**File:** 25-013158-0007-CO **Res. No. 2025016396** **CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE.** San José, at nine twenty hours on the thirtieth of May two thousand twenty-five.

An amparo petition processed in file no. 25-013158-0007-CO, filed by Nombre01, identity card CED02, against the MUNICIPALITY OF SANTA CRUZ.

**Whereas:** **1.-** By brief added to the digital file on 12 May 2025, the petitioner, who claims to be a resident of Dirección01 in Santa Cruz, files an amparo petition against the Municipality. He states: “First: Since mid-2024, the Municipality has been maintaining a sewer system road repair on Dirección02 from 27th Street to Dirección03, specifically at Dirección01. Second: From the start, the company in charge removed asphalt to proceed with the works. Third: This removal of asphalt led to the street being left as ballast, and obstructing the drainage channels (caños) with earth. Fourth: This obstruction of drainage channels leaves stagnant water along the entire stretch of that avenue, giving off bad odors since wastewater from the houses falls directly into the drainage channels. Fifth: The streets being in ballast generate dust along the entire stretch that causes lung diseases and allergies to the affected population, this being a main road (sic), where vehicles, trucks, buses, and pedestrians transit. SIXTH: In official letter DAM-DGA-SUA-127-2024, dated 1 April 2025, addressed to Mr. Ing. Didier Monge Jiménez, coordinator of the UTGVM of the Municipality of Santa Cruz, it refers to the transfer to UTGVM of a request for clearing out (destaque) the curb and drainage channel, regarding the works in the Barrio Panamá sector. The official letter is attached. SEVENTH (sic): This project runs from the Dirección04 bridge to Dirección05, central Santa Cruz. EIGHTH: On Thursday, 27 March 2025, Mr. Randal Hernández Jaén conducted an inspection where he verified several sectors in the community of Barrio Panamá with the curb and drainage channel obstructed, with the material of earth and ballast due to the earthworks (movimientos de tierras) carried out by the machinery. NINTH: Due to the foregoing, a formal request is submitted to the Unidad Técnica de Gestión Vial Municipal, for it to remove or clear out the curb and drainage channel of the sectors obstructed with material. TENTH: He states that the sanitation and Roads officials cannot expose themselves to risk due to occupational health reasons. And especially due to the restricted access at the construction work site. ELEVENTH: With the first rains, it has been seen that the streets flood easily and that the sewer system project does not fulfill the corresponding function, photos are attached. PETITION: 1. That the amparo petition against the Municipality of Santa Cruz be granted. 2. That there be a prompt repair of the mentioned streets. 3. That they be ordered to pay damages and losses”.

**2.-** By resolution at 13:02 hours on 13 May 2025, the Presidency of the Chamber admitted the proceedings. It also requested a report from the mayor, president of the Municipal Council, and head of the Unidad Técnica de Gestión Vial, all from the Municipality of Santa Cruz, on the following facts: “In mid-2024, the Municipality of San Cruz is carrying out works for the sewer system road repair on Dirección02, from Dirección06 to Dirección03, in Dirección01 in Santa Cruz. It points out that as part of the works, the contracted company proceeded to remove the asphalt layer, so the road was left in ballast and caused an obstruction in the drainage channels with earth. It comments that this causes water to stagnate along the entire stretch of the avenue, which generates bad odors, because the wastewater from residential houses falls into the drainage channels. It notes that the street being in ballast generates a large amount of dust that causes lung diseases and allergies among the neighbors, because a lot of dust is raised due to the transit of vehicles, trucks, buses, and pedestrians through the site. It mentions that on 27 March 2025, the official Randal Hernández Jáen inspected several sectors of the community of Barrio Panamá, who confirmed that the curb (cordón) and the drainage channel (caño) are obstructed with earth and ballast material due to the earthworks that were carried out for the works in the area. Given this situation, he requested the Unidad Técnica de Gestión Vial of the respondent municipal entity to proceed with the cleaning and removal of materials from the drainage channels. By official letter DAM-DGA-SUA-127-20024 of 1 April 2024, signed by the coordinator of Servicios Urbanos Ambientales, Dirección de Gestión Ambiental of the Municipality of Santa Cruz, and sent to the coordinator of the Unidad Técnica de Gestión Vial of that municipality, through which said Technical Unit was requested to remove or clear out (destaque) the curb and drainage channels of the sectors obstructed with material in Barrio Panamá (see evidence associated with the file). This, because the Sanitation and Roads officials cannot expose themselves to a risk due to occupational health reasons, especially considering that the site is a construction site. He states that due to the first rains, the streets have easily flooded and the sewer system project is not fulfilling its specific function. He considers that the described facts violate his fundamental rights”.

**3.-** By brief added to the digital file on 20 May 2025, Didier Antonio Monge Jiménez, coordinator of the Departamento de Gestión Vial of the Municipality of Santa Cruz, renders a report under oath, in the following terms: "1. Road repair based on sewer system on Dirección02, from Dirección06 to Dirección03 Since mid-2024 the Municipality has maintained a sewer system road repair on Dirección02 from 27th Street to 3rd Street, specifically in Barrio Panamá. It is correct that the Municipality of Santa Cruz has been executing since mid-2024 a project for the construction of a storm and sanitary sewer system on Dirección02, as part of a larger urban infrastructure improvement project. This project has technical design, financing, and planning in accordance with regulations. The (sic) Departamento de Gestión Vial is carrying out improvement works in Dirección01, through the modality of a contract by demand. The first stage (phases 1, 2, 3) of the project included the installation of the sewer system for the evacuation of stormwater. During the fourth and final phase, the construction of the remaining urban infrastructure such as sidewalks (aceras), pavement structure and road surface (carpeta de rodamiento), curb and drainage channel (cordón y caño) is contemplated. 2. Removal of asphalt From the start, the company in charge removed asphalt to proceed with the works. As indicated above, the project is executed in stages. The first stage included the installation of the storm sewer system, which required the removal of the existing asphalt layer where needed. The asphalt removal was necessary and planned as part of the construction phase. This technical procedure is carried out to replace the existing structures and facilitate the placement of the sewer pipe. • Currently, an asphalt seal exists on half the length where the road surface was completely removed. • In the second half, only the part where the storm pipe was located was excavated, which covers approximately one-third of the roadway width, the rest is still under the asphalt road surface. 3. Street in a state of ballast This removal of asphalt led to the street being left as ballast, and obstructing the drainage channels with earth During the earthworks stage, granular material was used as a provisional surface, which is common in works of this type. The partial obstruction of some drainage channels was identified and documented in official letter DAM-DGA-SUA-127-2024, issued by the Departamento de Gestión Vial, which includes photographic documentation of its state as of 01 April 2025. This situation is (sic) being addressed since 08 May. The removal of the asphalt was necessary to carry out the stormwater evacuation works, therefore, temporarily the street was left in granular material. It is clarified that the project contemplates the replacement of the asphalt road surface in its final phase. Additionally, it is important to point out that the current flooding is partly due to the fact that, at the express request of the neighbors, vehicular accesses were built in ballast in front of each property, which has caused water retention by partially obstructing the natural path where the curbs and drainage channels, still under construction and to be located in the future, are located. This situation is temporary and will be corrected with the final coupling of the storm drainage system. 4. Obstruction of drainage channels and stagnant water This obstruction of drainage channels leaves stagnant water along the entire stretch of that avenue, generating bad odors since the wastewater from the houses falls directly into the drainage channels. It is important to point out that the current flooding is partly due to the fact that, at the express request of the neighbors, vehicular accesses were built in ballast in front of each property, which has caused water retention by partially obstructing the natural path through the curbs and drainage channels still under construction. This situation is temporary and will be corrected with the definitive formation of the drainage system. As a contingency, this department has already included the cleaning of catch basins (tragantes) in its work schedule. At the same time, the corresponding signage has been placed by the company in charge of this phase, because the construction of the curb and drainage channel and sidewalks is still in process. However, these efforts must be monitored since provisional devices are used, which are removed by passers-by. On the other hand, it is indicated that wastewater discharges to the road (via) (sic) have been found, which, under current legislation, this practice is not permitted, for which coordination will be made with the (sic) Ministerio de Salud (sic) so they can make the respective notifications. 5. Street in ballast during the summer The streets being in ballast generate dust that causes lung diseases and allergies among the affected population... During the dry season, being in the construction phase, it was not possible to make additional improvements. However, in January a temporary improvement was made to mitigate dust, which is maintained to date. It is indicated that currently there is an asphalt seal (sic) on half the length, and in the second half, only the part where the storm pipe was located was excavated, which makes up approximately one-third of the roadway width, the rest is still under the asphalt road surface. It should be noted that during the current rainy season and the completion (sic) of the construction, the presence of dust will be absent. 6. Official letter DAM-DGA-SUA-127-2024 In official letter DAM-DGA-SUA-127-2024... reference is made to the transfer to UTGVM of a request for clearing out the curb and drainage channel... This department received said official letter by email on 30 April 2025. It is reported that the request was included in the maintenance crew's schedule, in accordance with the programming carried out in response to the number of requests received from both the administration and the taxpayers. However, due to the number of activities scheduled by the municipal crew, since 08 May, the environment department has collaborated in the cleaning of drainage channels and catch basins, which, according to a field inspection, have been obstructed (sic) by garbage carried by stormwater runoff from the southern and western sector of downtown Santa Cruz during the initial downpours of the rainy season, which were of greater intensity. As a contingency, it is confirmed that this intervention was (sic) included as an additional task in case it was needed emergently, by the maintenance crew of the Departamento de Gestión Vial. 7. Scope of the project The project runs from the Río En Medio bridge to Almacén El Colono... The scope of the project is confirmed, which covers a broad stretch including the indicated sector. Its purpose is to improve the drainage infrastructure and clean up the entire area's stormwater system. The project covers the entire length of Barrio Panamá and includes stormwater evacuation, construction of curb and drainage channel, sidewalks, and the replacement of the asphalt road surface. 8. Inspection to verify obstruction in curb and drainage channel. On 27 March 2025, Randal Hernández Jaén inspects the site and verifies obstructions in the curb and drainage channel... Based on official letter DAM-DGA-SUA-127-2024, issued by the Departamento de Gestión Vial, the mentioned obstructions are observed, accompanied by photographic documentation of the current state of the drainage channels in the sector. Said inspection was key to adopting corrective measures. As a result, and jointly with the Environment Department, the cleaning of the sector began on 08 May 2025, taking advantage of the construction pause between the third and fourth phase. During this period, there was no machinery or occupational health risks for the workers. 9. Request to the Departamento de Gestión Vial (UNIDAD TECNICA) (sic) A formal request is submitted for the removal of obstructions... There is no request from the petitioner dated after the report from the environmental management department, except the one included in the same report. Faced with this situation, with the collaboration of an environment crew, the corresponding cleaning is currently being carried out since 08 May, taking advantage of the interface between the third and fourth phase of the project. (in this period, there is no machinery present or restricted access that causes risk to the collaborators). However, on the part of the department (sic), additional inclusion was made in the work schedule to address the situation at the moment it is required. 10. Impossibility of cleaning by (sic) municipal officials. He states that the Sanitation and Roads officials cannot expose themselves to risk due to occupational health reasons. And especially due to the restricted access at the construction work site. During the critical phase of the work, access was restricted for safety, which is justified in this type of project. However, as indicated, starting 08 May, the cleaning work has been carried out without restrictions or occupational risk, since the work progress allows it. 11. Sewer system project does not fulfill its function With the first rains, the streets flood and the project does not fulfill its function. The project has not yet finished. The construction of curbs, drainage channels, and the connection to catch basins is still pending. The first rains carried garbage that obstructed the intake points under construction. However, this was discussed at a community meeting on 07 May 2025, where the situation was explained and the community expressed support for the project. Paradoxically (sic), the flooded sector was the sector that is at a higher level compared to the end of the project, and the lowest sector did not flood, showing that even without being fully completed, the sewer system is fulfilling its purpose. Therefore, it is respectfully requested: 1.- That the amparo petition filed by Mr. Nombre01 be declared without merit. 2.- That it be demonstrated that the Municipality of Santa Cruz has acted in accordance with legality, with adequate technical measures and diligent attention to the needs of the project and the community. 3.- That it be recognized that the indicated impacts are a normal and temporary consequence of the development of a public sanitation project, whose ultimate purpose is the comprehensive improvement of the urban and sanitary environment of Barrio Panamá. 4.- That the duty of institutional attention and response to the petitioner's and the community's dealings in general be considered satisfied. With the above exposed, the intent is to report the actions taken by this department representing the municipal administration, summarized as: • The Municipality acts in accordance with its established constitutional and legal powers. • The works in question are supported by technical studies and have professional supervision. • The inconveniences caused in the sector of Dirección01 are inherent to the construction process of the Road Infrastructure and Stormwater Network Improvement Project for the sector of Barrio Panamá, in the Canton of Santa Cruz. Additionally, attached to this official letter are an inspection report and a report on cleaning activities with the corresponding photographic support of the state of the built catch basins, their cleaning, and the state of the road surface of the sector. That is all”.

**4.-** By brief added to the digital file on 20 May 2025, Jorge Arturo Alfaro Orias, mayor of Santa Cruz, renders a report under oath, in the following terms: "FACT ONE: Indeed, the Municipality of Santa Cruz, in the 2024 period, initiated the project for the construction of the storm and sanitary sewer system on Avenida O, specifically, in the sector of Barrio Panamá, this, as part of a larger urban infrastructure improvement project corresponding to National Public Tender No. 2021LN-000002-0021000001, called 'Contracting of delivery according to demand for public works, maintenance, and road improvement in Santa Cruz', a tender that was awarded to Constructora Herrera S.A. The respective project was structured into four execution phases. To date, the first three phases are practically finished, leaving only the fourth and final phase, which is in the process of execution. During its development, at the end of the third phase and the beginning of the fourth phase, the project experienced a temporary stoppage because the awarded company did not have its municipal business license (patente comercial municipal) up to date, which prevented managing the necessary purchase order to continue with the work; as a result, the Administration carried out due process and warned the contractor so that it would comply with the submission of the respective requirement and the payment of municipal taxes. As a temporary measure, the current order for sidewalk construction in the district of Santa Cruz was used, which allowed attending to some work while the contractor's non-compliance was resolved. Currently, the contractor company has regularized its legal situation and is up to date with the municipal business license; therefore, from a technical and administrative point of view, the project can resume in the short term once the approval procedures for the corresponding request order and purchase order are finalized, thus continuing with the execution of the pending phase under normal conditions. As mentioned above, the project is scheduled to be executed in stages, the first of them, phases 1, 2, 3, in which the installation of the sewer system for stormwater evacuation was contemplated. During the fourth and final phase, the construction of urban infrastructure such as sidewalks, pavement structure and road surface, curb and drainage channel is contemplated. A project that has technical design, financing, and planning in accordance with current regulations governing the matter; however, it is reiterated that due to non-compliance by the contractor, the project is suspended, specifically, the contractor failed to process the obtainment of the business license and the payment of the respective tax before the Municipality of Santa Cruz. It should be mentioned that the contractor has already obtained the business license and paid the municipal taxes for the license, consequently, it came into compliance and fulfilled what was required by the Administration; by reason of the contractor's compliance, the contract administrator will be able to issue a start order so that the contractor continues carrying out the works, in accordance with the General Law on Public Procurement and its Regulations. It is important to indicate that prior to the start of the aforementioned project, the Municipality, through licensed Melissa Ramírez Ríos in her capacity as Social Promoter of the UTGVM, carried out the socialization process with the neighbors inhabiting the properties located on the stretch where the project is developed, which can be verified in official letter number DDUR-UTGVM-PS-040-2024 and the minutes of the attached records. During the socialization process with the neighbors of Dirección01, the scope of the project was explained to them, what it consists of, the activities to be carried out, the estimated execution times and delay times, the total value of the work, they were given the floor, the engineers in charge issued recommendations, emphasis was placed on the type of work and the possible impacts generated, the containment measures, the working partnerships with the different institutions that provide essential services and are located in part of the public road were also explained to them, such as: AyA, Coopeguanacaste R.L, ICE, cable companies, and others. Also, during the project execution, several follow-up meetings were held to keep people informed, allowing the collection of opinions, needs, and suggestions that ensure the real situations they live day by day; likewise, follow-up is given to the problems raised, for example: 1. Difficulties accessing residential houses. 2. Impact on basic services. 3. Health problems. 4. Obstacles on the road. 5. Difficulty for school transport or ambulances, firefighters (coordination is carried out) and thus avoid them having difficulties to transit freely in case of an emergency. Since the project began, the Administration has held working groups and meetings with the neighbors of Barrio Panamá on the following dates: • 15 October 2024 • 28 March 2024 • 01 August 2024 • 21 March 2024 • 10 March 2025 FACT TWO: As indicated in the previous fact, the project is scheduled to be executed in stages; the first stage included the installation of the storm sewer system; therefore, the removal of the existing asphalt layer in the sectors where it was required was necessary. The asphalt removal was necessary and planned as part of the construction phase; this technical procedure was carried out to replace the existing structures and facilitate the placement of the sewer pipe. Currently, there is an asphalt seal on half the length where the road surface was completely removed; in the second half, only the part where the storm pipe was located was excavated, which covers approximately one-third of the roadway width; the remaining part is still under the asphalt road surface. FACT THREE: As part of the already mentioned project, during the earthworks stage, granular material was used as a provisional surface, which is common in works of this type. The removal of the asphalt was necessary to carry out the stormwater evacuation works, so, temporarily, the street was left in granular material. It should be clarified that the project contemplates the replacement of the asphalt road surface in its final phase. Now, regarding the obstruction of the curb and drainage channel, it is important to point out that the current flooding is partly due to the fact that, at the express request of the neighbors, vehicular accesses were built in ballast in front of each of the properties, which has caused water retention by partially obstructing the natural path where the curbs and drainage channels, still under construction and to be located in the future, are located; a situation that is temporary and will be corrected with the final coupling of the storm drainage system in the project's final stage. According to report number DDUR-DGV-COORD-0280-2025 signed by engineer Didier Antonio Monge Jiménez, coordinator of the UTGVM, on 16 May 2025, he conducted a field inspection in the sector of Dirección01, specifically, where the road improvement and storm drainage works are being carried out, and it was verified that the curb and drainage channel and the catch basins were clean. In the same way, engineer Diana Carolina Vallejos Noguera, in her capacity as coordinator of Servicios Urbanos Ambientales, reported through official letter number DAM-DGA-SUA-199-2025 that the road cleaning crew continues carrying out the cleaning work of the curb and drainage channel in the sector of Dirección01, and that the cleaning work in that sector is carried out 1 to 2 times per week, and these tasks have even been extended to the afternoon hours if the weather allows. Therefore, it is demonstrated that the situation alleged in this fact has already been duly addressed by the road cleaning service crew of the Dirección de Gestión Ambiental. FACT FOUR: As stated in the previous fact, a large part of the flooding was generated because, at the express request of the neighbors, vehicular accesses were built in ballast in front of each of the properties, which has caused water retention by partially obstructing the natural path through the curbs and drainage channels still under construction; a situation that is temporary and will be definitively corrected when the fourth stage of the project begins with the definitive formation of the drainage system. To mitigate this problem, the UTGVM included the cleaning of catch basins within the work schedule; likewise, the company in charge of the works placed the corresponding signage because the construction of the curb and drainage channel and sidewalks is still in process. On the other hand, it is indicated that wastewater discharges to the road have been found, which, according to the legal system governing the matter under study, is not a permitted practice; given that, by reason of subject matter, the attention to this problem falls under the jurisdiction of the Ministry of Health, the Administration will proceed to refer the case to the Ministry of Health so they can carry out the respective interventions and notifications. FACT FIVE: Regarding this particular matter, the petitioner did not identify the person or persons who, apparently, have had health problems caused by dust particles; nor did he provide the medical opinion through which the specialist doctor would certify that exposure to dust has been the cause of the pulmonary problems and allergies of the patient or patients. Let us remember that the project consists of phases and/or stages; during the dry season, while in the construction phase, it was not feasible to make additional improvements; however, in January a temporary improvement was made to mitigate dust, which is maintained to date. Currently, there is an asphalt seal on half the length, and in the second half, only the part where the storm pipe was located was excavated, which makes up approximately one-third of the roadway width; the rest is still under the asphalt road surface. FACT SIX: Certainly, through official letter number DAM-DGA-SUA-127-2024, engineer Diana Carolina Vallejos Noguera, coordinator of Servicios Urbanos Ambientales, informed engineer Didier Antonio Monge Jiménez of the obstruction situation of the curb and drainage channel located on Avenida O, at Dirección07; given this situation, the UTGVM requested the Dirección de Gestión Ambiental's collaboration to carry out the cleaning work of the curb and drainage channel and catch basins in the indicated sector. From the field inspection carried out by engineer Monge Jiménez, it was determined that the referred obstruction has been caused by the amount of garbage carried by stormwater runoff from the South and West sector coming from downtown Santa Cruz, as a result of the current rainy season. Now, as a measure to mitigate this problem, the UTGVM requested collaboration from the Dirección de Gestión Ambiental so that the road cleaning crew would clean the curb and drainage channel and the catch basins, cleaning work that the crew has effectively carried out. In the same way, the Gestión Vial maintenance crew, once the order to restart the works in question is given, will carry out the respective cleaning work. FACT SEVEN: It is correct, the project in question covers the stretch running from the Río En medio bridge to Almacén El Colono, a project whose purpose is to improve the drainage infrastructure and clean up the entire area's stormwater system. The project covers the entire length of Barrio Panamá and includes stormwater evacuation, construction of curb and drainage channel, sidewalks, and the replacement of the asphalt road surface.

FINDING EIGHT: based on the information provided in official communication DAM-DGA-SUA-1272024, engineer Didier Monge Jiménez on May 16, 2025, conducted a field inspection at the site of the events with the purpose of verifying and taking the pertinent corrective measures; from the field visit it was concluded that both the storm drains (tragantes) and the curb and gutter (cordón y caño) in the Barrio Panamá sector are clean, this, because jointly with the Dirección de Gestión Ambiental, cleaning work began on May 8, 2025. FINDING NINE: In accordance with what was stated in official communication number DT-0612025 signed by engineer Oscar (sic) Danilo González Mora in his capacity as Tax Director (Director Tributario), from the review conducted within the records of the municipal tax system DECSIS, and in the official institutional email ...01, there is no record that Mr. Nombre01, identification number CED01, has submitted any request directed to the Unidad Técnica de Gestión Vial Municipal during the periods 2024 — 2025. FINDING TEN: In this regard, from the inspection conducted by engineer Monge Jiménez on May 16, 2025, it was determined that there is no machinery or risk factors that could affect the physical integrity of the officials of the road cleaning crew (cuadrilla de limpieza de vías) of the Dirección de Gestión Ambiental. FINDING ELEVEN: As explained in finding one, the project was planned to be carried out in stages, with the construction of curbs, gutters (caños), and the connection to storm drains (tragantes) pending; therefore, the project has not yet been completed, therefore, the same, among other things, aims to eradicate flooding problems. The first rains dragged garbage and debris that obstructed the catchment points under construction; however, this situation is being addressed by the road cleaning crew, who, 1 to 2 times per week, appear at the site to clean the storm drains (tragantes) and curb and gutter (cordón y caño), and even perform two shifts, in the morning and in the afternoon, conditional on weather conditions permitting. In addition to the above, on May 7, 2025, the Administration held a working group meeting (mesa de trabajo) with the residents of the Dirección01 sector, specifically, those who live on properties located in the section where the project in question is being developed; a meeting in which the following officials participated on behalf of the Municipality: Mitzy Salazar Morales, Municipal Vice Mayor, Maureen Contreras Arrieta, Municipal Council Member, Didier Monge Jiménez, coordinator of the UTGVM, and the undersigned, Jorge Arturo Alfaro Orias, Municipal Mayor. The working group meeting was held for the purpose of explaining the situation and addressing the following topics: 1. Impact on the main street. 2. Width of the right-of-way. 3. Flooding problems. 4. Waste collection. 5. Construction of sidewalks (aceras). 6. Lack of supervision. 7. Start of the next phase. 8. Wastewater 9. Administrative delays. It is worth mentioning that the residents who attended the meeting expressed support and backing for the project. (See the minutes of the working group meeting of May 7, 2025). As was demonstrated in the attached technical reports, the project has not yet been completed and the execution of the last stage is pending; therefore, the Administration plans to issue the order to restart the works once the due process is concluded and it is verified that the contractor has complied with the payment of the business license tax (patente comercial), all in compliance with the provisions of the Ley General de la Administración Pública, Ley General de Contratación Pública and its Reglamento. Regarding the cleaning of the storm drains (tragantes), curb and gutter (cordón y caño), the road cleaning crew of the Dirección de Gestión Ambiental performs cleaning weekly, 1 to 2 times, and they have even been willing to redouble efforts and perform cleaning in double shifts, in the morning and in the afternoon. Based on the foregoing and it being demonstrated that the Administration addressed the situation alleged by the appellant, and commits to continuing to effectively provide the road cleaning service, I respectfully request that the Recurso de Amparo filed against my represented party be declared without merit (…)".

5.- By certification of May 22, 2025, the acting secretary and judicial technician 3 who processes the file, both positions of the Chamber, made known: "reviewed, at eleven hours and six minutes on May twenty-second, two thousand twenty-five, in the Costa Rican judicial office management system, the control of documents received and this file, it did not appear that from 05/16/2025 to 05/20/2025, the PRESIDENT OF THE MUNICIPAL COUNCIL OF THE MUNICIPALITY OF SANTA CRUZ filed any writing or document, in order to render the report requested in the resolution issued at thirteen hours and two minutes on May thirteenth, two thousand twenty-five".

6.- In the proceedings followed, the legal requirements have been observed.

Drafted by Magistrate Garita Navarro; and,

Considering:

I.- PRELIMINARY ISSUE. Given that the president of the Municipal Council of Santa Cruz failed to respond to the hearing within the deadline set by this Court in the resolution processing the sub lite, the appeal is resolved in accordance with article 45 of the Ley de la Jurisdicción Constitucional and taking into consideration the evidentiary elements contained in the record.

II.- PURPOSE OF THE APPEAL. The appellant, who claims to be a resident of Dirección01 of Santa Cruz, files a recurso de amparo against the Municipality. He states that, since mid-2024, the Municipality of Santa Cruz "is maintaining a sewerage road project on Dirección02 from 27th Street to Dirección03, specifically in Dirección01". He mentions that the company in charge removed the asphalt to proceed with the works, so the street was left as ballast (lastre) and "obstructing the gutters (caños) with earth". He asserts that the obstruction of gutters leaves stagnant water along the avenue's path, which emanates bad odors, since the "wastewater from the houses falls directly into the gutters". He maintains that the ballast streets generate dust that causes lung diseases and allergies to the affected population, because the road is traveled by trucks, buses, and pedestrians. He argues that the coordinator of UTGVM of the Municipality of Santa Cruz, through official communication DAM-DGA-SUA-127-2024, of April 1, 2025, referred to the transfer to the UTGVM of the request to clean curb and gutter (cordón y caño) in Barrio Panamá. He adds that the project extends from "Dirección08 to Dirección05, Santa Cruz center". He relates that on March 27, 2025, server Randal Hernández Jaén, on the occasion of an inspection, verified several sectors "in the community of Dirección01" with the curb and gutter (cordón y caño) obstructed by "earth and ballast material due to the earthworks (movimientos de tierras) carried out with the machinery". He notes that, due to the above, a "formal request is submitted to the Unidad Técnica de Gestión Vial Municipal, to remove or unblock curb and gutter (cordón y caño) from the sectors obstructed with material". He explains that with the first rains it has been seen that the streets flood and that the sewerage project does not fulfill its function. He asks that "there be a prompt repair of the mentioned streets".

III.- PROVEN FACTS. Of importance for the decision of this matter, the following facts are deemed duly proven:

a. Since mid-2024, the Municipality of Santa Cruz has been executing a stormwater and sanitary sewer construction project on Dirección02, as part of a larger urban infrastructure improvement project. The first stage (phase 1,2,3) of the project included the installation of the sewer system for the evacuation of stormwater. The fourth and final phase includes the construction of the remaining urban infrastructure such as sidewalks (aceras), pavement structure and wearing course (carpeta de rodamiento), curb and gutter (cordón y caño). (Report from the coordinator of the Departamento de Gestión Vial of the Municipality of Santa Cruz).

b. The works in the Dirección01 sector are part of the larger urban infrastructure improvement project corresponding to public tender No. 2021LN-000002-0021000001 called "Contracting of delivery according to demand for public works, maintenance and road improvement in Santa Cruz", which was awarded to Constructora Herrera S.A. (Report from the mayor of Santa Cruz).

c. The coordinator of Servicios Urbanos Ambientales of the Dirección de Gestión Ambiental of the Municipality of Santa Cruz, through official communication DAM-DGA-SUA-127-2024 (sic) of April 1, 2025 addressed to the coordinator of the UTGVM of that local government, indicated: "Receive a cordial greeting. The Unidad Técnica de Gestión Vial has been carrying out works on the street of Dirección01, the project that goes from the bridge of Rio En medio to Almacenes El Colono S.A. Santa Cruz center. (...) Mr. Randal Hernández Jaén reports that he conducted an inspection on Thursday, March 27, 2025, where he verifies several sectors in the Barrio Panamá community with the curb and gutter (cordón y caño) obstructed, with earth or ballast material due to the earthworks (movimientos de tierra) carried out with the machinery. (...) Due to the above, a formal request is submitted to the Unidad Técnica de Gestión Vial Municipal, to remove or unblock curb and gutter (cordón y caño) from the sectors obstructed with material, the sanitation and road officials cannot be exposed to risk due to occupational health issues and especially due to restricted access at the construction site, we must monitor their physical integrity and especially their health". (Evidence provided by the appellant).

d. The coordinator of the Departamento de Gestión Vial of the Municipality of Santa Cruz, in the report dated May 16, 2025 (official communication DDUR-DGV-COORD-0280-2025), stated: "The first stage included the installation of the storm sewer, which required the removal of the existing asphalt layer where needed. The removal of asphalt was necessary and planned as part of the construction phase. This technical procedure is carried out to replace the existing structures and facilitate the placement of the sewer pipe. (...) • currently there is an asphalt seal (sello asfaltico) on half of the length where the wearing course was completely removed. • in the second half, only the part where the storm pipe was located was excavated, which covers approximately one third of the width of the roadway, the rest is still on asphalt pavement (carpeta asfáltica). (...) During the earthworks (movimiento de tierras) stage, granular material was used as a provisional surface, which is common in works of this type. The partial obstruction of some gutters was identified and documented in official communication DAM-DGA-SUA-127-2024, issued by the Departamento de Gestión Vial, which includes photographic documentation of their status as of April 1, 2025. This situation is () being addressed since May 8. The removal of asphalt was necessary to carry out the stormwater evacuation works; therefore, the street was temporarily covered with granular material. It is clarified that the project includes the replacement of the asphalt pavement (carpeta asfáltica) in its final phase. Additionally, it is important to note that the current ponding is partly due to the fact that, at the express request of the residents, vehicle accesses were built in ballast in front of each property, which has caused water damming by partially obstructing the natural passage where the curbs and gutters (caños), still under construction and to be installed in the future, are located. This situation is temporary and will be corrected with the final coupling of the storm drainage system. (...) As a contingency, this department has already included the cleaning of storm drains (tragantes) in its work schedule. At the same time, the corresponding signage has been placed by the company in charge of this phase, because the construction of the curb and gutter (cordón y caño) and sidewalks (aceras) is still in process. However, these measures must be monitored since provisional devices are used which are removed by passersby. Furthermore, it is indicated that wastewater discharge onto the road has been found, which, under current legislation, this practice is not permitted, for which coordination will be made with the Ministry of Health (ministerio de salud) (sic) to carry out the respective notifications. (...) During the dry season, being in the construction phase, it was not possible to make additional improvements. However, in the month of January, a temporary improvement was carried out to mitigate dust, which is maintained to date. It is indicated that currently there is an asphalt seal on half of the length and in the second half, only the part where the storm pipe was located was excavated, which makes up approximately one third of the width of the roadway; the rest is still on asphalt pavement (carpeta asfáltica). It is worth noting that during the current rainy season and the completion of the construction, the presence of dust will be absent. (...) In official communication DAM-DGA-SUA-127-2024... reference is made to the transfer to UTGVM of the request for unblocking curb and gutter (cordón y caño)... This department received said official communication by email on April 30, 2025. It is reported that the request was included in the schedule of the maintenance crew (cuadrilla de mantenimiento), in accordance with the programming carried out in response to the number of requests received from both the administration and the taxpayers. However, due to the number of activities scheduled by the municipal crew, since May 8, the environment department (departamento de ambiente) has collaborated in cleaning gutters (caños) and storm drains (tragantes), which, according to a field inspection, were obstructed by the garbage carried by the stormwater runoff from the southern and western sector of the center of Santa Cruz during the initial heavy rains of the rainy season that were of greater intensity. As a contingency, it is confirmed that this intervention was included as additional in case it was required on an emergency basis with the maintenance crew of the road management department (departamento de gestión vial). (...) Based on official communication DAM-DGA-SUA-127-2024, issued by the Departamento de Gestión Vial, the mentioned obstructions are observed and accompanied by photographic documentation of the current state of the gutters in the sector. Said inspection was key to adopting corrective measures. As a result of that, and jointly with the Department of Environment (Departamento de Ambiente), cleaning of the sector began on May 8, 2025, taking advantage of the construction pause between the third and fourth phase. During this period there was no machinery or occupational health risks for the workers". (Report from the coordinator of the Departamento de Gestión Vial of the Municipality of Santa Cruz).

e. The Departamento de Gestión Vial of the Municipality of Santa Cruz, in the annex to official communication DDUR-DGV-COORD-0280-2025 of May 16, 2025, recorded: "ANNEX Report CURRENT AS OF MAY 16, 2025 Inspection: Physical state of the road infrastructure improvement and storm drainage works sector, Barrio Panamá (...) Observations and Considerations: As of May 8, municipal crews began constant cleaning and monitoring to clean the catchment and drainage systems even without connection to the collector infrastructure (Curb and gutter [Cordones y caño])". (Evidence provided by the coordinator of the Departamento de Gestión Vial of the Municipality of Santa Cruz).

f. On May 16, 2025, engineer Didier Monge Jiménez conducted an inspection at the site, in which he concluded that "both the storm drains (tragantes) and the curb and gutter (cordón y caño) of the Barrio Panamá sector are clean, this, because jointly with the Dirección de Gestión Ambiental, cleaning work began on May 8, 2025". (Report from the mayor of Santa Cruz).

g. The tax director of the Municipality of Santa Cruz, in official communication DT-061-2025 of May 20, 2025, made known: "After consulting the official who currently holds the position of receptionist at the Service Platform (Plataforma de Servicios), I confirm that there are no records in the municipal tax system Decsis, nor in the official institutional email ...01, indicating that Mr. Nombre01, identification number CED01, has submitted any type of documentation addressed to the Unidad Técnica de Gestión Vial Municipal during the years 2024 or 2025". (Evidence provided by the mayor of Santa Cruz).

IV.- UNPROVEN FACT. Of importance for the resolution of this matter, it is deemed not proven that the road in the Dirección09 sector presents any condition that represents a manifest risk to the integrity of persons, or that it is impassable.

V.- ON THE SPECIFIC CASE. In the sub lite, the appellant, who claims to be a resident of Dirección09, files a recurso de amparo against the Municipality. He states that, since mid-2024, the Municipality of Santa Cruz "is maintaining a sewerage road project on Dirección02 from 27th Street to Dirección03, specifically in Barrio Panamá". He mentions that the company in charge removed the asphalt to proceed with the works, so the street was left as ballast (lastre) and "obstructing the gutters (caños) with earth". He asserts that the obstruction of gutters leaves stagnant water along the avenue's path, which emanates bad odors, since the "wastewater from the houses falls directly into the gutters". From the study of the record, it is proven that, since mid-2024, the Municipality of Santa Cruz has been executing a stormwater and sanitary sewer construction project on Dirección02, as part of a larger urban infrastructure improvement project. The first stage (phase 1,2,3) of the project included the installation of the sewer system for the evacuation of stormwater. The fourth and final phase includes the construction of the remaining urban infrastructure such as sidewalks (aceras), pavement structure and wearing course (carpeta de rodamiento), curb and gutter (cordón y caño). From this panorama, in the terms set forth in the filing brief, any situation that, at this moment, warrants the intervention of the Chamber is dismissed.

In this regard, the appellant neither set forth nor demonstrated that the condition of the road in the Dirección01 sector represents a manifest risk to the integrity of persons.

Now, with respect to the removal of the asphalt, the appellant neither alleged nor proved that the road was impassable. Furthermore, even though he mentioned that the street was left as ballast and generates dust that causes lung diseases and allergies to the affected population, it is no less true that in the filing brief he did not set forth any concrete impact on specific persons (accompanied by the respective evidence) that had also been previously alleged before the municipal authorities, so prima facie no omission susceptible of being declared is observed. Ergo, taking into consideration the particularities of the specific case, it is not for this jurisdiction to issue any order regarding the state of the road. In any case, it was not only reported that the removal of the asphalt layer is temporary, but that the part where it is absent (corresponding to half of the length) covers only one third of the roadway; indeed, it was indicated that the project includes the replacement of the asphalt pavement (carpeta asfáltica).

On the other hand, with respect to the obstruction of the gutters, there is no record in the file of any complaint of such situation to the municipality by the appellant, nor any derived situation that has caused any danger to the integrity of persons. Note that no reference was made to the dates of the floods nor to events derived from them that, due to their magnitude, generate any risk that makes the protection of the Right of the Constitution necessary in this jurisdiction. Rather, it is verified that the situation was noted by local government personnel on April 1, 2025, and that recourse was made to amparo on the following May 12, meaning an excessive period for addressing the situation had not elapsed. In fact, without prejudice to the foregoing, the respondent authorities stated that they had begun cleaning work on May 8 of this year and that on the 16th of that month the area was already clean.

Likewise, even though bad odors from stagnant water are alleged, no complaint of that situation before any competent authority is accredited.

In any event, in official communication dated May 16, 2025, the municipality stated that wastewater discharges were found on the road, and therefore coordination will be undertaken with the Ministry of Health. Hence, for the purposes of this proceeding, no omission by the municipal authorities is observed that could be declared in this proceeding.

Consequently, the appeal is declared without merit.

VI.- NOTE BY JUDGE SALAZAR ALVARADO. As a matter of principle, I consider that cases related to the action or inaction of the Public Administration regarding the repair, construction, modification, or demolition of any infrastructure work should be dismissed, because such omission constitutes a matter of legality, the discussion of which belongs to the ordinary jurisdiction, where the interested party can debate their disagreements more broadly. However, when that administrative conduct (whether by omission or not) results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do proceed to hear the merits of the matter, as this situation constitutes an exception to my position on this subject, as is the case here, where the appellant indicates that unfinished works by the Municipality of Santa Cruz cause problems of stagnant water with foul odors and, furthermore, dust that causes pulmonary diseases and allergies to the affected population.

VII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are warned that, if they have submitted any paper document or objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be withdrawn within a maximum period of 30 business days, counted from the notification of this judgment. It is warned that any material not collected within that period will be destroyed, based on the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (approved by the Corte Plena in article XXVI of session no. 27-11 of August 22, 2011, and published in Boletín Judicial no. 19 of January 26, 2012) and article LXXXI of the session of the Consejo Superior del Poder Judicial no. 43-12 of May 3, 2012.

Therefore:

Recurso de amparo que se tramita en el expediente nro. 25-013158-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra la MUNICIPALIDAD DE SANTA CRUZ.

Resultando:

1.- Por escrito incorporado al expediente digital el 12 de mayo de 2025, la parte accionante, quien dice ser vecino de Dirección01 de Santa Cruz, plantea recurso de amparo en contra de la Municipalidad. Manifiesta: “Primero: Desde mediados del año 2024 la Municipalidad mantiene un arreglo vial de alcantarillado en la Dirección02 desde calle 27 a Dirección03, específicamente en Dirección01. Segundo: Desde su inicio la empresa encargada realizo removimiento de asfalto para proceder con las obras. Tercero: Que tal removimiento de asfalto conllevo a que la calle quedara de lastre, y obstaculizando los caños con tierra. Cuarto: Esta obstaculización de caños deja aguas estancadas en todo el trayecto de dicha avenida, emanando malos olores ya que las aguas residuales de las casas caen directamente a los caños. Quinto: Que, al estar las calles de lastre, generan en todo el trayecto polvo que provoca enfermedades pulmonares y alergias a la población afectada, esto por motivo de ser una via (sic) principal, donde transitan vehículos, camiones, buses, y peatones. SEXTO: Que en oficio DAM-DGA-SUA-127-2024, del 1 de abril del 2025, al señor Ing. Didier Monge Jiménez, coordinador de UTGVM de la Municipalidad de Santa Cruz, hace referencia asunto traslado a UTGVM solicitud de destaque en cordón y caño, sobre los trabajos en sector Barrio Panamá. Se adjunta oficio. SEPTIMO (sic): Que dicho proyecto va desde el puente del Dirección04 hasta Dirección05, Santa Cruz centro. OCTAVO: Que el jueves 27 de marzo del 2025 el señor Randal Hernández Jaén realizo inspección donde verifica varios sectores en la comunidad de barrio Panamá con el cordón y caño obstruido, con el material de tierra y lastre debido a los movimientos de tierras realizados con la maquinaria. NOVENO: Que debido a lo anterior se presenta formal solicitud a la Unidad Técnica de Gestión Vial Municipal, para que retire o destaque cordón y caño de los sectores obstruidos con material. DECIMO: Manifiesta que los funcionarios de aseo y Vías no pueden exponerse ante riesgo por tema de salud ocupacional. Y en especial por el acceso restringido en el sitio de la obra en construcción. DECIMO PRIMERO: Que, con las primeras lluvias, se ha visto que las calles se inundan con facilidad y que el proyecto de alcantarillado no cumple con la función correspondiente, se adjuntan fotos. PETITORIA: 1. Que se declare con lugar el Recurso de amparo ante la Municipalidad de Santa Cruz. 2. Que haya pronto arreglo de las calles mencionadas 3. Que se condene en daños y perjuicios”.

2.- Mediante resolución de las 13:02 horas de 13 de mayo de 2025, la Presidencia de la Sala dio curso al proceso. Asimismo, solicitó informe al alcalde, presidente del Concejo Municipal y jefe de la Unidad Técnica de Gestión Vial, todos de la Municipalidad de Santa Cruz, sobre los siguientes hechos: “a medidos de 2024 la Municipalidad de San Cruz realiza obras para el arreglo vial de alcantarillado en Dirección02, desde Dirección06 a Dirección03, en el Dirección01 en Santa Cruz. Señala que como parte de las obras la empresa contratada procedió a retirar la capa asfáltica, por lo que la vía quedó de lastre y generó una obstrucción en los caños con tierra. Comenta que lo anterior, ocasiona que las aguas se estanquen en todo el tramo de la avenida, lo que genera maslos olores, debido que las aguas residuales de las casas de habitación caen en los caos. Acota que al estar la calle con lastre genera gran cantidad de polvo que provoca enfermedades pulmonares y alergias en los vecinos, por cuanto se levanta mucho polvo ante el tránsito de vehículos, camiones, autobuses y peatones por el sitio. Menciona que el 27 de marzo de 2025 el funcionario Randal Hernández Jáen realizó una inspección en varios sectores de la comunidad de Barrio Panamá, quien constató que el cordón y el caño están obstruidos con material de tierra y lastre debido a los movimientos de tierra que se efectuaron por las obras en la zona. Ante tal situación solicitó a la Unidad Técnica de Gestión Vial del ente municipal recurrido proceder a la limpieza y retiro de materiales de los caños. Por oficio DAM-DGA-SUA-127- 20024 de 1° de abril de 2024 suscrito por la coordinadora Servicios Urbanos Ambientales, Dirección de Gestión Ambiental de la Municipalidad de Santa Cruz y remitido al coordinador de la Unidad Técnica de Gestión Vial de esa municipalidad, mediante el cual se solicitó a dicha Unidad Técnica el retiro o destaque del cordón y caños de los sectores obstruidos con material en Barrio Panamá (véase prueba asociada al expediente). Esto, por cuanto los funcionarios de Aseo y Vías no pueden exponerse ante un riesgo por el tema de salud ocupacional, máxime al tener en cuenta que el sitio es una construcción. Manifiesta que debido a las primeras lluvias las calles se han inundado con facilidad y el proyecto de alcantarillado no está cumpliendo con su función específica. Considera que los hechos expuestos lesionan sus derechos fundamentales”.

3.- Por escrito incorporado al expediente digital el 20 de mayo de 2025, rinde informe bajo juramento Didier Antonio Monge Jiménez, coordinador del Departamento de Gestión Vial de la Municipalidad de Santa Cruz, en los siguientes términos: “1. Arreglo de calle basado en alcantarillado en la Dirección02, desde Dirección06 hasta Dirección03 Desde mediados del año 2024 la Municipalidad mantiene un arreglo vial de alcantarillado en la Dirección02 desde calle 27 a calle 3, específicamente en barrio Panamá. Es correcto que la Municipalidad de Santa Cruz ejecuta desde mediados de 2024 un proyecto de construcción de alcantarillado pluvial y sanitario en la Dirección02, como parte de una obra mayor de mejoramiento de infraestructura urbana. Este proyecto cuenta con diseño técnico, financiamiento y planificación conforme a normativa. el (sic) departamento de gestión vial se encuentra realizando trabajos de mejoramiento en el Dirección01, mediante bajo la figura de contrato por demanda. La primera etapa (fase 1,2,3) del proyecto contempló la instalación del sistema de alcantarillado para la evacuación de aguas pluviales. Durante la cuarta y última fase se contempla la construcción de lo faltante de infraestructura urbana como aceras, estructura de pavimento y carpeta de rodamiento, cordón y caño. 2. Remoción del asfalto Desde su inicio la empresa encargada realizó removimiento de asfalto para proceder con las obras. Tal como se indicó anteriormente, el proyecto se ejecuta por etapas. La primera etapa incluyó la instalación del alcantarillado pluvial, lo que requirió la remoción de la capa asfáltica existente donde se requería. La remoción de asfalto fue necesaria y planificada como parte de la fase constructiva. Este procedimiento técnico se realiza para sustituir las estructuras existentes y facilitar la colocación de la tubería de alcantarillado. • actualmente se cuenta con sello asfaltico en la mitad de la longitud donde se removió en su totalidad la carpeta. • en la segunda mitad solo se excavó la parte donde se ubicó la tubería pluvial, la cual abarca aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. 3. Calle en estado de lastre Que tal removimiento de asfalto conllevó a que la calle quedara de lastre, y obstaculizando los caños con tierra Durante la etapa de movimiento de tierras se utilizó material granular como superficie provisional, lo cual es habitual en obras de este tipo. La obstrucción parcial de algunos caños fue identificada y documentada en el oficio DAM-DGA-SUA-127-2024, emitido por el Departamento de Gestión Vial, el cual incluye documentación fotográfica de su estado al 01 de abril de 2025. Esta situación esta (sic) siendo atendida desde el 08 de mayo. La remoción del asfalto era necesaria para realizar las obras de evacuación de aguas pluviales, por lo tanto, temporalmente la calle quedó en material granular. Se aclara que el proyecto contempla la reposición de la carpeta asfáltica en su fase final. Adicionalmente, es importante señalar que los estancamientos actuales se deben en parte a que, por solicitud expresa de los vecinos, se construyeron accesos vehiculares en lastre frente a cada propiedad, lo cual ha provocado represamientos de agua al obstruir parcialmente el paso natural por donde se ubican los cordones y caños aún en construcción y futuramente a ubicar. Esta situación es temporal y se corregirá con el acoplamiento final del sistema de drenaje pluvial. 4. Obstrucción de caños y aguas estancadas Esta obstaculización de caño de aguas estancadas que en todo el trayecto de dicha avenida generando malos olores ya que las aguas residuales de las casas caen directamente a los caños Es importante señalar que los estancamientos actuales se deben en parte a que, por solicitud expresa de los vecinos, se construyeron accesos vehiculares en lastre frente a cada propiedad, lo cual ha provocado represamientos de agua al obstruir parcialmente el paso natural por los cordones y caños aún en construcción. Esta situación es temporal y se corregirá con la conformación definitiva del sistema de drenaje Como contingencia este departamento ya ha incluido en su cronograma de trabajo la limpieza de tragantes. Al mismo tiempo, se han colocado las señalizaciones correspondientes por parte de la empresa encargada de esta fase, debido a que aún se encuentra en proceso la construcción de del cordón y caño y aceras. No obstante, estas diligencias se deben estar monitoreando ya que se utilizan dispositivos provisionales los cuales son quitados por los transeúntes. Por otra parte se indica que se han encontrado desfogue de aguas residuales al via (sic), lo que, bajo la legislación actual no es permitido esta práctica, para lo que se coordinará con él (sic) ministerio de salud (sic) para que realicen las notificaciones respectivas. 5. Calle en lastre durante el verano Al estar las calles de lastre, generan polvo que provoca enfermedades pulmonares y alergias a la población afectada... Durante la época seca, al encontrarse en fase constructiva, no fue posible realizar mejoras adicionales. No obstante, en el mes de enero se ejecutó un mejoramiento temporal para mitigar el polvo, el cual se mantiene hasta la fecha. Se indica que actualmente se cuenta con sello asfaltico (sic) en la mitad de la longitud y en la segunda mitad solo se excavo (sic) la parte donde se ubicó la tubería pluvial, la cual conforma aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. Cabe acotar, durante la presente época lluviosa y el termino (sic) de ejecución de la construcción la presencia de polvo será ausente. 6. Oficio DAM-DGA-SUA-127-2024 En oficio DAM-DGA-SUA-127-2024... se hace referencia a traslado a UTGVM solicitud de destaque en cordón y caño... Este departamento recibió dicho oficio por correo electrónico el 30 de abril de 2025. Se informa que la solicitud fue contemplada dentro del cronograma de la cuadrilla de mantenimiento, conforme a la programación que se realiza en atención a la cantidad de solicitudes recibidas tanto de la administración como de los contribuyentes. No obstante, por la cantidad de actividades programadas por la cuadrilla municipal, desde el día 8 de mayo por parte del departamento de ambiente ha colaborado en la limpieza de caños y tragantes lo que según inspección de campo se al (sic) obstruido por la basura que acarreó la escorrentía pluvial del sector sur y oeste del centro de Santa Cruz durante los aguaceros iniciales de la época de lluvia que fueron de mayor intensidad. Como contingencia se confirma que esta intervención está (sic) se incluyó como adicional en caso de requerirse de forma emergente con de cuadrilla de mantenimiento del departamento de gestión vial. 7. Alcance del proyecto El proyecto va desde el puente del Río En Medio hasta Almacén El Colono... Se confirma el alcance del proyecto, el cual abarca un tramo amplio que incluye el sector indicado. Su propósito es mejorar la infraestructura de drenaje y sanear el sistema pluvial de toda la zona. El proyecto contempla toda la longitud de Barrio Panamá e incluye evacuación de aguas pluviales, construcción de cordón y caño, aceras y la reposición de la carpeta asfáltica. 8. Inspección para verificación de obstrucción en cordón y caño. El 27 de marzo de 2025, Randal Hernández Jaén inspecciona el sitio y verifica obstrucciones en cordón y caño... Con base en el oficio DAM-DGA-SUA-127-2024, emitido por el Departamento de Gestión Vial se observa obstrucciones mencionadas y acompañado de documentación fotográfica del estado actual de los caños del sector. Dicha inspección fue clave para adoptar medidas correctivas. A raíz de eso, y en conjunto con el Departamento de Ambiente, se inició la limpieza del sector desde el 8 de mayo de 2025, aprovechando la pausa constructiva entre la tercera y cuarta fase. Durante este periodo no hubo maquinaria ni riesgos de salud ocupacional para los trabajadores. 9. Solicitud Departamento de gestión vial (UNIDAD TECNICA) (sic) Se presenta formal solicitud para retiro de obstrucciones... No existe solicitud por parte del recurrente con data después del informe de departamento de gestión ambiental salvo la incluida en el mismo informe. Ante esta situación, con la colaboración una cuadrilla de ambiente en la actualidad se realiza la limpieza correspondiente desde el 8 de mayo, aprovechando la interfaz entre la tercera y cuarta fase del proyecto. (en este periodo no hay maquinaria presente ni acceso restringido que cause riesgo a los colaboradores). No obstante, Por (sic) parte del departamento se hace inclusión adicional en el cronograma de trabajo para atender la situación en el momento que se requiere. 10. Imposibilidad de limpieza por arte (sic) de funcionarios municipales. Manifiesta que los funcionarios de aseo y Vías no pueden exponerse ante riesgo por tema de salud ocupacional. Y en especial por el acceso restringido en el sitio de la obra en construcción. Durante la fase crítica de obra, el acceso fue restringido por seguridad, lo cual es justificado en este tipo de proyectos. No obstante, como se indicó, a partir del 8 de mayo las labores de limpieza se han desarrollado sin restricciones ni riesgo ocupacional, ya que el avance de obra lo permite. 11. Proyecto de alcantarillado no cumple Con las primeras lluvias las calles se inundan y el proyecto no cumple su función. El proyecto aún no ha finalizado. Falta la construcción de cordones, caños y la conexión a tragantes. Las primeras lluvias arrastraron basura que obstruyó los puntos de captación en construcción. Sin embargo, esto fue discutido en una reunión comunal el 7 de mayo de 2025, donde se explicó la situación y la comunidad manifestó respaldo al proyecto. Paragógicamente (sic) El sector inundado fue el sector que se encuentra a mayor nivel respecto al final del proyecto y el sector más bajo no se inundó, mostrando que aun el sistema de Alcantarillado sin estar totalmente concluido está cumpliendo con su fin. Por tanto, respetuosamente se solicita: 1.- Que se declare sin lugar el recurso de amparo interpuesto por el señor Nombre01. 2.- Que se tenga por demostrado que la Municipalidad de Santa Cruz ha actuado conforme a la legalidad, con medidas técnicas adecuadas y atención diligente a las necesidades del proyecto y de la comunidad. 3.-Que se reconozca que los impactos señalados son consecuencia normal y transitoria del desarrollo de una obra pública de saneamiento, cuya finalidad última es la mejora integral del entorno urbano y sanitario de Barrio Panamá. 4.-Que se tenga por satisfecho el deber de atención y respuesta institucional ante las gestiones del recurrente y de la comunidad en general. Con lo anteriormente expuesto se pretende informar lo actuado por este departamento en representación de la administración municipal que en resumen tenemos: • La Municipalidad actúa conforme a sus competencias constitucionales y legales establecidas. • Las obras en cuestión están respaldadas por estudios técnicos y cuentan con supervisión profesional. • Los inconvenientes causados en el sector de Dirección01 son propios del proceso constructivo del Proyecto de mejoramiento de la infraestructura vial y red pluvial del sector de Barrio Panamá, del Cantón de Santa Cruz. Adicionalmente se anexa al presente oficio informe de inspección e informe de actividades de limpieza con el debido respaldo fotográfico del estado de los tragantes construidos, su limpieza y el estado de la superficie de ruedo del sector. Sin otro particular”.

4.- Por escrito incorporado al expediente digital el 20 de mayo de 2025, rinde informe bajo juramento Jorge Arturo Alfaro Orias, alcalde de Santa Cruz, en los siguientes términos: “HECHO PRIMERO: Efectivamente, la Municipalidad de Santa Cruz en el período 2024 inició el proyecto de construcción de alcantarillado pluvial y sanitario en la avenida o, específicamente, en el sector de Barrio Panamá, esto, como parte de una obra mayor de mejoramiento de infraestructura urbana que corresponde a la Licitación Pública Nacional No 2021LN-000002-0021000001, denominada "Contratación de entrega según demanda para obra pública, mantenimiento y mejoramiento vial en Santa Cruz", licitación que fue adjudicada a Constructora Herrera S.A. El respectivo proyecto fue estructurado en cuatro fases de ejecución. A la fecha, las tres primeras fases están prácticamente finalizadas, restando únicamente la cuarta y última fase, la cual se encuentra en proceso de ejecución. Durante su desarrollo, al final de la tercera fase e inicio de la cuarta fase, el proyecto experimentó una paralización temporal debido a que la empresa adjudicada no contaba con la patente comercial municipal al día, lo que impedía gestionar la orden de pedido necesaria para continuar con las labores, en razón de ello, la Administración realizó el debido proceso y apercibió al contratista con el objeto de que cumpliera con la presentación del respectivo requisito y el pago de los tributos municipales. Como medida temporal, se utilizó la orden vigente de contratación de aceras del distrito de Santa Cruz, lo que permitió atender algunas labores mientras se resolvía el incumplimiento por parte del contratista. Actualmente, la empresa contratista ha regularizado su situación legal y se encuentra al día con la patente municipal, por tanto, desde el punto de vista técnico y administrativo el proyecto puede reanudarse en corto plazo una vez finiquitados los tramites de aprobación de la orden de pedido y orden de compra correspondientes, continuando de esta manera con la ejecución de la fase pendiente bajo condiciones normales. Como se mencionó supra, el proyecto está programado a ejecutarse en etapas, la primera de ellas, la fase 1,2,3 en la que se contempló la instalación del sistema de alcantarillado para la evacuación de aguas pluviales. Durante la cuarta y última fase se contempla la construcción de la infraestructura urbana como aceras, estructura de pavimento y carpeta de rodamiento, cordón y caño. Proyecto que cuenta con diseño técnico, financiamiento y planificación conforme a normativa vigente que regula la materia, sin embargo, se reitera que debido a incumplimientos por parte del contratista el proyecto se encuentra suspendido, específicamente, el contratista incumplió con la tramitación para la obtención de la patente comercial y el pago del respectivo impuesto ante la Municipalidad de Santa Cruz. Cabe hacer mención que el contratista ya obtuvo la patente comercial y canceló los tributos municipales por concepto de la patente, por consiguiente, se puso a derecho y cumplió con lo requerido por la Administración, en razón del cumplimiento por parte del contratista, podrá el administrador del contrato girar orden de inicio para que el contratista continúe con la realización de las obras, de conformidad con lo ordenado por la Ley General de Contratación Pública y su Reglamento. De importancia lo es, indicarle que de previo al inicio del proyecto aludido la Municipalidad a través de la licenciada Melissa Ramírez Ríos en su condición de Promotora Social de la UTGVM, realizó el proceso de socialización con los vecinos que habitan las propiedades ubicadas en el tramo en el que se desarrolla el proyecto, lo cual se puede constatar en oficio número DDUR-UTGVM-PS-040-2024 y las minutas de las actas adjuntas. Durante el proceso de socialización con los vecinos de Dirección01, se les explicó el alcance del proyecto, en que consiste, las actividades que se van a llevar a cabo, los tiempos estimados de ejecución y tiempos de atrasos, el valor total de la obra, se les otorgó la palabra, los ingenieros a cargo emitieron recomendaciones, se hizo énfasis en el tipo de trabajo y las posibles afectaciones generadas, las medidas de contención, se les explicó también las alianzas de trabajo con las diferentes instituciones que brindan los servicios esenciales y que están en parte de la vía pública, como: AYA, Coopeguanacaste R.L, ICE, cableras y demás. También, durante la ejecución del proyecto, se realizaron varias reuniones de seguimiento, para mantener a las personas informadas, permitiendo la obtención de opiniones necesidades y sugerencias que aseguran las situaciones reales que viven día a día, asimismo, se da seguimiento a los problemas expuestos, por ejemplo: 1. Dificultades de acceso a las casas de habitación 2. Afectación de los servicios básicos. 3. Problemas de salud. 4. Obstáculos en la vía. 5. Dificultad de trasporte escolar o ambulancias, bomberos (se realizan coordinaciones) y así evitar que tengan dificultades para transitar libremente en caso de una emergencia. Desde que el proyecto inició la Administración ha realizado mesas de trabajo y reuniones con los vecinos de Barrio Panamá en las siguientes fechas: • 15 de octubre de 2024 • 28 de marzo de 2024 • 01 de agosto de 2024 • 21 de marzo de 2024 • 10 de marzo de 2025 HECHO SEGUNDO: Tal como se indicó en el hecho anterior, el proyecto está programado para que se ejecute por etapas, la primera etapa incluyó la instalación de alcantarillado pluvial, por tanto, fue necesaria la remoción de la capa asfáltica existente en los sectores donde así se requería. La remoción de asfalto fue necesaria y planificada como parte de la fase constructiva, este procedimiento técnico se realizó para sustituir las estructuras existentes y facilitar la colocación de la tubería de alcantarillado. Actualmente, se cuenta con sello asfáltico en la mitad de la longitud donde se removió en su totalidad la carpeta, en la segunda mitad únicamente se excavó la parte donde se ubicó la tubería pluvial, la cual, abarca aproximadamente un tercio del ancho de la calzada, la parte restante aún se encuentra en carpeta asfáltica. HECHO TERCERO: Como parte del proyecto ya mencionado, durante la etapa de movimiento de tierra se utilizó material granular como superficie provisional, lo cual es habitual en obras de este tipo. La remoción del asfalto era necesaria para realizar las obras de evacuación de aguas pluviales, por lo que, temporalmente la calle quedó en material granular. Cabe aclarar que el proyecto contempla la reposición de la carpeta asfáltica en su fase final. Ahora bien, en lo concerniente a la obstaculización del cordón y caño es importante señalar que los estancamientos actuales se deben en parte a que, a solicitud expresa de los vecinos, se construyeron accesos vehiculares en lastre frente a cada una de las propiedades, lo cual ha provocado represamientos de agua al obstruir parcialmente el paso natural donde se ubican los cordones y caños aún en construcción y futuramente a ubicar, situación que es temporal y se corregirá con el acoplamiento final del sistema de drenaje pluvial en la etapa final del proyecto. Según informe número DDUR-DGV-COORD-0280-2025 suscrito por el ingeniero Didier Antonio Monge Jiménez coordinador de la UTGVM, en fecha del 16 de mayo de 2025 realizó inspección de campo en el sector de Dirección01, específicamente, donde se están realizado las obras de mejoramiento vial y drenaje pluvial, y se constató que el cordón y caño y los tragantes se encontraban limpios. De la misma manera, la ingeniera Diana Carolina Vallejos Noguera en su condición de coordinadora de Servicios Urbanos Ambientales, informó a través de oficio número DAM-DGA-SUA-199-2025 que la cuadrilla de limpieza de vías continúa realizando los trabajos de limpieza del cordón y caño en el sector de Dirección01, y que las labores de limpieza en ese sector se realizan de 1 a 2 veces por semana, incluso, se han extendido dichas labores en horario de la tarde si el clima así lo permite. Por consiguiente, queda demostrado que la situación alegada en este hecho ya ha sido debidamente atendida por la cuadrilla del servicio de limpieza de vías de la Dirección de Gestión Ambiental. HECHO CUARTO: Como se manifestó en el hecho anterior, gran parte de los estancamientos se generaron, debido a que, a solicitud expresa de los vecinos, se construyeron accesos vehiculares en lastre frente a cada una de las propiedades, lo cual ha provocado represamientos de agua al obstruir parcialmente el paso natural por los cordones y caños aún en construcción, situación que es temporal, y será corregida de manera definitiva cuando se inicie la cuarta etapa del proyecto con la conformación definitiva del sistema de drenaje. Para mitigar dicha problemática, la UTGVM incluyó dentro del cronograma de trabajos la limpieza de tragantes, asimismo, la empresa encargada de las obras colocó las señalizaciones correspondientes debido a que aún se encuentra en proceso la construcción del cordón y caño y aceras. Por otra parte, se indica que se han encontrado desfogue de aguas residuales a la vía, lo que, según el Ordenamiento Jurídico por el cual se rige la materia en estudio esa práctica no es permitida, siendo que, en razón de materia es competencia del Ministerio de Salud la atención de esta problemática procederá la Administración a trasladar el caso al Ministerio de Salud para que realicen las intervenciones y notificaciones respectivas. HECHO QUINTO: Sobre este particular, el recurrente no identificó a la persona o las personas, que, en apariencia, han tenido afectaciones de salud provocadas por partículas de polvo, tampoco, aportó el dictamen médico por medio del cual el médico especialista hiciera constar que la exposición al polvo haya sido la causal de la afectación pulmonar y alergias del paciente o los pacientes. Recordemos que el proyecto consta de fases y/o etapas, durante la época seca al encontrarse en fase constructiva no fue factible realizar mejoras adicionales, no obstante, en el mes de enero se ejecutó un mejoramiento temporal para mitigar el polvo, el cual se mantiene hasta la fecha. Actualmente, se cuenta con sello asfáltico en la mitad de la longitud y en la segunda mitad solo se excavó la parte donde se ubicó la tubería pluvial, la cual conforma aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. HECHO SEXTO: Ciertamente, mediante oficio número DAM-DGA-SUA-127-2024 la ingeniera Diana Carolina Vallejos Noguera, coordinadora de Servicios Urbanos Ambientales, informó al ingeniero Didier Antonio Monge Jiménez la situación de obstrucción del cordón y caño situado en avenida o, de Dirección07, ante tal posición la UTGVM solicitó a la Dirección de Gestión Ambiental colaboración para realizar los trabajos de limpieza del cordón y caño y tragantes del sector aludido. De la inspección de campo realizada por el ingeniero Monge Jiménez, se determinó que la obstrucción referida ha sido ocasionada por la cantidad de basura acarreada por la escorrentía pluvial del sector Sur y Oeste que proviene del centro de Santa Cruz, esto, producto de la época lluviosa actual. Ahora bien, como medida para mitigar dicha problemática, la UTGVM solicitó a la Dirección de Gestión Ambiental colaboración con la finalidad de que la cuadrilla de limpieza de vías realice la limpieza de cordón y caño y los tragantes, trabajos de limpieza que la cuadrilla ha realizado de manera efectiva. De la misma manera, la cuadrilla de mantenimiento de Gestión Vial una vez que se dé la orden de reiniciar las obras en cuestión, realizará los trabajos de limpieza respectivos. HECHO SÉTIMO: Es correcto, el proyecto del caso que nos atañe abarca el tramo que va desde el puente del Río En medio hasta Almacén El Colono, proyecto que tiene como propósito mejorar la infraestructura de drenaje y sanear el sistema pluvial de toda la zona. El proyecto contempla toda la longitud de Barrio Panamá e incluye evacuación de aguas pluviales, construcción de cordón y caño, aceras y la reposición de la carpeta asfáltica. HECHO OCTAVO: con base en lo informado en el oficio DAM-DGA-SUA-1272024, el ingeniero Didier Monge Jiménez en fecha del 16 de mayo de 2025 realizó inspección de campo al lugar de los hechos con el objeto de verificar y tomar las medidas correctivas pertinentes, de la visita a campo se concluyó que tanto los tragantes como el cordón y caño del sector de Barrio Panamá están limpios, esto, debido a que de manera mancomunada con la Dirección de Gestión Ambiental se iniciaron los trabajos de limpieza desde el 08 de mayo de 2025. HECHO NOVENO: De conformidad con lo manifestado en oficio número DT-0612025 suscrito por el ingeniero Oscar (sic) Danilo González Mora en su condición de Director Tributario, de la revisión realizada dentro de los registros del sistema tributario municipal DECSIS, y en el correo institucional oficial ...01, no existe registro que el señor Nombre01, cédula CED01, haya presentado alguna gestión dirigida a la Unidad Técnica de Gestión Vial Municipal durante los períodos 2024 — 2025. HECHO DÉCIMO: Al respecto, de la inspección realizada por el ingeniero Monge Jiménez en fecha del 16 de mayo de 2025, se determinó que no existe maquinaria ni factores de riesgo que puedan generar afectación a la integridad física de los funcionarios de la cuadrilla de limpieza de vías de la Dirección de Gestión Ambiental. HECHO DÉCIMO PRIMERO: Como se explicó en el hecho primero, el proyecto fue planificado para realizarse en etapas, estando pendiente la construcción de cordones, caños y la conexión a tragantes, por consiguiente, el proyecto aún no ha finalizado, por consiguiente, el cual, entre otros, tiene por objeto erradicar los problemas de inundaciones. Las primeras lluvias arrastraron basura y desechos que obstruyeron los puntos de captación en construcción, sin embargo, esta situación está siendo atendida por la cuadrilla de limpieza de vías, quienes, de 1 a 2 veces por semana se apersonan al lugar de los hechos a limpiar los tragantes y cordón y caño, e incluso, realizan dos turnos, en la mañana y en la tarde, condicionado a que las condiciones del clima así lo permitan. Aunado a lo anterior, en fecha del 07 de mayo de 2025 la Administración realizó una mesa de trabajo con los vecinos del sector de Dirección01, específicamente, los que habitan en predios ubicados en el tramo donde se desarrolla el proyecto en cuestión; reunión en la que por parte de la Municipalidad participaron los siguientes funcionarios: Mitzy Salazar Morales, Vicealcaldesa municipal, Maureen Contreras Arrieta, Regidora municipal, Didier Monge Jiménez, coordinador de la UTGVM, y quien suscribe, Jorge Arturo Alfaro Orias, Alcalde Municipal. La mesa de trabajo se realizó con la finalidad de explicar la situación y abordar los siguientes temas: 1. Afectación de la calle principal. 2. Ancho del derecho de vía. 3. Problemas de inundación. 4. Recolección de residuos. 5. Construcción de aceras. 6. Falta de supervisión. 7. Inicio de la siguiente fase. 8. Aguas residuales 9. Atrasos administrativos. Cabe hacer mención que los vecinos que asistieron a la reunión manifestaron apoyo y respaldo al proyecto. (Ver minuta del acta de la mesa de trabajo del 07 de mayo de 2025). Como se logró demostrar en los informes técnicos adjuntos, el proyecto aún no ha finalizado y se encuentra pendiente la ejecución de la última etapa, lo cual, la Administración tiene previsto dar la orden de reinicio de las obras una vez que se concluya con el debido proceso y se verifique que el contratista cumplió con el pago del impuesto de la patente comercial, todo en cumplimiento a lo dispuesto por la Ley General de la Administración Pública, Ley General de Contratación Pública y su Reglamento. En lo que respecta a la limpieza de los tragantes, cordón y caño, la cuadrilla de limpieza de vías de la Dirección de Gestión Ambiental realiza la limpieza semanalmente, de 1 a 2 veces, e incluso se han dispuesto a redoblar esfuerzos y realizar la limpieza en doble horario, por la mañana y por la tarde. En razón de lo expuesto y quedando demostrado que la Administración atendió la situación alegada por el recurrente, y se compromete a continuar brindado de manera efectiva el servicio de limpieza de vías, solicito respetuosamente, se declare sin lugar el Recurso de Amparo interpuesto contra mi representada (…)”.

5.- Por constancia de 22 de mayo de 2025, la secretaria a. i. y el técnico judicial 3 que tramita el expediente, ambos cargos de la Sala, hicieron saber: “revisado, a las once horas seis minutos del veintidós de mayo de dos mil veinticinco, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 16/05/2025 al 20/05/2025, el PRESIDENTE DEL CONCEJO MUNICIPAL DE LA MUNICIPALIDAD DE SANTA CRUZ haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las trece horas dos minutos del trece de mayo de dos mil veinticinco”.

6.- En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Garita Navarro; y,

Considerando:

I.- CUESTIÓN PREVIA. En vista de que el presidente del Concejo Municipal de Santa Cruz omitió contestar la audiencia dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.

II.-OBJETO DEL RECURSO. La parte accionante, quien dice ser vecino de Dirección01 de Santa Cruz, plantea recurso de amparo en contra de la Municipalidad. Manifiesta que, desde mediados de 2024, la Municipalidad de Santa Cruz “mantiene un arreglo vial de alcantarillado en la Dirección02 desde calle 27 a Dirección03, específicamente en Dirección01”. Menciona que la empresa encargada removió el asfalto para proceder con las obras, por lo que la calle quedó de lastre y “obstaculizando los caños con tierra”. Asevera que la obstaculización de caños deja aguas estancadas en el trayecto de la avenida, lo que emana malos olores, pues las “aguas residuales de las casas caen directamente a los caños”. Sostiene que las calles de lastre generan polvo que provoca enfermedades pulmonares y alergias a la población afectada, por cuanto la vía es transitada por camiones, buses y peatones. Arguye que el coordinador de UTGVM de la Municipalidad de Santa Cruz, por oficio DAM-DGA-SUA-127-2024, del 1 ̊ de abril del 2025, hizo referencia al traslado a la UTGVM de la solicitud de limpiar cordón y caño en el barrió Panamá. Añade que el proyecto se extiende desde “el Dirección08 hasta Dirección05, Santa Cruz centro”. Refiere que el 27 de marzo de 2025, servidor Randal Hernández Jaén, con ocasión de una inspección, verificó varios sectores “en la comunidad de Dirección01” con el cordón y caño obstruido por “material de tierra y lastre debido a los movimientos de tierras realizados con la maquinaria”. Acota que, debido a lo anterior, se “presenta formal solicitud a la Unidad Técnica de Gestión Vial Municipal, para que retire o destaque cordón y caño de los sectores obstruidos con material”. Explica que con las primeras lluvias se ha visto que las calles se inundan y que el proyecto de alcantarillado no cumple la función. Pide que “haya pronto arreglo de las calles mencionadas”.

III.-HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

a. Desde mediados de 2024, la Municipalidad de Santa Cruz ejecuta un proyecto de construcción de alcantarillado pluvial y sanitario en la Dirección02, como parte de una obra mayor de mejoramiento de infraestructura urbana. La primera etapa (fase 1,2,3) del proyecto contempló la instalación del sistema de alcantarillado para la evacuación de aguas pluviales. En la cuarta y última fase se contempla la construcción de lo faltante de infraestructura urbana como aceras, estructura de pavimento y carpeta de rodamiento, cordón y caño. (Informe del coordinador del Departamento de Gestión Vial de la Municipalidad de Santa Cruz).

b. Las obras en el sector de Dirección01 forman parte de la obra mayor de mejoramiento de infraestructura urbana correspondiente a la licitación pública nro. 2021LN-000002-0021000001 denominada “Contratación de entrega según demanda para obra pública, mantenimiento y mejoramiento vial en Santa Cruz”, que fue adjudicada a Constructora Herrera S.A. (Informe del alcalde de Santa Cruz).

c. La coordinadora de Servicios Urbanos Ambientales de la Dirección de Gestión Ambiental de la Municipalidad de Santa Cruz, mediante oficio DAM-DGA-SUA-127-2024 (sic) del 1 ̊ de abril de 2025 dirigido al coordinador de la UTGVM de ese gobierno local, señaló: “Reciban un cordial saludo. La Unidad Técnica de Gestión Vial ha venido realizando trabajos en la calle de Dirección01, el proyecto que va desde el puente de Rio En medio hasta Almacenes El Colono S.A. Santa Cruz centro. (…) Informa el señor Randal Hernández Jaén, que realizó inspección el día jueves 27 de marzo del 2025, donde verifica varios sectores en la comunidad de Barrio Panamá con el cordón y caño obstruidos, con el material de tierra o lastre debido los movimientos de tierra realizados con la maquinaria. (…) Debido a lo anterior, se presenta formal solicitud a la Unidad Técnica de Gestión Vial Municipal, para que retire o destaque cordón y caño de los sectores obstruidos con material, los funcionarios de aseo y vías no pueden exponerse ante riesgo por tema de salud ocupacional y en especial por el acceso restringido en el sitio de la obra en construcción, debemos vigilar su integridad física y especialmente su salud”. (Prueba aportada por la parte recurrente).

d. El coordinador del Departamento de Gestión Vial de la Municipalidad de Santa Cruz, en el informe fechado 16 de mayo de 2025 (oficio DDUR-DGV-COORD-0280-2025), manifestó: “La primera etapa incluyó la instalación del alcantarillado pluvial, lo que requirió la remoción de la capa asfáltica existente donde se requería. La remoción de asfalto fue necesaria y planificada como parte de la fase constructiva. Este procedimiento técnico se realiza para sustituir las estructuras existentes y facilitar la colocación de la tubería de alcantarillado. (…) • actualmente se cuenta con sello asfaltico en la mitad de la longitud donde se removió en su totalidad la carpeta. • en la segunda mitad solo se excavó la parte donde se ubicó la tubería pluvial, la cual abarca aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. (…) Durante la etapa de movimiento de tierras se utilizó material granular como superficie provisional, lo cual es habitual en obras de este tipo. La obstrucción parcial de algunos caños fue identificada y documentada en el oficio DAM-DGA-SUA-127-2024, emitido por el Departamento de Gestión Vial, el cual incluye documentación fotográfica de su estado al 01 de abril de 2025. Esta situación esta () siendo atendida desde el 08 de mayo. La remoción del asfalto era necesaria para realizar las obras de evacuación de aguas pluviales, por lo tanto, temporalmente la calle quedó en material granular. Se aclara que el proyecto contempla la reposición de la carpeta asfáltica en su fase final. Adicionalmente, es importante señalar que los estancamientos actuales se deben en parte a que, por solicitud expresa de los vecinos, se construyeron accesos vehiculares en lastre frente a cada propiedad, lo cual ha provocado represamientos de agua al obstruir parcialmente el paso natural por donde se ubican los cordones y caños aún en construcción y futuramente a ubicar. Esta situación es temporal y se corregirá con el acoplamiento final del sistema de drenaje pluvial. (…) Como contingencia este departamento ya ha incluido en su cronograma de trabajo la limpieza de tragantes. Al mismo tiempo, se han colocado las señalizaciones correspondientes por parte de la empresa encargada de esta fase, debido a que aún se encuentra en proceso la construcción de del cordón y caño y aceras. No obstante, estas diligencias se deben estar monitoreando ya que se utilizan dispositivos provisionales los cuales son quitados por los transeúntes. Por otra parte se indica que se han encontrado desfogue de aguas residuales al via (sic), lo que, bajo la legislación actual no es permitido esta práctica, para lo que se coordinará con él (sic) ministerio de salud (sic) para que realicen las notificaciones respectivas. (…) Durante la época seca, al encontrarse en fase constructiva, no fue posible realizar mejoras adicionales. No obstante, en el mes de enero se ejecutó un mejoramiento temporal para mitigar el polvo, el cual se mantiene hasta la fecha. Se indica que actualmente se cuenta con sello asfaltico en la mitad de la longitud y en la segunda mitad solo se excavo (sic) la parte donde se ubicó la tubería pluvial, la cual conforma aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. Cabe acotar, durante la presente época lluviosa y el termino de ejecución de la construcción la presencia de polvo será ausente. (…) En oficio DAM-DGA-SUA-127-2024... se hace referencia a traslado a UTGVM solicitud de destaque en cordón y caño... Este departamento recibió dicho oficio por correo electrónico el 30 de abril de 2025. Se informa que la solicitud fue contemplada dentro del cronograma de la cuadrilla de mantenimiento, conforme a la programación que se realiza en atención a la cantidad de solicitudes recibidas tanto de la administración como de los contribuyentes. No obstante, por la cantidad de actividades programadas por la cuadrilla municipal, desde el día 8 de mayo por parte del departamento de ambiente ha colaborado en la limpieza de caños y tragantes lo que según inspección de campo se al obstruido por la basura que acarreó la escorrentía pluvial del sector sur y oeste del centro de Santa Cruz durante los aguaceros iniciales de la época de lluvia que fueron de mayor intensidad. Como contingencia se confirma que esta intervención está se incluyó como adicional en caso de requerirse de forma emergente con de cuadrilla de mantenimiento del departamento de gestión vial. (…) Con base en el oficio DAM-DGA-SUA-127-2024, emitido por el Departamento de Gestión Vial se observa obstrucciones mencionadas y acompañado de documentación fotográfica del estado actual de los caños del sector. Dicha inspección fue clave para adoptar medidas correctivas. A raíz de eso, y en conjunto con el Departamento de Ambiente, se inició la limpieza del sector desde el 8 de mayo de 2025, aprovechando la pausa constructiva entre la tercera y cuarta fase. Durante este periodo no hubo maquinaria ni riesgos de salud ocupacional para los trabajadores”. (Informe del coordinador del Departamento de Gestión Vial de la Municipalidad de Santa Cruz).

e. El Departamento de Gestión Vial de la Municipalidad de Santa Cruz, en el anexo del oficio DDUR-DGV-COORD-0280-2025 de 16 de mayo de 2025, consignó: “ANEXO Informe ACTUAL AL 16 DE MAYO 2025 Inspección: Estado físico sector de obras mejoramiento infraestructura Vial y drenaje pluvial Barrio Panamá (…) Observaciones y Consideraciones: A partir del 8 de mayo y cuadrillas municipales iniciaron limpieza constante y monitoreo para realizar limpieza de los sistemas de captación y drenaje aun sin conectar a la infraestructura de colectora (Cordones y caño)”. (Prueba aportada por el coordinador del Departamento de Gestión Vial de la Municipalidad de Santa Cruz).

f. El 16 de mayo de 2025, el ingeniero Didier Monge Jiménez realizó una inspección en el lugar, en la cual concluyó que “tanto los tragantes como el cordón y caño del sector de Barrio Panamá están limpios, estos, debido a que de manera mancomunada con la Dirección de Gestión Ambiental se iniciaron los trabajos de limpieza desde el 08 de mayo de 2025”. (Informe del alcalde de Santa Cruz).

g. El director tributario de la Municipalidad de Santa Cruz, en el oficio DT-061-2025 de 20 de mayo de 2025, hizo saber: “Luego de realizada la consulta al funcionario que actualmente ocupa el puesto de recepcionista en la Plataforma de Servicios, le confirmo que no se encuentran registros en el sistema tributario municipal Decsis, ni en el correo institucional oficial ...01, que indiquen que el señor Nombre01, cédula CED01, haya presentado algún tipo de documentación dirigida a la Unidad Técnica de Gestión Vial Municipal durante los años 2024 o 2025”. (Prueba aportada por el alcalde de Santa Cruz).

IV.-HECHO NO PROBADO. De importancia para la resolución de este asunto, se estima como no demostrado que la vía en el sector de Dirección09 presente alguna condición que represente algún riesgo manifiesto para la integridad de las personas, o bien, que sea intransitable.

V.- SOBRE EL CASO CONCRETO. En el sub lite, la parte accionante, quien dice ser vecino de Dirección09, plantea recurso de amparo en contra de la Municipalidad. Manifiesta que, desde mediados de 2024, la Municipalidad de Santa Cruz “mantiene un arreglo vial de alcantarillado en la Dirección02 desde calle 27 a Dirección03, específicamente en barrio Panamá”. Menciona que la empresa encargada removió el asfalto para proceder con las obras, por lo que la calle quedó de lastre y “obstaculizando los caños con tierra”. Asevera que la obstaculización de caños deja aguas estancadas en el trayecto de la avenida, lo que emana malos olores, pues las “aguas residuales de las casas caen directamente a los caños”. Sostiene que las calles de lastre generan polvo que provoca enfermedades pulmonares y alergias a la población afectada, por cuanto la vía es transitada por camiones, buses y peatones. Arguye que el coordinador de UTGVM de la Municipalidad de Santa Cruz, por oficio DAM-DGA-SUA-127-2024, del 1 ̊ de abril del 2025, hizo referencia al traslado a la UTGVM de la solicitud de limpiar cordón y caño en el barrió Panamá. Añade que el proyecto se extiende desde “el Dirección08 hasta Dirección05, Santa Cruz centro”. Refiere que el 27 de marzo de 2025, servidor Randal Hernández Jaén, con ocasión de una inspección, verificó varios sectores “en la comunidad de Dirección01” con el cordón y caño obstruido por “material de tierra y lastre debido a los movimientos de tierras realizados con la maquinaria”. Acota que, debido a lo anterior, se “presenta formal solicitud a la Unidad Técnica de Gestión Vial Municipal, para que retire o destaque cordón y caño de los sectores obstruidos con material”. Explica que con las primeras lluvias se ha visto que las calles se inundan y que el proyecto de alcantarillado no cumple la función. Pide que “haya pronto arreglo de las calles mencionadas”.

Del estudio de los autos se tiene por demostrado, que, desde mediados de 2024, la Municipalidad de Santa Cruz ejecuta un proyecto de construcción de alcantarillado pluvial y sanitario en la Dirección02, como parte de una obra mayor de mejoramiento de infraestructura urbana. La primera etapa (fase 1,2,3) del proyecto contempló la instalación del sistema de alcantarillado para la evacuación de aguas pluviales. En la cuarta y última fase se contempla la construcción de lo faltante de infraestructura urbana como aceras, estructura de pavimento y carpeta de rodamiento, cordón y caño. Las obras en el sector de Dirección01 forman parte de la obra mayor de mejoramiento de infraestructura urbana correspondiente a la licitación pública nro. 2021LN-000002-0021000001 denominada “Contratación de entrega según demanda para obra pública, mantenimiento y mejoramiento vial en Santa Cruz”, que fue adjudicada a Constructora Herrera S.A. La Unidad Técnica de Gestión Vial ha venido realizando trabajos en la calle de Dirección01, el proyecto que va desde el puente de Dirección04 hasta Almacenes El Colono S.A. Santa Cruz centro. (…) Durante la época seca, al encontrarse en fase constructiva, no fue posible realizar mejoras adicionales. No obstante, en el mes de enero se ejecutó un mejoramiento temporal para mitigar el polvo, el cual se mantiene hasta la fecha. Se indica que actualmente se cuenta con sello asfaltico en la mitad de la longitud y en la segunda mitad solo se excavo (sic) la parte donde se ubicó la tubería pluvial, la cual conforma aproximadamente un tercio del ancho de la calzada, el resto aún se encuentra en carpeta asfáltica. Cabe acotar, durante la presente época lluviosa y el termino de ejecución de la construcción la presencia de polvo será ausente. (…) En oficio DAM-DGA-SUA-127-2024... se hace referencia a traslado a UTGVM solicitud de destaque en cordón y caño... Este departamento recibió dicho oficio por correo electrónico el 30 de abril de 2025. Se informa que la solicitud fue contemplada dentro del cronograma de la cuadrilla de mantenimiento, conforme a la programación que se realiza en atención a la cantidad de solicitudes recibidas tanto de la administración como de los contribuyentes. No obstante, por la cantidad de actividades programadas por la cuadrilla municipal, desde el día 8 de mayo por parte del departamento de ambiente ha colaborado en la limpieza de caños y tragantes lo que según inspección de campo se al obstruido por la basura que acarreó la escorrentía pluvial del sector sur y oeste del centro de Santa Cruz durante los aguaceros iniciales de la época de lluvia que fueron de mayor intensidad. Como contingencia se confirma que esta intervención está se incluyó como adicional en caso de requerirse de forma emergente con de cuadrilla de mantenimiento del departamento de gestión vial. (…) Con base en el oficio DAM-DGA-SUA-127-2024, emitido por el Departamento de Gestión Vial se observa obstrucciones mencionadas y acompañado de documentación fotográfica del estado actual de los caños del sector. Dicha inspección fue clave para adoptar medidas correctivas. A raíz de eso, y en conjunto con el Departamento de Ambiente, se inició la limpieza del sector desde el 8 de mayo de 2025, aprovechando la pausa constructiva entre la tercera y cuarta fase. Durante este periodo no hubo maquinaria ni riesgos de salud ocupacional para los trabajadores”. El Departamento de Gestión Vial de la Municipalidad de Santa Cruz, en el anexo del oficio DDUR-DGV-COORD-0280-2025 de 16 de mayo de 2025, consignó: “ANEXO Informe ACTUAL AL 16 DE MAYO 2025 Inspección: Estado físico sector de obras mejoramiento infraestructura Vial y drenaje pluvial Dirección01 (…) Observaciones y Consideraciones: A partir del 8 de mayo y cuadrillas municipales iniciaron limpieza constante y monitoreo para realizar limpieza de los sistemas de captación y drenaje aun sin conectar a la infraestructura de colectora (Cordones y caño)”. El 16 de mayo de 2025, el ingeniero Didier Monge Jiménez realizó una inspección en el lugar, en la cual concluyó que “tanto los tragantes como el cordón y caño del sector de Dirección01 están limpios, estos, debido a que de manera mancomunada con la Dirección de Gestión Ambiental se iniciaron los trabajos de limpieza desde el 08 de mayo de 2025”. El director tributario de la Municipalidad de Santa Cruz, en el oficio DT-061-2025 de 20 de mayo de 2025, hizo saber: “Luego de realizada la consulta al funcionario que actualmente ocupa el puesto de recepcionista en la Plataforma de Servicios, le confirmo que no se encuentran registros en el sistema tributario municipal Decsis, ni en el correo institucional oficial ...01, que indiquen que el señor Nombre01, cédula CED01, haya presentado algún tipo de documentación dirigida a la Unidad Técnica de Gestión Vial Municipal durante los años 2024 o 2025”.

Desde este panorama, en los términos planteados en el escrito de interposición, se descarta alguna situación que, en este momento, amerite la intervención de la Sala.

Al respecto, la parte accionante no expuso ni demostró que la condición de la vía del sector del Dirección01 represente algún riesgo manifiesto para la integridad de las personas.

Ahora, con respecto a la remoción del asfalto, el accionante no alegó ni probó que la vía fuera intransitable. Además, aun cuando mencionó que la calle quedó de lastre y genera polvo que provoca enfermedades pulmonares y alergias a la población afectada, no menos cierto es que en el escrito de interposición no expuso alguna afectación concreta de personas individualizadas (acompañada de la prueba respectiva) que haya sido también previamente alegada ante las autoridades municipales, por lo que prima facie no se observa alguna omisión susceptible de ser declarada. Ergo, tomando en consideración las particularidades del caso concreto, no compete a esta jurisdicción emitir alguna orden con respecto al estado de la vía. En todo caso, no solo se informó que el retiro de la capa asfáltica es temporal, sino que la parte en la que no hay (correspondiente a la mitad de la longitud) abarca solo un tercio de la calzada; incluso, se indicó que el proyecto contempla la reposición de la carpeta asfáltica.

Por otra parte, con respecto a la obstaculización de los caños, no consta en el expediente alguna denuncia de tal situación a municipalidad por parte del recurrente, ni tampoco alguna situación derivada que haya ocasionado algún peligro para la integridad de las personas. Nótese que no se hizo alusión a las fechas de las inundaciones ni tampoco a hechos derivados de estas que, por su magnitud, generen algún riesgo que haga necesaria la tutela del Derecho de la Constitución en esta jurisdicción. Más bien, se constata que la situación fue advertida por personal del gobierno local el 1 de abril de 2025 y que se acudió en amparo el 12 de mayo siguiente, es decir, no había transcurrido un plazo excesivo para la atención de la situación. De hecho, sin perjuicio de lo anterior, las autoridades accionadas manifestaron haber iniciado labores de limpieza el 8 de mayo de este año y que el 16 de ese mes ya se encontraba limpia la zona.

Asimismo, si bien se alegan malos olores por las aguas estancadas, no se acredita alguna denuncia de esa situación ante alguna autoridad competente. En todo caso, en oficio de 16 de mayo de 2025, la municipalidad consignó que se encontraron desfogues de aguas residuales en la vía, por lo que se va a coordinar con el Ministerio de Salud. De ahí que, a los efectos de este proceso, no se observa alguna omisión de las autoridades municipales que pueda ser declarada en este proceso.

En consecuencia, se declara sin lugar el recurso.

VI.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente indica que unos trabajos no finalizados por la Municipalidad de Santa Cruz, genera problemas de aguas estancadas con malos olores y, además, polvo que provoca enfermedades pulmonares y alergias a la población afectada.

VII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.

Por tanto:

Se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota.
