Date of Resolution: May 30, 2025 at 09:20 Case File: 25-009962-0007-CO Type of matter: Writ of amparo (recurso de amparo) SALA CONSTITUCIONAL OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes on the thirtieth of May, two thousand twenty-five.
Writ of amparo filed by Nombre01, national identity card (cédula de identidad) CED01, against the MUNICIPALITY OF SANTA ANA AND THE ÁREA RECTORA DE SALUD DE SANTA ANA.
WHEREAS:
"…the owner Nombre04 with identity card CED02 of this property—an inspection is carried out and the boundary wall mentioned by Nombre03 is not seen to be affected; she is reinforcing the boundary wall because it collapsed due to the age it appears to be, but on Mr. Roberto's property the boundary wall is not affected, the fill made many years ago at the foot of the wall is at an acceptable distance.
On this property, the soil being stored is for use by the plant nursery (vivero), not for fill; the structures are very old—one house and one warehouse—and they store heavy vehicles on their property (sic)…" Under this same position, Architect Daniel Sánchez Méndez, in the conclusions of report MSA-GOT-PPU-UCU-01-040-2024, stated:
Por tanto 1. No fill activities were observed on the property at the time of the visit.
2. The topography at the southern end of the property is at sidewalk level and decreases in elevation as the property extends northward.
3. No active construction or machinery is identified, as shown in the photographs provided by Mr. Nombre01 on the day of the visit.
4. There are no construction permits linked to the property in question in the municipal system.
5. There are no closure orders (actas de clausura) for the dwellings on the site; therefore, the case is referred to the inspector assigned to the route to proceed with the appropriate closures of the existing structures on site.
6. The piping mentioned in the formal complaint (denuncia) is not observed.
7. With regard to the dismantling activities, the activity is not observed upon arrival at the site; however, the matter is referred to the business licensing department (proceso de patentes) for an on-site inspection.
8. Should the complainant observe and/or hear activities in the late hours of the night, he must contact the Municipal Police (Policía Municipal) so that they may prepare the corresponding Observation Report (Acta de Observación) to be forwarded to the Business Licensing Department.
9. Because this is a dispute between private properties that, according to Mr. Nombre01, dates back several years, they must file a complaint through the judicial channels so that the appropriate investigation may proceed. Mr. Nombre01 must file the complaint as a direct victim and eyewitness to the development of the activities he has reported from previous years." In accordance with the foregoing, the visual inspection report (acta de inspección ocular) of July 9, 2024 was forwarded together with closure order CLA-UCU-MAZ-1235, which indicates the existence of construction works without an apparent construction permit:
"Result: THE WORK IS (FINISHED), and therefore the Breaking of Seals/Contempt of Authority (Violación de Sellos/Desobediencia de la Autoridad) report is not served, and the matter is referred to the Legal Department. For the construction of 2 block dwellings and one wooden dwelling, and various roofs that appear to be storage sheds (bodegas). The closure is carried out at the request of department management, but the constructions, according to the owner, are more than 20 years old…" Furthermore, the jurisdictional authority is hereby informed that, at the time of submitting this report, the special construction proceeding concerning the aforementioned property (finca) is pending processing and will be addressed in due course.
Drafted by Magistrate Hess Herrera; and,
WHEREAS:
The appellant accuses the authorities of failing to attend to the complaints he filed before both the Municipality and the Health Governing Area of Santa Ana, regarding the existence of an illegal fill and earthworks (movimientos de tierra) on an adjoining landholding (fundo) to his residence, where economic activities are also being carried out without any permit whatsoever. Such conduct is contrary to his fundamental rights.
The following facts, relevant to the decision in this amparo proceeding, are considered established: a) Regarding the Municipality of Santa Ana.
It was established that, on May 13, 2024, the petitioner filed an inquiry with the Municipal Legal Advisory Process regarding the zoning of the Regulatory Plan, alleging that he did not understand why the owner of the truck depot continued to build rooming houses in an Agricultural Zone. It was further established that, in the inspections conducted by municipal officials, the existence of a fill at the reported location, as well as the profit-making activity alleged, were ruled out. In view of the petitioner's repeated disagreements, on June 19, October 1, and October 7 of that same year, the reported site was inspected again, confirming that the alleged facts did not exist. For the foregoing reasons, by email from the Urban Planning Process of that Municipality at 16:56 hours on December 17, 2024, the complaint was archived, and the petitioner was advised to pursue the matter through judicial channels.
In sum, it is not that the protected party's complaints were left unattended, but rather that the protected party is dissatisfied with the decisions of the respondent authorities. The Court therefore finds that the alleged violation does not exist. On this basis, the Court is compelled to dismiss the appeal, as is hereby ordered.
The parties are hereby notified that if any document in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, has been submitted to the record, such materials must be retrieved from the court office within a maximum period of 30 business days counted from the date of notification of this judgment. Otherwise, all materials not retrieved within that period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Plenary Court (Corte Plena) in session number 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as pursuant to the agreement approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session number 43-12 held on May 3, 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de mayo de dos mil veinticinco .
Recurso de amparo promovido por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE SANTA ANA Y EL ÁREA RECTORA DE SALUD DE SANTA ANA.
RESULTANDO:
“… el propietario Nombre04 con CEDULA CED02 de esta finca se hace inspección y no se ve que esté afectada la tapia señor Nombre03, la cual la está reforzando por el motivo que se volcó por los años que aparenta la tapia, pero en la propiedad del Sr. Roberto no afecta la tapia, se encuentra una distancia aceptada del relleno que se hizo hace muchos años al pie de la tapia.
En esta finca la tierra que se es par a uso del vivero no es para relleno, las edificaciones son muy viejas una casa y bodega y guardan los carros pesados en su propiedad (sic) …” Bajo esta misma postura, el Arq. Daniel Sánchez Méndez, en las conclusiones del informe MSA-GOT-PPU-UCU-01-040-2024 indicó:
“POR TANTO 1. En el terreno no se observan actividades de relleno a la hora de la visita.
2. La topografía al Sur del terreno se encuentra al nivel de acera y disminuye en altura conforme el terreno se extiende hacia el Norte.
3. No se identifican construcciones activas o maquinaria como se muestra en las fotos brindadas por el Sr. Nombre01 al día de la visita.
4. No existen permisos de construcción vinculados con la propiedad en cuestionamiento en el sistema municipal.
5. No existen actas de clausura de las viviendas en el sitio, por lo tanto, se traslada el caso al inspector a cargo de la ruta para que proceda a realizar las debidas clausuras de las estructuras existentes en sitio.
6. No se observa la entubación mencionada en la denuncia.
7. Con respecto a las actividades de desmantelamiento, no se observa la actividad al llegar al sitio, sin embargo, se traslada al proceso de patentes para que realicen inspección en sitio.
8. En caso de observar y/o escuchar actividades a altas horas de la noche, el denunciante debe comunicarse con la Policía Municipal para que realicen el Acta de Observación correspondiente para que la trasladen al proceso de Patentes.
9. Debido a que es un conflicto entre propiedades privadas que, según el Sr. Nombre01, data de años atrás, deben anteponer una denuncia a través de la vía judicial para que procedan con la debida investigación. El Sr. Nombre01 debe anteponer la denuncia como afectado directo y testigo ocular del desarrollo de las actividades que denuncia de años previos.” En concordancia con lo expuesto, se trasladó el acta de inspección ocular de 9 de julio 2024, en conjunto con el acta de clausura CLA-UCU-MAZ-1235, en donde se indica la existencia de obras constructivas sin aparente permiso de construcción:
“Resultado: LA OBRA SE ENCUENTRA (TERMINADA), por lo que no se hace entrega del acta de Violación de Sellos/Desobediencia de la Autoridad y se traslada al Departamento Legal. Por construcción de 2 viviendas en block y otra en madera y varios techos en apariencia bodegas. Se realiza la clausura a solicitud de la jefatura, pero las construcciones según el dueño tienen más de 20 años …” Asimismo, se informa a la autoridad jurisdiccional, que, al momento de rendir el presente informe, el proceso especial de construcción sobre la finca indicada anteriormente se encuentra pendiente de trámite y se atenderá oportunamente.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
El recurrente acusa la desatención de las denuncias que formuló ante la Municipalidad y el Área Rectora de Salud, ambas de Santa Ana, por la existencia de un relleno ilegal y movimientos de tierra en un fundo contiguo a su vivienda, en el que además se realizan actividades económicas sin contar con permiso alguno. Ese proceder es contrario a sus derechos fundamentales.
De relevancia para la decisión del presente amparo se tienen por demostrados los siguientes: a) Sobre la Municipalidad de Santa Ana.
Se acreditó que, el 13 de mayo 2024, el recurrente formuló una consulta ante el Proceso de Asesoría Legal Municipal, sobre la Zonificación del Plan Regulador, alegando que no entendía por qué el propietario del plantel de camiones continúa construyendo cuarterías en Zona Agrícola. Se acreditó que, en las inspecciones realizadas por funcionarios municipales se descartó la existencia de un relleno en el lugar denuncias, así como la actividad lucrativa que acusa. En vista de que las reiteradas discrepancias del recurrente, el 19 de junio, el 1 y 7 de octubre de ese mismo año, se inspeccionó nuevamente el sitio denunciado, confirmándose la inexistencia de los hechos planteados. Por lo anterior, mediante correo electrónico de Proceso de Planificación Urbana de esa Municipalidad de las 16:56 horas de 17 de diciembre de 2024 se archivó la denuncia, indicando al recurrente que debía ocurrir a la vía judicial.
En suma, no es que las denuncias del amparado se hayan desatendido, sino que este se encuentra disconforme con la decisión de las autoridades recurridas. De ahí que, descarta la Sala que exista la infracción acusada. Bajo esta inteligencia, se impone desestimar el recurso, como en efecto se dispone.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Notifíquese.
