Decision No. 2025024090 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen on uno de agosto de dos mil veinticinco.

Writ of amparo (recurso de amparo) proceeding under expediente número No. 25-019161-0007-CO, filed by Nombre01, identity card CED01, against the ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO Y ALCANTARILLADO SANITARIO MATAPALO and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Findings:

  1. 1By a filing received by the Court on 1 de julio de 2025, the petitioner filed a writ of amparo against the ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO Y ALCANTARILLADO SANITARIO MATAPALO and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. The petitioner states that she is currently the owner of the property recorded in the Public Registry under the real-property folio system (sistema de folio real), registration no. , located in the district of Matapalo, province of Guanacaste, according to registered survey map (plano catastrado) no. , and that the property is intended for the eventual provision of service to a family housing project. She states that she needs to use the land in order to enjoy a stable quality of life because her health has been impaired by various medical conditions and surgical procedures. Additionally, she suffers from progressive blindness and deafness and therefore requires water availability and special care from relatives and other persons who oversee her treatments, medications, and transportation.She adds that she is currently the owner of the property recorded in the Public Registry, with title derived from property 5-00151355, located in Cabo Velas, canton 03 Santa Cruz, province of Guanacaste. She indicates that this lot is located 600 meters east of the Matapalo plaza, toward Huacas, on the main road at the entrance to Cabinas Marlova, Santa Cruz, Guanacaste, and is intended for the construction of a residence. She states that there are already lots within that housing project on which construction has taken place and for which the Asociación Administradora de Acueducto y Alcantarillado Sanitario -ASADA- Matapalo granted water service. She states that, on 26 de mayo de 2025, she was notified through ASADA official communication no. 603-2025 that, because the technical report (informe técnico) referenced in official communications nos. GSD-UEN-GAR-2020-0142, GSD-UEN-GAR2025-012554 and GSD-UEN-GAR-2025-013553 remained pending, it had been determined that potable water was unavailable because there was no flow capacity.She nevertheless complains that ASADA affords different treatment to other lots that do have that right, meaning that they do have potable-water availability. She asserts that this action seeks disclosure of the scope of the cited reports because they lack a factual basis. She complains that the decision is defective for lack of legal grounds and reasoning (fundamentación y motivación), because no rigorous technical arguments were provided. She contends that, if there is no flow capacity, there is no explanation for why the respondent ASADA is granting services in the same area for new applications, without any response having been provided to them to date. She maintains that the original application petitioned and requested the installation of water meters on the property she owns and that, to date, ASADA has not responded. For the foregoing reasons, she requests the Court’s intervention in this matter.
  2. 2By the decision issued at ten oh nine on cuatro de julio de dos mil veinticinco, this proceeding was admitted and a report was requested from Efraín Milanés Obando Álvarez, identity card CED02, in his capacity as president of the Asociación de Administradora del Acueducto y Alcantarillado Sanitario de Matapalo, Santa Cruz, Guanacaste, and the general manager of the Instituto Costarricense de Acueductos y Alcantarillados was ordered to submit a report,
  3. 3Alejandra Mora Segura, in her capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath as follows: “(…) FIRST: These are matters pertaining personally to the petitioner. SECOND: These are matters pertaining personally to the petitioner. THIRD: These are matters pertaining personally to the petitioner. FOURTH: This fact pertains personally to the petitioner and the Asada de Matapalo; nevertheless, according to report N° GSD-UEN-GAR-2025-02606 dated 08 de julio del 2025, issued by the Orac Región Chorotega, it must be stated that, regardless of whether services already exist in the area, if an Asada is in a condition of technical infeasibility (no factibilidad técnica), it may not issue positive service-availability certificates or grant permanent services unless the conditions that gave rise to the technical infeasibility change. It may be the case, as with the Asada de Matapalo, that services had been installed in the housing project where the petitioner owns her property before AyA provided notice of the Technical Infeasibility condition; however, it bears repeating that they were installed before the technical-infeasibility condition arose.FIFTH: This is denied as inaccurate. The petitioner is incorrect in stating that she was notified through ASADA sequential communication N° 603-2025 ‘that because TECHNICAL REPORT number GSDUEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553 was pending,’ she was informed that ‘THERE IS NO POTABLE-WATER AVAILABILITY BECAUSE THERE IS NO FLOW CAPACITY.’ It is not correct, however, that the technical reports are pending. To the contrary, the document issued by ASADA clearly states: ‘as a result of the technical report referenced in Official Communication,’ meaning that the respondent Asada is informing the applicant of the reasons why she was issued a negative availability certificate. As is evident, no technical report is pending; official communications GSDUEN-GAR-2020-014241; GSD-UEN-GAR-2025-01254 and GSD-UEN-GAR-2025- 01353 are documents setting out the system’s conditions and explaining why it lacks technical feasibility.(See annexes 2, 3 and 4 to memorandum N° GSDUEN-GAR-2025-02606 dated 08 de julio del 2025, issued by the Orac Región Chorotega. SIXTH: This is denied as inaccurate. It follows from the petitioner’s statements that her purpose is to use the writ-of-amparo proceeding to learn the scope of the reports referenced in the service-unavailability certificate, but she did not request that information from the Asada de Matapalo or AyA, and the constitutional proceeding is not the proper avenue for obtaining the requested relief. In other words, the petitioner filed a writ of amparo in order to learn the scope of reports GSD-UEN-GAR-2020-014241; GSD-UEN-GAR-2025- 01254 and GSD-UEN-GAR-2025-01353 without first pursuing a request before the respondent Asada; therefore, no constitutional right has been violated. SEVENTH: This is denied as inaccurate. The evidence submitted by the petitioner does not show that she filed an application with the Asada de Matapalo or AyA and submitted the requirements for the installation of permanent service, as established by sections 15, 67 and 68 of the Reglamento para la prestación de los servicios del AyA.Accordingly, there is no application pending resolution in that regard, nor any petition awaiting action by AyA or ASADA. The evidence contained in the digital case file and submitted by the claimant shows an application for service availability, received by the Asada de Matapalo on 12 de mayo del 2025, which was addressed through ASADA Sequential Communication: No. 603-2025 dated 26 de mayo del 2025, a document that the petitioner likewise did not challenge. It is clear that the claimant confuses the procedure for requesting a service-availability certificate with the installation of permanent service. It is clarified, however, that the only procedure evidenced by the submitted materials as having been initiated by the applicant before the Asada de Matapalo is her request for a service-availability certificate, which was addressed within the prescribed period by the delegated operator (…)”. On the foregoing grounds, she requests that the writ be denied.
  4. 4By a filing added to the electronic case file on 10 de julio del 2025, Efraín Milanés Obando Álvarez, in his capacity as Judicial and Extrajudicial Attorney-in-Fact (Apoderado Judicial y Extrajudicial) of the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, states as follows: “(…) SOLE FACT: It is true that a water-unavailability certificate bearing sequential number 603-2025 was issued for the property Dirección01, located in the district of Matapalo, Province of Guanacaste, according to registered survey map number 5-1944058-2016. 201619-1913350. The ASADAS are required to comply with the provisions and directives issued by AyA as the governing authority for the provision of water-supply and sewerage services, as established by section 28(a) of the Reglamento de ASADAS. On 26 de mayo 2025, the Service-Unavailability certificate was issued, denying the request for water availability on the basis of official communications GSD-UEN-GAR-2020-01424 No. GSD-UEN-GAR-2025-01254, No. Geo-UEN-GAR~2IJ-25-01353.This study determined that there is no technical feasibility, meaning that there is no available water flow capacity. It must be noted that A3-IA is the technical governing authority of the ASADAS, which are required to comply with the regulations, 1516 at 18:36 hours on 26 de enero de 2010, as well as judgment 2015-8177 at 10:05 hours on 05 de junio de 201 5). In this specific case, there is a technical or material impossibility because of the reasons stated by the respondent authority (lack of infrastructure and serious water-resource constraints in that area). Based on all the foregoing, because the denial was neither capricious nor arbitrary and technical criteria exist to support it, this amparo must be dismissed. (…) REGARDING THE PETITIONER’S SPECIFIC REQUEST: For AyA or an ASADA to issue a service-availability certificate and grant water availability, it must have technical feasibility, as required by article T subsection 12 of the Reglamento para la prestación de los servicios del AyA, which states: ‘Technical-feasibility analysis for granting services: The process of verifying the actual and present existence of sufficient water, hydraulic, material, technical, legal, and environmental resources to grant availability and the eventual service connection.For these purposes, the following conditions must be observed: a. The distribution and collection networks must run along the boundaries of the property, or the property for which service is requested must have direct access by means of a public road or right-of-way easement (servidumbre de paso). b. The systems must have sufficient water, hydraulic, treatment, and purification capacity to grant new services. c. The system must meet the established quality attributes. d. It must comply with the applicable environmental regulations. In the present case, the ASADA de Matapalo lacks the conditions necessary to accommodate maximum development growth because the technical and legal feasibility conditions do not exist pursuant to article 7 subsections: 12, 20, 21, 49 and 129 3-f ordinals s, 9, 10 and 14 of the currently effective Reglamento de Prestación de Servicios,’ all in furtherance of the public interest.The ASADA de Matapalo currently lacks the technical feasibility to issue potable-water service-availability certificates or install permanent service (…)”. On the foregoing grounds, he requests that the writ be denied.
  5. 5The statutory requirements have been observed in the conduct of the proceeding.

Justice Cruz Castro authors the opinion; and,

Considering:

I. PRELIMINARY ISSUE

In the case of amparo petitions (recursos de amparo) filed against private parties, before examining the merits of the alleged constitutional violation, it must be determined whether the case falls within any of the circumstances under which such a petition is allowed and, if so, whether it is admissible. Article 57 of the Ley de la Jurisdicción Constitucional provides that an amparo petition may be brought against the actions or omissions of private-law persons when they act or are required to act in the exercise of public functions or powers, or when they are, as a matter of law or fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms referred to in Article 2(a) of that same Law. In this case, if the protected party’s claims are true, the respondent ASADA could be in a position of power because it provides a delegated public service, against which ordinary judicial remedies could be insufficient to protect the fundamental rights of the amparo petitioner; accordingly, the petition must be admitted for review by this Court.

II. SUBJECT MATTER OF THE PETITION. Subject matter

The petitioner alleges that she currently owns the property recorded in the Registro Público, whose prior record of title is property Dirección02, located in Cabo Velas, canton 03 Santa Cruz, province of Guanacaste, which is intended for the construction of a residence. She states that, on 26 de mayo de 2025, she was notified through ASADA official letter no. 603-2025 that, because the technical report contained in official letters nos. GSD-UEN-GAR-2020-0142, GSD-UEN-GAR2025-012554 and GSD-UEN-GAR-2025-013553 remained pending, it had been determined that potable water was unavailable because there was no flow capacity. However, she claims that ASADA treats other lots differently by granting them that right, meaning that they do have potable-water availability. She contends that this action is intended to ascertain the scope of the cited reports, since they lack a factual basis. She claims that the decision is defective for lack of grounds and reasoning because no rigorous technical arguments were presented.

She argues that, if there is no flow capacity, there is no explanation why the respondent ASADA is providing services in the same area for new applications, without any response having been provided to date. She maintains that the original application requested the installation of water meters for the property she owns and that, to date, ASADA has not responded. She therefore requests the Chamber’s intervention.

III. PROVEN FACTS

The following facts, which are relevant to the disposition of this matter, are deemed duly proven, either because they were established by the evidence or because the respondent failed to address them as ordered in the initial ruling:

  • a)The protected party owns the property recorded in the Registro Público under the real-property folio system, registration no. , located in the Matapalo district, province of Guanacaste, according to registered cadastral plan no. 5-1944058-2016- 201619-19035C, and intended for residential use (undisputed fact) b) The property is located in a residential development containing lots on which construction has already taken place and to which the Asociación Administradora de Acueducto y Alcantarillado Sanitario -ASADA- Matapalo has provided water service (undisputed fact) c) On 12 de mayo of the current year, the petitioner requested confirmation of the availability of potable-water service for her lot (reports submitted under oath) d) On 26 de mayo, the petitioner was notified of official letter No. 603-2025, which stated as follows: “(…) In response to your application for the availability of potable-water/sanitary-sewer service, submitted to this ASADA on 16 mayo 2025, concerning the single-family residential project to be located on the property bearing Real Property Folio registration number - located in the MATAPALO district, GUANACASTE, according to cadastral plan N° PLANO 5-1944058-2016- 2016-190350, for the potential provision, for the potential provision, of ONE SERVICE, I hereby inform you that, as a result of the technical report contained in Official Letter (GSD-UEN-GAR-2020-0142 , GSD-UEN-GAR-2025-01254; GSD-UEN-GAR-2025-01353 ), the following was determined: “POTABLE WATER IS UNAVAILABLE BECAUSE THERE IS NO FLOW CAPACITY (…)” (reports submitted under oath) e) The petitioner did not file any objection to the respondent ASADA’s decision f) The ASADA de Matapalo lacks the conditions for technical and legal feasibility (factibilidad técnica y legal) under Article 7, subsections: 12, 20, 21, 49 and 129 3-f, items s, 9, 10 and 14, of the current Reglamento de Prestación de Servicios, and also lacks the technical feasibility to issue certificates of potable-water service availability or to install a permanent service (reports submitted under oath)

IV. UNPROVEN FACTS

The following fact, which is relevant to the disposition of this matter, is deemed unproven:

  • a)That the amparo petitioner requested the installation of a permanent service and that such request remains pending (the case record) b) That the protected party requested from the respondents copies of reports numbers GSD-UEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553 (the case record)

V. THE SPECIFIC CASE

In the matter under review, the petitioner states that she applied to the respondent ASADA for confirmation of water availability. Her application, however, was denied. She alleges that some people have built homes in the development where her property is located and have been supplied with water, making the denial unjustified. In addition, her lot has the infrastructure required to receive the service.

After reviewing the case record, the Chamber found it proven that the protected party owns the lot bearing registration no. , located in the Matapalo district, province of Guanacaste, according to registered cadastral plan no. , and intended for residential use. On 12 de mayo de 2025, the amparo petitioner requested confirmation from the respondent ASADA of the availability of potable-water service for her lot. By official letter dated 26 de mayo de 2025, the respondent ASADA denied the application because it lacks the flow capacity required to meet the demand.

The Chamber has determined that denying potable-water service does not violate a person’s rights when technical impediments justify the denial:

“II.- The specific case. The evidence submitted includes a certificate of water unavailability dated 15 de julio de 2021, through which AyA notified the claimant that his application for potable-water availability to establish an individual service for an apartment located on his property had been denied. The denial was based on a lack of technical feasibility due to insufficient water resources and hydraulic capacity in the area’s supply system; consequently, potable-water service is unavailable for new development projects.

Accordingly, it has been established that the matter under consideration does not concern an arbitrary denial of potable-water service, because the denial was based on a lack of technical feasibility. In this regard, it should be noted that this Constitutional Court does not oversee the legality of the respondent authority’s actions or decisions, nor may it replace the active Administration in the exercise of its powers; it therefore cannot usurp the functions legally conferred on other offices, bodies, or entities, such as AyA. Nor does this Court act as a mediator before a particular natural or legal person—whether governed by public or private law—to intercede so that the petitioner may obtain what he seeks, which in this case is the installation of a new meter for the apartment he built for his daughter. If the petitioner disagrees with the reasons that justified AyA’s denial of the new meter, he must submit his grievances and claims through the ordinary legality proceedings (vía ordinaria de legalidad), where the legally appropriate determination may be made.” (Judgment no. 2021018977 at 11:50 on 24 de agosto de 2021).

The Chamber sees no reason to depart from the criterion quoted above. Indeed, the denial cannot be deemed unreasonable or arbitrary when it is based on a technical justification, which in this case is the aqueduct’s inadequate hydraulic capacity. The merits of this issue may be litigated through the ordinary legality proceedings.

Furthermore, there is no evidence of any pending application by the petitioner for the installation of a permanent service, nor is there evidence that she requested official letters Nos. GSD-UEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553 in order to ascertain the scope of the technical studies performed.

Moreover, there is no evidence establishing that discriminatory treatment occurred. The Chamber reiterates that such allegations must be accompanied by comparators that enable the Court to establish unequivocally that unequal treatment occurred:

“III.- REGARDING THE ALLEGED DISCRIMINATORY TREATMENT. Finally, the applicant should be advised that, to determine whether the provisions of Article 33 of the Constitución Política have been violated, a standard of equality must be established so that it can be determined whether he has received discriminatory treatment in comparison with persons in circumstances similar to his own. No such standard appears in the amparo petition, which prevents the Chamber from conducting a specific analysis of the facts because that essential basis is lacking. The allegation that this public service was installed for other property owners, unlike in his case, is unavailing, because it is necessary to provide the full names of the alleged comparators in the discrimination cases and explain how, despite being similarly situated, they were treated differently. Merely alleging a violation of Article 33 of the Constitución Política is insufficient when the challenged conduct does not specifically reveal what the violation consists of.

It bears emphasizing that the mere fact that potable-water service was granted to other property owners is not sufficient to presume that the same public service must be authorized in his case, since objective factors pertaining to each particular case must be evaluated, along with the various timing-related variables specific to each area or property that may justify a different decision.” (Judgment no. 2024030039 at 9:15 on 11 de octubre de 2024).

In view of the foregoing, the petition is denied.

VI. DOCUMENTATION SUBMITTED FOR THE CASE RECORD

The parties are advised that, if they submitted any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected within a maximum period of 30 business days from notice of this judgment. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del uno de agosto de dos mil veinticinco .

Recurso de amparo que se tramita en expediente número No. 25-019161-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO Y ALCANTARILLADO SANITARIO MATAPALO y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando:

  1. 1Por escrito recibido en la Sala el 1 de julio de 2025, el recurrente interpone un recurso de amparo contra la ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO Y ALCANTARILLADO SANITARIO MATAPALO y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta que actualmente la propietaria de la finca inscrita en el Registro Público bajo el sistema de folio real, matrícula nro. , localizada en el distrito Matapalo, provincia de Guanacaste, según plano catastrado nro. , es destinada para la eventual dotación de un servicio en un proyecto de vivienda familiar. Manifiesta que necesita hacer uso del terreno con el fin de tener una calidad de vida estable ya que sufre un quebranto de salud por diferentes patologías e intervenciones quirúrgicas. Adicionalmente, padece ceguera y sordera progresiva, por lo que requiere de la disponibilidad de agua y cuidados especiales por parte de familiares y personas que tutelen los tratamientos, medicamentos y traslados.Acota que actualmente es propietaria de la finca inscrita en el Registro Público, con antecedente de dominio de la finca 5-00151355, situada en Cabo Velas, cantón 03 Santa Cruz, provincia de Guanacaste. Indica que ese lote se ubica 600 metros al este de la plaza de Matapalo, hacia Huacas, sobre carretera principal, entrada a Cabinas Marlova, Santa Cruz, Guanacaste y está destinado para la construcción de una vivienda. Comenta que dentro de ese proyecto habitacional ya existen lotes en los cuales se construyó y la Asociación Administradora de Acueducto y Alcantarillado Sanitario -ASADA- Matapalo otorgó el servicio de agua. Señala que, el 26 de mayo de 2025, se le notificó mediante el oficio de la ASADA nro. 603-2025 que, por estar pendiente el informe técnico que consta en oficios nros. GSD-UEN-GAR-2020-0142, GSD-UEN-GAR2025-012554 y GSD-UEN-GAR-2025-013553, se determinó que no hay disponibilidad de agua potable por no haber caudal.Sin embargo, reclama que la ASADA concede trato diferenciado a otros lotes que sí cuentan con ese derecho, es decir, sí tienen disponibilidad de agua potable. Acusa que con esta acción se pretende conocer los alcances de los informes indicados ya que carecen de fundamentación fáctica. Reclama que existe vicio de falta de fundamentación y motivación dado que no se presentaron argumentos técnicos de rigor. Alega que, si no hay caudal, por qué razón en la misma zona sí se otorgan servicios por parte de la ASADA recurrida a formularios nuevos, sin que hasta la fecha se nos haya dado respuesta. Sostiene que mediante solicitud originaria se peticionó y solicitó la instalación de medidores de agua para la propiedad de la cual es titular y a la fecha no existe respuesta por parte de la ASADA. Por los motivos expuestos, solicita la intervención de la Sala en el presente asunto.
  2. 2Mediante la resolución de las diez horas nueve minutos del cuatro de julio de dos mil veinticinco, se dio curso a este proceso y se solicitó informe a Efraín Milanés Obando Álvarez, cédula de identidad CED02, en su condición de presidente de la Asociación de Administradora del Acueducto y Alcantarillado Sanitario de Matapalo, Santa Cruz, Guanacaste y rinda informe al gerente general del Instituto Costarricense de Acueductos y Alcantarillados,
  3. 3Informa bajo juramento, Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, en los siguientes términos: “(…) PRIMERO: Son hechos propios de la recurrente. SEGUNDO: Son hechos propios de la recurrente. TERCERO: Son hechos propios de la recurrente. CUARTO: Este hecho es propio de la recurrente y de la Asada de Matapalo, no obstante, según lo indicado en el informe N° GSD-UEN-GAR-2025-02606 de fecha 08 de julio del 2025, emitido por la Orac Región Chorotega, se debe indicar que indistintamente si ya existen servicios en el área, si una Asada se encuentra en una condición de no factibilidad técnica, no puede emitir constancias de disponibilidad de servicios positivas u otorgar servicios permanente, a menos que cambien las condiciones que originaron la no factibilidad técnica. Puede darse, como es el caso de la Asada de Matapalo, que previo a la notificación por parte del AyA de la condición de No Factibilidad Técnica, existieran servicios instalados en el proyecto habitacional donde la recurrente tiene su propiedad, pero se reitera, fueron instaladas previo a la condición de no factibilidad técnica.QUINTO: Se rechaza por inexacto. No lleva razón la recurrente al indicar que, se le notificó mediante consecutivo de la ASADA N° 603-2025 “que por estar pendiente el INFORME TECNICO número GSDUEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553” se le indicó que “NO HAY DISPONIBILIDAD DE AGUA POTABLE POR NO HABER CAUDAL”, pero no es correcto que estén pendientes los informes técnicos, por el contrario, el documento emitido por la ASADA es claro al referir: “como resultado del Informe técnico que consta en Oficio”, es decir, la Asada recurrida está informando a la solicitante los motivos por los cuales se le emite una constancia de disponibilidad negativa. Tal como se evidencia, no hay ningún informe técnico pendiente, los oficios GSDUEN-GAR-2020-014241; GSD-UEN-GAR-2025-01254 y GSD-UEN-GAR-2025- 01353 son documentos que indican las condiciones del sistema y el por qué se encuentra sin factibilidad técnica.(ver anexos 2, 3 y 4 del memorando N° GSDUEN-GAR-2025-02606 de fecha 08 de julio del 2025, emitido por la Orac Región Chorotega. SEXTO: Se rechaza por inexacto. Se desprende de lo referido por la recurrente, que su finalidad es que por medio de la vía del recurso de amparo, se le den a conocer los alcances de los informes referidos en la constancia de no disponibilidad de servicios, pero sin haber solicitado dicha información ante la Asada de Matapalo o el AyA, no siendo la vía constitucional la apta para obtener lo pretendido. Es decir, la recurrente interpone un recurso de amparo con el fin de conocer los alcances de los informes GSD-UEN-GAR-2020-014241; GSD-UEN-GAR-2025- 01254 y GSD-UEN-GAR-2025-01353, sin agotar primero la vía de solicitud ante la Asada recurrida, por lo cual, no existe derecho constitucional violentado. SÉTIMO: Se rechaza por inexacto. No consta en la prueba aportada por la recurrente que haya realizado una solicitud y presentara ante la Asada de Matapalo o el AyA, los requisitos para la instalación de un servicio permanente, conforme lo establecen los numerales 15, 67 y 68 del Reglamento para la prestación de los servicios del AyA, por lo cual, no existe gestión pendiente de resolver en ese sentido, ni tampoco petición por atender por parte del AyA o la ASADA.De la prueba presentada en el expediente digital y que fue aportada por la accionante, lo que consta es una solicitud de disponibilidad de servicios, recibida por la Asada de Matapalo el 12 de mayo del 2025 y la cual fue atendida por medio del Consecutivo de la ASADA: No. 603-2025 de fecha 26 de mayo del 2025, documento que tampoco fue impugnado por la recurrente. Es claro que la accionante confunde el trámite de solicitud de constancia de disponibilidad de servicios con el de la instalación de un servicio permanente, sin embargo, se aclara que el único trámite que consta en la prueba aportada, que haya realizado la gestionante ante la Asada de Matapalo es el de la solicitud de constancia de disponibilidad de servicio, la cual, le fue atendida en plazo, por el operador delegado (…)”. Por lo anterior, solicita se declare sin lugar el recurso.
  4. 4Por escrito agregado al expediente electrónico el 10 de julio del 2025, Efraín Milanés Obando Álvarez, en su condición de Apoderado Judicial y Extrajudicial de la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, manifiesta lo siguiente: “(…) UNICO HECHO: Es cierto se emitió una certificación de no disponibilidad de agua con el consecutivo 603-2025, para la finca Dirección01, localizada en el distrito de Matapalo, Provincia de Guanacaste, según piano catastrado numero 5-1944058-2016. 201619-1913350. Las ASADAS están obligadas a acatar las disposiciones y directrices emanadas por el AyA. como ente rector en la prestación del servicio de acueducto y alcantarillado, tal como lo establece el numeral 28 inciso a) del Reglamento de ASADAS. El 26 de mayo 2025, se extendió la certificación de No disponibilidad de Servicios, donde se le denegó la solicitud de disponibilidad de agua, con fundamento en el oficio GSD-UEN-GAR-2020-01424 No. GSD-UEN-GAR-2025-01254, No. Geo-UEN-GAR~2IJ-25-01353, este estudio determinó que no hay factibilidad técnica, es decir, no hay caudal disponible de agua.Es necesario acotar que el A3-IA el ente rector técnico de las ASADAS, las cuales están obligadas a acatar las normativas, 1516 de las 18:36 horas del 26 de enero de 2010. como también la sentencia 2015-8177 de las 10:05 horas del 05 de junio de 201 5). En el caso concreto, nos encontramos ante una imposibilidad técnica o material, debido a las razones esbozadas por la autoridad recurrida (falta de infraestructura y existen serias limitaciones de recurso hídrico en esa zona). Por todo le expuesto. al no existir una denegatoria antojadiza o arbitraria y' existir criterios técnicos para esa denegatoria, lo que corresponde es desestimar el presente amparo. (…) SOBRE LA SOLICITUD CONCRETA DEL RECURRENTE: Para que el AyA o una ASADA puedan emitir una constancia de disponibilidad de servicio y otorgar una disponibilidad de agua, debe de contar con factibilidad técnica, tal como lo exige el articulo T inciso 12 del Reglamento para la prestación de los servicios del AyA, mismo que indica: "Análisis de factibilidad técnica para el otorgamiento de los servicios: Proceso de verificación de la existencia real y actual de los recursos hídricos. hidráulicos, materiales.Técnicos, legales y ambientales suficientes para otorgar la disponibilidad y eventual conexión del servicio. Para tales efectos se deberán de observar las siguientes condiciones: a. Que las redes de distribución y de recolección pasan frente a linderos del inmueble o tenga acceso directo por vía pública o servidumbre de peso del inmueble para el cual se solicita un servicio b. Que los sistemas cuenten con capacidad hídrica, hidráulica, de potabilización y de tratamiento, suficientes para otorgar nuevos servicios. c. Que el sistema cumple con los artibutos de calidad establecidos. d. Que cumple con la normativa ambiental correspondiente. Y en el presente caso, la ASADA de Matapalo no cuenta con condiciones para atender el desarrollo máximo de crecimiento, dado que no existen condiciones de factibilidad técnica y legal según en el artículo 7 incisos: 12, 20, 21, 49 y 129 3-f ordinales s, 9, 10 y 14 del Reglamento de Prestación de Servicios vigente", todo en aras del interés público La ASADA de Matapalo no cuenta actualmente con factibilidad técnica para emitir constancias de disponibilidad de servicio de agua potable ni la instalación de un servicio permanente (…)”. Por lo anterior, solicita que se declare sin lugar el recurso.
  5. 5En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. CUESTIÓN PREVIA

Tratándose de recursos de amparo dirigidos contra sujetos privados, previo al análisis de fondo acerca de la violación constitucional alegada, debe examinarse si, en la especie, se está o no ante alguno de los supuestos que hacen admisible tal recurso, y, en caso afirmativo, dilucidar si es o no admisible. Indica la Ley de la Jurisdicción Constitucional en el artículo 57 que procede el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En la especie, de ser ciertos los reclamos de la parte tutelada, la ASADA recurrida podría estar en una situación de poder al prestar un servicio público delegado, frente a lo cual los remedios jurisdiccionales comunes podrían resultar insuficientes para tutelar los derechos fundamentales de la parte amparada, motivo por el cual, el recurso se debe admitir para su análisis por parte de este Tribunal.

II. OBJETO DEL RECURSO. Objeto

Alega la recurrente que, actualmente, es propietaria de la finca inscrita en el Registro Público, con antecedente de dominio de la finca Dirección02, situada en Cabo Velas, cantón 03 Santa Cruz, provincia de Guanacaste, el cual está destinado para la construcción de una vivienda. Señala que, el 26 de mayo de 2025, se le notificó mediante el oficio de la ASADA nro. 603-2025 que, por estar pendiente el informe técnico que consta en oficios nros. GSD-UEN-GAR-2020-0142, GSD-UEN-GAR2025-012554 y GSD-UEN-GAR-2025-013553, se determinó que no hay disponibilidad de agua potable por no haber caudal. Sin embargo, reclama que la ASADA concede trato diferenciado a otros lotes que sí cuentan con ese derecho, es decir, sí tienen disponibilidad de agua potable. Acusa que con esta acción se pretende conocer los alcances de los informes indicados ya que carecen de fundamentación fáctica. Reclama que existe vicio de falta de fundamentación y motivación dado que no se presentaron argumentos técnicos de rigor.

Alega que, si no hay caudal, por qué razón en la misma zona sí se otorgan servicios por parte de la ASADA recurrida a formularios nuevos, sin que hasta la fecha se nos haya dado respuesta. Sostiene que mediante solicitud originaria se peticionó y solicitó la instalación de medidores de agua para la propiedad de la cual es titular y a la fecha no existe respuesta por parte de la ASADA. Por lo anterior, solicita la intervención de la Sala.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)La tutelada es propietaria de la finca inscrita en el Registro Público bajo el sistema de folio real, matrícula nro. , localizada en el distrito Matapalo, provincia de Guanacaste, según plano catastrado nro. 5-1944058-2016- 201619-19035C, destinado para casa habitacional (hecho no controvertido) b) La propiedad se ubica en un proyecto habitacional donde ya existen lotes en los cuales se construyó y la Asociación Administradora de Acueducto y Alcantarillado Sanitario -ASADA- Matapalo otorgó el servicio de agua (hecho no controvertido) c) El 12 de mayo del año en curso, la recurrente solicitó la disponibilidad del servicio de agua potable para su lote (informes rendidos bajo fe de juramento) d) Que el pasado 26 de mayo se le notificó a la recurrente el oficio No. 603-2025 en el cual se indicó lo siguiente: “(…) En atención u su solicitud de disponibilidad de agua potable/ alcantarillado sanitario, presentada ante esta ASADA en fecha 16 mayo 2025, relativa al proyecto vivienda unifamiliar, el cual se ubicará en la propiedad, matrícula de Folio Real número - localizada en distrito MATAPALO.

GUANACASTE según plano catastro N° PLANO 5-1944058-2016- 2016-190350 para la eventual dotación para la eventual dotación de UN SERVICIO le comunico que como resultado del Informe técnico que consta en Oficio (GSD-UEN-GAR-2020-0142 , GSD-UEN-GAR-2025-01254; GSD-UEN-GAR-2025-01353 ) se determinó lo siguiente: “NO HAY DISPONIBILIDAD DE AGUA POTABLE POR NO HABER CAUDAL(…)” (informes rendidos bajo fe de juramento) e) La recurrente no presentó objeción alguna en contra de lo resuelto por la ASADA accionada f) La ASADA de Matapalo no cuenta con condiciones de factibilidad técnica y legal según en el artículo 7 incisos: 12, 20, 21, 49 y 129 3-f ordinales s, 9, 10 y 14 del Reglamento de Prestación de Servicios vigente", ni tampoco con factibilidad técnica para emitir constancias de disponibilidad de servicio de agua potable ni la instalación de un servicio permanente (informes rendidos bajo fe de juramento)

IV. HECHOS NO PROBADOS

De importancia para la resolución de este asunto, se estima como no demostrado el siguiente hecho:

  • a)Que la amparada haya solicitado la instalación de un servicio permanente que esté pendiente de resolver (los autos) b) Que la tutelada haya solicitado ante los recurridos copia de los informes números GSD-UEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553 (los autos)

V. SOBRE EL CASO CONCRETO

En el sub examine, la parte recurrente indica que gestionó la disponibilidad de agua ante la Asada accionada. Sin embargo, su gestión fue rechazada. Alega que en el proyecto donde se ubica su inmueble, algunas personas han construido y si se les ha suministrado por lo que la negativa es injustificada. Además, su lote tiene las condiciones de infraestructura para recibir el servicio.

Analizados los autos, la Sala tuvo por probado que la tutelada es propietaria del lote matrícula nro. , localizado en el distrito Matapalo, provincia de Guanacaste, según plano catastrado nro. , destinado para casa habitacional. El 12 de mayo de 2025, la amparada solicitó a la Asada recurrida la disponibilidad del servicio de agua potable para su lote. Mediante oficio del 26 de mayo de 2025, la Asada accionada rechazó la gestión, debido a que carece de caudal para atender la demanda.

Ahora bien, la Sala ha determinado que no constituye una lesión a los derechos de una persona que se niegue el servicio de agua potable cuando existen impedimentos técnicos que lo justifiquen:

“II.-Sobre el caso concreto. Entre la prueba aportada, se aprecia una certificación de no disponibilidad de agua del 15 de julio de 2021, mediante la que el AyA le notificó al accionante el rechazo de su solicitud de disponibilidad de agua potable para la individualización de servicios para un apartamento ubicado en el inmueble de su propiedad. La denegatoria se sustentó en la falta de factibilidad técnica debido a la insuficiencia de capacidad hídrica e hidráulica en el sistema de abastecimiento de la zona, por lo que no se tiene disponibilidad del servicio de agua potable para nuevos proyectos de desarrollo.

Así las cosas, se acredita que el sub lite no versa sobre una denegatoria arbitraria del servicio de agua potable, pues esta se fundamentó en la falta de factibilidad técnica. En esta línea, adviértase que este Tribunal Constitucional no es un contralor de la legalidad de las actuaciones o resoluciones de la autoridad recurrida y tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde usurpar las atribuciones que le han sido legalmente conferidas a otras dependencias, órganos o entes, como el AyA. Tampoco este Tribunal funge como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder a fin de que se le conceda lo que la parte recurrente pretende, en este caso, que se le instale un nuevo medidor para el apartamento que construyó para su hija. Ahora bien, si lo que ocurre es que el recurrente está inconforme con las razones que justificaron la denegatoria del nuevo medidor por parte del AyA, deberá plantear sus agravios y pretensiones ante la vía ordinaria de legalidad, para que allí se determine lo que en derecho corresponde”. (Sentencia nro. 2021018977 de las 11:50 horas de 24 de agosto de 2021).

La Sala no observa motivos para cambiar el criterio transcrito. En efecto, no se estima que la denegatoria sea irrazonable ni antojadiza cuando se basa en una justificación técnica como es, en este caso, la deficiente capacidad hidráulica del acueducto. La discusión del tema de fondo puede ser planteada en la vía de legalidad.

Ahora bien, tampoco consta que esté pendiente de resolver alguna solicitud instalación de un servicio permanente que haya presentado la recurrente, ni tampoco que haya solicitado los oficios Nos. GSD-UEN-GAR 2020-0142, GSD-UEN-GAR-2025- 012554, GSD- UEN-GAR -2025- 013553 para conocer los alcances de los estudios técnicos que se realizaron.

Por otro lado, no existen elementos de prueba para establecer que se incurrió en un trato discriminatorio. La Sala recuerda que tales acusaciones deben ser acompañadas por parámetros de comparación que permitan al Tribunal establecer inequívocamente un trato desigual:

“III.- EN CUANTO AL PRESUNTO TRATO DISCRIMINATORIO. Finalmente, cabe indicarle al petente que para determinar si ha existido o no una lesión a lo dispuesto en el artículo 33, de la Constitución Política, deben fijar un parámetro de igualdad, a efecto de que se pueda establecer si han recibido o no un trato discriminatorio con relación a personas que se encuentran en una situación similar a la suya, extremo que no se desprende del escrito de interposición del amparo, lo cual impide a la Sala realizar un análisis en concreto de los hechos, pues carece de esa base esencial. No es de recibo aducir que a otros propietarios de inmuebles sí se les instaló dicho servicio público, contrario a lo que sucede en su caso, pues es necesario aportar nombres y apellidos de los supuestos casos de discriminación, y explicar en qué, siendo iguales, se les discrimina. No basta alegar la lesión de lo dispuesto en el artículo 33, de la Constitución Política, si de las conductas impugnadas no se desprende en concreto en qué consiste.

Cabe recalcar que el simple hecho de que a otros propietarios de inmuebles se le haya concedido dicho servicio de agua potable, no es elemento suficiente para suponer que en su caso debe autorizarse el mismo servicio público, toda vez que, deben ser valorados elementos objetivos referidos a cada caso específico, así como las diversas variables temporales que son propias de cada sector o inmueble que puede justificar una resolución distinta”. (Sentencia nro. 2024030039 de las 9:15 horas del 11 de octubre de 2024).

En virtud de lo expuesto, se declara sin lugar el recurso.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
