Document Review Decision No. 2025024007 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on uno de agosto de dos mil veinticinco.

Writ of amparo proceeding (recurso de amparo) processed under case number 25-016872-0007-CO, filed by Nombre01, identity card CED01, against the NATIONAL ROADWAY COUNCIL (CONAVI) and the MUNICIPALITY OF LA CRUZ.

Considering the Facts:

  1. 1By a written submission filed with the Office of the Clerk of the Chamber and added to the case file at 20:55 on 11 de junio de 2025, the petitioner filed a writ of amparo against the NATIONAL ROADWAY COUNCIL (CONAVI) and the MUNICIPALITY OF LA CRUZ. She states, in summary, that she resides, together with two other older adults, on the property registered under real property folio (finca matrícula de folio real), located adjacent to Dirección01 in the canton of La Cruz, Guanacaste. She indicates that the property has continually experienced a problem involving the improper management of stormwater (aguas pluviales). She explains that there is a culvert (alcantarilla) on that national roadway, which is administered by CONAVI, and that the water flowing through that structure is diverted directly toward the aforementioned property, causing flooding, overflows, and loss of land, particularly during the rainy season.She notes that, for more than twenty years, numerous petitions have been submitted to the Municipality of La Cruz, which has intervened sporadically by performing cleaning work; however, it has acknowledged that it lacks direct jurisdiction over the culvert. She adds that the engineer from the Technical and Road Inspection Unit indicated that jurisdiction lies with CONAVI because it is a national roadway; nevertheless, coordination between the two institutions has been insufficient to achieve an effective solution. She asserts that, at the same time, the local government has failed to fulfill its duty to properly channel the district’s stormwater, allowing it to discharge uncontrollably onto the affected property. She points out that the construction of the drainage-pipe system (obras de cañería) has remained unfinished for reasons beyond the affected party’s control, related to legal proceedings concerning adjoining properties, a situation that has persisted for more than two decades, during which the local administration has taken no effective action.She explains that, as a direct consequence of the prolonged failure to act by both entities, a significant portion of the land has been affected by erosion, loss of topsoil, and diminished functionality and value, in addition to the potential risk to the occupants of the property. She believes that the foregoing violates her fundamental rights, particularly in view of her vulnerable status. She requests that the petition be granted, with the consequences prescribed by law, and that CONAVI be ordered to immediately and permanently clean, maintain, and repair the culvert located on Dirección02 that affects the undersigned’s property, as well as to implement an appropriate technical solution to prevent its waters from discharging onto SAID private property. She further requests that the Municipality of La Cruz be ordered to complete the stormwater drainage network (red de alcantarillado pluvial) in the affected area, adopting the measures necessary to ensure proper water runoff.
  2. 2By an order issued at 22:06 on 21 de junio de 2025, the present proceeding was admitted, and the executive director of CONAVI, as well as the Mayor, the Head of Public Works and Services, and the Director of the Technical Road Management Unit, all from the Municipality of La Cruz, were ordered to respond regarding the facts alleged by the petitioner.
  3. 3Mauricio Sojo Quesada, Acting Executive Director of the National Roadway Council, states under oath that, according to the Road and Bridge Maintenance Division, the water affecting the property is neither stormwater nor does it originate from Dirección03; rather, it is sewage (aguas servidas) originating from cantonal streets in the urban center of La Cruz. This water is conveyed through a Rib Loc-type plastic pipe measuring 1,5 m in diameter, located partly on adjoining private properties, and discharges into a culvert within the right-of-way (derecho de vía) of Dirección03 through an open channel constructed outside the right-of-way. It was indicated that the local government’s use of that culvert to discharge sewage is improper because that infrastructure was designed exclusively to convey stormwater within the national road network. He states that the CONAVI culvert crossing (paso de alcantarilla) was inspected on 3 de octubre de 2024 and 24 de junio de 2025, and on both occasions it was found to be operating normally, with no stormwater present and no evidence of blockages.Preventive cleaning was also performed on 28 de septiembre de 2024 and 25 de junio de 2025. He indicates that CONAVI first learned of Ms. Nombre01’s case through an email dated 17 de setiembre de 2024, sent by Ms. Silvia Cruz, to which a response was provided on 18 de setiembre de 2024; Ms. Silvia Cruz was subsequently contacted by telephone, and an on-site inspection was arranged. He specifies that the technical inspection was conducted on 3 de octubre de 2024 in the presence of a family member designated by Ms. Silvia Cruz. He states that, during the visit, sewage or wastewater (aguas residuales) was found to be discharging through the transverse culvert crossing located at Dirección03, specifically from an open channel constructed on private properties located outside the right-of-way of the aforementioned national route. He explains that it was verified that the wastewater originates from cantonal streets in the populated center of La Cruz and therefore does not originate from the national road infrastructure or its public-domain area (zona de dominio público).He asserts that, regarding the condition of the culvert crossing on National Route No. 1, it was documented that, at the time of the inspection, it was clean and operating properly, allowing the normal flow of the water—which is not stormwater—from west to east through the existing pipe. He emphasizes that, prior to the technical visit, specifically on 28 de septiembre de 2024, the corresponding preventive cleaning of the drainage system located in front of Ms. Nombre01’s property, on the same national route, had been performed. He notes that, on 24 de junio, an inspection was conducted on National Route No. 1 at the location of the culvert crossing associated with the alleged harm, and it was operating normally; once again, sewage from the open channel on private property was observed, rather than stormwater. He reports that cleaning was scheduled to remove a minimal amount of trash from the inlet headwall (cabezal de entrada).He concludes that the foregoing establishes that the harm alleged by the petitioner originates from an unfinished drainage-pipe network and an open channel located on private properties adjoining her land, which rules out that such works were constructed or administered by the National Roadway Council or that they entail responsibilities attributable to CONAVI. He stresses that CONAVI cannot be held responsible for the effects arising from that infrastructure, the management of which—according to the petitioner herself—is the responsibility of the local government. He reiterates that CONAVI has fulfilled its substantive responsibilities by performing routine maintenance on the drainage system located within the right-of-way of National Route No. 1, including cleaning the transverse culvert crossing and the lined roadside ditches (cunetas revestidas) in the area of the alleged harm, all of which has been duly documented.He asserts that the Project Engineering Department has received no formal reports or complaints from the Local Government or from users of Dirección04 concerning flooding or harm attributable to stormwater runoff from that national roadway at the site under review. He clarifies, with respect to the photographs submitted by the petitioner showing significant flooding in the area in question, that there is no technical evidence or record indicating that this condition was caused by the operation of the national road infrastructure. On the contrary, based on the condition of the drainage system at the time of the inspection, the infrastructure was in proper condition and had adequate conveyance capacity. He believes that the images could correspond to extraordinary events associated with extreme natural phenomena, such as the passage of a hurricane or tropical storm, which constitute force majeure (fuerza mayor) and fall outside the responsibility of this National Roadway Council.He infers that the harm alleged in this case was caused by sewage discharges from local systems unrelated to the national road network, particularly an unfinished drainage-pipe network and an open channel located on private properties and connected to the drainage of cantonal streets in the populated center of La Cruz. He notes that the matter must be addressed by the local government and the direct generators of those discharges, who must undertake the proper treatment and management of this wastewater. He requests that the petition be denied.
  4. 4Luis Alonso Alán Corea, in his capacity as Mayor of the Municipalidad del Cantón de La Cruz, states under oath that the Departamento de Gestión Ambiental indicated that, on 16 de setiembre de 2024, it received, on a single occasion, an email from Ms. Silvia Cruz, who asked the Gestión Ambiental area about an apparently unfinished project which, she presumed, included the sewer system running across her mother’s property, her mother being the current petitioner. He adds that, on 17 de setiembre de 2024, the person in charge of the works and services area of the Departamento de Gestión Ambiental informed her that, considering that the issue originated in a roadworks project and that it was located alongside a national route, responsibility for addressing the resulting problems lay with the Consejo de Seguridad Vial. He further states that, similarly, on 16 de setiembre de 2024, the Engineer from the Departamento de Unidad Técnica de Gestión Vial received, for the first time, an email inquiry regarding the Municipal Sewer System in Dirección05, popularly known as the INA sector, in response to which he informed Ms.Silvia Cruz that the route to which she referred was route #01, which was not a cantonal but a national route; consequently, its maintenance and preventive and corrective actions were the responsibility of the Consejo Nacional de Vialidad (CONAVI). He therefore forwarded her request to the appropriate entity, copying the Engineer from that institution, Engineer Gustavo Alvarado, on the same email. He specifies that the culvert (alcantarilla) is located in Dirección02, known as Dirección06#, and that its administration and maintenance are the responsibility of CONAVI. He states that, with respect to flooding, overflows, and landslides (desprendimientos de tierras), no incidents have been reported to the agencies responsible for emergency response. He indicates that the petitioner’s property, recorded property folio , cadastral plan , apparently, based on the hydrography layer obtained from the Sistema Nacional de Información Territorial, or SNIT, and the information contained in State Natural Heritage certification (certificación de Patrimonio Natural del Estado) SINAC-ACG-DR-PNE-ZMT-001-2025, suggests the existence of a body of water or natural stream (yurro natural) serving as a channel for the natural discharge of stormwater (aguas pluviales); this stream apparently runs naturally across the northern corner of the petitioner’s land, a fact tacitly acknowledged by the petitioner.He explains that the only communication received from the petitioner was the inquiry submitted by her daughter on 16 de setiembre de 2024, to which a response was provided; it is therefore untrue that the Municipalidad was alerted on multiple occasions regarding the situation alleged by the petitioner. He states that the allegation that the Municipalidad de La Cruz discharges the district’s stormwater without control is unfounded, since the stormwater has followed the course naturally determined by the topography of the land, flowing into the natural stream that apparently originally crosses the northern corner of the petitioner’s land and that, according to a report from the Departamento de la Unidad Técnica y Gestión Vial Municipal, has not received any additional flow. He says that although the stream in question is not graphically depicted on the cadastral plan associated with the petitioner’s property, the available indications support a presumption that a natural stream exists; in this regard, pursuant to section 94 of the Ley de Aguas: “Lower-lying lands are required to receive waters that flow naturally, and without human intervention, from higher lands, as well as the soil or stones carried along their course (…)”.They consider it appropriate to make the corresponding inquiry with the Dirección Nacional de Aguas to determine whether it constitutes public-domain property (bien demanial). Furthermore, the petitioner seeks intervention on private property through which natural runoff (escorrentía natural) passes. Under that premise and in accordance with the principle of legality (principio de legalidad), the Ley General de Caminos Públicos clearly establishes the obligation of owners or possessors of properties adjoining public roads to receive and channel the stormwater flowing down them when the topography so determines. In this regard, articles 14 and 20 of the Ley General de Caminos Públicos provide that: “All possessors of real property, under any title, are required to receive and allow road waters to flow through their properties when the slope of the land so determines, and when their properties are adjacent to road drains, they must keep those drains clean, in perfect working order, and free of obstructions.” He discloses that, with respect to the apparent existence of unfinished piping, the pipe running through the lot belonging to the Municipalidad de La Cruz encloses that natural runoff in piping installed in prior years, and the site has undergone restoration of areas of municipal land without altering the natural runoff or topography in a manner that would increase the flow or affect the area of the petitioner’s lot.He explains that, according to a site visit conducted by the Departamento de Unidad Técnica y Gestión Vial, there is no evidence of erosion or of any process causing damage to the lot that demonstrates a loss of land area. The natural drainage (drenaje natural) observed in Dirección07 has existed since the route was built in the 70”s, and the installed culvert (corrugated iron) remains at the site unchanged and has done so for more than two decades; thus, it is not a construction practice currently used in the country. He adds that the petitioner has submitted no suitable evidence supporting the alleged loss of property value related to the real property, nor reliable evidence of the land’s value, and that the amparo proceeding (amparo) is not the proper avenue for seeking the payment claimed by the petitioner. He requests that the petition be dismissed.
  5. 5The Acting Judicial Technician 3 and the Secretary, both of the Sala Constitucional, certify that, upon reviewing at 10:39 hours on 14 de julio de 2025 the Sistema Costarricense de Gestión de Despachos Judiciales, the log of documents received, and this case file, there was no indication that, from 02 al 11 de julio de 2025, the Head of Works and Services or the Director of the Unidad Técnica de Gestión Vial, both of the Municipalidad de la Cruz, had filed any brief or document for the purpose of submitting the report requested from them.
  6. 6The legal requirements have been observed in the proceedings conducted.

Justice Salazar Alvarado authors the opinion; and,

Whereas:

I.Subject matter of the petition. The petitioner, who is an older adult, complains of the improper management of stormwater affecting her property, located across from Dirección01, in the canton of La Cruz, Guanacaste. She requests that the Consejo Nacional de Vialidad (CONAVI) be ordered to carry out the immediate and permanent cleaning, maintenance, and repair of the culvert on the national road that causes flooding and overflows on the property, as well as to implement a technical solution preventing stormwater from discharging onto her property. She likewise requests that the Municipalidad de La Cruz complete the storm sewer network (red de alcantarillado pluvial) in the affected area and adopt the measures necessary to ensure proper water drainage and prevent future damage, thereby safeguarding her fundamental rights and those of the property’s vulnerable occupants.

II.Preliminary matter. According to the certification added to the case file, neither the Head of Works and Services nor the Director of the Unidad Técnica de Gestión Vial, both of the Municipalidad de la Cruz, filed a brief or document for the purpose of submitting the report requested from them. Pursuant to article 45 of the Ley de la Jurisdicción Constitucional, if the report required from the respondent is not submitted within the period granted for that purpose, as occurred in this case, the facts will be deemed true and the amparo will be decided without further proceedings. However, that circumstance is not sufficient grounds for automatically granting the petition, since the admissibility and merits of the petition must be examined on the basis of the allegations made and the other evidence entered into the record.

Furthermore, before examining the merits of the allegation—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since Sentencia N° 2008-02545, issued at 8:55 hours on 22 de febrero de 2008, this Sala has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—matters in which the issue is whether the public administration complied with the time limits established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws governing special administrative proceedings, whether for issuing a final administrative decision in proceedings initiated ex officio or at a party’s request, or for deciding the available administrative appeals. In this sub lite, precisely such an exception is alleged because the complaint was filed on behalf of an older adult and allegedly was not addressed within a reasonable period.

III.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • 1)The petitioner is sesenta y ocho years old, and Silvia Cruz Avilés, identity card N° 503800921, is her daughter (inquiry conducted in the Registro Civil).
  • 2)The petitioner appears as the owner of the property registered under real-property folio number Nº 5-15449-000, corresponding to cadastral plan Nº G-0493731-1983 (see copies of the certification and plan).

A.- Regarding CONAVI:

  • a)On 17 de septiembre de 2024, an email sent by Silvia Cruz, daughter of the petitioner herein, was received (see report and copy of official letter CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • b)On 18 de setiembre de 2025, the respondent authority addressed the request and coordinated a site visit (see report and CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • c)On 28 de septiembre de 2024, preventive cleaning work was performed on the sewer system (see report and copy of official letter CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • d)On 3 de octubre de 2024, in the presence of a family member designated by the interested party, the reported location was inspected, and it was verified that sewage or wastewater (aguas servidas o residuales) was discharging into the culvert crossing at Dirección04 from an open channel built on private property outside the right-of-way (derecho de vía) of Ruta Nacional N° 1. It was also confirmed that the culvert crossing was clean, and therefore the sewage, rather than stormwater, was flowing normally through the pipe from west to east (see report and CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • e)On 25 de junio de 2025, preventive cleaning work was performed on the sewer system (see report).

Regarding the Municipalidad de La Cruz.

  • a)On 16 de septiembre de 2024, Silvia Cruz, the petitioner’s daughter, sent an email to the Área de Gestión Ambiental in which she reported that an unfinished sewer project was causing flooding and affecting the property, and therefore asked which entity was responsible for cleaning it and resolving the problem (see report and copy of the email).
  • b)On 17 de setiembre de 2025, the official in charge of the Works and Services Area of the Environmental Management Department responded to the aforementioned communication, indicating that, because the structure is located across from a national route, responsibility for addressing the problem lay with the National Road Council (CONAVI) (see report and copy of the email).
  • c)The culvert (alcantarilla) in question is located on Ruta Nacional Nº 1 (Interamericana Norte), fifty meters from the appellant’s residence, and its administration and maintenance fall under the responsibility of the National Road Council (see report and copy of official letter MLC-UTGV-OF-217-2025).
  • d)The Municipality has neither artificially altered or redirected that watercourse (cauce) nor caused an increase in its flow (see report).
  • e)The channel constitutes natural runoff (escorrentía natural) and was placed in a pipe years ago by the Municipality; this involved the recovery of areas of municipal land, without altering its status as natural runoff or the topography in a manner that would increase the flow or affect the area of the aforementioned lot (see report of the respondent authority).
  • f)Regarding flooding, overflows, or landslides, there are no records of incident reports filed by the appellant with the competent emergency-response entities (see report and copy of official letter MLC-UTGV-OF-217-2025).
  • g)On 26 de junio de 2025, an on-site inspection was conducted, and according to the technical inspection performed by the Municipal Technical and Road Management Unit Department, there was no evidence of erosion processes or loss of land on the appellant’s lot, nor of any effects attributable to the pipeline crossing the adjoining municipal lot, which follows the existing natural runoff (see report and copy of official letter MLC-UTGV-OF-217-2025).

IV. Unproven facts. The following facts relevant to this decision are not deemed proven

  • a)That the Municipality artificially altered or redirected that watercourse or carried out works that increased the flow.
  • b)That the flooding is the result of malfunctioning national road infrastructure.
  • c)That CONAVI provided a written response to the request submitted by the appellant’s daughter on 17 de setiembre de 2024.

V.Merits. From its analysis of the reports submitted by the National Road Council and the respondent Municipality, together with the evidence provided, the Chamber finds that both institutions are aware of the situation affecting the appellant in connection with the flooding problems caused by a water discharge that crosses her property and empties into a culvert located on the national route. However, neither entity accepts responsibility for the situation, since the Municipality stated under oath that, because the structure is located across from a national route, responsibility for addressing the problem lies with the National Road Council (CONAVI), as the competent entity. It added that the channel constitutes natural runoff and was placed in a pipe years ago by the Municipal Government, without altering its status as natural runoff or the topography in a manner that would increase the flow or affect the area of the protected party’s property.

In turn, in its defense, CONAVI informed this Chamber that the waters affecting the appellant’s property are neither stormwater (aguas pluviales) nor derived from the drainage system of Ruta Nacional N.° 1; rather, they consist of wastewater discharges (descargas de aguas servidas) originating from local systems unrelated to the national road network, specifically an unfinished pipeline network and an open channel located on private properties, and therefore involve circumstances outside CONAVI’s administration.

From the statements made by both authorities, the Chamber concludes that the two reports are contradictory. Nevertheless, from those reports and the evidence provided, it finds that water is indeed conveyed through a pipe and discharged into the aforementioned national culvert through an open channel constructed on private properties, and that this infrastructure does not form part of the national road drainage system, which was designed not to handle wastewater but exclusively to handle stormwater. That said, given the summary nature of the amparo proceeding (recurso de amparo), it is not for the Chamber to determine whether such water is the result of natural runoff or is wastewater, or whether its use and discharge into the culvert constitute an improper deviation from the technical purpose of the public works. It is therefore neither practically nor reasonably possible to undertake a complex and lengthy evidentiary process to resolve these issues, since they exceed the summary nature of the amparo proceeding, as well as the jurisdiction granted to this Court by the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional) and the Political Constitution (Constitución Política) itself. Accordingly, this grievance must be raised and examined before the respondent party itself or through the ordinary judicial proceedings specifically established for that purpose.

It should also be noted that CONAVI has performed preventive cleaning and routine maintenance work on the infrastructure under its authority, including interventions on 28 de septiembre de 2024 and 25 de junio de 2025, and that the culvert crossing in question was found to be in proper working condition at the time of the technical inspections. Thus, the National Road Council (CONAVI) did not construct, operate, or channel the waters affecting the appellant’s property because, as indicated, the works giving rise to the problem are located outside the right-of-way (derecho de vía) and do not form part of the national road infrastructure under its authority. Therefore, there is no objective or technical evidence that the national road infrastructure caused the alleged effects, nor has it been proven that CONAVI failed to fulfill its legal or constitutional duties. On the contrary, the normal operation of the public works was verified, as was the absence of blockages or abnormal runoff attributable to that entity; consequently, no violation of the appellant’s fundamental rights is established in this respect.

Nevertheless, the Chamber finds it noteworthy that although COSEVI is aware of the complaint made by the appellant and conducted an inspection as a result, there is no record that a written response was provided to her regarding the request contained in the email sent on 17 de setiembre de 2024. For that reason, her right to prompt and effective justice was violated in this respect.

VI.Furthermore, this Chamber notes that there is unfinished municipal infrastructure and, on the other hand, a citizen who alleges that this causes her property to flood. Accordingly, under the pro homine principle (principio pro homine) and Article 169 of the Political Constitution, which establishes the duty of the country’s Municipalities to safeguard the interests of the residents within their jurisdictions, such municipal corporations are required to eliminate any threat that places at risk the rights to health and to a healthy and ecologically balanced environment of persons living in their canton (see, to that effect, Judgments N° 2008-11739, at 12:12 hours on 25 de julio de 2008, and N° 2011-003043, at 16:03 hours on 08 de marzo de 2011).

In view of the foregoing, the respondent Municipality is required to conduct a comprehensive examination of the situation reported by the appellant, who is an older adult, in order to determine the source of the problem and those responsible for it, since addressing and correcting it falls to the local government within the municipal administration’s own authority over public services, environmental sanitation, and the protection of public health. Thus, although there is no record that the Municipality altered the natural watercourse or contributed to the increase in flow, or that this caused the effects on the appellant’s property, the fact remains that the municipal corporation has authority to properly manage and channel wastewater and stormwater within the canton. Therefore, should municipal liability exist, it is limited to the failure to intervene to complete the unfinished works and control the discharges. Accordingly, the amparo petition is granted in this respect.

VII. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the courts of the Contentious-Administrative Jurisdiction (jurisdicción de lo contencioso-administrativo), rather than this Chamber, are the bodies that must hear the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the amparo proceeding established by Article 32 of the Law on Constitutional Jurisdiction, in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases where petitioners consider that the Administration’s material actions, administrative acts, or response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Court to alter its line of precedent, since, pursuant to section 7 of its Law, it alone is responsible for defining its own jurisdiction.

Accordingly, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases—and for the reasons stated by this Court (Judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008)—jurisdiction lies with the judges of the Contentious-Administrative Jurisdiction. All of this is consistent with section 25 of the American Convention on Human Rights, the Law of the Constitution (Derecho de la Constitución)—its values, principles, and rules—and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.

VIII. NOTE BY JUSTICE SALAZAR ALVARADO

As a matter of principle, I consider that cases involving the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure works should be dismissed because such an omission is a matter of ordinary legality, the discussion of which falls within the ordinary jurisdiction, where the interested person may challenge the matter more fully. However, when that administrative failure to act results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups regarded as vulnerable, I do address the merits because such a situation constitutes an exception to my position on this subject. That is the case in this amparo proceeding, in which the appellant, who is an older adult, alleges that the respondent authorities have failed to take the appropriate measures to resolve the flooding problem that purportedly affects her property and threatens the physical integrity of the other older adults who live there.

IX. PARTIAL DISSENT BY JUSTICE GARRO VARGAS REGARDING THE OPERATIVE PART OF THIS JUDGMENT

Although I agree with the majority of the Chamber that the appeal should be granted, I disagree as to where the enforcement phase of the matter should be conducted, due to the lack of adequate mechanisms under the regulations governing this constitutional jurisdiction to monitor compliance with a judgment involving highly complex technical matters, such as resolving the flooding problem caused by a water outfall that crosses the protected party’s property and empties into a culvert located along the national highway, since it is an open channel constructed on private properties that is not part of the national roadway drainage system—which, in any event, was not designed to handle wastewater, but exclusively stormwater. In this regard, the provisions of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso-Administrativo) concerning enforcement (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, oversee stages of compliance, and so forth.

Therefore, pursuant to Article 56 of the Constitutional Jurisdiction Act (Ley de Jurisdicción Constitucional), I consider that the enforcement phase should be conducted before the Enforcement Division of the Contentious-Administrative and Civil Treasury Court (Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda), under the judgment-enforcement rules of that Code.

X. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any document in paper form, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the Court within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11, dated 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19, dated 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12, held on 3 de mayo del 2012, Article LXXXI.

Therefore:

The appeal is partially granted. Luis Alonso Alán Corea, in his capacity as Mayor of the Municipalidad del Cantón de La Cruz, or whoever holds that office, is ordered, within a period of THREE MONTHS from notification of this judgment, to issue the corresponding acts for the purpose of resolving the flooding problem affecting the appellant’s property and, if applicable, to coordinate with CONAVI on matters within its jurisdiction so that they may jointly resolve the situation. Mauricio Sojo Quesada, in his capacity as Acting Executive Director of the Consejo Nacional de Vialidad, or whoever holds that office, is likewise ordered, within five days from notification of this judgment, to respond to the request submitted on behalf of the appellant on 17 de setiembre de 2025. He shall also take notice that he must provide assistance, if requested by the authorities of the Municipalidad de La Cruz, so that they may resolve the problem affecting the appellant in a coordinated manner.

All of the foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Municipalidad de La Cruz and the State are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment (ejecución de sentencia) in the contentious-administrative jurisdiction. In all other respects, the appeal is denied. Justice Castillo Víquez and Justice Salazar Alvarado each issue separate notes.

Justice Garro Vargas dissents regarding the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that it be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Article 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded to that Division so that proceedings to enforce this ruling may be initiated. - Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del uno de agosto de dos mil veinticinco .

Recurso de amparo que se tramita en expediente número 25-016872-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI) y la MUNICIPALIDAD DE LA CRUZ.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala y, agregado al expediente a las 20:55 horas del 11 de junio de 2025, el recurrente interpone recurso de amparo contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI) y la MUNICIPALIDAD DE LA CRUZ. Manifiesta, en resumen, que reside, junto a otras dos personas adultas mayores, en la finca matrícula de folio real , ubicada contiguo a la Dirección01 en el cantón de La Cruz, Guanacaste. Señala que en dicha propiedad, se ha presentado, de forma continua, un problema relacionado con el manejo inadecuado de aguas pluviales. Explica que, hay una alcantarilla sobre dicha vía nacional cuya administración corresponde al CONAVI y que las aguas que discurren por esa estructura se desvían directamente hacia el fundo mencionado, generando inundaciones, desbordamientos y pérdida de terreno, en especial en la época lluviosa. Acota que, desde hace más de veinte años, se han presentado múltiples gestiones ante la Municipalidad de La Cruz, la cual ha intervenido de forma esporádica mediante limpiezas; sin embargo, ha reconocido carecer de competencia directa sobre la alcantarilla.Agrega que, por medio del ingeniero de la Unidad Técnica e Inspección Vial, se indicó que la competencia corresponde a CONAVI por tratarse de una vía nacional; no obstante, la coordinación entre ambas instituciones ha sido insuficiente para una solución efectiva. Afirma que, paralelamente, el gobierno local ha incumplido su deber de canalizar adecuadamente las aguas pluviales del distrito, permitiendo que estas desemboquen sin control en la propiedad afectada. Apunta que, la ejecución de obras de cañería ha quedado inconclusa por razones ajenas a la parte afectada, relacionadas con un litigio legal sobre propiedades colindantes, situación que persiste desde hace más de dos décadas, durante las cuales no se han ejercido acciones efectivas por parte de la administración local. Explica que, como consecuencia directa de la omisión prolongada de ambas entidades, una porción significativa del terreno ha sido afectada por procesos de erosión, pérdida de capas superficiales, y disminución de su funcionalidad y valor, amén del riesgo eventual de los ocupantes del inmueble.Estima que lo expuesto viola sus derechos fundamentales, en especial, dada su condición de vulnerabilidad. Solicita que se declare con lugar el recurso, con las consecuencias de ley y se ordene al CONAVI realizar de forma inmediata y permanente la limpieza, mantenimiento y reparación de la alcantarilla ubicada sobre la Dirección02 que afecta la propiedad de la suscrita, así como implementar una

solución técnica adecuada para que sus aguas no desemboquen en DICHA propiedad privada. Además, se ordene a la Municipalidad de La Cruz culminar la red de alcantarillado pluvial en la zona afectada, adoptando las medidas necesarias para garantizar el adecuado escurrimiento de aguas.

  1. 2Mediante resolución de las 22:06 horas del 21 de junio de 2025, se dio curso al presente recurso y se otorgó audiencia al director ejecutivo del CONAVI, así como al Alcalde, la Encargada de Obras y Servicios y al Director de la Unidad Técnica de Gestión Vial, todos de la Municipalidad de la Cruz, sobre los hechos alegados por la parte recurrente.
  2. 3Informa bajo juramento Mauricio Sojo Quesada, Director Ejecutivo a.i. del Consejo Nacional de Vialidad, que según lo indicado por la Gerencia de Conservación de Vías y Puentes, las aguas que afectan la propiedad no son pluviales ni proceden de la Dirección03, sino aguas servidas provenientes de calles cantonales del casco urbano de La Cruz, siendo que estas aguas se transportan mediante una tubería plástica tipo Rib Loc de 1,5 m de diámetro, parcialmente en propiedades privadas colindantes, las cuales se desfogan en una alcantarilla dentro del derecho de vía de la Dirección03, a través de un canal abierto construido fuera del derecho de vía. Se indicó que el uso de dicha alcantarilla por parte del gobierno local para depositar aguas servidas es indebido, ya que esa infraestructura está diseñada exclusivamente para transportar aguas pluviales dentro de la red vial nacional. Refiere que el paso de alcantarilla del CONAVI fue inspeccionado el 3 de octubre de 2024, y el 24 de junio de 2025, constatándose en ambas ocasiones su funcionamiento normal, sin presencia de aguas pluviales ni evidencia de taponamientos.Asimismo, se realizaron labores de limpieza preventiva los días 28 de septiembre de 2024 y 25 de junio de 2025. Indica que, del caso de la Sra. Nombre01 se tuvo conocimiento por primera vez mediante correo electrónico de fecha 17 de setiembre de 2024, remitido por la Sra. Silvia Cruz, al cual se le brindó respuesta el 18 de setiembre de 2024, posteriormente se conversó vía telefónica con la Sra. Silvia Cruz y se coordinó una inspección in situ. Especifica que, la inspección técnica se llevó a cabo el día 3 de octubre de 2024, con la presencia de un familiar designado por la señora Silvia Cruz. Especifica que, durante la visita, se constató la presencia de aguas servidas o residuales que desfogan a través del paso de alcantarillas transversal ubicado en la Dirección03, específicamente provenientes de un canal abierto que ha sido construido dentro de propiedades privadas, ubicadas fuera del derecho de vía de la mencionada ruta nacional.Expone que, se verificó que dichas aguas residuales provienen de calles cantonales del centro poblacional de La Cruz, por lo que no se originan en la infraestructura vial nacional ni en su zona de dominio público. Asevera que, en cuanto al estado del paso de alcantarillas de la Ruta Nacional N° 1, se documentó que al momento de la inspección se encontraba limpio y en adecuado funcionamiento, permitiendo el flujo normal de las aguas -que no son pluviales- en dirección oeste a este a través de la tubería existente. Destaca que, con anterioridad a la visita técnica, específicamente el día 28 de septiembre de 2024, se había realizado la correspondiente limpieza preventiva del sistema de alcantarillado ubicado frente a la propiedad de la señora Nombre01, en la misma ruta nacional. Apunta que, el 24 de junio se procedió a realizar una inspección en la Ruta Nacional N° 1, en el sitio donde se ubica el paso de alcantarillas de la supuesta afectación, el mismo se encontraba funcionando con normalidad, se observó nuevamente la presencia de aguas servidas provenientes del canal abierto en propiedad privada y no la presencia de aguas pluviales.Relata que, se agendó una limpieza para remover una mínima cantidad de basura en el cabezal de entrada. Concluye que, lo anterior permite establecer que la afectación alegada por la recurrente tiene como origen una red de cañerías inconclusa y un canal abierto que se localizan en propiedades privadas colindantes a su terreno, lo cual descarta que dichas obras hayan sido ejecutadas o administradas por el Consejo Nacional de Vialidad, ni implican responsabilidades propias del CONAVI. Puntualiza que, no puede atribuirse responsabilidad al CONAVI por los efectos derivados de dicha infraestructura, cuya gestión -según lo señalado por la misma recurrente- corresponde al gobierno local. Reitera que el CONAVI ha cumplido con sus competencias materiales, efectuando las labores de mantenimiento rutinario del sistema de drenaje ubicado dentro del derecho de vía de la Ruta Nacional N° 1, incluyendo la limpieza del paso de alcantarillas transversal y de las cunetas revestidas en el sector de la supuesta afectación, lo cual ha sido debidamente documentado.Asevera que, el Departamento de Ingeniería de Proyecto no ha recibido reportes ni denuncias formales por parte del Gobierno Local ni de usuarios de la Dirección04, que den cuenta de la ocurrencia de inundaciones o afectaciones atribuibles al escurrimiento de aguas pluviales provenientes de dicha vía nacional en el sitio objeto de análisis. Esclarece que, en cuanto a las fotografías aportadas por la parte recurrente, en las que se observa una inundación significativa en el sector señalado, señalar que no existe evidencia técnica ni registros que indiquen que dicha condición haya sido causada por el funcionamiento de la infraestructura vial nacional. Por el contrario, según el estado del alcantarillado al momento de la inspección, la infraestructura se encontraba en condiciones adecuadas y con capacidad de conducción funcional. Estima que las imágenes podrían corresponder a eventos extraordinarios asociados a fenómenos naturales extremos, como el paso de un huracán o tormenta tropical, situaciones que constituyen fuerza mayor y resultan ajenas a la responsabilidad de este Consejo Nacional de Vialidad.Deduce que, la causa de la afectación alegada en el presente caso responde a descargas de aguas servidas provenientes de sistemas locales ajenos a la red vial nacional, en particular a una red de cañerías inconclusa y un canal abierto localizados en propiedades privadas, vinculados al drenaje de calles cantonales del centro de población de La Cruz. Acota que, la situación corresponde su atención al gobierno local y a los generadores directos de dichos vertidos, quienes deben asumir el tratamiento y manejo adecuado de estas aguas residuales. Solicita se declare sin lugar el recurso.
  3. 4Informa bajo juramento Luis Alonso Alán Corea, en calidad de Alcalde de la Municipalidad del Cantón de La Cruz que. el Departamento de Gestión Ambiental indicó que, el 16 de setiembre de 2024, que se recibe por una única vez, correo electrónico de la señora Silvia Cruz, quien consulta al área de Gestión Ambiental sobre una aparente obra que quedó sin terminar, el cual bajo supuesto, incluía el alcantarillado que pasa sobre la propiedad de su madre, la ahora recurrente. Acota que, el 17 de setiembre de 2024, la encargada del área de obras y servicios del Departamento de Gestión Ambiental le informó, que considerando que el génesis de la problemática radicaba en una obra vial, y que por encontrarse la misma frente a ruta nacional, le corresponde al Consejo de Seguridad Vial, atender los problemas que de estos deriven. Adiciona que, de manera similar, el Ingeniero de la Departamento de Unidad Técnica de Gestión Vial, en fecha 16 de setiembre de 2024, recibe por primera vez, un correo de consulta sobre el Alcantarillado Municipal en Dirección05 o popularmente, sector INA, a lo cual este le informa a doña Silvia Cruz, que la ruta a la cual refiere corresponde a la ruta #01, no es una ruta cantonal sino nacional por lo que el mantenimientos y acciones preventivas y activas les compete al Consejo Nacional de Vialidad (CONAVI), ante ello remitía su solicitud al ente pertinente, siendo que en ese mismo correo remite al Ingeniero de dicha institución Ing. Gustavo Alvarado.Especifica que, la alcantarilla se ubica en la Dirección02 conocida como Dirección06# y la administración y mantenimiento corresponde al CONAVI. Concreta que, en lo que corresponde a las inundaciones, desbordes y desprendimientos de tierras, no existen reportes de incidentes ante los entes competentes de atención de emergencias. Señala que, la propiedad de la parte recurrente finca matrícula folio Real , plano catastrado , en apariencia conforme a la capa de hidrografía tomada del Sistema Nacional de Información Territorial o SNIT, y de la información que desprende la certificación de Patrimonio Natural del Estado SINAC-ACG-DR-PNE-ZMT-001-2025, presume la existencia de un cuerpo de agua o yurro natural que sirve como canal para el desfogue natural de las aguas pluviales; el cual en buena apariencia atraviesa de forma nativa la esquina norte del terreno de la recurrente, acto que de manera tácita reconoce la recurrente.Expone que, la única comunicación que se ha recibido por parte de la recurrente fue a través de la consulta generada por su hija el 16 de setiembre de 2024, a la cual se le brindó contestación, por lo que no es cierto que en múltiples ocasiones la Municipalidad se ha recibido alertada sobre la situación que alega la recurrente. Menciona que, no resulta de recibo alegar que la Municipalidad de La Cruz, sin control desemboca las aguas pluviales del distrito, puesto que el recorrido de las aguas pluviales, ha seguido el rumbo que naturalmente presenta la topografía del terreno, pues el recorrido que realizan las aguas pluviales desembocan en el yurro natural, que en buena apariencia atraviesa originalmente la esquina norte del terreno de la recurrente, el cual, según informe del Departamento de la Unidad Técnica y Gestión Vial Municipal no ha sido recargado. Dice que, el yurro sobre el cual se hace mención, pese a no estar gráficamente reflejado en el plano catastrado asociado a la finca de la recurrente, conforme a los indicios puede presumirse la existencia de un yurro natural, y en ese sentido conforme al numeral 94, de la Ley de Aguas: “Los terrenos inferiores están obligados a recibir las aguas que naturalmente, y sin intervención del hombre, fluyan de los superiores, así como la tierra o piedras que arrastren en su curso (…)”.Consideran oportuno realizar la debida consulta ante la Dirección Nacional de Aguas, para determinar si corresponde a un bien demanial. Por otra parte, la recurrente pretende que se intervenga sobre una propiedad privada en la cual pasa la escorrentía natural, bajo esa hipótesis y en apego al principio de legalidad, siendo que la Ley General de Caminos Públicos establece claramente la obligación de los propietarios o poseedores de predios vecinos a caminos públicos de recibir y canalizar las aguas pluviales que descienden por los mismos, cuando la topografía así lo determine, en ese sentido véase que los artículos 14 y 20, de la Ley General de Caminos Públicos, establece que “Todos los poseedores de bienes raíces por cualquier título, están obligados a recibir y dejar escurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y cuando sus fundos estén inmediatos a los desagües del camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos”.Revela que, con respecto a la aparente existencia de una cañería inconclusa, la tubería que pasa por el lote que pertenece a la Municipalidad de La Cruz, tiene un entubado de dicha escorrentía natural realizado en años pasados, y el mismo cuenta con una recuperación de áreas del terreno Municipal, sin variar la escorrentía natural, o topografía que sumen caudal o afecten el área del lote de la recurrente. Explica que, según visita de campo realizada por el Departamento de Unidad Técnica y Gestión Vial, no hay evidencia de erosión o de algún proceso de daño al lote que se evidencia pérdida de espacio, por lo que el drenaje natural que se evidencia en la Dirección07, existe desde que la ruta fue construida en los años 70”s , siendo que en sitio se encuentra esta alcantarilla colocada (Hierro corrugado) el cual no ha variado y desde hace más de dos décadas, por lo que no es una práctica constructiva que se realice en el país.Agrega que, la recurrente no presenta prueba idónea que justifique la pérdida patrimonial relacionado con el inmueble, ni prueba fehaciente del valor del terreno, además que el amparo no corresponde a la vía correcta para un cobro como el que pretende la recurrente. Solicita se declare sin lugar el recurso
  4. 5La Técnica Judicial 3 a.i. y la Secretaria ambas de la Sala Constitucional hace constar que, revisado, a las 10:39 horas del 14 de julio de 2025, en el Sistema Costarricense de Gestión de Despachos Judiciales, el control de documentos recibidos y este expediente, no apareció que del 02 al 11 de julio de 2025, la Encargada de Obras y Servicios y el Director de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de la Cruz hayan presentado escrito o documento alguno, a fin de rendir el informe que se les solicitó.
  5. 6En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

Considerando:

I.Objeto del recurso. La recurrente, quien es adulta mayor denuncia el manejo inadecuado de las aguas pluviales que afectan su propiedad, ubicada frente a la Dirección01, en el cantón de La Cruz, Guanacaste. Solicita que se ordene al Consejo Nacional de Vialidad (CONAVI) realizar de manera inmediata y permanente la limpieza, mantenimiento y reparación de la alcantarilla sobre la vía nacional que provoca las inundaciones y desbordamientos en el inmueble, así como la implementación de una solución técnica que evite que las aguas pluviales desemboquen en su finca. Asimismo, se requiere que la Municipalidad de La Cruz culmine la red de alcantarillado pluvial en la zona afectada, adoptando las medidas necesarias para garantizar el adecuado escurrimiento de las aguas y prevenir daños futuros, en resguardo de sus derechos fundamentales y de los ocupantes vulnerables de la propiedad.

II.De previo. Según constancia agregada al expediente, la Encargada de Obras y Servicios ni el Director de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de la Cruz no presentaron escrito o documento, a fin de rendir el informe que se les solicitó. De conformidad con lo dispuesto en el artículo 45, de la Ley de la Jurisdicción Constitucional, si el informe requerido a la parte recurrida no es rendido dentro del plazo conferido a tal efecto, como sucedió en el presente caso, se tendrá por ciertos los hechos y se entrará a resolver el amparo sin más trámite. Sin embargo, dicha situación no es motivo suficiente para la estimatoria automática del recurso, toda vez que se debe entrar a estudiar la procedencia del recurso con base en los alegatos esgrimidos y demás elementos probatorios allegados a los autos.

Por otra parte, previo a analizar el fondo del alegato -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la Sentencia N° 2008-02545, de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante una denuncia planteada a favor de una persona adulta mayor, que presuntamente, no ha sido atendida dentro de un plazo razonable.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • 1)La recurrente tiene sesenta y ocho años y Silvia Cruz Avilés, cédula de identidad N° 503800921, es su hija (consulta efectuada en el Registro Civil).
  • 2)La recurrente aparece como propietaria de la finca inscrita bajo el número de folio real Nº 5-15449-000, correspondiente al plano catastrado Nº G-0493731-1983 (ver copia de la certificación y del plano).

A.- En relación con el CONAVI:

  • a)El 17 de septiembre de 2024, se recibió un correo electrónico remitido por Silvia Cruz, hija de la aquí recurrente (ver informe y copia del oficio CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • b)El 18 de setiembre de 2025, la autoridad recurrida atendió la gestión y coordinó una visita en el sitio (ver informe y CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • c)El 28 de septiembre de 2024, se realizaron labores de limpieza preventiva en el sistema de alcantarillado (ver informe y copia del oficio CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • d)El 3 de octubre de 2024, con la presencia de un familiar designado por la interesada se inspeccionó el lugar denunciado y se verificó que, existen aguas servidas o residuales que desfogan en el paso de alcantarillas transversal a la Dirección04, provenientes por un canal abierto que fue construido en propiedad privada fuera del derecho de vía de la Ruta Nacional N° 1. Además se constató, que el paso de alcantarillas se encontraba limpio, por lo que las aguas servidas y no pluviales circulaba con normalidad por la tubería en dirección oeste a este ver informe y CARTA-CONAVI-DRCH-02-2025-0313 (0530).
  • e)El 25 de junio de 2025, se realizaron labores de limpieza preventiva en el sistema de alcantarillado (ver informe).

En cuanto a la Municipalidad de La Cruz.

  • a)El 16 de septiembre de 2024, Silvia Cruz, hija de la recurrente, envió un correo electrónico al Área de Gestión Ambiental, en el denunció que existe una obra de alcantarillado sin concluir lo que provoca inundaciones y afecta la propiedad, por lo que consulta a cuál ente, le corresponde la limpieza y la solución del problema (ver informe y copia del correo electrónico).
  • b)El 17 de setiembre de 2025, la encargada del área de Obras y Servicios del Departamento de Gestión Ambiental respondió la supra indicada misiva indicando que, por tratarse de una obra ubicada frente a una ruta nacional, la atención de la problemática correspondía al Consejo Nacional de Vialidad (CONAVI) (ver informe y copia del correo electrónico).
  • c)La alcantarilla en cuestión se ubica sobre la Ruta Nacional Nº 1 (Interamericana Norte), y a cincuenta metros de la vivienda de la recurrente siendo que administración y mantenimiento recae en el Consejo Nacional de Vialidad (ver informe y copia del oficio MLC-UTGV-OF-217-2025).
  • d)La Municipalidad no ha alterado o redirigido artificialmente dicho cauce ni que ha provocado el aumentado el caudal (ver informe).
  • e)El canal es una escorrentía natural y fue entubado años atrás por la Municipalidad, el cual cuenta con una recuperación de áreas del terreno Municipal, sin variar su condición de escorrentía natural o topografía que sumen caudal o afecten el área del lote mencionado (ver informe de la autoridad recurrida).
  • f)En relación con la situación de inundaciones, desbordamientos o desprendimientos de tierra, no constan reportes de incidentes presentados por la recurrente ante los entes competentes de atención de emergencias (ver informe y copia del oficio MLC-UTGV-OF-217-2025).
  • g)El 26 de junio de 2025, se realizó visita in situ y según inspección técnica realizada por el Departamento de Unidad Técnica y Gestión Vial Municipal, no se evidencian procesos de erosión ni pérdida de terreno en el lote de la recurrente, ni afectaciones atribuibles al entubado que atraviesa el lote municipal colindante, el cual respeta la escorrentía natural existente (ver informe y copia del oficio MLC-UTGV-OF-217-2025)..

IV. Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución

  • a)Que la Municipalidad haya alterado o redirigido artificialmente dicho cauce o que haya realizado obras para el aumento del caudal.
  • b)Que las inundaciones sean producto del mal funcionamiento de la infraestructura vial nacional.
  • c)Que el CONAVI haya brindado una respuesta por escrito a la gestión remitida por la hija de la recurrente el 17 de setiembre de 2024.

V.Sobre el fondo. Del análisis de los informes rendidos por el Consejo Nacional de Vialidad y de la Municipalidad recurrida aunado a la prueba aportada, la Sala verifica que, ambas instituciones son conocedoras de la situación que le aqueja a la recurrente, en relación con los problemas de inundaciones que provoca un desfogue de agua que pasa por su propiedad y caen en una alcantarilla ubicada sobre la ruta nacional. Sin embargo, ninguno de los dos entes se hace responsable de dicha situación, toda vez, que la Municipalidad manifestó bajo juramento, que por tratarse de una obra ubicada frente a una ruta nacional, la atención de la problemática corresponde al Consejo Nacional de Vialidad (CONAVI), por ser el ente competente y agregó que, el canal es una escorrentía natural y fue entubado años atrás por el Gobierno Municipal, sin variar su condición de escorrentía natural o topografía que agreguen caudal o afecten el área de la finca de la tutelada.

A su vez, en su defensa el CONAVI informó a esta Sala que, las aguas que afectan la propiedad de la recurrente no son pluviales ni provienen del sistema de drenaje de la Ruta Nacional N.° 1, sino que responde a descargas de aguas servidas provenientes de sistemas locales ajenos a la red vial nacional, en particular a una red de cañería inconclusa y un canal abierto localizados en propiedades privadas y por ende, son situaciones ajenas a la administración de CONAVI.

De lo dicho por ambas autoridades, la Sala desprende que ambos informes son contradictorios; no obstante de ellos y de la prueba aportada, constata que efectivamente existen unas aguas que son conducidas por una tubería, y que desfogan en la mencionada alcantarilla nacional, a través de un canal abierto construido en propiedades privadas siendo que esta infraestructura no forma parte del sistema de drenaje vial nacional, el cual no fue diseñado para el manejo de aguas servidas, sino exclusivamente para aguas pluviales. Ahora bien, dada la sumariedad del recurso de amparo, no le corresponde a la Sala indicar si dichas aguas son producto de una escorrentía natural o son aguas servidas, y si su uso y desfogue a la alcantarilla constituye una desviación indebida del fin técnico de la obra pública. De manera que no resulta material ni razonablemente posible entrar a un complicado y lento sistema probatorio para dilucidar estos aspectos señalados, pues exceden el carácter sumario del recurso de amparo, así como la competencia de este Tribunal otorgada por la Ley de la Jurisdicción Constitucional y la propia Constitución Política. Por ende, este agravio debe ser planteados y analizados ante la propia parte recurrida o bien, ante las vías jurisdiccionales ordinarias creadas especialmente al efecto.

Ahora bien, es menester indicar que el CONAVI ha realizado labores de limpieza preventiva y mantenimiento rutinario en la infraestructura bajo su competencia, incluyendo intervenciones los días 28 de septiembre de 2024 y 25 de junio de 2025, así como que el paso de alcantarilla en cuestión se encuentra en condiciones adecuadas de funcionamiento al momento de las inspecciones técnicas. De manera que, el Consejo Nacional de Vialidad (CONAVI) no ha construido, operado ni canalizado las aguas que generan afectación a la propiedad de la recurrente, ya que según se indicó, las obras que originan el problema se encuentran fuera del derecho de vía y no forman parte de la infraestructura vial nacional bajo su competencia. Así las cosas, en ese sentido no se encuentra evidencia objetiva ni técnica de que la infraestructura vial nacional haya ocasionado la supuesta afectación alegada, ni se ha probado que exista omisión por parte del CONAVI en el cumplimiento de sus deberes legales o constitucionales.

Por el contrario, se verificó el funcionamiento normal de la obra pública y la inexistencia de taponamientos o escurrimientos anómalos atribuibles a este ente, por lo que en cuanto este extremo, no se verifica lesión alguna a los derechos fundamentales de la recurrente. Empero, llama la atención a la Sala, que pese a que el COSEVI es conocedor de la denuncia que hizo la recurrente y en virtud de ello, efectuó una inspección, lo cierto es que no consta que se le haya remitido una respuesta por escrito a lo requerido por la interesada en el correo electrónico remitido el 17 de setiembre de 2024, razón por la cual, en cuanto este extremo, se lesionó el derecho a una justicia pronta y cumplida.

VI.Por otra parte, esta Sala advierte que existe una infraestructura municipal inconclusa, y del otro lado, una ciudadana que alega que ello, provoca que se le inunde su propiedad, por lo que en aplicación del principio pro homine y del artículo 169, de la Constitución Política, que dispone el deber de las Municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, es que dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véanse en ese sentido las Sentencias N° 2008-11739, de las 12:12 horas del 25 de julio de 2008 y N° 2011-003043, de las 16:03 horas del 08 de marzo de 2011).

En virtud de lo anterior, es obligación de la Municipalidad recurrida efectuar un examen integral de la situación denunciada por la recurrente, quien es una persona adulta mayor, a los efectos de determinar el origen de la problemática así como los responsables de la misma, ya que su atención y corrección corresponde al gobierno local, dentro de las competencias propias de la administración municipal en materia de servicios públicos, saneamiento ambiental y protección a la salubridad. Entonces, si bien no consta que la Municipalidad haya alterado el cauce natural ni que haya contribuido al aumento del caudal; y que ello sea el causante de la afectación de la propiedad de la recurrente, lo cierto es que dicha Corporación tiene la competencia para gestionar y canalizar adecuadamente las aguas servidas y pluviales dentro del ámbito cantonal, por lo que, de existir responsabilidad municipal, esta se circunscribe a la falta de intervención para terminar las obras inconclusas y controlar los vertidos. Así las cosas, en cuanto este extremo se declara con lugar el recurso.

VII. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VIII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este amparo, en que la recurrente, quien es una persona adulta mayor, acusa que las autoridades recurridas no han dispuesto lo correspondiente para dar una solución al problema de inundaciones que supuestamente afecta a su propiedad, y amenaza la integridad de las demás personas adultas mayores que viven allí.

IX. VOTO SALVADO PARCIAL RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA DE LA MAGISTRADA GARRO VARGAS

Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como lo es dar solución al problema de inundaciones ocasionado por un desfogue de agua que pasa por la propiedad de la parte amparada y cae a una alcantarilla ubicada sobre la ruta nacional, toda vez que se trata de un canal abierto, construido en propiedades privadas, que no forma parte del sistema de drenaje vial nacional —mismo que, en todo caso, no fue diseñado para el manejo de aguas servidas, sino exclusivamente para aguas pluviales—. En este sentido, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

X. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso. Se ordena a Luis Alonso Alán Corea, en calidad de Alcalde de la Municipalidad del Cantón de La Cruz, o a quien ocupe dicho cargo, para que, dentro del plazo de TRES MESES, a partir de la notificación de la presente sentencia, dicte los actos correspondientes con el fin de solucionar el problema de inundaciones que afecta la propiedad de la recurrente y coordinar con el CONAVI, si fuera el caso, lo pertinente a su competencia para resolver en forma conjunta dicha situación. Asimismo, se ordena a Mauricio Sojo Quesada, en calidad de Director Ejecutivo a.i. del Consejo Nacional de Vialidad, o a quien ocupe dicho cargo, que en el plazo de cinco días, a partir de la notificación de esta sentencia, brinde la respuesta a la gestión remitida a favor de la recurrente el 17 de setiembre de 2025. A su vez, tome nota que deberá de prestar su colaboración, si esta fuera requerida, por las autoridades de la Municipalidad de La Cruz, con el fin de que forma coordinada solucionen el problema que aqueja a la recurrente.

Todo lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de La Cruz y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En los demás extremos, se declara sin lugar. El magistrado Castillo Víquez y Salazar Alvarado consignan notas, de manera separada. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. - Fernando Castillo V.
