San José, at nine hours twenty-five minutes on the twenty-third of May of two thousand twenty-five.

Gerencia de desobediencia (enforcement proceeding) filed by MINOR VARGAS SALAS, acting as attorney for the petitioner, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) and the MUNICIPALIDAD DE GOLFITO.

**Resultando (Procedural Background):** 1.- By brief received in the Secretariat of the Chamber and incorporated into the digital case file at 15:06 hours on 15 November 2024, the petitioner's attorney alleges non-compliance with the order issued in sentence No. 2022010631 of 9:40 hours on 13 May 2022. He requests that the authorities of the Instituto Costarricense de Acueductos y Alcantarillados be compelled to report on the completion of the project for the residents of the community of El Jardín.

2.- By brief received in the Secretariat of the Chamber and incorporated into the digital case file at 16:31 hours on 15 November 2024, the petitioner commented on the report rendered by the authorities of the ICAA on 10 January 2024 and refuted the assertions made therein regarding the actions taken to comply with the order issued in this amparo. He requests that the authorities of the ICAA be compelled to "report on the completion of the project for the residents of the Community of El Jardín, providing photographs of the meters and service connections installed and in operation." 3.- By resolution of 9:23 hours on 25 November 2024, the enforcement proceeding was admitted for processing and a hearing was granted to Eric Alonso Bogantes Cabezas, in his capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, or to whomever holds said position in his stead, so that he could address the facts and omissions attributed to him and provide the corresponding evidence.

4.- By brief received in the Secretariat of the Chamber and incorporated into the digital case file at 7:32 hours on 28 November 2024, María Alejandra Mora Segura, in her capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath. She states the following: "FIRST: PARTIALLY TRUE. Ing. Rafael Barboza Topping, via official letter No. GSD-UEN-GAR-2024-05126, dated 26 November 2024, states: "Regarding point 1) Partially true, while it has been reported that the Municipalidad de Golfito, based on document AMMG-O-0319-2022 (report MG-DCU-I-0089-2022), delivered pipe to the ASADA (Administrative Association for Aqueduct and Sewer Systems) of Conte de Pavón, it is not true that AyA did not participate in this process, given that follow-up was provided as evidenced in official letters GG-2022-03174, GG-2022-02800, and SG-GSD-2022-01278. These official letters detail the following aspects of coordination between the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and the Municipalidad de Golfito regarding the supply of drinking water to the communities of El Jardín and La Escuadra de Conte, in the district of Pavón: • In July 2022, AyA requested information from the Municipality about the materials it had acquired for donation to the community. • AyA also asked whether those materials had the approval of any agency within AyA, since it is the technical governing body for ASADAs. • In August 2022, faced with a lack of response, AyA sent a reminder to the Municipality, reiterating the urgency of the information to comply with the order of the Sala Constitucional in resolution Nº 2022010631, to which they responded with official letter AM-MG-O-0319-2022. • AyA, through the Programa de Comunidades en Riesgo Sanitario (PCRS, Program for Communities at Sanitary Risk), supplemented the Municipality's donation by purchasing additional pipes. • In February 2024, work was underway on the installation of the pipe, with the participation of AyA, the ASADA de Conte, the Municipality, and the community. The municipal report details that, in accordance with the circumstances described above, work proceeded with the ASADA de Conte de Pavón on the necessary steps to install the pipe donated by the Municipalidad de Golfito, as the delegated operator of the service tasked with pipe installation under the guidelines and direction of AyA, under the service delegation model and since the ASADA de Conte was selected to carry out the project.

Quantity Description 170 PVC pipe, 6 meters long, 4" diameter, SDR26.

292 High-density polyethylene pipe, 12 meters long, 4" diameter, SDR13.5 PE.4710 In summary, coordination is shown between AyA and the Municipalidad de Golfito to resolve the water supply problem in the communities of El Jardín and La Escuadra. The Municipality and AyA donated pipes and both entities worked with the ASADA de Conte and the community on their installation." SECOND: NOT TRUE. In this regard, Ing. Rafael Barboza Topping, in the cited official letter No. GSD-UEN-GAR-2024-05126, states: "Regarding point 2) Not true. From the engineer's technical visit, guidelines were given to develop the project. On 7 August 2023, a visit was made to the project site, together with the ASADA Conte, to establish the project's scope. The ASADA de Conte administers the nearest aqueduct and will provide supply service to the community of El Jardín; therefore, it was coordinated that they would install the pipe under AyA's supervision. As a result of this visit, the definitive technical solution for supplying this community was established under the following scheme: (…) The technical proposal establishes the drinking water supply for the communities of La Escuadra and El Jardín through the installation of the necessary distribution piping from the aqueduct of the ASADA de Conte de Pavón, using the pipe donated by the Municipalidad de Golfito and AyA through the Programa de Comunidades en Riesgo Sanitario (PCRS) as a reference." THIRD: PARTIALLY TRUE. Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales (Rural Aqueduct Management UEN), via official letter No. GSD-UEN-GAR-2024-05126, states: "Regarding point 3) Partially true. As stated in the brief, AyA did purchase the remaining pipe, as shown in the following purchase requisition within the program for communities at risk. The order was for 580 PVC pipes with a 100 mm diameter, which, due to the nature of the purchase, are delivered to AyA's central warehouses in Pavas, San José, and as the ASADAs are informed, they must pick them up at that location. (…) FOURTH: PARTIALLY TRUE. Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, via official letter No. GSD-UEN-GAR-2024-05126, states: "Regarding point 4): Partially true. While it is true that, as in all cases, pipe provided to communities is delivered from the Central Warehouse located at AyA Headquarters in Pavas, San José, it is not true that it could not be installed, given that as of the date of this report, only 400 meters of it remain to be installed. It is not true that AyA has not maintained contact with the ASADA to verify installation; meetings have been held from the Presidencia Ejecutiva (Executive Presidency), and follow-up has been maintained by the ORAC Brunca with the ASADA de Conte as part of this office's functions." It is important to note that Ing. Rafael Barboza Topping, via email dated 27 November 2024, states: "… with the aim of clarifying the length of pipe remaining to be installed for the project's completion, a clarification is made that the 400 meters mentioned in point 4) is to reach the El Jardín School, but to complete the entire installation and finish the entire extension to La Escuadra, a total (sic.) of 1700m remains, which already includes the 400 meters to reach the School." FIFTH: NOT TRUE. Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, via official letter No. GSD-UEN-GAR-2024-05126, states: "Regarding point 5): Not true. From the beginning, the pipe installation project was coordinated so that the operator providing the service would install the pipe. As has been mentioned throughout this report, this was the coordination carried out between AyA, the ASADA de Conte, and the Municipalidad de Golfito. At no time has it been stated that these works were executed by AyA with its own personnel; rather, it has always been reported that this solution is carried out by the involved parties." SIXTH: NOT TRUE. Via official letter No. GSD-UEN-GAR-2024-05126 cited herein, Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, states: "Regarding point 6) Not true. The pipe provided by AyA has continued to be installed by the ASADA de Conte. This installation was suspended due to weather conditions, which have made it difficult to continue with pipe installation. In consultation with the ASADA, installation is scheduled to resume the week of 2 December, so the project can be finalized." (emphasis ours). SEVENTH: NOT TRUE. Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, via official letter No. GSD-UEN-GAR-2024-05126, states: "Regarding point 7) Not true. It should be noted that AyA provides advisory services to ASADAs, but all responsibilities for operational matters are broad and encompass water resource management, infrastructure administration, and addressing community needs. Some of the most important responsibilities are detailed below: Environmental Management and Water Resource Protection: Conservation and Protection: ASADAs have the duty to protect the sources and bodies of water they administer, in accordance with current legislation and in coordination with other public institutions. They must ensure the preservation, conservation, and protection of the water resource, as well as its rational use. Flow Rate Registry: ASADAs must maintain a monthly flow rate measurement program and a permanent record of gaugings of their sources, sending this information annually to the Subgerencia de Gestión Sistemas Comunales (Sub-Management for Communal System Management). Surveillance of Irregular Use: They must exercise surveillance and control over the use of the assigned water resource, filing complaints with AyA and the Dirección de Aguas del MINAE (Water Directorate of MINAE) in the event of irregularities. Infrastructure Administration: • Operation and Maintenance: ASADAs must operate their systems guaranteeing the continuity, quality, and quantity of service, and maintain all system components according to technical regulations. • Improvement Plan: They must develop and update a five-year plan for the expansion, maintenance, and improvement of services, following AyA's guide. Relationship with AyA: • Service Delegation: AyA delegates the management of drinking water and sanitation services to the ASADAs through a delegation agreement. • Technical Assistance: AyA offers technical assistance, training, oversight, and evaluation to the ASADAs to guarantee the adequate functioning of the services. • Project Approval: ASADAs must obtain AyA's approval for infrastructure improvement, expansion, or modernization projects. Based on the foregoing, it is concluded that support for the ASADAs is provided by the ORAC Brunca, which advises the ASADAs on all operational matters. Regarding the request, it should be noted that this project, as has been mentioned throughout this report, has been a joint action between AyA, the ASADA de Conte, the Municipalidad de Golfito, and the communities, given that from the beginning, coupled with the participation of the stakeholders, projects are finalized satisfactorily. To update the progress status as of today, 3500 meters of pipe have been laid, with 1700 meters pending placement, which had to be suspended due to the area's weather conditions. This installation is scheduled to continue starting the week of 02 December 2024, with the goal of completing this project during the first half of 2025. As is evident from official letter No. GSD-UEN-GAR-2024-05126, dated 26 November 2024, issued by Ing. Rafael Barboza Topping, as well as the clarification made by said official via email dated 27 November 2024, it is reiterated that AyA, in coordination with the Municipality, the ASADA Conte, and neighboring communities, has made efforts to comply with resolution No. 2022010631, a project that will conclude with the installation of the 1700 meters of pipe pending due to weather issues, as reported by the UEN Gestión de Acueductos Rurales, thereby interconnecting the communities of El Jardín and La Escuadra with the system administered by the ASADA de Conte de Pavón. As indicated by Ing. Barboza Topping, the possible date for resuming the works is 02 December 2024." 5.- By resolution of 16:19 hours on 29 November 2024, the Instructor Magistrate requested María Alejandra Mora Segura, in her capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, or whomever holds said position in her stead, to render a new report to this Chamber, clearly and precisely indicating whether the specific and particular orders issued in Voto No. 2022-10631 of 09:40 hrs. on 13 May 2022 have been complied with, yes or no.

6.- By brief received in the Secretariat of the Chamber and incorporated into the digital case file at 8:22 hours on 9 December 2024, María Alejandra Mora Segura, in her capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath. She states the following: "(…) it is important to indicate that Lic. José Antonio Jiménez Gómez, UEN Gestión de Acueductos Rurales (Rural Aqueduct Management UEN), via official letter No. GSD-UEN-GAR-2024-05222, dated 03 December 2024, states: "In response to official letter No. PRE-J-2024-04839, in which we are asked to provide an expanded report to the Sala Constitucional regarding an alleged contempt of resolution No. 2022010631, I hereby inform you of the following: 1.- That AyA has complied with what was specifically ordered by the Sala Constitucional and has undertaken actions, which have been duly reported, to provide a definitive solution for drinking water supply to the communities of El Jardín and La Escuadra de Golfito; this through an expansion project for the ASADA de Conte de Pavón to the indicated communities that lack drinking water service. Likewise, coordination has been made with the ASADA de Bella Luz de Corredores, which has provided assistance by means of a water truck, to supply water to this community to allow them to meet their basic needs while the works are finalized and the aqueduct system in those sectors begins operation. 2.- Regarding the stages, schedules, and responsibilities, it is important to clarify that this project was initially an initiative of the ASADA de Conte with the Municipalidad de Golfito, into which AyA's participation was subsequently incorporated in compliance with the cited resolution (No. 2022010631). Thus, there was no initial, duly planned schedule with the project's stages and responsible parties; instead, AyA stepped in to cover the deficiencies that had allowed the project to be executed, in this case assuming Technical Direction and providing part of the pipe needed to cover the entire area, since another part had been contributed by the Municipalidad de Golfito. Now, in this case it is important to note that in order to finalize the pipe installation works and advance with the desired speed, AyA needs to transport machinery (Back Hoe) for trench excavation. Currently, 3500 meters of pipe have been laid, with 1700 meters pending placement, which had to be suspended due to the area's weather conditions. This installation was scheduled to continue starting the week of 02 December 2024, with the goal of completing this project during the first half of 2025. However, given the weather conditions affecting the country, bringing in machinery was not materially possible, and therefore the work to continue pipe installation had to be suspended. This being the case, and with the hope that weather conditions will improve in the coming weeks, the entry of the machinery (Back Hoe) is projected for the second week of January 2025. These dates are always subject to weather conditions, as it is evident that the current end-of-year period has not presented the best conditions for project development. Given the foregoing and being conservative, considering that daily progress in pipe installation averages 80 pipes, the project would be completed within a week, i.e., the third week of January 2025." 7.- By resolution of 8:38 hours on 13 May 2025, the Instructor Magistrate requested better-evidence discovery from the Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, for the purpose of clarifying the following: "a) Whether the pipe-laying works on the pending 1700-meter section, as well as all corresponding actions to comply with sentence No. 2022010631 of 9:40 hours on 13 May 2022, have been completed, and b) if not, indicate the reasons." 8.- By brief received in the Secretariat of the Chamber and incorporated into the digital case file at 17:22 hours on 16 May 2025, María Alejandra Mora Segura, in her capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath. She states the following: "In this regard, Ing. Rafael Barboza Topping, UEN Gestión de Acueductos Rurales (Rural Aqueduct Management UEN), via official letter No. GSD-UEN-GAR-2025-01818, dated 15 May 2025, states: "The response to official letter PRE-J-2025-01779 is hereby provided, in response to your request for better-evidence discovery. In response to the request for a report required by the Sala Constitucional via resolution of eight hours thirty-eight minutes on the thirteenth of May of two thousand twenty-five, forwarded internally via memorandum No. PRE-J-2025-01779 dated 14 May 2025, regarding compliance with resolution No. 2022010631, specifically concerning whether the pipe-laying works on the pending 1700-meter section have been completed, the following is reported, based on information provided by the UEN Gestión de Acueductos Rurales via memorandum GSDUEN-GAR-2025-01813: In response to point a) The works to lay the 1700 meters of 100mm pipe are still pending installation. In response to point b) Regarding the reasons for said pending status, as requested by the Sala Constitucional, the following are indicated, according to the information gathered: 1. The installation has not been completed due to circumstances related to the logistics of the machinery or back hoe needed to dig the trench and subsequently backfill it for pipe installation, which has not been available. 2. Actions have been taken with the Municipalidad de Golfito, which has significantly collaborated by providing its back hoe throughout the project execution period. 3. Internally, actions were taken to utilize an institutional backhoe; however, technical problems arose with the machinery and subsequently with its transportation, so we continue to await repairs." 9.- In the proceedings followed, the legal requirements have been observed.

Drafted by Magistrate Sánchez Navarro; and, **Considerando (Findings of Law):** I.- Regarding what was ordered by this Chamber. Through sentence No. 2022010631 of 9:40 hours on 13 May 2022, this Chamber resolved the following:

"POR TANTO (THEREFORE):

The action is partially granted, solely against the authorities of the Instituto Costarricense de Acueductos y Alcantarillados. Consequently, Eric Alonso Bogantes Cabezas, in his capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, or whomever holds said position in his stead, is ORDERED that, within a period of TWO MONTHS—starting from the notification of this sentence—he shall determine the appropriate course of action regarding the provision of drinking water service in the community identified by the petitioner. Likewise, the respondent party is ORDERED that, should any action regarding this matter be agreed upon, the respective stages, schedules, and responsibilities shall be established within that same period. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, whoever receives an order that must be complied with or enforced, issued within an amparo proceeding, and fails to comply with it or enforce it, shall be punished with imprisonment of three months to two years or a fine of twenty to sixty days, provided the offense is not more severely penalized. The Instituto Costarricense de Acueductos is ORDERED to pay the costs, damages, and losses caused by the acts serving as the basis for this declaration, which shall be calculated in the sentence execution phase of the administrative litigation court. In regards to the Municipalidad de Golfito, the action is dismissed. Let it be notified." The above sentence was notified to the authorities of the Instituto Costarricense de Acueductos y Alcantarillados on 16 May 2022.

Subsequently, through interlocutory resolution No. 2023028040 of 9:15 hours on 31 October 2023, this Court resolved the following:

"Por tanto (Therefore):

The enforcement proceeding is granted. Eric Alonso Bogantes Cabezas, in his capacity as Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, or whomever holds said position in his stead, is REITERATED to comply with what was ordered by this Chamber in sentence No. 2022-010631 of 09:40 hours on 13 May 2022. The foregoing, under the warning of ordering the opening of a disciplinary administrative proceeding, based on Article 53 of the Ley de la Jurisdicción Constitucional, should he fail to do so, and furthermore, certifying documents to the Ministerio Público (Public Prosecutor's Office) as provided in Article 71 of the Ley de la Jurisdicción Constitucional. Let it be notified." The above resolution was notified to the authorities of the Instituto Costarricense de Acueductos y Alcantarillados on 1 November 2023.

II.- Regarding the present enforcement proceeding. In the present matter, non-compliance has again been alleged regarding what was ordered by the Chamber in Voto No. 2022010631 of 9:40 hours on 13 May 2022.

In this regard, it should be recalled that this sentence ordered the respondents (ICAA) to strictly do the following within two months: "determine the appropriate course of action regarding the provision of drinking water service in the community identified by the petitioner." Likewise, it was ordered that, should any action regarding this matter be agreed upon, "the respective stages, schedules, and responsibilities" be established within that same period.

Now, having reviewed the reports rendered under oath, it is evident that the respondent authorities of the ICAA have already determined the appropriate course of action regarding the provision of drinking water service in the community alleged by the petitioner. In that regard, it has been reported that a definitive technical proposal was established for the drinking water supply in the community of El Jardín. It was expressly stated that: "(…) The technical proposal establishes the drinking water supply for the communities of La Escuadra and El Jardín through the installation of the necessary distribution piping from the aqueduct of the ASADA de Conte de Pavón, using the pipe donated by the Municipalidad de Golfito and AyA through the Programa de Comunidades en Riesgo Sanitario (PCRS) as a reference (…)." In this way, this aspect is deemed complied with.

Regarding the second part of the issued order, the Gerente General (General Manager) of the Instituto Costarricense de Acueductos y Alcantarillados, in December 2024, informed this Sala Constitucional, under the solemnity of oath, the following:

"(…) 2.- Regarding the stages, schedules, and responsibilities, it is important to clarify that this project was initially an initiative of the ASADA de Conte with the Municipalidad de Golfito, into which AyA's participation was subsequently incorporated in compliance with the cited resolution (No. 2022010631). Thus, there was no initial, duly planned schedule with the project's stages and responsible parties; instead, AyA stepped in to cover the deficiencies that had allowed the project to be executed, in this case assuming Technical Direction and providing part of the pipe needed to cover the entire area, since another part had been contributed by the Municipalidad de Golfito.

Now, in this case it is important to note that in order to finalize the pipe installation works and advance with the desired speed, AyA needs to transport machinery (Back Hoe) for trench excavation. Currently, 3500 meters of pipe have been laid, with 1700 meters pending placement, which had to be suspended due to the area's weather conditions. This installation was scheduled to continue starting the week of 02 December 2024, with the goal of completing this project during the first half of 2025. However, given the weather conditions affecting the country, bringing in machinery was not materially possible, and therefore the work to continue pipe installation had to be suspended. This being the case, and with the hope that weather conditions will improve in the coming weeks, the entry of the machinery (Back Hoe) is projected for the second week of January 2025. These dates are always subject to weather conditions, as it is evident that the current end-of-year period has not presented the best conditions for project development. Given the foregoing and being conservative, considering that daily progress in pipe installation averages 80 pipes, the project would be completed within a week, i.e., the third week of January 2025 (…)." For its part, on 16 May 2025, that same authority (after being consulted about the completion of the pending 1700-meter pipe-laying works), indicated the following:

"In response to point a) The works to lay the 1700 meters of 100mm pipe are still pending installation. In response to point b) Regarding the reasons for said pending status, as requested by the Sala Constitucional, the following are indicated, according to the information gathered:

1. The installation has not been completed due to circumstances related to the logistics of the machinery or back hoe needed to dig the trench and subsequently backfill it for pipe installation, which has not been available.

2. Actions have been taken with the Municipalidad de Golfito, which has significantly collaborated by providing its back hoe throughout the project execution period.

3. Internally, actions were taken to utilize an institutional backhoe; however, technical problems arose with the machinery and subsequently with its transportation, so we continue to await repairs." Thus, it can be appreciated that, although the ICAA did not prepare stages, schedules, and responsibilities in the strictly indicated terms, this was due, as stated, to the circumstances inherent to the project in question, i.e., because the latter was, in reality, an original initiative of the ASADA de Conte and the Municipalidad de Golfito, which the respondent institute subsequently joined.

A project in which, in turn, ICAA has participated and collaborated with technical direction and the contribution of part of the piping that was missing, to the point that, at this time, only 1700 meters of the latter remain to be installed to achieve the main objective and claim pursued by the appealing party.

Given these circumstances, this Chamber considers that the two specific and precise orders issued in Voto No. 2022010631 have been fulfilled. Therefore, what was ordered therein cannot be deemed unfulfilled.

III.- That said, this Chamber also observes, according to the latest report rendered by the respondent authorities, that, to date, it has not yet been possible to install the remaining piping. However, since this was not an express order issued by this Court at the time, it is appropriate to indicate to the respondents that it is their duty to coordinate and carry out all pertinent steps, in order to install said piping and, consequently, complete the project under review as soon as possible.

IV.- Documentation submitted to the file. The parties are warned that if they have submitted any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not withdrawn within this period will be destroyed, pursuant to the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI and published in the Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, article LXXXI.

Por tanto:

The petition is dismissed. Let the respondent authorities of the Instituto Costarricense de Acueductos y Alcantarillados take note of the provisions set forth in considerando III of this resolution. Notify.- Fernando Castillo V.

Sala Constitucional Clase de asunto: Recurso de amparo Analizado por: SALA CONSTITUCIONAL Sentencia con datos protegidos, de conformidad con la normativa vigente  Res. Nº 2025015242 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintitres de mayo de dos mil veinticinco .

Gestión de desobediencia presentada por MINOR VARGAS SALAS, en su condición de abogado del recurrente, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) y LA MUNICIPALIDAD DE GOLFITO.

Resultando:

1.- Por escrito recibido en la Secretaría de la Sala e incorporado al expediente digital a las 15:06 horas del 15 de noviembre de 2024, el abogado del recurrente acusa la desobediencia de lo ordenado en la sentencia No. 2022010631 de las 9:40 horas del 13 de mayo de 2022. Solicita se obligue a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados informar sobre la terminación del proyecto para los vecinos de la comunidad de El Jardín.

2.- Por escrito recibido en la Secretaría de la Sala e incorporado al expediente digital a las 16:31 horas del 15 de noviembre de 2024, el gestionante se pronunció sobre el informe rendido por las autoridades del ICAA el 10 de enero de 2024 y refutó las aseveraciones ahí consignadas respecto a las gestiones realizadas para dar cumplimiento a lo ordenado en este amparo. Solicita se le obligue a las autoridades del ICAA a “informar de la terminación del proyecto para los vecinos de la Comunidad del Jardín teniendo fotografías de los medidores y previstas instaladas y en funcionamiento”.

3.- Por resolución de las 9:23 horas del 25 de noviembre de 2024, se le dio traslado a la gestión de desobediencia y se le concedió audiencia a Eric Alonso Bogantes Cabezas, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ocupe dicho cargo, para que se refiriera y aportara las pruebas correspondientes respecto a los hechos y omisiones que se le atribuyen.

4.- Por escrito recibido en la Secretaría de la Sala e incorporado al expediente digital a las 7:32 horas del 28 de noviembre de 2024, informa bajo jumento María Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta lo siguiente: “PRIMERO: PARCIALMENTE CIERTO. El Ing. Rafael Barboza Topping, mediante oficio No. GSD-UEN-GAR-2024-05126, de fecha 26 de noviembre del 2024, señala: “Sobre punto 1) Parcialmente cierto, como se ha informado efectivamente que la Municipalidad de Golfito y con base en el documento emitido AMMG-O-0319-2022 (informe MG-DCU-I-0089-2022), realizó la entrega de tubería a la ASADA de Conte de Pavón, no es cierto que el AyA no haya participado en este proceso, dado que se ha dado seguimiento como se evidencia en los oficios GG-2022-03174, GG-2022-02800 y SG-GSD-2022-01278. En estos oficios se detallan los siguientes aspectos de coordinación entre el Instituto Costarricense de Acueductos y Alcantarillados (AyA) y la Municipalidad de Golfito en relación con el suministro de agua potable a las comunidades de El Jardín y La Escuadra de Conte, en el distrito de Pavón: • En julio de 2022, el AyA solicitó información a la Municipalidad sobre los materiales que ésta había adquirido para su donación a la comunidad. • El AyA también preguntó si esos materiales contaban con la aprobación de alguna dependencia del AyA, ya que es el ente rector técnico de las ASADAS. • En agosto de 2022, ante la falta de respuesta, el AyA envió un recordatorio a la Municipalidad, reiterando la urgencia de la información para atender la orden de la Sala Constitucional en la resolución Nº 2022010631 a lo cual se respondió con el oficio AM-MG-O-0319-2022. • El AyA, a través del Programa de Comunidades en Riesgo Sanitario (PCRS), complementó la donación de la Municipalidad con la compra de tuberías adicionales. • En febrero de 2024, se estaba trabajando en la instalación de la tubería, con la participación del AyA, la ASADA de Conte, la Municipalidad y la comunidad. En el informe de la municipalidad se detalla que De acuerdo con la circunstancia expuesta anteriormente, se procedió a trabajar con la ASADA de Conte de Pavón, en las gestiones necesarias para realizar la instalación de la tubería donada por la Municipalidad de Golfito, esto como operador delegado del servicio al cual se le confirió la tarea de la instalación de la tubería bajo los lineamientos y dirección del AyA, bajo el modelo de la delegación de los servicios y al ser la ASADA de Conte la seleccionada para la realización del proyecto.

292 Tubo de Polietileno de alta densidad con 12 metros de longitud con 4” de diámetro SDR13.5 PE.4710 En resumen, se muestra una coordinación entre el AyA y la Municipalidad de Golfito para resolver el problema de abastecimiento de agua en las comunidades de El Jardín y La Escuadra. La Municipalidad y el AyA, donaron tuberías y ambas entidades trabajaron con la ASADA de Conte y la comunidad en la instalación de la esta”. SEGUNDO: NO ES CIERTO. Sobre este particular el Ing. Rafael Barboza Topping, en el oficio No. GSD-UEN-GAR-2024-05126 citado, indica: “Sobre el punto 2) No es cierto, de la visita técnica del ingeniero de dieron las pautas para elaborar el proyecto, el día 7 de agosto del 2023, se realizó visita al sitio del proyecto, en conjunto con la ASADA Conte, para establecer los alcances del proyecto. La ASADA de Conte es quien administra el acueducto más cercano y será quién proveerá el servicio de abastecimiento a la comunidad del Jardín y por lo tanto se coordinó quien fuera quien instale la tubería bajo la supervisión del AyA. Como resultado de esta visita se estableció la solución técnica definitiva para el abastecimiento de esta comunidad bajo el siguiente esquema: (…) La propuesta técnica establece el abastecimiento de agua potable para las comunidades de La Escuadra y El Jardín, mediante la instalación de tubería de distribución necesaria a partir del acueducto de la ASADA de Conte de Pavón, y tomando como referencia la tubería donada por la Municipalidad de Golfito y el AyA mediante el Programa de Comunidades en Riesgo Sanitario (PCRS)”. TERCERO: PARCIALMENTE CIERTO. El Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2024-05126, afirma: “Sobre punto 3) Parcialmente cierto, como se manifiesta en el escrito efectivamente el AyA realizó la compra la tubería faltante, según se muestra en la siguiente solicitud de pedido dentro del programa de comunidades en riesgo. El pedido correspondió a 580 tubos de PVC con un diámetro de 100 mm, los cuales por efectos de la compra son entregados en los almacenes centrales del AyA en Pavas, San Jose, y como se les hace de conocimiento a las ASADAS, estas deben ser retiradas en esta ubicación. (…) CUARTO: PARCIALMENTE CIERTO. El Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2024-05126, indica: “Sobre punto 4): Parcialmente cierto, efectivamente como en todos los casos de tubería que se proporciona a las comunidades son entregadas desde el Almacén Central ubicado en la Sede del AyA en Pavas, San José, no es cierto que no ha podido instalar dado que a la fecha del presente informe solo restan de instalar 400 metros de esta. No es cierto que el AyA no ha mantenido contacto con la ASADA para verificar la instalación, se han atendido en reuniones desde la Presidencia Ejecutiva y se mantenido un seguimiento por parte de la ORAC Brunca con la ASADA de Conte como parte de las funciones de esta oficina”. Es importante indicar que, el Ing. Rafael Barboza Topping, mediante correo electrónico de fecha 27 de noviembre del 2024, señala: “… con el objetivo de aclarar la longitud de tubería que falta de instalar para la conclusión del proyecto, se realiza la aclaración que los 400 metros que se menciona en el punto 4) es para llegar a la Escuela de El Jardín, pero para concluir la totalidad de la instalación y concluir toda la extensión hasta la Escuadra, faltan un toral (sic.) de 1700m que ya contiene los 400 metros para llegar a la Escuela”. QUINTO: NO ES CIERTO. El Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2024-05126, señala: “Sobre punto 5): No es cierto, el proyecto de instalación de tubería desde un inició se coordinó para que el operador que brindará el servicio instalara la tubería, como se ha mencionado a lo largo de este informe, esta fue la coordinación que se ha realizado entre el AyA, ASADA de Conte y la Municipalidad de Golfito, en ningún momento se ha manifestado que estás obras las ejecutó el AyA con su personal, más bien siempre se ha informado que esta solución se realiza en lo actores involucrados”. SEXTO: NO ES CIERTO. Con oficio No. GSD-UEN-GAR-2024-05126 aquí citado, el Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, afirma: “Sobre el punto 6) No es cierto, la tubería proporcionada p por al AyA ha seguido siendo instalada por la ASADA de Conte, esta instalación se suspendió debido a las condiciones climáticas, que ha dificultado continuar con la instalación de tubería, en consulta con la ASADA, se programa reiniciar con la instalación para la semana del 2 de diciembre y poder concretar la conclusión del proyecto”. (el resaltado es nuestro). SÉPTIMO: NO ES CIERTO. El Ing. Rafel Barboza Topping, Director UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2024-05126, señala: “Sobre el punto 7) No es cierto, cabe destacar que desde el AyA se brinda asesoramiento a las ASADAS pero todo lo correspondiente a las responsabilidades en los temas operativos son amplias y abarcan la gestión del recurso hídrico, la administración de la infraestructura, y la atención a las necesidades de la comunidad. A continuación, se detallan algunas de las responsabilidades más importantes: Gestión Ambiental y Protección del Recurso Hídrico: Conservación y Protección: Las ASADAS tienen el deber de proteger las fuentes y los cuerpos de agua que administran, en consonancia con la legislación vigente y en coordinación con otras instituciones públicas. Deben velar por la preservación, conservación y protección del recurso hídrico, así como su aprovechamiento racional. Registro de Caudales: Las ASADAS deben mantener un programa de medición mensual de caudales y un registro permanente de aforos de sus fuentes, enviando esta información anualmente a la Subgerencia de Gestión Sistemas Comunales. Vigilancia del Uso Irregular: Deben ejercer vigilancia y control sobre el uso del recurso hídrico asignado, presentando denuncias ante el AyA y la Dirección de Aguas del MINAE en caso de irregularidades. Administración de Infraestructura: • Operación y Mantenimiento: Las ASADAS deben operar sus sistemas garantizando la continuidad, calidad y cantidad del servicio, y mantener todos los componentes del sistema según la normativa técnica. • Plan de Mejoras: Deben elaborar y actualizar quinquenalmente un plan de expansión, mantenimiento y mejora de los servicios, siguiendo la guía del AyA. Relación con el AyA: • Delegación de Servicios: El AyA delega la gestión de los servicios de agua potable y saneamiento a las ASADAS mediante un convenio de delegación. • Asistencia Técnica: El AyA ofrece asistencia técnica, capacitación, fiscalización y evaluación a las ASADAS para garantizar el adecuado funciona-miento de los servicios. • Aprobación de Proyectos: Las ASADAS deben obtener la aprobación del AyA para proyectos de mejoras, ampliación o modernización de la infraestructura. Por lo anterior se concluye que el acompañamiento de las ASADAS se presta desde la ORAC Brunca, quien asesora de todos los temas operativos a la ASADAS. Con respecto a la solicitud, cabe destacar que este proyecto como se ha mencionado en durante todo este informe, ha sido una acción en conjunto entre el AyA, ASADA de Conte, Municipalidad de Golfito y comunidades, dado que desde el inicio y aunado a la participación de los actores se concretan los proyectos de manera satisfactoria. Para actualizar el estado de avance a la fecha se han colocado 3500 metros de tubería, quedando pendiente la colocación de 1700 metros, que se tuvo que suspender por las condiciones climáticas de la zona, esta instalación se programa continuar a partir de la semana del 02 de diciembre del 2024, con la meta de concluir este proyecto durante el primer semestre del año 2025. Como se desprende del oficio No. GSD-UEN-GAR-2024-05126, de fecha 26 de noviembre del 2024, emitido por el Ing. Rafael Barboza Topping, así como de la aclaración realizada por dicho funcionario mediante correo electrónico de fecha 27 de noviembre del 2024, se reitera que, el AyA en coordinación con la Municipalidad, ASADA Conte y comunidades vecinas, ha realizado esfuerzos para dar cumplimiento a la resolución No. 2022010631, proyecto que finalizará con la instalación de 1700 metros de tubería pendientes por asuntos climáticos según se informó por parte de la UEN Gestión de Acueductos Rurales, con lo que se realizará la interconexión de las comunidades de El Jardín y La Escuadra, con el sistema administrado por la ASADA de Conte de Pavón. Según lo indicó el Ing. Barboza Topping, se tiene como posible fecha de reinicio de las obras el día 02 de diciembre del 2024”.

5.- Por resolución de las 16:19 horas del 29 de noviembre de 2024, el Magistrado Instructor solicitó a María Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ocupe dicho cargo, rendir un nuevo informe a esta Sala, donde se indique de forma clara y precisa si las órdenes concretas y particulares que se giraron en el Voto No. 2022-10631 de las 09:40 hrs. de 13 de mayo de 2022 se han cumplido, sí o no.

6.- Por escrito recibido en la Secretaría de la Sala e incorporado al expediente digital a las 8:22 horas del 9 de diciembre de 2024, informa bajo jumento María Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta lo siguiente: “(…) es importante indicar que, el Lic. José Antonio Jiménez Gómez, UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2024-05222, de fecha 03 de diciembre del 2024, señala: “En atención al oficio No.PRE-J-2024-04839 en el cual se nos solicita ampliación al informe a la Sala Constitucional por supuesto desacato a la resolución No. 2022010631 me permito informarle lo siguiente: 1.- Que el AyA ha acatado lo dispuesto concretamente por la Sala Constitucional y ha emprendido acciones que han sido debidamente informadas para dar solución definitiva al abastecimiento de agua potable a las comunidades del Jardín y la Escuadra de Golfito; esto mediante un proyecto de ampliación de la ASADA de Conte de Pavón hacia las comunidades indicadas que no cuentan con servicio de agua potable. Asimismo, se ha coordinado con la ASADA de Bella Luz de Corredores que ha brindado asistencia por medio de un vehículo acondicionado tanqueta, para abastecer de agua a esta comunidad que les permita satisfacer sus necesidades básicas, mientras se finiquitan las obras y entra en operación el sistema de acueducto en dichos sectores. 2.- Respecto a las etapas cronogramas y responsabilidades, es importante aclarar que este proyecto inicialmente fue una iniciativa de la ASADA de Conte con la Municipalidad de Golfito, que posteriormente fue incorporada la participación del AYA en acatamiento a lo dispuesto en la citada resolución (No. 2022010631). Así las cosas, no existió un cronograma inicial y debidamente planificado con las etapas y responsables del proyecto, sino que el AyA llegó a cubrir aquellas carencias que habían permitido la ejecución del mismo, asumiendo en este caso la Dirección Técnica y aportando parte de la tubería que se requería para cubrir la totalidad de la zona, ya que otra parte había sido aportada por la Municipalidad de Golfito. Ahora, en este caso es importante señalar que para finiquitar las obras de instalación de tubería y poder avanzar con la celeridad deseada se requiere que el AyA traslade maquinaria (Back Hoe) para la apertura de zanja. De momento existe un avance de tubería colocada de 3500 metros de tubería, quedando pendiente la colocación de 1700 metros, que se tuvo que suspender por las condiciones climáticas de la zona, esta instalación se programó continuar a partir de la semana del 02 de diciembre del 2024, con la meta de concluir este proyecto durante el primer semestre del año 2025. Sin embargo, al tenor de las condiciones meteorológicas que hay en el país, el ingreso de maquinaria no fue materialmente posible y por ende los trabajos para continuar con la instalación de tubería debieron suspenderse. Así las cosas y con la esperanza que en las próximas semanas mejoren las condiciones climáticas, se tiene proyectado el ingreso de la maquinaria (Back Hoe) para la segunda semana del mes de enero de 2025. Estas fechas están sujetas siempre a las condiciones meteorológicas pues es evidente que el cierre actual de período no ha presentado las mejores condiciones para el desarrollo de proyectos. Dado lo anterior y siendo conservador, considerando que en la instalación de la tubería se logra avance diario en promedio de 80 tubos, se estaría concluyendo el proyecto en término de una semana, es decir, la tercera semana de enero del 2025”.

7.- Por resolución de las 8:38 horas del 13 de mayo de 2025, el Magistrado Instructor solicitó prueba para mejor resolver a la Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, a efectos de que aclarara lo siguiente: “a) Si ya se culminó con las obras de colocación de tubería en el trayecto pendiente de 1700 metros, así como todas las gestiones correspondiente con el fin de brindar cumplimiento a lo establecido en la sentencia No. 2022010631 de las 9:40 horas del 13 de mayo de 2022, y b) en caso contrario, indicar las razones”.

8.- Por escrito recibido en la Secretaría de la Sala e incorporado al expediente digital a las 17:22 horas del 16 de mayo de 2025, informa bajo jumento María Alejandra Mora Segura, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta lo siguiente: “En este sentido, el Ing. Rafael Barboza Topping, UEN Gestión de Acueductos Rurales, mediante oficio No. GSD-UEN-GAR-2025-01818, de fecha 15 de mayo del 2025, señala: “Se presenta la respuesta al oficio PRE-J-2025-01779, en atención a su solicitud de prueba para mejor resolver. En atención a la solicitud de informe requerido por la Sala Constitucional mediante resolución de las ocho horas treinta y ocho minutos del trece de mayo de dos mil veinticinco, trasladada internamente mediante memorando No. PRE-J-2025-01779 de fecha 14 de mayo del 2025, en relación con el cumplimiento de la resolución No. 2022010631, específicamente en cuanto a si ya se culminó con las obras de colocación de tubería en el trayecto pendiente de 1700 metros, se informa lo siguiente, basándose en la información proporcionada por la UEN Gestión de Acueductos Rurales mediante memorando GSDUEN-GAR-2025-01813: En repuesta a punto a) Las obras de colocación de los 1700 metros de tubería de 100mm aún se encuentran pendientes de instalar. En respuesta al punto b)Respecto a las razones de dicho pendiente, según lo solicitado por la Sala Constitucional, se indican las siguientes, de conformidad con la información recabada: 1. No se ha concluido la instalación a circunstancias relacionadas con la logística de la maquinaria o back hoe necesaria para realizar la zanja y su posterior relleno para la instalación de la tubería, la cual no ha estado disponible. 2. Se han llevado a cabo gestiones con la Municipalidad de Golfito, la cual ha colaborado significativamente aportando su back hoe a lo largo del tiempo de ejecución del proyecto. 3. Internamente, se realizaron gestiones para aprovechar una retroexcavadora institucional, sin embargo, se presentaron problemas técnicos con la maquinaria y posteriormente con su transporte, por lo que se sigue a la espera de la reparación”.

9.- En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Sánchez Navarro; y,

Considerando:

I.- Sobre lo dispuesto por esta Sala. Mediante la sentencia No. 2022010631 de las 9:40 horas del 13 de mayo de 2022, esta Sala resolvió lo siguiente:

“POR TANTO:

Se declara parcialmente con lugar el recurso, únicamente en contra de las autoridades del Instituto Costarricense de Acueductos y Alcantarillados. En consecuencia, se le ordena a Eric Alonso Bogantes Cabezas, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ocupe dicho cargo que, dentro del plazo de DOS MESES - contado a partir de la notificación de esta sentencia-, se defina lo que corresponda respecto a la prestación del servicio potable en la comunidad señalada por el recurrente. Asimismo, se le ordena a la parte recurrida que, en caso de acordarse la realización de alguna actuación tocante a esta materia, se establezcan -dentro de ese mismo plazo-, las respectivas etapas, cronogramas y responsabilidades. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a la Municipalidad de Golfito, se declara sin lugar el recurso. Notifíquese”.

La anterior sentencia le fue notificada a las autoridades Instituto Costarricense de Acueductos y Alcantarillados el 16 de mayo de 2022.

Posteriormente, mediante la resolución interlocutoria No. 2023028040 de las 9:15 horas del 31 de octubre de 2023, este Tribunal resolvió lo siguiente:

“Por tanto:

Se acoge la gestión de desobediencia. Se le reitera a Eric Alonso Bogantes Cabezas, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ocupe dicho cargo, el cumplimiento de lo dispuesto por esta Sala en la sentencia No. 2022-010631 de las 09:40 horas del 13 de mayo de 2022. Lo anterior, bajo la advertencia de ordenar la apertura de un procedimiento administrativo disciplinario, con base en lo dispuesto el artículo 53 de la Ley de la Jurisdicción Constitucional, en caso de no hacerlo y, además, testimoniar piezas al Ministerio Público conforme lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional. Notifíquese”.

La anterior resolución le fue notificada a las autoridades Instituto Costarricense de Acueductos y Alcantarillados el 1º de noviembre de 2023.

II.- En cuanto a la presente gestión de desobediencia. En el presente asunto, se ha acusado nuevamente desobediencia a lo ordenado por la Sala en el voto No. 2022010631 de las 9:40 horas del 13 de mayo de 2022.

Respecto a ello, cabe recordar que esta sentencia se les ordenó a los recurridos (ICAA) realizar estrictamente lo siguiente en el plazo de dos meses: “definir lo que corresponda respecto a la prestación del servicio potable en la comunidad señalada por el recurrente”. Asimismo, se dispuso que, en caso de acordarse la realización de alguna actuación tocante a esta materia, se establecieran -dentro de ese mismo plazo-, “las respectivas etapas, cronogramas y responsabilidades”.

Ahora bien, revisados los informes rendidos bajo juramento, consta que las autoridades recurridas del ICAA ya determinaron lo correspondiente a la prestación del servicio de agua potable en la comunidad alegada por el recurrente. En ese particular se ha informado que se estableció una propuesta técnica definitiva para el abastecimiento de agua potable en la comunidad de El Jardín. Expresamente se dijo que: “(…) La propuesta técnica establece el abastecimiento de agua potable para las comunidades de La Escuadra y El Jardín, mediante la instalación de tubería de distribución necesaria a partir del acueducto de la ASADA de Conte de Pavón, y tomando como referencia la tubería donada por la Municipalidad de Golfito y el AyA mediante el Programa de Comunidades en Riesgo Sanitario (PCRS) (…)”. De esta manera, este extremo se tiene por cumplido.

Respecto a la segunda parte de la orden girada, la Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, en diciembre de 2024, informó a esta Sala Constitucional, bajo la solemnidad de juramento, lo siguiente:

“(…) 2.- Respecto a las etapas cronogramas y responsabilidades, es importante aclarar que este proyecto inicialmente fue una iniciativa de la ASADA de Conte con la Municipalidad de Golfito, que posteriormente fue incorporada la participación del AYA en acatamiento a lo dispuesto en la citada resolución (No. 2022010631). Así las cosas, no existió un cronograma inicial y debidamente planificado con las etapas y responsables del proyecto, sino que el AyA llegó a cubrir aquellas carencias que habían permitido la ejecución del mismo, asumiendo en este caso la Dirección Técnica y aportando parte de la tubería que se requería para cubrir la totalidad de la zona, ya que otra parte había sido aportada por la Municipalidad de Golfito.

Ahora, en este caso es importante señalar que para finiquitar las obras de instalación de tubería y poder avanzar con la celeridad deseada se requiere que el AyA traslade maquinaria (Back Hoe) para la apertura de zanja. De momento existe un avance de tubería colocada de 3500 metros de tubería, quedando pendiente la colocación de 1700 metros, que se tuvo que suspender por las condiciones climáticas de la zona, esta instalación se programó continuar a partir de la semana del 02 de diciembre del 2024, con la meta de concluir este proyecto durante el primer semestre del año 2025. Sin embargo, al tenor de las condiciones meteorológicas que hay en el país, el ingreso de maquinaria no fue materialmente posible y por ende los trabajos para continuar con la instalación de tubería debieron suspenderse. Así las cosas y con la esperanza que en las próximas semanas mejoren las condiciones climáticas, se tiene proyectado el ingreso de la maquinaria (Back Hoe) para la segunda semana del mes de enero de 2025. Estas fechas están sujetas siempre a las condiciones meteorológicas pues es evidente que el cierre actual de período no ha presentado las mejores condiciones para el desarrollo de proyectos. Dado lo anterior y siendo conservador, considerando que en la instalación de la tubería se logra avance diario en promedio de 80 tubos, se estaría concluyendo el proyecto en término de una semana, es decir, la tercera semana de enero del 2025 (…)”.

Por su parte, el pasado 16 de mayo de 2025, esa misma autoridad (luego de consultársele sobre la culminación de las obras de colocación de tubería en el trayecto de 1700 metros pendiente), señaló lo siguiente:

“En repuesta a punto a) Las obras de colocación de los 1700 metros de tubería de 100mm aún se encuentran pendientes de instalar. En respuesta al punto b)Respecto a las razones de dicho pendiente, según lo solicitado por la Sala Constitucional, se indican las siguientes, de conformidad con la información recabada:

1. No se ha concluido la instalación a circunstancias relacionadas con la logística de la maquinaria o back hoe necesaria para realizar la zanja y su posterior relleno para la instalación de la tubería, la cual no ha estado disponible.

2. Se han llevado a cabo gestiones con la Municipalidad de Golfito, la cual ha colaborado significativamente aportando su back hoe a lo largo del tiempo de ejecución del proyecto.

3. Internamente, se realizaron gestiones para aprovechar una retroexcavadora institucional, sin embargo, se presentaron problemas técnicos con la maquinaria y posteriormente con su transporte, por lo que se sigue a la espera de la reparación”.

De este modo, se puede apreciar que, si bien el ICAA no elaboró etapas, cronogramas y responsabilidades en los términos estrictamente señalados, eso se debió, como se dijo, a las circunstancias propias del proyecto en cuestión, es decir, debido a que este último fue, en realidad, una iniciativa original de la ASADA de Conte y de la Municipalidad de Golfito, a la que posteriormente se unió el instituto recurrido. Proyecto en el cual, a su vez, ha participado y colaborado el ICAA con la dirección técnica y con el aporte de parte de la tubería que faltaba, al punto que, en este momento, solo falta de instalarse 1700 metros de esta última para alcanzar el objetivo y pretensión principal apuntada por la parte recurrente.

Así las cosas, esta Sala aprecia que las dos concretas y precisas órdenes giradas en el Voto No. 2022010631, se han cumplido. Por ende, no podría tenerse por incumplido lo ahí dispuesto.

III.- Ahora bien, dicho lo anterior, también observa la Sala, según el último informe rendido por las autoridades recurridas, que, a la fecha, no ha sido posible aún instalar la tubería faltante. Sin embargo, al no haber sido esta una orden expresa girada por este Tribunal en su momento, lo que corresponde es señalares a los recurridos que es su deber coordinar y realizar todas las gestiones pertinentes, en aras de instalar dicha tubería y, consecuentemente, finiquitar el proyecto bajo estudio lo más pronto posible.

IV.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

No ha lugar a la gestión. Tomen nota las autoridades recurridas del Instituto Costarricense de Acueductos y Alcantarillados de lo dispuesto en el considerando III de la presente resolución. Notifíquese.- Fernando Castillo V.
