PJEDITOR Document Case File: 25-010235-0007-CO Decision No. 2025021358 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on July eleventh, two thousand twenty-five.
Petition for amparo (recurso de amparo) being processed under case file no. 25-010235-0007-CO, filed by Nombre01, identity card CED01, against the MUNICIPALIDAD DE CURRIDABAT, MINISTERIO DE SALUD, CONSEJO NACIONAL DE VIALIDAD (CONAVI), INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Findings of Fact:
By Official Letter CNE-DGR-OF-187-2024, the Comisión Nacional de Emergencia informed them that “in accordance with the responsibilities and powers conferred upon it by the applicable regulations, the units involved within CNE (the Operations Management Unit and the Risk Research and Analysis Unit) were consulted, and they informed us that the Municipalidad de Curridabat had sought to engage with CONAVI to address the situation, since it involves water management (manejo de aguas) and general maintenance arising from the work performed in Sector Hacienda Vieja. To that end, a meeting was held this past 17 de septiembre, at which it was concluded that, as an initial matter, CONAVI must prepare and submit studies before a possible solution—or at least a reduction of the effects—can be addressed.” They were also informed that an inspection of the area would be conducted and that they would be notified thereof.
He states that on 21 de octubre de 2024, the Concejo Municipal de Curridabat held a special session with CONAVI officials, attended by several residents of Urbanización La Troja. He indicates that the session is recorded in Minutes S.E.014-2024, which reflect the participation of several council members on behalf of the affected communities, as well as the responses of both CONAVI and the municipality, in which they undertook to provide a solution. Nevertheless, the respondent municipality remains wholly unconcerned about the situation, as it has refused to address the matter even though CONAVI assisted it by providing the project plans for the permanent solution to the problems they are experiencing because of the ditch (acequia) in question. He recounts that on 22 de octubre de 2024, the Comité de Vecinos de La Troja submitted a petition to the respondent municipality reiterating the petition filed on 12 de agosto de 2024 under processing number 16074-2024.
He relates that on 11 de diciembre de 2024, through Official Letter No. CNE-DGR-OF-318-2024, the Comisión Nacional de Emergencia sent them Technical Report No. CNE-UIAR-INF-11-2024, signed by Geologist Juan Ignacio Chaves Salas, whose conclusions stated as follows: “A) The sealing of soils through civil works (obras civiles) reduces infiltration and increases water flow in drainage systems (drenajes). B) The lack of adequate stormwater (aguas pluviales) and wastewater (aguas residuales) management could cause flooding (anegamientos), affecting infrastructure and the health of residents.” It also issued the following recommendations: “A) This drainage system must be modified, with stormwater and wastewater receiving appropriate treatment to prevent it from continuing to affect residents. B) Both CONAVI and the Municipalidad de Curridabat must act within the scope of their respective authority to take the necessary measures for the proper management and control of these waters.
Once again, it is evident that the Municipality simply disregarded the situation documented for more than 12 years, and regarding which the current Mayor, although he denies it, had all the information in his possession since Agosto del 2024. He then responded that he acknowledges it is a longstanding problem and that, moreover, “The current Municipal Mayor’s Office has issued immediate instructions to the Dirección de Gestión Vial, Departamento de Protección al Medio Ambiente and Departamento de Gestión Integral de Riesgo, with the aim of giving priority to an on-site inspection and issuing a report on the current situation.” Those instructions remained on paper; they were never carried out, much less implemented. They were never issued by the Mayor to any of the Municipal Departments, nor to the Ministerio de Salud, Conavi, Acueductos y Alcantarillados, as all the entities have stated in each report that they were not convened by the Mayor, demonstrating the current Municipal Mayor’s neglect in municipal administration.- 5.
Regarding the report submitted by Engineer Randal Rodríguez Araya, in his capacity as Director de Gestión Vial Municipalidad de Curridabat, all the photographs included in his filing depict work performed by CONAVI, and none shows the current condition of the drainage channel (acequia), the connections that have been made to the drainage channel, or the problems involving the undermining of the land. They seek to rely on photographs depicting CONAVI’s work on National land, as stated in its report, but the Municipality’s Gestión Vial submits neither a report nor photographs of the drainage channel located on Municipal land, as CONAVI made very clear in its report. It states that CONAVI cannot continue the work along the entire drainage channel because this falls within the Municipality’s jurisdiction, as it is Municipal territory. Furthermore, CONAVI confirms in its report, as well as at the Special Session of 21 de Octubre del 2024 (Fact number 21, with its corresponding evidence in the constitutional amparo proceeding (Recurso de Amparo)), that since Septiembre del 2024 it has provided the plans and everything necessary for the Municipality to continue the work on the drainage channel.
The Municipality could have begun that work last year because it had a large budget surplus (Fact number 24, with its corresponding Evidence in the constitutional amparo proceeding), thereby permanently resolving the longstanding drainage-channel problem in these communities, which are directly affected and are also concerned that their foundations have been undermined with each passing year and that, as has been demonstrated, the Mayor is not even interested in resolving it.- 6. Regarding the report submitted by Biologist José Retana, Jefe Centro de Inteligencia Territorial en Biodiversidad Departamento Protección del Medio Ambiente, it is again evident that residents, as well as previous Residents’ Committees, have been undertaking procedures to resolve the drainage-channel problem since 2012. He emphasizes that digital signatures did not exist at that time, so responses were sent in hard copy.
He states that he “submitted the scope of the project to the Mayor’s Office in late 2019, and it was determined that addressing the project from a sanitation standpoint using a treatment-plant alternative was financially and operationally unfeasible.” He also states that it was only now, in 2025, through this constitutional amparo proceeding—and I quote verbatim—that: “It was only through the report provided by ICCA for this constitutional amparo proceeding that the Departamento de Protección del Medio Ambiente officially learned that sewage from the sanitary sewer system was in fact being discharged untreated into the La Troja stormwater channel.” They include the Analytical Report dated 01-marzo-2019 from Agrotec Laboratorios Analíticos, which states that there are no Fecal Coliforms. Furthermore, Fact number 2 of this constitutional amparo proceeding, together with Documentary Evidence number 2, documents the Report on the Handling of a Complaint concerning problems with odors and sewage, issued by the Dirección Área Rectora de Salud de Curridabat to resident Nombre04 and Nombre05, dated 19 de Noviembre del 2012 (CS-ARS-CU-RS-1264-12).
It states that on 10 de Septiembre of that year (2012), an inspection was conducted along the drainage channel that crosses the entire Urbanización. It mentions an inspection chamber (caja de registro) into which a pipe discharges water whose source could not be determined. The report states that the drainage channel shows signs of severe contamination from the organic load resulting from wastewater discharges from most of the urban area in the central district of Curridabat, which has a high density of buildings developed with little or no oversight and control by the Municipality, the entity bearing primary responsibility for supervising construction development within its territory. That same report was attached to a filing dated 12 de Agosto del 2024 (Proceeding 16074- 2024), which included Laura Artavia, Encargada del Departamento de Protección al Medio Ambiente de la Municipalidad de Curridabat.
Thus, it is again evident that they not only failed to read the filing addressed to them as a Department, but also downplayed the problem of fecal matter in the drainage channel and the fact that, when the drainage channel overflows, it reaches the streets of the Urbanización. This evidence leads to the conclusion that the Área de Protección del Medio Ambiente has failed to perform its duties for at least 6 years, since the evidence submitted concerning analyses and projects dates from 2019. As can be seen in light of all the evidence and arguments, the response that they only now became aware of the matter through this constitutional amparo proceeding is unacceptable, because it means that they have not been doing their job for the past 13 years: following up on the procedures undertaken and turning a blind eye to a situation affecting several communities and Public Education Institutions.
Mr. José Retana claims lack of knowledge because he underwent surgery in 2024, but Fact number 1 of the constitutional amparo proceeding, together with its documentary evidence bearing the signatures of the Committee at that time and those of several residents, disproves his argument, because Mr. Retana has known about the storm drains and drainage-channel problem since 2012, when he worked in the Departamento de Alcantarillado Pluvial de la Municipalidad de Curridabat. It is therefore worth asking: Is he now unaware of a situation that he had known about through letters and meetings since 2012? Moreover, because he was absent for surgery, is it reasonable to accept that no one remained in the Departamento de Protección del Medio Ambiente de la Municipalidad? Clearly, that Department has always maintained staff to continue operating, as demonstrated by the fact that a letter was sent to it in Agosto del 2024.- 7.
Among the evidence submitted by the Municipalidad de Curridabat is a “Basic Hydrogeological Study of La Troja, Project: Watercourse Sanitation, Municipalidad de Curridabat,” authored by Lic. José Daniel López Oviedo and Geologist Alejandra Ceciliano Chacón. It is important to note that the study is not signed by the aforementioned authors and bears no date indicating when it was conducted. The evidence is therefore challenged and deemed illegitimate and invalid. They are introducing false information that is irrelevant and has absolutely nothing to do with the matter under discussion, solely to pad and lengthen their response.- 8. Once again, the Mayor and the Municipalidad de Curridabat are passing responsibility back and forth among themselves and the other entities named in this constitutional amparo proceeding, and they are unwilling to provide a definitive solution to our serious problem, even though they have more than sufficient financial resources and the personnel responsible for carrying out and supervising the work necessary to resolve the drainage-channel problem.- 9.
Regarding the report submitted by the Ministra de Salud, on page 5, point 2, I quote: “With respect to the appellant’s statement concerning a matter brought before the Ministerio de Salud in 2017, I must indicate that the database of complaints received by this Organizational Unit was reviewed and that there are no records of any matter initiated by the protected party.” At no time has it been claimed that I personally undertook all the procedures from 2012 to the present. On the contrary, I stated in my constitutional amparo proceeding that these represent 13 years of procedures undertaken by various residents and various Residents’ Committees. This is demonstrated by the evidence concerning the request submitted to the Ministro de Salud in 2017, under Fact number 3, with the corresponding Documentary Evidence identified as Evidence number 3, which clearly bears the stamp of the Ministerio de Salud y Desarrollo Social, with the notation “Document Received,” and the letter was signed by the President and Board Member of the Residents’ Committee for that year.- 10.
Once again, point 3 on the same page 5 of the Ministra de Salud’s report demonstrates the lack of interest of the Municipal Mayor of Curridabat, who failed to act on his letter dated 29 de Agosto del 2024, in which he told me that he would convene the entities involved in the matter. I quote from the Ministra de Salud’s report: “Regarding the appellant’s statement that the Municipalidad de Curridabat intended to carry out a joint project with the Ministerio de Salud and ICAA, I must state that this Área Rectora de Salud received no invitation or proposal from the municipality to participate in any intervention project involving the drainage channel located near Dirección04.” 11. Regarding point 4 on page 5 of the Ministra de Salud’s report, I quote: “With reference to the appellant’s statement concerning the intervention carried out by ARESEP and the report generated as a result, I must state that this Área Rectora de Salud has no knowledge of that document and was not notified of it.” I reiterate that those documents appear as Facts numbers 8, 9 and 10, together with their corresponding documentary evidence, in the constitutional amparo proceeding.- COROLLARY: The studies have already been completed by all the parties involved; we are not requesting new studies, as Errol Solanos Bolaños, Mayor of the Municipalidad de Curridabat, claims, in an effort to prevent, obstruct and delay the required corrective actions.
We do not accept statements that are untruthful, unsupported by evidence and contrary to the documentary evidence submitted. It is unacceptable to consider granting additional time to submit documents for the purpose of delaying and evading responsibility. What we demand and need is a definitive and permanent solution. The modus operandi of the Municipalidad de Curridabat is evident in its response to this constitutional amparo proceeding: it makes false statements and submits photographs of other locations, as demonstrated by photographs of the sector where CONAVI is installing pipes along the National Road Network, while omitting actual and current photographs of the drainage channel and the problem at issue. Acueductos y Alcantarillados did provide such photographs in its submitted report and confirms that resolving the drainage-channel problem is the responsibility of the Municipalidad de Curridabat because it is located within the Cantonal and Municipal Road Network. Likewise, we, as those directly affected, have documented through photographs and videos the drainage channel that endangers the health of a large number of people and public institutions.”
Justice Garita Navarro authors the opinion; and,
Whereas:
I.Preliminary matter. Given that the president of the Concejo, the official in charge of the Departamento Control Urbano, the head of the Departamento Gestión Vial, the official in charge of the Departamento de Planificación, and the official in charge of the Departamento Protección del Ambiente, all of the Municipalidad de Curridabat, failed to respond to the hearing (audiencia) within the period established by this Court in the order admitting the matter at issue (sub lite), the constitutional appeal (recurso) shall be decided in accordance with article 45 of the Ley de la Jurisdicción Constitucional and in consideration of the evidence contained in the record (autos).
II.Subject matter of the appeal. The petitioner states that he is a resident of the La Troja de Curridabat residential development. He asserts that a drainage ditch (acequia) bordering his community causes problems involving mosquitoes, flies, and nauseating odors because stormwater (aguas pluviales) mixes with sewage (aguas negras). He complains that this situation has been reported several times over the past 12 years. However, the problem has not been resolved.
III.Proven facts (hechos probados). The following facts relevant to the decision in this matter are deemed duly established, either because they have been substantiated or because the respondent (recurrido) failed to address them, as directed in the initial order:

Regarding the Municipalidad de Curridabat.
IV.The specific case. In the matter under review (sub examine), the petitioner states that he is a resident of the La Troja de Curridabat residential development. He asserts that a drainage ditch bordering his community causes problems involving mosquitoes, flies, and nauseating odors because stormwater mixes with sewage. He complains that this situation has been reported several times over the past 12 years. However, the problem has not been resolved.
Regarding the Ministerio de Salud, the Chamber found it established that, on 18 de abril de 2024, the Ministerio de Salud received a unified complaint form from several residents who complained about a drainage ditch, a pond of sewage and soapy water, and a mosquito breeding ground at the location that is the subject of these proceedings. On 14 de mayo de 2024, the Área Rectora de Salud inspected the site. According to inspection report no. 306-24: “At the reported site, I meet with several residents of the La Troja residential development, who describe a problem arising from the presence of a large vacant lot behind Escuela Juan Santamaría. I proceed to walk through it with several community residents, including Mr. Nombre03, who identifies himself as the president of the La Troja residents’ committee. They state that wastewater collects at several points on that lot, although its source is unknown because its origin is difficult to determine; only wastewater runoff and pooling in certain areas can be observed.
This vacant lot borders the La Troja residential development, causing distress to the residents who filed the complaint. Photographs are taken. Those present are informed that the complaint must be addressed through an interinstitutional approach and that municipal support and intervention will therefore be requested to address the matter.” Through official letter MS-DRRSCS-DARSCU-IT-185-2024 dated 22 de mayo de 2024, addressed to the head of Protección del Medio Ambiente of the Municipalidad de Curridabat, the Ministerio de Salud requested that municipality’s assistance in addressing the reported problem.
Regarding the ICAA, the Chamber verified that the La Troja residential development has an operational sanitary sewer system. In 2024, the ICAA carried out work in the Hacienda Vieja sector in connection with the construction of the new roundabout and resolved an operational problem with the sanitary sewer system at that location. In the Escuela Juan Santamaría sector, the sanitary sewer system is incomplete, causing water to be discharged untreated into the stream. The problem is also worsened by unlawful discharges originating from the municipal stormwater system. The ICAA plans to develop project IT-284 to resolve the problem. The project includes the following phases: design review and adjustment (III trimestre 2025), budget update (IV trimestre 2025), feasibility update (IV trimestre 2025), securing financing (IV trimestre 2025), preparation of tender specifications and tender documents (IV trimestre 2025), commencement of the tendering process (I trimestre 2026), commencement of construction work (I trimestre 2027), and completion of construction work (II trimestre 2029).
Regarding Conavi, the Chamber confirmed that it carried out stormwater channeling works in the Hacienda Vieja sector based on hydraulic technical studies and within the scope of its statutory authority over road infrastructure. The completed works neither altered nor increased the stormwater flow that naturally drains through the area. They consisted solely of optimizing the conveyance of the existing water, without generating additional inflows, and ensuring its efficient conveyance to the previously established outfall.
With respect to the Municipalidad de Curridabat, the Chamber verified that, in 2012, the problem at issue in these proceedings was already known to that local government. In 2018, the Municipalidad de Curridabat met with local residents, cleaned the stormwater channel (paso pluvial), requested a budget allocation (contenido presupuestario) to conduct a technical study (estudio técnico), and held a meeting with the Área Rectora de Salud. In 2019, the Municipalidad de Curridabat obtained the results of the technical study. However, it determined that the sanitation project (proyecto de saneamiento) involving a treatment-plant alternative (planta de tratamiento) was financially and operationally unfeasible, and it was therefore agreed that illegal connections (conexiones ilícitas) to the stormwater system (sistema pluvial) had to be reduced. In 2020 and 2021, the Mesa de Saneamiento de Curridabat convened, comprising several water-resource management institutions (instituciones de gestión del recurso hídrico).
It was determined that illegal connections to the stormwater system had to be reduced. However, based on the experience and attempts of Área Rectora officials, residents did not open the doors of their homes to allow the dye-testing procedures (procedimientos de coloración) to be performed. According to meeting minutes MC-GIR-0004-02-2025 of 12 de febrero de 2025, between representatives of the Municipalidad de Curridabat and the company Cogusa: “It is agreed that CONAVI, through the company Santa Fe, will construct a headwall (cabezal) for the two stormwater outlet pipes (tuberías de desfogue pluvial) (meaning the municipal HDPE pipe [tubería PEAD] with an internal diameter of 1200 mm and the project’s HDPE pipe with an internal diameter of 1500 mm); likewise, they will be responsible for shaping and constructing the channel with an energy dissipator (disipador de energía), to be located between the outlet headwall (cabezal de desfogue) and the unnamed ditch (acequia sin nombre), in order to prevent erosion and water ponding, as well as for protecting the slope (talud) adjoining the perimeter fence of the Escuela Juan Santamaria.” On 19 de febrero de 2025, the Departamento de Gestión Integral del Riesgo of the Municipalidad de Curridabat emailed these minutes to the engineer in charge of the procurement process (Contratación) of the Gerencia de Conservación de Vías y Puentes del Conavi.
In analyzing these facts, the Chamber finds that the problem at issue in these proceedings had been known to all the respondent authorities (instancias recurridas) since before the application for amparo (amparo) was filed. With respect to the Municipalidad de Curridabat, a 2019 technical study on the matter even exists, and it held meetings—the Mesa de Saneamiento de Curridabat of 2020 and 2021—with other entities (Ministerio de Salud, Dirección de Aguas, Instituto Costarricense de Acueductos y Alcantarillados) for the purpose of addressing it. The ICAA likewise acknowledges that the matter falls within its jurisdiction, because it concerns an unfinished section of the sanitary sewer network (red de alcantarillado sanitario), which causes untreated water to be discharged into the stream. Nevertheless, it states that the problem is exacerbated by illegal discharges (descargas ilícitas) from the municipal stormwater network.
This fact is also apparent from the reports of the respondent municipality, since it had already been agreed in 2019 that illegal connections to the stormwater system had to be reduced. This action was to be coordinated with the Ministerio de Salud. However, no results were verified in that regard. Instead, that ministry points to official letter MS-DRRSCS-DARSCU-IT-185-2024 of 22 de mayo de 2024, which it sent to the Municipalidad de Curridabat seeking its assistance in addressing the problem. Nevertheless, there is likewise no evidence that this initiative produced concrete results. Finally, although Conavi asserts that it is not responsible for the local sewer system and that its water-channeling works (obras de canalización de aguas) did not increase the flow rate (caudal), but merely optimized the conveyance of the existing water, it is nonetheless true that it fails to respond expressly to several of the applicant’s complaints, such as the fact that Conavi had been required to submit studies or that the Deputy Manager of the Conservación de Vías y Puentes division of Conavi allegedly told local council members that Conavi would assist with designing the proposal jointly with the municipality.
Added to this are meeting minutes MC-GIR-0004-02-2025 of 12 de febrero de 2025, submitted by the municipality, which stated: “It is agreed that CONAVI, through the company Santa Fe, will construct a headwall for the two stormwater outlet pipes (meaning the municipal HDPE pipe with an internal diameter of 1200 mm and the project’s HDPE pipe with an internal diameter of 1500 mm); likewise, they will be responsible for shaping and constructing the channel with an energy dissipator, to be located between the outlet headwall and the unnamed ditch, in order to prevent erosion and water ponding, as well as for protecting the slope adjoining the perimeter fence of the Escuela Juan Santamaria.” Based on the facts set out above, the Chamber confirms that an environmental problem exists that infringes the rights of the protected party (tutelado) and, more generally, those of the residents of the La Troja residential development, consisting of the discharge of untreated sewage and graywater (aguas negras y grises) into a local ditch. Clearly, the existence of that ditch under its current conditions undermines the right to a healthy and ecologically balanced environment established by Article 50 of the Constitution.
It is likewise established that each respondent entity (instancia accionada) bears responsibility—albeit to varying degrees—for comprehensively addressing the problem. Thus, for example, the Ministerio de Salud and the Municipalidad de Curridabat must coordinate to eliminate the problem of illegal connections to the stormwater system. The ICAA must ensure completion of the sanitary sewer network, coordinating for that purpose—if necessary—with the respondent municipality. Conavi and the Municipalidad de Curridabat must also collaborate to verify compliance with the agreements recorded in the minutes of 12 de febrero de 2025. This list, which is not intended to be exhaustive, demonstrates the need for all respondents to work together to properly resolve the reported problem. The Chamber emphasizes the importance of interinstitutional coordination (coordinación interinstitucional) in addressing larger-scale problems that, by their nature, require each government entity to exercise its authority in a coordinated manner to achieve a comprehensive solution. On the terms indicated, the application is granted.
V.Note by Justice Salazar Alvarado. In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative courts (jurisdicción administrativa). Nevertheless, I do address the merits when other rights of persons affected by pollution are implicated, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as occurs in this case, in which it is alleged that the respondent authorities have failed to fulfill their duty to protect health and the environment because they have not yet put an end to the alleged pollution problem in the La Troja residential development in Curridabat caused by ponding stormwater, graywater, and sewage, which threatens to infringe the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
As a matter of principle, I consider that cases concerning the Public Administration’s inaction in repairing, constructing, modifying, or demolishing any infrastructure work should be dismissed because such an omission raises a question of legality that must be adjudicated by the ordinary courts (jurisdicción ordinaria), before which the interested party may present objections more fully. However, when such administrative inaction results in a violation of other fundamental rights protected by this constitutional jurisdiction (jurisdicción constitucional), or affects groups considered vulnerable, I do address the merits because such circumstances constitute an exception to my position on this matter, as occurs in this amparo proceeding, which concerns the effects of the works, as well as the absence of necessary works and safeguards relating to the ponding of water that causes pollution in the La Troja residential development in Curridabat. For all these reasons, problems involving graywater and sewage arise from the lack of works needed to complete the stormwater network, as do other complications resulting from the absence of works that affect residents along the course of the ditch, all of which pose a risk to property, physical integrity, and health.
Although I agree with the Chamber’s majority that the application should be granted, I disagree as to the forum in which the enforcement phase (fase de ejecución) should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters, as in this case, in order to ensure that: 1) within a maximum period of one year from service of this judgment, the problems involving illegal connections to the stormwater system, as well as any other factor contributing to the problem at issue in these proceedings, are resolved; and 2) within five years from service of this judgment, the sanitary sewer network affecting the community of La Troja de Curridabat is completed. By contrast, the enforcement provisions of the Código Procesal Contencioso-Administrativo (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, assign responsibility, monitor stages of compliance, and so forth. Accordingly, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should take place before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules (reglas de ejecución de sentencia) of that Code.
VIII.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they have submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such materials must be retrieved within a maximum period of 30 business days from service of this judgment. The parties are warned that any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Corte Plena in Article XXVI of session no. 27-11 of 22 de agosto de 2011 and published in Boletín Judicial no. 19 of 26 de enero de 2012) and Article LXXXI of the session of the Consejo Superior del Poder Judicial no. 43-12 of 3 de mayo de 2012.
Therefore:
The amparo proceeding (recurso de amparo) is granted. Mary Denisse Munive Angermüller, Ricardo Alberto Morales Vargas, Juan Manuel Quesada Espinoza, Mauricio Sojo Quesada, Errol Solano Bolaños, and Luis Ulderico Monge Diaz, respectively Minister and Acting Director of the Dirección de Protección Radiológica y Salud Ambiental, both of the Ministerio de Salud; Executive President of the Instituto Costarricense de Acueductos y Alcantarillados; Acting Executive Director of the Consejo Nacional de Vialidad; and Mayor and President of the Concejo, both of the Municipalidad de Curridabat, or whoever holds those offices, are ordered to coordinate the pertinent actions and make the appropriate arrangements within the scope of their respective authority so that: 1) within a maximum period of ONE YEAR from notification of this judgment, the problems involving illegal connections to the stormwater system, as well as any other factor contributing to the problem at issue in this proceeding, are resolved; 2) within FIVE YEARS from notification of this judgment, the sanitary sewer network serving the community is completed.
The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State, the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Curridabat, and the Consejo Nacional de Vialidad are ordered to pay the costs, damages, and losses (costas, daños y perjuicios) caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in the administrative litigation jurisdiction. Justice Salazar Alvarado submits separate notes. Justice Garro Vargas dissents (salva el voto) regarding the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules set forth in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded to that body so that proceedings to enforce this ruling may be initiated. Let notice be given.

Documento PJEDITOR SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del once de julio de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente nro. 25-010235-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE CURRIDABAT, MINISTERIO DE SALUD, CONSEJO NACIONAL DE VIALIDAD (CONAVI), INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Resultando:
Redacta el Magistrado Garita Navarro; y,
Considerando:
I.Cuestión previa. En vista de que presidente del Concejo, el encargado del departamento Control Urbano, el jefe del Departamento Gestión Vial, el encargado del Departamento de Planificación y el encargado del Departamento Protección del Ambiente, todos de la Municipalidad de Curridabat, omitieron contestar la audiencia dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.
II.Objeto del recurso. El recurrente indica que es vecino de la urbanización La Troja de Curridabat. Afirma que hay una acequia que colinda con su comunidad, que causa problemas de zancudos, moscas y olores nauseabundos, pues se mezclan aguas pluviales con aguas negras. Reclama que esa situación ha sido denunciada varias veces en los últimos 12 años. Sin embargo, el problema no ha sido solucionado.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En cuanto al Ministerio de Salud:
En cuanto al Instituto de Acueductos y Alcantarillados d) La urbanización La Troja tiene una red de alcantarillado sanitario en funcionamiento. (Ver informe rendido).
Con respecto al Conavi.
En cuanto a la Municipalidad de Curridabat.
IV.Sobre el caso concreto. En el sub examine, el recurrente indica que es vecino de la urbanización La Troja de Curridabat. Afirma que hay una acequia que colinda con su comunidad, que causa problemas de zancudos, moscas y olores nauseabundos, pues se mezclan aguas pluviales con aguas negras. Reclama que esa situación ha sido denunciada varias veces en los últimos 12 años. Sin embargo, el problema no ha sido solucionado.
Con respecto al Ministerio de Salud, la Sala tuvo por demostrado que, el 18 de abril de 2024, el Ministerio de Salud recibió un formulario unificado de denuncias por parte de varios vecinos, quienes se quejaban por una acequia, laguna de aguas negras, jabonosas y criadero de mosquitos, en el lugar, objeto de este proceso. El 14 de mayo de 2024, el Área Rectora de Salud inspeccionó el sitio. De acuerdo con el acta de inspección nro. 306-24: “En el sitio denunciado me reúno con varios vecinos de la urbanización La Troja, los cuales aquejan una problemática debido a que detrás de la Escuela Juan Santamaría se ubica un gran lote baldío, el cual se procede a recorrer con varios vecinos de la comunidad entre ellos el Sr. Nombre03 que se identifica como el presidente del comité de vecinos de La Troja, indican que en dicho lote se resumen aguas residuales en varios puntos, sin embargo se desconoce su procedencia, ya que es difuso determinar su origen, sólo se visualizan escurrimiento de aguas residuales y estancamiento de las mismas en algunos sectores y este lote baldío colinda con dicha urbanización La Troja, lo que genera malestar a los vecinos denunciantes.
Se toman fotografías. Se indica a los presentes que el abordaje de la denuncia debe ser desde una visión interinstitucional, por lo que se solicitará el apoyo e intervención municipal para el abordaje del caso”. Mediante oficio MS-DRRSCS-DARSCU-IT-185-2024 del 22 de mayo de 2024, dirigido al jefe de Protección del Medio Ambiente de la Municipalidad de Curridabat, el Ministerio de Salud solicitó la colaboración de esa municipalidad en la atención de la problemática denunciada.
En cuanto al ICAA, la Sala verificó que la urbanización La Troja tiene una red de alcantarillado sanitario en funcionamiento. En 2024, el ICAA intervino el sector de Hacienda Vieja, con ocasión de la construcción de la nueva rotonda, y solucionó un problema en el funcionamiento de la red de alcantarillado sanitario en ese lugar. En el sector de la Escuela Juan Santamaría, la red de alcantarillado sanitario está inconclusa y provoca que el agua se vierta a la quebrada sin tratamiento. El problema también empeora debido a descargas ilícitas, proveniente de la red pluvial municipal. El ICAA planea desarrollar el proyecto IT-284 para solucionar el problema. El proyecto incluye las siguientes fases: revisión y ajuste de diseño (III trimestre 2025), actualización de presupuesto (IV trimestre 2025), actualización de la factibilidad (IV trimestre 2025), obtención del financiamiento (IV trimestre 2025), Elaboración de cartel y documentos cartelarios (IV trimestre 2025), inicio del proceso de licitación (I trimestre 2026), inicio de ejecución de obras (I trimestre 2027) y fin de ejecución de obras (II trimestre 2029).
En lo que concierne al Conavi, la Sala corroboró que él ejecutó obras de canalización de aguas pluviales en el sector de Hacienda Vieja, desarrolladas con base en estudios técnicos hidráulicos y bajo el marco de sus competencias legales en materia de infraestructura vial. Las obras ejecutadas no modificaron ni incrementaron el caudal de aguas pluviales que naturalmente escurren en la zona. Consistió únicamente en optimizar la conducción de las aguas existentes, sin generar aportes adicionales, asegurando una conducción eficiente hacia el punto de desfogue previamente establecido.
Atinente a la municipalidad de Curridabat, la Sala verificó que, en 2012, el problema, objeto de este proceso, ya era de conocimiento de ese ente local. En 2018, la Municipalidad de Curridabat se reunió con los vecinos de lugar, efectuó la limpieza del paso pluvial, solicitó contenido presupuestario para llevar a cabo un estudio técnico y tuvo una reunión con el Área Rectora de Salud. En 2019, la Municipalidad de Curridabat obtuvo el resultado del estudio técnico. Sin embargo, determinó que había inviabilidad financiera y operativa para el proyecto de saneamiento con alternativa de planta de tratamiento, por lo que se acordó que debían reducirse las conexiones ilícitas al sistema pluvial. En 2020 y 2021 tuvo lugar la Mesa de Saneamiento de Curridabat, conformada por varias instituciones de gestión del recurso hídrico. Se estimó que correspondía reducir las conexiones ilegales al sistema pluvial.
Sin embargo, de acuerdo con la experiencia y a los intentos de los funcionarios del Área Rectora las puertas de las viviendas no les fueron abiertas para ejecutar los procedimientos de coloración. Según minuta de reunión MC-GIR-0004-02-2025 del 12 de febrero de 2025, entre personeros de la Municipalidad de Curridabat y la empresa Cogusa: “Se acuerda que CONAVI por medio de la empresa Santa Fe realizará la construcción de un cabezal para las dos tuberías de desfogue pluvial (entiéndase la tubería PEAD con diámetro interno de 1200 mm municipal y la tubería PEAD con diámetro interno de 1500 mm del proyecto), así mismo, se encargarán de la conformación y ejecución del canal con disipador de energía a ubicarse entre el cabezal de desfogue y la acequia sin nombre para evitar procesos de erosión y estancamiento de aguas, así como la protección del talud con que colinda el cerramiento perimetral de la Escuela Juan Santamaria”.
El 19 de febrero de 2025, el Departamento de Gestión Integral del Riesgo de la Municipalidad de Curridabat remitió por correo electrónico esta minuta al ingeniero a cargo de la Contratación de la Gerencia de Conservación de Vías y Puentes del Conavi.
Ahora bien, al analizar estos hechos, la Sala verifica que el problema, objeto de este proceso, era del conocimiento de todas las instancias recurridas, desde fechas anteriores a la interposición del amparo. En lo que respecta a la Municipalidad de Curridabat, incluso existe un estudio técnico de 2019 al respecto y ha efectuado reuniones (la Mesa de Saneamiento de Curridabat de 2020 y 2021) con otras instancias (Ministerio de Salud, la Dirección de Aguas, Instituto Costarricense de Acueductos y Alcantarillados), con el propósito de atenderlo. El ICAA igualmente reconoce que el tema es de su competencia, pues se trata de una parte inconclusa de la red de alcantarillado sanitario, que provoca que el agua se vierta en la quebrada sin tratamiento. Empero, señala que el problema lo empeoran las descargas ilícitas, provenientes de la red pluvial municipal. Este hecho también se desprende de los informes de la municipalidad accionada, pues incluso se acordó desde 2019 que debían reducirse las conexiones ilícitas al sistema pluvial.
Tal acción debía coordinarse con el Ministerio de Salud. Empero, no se verificaron resultados al respecto. Más bien, ese ministerio apunta al oficio MS-DRRSCS-DARSCU-IT-185-2024 del 22 de mayo de 2024 que envió a la Municipalidad de Curridabat, pretendiendo su colaboración para la atención de la problemática. No obstante, tampoco se verifica que esa iniciativa condujera a resultados concretos. Finalmente, aunque el Conavi afirma que no es el encargado del alcantarillado local y que sus obras de canalización de aguas no incrementaron el caudal, sino que solo optimizaron la conducción de las aguas existentes, no menos cierto es que omite referirse expresamente a varios reproches del recurrente como, por ejemplo, el hecho de que se había requerido al Conavi la presentación de estudios o que el subgerente de Conservación de Vías y Puentes del Conavi presuntamente indicó a los regidores locales que el Conavi colaboraría con el diseño de la propuesta, en conjunto con la municipalidad.
A esto se suma la minuta de reunión MC-GIR-0004-02-2025 del 12 de febrero de 2025, aportada por la municipalidad, donde se indicó que: “Se acuerda que CONAVI por medio de la empresa Santa Fe realizará la construcción de un cabezal para las dos tuberías de desfogue pluvial (entiéndase la tubería PEAD con diámetro interno de 1200 mm municipal y la tubería PEAD con diámetro interno de 1500 mm del proyecto), así mismo, se encargarán de la conformación y ejecución del canal con disipador de energía a ubicarse entre el cabezal de desfogue y la acequia sin nombre para evitar procesos de erosión y estancamiento de aguas, así como la protección del talud con que colinda el cerramiento perimetral de la Escuela Juan Santamaria”.
A partir de los hechos expuestos, la Sala corrobora que existe una problemática ambiental que lesiona los derechos del tutelado y, en general, de la vecindad de la urbanización La Troja, consistente en el vertido de aguas negras y grises, sin tratamiento alguno, en una acequia de la localidad. Evidentemente, la existencia de tal acequia, en las condiciones actuales, va en detrimento del derecho a un ambiente sano y ecológicamente equilibrado que prescribe el numeral 50 constitucional.
Asimismo, se constata que cada una de las instancias accionadas tiene responsabilidad -si bien en distinto grado- en la atención integral del problema. Así, por ejemplo, el Ministerio de Salud y la Municipalidad de Curridabat deben coordinar para eliminar el problema de conexiones ilegales al sistema pluvial. El ICAA debe responder por la conclusión el alcantarillado sanitario, coordinando para ello -eventualmente- con la municipalidad accionada. El Conavi y la Municipalidad de Curridabat también deben colaborar para verificar el cumplimiento de los acuerdos señalados en la minuta del 12 de febrero de 2025. Esta lista, que se elabora sin la pretensión de ser exhaustiva, demuestra la necesaria colaboración de todos los accionados para la solución adecuada del problema denunciado. La Sala resalta la importancia de la coordinación interinstitucional en la atención de problemáticas de mayor envergadura que, por su naturaleza, requieren que cada instancia estatal asuma de manera coordinada sus competencias para alcanzar una solución integral. En los términos indicados, se declara con lugar el recurso.
V.Nota del magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que las autoridades recurridas, han omitido cumplir con su deber de proteger la salud y el ambiente, pues aún no han puesto fin al supuesto problema de contaminación en la urbanización La Troja de Curridabat por el estancamiento de aguas pluviales, aguas grises y negras, lo que amenaza lesionar el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este amparo, en el que se discute los efectos de las obras, así como la falta de ellas y previsiones necesarias por el estancamiento de aguas que genera contaminación para la urbanización La Troja de Curridabat. En razón de todo ello, surgen problemas de aguas grises y negras por falta de obras que concluyan la red de aguas pluviales, y otras complicaciones por falta de obras, que afectan a los vecinos durante el trayecto de la acequia, todo lo cual representa un riesgo para la propiedad, integridad física y la salud.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que: 1) en el plazo máximo de un año, contado a partir de la notificación de esta sentencia, se resuelvan los problemas de conexiones ilegales al sistema pluvial, así como cualquier otro factor que contribuya al problema, objeto de este proceso; 2) en el plazo de cinco años, contado a partir de la notificación de esta sentencia, se concluya la red de alcantarillado sanitario que afecta a la comunidad La Troja de Curridabat. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.
Por tanto:
Se declara con lugar el recurso. Se ordena a Mary Denisse Munive Angermüller, Ricardo Alberto Morales Vargas, Juan Manuel Quesada Espinoza, Mauricio Sojo Quesada, Errol Solano Bolaños y Luis Ulderico Monge Diaz, por su orden ministra y director a.i. de la Dirección de Protección Radiológica y Salud Ambiental, ambos del Ministerio de Salud; presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados; director ejecutivo a.i. del Consejo Nacional de Vialidad; alcalde y presidente del Concejo, ambos de la Municipalidad de Curridabat, o a quienes ejerzan esos cargos, que coordinen lo pertinente y dispongan lo correspondiente dentro del ámbito de sus respectivas competencias para que: 1) en el plazo máximo de UN AÑO, contado a partir de la notificación de esta sentencia, se resuelvan los problemas de conexiones ilegales al sistema pluvial, así como cualquier otro factor que contribuya al problema, objeto de este proceso; 2) en el plazo de CINCO AÑOS, contado a partir de la notificación de esta sentencia, se concluya la red de alcantarillado sanitario que afecta a la comunidad.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado, el Instituto Costarricense de Acueductos y Alcantarillados, la Municipalidad de Curridabat y el Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado consigna notas. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
