Document Review Case: 25-017897-0007-CO Decision No. 2025024033 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on August first, two thousand twenty-five .
Amparo proceeding (recurso de amparo) processed under case number 25-017897-0007-CO, filed by Nombre01, identity card CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
BACKGROUND:
“1- Process for taking over the Dirección05– water-supply system.
Following the issuance of document GG-2022-03927, Subgerencia Gestión de Sistemas GAM, under the coordination of UEN Optimización de Sistemas GAM, began managing the activities under the plan to take over the Dirección05– water-supply system. The technical report formalized through document SG-GSGAM-2022-01308 identified short- and medium-term measures for taking over the Dirección05– water-supply system. Short term: a) Improvements and maintenance work on components of the water-supply system’s infrastructure. b) Improvements to the disinfection system. c) Improvements to intake, transmission, and distribution pipelines. Medium term. a) Interconnection with the ME-A-11 Guatuso de Patarrá system.
Similarly, the following requirements were identified as part of the process for taking over the water supply system: a) Land surveying and appraisals for the acquisition of real property. b) Water-quality analyses of the existing sources. c) 1 motorcycle-type vehicle for inspecting, operating, and maintaining the system. d) 3 operational staff positions for maintaining and operating the water supply infrastructure. e) 3 operational staff positions to inspect the condition of the civil infrastructure at the springs (nacientes), tanks, and system disinfection stations, and to perform maintenance work on access routes and green areas, as well as cleaning, painting, and repairs to the civil infrastructure at the springs, tanks, and rights-of-way easements (servidumbres de paso). f) A new operations yard. g) A budget for implementing operational improvements and investment projects. Additionally, one of the main obstacles identified to beginning implementation of the short-term improvements was the access road leading to the springs and tanks of the Dirección05– water supply system, as it was in deplorable condition, making it impossible—even with 4x4 vehicles—to transport labor and materials to the site during the rainy season.
For this reason, on 7 de febrero de 2023, Macrozona Este sent document SG-GSGAM-MZESTE-2023-00091 to the Municipalidad de Desamparados, requesting assistance to improve access for vehicles and trucks at least as far as the tank site and to provide adequate stormwater-management infrastructure, in order to prevent problems and damage during the rainy season. No response was received to AyA’s request. Furthermore, because the Subgerencia Gestión de Sistemas GAM requires support from other AyA departments to carry out all activities under the plan for taking over the Dirección05– water supply system, on 13 de febrero de 2023 official letter N° UEN-OSMS-GAM-2023-00013 was sent, formally requesting the cooperation and involvement of all participants in the process, including the Gerencia General. On that occasion, the Gerencia General responded through document N° GG-2023-00421, reaffirming its support and requesting the commitment and cooperation of all areas involved in the process.
Given the lack of support from the Municipalidad de Desamparados in repairing the access road to the springs and tanks of the Dirección05– water supply system, document N° UEN-OSMS-GAM-2024-00123 was sent on 04 de julio de 2024, requesting authorization from the local government for AyA to improve the road through a plan involving the use of clean demolition debris generated daily by the Subgerencia Gestión de Sistemas GAM through its work repairing leaks in drinking-water system pipelines. On 18 de julio de 2024, the Municipalidad de Desamparados responded through document N° TE-GE-207-2024, which addressed only the pruning and removal of branches required as part of the access-road improvements and raised no objection to the work proposed by AyA. Due to weather conditions associated with the 2024 rainy season, as well as the prioritization of public-works investment initiatives and reductions in non-revenue water (agua no contabilizada) in the drinking-water systems managed by the institution within the GAM, it was not possible to perform this work during that year.
2- Considerations for taking over the Dirección05- water supply system Repeated sections of the technical report emphasized that the proposal to take over the Dirección05– water supply system covers solely and exclusively the 69 service connections identified when the assessment was conducted. Taking over service for the entire population of Dirección01 and Dirección06 requires a medium-term investment project to improve storage and the distribution networks running from the secondary tanks to the population, in order to increase the flow available for the drinking-water supply and meet the projected future demand of this population. This means that the system has no capacity for new service connections, a condition that will change only once the medium-term investments have been implemented. The report also establishes that an efficient disinfection system must urgently be installed at the La Zetilla main tank, the sections and joints of the intake pipeline (tubería de aducción) along the bank of the creek must be improved (approximately 740 m), and civil maintenance and improvements to the existing infrastructure must be carried out.
Finally, one of the report’s recommendations states: “The community of Dirección01 and Calle Zetilla must be kept informed about the takeover process to be carried out by AyA, as well as all improvements ultimately approved for this water supply system. The water supply system organization must continue operating the system until the date on which it is determined that AyA will take it over in full.” 3- Updated plan for taking over the Calle Naranjo - Zetilla water supply system Under the directives and considerations cited in the preceding section, work is currently moving forward to resume the plan for taking over the Dirección05– water supply system. Evidence of this is the coordination email sent on 24 de junio de 2025, which included the plan shown in Table 1, setting out a short-term operational action plan and the party responsible for each action. That coordination also proposed a site visit for the beginning of julio, in order to refresh the knowledge of all participants involved regarding the condition and operation of the system to be taken over, as well as the needs that must be addressed.

Third Stage UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Hold a meeting with the community organization that currently manages the water supply system to provide information on the change in service operator and the new service conditions.
Unidad de Hidrantes GAM 1 – Conduct a study of the elements required for proper compliance with the hydrant law (ley de hidrantes) and the technical recommendations of the Benemérito Cuerpo de Bomberos de Costa Rica.
UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Hold a meeting with the community to explain the changes that will be made to both the administrative system and the operation of the water supply system.
Similarly, support for the medium-term activities will be formally requested by memorandum from departments outside the Subgerencia Gestión de Sistemas GAM, in order to comply with all measures included in the plan. The plan is expected to be duly updated with deadlines by the third quarter of 2025; those deadlines will be provided by each responsible department based on the available resources.
4- Regarding the administration of the Dirección05- water supply system Although the UEN Optimización de Sistemas GAM is not responsible for advising organizations that administer community water supply systems, it states the following regarding the administration of the water supply system by the Comité de Vecinos de Dirección05–: a) Technical report N° SG-GSGAM-2022-01308, endorsed by the Junta Directiva through Acuerdo N° 2022-428, stated that “the water supply system organization must continue operating the system until the date on which it is determined that AyA will take it over in full.” In other words, during the transitional period while AyA takes over administration of the water supply system, the Comité de Vecinos must provisionally continue managing the community infrastructure so that the community continues to receive water in its homes. b) Technical report N° SG-GSGAM-2022-01308 clearly states that the proposal to take over the Dirección05– water supply system covers solely and exclusively the 69 service connections identified when the assessment was conducted.
Taking over service for the entire population of Dirección01 and Dirección06 requires a medium-term investment project to improve storage and the distribution networks running from the secondary tanks to the population, in order to increase the flow available for the drinking-water supply and meet the projected future demand of this population. This means that the system has no capacity for new service connections, a condition that will change only once the medium-term investments have been implemented. c) Based on the foregoing, it is clear that the Comité de Vecinos must NOT connect new service connections to the water supply system, nor may AyA do so after it takes over administration of the Dirección05– water supply system, since this will require the successful implementation of the investments described in technical report N° SG-GSGAM-2022-01308. d) The Subgerencia Gestión de Sistemas GAM, with support from the UEN Gestión Ambiental, currently has a specialized team to conduct community outreach and awareness-building during the process through which AyA will take over the Dirección05– water supply system.
Accordingly, sessions will be held with the community, whose members will be able to obtain answers to all their questions and gain a thorough understanding of everything involved in becoming commercial customers of AyA.
While we must note that the supply of drinking water constitutes an essential public service, the case law of the Constitutional Chamber, regarding the supply of drinking water, has focused primarily on protecting the rights to life and health of natural persons. Those rights entail the possibility of demanding certain services from the State, an area in which the State is required to provide certain public services, particularly those essential to maintaining sanitary conditions conducive to preserving people’s life and health. Likewise, provision of the service may also be made subject to compliance with the regulatory requirements established for granting it and to the material feasibility of supply; that is, there must be no technical circumstances that make it impossible or inadvisable for the administration to provide it.” (Constitutional Chamber Judgment No. 2019008796). Along the same lines, the Constitutional Chamber has addressed legal impediments in several rulings, such as Judgment N.º 07779-2019 at 09:15 on 03 de mayo de 2019, which stated:
“(…) III.- REGARDING THE TECHNICAL IMPOSSIBILITIES THAT HINDER THE SUPPLY OF DRINKING WATER. This Court has repeatedly held that a technical, legal, or formal impossibility of providing drinking water service does not violate fundamental rights; and that it is reasonable not to grant service applications, or to require the interested party to bear the installation costs, where no drinking water distribution network exists and infrastructure must be built. Thus, in these cases, it has been made clear that this does not constitute a denial of access to drinking water service, but rather an impossibility of providing it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. The responsible authorities, of course, have an obligation to continue expanding their infrastructure to guarantee the population access to the service, but as long as gaps remain, the cooperation of interested parties is essential.
In other words, provided that the failure to supply drinking water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impossibility, no violation of fundamental rights will be found (see judgments 2010-001516, 2017-6701, 2007-11190, and 2006-014218, among others).” Next, regarding the facts mentioned by the petitioner, it is important to refer to Article 46 of the AyA Service Provision Regulations (Reglamento de Prestación de Servicios del AyA), concerning applications submitted by good-faith third parties who receive services from an unauthorized operator, which states:
“Article 46—Applications by good-faith third parties who receive services from an operator that has not been legally authorized. Applications relating to Articles 36, 39, 43, and 76 of these regulations, submitted by good-faith third parties who receive the service from an operator that has not been legally authorized, shall be formally referred to the Executive Presidency of AyA to determine the legal operator that will process the application, through the opening of an administrative record (expediente administrativo) and the application of AyA’s internal institutional procedure, overseen by the AyA Governing Authority Division. Once the Executive Presidency has designated the legal operator, whether AyA or an ASADA, the application shall be decided in accordance with the ordinary rules established in this body of regulations.” Likewise, the Office of the Attorney General of the Republic, in Legal Opinion C-236-2008, dated siete de julio del 2008, stated the following regarding the matter at issue:
(…)
Under the cited regulations and in accordance with the opinions issued by the Office of the Attorney General of the Republic, it is clear that the only operators nationwide empowered and authorized to provide drinking water supply and sanitation services are AyA; the Municipalities, provided that they deliver the service efficiently; Empresa de Servicios Públicos de Heredia; JASEC; and the ASADAs operating under a delegation agreement (convenio de delegación). We must reiterate the findings set forth in technical report Acueducto Dirección07–: the system operator is an irregular operator, the locations are outside the service coverage area, and the nearest AyA system is ME-A-11 Guatuso de Patarrá, whose operation and maintenance area has expanded considerably. This prevents service availability approvals (disponibilidades de servicio) from being granted until an investment project is carried out to take over this unauthorized operator. Accordingly, the impossibility of connection does not arise from a lack of institutional willingness or an unfounded refusal, but from an actual technical constraint, which has been communicated to the interested parties in accordance with the technical criteria and reports issued.
REGARDING THE ESTABLISHMENT OF THE PROCEDURE FOR PROVIDING SERVICES TO COMMUNITIES WHERE AN UNAUTHORIZED OPERATOR EXISTS.
It should be noted that the supply of drinking water by the aforementioned Dirección05 Aqueduct Users’ Committee has been carried out outside the legal framework, as it is not a legally authorized operator. Consequently, and based on the technical assessment issued, AyA is monitoring the process until the actions proposed in that technical assessment are implemented, thereby regularizing the provision of drinking water supply service. This Institute cannot disregard the established procedure, because conduct lacking a proper basis could result in the violation of the fundamental right to drinking water and to an efficient public service. It must be emphasized that public water-supply systems must be designed, built, and operated in compliance with existing technical rules and regulations, particularly the parameters established in the Technical Standard for the “Design and construction of drinking water supply, sanitation, and stormwater systems” (AyA Board of Directors Resolution N° 2017-281).
In view of the foregoing, when the service is provided through an existing supply system that was not conceived, administered, or operated by an authorized public operator, the established period for regularizing service provision first requires the completion of all necessary activities by both the interested parties and the competent institutions, so that AyA may take over the supply service. This entails the proper allocation of the resources and budget items necessary for the correct operation and maintenance of the aqueduct, as well as planning the investments that will enable the Institute to prepare an investment project providing a solution to the problems faced by the Dirección04 community in Desamparados.” It requests that the petition be dismissed.
Drafted by Justice Garro Vargas; and,
CONSIDERING:
The petitioner states that no ASADA or other formally constituted operator provides drinking water service in the Dirección01 community. In this regard, he states that in 2020 the Dirección02 committee in Desamparados requested ICAA’s approval to become an ASADA. However, the Regional Office of Community Aqueducts (ORAC) for the Metropolitan area recommended denying the application, based on three principal grounds: “The area is located within the Metropolitan Area, and a directive from the Office of the Comptroller General of the Republic orders AyA to take over operation of the aqueducts in this area. Through rate resolution RIA-006-2017, ARESEP instructed AyA to physically or administratively integrate ASADAs with fewer than 100 subscribers. The committee charged a flat monthly rate of 6.000 without applying the rates regulated by ARESEP.” He states that between 2020 and 2021, ICAA carried out a series of administrative and technical procedures, including site visits, during which it was determined that the committee was providing the service without the corresponding authorization.
Despite the foregoing, he asserts that the committee continues to operate as though it were an authorized provider, performing tasks such as installing meters, charging for consumption, carrying out works, and controlling shutoff valves. He explains that the committee initially presented itself as a duly authorized ASADA, impersonating that legal entity despite lacking ICAA authorization to operate as such. He maintains that once questions began to arise in this regard, it stopped issuing receipts bearing the heading “ASADA” and changed its name to “Acueducto Calle Naranjo-La Zetilla.” He states that it initially charged a flat monthly rate of 6.000 per water connection (paja de agua); however, it subsequently installed water meters and began imposing excessive charges without regulation or authorization. He asserts that payment for the service was collected in cash, without any oversight or legal basis.
He explains that on 30 de julio de 2024, a formal inquiry was submitted to ICAA to verify whether the committee in question had the proper authorization to provide drinking water service in the area. He states that, on that same date, he received a response from ICAA expressly indicating that the committee had no authorization whatsoever to provide the service. He alleges that this shows that ICAA has been fully aware of the existence of this irregular committee since at least that date and that, despite its lack of authorization, it has disregarded the situation, allowing the committee to continue improperly providing the service without taking the appropriate actions to ensure legality and protect the public interest.
The following facts are considered duly proven and relevant to the decision in this matter, either because they have been established by the evidence or because the respondent failed to address them as ordered in the initial ruling:

The following fact relevant to this decision is not deemed proven:
Sole fact. That ICAA has taken over the Dirección05– aqueduct.
In the case at bar, it was established that the supply of drinking water by the Dirección05 water-supply system Users’ Committee has in fact been carried out outside the legal framework, as it is an operator that is not legally authorized. In view of the foregoing, it follows that, in official letter No. GG-2022-03927, the General Management of ICAA requested that the GAM Systems Management Deputy Division proceed with implementation of the institutional procedure “Integration of water systems (GNU-43-01-P)” in order to take over the water-supply systems (acueductos) of Dirección08 in San Isidro de Vásquez de Coronado and Dirección05– in Patarrá de Desamparados. Based on the foregoing, the body of proven facts shows the following: the GAM Systems Management Deputy Division, under the coordination of the GAM Systems Optimization UEN, began managing the activities set forth in the plan to take over the Dirección05 water-supply system.
Technical report No. SG-GSGAM-2022-01308, issued by the GAM Systems Management Deputy Division, identified short- and medium-term measures for taking over the Dirección05 water-supply system, namely: “Short term: a) Improvements and maintenance work on components of the water-supply infrastructure. b) Improvements to the disinfection system. c) Improvements to intake, conveyance, and distribution pipelines. Medium term: a) Interconnection with the ME-A-11 Guatuso de Patarrá system.” In addition, the following requirements were identified as part of the process of taking over the water-supply system: “a) Surveying and appraisals for the acquisition of real property. b) Water-quality analyses of the existing sources. c) 1 motorcycle-type vehicle for inspecting, operating, and maintaining the system. d) 3 operational staff positions for maintaining and operating the water-supply infrastructure. e) 3 operational staff positions to inspect the condition of the civil infrastructure of the springs (nacientes), tanks, and system disinfection stations, and to carry out maintenance work on access routes and green areas, as well as cleaning, painting, and repairs to the civil infrastructure of the springs, tanks, and rights-of-way (servidumbres de paso). f) A new operations yard. g) A budget for implementing operational improvements and investment projects.” Technical report No. SG-GSGAM-2022-01308 on taking over the Dirección05 water-supply system establishes, as a matter of urgency, that an efficient disinfection system must be implemented at the main La Zetilla tank, that the sections and joints of the intake pipeline (approximately 740 m) along the bank of the stream must be improved, and that civil maintenance and improvement work must be carried out on the existing infrastructure.
In addition, one of the report’s recommendations states that “it will be necessary to keep the communities of Dirección01 and Dirección04 informed about the takeover process to be carried out by AyA, as well as all improvements ultimately approved for this water-supply system. The water-supply system association must continue operating the system until the date on which it is determined that AyA will fully take it over.” One of the principal obstacles identified to beginning implementation of the short-term improvements was the access road leading to the springs and tanks of the Dirección05 water-supply system, as it was in deplorable condition, which made it impossible to transport labor and materials to the site during the rainy season, even in 4x4 vehicles. For that reason, on 07 de febrero de 2023, Macrozona Este sent document No. SG-GSGAM-MZESTE-2023-00091 to the Municipalidad de Desamparados, requesting assistance to improve access for vehicles and trucks at least as far as the tank site and to provide adequate stormwater-management infrastructure in order to prevent problems and damage during the rainy season; however, no response was received.
On 13 de febrero de 2023, because the GAM Systems Management Deputy Division requires support from other ICAA divisions to carry out all activities under the plan to take over the Dirección05 water-supply system, official letter No. UEN-OSMS-GAM-2023-00013, issued by the Systems Optimization and GAM System Improvement UEN, was sent formally requesting the cooperation and involvement of all participants in the process, including the General Management. Through official letter No. GG-2023-00421, the General Management responded with a document reaffirming its support. At that time, it requested the commitment and cooperation of all areas involved in the process. On 04 de julio de 2024, the Systems Optimization and GAM System Improvement UEN sent official letter No. UEN-OSMS-GAM-2024-00123 to the Municipalidad de Desamparados, requesting permission for ICAA to undertake the road improvements through a plan involving the use of clean rubble generated daily by the GAM Systems Management Deputy Division from repairing leaks in drinking-water system pipelines.
On 18 de julio de 2024, the Municipalidad de Desamparados responded through document No. TE-GE-207-2024 and addressed the pruning and removal of branches required as part of the access-road improvements. It also raised no objection to the work proposed by ICAA; however, the work could not be carried out because of weather conditions characteristic of the 2024 rainy season, as well as the prioritization of public-works investment initiatives and the reduction of non-revenue water in the drinking-water systems administered by the institution within the GAM. The proposal to take over the Calle Naranjo – Zetilla water-supply system covers solely and exclusively the sixty-nine services identified when the assessment was conducted, because taking over service for the entire population of Dirección01 and Dirección06 requires a medium-term investment project to improve storage and the distribution networks extending from the secondary tanks to the population, with the aim of increasing the available flow for the supply of drinking water and thereby meeting the future projected demand of this population.
The foregoing means that this system has no capacity for new services, a condition that will change only when the medium-term investments are implemented. ICAA is currently making progress in resuming the plan to take over the Dirección05 water-supply system; the coordination email sent on 24 de junio de 2025 attached the plan setting forth short-term operational actions and the party responsible for each. That coordination also proposes a site visit for the beginning of julio de 2025, in order to reacquaint all participants involved with the condition and operation of the system to be taken over, as well as the needs to be addressed. The short-term operational action plan for taking over the Dirección05 water-supply system provides as follows:
Stage Division Support required in the takeover process First Stage Macrozona Este–Tanques del Sur 1 – Transport and use rubble to improve the quality of the access road to the system’s main infrastructure.
UEN PyD GAM - Civil Maintenance 1 – Clear and prepare the access route to the tanks by pruning branches, removing weeds, and addressing any other elements that obstruct entry.
2 – Conduct a visit and determine the actions necessary for the operational maintenance of the existing infrastructure.
3 – Install perimeter security measures to allow chlorination equipment to be installed at the main tank.
UEN PyD GAM - Water Treatment Plants 1 – Conduct a visit to the main tank of Dirección04 and determine the specifications of the chlorination equipment for dispensing calcium hypochlorite tablets, as well as begin the process of acquiring and implementing such equipment as soon as possible.
Second Stage Macrozona Este – Zona 2 1 - Replace the system’s intake pipelines.
GAM Project Implementation 1 - Replace the water-supply system’s conveyance pipelines.
UEN OS GAM - Systems Logistics 1 – Conduct a GPS survey of the new intake pipelines and conveyance lines.
UEN Environmental Management 1 – Register AyA’s rights to use the flow from the springs with the MINAE Water Directorate.
Third Stage UEN Customer Service GAM / UEN OS GAM / Macrozona Este GAM 1 - Meet with the community organization that currently administers the water-supply system to provide information regarding the change in the service operator and the new service conditions.
GAM Fire Hydrant Unit 1 – Conduct a study of the elements necessary to ensure proper compliance with the fire-hydrant law and the technical recommendations of the Benemérito Cuerpo de Bomberos de Costa Rica.
UEN Customer Service GAM / UEN OS GAM / Macrozona Este GAM 1 - Hold a meeting with the community to explain the changes that will occur in both the administrative system and the operation of the water-supply system.
It is expected that the plan will be duly updated, with its respective deadlines, by the third quarter of 2025. Finally, it was shown that the GAM Systems Management Deputy Division, with support from the UEN Environmental Management, has a specialized team for community engagement and awareness-building during the process through which ICAA will take over the Dirección05 water-supply system, so that sessions will be held with the community, whose members will be able to have all their questions answered and gain a thorough understanding of everything involved in becoming the institution’s commercial customers.
In the present case, although ICAA describes the various steps it has taken to assume control of the Calle Naranjo – Zetilla water-supply system, the fact remains that, as of the date this appeal was filed, the supply of drinking water in the community of Dirección01 continues to be provided by the Dirección05 water-supply system Users’ Committee, with the aggravating circumstance that, according to the respondent authority itself, it is being provided outside the legal framework. In that regard, it is necessary to cite the information provided by the General Manager of ICAA, the substance of which is as follows: “It must be stated that the supply of drinking water by the Dirección05 water-supply system Users’ Committee has been carried out outside the legal framework, as it is an operator that is not legally authorized. Consequently, and based on the technical assessment issued, AyA is monitoring the process until the actions proposed in that technical assessment are implemented, thereby bringing the provision of the drinking-water supply service into compliance (…) We must reiterate what was stated in the technical report Dirección07 Water-Supply System, namely, that the operator of that system is an irregular operator.” In view of the foregoing, the appropriate course is to grant the appeal so that the respondent institution issues the necessary orders and undertakes the corresponding actions within the scope of its authority in order to assume control of the Dirección05 water-supply system and thereby definitively resolve the problem reported by the appellant concerning the provision of drinking-water service in the community of Dirección01.
V.PARTIAL DISSENTING OPINION (VOTO SALVADO PARCIAL) OF JUSTICE GARRO VARGAS REGARDING THE OPERATIVE PORTION OF THIS JUDGMENT. Although I agree with the majority of the Chamber that the appeal (recurso) should be granted, I disagree as to where the enforcement phase (fase de ejecución) of the matter should be conducted, due to the lack of adequate mechanisms provided for under the rules governing this constitutional jurisdiction (jurisdicción constitucional) to monitor compliance with a judgment involving highly complex technical aspects, as is the case here, so that, within six months from notification of this judgment, the ICAA assumes control of the Calle Naranjo – Zetilla water-supply system (acueducto) and definitively resolves the problem reported by the appellant (parte recurrente) concerning the provision of drinking-water service in the community of Calle Naranjo. In contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (Article 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, determine liability, oversee stages of compliance, and so forth.
Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules (reglas de ejecución de sentencia) of that Code.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, in accordance with the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The appeal is granted. María Alejandra Mora Segura, in her capacity as Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that office in her stead, is ordered to issue the corresponding directives and undertake all appropriate actions within the scope of her authority so that, within SIX MONTHS from notification of this judgment, control of the Dirección05– water-supply system is assumed and the problem reported by the appellant concerning the provision of drinking-water service in the community of Dirección01 is definitively resolved. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or caused to be complied with, and who fails to comply with it or cause compliance with it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment in the administrative-law proceedings (ejecución de sentencia de lo contencioso administrativo). Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that it be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules set forth in Article 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded thereto so that proceedings to enforce this ruling may be commenced. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del uno de agosto de dos mil veinticinco .
Recurso de amparo que se tramita en expediente número 25-017897-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
RESULTANDO:
“1- Proceso para asumir acueducto Dirección05– .
A partir de la emisión del documento GG-2022-03927, la Subgerencia Gestión de Sistemas GAM, bajo la coordinación de la UEN Optimización de Sistemas GAM, inicia la gestión de las actividades del plan para asumir el acueducto de Dirección05– En el informe técnico oficializado mediante documento SG-GSGAM-2022-01308, se identificaron medidas a corto y mediano plazo para asumir el acueducto de Dirección05– Corto plazo: a) Mejoras y trabajos de mantenimiento a componentes de infraestructura del acueducto. b) Mejoras al sistema de desinfección. c) Mejoras a tuberías de aducción, conducción y distribución. Mediano plazo. a) Interconexión con sistema ME-A-11 Guatuso de Patarrá.
De igual manera, se identificaron los siguientes requerimientos dentro del proceso para asumir el acueducto: a) Topografía y avalúos para adquisición de bienes inmuebles. b) Análisis de calidad del agua de las fuentes existentes. c) 1 vehículo tipo motocicleta para la inspección, operación y mantenimiento del sistema. d) 3 plazas de funcionarios operativos para mantenimiento y operación de la infraestructura de acueducto. e) 3 plazas de funcionarios operativos para inspección del estado de la infraestructura civil de las nacientes, tanques y estaciones de desinfección del sistema, ejecución de trabajos de mantenimiento de accesos, zonas verdes, limpieza, pintura y reparaciones a la infraestructura civil de las nacientes, tanques y servidumbres de paso. f) Nuevo plantel operativo. g) Presupuesto para la ejecución de las mejoras operativas y proyectos de inversión. Adicionalmente, uno de los principales obstáculos que se identificó para iniciar la ejecución de las mejoras de corto plazo fue el camino de acceso para llegar a las nacientes y tanques del acueducto de Dirección05– pues se encontraba en deplorable estado, lo cual provocaba que, ni siquiera con vehículos 4x4 se pudiese trasladar mano de obra y materiales hasta el sitio en época lluviosa.
Por este motivo, el 7 de febrero de 2023, la Macrozona Este envió el documento SG-GSGAM-MZESTE-2023-00091 dirigido a la Municipalidad de Desamparados, solicitando apoyo de modo que se mejore el acceso de vehículos y camiones al menos hasta el sitio de tanques y se dote de una adecuada infraestructura para el manejo de aguas pluviales, con el fin de evitar inconvenientes y daños en época lluviosa. No se recibió respuesta para la solicitud remitida por parte de AyA. Por otra parte, debido a que la Subgerencia Gestión de Sistemas GAM requiere de apoyo de otras dependencias del AyA para la ejecución de todas las actividades del plan para asumir el acueducto de Dirección05– el 13 de febrero de 2023 se envió el oficio N° UEN-OSMS-GAM-2023-00013 solicitando formalmente la colaboración e involucramiento de todos los actores del proceso, incluyendo la Gerencia General. En esa ocasión, la Gerencia General respondió con el documento N° GG-2023-00421 reafirmando el apoyo y solicitando el compromiso y colaboración de todas las áreas involucradas en el proceso.
Ante la falta de apoyo por parte de la Municipalidad de Desamparados para reparar el camino de acceso a las nacientes y tanques del acueducto de Dirección05– el 04 de julio de 2024 se envía el documento N° UEN-OSMS-GAM-2024-00123, en el que se solicita permiso al gobierno local para que sea AyA quien ejecute la mejora al camino, por medio de un plan que involucraba el aprovechamiento de material de escombro limpio que la Subgerencia Gestión de Sistemas GAM genera a diario debido a la actividad de reparación de fugas en tuberías de sistemas de agua potable. El 18 de julio de 2024, la Municipalidad de Desamparados contesta por medio del documento N° TE-GE-207-2024, en el cual solamente se refiere a la poda y desrame requerido como parte de la mejora de los caminos de acceso y no pone objeción alguna a los trabajos propuestos por AyA. Por motivos climatológicos propios de la época lluviosa 2024, así como la priorización de iniciativas de inversión de obra pública y reducción de agua no contabilizada en los sistemas de agua potable que administra la institución dentro del GAM, no fue posible ejecutar estos trabajos durante ese año.
2- Consideraciones para asumir acueducto Dirección05- Se resaltó en reiteradas secciones del informe técnico que la propuesta para asumir el acueducto de Dirección05– ontempla única y exclusivamente los 69 servicios identificados en el momento de realización del diagnóstico. Para asumir la totalidad de la población de Dirección01 y Dirección06 es necesario un proyecto de inversión a mediano plazo para mejorar el almacenamiento y las redes de distribución desde los tanques secundarios a la población, con el propósito de reforzar el caudal disponible para el suministro de agua potable y satisfacer la demanda proyectada a futuro para esta población. Lo anterior implica que no existe disponibilidad para nuevos servicios en este sistema, condición que solo cambiará cuando se ejecuten las inversiones a mediano plazo. Asimismo, se establece en el informe que, con carácter de urgencia se debe implementar un sistema de desinfección eficiente en el tanque principal La Zetilla y mejorar los tramos y las uniones de la tubería de aducción (alrededor de 740 m) en la margen de la quebrada, así como ejecutar trabajos de mantenimiento civil y mejora de la infraestructura existente.
Finalmente, se indica en una de las recomendaciones del informe: “será necesario mantener informada a la comunidad de Dirección01 y Calle Zetilla acerca del proceso de asunción que desarrollará el AyA, así como también de todas las mejoras que finalmente se aprueben para este acueducto. La agrupación del acueducto deberá seguir operando el sistema hasta la fecha en la que se defina que AyA asumirá de pleno”.
3- Actualización del plan para asumir acueducto Calle Naranjo - Zetilla Bajo las consignas y consideraciones citadas en la sección anterior, en la actualidad se avanza en retomar el plan para asumir el acueducto de Dirección05– Evidencia de ello es el correo de coordinación enviado el 24 de junio de 2025, en el cual se envía el plan que se muestra mediante el Cuadro 1, en donde se formula un plan de acciones operativas de corto plazo con su respectivo responsable. Además, en dicha coordinación se propone una visita al sitio para inicios del mes de julio, con el fin de refrescarle a todos los actores involucrados el estado y funcionamiento del sistema por asumir, así como las necesidades por solventar.
Cuadro 1. Plan de acciones operativas de corto plazo para asumir acueducto Dirección05– Etapa Dependencia Apoyo requerido en proceso para asumir Primera Instancia Macrozona Este–Tanques del Sur 1 – Movilizar y utilizar escombros para mejorar la calidad de la calle de acceso a la infraestructura principal del sistema.
UEN PyD GAM - Mantenimiento Civil 1 – Realizar un acondicionamiento de la ruta de acceso a los tanques, en términos de poda de ramas, maleza u otros elementos que dificulten la entrada.
2 – Realizar una visita y determinar acciones necesarias para el mantenimiento operativo de la infraestructura existente.
3 – Realizar el acondicionamiento de seguridad perimetral para la instalación de un equipo de clorado en el tanque principal.
UEN PyD GAM - Plantas Potabilizadoras 1 – Realizar una visita al tanque principal de Dirección04 y determinar las características del equipo de cloración de dosificación de tabletas de hipoclorito de calcio, así como comenzar el proceso de adquisición de uno implementarlo a la brevedad posible.
Segunda Instancia Macrozona Este – Zona 2 1 - Realizar una sustitución de las tuberías de aducción del sistema.
Ejecución de Proyectos GAM 1 - Realizar el remplazo de las tuberías de conducción del acueducto.
UEN OS GAM - Logística de Sistemas 1 – Realizar un levantamiento GPS de las tuberías de aducción nuevas y las líneas de conducción.
UEN Gestión Ambiental 1 – Realizar la inscripción de los derechos de uso del caudal de las nacientes por parte de AyA ante la Dirección de Aguas del MINAE.
Tercera Instancia UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Reunión con la organización comunal que actualmente administra el acueducto, para informar de los cambios en el operador del servicio y nievas condiciones del servicio.
Unidad de Hidrantes GAM 1 – Realizar un estudio de los elementos necesarios para el debido cumplimiento de la ley de hidrantes y recomendaciones técnicas del benemérito cuerpo de bomberos de Costa Rica.
UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Realizar una reunión con la comunidad para aclarar los cambios que se darán en el sistema tanto administrativo como en termino de funcionamiento del acueducto.
De igual manera, se estará solicitando formalmente el apoyo con las actividades a mediano plazo a las dependencias externas a la Subgerencia Gestión de Sistemas GAM vía memorando, con el fin de cumplir con todas las medidas contempladas en el plan. Se espera para el tercer trimestre de 2025 contar con el plan debidamente actualizado con plazos, los cuales serán aportados por cada una de las dependencias responsables según los recursos disponibles.
4- Sobre la administración del acueducto Dirección05- Si bien la UEN Optimización de Sistemas GAM no tiene dentro de sus funciones asesorar a organizaciones administradoras de acueductos comunales, sobre la administración del acueducto por parte del Comité de Vecinos de Dirección05– e indica lo siguiente: a) En el informe técnico N° SG-GSGAM-2022-01308, avalado por la Junta Directiva en el Acuerdo N° 2022-428, se indicó que “la agrupación del acueducto deberá seguir operando el sistema hasta la fecha en la que se defina que AyA asumirá de pleno”. Es decir, durante el período de transición, mientras AyA asume la administración del acueducto, para que la comunidad siga contando con el recurso hídrico en sus viviendas, el Comité de Vecinos, de manera provisional, debe seguir administrando la infraestructura comunal. b) En el informe técnico N° SG-GSGAM-2022-01308 se indica claramente que la propuesta para asumir el acueducto de Dirección05– ontempla única y exclusivamente los 69 servicios identificados en el momento de realización del diagnóstico.
Para asumir la totalidad de la población de Dirección01 y Dirección06 es necesario un proyecto de inversión a mediano plazo para mejorar el almacenamiento y las redes de distribución desde los tanques secundarios a la población, con el propósito de reforzar el caudal disponible para el suministro de agua potable y satisfacer la demanda proyectada a futuro para esta población. Esto implica que no existe disponibilidad para nuevos servicios en este sistema, condición que solo cambiará cuando se ejecuten las inversiones a mediano plazo. c) En función de lo anterior, está claro que el Comité de Vecinos NO debe conectar nuevos servicios al acueducto, ni tampoco lo podrá hacer AyA una vez que asuma la administración del acueducto de Dirección05– pues para ello se requerirá de la exitosa ejecución de las inversiones descritas en el informe técnico N° SG-GSGAM-2022-01308. d) Actualmente, la Subgerencia Gestión de Sistemas GAM, con el apoyo de la UEN Gestión Ambiental, cuenta con un equipo especializado para el abordaje social y sensibilización de la comunidad durante el proceso para que AyA asuma el acueducto de Dirección05– de modo que se tendrán sesiones con la comunidad, quienes podrán aclarar todas sus consultas y conocer a fondo todo lo que implica ser usuarios comerciales del AyA.
Si bien, debemos indicar que el suministro de agua potable constituye un servicio público esencial, la jurisprudencia de la Sala, en materia de suministro de agua potable, se ha dirigido fundamentalmente a la protección del derecho a la vida y a la salud de las personas físicas. Esos derechos implican la posibilidad de exigir ciertas prestaciones del Estado, ámbito en el cual el Estado se ve obligado a proporcionar algunos servicios públicos, sobre todo los que resultan esenciales para mantener condiciones sanitarias favorables a la preservación de la vida y la salud de las personas. Así mismo, la prestación del servicio también puede sujetarse al cumplimiento de los requisitos normativos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten y desaconsejen a la administración brindarlo.” (Sentencia Sala Constitucional No. 2019008796). En este mismo sentido, la Sala Constitucional se ha pronunciado en varios pronunciamientos en cuanto a los impedimentos legales, como por ejemplo la Sentencia N.º 07779-2019 de las 09:15 del 03 de mayo de 2019, que indicó:
“(…) III.- SOBRE LAS IMPOSIBILIDADES TÉCNICAS QUE OBSTACULIZAN EL ABASTECIMIENTO DE AGUA POTABLE. Este Tribunal ha señalado en reiteradas ocasiones que la imposibilidad técnica, jurídica o formal para dotar el servicio de agua potable no es violatorio de derechos fundamentales; y que resulta razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. Por supuesto, las autoridades encargadas tienen la obligación de ir expandiendo su infraestructura para garantizar a la población el acceso al servicio, pero mientras queden vacíos resulta indispensable la colaboración de los interesados.
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en una imposibilidad jurídica o material; se descarta la violación de derechos fundamentales (véanse las sentencias 2010-001516, 2017-6701, 2007-11190, y 2006-014218, entre otras).” Seguidamente, en relación con los hechos mencionados por el recurrente, es importante hacer referencia a lo establecido en el Artículo 46 del Reglamento de Prestación de Servicios del AyA, sobre las solicitudes presentadas por terceros de buena fe que reciben los servicios de un operador no autorizado, que menciona:
“Artículo 46- De las solicitudes por parte de terceros de buena fe que reciben los servicios de un operador no legalizado. Las solicitudes referidas a los artículos 36, 39, 43 y 76 del presente reglamento, que realicen terceros de buena fe que reciban la prestación del servicio por parte de un operador no legalizado, deberán ser remitidas formalmente ante la Presidencia Ejecutiva del AyA, para la determinación del operador legal que asumirá la atención de la solicitud, mediante la conformación del expediente administrativo y la aplicación del procedimiento interno institucional a cargo del Área de Rectoría de AyA. Una vez definido el operador legal por parte de la Presidencia Ejecutiva, sea AyA o una ASADA, se resolverá la solicitud conforme a la normativa ordinaria establecida en este cuerpo normativo.” Así mismo, la Procuraduría General de la República en el Dictamen Jurídico C-236-2008, del siete de julio del 2008, en relación con el tema que nos ocupa, indicó lo siguiente:
(…)
De acuerdo con la normativa citada y de conformidad con los pronunciamientos emitidos por la Procuraduría General de la República, está claro que los únicos operadores a nivel nacional con la potestad y autorización para brindar los servicios de abastecimiento de agua potable y saneamiento son: el AyA, las Municipalidades siempre que presten el servicio de manera eficiente, la Empresa de Servicios Públicos de Heredia, JASEC y las Asadas con convenio de delegación. Debemos reiterar lo indicado en el informe técnico Acueducto Dirección07– siendo que dicho operador del sistema es un operador irregular y que se encuentran fuera del área de cobertura y que el sistema más cercano del AyA es ME-A-11 Guatuso de Patarrá, el cual ha visto su zona de operación y mantenimiento se ha visto ampliamente incrementada. Esto impide que se otorguen disponibilidades de servicio, hasta tanto no se realice un proyecto de inversión para asumir este operador no autorizado. Por ende, la imposibilidad de conexión no obedece a falta de voluntad institucional ni a negativa infundada, sino a una limitación técnica real, la cual le ha sido comunicada a los interesados según los criterios e informes técnicos emitidos.
RESPECTO A LA INSTAURACIÓN DEL PROCEDIMIENTO PARA LA PRESTACIÓN DE LOS SERVICIOS A COMUNIDADES DONDE EXISTE UN OPERADOR NO AUTORIZADO.
Corresponde indicar que el suministro de agua potable por parte de dicho Comité de usuarios del acueducto Dirección05 ha sido realizado al margen del ordenamiento jurídico, siendo este un operador no habilitado legalmente. Por consiguiente y con base en la valoración técnica emitida, el AyA se encuentra dando seguimiento al proceso hasta que se materialicen las acciones planteadas en dicha valoración técnica y con ello se regularice la prestación del servicio de abastecimiento de agua potable. No puede este Instituto abstraerse del procedimiento establecido, por cuanto una conducta carente de fundamento podría resultar en la vulneración del derecho fundamental al agua potable y a un servicio público eficiente. Es preciso enfatizar que los sistemas de abastecimiento poblacional deben ser diseñados, construidos y operados cumpliendo con la normativa y reglamentación técnica existente, particularmente según los parámetros establecidos en la Norma técnica para “Diseño y construcción de sistemas de abastecimiento de agua potable, de saneamiento y pluvial” (Acuerdo de Junta Directiva del AyA N° 2017-281).
En virtud de lo anterior, cuando la prestación del servicio parte de un sistema de abastecimiento existente que no ha estado bajo la conceptualización, administración y operación de un operador público autorizado, el plazo establecido para regularizar la prestación del servicio requiere de previo la realización de todas las actividades necesarias, tanto por los interesados como por las instituciones competentes, en aras de que el servicio de abastecimiento sea asumido por el AyA. Esto conlleva la debida asignación de recursos y partidas necesarias para la correcta operación y mantenimiento del acueducto, al igual que la planificación de las inversiones que permitan al Instituto elaborar un proyecto de inversión que brinde solución a la problemática de la comunidad de Dirección04 en Desamparados”.
Solicita que se declare sin lugar el recurso.
Redacta la Magistrada Garro Vargas; y,
CONSIDERANDO:
El recurrente manifiesta que en la comunidad de Dirección01 no existe una ASADA ni ningún operador formalmente constituido que preste el servicio de agua potable. En ese sentido señala que en el año 2020 el comité de Dirección02, en Desamparados le solicitó al ICAA el visto bueno para constituirse como una ASADA. No obstante, la Oficina Regional de Acueductos Comunales (ORAC) de la zona Metropolitana recomendó rechazar la solicitud, fundamentándose en tres aspectos principales: "La zona se encuentra dentro del Área Metropolitana, y existe una directriz de la Contraloría General de la República que ordena al AyA asumir la operación de los acueductos en esta área. La ARESEP, mediante resolución tarifaria RIA-006-2017, instruyó al AyA integrar física o administrativamente ASADAS con menos de 100 abonados. El comité cobraba una tarifa fija de 6.000 mensuales sin aplicar las tarifas reguladas por ARESEP".
Señala que entre el año 2020 y 2021 se desarrollaron una serie de trámites administrativos y técnicos por parte del ICAA, incluyendo visitas de campo, en las cuales se identificó que el comité prestaba el servicio sin contar con la autorización correspondiente. Pese a lo anterior, segura que el comité continúa operando como si fuera un prestador autorizado, realizando funciones como instalación de medidores, cobro por consumo, ejecución de obras y manejo de llaves de paso. Comenta que inicialmente el comité se presentaba como una ASADA debidamente autorizada, suplantando esa figura legal, sin contar con autorización del ICAA para operar como tal. Sostiene que una vez que comenzaron los cuestionamientos al respecto dejaron de emitir recibos con el encabezado de "ASADA" y cambiaron el nombre a "Acueducto Calle Naranjo-La Zetilla". Comenta que en sus inicios cobraban una tarifa fija de 6.000 mensuales por paja de agua; sin embargo, instalaron hidrómetros y comenzaron a aplicar cobros excesivos, sin regulación ni autorización.
Asegura que el cobro del servicio se realizaba en efectivo, sin ningún tipo de fiscalización ni respaldo legal. Explica que el 30 de julio de 2024 se realizó una consulta formal ante el ICAA con el fin de verificar si el comité en cuestión contaba con la debida autorización para brindar el servicio de agua potable en la zona. Comenta que, en esa misma fecha, recibió respuesta por parte del ICAA, en la cual se indicó expresamente que ese comité no cuenta con autorización alguna para prestar el servicio. Alega que lo anterior evidencia que el ICAA tiene pleno conocimiento de la existencia de este comité irregular desde al menos esa fecha, y que, a pesar de su falta de autorización, ha hecho caso omiso a la situación, permitiendo que continúe brindando el servicio de forma indebida, sin ejercer las acciones correspondientes para garantizar la legalidad y la protección del interés público.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Etapa Dependencia Apoyo requerido en proceso para asumir Primera Instancia Macrozona Este–Tanques del Sur 1 – Movilizar y utilizar escombros para mejorar la calidad de la calle de acceso a la infraestructura principal del sistema.
UEN PyD GAM - Mantenimiento Civil 1 – Realizar un acondicionamiento de la ruta de acceso a los tanques, en términos de poda de ramas, maleza u otros elementos que dificulten la entrada.
2 – Realizar una visita y determinar acciones necesarias para el mantenimiento operativo de la infraestructura existente.
3 – Realizar el acondicionamiento de seguridad perimetral para la instalación de un equipo de clorado en el tanque principal.
UEN PyD GAM - Plantas Potabilizadoras 1 – Realizar una visita al tanque principal de Dirección04 y determinar las características del equipo de cloración de dosificación de tabletas de hipoclorito de calcio, así como comenzar el proceso de adquisición de uno implementarlo a la brevedad posible.
Segunda Instancia Macrozona Este – Zona 2 1 - Realizar una sustitución de las tuberías de aducción del sistema.
Ejecución de Proyectos GAM 1 - Realizar el remplazo de las tuberías de conducción del acueducto.
UEN OS GAM - Logística de Sistemas 1 – Realizar un levantamiento GPS de las tuberías de aducción nuevas y las líneas de conducción.
UEN Gestión Ambiental 1 – Realizar la inscripción de los derechos de uso del caudal de las nacientes por parte de AyA ante la Dirección de Aguas del MINAE.
Tercera Instancia UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Reunión con la organización comunal que actualmente administra el acueducto, para informar de los cambios en el operador del servicio y nievas condiciones del servicio.
Unidad de Hidrantes GAM 1 – Realizar un estudio de los elementos necesarios para el debido cumplimiento de la ley de hidrantes y recomendaciones técnicas del benemérito cuerpo de bomberos de Costa Rica.
UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Realizar una reunión con la comunidad para aclarar los cambios que se darán en el sistema tanto administrativo como en termino de funcionamiento del acueducto.
(véase el informe y la prueba adjunta).
No se estima demostrado el siguiente hecho de relevancia para esta resolución:
Único. Que el ICAA haya asumido el acueducto Dirección05–
En el sub lite se tuvo por acreditado que efectivamente el suministro de agua potable por parte del Comité de usuarios del acueducto Dirección05 ha sido realizado al margen del ordenamiento jurídico, siendo este un operador no habilitado legalmente. En atención a lo anterior, se colige que en el oficio No. GG-2022-03927, la Gerencia General del ICAA solicitó a la Subgerencia Gestión de Sistemas GAM proceder con la aplicación del procedimiento institucional “Integración de sistemas de agua (GNU-43-01-P)” para asumir los acueductos de Dirección08 en San Isidro de Vásquez de Coronado y Dirección05– n Patarrá de Desamparados. A partir de lo expuesto, del elenco de hechos probados se desprende lo siguiente: la Subgerencia Gestión de Sistemas GAM, bajo la coordinación de la UEN Optimización de Sistemas GAM, inició la gestión de las actividades del plan para asumir el acueducto de Dirección05– En el informe técnico No. SG-GSGAM-2022-01308 emitido por la Subgerencia Gestión de Sistemas GAM se identificaron medidas a corto y mediano plazo para asumir el acueducto de Dirección05– a saber: “Corto plazo: a) Mejoras y trabajos de mantenimiento a componentes de infraestructura del acueducto. b) Mejoras al sistema de desinfección. c) Mejoras a tuberías de aducción, conducción y distribución.
Mediano plazo. a) Interconexión con sistema ME-A-11 Guatuso de Patarrá”. Además, se identificaron los siguientes requerimientos dentro del proceso para asumir el acueducto: “a) Topografía y avalúos para adquisición de bienes inmuebles. b) Análisis de calidad del agua de las fuentes existentes. c) 1 vehículo tipo motocicleta para la inspección, operación y mantenimiento del sistema. d) 3 plazas de funcionarios operativos para mantenimiento y operación de la infraestructura de acueducto. e) 3 plazas de funcionarios operativos para inspección del estado de la infraestructura civil de las nacientes, tanques y estaciones de desinfección del sistema, ejecución de trabajos de mantenimiento de accesos, zonas verdes, limpieza, pintura y reparaciones a la infraestructura civil de las nacientes, tanques y servidumbres de paso. f) Nuevo plantel operativo. g) Presupuesto para la ejecución de las mejoras operativas y proyectos de inversión”.
En informe técnico No. SG-GSGAM-2022-01308 para asumir el acueducto de Dirección05– e establece con carácter de urgencia que se debe implementar un sistema de desinfección eficiente en el tanque principal La Zetilla, mejorar los tramos y las uniones de la tubería de aducción (alrededor de 740 m) en la margen de la quebrada, así como ejecutar trabajos de mantenimiento civil y mejora de la infraestructura existente. Además, se indica en una de las recomendaciones del informe que “será necesario mantener informada a la comunidad de Dirección01 y Dirección04 acerca del proceso de asunción que desarrollará el AyA, así como también de todas las mejoras que finalmente se aprueben para este acueducto. La agrupación del acueducto deberá seguir operando el sistema hasta la fecha en la que se defina que AyA asumirá de pleno”. Uno de los principales obstáculos que se identificó para iniciar la ejecución de las mejoras de corto plazo fue el camino de acceso para llegar a las nacientes y tanques del acueducto de Dirección05– pues se encontraba en deplorable estado, lo cual impedía que ni siquiera con vehículos 4x4 se pudiese trasladar mano de obra y materiales hasta el sitio en época lluviosa.
Por tal motivo, el 07 de febrero de 2023 la Macrozona Este envió el documento No. SG-GSGAM-MZESTE-2023-00091 dirigido a la Municipalidad de Desamparados solicitando apoyo de modo que se mejore el acceso de vehículos y camiones al menos hasta el sitio de tanques y se dote de una adecuada infraestructura para el manejo de aguas pluviales con el fin de evitar inconvenientes y daños en época lluviosa; empero, no se recibió respuesta. El 13 de febrero de 2023, debido a que la Subgerencia Gestión de Sistemas GAM requiere de apoyo de otras dependencias del ICAA para la ejecución de todas las actividades del plan para asumir el acueducto de Dirección05– se envió el oficio No. UEN-OSMS-GAM-2023-00013 emitido por la UEN Optimización de Sistemas, Mejoramiento de Sist. GAM solicitando formalmente la colaboración e involucramiento de todos los actores del proceso, incluyendo la Gerencia General. Mediante oficio No. GG-2023-00421, la Gerencia General respondió con el documento reafirmando el apoyo.
En el acto solicitó el compromiso y colaboración de todas las áreas involucradas en el proceso. El 04 de julio de 2024, la UEN Optimización de Sistemas, Mejoramiento de Sist. GAM envió a la Municipalidad de Desamparados el oficio No. UEN-OSMS-GAM-2024-00123, en el cual se solicitó permiso para que sea el ICAA quien ejecute la mejora del camino por medio de un plan que involucraba el aprovechamiento de material de escombro limpio que la Subgerencia Gestión de Sistemas GAM genera a diario debido a la actividad de reparación de fugas en tuberías de sistemas de agua potable. El 18 de julio de 2024 la Municipalidad de Desamparados contestó mediante documento No. TE-GE-207-2024 y se refirió a la poda y desrame requerido como parte de la mejora de los caminos de acceso. Además, no puso objeción alguna a los trabajos propuestos por el ICAA; sin embargo, no fue posible realizar las obras por motivos climatológicos propios de la época lluviosa 2024, así como la priorización de iniciativas de inversión de obra pública y reducción de agua no contabilizada en los sistemas de agua potable que administra la institución dentro del GAM.
La propuesta para asumir el acueducto de Calle Naranjo – Zetilla contempla única y exclusivamente los sesenta y nueve servicios identificados en el momento de realización del diagnóstico, ya que para asumir la totalidad de la población de Dirección01 y Dirección06 es necesario un proyecto de inversión a mediano plazo para mejorar el almacenamiento y las redes de distribución desde los tanques secundarios a la población con el propósito de reforzar el caudal disponible para el suministro de agua potable y así satisfacer la demanda proyectada a futuro para esta población. Lo anterior implica que no existe disponibilidad para nuevos servicios en este sistema, condición que solo cambiará cuando se ejecuten las inversiones a mediano plazo. En la actualidad, el ICAA avanza en retomar el plan para asumir el acueducto de Dirección05– siendo que en el correo de coordinación enviado el 24 de junio de 2025 se adjuntó el plan donde se formulan acciones operativas de corto plazo con su respectivo responsable.
Igualmente, en dicha coordinación se propone una visita al sitio para inicios del mes de julio de 2025 con el fin de refrescarle a todos los actores involucrados el estado y funcionamiento del sistema por asumir, así como las necesidades por solventar. El plan de acciones operativas de corto plazo para asumir acueducto Dirección05– stablece lo siguiente:

2 – Realizar una visita y determinar acciones necesarias para el mantenimiento operativo de la infraestructura existente.
3 – Realizar el acondicionamiento de seguridad perimetral para la instalación de un equipo de clorado en el tanque principal.
UEN PyD GAM - Plantas Potabilizadoras 1 – Realizar una visita al tanque principal de Dirección04 y determinar las características del equipo de cloración de dosificación de tabletas de hipoclorito de calcio, así como comenzar el proceso de adquisición de uno implementarlo a la brevedad posible.
Segunda Instancia Macrozona Este – Zona 2 1 - Realizar una sustitución de las tuberías de aducción del sistema.

Tercera Instancia UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Reunión con la organización comunal que actualmente administra el acueducto, para informar de los cambios en el operador del servicio y nievas condiciones del servicio.
Unidad de Hidrantes GAM 1 – Realizar un estudio de los elementos necesarios para el debido cumplimiento de la ley de hidrantes y recomendaciones técnicas del benemérito cuerpo de bomberos de Costa Rica.
UEN Servicio al Cliente GAM / UEN OS GAM / Macrozona Este GAM 1 - Realizar una reunión con la comunidad para aclarar los cambios que se darán en el sistema tanto administrativo como en termino de funcionamiento del acueducto.
Se espera para el tercer trimestre de 2025 contar con el plan debidamente actualizado con sus respectivos plazos. Finalmente, se demostró que la Subgerencia Gestión de Sistemas GAM, con el apoyo de la UEN Gestión Ambiental, cuenta con un equipo especializado para el abordaje social y sensibilización de la comunidad durante el proceso para que ICAA asuma el acueducto de Dirección05– de modo que se tendrán sesiones con la comunidad, quienes podrán aclarar todas sus consultas y conocer a fondo todo lo que implica ser usuarios comerciales de la institución.
En la especie, si bien el ICAA describe las diferentes gestiones que ha realizado para asumir el control del acueducto Calle Naranjo – Zetilla, lo cierto del caso es que, actualmente, impera el hecho que, a la fecha de interposición de este recurso el suministro de agua potable en la comunidad de Dirección01 sigue siendo ejecutado por el Comité de usuarios del acueducto Dirección05; esto, con el agravante que, según lo informado por la propia autoridad recurrida, se realiza al margen del ordenamiento jurídico. En ese orden de ideas, es menester a colación lo informado por la Gerente General del ICAA, en lo medular: “Corresponde indicar que el suministro de agua potable por parte de dicho Comité de usuarios del acueducto Dirección05 ha sido realizado al margen del ordenamiento jurídico, siendo este un operador no habilitado legalmente. Por consiguiente y con base en la valoración técnica emitida, el AyA se encuentra dando seguimiento al proceso hasta que se materialicen las acciones planteadas en dicha valoración técnica y con ello se regularice la prestación del servicio de abastecimiento de agua potable (…) Debemos reiterar lo indicado en el informe técnico Acueducto Dirección07– siendo que dicho operador del sistema es un operador irregular”.
En razón de lo expuesto, lo procedente es declarar con lugar el recurso a efecto que la institución accionada emita las órdenes y lleve a cabo las actuaciones respectivas en el ámbito de su competencia, a fin de asumir el control del acueducto Dirección05– solucionar así en forma definitiva el problema denunciado por la parte recurrente respecto a la prestación del servicio de agua potable en la comunidad de Dirección01.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en el plazo de seis meses, contado a partir de la notificación de esta sentencia, el ICAA asuma el control del acueducto Calle Naranjo – Zetilla y solucione en forma definitiva el problema denunciado por la parte recurrente respecto a la prestación del servicio de agua potable en la comunidad de Calle Naranjo. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a María Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ejerza ese cargo, que emita las órdenes correspondientes y lleve a cabo todas las actuaciones respectivas dentro del ámbito de sus competencias para que, en el plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, se asuma el control del acueducto Dirección05– se solucione en forma definitiva el problema denunciado por la parte recurrente respecto a la prestación del servicio de agua potable en la comunidad de Dirección01. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
