Document Review Decision No. 2025021402 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on July eleventh, two thousand twenty-five.
Petition for constitutional relief (recurso de amparo) filed by Nombre01, identity card CED01, Nombre02, identity card CED02, Nombre03, identity card CED03, Nombre04, identity card CED04, and Nombre05, identity card CED05, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Findings of Fact:
They state that it was not until May 25, 2024, that the San Bernardino ASADA held an in-person meeting at the ASADA’s facilities, to which representatives of the comprehensive development associations of the communities of Dirección05, Oasis finca nueve, Dirección04, Colonia los Ángeles, and some local farmers and cattle ranchers who own large tracts of land were invited and attended. At the meeting, Mayela Reyes Quirós, president of the San Bernardino ASADA, stated that, according to technical studies recently conducted at the spring intake (captación de la naciente), they had the capacity to provide water to the communities and to the cattle ranchers’ farms or properties, but lacked the financial capacity to cover the cost of the four-inch water mains needed to extend the “viaduct.” It was therefore proposed that the community representatives meet with their respective residents to present the possibility of each community contributing the water mains corresponding to it.
They assert that on March 13, 2024, AyA representatives visited the facilities of the two drilled wells located in Dirección06, owned by the Dole company, which supply non-potable water to the “communities of Dirección07.” They mention that, based on that visit, the AyA officials prepared the technical characterization form for the service provided by an unauthorized operator, code: EST-04-03-F1. They state that on November 12, 2024, the Director of Quality of Life of the Defensoría de los Habitantes sent AyA intervention record no. 458044-2024-RI, official letter no. 12647-2024-DHR. They recount that on “November 13, 2024, (...) Héctor Paniagua Alfaro, UEN Gestión de Acueductos Rurales, sent document GSD-UEN-GAR-2024- 04939, Subject: Response to official letter dated November 01, 2024, sent by Mr. Nombre04, a resident of the Dirección08 area, Rio Frio de Horquetas de Sarapiquí de Heredia, in which the final response from Mr.
Héctor Paniagua Alfaro was: ‘They are urged to continue their discussions with the San Bernardino ASADA, given that, as the delegated service provider, it is the entity that will assess the possibility of expanding its coverage to the communities of Finca Ocho, Finca Nueve, Finca Diez and Colonia Los Ángeles through the submission of a technical study financed by the interested parties, which must be reviewed and potentially approved by AYA(...) On December 04, 2024, Mr. Héctor Paniagua Alfaro, UEN Gestión de Acueductos Rurales, sent a digitally signed document, report GSD-UEN-GAR-2024-05225, SUBJECT: Response to official letter PRE-UTSAPS-2024-00379, forwarding this report for the purpose of addressing the request contained in memorandum PREUTSAPS2024-00379 concerning an analysis of the unauthorized provision of potable-water supply services in the community of Dirección09, Analysis of unauthorized operator in Oasis finca nueve de Sarapiquí, Responsible area: UEN Gestión de Acueductos Rurales, Date prepared: December 4, 2024, prepared by Engineer Luis Diego Alfaro Artavia, ORAC Huetar Norte, and Attorney Daniela Ávila Bolaños, Asesoría Legal de Sistemas Delegados, a document digitally signed by both aforementioned participants’” (sic).
They add that on December 11, 2024, Héctor Paniagua Alfaro of the UEN Gestión de Acueductos Rurales stated in document GSD-UEN-GAR-2024-05315 that “an unauthorized provision of the service by the Dole Company currently exists in that sector. Under AYA’s internal regulations, cases involving unauthorized operators that are not ASADAS are handled by AYA’s Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento, which is currently applying the procedure for Provision of services to communities where an unauthorized operator exists” (Code EST04-03-P). I should note that all these materials relate to preparatory acts (actos preparatorios) and are therefore private and preliminary in nature, because the administrative act (acto administrativo) concerning a potential solution for the provision of the service must be issued by the AYA Board of Directors once a solution has been identified.
ORAC Huetar Norte lacks legal authority to determine how the unauthorized provision of the service by an operator that is not an ASADA will be regularized” (sic). They recount that on January 30, 2025, a meeting was held at AyA’s facilities in Pavas, with the participation of María José Castillo León—Deputy General Manager—, Georgina Garro Mora—Deputy Manager for Delegated Systems Management—, Deivy Espinoza Villalobos—advisor to the Executive Presidency—, all from AyA, Representative Ada Acuña, and the community representatives, at which the following was presented: “1. In 2015, the San Bernardino Asada was designated by AYA to lead the supply of water to the communities of Finca Nueve, Diez and Los Ángeles. However, this entity faces administrative and technical weaknesses in undertaking a project to expand coverage to the aforementioned communities and has therefore not submitted studies related to the project’s development. 2.
The Horquetas Asada is the service provider with the greatest management capacity near Finca Siete, Oasis, Finca Diez, Los Ángeles and Río Frío. The Asada has the following characteristics: a. Management Category ‘A.’ b. Services: 5.300. Population: 16.000 people. c. Location: 15 km north of the Dirección10 intersection, La Unión de Guápiles. d. The Asada and AYA are currently working on a coverage-expansion project to integrate the systems of four communities in Río Frio (4), located southeast of the current system. 3. In 2020, AYA began developing a project entitled ‘Expansion of the Horquetas ASADA Potable Water System to integrate the Río Frío system, BPIP 2681.’ a. The project’s implementation stage began in May 2024, with the installation of 46 km of piping, construction of four river crossings, and installation of valves. Implementation is 65% complete, will conclude on 06-10-25, and has a cost of: 920.000.000. b. Beneficiary communities: Finca Seis, Finca Cuatro, Villa Nueva and Semillero. c. There was no additional water capacity for coverage expansions. 4.
During 2021, the Asada informed AYA of the need to promote a complementary Horquetas—Río Frío project: a. AYA and the Asada applied for a concession for three streams totaling 197 1/s, with a 20a projection. b. The project would begin with intake works on the ‘La Gata’ stream. (95 1/s) c. Construction of a potable-water treatment plant. (PTAP) d. Storage tank. e. The beneficiary communities would be the current communities and their future growth. THESE TOPICS WERE ALSO ADDRESSED: 1Doña Georgina states that the Asada submitted a technical study to AYA in Nov 22, which ORAC Huetar Norte rejected in March 23. a. On April 17, 24, through an agreement between the Asada and AYA’s Executive Presidency, a technical working group was established to remedy the study’s technical and budgetary requirements. b. The Subgerencia delegados resumed the study jointly with the Asada, provided guidance regarding the corrections, and formally forwarded it through Official Letter No. GSD-UEN-AP-2024-00582, dated June 07, 2024.
Important points: it requested clarifications regarding the cost-benefit study and the use of financial resources. c. The Subgerencia delegados reiterated the project’s technical inquiries through Official Letter No. GSD-UEN-AP-2024-00610, dated June 10, 2024. d. The Subgerencia is awaiting the Asada’s corrections to the two documents sent. e. Through the project, the Asada would create robust water capacity in the system and could therefore propose new coverage expansions and the interconnection of the communities of Finca Cinco, Finca Siete, Finca Diez, Oasis and Los Ángeles. 2- Don Nombre02 states that the San Bernardino Asada (524s) has administrative and technical weaknesses that prevent it from expanding coverage to the communities and proposing a project. 3- Don Nombre07 met with the San Bernardino Asada, which expressed its interest in supplying the communities; it has significant potable-water sources but requires support 4. 5. 6. 7. 8.
Agreements: 1. 2. 3. from AYA. 4- Doña Georgina explains that the San Bernardino Asada must be consulted regarding its willingness to continue with the project. 5- Don Nombre02 explains that he met with the Horquetas Asada and that it stated it has the capacity to lead a project for the communities, for which AYA must authorize that legitimate interest. 6- Don Carlos Félix explains that the communities need AYA to formally state that the Horquetas Asada will lead the supply of water to these populations. 7- Doña María José states that AYA is seeking to increase the capacity of the Asadas so that they can assume responsibility for supplying communities without potable water. 8- Don Carlos states that the community of Oasis does not have a plastic potable-water storage tank and is therefore left without water when well production declines” (sic). They assert that the agreements reached at that meeting were as follows: “1.
The Subgerencia Delegados will call a meeting with the Horquetas Asada to identify the critical difficulties it faces in correcting the technical study; it will also do so with the San Bernardino Asada to review progress in submitting technical studies for improvements to supply communities without potable water on its periphery. 2. The communities will appoint a representative to participate in meetings with the Asadas. Don Nombre02 was designated as representative by the participants. 3. The Subgerencia delegados will conduct a technical visit to determine the need for plastic water-storage tanks in the communities without potable water. The compliance date will be February 10 to 14, 25” (sic). Nevertheless, they complain that, following that January 30, 2025 meeting, no further responses have been received, and the three agreements reached have therefore not been fulfilled. They state that “several emails have been sent requesting a response consistent with what was agreed, and no response whatsoever has been received from acueductos y alcantarillados (AYA)” (sic).
They request the adoption of immediate, effective, and reasonable measures to guarantee sufficient, continuous, high-quality, and safe access to potable water for the communities of “Finca Diez, Oasis Finca Nueve, Finca Ocho, Finca Siete and Colonia los Ángeles.”
SEVENTEENTH: This does not concern an act of AyA, but rather an alleged communication issued by ADI Finca 8 and addressed to the ASADA de San Bernardino. EIGHTEENTH: This does not concern an act of AyA, but rather a communication allegedly issued by the ASADA de San Bernardino. NINETEENTH: Partially true. It is true that the procedure “Provision of Services to Communities Where an Unauthorized Operator Exists” (EST-04-03-P) was issued and has been in effect since 19 de octubre del 2022. We have no knowledge of the statement made in this allegation regarding the ASADA de San Bernardino. TWENTIETH: This does not concern an act of AyA, but rather a meeting allegedly held with the ASADA de San Bernardino. TWENTY-FIRST: Partially true. It is true that the Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento established, at the end of 2024, the “Strategy for Identifying Vulnerable Communities Where an Unauthorized Operator Is Present,” which focuses on communities categorized as vulnerable that were identified and classified through Procurement Contract (Contratación) N° 2020CD000013-0021400001.
The community of “Dirección11” was among the communities to be analyzed, and during a visit to the community, the presence of an unauthorized operator was identified, prompting application of the “Provision of Services to Communities Where an Unauthorized Operator Exists,” Code EST-04-03-P. TWENTY-SECOND: True, according to the evidence submitted by the petitioners (memorandum N° 12647-2024-DHR issued by the Defensoría de Los Habitantes and addressed to Lic. Rodrigo Castro García, Contralor de Servicios de AyA). TWENTY-THIRD: True, according to the evidence submitted by the petitioners (memorandum GSD-UEN-GAR-2024-04939 issued by Ing. Héctor Paniagua of AyA’s ORAC Huetar Norte). TWENTY-FOURTH: True, according to the evidence submitted by the petitioners (memorandum GSD-UEN-GAR-2024-05204 issued by Lic. José Antonio Jiménez Gómez of AyA’s Subgerencia de Gestión de Sistemas Delegados). TWENTY-FIFTH: True, according to the evidence submitted by the petitioners (memorandum GSD-UEN-GAR-2024-05225 issued by Ing. Héctor Paniagua of AyA’s ORAC Huetar Norte).
TWENTY-SIXTH: True, according to the evidence submitted by the petitioners (memorandum GSD-UEN-GAR-2024-05315 issued by Ing. Héctor Paniagua of AyA’s ORAC Huetar Norte). TWENTY-SEVENTH: It is true that Deputy Ada Acuña, together with community representatives who expressed their need for a drinking-water supply service, was received at AyA’s facilities, as recorded in the minutes submitted as evidence by the petitioners. TWENTY-EIGHTH: True, according to the evidence submitted by the petitioners. The background information recorded in the minutes was discussed at the meeting (see evidence submitted by the petitioners), and official letters (oficios) GSD-UEN-AP-2024-00582 and GSD-UEN-AP-2024-00610, referenced in those minutes, substantiate the information provided by AyA to the ASADA de Horquetas (see evidence 05 and 06). Nombre09: Partially true. Through the UEN Administración de Proyectos, the Subgerencia de Sistemas Delegados has held the meetings agreed upon with the ASADA de Horquetas (see evidence 07), and, through ORAC Huetar Norte, with the ASADA de San Bernardino.
It is true that the petitioner Nombre02 has made inquiries by email regarding follow-up on the agreements, which were answered through official letter GSD-UEN GAR-2025-02143 (see evidence 08). Memorandum GSD-UEN-GAR-2025-01135 (see evidence 09) demonstrates the considerable complexity of immediately resolving the service-provision situation through any delegated system, given the lack of hydraulic infrastructure; accordingly, the case is being handled under the Procedure for the Provision of Services to Communities Where an Unauthorized Operator Exists, Code EST-04-03-P.”
Justice Castillo Víquez delivers the opinion; and,
Considering:
I.Subject matter of the petition. The petitioners believe that their fundamental rights have been violated because the communities of Dirección04, Dirección14, Finca 8, Finca 7, and Colonia Los Ángeles, located in the Río Frío area, district of Horquetas, canton of Sarapiquí, province of Heredia, have lacked potable water service for many years. They state that water has been supplied by Standard Fruit Company (Dole) free of charge, informally, and without the technical approval of the respondent Instituto, as well as through artisanal wells, a situation of which the respondent authority is fully aware; nevertheless, they contend that it has not taken the appropriate actions to provide a genuine solution to the situation described, compounded by the fact that the service is provided without meeting minimum standards of quality, continuity, and safety, thereby seriously affecting the rights to health, life, and a healthy environment. They request the intervention of the Chamber.
a. The petitioners live in the communities of Dirección04, Dirección14, Dirección03, Dirección15, and Dirección16, located in the district of Horquetas, canton of Sarapiquí, province of Heredia (undisputed fact); b. The communities of Dirección11, Dirección04, Dirección17, Dirección03, Dirección02, and Dirección16 in the Río Frío area, district of Horquetas, canton of Sarapiquí, province of Heredia, do not receive potable water service through an authorized operator (see sworn report and evidence submitted); c. On June 7, 2019, a meeting was held with the participation of representatives of the Instituto Costarricense de Acueductos y Alcantarillados. Its purpose was for the Comisión Técnica de Río Frío to define an approach for the water-supply project and coordinate the efforts necessary to propose a work plan for supplying all communities without water in Río Frío: Dirección12, Finca 6, and Semillero, as well as Dirección04, Finca 9, Finca 8, Finca 7, and Colonia Los Ángeles, Finca 4, Finca 6, Semillero, Finca 1, Finca 2, and Tapavientos, all in the Río Frío sector (see evidence submitted); d. On February 20, 2020, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados held a meeting to analyze the status of the water-supply project for the farms in Río Frío de Sarapiquí together with the ASADA de San Bernardino (see evidence submitted); e. On an unspecified date in September 2024, the Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento of the Instituto Costarricense de Acueductos y Alcantarillados issued a study entitled “Strategy for Identifying Vulnerable Communities in Which an Unauthorized Operator Is Present,” through which it identified 41 communities supplied with water by an unauthorized operator (see sworn report and evidence submitted); f. By official letter no. GSD-UEN-GAR-2024-05225 of December 4, 2024, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados described the significant deficiencies in the existing infrastructure operated by Nombre08 as an unauthorized operator, which prevent a lawful operator from assuming provision of the service as an independent system.
Specifically, they stated: “Although the ASADA de Horquetas de Sarapiquí has experience expanding service areas, the report concludes that determining whether the Dirección11 sector can be interconnected with its aqueduct requires a technical study and the implementation of a project that exceeds this operator’s capacity. This means that an immediate solution cannot be provided through the ASADA de Horquetas’s current project for other communities (Finca Cuatro, Seis y Semillero), and therefore no alternative solution is available” (see sworn report and evidence submitted); g. By official letter GSD-UEN GAR-2025-02143 of June 9, 2025, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados provided the following response to petitioner Nombre02: “Regarding your request for information submitted by email on March 22 to the AyA Executive Presidency concerning follow-up on the agreements reached at the meeting held, I hereby inform you as follows: 1.
Regarding the alternative water supply for the communities of Finca 7, Finca 8. La Oasis, Finca 10, and Los Ángeles de Sarapiquí, I inform you that an inspection visit to these communities will be conducted during the week of June 9 through 13 to define a strategy for distributing water by tanker truck. This will involve identifying strategic sites for installing tanks, distribution schedules, tanker-truck access to community roads, and the amount of water required to serve the residents of those communities. The purpose is to request entry of the truck and inform residents about the logistics. 2. Regarding the outreach to the ASADAS, it is important to note that ORAC Huetar Norte has followed up on the submission of the technical study by ASADA San Bernardino, whose representatives indicate that they are close to submitting it. Additionally, a meeting with the ASADA de Horquetas and ORAC Huetar Norte will be proposed for the last week of June 2025 to follow up on the updated status of the technical feasibility of this aqueduct.
Once the inspection has been conducted, you will be informed of the results and the proposal for an alternative supply for these communities, as well as the results of the assessment of the technical information provided by the ASADAS de Horquetas y San Bernardino” (see sworn report and evidence submitted); h. The authorities of the Instituto Costarricense de Acueductos y Alcantarillados reported that they can supply the residents of Finca Siete, Finca Ocho, Finca Nueve (including the Dirección11 sector), and Colonia Los Ángeles only by tanker truck because no hydraulic infrastructure exists to establish any type of connection to the surrounding aqueducts (see sworn report).
III.On the right to the proper functioning of public services and the role of the Instituto Costarricense de Acueductos y Alcantarillados as the governing authority for potable water supply. In this regard, in judgment no. 2016012058 at 9:30 a.m. on August 26, 2016, this Court stated:
“In the case at bar (sub judice), it is determined that ICAA, as the governing authority in this field, has failed to perform its duties of oversight and supervision regarding the provision of the public potable-water and sewerage service and has therefore violated the petitioners’ rights. Under Articles 1 and 2 of the Ley Constitutiva del Instituto Costarricense Acueductos y Alcantarillados, ICAA is responsible, among other functions, for resolving all matters relating to the supply of potable water and sanitary sewerage service; directing and overseeing all matters necessary to provide residents with potable water service; and directly administering and operating aqueduct and sewerage systems throughout the country. It is therefore inexcusable that ICAA failed to act to prevent and remedy a situation such as the present one, in which an ASADA has been providing the aforementioned services without executing any delegation agreement.
In this regard, it is appropriate to recall what the Chamber stated in judgment No. 2014-012971 at 2:45 p.m. on August 8, 2014, concerning ICAA and its duties to oversee and ensure the proper functioning of the public services in question:
“IV.- On the right to the proper functioning of public services and the role of ICAA as the governing authority for water supply. In judgment number 2012-12009 at 9:05 a.m. on August 31, 2013, this Chamber held as follows, which is relevant to the determination of the case at bar (sub lite):
“This Chamber has held that the Political Constitution implicitly recognizes the fundamental right of persons subject to public administration to the proper and efficient functioning of public services, meaning that such services must be provided in accordance with high quality standards. As a necessary corollary, public administrations are obligated to provide them continuously, regularly, promptly, effectively, and efficiently. This latter obligation arises from a systematic reading of several constitutional provisions, including Article 140, subsection 8 (which imposes on the Executive Branch the duty to ‘Oversee the proper functioning of administrative services and agencies’), Article 139, subsection 4 (insofar as it incorporates the concept of the ‘proper conduct of Government’), and Article 191 (insofar as it incorporates the principle of ‘administrative efficiency’). This Court has also stated that this atypical or unnamed individual guarantee is heightened when essential public services such as the supply of potable water are involved, because interests as precious as health and human life are at stake.
Accordingly, the principles of effectiveness, efficiency, promptness, continuity, and adaptability must apply with greater rigor (see, to this effect, judgments number 2008-016405 at 7:04 p.m. on October 30, 2008, and 2008-017633 at 12:06 p.m. on December 5, 2008). In this context, the role of the Instituto Costarricense de Acueductos y Alcantarillados as the governing authority in this field takes on particular significance. This Chamber has stated that:
“(…) pursuant to Article 1 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, that autonomous institution was created for the express purpose of directing, establishing policies, adopting and enforcing standards, undertaking and promoting planning, financing, and development, and resolving all matters relating to the supply of potable water. To fulfill that purpose, and in accordance with Article 2 of that same body of law, the Instituto Costarricense de Acueductos y Alcantarillados is responsible for directing and overseeing all matters necessary to provide the inhabitants of the Republic with potable water service, as well as for harnessing, using, administering, or overseeing, as applicable, all public-domain waters indispensable for proper compliance with the provisions of the aforementioned law. It is therefore established that the Instituto Costarricense de Acueductos y Alcantarillados bears the primary responsibility for ensuring that all inhabitants of the Republic can benefit from a potable-water supply system capable of providing such water continuously and in sufficient quantities to adequately meet the basic needs of all persons, effectively safeguarding their fundamental rights to life and health” (judgment number 2011005457 at 11:32 a.m. on April 29, 2011.)
Consistent with the foregoing, this Chamber has emphasized that, in those cases in which the water-supply service for human consumption is provided by an ASADA, the Instituto Costarricense de Acueductos y Alcantarillados is required to carry out effective and efficient oversight and control of the respective water-supply system with respect to its operation, maintenance, administration, and development, thereby ensuring its proper functioning (judgment number 2011009487, issued at 9:15 hours on 22 de julio de 2011). Indeed, recently, in judgment number 2012006447, issued at 10:30 hours on 18 de mayo de 2012, this Chamber stated:
“(…) although Article 2 of Ley 2726 authorizes AyA to enter into agreements with community organizations for the administration of aqueduct and sewerage systems, the respondent Institute, as the governing authority in this field, is responsible for all matters relating to the operation, maintenance, administration, and development of the systems necessary to supply water to the population. In light of the foregoing, the Administration may not excuse the absence of an efficient drinking-water service on the grounds of inadequate community organization or poor management of the rural aqueduct by the private concessionaire (…)
This confirms the obligation of the Instituto Costarricense de Acueductos y Alcantarillados to oversee and ensure the proper functioning of community aqueduct systems” (emphasis not in the original) “V.- The specific case. In this case, the petitioner alleges that, in the community of El Porvenir de La Cruz, Guanacaste, ICAA provides drinking-water service through delegation to an ASADA; however, that service is provided inadequately and requires infrastructure improvements, for which reason the Municipalidad de La Cruz allocated an appropriation for the improvement of that aqueduct, which cannot be used until ICAA conducts the corresponding technical studies. She considers her fundamental right of access to drinking water to have been violated.
In this regard, the Chamber deemed it established that the Asociación Administradora del Acueducto Rural El Porvenir, La Cruz, Guanacaste, does not have current legal status (personería jurídica), since it expired on 31 de julio de 2007. It is likewise apparent that ASADA El Porvenir has not submitted to ICAA the documentation required to process the execution of the delegation agreement (convenio de delegación). Furthermore, ICAA does not have an updated assessment of the aqueduct system operated by ASADA El Porvenir. The record established that, by official letter number SB-GSC-GA-FA-ORAC-CH-2014-1758 dated 03 de julio de 2014, the Head of the Oficina Regional de Sistemas Comunales de la Región Chorotega del ICAA suggested that ASADA El Porvenir retain the services of a professional to conduct a technical study recommending the improvements required by the aqueduct. Finally, it was shown that the Municipalidad de La Cruz allocated an appropriation of 3 million colones to improve the aqueduct infrastructure, which will be used once the corresponding technical studies have been completed.
In view of these circumstances, the Chamber considers that the writ of amparo (amparo) must be granted in part, solely against ICAA. As explained in the preceding recital (considerando), ICAA is obligated to oversee and ensure the proper functioning of community aqueduct systems and therefore cannot excuse the absence of an efficient drinking-water service on the grounds of inadequate community organization or poor management of the rural aqueduct. As the governing authority for drinking-water supply, ICAA is required to assist in promptly resolving the problem affecting the community of El Porvenir, in La Cruz de Guanacaste. Accordingly, the Chamber cannot accept the argument of the respondent ICAA authorities that they bear no responsibility whatsoever for the problems involving ASADA El Porvenir. As long as the water-supply problem continues, the most vulnerable parties are the local residents, who must endure the ineffectiveness of the responsible entities and, consequently, suffer from the inadequate provision of the public drinking-water service.
Under this reasoning, ICAA must supervise and issue the necessary orders for ASADA El Porvenir to bring its operations into compliance with the law and for the technical studies required to authorize the expenditure of the municipal budget already allocated to improve the drinking-water supply in that community—and, therefore, the quality of life of all its residents—to be completed.” (Emphasis not in the original).
In addition, section 36(1) of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales identifies the following as an obligation and right of ICAA: “To execute and terminate Delegation Agreements for the management of aqueduct and sewerage systems with Managing Associations when recommended by Management and approved by its Board of Directors, on grounds of expediency, timeliness, or ineffectiveness in the provision of public services.”
IV.Relevant precedent. By judgment no. 2025-013579, issued at 09:15 hours on 9 de mayo de 2025, this Chamber ruled on the water-shortage problem in the community of Río Frío, Horquetas de Sarapiquí, holding, insofar as relevant:
“VII.- Merits. In this case, the petitioner considers that her fundamental rights have been violated because there is no drinking-water supply in the community of Río Frío, Horquetas de Sarapiquí, Heredia.
In response to the problem at issue, the project entitled “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí” is being carried out in the area; the project consists of three stages.
The first stage of the project is the responsibility of both ICAA and ASADA de Horquetas de Sarapiquí and consists of installing 17 km of transmission pipeline, 26 km of distribution pipeline, installing hydraulic valves, constructing elevated crossings over rivers or streams, road crossings, and testing the system; this stage is currently under way. A pipeline is also currently being installed in the Semillero sector, and installation of the pipeline in the Finca 4 sector is subsequently expected to be completed between abril and agosto de 2025. The second and third stages of the project are the responsibility of ASADA de Horquetas de Sarapiquí; the second stage consists of developing the La Gata intake, the transmission line, and constructing the treatment plant, while the third stage consists of constructing the storage tank.
Although the first stage of the project is currently under way, the record shows that the start of the second and third stages is awaiting the respondent ASADA’s submission of the technical designs to ICAA for review and the formalization of the land arrangements required for the remaining works. According to ICAA, the foregoing is essential to put the area’s new drinking-water system into operation.
VIII.It is established that the technical study required by ICAA before stages II and III of the project “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí” may begin has not yet been prepared because the ASADA lacks financial and technical resources.
According to the respondent, the lack of resources is due to the fact that its revenues come from the rates established by ARESEP and are intended for operation of the current service. The record, however, establishes that the service is not being provided because there is no drinking water in the area. As the ASADA explains, installing the transmission pipeline that will connect the “La Gata” intake to the future storage tank in the community of Cubujuquí has an approximate cost of 2500 million colones and is beyond the management-related financial capacity of ASADA Horquetas.
Accordingly, efforts are being coordinated with INDER to obtain resources for construction of the project’s storage tank, and the project is expected to be submitted in 2026. Notwithstanding the foregoing, the ASADA clarifies that completing the pipeline installation does not mean that the service will be immediately available, because essential components are still required to complete the project and thereby supply drinking water to the community.
IX.Accordingly, in the case at bar (sub lite), it is evident that a structural problem is preventing ASADA de Horquetas de Sarapiquí from providing service to the community of Río Frio in Sarapiquí, resulting in the absence of a drinking-water supply in the area.
Although the project “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí” is being carried out with the collaboration of ICAA and ASADA de Horquetas de Sarapiquí and is in its first stage of implementation, the fact remains that the reports themselves show that the project is currently at a standstill because the ASADA is materially unable—due to its lack of technical and financial resources—to conduct the technical study required by ICAA for implementation of the project’s final two stages and thus to supply drinking water to the area.
It is also notable that the Instituto Costarricense de Acueductos y Alcantarillados, as the governing authority for drinking-water service, has not coordinated with ASADA de Horquetas de Sarapiquí, which is responsible for providing drinking-water service in the area, to implement a remedial plan to provide drinking-water service to the protected community and thereby secure access to drinking water.
In this regard, ICAA must be reminded that, as the governing authority for drinking-water supply, it is obligated to oversee and ensure the proper functioning of community aqueduct systems, as well as to assist in promptly resolving the problem affecting the community of Río Frío. Accordingly, this Chamber cannot accept the argument that ICAA bears no responsibility whatsoever for the problems involving the ASADA in the area. On the contrary, ICAA is responsible for supervising and issuing the necessary orders for ASADA de Horquetas de Sarapiquí to bring its operations into compliance with the law and for the technical studies required to authorize investment in the project “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí,” which has already been designated to improve the drinking-water supply in that community, to be completed, thereby safeguarding the quality of life of the area’s residents.
Following that reasoning, this Court considers that the respondent authorities have violated the fundamental rights of the community of Río Frio in Sarapiquí because, although it was established in these proceedings that some measures have been taken with respect to the reported problem, the fact remains that the area currently lacks access to drinking water. In view of the foregoing, the petition must be granted, with the consequences to be detailed in the operative part of this judgment.

Por tanto:
The petition is granted. Alejandra Mora Segura, in her capacity as general manager of the Instituto Costarricense de Acueductos y Alcantarillados, and Jesús María Masís Solano, in his capacity as president of the Asociación Administradora del Acueducto de Horquetas de Sarapiquí, are ordered to issue the pertinent instructions, carry out all actions within the scope of their authority, and undertake the necessary coordination so that: a) IMMEDIATELY, a remedial plan is implemented to provide drinking-water service to the community of Río Frío de Horquetas, in Sarapiquí de Heredia, until the project “Improvement and Expansion of the ASADA de Horquetas Drinking-Water System to the Communities of Rio Frío de Sarapiquí” is completed; b) within a maximum period of TWELVE MONTHS from service of this judgment, the project “Improvement and Expansion of the ASADA de Horquetas Drinking-Water System to the Communities of Rio Frío de Sarapiquí” is completed so that drinking water may be supplied to the community of Río Frío de Horquetas, in Sarapiquí de Heredia, and, once it is completed, drinking-water service is provided efficiently, effectively, and continuously to homes in the area that meet the requirements established by subconstitutional law (ordenamiento infraconstitucional).
The respondents, or whoever may hold their offices, are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados and the ASADA de Horquetas de Sarapiquí are ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment in the contentious-administrative jurisdiction (vía contencioso-administrativa). Let notice be given.”
V.The specific case. First, it should be noted that, similarly to the precedent transcribed above, in the case at hand, the petitioners consider that their fundamental rights have been violated because the communities of Dirección04, Dirección14, Dirección03, Dirección02, and Dirección16, located in the Río Frío area, district of Horquetas, canton of Sarapiquí, province of Heredia, have lacked drinking-water service for many years. They state that water has been supplied by Standard Fruit Company (Dole) free of charge, informally, and without technical approval from the respondent Instituto, as well as through artisanal wells, a situation of which the respondent authority is fully aware; nevertheless, they complain that it has failed to take the pertinent actions to provide a genuine solution to the situation described, with the aggravating circumstance that the service is provided without meeting minimum standards of quality, continuity, and safety, which seriously affects the rights to health, life, and a healthy environment. They request the intervention of the Sala.
In this regard, a review of the record shows that the respondent authority acknowledges the existence of the problem reported by the petitioners, as it states that the communities of Dirección11, Dirección04, Dirección17, Dirección03, Dirección02, and Dirección16 in the Río Frío area, district of Horquetas, canton of Sarapiquí, province of Heredia, indeed do not receive drinking-water service through an authorized operator.
In that regard, they report under oath that they have been addressing the situation at issue in these proceedings since 7 de junio de 2019, because the first meeting was held on that date for the purpose of having the Comisión Técnica de Río Frío define an approach for the supply project and align the efforts necessary to propose a work plan for supplying all communities in Río Frío that lack water: Dirección12, Dirección13, and Semillero, as well as Dirección06, Dirección18, Finca Ocho, Finca Siete, and Colonia Los Ángeles; however, that situation persists to date.
Although this Tribunal finds that the respondent Instituto has adopted a series of measures to resolve the situation described, for which it issued the study entitled “Strategy for Identifying Vulnerable Communities Where an Unauthorized Operator Is Present,” and the record even shows that drinking-water service is provisionally supplied by tanker truck, it is nonetheless true that these measures are insufficient because uncertainty persists regarding the date on which the reported problem will be definitively resolved. It should be noted that, in their report submitted under oath, the respondents emphatically acknowledged that there is currently no short-term solution, with the aggravating circumstance that they merely stated that they are implementing the Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado, without mentioning any prospective schedule containing definite dates and specific actions for regularizing drinking-water service in the communities of the Río Frío sector: Finca 4, Finca 6, Semillero, Finca 10, Finca 9, Finca 8, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2, and Tapavientos. Accordingly, it is considered that uncertainty exists regarding how the situation presented in this case will be addressed.
Under these circumstances, this Sala concludes that the authorities of the Instituto Costarricense de Acueductos y Alcantarillados have failed to fulfill their constitutional duty to ensure the proper functioning of public services. This demonstrates a violation of the fundamental rights of the residents of the following communities in the Río Frío sector: Dirección12, Dirección13, Semillero, Dirección04, Dirección17, Dirección03, Finca 7, Colonia Los Ángeles, Finca 1, Finca 2, and Tapavientos. Consequently, the appropriate course is to grant the petition on account of the prolonged violation of the fundamental right to drinking water, with the consequences established in the operative portion (parte dispositiva).
VI.Partial dissenting opinion (voto salvado parcial) of Justice Garro Vargas concerning the second order in the operative portion of this judgment. Although I agree with the majority of the Sala that the petition should be granted, I disagree as to the forum in which the enforcement phase of this matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters, as in this case, where the project “Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado” must be completed within twelve months from service of this judgment so that drinking water may be supplied to the communities of the Río Frío sector—Dirección12, Dirección13, Semillero, Dirección04, Dirección17, Dirección03, Dirección02, Colonia Los Ángeles, Dirección19, Dirección20, and Tapavientos—located in the district of Horquetas, canton of Sarapiquí, province of Heredia, and, once it is completed, drinking-water service is provided efficiently, effectively, and continuously to homes in the area that meet the requirements established by subconstitutional law.
By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (Article 155 et seq.) offer clear advantages, such as the possibility of requiring schedules, imposing fines, determining liability, monitoring stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
VII.Documents submitted to the case file. The petitioner is advised that any paper document submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The petition is granted. Juan Manuel Quesada Espinoza, in his capacity as executive president; Georgina Garro Mora, in her capacity as deputy manager of Delegated Systems Management; and Zaida María Ulate Gutiérrez, in her capacity as director of the Technical Unit for Drinking Water Supply and Sanitation Services, all of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those offices in their stead, are ordered to issue the appropriate directives, carry out all actions within the scope of their authority, and ensure the necessary coordination so that: a) IMMEDIATELY, a remedial plan is implemented to provide drinking-water service to the following communities in the Río Frío sector: Dirección12, Dirección13, Semillero, Dirección04, Finca 9, Dirección03, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2 and Tapavientos, located in the district of Horquetas, canton of Sarapiquí, province of Heredia, while the project “Procedure for the Provision of Services in Communities Where an Unauthorized Operator Exists” is being implemented; b) within a maximum period of TWELVE MONTHS from notification of this judgment, the project “Procedure for the Provision of Services in Communities Where an Unauthorized Operator Exists” is completed, thereby enabling the provision of drinking water to the following communities in the Río Frío sector: Dirección12, Dirección13, Semillero, Dirección04, Finca 9, Finca 8, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2 and Tapavientos, located in the district of Horquetas, canton of Sarapiquí, province of Heredia, so that, once the project has been completed, drinking-water service is provided efficiently, effectively, and continuously to homes in the area that satisfy the requirements established by subconstitutional law (ordenamiento infraconstitucional).
The respondents, or whoever may hold their offices, are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in contentious-administrative proceedings (vía contencioso-administrativa). Justice Garro Vargas dissents with respect to enforcement of the second order in this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that such enforcement be carried out before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be sent to that office so that proceedings to enforce this ruling may be commenced. Let notice be given.- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del once de julio de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, Nombre02, cédula de identidad CED02, Nombre03, cédula de identidad CED03, Nombre04, cédula de identidad CED04, y Nombre05, cédula de identidad CED05, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso. Los recurrentes estiman vulnerados sus derechos fundamentales, toda vez que las comunidades de Dirección04, Dirección14, Finca 8, Finca 7 y Colonia Los Ángeles, pertenecientes a la zona de Río Frío, distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, no cuentan con el servicio de agua potable desde hace muchos años. Exponen que el abastecimiento de agua ha sido proporcionado por Standard Fruit Company (Dole) de manera gratuita, informal y sin aval técnico del Instituto accionado y por pozos artesanales, lo cual es de pleno conocimiento de la autoridad recurrida; sin embargo, reclaman que no ha efectuado las acciones pertinentes para ofrecer una solución real a la situación expuesta, con el agravante de que el servicio se brinda sin contar con los estándares mínimos de calidad, continuidad y seguridad, lo que afecta gravante el derecho a la salud, la vida y al ambiente sano. Solicitan la intervención de la Sala.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. Los recurrentes viven en las comunidades de Dirección04, Dirección14, Dirección03, Dirección15 y Dirección16, pertenecientes al distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia (hecho incontrovertido); b. Las comunidades de Dirección11, Dirección04, Dirección17, Dirección03, Dirección02 y Dirección16 de la zona de Río Frío, distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, no cuentan con servicio de agua potable a través de un operador autorizado (ver informe rendido bajo juramento y prueba aportada); c. El 7 de junio de 2019 se realizó una reunión en la cual participaron representantes del Instituto Costarricense de Acueductos y Alcantarillados, la cual tuvo como objetivo definir por parte de la Comisión Técnica de Río Frío una ruta de abordaje del proyecto de abastecimiento y alinear esfuerzos necesarios para proponer una ruta de trabajo para el abastecimiento de todas las comunidades sin agua en Río Frío: Dirección12, Finca 6 y Semillero, así como Dirección04, Finca 9, Finca 8, Finca 7 y Colonia Los Ángeles, Finca 4, Finca 6, Semillero, Finca 1, Finca 2 y Tapavientos, todas del sector de Río Frío (ver prueba aportada); d. El 20 de febrero del 2020, las autoridades del Instituto Costarricense de Acueductos y Alcantarillados realizaron una reunión para analizar la situación del proyecto de abastecimiento de fincas en Río Frío de Sarapiquí en conjunto con la ASADA de San Bernardino (ver prueba aportada); e. En fecha indeterminada, pero en setiembre de 2024, la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento del Instituto Costarricense de Acueductos y Alcantarillados emitió el estudio denominado “Estrategia para la identificación de comunidades vulnerables donde hay presencia de un operador no autorizado”, por medio del cual lograron identificar a 41 comunidades que son abastecidas con agua por parte de un operador no autorizado (ver informe rendido bajo juramento y prueba aportada); f. Mediante oficio nro. GSD-UEN-GAR-2024-05225 del 4 de diciembre de 2024, las autoridades del Instituto Costarricense de Acueductos y Alcantarillados detallaron las carencias significativas en la infraestructura actual operada por Nombre08, como operador no autorizado, impidiendo que se asuma la prestación del servicio como un sistema independiente por parte de un operador legal, específicamente se indicó: “Si bien la ASADA de Horquetas de Sarapiquí tiene experiencia en la ampliación de zonas de cobertura, el informe concluye que para determinar la posibilidad de interconectar el sector de Dirección11 con su acueducto, se requiere un estudio técnico y la ejecución de un proyecto, que sobrepasa la capacidad de este operador.
Esto implica que la solución no puede darse de forma inmediata a partir del proyecto actual de la ASADA de Horquetas para otras comunidades (Finca Cuatro, Seis y Semillero), por lo que no se tiene alternativa de solución” (ver informe rendido bajo juramento y prueba aportada); g. Mediante oficio GSD-UEN GAR-2025-02143 del 9 de junio de 2025, las autoridades del Instituto Costarricense de Acueductos y Alcantarillados brindaron la siguiente respuesta al recurrente Nombre02: “En cuanto a su solicitud de información planteada mediante correo electrónico del pasado 22 de marzo a la Presidencia Ejecutiva del AyA, referente al seguimiento a los acuerdos de la reunión sostenida en procedo a informarle lo siguiente: 1. Respecto al tema de abastecimiento alternativo de las comunidades de Finca 7, Finca 8. La Oasis, Finca 10 y Los Ángeles de Sarapiquí le informo que en la semana del 9 al 13 de junio se realizará una visita de inspección a estas comunidades con el fin de definir una estrategia de distribución de agua por medio de camión cisterna, la cual consiste en verificar los sitios estratégicos para la instalación de tanques, horarios de distribución, acceso del camión a los caminos comunales y requerimiento de agua para atender la población de dichas comunidades.
Lo anterior con el fin de solicitar el ingreso del camión e informar a la población sobre la logística. 2. Respecto a los acercamientos con las ASADAS, es importante indicar que por medio de la ORAC Huetar Norte se ha dado seguimiento a la presentación del estudio técnico de ASADA San Bernardino, quienes indican que están próximos a entregarlo. Por otra parte, con la ASADA de Horquetas se propondrá un espacio de reunión con la ORAC Huetar Norte para la última semana del mes de Junio 2025, esto con fin seguimiento a la actualización de estado de factibilidad técnica de este acueducto. Una vez realizada la inspección, se le estará informando los resultados y la propuesta para abastecimiento alternativo de dichas comunidades. Asimismo, los resultados que se tengan de la valoración de los insumos técnicos con las ASADAS de Horquetas y San Bernardino” (ver informe rendido bajo juramento y prueba aportada); h. Las autoridades del Instituto Costarricense de Acueductos y Alcantarillados informaron que solamente pueden abastecer a la población de Finca Siete, Finca Ocho, Finca Nueve (incluye el sector de Dirección11) y Colonia Los Ángeles por medio del camión cisterna debido a que no existe infraestructura hidráulica para realizar ningún tipo de conexión con los acueductos aledaños (ver informe rendido bajo juramento).
III.Sobre el derecho al buen funcionamiento de los servicios públicos y el papel del Instituto Costarricense de Acueductos y Alcantarillados como ente rector en materia de abastecimiento de agua potable. Sobre el particular, en la sentencia nro. 2016012058 de las 9:30 horas de 26 de agosto de 2016, este Tribunal indicó:
“en el sub judice se determina que el ICAA, como ente rector en la materia, ha incumplido sus labores de fiscalización y supervisión sobre la prestación del servicio público de agua potable y alcantarillado, y, por tanto, ha violentado los derechos de los recurrentes. Según los artículos 1 y 2 de la Ley Constitutiva del Instituto Costarricense Acueductos y Alcantarillados, el ICAA es responsable, entres otras funciones, de resolver todo lo relacionado con el suministro de agua potable y el servicio de alcantarillado sanitario; de dirigir y vigilar todo lo concerniente para proveer a los habitantes el servicio de agua potable; y de administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país; por lo cual resulta inexcusable que el ICAA no haya actuado a fin de prevenir y remediar una situación como la presente, en que una ASADA ha venido prestando los servicios supracitados sin suscribir ningún convenio de delegación.
Al efecto, conviene recordar lo que la Sala, en la sentencia Nº 2014-012971 de las 14:45 horas de 8 de agosto de 2014, indicó en relación con el ICAA y sus deberes de fiscalizar y garantizar el debido funcionamiento de los servicios públicos en mención:
“IV.- Sobre el derecho al buen funcionamiento de los servicios públicos y el papel del ICAA como ente rector en materia de abastecimiento de agua. En sentencia número 2012-12009 de las 09:05 horas del 31 de agosto de 2013, esta Sala dispuso lo siguiente, que resulta de interés para la resolución del sub lite:
“Esta Sala ha sostenido que la Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es: que sean prestados con elevados estándares de calidad. Lo que tiene, como correlato necesario, la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Esta última obligación se desprende de la relación sistemática de varios preceptos constitucionales, tales como el 140, inciso 8 (que impone al Poder Ejecutivo el deber de “Vigilar el buen funcionamiento de los servicios y dependencias administrativas”), el 139, inciso 4 (en cuanto incorpora el concepto de “buena marcha del Gobierno”) y el 191 (en la medida que incorpora el principio de “eficiencia de la administración”). Este Tribunal también ha indicado que dicha garantía individual atípica o innominada se acentúa en tratándose de servicios públicos esenciales como el abastecimiento de agua potable, al estar en juego bienes tan preciados como la salud y la vida humana, por lo que deben imperar con mayor rigor los principios de eficacia, eficiencia, celeridad, continuidad y adaptación (ver, en este sentido, sentencias número 2008-016405 de las 19:04 horas del 30 de octubre de 2008 y 2008-017633 de las 12:06 horas del 5 de diciembre de 2008). En tal contexto adquiere particular trascendencia el papel del Instituto Costarricense de Acueductos y Alcantarillados, como ente rector en la materia. Esta Sala ha señalado que:
“(…) conforme a lo dispuesto en el artículo 1 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, se ha creado dicha institución autónoma con el expreso objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable. Para cumplir tal objeto, y de conformidad a lo previsto en el artículo 2 de ese mismo cuerpo normativo, al Instituto Costarricense de Acueductos y Alcantarillados le corresponde dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de agua potable , así como aprovechar, utilizar, gobernar o vigilar, según sea el caso, todas las aguas de dominio público indispensables para el debido cumplimiento de las disposiciones de la citada ley. Con lo que se verifica que el Instituto Costarricense de Acueductos y Alcantarillados es el primer llamado en procurar porque todos los habitantes de la República puedan beneficiarse de un sistema de abastecimiento de agua potable, capaz de suministrar dicho líquido de forma continua y en cantidad suficiente para satisfacer debidamente las necesidades básicas de todas las personas, en resguardo efectivo de sus derechos fundamentales a la vida y a la salud” (sentencia número 2011005457 de las 11:32 horas del 29 de abril de 2011.)
En consonancia con lo anterior, esta Sala ha destacado que en aquellos supuestos en que el servicio de suministro de agua para consumo humano lo presta una ASADA, el Instituto Costarricense de Acueductos y Alcantarillados está llamado a ejercer acciones efectivas y eficientes de vigilancia y de control del respectivo sistema de suministro de agua, en cuanto a su operación, mantenimiento, administración y desarrollo, para así garantizar su correcto funcionamiento (sentencia número 2011009487 de las 9:15 horas del 22 de julio de 2011). De hecho, recientemente, en sentencia número 2012006447 de las 10:30 horas del 18 de mayo de 2012, esta Sala expresó:
“(…) si bien el artículo 2 de la Ley 2726 faculta al AyA para convenir con organismos comunales la administración sistemas de acueductos y alcantarillados, el Instituto recurrido, como ente rector en la materia, es el responsable todos los asuntos relativos a la operación, mantenimiento, administración y desarrollo de los sistemas necesarios para el suministro de agua a las poblaciones. A partir de lo anterior, la Administración no puede excusar la inexistencia de un servicio eficiente de agua potable, por la falta de organización comunal o la mala gestión en la administración del acueducto rural por parte del órgano privado concesionado (…)
Con lo que se constata la obligación del Instituto Costarricense de Acueductos y Alcantarillados de fiscalizar y garantizar el debido funcionamiento de los sistemas de acueductos comunales” (lo destacado no corresponde al original) “ V.- Sobre el caso concreto. En la especie, la recurrente alega que en la comunidad de El Porvenir de La Cruz, Guanacaste, el ICAA brinda el servicio de agua potable por delegación en una ASADA; empero, dicho servicio es prestado de manera deficiente y requiere mejoras en la infraestructura, por lo que la Municipalidad de La Cruz asignó una partida para el mejoramiento de dicho acueducto, la cual no puede ejecutarse mientras el ICAA no realice los estudios técnicos correspondientes. Estima vulnerado su derecho fundamental de acceso al agua potable.
Al respecto, la Sala tuvo por acreditado que la Asociación Administradora del Acueducto Rural El Porvenir, La Cruz, Guanacaste, no cuenta con personería jurídica vigente, pues la misma venció desde el 31 de julio de 2007. Asimismo, se aprecia que la ASADA El Porvenir no ha presentado ante el ICAA la documentación requerida para el trámite de firma del convenio de delegación. Además, el ICAA no cuenta con un diagnóstico actualizado del sistema de acueducto operado por la ASADA El Porvenir. De los autos se constató que mediante oficio número SB-GSC-GA-FA-ORAC-CH-2014-1758 del 03 de julio de 2014, la Jefa de la Oficina Regional de Sistemas Comunales de la Región Chorotega del ICAA sugirió a la ASADA El Porvenir que contratara los servicios de un profesional para que realizara un estudio técnico mediante el cual recomendara las mejoras requeridas por el acueducto. Finalmente, se demostró que la Municipalidad de La Cruz asignó una partida de 3 millones de colones para hacer las mejoras a la infraestructura del acueducto, la cual se ejecutará una vez efectuados los estudios técnicos correspondientes.
Ante este panorama, estima la Sala que se debe acoger parcialmente el amparo, solo en contra del ICAA. Tal como se explicó en el considerando anterior, el ICAA está en la obligación de fiscalizar y garantizar el debido funcionamiento de los sistemas de acueductos comunales, de manera que no puede excusarse en que la inexistencia de un servicio eficiente de agua potable responde a la falta de organización comunal o la mala gestión en la administración del acueducto rural. Como ente rector en materia de abastecimiento de agua potable, el ICAA se encuentra llamado a coadyuvar para la pronta solución de la problemática que afecta la comunidad de El Porvenir, en La Cruz de Guanacaste. Así las cosas, para la Sala no es atendible el alegato de las autoridades recurridas del ICAA, en el sentido de que no les corresponde ningún tipo de responsabilidad por los problemas presentados con la ASADA de El Porvenir.
Mientras la problemática en el abastecimiento de agua continúe, la parte más vulnerable son los vecinos de la localidad, quienes deben tolerar la inoperancia de las entidades encargadas y, consecuentemente, sufrir con la deficiente prestación del servicio público de agua potable. Bajo esa inteligencia, deberá el ICAA supervisar y emitir las órdenes necesarias para que la ASADA de El Porvenir ajuste su funcionamiento a derecho y se logren concretar los estudios técnicos necesarios para autorizar la inversión del presupuesto municipal ya destinado para el mejoramiento del abastecimiento de agua potable en esa comunidad y, por ende, de la calidad de vida de todos sus munícipes.”(El destacado no corresponde al original).
En adición, el ordinal 36 inciso 1) del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, señala como obligación y derecho del ICAA: "Suscribir y rescindir los Convenios de Delegación de la gestión de los sistemas de acueductos y alcantarillados con Asociaciones Administradoras, cuando así lo recomiende la Gerencia y lo apruebe su Junta Directiva, por motivos de conveniencia, oportunidad o ineficacia en la prestación de los servicios públicos".
IV.Antecedente de interés. Esta Sala mediante la sentencia nro. 2025-013579 de las 09:15 horas del 9 de mayo de 2025, se pronunció sobre el problema de desabastecimiento de agua en la comunidad de Río Frío, Horquetas de Sarapiquí, disponiéndose en lo que interesa:
“VII.-Sobre el fondo. En la especie, la parte recurrente estima lesionados sus derechos fundamentales, pues en la comunidad de Río Frío, Horquetas de Sarapiquí, Heredia, no hay suministro de agua potable.
Debido a la problemática de marras, en la zona se está ejecutando el proyecto denominado “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”; proyecto que consta de tres etapas.
La primera etapa del proyecto está a cargo tanto del ICAA como de la ASADA de Horquetas de Sarapiquí, la cual consiste en la instalación de 17 km de tubería de conducción, 26 km de tubería de distribución, instalación de válvulas hidráulicas, construcción pasos elevados para cruces de ríos o quebradas, cruces de calle y pruebas del sistema; etapa que actualmente está en ejecución. Asimismo, actualmente se está instalando una tubería en el sector de Semillero y posteriormente, entre los meses de abril y agosto de 2025, se tiene previsto completar la instalación de la tubería en el sector de Finca 4. La segunda y tercera etapa del proyecto está a cargo de la ASADA de Horquetas de Sarapiquí; la segunda etapa consiste en la captación de la toma La Gata, línea de conducción y construcción de la planta de tratamiento y la tercera etapa consiste en la construcción del tanque de almacenamiento.
Ahora, si bien consta que actualmente está en ejecución la primera etapa del proyecto, de los autos se desprende que el inicio de la segunda y tercera etapa está a la espera de que la ASADA recurrida remita al ICAA los diseños técnicos para su revisión y se dé la formalización de los terrenos requeridos para las obras faltantes. Lo anterior, según el criterio del ICAA, es indispensable para la puesta en operación del nuevo sistema de agua potable en la zona.
VIII.Se acredita que es en virtud de la falta de recursos económicos y técnicos por parte de la ASADA que aún no se ha elaborado el estudio técnico requerido por el ICAA, previo a iniciar las etapas II y III del proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”.
De conformidad con la recurrida, la falta de recursos obedece a que los ingresos que se perciben son de las tarifas establecidas por ARESEP y son para la operación del servicio actual. Sin embargo, de los autos se constata que la prestación del servicio no se está dando, pues no hay agua potable en la zona. Según explica la ASADA, la instalación de la tubería de conducción que conectará la toma “La Gata” con el futuro tanque de almacenamiento en la comunidad de Cubujuquí tiene un costo aproximado de 2500 millones de colones, no está dentro de las posibilidades económicas de gestión de la ASADA Horquetas.
Por lo anterior, se está coordinando con el INDER la gestión de recursos para la construcción del tanque de almacenamiento para el proyecto y se espera presentar este en 2026. Pese a lo anterior, aclara que la finalización de la instalación de tuberías no significa que el servicio estará disponible de inmediato, ya que aún se requieren componentes esenciales para concluir el proyecto y así poder suministrar agua potable a la comunidad.
IX.Así las cosas, en el sub lite queda en evidencia que existe un problema estructural para procurar la prestación del servicio a la comunidad de Río Frio en Sarapiquí por parte de la ASADA de Horquetas de Sarapiquí, lo cual ha ocasionado que la zona no tenga suministro de agua potable.
Ahora bien, a pesar de que consta que se está ejecutando el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”, bajo la colaboración del ICAA y de la ASADA de Horquetas de Sarapiquí y el cual está en su primera etapa de ejecución; lo cierto es que de los propios informes rendidos se desprende que el proyecto actualmente está detenido, pues existe una imposibilidad material por parte de la ASADA -por la falta de recursos técnicos y económicos- para realizar el estudio técnico requerido por el ICAA para la ejecución de las dos etapas finales del proyecto, y así poder suministrar agua potable a la zona.
Asimismo, se echa de menos que el Instituto Costarricense de Acueductos y Alcantarillados, como ente rector del servicio de agua potable, coordinara junto con la ASADA de Horquetas de Sarapiquí, encargada de la prestación del servicio de agua potable en la zona, la ejecución de un plan remedial para brindar el servicio de agua potable a la comunidad tutelada, a fin de procurar el acceso a agua potable.
En ese sentido, es menester reiterarle al ICAA que, como ente rector en materia de abastecimiento de agua potable, está en la obligación de fiscalizar y garantizar el debido funcionamiento de los sistemas de acueductos comunales; así como de coadyuvar para la pronta solución de la problemática que afecta la comunidad de Río Frío, por lo que no es de recibo para esta Sala el alegato de que no les corresponde ningún tipo de responsabilidad por los problemas presentados con la ASADA de la zona. Por el contrario, le compete al ICAA supervisar y emitir las órdenes necesarias para que la ASADA de Horquetas de Sarapiquí ajuste su funcionamiento a derecho y se logren concretar los estudios técnicos necesarios para autorizar la inversión del proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”, ya destinado para el mejoramiento del abastecimiento de agua potable en esa comunidad y con ello garantizar la calidad de vida de los vecinos de la zona.
En ese orden de ideas, este Tribunal estima que las autoridades recurridas han vulnerado los derechos fundamentales de la comunidad de Río Frio en Sarapiquí, pues, en este proceso, si bien se acreditó que se han tomado algunas medidas respecto a la problemática denunciada, lo cierto es que actualmente la zona no tiene acceso a agua potable. En mérito de lo expuesto, se impone declarar con lugar el recurso planteado, con las consecuencias que se detallarán en la parte dispositiva de la presente sentencia.
(…)
Por tanto:
Se declara con lugar el recurso. Se ordena a Alejandra Mora Segura, en su condición de gerente general el Instituto Costarricense de Acueductos y Alcantarillados, así como a Jesús María Masís Solano, en su condición de presidente de la Asociación Administradora del Acueducto de Horquetas de Sarapiquí, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias y se coordine lo necesario, para que: a) DE INMEDIATO se ejecute un plan remedial para brindar el servicio de agua potable en la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, en el tanto se finaliza el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”; b) dentro del plazo máximo de DOCE MESES, contado a partir de la notificación de esta sentencia, se finalice el proyecto “Mejora y Ampliación del Sistema de Agua potable de la ASADA de Horquetas hacia las comunidades de Rio Frío de Sarapiquí”, que permita dotar de agua potable a la comunidad Río Frío de Horquetas, en Sarapiquí de Heredia, de manera que una vez finalizado este, se brinde el servicio de agua potable a las viviendas de la zona que cumplan los requisitos de conformidad con el ordenamiento infraconstitucional, de forma eficiente, eficaz y continua.
Se advierte a las recurridas, o a quienes ocupen sus cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados, y a la ASADA de Horquetas de Sarapiquí al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. Notifíquese.”
V.Sobre el caso concreto. En primer lugar, se debe advertir que en sentido similar al precedente transcrito, en el sub lite, los recurrentes estiman vulnerados sus derechos fundamentales, toda vez que las comunidades de Dirección04, Dirección14, Dirección03, Dirección02 y Dirección16, pertenecientes a la zona de Río Frío, distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, no cuentan con el servicio de agua potable desde hace muchos años. Exponen que el abastecimiento de agua ha sido proporcionado por Standard Fruit Company (Dole) de manera gratuita, informal y sin aval técnico del Instituto accionado y por pozos artesanales, lo cual es de pleno conocimiento de la autoridad recurrida; sin embargo, reclaman que no ha efectuado las acciones pertinentes para ofrecer una solución real a la situación expuesta, con el agravante de que el servicio se brinda sin contar con los estándares mínimos de calidad, continuidad y seguridad, lo que afecta gravante el derecho a la salud, la vida y al ambiente sano. Solicitan la intervención de la Sala.
Al respecto, del estudio de los autos, se desprende que la autoridad recurrida acepta la existencia de la problemática denunciada por los recurrentes, toda vez que afirman que efectivamente las comunidades de Dirección11, Dirección04, Dirección17, Dirección03, Dirección02 y Dirección16 de la zona de Río Frío, distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, no cuentan con servicio de agua potable a través de un operador autorizado.
En ese sentido, informan bajo la solemnidad del juramento que desde el 7 de junio de 2019 se encuentran abordando la situación objeto de este proceso, debido a que en esa fecha realizaron la primera reunión, la cual tuvo como objetivo definir por parte de la Comisión Técnica de Río Frío una ruta de abordaje del proyecto de abastecimiento y alinear esfuerzos necesarios para proponer una ruta de trabajo para el abastecimiento de todas las comunidades sin agua en Río Frío: Dirección12, Dirección13 y Semillero, así como Dirección06, Dirección18, Finca Ocho, Finca Siete y Colonia Los Ángeles; sin embargo, a la fecha persiste tal situación.
Si bien, este Tribunal acredita que el Instituto accionado ha adoptado una serie de medidas para dar una solución a la situación descrita, para lo cual emitieron el estudio denominado “Estrategia para la identificación de comunidades vulnerables donde hay presencia de un operador no autorizado” e incluso consta que, de forma provisional, se abastece el servicio de agua potable medio del camión cisterna, no menos cierto es que estas medidas son insuficientes debido a que persiste la situación de incertidumbre respecto a la fecha en la cual se solventará de forma definitiva la problemática denunciada. Nótese que los recurridos en su informe rendido bajo la solemnidad del juramento fueron enfáticos en reconocer que a la fecha no existe una solución en el corto plazo, con el agravante de que únicamente se limitaron a indicar que se encuentran ejecutando el Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado, esto sin mencionar un posible cronograma con fechas ciertas y acciones concretas a fin de regularizar el servicio de agua potable en las comunidades en el sector de Río Frío: Finca 4, Finca 6, Semillero, Finca 10, Finca 9, Finca 8, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2 y Tapavientos. Por lo anterior, se estima que existe una incertidumbre respecto a la atención que se dará respecto a la situación expueste en este caso.
Así las cosas, esta Sala concluye que las autoridades del Instituto Costarricense de Acueductos y Alcantarillados ha omitido su deber constitucional de garantizar un buen funcionamiento de los servicios públicos. De esta forma, se denota la violación a los derechos fundamentales de los vecinos que viven en las comunidades del sector de Río Frío: Dirección12, Dirección13, Semillero, Dirección04, Dirección17, Dirección03, Finca 7, Colonia Los Ángeles, Finca 1, Finca 2 y Tapavientos. En consecuencia, lo procedente es declarar con lugar el recurso por la vulneración prolongada del derecho fundamental al agua potable con las consecuencias que se disponen en la parte dispositiva.
VI.Voto salvado parcial de la magistrada Garro Vargas respecto a la segunda orden de la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en el plazo de doce meses, contado a partir de la notificación de esta sentencia, se finalice el proyecto “Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado”, que permita dotar de agua potable a las comunidades del sector de Río Frío: Dirección12, Dirección13, Semillero, Dirección04, Dirección17, Dirección03, Dirección02, Colonia Los Ángeles, Dirección19, Dirección20 y Tapavientos, pertenecientes al distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, de manera que una vez finalizado este, se brinde el servicio de agua potable a las viviendas de la zona que cumplan los requisitos de conformidad con el ordenamiento infraconstitucional, de forma eficiente, eficaz y continua.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
VII.Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Juan Manuel Quesada Espinoza, en su condición de presidente ejecutivo, a Georgina Garro Mora, en su condición de subgerente de Gestión de Sistemas Delegados, y a Zaida María Ulate Gutiérrez, en su condición de directora de la Unidad Técnica de los Servicios de Abastecimiento de Agua Potable y de Saneamiento, todos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en sus lugares ejerzan esos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias y se coordine lo necesario, para que: a) DE INMEDIATO se ejecute un plan remedial para brindar el servicio de agua potable en las comunidades del sector de Río Frío: Dirección12, Dirección13, Semillero, Dirección04, Finca 9, Dirección03, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2 y Tapavientos, pertenecientes al distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, en el tanto se ejecuta el proyecto “Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado”; b) dentro del plazo máximo de DOCE MESES, contado a partir de la notificación de esta sentencia, se finalice el proyecto “Procedimiento Prestación de los Servicios de Comunidades donde existe un operador no autorizado”, que permita dotar de agua potable a las comunidades del sector de Río Frío: Dirección12, Dirección13, Semillero, Dirección04, Finca 9, Finca 8, Dirección02, Colonia Los Ángeles, Finca 1, Finca 2 y Tapavientos, pertenecientes al distrito de Horquetas, cantón de Sarapiquí, provincia de Heredia, de manera que una vez finalizado este, se brinde el servicio de agua potable a las viviendas de la zona que cumplan los requisitos de conformidad con el ordenamiento infraconstitucional, de forma eficiente, eficaz y continua.
Se advierte a los recurridos, o a quienes ocupen sus cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. La magistrada Garro Vargas salva el voto respecto a la ejecución de la segunda orden de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.- Fernando Castillo V.
