Res. 2025025307 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at thirteen hours and fifty minutes on ocho de agosto de dos mil veinticinco.
Amparo proceeding (recurso de amparo) processed under expediente nro. 25-011146-0007-CO, filed by Nombre01, identity card CED02, against the MUNICIPALIDAD DE NICOYA and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
WHEREAS:
The respondent party is hereby advised that disobedience of orders issued by the Constitutional Jurisdiction, as provided in Article 71 of the aforementioned Law, is punishable by imprisonment for three months to two years or by a fine of twenty to sixty days, and that future rulings will be served upon them only if they provide a fax number, if available, or, failing that, a home or office address within the judicial district of this Chamber, pursuant to Articles 19 and 34 of the Law on Judicial Notifications; alternatively, for such purposes, the respondent party may provide an email address or any other technological means that permits communication, provided that it has previously requested accreditation of such means for service of notice (Articles 18, 34, and 39 of the aforementioned Law on Judicial Notifications). The JUDICIAL COMMUNICATIONS OFFICE OF THE SECOND JUDICIAL CIRCUIT OF GUANACASTE (NICOYA) is hereby commissioned to serve notice upon the MAYOR AND THE PRESIDENT OF THE MUNICIPAL COUNCIL, BOTH OF NICOYA, and the commission shall be transmitted to that office via the fax system.
That authority shall effect the corresponding service of notice within FIVE DAYS from receipt of the documents, under warning that failure to do so may result in liability for disobedience of authority. The commissioned authority is advised that it shall send a copy of the duly executed writ to the fax numbers indicated at the foot of this ruling or to the email address: ...01, both belonging to this Chamber, and shall send the original documents by certified mail or by any other means ensuring their prompt receipt by this Office. Let notice be served. Issue the corresponding commission. Justice Anamari Garro Vargas, to whom this matter falls by rotation, is appointed Reporting Justice for the processing of this proceeding.”
Justice Rueda Leal drafts the opinion; and,
WHEREAS:
The petitioner states that, for the past 55 years, the Municipalidad de Nicoya has unrestrictedly authorized construction, approval of maps, and land uses, to the detriment of public-domain property (bienes demaniales). He states that, on 19 de marzo de 2021, the Concejo Municipal unanimously resolved that the mayor should pursue administrative or judicial action to reclaim the public-domain property within the “Proyecto Americano.” He maintains that the properties are delimited and include public roads, parks, green areas, streets, and land reserved for community services. He mentions that a special commission was appointed in 2020 and determined that such areas exist. He states that the Comisión de Obras Municipales issued Opinion D-COM-0103-2021 regarding the untransferred public-domain areas of the “Proyecto Americano” in the district of Nosara and recommended to the Concejo: “Request that the Administración Municipal take the necessary administrative or judicial measures to comply with the resolution adopted by the Concejo Municipal through Resolution No. 012-039-2021 of 26 de enero, for the purpose of reclaiming in the name of this Municipalidad the 80 hectares currently registered in the names of private parties, land that must be public as stated in Article 40 of the Ley de Planificación Urbana.” He asserts that, in 2021, the Concejo forwarded the special commission’s opinion to the Municipalidad’s Departamento de Gestión Jurídica; however, there was no response.
He adds that, on 9 de abril de 2021, that collegial body again requested that the mayor take administrative or judicial measures to reclaim the public-domain property; however, no action has been taken.
The following facts are deemed duly established and relevant to the resolution of this matter:
Accordingly, that article states the following: (…) FOURTH: One of the legal means of deeming land for parks, green spaces, community halls, and playgrounds to have been conveyed is through plan approval (visado de planos) indicating the designated use of each lot in accordance with the aforementioned terms of Article 40 LPU. Because this legal requirement has not been met, it is impossible to identify the areas individually and classify them as such. FIFTH: To date, it has not been possible to locate a building permit, an INVU-approved site plan showing the common areas to be conveyed, or plans approved by the Municipalidad and INVU with a designated use compatible with the provisions of the aforementioned Article 40. SIXTH: Regarding the list of properties registered in the name of the ASOSIACIÓN CÍVICA DE NOSARA (ACN), it is important to note that all are encumbered by an ecological easement (servidumbre ecológica), and the designated use of the vast majority is not described as being for parks or other common areas; therefore, they cannot be used to satisfy the percentages established under the aforementioned legislation. SEVENTH (sic): The designated use ‘for green spaces’ does appear in the following real-property folios, which could be interpreted as a possible conveyance to satisfy the statutory percentage:

The aforementioned Registry shall make a final entry for those properties, remnants, or lots that the owner, in the capacity of subdivider (fraccionador), conveys to the municipality pursuant to this law, provided that the registrable document states the public purpose assigned to the property and the Notary certifies the municipal resolution approving the conveyance and ordering that the property be devoted to that same purpose.’ (Article 44, Ley de Planificación Urbana). In this regard, the Procuraduría General de la República has stated that when duly approved cadastral plans describing land whose designated use is compatible with the common elements specified in Article 40 LPU form part of the Official Map, the appropriate course of action is for the municipalities to request that the Registro Inmobiliario (RIM) register the land in the name of the respective municipal government. RECOMMENDATIONS FIRST: Before requesting that the Registro Inmobiliario register the parcels described in point 7 of this report, the Departamentos de Planificación Urbana, Control Constructivo y Ambiental should be instructed to conduct an on-site inspection (inspección in situ) to determine the condition of such land, so that its suitability for any of the purposes established in the aforementioned Article 40 may be technically determined, together with the Municipality’s actual ability to maintain it, ensure its intended use, and conduct a cost-benefit analysis of registering those properties in its name.
SECOND: Upon receipt of the aforementioned report, determine whether it is appropriate to pursue registration before the RIM or, instead, to reach an agreement with the ACN on a joint plan for the administration and use of those areas.” (Evidence submitted by the Municipalidad de Nicoya).
The following fact relevant to this decision is not deemed proven:
Sole Fact. That, after 28 de febrero de 2023, the Municipalidad de Nicoya took any action aimed at resolving the recovery of public-domain property (bienes de dominio público).
In the case at bar (sub lite), the petitioner states that, for 55 years, the Municipalidad de Nicoya has unrestrictedly authorized construction, plan approvals, and land uses (usos de suelos), to the detriment of public-domain property (bienes demaniales). He states that, on 19 de marzo de 2021, the Concejo Municipal unanimously resolved that the mayor should pursue administrative or judicial action to reclaim the public-domain property within the “Proyecto Americano.” He maintains that the properties are demarcated and include public roads, parks, green spaces, streets, and reserves for community services. He mentions that a special commission was appointed in 2020 and determined that such areas exist. He states that the Comisión de Obras Municipales issued opinion D-COM-0103-2021 regarding the unconveyed public-domain areas of the “Proyecto Americano” in the district of Nosara and recommended to the council: “Request that the Administración Municipal take the necessary administrative or judicial measures to comply with the resolution adopted by the Concejo Municipal through resolution N.- 012-039-2021 of 26 de enero, for the purpose of reclaiming in the name of this Municipalidad the 80 hectares currently registered in the names of private parties, land that must be public as provided in Article 40 of the Ley de Planificación Urbana.” He asserts that, in 2021, the council forwarded the special commission’s opinion to the municipality’s Departamento de Gestión Jurídica; however, no response was received.
He adds that, on 9 de abril de 2021, that collegiate body again requested that the mayor take administrative or judicial measures to reclaim the public-domain property; nevertheless, no action has been taken.
The record establishes that the Alcaldía Municipal de Nicoya received official letter CCOP-050-2021 of 10 de marzo 2021, which stated that 23 plans had been located “whose designated use was green areas or parks, as a result of a study that began in 2014.” The Concejo Municipal de Nicoya, by resolution no. 18-046-2021 adopted at ordinary session no. 46 held on martes 16 de marzo de 2021, ordered: “Municipal Resolution No. 018-046-2021: THE CONCEJO MUNICIPAL DE NICOYA UNANIMOUSLY APPROVES FORWARDING THIS MATTER TO THE DEPARTAMENTO DE GESTIÓN JURÍDICA DE LA MUNICIPALIDAD SO THAT IT MAY RESPOND AS APPROPRIATE, WITHIN NO MORE THAN 10 BUSINESS DÍAZ (sic), TO THE MATTERS SET FORTH IN OFFICIAL LETTER CCOP-050-2021, SIGNED BY ING. JOSUÉ RUIZ GUERRERO, COORDINATOR OF THE DEPARTAMENTO DE CONTROL CONSTRUCTIVO Y OBRA PÚBLICA, AND ING. BYRON ROSALES MORALES, COORDINATOR OF THE DEPARTAMENTO DE CATASTRO MUNICIPAL, REGARDING THE GREEN AREAS OF THE PROYECTO AMERICANO LOCATED IN NOSARA, WHEREIN THEY RECOMMEND PROCEEDING THROUGH THE DEPARTAMENTO LEGAL DE LA MUNICIPALIDAD DE NICOYA SO THAT IT MAY ASSESS THE APPROPRIATE COURSE OF ACTION IN THE CASE FROM A LEGAL AND JURIDICO (sic) PERSPECTIVE AND FOLLOW UP ON IT.
NOTIFIQUESE (sic) FOR THE CORRESPONDING LEGAL AND ADMINISTRATIVE PURPOSES. FINALLY APPROVED AND MADE ENFORCEABLE.” Resolution no. 18-046-2021 was served on the Alcaldía Municipal de Nicoya on 17 de marzo de 2021 by email. The Alcaldía Municipal de Nicoya reviewed the report of the Comisión de Obras Municipales (opinion D-COM-0103-2021, session no. 3 of 29 de marzo 2021), issued “for the purpose of recovering, in the name of this Municipalidad, the 80 hectares currently registered in the names of private parties, land that must be public as indicated by 05-3 Article 40 of the Ley de Planificación Urbana.” The Dirección de Gestión Jurídica de la Municipalidad de Nicoya, through official letter no. DGJ-041-09-2021 of 29 de setiembre de 2021, requested the case history from the departamento de Control Constructivo; however, due to the lack of suitable documentation, the case was referred to the Comisión Técnica Urbanística, a collegiate body comprising the professionals responsible for the construction, land-use planning, urban planning, legal management, and cadastral areas.
In report CTU 03-2023 of 28 de febrero de 2023, the Comisión Técnica Urbanística stated the following: “ANALYTICAL CONSIDERATIONS (…) The analysis conducted regarding the current status of the conveyance of common areas in what was at one time known as the ‘Proyecto Americano,’ as required by Article 40 of the Ley de Planificación Urbana (LPU), reveals the following circumstances: FIRST: The Proyecto Americano began in 1982, based on the oldest cadastral plans available for review. SECOND: The individual developers have died or cannot be located in the country, and the last legal entity, Amigos de Nosara, was dissolved several years ago; no parcels or properties appear registered in its name because they were conveyed to the Asociación Cívica de Nosara (ACN), which in this case was a good-faith purchaser unrelated to the aforementioned urban development. THIRD: The developers never conveyed the common areas as provided in the aforementioned Article 40.
Accordingly, that article states the following: (…) FOURTH: One of the legal means of deeming land for parks, green areas, community halls, and playgrounds to have been conveyed is through the approval of plans (visado de planos) specifying the designated use of each lot in accordance with the aforementioned terms of Section 40 LPU. Because this legal requirement has not been met, it is impossible to identify the areas individually and classify them as such. FIFTH: To date, it has not been possible to locate a construction permit or site design approved by INVU showing the common areas to be conveyed; nor have any plans approved by the Municipalidad and INVU been located whose designated use is compatible with the provisions of the cited Article 40. SIXTH: Regarding the list of properties registered in the name of the ASOSIACIÓN CÍVICA DE NOSARA (ACN), it is important to note that all are encumbered by an ecological easement (servidumbre ecológica), and the designated use of the great majority is not described as parks or other common areas; consequently, they cannot be used to satisfy the percentages arising from the aforementioned legislation.
SEVENTH (sic): The designated use ‘for green areas’ does appear in the following property registration folios (folios reales), which could be interpreted as a possible conveyance intended to satisfy the statutory percentage:

In this regard, the Procuraduría General de la República has stated that when duly approved cadastral plans describing land whose designated use is compatible with the common elements under Article 40 LPU form part of the Mapa Oficial, the appropriate course is for the municipalities to request that the Registro Inmobiliario (RIM) register the land in the name of the respective municipal government. RECOMMENDATIONS FIRST: Before requesting that the Registro Inmobiliario register the parcels described in point 7 of this report, the Departamentos de Planificación Urbana, Control Constructivo y Ambiental should be instructed to conduct an on-site inspection to determine the condition of such land, so that its suitability for any of the purposes established in the cited Section 40 may be technically determined, together with the Municipalidad’s actual ability to maintain it and ensure its intended use, and so that a cost-benefit analysis may be conducted regarding registration of those properties in its name.
SECOND: Upon receipt of the aforementioned report, determine whether proceedings before RIM are appropriate or whether, instead, a joint plan for the administration and use of such areas should be agreed upon with ACN.” With respect to this matter, this Court emphasizes that the subject of this amparo action (recurso de amparo) concerns the municipality’s failure to determine the status—and potential recovery—of property that, according to the allegations, is in the public domain (dominio público), as well as the environmental protection of such areas; it therefore constitutes a matter of full constitutional significance.
In this regard, the local government has been aware of the reported situation since at least 2021. Specifically, it should be noted that, on 10 de marzo de 2021, the Alcaldía Municipal de Nicoya received official letter CCOP-050-2021, informing it that twenty-three plans whose designated use was “green areas or parks” had been located as a result of a study begun in 2014.
Furthermore, although the alcaldía municipal reported that the Comisión Técnica Urbanística issued the “REPORT CTU 03-2023, UPDATED REGARDING COMMON AND GREEN AREAS OF THE PROYECTO AMERICANO,” no specific actions aimed at addressing the situation comprehensively are evident thereafter. This is relevant not only because of the land’s alleged public character, but also because the acting alcaldesa of Nicoya herself stated in her report that the land in question includes areas designated as ecological easements and park or green areas located “adjacent to the Refugio Nacional de Vida Silvestre de Ostional and forming part of its buffer zone (zona de amortiguamiento).” Ergo, the Municipalidad de Nicoya cannot simply adopt a passive stance by stating in general and abstract terms that this is a complex problem under discussion in criminal proceedings. The Chamber finds no legitimate argument justifying more than two years of inaction by the municipal authorities.
The action is therefore granted so that they may: 1) update the technical studies concerning property deemed to be public-domain property (bienes demaniales); and 2) exercise their powers so that the corresponding internal procedures are pursued and the necessary actions are brought in both the administrative and judicial spheres, as applicable, to safeguard the public and environmental interests associated with properties that are in the public domain, as well as to recover them in cases where any irregularity in title is established.
The amparo action against SINAC is denied because, based on the evidence submitted in the case file, there is no act or omission within the scope of its powers for which it may currently be held accountable in relation to the facts at issue in this action.
V.NOTE BY JUSTICE CASTILLO VÍQUEZ.- The case law of this Court has been clear that it is not responsible for enforcing resolutions of public administrative bodies. However, the Sub lite presents a particular circumstance, because the failure of the municipality’s executive body to act could be affecting public-domain property as well as the right to a healthy and ecologically balanced environment. It is therefore appropriate to examine the merits and, once the omission has been established, the logical consequence is to grant the amparo action. I am not unaware of the doctrine that the relationship between the concejo and the alcalde is not hierarchical but instead entails an allocation of exclusive powers; nevertheless, pursuant to Article 17, subsection 4, of the Código Municipal, the latter, as the corporation’s executive body, is responsible for implementing the former’s resolutions unless the alcalde vetoed them, which did not occur in this case.
In environmental matters, it is my view that if the Administración Pública has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation courts (jurisdicción contenciosa administrativa). Nevertheless, I do examine the merits when other fundamental rights are at stake, as occurs in this case, in which the appellant alleges that the Municipalidad de Nicoya has taken no action aimed at resolving the recovery of public-domain property.
The parties are hereby advised that, if they have submitted any paper document or objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved within a maximum period of 30 business days from notification of this judgment. They are warned that any material not retrieved within that period will be destroyed pursuant to the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”) (approved by the Full Court in Article XXVI of session no. 27-11 of August 22, 2011, and published in Judicial Bulletin no. 19 of January 26, 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of May 3, 2012.
POR TANTO:
By majority vote, the amparo proceeding (recurso de amparo) is granted solely with respect to the Municipality of Nicoya. Accordingly, Silvia Gutiérrez Oviedo, in her capacity as acting mayor, and Sandra María Muñoz Ruiz, in her capacity as president of the Council, both of the Municipality of Nicoya, or whoever holds those offices, are ordered to make the necessary arrangements, coordinate the pertinent matters, and carry out all actions within the scope of their authority so that, within EIGHTEEN MONTHS from notification of this judgment, they shall: 1) technically determine the legal status of the real properties deemed to be public-domain property (bienes demaniales) in official communications CCOP-050-2021, D-COM-0103-2021, and CTU 03-2023, and update their current status; and 2) bring, both administratively and judicially (as applicable), the actions necessary to safeguard the public and environmental interest in the properties whose public-domain status must be recognized, as well as to recover them in cases where any irregularity concerning their ownership is identified.
It is hereby advised that, pursuant to Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), anyone who receives an order issued in an amparo proceeding that the person must comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. The Municipality of Nicoya is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in proceedings to enforce the judgment before the administrative litigation jurisdiction (jurisdicción contencioso-administrativa). As to the Sistema Nacional de Áreas de Conservación, the proceeding is denied. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Res. Nº 2025-025307 DISSENTING OPINION OF JUSTICE GARRO VARGAS With the customary respect, I depart from the majority, dissent, and would deny the proceeding for the following reasons:
Arguments In the sub lite case, the petitioner states that for fifty-five years the Municipality of Nicoya has authorized, without restriction, construction, approval of plans (visado de planos), and land uses (usos de suelos) to the detriment of public-domain property. For that reason, on March 19, 2021, the Concejo de Nicoya unanimously resolved that the mayor should pursue the recovery of the public-domain property within the “Proyecto Americano,” either administratively or judicially. In this regard, the petitioner maintains that a special commission was appointed in 2020 and determined that such areas exist. The petitioner adds that the Comisión de Obras Municipales issued opinion D-COM-0103-2021 concerning the undelivered public-domain areas of the “Proyecto Americano” in the district of Nosara and recommended the following to the Council:
“…to request that the Municipal Administration take the necessary administrative or judicial measures to comply with the resolution adopted by the Concejo Municipal through resolution N.- 012-039-2021 of January 26, for the purpose of recovering in the name of this Municipality the 80 hectares currently registered in the names of private parties, lands that must be public as provided in Article 40 of the Urban Planning Law (Ley de Planificación Urbana).” The petitioner argues that in 2021 the Council referred the special commission’s opinion to the municipality’s Gestión Jurídica department; however, the petitioner alleges that no response was provided. In view of that omission, the petitioner states that on April 09, 2021, the Council again requested that the mayor take administrative or judicial measures to recover the public-domain property; nevertheless, the petitioner complains that no action has been taken.
Proven Facts Although the judgment contains the list of proven facts (hechos probados), it bears recalling that it was established that the Alcaldía Municipal de Nicoya received official communication CCOP-050-2021 of March 10, 2021, which stated that twenty-three plans had been located “designated as green spaces or parks, as a result of a study initiated in 2014.” Likewise, by resolution no. 18-046-2021 adopted at regular session no. 46 held on Tuesday, March 16, 2021, the Concejo de Nicoya ordered as follows:
“Municipal Resolution No. 018-046-2021: THE CONCEJO MUNICIPAL DE NICOYA UNANIMOUSLY APPROVES REFERRING THE MATTER TO THE MUNICIPALITY’S GESTIÓN JURÍDICA DEPARTMENT SO THAT IT MAY RESPOND AS APPROPRIATE, WITHIN NO MORE THAN 10 BUSSINESS (sic) DAYS, TO THE MATTERS SET FORTH IN OFFICIAL COMMUNICATION CCOP-050-2021, SIGNED BY ENG. JOSUÉ RUIZ GUERRERO, COORDINATOR OF THE CONTROL CONSTRUCTIVO Y OBRA PÚBLICA DEPARTMENT, AND ENG. BYRON ROSALES MORALES, COORDINATOR OF THE CATASTRO MUNICIPAL DEPARTMENT, REGARDING THE GREEN SPACES OF THE PROYECTO AMERICANO LOCATED IN NOSARA, WHEREIN THEY RECOMMEND PROCEEDING THROUGH THE MUNICIPALITY OF NICOYA’S LEGAL DEPARTMENT SO THAT IT MAY ASSESS THE APPROPRIATE COURSE OF ACTION FROM THE LEGAL AND JURIDICAL (sic) STANDPOINT AND FOLLOW UP ON THE MATTER. NOTIFY (sic) FOR THE CORRESPONDING LEGAL AND ADMINISTRATIVE PURPOSES. FINALLY AND DEFINITIVELY APPROVED.” That resolution was notified to the Alcaldía Municipal de Nicoya by email on March 17, 2021.
The record shows that the Mayor’s Office reviewed the report of the Comisión de Obras Municipales (opinion D-COM-0103-2021, session no. 3 of March 29, 2021), issued “for the purpose of recovering in the name of this Municipality the 80 hectares currently registered in the names of private parties, lands that must be public as provided in 05-3 Article 40 of the Urban Planning Law.” Furthermore, through official communication no. DGJ-041-09-2021 of September 29, 2021, the Dirección de Gestión Jurídica of the Municipality of Nicoya requested the case background records from the Control Constructivo department; however, due to the lack of suitable documentation, the case was referred to the Comisión Técnica Urbanística, a collegiate body (órgano colegiado) comprising the professionals responsible for construction, territorial planning, urban planning, legal management, and cadastral matters. Finally, it was established that in report CTU 03-2023 of February 28, 2023, the Comisión Técnica Urbanística set forth the following recommendations:
RECOMMENDATIONS FIRST: Before requesting that the Registro Inmobiliario register the parcels (predios) described in point 7 of this report, the Planificación Urbana, Control Constructivo, and Ambiental Departments should be instructed to conduct an on-site inspection (inspección in situ) to determine the condition of those lands, so that their suitability for any of the purposes established in the aforementioned Article 40 may be technically determined, along with the Municipality’s actual ability to maintain them, ensure their intended use, and conduct a cost-benefit analysis of registering those properties in its name. SECOND: Upon receipt of the aforementioned report, determine whether proceedings before the RIM are appropriate or whether, instead, a joint plan for the administration and use of those areas should be agreed upon with the ACN.”
Considerations
In this matter, there is one element that cannot be overlooked: as stated in the initial petition and in the order admitting the proceeding, the petitioner alleges an omission by the respondent Mayor’s Office in complying with the order issued by the Concejo de Nicoya. Consequently, the relief sought is an order directing the municipal mayor of Nicoya to implement resolution no. 18-046-2021, adopted by the Council at regular session no. 46 held on Tuesday, March 16, 2021, concerning the green spaces of the “Proyecto Americano” located in Nosara, as well as the measures set forth in the report of the Comisión de Obras Municipales (opinion D-COM-0103-2021, session no. 3 of March 29, 2021), aimed at recovering in the Municipality’s name the eighty hectares currently registered in the names of private parties and stating that those lands must be public.
A careful examination of the initial petition shows that the petitioner does not explain how that omission infringes any fundamental right. Rather, the petitioner appears to be defending legality. Nevertheless, by invoking the principle that the court knows the law (iura novit curia), this Chamber could find that the matter affects the right to a healthy and ecologically balanced environment.
Along those lines, although I understand the seriousness of the facts reported by the petitioner and the potentially harmful consequences they may be having for environmental protection in the canton of Nicoya, it cannot be overlooked that this Constitutional Chamber lacks jurisdiction to order the implementation of municipal resolutions. For example, in judgment 2021-5701 at 09:15 on March 19, 2021, it held:
“Name03.- Moreover, the petitioner alleges that, in official communication No. DAUHTPCOSR-0409-2018 of December 12, 2018, the Unidad Hidrológica Tárcoles-Pacífico Central-San Ramón- of the Ministerio de Ambiente y Energía granted the Municipality of Grecia a period of 8 business days to state whether the Mercado Municipal had sanitary sewer service and, if so, to provide the location coordinates of the treatment plant for that wastewater. Regarding this matter, the respondent local government reported that there is currently a Master Plan for the Market entitled ‘Project. REMODELING OF THE MERCADO MUNICIPAL UNDER THE PRINCIPLES OF SUSTAINABLE DESIGN,’ with plans, technical specifications, a budget, and implementation stages; the first two stages have already been completed with an investment of 100 million colones, while the final stage involving work on the mechanical systems remains pending and is undergoing formulation and implementation procedures.
Nevertheless, it emphasized that the Market Administration has spent years accumulating a surplus sufficient to reach the amount required to carry out the final stage of the project and provide a definitive solution; as of the date the report was submitted, the full amount required was still unavailable, and therefore work had not begun. In this regard, the Chamber notes that if the petitioner considers that the respondent local government has failed to comply with the directives of the Unidad Hidrológica Tárcoles-Pacífico Central-San Ramón- of the Ministerio de Ambiente y Energía, this essentially constitutes a complaint that may not be heard before this Jurisdiction, because the investigation and subsequent reprimand—if warranted—of a public authority that has failed to perform the duties assigned to it by law falls within the authority of other judicial bodies (the criminal courts) or administrative bodies.
Accordingly, the petitioner must raise the objection before the Municipality of Grecia itself or report the matter as a breach of official duties (incumplimiento de deberes).” (Emphasis not in the original).
Likewise, in judgment 2025-4619 at 09:20 hours on 14 de febrero de 2025, it stated, in essence, as follows:
“.- SUBJECT MATTER OF THE ACTION. The petitioner states that the Cantonal Road Board does not broadcast its sessions live, even though the Municipal Council ordered it to do so. He considers the principle of publicity to have been violated.
(...)
In this regard, the Chamber notes that if the petitioner believes that the Road Board has failed to comply with the Municipal Council’s decision in the aforementioned resolution, this essentially constitutes a complaint that is not properly heard before this Jurisdiction, since the investigation and subsequent reprimand—if applicable—of a public authority that has failed to perform the duties assigned to it by law falls within the purview of other judicial (criminal) or administrative bodies; therefore, they must raise their objection before the Municipality of Los Chiles itself or report the matter as a breach of official duties (incumplimiento de deberes).” In addition to the foregoing, I consider that the omission alleged by the petitioner constitutes a complaint that likewise is not properly heard before this constitutional jurisdiction, because the investigation and subsequent reprimand—if applicable—of a public authority that has failed to perform the duties assigned to it by law falls within the purview of other judicial (criminal) or administrative bodies; therefore, he must raise his objection before the Municipality of Nicoya itself or report the matter as a breach of official duties.
The Chamber has so held, as reflected in the precedents just transcribed. Furthermore, with respect to this section, it should be noted that the acting mayor of the Municipality of Nicoya emphasized the following:
“I have informal information indicating the possible existence of criminal proceedings against certain persons connected with that project, although I am unaware of the status of those proceedings (…) This is a complex matter being addressed through criminal proceedings and, if there is any objection, it must be resolved through the corresponding legal channels, not through constitutional proceedings.” In other words, the alleged omissions are already under consideration in criminal proceedings.
Now, although I observe that in this action this Court is not expressly ordering the respondent local government to implement the resolutions in question, it is nonetheless granting the petitioner’s request that those resolutions be implemented. It should be noted that the operative part orders the legal status of the real property deemed to be within the public domain (bienes demaniales) to be determined from a technical standpoint; the current condition of that property to be updated; the necessary actions to be brought in both administrative and judicial proceedings, as appropriate, to safeguard the public and environmental interests associated with property whose public-domain status must be recognized; and that property to be recovered in cases where any irregularity concerning its ownership is found. However, I consider that all of this properly falls to be heard and implemented in the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), given its considerable complexity.
Indeed, environmental protection is unquestionably a matter of constitutional importance and, in principle, this Chamber has jurisdiction to hear claims involving violations of Article 50 of the Political Constitution. Moreover, consistently with the ruling in this case file, it has repeatedly held that municipalities have an obligation to safeguard matters relating to environmental protection—for example, judgment 2007-017552 at 12:22 hours on 30 de noviembre de 2007. But that does not mean that every matter concerning a fundamental right—even where it involves the right to a healthy and ecologically balanced environment—is per se capable of being heard in summary proceedings (proceso sumario). This is especially so where consideration of the alleged violations and enforcement of the orders would require the procedural joinder (integración procesal) of various institutions, for example: Procuraduría General de la República, Instituto Costarricense de Turismo, Instituto Nacional de Vivienda y Urbanismo, Instituto Geográfico Nacional, Contraloría General de la República, etc.
What I maintain here—that it is appropriate for this matter not to be adjudicated in this forum through summary proceedings such as an amparo proceeding (recurso de amparo)—in fact affords greater procedural safeguards to the parties involved, since the ordinary jurisdiction would provide for a broader evidentiary phase and the possibility of resorting to a robust system of interim relief (justicia cautelar), which could be particularly useful in this case. I have explained this line of reasoning in many instances (for example, note to judgment 2022-9857, judgment 2022-17490, dissenting opinion in 2023-11233).
It should also be added that, during the judgment-enforcement stage, that jurisdiction has more extensive tools to properly oversee the order issued, pursuant to art. 155 et seq. of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso-Administrativo), which would offer clear advantages, such as the ability to require timetables, impose fines, establish liability, oversee stages of compliance, etc.
Conclusion
In summary, although I am mindful of the seriousness of the allegations concerning the purported conduct of the respondent municipality, I consider that the case at hand involves a claim regarding the failure to implement certain resolutions of the Concejo de Nicoya, and that the very subject matter underlying this dispute (litis)—both its adjudication and its enforcement—far exceeds the proper scope of an amparo proceeding. It is also reported that criminal investigations concerning this matter are already underway. I therefore consider that the various claims should be processed and resolved in other forums with the urgency they warrant, including the possibility of requesting and applying interim measures (medidas cautelares)—as the petitioner himself requests. In view of these arguments, I dissent and deny the action.

Res. 2025025307 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas y cincuenta minutos del ocho de agosto de dos mil veinticinco.
Recurso de amparo que se tramita en expediente nro. 25-011146-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra la MUNICIPALIDAD DE NICOYA y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
RESULTANDO:
Redacta el magistrado Rueda Leal; y,
CONSIDERANDO:
El recurrente manifiesta que, desde hace 55 años, la Municipalidad de Nicoya ha autorizado irrestrictamente construcciones, visado de planos y usos de suelos, en perjuicio de bienes demaniales. Señala que, el 19 de marzo de 2021, el Concejo Municipal acordó de forma unánime que el alcalde procediera administrativa o judicialmente con la reivindicación de los bienes demaniales dentro del “Proyecto Americano”. Sostiene que los inmuebles se encuentran delimitados, entre ellos, vías públicas, parques, áreas verdes, calles, reservas para servicios comunales. Menciona que en 2020 se nombró una comisión especial, la cual determinó que tales áreas existen. Manifiesta que la Comisión de Obras Municipales emitió el dictamen D-COM-0103-2021 sobre las áreas demaniales no entregadas del “Proyecto Americano” en el distrito de Nosara y le recomendó al concejo: “Solicitarle a la Administración Municipal tome las medidas administrativas o judiciales necesarias a efecto de cumplir con lo acordado por el Concejo Municipal mediante acuerdo N.- 012-039-2021 de 26 de enero, con la finalidad de reivindicar a nombre de esta Municipalidad las 80 hectáreas que actualmente están a nombre de privados, terrenos que deben ser públicos como lo indica el artículo 40 de la Ley de Planificación Urbana”.
Asevera que, en 2021, el concejo trasladó el dictamen de la comisión especial al departamento de Gestión Jurídica de la municipalidad; empero, no hubo respuesta. Añade que, el 9 de abril de 2021, tal órgano colegiado solicitó de nuevo al alcalde tomar las medidas administrativas o judiciales para la reivindicación de los bienes demaniales; sin embargo, no se ha actuado.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Conforme a ello, ese artículo menciona lo siguiente: (…) CUARTO: Uno de medios legales para tener por cedidos los terrenos para parques, áreas verdes, salones comunales y parques infantiles, es a través del visado de planos donde se indique la naturaleza de cada lote en los referidos términos del ordinal 40 LPU. Pues este requisito legal al no tenerse, resulta imposible la individualización de las áreas y clasificarlas como tal. QUINTO: A la fecha no ha sido posible localizar permiso de construcción, diseño de sitio visado por el INVU donde consten las áreas comunes a ceder, así como tampoco se localizan planos visados por la Municipalidad e INVU con naturaleza que sea compatible por lo dispuesto en el artículo 40 de citas. SEXTO: De la lista de propiedades inscritas a nombre de la ASOSIACIÓN CÍVICA DE NOSARA (ACN), es importante señalar que todas aparecen gravadas por servidumbre ecológica y la gran mayoría no describe como naturaleza el destino para parques y resto de áreas comunes, por lo que no pueden ser objeto para el cumplimiento de los porcentajes derivados de la legislación dicha. SETIMO (sic): En los siguientes folios reales sí aparece como naturaleza "para zonas verdes", lo que podría interpretarse como posible cesión para complacer el porcentaje de Ley:

"El Registro citado pondrá último asiento a aquellas fincas, restos o lotes que el propietario, en concepto de fraccionador, ceda al municipio por mandato de esta ley, si en el documento inscribible consta el destino público que se le da al inmueble y el Notario da fe del acuerdo municipal en que aprueba la cesión y se dispone entregar dicho bien a ese mismo destino." (Artículo 44, Ley de Planificación Urbana). Al respecto, la Procuraduría General de la República ha señalado que, cuando planos catastrados que describan terrenos de naturaleza compatible con los elementos comunes del artículo 40 LPU, debidamente visados, forman parte del Mapa Oficial, y, lo procedente, es que las municipalidades soliciten al Registro Inmobiliario (RIM) la inscripción a nombre del respectivo ayuntamiento. RECOMENDACIONES PRIMERA: De previo a solicitar al Registro Inmobiliario la inscripción de los predios descritos en el punto 7 del presente informe, se comisione a los Departamentos de Planificación Urbana, Control Constructivo y Ambiental hacer inspección in situ para determinar las condiciones de tales terrenos, para que se determine técnicamente su aptitud para algunos de los fines establecidos en el ordinal 40 de citas, la posibilidad real que podría tener la Municipalidad para darle mantenimiento, asegurar el uso deseado y hacer un balance costo-beneficio de inscribir esos inmuebles a su nombre.
SEGUNDA: Recibido el informe señalado, determinar si procede la gestión ante el RIM o más bien concertar con la ACN un plan conjunto de administración y explotación de tales áreas”. (Prueba aportada por la Municipalidad de Nicoya).
No se estima demostrado el siguiente hecho de relevancia para esta resolución:
Único. Que, luego del 28 de febrero de 2023, la Municipalidad de Nicoya haya llevado a cabo acciones dirigidas a resolver la situación de la recuperación de bienes de dominio público.
En el sub lite, el recurrente manifiesta que, desde hace 55 años, la Municipalidad de Nicoya ha autorizado irrestrictamente construcciones, visado de planos y usos de suelos, en perjuicio de bienes demaniales. Señala que, el 19 de marzo de 2021, el Concejo Municipal acordó de forma unánime que el alcalde procediera administrativa o judicialmente con la reivindicación de los bienes demaniales dentro del “Proyecto Americano”. Sostiene que los inmuebles se encuentran delimitados, entre ellos, vías públicas, parques, áreas verdes, calles, reservas para servicios comunales. Menciona que en 2020 se nombró una comisión especial, la cual determinó que tales áreas existen. Manifiesta que la Comisión de Obras Municipales emitió el dictamen D-COM-0103-2021 sobre las áreas demaniales no entregadas del “Proyecto Americano” en el distrito de Nosara y le recomendó al concejo: “Solicitarle a la Administración Municipal tome las medidas administrativas o judiciales necesarias a efecto de cumplir con lo acordado por el Concejo Municipal mediante acuerdo N.- 012-039-2021 de 26 de enero, con la finalidad de reivindicar a nombre de esta Municipalidad las 80 hectáreas que actualmente están a nombre de privados, terrenos que deben ser públicos como lo indica el artículo 40 de la Ley de Planificación Urbana”.
Asevera que, en 2021, el concejo trasladó el dictamen de la comisión especial al departamento de Gestión Jurídica de la municipalidad; empero, no hubo respuesta. Añade que, el 9 de abril de 2021, tal órgano colegiado solicitó de nuevo al alcalde tomar las medidas administrativas o judiciales para la reivindicación de los bienes demaniales; sin embargo, no se ha actuado.
Del estudio de los autos se tiene por demostrado, que la Alcaldía Municipal de Nicoya recibió el oficio CCOP-050-2021 de 10 de marzo 2021, en el cual se consignó que se localizaron 23 planos “con naturaleza para zonas verdes o parques, a raíz de un estudio que se inició en el año 2014”. El Concejo Municipal de Nicoya, por acuerdo nro. 18-046-2021 tomado en la sesión ordinaria nro. 46 celebrada el martes 16 de marzo de 2021, dispuso: “Acuerdo Municipal No. 018-046-2021: EL CONCEJO MUNICIPAL DE NICOYA EN FORMA UNÁNIME APRUEBA TRASLADAR AL DEPARTAMENTO DE GESTIÓN JURÍDICA DE LA MUNICIPALIDAD PARA QUE ATIENDA COMO CORRESPONDA Y EN UN PLAZO NO MAYOR A 10 DÍAZ (sic) HÁBILES A LO EXPUESTO EN EL OFICIO CCOP-050-2021 SUSCRITO POR EL ING. JOSUÉ RUIZ GUERRERO COORDINADOR DEL DEPARTAMENTO DE CONTROL CONSTRUCTIVO Y OBRA PÚBLICA, Y EL ING. BYRON ROSALES MORALES COORDINADOR DEL DEPARTAMENTO DE CATASTRO MUNICIPAL, EN REFERENCIA A LAS ZONAS VERDES DEL PROYECTO AMERICANO UBICADO EN NOSARA, SIENDO QUE, RECOMIENDAN PROCEDER MEDIANTE EL DEPARTAMENTO LEGAL DE LA MUNICIPALIDAD DE NICOYA PARA QUE VALOREN EL PROCEDER DEL CASO DESDE EL PUNTO DE VISTA LEGAL Y JURIDICO (sic), Y PARA DAR SEGUIMIENTO AL MISMO.
NOTIFIQUESE (sic) PARA LOS EFECTOS LEGALES Y ADMINISTRATIVOS CORRESPONDIENTES. DEFINITIVAMENTE APROBADO CON FIRMEZA”. El acuerdo nro. 18-046-2021 fue notificado a la Alcaldía Municipal de Nicoya el 17 de marzo de 2021 por correo electrónico. La Alcaldía Municipal de Nicoya conoció el reporte de la Comisión de Obras Municipales (dictamen D-COM-0103-2021, sesión nro. 3 de 29 de marzo 2021) emitido “con la finalidad de reivindicar a nombre de esta Municipalidad las 80 hectáreas que actualmente están a nombre de privados, terrenos que deben ser públicos como lo indica el 05-3 artículo 40 de la Ley de Planificación Urbana”. La Dirección de Gestión Jurídica de la Municipalidad de Nicoya, mediante oficio nro. DGJ-041-09-2021 de 29 de setiembre de 2021, solicitó los antecedentes del caso al departamento de Control Constructivo, pero ante la falta de documentación idónea se elevó el caso a la Comisión Técnica Urbanística, órgano colegiado que incorpora a los profesionales responsables de las áreas constructiva, planificación territorial, planificación urbana, gestión jurídica y catastral.
En el informe CTU 03-2023 del 28 de febrero de 2023, la Comisión Técnica Urbanística consignó lo siguiente: “CONSIDERACIONES DEL ANÁLISIS (…) Del análisis practicado sobre el estado actual de la entrega de zonas comunes en el denominado en algún momento como "Proyecto Americano", según lo ordena el artículo 40 de la Ley de Planificación Urbana (LPU), se desprenden las siguientes situaciones: PRIMERO: El Proyecto Americano inició en el año 1982, a partir de tener a la vista los planos catastrados más antiguos. SEGUNDO: Los desarrolladores físicos han fallecido o no son localizables en el país y la última persona jurídica, Amigos de Nosara, fue disuelta hace algunos años y no aparecen fincas o propiedades a su nombre pues fueron cedidas a la Asociación Cívica de Nosara (ACN), adquirente de buena fe en este caso y ajena al desarrollo urbanístico aludido. TERCERO: Los desarrolladores nunca hicieron cesión de las áreas comunales según lo que dispone el artículo 40 supra citado.
Conforme a ello, ese artículo menciona lo siguiente: (…) CUARTO: Uno de medios legales para tener por cedidos los terrenos para parques, áreas verdes, salones comunales y parques infantiles, es a través del visado de planos donde se indique la naturaleza de cada lote en los referidos términos del ordinal 40 LPU. Pues este requisito legal al no tenerse, resulta imposible la individualización de las áreas y clasificarlas como tal. QUINTO: A la fecha no ha sido posible localizar permiso de construcción, diseño de sitio visado por el INVU donde consten las áreas comunes a ceder, así como tampoco se localizan planos visados por la Municipalidad e INVU con naturaleza que sea compatible por lo dispuesto en el artículo 40 de citas. SEXTO: De la lista de propiedades inscritas a nombre de la ASOSIACIÓN CÍVICA DE NOSARA (ACN), es importante señalar que todas aparecen gravadas por servidumbre ecológica y la gran mayoría no describe como naturaleza el destino para parques y resto de áreas comunes, por lo que no pueden ser objeto para el cumplimiento de los porcentajes derivados de la legislación dicha. SETIMO (sic): En los siguientes folios reales sí aparece como naturaleza "para zonas verdes", lo que podría interpretarse como posible cesión para complacer el porcentaje de Ley:
Plano Descripción Folio Real A nombre de Naturaleza según asiento registral G-557689-84 Parque-Zona Verde 54236-000 Asociación Cívica de Nosara Zona verde G-557689-84 Parque-Zona Verde 54240-000 Asociación Cívica de Nosara Zona verde G-557689-84 Parque-Zona Verde parte de 7302-000 Amigos de Nosara G-2181109-20 Parque-Zona Verde 238518-000 Asociación Cívica de Nosara Parque G-546055-84 Parque-Zona Verde parte de 7302-000 Amigos de Nosara G-557685-84 Parque-Zona Verde parte de 7302-000 Amigos de Nosara OCTAVO: Sobre el tema bajo análisis, la Ley de Planificación Urbana dispone el artículo 44 de la analizada Ley de Planificación Urbana, indica expresamente lo siguiente: "El dominio municipal sobre las áreas de calles, plazas, jardines, parques u otros espacios abiertos de uso público general, se constituye por ese mismo uso y puede prescindirse de su inscripción en el Registro de la Propiedad, si consta en el Mapa Oficial.
"El Registro citado pondrá último asiento a aquellas fincas, restos o lotes que el propietario, en concepto de fraccionador, ceda al municipio por mandato de esta ley, si en el documento inscribible consta el destino público que se le da al inmueble y el Notario da fe del acuerdo municipal en que aprueba la cesión y se dispone entregar dicho bien a ese mismo destino." (Artículo 44, Ley de Planificación Urbana). Al respecto, la Procuraduría General de la República ha señalado que, cuando planos catastrados que describan terrenos de naturaleza compatible con los elementos comunes del artículo 40 LPU, debidamente visados, forman parte del Mapa Oficial, y, lo procedente, es que las municipalidades soliciten al Registro Inmobiliario (RIM) la inscripción a nombre del respectivo ayuntamiento. RECOMENDACIONES PRIMERA: De previo a solicitar al Registro Inmobiliario la inscripción de los predios descritos en el punto 7 del presente informe, se comisione a los Departamentos de Planificación Urbana, Control Constructivo y Ambiental hacer inspección in situ para determinar las condiciones de tales terrenos, para que se determine técnicamente su aptitud para algunos de los fines establecidos en el ordinal 40 de citas, la posibilidad real que podría tener la Municipalidad para darle mantenimiento, asegurar el uso deseado y hacer un balance costo-beneficio de inscribir esos inmuebles a su nombre. SEGUNDA: Recibido el informe señalado, determinar si procede la gestión ante el RIM o más bien concertar con la ACN un plan conjunto de administración y explotación de tales áreas”.
Sobre el particular, este Tribunal resalta que el objeto de este recurso versa sobre la omisión municipal de definir la situación (y eventual recuperación) de bienes que, según se indica son de dominio público, así como con la protección ambiental de tales zonas, por lo que constituye un tema de plena relevancia constitucional.
Al respecto, el gobierno local tiene conocimiento de la situación denunciada al menos desde el 2021. Justamente, adviértase que, el 10 de marzo de 2021, la Alcaldía Municipal de Nicoya recibió el oficio CCOP-050-2021, en el cual se le comunicó la localización de veintitrés planos con naturaleza “zonas verdes o parques” como consecuencia de un estudio iniciado en 2014.
Además, si bien la alcaldía municipal informó que la Comisión Técnica Urbanística emitió el “INFORME CTU 03-2023, ACTUALIZADO SOBRE ÁREAS COMUNES Y VERDES DEL PROYECTO AMERICANO”, con posterioridad a este no se aprecian acciones concretas dirigidas a atender la situación de forma íntegra. Lo anterior es relevante no solo por la presunta naturaleza pública de los terrenos, sino porque la propia alcaldesa a. i. de Nicoya mencionó en su informe que los terrenos de marras tienen zonas declaradas como servidumbres ecológicas y áreas de parque o verdes que están ubicadas “en colindancia con el Refugio Nacional de Vida Silvestre de Ostional y conforman zona de amortiguamiento”.
Ergo, la Municipalidad de Nicoya no se puede conformar con asumir una actitud pasiva al señalar de forma general y abstracta que se trata de un problema complejo que se discute en la vía penal. La Sala no observa algún argumento legítimo que justifique la inacción de más de dos años de las autoridades municipales, por lo que se declara con lugar el recurso a fin de que procedan a: 1) actualizar los estudios técnicos sobre los bienes que se reputan como demaniales; y 2) ejercer sus competencias a los efectos de que se gestionen los procedimientos internos correspondientes y se interpongan tanto en el ámbito administrativo como en el judicial (según corresponda) las acciones necesarias para garantizar el resguardo del interés público y ambiental de las propiedades que sean demaniales, así como la reivindicación de estas en los casos en los que se determine alguna irregularidad en la titularidad.
Respecto al SINAC se desestima el amparo ya que, de acuerdo con los elementos aportados al expediente, no se observa algún reproche de acción u omisión que, desde el ámbito de sus competencias, le pueda ser atribuido en este momento con respecto a los hechos objeto de este recurso.
V.NOTA DEL MAGISTRADO CASTILLO VÍQUEZ.- La jurisprudencia de este Tribunal ha sido clara en el sentido de que no le corresponde ejecutar los acuerdos de las administraciones públicas. Ahora bien, en el Sub lite hay una particularidad, pues la omisión del órgano ejecutivo de la municipalidad podría estar afectando bienes demaniales y también el derecho a un ambiente saludable y ecológicamente equilibrado, de ahí que resulta procedente entrar a conocer sobre el fondo y, al comprobarse la omisión, la consecuencia lógica es que se declare con lugar el recurso de amparo. No ignoro la doctrina de que la relación entre el concejo y el alcalde no es de jerarquía, sino de exclusión de competencias; sin embargo, de conformidad con el artículo 17, inciso 4, del Código Municipal, el segundo, como órgano ejecutivo de la corporación, le corresponde ejecutar los acuerdos del primero, excepto de que los haya votado, hecho que no se dio en este caso.
En asuntos ambientales, es criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando estén de por medio otros derechos fundamentales, tal y como sucede en este caso, en el que la parte recurrente asegura que, la Municipalidad de Nicoya no ha realizado las acciones dirigidas a resolver la situación de la recuperación de bienes de dominio público.
Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
POR TANTO:
Por mayoría, se declara con lugar el recurso, únicamente respecto a la Municipalidad de Nicoya. En consecuencia, se ordena a Silvia Gutiérrez Oviedo, en su condición de alcaldesa a.i., y a Sandra María Muñoz Ruiz, en su condición de presidenta del Concejo, ambas de la Municipalidad de Nicoya, o a quienes ocupen esos cargos, que dispongan lo necesario, coordinen lo pertinente y lleven a cabo todas las actuaciones dentro del ámbito de sus competencias, a fin de que, en el plazo de DIECIOCHO MESES, contado a partir de la notificación de esta sentencia, se proceda a: 1) definir desde el punto de vista técnico la situación jurídica de los bienes inmuebles que se reputan como demaniales en los oficios CCOP-050-2021, D-COM-0103-2021 y CTU 03-2023, así como actualizar el estado en el que se encuentran; y 2) interponer tanto en el ámbito administrativo como en el judicial (según corresponda) las acciones necesarias para garantizar el resguardo del interés público y ambiental de los bienes cuya demanialidad deba ser reconocida, así como la reivindicación de estos en los casos en los que se determine alguna irregularidad en cuanto a su titularidad.
Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Nicoya al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Sistema Nacional de Áreas de Conservación, se declara sin lugar el recurso. El Magistrado Castillo Víquez pone nota. El Magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso en todos sus extremos. Notifíquese.

Res. Nº 2025-025307 VOTO SALVADO DE LA MAGISTRADA GARRO VARGAS Con el respeto acostumbrado, me separo de la mayoría, salvo el voto y declaro sin lugar el recurso en atención a lo siguiente:
Alegatos En el sub lite la parte recurrente manifiesta que desde hace cincuenta y cinco años la Municipalidad de Nicoya ha autorizado irrestrictamente construcciones, visado de planos y usos de suelos en perjuicio de bienes demaniales. Por tal motivo, el 19 de marzo de 2021 el Concejo de Nicoya acordó de forma unánime que el alcalde procediera administrativa o judicialmente con la reivindicación de los bienes demaniales dentro del “Proyecto Americano”. En ese sentido, sostiene que en el año 2020 se nombró una comisión especial, la cual determinó que tales áreas existen. Agrega que la Comisión de Obras Municipales emitió el dictamen D-COM-0103-2021 sobre las áreas demaniales no entregadas del “Proyecto Americano” en el distrito de Nosara y le recomendó al concejo lo siguiente:
“…solicitarle a la Administración Municipal tome las medidas administrativas o judiciales necesarias a efecto de cumplir con lo acordado por el Concejo Municipal mediante acuerdo N.- 012-039-2021 de 26 de enero, con la finalidad de reivindicar a nombre de esta Municipalidad las 80 hectáreas que actualmente están a nombre de privados, terrenos que deben ser públicos como lo indica el artículo 40 de la Ley de Planificación Urbana”.
Arguye que en el año 2021 el concejo trasladó el dictamen de la comisión especial al departamento de Gestión Jurídica de la municipalidad; sin embargo, acusa que no hubo respuesta alguna. Ante tal omisión, dice que el 09 de abril de 2021, el concejo solicitó nuevamente al alcalde tomar las medidas administrativas o judiciales para la reivindicación de los bienes demaniales; empero, reclama que no se ha actuado.
Hechos probados
Aunque en la sentencia se encuentra el elenco de los hechos probados, vale recordar que se tuvo por acreditado que la Alcaldía Municipal de Nicoya recibió el oficio CCOP-050-2021 de 10 de marzo 2021, en el cual se consignó que se localizaron veintitrés planos “con naturaleza para zonas verdes o parques, a raíz de un estudio que se inició en el año 2014”. Asimismo, el Concejo de Nicoya, por acuerdo nro. 18-046-2021 tomado en la sesión ordinaria nro. 46 celebrada el martes 16 de marzo de 2021, dispuso lo siguiente:
“Acuerdo Municipal No. 018-046-2021: EL CONCEJO MUNICIPAL DE NICOYA EN FORMA UNÁNIME APRUEBA TRASLADAR AL DEPARTAMENTO DE GESTIÓN JURÍDICA DE LA MUNICIPALIDAD PARA QUE ATIENDA COMO CORRESPONDA Y EN UN PLAZO NO MAYOR A 10 DÍAZ (sic) HÁBILES A LO EXPUESTO EN EL OFICIO CCOP-050-2021 SUSCRITO POR EL ING. JOSUÉ RUIZ GUERRERO COORDINADOR DEL DEPARTAMENTO DE CONTROL CONSTRUCTIVO Y OBRA PÚBLICA, Y EL ING. BYRON ROSALES MORALES COORDINADOR DEL DEPARTAMENTO DE CATASTRO MUNICIPAL, EN REFERENCIA A LAS ZONAS VERDES DEL PROYECTO AMERICANO UBICADO EN NOSARA, SIENDO QUE, RECOMIENDAN PROCEDER MEDIANTE EL DEPARTAMENTO LEGAL DE LA MUNICIPALIDAD DE NICOYA PARA QUE VALOREN EL PROCEDER DEL CASO DESDE EL PUNTO DE VISTA LEGAL Y JURIDICO (sic), Y PARA DAR SEGUIMIENTO AL MISMO. NOTIFIQUESE (sic) PARA LOS EFECTOS LEGALES Y ADMINISTRATIVOS CORRESPONDIENTES. DEFINITIVAMENTE APROBADO CON FIRMEZA”.
Dicho acuerdo fue notificado a la Alcaldía Municipal de Nicoya el 17 de marzo de 2021 por correo electrónico. Consta que dicha alcaldía conoció el reporte de la Comisión de Obras Municipales (dictamen D-COM-0103-2021, sesión nro. 3 de 29 de marzo 2021) emitido “con la finalidad de reivindicar a nombre de esta Municipalidad las 80 hectáreas que actualmente están a nombre de privados, terrenos que deben ser públicos como lo indica el 05-3 artículo 40 de la Ley de Planificación Urbana”. Además, mediante oficio nro. DGJ-041-09-2021 de 29 de setiembre de 2021 la Dirección de Gestión Jurídica de la Municipalidad de Nicoya solicitó los antecedentes del caso al departamento de Control Constructivo; empero, ante la falta de documentación idónea se elevó el caso a la Comisión Técnica Urbanística, órgano colegiado que incorpora a los profesionales responsables de las áreas constructiva, planificación territorial, planificación urbana, gestión jurídica y catastral. Finalmente, se demostró que en el informe CTU 03-2023 del 28 de febrero de 2023 la Comisión Técnica Urbanística consignó las siguientes recomendaciones:
RECOMENDACIONES PRIMERA: De previo a solicitar al Registro Inmobiliario la inscripción de los predios descritos en el punto 7 del presente informe, se comisione a los Departamentos de Planificación Urbana, Control Constructivo y Ambiental hacer inspección in situ para determinar las condiciones de tales terrenos, para que se determine técnicamente su aptitud para algunos de los fines establecidos en el ordinal 40 de citas, la posibilidad real que podría tener la Municipalidad para darle mantenimiento, asegurar el uso deseado y hacer un balance costo-beneficio de inscribir esos inmuebles a su nombre. SEGUNDA: Recibido el informe señalado, determinar si procede la gestión ante el RIM o más bien concertar con la ACN un plan conjunto de administración y explotación de tales áreas”.
Consideraciones En el presente asunto hay un elemento que no puede obviarse y es que, tal y como consta en el escrito de interposición y en la resolución de curso, la parte recurrente lo que acusa es una omisión por parte de la alcaldía recurrida en atender lo ordenado por el Concejo de Nicoya. Consecuentemente, lo que se pretende es que se ordene al alcalde municipal de Nicoya a ejecutar el acuerdo nro. 18-046-2021 tomado por el concejo en la sesión ordinaria nro. 46 celebrada el martes 16 de marzo de 2021 sobre las zonas verdes del “Proyecto Americano” ubicado en Nosara, así como lo dispuesto en el reporte de la Comisión de Obras Municipales (dictamen D-COM-0103-2021, sesión nro. 3 de 29 de marzo 2021) tendiente a reivindicar a nombre de la municipalidad las ochenta hectáreas que actualmente están a nombre de privados, y que indica que tales terrenos deben ser públicos.
Del atento examen del escrito de interposición se puede advertir que el recurrente no explica en qué sentido dicha omisión lesiona algún derecho fundamental. Más bien parece venir en defensa de la legalidad. No obstante, invocando el principio iura novit curia, esta Sala podría afirmar que el tema incide en el derecho a un ambiente sano y ecológicamente equilibrado.
En esa línea de ideas, aunque comprendo la gravedad de los hechos denunciados por el accionante, y las posibles consecuencias nocivas que ello pudiese estar generando en la protección del medio ambiente del cantón de Nicoya, no puede dejarse de lado que esta Sala Constitucional no tiene competencia para ordenar la ejecución acuerdos municipales. Por ejemplo, en la sentencia 2021-5701 de las 09:15 horas del 19 de marzo de 2021 resolvió:
“Nombre03.- Por otro lado, el promovente acusa que en el oficio No. DAUHTPCOSR-0409-2018 del 12 de diciembre de 2018, la Unidad Hidrológica Tárcoles-Pacífico Central-San Ramón- del Ministerio de Ambiente y Energía le concedió un plazo de 8 días hábiles a la Municipalidad de Grecia para que indicara si el Mercado Municipal contaba con servicio de alcantarillado sanitario y, de ser así, señalara las coordenadas de ubicación de la planta de tratamiento de esas aguas. Sobre el particular, el gobierno local recurrido informó que actualmente existe un Plan Maestro del Mercado denominado "Proyecto. REMODELACIÓN DEL MERCADO MUNICIPAL BAJO LOS PRINCIPIOS DEL DISEÑO SOSTENIBLE" con planos, especificaciones técnicas, presupuesto y etapas de ejecución, las dos primeras ya fueron ejecutadas con una inversión de 100 millones de colones, quedando pendiente la última etapa de intervención de las instalaciones mecánicas, en trámite para su formulación y materialización.
No obstante, subrayaron que la Administración del mercado lleva años acumulando superávit que le permita llegar al monto requerido para poder ejecutar la última etapa del proyecto y dar una solución definitiva, siendo que, al día de rendido el informe, todavía no se cuenta con la totalidad de los montos requeridos y por eso no han iniciado. Al respecto, advierte la Sala que si el recurrente considera que el gobierno local recurrido ha omitido cumplir con lo dispuesto por la Unidad Hidrológica Tárcoles-Pacífico Central-San Ramón- del Ministerio de Ambiente y Energía, ello en el fondo constituye una queja que no compete ventilarse ante esta Jurisdicción, toda vez que la investigación y posterior amonestación -si fuera el caso- a una autoridad pública que no ha cumplido con las funciones que la propia ley le asigna, compete a otras instancias judiciales (la penal) o administrativas, por lo que deberán plantear su inconformidad ante la propia Municipalidad de Grecia, o bien, denunciar el hecho por incumplimiento de deberes”. (El destacado no es del original).
Igualmente, en la sentencia 2025-4619 de las 09:20 horas del 14 de febrero de 2025 dijo, en lo medular, lo siguiente:
“.- OBJETO DEL RECURSO. El recurrente manifiesta que la Junta Vial Cantonal, no transmite sus sesiones en vivo, pese que el Concejo Municipal les ordenó hacerlo. Considera lesionado el principio de publicidad.

Sobre el particular, advierte la Sala que si el recurrente considera que la Junta Vial ha omitido cumplir con lo dispuesto por el Concejo Municipal en el acuerdo referido, ello en el fondo constituye una queja que no compete ventilarse ante esta Jurisdicción, toda vez que la investigación y posterior amonestación -si fuera el caso- a una autoridad pública que no ha cumplido con las funciones que la propia ley le asigna, compete a otras instancias judiciales (la penal) o administrativas, por lo que deberán plantear su inconformidad ante la propia Municipalidad de Los Chiles, o bien, denunciar el hecho por incumplimiento de deberes”.
Aunado a lo anterior, considero que la omisión acusada por el recurrente constituye una queja que tampoco compete ventilarse ante esta jurisdicción constitucional, debido a que la investigación y posterior amonestación –si fuera el caso– a una autoridad pública que no ha cumplido con las funciones que la propia ley le asigna, compete a otras instancias judiciales (la penal) o administrativas, de manera que deberá plantear su inconformidad ante la propia Municipalidad de Nicoya o bien denunciar el hecho por incumplimiento de deberes. Así lo ha señalado la Sala, tal como consta en los precedentes recién transcritos. Además, sobre este apartado, adviértase que la alcaldesa a.i. de la Municipalidad de Nicoya subrayó lo siguiente:
“Tengo información informal que señala la posible existencia de causas penales contra algunas personas relacionadas con tal proyecto, ignorando el estado de tales causas (…) Este es un asunto complejo que se discute en la vía penal y, de existir alguna inconformidad, esta debe dilucidarse en las vías legales correspondientes, no en la vía constitucional”.
Es decir, que las presuntas omisiones acusadas ya están siendo conocidas en sede penal.
Ahora bien, pese a que observo que en el presente recurso este Tribunal no está ordenando de manera expresa al gobierno local recurrido que ejecute los acuerdos en cuestión, no menos cierto es que está acogiendo la petición de la parte accionante de que se ejecuten esos acuerdos. Adviértase que en la parte dispositiva ordena definir desde el punto de vista técnico la situación jurídica de los bienes inmuebles que se reputan como demaniales, actualizar el estado en el que se encuentran dichos bienes, interponer tanto en el ámbito administrativo como en el judicial (según corresponda) las acciones necesarias para garantizar el resguardo del interés público y ambiental de los bienes cuya demanialidad deba ser reconocida, y ejecutar la reivindicación de esos bienes en los casos en los que se determine alguna irregularidad en cuanto a su titularidad. Sin embargo, estimo que todo eso es propio de ser conocido y ejecutado en la sede contencioso-administrativo, en virtud de la gran complejidad que entraña.
En efecto, ciertamente la protección del ambiente es un tema que resulta de relevancia constitucional y, en principio, esta Sala es competente para conocer de lesiones contra el artículo 50 de la Constitución Política. Incluso, en concordancia con lo resuelto en este expediente, en reiterada jurisprudencia ha señalado que las municipalidades tienen la obligación de tutelar lo referente a la protección del ambiente –verbigracia la sentencia 2007-017552 de las 12:22 horas de 30 de noviembre de 2007–. Pero eso no significa que todo asunto relativo a un derecho fundamental –tampoco si se trata del derecho a un ambiente sano y ecológicamente equilibrado– es per se susceptible de ser ventilado en un proceso sumario. Esto mucho menos cuando el conocimiento de las presuntas infracciones y de la ejecución de las órdenes exigirían la integración procesal de diversas instituciones, por ejemplo: Procuraduría General de la República, Instituto Costarricense de Turismo, Instituto Nacional de Vivienda y Urbanismo, Instituto Geográfico Nacional, Contraloría General de la República, etc.
Lo que aquí sostengo –la pertinencia de que esto no sea residenciado en esta sede, mediante un proceso sumario como el recurso de amparo– resulta incluso más garantista para las partes intervinientes, pues en la jurisdicción ordinaria se contaría con una fase probatoria más amplia y con la posibilidad de echar mano de una robusta justicia cautelar, que en este caso podría ser especialmente útil. Esta línea de votación la he explicado en muchas ocasiones (por ejemplo, nota a la sentencia 2022-9857, sentencia 2022-17490, voto salvado a 2023-11233).
A esto se le debe sumar que en la etapa de ejecución de sentencia aquella jurisdicción tiene mayores herramientas para fiscalizar apropiadamente la orden que se haya dictado, de conformidad con el art. 155 y siguientes del Código Procesal Contencioso-Administrativo, lo que tendría evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc.
Conclusión
En síntesis, pese a que soy consciente de la seriedad de las denuncias relativas a las presuntas conductas por parte de la municipalidad recurrida, estimo que en el caso de marras estamos frente a un alegato sobre la falta de ejecución de unos acuerdos del Concejo de Nicoya, y el objeto mismo que subyace en esta litis –tanto para su conocimiento como para su ejecución– excede con mucho a lo que es lo propio de un recurso de amparo. Además, se informa que sobre esto ya hay investigaciones penales en curso. Por eso considero que lo correspondiente es que los distintos extremos se tramiten y resuelvan en otras sedes con la celeridad que amerita e, incluso, con la posibilidad de solicitar y aplicar medidas cautelares –tal y como lo requiere el propio recurrente–. En atención tales argumentaciones, salvo el voto y declaro sin lugar el recurso.
