Res. 2025016724 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty-five in the morning on tres de junio de dos mil veinticinco.

Petition for amparo (recurso de amparo) processed under expediente 25-007121-0007-CO, filed by Nombre01, identity card CED02, against the COLEGIO DE ABOGADOS Y ABOGADAS DE COSTA RICA.

Findings:

  1. 1By a written submission added to the digital case file on 12 de marzo de 2025, the petitioner filed a petition for amparo. She states that she is a member of the respondent professional association. She states that, by a letter dated 20 de febrero de 2025 addressed to the Dirección Académica y de Incorporaciones, she requested information of interest to her. She indicates that, on 20 y 21 de febrero de 2025, she received acknowledgments of receipt of the information request from the Office of the President and the recording secretary. She adds that “in a separate letter dated 20 de febrero de 2025, after receiving an email at my personal address, Mr. Martín Mesén Espinoza informed me that, as of that time, professionals had been admitted with grades between 76.40 and 79.99; however, thus far no regulatory amendment has been adopted by the General Assembly, as this was a decision made by the Board of Directors, which lacks authority to issue such acts.In light of the foregoing, and given the profession’s concern over the COLEGIO DE ABOGADOS Y ABOGADAS DE COSTA RICA’s violation of the regulations in force, a letter was sent to the Dirección Académica y de Incorporaciones and the Board of Directors requesting that, because it is public information, they provide information on the professionals admitted as of that date with those grades, as well as the respective resolutions of the Board of Directors approving and ratifying their admissions, since that resolution was neither final nor ratified by the respective Board at the time of my request. 5. That receipt of the aforementioned document was acknowledged on 21 de febrero de 2025 by Ms. Annia Picado Mesén, recording secretary, Mr. José Guillermo Silesky Mata, internal auditor, and Ms. Zeidy Ballestero Marín, assistant to the Office of the President and the Board of Directors.” She complains that, as of the date this petition was filed, the respondent professional association has not provided any of the requested information. She considers her fundamental rights to have been violated. She asks that the petition be granted.
  2. 2By a ruling of the Office of the President of the Chamber issued at 16:10 hours on 26 de marzo de 2025, the proceeding was admitted and the president of the Colegio de Abogados y Abogadas de Costa Rica was ordered to submit a report on the facts alleged by the petitioner.
  3. 3By a written submission added to the digital case file on 1° de abril de 2025, Francisco Cruz Marchena, in his capacity as president and judicial and extrajudicial representative of the Colegio de Abogados y Abogadas de Costa Rica, reports under oath. He explains: “The petitioner’s statement is partially true. Although the petitioner sent an email to the professional association and officials of the Corporation, the accounts to which the request was sent are not official channels authorized by the professional association for handling requests for information from outside the institution. According to the evidence I am attaching for the Court’s consideration, the email accounts to which the petitioner sent the document requesting information correspond to the email addresses of Ms. Annia Picado Mesén, recording secretary of the Board of Directors, and Ms. Zeidy Ballestero Marín, assistant to the Office of the President; they are not official channels designated as such by the professional association’s Administration for the receipt, processing, and resolution of requests for information from outside the Corporation.In this regard, we must take into consideration that even if the officials acknowledged receipt of the email sent by the petitioner, this does not mean that it was submitted through the proper channel or that the recipients were thereby obligated to provide the information, because the authority to supply what was requested lies exclusively with the Board of Directors. Accordingly, it is within the Board’s authority to admit, process, request, and forward the requested information to the appropriate administrative body and subsequently provide it to the applicant, none of which may be carried out by an official without duly following the internal administrative process (iter administrativo) established for that purpose by the professional association. To these ends, the professional association has established a channel for receiving requests for information or other submissions from parties outside the institution.The Corporation’s website clearly and specifically identifies the official channel for receiving inquiries from outside the professional association. In this regard, it states the following: ‘CONTACT US Telf01 inquiry / +Telf02 The email addresses shown in this directory are not official channels for receiving correspondence or submissions. The only official channels for contacting the professional association are: Information desk (physical documents) and the email address ...01 (Under no circumstances will emails without a digital signature be handled). The official email address is intended for members to submit inquiries to the professional association regarding administrative matters or matters related to the practice of the profession. As for members of the public, it is intended for inquiries concerning members or the operation of the professional association. Accordingly, inquiries concerning personal matters will not be handled.’ Emphasis not in the original.In filing the petition for amparo, the petitioner states that her request has not been addressed; however, it is important to note the following: 1. That the petitioner’s request for information or requested opinion was not sent to the official email account designated by the Corporation for external inquiries, namely: ...01 2. That, as a requirement expressly established by the Corporation, requests for information must be sent with the interested party’s corresponding digital signature. Regarding this matter, the following clarification, illustrated by the attached image, is appropriate: (…) By email dated 28 del mes y año en curso, the professional association’s Executive Director informed the Legal Department that, upon reviewing the letters sent by the petitioner to a NON-OFFICIAL channel for handling inquiries, they were found not to contain a valid digital-signature certificate, meaning that the documents provide no assurance of integrity and authenticity, validity, current effectiveness, or trustworthiness as to the identity of the person signing them.The foregoing is relevant to the transparency and proper processing of requests for information, because the petitioner appeared before this Court stating that she had submitted requests for information, but there is no certainty, validity, or reliability regarding the documents sent to a non-official channel of the professional association sufficient to ensure that the person making the requests is who she claims to be or that the petitioner was the person who requested the information, due to problems with the signatures on her requests. In this regard, when the signatures on the documents sent by the member and on which the amparo at issue is based were checked, the Banco Central de Costa Rica system indicated: (…) As can be seen, prior to the response to this amparo, the signature on the document in question was invalid. Accordingly, the request for information on which this petition is based not only fails to comply with the requirements established by the Corporation for processing requests for external information (namely, sending them to the email address ...01), but also with the requirement that, if sent by email, they bear the applicant’s corresponding digital signature.It should be noted that the certification issued at 08:00 hours on 8 de mayo del año en curso, signed by the director of the professional association’s Departamento de Tecnologías de la Información, Engineer Christian Leandro Sánchez, expressly states that the email address to which inquiries for the Corporation must be sent is: ...01 The foregoing is of vital importance in light of the rulings issued by this Constitutional Court in various cases, such as the one addressed in judgment No.2016 – 011396, issued at 09:45 hours on 12 de agosto de 2016, in which it held: (…) Without prejudice to the foregoing, it must be taken into consideration that the person who sent the letter (because, for the reasons stated, there is no certainty that it was the protected party) has at all times been informed of the administrative action intended to produce the response to the requested opinion, because the communication sent to the email address specified in the letter informed her that the Board of Directors had forwarded her request to the institution’s Legal Department.The document in question states as follows: (…) Information on the status of the request was provided on 05 de marzo del año en curso, which means that the interested person was never left uninformed of the progress or status of her requests before the institution. RELIEF REQUESTED In accordance with the foregoing, and the cited statutory and case-law authorities, I respectfully request that this Honorable Constitutional Court dismiss in its entirety the Petition for Amparo filed by Ms. Nombre01.”
  4. 4In a written submission incorporated into the digital case file (expediente digital) on 2 de abril de 2025, the petitioner (recurrente) states: “Through this written submission, the undersigned states her position in response to the response brief submitted by the Colegio de Abogados y Abogadas de Costa Rica (hereinafter, CAACR) in expediente No. 25-007121-0007-CO. In that response, CAACR presents arguments arising from an erroneous interpretation of the fundamental rights involved, which I proceed to refute in detail below. I. Rebuttal of CAACR’s central arguments. In its response brief, CAACR states that the undersigned sent requests for information through CAACR’s unofficial channels; however, several clarifications are necessary. First, when callers contact CAACR’s main telephone line and make inquiries, its staff themselves identify and direct callers to the email addresses through which information must be requested, depending on what is needed.At no time, however, do they indicate that such requests must be processed exclusively through the official channel identified by the Colegio, which is a major source of confusion. Moreover, on this same webpage, they provide an extensive telephone directory containing the official email addresses of various departments from which information may be requested. It is therefore also confusing that requests are limited solely and exclusively to one email address, from which receipt of the information is not even acknowledged and no notice is provided that it has been forwarded to the appropriate departments. This is contradictory for members, as may be seen at the following link: https://www.abogados.or.cr/contactenos/ Second, it is important to note that the requests raised herein were in fact processed internally by the Board of Directors, which resulted in Acuerdo No. 2025-08-24, notified to my official email address and reproduced below.(…) Although my document was reviewed, the Board of Directors also resolved that it be forwarded to the Legal Department for a response. This situation is difficult to understand because the undersigned did not request a formal or legal opinion on any specific matter, but rather information that is public and falls within the purview of other departments, regarding which a Legal Department lacks authority to respond. Otherwise, it would constitute a duplication of effort for the Legal Department to request the information from those departments in order to provide a response to the undersigned. This is plainly a delaying tactic intended to prevent me from obtaining the requested information. Furthermore, it demonstrates that CAACR has repeatedly failed to provide public information until compelled to do so through the filing of these types of proceedings, which merely adds to the inconsistencies occurring within that institution.CAACR now attempts to make serious statements or allegations concerning me by asserting that the Executive Director—who has not even been appointed in accordance with the formalities established by law or based on suitability for the position, but whose appointment is known to have been irregularly made by the president himself—ventures to raise serious issues such as the authenticity of my digital signature (firma digital). While it is true that, when I signed the documents—which involves personal use of the signature—the system indicated that the certificates were valid when the emails were sent, CAACR officials subsequently found, when they accessed the request, that the certificates contained an error. CAACR NEVER notified me of that error. Had a request to cure the defect (solicitud de subsane) been made, I would immediately have signed the documents in question again. Instead, CAACR withheld this information, processed my documents, and the Board of Directors even adopted resolutions requiring that a response be provided to me, leaving me defenseless by failing to notify me that the documents contained an error.Instead, CAACR raises the matter before this Honorable Chamber, creating the impression that my information is invalid and attempting to evade its responsibilities without sufficient grounds that could reasonably be deemed justifiable. In light of the foregoing, and upon learning of this situation through the brief rebutted herein, I proceeded today, on my own initiative, to send a correction and ratification of all requests for information submitted by email. This automatically demonstrates that they were signed by me and are sufficiently valid to be processed. It is important, however, to inform this Honorable Chamber that this is not an offense warranting an investigation against me, as Mr. Allan stated, but rather an error in the technological medium that could readily have been corrected in a timely manner had I been informed. (…) Nevertheless, the entity’s bad faith is even more evident in its assertion that, because of this validation error, it did not know whether the requests were attributable to me.This is a serious matter, because it would have been sufficient to check my membership information and verify that the email address registered with CAACR is the same address from which all the information was requested, as shown below. (…) In summary, this entity contradicts itself by initially stating that I did not send requests to the official email address, while nevertheless acknowledging receipt and forwarding them to the Board of Directors itself, which in any event ordered that a response be provided to my request. It is also very important to note that 28 business days have elapsed since the request was submitted and 25 business days since it was stated that a department would provide me with a response, without any response having been provided to date. It is important to emphasize that, in the evidence attached by CAACR itself, Mr. Allan Salazar López makes a very serious statement concerning what occurred because, rather than first requesting correction of the digital certificate, he states that he will refer these events to the Prosecutor’s Office for investigation—even though there are insufficient grounds to warrant an investigation or the expenditure of public funds on any such investigation.I instead regard this as an act of persecution against me solely because I seek access to public information that, to some extent, concerns reductions in grades made without resolutions of the Board of Directors, which I have been reporting and making public over the past two months. Lastly, it is important to inform this Honorable Chamber that, in this specific matter, Resolución No, 2003-06466 de las diez horas con cincuenta y dos minutos del cuatro de julio del dos mil tres addressed a matter under similar circumstances that should be taken into consideration in deciding this writ of amparo (recurso de amparo); accordingly, the following is quoted verbatim: (…) the response deadlines were exceeded and the requests were not addressed by CAACR, with a clear reference to the issue involving my digital signature, which does not constitute an omission on my part that would justify failing to provide the information within the statutory time limits.I therefore request that CAACR’s arguments be rejected and that it be ordered to provide the information, which is public and of interest to the membership, so as not to hinder any administrative proceedings that may arise from the alleged irregularities committed by the Colegio in recent months and so that, in order to guarantee access to information, the requests submitted are addressed. RELIEF REQUESTED (PETITORIA). For the foregoing factual and legal reasons, I respectfully request that this Honorable Court GRANT the writ of amparo, because the violation of the petitioner’s fundamental right to petition (derecho fundamental de petición), as well as that of the other members of the Colegio who wish to learn of the resolutions adopted by the Board of Directors, has been demonstrated. Consequently, I request that the Colegio de Abogados y Abogadas de Costa Rica be ordered to provide the requested information and henceforth guarantee the right to learn of official resolutions concerning membership matters, since it failed to establish that the information I requested contained a serious error; any such error was curable at all times, but was never communicated to me by any means.Because CAACR failed to establish that it issued me a prior notice (prevención) concerning the official channels for requesting information, I request that its argument be rejected and that the institution be required to respond to the request. This practice of concealing information has become systematic and recurring under the current CAACR administration, making it necessary to repeatedly request that this entity adopt measures allowing access to information that is public and of interest to the membership as a whole. Por tanto, I request that a decision be issued in accordance with law, effectively protecting the rights invoked.”
  5. 5In a written submission incorporated into the digital case file at 8:09 on 22 de mayo de 2025, Justice Jara Velásquez filed a motion to recuse herself (solicitud de inhibitoria).
  6. 6By a ruling of the Presidency of the Chamber issued at 10:05 on 22 de mayo de 2025, Justice Jara Velásquez’s recusal was accepted.

Justice Rueda Leal drafts the opinion; and, Whereas (Considerando):

I. SUBJECT MATTER OF THE PROCEEDING

The petitioner considers that her fundamental rights have been violated because the Colegio de Abogados y Abogadas de Costa Rica has not responded to two requests she submitted on 20 de febrero de 2025.

II. PROVEN FACTS (HECHOS PROBADOS)

The following facts relevant to the resolution of this matter are deemed duly established:

  • a)At 12:43 on 20 de febrero de 2025, the petitioner sent an email to ...02, ...03, ...04, ...05, ...06, ...07, ...08 and ...09, in which she stated: “(…) The undersigned, Nombre01, member under card number 24669, attaches a request digitally signed by me (…)”. A written petition (memorial) was also attached, which reads:

“(…) The undersigned, Nombre01, of legal age, unmarried, attorney under card number CED03, resident of Heredia, San Pablo, identity card number CED01, in my capacity as a member, hereby submits the following request.

Pursuant to artículo 11 del Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica, which establishes the format and content of the Academic Excellence Examination, I request that I be informed what percentage corresponds to the content assessed in the respective examination and what percentage corresponds to the legal ethics course, together comprising 100% of the grade.

Likewise, pursuant to artículos 14 y 15 de este Reglamento, I request that I be provided with the list and credentials of the professionals who comprised the former Academic Excellence Committee, which, without authority, was removed by the Board of Directors through Acta N.3 de la Sesión Ordinaria del 21 de enero de este año.

In addition, I expressly request that I be provided with the list and credentials of the professionals who comprise the current Academic Excellence Committee, appointed without authority by the Board of Directors at its Ordinary Session of 21 de enero de 2025.

I also expressly request that an investigation be conducted to determine whether any of the current members of the CEA have relatives by affinity or consanguinity undergoing the admission process (Incorporación), in order to prevent possible influence peddling. (…)

  • b)At 14:18 hours on 20 de febrero de 2025, the claimant (accionante) sent an email to ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14, and ...09, stating: “I, the undersigned, Nombre01, bar member, membership card 24669, attach an express request digitally signed by me.” A written submission (memorial) was also attached, stating:

“I, the undersigned, Nombre01, of legal age, single, attorney, membership card 24669, resident of Heredia, San Pablo, identity card number CED01, in my capacity as a member, submit the following request.

According to the attached email, signed by Mr. Martin Mesén Espinoza and sent to my personal email address, I am informed:

‘There are many professionals admitted with scores of 76.40 to 79.99 who would lose their jobs, and I do not want to imagine how they will feel or how they will act.’ In view of the foregoing, because this is known to people nationwide and is a matter of public interest, I request that I be provided with the lists of members and their membership card numbers who received a score of 76.40 to 79.99 or lower, as well as the respective resolutions through which the Board of Directors verified compliance with the requirements established in the Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica for their respective admission, which must already be final and ratified.

(…)

I designate the email address ...10 as the means for receiving the requested information and future notices, and, subsidiarily, my telephone number Telf03.” (See documentary evidence).

On 21 de febrero de 2025, acknowledgment of receipt of that submission was sent by ...04, ...06, and ...15 (in the latter’s capacity as internal auditor of the respondent professional association). (See documentary evidence).

  • c)The email accounts ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14, and ...09 are not official channels of the Colegio de Abogados y Abogadas de Costa Rica for receiving submissions. (See report rendered under oath by the respondent authority).
  • d)The email address ...01 is the official channel for receiving submissions addressed to the respondent professional association. (See report rendered under oath by the respondent authority).
  • e)At 15:15 hours on 27 de marzo de 2025, the respondent authority was notified of the order admitting this proceeding. (See certificate of service).
  • f)On 28 de marzo de 2025, the executive director of the Colegio de Abogados y Abogadas de Costa Rica informed the Legal Department that several written requests submitted by the claimant did not have a valid digital-signature certificate. (See documentary evidence).
  • g)On 28 de marzo de 2025, the secretary of the Board of Directors of the respondent professional association certified that, at ordinary session no. 08-25 of that collegiate body, held on 25 de febrero de 2025, the following resolution was adopted: “Refer to the Legal Department the preceding written requests, 20.2, 20.3, signed by Ms. Nombre01 (…).” It was also stated that the appellant (recurrente) was notified of that resolution on 5 de marzo de 2025. (See documentary evidence).
  • h)The Colegio de Abogados y Abogadas de Costa Rica did not order the claimant to cure the error involving her digital signature. (Undisputed fact).
  • i)On 2 de abril de 2025, the claimant sent an email to ...01, once again attaching the submissions at issue in this proceeding. (See documentary evidence).

III. THE SPECIFIC CASE

In the matter at hand (sub lite), the appellant considers that her fundamental rights were violated because the Colegio de Abogados y Abogadas de Costa Rica has not responded to two requests she submitted on 20 de febrero de 2025.

The Chamber finds that, at 12:43 hours on 20 de febrero de 2025, the appellant sent an email to ...02, ...03, ...04, ...05, ...06, ...07, ...08, and ...09, stating: “(…) I, the undersigned, Nombre01, bar member, membership card CED03, attach a request digitally signed by me (…).” A written submission was also attached, which reads: “(…) I, the undersigned, Nombre01, of legal age, single, attorney, membership card CED03, resident of Heredia, San Pablo, identity card number CED01, in my capacity as a member, submit the following request. In accordance with Article 11 of the Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica, which specifies the format and content of the Academic Excellence examination, I request that I be informed what percentage corresponds to the content assessed in the respective examination and what percentage corresponds to the legal ethics course, together comprising 100% of the grade.

Likewise, pursuant to Articles 14 and 15 of this Regulation, I request that I be provided with the list and credentials of the professionals who comprised the former Academic Excellence Committee, which was removed without authority by the Board of Directors through Minutes No. 3 of the Ordinary Session of 21 de enero of this year. In addition, I expressly request that I be provided with the list and credentials of the professionals who comprise the current Academic Excellence Committee, appointed without authority by the Board of Directors at its Ordinary Session of 21 de enero de 2025. I also expressly request that an investigation be conducted to determine whether any of the current members of the CEA have relatives by affinity or consanguinity undergoing the admission process, in order to prevent possible influence peddling. (…) I designate the email address ...10 as the means for receiving the requested information and future notices, and, subsidiarily, my telephone number Telf03.” On 20 and 21 de febrero de 2025, acknowledgment of receipt was sent from accounts ...11 and ...12, respectively.

At 14:18 hours on 20 de febrero de 2025, the claimant sent an email to ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14, and ...09, stating: “I, the undersigned, Nombre01, bar member, membership card 24669, attach an express request digitally signed by me.” A written submission was also attached, stating: “I, the undersigned, Nombre01, of legal age, single, attorney, membership card 24669, resident of Heredia, San Pablo, identity card number CED01, in my capacity as a member, submit the following request. According to the attached email, signed by Mr. Martin Mesén Espinoza and sent to my personal email address, I am informed: ‘There are many professionals admitted with scores of 76.40 to 79.99 who would lose their jobs, and I do not want to imagine how they will feel or how they will act.’ In view of the foregoing, because this is known to people nationwide and is a matter of public interest, I request that I be provided with the lists of members and their membership card numbers who received a score of 76.40 to 79.99 or lower, as well as the respective resolutions through which the Board of Directors verified compliance with the requirements established in the Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica for their respective admission, which must already be final and ratified.

(…) I designate the email address ...10 as the means for receiving the requested information and future notices, and, subsidiarily, my telephone number Telf03.” On 21 de febrero de 2025, acknowledgment of receipt of that submission was sent by ...04, ...06, and ...15 (in the latter’s capacity as internal auditor of the respondent professional association). The email accounts ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14, and ...09 are not official channels of the Colegio de Abogados y Abogadas de Costa Rica for receiving submissions. The email address ...01 is the official channel for receiving submissions addressed to the respondent professional association. On 28 de marzo de 2025, the executive director of the Colegio de Abogados y Abogadas de Costa Rica informed the Legal Department that several written requests submitted by the claimant did not have a valid digital-signature certificate.

On 28 de marzo de 2025, the secretary of the Board of Directors of the respondent professional association certified that, at ordinary session no. 08-25 of that collegiate body, held on 25 de febrero de 2025, the following resolution was adopted: “Refer to the Legal Department the preceding written requests, 20.2, 20.3, signed by Ms. Nombre01 (…).” It was also stated that the appellant was notified of that resolution on 5 de marzo de 2025. The Colegio de Abogados y Abogadas de Costa Rica did not order the claimant to cure the error involving her digital signature. On 2 de abril de 2025, the claimant sent an email to ...01, once again attaching the submissions at issue in this proceeding.

Now, because the respondent authority objects to the channel used by the protected party to submit the requests at issue in this matter, and given that it challenges the validity of the digital signature contained in those requests, these issues must be clarified.

First, it is appropriate to recall the provisions of judgment no. 2008009670, issued at 9:55 hours on 13 de junio de 2008:

“(…) Within the framework of the information and knowledge society, fundamental rights may be exercised through new information technologies. With regard to the right to petition and receive a prompt response (derecho de petición y pronta respuesta), the use of electronic means introduces new nuances that must be weighed. While always bearing in mind the progressive and expansive effectiveness of that right, but also taking into account that fundamental rights are not absolute, it may be concluded that, in order to exercise the right to petition and receive a prompt response through the means made available by new technologies, the request must be channeled through a freely accessible website of the public entity or body. In addition, that electronic domain must contain a hyperlink directing users to an email address specifically designated to receive requests, whether concerning a particular matter or serving as a mailbox for all types of submissions (…)” (emphasis added).

For its part, in judgment no. 2019002204, issued at 9:15 hours on 8 de febrero de 2019, this Court addressed submissions that, although sent to unofficial email addresses, were acknowledged as received by the respondent authority or for which the authority began processing the corresponding response:

“(…) Now, in view of the foregoing and after examining the evidence submitted in the case file (autos), the Chamber considers the appellant’s claim in this respect to be well-founded, because, although the email address to which the interested party sent his request is not an official channel for receiving such submissions, the respondent acknowledged that it had proceeded to process that request and therefore had knowledge of it upon receiving it (…)”.

In the case at bar (sub iudice), the president of the respondent professional association maintains that the email accounts to which the protected party sent the submissions of February 20, 2025, are not official channels of the Colegio de Abogados y Abogadas de Costa Rica for receiving submissions, since the official channel is ...01. Notwithstanding the foregoing, in the matter under examination (sub examine), it has been fully established that, on February 20 and 21, 2025, acknowledgments of receipt of the submission filed at 12:43 p.m. on February 20, 2025, were sent from accounts ...11 and ...12, respectively; likewise, on February 21, 2025, ...04, ...06, and ...15 (in the latter’s capacity as internal auditor of the respondent professional association) acknowledged receipt of the request submitted by the petitioner at 2:18 p.m. on February 20, 2025. Moreover, the evidence submitted by the respondent authority itself shows that, at ordinary session no. 08-25 held on February 25, 2025, the Board of Directors of the Colegio de Abogados y Abogadas de Costa Rica resolved to refer the communications issued by the protected party to the Legal Department, which was notified to her on March 5, 2025. Accordingly, it is deemed established in this matter that the respondent professional association was aware of the submissions at issue in these proceedings.

Second, regarding the assertion by the president of the respondent association that “there is no certainty, validity, or reliability as to documents sent through a channel that is not an official channel of the Colegio, so as to ensure that the person requesting them is who she claims to be or that the appellant was the person who requested the information, due to issues with the signature on her requests,” it is appropriate to refer to the provisions of judgment no. 2023006416, issued at 9:15 a.m. on March 17, 2023:

“V.- With respect to the Ministerio de Salud, the Chamber confirmed that, by official letter no. MS-DM-2678-2023 of January 27, 2023, the ministra de Salud referred the submission to the Dirección General de Salud in order to obtain its technical support and provide a response to the appellant. Subsequently, by official letter no. MS-DGS-320-2023 of February 6, 2023, the directora general de Salud issued the following request for correction (prevención) to the protected party: ‘Regarding (sic) the requests, they must be submitted with a signature: 1. If digitally signed, the signature must meet the characteristics required by the applicable regulations, in that (sic) it must comply with the “Ley de Certificados, firmas digitales y documentos Electrónicos,” Ley N° 8454. 2. If the request is submitted by email through a document bearing a handwritten signature, as is the case here, that signature must be duly authenticated, or the interested party must be given the opportunity to sign it personally before the competent representative of the Administration responsible for receiving such documentation.

Therefore, in order to process your request, given that the communication received lacks the minimum requirements, and pursuant to the Ley General de la Administración Pública (article 285, paragraph 1, subparagraph b), and paragraph 3) and the Ley de Regulación del derecho de petición (paragraph a) of article 4 and paragraph b) of article 7), you are hereby directed to resubmit the communication containing the request so that it complies with the prescribed requirements for the handwritten-signature option. Accordingly, if the document is sent by email, the signature must be duly authenticated by an attorney; alternatively, the interested party may appear at the Dirección Área Rectora de Salud de Grecia or the Dirección Regional de Rectoría de la Salud Central Norte and sign the communication in the presence of an official of the Ministerio de Salud. You are granted a period of 3 business days to resubmit the communication as specified in this official letter.

The communication may be processed or delivered to the Dirección Regional de Rectoría de la Salud Central Norte via email at ...16 or to the Área Rectora de Salud de Grecia via email at ...17; if the documentation is not submitted, your request must be closed and archived. Please copy the Dirección General de Salud at ...18.’ This official letter was served on the protected party on February 7, 2023.

The Chamber emphasizes, however, that the submission filed by the petitioner was a digitized document containing his signature. To that extent, the Chamber deems applicable, mutatis mutandis, the position set forth in judgment no. 2022020101, issued at 3:02 p.m. on August 26, 2022:

‘(…) Strictly speaking, a signature constitutes a graphic representation identifying a person, placed on a document for the purpose of demonstrating its authenticity with respect to a particular person’s execution thereof or manifestation of assent. Moreover, given the contemporary dynamics of electronic or digital processing, mechanisms have been established for verifying the authenticity of documents or persons, seeking to reconcile the need for identification and authenticity with the growing trend toward digitized submissions. It is in this context that the Ley de Certificados, firmas digitales y documentos electrónicos, No, 8454, was enacted. By way of reference, it recognizes the functional equivalence of electronic documents (art. 3), as well as the digital signature certificate, which it defines as: “...any set of data attached or logically associated with an electronic document that makes it possible to verify its integrity, uniquely identify its author, and legally link the author to the electronic document/ A digital signature shall be deemed certified when issued under a current digital certificate granted by a registered certifier.” Viewed in this manner, it is clear that a signature consists of a feature or set of features placed on a physical document. Technological advances have led to the so-called digital signature being accorded similar functional equivalence.

In the opinion of the undersigned, the substantive exercise of the right of petition (derecho de petición) may be carried out through physical documents, which must bear the petitioner’s signature as a guarantee of identity. However, that right may likewise be exercised through other means made available to persons subject to the Administration by the technological era. The introduction of the internet as a data-transmission platform decades ago has led to its implementation as a means of providing administrative services and as a tool for filing administrative submissions online. Indeed, with the introduction and strengthening of so-called e-government, public entities have made electronic means available to the public through which people may access information of interest and, moreover, exercise their right of petition. This platform is increasingly used to enhance administrative efficiency and provide increasingly swift access to public procedures.

It should be noted that section 4 of Ley No. 8220 even requires procedures and requirements to be publicized through the internet. As part of that evolution, email is undeniably recognized as a means for conveying communications and, in turn, as a means for submitting petitions. Numerous provisions attest to the increasingly frequent use of email as a channel of communication between individuals, a phenomenon that is neither foreign nor unusual in legal-administrative relations. In this regard, see Leyes Nos. 8687 (which governs judicial communications) and 4755 (in the tax context), as well as section 243 of the LGAP. Accordingly, it is my view that email constitutes a valid digital means of expressing an intent directed toward submitting administrative petitions. It is clear that, even when this method is used, the submission must satisfy the formal requirements already noted. For example, a petition submitted by this means must allow the petitioner to be identified by stating the name of the person initiating the relevant procedure.

Nevertheless, use of this medium does not require, as a condition for acceptance, the inclusion of a signature in the form used on physical documents. Email gives rise to a presumption as to the identity of the sender who owns that account, which may be verified through the IP address from which it is sent or transmitted. Thus, if there is doubt regarding that identity or the authenticity of the source, the Administration must issue the appropriate requests for correction to verify the authenticity of the petition, as recognized in section 286.1 of the LGAP.

Accordingly, the aforementioned signature requirement is not considered applicable to the submission of a petition by email, provided that the content of the request makes it possible to establish the petitioner’s identity, as follows from section 285.1(a) of the LGAP in relation to (sic) section 4(a) of Ley No. 9097. If reasonable doubt arises concerning that identity or authenticity, the requested entity may require the submission of information for purposes of verification; however, I do not consider that using email as a means of exercising the right of petition must be accompanied by a signature of the type required for physical documents. The foregoing does not preclude the petitioner from accompanying petitions with the corresponding digital signature certificate or other mechanisms capable of demonstrating the authenticity of the request. Nevertheless, use of such a certificate is not considered a sine qua non requirement for submitting requests through digital means, as this would introduce bias arising from the so-called digital divide.

Specifically, the signature requirement referred to above applies to processing by means of physical documents, but not when the request is submitted by email, without prejudice to the Administration’s authority to verify the request’s authenticity. Requiring a signature for submissions made by email solely because that medium is used constitutes arbitrary and unfounded conduct that lacks support in any formal source and entails, it bears repeating, an unreasonable restriction on the right of petition.

Viewed in this light in the case at hand, in response to the petition submitted by the appellant, the respondent administration issued a request to cure deficiencies (prevención de subsanación) concerning three requirements that it deemed the petition in question had failed to satisfy, namely: - the subject matter of the petition; - to whom it was addressed; and - the petitioner’s signature. On this particular point, and in accordance with the foregoing discussion, the majority of this Chamber considers that, irrespective of the authority to require the curing of deficiencies in the requirements applicable to administrative petitions, the respondent entity has not established any reasonable doubt regarding the petitioner’s identity or the authenticity of the petition. Therefore, the alleged lack of a signature in the email through which the petition was submitted, and to which a failure to respond is alleged, cannot constitute a legitimate ground for the challenged rejection.

This is an application of the law that conflicts with the pro-actione doctrine (doctrina pro actione) and the principle of informality (principio de informalismo) established in provisions 224 and 286 of the LGAP and that, unquestionably, reflects an unlawful and arbitrary exercise of the aforementioned authority to issue such a request. Like all administrative action, such conduct is subject to the Legal Order (Ordenamiento Jurídico), and therefore administrative authority may not be exercised excessively by imposing requirements that are not relevant, proper, or reasonable under the specific circumstances. Even the authority in question is subject to the prohibition against arbitrariness (interdicción de la arbitrariedad), so that its conformity with the body of applicable law, as well as with the values and principles underlying the right of petition (derecho de petición) and due process in administrative proceedings (trámite debido de los procedimientos administrativos), may be assessed.

Ergo, because this was not an unmet requirement, the respondent entity had a duty to respond to the request; accordingly, since the record does not show that it provided the required response within the applicable period, this constitutional protection action (recurso de amparo) must be granted and the respondent local entity ordered to provide the requested information within a maximum period of five business days calculated from notice of this judgment (…)” (Underlining added).

In the case at bar (sub lite), the respondent authority required the protected party to submit the application with a signature authenticated by an attorney or in person if she wished to use a handwritten signature. However, the Chamber does not find that the request issued was based on a legitimate reason, such as a reasonable doubt regarding the petitioner’s identity or the authenticity of the application, under the terms of the judgment transcribed above. To that extent, such a request constitutes an arbitrary and unfounded action entailing an unreasonable restriction on the right of petition. In view of the foregoing, this claim is granted” (emphasis in the original).

In the matter before the Court (sub iudice), although the respondent authority contends that it was unable to verify the validity of the protected party’s digital signature (firma digital) on the applications under review, it is no less true that no reasonable doubt concerning her identity has been established, particularly because both the emails and the body of those applications expressly referred to the identifying information of the protected party, including her name and her identification-card and professional-membership numbers. In this regard, it should be recalled that, in the precedent transcribed above, this Court clearly stated: “the aforementioned signature requirement is not deemed relevant when an application is submitted by email, provided that the content of the request makes it possible to establish the identity of the person submitting it, as follows from provision 285.1 subsection a) of the LGAP in relation to (sic) 4 subsection a) of Ley No. 9097.

If a reasonable doubt should arise concerning that identity or authenticity, the entity receiving the request could require the submission of information for purposes of that verification; however, I do not consider that the use of email as a means of exercising the right of petition must in any event be accompanied by a signature, as is required for physical documents. The foregoing does not prevent the applicant from attaching the corresponding digital-signature certificate (certificado de firma digital) to the petitions or using other mechanisms capable of demonstrating the authenticity of the request. Nevertheless, the use of such a certificate is not deemed capable of constituting a sine qua non requirement for submitting requests by digital means, because doing so would create bias within the so-called digital divide (brecha digital).” In any event, if, even in light of the foregoing, the respondent professional association continued to have doubts regarding the petitioner’s identity, there is no indication that it issued any request to the protected party in that regard.

IV.Having clarified the foregoing, the Chamber finds that the protected party’s fundamental rights (derechos fundamentales) were violated due to the failure of the Colegio de Abogados y Abogadas de Costa Rica to act diligently and promptly in addressing the matters requested in the applications submitted at 12:43 horas del 20 de febrero de 2025 concerning “(…) that I be informed what (sic) percentage corresponds to the content evaluated on the respective examination and what (sic) percentage corresponds to the legal ethics course (curso de deontología jurídica) in making up 100% of the grade. Likewise, pursuant to articles 14 and 15 of this Reglamento, I request that I be provided with the list and credentials of the professionals who comprised the former Comte de Excelencia Académica, which, without authority, was removed by the Junta Directiva through Acta N.3 de la Sesión Ordinaria del 21 de enero de este año.

Furthermore, I expressly request that I be provided with the list and credentials of the professionals who comprise the current Comité de Excelencia Académica, appointed without authority by the Junta Directiva through Sesión Ordinaria del 21 de enero de 2025,” and in the application submitted at 14:18 horas del 20 de febrero de 2025. This is because, although those applications were filed on 20 de febrero de 2025, there is no record that, as of 1° de abril de 2025—that is, more than one month later—the corresponding response had been provided.

Ergo, the action is granted with respect to these grievances.

V.Finally, this Court does not fail to note that it is improper to grant the constitutional protection action with respect to the request made in the application submitted at 12:43 horas del 20 de febrero de 2025 that “an investigation be conducted to determine whether any current member of the CEA has relatives by affinity or consanguinity involved in the admission process, in order to prevent possible influence peddling,” because it constitutes an exhortation (exhortación).

In this regard, in judgment nro. 2024008805 at 9:20 horas del 5 de abril de 2024, this Court explained:

“(…) First, through official letter SMTA-010-2023 del 11 de agosto de 2023, the petitioner stated to the Municipalidad de Atenas: “(…) Email: ...19 (…) because the employees of this municipality have been left without space to park our vehicles, we respectfully request authorization to use the facilities of the Estadio Municipal de Atenas as a parking area (…)”. That document bears a receipt stamp dated 21 de setiembre de 2023. Likewise, through memorial SMTA-011-2023 del 11 de agosto de 2023, the appellant stated to the respondent local government: “(…) Email: ...19 (…) because the members of this union do not have a space in which to hold either ordinary or extraordinary meetings, we request that an office be assigned exclusively for the use of SITRAMA (…)”. That memorial bears a receipt stamp dated 27 de setiembre de 2023.

In this regard, a comprehensive reading of memorials SMTA-010-2023 and SMTA-011-2023 del 11 de agosto de 2023 shows that, in substance, they concern exhortations rather than simple petitions or requests for information. Regarding this issue, the Chamber addressed the matter in judgment nro. 2022018615 at 9:05 horas del 12 de agosto de 2022:

“IV.- CONCERNING THE SPECIFIC CASE. In the case at hand, the petitioners maintain that on 9 de junio de 2022 they sent to the email address ...20 an application in which they requested, among other things, that they be informed about matters relating to the implementation of Ley n.° 65 del 30 de julio de 1888 and compliance with a judgment issued by this Constitutional Court. They state that the application was reiterated on 14 de junio de 2022, when it was submitted in person to the office of the Ministro de Ambiente y Energía. They allege that, as of the filing of this action, they have received no response whatsoever.

A review of the record shows that, on 9 de junio de 2022, the appellant sent an email to the account ...20, attaching a memorial containing a request for information regarding compliance with a judgment issued by this Court. In this respect, it should be noted that it is undisputed in this case that this email account constitutes an official channel of the respondent authority for receiving applications. The Chamber also finds that the application was reiterated by the appellant, since the record shows that, on 14 de junio de 2022, the office of the respondent minister received memorial JFAC/032/2022 dated 9 de junio de 2022.

In that application, the petitioner requested: “1. That steps be taken as soon as possible to comply with voto 12109-2008 of the Sala Constitucional and to recover the lands in the inalienable zone (zona inalienable); and that, while the legal recovery procedure is underway, taking into account that we are located in an area of high aquifer recharge (recarga acuífera) and very high environmental and hydrogeological vulnerability (vulnerabilidad ambiental e hidrogeológica), MINAE, in coordination with the municipalities, take action to prevent activities from being permitted within the 2015 expansion of Parque Braulio Carrillo and throughout the remainder of the inalienable zone. 2. We request that, in all case files involving claims to property or possession rights, before MINAE issues decisions recognizing or denying such rights, it consult the Registro de la Propiedad Inmueble, as the technical registry authority, and the Procuraduría General de la República regarding the validity of those rights, in view of the lack of expertise from which MINAE may suffer in deciding these cases (…) 9.

That MINAE review again, and request opinions from the Registro nacional (sic) and the Procuraduría General de la República concerning, the procedures and decisions issued by former environment ministers through which they recognized property rights over lands geographically located within the inalienable zone, for purposes of transparency and to ensure that the corresponding lawful procedure was followed. 10. Considering that the lands located in the Zona Inalienable (sic) established by Ley 65 de 1888 are state property and that their administration is under the authority of MINAE, we request that any repair or construction of a road by the Ministerio de Obras Públicas, a municipality, or a private party be carried out only after prior approval from MINAE, which shall consider or take into account the potential environmental impact (efecto ambiental) on the area that may result directly from the work on the land (sic), as well as indirect impacts, such as the human burden caused by increased visits by citizens to an environmentally fragile area (…)”.

Regarding the matters requested by the appellant in points 1, 2, 9, and 10 of the application under review, it should be noted that they concern exhortations rather than simple petitions or requests for information. In this regard, the Chamber addressed the matter in judgment n.° 705-96 at 16:12 horas de 7 de febrero de 1996:

“(…) From the analysis of the official letter dated 29 de noviembre de 1995, sent by the appellant to the Ministro de Obras Públicas y Transportes (see folio 4), the failure to respond to which is the subject of the arguments raised herein, it does not appear that such failure constitutes a violation of the right of petition (derecho de petición) and prompt response (pronta respuesta) protected by article 27 of the Constitución Política. Indeed, what can be inferred from that document is that its objective was to make an exhortation (exitativa [sic]) to the Minister so that he would undertake to promote, within the Ministry under his authority, the ‘consensual, participatory, and transparent process concerning the Transformation of the State,’ as the appellant states in the pleading initiating the appeal… In view of the foregoing, the Ministro de Obras Públicas y Transportes cannot be compelled to issue a response, since he is not being asked to provide any information regarding the transformation process within his portfolio, which makes it necessary to dismiss the appeal. (…)”.

Whereas, in judgment no. 2002003910 at 15:55 hours on 30 de abril de 2002, this Chamber held that:

“(…) II.- The appellant further alleges that article 27 of the Constitución Política has been violated, because, as of this date, no response has been received to the letter sent by the Legal Advisor of the Sindicato Unión de Conserjes de Educación Pública to the Director del Personal del Ministerio de Educación Pública on the twenty-sixth of last February. Indeed, the cited constitutional article refers to the right of every person to address any public official or government entity in writing so that they may provide information or decide matters of interest to that person, a guarantee complemented by the right to obtain a prompt decision. However, from a reading of the document in question, the alleged failure to decide upon which is challenged (see copy at folio 6 of the case file), this Chamber concludes that such submission does not fall within the requirements of article 27 of the Constitution and article 32 of the Ley de la Jurisdicción Constitucional, because it is properly an exhortation (exhortativa) or request for support (gestión de apoyo), intended to urge the respondent to use ‘his good offices so that señora Nombre02 may be permanently appointed.’ Thus, if the intention of said Legal Advisor was to have the respondent act in the manner he sought and this has not yet been done, that does not constitute an omission capable of infringing his right of petition in the terms set forth in the initial pleading (see, to similar effect, judgments number 1481-96 at 18:15 hours on 27 de marzo de 1996, number 2000-8491 at 15:01 hours on 26 de septiembre del 2000, and 2001-118 at 9:26 hours on 5 de enero del 2001). (…)” (emphasis not in the original).

The Court finds no reason to depart from the holding set forth in the aforementioned judgments, nor any grounds for assessing the situation presented differently. Consequently, given that the matters requested by the appellant in points 1, 2, 9, and 10 of the submission dated 9 de junio de 2022, reiterated on the 14th day of that same month, constitute exhortations, the appeal for constitutional relief (amparo) may not be granted with respect to those grievances” (emphasis added).

Likewise, judgment no. 2022021561 at 9:30 hours on 16 de setiembre de 2022 established:

“VI.- In points 1, 4, and 5 of the submission dated 15 de junio de 2022, the appellant requested: 1. We request that official letter JDC-SINDEU-314-2022 dated 6 de junio del 2022 be revoked and rendered ineffective (…) 4. We request an apology from the Junta Directiva Central del SINDEU for having conducted ‘a review’ of the members without taking the Seccional de Maquinaria y Equipo into account. 5. We request that these regrettable events be remedied so that they do not occur again in the future (…)”.

It should be noted that these requests do not concern requests for information made in exercise of the right of association (derecho de asociación), but instead constitute exhortations intended to urge the respondent union to undertake a series of actions consistent with the claims of the protected parties. Therefore, no infringement of the fundamental rights (derechos fundamentales) of the protected party is established with respect to points 1, 4, and 5 of the submission dated 15 de junio de 2022”.

Similarly, judgment no. 2023019751 at 9:30 hours on 11 de agosto de 2023 stated:

“V.- This Chamber finds that points 2 and 3 of the protected party’s submission, concerning ‘SECOND: That the current list of eligible candidates for the occupational position of Nursing Professionals be made generally known. THIRD: That the lists requested above be duly “placed in a location readily accessible to any staff member who requests them or demonstrates a legitimate interest,” as stated in circular GG-DAGP-0724-2021,’ do not concern a request for information or any pure and simple petition, but instead constitute exhortations intended to urge the respondent authority to make the list of eligible nursing professionals generally known and even to place it in specific locations. Accordingly, the apparent failure to respond to those points does not entail an infringement of her right of petition or her right to a prompt decision (pronta resolución) and, therefore, does not warrant relief from this Chamber. For example, regarding these matters, the Chamber ruled as follows in judgment 2002-003910 at 15:55 hours on 30 de abril de 2002:

“II.- The appellant further alleges that article 27 of the Constitución Política has been violated, because, as of this date, no response has been received to the letter sent by the Legal Advisor of the Sindicato Unión de Conserjes de Educación Pública to the Director del Personal del Ministerio de Educación Pública on the twenty-sixth of last February. Indeed, the cited constitutional article refers to the right of every person to address any public official or government entity in writing so that they may provide information or decide matters of interest to that person, a guarantee complemented by the right to obtain a prompt decision. However, from a reading of the document in question, the alleged failure to decide upon which is challenged (see copy at folio 6 of the case file), this Chamber concludes that such submission does not fall within the requirements of article 27 of the Constitution and article 32 of the Ley de la Jurisdicción Constitucional, because it is properly an exhortation or request for support, intended to urge the respondent to use ‘his good offices so that señora Nombre02 may be permanently appointed.’ Thus, if the intention of said Legal Advisor was to have the respondent act in the manner he sought and this has not yet been done, that does not constitute an omission capable of infringing his right of petition in the terms set forth in the initial pleading (see, to similar effect, judgments number 1481-96 at 18:15 hours on 27 de marzo de 1996, number 2000-8491 at 15:01 hours on 26 de septiembre del 2000, and 2001-118 at 9:26 hours on 5 de enero del 2001). (…)” (Emphasis not in the original).

Those considerations apply to the case under review, because this Court finds no reason to depart from the holding set forth in that judgment, nor any grounds for assessing the situation presented differently. Accordingly, the appeal is dismissed with respect to those matters”.

In the case under review (sub examine), it should be recalled that what the protected party requested in official letters SMTA-010-2023 and SMTA-011-2023 dated 11 de agosto de 2023, the alleged failure to respond to which is challenged, was authorization for the staff members of the Municipalidad de Atenas to use the municipal stadium facilities for parking and the assignment of an office for the exclusive use of Sitrama. These matters clearly do not constitute mere petitions or requests for information, but rather exhortations. Therefore, because the submissions made by the claimant on 11 de agosto de 2023 consist of exhortations, this appeal may not be granted with respect to those matters (…)”.

Consequently, given that what the claimant requested in the submission made at 12:43 hours on 20 de febrero de 2025—namely, “that an investigation be conducted to determine whether any of the current members of the CEA have relatives by affinity or consanguinity undergoing the Membership process, in order to prevent possible influence peddling”—does not constitute a mere petition or request for information, but instead an exhortation, the appeal is not granted with respect to this matter.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved within a maximum period of 30 business days, counted from notification of this judgment. They are warned that any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (approved by the Corte Plena in article XXVI of session no. 27-11 dated 22 de agosto de 2011 and published in Boletín Judicial no. 19 dated 26 de enero de 2012) and article LXXXI of the session of the Consejo Superior del Poder Judicial no. 43-12 dated 3 de mayo de 2012.

Therefore:

The amparo petition (recurso) is declared partially granted, solely with respect to the delay in addressing the requests (gestiones) submitted at 12:43 on 20 de febrero de 2025 concerning “(…) that I be informed what (sic) percentage corresponds to the content evaluated on the respective examination and what (sic) percentage corresponds to the legal ethics course, together comprising 100% of the grade. Likewise, pursuant to Articles 14 and 15 of these Regulations, I request that I be provided with the list and credentials of the professionals who constituted the former Comte de Excelencia Académica, which, without authority, was removed by the Junta Directiva through Minutes N.3 of the Ordinary Session of 21 de enero of this year. Furthermore, I expressly request that I be provided with the list and credentials of the professionals who constitute the current Comité de Excelencia Académica, appointed without authority by the Junta Directiva through the Ordinary Session of 21 de enero de 2025,” and at 14:18 on 20 de febrero de 2025.

Francisco Cruz Marchena, in his capacity as president and judicial and extrajudicial representative of the Colegio de Abogados y Abogadas de Costa Rica, or whoever holds that position, is ordered to take all necessary measures and coordinate the relevant actions within the scope of his authority so that, within EIGHT DAYS from notification of this judgment, the claimant (accionante) is notified, through the means designated for such purposes, of the response to the requests submitted at 12:43 on 20 de febrero de 2025 concerning “(…) that I be informed what (sic) percentage corresponds to the content evaluated on the respective examination and what (sic) percentage corresponds to the legal ethics course, together comprising 100% of the grade. Likewise, pursuant to Articles 14 and 15 of these Regulations, I request that I be provided with the list and credentials of the professionals who constituted the former Comte de Excelencia Académica, which, without authority, was removed by the Junta Directiva through Minutes N.3 of the Ordinary Session of 21 de enero of this year.

Furthermore, I expressly request that I be provided with the list and credentials of the professionals who constitute the current Comité de Excelencia Académica, appointed without authority by the Junta Directiva through the Ordinary Session of 21 de enero de 2025,” and at 14:18 on 20 de febrero de 2025. The foregoing shall be carried out while safeguarding restricted-access, confidential, and sensitive personal data in accordance with the regulations in force. If any costs are incurred as a result of the requested copies, they shall be borne by the interested party. The respondent authority (autoridad recurrida) is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment for three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order issued in amparo proceedings (recurso de amparo) that must be complied with or enforced and fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty.

The Colegio de Abogados y Abogadas de Costa Rica is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in contentious-administrative proceedings (contencioso administrativo). In all other respects, the petition is denied. Let notice be served.

Res. 2025016724 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas y veinticinco minutos del tres de junio de dos mil veinticinco.

Recurso de amparo que se tramita en expediente 25-007121-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el COLEGIO DE ABOGADOS Y ABOGADAS DE COSTA RICA.

Resultando:

  1. 1Por escrito incorporado al expediente digital el 12 de marzo de 2025, la parte accionante interpone recurso de amparo. Expone que es agremiada del colegio recurrido. Expone que mediante nota de fecha 20 de febrero de 2025 dirigida a la Dirección Académica y de Incorporaciones, solicitó información de su interés. Indica que el 20 y 21 de febrero de 2025 recibió de parte de la presidencia y de la secretaria de actas acuse de recibo de la solicitud de información. Añade que “mediante nota aparte de fecha 20 de febrero de 2025, por recibir un correo electrónico a mi dirección personal, el señor Martín Mesén Espinoza, me indica que se encontraban hasta ese momento, profesionales incorporados con notas entre los 76.40 y 79.99, sin embargo, hasta el momento no se cuenta con una reforma normativa por parte de la Asamblea General, siendo esta una decisión tomada por la Junta Directiva, quien carece de competencia para emitir estos actos.En razón de lo anterior y ante la preocupación del gremio por violación a las normativas vigentes por parte del Colegio de Abogados y Abogadas de Costa Rica, se remitió nota a la Dirección Académica y de Incorporaciones y a la Junta Directiva, para que se suministrara, por ser de carácter público, la información de los profesionales incorporados hasta esa fecha con esas notas y los respectivos acuerdos de la Junta Directiva mediante los cuales se habían aprobado y ratificado las respectivas incorporaciones, ya que ese acuerdo no se encontraba en firme y ratificado por la respectiva Junta al momento de mi solicitud. 5. Que el documento citado anteriormente tuvo acuse de recibido en fecha 21 de febrero de 2025 por parte de la señora Annia Picado Mesén, Secretaria de Actas, por el señor José Guillermo Silesky Mata, Auditor Interno y la señora Zeidy Ballestero Marín, Asistente de Presidencia y Junta Directiva”.Reclama que, a la fecha de presentación de este recurso, el Colegio recurrido no ha suministrado información alguna de las solicitudes planteadas. Estima lesionados sus derechos fundamentales. Pide que se declare con lugar el recurso.
  2. 2Mediante resolución de la Presidencia de la Sala de las 16:10 horas del 26 de marzo de 2025, se dio curso al proceso y se requirió informe el presidente del Colegio de Abogados y Abogadas de Costa Rica, sobre los hechos alegados por la parte recurrente.
  3. 3Por escrito incorporado al expediente digital el 1° de abril de 2025, informa bajo juramento Francisco Cruz Marchena, en su condición de presidente con representación judicial y extrajudicial del Colegio de Abogados y Abogadas de Costa Rica. Explica: “Lo indicado por la recurrente es parcialmente cierto. Si bien la recurrente remite correo electrónico al colegio y a funcionarios de la Corporación, las cuentas a donde fue enviada la solicitud no son un medio oficial autorizado por el Colegio para atender requerimientos de información externa a la institución. Según la prueba que adjunto para efectos de la valoración del Tribunal, la cuenta de correo electrónica a donde la recurrente envió el documento mediante el cual solicita información corresponde a la dirección de correo electrónico de las señoras Annia Picado Mesén, secretaria de Actas de la Junta Directiva y Zeidy Ballestero Marín, Asistente de Presidencia, no son un medio oficial así definido por la Administración del Colegio para la recepción, procesamiento y resolución de consultas de información externa a la Corporación.En ese sentido, debemos tomar en consideración que aún y cuando las funcionarias hubiesen acusado el recibo del correo remitido por la recurrente, ello no significa que éste se hubiese dirigido al canal correcto y que ello implicase la obligación de los receptores de proporcionar la información, esto por cuanto el suministro de lo pretendido es resorte exclusivo y excluyente de la Junta Directiva, por ende, resulta ser su competencia admitir, procesar, requerir, remitir al órgano administrativo respectivo la información solicitada y, posteriormente, suministrarle la información a la gestionante, todo lo que no puede ser ejecutado por un funcionario sin el respectivo cumplimiento del iter administrativo interno que se ha creado al efecto por parte del Colegio. Para los anteriores fines, el Colegio ha diseñado un medio de recepción de solicitudes de información u otros que provengan de agentes externos a la institución.En la página web de la Corporación, se publicita de forma clara y detallada, cual es el medio oficial para recibir consultas externas al Colegio. En ese sentido, se señala lo siguiente: “CONTÁCTENOS Consulta de Telf01 / +Telf02 Los correos mostrados en este directorio no son medios oficiales para recibir correspondencia o gestiones. Los únicos medios oficiales para dirigirse al Colegio son: Módulo de información (documentos físicos) y al correo electrónico ...01 (En ningún caso se atenderán correos sin firma digital). El correo electrónico oficial tiene por finalidad que los agremiados formulen consultas al Colegio sobre aspectos administrativos o relacionados con el ejercicio de la profesión. En cuanto a los particulares, es para que realicen consultas sobre agremiados o el funcionamiento del Colegio. No se atenderán, por tanto, consultas sobre asuntos personales.” El resaltado no es del original.En el planteamiento del recurso de amparo, la recurrente indica que su gestión no ha sido atendida, sin embargo, es importante indicar lo siguiente: 1. Que la solicitud de información o criterio solicitado por la recurrente no fue remitido a la cuenta de correo oficial de consultas externas así definido por la Corporación, a saber: ...01 2. Que, como requisito expresado así por la Corporación, las solicitudes de información deben ser enviadas con la respectiva firma digital del interesado. Sobre este tema, conviene hacer la siguiente aclaración que se ilustra con la imagen que se adjunta: (…) Mediante el correo electrónico de fecha 28 del mes y año en curso, el Director Ejecutivo del Colegio hace del conocimiento del Departamento Legal que, una vez analizados las notas que fueron remitidas por la recurrente a un canal NO OFICIAL de atención de consultas, los mismos no cuentan con un certificado de firma digital válido, lo que implica que los documentos no presentan garantía de integridad y autenticidad, de validez, vigencia ni confianza de quien esté suscribiendo los mismos.Lo anterior es relevante de cara a la transparencia y correcto procesamiento de solicitudes de información, toda vez que la recurrente se presenta ante este Tribunal señalando que ha gestionado solicitudes de información, pero, no existe certeza, validez ni confianza en los documentos remitidos a un canal no oficial del Colegio, para asegurar que quien los está requiriendo es quien dice ser o bien, que la recurrente fue quien gestionó la información por problemas con la firma de sus solicitudes. Al efecto, el sistema del Banco Central de Costa Rica al ser consultadas las firmas de los documentos remitidos por la agremiada y sobre los cuales sustenta el amparo que nos ocupa, señala: (…) Como se puede apreciar, de previo a la contestación del presente amparo, la firma en el documento de referencia no es válida, por ende, la solicitud de información que da base a este recurso no solo incumple con lo establecido por la Corporación como requisitos para el procesamiento de gestiones de información externa (a saber, remitirlas al correo electrónico ...01), sino también, en caso de ser enviadas por correo electrónico, venir firmadas con la respectiva firma digital del promovente.Debe notarse que certificación de las 08:00 horas del 8 de mayo del año en curso, suscrita por el director del Departamento de Tecnologías de la Información del Colegio, señor Ingeniero Christian Leandro Sánchez, expresamente señala que la dirección de correo electrónico a donde deben remitirse las consultas para la Corporación es: ...01 Lo anterior reviste vital importancia de cara a lo que ha venido resolviendo este Tribunal Constitucional en diferentes casos como el contenido en la sentencia No.2016 – 011396, de las 09:45 horas del 12 de agosto de 2016, en la cual se resolvió: (…) Sin perjuicio de lo anteriormente señalado, debe tomarse en consideración que quien envió la nota (porque por la razones dichas no se tiene certeza de que sea la amparada) siempre ha estado enterada de la acción administrativa tendiente a generar la respuesta al criterio solicitado, pues en la comunicación que fue remitida al correo electrónico señalado en la nota se le informa del traslado que realizó la Junta Directiva de su gestión al Departamento Legal de la institución.En el documento de referencia se indica lo siguiente: (…) La información del estado de la gestión fue realizada en fecha 05 de marzo del año en curso, lo que significa que la persona interesada nunca ha estado desinformada del avance o estado de sus requerimientos ante la institución. PETITORIA De conformidad con lo anteriormente expuesto, citas legales y jurisprudenciales, solicito a este honorable Tribunal Constitucional proceder a declarar sin lugar en todos sus extremos el Recurso de Amparo presentado por la señora Nombre01, decretando su rechazo”.
  4. 4Por escrito incorporado al expediente digital el 2 de abril de 2025, la recurrente expone: “Por medio del presente escrito, la suscrita manifiesta la posición en respuesta al informe de contestación presentado por el Colegio de Abogados y Abogadas de Costa Rica (en adelante CAACR), en el expediente No. 25-007121-0007-CO. En tal contestación, el CAACR expone argumentos que resultan de una interpretación errónea de los derechos fundamentales involucrados, los cuales paso a refutar en detalle a continuación. I. Refutación de los argumentos centrales del CAACR El CAACR, mediante escrito de contestación hace referencia a que la suscrita remitió solicitud de información a los canales no oficiales del CAACR, sin embargo, es necesario hacer varias aclaraciones. Como primer punto, al comunicarse a la central telefónica del CAACR y realizar consultas, estos mismos indican y remiten a los correos electrónicos donde se debe solicitar la información según lo que se requiera, sin embargo, en ningún momento indican que estas deban ser únicamente tramitadas al canal oficial indicado por este Colegio, siendo un motivo clave para que cause confusión.Además, en esta misma página ofrecen un amplío directorio telefónico, que contienen correos electrónicos oficiales de distintas áreas donde se puede solicitar información, por lo que también resulta confuso que se limite única y exclusivamente a un correo electrónico en el cual ni tan siquiera acusan recibido de la información, ni indican el traslado a las dependencias correspondientes, por lo que resulta contradictorio para los agremiados, tal y como se puede observar en el siguiente link https://www.abogados.or.cr/contactenos/ Como segundo punto, es importante indicar que mis solicitudes aquí planteadas si tuvieron un tramite (sic) a lo interno de la Junta Directiva, de aquí se emana el Acuerdo No. 2025-08-24, notificado a mi correo electrónico oficial y visto a continuación. (…) A pesar de que mi documento fue conocido, también fue acordado por la Junta Directiva a ser trasladado para su respuesta al Departamento Legal, situación que no se termina de comprender, porque la suscrita no solicitó un criterio formal ni legal sobre algún tema en específico, sino, información que es de carácter publico (sic) y competencia de otros departamentos en los cuales, un Departamento Legal no cuenta con la competencia para dar respuesta, o caso contrario, sería un doble esfuerzo el solicitar por parte del área legal a los departamentos la información para dar una respuesta a la suscrita, lo que a todas luces se denota como un acto dilatorio para que mi persona no obtenga la información solicitada, además, de que, queda demostrado es una conducta reiterativa del CAACR, al no suministrar información de carácter público, hasta que se le sea exigido mediante la interposición de este tipo de recursos, que únicamente vienen a sumar más de las inconsistencias que se presentan en dicha institución.Ahora bien, intenta el CAACR, hacer manifestaciones o afirmaciones que resultan graves en cuanto a mi persona, al indicar que el Director Ejecutivo, -quien ni tan siquiera se encuentra nombrado con formalidades establecidas normativamente ni con idoneidad del puesto, sino que, se conoce que es un nombramiento irregular realizado por el mismo presidente-, se atreve a exponer situaciones graves, como lo es la autenticidad de mi firma digital, que si bien es cierto, al momento de firmar los documentos por mi persona, -por ser esta de uso personal-, me indicaba que los certificados si estaban válidos al momento de remitir los correos electrónicos, sin embargo al momento de que los funcionarios del CAACR ingresaran a la solicitud, denotaron que presentaban una falla, la cual NUNCA fue notificada por el CAACR a mi persona, siendo que, en caso de haber ocurrido esta solicitud de subsane, inmediatamente se hubiera procedido nuevamente con la firma de los documentos en cuestión, pero caso contrario, el CAACR se guarda esta información, le dan trámite a mis documentos y hasta se toman acuerdos por parte de la Junta Directiva para que se me suministre una respuesta, poniéndome en un estado de indefensión por no haberme notificado que estos presentaran un error, sino, que lo ventilan ante esta Honorable Sala, haciendo pensar que mi información no es válida y tratando de salvar sus responsabilidades, sin motivos suficientes que se consideren justificables como criterio personal.Debido a lo anterior y al enterarme de esta situación por el escrito aquí refutado, se procedió a remitir el día de hoy, por cuenta propia, el subsane y ratificación de todas las solicitudes de información enviadas al correo, lo que automáticamente deja en evidencia que son suscritos por mi persona y que cuentan con la validez suficiente para ser tramitados, sin embargo, es importante hacer ver a esta Honorable Sala, que esto no se considera una falta que amerite un proceso de investigación en mi contra como lo expresó el señor Allan, sino un error en el medio tecnológico que perfectamente se pudo subsanar en tiempo si se me hubiera puesto en conocimiento. (…) Sin embargo, se denota aun mas la mala intención del ente, al indicar que por este error de validación, el afirmar que no se sabe si corresponden a mi persona, resulta un hecho grave, ya que bastaba con realizar la consulta como agremiada para verificar que el correo electrónico registrado en el CAACR, es el mismo del cual se solicitan todas las informaciones, tal y como se muestra a continuación.(…) En síntesis, este Ente es contradictorio, al indicar en primera instancia que no envío solicitudes al correo oficial, sin embargo, dan acuse de recibido y lo trasladan a la propia Junta Directiva, quien en todo caso ordena que se me de respuesta a lo peticionado y que es muy importante indicar que han transcurrido 28 días hábiles desde que se planteó la solicitud y 25 días hábiles desde que se indicó que se me iba a dar una respuesta por parte de algún Departamento, sin que a la fecha esto haya sucedido. Es importante recalcar, que dentro de la misma prueba adjunta por el CAACR, el señor Allan Salazar López, hace una manifestación muy grave sobre lo acontecido, ya que, sin solicitar de previo la corrección del certificado digital, más bien indica que va a remitir estos hechos a la Fiscalía para que se investiguen, -lo cual no cuenta con sustento suficiente para incurrir en investigaciones, ni inversión del erario público en algún tipo de investigación-,considerando esto más bien como un acto de persecución en mi contra, únicamente por querer tener acceso a información pública y que en cierta forma corresponde a rebajos de notas sin acuerdos de Junta Directiva que he venido denunciando y haciendo públicos en los últimos dos meses.Por último, es importante indicar a esta Honorable Sala, que sobre este caso en concreto mediante Resolución No, 2003-06466 de las diez horas con cincuenta y dos minutos del cuatro de julio del dos mil tres, se conoció un asunto en similitud de condiciones, que para el dictado de la resolución de este recurso, es importante que se tome en consideración, por lo cual se cita textualmente: (…) superaron plazos de respuesta y no son atendidos por el CAACR, haciendo una mención clara sobre el problema presentado con mi firma digital, lo cual no constituye una falta de mi parte para que la información no sea suministrada dentro de los plazos legales, por lo que solicito se rechacen los alegatos del CAACR y se solicite suministrar la información que es de carácter público y de interés gremial, para no obstaculizar los procedimientos administrativos que se podrían derivar por las presuntas irregularidades en los últimos meses ejercidas por parte de dicho Colegio y que en aras de garantizar el acceso a la información, se atiendan las solicitudes realizadas.PETITORIA Por las razones de hecho y derecho expuestas, solicito respetuosamente que este honorable Tribunal declare CON LUGAR el recurso de amparo, al haber quedado demostrada la violación al derecho fundamental de petición de la recurrente y de los demás agremiados del Colegio que quisieran conocer los acuerdos tomados por la Junta Directiva. En consecuencia, pido se ordene al Colegio de Abogados y Abogadas de Costa Rica suministrar la información solicitada, garantizando en adelante el derecho de conocer los acuerdos oficiales que versen sobre asuntos gremiales, al no lograr acreditar que la información solicitada por mi persona contuviera un error grave, siendo en todo momento subsanable, pero no comunicado por ningún medio a mi persona. Que por no lograrse acreditar por parte del CAACR que se realizara una prevención a mi persona sobre los medios oficiales para solicitud de información, se rechace el alegato y se exija a esta institución a dar respuesta a lo peticionado.Esta práctica de ocultamiento de información se ha vuelto sistemática y reiterativa por la administración actual del CAACR, lo que obliga estar solicitando ante este Ente la adopción de medidas para que se pueda conocer información que es de carácter público y de interés para el gremio en general. Por tanto, solicito se emita la resolución conforme a derecho, tutelando eficazmente los derechos invocados”.
  5. 5Por escrito incorporado al expediente digital a las 8:09 horas del 22 de mayo de 2025, la magistrada Jara Velásquez formuló solicitud de inhibitoria.
  6. 6Mediante resolución de Presidencia de la Sala de las 10:05 horas del 22 de mayo de 2025, se aceptó la inhibitoria de la magistrada Jara Velásquez.
  7. 7Mediante sorteo nro. 13605 del 26 de mayo de 2025, se nombró al magistrado Fernando Enrique Lara Gamboa en sustitución de la magistrada Jara Velásquez.
  8. 8Por escrito incorporado al expediente digital a las 7:33 horas del 29 de mayo de 2025, el magistrado Fernando Enrique Lara Gamboa formuló solicitud de inhibitoria.
  9. 9Mediante resolución de Presidencia de la Sala de las 9:21 horas del 29 de mayo de 2025, se rechazó la inhibitoria del magistrado Lara Gamboa.
  10. 10En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el magistrado Rueda Leal; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente estima lesionados sus derechos fundamentales, dado que el Colegio de Abogados y Abogadas de Costa Rica no ha dado respuesta a dos solicitudes que formuló el 20 de febrero de 2025.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)A las 12:43 horas del 20 de febrero de 2025, la recurrente envió un correo electrónico a ...02, ...03, ...04, ...05, ...06, ...07, ...08 e ...09, en el que indicó: “(…) La suscrita, Nombre01, colegiada carné 24669, adjunto solicitud firmada digitalmente por mi persona (…)”. Además, se adjuntó un memorial en el que se lee:

“(…) La suscrita, Nombre01. mayor, soltera, abogada carné CED03, vecina de Heredia, San Pablo, cédula de identidad número CED01; en mi condición de agremiada, realizo la siguiente solicitud.

De conformidad con el artículo 11 del Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica, indica la forma y contenido del examen de Excelencia Academia, por lo cual solicito se me indique, cuanto (sic) porcentaje equivale a contenido evaluado en el respectivo examen y cuanto (sic) porcentaje equivale al curso de deontología jurídica para conformar el 100% de la nota.

Asimismo, solicito de conformidad con los artículos 14 y 15 de este Reglamento, se me proporcione la lista y los atestados de las profesionales que constituían el anterior Comte de Excelencia Académica, que, sin competencia, fue destituido por la Junta Directiva mediante Acta N.3 de la Sesión Ordinaria del 21 de enero de este año.

Además, solicito de manera expresa, se me suministre la lista y atestados de los profesionales que conforman el presente Comité de Excelencia Académica, nombrados sin competencia por la Junta Directiva, mediante Sesión Ordinaria del 21 de enero de 2025.

También realzo petición expresa, de que se investigue si alguno de los miembros actuales del CEA, tiene familiares por afinidad o consanguinidad en proceso de Incorporación, esto para evitar un posible tráfico de influencias. (…)

Señalo como medio para recibir lo solicitado y para futuras notificaciones el correo electrónico ...10 y subsidiariamente mi número telefónico Telf03”.

El 20 y el 21 de febrero de 2025, desde las cuentas ...11 y ...12, respectivamente, se dio acuse de recibido. (Ver prueba documental).

  • b)A las 14:18 horas del 20 de febrero de 2025, la accionante remitió un correo electrónico a ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14 e ...09, en el que señaló: “La suscrita, Nombre01, colegiada carné 24669, adjunto solicitud expresa firmada digitalmente por mi persona”. Asimismo, se adjuntó un memorial en el que se consignó:

“La suscrita, Nombre01, mayor. soltera. abogada carné 24669, vecina de Heredia, San Pablo, cédula de identidad número CED01. en mi condición de agremiada, realizo la siguiente solicitud.

De conformidad con el correo adjunto, suscrito por el señor Martin Mesén Espinoza, remitido a m correo electrónico personal, se me indica:

"Hay muchos profesionales incorporados con 76.40 a 79.99 que perderían su empleo y no quiero imaginarme cómo se van a sentir y cómo van a actuar. " En razón de lo anterior y por ser de conocimiento de personas a nivel nacional y tratarse de interés público, solcito la remisión de las listas de las personas agremiadas y los números de carné, con nota de 76.40 a 79.99 o menor, así como los respectivos acuerdos por los cuales la Junta Directiva verificó el cumplimiento de los requisitos establecidos en el Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica para su respectiva incorporación, los cuales ya deben estar firmes y ratificados.

(…)

Señalo como medio para recibir lo solicitado y para futuras notificaciones el correo electrónico ...10 y subsidiariamente mi número telefónico Telf03”. (Ver prueba documental).

El 21 de febrero de 2025 se dio acuse de recibido a esa gestión por parte de ...04, ...06 y ...15 (en su condición de auditor interno de la corporación gremial recurrida). (Ver prueba documental).

  • c)Las cuentas de correo electrónico ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14 e ...09 no son medios oficiales del Colegio de Abogados y Abogadas de Costa Rica para recibir gestiones. (Ver informe rendido bajo juramento por la autoridad recurrida).
  • d)El correo electrónico ...01 es el medio oficial para recibir gestiones de la corporación gremial recurrida. (Ver informe rendido bajo juramento por la autoridad recurrida).
  • e)A las 15:15 horas del 27 de marzo de 2025, la autoridad recurrida fue notificada de la resolución de curso de este recurso. (Ver acta de notificación).
  • f)El 28 de marzo de 2025, el director ejecutivo del Colegio de Abogados y Abogadas de Costa Rica comunicó al Departamento Legal que diversas notas remitidas por la accionante no cuentan con un certificado de firma digital válido. (Ver prueba documental).
  • g)El 28 de marzo de 2025, el secretario de la Junta Directiva de la corporación gremial accionada certificó que en la sesión ordinaria nro. 08-25 de ese órgano colegiado celebrada el 25 de febrero de 2025 se tomó el acuerdo de “Trasladar al Departamento Legal, las anteriores notas, 20.2, 20.3, suscritas por la Sra. Nombre01 (…)”. Además, se consignó que ese acuerdo fue notificada a la recurrente el 5 de marzo de 2025. (Ver prueba documental).
  • h)El Colegio de Abogados y Abogadas de Costa Rica no previno a la accionante subsanar el error acaecido con su firma digital. (Hecho incontrovertido).
  • i)El 2 de abril de 2025, la accionante envió un correo electrónico a ...01, por medio del cual adjuntó nuevamente las gestiones objeto de este recurso. (Ver prueba documental).

III. SOBRE EL CASO CONCRETO

En el sub lite, la parte recurrente estima lesionados sus derechos fundamentales, dado que el Colegio de Abogados y Abogadas de Costa Rica no ha dado respuesta a dos solicitudes que formuló el 20 de febrero de 2025.

La Sala comprueba que, a las 12:43 horas del 20 de febrero de 2025, la recurrente envió un correo electrónico a ...02, ...03, ...04, ...05, ...06, ...07, ...08 e ...09, en el que indicó: “(…) La suscrita, Nombre01, colegiada carné CED03, adjunto solicitud firmada digitalmente por mi persona (…)”. Además, se adjuntó un memorial en el que se lee: “(…) La suscrita, Nombre01. mayor, soltera, abogada carné CED03, vecina de Heredia, San Pablo, cédula de identidad número CED01; en mi condición de agremiada, realizo la siguiente solicitud. De conformidad con el artículo 11 del Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica, indica la forma y contenido del examen de Excelencia Academia, por lo cual solicito se me indique, cuanto (sic) porcentaje equivale a contenido evaluado en el respectivo examen y cuanto (sic) porcentaje equivale al curso de deontología jurídica para conformar el 100% de la nota.

Asimismo, solicito de conformidad con los artículos 14 y 15 de este Reglamento, se me proporcione la lista y los atestados de las profesionales que constituían el anterior Comte de Excelencia Académica, que, sin competencia, fue destituido por la Junta Directiva mediante Acta N.3 de la Sesión Ordinaria del 21 de enero de este año. Además, solicito de manera expresa, se me suministre la lista y atestados de los profesionales que conforman el presente Comité de Excelencia Académica, nombrados sin competencia por la Junta Directiva, mediante Sesión Ordinaria del 21 de enero de 2025. También realzo petición expresa, de que se investigue si alguno de los miembros actuales del CEA, tiene familiares por afinidad o consanguinidad en proceso de Incorporación, esto para evitar un posible tráfico de influencias. (…) Señalo como medio para recibir lo solicitado y para futuras notificaciones el correo electrónico ...10 y subsidiariamente mi número telefónico Telf03”.

El 20 y el 21 de febrero de 2025, desde las cuentas ...11 y ...12, respectivamente, se dio acuse de recibido. A las 14:18 horas del 20 de febrero de 2025, la accionante remitió un correo electrónico a ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14 e ...09, en el que señaló: “La suscrita, Nombre01, colegiada carné 24669, adjunto solicitud expresa firmada digitalmente por mi persona”. Asimismo, se adjuntó un memorial en el que se consignó: “La suscrita, Nombre01, mayor. soltera. abogada carné 24669, vecina de Heredia, San Pablo, cédula de identidad número CED01. en mi condición de agremiada, realizo la siguiente solicitud. De conformidad con el correo adjunto, suscrito por el señor Martin Mesén Espinoza, remitido a m correo electrónico personal, se me indica: "Hay muchos profesionales incorporados con 76.40 a 79.99 que perderían su empleo y no quiero imaginarme cómo se van a sentir y cómo van a actuar.

" En razón de lo anterior y por ser de conocimiento de personas a nivel nacional y tratarse de interés público, solcito la remisión de las listas de las personas agremiadas y los números de carné, con nota de 76.40 a 79.99 o menor, así como los respectivos acuerdos por los cuales la Junta Directiva verificó el cumplimiento de los requisitos establecidos en el Reglamento de Deontología Jurídica, Vigilancia y Excelencia Académica para su respectiva incorporación, los cuales ya deben estar firmes y ratificados. (…) Señalo como medio para recibir lo solicitado y para futuras notificaciones el correo electrónico ...10 y subsidiariamente mi número telefónico Telf03”. El 21 de febrero de 2025 se dio acuse de recibido a esa gestión por parte de ...04, ...06 y ...15 (en su condición de auditor interno de la corporación gremial recurrida). Las cuentas de correo electrónico ...02, ...03, ...06, ...08, ...04, ...05, ...07, ...13, ...14 e ...09 no son medios oficiales del Colegio de Abogados y Abogadas de Costa Rica para recibir gestiones.

El correo electrónico ...01 es el medio oficial para recibir gestiones de la corporación gremial recurrida. El 28 de marzo de 2025, el director ejecutivo del Colegio de Abogados y Abogadas de Costa Rica comunicó al Departamento Legal que diversas notas remitidas por la accionante no cuentan con un certificado de firma digital válido. El 28 de marzo de 2025, el secretario de la Junta Directiva de la corporación gremial accionada certificó que en la sesión ordinaria nro. 08-25 de ese órgano colegiado celebrada el 25 de febrero de 2025 se tomó el acuerdo de “Trasladar al Departamento Legal, las anteriores notas, 20.2, 20.3, suscritas por la Sra. Nombre01 (…)”. Además, se consignó que ese acuerdo fue notificada a la recurrente el 5 de marzo de 2025. El Colegio de Abogados y Abogadas de Costa Rica no previno a la accionante subsanar el error acaecido con su firma digital. El 2 de abril de 2025, la accionante envió un correo electrónico a ...01, por medio del cual adjuntó nuevamente las gestiones objeto de este recurso.

Ahora bien, dado que la autoridad recurrida expone su disconformidad con el medio empleado por la tutelada para remitir las gestiones objeto de este asunto y visto que cuestiona la validez de la firma digital contenida en tales gestiones, resulta menester aclarar tales temas.

Primeramente, resulta oportuno traer a colación lo dispuesto en la sentencia nro. 2008009670 de las 9:55 horas de 13 de junio de 2008:

“(…) En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales, deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público. Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones (…)” (el destacado fue suplido).

Por su parte, en la sentencia nro. 2019002204 de las 9:15 horas de 8 de febrero de 2019, este Tribunal se pronunció respecto a gestiones que, si bien son remitidas a correos electrónicos no oficiales, la autoridad recurrida acusa su recibido o inicia la tramitación de la respuesta correspondiente:

“(…) Ahora bien, en vista de lo expuesto y luego de analizar los elementos aportados a los autos, la Sala considera que el reclamo del recurrente en este sentido, resulta procedente, toda vez, que si bien el correo electrónico al que el interesado remitió su petición, no constituye un medio oficial para la recepción de tales gestiones, lo cierto es que la parte recurrida admitió que ha procedido a tramitar dicha solicitud, siendo que al momento que la recibió, tuvo conocimiento de ella (…)”.

En el sub iudice, el presidente de la corporación gremial recurrida sostiene que las cuentas de correo electrónico a las que la tutelada remitió las gestiones del 20 de febrero de 2025 no son medios oficiales del Colegio de Abogados y Abogadas de Costa Rica para recibir gestiones, toda vez que el medio oficial es ...01. Pese a lo anterior, en el sub examine queda plenamente demostrado que, el 20 y el 21 de febrero de 2025, desde las cuentas ...11 y ...12, respectivamente, se dio acuse de recibido a la gestión planteada a las 12:43 horas del 20 de febrero de 2025; en tanto que, el 21 de febrero de 2025 se dio acuse de recibido a esa gestión por parte de ...04, ...06 y ...15 (en su condición de auditor interno de la corporación gremial recurrida) a la solicitud formulada por la accionante a las 14:18 horas del 20 de febrero de 2025. Aunado a lo anterior, de la propia prueba aportada por la autoridad recurrida se desprende que en la sesión ordinaria nro. 08-25 celebrada el 25 de febrero de 2025 por la Junta Directiva del Colegio de Abogados y Abogadas de Costa Rica se acordó trasladar al Departamento Legal las notas emitidas por la amparada, lo cual le fue notificado el 5 de marzo de 2025. De este modo, en el sub examine se tiene por acreditado que la corporación gremial recurrida tenía conocimiento de las gestiones objeto de este asunto.

De segundo, en cuanto a lo alegado por el presidente del colegio accionado respecto a que “no existe certeza, validez ni confianza en los documentos remitidos a un canal no oficial del Colegio, para asegurar que quien los está requiriendo es quien dice ser o bien, que la recurrente fue quien gestionó la información por problemas con la firma de sus solicitudes”, se estima oportuno traer a colación lo dispuesto en la sentencia nro. 2023006416 de las 9:15 horas del 17 de marzo de 2023:

“V.- Atinente al Ministerio de Salud, la Sala corroboró que, mediante oficio nro. MS-DM-2678-2023 del 27 de enero de 2023, la ministra de Salud trasladó la gestión a la Dirección General de Salud para contar con su apoyo técnico y dar una respuesta al recurrente. Luego, por oficio nro. MS-DGS-320-2023 del 6 de febrero de 2023, la directora general de Salud previno al amparado lo siguiente: “Con relación a (sic) las solicitudes, estas deben ser presentadas con firma, 1. Si es con firma digital debe cumplir con las características que exige la normativa, con relación a (sic) que debe de cumplir con la “Ley de Certificados, firmas digitales y documentos Electrónicos” Ley N° 8454. 2. Si la solicitud se gestiona vía correo electrónico, mediante un documento con firma autógrafa, caso que nos compete en esta oportunidad; dicha firma debe estar debidamente autenticada o con la posibilidad que el interesado la realice personalmente frente a la persona, representante de la Administración, competente para el recibo de dicha documentación.

Por lo tanto, en aras de atender su solicitud dado que la nota que se recibió carece de los requisitos mínimos, tal y según lo dispuesto en la Ley General de la Administración Pública (artículo 285, inciso 1), sub-inciso b) e inciso 3) y en la Ley de Regulación del derecho de petición (inciso a) de su artículo 4 y b) de su artículo 7), se apercibe que debe presentar la nota con la petitoria nuevamente con el fin que cumpla con lo establecido con la opción de firma autógrafa, para ello, en el caso de enviar el documento por correo electrónico la firma debe estar debidamente autenticada por un abogado; caso contrario, la otra opción que cuenta el interesado, es apersonarse a la Dirección Área Rectora de Salud de Grecia o a la Dirección Regional de Rectoría de la Salud Central Norte y firmar la nota enfrente de un funcionario de Ministerio de Salud. Para ello se le otorga un plazo de plazo de 3 días hábiles para presentar nuevamente la nota con lo indicado en este oficio, esta nota la puede tramitar o hacer llegar en la Dirección Regional de Rectoría de la Salud Central Norte por medio del correo electrónico ...16 o en el Área Rectora de Salud de Grecia al correo electrónico ...17; en caso de que la documentación no se presente su solicitud debe ser archivada. Favor copiar el correo electrónico de la Dirección General de Salud ...18.” Este oficio fue notificado al amparado el 7 de febrero de 2023.

Ahora bien, la Sala subraya que la gestión planteada por el accionante era un documento digitalizado que contenía su firma. En ese tanto, la Sala estima aplicable, mutatis mutandis, el criterio expuesto en la sentencia nro. 2022020101 de las 15:02 horas del 26 de agosto de 2022:

“(…) En rigor, la firma constituye una representación gráfica de identificación de la persona, que se consigna en un documento, con el fin de expresar su autenticidad en cuanto a la suscripción o concurrencia de voluntad de determinada persona. Por otro lado, dada la dinámica contemporánea de tramitación electrónica o digital, se han establecido dispositivos de verificación de autenticidad de documentos o de personas, que pretenden armonizar la necesidad de identificación y autenticidad, con la creciente tendencia de las gestiones digitalizadas. Es en ese orden que se emite la Ley de Certificados, firmas digitales y documentos electrónicos, No, 8454, en la cual, a modo de simple referencia, se reconoce la equivalencia funcional de los documentos electrónicos (art. 3), así como al certificado de firma digital, que define como: “...cualquier conjunto de datos adjunto o lógicamente asociado a un documento electrónico, que permita verificar su integridad así como identificar en forma unívoca y vincular jurídicamente al autor con el documento electrónico/ Una firma digital se considerará certificada cuando sea emitida al amparo de un certificado digital vigente, expedido por un certificador registrado.” Así considerado, es claro que la firma dice de un rasgo o conjunto de ellos que se plasman en un documento físico. Los avances tecnológicos han llevado a impregnar de similar equivalencia funcional a la denominada firma digital.

Para quien suscribe, el ejercicio material del derecho de petición puede realizarse mediante documentos físicos, en los cuales, debe consignarse la firma del petente, como garantía de identidad. Sin embargo, ese ejercicio igualmente puede llevarse a cabo mediante otros medios que la era tecnológica pone a disposición de las personas administradas. La introducción del internet como plataforma de transmisión de datos, desde hace décadas, ha llevado a la implementación de esta plataforma como medio de prestación de actividades administrativas, así como herramienta para la formulación de gestiones administrativas en línea En efecto, con la introducción y fortalecimiento del denominado e-goverment, los entes públicos han puesto a disposición del público medios electrónicos mediante los cuales pueden acceder a información de interés, pero, además, a concretar su derecho de petición. Es cada vez más frecuente el uso de esta plataforma para potenciar la eficiencia administrativa y mi acceso cada vez más ágil a los trámites públicos.

Véase que incluso el numeral 4 de la Ley No. 8220 ordena la divulgación de trámites y requisitos mediante la plataforma de internet. Como parte de esa evolución, es innegable el reconocimiento del correo electrónico como medio de divulgación de comunicaciones, pero a su vez, como medio de formulación de peticiones. Múltiples normas dan cuenta de la cada vez más frecuente utilización del correo electrónico como canal de comunicación entre las personas, fenómeno que no resulta ajeno ni extraño a las relaciones jurídico-administrativas. En ese orden puede verse las Leyes Nos. 8687 (que regula las comunicaciones judiciales), 4755 (en el plano fiscal), así como el precepto 243 de la LGAP. En ese sentido, es mi consideración que el correo se constituye en un medio digital válido para expresar una manifestación de voluntad direccionada a formular peticiones administrativas. Es claro que, aun utilizando esa modalidad, la gestión debe llenar las exigencias formales ya señaladas.

Verbigracia, la petición realizada por este medio debe permitir la identificación de la persona gestionante, mediante la referencia del nombre de quien promueve determinado trámite. Empero, el uso de este medio no precisa, como condición de ingreso, de la inclusión de una firma tal y como es considerada en documentos físicos. El correo electrónico hace presuponer una identidad de la persona remitente, titular de ese medio, aspecto verificable a partir de la dirección IP mediante la cual se remite o transmite, de manera que, si existe duda en cuanto a esa identidad o autenticidad de la fuente, lo debido es que la administración ordene las prevenciones de rigor para verificar la autenticidad de la petición, tal y como lo reconoce el canon 286.1 de la LGAP.

De esa manera, la exigencia de firma aludida, no se estima pertinente en la remisión de una gestión por la vía del correo electrónico, sin perjuicio que el contenido de la solicitud permita establecer la identidad de la persona gestionante, tal y como se desprende del precepto 285.1 inciso a) de la LGAP en relación al (sic) 4 inciso a) de la Ley No. 9097. Frente a la eventual duda razonable que pueda establecerse en torno a esa identidad o autenticidad, es que el ente requerido podría prevenir el aporte de datos para dicho cotejo, pero en modo alguno, estimo que el uso del correo electrónico como medio de ejercicio del derecho de petición, deba acompañarse de una firma como es preciso para los documentos físicos. Lo anterior no es óbice para que el gestionante pueda acompañar sus peticiones con el respectivo certificado de firma digital, o bien, de otros mecanismos que puedan reflejar la autenticidad de la solicitud. Empero, no se estima que el uso de ese certificado pueda constituirse como requisito sine qua non para la presentación de solicitudes por medios digitales, al suponer un sesgo en la denominada brecha digital.

En concreto, la exigencia de firma a la que se ha hecho referencia, se impone en la tramitación mediante documentos físicos, no así cuando la solicitud se hace mediante correo electrónico, sin perjuicio de la potestad de la administración de verificar la autenticidad de la solicitud. La exigencia de firma en gestiones formuladas mediante correo electrónico, por la sola razón de utilizar ese medio, constituye una actuación arbitraria, infundada, que no encuentra respaldo en fuente formal alguna y conlleva, se reitera, a una limitación irrazonable al derecho de petición.

Visto así en la especie, ante la petición presentada por la parte recurrente, la administración accionada previno la subsanación de tres requisitos que estimó, desatendía la solicitud de marras, a saber: - el objeto de su petición; - hacía quien va dirigida la misma y - la firma del peticionario. Sobre ese particular, y al tenor del desarrollo anterior, es consideración de la mayoría de mi Cámara, que al margen de la potestad de prevenir la subsanación de las exigencias propias de las peticiones administrativas, el ente recurrido no ha acreditado una duda razonable en cuanto a la identidad del petente o bien, en cuanto a la autenticidad de la solicitud, por lo que, la supuesta falta firma en el correo electrónico en el cual se formuló la solicitud cuya omisión de respuesta se alega, no se puede constituir en un alegato legítimo del rechazo que se reprocha. Se trata de una aplicación normativa que antagoniza con la doctrina pro actione y el principio de informalismo que estatuyen los ordinales 224 y 286 de la LGAP y que, a no dudarlo, dice de un ejercicio ilegitimo y arbitrario de la potestad de prevención aludida.

Como todo ejercicio administrativo, estas conductas se encuentran sometidas al Ordenamiento Jurídico, de manera que el ejercicio de la potestad administrativa no puede ser desbordada, pretendiendo requerimientos que no resultan pertinentes, debidos o razonables en circunstancias concretas. Aún la potestad de marras se encuentra sometida a la interdicción de la arbitrariedad, a efectos de poder cotejar su conformidad con el plexo normativo, así como con los valores y principios que nutren el derecho de petición y el trámite debido de los procedimientos administrativos. Ergo, al no tratarse de un requisito incumplido, era deber del ente recurrido dar respuesta a lo solicitado, por lo que, al no constar en autos que haya dado la respuesta debida en el plazo correspondiente, es menester declarar con lugar el presente recurso de amparo y ordenar al ente local accionado brindar la información gestionada dentro del plazo máximo de cinco días hábiles computados a partir de la comunicación de este fallo (…)” (El subrayado es agregado).

En el sub lite, la autoridad recurrida requirió al tutelado que se presentara la gestión con firma autenticada por abogado o de manera presencial, en caso de que quisiera utilizar una firma autógrafa. Sin embargo, la Sala no aprecia que la prevención efectuada se fundara en un motivo legítimo, como sería una duda razonable en cuanto a la identidad del petente o la autenticidad de la solicitud, en los términos de la sentencia transcrita. En ese tanto, tal prevención constituye una actuación arbitraria e infundada, que implica una limitación irrazonable al derecho de petición. En virtud de lo expuesto, se declara con lugar este extremo” (el resaltado es del original).

En el sub iudice, si bien la autoridad recurrida aduce que no se pudo verificar la validez de la firma digital de la tutelada en las gestiones bajo estudio, no menos cierto es que no se acredita que exista una duda razonable sobre su identidad, máxime que tanto en los correos electrónicos como en el cuerpo de tales gestiones se hizo referencia expresa a los datos de identificación de la amparada, incluido su nombre y sus números de cédula y de carné de agremiada. En ese sentido, recuérdese que en el precedente transcrito este Tribunal fue claro al señalar que: “la exigencia de firma aludida, no se estima pertinente en la remisión de una gestión por la vía del correo electrónico, sin perjuicio que el contenido de la solicitud permita establecer la identidad de la persona gestionante, tal y como se desprende del precepto 285.1 inciso a) de la LGAP en relación al (sic) 4 inciso a) de la Ley No. 9097.

Frente a la eventual duda razonable que pueda establecerse en torno a esa identidad o autenticidad, es que el ente requerido podría prevenir el aporte de datos para dicho cotejo, pero en modo alguno, estimo que el uso del correo electrónico como medio de ejercicio del derecho de petición, deba acompañarse de una firma como es preciso para los documentos físicos. Lo anterior no es óbice para que el gestionante pueda acompañar sus peticiones con el respectivo certificado de firma digital, o bien, de otros mecanismos que puedan reflejar la autenticidad de la solicitud. Empero, no se estima que el uso de ese certificado pueda constituirse como requisito sine qua non para la presentación de solicitudes por medios digitales, al suponer un sesgo en la denominada brecha digital”. En todo caso, si aun en consideración de lo anterior, la corporación gremial accionada persistía en cuanto a la duda sobre la identidad de la petente, no se observa que se haya efectuado alguna prevención a la tutelada en ese sentido.

IV.Aclarado lo anterior, la Sala verifica la lesión a los derechos fundamentales de la tutelada, debido a la falta de actuación diligente y célere del Colegio de Abogados y Abogadas de Costa Rica en atender lo peticionado en las gestiones de las 12:43 horas del 20 de febrero de 2025 en cuanto a “(…) se me indique, cuanto (sic) porcentaje equivale a contenido evaluado en el respectivo examen y cuanto (sic) porcentaje equivale al curso de deontología jurídica para conformar el 100% de la nota. Asimismo, solicito de conformidad con los artículos 14 y 15 de este Reglamento, se me proporcione la lista y los atestados de las profesionales que constituían el anterior Comte de Excelencia Académica, que, sin competencia, fue destituido por la Junta Directiva mediante Acta N.3 de la Sesión Ordinaria del 21 de enero de este año. Además, solicito de manera expresa, se me suministre la lista y atestados de los profesionales que conforman el presente Comité de Excelencia Académica, nombrados sin competencia por la Junta Directiva, mediante Sesión Ordinaria del 21 de enero de 2025” y de las 14:18 horas del 20 de febrero de 2025. Ello por cuanto, pese a que tales gestiones fueron planteadas desde el 20 de febrero de 2025, no se tiene constancia de que al 1° de abril de 2025, a saber, más de un mes después, se haya dado la respuesta correspondiente.

Ergo, se estima el asunto en cuanto a estos agravios.

V.Finalmente, este Tribunal no omite señalar la improcedencia de acoger el recurso de amparo en cuanto a lo peticionado en la gestión de las 12:43 horas del 20 de febrero de 2025 respecto a “que se investigue si alguno de los miembros actuales del CEA, tiene familiares por afinidad o consanguinidad en proceso de Incorporación, esto para evitar un posible tráfico de influencias”, toda vez que constituye una exhortación.

Al respecto, en la sentencia nro. 2024008805 de las 9:20 horas del 5 de abril de 2024, este Tribunal explicó:

“(…) Primeramente, por oficio SMTA-010-2023 del 11 de agosto de 2023, el accionante mencionó a la Municipalidad de Atenas: “(…) Correo electrónico: ...19 (…) debido a que los funcionarios de esta municipalidad nos hemos quedado sin espacio para parquear nuestros vehículos, respetuosamente les solicitamos autorización para utilizar las instalaciones del Estadio Municipal de Atenas como parqueo (…)”. Ese escrito cuenta con sello de recibido del 21 de setiembre de 2023. Asimismo, por memorial SMTA-011-2023 del 11 de agosto de 2023, el recurrente señaló al gobierno local recurrido: “(…) Correo electrónico: ...19 (…) debido a que los miembros de este sindicato no contamos con un espacio para realizar las reuniones tanto ordinarias, como extraordinarias, les solicitamos se nos asigne una oficina exclusiva para uso de SITRAMA (…)”. Tal memorial cuenta con sello de recibido del 27 de setiembre de 2023.

Al respecto, de la lectura integral de los memoriales SMTA-010-2023 y SMTA-011-2023 del 11 de agosto de 2023 se desprende que en el fondo tratan de exhortaciones y no de peticiones simples o de solicitudes de información. Acerca de este tema, la Sala se refirió en la sentencia nro. 2022018615 de las 9:05 horas del 12 de agosto de 2022:

“IV.- SOBRE EL CASO CONCRETO. En la especie, los accionantes sostienen que el 9 de junio de 2022 remitieron a la dirección electrónica ...20 una gestión en la que solicitaron, entre otras cosas, les comunicaran sobre aspectos relacionados con la implementación de la Ley n.° 65 del 30 de julio de 1888 y el cumplimiento de una sentencia dictada por este Tribunal Constitucional. Afirman que tal gestión fue reiterada el 14 de junio de 2022, momento en el que se formuló de forma personal ante el despacho del ministro de Ambiente y Energía. Acusan que, al momento te interposición de este recurso, no han recibido respuesta alguna.

Del estudio de los autos se desprende que, el 9 de junio de 2022 la parte recurrente remitió un correo electrónico a la cuenta ...20, en el que se adjuntó un memorial que contiene una solicitud de información referente al cumplimiento de una sentencia dictada por este Tribunal. Al respecto, cabe señalar que en la especie se tiene como incontrovertido que tal correo electrónico constituye un medio oficial de la autoridad recurrida para recibir gestiones. Asimismo, la Sala verifica que tal gestión fue reiterada por la parte recurrente, dado que se aprecia que, 14 de junio de 2022, el despacho del ministro accionado recibió el memorial JFAC/032/2022 fechado 9 de junio de 2022.

En tal gestión, la parte accionante solicitó: “1. Se proceda en cuanto antes a cumplir el voto 12109-2008 de la Sala Constitucional, y se recuperen los terrenos de la zona inalienable, y mientras se lleve el procedimiento legal de recuperación, y tomando en cuenta que nos encontramos en una zona de alta recarga acuífera y de muy alta vulnerabilidad ambiental e hidrogeológica, se actúe por parte del MINAE en coordinación con las municipalidades, para que no se permitan actividades dentro de la ampliación del 2015 del Parque Braulio Carrillo y en el resto de la zona inalienable. 2. Solicitamos que, de todos los expedientes de reclamos de derechos de propiedad o posesión, antes de que el MINAE emita resoluciones que avalen o nieguen los derechos, se consulte como ente técnico registral al Registro de la Propiedad Inmueble y a la vez a la Procuraduría General de la República, sobre la veracidad de los derechos; esto ante la falta de pericia que pueden adolecer en el MINAE para resolver los casos (…) 9.

Se vuelvan a revisar por parte del MINAE, y se pida criterio al Registro nacional (sic) y Procuraduría General de la República los procedimientos y las resoluciones dictadas por ministros de ambiente anteriores por medio de las cuales han avalado derechos de propiedad de terrenos que geográficamente se encuentren en la zona inalienable, esto a efecto de la transparencia y tener la certeza que se hizo el procedimiento correspondiente y a derecho. 10. Considerando que los terrenos que se ubican en la Zona Inalienable (sic) de la Ley 65 de 1888, son patrimonio estatal, estando su administración bajo la tutela del MINAE, solicitamos que cualquier arreglo y construcción de un camino por parte del Ministerio de Obras Públicas o una municipalidad o particular se lleve a cabo previo aval del MINAE, el que considerará o tomará en cuenta el posible efecto ambiental sobre la zona que puede significar directamente las obras sobre el terrenos (sic), como las indirectas, como la carga humana por una mayor visitación de ciudadanos, en una zona ambientalmente frágil (…)”.

Sobre lo requerido por la parte recurrente en los puntos 1, 2, 9 y 10 de la gestión bajo estudio, cabe indicar que trata de exhortaciones y no de peticiones simples o de solicitudes de información. Al respecto, la Sala se refirió en la sentencia n.° 705-96 de las 16:12 horas de 7 de febrero de 1996:

“(…) Del análisis del oficio de fecha 29 de noviembre de 1995, enviado por el recurrente al Ministro de Obras Públicas y Transportes (Ver a folio 4) y cuya omisión de dar respuesta es el objeto de los alegatos aquí planteados, no se observa que tal omisión constituya violación al derecho de petición y pronta respuesta tutelado por el artículo 27 de la Constitución Política. En efecto, lo que sí se desprende de ese documento, es que el objetivo que buscaba era hacerle una exitativa (sic) al señor Ministro para que se abocara a promover al interior del Ministerio que tiene a su cargo el proceso ‘concertado, participativo y transparente en la cuestión de la Transformación del Estado’, tal y como lo afirma el recurrente en el libelo de interposición del recurso… En razón de lo anterior, no se podría pretender obligar al Ministro de Obras Públicas y Transportes a rendir una respuesta, pues no se le está solicitando que rinda información alguna sobre el proceso de transformación en su cartera, lo cuál (sic) hace necesario, declarar sin lugar el recurso. (…)” .

Mientras que en la sentencia n.° 2002003910 de las 15:55 horas de 30 de abril de 2002, esta Cámara consideró que:

“(…) II.- La recurrente acusa –además- que se ha violentado el artículo 27 de la Constitución Política, pues a la fecha no se ha obtenido respuesta a la nota que remitió el Asesor Legal del Sindicato Unión de Conserjes de Educación Pública al Director del Personal del Ministerio de Educación Pública, esto el veintiséis de febrero pasado. Efectivamente, el citado artículo constitucional hace referencia a la facultad que posee toda persona para dirigirse por escrito a cualquier funcionario público o entidad oficial, a fin de que estos le informen o resuelvan asuntos de su interés, garantía que se complemente con el derecho de obtener pronta resolución. Sin embargo, de la lectura del escrito en mención y cuya omisión en resolver se acusa (ver copia a folio 6 del expediente), desprende esta Sala que tal gestión no encaja en los presupuestos del artículo 27 constitucional y del 32 de la Ley de la Jurisdicción Constitucional, pues corresponde propiamente a una exhortativa o gestión de apoyo, con la que se procura incitar al recurrido para que interponga “sus buenos oficios para que se nombre en propiedad a la señora Nombre02”.

De ahí, que si la intención de dicho Asesor Legal era procurar que el recurrido actuara de la forma que él pretendía y aún no lo han hecho, ello no constituye una omisión que pueda lesionar su derecho de petición en los términos que lo plantea en el memorial inicial (ver en sentido similar sentencias número 1481-96 de las 18:15 horas del 27 de marzo de 1996, número 2000-8491 de las 15:01 horas del 26 de septiembre del 2000, y 2001-118 de las 9:26 horas del 5 de enero del 2001). (…)” (el destacado no es del original).

El Tribunal no encuentra razones para variar el criterio vertido en las supracitadas sentencias, ni motivos que lo hagan valorar de manera distinta la situación planteada. En consecuencia, dado que lo requerido por la parte recurrente en los puntos 1, 2, 9 y 10 de la gestión del 9 de junio de 2022, reiterada el día 14 de ese mismo mes, constituyen exhortaciones, no procede acoger el amparo en lo que a tales agravios refiere” (el resaltado fue agregado).

Asimismo, en la sentencia nro. 2022021561 de las 9:30 horas del 16 de setiembre de 2022 se estableció:

“VI.- En los puntos 1, 4 y 5 de la gestión del 15 de junio de 2022, la parte recurrente solicitó: 1. Solicitamos revocar y dejar sin efecto el oficio JDC-SINDEU-314-2022 con fecha 6 de junio del 2022 (…) 4. Solicitamos una disculpa por parte de la Junta Directiva Central del SINDEU, por haber realizado "una revisión" de los afiliados sin haber tomado en cuenta a la Seccional de Maquinaria y Equipo. 5. Solicitamos que se subsanen estos hechos lamentables, para que no vuelvan a ocurrir en el futuro (…)”.

Obsérvese que tales requerimientos no tratan de solicitudes de información en ejercicio del derecho de asociación, sino que constituyen exhortaciones, en las que se procuró incitar al sindicato recurrido a efectuar una serie de actuaciones acordes con las pretensiones de los tutelados. Ergo, no se verifica la lesión a los derechos fundamentales de la parte amparada en cuanto a los puntos 1, 4 y 5 de la gestión del 15 de junio de 2022”.

En igual sentido, en la sentencia nro. 2023019751 de las 9:30 horas del 11 de agosto de 2023 se indicó:

“V.- Ahora bien, esta Cámara verifica que los puntos 2 y 3 de la gestión de la amparada, concernientes a “SEGUNDO: Sea de conocimiento general la lista de elegibles del puesto ocupacional de Profesionales en Enfermería actualizado a la fecha. TERCERO: Que las listas supra solicitadas sean debidamente “ubicadas en un lugar de fácil acceso a la persona funcionaria que así lo requieran o que demuestre un interés legítimo” como lo indica la circular GG-DAGP-0724-2021”, no versan sobre una solicitud de información ni alguna petición pura y simple, sino que tratan más bien de exhortaciones con las que se procura incitar a la autoridad recurrida a que haga de conocimiento general la lista de elegibles de profesionales en Enfermería y que incluso se ubiquen en determinados lugares. De allí que la aparente omisión en contestar tales puntos no implica una lesión a su derecho de petición ni tampoco al de pronta resolución y, por ende, no resulta amparable en esta Sala. Verbigracia, en lo atinente a estos temas, la Sala, mediante sentencia 2002-003910 de las 15:55 horas del 30 de abril de 2002, dispuso lo siguiente:

“II.- La recurrente acusa –además- que se ha violentado el artículo 27 de la Constitución Política, pues a la fecha no se ha obtenido respuesta a la nota que remitió el Asesor Legal del Sindicato Unión de Conserjes de Educación Pública al Director del Personal del Ministerio de Educación Pública, esto el veintiséis de febrero pasado. Efectivamente, el citado artículo constitucional hace referencia a la facultad que posee toda persona para dirigirse por escrito a cualquier funcionario público o entidad oficial, a fin de que estos le informen o resuelvan asuntos de su interés, garantía que se complemente con el derecho de obtener pronta resolución. Sin embargo, de la lectura del escrito en mención y cuya omisión en resolver se acusa (ver copia a folio 6 del expediente), desprende esta Sala que tal gestión no encaja en los presupuestos del artículo 27 constitucional y del 32 de la Ley de la Jurisdicción Constitucional, pues corresponde propiamente a una exhortativa o gestión de apoyo, con la que se procura incitar al recurrido para que interponga “sus buenos oficios para que se nombre en propiedad a la señora Nombre02”.

De ahí, que si la intención de dicho Asesor Legal era procurar que el recurrido actuara de la forma que él pretendía y aún no lo han hecho, ello no constituye una omisión que pueda lesionar su derecho de petición en los términos que lo plantea en el memorial inicial (ver en sentido similar sentencias número 1481-96 de las 18:15 horas del 27 de marzo de 1996, número 2000-8491 de las 15:01 horas del 26 de septiembre del 2000, y 2001-118 de las 9:26 horas del 5 de enero del 2001). (…)” (El destacado no es del original).

Tales consideraciones son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dicha sentencia, ni motivos que lo hagan valorar de manera distinta la situación planteada. Así las cosas, se desestima el recurso en relación con tales extremos”.

En el sub examine, recuérdese que lo requerido por el amparado en los oficios SMTA-010-2023 y SMTA-011-2023 del 11 de agosto de 2023 cuya falta de respuesta se acusa fue la autorización para que las personas funcionarias de la Municipalidad de Atenas utilicen las instalaciones del estadio municipal para parquear y la asignación de una oficina para uso exclusivo de Sitrama, cuestiones que, evidentemente, no constituyen meras peticiones ni solicitudes de información, sino en exhortaciones. Por ende, al consistir en exhortaciones las gestiones planteadas por la parte accionante el 11 de agosto de 2023, no procede la estimatoria de este recurso en cuanto a estos extremos (…)”.

En consecuencia, dado que lo peticionado por la accionante en la gestión de las 12:43 horas del 20 de febrero de 2025 respecto a “que se investigue si alguno de los miembros actuales del CEA, tiene familiares por afinidad o consanguinidad en proceso de Incorporación, esto para evitar un posible tráfico de influencias”, no constituye una mera petición ni solicitud de información, sino que trata de una exhortación, no se estima el recurso concerniente a este extremo.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso, solo en cuanto a la demora en atender las gestiones de las 12:43 horas del 20 de febrero de 2025 en cuanto a “(…) se me indique, cuanto (sic) porcentaje equivale a contenido evaluado en el respectivo examen y cuanto (sic) porcentaje equivale al curso de deontología jurídica para conformar el 100% de la nota. Asimismo, solicito de conformidad con los artículos 14 y 15 de este Reglamento, se me proporcione la lista y los atestados de las profesionales que constituían el anterior Comte de Excelencia Académica, que, sin competencia, fue destituido por la Junta Directiva mediante Acta N.3 de la Sesión Ordinaria del 21 de enero de este año. Además, solicito de manera expresa, se me suministre la lista y atestados de los profesionales que conforman el presente Comité de Excelencia Académica, nombrados sin competencia por la Junta Directiva, mediante Sesión Ordinaria del 21 de enero de 2025” y de las 14:18 horas del 20 de febrero de 2025.

Se le ordena a Francisco Cruz Marchena, en su condición de presidente con representación judicial y extrajudicial del Colegio de Abogados y Abogadas de Costa Rica, o a quien ocupe ese puesto, que disponga todas las medidas necesarias y coordine lo pertinente dentro del ámbito de sus competencias, a fin de que, plazo de OCHO DÍAS, contado a partir de la notificación de esta sentencia, se notifique a la accionante al medio señalado para tales efectos la respuesta de las gestiones de las 12:43 horas del 20 de febrero de 2025 en cuanto a “(…) se me indique, cuanto (sic) porcentaje equivale a contenido evaluado en el respectivo examen y cuanto (sic) porcentaje equivale al curso de deontología jurídica para conformar el 100% de la nota. Asimismo, solicito de conformidad con los artículos 14 y 15 de este Reglamento, se me proporcione la lista y los atestados de las profesionales que constituían el anterior Comte de Excelencia Académica, que, sin competencia, fue destituido por la Junta Directiva mediante Acta N.3 de la Sesión Ordinaria del 21 de enero de este año.

Además, solicito de manera expresa, se me suministre la lista y atestados de los profesionales que conforman el presente Comité de Excelencia Académica, nombrados sin competencia por la Junta Directiva, mediante Sesión Ordinaria del 21 de enero de 2025” y de las 14:18 horas del 20 de febrero de 2025. Lo anterior salvaguardando los datos personales de acceso restringido, confidenciales y sensibles, de acuerdo con la normativa vigente. En caso de incurrirse en algún costo producto de las copias requeridas, el mismo correrá a cargo de la parte interesada. Se advierte a la autoridad recurrida, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Colegio de Abogados y Abogadas de Costa Rica al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese.
