Non-compliance with ruling on environmental and health complaint regarding Puntarenas streamsInejecución de sentencia sobre denuncia ambiental y sanitaria en quebradas de Puntarenas

Type of matter: Amparo action (Recurso de amparo) Ruling with protected data, in accordance with current regulations SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at thirteen hours ten minutes on the twentieth of August, two thousand twenty-five.

A judgment enforcement proceeding (Gestión de inejecución de sentencia) processed within the amparo action (Recurso de amparo) under expediente number 25-008866-0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE PUNTARENAS AND THE MINISTERIO DE SALUD.

RESULTANDO:

1. 1By means of a brief filed in the Secretariat of the Sala at 13:27 on July 29, 2025, the petitioner alleges disobedience to what was ordered by this Sala in resolution No. 2025-017101 at 10:15 on June 6, 2025, given that in that judgment the following was ordered: “The amparo action is granted. Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Desarrollo Territorial y Urbano, both of the Municipalidad de Puntarenas, or those holding those positions, are ordered to take the appropriate measures and coordination actions deemed necessary, within the scope of their competence, so that within a period of ONE MONTH following the notification of this judgment, the complaint filed by the plaintiff before said municipality on August 13, 2024, is definitively resolved. Likewise, Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Área Rectora de Salud de Barranca, or those holding those positions, are ordered to take the appropriate measures and coordination actions deemed necessary, within the scope of their competence, so that within a period of ONE MONTH following the notification of this judgment, the complaint filed by the amparo petitioner before said governing health area on November 15, 2024 -within the procedure for which sanitary order (orden sanitaria) No. 231-PRSB-2024 was issued- is definitively resolved.Furthermore, within the same period, the petitioner must be notified of the resolution. (…)”. Despite the foregoing, she alleges that the respondent authorities have not complied with what was ordered.
2. 2By resolution at 15:36 on July 31, 2025, the present disobedience proceeding was transferred for a response.
3. 3By means of a document incorporated into the Legal System on August 7, 2025, Jimmy Mauricio Méndez Vargas, director of the Área Rectora de Salud de Barranca, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, Área Rectora de Salud Barranca, both of the Dirección Regional Rectoría de la Salud Pacífico Central, report that: “within the period granted in the resolution of the Sala Constitucional, issued at 15:36 on July 31, 2025, we appear before the Honorable Sala Constitucional to render the required legal report regarding the accusation of disobedience to what was ordered by this Sala, through resolution No. 2025-017101 at 10:15 on June 6, 2025. Having stated the foregoing, we address the accusation of disobedience. (…) TENTH: On July 9, 2025, document CARTA-MS-DRRSPC-DARSB-294-2025 was notified by email to Mrs. [Name 001], describing the actions taken by this Área Rectora de Salud, as well as a copy of Technical Report MS-DRRSPC-DARSB-IT-746-2025, which includes the Work Plan that will provide a solution to the reported problem.ELEVENTH: On July 10, 2025, Technical Report MS-DRRSPC-DARSB-IT-753-2025 was prepared, setting forth the findings identified during the inspection of the reported streams and the follow-up on the agreements reached by the Municipalidad de Puntarenas, which were: * Accumulation of weeds and vegetation obstructing the channel in other sectors different from those initially inspected. * Accumulation of solid waste. * Cleanup of the clandestine dump diagonally across from the Paca Loca establishment and cleanup of the stretch from the bridge diagonally across from the CTP Puntarenas to the bridge located next to Panadería Elizondo in El Progreso. * Clearing of vegetation from the sector where the streams meet. Likewise, other points along the streams requiring intervention were identified. The inspected points correspond to: 1. Point 1. Bridge next to Panadería Elizondo in El Progreso. 2. Point 2.Bridge 50 meters west of the multi-use court in El Progreso. 3. Point 3. Bridge diagonally across from the Chante de Fanny establishment, in the Las Parcelas sector. 4. Point 4. From the bridge located 25 meters east of the old synthetic court Los Conejos, in the Las Parcelas sector 100 meters south. 5. Point 5. Stretch of the stream starting next to the Empresarios Unidos bus terminal to the locality of Fiestas del Mar. Furthermore, an accumulation of waste on public roads was identified in two sectors near the stream bank, making their removal of interest, as this waste ends up being swept into the water bodies. 1. Dump 1. Bridge 50 meters west of the multi-use court in El Progreso. 2. Dump 2. In front of the 4x3 bus company depot on Boulevard. Pursuant to Article 8 of the Ley para la Gestión Integral de Residuos No. 8839, it is recommended to issue a sanitary order (ordenamiento sanitario) to the Municipalidad de Puntarenas to address the identified findings.TWELFTH: That on July 10, 2025, sanitary order (ordenamiento sanitario) No. 099-PRSB-2025 was electronically notified to Mr. Randall Chavarría Matarrita, Mayor of the Municipalidad de Puntarenas, instructing him to: “1. Carry out vegetation clearing and removal of accumulated solid waste in the following sectors of the Bomba Vieja stream and another stream joining it as described in Technical Report MS-DRRSPC-DARSB-IT-753-2025: a. Point 1. Bridge next to Panadería Elizondo in El Progreso. b. Point 2. Bridge 50 m west of the multi-use court in El Progreso. c. Point 3. Bridge diagonally across from the Chante de Fanny establishment, in the Las Parcelas sector. d. Point 4. From the bridge located 25 m east of the old synthetic court Los Conejos, in the Las Parcelas sector 100 m south. e. Point 5. Stretch of the stream starting next to the Empresarios Unidos bus terminal to the locality of Fiestas del Mar. 2.Carry out cleanup and collection of solid waste from the dumps identified and described in Technical Report MS-DRRSPC-DARSB-IT-753-2025: a) Dump 1. Bridge 50 m west of the multi-use court in El Progreso. b) Dump 2. In front of the 4x3 bus company depot on Boulevard. 3. Adequately and sanitarily dispose of all waste collected as indicated in the preceding points. Ordered for the purpose of safeguarding the health of the population.” From the foregoing, it is clear that this health representation has acted at all times with diligence and coordination within the scope of the competencies corresponding to the officials of this Ministry, technically resolving the complaint through the preparation of a Work Plan and on-site inspections, and also notifying Mrs. [Name 001] of the actions to resolve the situation described in complaint No. 5026-24, within the statutory period; however, given the complexity of the problem and the need for inter-institutional coordination, it is essential that the case be addressed comprehensively, which has been duly documented.Thus, we consider that this Ministry has not disobeyed what was ordered by this Honorable Sala Constitucional in resolution No. 2025-017101 at 10:15 on June 6, 2025. IV. PETITION. By virtue of the foregoing, we respectfully request that this Honorable Constitutional Court dismiss the complaint for disobedience to what was ordered by this Sala through resolution No. 2025-017101 at 10:15 on June 6, 2025, as this Área Rectora de Salud has indeed complied with what was ordered; we therefore respectfully reiterate the request that THE SUBSCRIBED BE EXEMPTED FROM ALL RESPONSIBILITY AND THAT THIS AMPARO ACTION BE DISMISSED”.
4. 4By document submitted on August 14, 2025, Randall Alexis Chavarría Matarrita, mayor of Puntarenas, reports that: “By official letter No. MP-DDTU-OF-0254-U3-2025 dated August 13, 2025, the Unidad de Desarrollo Territorial y Urbano of the Municipalidad de Puntarenas, on August 13 of the current year at 13:36, notified Mrs. [Name 001] of a detailed report for the purpose of clarifying and expanding upon official letter MP-DDTU-OF-382-11-2024 dated November 19, 2024, from the Unidad de Desarrollo Territorial y Urbano, on points that inform the amparo petitioner on aspects of legality in the proceedings and the competencies of the different Institutions that are part of the process subject to the Amparo. Official letter MP-DDTU-OF-0254-08-2025 dated August 13, 2025, from the Unidad de Desarrollo Territorial y Urbano of the Municipalidad de Puntarenas is attached. Said letter explains the process carried out and the pending actions to be performed, among them, the process of requesting intervention for an undeclared emergency before the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, which will last the remainder of 2025 -as they must request the respective intervention- to then restart the process.”
5. 5In the proceedings followed, the legal requirements have been observed.

Drafted by Judge Hess Herrera; and,

CONSIDERANDO:

Sole: The petitioner comes before this Constitutional Court alleging disobedience to the provisions of vote No. 2025-017101 at 10:15 on June 6, 2025, given that in that judgment the following was ordered: “The amparo action is granted. Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Desarrollo Territorial y Urbano, both of the Municipalidad de Puntarenas, or those holding those positions, are ordered to take the appropriate measures and coordination actions deemed necessary, within the scope of their competence, so that within a period of ONE MONTH following the notification of this judgment, the complaint filed by the plaintiff before said municipality on August 13, 2024, is definitively resolved. Likewise, Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Área Rectora de Salud de Barranca, or those holding those positions, are ordered to take the appropriate measures and coordination actions deemed necessary, within the scope of their competence, so that within a period of ONE MONTH following the notification of this judgment, the complaint filed by the amparo petitioner before said governing health area on November 15, 2024 -within the procedure for which sanitary order (orden sanitaria) No. 231-PRSB-2024 was issued- is definitively resolved.

Furthermore, within the same period, the petitioner must be notified of the resolution. (…)”. In this regard, Randall Alexis Chavarría Matarrita, mayor of Puntarenas, reported that according to official letter No. MP-DDTU-OF-0254-U3-2025 dated August 13, 2025, the Unidad de Desarrollo Territorial y Urbano of the Municipalidad de Puntarenas explained the process carried out and the pending actions to be performed, among them, the process of requesting intervention for an undeclared emergency before the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, which will last the remainder of 2025 -as they must request the respective intervention- to then restart the process. For their part, Jimmy Mauricio Méndez Vargas, director of the Área Rectora de Salud de Barranca, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, Área Rectora de Salud Barranca, both of the Dirección Regional Rectoría de la Salud Pacífico Central, indicated that they issued sanitary order (orden sanitaria) No. 099-PRSB-2025 of July 10, 2025, in which the respondent mayor was ordered to carry out a series of works in the area under discussion; however, there is no record of the follow-up performed on said administrative order, much less that the amparo petitioner was notified of the actions taken.

As a consequence of the foregoing, it is considered accredited that the cited judgment was not fully complied with by the respondents within the stipulated period, and upon being granted a hearing regarding this enforcement proceeding, they acknowledge the non-compliance with what was ordered and promise to carry out the outstanding actions. Consequently, Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Desarrollo Territorial y Urbano, both of the Municipalidad de Puntarenas, as well as Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Área Rectora de Salud de Barranca, or those who in their stead hold said positions, are reiterated to proceed with immediate compliance with what was faithfully ordered in Judgment number 2025-017101 at 10:15 on June 6, 2025, under the warning that testimony of documents -in the case of the mayor- and the opening of an administrative proceeding against them if they fail to do so -in the case of the other respondents- will be ordered. They must provide evidence demonstrating said compliance with what was ordered.

POR TANTO:

Randall Alexis Chavarría Matarrita, mayor, and Mauricio Gutiérrez Villafuerte, director of Desarrollo Territorial y Urbano, both of the Municipalidad de Puntarenas, as well as Jimmy Mauricio Méndez Vargas, director, and German Enrique Madrigal Duarte, environmental manager of the Health Regulation Process, both of the Área Rectora de Salud de Barranca, or those who in their stead hold said positions, are reiterated to proceed with immediate compliance with what was faithfully ordered in Judgment number 2025-017101 at 10:15 on June 6, 2025, under the warning that testimony of documents -in the case of the mayor- and the opening of an administrative proceeding against them if they fail to do so -in the case of the other respondents- will be ordered. Notify the respondents personally.

Sentencia con datos protegidos, de conformidad con la normativa vigente SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas diez minutos del veinte de agosto de dos mil veinticinco .

Gestión de inejecución de sentencia que se tramita dentro del recurso de amparo con expediente número 25-008866-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE PUNTARENAS Y EL MINISTERIO DE SALUD.

RESULTANDO:

1. 1Mediante memorial presentado en la Secretaría de la Sala a las 13:27 horas del 29 de julio de 2025, en donde el recurrente acusa desobediencia a lo ordenado por esta Sala en la resolución Nº 2025-017101 de las 10:15 horas del 6 de junio de 2025, toda vez que en esa sentencia se dispuso lo siguiente: “Se declara con lugar el recurso. Se ordena a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la accionante ante dicho municipio el 13 de agosto de 2024. A su vez se ordena a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la amparada ante dicha área rectora el 15 de noviembre de 2024 -dentro del trámite de la cual se dictó la orden sanitaria N°231-PRSB-2024-. A su vez, en el mismo plazo se le deberá comunicar a la recurrente lo resuelto. (…)”. Pese a lo expuesto, acusa que las autoridades accionadas no han cumplido con lo ordenado.
2. 2Mediante resolución de las 15:36 horas del 31 de julio de 2025, se dio traslado a la presente gestión de desobediencia.
3. 3Mediante escrito incorporado al Sistema Jurídico el 7 de agosto de 2025, Jimmy Mauricio Méndez Vargas, director del Área Rectora de Salud de Barranca y German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, Área Rectora de Salud Barranca, ambos de la Dirección Regional Rectoría de la Salud Pacífico Central, informan que: “dentro del plazo conferido en resolución de la Sala Constitucional, dictada a las 15:36 horas del 31 de julio del 2025, nos apersonamos ante la Honorable Sala Constitucional con el objeto de rendir el informe de ley solicitado, en relación con el acuse por desobediencia a lo ordenado por esa Sala, mediante la resolución N° 2025-017101 de las 10:15 horas del 6 de junio de 2025. Una vez expuesto lo anterior, nos referimos al acuse de desobediencia. (…) DÉCIMO: El día 09 de julio del 2025, se notifica por correo electrónico el documento CARTA-MS-DRRSPC-DARSB-294-2025 a la señora [Nombre 001], donde se describen las actuaciones por parte de esta Área Rectora de Salud, así como también copia del Informe Técnico MS-DRRSPC-DARSB-IT-746-2025, donde se incluye el Plan de Trabajo que dará una solución a la problemática denunciada.DÉCIMO PRIMERO: El día 10 de julio del 2025, se procede a la elaboración del informe técnico MS-DRRSPC-DARSB-IT-753-2025, donde se expone los hallazgos identificados sobre la inspección en las quebradas denunciadas y el seguimiento a los acuerdos adquiridos por la Municipalidad de Puntarenas, los cuales fueron: * Acumulación de maleza y vegetación que obstruye el canal en otros sectores diferentes a los inspeccionados inicialmente. * Acumulación de residuos sólidos. * Limpieza del botadero clandestino diagonal al establecimiento Paca Loca y limpieza del tramo del puente diagonal al CTP Puntarenas hasta el puente ubicado a un costado de la Panadería Elizondo en El Progreso. * Limpieza de vegetación del sector donde se unen las quebradas. Asimismo, se identificaron otros puntos de las quebradas que requieren ser intervenidos. Los puntos inspeccionados corresponden: 1. Punto 1. Puente a un costado de la Panadería Elizondo en El Progreso. 2.Punto 2. Puente 50 metros oeste de la cancha multiuso de El Progreso. 3. Punto 3. Puente diagonal al establecimiento Chante de Fanny, en el sector de Las Parcelas. 4. Punto 4. Del puente ubicado a 25 metros este de antigua cancha sintética Los Conejos, en el sector de Las Parcelas 100 metros sur. 5. Punto 5. Tramo de la quebrada iniciando a un costado de la terminal de buses de empresarios unidos hasta la localidad Fiestas del Mar. Se identificó, además, acumulación de residuos sobre la vía pública en dos sectores cerca del margen de la quebrada, por lo que resulta de interés eliminarlos, ya que estos residuos terminan siendo arrastrados en los cuerpos de agua. 1. Botadero 1. Puente 50 metros oeste de la cancha multiuso de El Progreso. 2. Botadero 2. Frente al plantel de la empresa de buses 4x3 en Boulevard. Según lo dispuesto en el artículo 8 de la Ley para la Gestión Integral de Residuos N°8839, se recomienda emitir ordenamiento sanitario a la Municipalidad de Puntarenas para la atención de los hallazgos identificados.DUODÉCIMO: Que el día 10 de julio del 2025, se notifica de forma electrónica el ordenamiento sanitario N°099-PRSB-2025, al señor Randall Chavarría Matarrita, Alcalde de la Municipalidad de Puntarenas, en el que se le indica: “1. Efectuar labores de limpieza de vegetación y remoción de residuos sólidos acumulados en los siguientes sectores de la quebrada Bomba Vieja y otra que se une a esta descritos en el Informe Técnico MS-DRRSPC-DARSB-IT-753-2025: a. Punto 1. Puente a un costado de la Panadería Elizondo en El Progreso. b. Punto 2. Puente 50 m oeste de la cancha multiuso de El Progreso. c. Punto 3. Puente diagonal al establecimiento Chante de Fanny, en el sector de Las Parcelas. d. Punto 4. Del puente ubicado a 25 m este de antigua cancha sintética Los Conejos, en el sector de Las Parcelas 100 m sur. e. Punto 5. Tramo de la quebrada iniciando a un costado de la terminal de buses de empresarios unidos hasta la localidad Fiestas del Mar. 2.Efectuar labores de limpieza y recolección de residuos sólidos de los botaderos identificados y descritos en el Informe Técnico MS-DRRSPC-DARSB-IT-753-2025: a) Botadero 1. Puente 50 m oeste de la cancha multiuso de El Progreso. b) Botadero 2. Frente al plantel de la empresa de buses 4x3 en Boulevard. 3. Disponer adecuada y sanitariamente la totalidad de los residuos recolectados indicados en los puntos anteriores. Se ordena con el fin de salvaguardar la salud de la población.” De todo lo anterior se desprende que, esta representación de salud ha actuado en todo momento con diligencia y coordinación dentro del ámbito de las competencias que corresponden a los funcionarios de este Ministerio, resolviendo técnicamente la denuncia a través de la elaboración de un Plan de Trabajo e inspecciones en el sitio denunciado, así como también se ha comunicado a la señora [Nombre 001], las acciones para resolver la situación expuesta mediante la denuncia N°5026-24, dentro del plazo de ley conferido; no obstante, dada la complejidad de la problemática, y la necesidad de una coordinación interinstitucional hacen imprescindible que el caso sea atendido de forma integral, lo cual ha sido debidamente documentado.Así las cosas, consideramos que este Ministerio no ha desobedecido lo ordenado por esa Honorable Sala Constitucional, en la resolución N° 2025-017101 de las 10:15 horas del 6 de junio de 2025. IV. PETITORIA. En virtud de lo expuesto, respetuosamente solicitamos a ese Honorable Tribunal Constitucional, declarar sin lugar la denuncia por desobediencia a lo ordenado por esa Sala, mediante la resolución N° 2025-017101 de las 10:15 horas del 6 de junio de 2025, por cuanto esta Área Rectora de Salud sí ha cumplido con lo ordenado; por lo que reiteramos, respetuosamente, la solicitud de que se EXIMA DE TODA RESPONSABILIDAD A LOS SUSCRITOS Y SE DECLARE SIN LUGAR EL PRESENTE RECURSO DE AMPARO”.
4. 4Mediante escrito aportado el 14 de agosto de 2025, Randall Alexis Chavarría Matarrita, alcalde de Puntarenas, informa que: “Mediante oficio No. MP-DDTU-OF-0254-U3-2025 de fecha 13 de agosto de 2025, la Unidad de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas, en fecha 13 de agosto de los corrientes al ser las 13:36 horas, le notifica a la señora [Nombre 001] un informe detallado para efectos de aclarar y ampliar el oficio MP-DDTU-OF-382-11-2024 de fecha 19 de noviembre de 2024 de la Unidad de Desarrollo TerritoriaI y Urbano, sobre puntos que vienen a informarle a la amparada aspectos de legalidad en los procedimientos, y las competencias de las diferentes Instituciones que son parte del proceso objeto del Amparo. Se adjunta el oficio MP-DDTU-OF-0254-08-2025 de fecha 13 de agosto de 2025, la Unidad de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas. En dicho oficio se explica el proceso llevado a cabo y las acciones pendientes a realizar, entre ellas, el proceso de solicitud de intervención por emergencia no declarada ante la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias el cual durará el resto del 2025 -pues deben solicitar la intervención respectiva-, para luego reiniciar el proceso”.
5. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

CONSIDERANDO:

Único: La recurrente acude a este Tribunal Constitucional aduciendo la desobediencia a lo dispuesto en el voto Nº 2025-017101 de las 10:15 horas del 6 de junio de 2025, toda vez que en esa sentencia se dispuso lo siguiente: “Se declara con lugar el recurso. Se ordena a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la accionante ante dicho municipio el 13 de agosto de 2024. A su vez se ordena a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes ocupen esos cargos, tomar las medidas correspondientes y las acciones de coordinación que se estimen, dentro del ámbito de su competencia, para que en el plazo de UN MES posterior a la notificación de esta sentencia, se resuelva de forma definitiva la denuncia presentada por la amparada ante dicha área rectora el 15 de noviembre de 2024 -dentro del trámite de la cual se dictó la orden sanitaria N°231-PRSB-2024-.

A su vez, en el mismo plazo se le deberá comunicar a la recurrente lo resuelto. (…)”. Al respecto, Randall Alexis Chavarría Matarrita, alcalde de Puntarenas, informó que según el oficio No. MP-DDTU-OF-0254-U3-2025 de fecha 13 de agosto de 2025, la Unidad de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas, explicó el proceso llevado a cabo y las acciones pendientes a realizar, entre ellas, el proceso de solicitud de intervención por emergencia no declarada ante la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias el cual durará el resto del 2025 -pues deben solicitar la intervención respectiva-, para luego reiniciar el proceso. Por su parte, Jimmy Mauricio Méndez Vargas, director del Área Rectora de Salud de Barranca y German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, Área Rectora de Salud Barranca, ambos de la Dirección Regional Rectoría de la Salud Pacífico Central, indicaron que emitieron la orden sanitaria N°099-PRSB-2025 del 10 de julio de 2025, en donde se le ordenó al alcalde accionado realizar una serie de obras en la zona en discusión; sin embargo, no consta el seguimiento efectuado a dicha orden administrativa, ni menos aún, que se le haya notificado a la parte amparada sobre lo actuado.

Como consecuencia de lo expuesto, se tiene por acreditado que la sentencia citada no fue cumplida a cabalidad por los accionados en el plazo previsto, y al concedérseles audiencia en razón de esta gestión de desobediencia, reconocen el incumplimiento de lo ordenado y prometen realizar las acciones faltantes. En consecuencia, se le reitera a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, así como a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes en su lugar ocupen dichos cargos, que procedan al cumplimiento inmediato de lo fielmente dispuesto en la Sentencia número 2025-017101 de las 10:15 horas del 6 de junio de 2025, bajo la advertencia de ordenarse el testimonio de piezas -en el caso del alcalde- y la apertura de un procedimiento administrativo en su contra si no lo hicieren -en el caso de los otros recurridos-. Deberán aportar prueba que demuestre dicho cumplimiento de lo ordenado.

POR TANTO:

Se le reitera a Randall Alexis Chavarría Matarrita, alcalde y a Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano, ambos de la Municipalidad de Puntarenas, así como a Jimmy Mauricio Méndez Vargas, director y a German Enrique Madrigal Duarte, gestor ambiental del Proceso de Regulación de la Salud, ambos del Área Rectora de Salud de Barranca, o a quienes en su lugar ocupen dichos cargos, que procedan al cumplimiento inmediato de lo fielmente dispuesto en la Sentencia número 2025-017101 de las 10:15 horas del 6 de junio de 2025, bajo la advertencia de ordenarse el testimonio de piezas -en el caso del alcalde- y la apertura de un procedimiento administrativo en su contra si no lo hicieren -en el caso de los otros recurridos-. Notifíquese a los accionados de forma personal.
