San José, at nine twenty in the morning on treinta de mayo de dos mil veinticinco.
Amparo proceeding being processed under case file number 25-010101-0007-CO, filed by Nombre01, identity card CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS AND THE ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO RURAL DE SAN PEDRO DE SANTA CRUZ DE GUANACASTE.
BACKGROUND:
Yes, there is evidence of two documents in which the BCR declares its interest in the housing subsidy project for property 5- 185192-000 (Annex 4), and a document in which the BCR and Banhvi approve the subsidy; however, the latter document contains the following statement at the end: “This notice applies for purposes of approval of the Housing Subsidy; approval of the loan related to this subsidy is subject to the corresponding assessment” (Annex 5). This same document also states that construction permits are required, but there is no evidence whatsoever that they were applied for or processed in either the proceeding file or the application submitted to the ASADA. Lastly, with respect to a possible extension, the ASADA must ensure that the required conditions exist within the system, which are likewise not met in this case, since the wells used by the ASADA do not have an authorized flow rate (caudal concesionado), as shown by expediente 607-R (Annex 6).
This had already been established in official letter GSD-UEN-GAR-2021-00422. (Annex 7) Therefore, this allegation is rejected because no application for a permanent connection (conexión permanente) or an extension of service availability (prórroga de disponibilidad) was submitted in accordance with the regulations.” FOURTH: Partially true. The cited report states: “Regarding this allegation, it is important to note that, although the ASADA had not been declared technically unfeasible (no factibilidad) by AyA, it had been warned since 2021 about the status of the lawful authorization of its water sources and their authorized flow rates. As mentioned in the response to Allegation 3, official letter GSD-UEN-GAR-2021-00422 (Annex 7) stated that the flow rates and sources needed to be updated. Therefore, this allegation is partially true: the ASADA does not have an official letter stating that it lacks technical feasibility (factibilidad); however, following the decision reviewing a technical study, it had already been warned about the status of its sources, which, under the Reglamento de Prestación de Servicios del AyA, is a prerequisite for technical feasibility (factibilidad técnica) and, consequently, for issuing new service availability certificates (certificaciones de disponibilidad de servicios). des Therefore, until the authorized flow rate and registration of the water-supply system’s sources are updated, the system lacks technical feasibility, as confirmed by the analysis conducted and issued through official letters GSD-UEN-GAR-2025-01553 and GSD-UEN-GAR-2025- 01552.” FIFTH: True.
As stated in the report issued by the Orac Región Chorotega, on 21 de marzo de 2025, in response to complaints made against the Asada San Pedro, that Office contacted it by email to ascertain why it was not issuing positive service availability determinations; that same day, the respondent Asada replied, stating that it was relying on official letter GSD-UEN-GAR-2021-00422 issued by AyA, which establishes that not all of the ASADA’s sources are registered and that it has no allocated flow rate (caudal asignado). At the beginning of the current year, the Association’s Board of Directors resolved not to issue any new positive service availability certificates because of that condition (Annex 8); this decision is entirely valid, as explained in the responses to the preceding allegations. The Orac Chorotega states that it held a virtual meeting on 31 de marzo de 2025 with the respondent Asada, during which it became clear that withholding service availability determinations until the situation involving the water-supply system’s sources and flow rates is resolved is justified.
Following this meeting, the operator submitted a series of questions to the Orac Chorotega, which were answered on 21 de abril de 2025; one of the responses confirmed that, because of the water capacity (capacidad hídrica)—the sources and their allocations—it was best not to issue new service availability determinations until the allocation of flow rates to the wells was resolved. (Annex 9) It should be noted that, in febrero de 2025, the interested party contacted AyA, stating that he had a construction permit but was not being provided service; the Institution, in turn, informed him that he was required to take the appropriate steps before the Asada in accordance with due process (debido proceso). As demonstrated by Annex 3, on 12 de marzo del 2025 the interested party requested that the Asada San Pedro de Santa Cruz install the service and renew the service availability determination, without demonstrating that the request had been submitted with the required documentation.
On 8 de abril de 2025, the person again wrote to the Orac Chorotega (Annex 10), and that Office responded on 21 de abril. In parallel, on 8 de abril del presente año, Ms. Nombre02 wrote to the respondent Asada, stating that she had visited AyA, and submitted a series of questions to the Asada (Annex 11). The ASADA’s extensive responses to the interested party, dated 15 de abril, may be seen in Annex 12. Therefore, Allegation 5 is confirmed: the ASADA acted on the basis of an official communication from AyA, specifically official letter GSD-UEN-GAR-2021-00422, and this was ratified through the virtual meeting held and the subsequent email communication of 21 de abril de 2025. (Annex 9) The Orac Región Chorotega concludes in its report: 1. 2. 3. A service availability determination was issued in 2024 for the property identified by survey plan (plano) G- 1458923-2010. The information provided does not establish that the interested parties properly submitted an application to the ASADA for service installation (permanent connection) or renewal of service availability; therefore, the ASADA was not required to process a response beyond stating that the requirements had not been met.
The ASADA had been warned since 2021 about the situation involving the wells and flow rates, and although no document declaring technical unfeasibility was issued at that time, the ASADA acted correctly in suspending the issuance of service availability determinations until the matter was resolved. The ORAC Chorotega has ratified the ASADA’s status, and this was communicated to the ASADA and the interested parties. The ORAC Chorotega proceeded to issue official letters GSD-UEN-GAR-2025-01553 and GSD-UEN-GAR-2025-01552 to the ASADA concerning its technical unfeasibility, which will remain in effect until the information on the wells is updated. The ASADA’s actions are deemed correct. There is one factor in this case that could assist the interested party: in communications with AyA, the interested party stated that he has a construction permit—which was not submitted in the proceeding file or in any communication—and therefore, if he does in fact have a construction permit associated with the service availability determination issued in abril de 2024, he could apply for a permanent connection because the permit was obtained during the validity period of the service availability determination, provided that one exists.”
Justice Cruz Castro drafts the opinion; and,
Considering:
Section 57 of the Ley de la Jurisdicción Constitucional establishes several requirements for the admissibility of amparo petitions (recursos de amparo) against private-law parties. First, private entities or persons must “act or be required to act in the exercise of public functions or powers.” If that circumstance is not present and the private-law party occupies a position of power, whether de facto or de jure, amparo will be available solely as a subsidiary remedy under ordinary law if two other conditions are met: a) ordinary judicial remedies are insufficient, and b) they are untimely. That is, even where ordinary judicial proceedings adequate to satisfy the protected party’s claim exist, their outcome would be untimely, resulting in harm that would be difficult or impossible to remedy. In this particular case, the Court deems it appropriate to consider the merits of the matter because the respondent ASADA acts in the exercise of public functions or powers. Accordingly, the merits of the petition shall be considered.
The petitioner files an amparo petition and states that he and his wife acquired, through a housing subsidy (bono de vivienda), the property recorded under registration number , with cadastral plan (plano catastrado) . He states that the property had a water availability letter valid until 18 April 2025, which was required for the housing-subsidy, loan, and construction-permit procedures. He indicates that on 12 March 2025 he requested renewal of the water availability and, after receiving no response, repeated the request on 4 April of that same year. However, the respondent ASADA replied that, at that time, neither renewals nor new availability approvals were being granted because of circumstances involving the water sources, and that this had been communicated through ORAC Chorotega. In response, on 31 March 2025, the petitioner went to the Oficina Regional de Acueductos Comunales (ORAC) in Liberia to inquire whether any directive existed ordering the ASADA de San Pedro de Santa Cruz to suspend the granting of water availability approvals.
According to him, official Liany Alfaro informed him that no such order existed and that, although the ASADA was arranging to join a program for suspending availability approvals, it had not yet been admitted and there was no ratified technical study justifying that measure. Despite this information, the ASADA continued to assert that orders from the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) required it to halt availability approvals. For the foregoing reasons, the petitioner requests the intervention of the Sala Constitucional, asserting that his fundamental rights have been violated.
The following facts are deemed duly established and relevant to the decision in this matter:
1. The property recorded under cadastral plan (registration number ) had a water availability letter issued on 18 April 2024, with sequential number 18-ABR-2024-0025, originally granted to Corporación Hermanos Cortés Arias S.A. Subsequently, two rights were recorded: in the name of Nombre02 and 5-185192-002 in the name of Nombre01 (see reports submitted).
2. On 12 March 2025, Nombre02 emailed the ASADA requesting installation of the water service pursuant to the availability previously granted and, additionally, its renewal (see reports submitted).
3. The ASADA replied on 04 April 2025, stating that neither renewals nor new availability approvals were being granted in view of the condition of the water sources (see reports submitted).
4. On 31 March 2025, the interested party went to ORAC Chorotega in Liberia, where he was informed that there was no formal AyA order suspending availability approvals, but that the ASADA was in the process of arranging its admission into a special program (see reports submitted).
5. The ASADA maintained that it was guided by AyA Official Letter GSD-UEN-GAR-2021-00422, which had warned since 2021 about the irregular condition of the system’s flow rates (caudales) and concessioned sources, providing the basis for suspending new approvals (see reports submitted).
6. On 21 March 2025, ORAC Chorotega formally asked the ASADA about the suspension of availability approvals. That same day, the ASADA replied by reaffirming that its Board of Directors had agreed not to issue new availability approvals because the sources had not been registered and no flow rate had been allocated, based on Official Letter GSD-UEN-GAR-2021-00422 (see reports submitted).
7. On 31 March 2025, the ASADA and ORAC Chorotega held a virtual meeting at which the reason for not granting availability approvals while the technical condition of the sources remained unresolved was recognized as valid. As a follow-up, Official Letters GSD-UEN-GAR-2025-01553 and GSD-UEN-GAR-2025-01552 were issued, confirming the system’s lack of technical feasibility (see reports submitted).
8. On 03 April 2025, Nombre02 paid for the service connection installation, and on 04 April 2025 meter N° 449 was installed at the residence; however, at this time it is not feasible for the ASADA to grant additional services because of the lack of water sources supplying the community (see reports submitted).
9. On 08 April 2025, Nombre02 sent emails to both ORAC Chorotega and the ASADA expressing her disagreement, and the ASADA replied on 15 April 2025 with a detailed explanation of the condition of the sources and the unmet requirements (see reports submitted).
10. It is confirmed that a valid availability approval was issued in April 2024; nevertheless, it was not shown that the requirements necessary to process installation of the service or renewal of the availability approval had been formally submitted, in accordance with Articles 37, 67, and 68 of the Reglamento de Prestación de los Servicios del AyA (see reports submitted).
11. If the interested party has a valid construction permit, he may request a permanent connection, provided that it is documented within the validity period of the availability approval (see reports submitted).
After analyzing the evidence submitted, this Court finds no violation of the fundamental rights of the party seeking amparo relief (parte amparada). The reports rendered and the evidence submitted for adjudication of this matter have duly established that the respondent ASADA granted a potable water service connection (conexión del servicio de agua potable) to the protected parties’ residence, based on the availability in effect at the time of the application. However, the record also shows that the application to renew the availability letter (carta de disponibilidad) was not processed because it was not technically feasible to provide new services, a situation supported by several technical reports, particularly official communications GSD-UEN-GAR-2021-00422, GSD-UEN-GAR-2025-01552 and GSD-UEN-GAR-2025-01553, which demonstrate structural limitations in the system’s water capacity, such as insufficient concessioned flow (caudal concesionado) and the failure to register water sources.
Additionally, it has been established that the ASADA’s refusal was not based on an arbitrary or unreasoned act, but rather on a decision adopted by its Board of Directors at the ordinary meeting of 19 de marzo de 2025, minutes N.° 176, as a measure to protect the sustainability of the essential public potable water service for the benefit of the entire community supplied by that community aqueduct (acueducto comunal). This action falls within the principles of efficiency, continuity, and safety in service provision established in article 9 of the AyA Service Provision Regulations (Reglamento de Prestación de los Servicios del AyA). Moreover, it was also determined that the application submitted on 12 de marzo de 2025 did not comply with the documentary requirements established in articles 37, 67 and 68 of the aforementioned Regulations, either for installation of the service or renewal of availability.
Consequently, the ASADA was under no legal obligation to approve the application, and the interested parties were duly and timely informed of the reasons for that decision. Finally, with respect to the matter brought before the Regional Office of Community Aqueducts (Oficina Regional de Acueductos Comunales, ORAC Chorotega), that office validated the ASADA’s actions at a meeting held on 31 de marzo de 2025, as well as through subsequent communications confirming that new availability letters could not be issued until the aqueduct’s technical conditions were remedied. In this context, there is no action contrary to the legal system, nor any direct, current, and specific impairment of the fundamental rights asserted by the party seeking amparo relief. On the contrary, the response provided by the ASADA falls within the bounds of reasonableness and legality governing the actions of entities that administer essential public services.
Accordingly, the amparo petition (recurso) must be dismissed because no violation of the rights protected by this jurisdiction has been established, as stated in the operative part (parte dispositiva) of this judgment.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the Court’s office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” ("Reglamento sobre Expediente Electrónico ante el Poder Judicial"), approved by the Full Court (Corte Plena) at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
THEREFORE:
The petition is DENIED.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de mayo de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente número 25-010101-0007-CO interpuesto por Nombre01, cédula de identidad CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO RURAL DE SAN PEDRO DE SANTA CRUZ DE GUANACASTE.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
En numeral 57 de la Ley de la Jurisdicción Constitucional, establece varios requisitos de admisibilidad de los recursos de amparo contra sujeto de derecho privado. En primer lugar, que las entidades o personas privadas "actúen o deban actuar en ejercicio de funciones o potestades públicas". Si no se trata de esta hipótesis, y el sujeto de derecho privado, se encuentra en una posición de poder, de hecho, o de derecho, el amparo será procedente, únicamente, como remedio subsidiario de la legislación común si se cumplen otras dos condiciones: a) Que los remedios jurisdiccionales comunes no sean suficientes y b) que sean tardíos. Esto es que, aun existiendo procedimientos jurisdiccionales comunes adecuados para satisfacer la pretensión del tutelado, el resultado de estos sería tardío produciéndose lesiones de difícil o imposible reparación. En el caso particular, se estima procedente entrar a conocer el fondo del asunto, considerando que la Asada accionada actúa en ejercicio de funciones o potestades públicas. En consecuencia, procede conocer el recurso por el fondo.
La parte recurrente interpone recurso de amparo y expone que, junto con su esposa, adquirió mediante bono de vivienda el inmueble inscrito bajo la matrícula , con plano catastrado . Señala que dicha propiedad contaba con una carta de disponibilidad de agua vigente hasta el 18 de abril de 2025, la cual fue requisito para los trámites de bono de vivienda, préstamo y permiso de construcción. Indica que el 12 de marzo de 2025 solicitó la renovación de la disponibilidad de agua, y al no recibir respuesta, reiteró la solicitud el 4 de abril del mismo año. Sin embargo, la ASADA recurrida respondió que, en ese momento, no se estaban otorgando renovaciones ni nuevas disponibilidades debido a situaciones relacionadas con las fuentes de agua, y que esto se comunicó a través de la ORAC Chorotega. Ante esta respuesta, el 31 de marzo de 2025, el accionante acudió a la Oficina Regional de Acueductos Comunales (ORAC) en Liberia para consultar si existía alguna directriz que ordenara la suspensión de otorgamientos de agua por parte de la ASADA de San Pedro de Santa Cruz.
Según indica, la funcionaria Liany Alfaro le informó que no existía tal orden y que, si bien la ASADA estaba gestionando su ingreso a un programa para suspender disponibilidades, aún no estaba incorporada ni existía estudio técnico ratificado que justificara esa medida. A pesar de esta información, la ASADA continuó alegando la existencia de órdenes del Instituto Costarricense de Acueductos y Alcantarillados (ICAA) para paralizar las disponibilidades. En razón de lo anterior, el recurrente solicita la intervención de la Sala Constitucional por considerar que se vulneran sus derechos fundamentales.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
1. La propiedad inscrita bajo el plano catastrado (matrícula ), contaba con una carta de disponibilidad de agua emitida el 18 de abril de 2024, con consecutivo 18-ABR-2024-0025, originalmente otorgada a Corporación Hermanos Cortés Arias S.A. Posteriormente, se registran dos derechos: a nombre de Nombre02 y 5-185192-002 a nombre de Nombre01 (ver informes rendidos).
2. El 12 de marzo de 2025, la señora Nombre02 envió un correo electrónico a la ASADA solicitando la instalación del servicio de agua según la disponibilidad previamente otorgada y, además, la renovación de la misma (ver informes rendidos).
3. La ASADA respondió el 04 de abril de 2025, señalando que no se estaban otorgando ni renovaciones ni nuevas disponibilidades, en atención a la situación de las fuentes de agua (ver informes rendidos).
4. El 31 de marzo de 2025, el interesado acudió a la ORAC Chorotega en Liberia, donde se le informó que no existía una orden formal del AyA de suspender disponibilidades, pero que la ASADA estaba en proceso de gestionar su incorporación a un programa especial (ver informes rendidos).
5. La ASADA sostuvo que se guiaba por el oficio GSD-UEN-GAR-2021-00422 del AyA, que alertaba desde el año 2021 sobre la situación irregular de los caudales y fuentes concesionadas del sistema, fundamento para suspender nuevos otorgamientos (ver informes rendidos).
6. El 21 de marzo de 2025, la ORAC Chorotega consultó formalmente a la ASADA sobre la suspensión en el otorgamiento de disponibilidades. Ese mismo día, la ASADA respondió reafirmando que su Junta Directiva acordó no emitir nuevas disponibilidades por falta de inscripción de fuentes y ausencia de caudal asignado, basándose en el oficio GSD-UEN-GAR-2021-00422 (ver informes rendidos).
7. El 31 de marzo de 2025, se celebró una reunión virtual entre la ASADA y la ORAC Chorotega, donde se reconoció como válida la razón de no brindar disponibilidades mientras no se resuelva la condición técnica de las fuentes. Como seguimiento, se emitieron los oficios GSD-UEN-GAR-2025-01553 y GSD-UEN-GAR-2025-01552, ratificando la condición de no factibilidad técnica del sistema (ver informes rendidos).
8. El 03 de abril de 2025, la señora Nombre02 realizó el pago del servicio (prevista) y el 04 de abril de 2025 se ejecutó la instalación del medidor N° 449 en la casa de habitación; sin embargo en este momento no es factible para la ASADA otorgar otros servicios debido a la falta de fuentes de agua, que abastezcan la comunidad (ver informes rendidos).
9. El 08 de abril de 2025, la señora Nombre02 remitió correos tanto a la ORAC Chorotega como a la ASADA, expresando su disconformidad y la ASADA respondió el 15 de abril de 2025 con una explicación detallada sobre la situación de las fuentes y los requisitos no cumplidos (ver informes rendidos).
10. Se confirma que se emitió una disponibilidad válida en abril de 2024, no obstante, no se demostró la presentación formal de los requisitos necesarios para tramitar la instalación del servicio ni la renovación de la disponibilidad, de conformidad con los artículos 37, 67 y 68 del Reglamento de Prestación de los Servicios del AyA (ver informes rendidos).
11. Si el interesado cuenta con un permiso constructivo vigente, podría solicitar la conexión permanente, siempre que se acredite dentro del período de vigencia de la disponibilidad (ver informes rendidos).
Después de analizar los elementos probatorios aportados, este Tribunal descarta la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, la ASADA recurrida procedió a otorgar la conexión del servicio de agua potable a la vivienda de los amparados, en atención a la disponibilidad vigente al momento de la solicitud. No obstante, también consta que no se dio curso a la solicitud de renovación de la carta de disponibilidad, debido a la falta de factibilidad técnica para brindar nuevos servicios, situación fundamentada en diversos informes técnicos, particularmente los oficios GSD-UEN-GAR-2021-00422, GSD-UEN-GAR-2025-01552 y GSD-UEN-GAR-2025-01553, los cuales evidencian limitaciones estructurales en la capacidad hídrica del sistema, tales como la insuficiencia de caudal concesionado y la falta de inscripción de fuentes.
Adicionalmente, ha sido acreditado que la negativa de la ASADA no se basó en un acto arbitrario o carente de motivación, sino en una decisión adoptada por su Junta Directiva en sesión ordinaria del 19 de marzo de 2025, acta N.° 176, como medida de protección de la sostenibilidad del servicio público esencial de agua potable, en beneficio de toda la comunidad abastecida por dicho acueducto comunal. Esta actuación se enmarca dentro de los principios de eficiencia, continuidad y seguridad en la prestación del servicio, establecidos en el artículo 9 del Reglamento de Prestación de los Servicios del AyA. Por otra parte, también se determinó que la solicitud presentada el 12 de marzo de 2025 no cumplía con los requisitos documentales exigidos por los artículos 37, 67 y 68 del Reglamento citado, tanto para la instalación del servicio como para la renovación de la disponibilidad. En consecuencia, la ASADA no estaba obligada jurídicamente a dar curso favorable a la petición, lo cual fue informado y fundamentado oportunamente a los interesados.
Finalmente, en cuanto a la gestión ante la Oficina Regional de Acueductos Comunales (ORAC Chorotega), esta validó el proceder de la ASADA mediante reunión sostenida el 31 de marzo de 2025, así como a través de comunicaciones posteriores, en las que se ratificó la imposibilidad de brindar nuevas disponibilidades mientras no se subsanen las condiciones técnicas del acueducto. En este contexto, no se verifica una actuación contraria al ordenamiento jurídico ni una afectación directa, actual y concreta a los derechos fundamentales alegados por la parte amparada. Por el contrario, la respuesta brindada por la ASADA se enmarca dentro del margen de razonabilidad y legalidad que rige la actuación de los entes administradores de servicios públicos esenciales. Así las cosas, el recurso debe ser desestimado por no configurarse ninguna lesión a los derechos tutelados por esta jurisdicción, lo anterior, tal como se indica en la parte dispositiva de esta sentencia.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara SIN LUGAR el recurso.
