesidad adicional de inversión de fondos públicos (cuyo costo debió asumir quien desarrolló el proyecto constructivo). RECOMENDACIONES • Solicitar a la Municipalidad de Santa Cruz realizar la limpieza de las instalaciones de la PTAR El Cacao, mediante succión de toda el agua residual que se encuentra empozada en el sitio, a través del servicio de recolección mediante una empresa autorizada, evitando la descarga del agua cruda al Río Campero. • Solicitar a la Municipalidad de Santa Cruz la eliminación del taponamiento y reparación del tramo de tubería sanitaria dañada, en calidad de contratante de la empresa responsable del daño CONCLUSIONES • La infraestructura sanitaria en el proyecto del Cacao no ha sido entregada formalmente siguiendo el procedimiento indicado para este fin. • No se registra una solicitud formal por parte de los interesados (desarrollador) para que AyA inicie el proceso para asumir este sistema sanitario, en apego del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA. • Obligar a que AyA asuma el sistema en las condiciones actuales, va contrario a la ley y representa un mecanismo que eximiría al Desarrollador de realizar la inversión requerida.
Esto implicaría que se cargue al Estado mediante fondos públicos el realizar las obras que el Desarrollador debería haber garantizado que se construyeran desde el origen del proyecto. • Se evidencia un aparente desacato por parte de los operadores de la infraestructura, pues ya hay antecedentes de años atrás documentando los problemas operativos y por descarga de agua aparentemente cruda al río. • La infraestructura de saneamiento está en propiedad privada y en la actualidad no es objeto de operación, ni siquiera cuenta con técnicos de operación. • Es necesario aclarar que tanto la PTAR como el sistema de recolección y disposición de aguas tratadas en el efluente deben encontrarse en buen estado operativo para que el eventual proceso de puesta en marcha y recepción se concrete. • No se logró contactar a los encargados de la PTAR para el ingreso y valoración detallada de sus componentes. Por esa razón, no se tiene un diagnóstico minucioso y real del estado presente de las obras. • Forzar la inversión de recursos públicos para subsanar falencias en infraestructura que debe ser diseñada, construida y operada en apego a la normativa, representaría una vía fácil y cuestionable, para que algunos desarrolladores no cumplan con sus obligaciones fundamentales y normadas. • La Municipalidad de Santa Cruz, debe responsabilizarse por el daño ocasionado al alcantarillado sanitario en el tramo del vertido al Río Campero, a la PTAR y al medio ambiente, producto del taponamiento de la tubería, lo que ha ocasionado el estancamiento y anegación de la PTAR El Cacao. • En cuanto a la petitoria de que “esos residuos” sean trasladados a la PTAR de Dirección01 en Santa Cruz; la ciencia y la técnica indican que existen condiciones que no permiten esta petición, que consiste en trasladar los residuos a 2 kilómetros de distancia a otra PTAR.
En primer lugar, se desconocen las cotas de elevación de ambos terrenos y su respectiva pendiente, lo que implicaría un estudio topográfico de la zona; en segundo lugar se requiere de un diseño independiente que permita llevar dichas aguas residuales a la nueva PTAR; en tercer lugar se debería valorar la capacidad de la Planta de Tratamiento del Barrio las Maravillas, tanto en recolección como en tratamiento; en cuarto lugar esta inversión requeriría ser asumida por el Desarrollador y propietario de la actual PTAR El Cacao, siendo más oneroso que rehabilitar y corregir el buen funcionamiento de las instalaciones actuales (…)” (ver informe).
Hechos relacionados con la Municipalidad de Santa Cruz:
“(…) Análisis: Los vecinos del Residencial Nuevo El Cacao denuncian reiteradamente ante las instancias municipales el fétido olor que emana la planta de tratamiento del residencial Nuevo El Cacao y la descarga de aguas oscuras jabonosas y con mal olor hacia la quebrada campero, siendo que hay constancia de la denuncia de los vecinos del 21 de febrero de que la planta de tratamiento se encontraba sin operar y a la fecha esta situación no se ha corregido, se presume que las aguas residuales vertidas a la quebrada Campero no están recibiendo el tratamiento debido por lo cual esto se convierte en una amenaza hacia el cuerpo de agua receptor y hacia la salud de los vecinos quienes manifiestan que los malos olores les producen dolores de cabeza, náuseas y les impiden consumir sus alimentos con normalidad así como conciliar el sueño. Asimismo, en tres visitas de campo realizadas al sitio tanto en octubre del año 2021 como en febrero del corriente se pudo percibir malos olores en la planta y en el punto de desfogue, así como se pudo observar una coloración oscura y un aspecto espumoso/jabonoso en dicho efluente.
Por otra parte, se desconoce si el citado sistema de tratamiento ha recibido el seguimiento por parte del Ministerio de Salud según se indica en el Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales N.º 39887-S-MINAE en el artículo 27 o si cumple con los requisitos estipulados por el AyA que se plantean en el artículo 28 de dicho reglamento (…) Por tanto, el Ministerio de Salud así como el AyA según normativa son actores clave a citar para el mejor resolver de la problemática de salud pública y contaminación de las aguas de la quebrada que se gesta a partir de la deficiente operación o la falta de la misma del Sistema de Tratamiento de Aguas Residuales del Residencial Nuevo El Cacao. Por lo cual es fundamental que ambas instituciones converjan en un llamamiento por parte de la administración municipal con carácter de urgencia para conocer cuál será el procedimiento que seguirán para atender la problemática señalada con la inmediatez que se requiere (…) 8.
Recomendaciones: • Solicitar con carácter de urgencia la rendición de cuentas al Ministerio de Salud y al AyA para el mejor resolver de la problemática de afectación a la salud pública y la contaminación del cauce de la quebrada Campero que representa la deficiente operación o la carencia de la misma de la Planta de Tratamiento del Residencial Nuevo El Cacao. • Analizar la pertinencia de realizar una modificación unilateral a la contratación vigente 2021LA-000015-0021000001 descrita para la OPERACIÓN Y MANTENIMIENTO DE LA PLANTA DE TRATAMIENTO DE AGUAS RESIDUALES DEL RELLENO SANITARIO MECANIZADO DEL PARQUE TECNOLÓGICO AMBIENTAL DE SANTA CRUZ con el afán de resolver a corto plazo y por un período definido la problemática salud pública y de contaminación del cauce de la quebrada Campero (…)” (ver prueba).
“(…) 6. Análisis: Los vecinos del Residencial Nuevo El Cacao denuncian reiteradamente ante las instancias municipales el fétido olor que emana una alcantarilla dentro del residencial Nuevo El Cacao y la descarga de aguas oscuras jabonosas y con mal olor hacia la quebrada campero, por lo cual el departamento de protección ambiental se apersona al sitio denunciado, dirección 200 metros este de la entrada principal a este residencial, donde se pudo observar una alcantarilla la cual salen aguas jabonosas las cuales emanan un mal olor y generan una contaminación dentro de este residencial, además este departamento visita la planta de tratamiento del proyecto habitacional, la cual al momento se encuentra en funcionamiento, se realiza revisión del sitio de desfogue ubicado en la quebrada campero, donde se pudo observar el desfogue de aguas residuales y jabonosas que fluyen con mal olor hasta el cauce de esta quebrada. provocando una contaminación a esta naciente.
De todo lo anterior, ya este Departamento ha emitido informes resultando en una denuncia interpuesta ante la fiscalía ambiental por parte del Ministerio de Salud. 7. Recomendaciones: Según lo antes mencionado, este Departamento recomienda: 1- Enviar este informe al Ministerio de Salud, para que sea aportado al expediente judicial correspondiente. 2- Se sugiere al Ministerio de Salud remitir el presente informe al AyA para que estos a su vez intervengan en el sistema de alcantarillado para que las aguas residuales sean dirigidas a la planta de tratamiento y no discurran sobre la calzada sin tratamiento alguno (…)” (ver prueba).
“(…) A partir de la evaluación realizada en PTAR Residencial El Cacao, es posible emitir conclusiones acerca de su estado actual. Respecto al estado general de la PTAR se concluye: • El estado de conservación de la PTAR no es satisfactorio, se percibe mal estado físico de la estructura del tanque y elementos metálicos. Además, existen elementos esenciales para el tratamiento de los lodos como son los lechos de secado y los digestores sin embargo, no poseen la capacidad suficiente para el caudal de la planta. • La PTAR no se encuentra en operación y por ende no permite cumplir con el objetivo de tratamiento de aguas residuales del Residencial El Cacao, factor que provoca deterioro en el cuerpo de agua receptor y afectaciones a la comunidad. • En la línea de tratamiento secundario, la capacidad instalada de todas las unidades (volúmenes de tanques disponibles) es satisfactoria para el caudal calculado por medio del censo poblacional, mas no el caudal utilizado en diseño según la memoria de cálculo; cabe destacar que los sedimentadores tienen una longitud de sedimentación muy corta y por ende están pasando sólidos finos al efluente. • Los lodos generados en el sedimentador secundario se acumulan con el paso del tiempo y para evitar la reducción de su volumen útil, es necesario la purga a los lechos de secado (en evidente deterioro); es importante la implementación de la línea de lodos en la PTAR.
Respecto a la capacidad de las unidades de tratamiento: • En la línea de tratamiento preliminar existe una caja de rejas para evitar el paso de sólidos gruesos, sin embargo, las rejillas no son las adecuadas, la separación de las rejillas es muy amplia y se encuentran corroídas. No cuenta con una bandeja de escurrimiento por lo cual los sólidos no se escurren antes de ser llevados a su disposición final. • La aireación en el reactor biológico es suficiente sin embargo solo se tiene un soplador funcionando a más del 90%, situación que es inadecuada en caso de que este falle, la planta tendrá que parar de funcionar ya que no hay un respaldo. Es necesario contar con duplicidad en la unidad soplante para evitar esta situación y prolongar su vida útil. Según el informe electromecánico el soplador existente es funcional, pero requiere de mantenimiento preventivo amplio. • El sedimentador secundario cuenta con un canal de salida con vertedero dentado para no generar un flujo preferencial; sin embargo, en la entrada se provocan muchas perturbaciones ya que la agitación del tanque de aireación logra pasar hasta el canal del sedimentador.
La forma usual de un sedimentador secundario es más largo que ancho en una relación usual entre 3:1 a 5:1, con el objetivo proveer una distancia adecuada para la sedimentación de las partículas finas y evitar el paso de estas al efluente tratado y por ende al cuerpo receptor. Una forma cuadrada o muy corta no permite la sedimentación efectiva y genera problema de arrastre de sólidos. • Los lechos de secado no tienen el área adecuada para desaguar los lodos que deberían ser tratado en el digestor de lodos. Sobre la instalación electromecánica de la PTAR, se concluye: • El estado general de las tuberías no es adecuado, la mayoría no presenta rotulación, en la línea de agua residual, lodo y aire se encuentran gazas y anclajes en mal estado o no existe este elemento, lo que brinda inestabilidad y flexión a las tuberías. • Respecto al sistema de aireación, se concluye que satisfacen los requerimientos de oxígeno en la PTAR, sin embargo, solo se encuentra operando un soplador, lo cual puede generar problemas a futuro en caso de que este falle y no se tenga un respaldo que permita garantizar la aireación.
Actualmente, el soplador tiene la capacidad para dotar del caudal necesario para proveer a los organismos del tanque de aireación con el oxígeno necesario para su funcionamiento normal pero requiere mantenimiento. • Se detectaron fugas en la tubería de aire en cada tanque de aireación y en un sedimentador secundario por lo cual hay una pérdida de presión y mayor agitación de la necesaria. En el sedimentador no deberían existir perturbaciones por lo que la fuga afecta el funcionamiento de esta unidad. • Del mismo modo, las tuberías de la planta son de PVC y expuestas directamente al Sol lo que puede generar problemas importantes e incluso de manera repentina. Sobre el vertido al cuerpo receptor de efluentes que no cumplen los límites de vertido, se concluye: • Tal y como se muestra en el Cuadro 7, los valores de los parámetros obligatorios de análisis en el efluente, están muy por encima del límite permitido establecido en el Reglamento de Vertido y Reuso de Aguas Residuales lo cual puede generar problemas sociales, ambientales y legales. • El vertido de aguas residuales que no cumplen con los parámetros establecidos en el Reglamento de Vertido y Reuso de Aguas Residuales puede causar graves daños ambientales, afectando la biodiversidad acuática y provocando eutrofización.
Además, compromete la salud pública al contaminar fuentes de agua cercanas y dañar actividades recreativas y económicas. Estos vertidos alteran significativamente los ecosistemas y presentan riesgos serios tanto para el medio ambiente como para las comunidades humanas que dependen de esos recursos hídricos. De manera puntual se recomienda lo siguiente: • Mejora de caja de rejas e instalación de rejilla con bandeja de escurrimiento. • Construcción de losa superior en el tanque de aireación 1. • Acondicionamiento del digestor de lodos en un adensador de lodos. • Instalación de tanque plástico de 22 m³ para digestor de lodos. • Ampliación de sedimentador secundario 1. • Demolición de lechos de secado 1. • Construcción de 3 unidades de lecho de secado. • Mantenimiento preventivo del soplador actual. • Instalación de un nuevo soplador de paletas rotativas y tubería requerida. • Revisión y reemplazo de tubería de PVC a tubería HG en sitios expuestos al Sol. • Remodelación general de instalación mecánica, pintura y equipos.
Para finalizar con la presente evaluación, los pasos a seguir en busca de retomar una operación y mantenimiento efectivo de la PTAR y así generar un efluente tratado que cumpla con los límites de vertido establecidos por el Ministerio de Salud, se insta a aplicar las recomendaciones sugeridas, realizar las mejoras propuestas, brindar adecuada operación y mantenimiento regular en la planta, realizar reportes operaciones, toma de muestras y mediciones de parámetros obligatorios (DBO, DQO, SST, GyA, etc), en los tiempos requeridos según la normativa nacional (…)” (ver prueba).
“(…) Por medio de la presente, se informa que, en el proyecto de Pavimentación El Cacao, se ha identificado la presencia de aguas de origen desconocido en las coordenadas 10°17'07.3"N 85°34'12.4"W. A pesar de no observarse una ruptura en la tubería sanitaria, dichas aguas emanan un olor desagradable y parecen estar contaminando el suelo, particularmente en el área excavada para la instalación de una Caja de Registro para Aguas Pluviales. Cabe destacar que, de manera paralela a esta excavación, se encuentra una tubería sanitaria que, al parecer, proviene del Residencial El Cacao Nuevo, ubicado en las coordenadas 10°17'20.2"N 85°34'07.5"W. Se presume que las aguas en cuestión podrían tener su origen en la planta de tratamiento de dicho residencial. Ante esta situación, este departamento manifiesta su preocupación desde el punto de vista ambiental. Se tiene conocimiento de que este asunto está registrado bajo el expediente N.° 23-000013-1791-PE. Por esta razón, se solicita a la Alcaldía Municipal la posibilidad de coordinar una reunión con la Licda. Annia Melina Rodríguez Garro, Fiscal Auxiliar de la Fiscalía Adjunta Ambiental, a fin de analizar el caso y definir las acciones a seguir. Agradecemos su pronta atención a esta solicitud y quedamos atentos a su confirmación (…)” (ver prueba).
“(…) en relación con el Proyecto de Pavimentación El Cacao, se ha identificado la presencia de aguas de origen desconocido en las coordenadas (…) A pesar de no observarse una ruptura en la tubería sanitarias, dichas aguas emanan un olor desagradable y parecen estará contaminando el suelo, particularmente en el área excavada para la instalación de una caja de registro para aguas pluviales y otras zonas identificadas. (…) paralelamente a esta excavación, se encuentra una tubería sanitaria que, al parecer, proviene del Residencial El Cacao Nuevo, ubicado en las coordenadas (…) Se presume que las aguas en cuestión podrían tener su origen en la planta de tratamiento de dicho residencial. Ante esta situación, este departamento manifiesta su preocupación desde el punto de vista ambiental y solicita (…) Programar una inspección conjunta el lunes 13 de abril (…) Elaborar un informe detallado (…)” (ver prueba).
“(…) la Unidad Técnica de Gestión Vial instruyó a la empresa contratista, adjudicataria de la Licitación Pública No. 2021LN-000002-0021000001, correspondiente a la obra "Contratación de entrega según demanda para Obra Pública, Mantenimiento y Mejoramiento Vial en Santa Cruz", a implementar las siguientes acciones: • Suspensión de trabajos en el tramo comprendido entre Dirección04 (puente sobre quebrada) y Dirección05 (descarga de la tubería), debido a la posible filtración de aguas provenientes de la planta de tratamiento, detectadas en las excavaciones cercanas a Dirección04. • Continuación de labores únicamente en los tramos entre PK 0+000 a PK 0+200 y PK 1+025 a PK 1+350, los cuales no se ven comprometidos por la situación descrita. • Se coordina una inspección conjunta con personeros del Ministerio de Salud para el lunes 07 de abril a la 1:30 p.m., con el fin de verificar, mediante pruebas técnicas, si el origen del agua corresponde efectivamente al sistema de tratamiento de aguas residuales. Por lo tanto se remite esta información para que en calidad de inspectora municipal verifique lo acordado y su respectivo cumplimiento (…)” (ver prueba).
“(…) • Se realiza una revisión de sitio Planta de Tratamiento del Residencial El Cacao Nuevo • Se escucha en operación la planta de tratamiento antes descrita • Se observa agua rebalsada alrededor de la infraestructura de la Planta de tratamiento, no es tan abundante como el video que envió la denunciante (Ver imagen 1 y fotografía 1 en anexos). • Se realizó un recorrido a lo largo de 250m en sentido quebrada campero-Dirección06 sobre la calle de lastre que la Municipalidad de Santa Cruz intervino para la mejora del camino y colocación de estructura de pavimento (Ver fotografías 2 y 3 en anexos) • Sobre el tramo de camino en el cual están suspendidas las obras desde el día 7 del mes de abril (Oficio DDUR-DGV-ING-13-M-2025), no se observó maquinaria presente, ni obras en ejecución; no obstante se observó un afloramiento de agua y un vertido en dos puntos distintos. (Ver tabla 1) • Se realiza una revisión del sitio de desfogue de la planta de tratamiento en la quebrada Campero y se determina que el vertido es constante, el agua tiene una coloración oscura que se diferencia del agua presente en el cauce y emana un olor fétido muy fuerte. (Ver fotografías 5 y 6 en anexos)”.
En el apartado llamado “Análisis” se consignó expresamente lo siguiente: “(…) en horas de la mañana del día 17 de abril las funcionarias (…) realizan una revisión de las condiciones de la Planta de Tratamiento El Nuevo Cacao y del tramo adyacente de calle en el cual la Municipalidad de Santa Cruz tiene colocado alcantarillado pluvial para la posterior colocación de estructura de pavimento. En el tramo de camino antes descrito no se ha intervenido la tubería de alcantarillado sanitario existente, únicamente se realizaron excavaciones para colocar el alcantarillado pluvial; siendo que al realizar la primera excavación para colocación del alcantarillado pluvial se dio el afloramiento de agua de colocación verdosa y olor a aguas residuales, se detuvo el proyecto por instrucción de la funcionaria Ing. Mary Paz Castillo Rodríguez (…) el 7 de abril del corriente. Asimismo, se realizó una revisión del punto de desfogue de la planta de tratamiento hacia la quebrada campero, se determinó que el vertido es constante, con coloración oscura de las aguas que se diferencia de la coloración presente en el cauce y un fuerte olor fétido.
Este último punto ha sido señalado a las autoridades de salud y discutido en sesiones de la Comisión Interinstitucional de Aguas Residuales, se ha acudido incluso a las instancias judiciales, cuyo expediente consta en el Ministerio de Salud, se ha ejecutado una causa de seguimiento y acumulación de informes que detallan la problemática de contaminación existente en la quebrada campero a raíz de la No Operación o Mal operación de la Planta de tratamiento del Residencial El Nuevo Cacao. Recomendaciones: Que la Alcaldía Municipal solicite a fiscalía ambiental ordenar la intervención inmediata de los propietarios de esta planta de tratamiento a fin de se garantice la correcta y funcional operación de la misma, así como se garantice el perfecto estado de la red de alcantarillado sanitario que encausa las aguas negras de dicha planta de tratamiento bajo calle pública y hacia el sitio de desfogue en Quebrada Campero, en cumplimiento de las normas técnicas sanitarias, de modo que se elimine por completo la contaminación hacia la quebrada campero, se cumpla con el artículo 50 de la Constitución Política (…) y se garantice que la Municipalidad de Santa Cruz podrá continuar con el proyecto de colocación de pavimento asfáltico y sistemas pluviales, según Licitación Pública (…) en sitio El Cacao, distrito Santa Cruz (…)” (ver prueba).
“(…) ACUERDO: Se evidenció que se están vertiendo aguas residuales sin tratar al cauce del río Campero, situación confirmada mediante el “Informe de Diagnóstico de la Planta de Tratamiento de Aguas Residuales del Residencial El Cacao”, promovido por la Municipalidad de Santa Cruz mediante contratación administrativa y entregado oficio MDC-PTAST-107SC-2024. Este informe fue entregado al señor Olman Alexandre Murillo Azofeifa, representante de Grupo Mutual, el viernes 2 de mayo de 2025 a las 14:47 horas, mediante correo electrónico. Además, se hizo referencia a esta situación en el oficio DDUR-DGV-ING-24-M-2025, emitido por el Departamento de la Unidad Técnica de Gestión Vial. Durante la reunión virtual sostenida con representantes de Grupo Mutual, se reiteró la preocupación por el mal estado de la planta de tratamiento, conforme a lo detallado en el diagnóstico. Asimismo, se indicó que la tubería encargada de transportar las aguas desde la planta hasta la quebrada Campero podría presentar daños.
Como resultado, se acordó que Grupo Mutual presentará un plan remedial para atender esta situación a más tardar el día 03 de junio de 2025 (…)”. Asimismo, en dicho documento, se consignó: “(…) Con relación a la operación de la planta se tiene lo siguiente: • Grupo mutual indica que se deja constancia de que la operación de la Planta de Tratamiento de Aguas Residuales (PTAR) es responsabilidad directa del Desarrollador. Asimismo, se señala que la finca en la que se encuentra ubicada dicha infraestructura se encuentra bajo un fideicomiso a nombre de Banco Improsa, entidad con la cual se han gestionado las coordinaciones pertinentes hasta la fecha. • La Municipalidad de Santa Cruz y el Ministerio de Salud han realizado este primer acercamiento formal con Grupo Mutual, con el objetivo de explorar posibles mecanismos de colaboración, ante la falta de respuesta del Desarrollador a las gestiones previamente efectuadas.
Este esfuerzo responde a la necesidad de atender una situación que reviste importancia sanitaria y ambiental. • En este contexto, Grupo Mutual, en el marco de su compromiso con la responsabilidad social empresarial, y considerando también la ausencia de respuesta por parte del Desarrollador a las gestiones que ha emprendido esta misma entidad, informa que actualmente se encuentra dando seguimiento al tema. Además, se encuentra en proceso de elaboración de una propuesta técnica que será presentada para evaluación y eventual aprobación por las instancias competentes. • Cabe señalar que se citó a la reunión al señor Ramón Prado Monterrey, pero estuvo ausente en la sesión (…)” Ramón Prado Monterrey fue citado en representación de la empresa Construcciones Modulares de Costa Rica S.A. (ver prueba).
“(…) Se informa que se han contactado diversas instituciones como el AyA, el Ministerio de Salud y la Fiscalía, así como también se ha gestionado un primer acercamiento con Grupo Mutual, debido a que el desarrollador, responsable de la operación de la Planta de Tratamiento de Aguas Residuales (PTAR), no ha brindado respuesta a las gestiones realizadas. La finca donde se ubica la planta se encuentra en fideicomiso a nombre del Banco Improsa. La Municipalidad de Santa Cruz y el Ministerio de Salud coordinan con Grupo Mutual con el objetivo de encontrar soluciones interinstitucionales a esta situación ambiental. Se reconoce que esta situación constituye una imprevisibilidad técnica, ya que al momento de iniciar el proyecto no se tenía conocimiento de que existían aguas negras transitando por la calle pública ni de posibles daños en los sistemas de conducción. Continuar con la ejecución bajo estas condiciones habría supuesto un alto riesgo de contaminación de la estructura vial y un uso ineficiente de recursos públicos, debido a la eventual necesidad de remover la carpeta asfáltica para realizar reparaciones.
Antes de la suspensión, se logró colocar parcialmente las estructuras de drenaje, como tuberías, pozos y tragantes. No obstante, estas instalaciones podrían verse comprometidas si no se atiende a tiempo la problemática. Se indica que los recursos del proyecto están disponibles únicamente hasta el 31 de junio de 2025, lo que permitirá concluir los trabajos en los tramos no afectados, pero no en los 825 metros pendientes. Grupo Mutual presentará su plan remedial hasta el mes de junio, lo cual imposibilita cumplir con los plazos de ejecución para el resto del proyecto. En virtud de lo anterior, se acuerda lo siguiente: 1. No queda aprobado un control de cambios en el proyecto que permita ejecutar labores de mitigación de polvo en el tramo suspendido (PK 0+200 a PK 1+025), con el fin de preservar los sistemas de drenaje existentes y evitar que el material suelto sea arrastrado hacia las tuberías ya instaladas. 2.
Se acuerda incorporar la inclusión del monto correspondiente en los próximos presupuestos municipales, una vez resuelta la situación sanitaria, con el objetivo de reponer los recursos invertidos en la mitigación de polvo y concluir con la pavimentación del proyecto. Además, establecer que los 825 metros pendientes deberán ser nuevamente presupuestados, una vez habilitados nuevos recursos, lo cual se prevé que ocurra entre los meses de octubre y diciembre de 2025, cuando se aprueben los presupuestos extraordinarios por parte de la Contraloría General de la República. 3. Continuar con el seguimiento interinstitucional a la situación ambiental presentada en el Residencial El Cacao, en coordinación con las instituciones involucradas, hasta lograr una solución definitiva (…)” (ver informe y prueba).
“(…) La señora Villalobos indica que Grupo Mutual remitió a final del mes de junio el borrador del contrato de administración de recursos para su revisión y aprobación y así realizar la firma y poder comenzar con el proceso de contratación respectiva. A la fecha no se ha firmado este contrato como lo indicó don Walter y Grupo Mutual se encuentra a la espera de esta aprobación para su firma y poder iniciar el proceso del plan remedial por etapas: Primera: Poner a trabajar la planta de tratamiento Segunda: Diagnostico. No se tiene claridad del atasco y lo que está sucediendo para poder dimensionar la magnitud de las obras. El señor Villalobos indica que efectivamente es tal y como lo vieron con el BANHVI, que esa aborda primero la parte más urgente que es la planta y luego ya iniciar como la etapa de diagnóstico. El señor Murillo indica que esta es la línea de trabajo. La Ing. Castillo consulta si se realizara algún cronograma para generar la expectativa de la municipalidad del plazo en el que ustedes van a estar durando en realizar estas gestiones.
La señora Sibaja indica que una vez que el BANHVI apruebe el contrato y se firme se puede detallar las fechas. Para la primera etapa, si se tienen estimado tiempos, pero se puede realizar un cronograma con fechas específicas, porque todo depende de la firma del contrato, esta será el inicio del proceso. Importante presentar estas estimaciones de tiempo. Al tener la firma, ya se puede indicar lo que se va a tardar en ejecutar. El señor Warren Chavarría, director del área rectora de salud de Santa Cruz indica que hace 2 meses se tuvo esta reunión y básicamente se dijo lo mismo. Ministerio de Salud y la Municipalidad son los que tienen a la Comunidad encima. Indica que se entiende el tema de los procesos que pueden durar cierto tiempo y que muchas veces no depende de ellos. Sin embargo, hace hincapié en la necesidad de darle una respuesta urgente a este asunto. Indica que, si existe alguna forma de que ellos como Ministerio de Salud puedan ayudar para que este proceso se acelere, ya que esta problemática se tiene desde 4 años y por más reuniones no se ven los avances.
Lo que se busca es ver en qué se puede ayudar o si no se puede ayudar en nada, por lo menos tener la certeza de que esto está en trámite y va a arrancar realmente. La presión la está recibiendo tanto la Municipalidad como para nosotros como Ministerio de Salud y prácticamente todos los días se reciben correos y denuncias sobre el sobre el tema y solicit que Grupo Mutual y BANHVI sean empáticos con esta situación ya que no se encuentra en nuestras manos como tal, ejecutar una solución del tema. La Ing. Castillo indica que a pesar de que están supeditados una firma de alguien también en un cronograma de trabajo se puede estimar las fechas y si no se cumplen se entiende que el BANHVI no ha hecho las respectivas aprobaciones, pero sí que ya está en proceso. Se necesita algo real para poder asistir a las reuniones y no se venga a decir lo mismo nuevamente. Esto afectando a la Municipalidad ya que no se puede informar a la Comunidad y sin poder hacer ningún tipo de gestión.
En la reunión anterior se acordaron realizar actividades que iban a durar un día, que en la misma semana o en cierto plazo y no se realizó. Indica que esto es muy grave, ya que se dice una cosa que realmente no se ha hecho o que no se va a gestionar y la Municipalidad gestionarlo a la Comunidad. E incluso pasar la vergüenza de que viniera el presidente de la República y nosotros decirle que se van a hacer las gestiones acordadas la sesión anterior, la cual quedó grabada, y que a esta fecha no se tenga un cronograma, ni nada establecido o informado. Se les solicita este cronograma por respeto a la Municipalidad, por respeto a la Comunidad y por el tema de salud pública. La Ing. Castillo REITERA que no se está tratando con un tema normal y sencillo, es un tema delicado. Se solicita que se gestione un cronograma con un rango de tanto para la firma y la aprobación y que se establezcan los procesos para que esto no sea solo humo y la Municipalidad sepa cuáles son los procesos que se tienen que seguir y poder informar a la alcaldía municipalidad o al Ministerio de Salud y así saber si se puede colaborar o dar seguimiento.
El Ing. Sánchez indica que está totalmente de acuerdo con la Ing. Castillo y indica que es muy importante para la Municipalidad porque la Comunidad está solicitando información en físico de cómo va el proceso y si no se tiene ni siquiera un informe, no se puede indicar que Grupo Mutual está haciendo la gestión o que el BANHVI está en proceso de firma. Esta información es requerida para poder respaldar los procesos El Ing. Monge indica que la parte esencial que notó que se quería evitar es el cronograma en conjunto. Lo responsable por realizar es un cronograma conjunto y simultáneo de lo que es la planta de tratamiento y el desagüe, porque la conducción es parte inseparable en la solución ya que no se explica técnicamente como se pueda poner en funcionamiento la planta sin tener la conducción de la fuente. Es preocupante esto y se reafirma que la Municipalidad está en un proyecto que no se puede continuar, ya que si se deben realizar reparaciones a la conducción y el proyecto de pavimentación ya se haya realizado sería dañar proyecto que se encuentra en proceso.
La preocupación radica en que esto puede provocar la no ejecución del proyecto que se tiene planeado por lo que se solicita realizar todo el proceso lo más pronto posible, tratar de trabajar las dos problemáticas en conjunto, la planta y la conducción, ya que son parte del mismo sistema. (…) El señor Muñoz indica que el tema de este proyecto o de esta situación que se está dando en este proyecto de vivienda es un tema bastante complejo debido a que aquí sí hay una responsabilidad directa del desarrollador. Esto debido a que no logró hacer los trabajos que deben hacerse en la planta. Esta es la presunción que el BANHVI tiene hasta el momento y por esto las decisiones que se han tenido que tomar o implementar han sido complejas. Esto se ha trabajado en conjunto entre Grupo Mutual y BANHVI para poder dar una solución. Esto conllevó aun análisis profundo a nivel legal y a nivel técnico para poder tener un primer producto: Firmas de Resolución de la Problemática.
Se debe entender que BANHVI se debe apegar a la normativa y a la legalidad y los procesos. El banco no quiere eximirse de la responsabilidad, todo lo contrario, está buscando apegarse a las normativas para mover esta situación porque es una situación totalmente atípica. (…) La señora Salas indica que sin un plan de trabajo la Ing. Castillo tiene razón. Porque lo que no se mide, no se puede determinar si se falla y no se avanza. Indica que esto es un paso importante, sin embargo, un cronograma de obras es un poco prematuro poderlo desarrollar. La idea es presentar un plan de trabajo con fechas para dar seguimiento. Este plan de trabajo es va a estar renovando, revisando a y será adaptativo, esto porque se va a ir ajustando de acuerdo con las necesidades que se vayan encontrando. Indica que es importante lo que indica la Ing. Castillo y que la mejor forma de esto es desarrollar este este plan de trabajo conjunto.
La señora Salas coordinará con la entidad autorizada para que entre esta y BANHVI presente un borrador de plan de trabajo o plan de acción como base. A partir de esto poder realizar una reunión de las partes que se ven más influenciadas en el proceso y no todo el equipo, como una subcomisión para definir y poner fechas y demás. Luego de esto ya se puede trabajar en el seguimiento y presentar en cada una de estas sesiones (…) El Ing. Obando indica que esto es tema en el cual se están violentando derechos humanos, la situación se está saliéndose de todo ámbito, porque de estas personas están expuestas a condiciones totalmente insalubres. Esto también hay que exponerlo. Se entiende que todo tiene su debido proceso y cronograma; por ejemplo, la Municipalidad está atrasada con el proyecto que se debe ejecutar, pero antes que todo eso, la parte humana es lo más importante. Estos planes de trabajo y todo lo que se vaya a desarrollar está bien para medir, solo así se puede medir, sin embargo, siempre tener en cuenta esa prioridad.
Se tiene claro que existen procedimientos y trámites que hay que seguir, pero también analizar que trámites se pueden agilizar más para tratar de acortar los tiempos lo más que se pueda. Esto para evitar que la comunidad siga con este tema totalmente insalubre y expuestos a condiciones deplorables, expuestos a enfermedades. Se indica que la idea al final de cuentas es poder llegar a una solución y que se dé lo más pronto posible. (…) El señor Muñoz indica también que se deben definir los tipos de financiamiento, ya que los financiamientos para poderle hacer frente a una planta son distintos a los financiamientos de viviendas. Por lo que se debe entender que este tipo de situaciones van a acomodarse poco a poco conforme avance el proceso. En conclusión, a la reunión se tiene como entregables: * La resolución firmada por parte de la gerencia general, Permitirá a la entidad empezar con la primera etapa y el diagnostico.
A más tardar el 06/08/2025. * Mesa de trabajo para generar una hoja de ruta o plan de trabajo con un rango de fechas. * Visita el banco momento que se requiera para reunirse con la comunidad familias y explicarles lo pertinente * Informes de inspecciones, reuniones u otros por parte de Grupo Mutual y BANHVI, para generar un expediente. El Ing. Sanchez indica como cierre que se establecieron los puntos importantes y lo necesario es dar los entregables solicitados. Así como, exponerle a la Comunidad que el banco está haciendo las gestiones y tiene también en perspectiva de que la comunidad es importante y se está trabajando en la solución. Todo este trabajo es para indicarle a la comunidad que se va a resolver el problema como equipo. También se indica que la idea no es prolongar el proceso y tener una reunión semanal por 5 o 6 años, sino resolver lo más pronto posible y en los lapsos de tiempo que lo requieran (…)” (ver prueba).
Hechos relacionados con el Ministerio de Salud (Área Rectora de Salud de Santa Cruz):
La recurrente, en su condición de representante legal de la Asociación de Desarrollo Integral de El Cacao, ubicado en Santa Cruz, Guanacaste, acude en amparo. Explica que en dicho sitio se construyó un residencial y una planta de tratamiento, para dar servicio a alrededor de 168 casas. Refiere que en abril de este año 2025 se denunció ante la Municipalidad de Santa Cruz un grave problema, en el tanto, con motivo de trabajos de pavimentación realizados, empezaron a brotar aguas negras de la tubería correspondiente a la planta de tratamiento.
Apunta que esa planta dejó de operar unos días, lo cual ocasionó un bloqueo que, a su vez, produjo el rebalse de las aguas negras y el depósito de fluidos fecales a cielo abierto, lo cual genera un olor fétido y amenaza la salud de los habitantes de la comunidad.
Menciona que, aunque la municipalidad inició gestiones, el proceso ha sido muy lento y los efectos nocivos de dicha situación persisten a la fecha de presentado el amparo (pues todo se mantiene como el primer día). Agrega que la Dirección08 está cada día más contaminada, ya que es ahí donde se depositan todos los residuos.
Por todo lo anterior, solicita la intervención de este Tribunal para que se solvente el problema de aguas negras y se reestablezca el funcionamiento adecuado de la planta de tratamiento. También, solicita que se gestione lo necesario para que los desechos sean trasladados a otra planta de tratamiento ubicado en Las Maravillas de Santa Cruz.
Ahora bien, para dar inicio al estudio por el fondo de este asunto, conviene señalar que, revisados los argumentos expuestos por la parte accionante, todos los informes rendidos por las autoridades recurridas (Instituto Costarricense de Acueductos y Alcantarillados, Municipalidad de Santa Cruz y Área Rectora de Salud de Santa Cruz), así como todas las pruebas allegadas a los autos, este Tribunal Constitucional ha podido tener indefectiblemente por acreditado los siguientes aspectos de relevancia:
Primero, que en Santa Cruz de Guanacaste se construyó un conjunto residencial de interés social llamado El Cacao, el cual está compuesto por 170 casas y cuenta con una población aproximada de 600 personas. Además, que, como propietario de ese residencial, aparece un sujeto de derecho privado llamado Construcciones Modulares de Costa Rica S.A..
Segundo, que, en virtud de ese desarrollo urbanístico, fue necesario construir una planta de tratamiento de aguas residuales (PTAR) para el manejo de aguas residuales. Además, se tiene que el desarrollador y el responsable de la construcción y operación de dicha planta es el Banco IMPROSA S.A., en calidad de fiduciario. Consta también que la construcción de la citada planta estuvo a cargo de Construcciones Modulares de Costa Rica S.A. y que dicha infraestructura se ubica en una propiedad privada que pertenece a la citada entidad bancaria.
Tercero, que los permisos para construir dicha planta se otorgaron en el año 2011 por parte del Ministerio de Salud y que los planos constructivos de dicha infraestructura los aprobó el ICAA en julio de 2013.
Cuarto, que dicha planta no es operada por el ICAA ni por una ASADA (tampoco está dentro del área de cobertura de una ASADA). Toda la infraestructura de la planta es de propiedad privada.
Quinto, que la referida planta no ha sido entregada al ICAA siguiendo el procedimiento establecido en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento (pues no se han cumplido los requisitos señalados al efecto en el ordenamiento jurídico). El desarrollador no ha presentado ninguna solicitud para que el ICAA asuma la administración del sistema sanitario.
Sexto, que, desde al menos el año 2021, la referida planta de tratamiento ha presentado una serie de problemas en su funcionamiento, lo cual ha generado, entre otros aspectos, el desfogue irregular de aguas negras y la generación de olores fétidos. Incluso, se constató el discurrir irregular de dichas aguas crudas hacia la Quebrada Campero. Además, consta que en mayo de 2024 una empresa privada realizó un diagnóstico de la planta y halló una serie de deficiencias técnicas en la misma.
Sétimo, que, en marzo de 2025, con motivo de unos trabajos de pavimentación realizados por una empresa contratada por la Municipalidad de Santa Cruz cerca del citado residencial, se dio una ruptura de la tubería de agua potable y de la tubería de aguas residuales, lo cual agravó el referido estado de cosas. Producto de esta situación se han realizado inspecciones por las autoridades del ICAA y del municipio recurrido. Cuando se dieron los hechos, las autoridades municipales recurridas realizaron inspección y determinaron la existencia de aguas negras que generaban mal olor y estaban contaminado el suelo, en particular, en el área excavada (por la citada empresa) para instalar una caja de registro de aguas pluviales. Además, el 17 de abril de 2025 se inspeccionó el sitio de desfogue de la planta en la Quebrada Campero y se determinó que “el vertido es constante, el agua tiene una coloración oscura que se diferencia del agua presente en el cauce y emana un olor fétido muy fuerte”.
El pasado 18 agosto de 2025, el ICAA constató que la planta de tratamiento no se encontraba operando y estaba totalmente abandonada, que el alcantarillado sanitario presentaba obstrucciones en la línea que conduce el vertido al cuerpo receptor Rio Campero (pues la empresa constructora tapó con concreto la tubería dañada), que esto último produjo que se presentara una inundación de aguas crudas en el sitio de aproximadamente 60 cm sobre el nivel del terreno natural y que se percibían malos y fuertes olores.
Octavo, que de la situación supra descrita tienen pleno conocimiento, desde hace varios meses o años, las tres autoridades recurridas en este amparo, sea, la Municipalidad de Santa Cruz, el Área Rectora de Salud de Santa Cruz y el Instituto Costarricense de Acueductos y Alcantarillados. Incluso, consta que ante el municipio y el área rectora de salud se han formulado varias denuncias. La recurrente, por ejemplo, denunció el caso en abril de 2025 ante la corporación municipal recurrida.
Noveno, que el estado de cosas anterior (inadecuado funcionamiento de la planta de tratamiento, desfogue irregular de aguas negras, estancamiento de las mismas y vertido en crudo a quebrada, así como la generación de malos olores), indefectible e indiscutiblemente produce un grave problema de contaminación ambiental y de afectación a la salud, principalmente, de todas las cientos de personas que habitan cerca del sitio en cuestión. Todas estas personas que habitan, trabajan o estudian cerca de la citada planta de tratamiento o bien, que transitan por el sitio donde se ubica dicha infraestructura, están expuestas a condiciones absoluta y totalmente insalubres y deplorables. Además, no puede perderse de vista que la Quebrada Campero, también está siendo gravemente contaminada, pues se ve expuesta a recibir aguas negras (sin tratar o crudas).
IV.Dicho lo anterior, resulta menester examinar la actuación de las autoridades recurridas frente al referido problema de contaminación.
A. En cuanto a la Municipalidad de Santa Cruz, se tiene que dichas autoridades conocen del problema bajo estudio desde el año 2021 (en virtud de una primera denuncia formulada por malos olores expedidos de la planta de tratamiento) y que, a pesar de los varios años trascurridos hasta la fecha, no han llevado a cabo acciones claras y contundentes tendentes a solventarlo de forma definitiva. Nótese que, según el apartado de hechos probados de este amparo, con motivo de esa denuncia, solamente consta la emisión de un informe en octubre de 2021 (donde se consigna la comprobación de los hechos) y el giro de una serie de recomendaciones, las cuales se desconoce si fueron o no atendidas. Esta misma situación (denuncia e intervención del municipio), se repitió en marzo de 2022 y junio de 2023; sin embargo, en ambos casos nuevamente, solamente se acreditó la realización de una inspección (que acreditó los malos olores y descarga de aguas negras a quebrada) y el giro de recomendaciones, cuyo cumplimiento tampoco no se acreditó en este amparo.
Ahora, con motivo de lo ocurrido en marzo de este año (desfogue de aguas negras producto de los trabajos realizados por empresa que pavimentaba las calles), consta que las autoridades del Departamento de Gestión Vial del municipio ciertamente, en abril de 2025, emitieron una gran cantidad de oficios a otras instancias públicas dentro de esa misma corporación y fuera de esta, tendentes a entablar reuniones, emitirse criterios, realizar pruebas, efectuar inspecciones, etc. Sin embargo, en el informe y pruebas aportadas a esta Sala, no se hizo referencia al resultado de estas últimas gestiones. Adicionalmente, se demostró la realización de una inspección en el sitio el 17 de abril de 2025, donde se constata el problema ambiental bajo estudio y se emite la recomendación únicamente de solicitar la intervención de la fiscalía ambiental, mas no de llevar a cabo alguna otra actuación urgente (de parte propiamente del municipio) en aras de garantizar y proteger la salud de los habitantes de la comunidad y evitar la grave situación de contaminación que persistía en ese momento (y que continúa a la fecha).
Posteriormente, se determinó que, en mayo, julio y agosto de 2025, el municipio se ha limitado únicamente a realizar reuniones y sesiones de trabajo con funcionarios de la misma corporación, de otras instancias públicas y de representantes tanto del Grupo Mutual y del BANHVI, en aras de buscar una solución al problema en cuestión. Sin embargo, lo cierto es que dichas mesas de trabajo no han dado como resultado ninguna contundente actuación que haya paliado los efectos negativos de la operación de la planta de tratamiento ya apuntados.
Así las cosas, para esta Sala Constitucional no cabe duda que las autoridades del municipio recurrido han incurrido en graves omisiones que han coadyuvado a que el problema sanitario y ambiental bajo estudio (detectado aproximadamente desde el año 2021) se mantenga a la fecha.
B. En lo que respecta al Área Rectora de Salud de Santa Cruz del Ministerio de Salud, se tiene que estas autoridades, desde el año 2022, conocen del problema bajo estudio y que, desde entonces también, realizaron inspecciones en el sitio y, al constatar los hechos denunciados, dictaron varias órdenes sanitarias, principalmente, al propietario de la planta de tratamiento (representante de Construcciones Modulares de Costa Rica S.A.) y al Banco IMPROSA S.A. (en calidad de fiduciario de la obra) ambos sujetos de derecho privado. Asimismo, se demostró que, ante el incumplimiento de tales medidas, el caso se decidió finalmente enviar en ese mismo año 2022 a la Fiscalía Ambiental. Igualmente, se informó que el caso fue remitido al Tribunal Ambiental Administrativo. Luego de esto, únicamente consta que en abril de 2023 el área rectora de salud recurrida recomendó realizar una “solicitud de apoyo”, para cumplir un requerimiento formulado por la Fiscalía Adjunta Agrario Ambiental; sin embargo, no se informó ni demostró si esta última actuación se llevó a cabo.
Consta también que más de un año después de haberse realizado esta última actuación citada, concretamente, en mayo de 2023, dicha área rectora de salud se limitó a girar un oficio a la Asociación de Desarrollo Integral de El Cacao, en el cual indicó que la vía administrativa se había agotado y que, al no haberse encontrado una solución por parte de los encargados, el caso se había remitido a la vía judicial (Fiscalía Ambiental).
Igualmente, se demostró que un año después, en marzo de 2024, dicha área rectora de salud giró una orden sanitaria a la Municipalidad de Santa Cruz (a efecto que tomara “(…) las medidas o acciones necesarias así como un diagnóstico, caracterización y evaluación del sistema de tratamiento de aguas residuales del Residencial Nuevo El Cacao, con el fin de verificar su funcionamiento (…)”. Sin embargo, no se informó ni acreditó que a esta última orden se le haya brindado el seguimiento correspondiente.
También, consta que en marzo del año anterior se emitió una orden sanitaria al ICAA, mediante la cual se les solicitó asumir el funcionamiento del sistema de tratamiento de aguas residuales del Residencial El Cacao, hasta que se resolviera el proceso penal. No obstante, el ICAA, mediante oficio No. GSP-RCHO-2024-01377 de mayo de 2024, consignó los motivos por los cuales no resultaba posible asumir o cumplir lo ordenado. Ante esta última situación, el área rectora solicitó un criterio sobre cómo proceder respeto a la respuesta brindada por el ICAA, pero no se informó a esta Sala qué ocurrió luego de emitido este último y qué se resolvió finalmente al respecto.
En adición a lo anterior, se demostró que igualmente se giró en el año 2024 una nueva orden al Banco IMPROSA S.A., la cual nuevamente no fue cumplida, según consta en informe de agosto de ese mismo año.
Igualmente, según se informó, dichas autoridades han solicitado a la Fiscalía Ambiental citada el giro de medidas cautelares ante el problema descrito. Sin embargo, en el informe, no se explicó qué ha dispuesto o resuelto al respecto dicho órgano judicial.
De esta manera, se tiene, entonces, que, desde hace un año prácticamente (agosto de 2024), el Ministerio de Salud no ha dictado ninguna medida o ejecutado alguna actuación concreta y contundente tendente a hacer frente al grave problema de contaminación acreditado en este proceso de amparo. Todo esto, pese a que estas autoridades, como se dijo, tienen pleno conocimiento que dicha situación persiste a la fecha y que, incluso, se ha agravado con los hechos acaecidos en marzo de este año, producto de los trabajos realizados por una empresa contratada por el municipio recurrido.
En este punto, es importante recordarles a las autoridades del Ministerio de Salud, que el hecho de haber elevado el caso ante el Ministerio Público o ante alguna otra instancia, no lo releva o exime de continuar atendiéndolo y darle el seguimiento que corresponda, a través del dictado y ejecución de todos aquellos actos que resulten pertinentes, conforme, a su vez, lo estipulado en la Ley General de Salud y su reglamento. En ese particular, esta jurisdicción, en el Voto No. 2016-6368 de las 09:30 hrs. de 13 de mayo de 2016, señaló lo siguiente:
“(…) V. DEL AMPARO CONTRA EL MINISTERIO DE SALUD. SOBRE EL FONDO: De los hechos anteriores se desprende que el Ministerio de Salud, si bien actuó oportunamente, emitió las órdenes sanitarias e incluso presentó denuncias penales, lo cierto es que el problema sanitario subsiste, como lo indica su representante en el informe rendido bajo juramento. No observa la Sala que el Ministerio haya adoptado medidas extraordinarias, como la clausura del lugar, la colaboración de la Fuerza Pública para la seguridad del lugar, e incluso, el eventual desalojo del residencial o cualesquiera otras medidas efectivas. La prestación de un servicio público como el que está en manos del Ministerio de Salud exige una eficiencia y diligencias acaso más allá de la necesaria en por parte de otros órganos públicos, por causa de los derechos fundamentales a la salud y al ambiente sano, en lo que atañe a sus competencias.
La Sala considera que lo actuado por el Ministerio de Salud ha sido insuficiente y viola el derecho fundamental a la salud y a un ambiente sano de la amparada, por lo que procede estimar el recurso en su contra y ordenar que se disponga las medidas necesarias, incluso radicales, y adopte las decisiones pertinentes a fin de eliminar el problema sanitario existente en la colindancia entre el Dirección09, el Río Liberia y el Residencial El Río, dentro de un término de dos meses, a partir de la notificación de la sentencia. (…)” (El destacado no forma parte del original).
Asimismo, en la Sentencia No. 2022-10613 de las 09:40 hrs. de 13 de mayo de 2022, esta Sala señaló:
“(…) IV.- SOBRE EL CASO EN CONCRETO.- Después de analizar los elementos probatorios aportados, este Tribunal verifica que ha existido la violación a los derechos fundamentales por parte de las autoridades recurridas. Lo anterior, porque en el informe rendido por parte del representante de dicha autoridad -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el 16 de agosto del 2021, el recurrido recibió la denuncia interpuesta por el recurrente, en contra de sus vecinos por la descarga de aguas servidas hacia su propiedad por parte de los vecinos denunciados. El 27 de agosto del 2021, la Gestora Ambiental del Área Rectora de Salud Alajuela 1, realizó visita de inspección al sitio, en que la autoridad sanitaria determinó la descarga de aguas pluviales y residuales (negras y servidas) hacia la propiedad del amparado, ocasionando malos olores, riesgo de proliferación de insectos y roedores que pueden afectar la salud las personas que habitan la vivienda.
El 03 de setiembre del 2021, el recurrido giró y notificó orden sanitaria N° 0188 en que se le ordenó a Nombre06, proceder a corregir la problemática encontrada, y en el plazo de dos meses disponer sanitaria y adecuadamente las aguas pluviales, residuales y negras que no están encausadas adecuadamente en la vivienda de su propiedad. El 10 de noviembre del 2021, el recurrido realizó una visita de verificación del cumplimiento de la orden sanitaria referida, comprobando que las aguas pluviales y residuales seguían descargando hacia la propiedad del tutelado, por lo que se constató el incumpliendo lo ordenado. Por oficio MS-DRRSCN-DARSA1-3001-2021, el recurrido remitió denuncia a la Fiscalía Adjunta de Alajuela, contra de Nombre06 por el delito de desobediencia a la autoridad, sin que a la fecha se haya emitido resolución al respecto. El 09 de diciembre del 2021, el recurrente presentó denuncia contra el señor Nombre07 e indica que el denunciado conduce sus aguas pluviales y residuales (servidas) hacia su propiedad, por lo que pidió solicitar al vecino que encause esas aguas de forma adecuada.
El 06 de enero del 2022, el recurrido efectuó la visita de inspección y a pesar de que no había nadie en la propiedad del denunciado, se comprobó que las aguas pluviales y servidas son dirigidas a la propiedad del amparado, por lo que se confeccionó la orden sanitaria 0030 ordenando al señor Nombre07, disponer sanitaria y adecuadamente las aguas pluviales que no están encausadas en su vivienda, empero, no se ha podido notificar, ya que no se encuentra a las personas en el lugar.
Así las cosas, esta Sala estima que si bien el recurrido argumenta que ha efectuado acciones tendientes a la resolución de la situación que aqueja al tutelado, lo cierto es que a pesar de ello, no ha logrado resolverlo de manera definitiva, pues la simple interposición de una denuncia penal por incumplimiento de una orden sanitaria y la excusa de que no han podido notificar la otra orden sanitaria, no resulta suficiente para esta Sala, tomando en cuenta que hay un problema serio comprobado de aguas llovidas y residuales incorrectamente manejadas, que discurren todas hacia la propiedad del recurrente, por falta de obras de drenaje por parte de los vecinos, lo que le ocasionan problemas serios de inundación y contaminación desde hace mucho tiempo y no se soluciona. Nótese que el Ministerio de Salud tiene amplias potestades para actuar de conformidad con la Ley General de Salud y el Reglamento correspondiente, como ente rector encargado de la vigilancia y control de la salud, tales como: las medidas sanitarias especiales de desalojo de vivienda (artículo 1 inciso c del Reglamento), declaratoria de inhabitabilidad, demolición, así como las multas, ya que es claro que de conformidad con la Ley General de Salud artículos 39 y 286 es deber de todo propietario y encargado de muebles e inmuebles evitar molestias y daños a la salud así como focos de contaminación o infección debiendo efectuar obras de drenaje e incluso en caso de renuencia hacerlas la administración a costa del omiso, todo resguardando el debido proceso. De modo que lo procedente es declarar con lugar el recurso, con las consecuencias, que se indicaran en la parte dispositiva (…)” (El destacado no forma parte del original).
Más recientemente, en el Voto No. 2025-583 de las 09:20 hrs. de 10 de enero de 2025, este órgano constitucional señaló:
“(…) Sobre el Ministerio de Salud. Si bien, de los informes rendidos y de la prueba que consta en autos, se acredita que las autoridades accionadas del Ministerio de Salud -Área Rectora de Salud de Puntarenas – Chacarita-, han realizado gestiones a fin de cumplir con las ordenes que en su momento dio este Tribunal, tal como se aprecian en los hechos probados de esta sentencia, y que, ante el incumplimiento de la orden sanitaria 0112-REG-2024 por parte de la Municipalidad de Puntarenas, el 4 de diciembre del 2024, se interpuso denuncia penal contra la Municipalidad de Puntarenas, por el presunto Delito de Desobediencia a la Autoridad ante la Fiscalía Adjunta del Ministerio Público en Puntarenas; sin embargo, lo cierto del caso es que, para esta Sala su deber ha sido insuficiente, pues dicho ministerio demanda la observancia, así como, el garantizar la protección de la salud de la población y del medioambiente (…)” (El destacado no forma parte del original).
Bajo dicho panorama, resulta claro que las autoridades recurridas del Ministerio de Salud también han sido omisas en atender la grave situación ambiental que afronta la comunidad de El Cacao de Santa Cruz de Guanacaste.
C. Finalmente, en cuanto al Instituto Costarricense de Acueductos y Alcantarillados, se ha informado y se ha acreditado a partir de las pruebas allegadas, que la planta de tratamiento pertenece a un sujeto de derecho privado y que no ha sido entregada al ICAA siguiendo el procedimiento establecido en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento (pues no se han cumplido los requisitos señalados al efecto). Se aseveró que el desarrollador no ha presentado ninguna solicitud para que el ICAA asuma la administración del sistema sanitario y que, al ser la planta de propiedad privada, “su operación, mantenimiento y cumplimiento de las órdenes sanitarias son responsabilidad exclusiva del desarrollador”. También se demostró que en marzo de 2024 el Ministerio de Salud giró al ICAA una orden sanitaria para asumir el funcionamiento de la referida planta, la cual, sin embargo, no fue atendida, en virtud de los razonamientos expuestos informe técnico No. GSP-RCHO-2024-01377 de 9 de mayo de 2024. Tanto en dicho informe como en el informe rendido a esta Sala, el ICAA explicó claramente lo siguiente:
“(…) La Infraestructura sanitaria en el proyecto del Cacao que presenta problemas operativos no ha sido entregada formalmente siguiendo el procedimiento indicado para este fin. - No se registra una solicitud formal por parte de los interesados (Desarrollador) para que AYA inicie el proceso para asumir este sistema Sanitario, en apego del Reglamento de Aprobación y Recepción de Sistemas de Saneamiento de AyA. – La orden sanitaria que se dirige a AyA para que asuma el sistema en las condiciones actuales, representa un mecanismo que eximiría al desarrollador para realizar la inversión requerida. Esto implicaría que se cargue al Estado que mediante fondos públicos se realicen las obras que el desarrollador debería haber garantizado que se construyeran en la génesis del proyecto. (…)Es necesario aclarar que tanto la PTAR, como el sistema de recolección y disposición del efluente deben encontrarse en buen estado operativo para que el eventual proceso de puesta en marcha y recepción se concrete.
- Forzar mediante órdenes sanitarias la inversión de recursos públicos para subsanar falencias en infraestructura que debe ser diseñada, construida y operada en apego a la normativa, representaría una vía fácil y cuestionable, para que ciertos desarrolladores no cumplan con sus obligaciones fundamentales y normadas (…)” (El destacado no forma parte del original).
Posterior a esta última actuación, únicamente consta una inspección realizada por el ICAA al sitio bajo estudio el pasado 18 de agosto de 2025 (con motivo de la interposición de este amparo), mediante la cual se constaron los hechos aducidos, se reiteró que la operación y mantenimiento de la planta no es competencia de dicho instituto por los motivos arriba señalados y se giraron una serie de recomendaciones directamente al municipio recurrido.
Ahora, cabe señalar que si bien esta Sala Constitucional es consciente y comprende los motivos objetivos explicados por las autoridades del ICAA para no asumir con fondos públicos el problema responsabilidad de un sujeto de derecho privado, lo cierto es que, de otra parte, este estado de cosas no lo debe ni puede eximir de colaborar con el resto de autoridades recurridas en aras de hallar una solución al problema ambiental y de salubridad acreditado. Ante la gravedad de los hechos demostrados y, principalmente, ante la afectación que está produciendo el mal funcionamiento de la planta de tratamiento, este Tribunal Constitucional considera que el ICAA sí debe intervenir (en virtud del claro y amplio conocimiento que posee en la materia) y ejecutar las instancias de coordinación que sean pertinentes tanto con la Municipalidad de Santa Cruz y con el Área Rectora de Salud de Santa Cruz para lograr, en consuno, hallar una respuesta y hacer frente a la situación bajo estudio.
Si bien, como se dijo, el ICAA no se encuentra compelido a asumir el funcionamiento de la planta ni invertir fondos públicos en esta, sí puede colaborar y coordinar con el resto de instancias públicas citadas en los términos señalados. Sin embargo, esta última labor se echa de menos en el presente asunto, pues el ICAA se limitó a emitir el informe No. GSP-RCHO-2024-01377 y no brindar ningún otro tipo de colaboración o solución alterna; todo esto, en perjuicio de la población afectada.
* Es evidente que la situación descrita supra, genera una clara vulneración a los derechos fundamentales no solo de la recurrente, sino también de los demás vecinos del referido asentamiento humano, pues desde el 2021 se tiene conocimiento de tal situación y no se ha solucionado de manera definitiva, con el agravante que ello conlleva no sólo un daño al medio ambiente, sino para la propia salud pública.
Como se explicó, a pesar de las labores que han realizado principalmente el ayuntamiento recurrido y el Área Rectora de Salud de Santa Cruz, no se ha concretado una colaboración interinstitucional eficiente y eficaz, a fin de lograr determinar cómo solventar el problema en cuestión. Tampoco, se demostró que las autoridades del ICAA hayan intervenido y coadyuvado en hallar una solución a dicho estado de cosas.
Para este Tribunal existe una escasa actuación conjunta entre los recurridos, pues no han logrado solucionar en definitiva el problema de contaminación ambiental, en detrimento de la salud pública. En virtud de lo anterior, se considera de mérito declarar con lugar el recurso, por violación a los artículos 21 y 50 de la Constitución Política, en los términos que se dirán en la parte dispositiva de esta sentencia.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que pese a que se presentó una denuncia por contaminación ambiental esta no ha sido resuelta en forma definitiva, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
V.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se le ordena a Jorge Arturo Alfaro Orias, en su condición de Alcalde y a Didier Monge Jiménez, en su condición de Coordinador del Departamento de Gestión Vial, ambos de la Municipalidad de Santa Cruz de Guanacaste, a Warren Chavarría Venegas, en su condición de Director del Área Rectora de Salud del Ministerio de Salud en Santa Cruz de Guanacaste y a Rafael Alberto Barboza Topping, en su condición de Subgerente de Gestión Sistemas Delegados del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en su lugar ocupen dichos cargos, que de forma INMEDIATA, a partir de la notificación de la presente sentencia, de manera conjunta y coordinada, dispongan lo necesario para asegurar temporalmente que no hayan afectaciones a la salud de las personas que habitan en el Residencial de Interés Social El Cacao, mientras se da una solución definitiva del problema objeto del presente proceso.
Asimismo, se les ordena a dichas autoridades que coordinen entre sí lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de DOS MESES, contado a partir de la notificación de la presente sentencia, se brinde una solución definitiva a la problemática ambiental y de salubridad acreditada. Todo lo anterior, según los términos señalados en esta sentencia. Se advierte a las autoridades recurridas que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Santa Cruz de Guanacaste, al Estado y al Instituto Costarricense de Acueductos y Alcantarillados, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
