PJEDITOR Document Case: 25-011090-0007-CO Decision No. 2025016170 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on treinta de mayo de dos mil veinticinco.
Amparo proceeding being heard under case no. 25- 011090-0007-CO, filed by Nombre01, identity card CED02, against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Findings of Fact:
2004-07296 issued at 08 hours and 56 minutes on 02 de julio del 2004, this honorable Court stated: “In any event, the duty to decide does not entail obtaining a favorable or unfavorable response, but it does require consistency between the subject matter of the request and that of the response.” Furthermore, the legal doctrine developed in light of constitutional case law establishes that the right of petition and prompt response (derecho de petición y pronta respuesta) is realized not through the granting of the applicant’s request, but through the Administration’s timely response within a reasonable period; in this respect, the period for responding is strictly related to the particular characteristics and nature of the request, including its complexity and institutional consequences, which under no circumstances may be interpreted as a license to violate the applicant’s fundamental right.
On this matter, Sala Constitucional itself stated in its previously cited judgment No. 2004-03538: “…what is protected is every person’s right to have their case resolved within a reasonable period; that period must be determined in each specific case, taking into account the technical complexity of the administrative matter concerned, the scope of the evidence to be taken, the consequences of the delay for the parties or the degree to which the challenged act affects the person or the environment, the conduct of the litigants and authorities involved, the ordinary guidelines and timeframes for the type of proceeding in question, and the average standard for the resolution of similar matters by authorities in the same field...” Regarding the absence of a violation where the issue is disagreement with the response, Sala Constitucional specifically stated the following in judgment No 2005-03804 issued at 15 hours and 41 minutes on 13 de abril del 2005: “…
With respect to the petitioner’s dissatisfaction, this Sala Constitucional must note that the right established in Article 27 of the Constitución Política refers to the power of every citizen to address any public official or government entity in writing for the purpose of presenting a matter of interest. That guarantee is complemented by the right to obtain a prompt response; however, the latter does not necessarily mean a favorable response. In other words, what is guaranteed is the right to request, not the right to obtain what is requested, even (sic) when the public official must decide in strict accordance with the law, because freedom of petition is based on another principle, namely, that the Administration may not restrict the right of governed persons to address public bodies. In the case under review, the documentation accompanying the filing of the appeal establishes that the Secretario General del Consejo Superior de Educación did respond, by official letter number CSE853-2004 dated 27 de setiembre del 2004, to the application submitted by the petitioner on 1 de julio del 2004, informing him that, according to the records maintained for that purpose by that body, those documents—which were duly listed in that official letter—did not appear in the case file (see folios 5 and 6 of the case file); it therefore follows that, in substance, what exists is the appellant’s disagreement with the response given to his application, rather than a violation of his right to obtain a prompt response…” In summary, the right of petition and response (derecho de petición y respuesta) encompasses, among others, the following elements, which in turn serve as criteria for assessing the Administration’s handling of a matter involving an administered person (administrado) in each specific case: a. The right of petition guarantees the right of governed persons to address public bodies. b. The right of petition does not guarantee that the administered person will obtain what was requested. c. The response provided by the Administration to the administered person must be consistent, meaning that there must be a logical relationship between the subject matter of the request and that of the response.
The case law cited in this amparo appeal (recurso de amparo) demonstrates that, in the case before us, the appellant’s fundamental rights were not violated and that the request made by Mr. Nombre01 was handled by the competent authority. In view of the foregoing, it has been amply demonstrated that, in light of the cited case law, the Administration did not violate the principle of the right to a response set forth in Articles 27 and 41 of the Constitución Política. The documentary evidence submitted in this amparo proceeding (Amparo) demonstrates our Ministerio’s good faith in handling the case. V. PRAYER FOR RELIEF (PETITORIA) Having submitted this report, and given that the appellant’s request has been processed in accordance with what was requested and with the available information, as reflected in the case file, I REQUEST THAT THE RECURSO DE AMPARO filed by Mr. Nombre01, holder of identity card number CED01, processed under case file number 25-011090-0007-CO against the Directora Regional del Área de Conservación la Amistad Caribe and the Coordinador del Programa de Prevención Control y Protección del Área de Conservación Amistad Caribe del Sistema Nacional de Áreas de Conservación, BE DISMISSED. 1. - Declare the appellant’s claims satisfied, given that: a. The required urgent measures have been adopted. b. Protection of the reported ecosystems has been ensured. c. There is full compliance with environmental legal provisions. 2. Order the case file permanently closed, pursuant to Article 44 of the Ley de la Jurisdicción Constitucional, because the alleged violations have been remedied.”
Justice Garita Navarro drafts the opinion; and,
Considering:
I.Subject matter of the proceeding. The claimant (parte accionante) states that on 11 de abril de 2025, he filed an urgent complaint (official letter AEL-00168-2025) with the coordinator of the Programa de Prevención, Control y Protección del ACLAC concerning unauthorized intervention in wetlands and forests in front of the residential development of Cooperativa Coopetrauto R. L. He asserts that the following day he submitted “a request for a follow-up report and urgent action” (official letter AEL-00172-2025) concerning the criminal case against Cooperativa Coopetrauto R. L. for alleged wetland drainage and filling (case file 23-000011-0472-PE). He states that, in response, he received official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025, both dated 22 de abril de 2025; however, the responses are contradictory because they refer to case file 23-000011-0472-PE, even though the complaints concern different events and circumstances and even different properties.
He considers that the foregoing demonstrates an alleged failure to conduct the field inspections essential to verifying the reported facts concerning land-use change, wetland drainage, and filling, which constitutes a violation of the right to a healthy and balanced environment. He seeks the following relief: “1. Admit this amparo proceeding for violation of the fundamental right to a healthy and balanced environment, enshrined in Article 50 of the Constitución Política. 2. Order Eng. Alexis Salas Rodríguez, in his capacity as Coordinator of the Programa de Prevención, Control y Protección del Área de Conservación Amistad Caribe (ACLAC), to immediately conduct the field inspections corresponding to the complaints filed through official letters AEL-00168-2025 and AEL-00172-2025, in order to document the current condition of the areas affected by the alleged wetland drainage and filling and land-use change. 3.
Require the Área de Conservación Amistad Caribe (ACLAC) to submit a detailed report on the actions taken to ensure the protection of the reported wetlands and forests, as well as compliance with the applicable legal provisions. 4. Suspend any activity by Cooperativa Coopetrauto R.L. involving intervention in the reported wetlands and forests until the inspections are conducted and the corresponding liabilities are determined.”
i. The petitioner, by official letter AEL-00168-2025 of 11 de abril de 2025 addressed to the head of Protection and Control of ACLAC, stated: “Re: Urgent complaint concerning improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L. Dear Sir: I am writing to you in your capacity as Head of Protection and Control of the Amistad Caribe Conservation Area (ACLAC) for the purpose of filing a vigorous complaint and requesting your immediate intervention to ensure the protection and restoration of the wetlands and forests located across from the urban development project of Cooperativa Coopetrauto R.L. (legal entity identification number 3-004-727922), in the Santa Rosa sector, province of Limón. It is alarming and extremely serious that, in the context of the announced project for construction of the new Limón Hospital in the Santa Rosa area, activities are being carried out that directly threaten the environmental balance of the area.
In particular, the fragmentation of forests, drainage of wetlands, and felling of trees in the aforementioned area have been verified, actions that flagrantly violate current environmental regulations, including the Organic Law of the Environment (N° 7554), the Ley Forestal (N° 7575), and Costa Rica’s international commitments concerning wetland conservation, such as the Ramsar Convention. Today, we witnessed the presence of a worker carrying out tree-felling activities within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L. Far from being isolated incidents, these activities suggest a clear intention to fragment the forests, alter land use, and drain the wetlands, representing environmental damage that would be difficult or impossible to remedy. Such acts not only jeopardize the biodiversity and ecosystem services of the area, but also affect the fundamental rights of local communities to a healthy and ecologically balanced environment, enshrined in Article 50 of the Political Constitution.
Accordingly, I hereby REQUEST the following immediate actions: 1. The complete cessation of any felling, drainage, or fragmentation activity in the wetlands and forests of the specified sector. 2. An urgent inspection of the affected area by the competent ACLAC authorities, in order to assess the damage caused and determine the corresponding liability. 3. The adoption of effective measures to restore the degraded ecosystems and punish those responsible for these unlawful activities, as established by environmental legislation. 4. The submission of a detailed report on the actions undertaken by your office to address this complaint, within no more than ten business days. Mr. Alexis, your role as Head of Protection and Control imposes upon you the inescapable obligation to ensure the conservation of the natural resources under your jurisdiction. Inaction or delay in this matter would constitute not only a failure to perform your duties, but also an affront to the principles of sustainability and environmental justice that must guide public administration. Without further ado, I reiterate the urgency of your intervention and await any communication.” (Evidence submitted by the petitioner).
ii. The coordinator of ACLAC’s Prevention, Control, and Protection Program, by official letter CARTA-SINAC-ACLAC-PPCP-035-2025 of 22 de abril de 2025 addressed to Nombre01, stated: “SUBJECT: Response to AEL-00168-2025. Dear Mr. Nombre01, In response to the request concerning the complaint filed regarding the impact on the property associated with Cooperativa Coopetrauto R.L, please be advised as follows: • This case has been before the courts since 2023 and is recorded under court case 23-000011-0472-PE. • At the time, an order was issue (sic) to halt any activity affecting the ecological environment of the identified property within the National Wetlands Registry. • SINAC has visited the site for the purpose of reporting its current condition to the Prosecutor’s Office, as well as the failure to comply with the ordered precautionary measures. • The restoration measures must be requested at the appropriate time by the Prosecutor’s Office so that, by order of a judge of the Republic, they may be imposed upon the persons responsible or the representatives of Coopetrauto R.L. • The reports prepared for this case are addressed to the Prosecutor’s Office so that they may be incorporated into the corresponding case file.
We understand your concern regarding the impact on the wetland ecosystem and hereby advise you that this office has performed what the procedures require to identify the unlawful conduct arising from violations of statutory provisions associated with this case.” (Evidence submitted by the petitioner and the respondent authorities).
iii. The coordinator of ACLAC’s Prevention, Control, and Protection Program, by official letter CARTA-SINAC-ACLAC-PPCP-046-2025 of 20 de mayo de 2025 addressed to Nombre01, stated: “SUBJECT: Clarification and expansion of letter AEL-00168-2025. Re: SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025. Dear Sir, In order to expand upon our official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025, in response to your letter AEL-00168-2025, the following clarifying response is provided concerning the four points described: 1. The complete cessation of any felling, drainage, or fragmentation activity in the wetlands and forests of the specified sector. Response/ I advise (sic) you that, upon analyzing and interpreting the location where the reported events occurred, the location provided is unclear and ambiguous, making the meaning of the statements ‘Urgent complaint concerning improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L.’ or ‘we witnessed the presence of a worker carrying out tree-felling activities within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L.’ insufficiently precise.
That is, whether it is across from or adjoining requires greater precision, since those descriptions are contradictory. I advise you that, upon analyzing and interpreting the location where the reported events occurred, the location provided is unclear and ambiguous, making the meaning of the statements ‘Urgent complaint concerning improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L.’ or ‘we witnessed the presence of a worker carrying out tree-felling activities within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L.’ insufficiently precise. We would appreciate it if you would identify more precisely the site you wish to report, so that we have additional information with which to assess whether a new inspection is required, given that the information is currently imprecise, as stated. 2.
An urgent inspection of the affected area by the competent ACLAC authorities, in order to assess the damage caused and determine the corresponding liability. Response/ Although the precise site you wish to report is unavailable, we reiterate that, based on the request made in letter AEL-00168-2025, this office clarifies that, assuming that by stating ‘across from or adjoining’ we should understand that you are referring to the northeastern side of the property involved in the Cooperativa Coopetrauto R.L case (case 23-000011-0472-PE), and in an effort to provide you with information regarding the handling of environmental offenses at the site, the Prevention, Control, and Protection Program of the Amistad Caribe Conservation Area processed the corresponding complaint for harm to the environment, specifically for damage to and modification of the wetland ecosystem present in the area. That complaint corresponds to case number 24-000066-472-PE; accordingly, you are advised as follows: • This case has been before the courts since 2024 and is recorded under court case 24-000066-472-PE. • At the time, an order was issued to halt any activity affecting the ecological environment of the identified property within the National Wetlands Registry and the delineation of new wetland areas. • SINAC has visited the site for the purpose of reporting its current condition to the Prosecutor’s Office, as well as the failure to comply with the ordered precautionary measures. 3.
The adoption of effective measures to restore the degraded ecosystems and punish those responsible for these unlawful activities, as established by environmental legislation. Response/ The restoration measures must be requested at the appropriate time by the Prosecutor’s Office so that, by order of a judge of the Republic, they may be imposed upon the persons responsible for or representatives of the property in question. 4. The submission of a detailed report on the actions undertaken by your office to address this complaint, within no more than ten business days. Response/ The reports prepared for this case are addressed to the Prosecutor’s Office so that they may be incorporated into the corresponding case file. With respect to specific information such as that requested, which is contained in a court case, you are reminded that the provisions of Article 295 of the Code of Criminal Procedure concerning the confidentiality of proceedings must be observed: ‘preliminary proceedings shall not be public for third parties; nevertheless, the proceedings may be examined by the parties or their representatives.
Attorneys who assert a legitimate interest may, after that interest has been verified, be informed of the facts under investigation by the female or male prosecutor of the Public Prosecutor’s Office. Likewise, all parties and officials who participated in the investigation must maintain its confidentiality.’ We understand your concern regarding the impact on the wetland and forest ecosystem and hereby advise you that this office has performed what the procedures require to identify the unlawful conduct arising from violations of statutory provisions associated with this case. You are therefore also requested to submit these environmental complaints through the official SITADA platform so that these offenses can be followed up.” (Evidence submitted by the petitioner and the respondent authorities).
iv. On 19 de mayo de 2025, the respondent authorities were notified that these proceedings had been instituted. (Certificates of service).
v. By official letter AEL-00224-2025 of 20 de mayo de 2025 addressed to the coordinator of the ACLAC Prevention, Control, and Protection Program, the petitioner stated: “Subject: Response to Official Letter CARTA-SINAC-ACLAC-PPCP-046-2025 and Request for Clarification. Dear Sir: I am writing to you in your capacity as Coordinator of the Prevention, Control, and Protection Program of the Área de Conservación Amistad Caribe (SINAC-ACLAC), in response to official letter CARTA-SINAC-ACLAC-PPCP-046-2025, dated 20 de mayo de 2025, addressed to the undersigned, which supplements official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025 concerning my letter AEL-00168-2025 regarding improper interventions in wetlands (humedales) and forests adjacent to the development project of Cooperativa Coopetrauto R.L. I appreciate your response, but I believe that the contents of the official letter do not adequately address the seriousness of the reported environmental violations or meet the level of rigor expected of an official acting as environmental police, serving as the ‘eyes’ of judges and prosecutors in the field.
My observations and requests are detailed below: 1. Inadequate Identification of the Reported Site: Your official letter characterizes the reported location (‘in front of or adjacent to’ the project of Cooperativa Coopetrauto R.L.) as ‘ambiguous,’ which is unjustified given that the references provided are clear. The intervention includes a road that bisects a wetland and large ditches that prevent its restoration, facts not mentioned in your response. I request a comprehensive report, accompanied by satellite photographs, detailing the true factual circumstances surrounding these interventions so that judges and prosecutors may properly assess the situation. 2. Omission of Broader Impacts on the Ecosystem: The official letter disregards the fact that the wetland ecosystem extends beyond the boundaries of the property of Cooperativa Coopetrauto R.L. Furthermore, it does not mention the troubling wetland drainage and filling activity in the area, particularly in light of the potential construction of the future Hospital de Limón.
Inexplicably, these actions have not been investigated by the SINAC-ACLAC authorities, reflecting a passive response that depends exclusively on requests made by interested parties. 3. Lack of Rigor in the Performance of Duties: As Coordinator of the Prevention, Control, and Protection Program, your role requires you to provide the judicial authorities with accurate and complete information. Nevertheless, the official letter does not demonstrate rigorous follow-up concerning the stop-work order (orden de paralización) mentioned in case 24-000066-472-PE, nor does it specify concrete measures for restoring the affected ecosystem. I request that an urgent inspection be conducted in the area and documented with visual and technical evidence in order to ensure compliance with the precautionary measures (medidas cautelares) and assess the damage. 4. Improper Use of Article 295 of the Code of Criminal Procedure (Código Procesal Penal): Invoking Article 295 to restrict the disclosure of information is disproportionate and obstructs transparency.
As the complainant, I have a legitimate interest in learning what actions have been taken, as permitted by that very article. I urge that a detailed and accessible report on the measures taken be provided within no more than ten business days, in compliance with my original request. 5. Use of the SITADA Platform: Although I have been asked to submit complaints through the SITADA platform, this does not relieve SINAC-ACLAC of its responsibility to proactively investigate reported environmental violations, particularly when protected ecosystems such as wetlands are involved. I request clarification regarding how these complaints are being followed up through SITADA and what preventive measures have been implemented in the area. In view of the foregoing, I respectfully request: • The preparation of a detailed report, with satellite and photographic evidence, describing the interventions in the wetland (road, ditches, drains, and fill) and their impact on the ecosystem, including areas beyond the property of Cooperativa Coopetrauto R.L. • An immediate and comprehensive inspection of the affected area, with a clear report on compliance with the precautionary measures in case 24-000066-472-PE. • The adoption of urgent measures to halt any activity that degrades the wetland and to begin restoring the ecosystem, in accordance with environmental legislation. • An accessible report on the actions taken, within ten business days, ensuring transparency and accountability.
I am attaching a copy of my original letter AEL-00168-2025 for your reference. I look forward to your prompt response and concrete action to protect the wetland and forest ecosystems in the area. I remain available to provide any clarification or additional information.” (Evidence submitted by the petitioner).
i. By official letter AEL-00172-2025 of 12 de abril de 2025 addressed to the ACLAC official responsible for Control and Protection, the appellant stated: “Re: Request for a follow-up report and urgent action in the criminal case against Cooperativa Coopetrauto for alleged wetland drainage and filling. Dear Sir: I am writing to you in your capacity as the official responsible for Control and Protection at Área de Conservación Amistad Caribe (ACLAC) to respectfully request a detailed report on the follow-up to the criminal case initiated against Cooperativa Coopetrauto, legal entity identification number 3-004-727922, for the alleged drainage and filling of a wetland at a real estate development located in Santa Rosa, according to cadastral plan (plano catastrado) L-0036944-2023. Because wetlands generally extend beyond the areas where they are located, and considering their ecological importance, I respectfully request that a comprehensive investigation be conducted using historical photographs of the area.
This investigation should cover the history of land-use change (cambio de uso del suelo) both on the property of Cooperativa Coopetrauto and on the parent parcel (finca madre) from which that property was segregated. This information is essential for legal purposes aimed at protecting and restoring the affected wetland. It bears noting that wetlands form part of the State Natural Heritage (Patrimonio Natural del Estado), as established by articles 262 of the Código Civil, 2 of the Ley de Aguas, 13, 14, 15 and 39 subsection i) of the Ley Forestal, 32 and 38 of the Ley Orgánica del Ambiente, and 22 and 28 of the Ley de Biodiversidad. This status prevails even if those areas have been stripped of their original vegetation, further underscoring the need for prompt action. I also reiterate the urgency of your interceding with the Fiscalía, within the scope of your authority, so that immediate protective measures aimed at restoring the wetland may be adopted.
In particular, I request that the drains that were installed be ordered closed to facilitate the ecosystem’s recovery. Judicial proceedings in the ordinary courts commonly take years, which could worsen the environmental damage if prompt action is not taken. Thank you in advance for your attention to this request. Trusting in your commitment to conserving our natural heritage, I look forward to your prompt response.” (Evidence submitted by the petitioner).
ii. By official letter CARTA-SINAC-ACLAC-PPCP-037-2025 of 22 de abril de 2025 addressed to Nombre01, the coordinator of the ACLAC Prevention, Control, and Protection Program stated: “SUBJECT: Response to AEL-00172-2025. Dear Don Nombre01: In response to your request, as indicated in official letter CARTA-SINAC-ACLAC-PPCP-035-2025, with respect to the follow-up being conducted in this matter reported to the Fiscalía de Limón under judicial case 23-000011-0472-PE, the materials requested by that office have been provided as appropriate. In its administrative compliance and its compliance with judicial directives in resolving reported cases, this office respects the manner in which the Ministerio Publico is handling the matter during the adjudication process. Accordingly, I reiterate that the reports prepared for this case are addressed to the Fiscalía so that they may be incorporated into the corresponding case file (expediente).” (Evidence submitted by the petitioner).
With regard to the preventive and precautionary principles (principios preventivo y precautorio), in judgment no. 2021024807 at 9:20 a.m. on 5 de noviembre de 2021, this Chamber clarified:
“In this regard, specialized legal scholarship has indicated that the preventive principle requires that, when there is certainty regarding potential harm to the environment, the harmful activity must be prohibited, restricted, or made subject to compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; likewise, the principle is useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient grounds exist to foresee possible adverse impacts. The precautionary principle, by contrast, provides that where there is a threat of serious and irreversible harm, a lack of absolute scientific certainty shall not be used as a reason to postpone the adoption of cost-effective measures to prevent environmental degradation. It follows from the foregoing that the principle is based on reasonable scientific uncertainty coupled with the threat of serious and irreversible environmental harm.
In general terms, a relevant distinction between the preventive and precautionary principles lies in the level of knowledge and certainty concerning the risks posed by an activity or project. Whereas such certainty exists under the former, under the latter there is a state of doubt arising from scientific information or technical studies (…)” Indeed, the precautionary principle (principio precautorio) must be understood as set forth in Principle XV of the Rio Declaration on Environment and Development: “Where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” That is, scientific studies are not required in order to reach “absolute certainty” that an activity is harmless to the environment (in principle, total certainty is hardly attainable); rather, even if the threat of serious or irreversible environmental damage has not been fully established, such uncertainty may never justify or excuse postponing the implementation of effective measures to prevent environmental degradation.
In this regard, it should be noted, on the one hand, that this does not concern just any type of threat, since it must plausibly involve a serious danger, and, on the other hand, that the measure requires the effective and efficient use of the resources employed. In the sense explained above, although the precautionary principle is linked to a certain degree of scientific uncertainty (incerteza científica), this does not mean that it may be applied without restriction on the argument that any activity could cause environmental damage, which would distort its underlying purpose; rather, there must be some degree of identification of the dangers of serious or irreversible damage that could arise, the determination of which varies according to the particular circumstances of the specific case. Thus, when faced with a situation requiring application of the precautionary principle, public entities and bodies must refrain from authorizing, approving, or permitting any new application or application for modification that reasonably entails a serious risk; they are even required to suspend activities already under way. At the same time, they must efficiently and effectively adopt all measures required to preserve a healthy and ecologically balanced environment.
That principle is likewise embodied in a source of hard law, insofar as Principle 3 of the United Nations Nombre01 Convention on Climate Change—ratified by Costa Rica through law no. 7414 of 13 de junio de 1994 and by all OAS Member States—provides:
“3. The Parties should take precautionary measures to anticipate, prevent, or minimize the causes of climate change and mitigate its adverse effects. Where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing such measures, taking into account that policies and measures to address climate change should be cost-effective so as to ensure global benefits at the lowest possible cost. To this end, such policies and measures should take into account differing socioeconomic contexts, be comprehensive, cover all relevant sources, sinks, and reservoirs of greenhouse gases, and encompass all economic sectors. Efforts to address climate change may be carried out cooperatively by interested Parties.” The precautionary principle is also provided for in the Stockholm Convention on Persistent Organic Pollutants, which has been ratified by 32 OAS Member States, including Costa Rica—see law no. 8538 of 23 de agosto de 2006—which states:
“ARTICLE 1 Objective Mindful of the precautionary approach set forth in Principle 15 of the Rio Declaration on Environment and Development, the objective of this Convention is to protect human health and the environment from persistent organic pollutants (…).” Likewise, this principle is contemplated in the Convention on Biological Diversity, ratified by 34 OAS Member States, including Costa Rica, through law no. 7416 of 30 de junio de 1994, whose preamble provides: “(…) Noting that it is vital to anticipate, prevent, and attack at source the causes of significant reduction or loss of biological diversity. Noting also that where there is a threat of significant reduction or loss of biological diversity, lack of unequivocal scientific evidence should not be invoked as a reason for postponing measures to avoid or minimize such a threat (…).” Consistent with the aforementioned legislation in force in the country, the Inter-American Court of Human Rights also addressed the precautionary principle in Advisory Opinion OC 23/17 of 15 de noviembre de 2017:
“180. (…) Por tanto, this Court understands that States must act in accordance with the precautionary principle in order to protect the rights to life and personal integrity in cases where there are plausible indicators that an activity could cause serious and irreversible harm to the environment, even in the absence of scientific certainty. Por tanto, States must exercise due caution to prevent potential harm. Indeed, in the context of protecting the rights to life and personal integrity, the Court considers that States must act in accordance with the precautionary principle and must therefore, even in the absence of scientific certainty, adopt measures that are ‘effective’ in preventing serious or irreversible harm.” Subsequent to that decision, in a judgment in Indigenous Communities Members of the Lhaka Honhat (Our Land) Association v. Argentina, the Inter-American Court of Human Rights ruled on 6 de febrero de 2020 as follows: “the right to a healthy environment ‘must be deemed included among the rights [...] protected by Article 26 of the American Convention,’ given the obligation of States to achieve the ‘integral development’ of their peoples, arising from Articles 30, 31, 33, and 34 of the Charter.” Of particular significance, it should be emphasized that, in this ruling, the Inter-American Court of Human Rights refers to Advisory Opinion no. OC-23/17 for the purpose of developing the content and scope of that right, as a result of which the legal considerations in the latter have logically acquired the binding legal force inherent in a judgment.
In this regard, the international judicial body reiterates “that the right to a healthy environment ‘constitutes a universal interest’ and ‘is a fundamental right for the existence of humankind,’ and that, ‘as an autonomous right, [...] it protects the components of the [...] environment, such as forests, seas, rivers, and others, as legal interests in themselves, even in the absence of certainty or evidence regarding risk to individual persons. This entails protecting nature,’ not only because of its ‘usefulness’ or ‘effects’ with respect to human beings, ‘but because of its importance to the other living organisms with which the planet is shared.’ The foregoing does not preclude, of course, the possibility that other human rights may be violated as a consequence of environmental damage.” Specifically, in developing the concept of the right to the environment, the Inter-American Court of Human Rights clearly details States’ obligations in the face of potential environmental damage, such as the duty of prevention (deber de prevención), the precautionary principle, the duty to cooperate (obligación de cooperación), and access to information (acceso a la información).
In sum, application of the precautionary principle means that, when there are indicators that a particular activity could plausibly cause serious and irreversible environmental damage, the lack of absolute scientific certainty or evidence in that regard does not relieve the obligation to adopt all efficient and effective measures to prevent a violation of the right to the environment.
As regards the preventive principle (principio preventivo), the first UN report on the status of international environmental law, document A/73/419 of 30 de noviembre de 2018, prepared by its Secretary-General pursuant to the General Assembly resolution of 10 de mayo de 2018 (no. A/72/L.51), conceptualizes it as a normative standard of customary international law “confirmed by relevant practice in numerous environmental treaties and major codification projects.” Although the aforementioned report emphasizes the prevention of transboundary harm (prevención del daño transfronterizo), the fact is that this general principle of law, as properly stated in the document “95 Environmental Legal Principles for Ecologically Sustainable Development” (approved at the XIX Edition of the Ibero-American Judicial Summit—2018—and by the Full Court in Article XIX of session no. 28-2020 of 25 de mayo de 2020), has a much broader scope, since, as a hermeneutic guide (guía hermenéutica), it requires that “the causes and sources of environmental problems be addressed as a priority and in an integrated manner, seeking to prevent the adverse effects that may be produced on the environment.
The prevention criterion shall therefore prevail over any other criterion in the public and private management of the environment and natural resources.” The foregoing is entirely logical, since it is consistent with the duty to prevent environmental damage from materializing and not merely to decide upon reparation for harmful consequences that have already been verified, including by ordering that the harmful effects be halted.
This doctrine (instituto) is reflected, among other provisions, in Articles 194.1 of the United Nations Convention on the Law of the Sea (ratified by Costa Rica through law no. 7291) and 5 and Annex II of the United Nations Fish Stocks Agreement on Straddling and Highly Migratory Fish Stocks (ratified through law no. 8059), as well as in constitutional case law (see judgments nos. 2021024807 at 9:20 hours on 5 de noviembre de 2021 and 2018016383 at 17:00 hours on 28 de setiembre de 2018, among many others) and treaty-based case law, for example, Advisory Opinion no. OC-23/17 of 15 de noviembre de 2017, paragraphs 127 to 174 and subparagraphs a) and b) of paragraph 242, and the judgment of 24 de noviembre de 2022 in Nombre02 v. Chile. Indeed, in the latter, the Inter-American Court of Human Rights expressly states:
“208. Without prejudice to the foregoing, specifically in environmental matters, it should be emphasized that the principle of prevention of environmental damage (principio de prevención de daños ambientales) forms part of customary international law and entails the obligation of States to implement the necessary measures before environmental damage occurs, taking into account that, owing to its particular characteristics, once such damage has occurred it will frequently be impossible to restore the previously existing situation. By virtue of the duty of prevention, the Court has stated that ‘States are required to use all means at their disposal to prevent activities conducted under their jurisdiction from causing significant harm to the […] environment’200. This obligation must be fulfilled under a due-diligence standard (estándar de debida diligencia) that is appropriate and proportional to the degree of risk of environmental damage201.
Furthermore, although it is not possible to provide a detailed enumeration of all the measures that States could take to comply with this duty, certain measures relating to potentially harmful activities may be identified: i) regulation; ii) supervision and oversight; iii) requiring and approving environmental impact assessments (estudios de impacto ambiental); iv) establishing contingency plans (planes de contingencia); and v) mitigation in cases where environmental damage occurs202.” For its part, the in dubio pro natura principle means, according to the ‘World Declaration of the International Union for Conservation of Nature (UICN) on the Environmental Rule of Law,’ that “in cases of doubt, all proceedings before courts, administrative bodies, and other decision-makers shall be resolved in a manner that favors the protection and conservation of the environment, giving preference to the least harmful alternatives. Actions shall not be undertaken when their potential adverse effects are disproportionate or excessive in relation to the benefits derived therefrom” (see Principle V).
In this regard, according to the document ‘95 Environmental Legal Principles for Ecologically Sustainable Development’ (approved at the XIX Edition of the Ibero-American Judicial Summit-2018 and by the Corte Plena in Article XIX of session no. 28-2020 of 25 de mayo de 2020), “Every person applying environmental rules shall always bear in mind the pro natura principle, pursuant to which risks shall be avoided, general collective interests shall take precedence over private interests, preservation of the environment shall be favored, and, in cases of doubt, the interpretation that most broadly protects the environment shall be preferred.” The in dubio pro natura principle, therefore, does not depend on the existence of a risk of serious or irreversible harm—as is the case with the precautionary principle (principio precautorio)—but rather entails a “general rule of conduct governing the relationship of the State—and society in general—with the environment, applicable to every sphere of decision-making in which there is a risk of affecting the environment, and requiring us to refrain from choosing conduct that may cause environmental harm when other options exist” (Olivares and Lucero, 2018).
Furthermore, in Judgment no. 2012013367, issued at 11:33 on 21 de setiembre de 2012, this Constitutional Court addressed the principles of progressive realization (progresividad) and non-regression (no regresión) in environmental matters as follows:
“V. On the principles of progressive realization and non-regression of environmental protection. The principle of progressive realization of human rights has been recognized by International Human Rights Law; among other international instruments, it is enshrined in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights. Under these provisions, the State assumes the obligation to progressively increase, to the extent permitted by its capabilities and development, the levels of human-rights protection, with special consideration for rights that, like the right to the environment (Art. 11 of the Protocol), require multiple affirmative actions by the State for their protection and full enjoyment by all rights-holders.
From the principle of progressive realization of human rights and the principle prohibiting the retroactive application of rules to the detriment of vested rights (derechos adquiridos) and settled legal situations (situaciones jurídicas consolidadas), enshrined in section 34 of the Constitution, derives the principle of non-regression or irreversibility of the benefits or protection attained. This principle constitutes a substantive safeguard of rights—in this case, the right to a healthy and ecologically balanced environment—by virtue of which the State is required not to adopt measures or policies, or enact legal rules, that, without reasonable and proportionate justification, worsen the status of the rights attained up to that point. This principle does not entail absolute irreversibility, because all States experience domestic circumstances of an economic, political, social, or natural character that adversely affect the achievements attained up to that point and require reconsideration of the new level of protection by lowering it.
In such cases, Constitutional Law and the principles under examination require that any reduction in levels of protection be justified in light of the constitutional standards of reasonableness and proportionality. In this regard, the Sala Constitucional has stated in its case law, concerning the right to health: ‘…pursuant to the PRINCIPLE OF NON-REGRESSION, measures that diminish the protection of fundamental rights are prohibited. Thus, if the Costa Rican State, for the purpose of protecting the right to health and the right to life, has a policy of expanding access to medicines, it cannot—and much less through an International Treaty—reduce such access and make it more restrictive under the pretext of protecting trade. (Judgment of the Sala Constitucional No. 9469-07).’ Regarding the right to the environment, it stated: ‘The foregoing constitutes an evolving interpretation of environmental protection in accordance with Constitutional Law, which does not permit regression to its detriment.’ (Judgment of the Sala Constitucional No. 18702-10).” (Emphasis does not appear in the original).
(To the same effect, Judgments 2014-012887, 2017-002375, 2017-005994, 2019-012745, and 2019-017397).” Accordingly, under the principle of progressive realization, the State assumes the obligation to increase, to the extent possible, the levels of human-rights protection, including the right to a healthy and ecologically balanced environment. For its part, application of the principle of non-regression constitutes a safeguard requiring the State to refrain from adopting measures, policies, or rules that, without reasonable and proportionate justification, worsen the level of protection of fundamental rights already attained and, where applicable, requiring the corresponding compensatory measures to be weighed.
Finally, this Court explained the principle of objective grounding of environmental protection (principio de objetivación de la tutela ambiental) in the following terms:
“As regards the environment, the object of the fundamental right described above, our Constitution also requires it to be ‘healthy.’ The requirement that it be ‘healthy’ leads us to ‘regenerative capacity’ and ‘successional capacity’ as means of safeguarding life. From both requirements—‘healthy’ and ‘balanced’—arises the need for sustainable development; quality of life and environmental quality depend upon it. Now, by introducing the concepts of ‘environment,’ ‘healthy,’ and ‘ecologically balanced,’ the constitutional provision incorporated science and technology into environmental decisions, whether legislative or administrative, such that, under sections 16 of the Ley General de la Administración Pública and 38 of the Ley Orgánica del Ambiente, State actions in environmental matters must be grounded in, and may not contradict, the unequivocal rules of science and technology, in order to achieve the full and universal enjoyment of a healthy and ecologically balanced environment, as well as ‘greater well-being for all inhabitants of the country.’ With respect to subjecting legislative and administrative decisions to the unequivocal rules of science and technology, the Sala has termed this the principle of objective grounding of environmental protection: ‘Objective grounding of environmental protection (…) is a principle that cannot in any way be confused with the preceding principle [the precautionary principle or “principle of prudent avoidance”], because, as a principle derived from Articles 16 and 160 of the Ley General de la Administración Pública, it translates into the need to substantiate decision-making in this field through technical studies, with respect both to individual acts and to generally applicable provisions—whether statutory or regulatory—from which arises the requirement of adherence to science and technology, thereby constraining the Administration’s discretion in this field.
Accordingly, based on the results of those technical studies—such as environmental impact studies (estudios de impacto ambiental)—if an objective technical assessment demonstrates the likelihood of manifest harm to the environment, natural resources, or human health, the proposed project, work, or activity must be rejected; and where there is “reasonable doubt,” decisions must be made in favor of the environment (pro natura principle), which may entail the adoption of both compensatory and precautionary measures in order to protect the environment adequately.’ (Judgments of the Sala Constitucional Nos. 21258-10, 17126-06, 14293-05)” (emphasis added). (Decision no. 2012-13367, issued at 11:33 on 21 de setiembre de 2012).
IV.Regarding the specific case. In the case at hand (sub lite), the petitioner states that on 11 de abril de 2025, the petitioner filed an urgent complaint (reclamo urgente) with the coordinator of ACLAC’s Prevention, Control, and Protection Program (official letter AEL-00168-2025) concerning improper intervention in wetlands and forests adjacent to the Cooperativa Coopetrauto R. L. housing development project. The petitioner asserts that, on the following day, a “request for a follow-up report and urgent action” (official letter AEL-00172-2025) was submitted regarding the criminal case against Cooperativa Coopetrauto R. L. for the alleged drainage and filling of wetlands (case file 23-000011-0472-PE). The petitioner states that official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025, both dated 22 de abril de 2025, were received; however, they are contradictory because they refer to case file 23-000011-0472-PE even though the complaints concern different events, with different characteristics, and even different properties.
The petitioner considers that the foregoing evidences an alleged failure to conduct the field inspections essential to verifying the reported events involving land-use change (cambio de uso del suelo) and the drainage and filling of wetlands, which constitutes a violation of the right to a healthy and balanced environment. The petitioner seeks the following relief: “1. Admit this amparo proceeding (recurso de amparo) based on the violation of the fundamental right to a healthy and balanced environment enshrined in Article 50 of the Constitución Política. 2. Order Ing. Alexis Salas Rodríguez, in his capacity as Coordinator of the Prevention, Control, and Protection Program of Área de Conservación Amistad Caribe (ACLAC), to immediately conduct the field inspections corresponding to the complaints submitted through official letters AEL-00168-2025 and AEL-00172-2025, in order to document the current condition of the areas affected by the alleged drainage and filling of wetlands and land-use change. 3.
Require Área de Conservación Amistad Caribe (ACLAC) to provide a detailed report on the actions taken to ensure protection of the reported wetlands and forests, as well as compliance with the applicable legal provisions. 4. Suspend any activity by Cooperativa Coopetrauto R.L. involving intervention in the reported wetlands and forests until the inspections have been conducted and the corresponding liabilities determined.”
In relation to the foregoing, the Sala observes that the petitioner alleges that the complaints concern different events and locations. Consequently, they will be analyzed separately in order to assess ACLAC’s handling of each one.
IV.1. Regarding the request submitted through official letter AEL-00168-2025.
With respect to this issue, the Chamber finds it established that the petitioner, by official letter AEL-00168-2025 of 11 de abril de 2025 addressed to the person in charge of Protection and Control at ACLAC, stated: “Re: Urgent complaint regarding improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L. Dear Sir: I am writing to you in your capacity as Head of Protection and Control for Área de Conservación Amistad Caribe (ACLAC), for the purpose of filing a forceful complaint and requesting your immediate intervention to ensure the protection and restoration of the wetlands and forests located across from the urban development project of Cooperativa Coopetrauto R.L. (legal entity identification number 3-004-727922), in the Santa Rosa sector, province of Limón. It is alarming and extremely serious that, in the context of the announced project to construct the new Hospital de Limón in the Santa Rosa area, activities are being carried out that directly threaten the environmental balance of the area.
In particular, forest subdivision (fraccionamiento), wetland drainage, and tree felling have been confirmed in the aforementioned area, actions that flagrantly violate the environmental regulations currently in force, including the Ley Orgánica del Ambiente (N° 7554), the Ley Forestal (N° 7575), and Costa Rica’s international commitments concerning wetland conservation, such as the Ramsar Convention. Today, we witnessed an operator carrying out tree-felling work within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L. Far from being isolated incidents, these activities suggest a clear intention to subdivide the forests, alter land use (uso del suelo), and drain the wetlands, thereby causing environmental damage that would be difficult or impossible to remedy. Such acts not only jeopardize the area’s biodiversity and ecosystem services, but also affect the fundamental rights of local communities to a healthy and ecologically balanced environment, enshrined in Article 50 of the Constitución Política.
Accordingly, I HEREBY REQUEST the following immediate actions: 1. The complete suspension of any felling, drainage, or subdivision activity in the wetlands and forests of the specified sector. 2. An urgent inspection by the competent ACLAC authorities in the affected area, for the purpose of assessing the damage caused and determining the corresponding liabilities. 3. The adoption of effective measures to restore the degraded ecosystems and sanction those responsible for these unlawful activities, as provided by environmental legislation. 4. The submission of a detailed report on the actions undertaken by your office to address this complaint, within no more than ten business days. Don Alexis, your role as Head of Protection and Control imposes upon you the inescapable obligation to safeguard the conservation of the natural resources under your jurisdiction. Inaction or delay in this matter would constitute not only a failure to perform your duties, but also an affront to the principles of sustainability and environmental justice that must guide public administration.
Without further matters, I reiterate the urgency of your intervention and await any communication.” The coordinator of the ACLAC Prevention, Control, and Protection Program, by official letter CARTA-SINAC-ACLAC-PPCP-035-2025 of 22 de abril de 2025 addressed to Nombre01, stated: “SUBJECT: Response to AEL-00168-2025. Dear Don Nombre01, In response to your request concerning the complaint filed regarding the impact on the property associated with Cooperativa Coopetrauto R.L, you are hereby informed as follows: • This case has been before the courts since 2023 and is recorded as judicial case 23-000011-0472-PE. • At the appropriate time, an order was issue (sic) to suspend any activity affecting the ecological surroundings of the specified property within the Registro Nacional de Humedales. • SINAC has visited the site for the purpose of informing the Prosecutor’s Office of its current condition, as well as of the failure to comply with the ordered precautionary measures (medidas cautelares). • The restoration measures must be requested by the Prosecutor’s Office at the appropriate time so that, by order of a judge of the Republic, they may be imposed upon the responsible parties or representatives of Coopetrauto R.L. • The reports prepared for this case are addressed to the Prosecutor’s Office so that they may be incorporated into the corresponding case file.
We understand your concern regarding the impact on the wetland ecosystem and hereby inform you that this office have (sic) taken the steps required by the applicable procedures to identify the unlawfulness arising from violations of statutory provisions associated with this case.” On 19 de mayo de 2025, the respondent authorities were notified that these proceedings had been instituted. The coordinator of the ACLAC Prevention, Control, and Protection Program, by official letter CARTA-SINAC-ACLAC-PPCP-046-2025 of 20 de mayo de 2025 addressed to Nombre01, stated: “SUBJECT: Clarification and expansion of note AEL-00168-2025. Re: SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025. Dear Sir, For the purpose of expanding upon our official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025, in response to your note AEL-00168-2025, the following clarifying response is provided regarding the four specified points: 1.
The complete suspension of any felling, drainage, or subdivision activity in the wetlands and forests of the specified sector. Response/ I informed (sic) you that, upon analyzing and interpreting the location where the reported events occurred, the location provided appears unclear and ambiguous, making the meaning of the statements ‘Urgent complaint regarding improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L.’ or ‘we witnessed an operator carrying out tree-felling work within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L.’ insufficiently precise. In other words, ‘across from’ and ‘adjoining’ require greater specificity because they are contradictory. I inform you that, upon analyzing and interpreting the location where the reported events occurred, the location provided appears unclear and ambiguous, making the meaning of the statements ‘Urgent complaint regarding improper intervention in wetlands and forests across from the urban development project of Cooperativa Coopetrauto R.L.’ or ‘we witnessed an operator carrying out tree-felling work within a wetland and forest adjoining the urban development project of Cooperativa Coopetrauto R.L.’ insufficiently precise.
We would appreciate it if you would identify the site you wish to report with greater precision, so that we have sufficient information to assess whether a new inspection is required, given that, as stated, the location is currently imprecise. 2. An urgent inspection by the competent ACLAC authorities in the affected area, for the purpose of assessing the damage caused and determining the corresponding liabilities. Response/ Although the precise site you wish to report has not been provided, we reiterate that, in connection with the request made in note AEL-00168-2025, this office clarifies that, assuming that the phrase ‘across from or adjoining’ refers to the northeastern side of the property involved in the Cooperativa Coopetrauto R.L case (case 23-000011-0472-PE), and in an effort to provide you with information regarding the handling of environmental offenses at the site, the Prevention, Control, and Protection Program of Área de Conservación Amistad Caribe processed the corresponding complaint concerning environmental harm, specifically damage to and modification of the wetland ecosystem present in the area.
That complaint corresponds to case number 24-000066-472-PE; accordingly, you are hereby informed as follows: • This case has been before the courts since 2024 and is recorded as judicial case 24-000066-472-PE. • At the appropriate time, an order was issued to suspend any activity affecting the ecological surroundings of the specified property within the Registro Nacional de Humedales and the delineation of new wetland areas. • SINAC has visited the site for the purpose of informing the Prosecutor’s Office of its current condition, as well as of the failure to comply with the ordered precautionary measures. 3. The adoption of effective measures to restore the degraded ecosystems and sanction those responsible for these unlawful activities, as provided by environmental legislation. Response/ The restoration measures must be requested by the Prosecutor’s Office at the appropriate time so that, by order of a judge of the Republic, they may be imposed upon the responsible parties or representatives of the property in question. 4.
The submission of a detailed report on the actions undertaken by your office to address this complaint, within no more than ten business days. Response/ The reports prepared for this case are addressed to the Prosecutor’s Office so that they may be incorporated into the corresponding case file. With respect to specific information such as that requested, which forms part of a judicial case, you are reminded that the provisions of Article 295 of the Código Procesal Penal concerning the confidentiality of proceedings must be observed: ‘the preparatory proceedings shall not be public with respect to third parties; however, the proceedings may be examined by the parties or their representatives. The prosecutor of the Ministerio Público may inform attorneys who invoke a legitimate interest about the facts under investigation after verifying that interest. Likewise, all parties and public officials who participated in the investigation must maintain its confidentiality.’ We understand your concern regarding the impact on the wetland and forest ecosystems and hereby inform you that this office has taken the steps required by the applicable procedures to identify the unlawfulness arising from violations of statutory provisions associated with this case.
You are also requested to submit these environmental complaints through the official SITADA platform so that these offenses may be tracked.” The petitioner, by official letter AEL-00224-2025 of 20 de mayo de 2025 addressed to the coordinator of the ACLAC Prevention, Control, and Protection Program, stated: “Subject: Response to Official Letter CARTA-SINAC-ACLAC-PPCP-046- 2025 and Request for Clarifications. Dear Sir: I am writing to you in your capacity as Coordinator of the Prevention, Control, and Protection Program of Área de Conservación Amistad Caribe (SINAC-ACLAC), in response to official letter CARTA-SINACACLAC-PPCP-046-2025, dated 20 de mayo de 2025 and addressed to the undersigned, which expands upon official letters SINAC-ACLAC-PPCP-035-2025 and SINAC-ACLAC-PPCP-037-2025 in connection with my note AEL-00168- 2025 regarding improper interventions in wetlands and forests adjoining the urban development project of Cooperativa Coopetrauto R.L.
I appreciate your response, but I believe that the contents of the official letter fail to address adequately the seriousness of the reported environmental violations and do not meet the level of rigor expected of an official acting as an environmental police officer and serving as the ‘eyes’ of judges and prosecutors in the field. My observations and requests are detailed below: 1. Insufficient Identification of the Reported Site: Your official letter characterizes the reported location (‘across from or adjoining’ the Cooperativa Coopetrauto R.L. project) as ‘ambiguous,’ which is unjustified because the references provided are clear. The intervention includes a road that divides a wetland and large ditches that prevent its restoration, facts that are not mentioned in your response.
I request a comprehensive report, accompanied by satellite imagery, detailing the true factual circumstances of these interventions so that judges and prosecutors may properly assess the situation. 2. Omission of Broader Ecosystem Impacts: The official letter (oficio) ignores the fact that the wetland ecosystem (ecosistema de humedal) extends beyond the boundaries of the property owned by Cooperativa Coopetrauto R.L. Furthermore, it fails to mention the troubling drainage (drenajes) and wetland-filling (rellenos de humedales) activities in the area, particularly in view of the potential construction of the future Hospital de Limón. Inexplicably, these actions have not been investigated by the SINAC-ACLAC authorities, reflecting a passive response that depends exclusively on requests submitted by interested parties. 3. Lack of Rigor in the Performance of Duties: As Coordinator of the Prevention, Control, and Protection Program (Programa de Prevención, Control y Protección), your role requires you to provide the judicial authorities with accurate and complete information.
However, the official letter provides no evidence of rigorous follow-up regarding the stop-work order (orden de paralización) referenced in case 24-000066-472-PE, nor does it detail specific measures for restoring the affected ecosystem. I request that an urgent inspection be conducted in the area and documented with visual and technical evidence to ensure compliance with the provisional measures (medidas cautelares) and to assess the damage. 4. Improper Use of Article 295 of the Code of Criminal Procedure (Código Procesal Penal): Invoking Article 295 to restrict the disclosure of information is disproportionate and obstructs transparency. As the complainant (denunciante), I have a legitimate interest in learning what actions have been taken, as permitted by that very article. I urge that a detailed and accessible report on the measures taken be provided within no more than ten business days, in compliance with my original request. 5.
Use of the SITADA Platform: Although I am being asked to submit complaints through the SITADA platform, this does not relieve SINAC-ACLAC of its obligation to proactively investigate reported environmental violations, particularly when protected ecosystems such as wetlands are involved. I request clarification regarding how these complaints are being followed up through SITADA and what preventive measures have been implemented in the area. In light of the foregoing, I respectfully request: • The preparation of a detailed report, supported by satellite and photographic evidence, describing the interventions in the wetland (road, ditches, drainage, and filling) and their impact on the ecosystem, including areas beyond the property owned by Cooperativa Coopetrauto R.L. • An immediate and comprehensive inspection of the affected area, together with a clear report on compliance with the provisional measures in case 24-000066-472-PE. • The adoption of urgent measures to halt any activity that degrades the wetland and to begin restoring the ecosystem, in accordance with environmental law. • An accessible report on the actions taken, within ten business days, ensuring transparency and accountability.
I am attaching a copy of my original letter AEL-00168-2025 for your reference. I look forward to your prompt response and concrete action to protect the wetland and forest ecosystems in the area. I remain available to provide any clarification or additional information.” From this perspective, the claim brought by the claimant should be partially granted.
Certainly, ACLAC promptly responded to the first request; however, there is no indication that the reported situation was addressed. Indeed, on April 11, 2025, the petitioner informed that agency of alleged serious harm to the environment, including subdivision (fraccionamiento) of forests, drainage of wetlands, and tree felling; it was even expressly stated that, on that same day, an “operator was carrying out tree-felling work within a wetland and forest.” Notwithstanding the foregoing, the respondent authority merely stated that the case had been before the courts since 2023 and that an order to halt all activity had previously been issued; it further stated that SINAC had visited the site to inform the Prosecutor’s Office of the failure to comply with the precautionary measures (medidas cautelares). Additionally, in connection with this amparo proceeding (recurso de amparo), ACLAC stated that there had been little clarity regarding the reported property and expanded its response concerning the existence of another criminal case instituted in 2024; nevertheless, it once again merely stated that the case was before the courts, that an order to halt activities had also previously been issued, and that the site had been visited to inform the Public Prosecutor’s Office of the failure to comply with the precautionary measures.
It is likewise established that, in both responses, when a detailed account of the actions taken as a result of the complaint was requested, it was explicitly stated that the case reports are forwarded to the Prosecutor’s Office for inclusion in the case file.
Regarding the foregoing, it must be noted that bringing an environmental matter before the courts does not exempt SINAC from exercising the administrative powers conferred upon it by the legal system (provided that doing so neither obstructs the criminal investigation nor decides matters properly reserved for determination therein), without prejudice to subsequently notifying the criminal authorities of any facts it considers relevant. This is particularly true when the complaints invoke some degree of urgency and immediacy, as in the matter under examination (sub examine), where ongoing actions were mentioned (“tree felling within a wetland and forest,” as well as the “drainage of wetlands”) that were allegedly being carried out when the complaint was filed. Accordingly, it is unlawful for ACLAC to adopt a passive and evasive stance (on the grounds that it had reported the facts through criminal channels and issued stop-work orders in prior years), since the administrative complaint itself refers to current circumstances requiring prompt intervention.
Indeed, it should be noted that criminal proceedings do not per se preclude those actions that SINAC may undertake (always within the administrative sphere) to protect the environment, prevent even greater harm, or avert additional adverse effects beyond those already reported to the courts. It should also be noted that the national legal system confers police authority upon officials of the Forestry Administration (Article 54 of the Ley Forestal) and Wildlife inspectors (Article 15 of the Ley de Conservación de la Vida Silvestre). Nor does the foregoing exempt that institution from accounting for its actions to administrative complainants (for example, those public actions concerning the handling of administrative environmental complaints), without prejudice to withholding any data or documents intended for the criminal authorities that are covered by the confidentiality of proceedings provided for in Article 295 of the Código Procesal Penal.
With respect to the case before the Court (sub iudice), the Chamber, in judgment No. 2024004807 at 9:20 a.m. on February 23, 2024, ruled:
“First, the Chamber observes that the request submitted to Sinac describes the harm caused to the ‘humedal laguna Carrizal’ by the construction of infrastructure and the setting of fires, and further requests an investigation into the matters raised and the implementation of control, protection, and enforcement measures; however, that decentralized body of Minae merely conducted an inspection in the area and filed a complaint with the Public Prosecutor’s Office (which did not address all the matters alleged in the petitioner’s request). It should be noted that the ‘Informe por daños al ambiente’ sent to the Prosecutor’s Office referred only to construction and the opening of a road within the protected area (área de protección) of the laguna Carrizal. In any event, once a potentially environmentally significant situation has been identified, Sinac’s actions in the administrative sphere cannot be limited to referring the matter for investigation through criminal proceedings.
Specifically, that agency has the authority to institute proceedings concerning complaints filed for violations of environmental regulations and to issue administrative acts (actos administrativos) to secure compliance with them. Accordingly, the failure to address the substance of the reported situation constitutes a matter of constitutional significance for the purpose of securing the protection afforded by Article 50 of the Constitution.
In relation to the foregoing, the Ley de Biodiversidad provides:
“ARTICLE 22 Sistema Nacional de Áreas de Conservación. The Sistema Nacional de Áreas de Conservación, hereinafter referred to as the System, is hereby created and shall have its own legal personality; it shall be a decentralized and participatory system of institutional management and coordination that integrates powers relating to forestry, wildlife, protected areas, and the Ministerio del Ambiente y Energía, for the purpose of establishing policies and planning and implementing processes aimed at achieving sustainability in the management of Costa Rica’s natural resources. In accordance with the foregoing, the Dirección General de Vida Silvestre, the Administración Forestal del Estado, and the Servicio de Parques Nacionales shall exercise their functions and powers as a single body through the System’s administrative structure, without prejudice to the purposes for which they were established. The System’s powers shall include the protection and conservation of watersheds and water systems.
(…)
ARTICLE 28.- Conservation Areas (Áreas de Conservación). The System shall consist of territorial units known as Conservation Areas, under the general supervision of the Ministerio del Ambiente y Energía through the Consejo Nacional de Áreas de Conservación, with jurisdiction throughout the national territory, whether involving protected wilderness areas, highly fragile areas, or privately owned areas used for economic activities. Each Conservation Area is an administratively delimited territorial unit of the country, governed by a single development and administrative strategy and duly coordinated with the rest of the public sector. In each such area, private and state conservation activities are interrelated without detriment to protected areas. The Conservation Areas shall be responsible for applying the legislation in force concerning natural resources within their geographical boundaries.
They shall implement the policies, strategies, and programs approved by the Consejo Nacional de Áreas de Conservación concerning protected areas; they shall also be responsible for enforcing other laws governing their subject matter, such as the Ley de conservación de la vida silvestre, No. 7317, of October 30, 1992; the Ley Forestal, No. 7575, of February 13, 1996; Ley Orgánica, No. 7554, of October 4, 1995; and the Ley de Creación del Servicio de Parques Nacionales, No. 6084, of August 24, 1977. Based on the Council’s recommendations, the Ministerio del Ambiente y Energía shall define the territorial division that is technically most advisable for the country’s Conservation Areas, as well as any amendments thereto.” Likewise, the Ley de Conservación de Vida Silvestre provides:
“Article 7.- The Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía shall have the following functions in the exercise of its authority:
(*)(Its designation was amended by Article 3 of Law No. 9106 of December 20, 2012; it previously read ‘wild flora and fauna’)
The boundaries of wetlands shall be established by executive decree, in accordance with technical criteria.
(As amended by Article 1 of Law No. 9106 of December 20, 2012).” Additionally, Article 99 of the Ley Orgánica del Ambiente provides:
“Article 99.- Administrative sanctions (sanciones administrativas). In the event of a violation of environmental protection regulations or conduct harmful to the environment that is clearly established in this law, the Public Administration shall apply the following protective measures and sanctions:
These penalties may be imposed on private individuals or public officials for actions or omissions that violate the provisions of this law, other environmental protection provisions, or provisions protecting biological diversity.” Consequently, the petition should be granted with respect to SINAC, so that, irrespective of the referral of the matter to the criminal courts, it may fully examine in administrative proceedings (vía administrativa) the situation reported, in light of the legal system, rule on all the claims raised and, if appropriate, issue the corresponding administrative acts (actos administrativos).
Furthermore, the Municipalidad de Garabito also received the complaint from the petitioner, in which the petitioner requested the intervention of the local government within the scope of its authority, for example, among other matters, concerning municipal permits and the impact of the works on the aforementioned wetland (humedal). However, there is no evidence that, after more than two months, the reported situation had been addressed or that any response had been served. This is particularly significant because, according to the case file, the inspection carried out by the municipal authorities established that no municipal permits existed. Therefore, given the possible impact on the environment, the petition must also be granted against the respondent municipality.
(…)
Por tanto:
The petition is granted. It is ordered: 1) That David Chavarría Morales and Jeffrey Hernández Espinoza, respectively acting executive director and regional director of the Área de Conservación Pacífico Central, both of the Sistema Nacional de Áreas de Conservación, or whoever holds those positions, undertake the necessary coordination, issue the pertinent orders, and carry out all actions within the scope of their authority so that, within a maximum period of ONE MONTH from service of this judgment, the situation reported by the petitioner in the submission dated 25 de octubre de 2023 is fully examined, all the claims raised are resolved and, if appropriate, the administrative acts corresponding to the authority of the Sistema Nacional de Área de Conservación are issued, all of which must be served on the appellant through the means designated for such purposes within the same period granted ut supra. (…)”.
In view of the foregoing considerations and taking into account the precedent cited, this claim must be partially granted under the terms to be set forth in the operative portion (parte dispositiva) of this judgment.
Furthermore, the adoption of measures to restore ecosystems and the imposition of penalties on those responsible for unlawful activities are matters to be adjudicated through ordinary proceedings (vías ordinarias).
Finally, the appellant submitted another request dated 20 de mayo de 2025; however, it was filed while these proceedings were pending, and therefore prima facie any failure to address the new requests made therein is ruled out. Nevertheless, it bears noting that the requested reports “with satellite and photographic evidence describing the interventions in the wetland (…) and their impact on the ecosystem,” which the appellant seeks to have issued in those specific terms, as well as the requested inspection and the resulting report on compliance with precautionary measures (medidas cautelares) ordered in a criminal case, entail the preparation of technical evidence (prueba técnica). Whether such evidence is warranted or whether its nonproduction was improper must be addressed through ordinary proceedings rather than in this constitutional jurisdiction (jurisdicción constitucional).
IV.2. Regarding the request submitted through official letter AEL-00172-2025.
Regarding this claim, the Chamber finds it established that, through official letter AEL-00172-2025 dated 12 de abril de 2025 and addressed to the head of Control y Protección del ACLAC, the appellant stated: “Re: Request for a follow-up report and urgent action in the criminal case against Cooperativa Coopetrauto for the alleged drainage and filling of a wetland. Dear Sir: I hereby write to you in your capacity as Head of Control y Protección of the Área de Conservación Amistad Caribe (ACLAC) to respectfully request a detailed report on the follow-up to the criminal case initiated against Cooperativa Coopetrauto, corporate identification number 3-004-727922, for the alleged drainage and filling of a wetland in a real estate development located in Santa Rosa, according to cadastral plan L-0036944-2023. Given that wetlands often extend beyond the areas where they are located, and considering their ecological importance, I respectfully request that a comprehensive investigation be conducted using historical photographs of the area.
This investigation should cover the history of land-use change (cambio de uso del suelo) both on the property of Cooperativa Coopetrauto and on the parent parcel (finca madre) from which that property was segregated. This information is essential for legal measures aimed at protecting and restoring the affected wetland. It should be noted that wetlands form part of the Patrimonio Natural del Estado, as established in Articles 262 of the Código Civil, 2 of the Ley de Aguas, 13, 14, 15 and 39 subsection i) of the Ley Forestal, 32 and 38 of the Ley Orgánica del Ambiente, and 22 and 28 of the Ley de Biodiversidad. This status prevails even if those areas have been stripped of their original vegetation, which underscores the need to act promptly. I also reiterate the urgency of having you, within the scope of your authority, intercede with the Fiscalía so that immediate protective measures aimed at restoring the wetland are adopted.
In particular, I request that the closure of the drainage channels be ordered to facilitate the ecosystem’s recovery. Judicial proceedings in the ordinary courts often continue for years, which could exacerbate the environmental damage if prompt action is not taken. Thanking you in advance for your attention to this request and trusting in your commitment to conserving our natural heritage, I look forward to your prompt response.” Through official letter CARTA-SINAC-ACLAC-PPCP-037-2025 dated 22 de abril de 2025 and addressed to Nombre01, the coordinator of the ACLAC Prevention, Control and Protection Program stated: “SUBJECT: Response to AEL-00172-2025. Dear Mr. Nombre01, In response to your request, as indicated in official letter CARTA-SINAC-ACLAC-PPCP-035-2025, with respect to the follow-up being conducted in this case, which was reported to the Fiscalía de Limón under judicial case 23-000011-0472-PE, the materials requested by that authority have been provided as appropriate.
In complying with administrative and judicial requirements in resolving reported cases, this office respects the follow-up undertaken by the Ministerio Publico in its resolution process. Accordingly, we reiterate that the reports prepared for this case are addressed to the Fiscalía so that they may be incorporated into the corresponding case file.” In this regard, the Chamber observes that what the appellant requested was “a detailed report on the follow-up to the criminal case initiated against Cooperativa Coopetrauto and urgent actions in the criminal case (…) for the alleged drainage and filling of a wetland,” as well as “a comprehensive investigation using historical photographs of the area (…). This investigation should cover the history of land-use change both on the property of Cooperativa Coopetrauto and on the parent parcel from which that property was segregated.” The appellant likewise requested that ACLAC “intercede with the Fiscalía so that immediate protective measures aimed at restoring the wetland are adopted” and also that “the closure of the drainage channels be ordered to facilitate the ecosystem’s recovery.” In this respect, it is important to emphasize that this request differs substantially from the one addressed in the preceding recital (considerando), since it did not refer to any environmental harm already underway but instead discussed the “alleged” drainage and filling of a wetland that had occurred.
As stated ut supra, the requested adoption of measures for ecosystem restoration is, in principle, a matter to be adjudicated through ordinary proceedings. Likewise, the request for reports “for legal purposes,” along with the specific material requested for inclusion, such as “historical photographs (…) history of land-use change,” entails the preparation of technical evidence, and whether such evidence is warranted or whether its nonproduction was improper must be addressed through ordinary proceedings rather than in this constitutional jurisdiction. The petitioner even asked ACLAC, in the request at issue, to intercede with the Fiscalía so that measures would be taken and the closure of the drainage channels ordered. However, in principle, these matters must be adjudicated in criminal proceedings (vía penal), according to the particular circumstances of the specific case. Accordingly, as this request was framed, no action or omission warranting the Chamber’s intervention is apparent. Ergo, this claim is denied.
V.Dissenting opinion (voto salvado) of Justice Salazar Alvarado. With due respect, I dissent from the majority opinion granting the petition, for the following reasons:
The protection of a healthy and ecologically balanced environment, under the Costa Rican legal system, is safeguarded not only by Article 50 of the Political Constitution, but also by a series of laws and executive decrees (regulations) currently in force, such as the Organic Environmental Law, Ley N° 7554 de 4 de octubre de 1995; the Biodiversity Law, Ley N° 7788 de 30 de abril de 1998; the Wildlife Conservation Law, Ley N° 7317 de 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, General Regulations on Environmental Impact Assessment Procedures (Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, EIA), to name only a few. This makes it necessary, in environmental matters, to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, it is the opinion of the undersigned that this Chamber, through an amparo proceeding (recurso de amparo), should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and when the violation of that right is manifest and evident, readily ascertainable, of a certain importance or seriousness, and directly affects a specific person or community.
Otherwise, the matter must be raised and litigated through the ordinary legality-review process. Therefore, the mere breach of obligations and duties legally imposed on the various public administrations in environmental matters is properly heard through the administrative or judicial legality-review process, where the alleged breaches or omissions may be examined much more thoroughly. It must be borne in mind that an amparo proceeding is summary, informal, simple, and expeditious; consequently, from the very moment the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding involving the issuance of administrative acts (actos administrativos), review of that matter falls outside the jurisdiction of this specialized court. Accordingly, review of administrative actions undertaken in connection with an environmental matter that, for proper evaluation, requires full proceedings on the merits (proceso de conocimiento pleno) is possible only in the ordinary courts, because the design of the amparo proceeding is incompatible with comparing or reviewing technical or legal criteria developed pursuant to the laws or regulations in force, or with obtaining additional and more extensive evidence needed to compare or review the criteria already contained in the administrative record (expediente administrativo) for the case.
Any other approach would transform the amparo proceeding into ordinary proceedings involving full adjudication of the merits, thereby distorting its nature and frustrating the purposes for which it was designed, with the result that it would lose its status as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I find that when a public entity or body has intervened in various ways or has issued administrative acts concerning an environmental matter, its review and oversight fall within the jurisdiction of the contentious-administrative courts (jurisdicción de lo contencioso-administrativo). It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of the legality-review process. Consequently, this appeal should have been summarily dismissed, since its subject matter is an issue properly litigated, analyzed, and decided through the legality-review process.
However, because that was not done, the appropriate course is to deny the appeal without making any ruling on the merits of the issue raised, since it falls to the ordinary courts—specifically, the contentious-administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the legal system at the statutory level regarding the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.
VI.Documentation submitted for the case file. This Chamber must advise the petitioner that, if any document has been submitted, whether on paper, as well as any objects or evidence stored on any additional device or on electronic, computerized, magnetic, optical, or telematic media, or produced using new technologies, they must be retrieved from the Court’s offices within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 del 22 de agosto de 2011, artículo XXVI and published in Boletín Judicial número 19 del 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
The appeal is partially granted. Maylin Mora Arias and Alexis Salas Rodríguez, respectively acting regional director and person in charge of the Control y Protección program, both of the Área de Conversación Amistad Caribe del Sistema Nacional de Área de Conservación, or whoever holds those positions, are ordered to undertake the necessary coordination, issue the pertinent orders, and carry out all actions within the scope of their authority so that, within a maximum period of ONE MONTH from notice of this judgment, the situation described by the petitioner in the submission of 11 de abril de 2025 (oficio AEL-00168-2025) is fully analyzed and the relevant issues concerning the reported ongoing activities of “logging, drainage, or subdivision (fraccionamiento) in wetlands and forests” are resolved; furthermore, if appropriate, the administrative acts falling within the jurisdiction of the Sistema Nacional de Área de Conservación shall be issued.
Notice of all the foregoing must be given to the petitioner through the means designated for that purpose within the same period granted ut supra. The respondent authorities are advised that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined an amount equivalent to twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Sistema Nacional de Área de Conservación is ordered to pay the legal costs and the damages and losses caused by the events underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the contentious-administrative courts. In all other respects, the appeal is denied.
Justice Salazar Alvarado dissents and would deny the appeal because it falls to the ordinary courts—specifically, the contentious-administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the legal system at the statutory level regarding the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment. Documento PJEDITOR SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta de mayo de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente nro. 25- 011090-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Resultando:
Redacta el Magistrado Garita Navarro; y,
Considerando:
I.Objeto del recurso. La parte accionante indica que el 11 de abril de 2025 formuló ante el coordinador del programa de Prevención, Control y Protección del ACLAC un reclamo urgente (oficio AEL-00168-2025), por la intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R. L. Asevera que al día siguiente planteó una “una solicitud de informe de seguimiento y acciones urgentes” (oficio AEL-00172-2025) con respecto a la causa penal contra la Cooperativa Coopetrauto R. L. por presunto drenaje y relleno de humedales (expediente 23-000011-0472-PE). Menciona que en respuesta recibió los oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, ambas de 22 de abril de 2025; sin embargo, las contestaciones son contradictorias, ya que hacen referencia al expediente 23-000011-0472-PE, pese a que las denuncias corresponden a hechos distintos y características diferentes e, incluso, en propiedades distintas.
Considera que lo anterior evidencia una presunta omisión en la realización de las visitas de campo indispensables para verificar los hechos denunciados, relacionados con el cambio de uso del suelo, drenaje y relleno de humedales, lo cual constituye una violación al derecho a un ambiente sano y equilibrado. Formula la siguiente pretensión: “1. Admitir el presente recurso de amparo por la violación al derecho fundamental a un ambiente sano y equilibrado, consagrado en el artículo 50 de la Constitución Política. 2. Ordenar al Ing. Alexis Salas Rodríguez, en su calidad de Coordinador del Programa de Prevención, Control y Protección del Área de Conservación Amistad Caribe (ACLAC), realizar de inmediato las inspecciones de campo correspondientes a las denuncias presentadas en los oficios AEL-00168-2025 y AEL-00172-2025, a fin de documentar la situación actual de las zonas afectadas por el presunto drenaje, relleno de humedales y cambio de uso del suelo. 3.
Requerir al Área de Conservación Amistad Caribe (ACLAC) un informe detallado sobre las acciones tomadas para garantizar la protección de los humedales y bosques denunciados, así como el cumplimiento de las disposiciones legales aplicables. 4. Suspender cualquier actividad de la Cooperativa Coopetrauto R.L. que implique intervención en los humedales y bosques denunciados, hasta que se realicen las inspecciones y se determinen las responsabilidades correspondientes”.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
i. El accionante, mediante oficio AEL-00168-2025 de 11 de abril de 2025 dirigido al encargado de Protección y Control del ACLAC, indicó: “Ref: Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L. Estimado señor: Me dirijo a usted en su calidad de Encargado de la Protección y Control del Área de Conservación Amistad Caribe (ACLAC), con el propósito de formular un enérgico reclamo y solicitar su inmediata intervención para garantizar la protección y restauración de los humedales y bosques ubicados frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L. (cédula jurídica 3-004-727922), en el sector de Santa Rosa, provincia de Limón. Resulta alarmante y de suma gravedad que, en el contexto del anunciado proyecto de construcción del nuevo Hospital de Limón en la zona de Santa Rosa, se estén llevando a cabo actividades que atentan directamente contra el equilibrio ambiental de la zona.
En particular, se ha constatado el fraccionamiento de bosques, el drenaje de humedales y la tala de árboles en el área antes mencionada, acciones que contravienen flagrantemente la normativa ambiental vigente, incluyendo la Ley Orgánica del Ambiente (N° 7554), la Ley Forestal (N° 7575) y los compromisos internacionales de Costa Rica en materia de conservación de humedales, como la Convención Ramsar. El día de hoy, hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L. Estas actividades, lejos de ser hechos aislados, sugieren una clara intención de fraccionar los bosques, alterar el uso del suelo y drenar los humedales, lo que representa un daño ambiental de difícil o imposible reparación. Tales actos no solo comprometen la biodiversidad y los servicios ecosistémicos de la zona, sino que también afectan los derechos fundamentales de las comunidades locales a un ambiente sano y ecológicamente equilibrado, consagrados en el artículo 50 de la Constitución Política.
En consecuencia, SOLICITO de manera inmediata las siguientes acciones: 1. La paralización total de cualquier actividad de tala, drenaje o fraccionamiento en los humedales y bosques del sector señalado. 2. Una inspección urgente por parte de las autoridades competentes de ACLAC en el área afectada, con el fin de evaluar los daños ocasionados y determinar las responsabilidades correspondientes. 3. La adopción de medidas efectivas para la restauración de los ecosistemas degradados y la sanción de los responsables de estas actividades ilícitas, conforme lo establece la legislación ambiental. 4. La presentación de un informe detallado sobre las acciones emprendidas por su oficina para atender esta denuncia, en un plazo no mayor a diez días hábiles. Don Alexis, su rol como Encargado de la Protección y Control le impone la ineludible obligación de velar por la conservación de los recursos naturales bajo su jurisdicción.
La inacción o demora en este asunto sería no solo una omisión de sus deberes, sino también una afrenta a los principios de sostenibilidad y justicia ambiental que deben guiar la gestión pública. Sin otro particular, le reitero la urgencia de su intervención y quedo atento a cualquier comunicación.” (Prueba aportada por la parte accionante).
ii. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-035-2025 de 22 de abril de 2025 dirigido a Nombre01, consignó: “ASUNTO: Respuesta AEL-00168-2025. Estimada Don Nombre01, En atención a lo solicitado con respecto a la denuncia realizada por la afectación de la propiedad asociada a la Cooperativa Coopetrauto R.L, se informa lo siguiente: • Este caso actualmente se encuentra judicializado desde el 2023, en donde consta en la causa judicial 23-000011-0472-PE. • En su momento, se giro (sic) una orden de paralización de cualquier actividad que afectara el entorno ecológico de la propiedad señalada dentro del Registro Nacional de Humedales. • Por parte del SINAC, el sitio ha sido visitado, con el propósito de informar a la Fiscalía el estado actual, así como el incumplimiento de las medidas cautelares ordenadas. • Las medidas de restauración deberán ser solicitadas en su momento por la fiscalía, para que, por orden de un juez de la república, se le impongan a los responsables o representantes de Coopetrauto R.L. • Los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente.
En comprensión por su preocupación por la afectación al ecosistema de humedal, se le informa que esta dependencia a realizado lo que los procedimientos requieren para identificar la ilegalidad por afectación a artículos de ley asociados a este caso”. (Prueba aportada por la parte accionante y las autoridades recurridas).
iii. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-046-2025 de 20 de mayo de 2025 dirigido a Nombre01, indicó: “ASUNTO: Aclaración y ampliación nota AEL-00168-2025. Ref. SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025. Estimado señor, A efectos de ampliar nuestros oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, en respuesta a su nota AEL-00168-2025, se le remite la siguiente respuesta aclaratoria, para los cuatro puntos detallados: 1. La paralización total de cualquier actividad de tala, drenaje o fraccionamiento en los humedales y bosques del sector señalado. R/ Le indicó (sic) que en el análisis e interpretación de la ubicación de donde ocurre lo denunciado, resulta con poca claridad y ambiguo la ubicación brindada, siendo esto poco preciso en la interpretación de lo indicado “Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L.” o “hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L.”.
Es decir, al frente o colindante requiere de mayor exactitud puesto que resultan contradictorios. Le indico que en el análisis e interpretación de la ubicación de donde ocurre lo denunciado, resulta con poca claridad y ambigua la ubicación brindada, siendo esto poco preciso en la interpretación de lo indicado “Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L.” o “hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L.”. Agradecemos nos brinde el sitio que usted desea reportar con mayor precisión, de manera que contemos con mayores herramientas para valorar si es requerido una nueva inspección, dado que, como se indica en este momento resulta inexacta. 2. Una inspección urgente por parte de las autoridades competentes de ACLAC en el área afectada, con el fin de evaluar los daños ocasionados y determinar las responsabilidades correspondientes.
R/ A pesar de que no se cuenta con exactitud el sitio que desea reportar, le reiteramos que en función a lo solicitado en la nota AEL-00168-2025, se aclara que esta dependencia, asumiendo que al indicar “frente o colindante” interpretemos que hace referencia al costado noreste de la propiedad donde se lleva el caso de la Cooperativa Coopetrauto R.L (causa 23-000011-0472-PE); siendo así, y con el afán de facilitarle información respecto de las atenciones en cuanto a delitos ambientales en el sitio, desde las acciones del Programa de Prevención Control y Protección del Área de Conservación Amistad Caribe, se tramitó la correspondiente denuncia por afectación al medio ambiente específicamente por el daño y modificación del ecosistema de humedal presente en la zona, dicha denuncia responde al número de causa 24-000066-472-PE, por lo que se informa lo siguiente: • Este caso actualmente se encuentra judicializado desde el 2024, en donde consta en la causa judicial 24-000066-472-PE. • En su momento, se giró una orden de paralización de cualquier actividad que afectara el entorno ecológico de la propiedad señalada dentro del Registro Nacional de Humedales y la determinación de nuevas áreas de humedal. • Por parte del SINAC, el sitio ha sido visitado, con el propósito de informar a la Fiscalía el estado actual, así como el incumplimiento de las medidas cautelares ordenadas. 3.
La adopción de medidas efectivas para la restauración de los ecosistemas degradados y la sanción de los responsables de estas actividades ilícitas, conforme lo establece la legislación ambiental. R/ Las medidas de restauración deberán ser solicitadas en su momento por la fiscalía, para que, por orden de un juez de la república, se le impongan a los responsables o representantes de la propiedad en cuestión. 4. La presentación de un informe detallado sobre las acciones emprendidas por su oficina para atender esta denuncia, en un plazo no mayor a diez días hábiles. R/ Los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente. Se le recuerda en cuanto a información específica como la solicitada, que consta en una causa judicial, se debe respetar lo indicado en el Artículo 295 del Código Procesal Penal en cuanto a la privacidad de las actuaciones: “el procedimiento preparatorio no será público para terceras personas, no obstante, las actuaciones pueden ser examinadas por las partes o sus representantes.
A las personas abogadas que invoquen un interés legítimo, la fiscala o el fiscal del Ministerio Público, luego de constatar ese interés, puede informar acerca de los hechos que se investigan. Así mismo, todas las partes y personas funcionarias que participaron en la investigación deben guardar secreto sobre la misma”. En comprensión por su preocupación por la afectación al ecosistema de humedal y forestal, se le informa que esta dependencia ha realizado lo que los procedimientos requieren para identificar la ilegalidad por afectación a artículos de ley asociados a este caso. Por lo que también se le solicita realizar estas denuncias ambientales en la plataforma oficial SITADA, de manera que se le pueda dar seguimiento a estos delitos”. (Prueba aportada por la parte accionante y las autoridades recurridas).
iv. El 19 de mayo de 2025, las autoridades recurridas fueron notificadas del curso de este proceso. (Actas de notificación).
v. El accionante, por oficio AEL-00224-2025 de 20 de mayo de 2025 dirigido al coordinador del programa de Prevención, Control y Protección del ACLAC, expuso: “Asunto: Respuesta al Oficio CARTA-SINAC-ACLAC-PPCP-046- 2025 y Solicitud de Aclaraciones Estimado señor: Me dirijo a usted en su calidad de Coordinador del Programa de Prevención, Control y Protección del Área de Conservación Amistad Caribe (SINAC-ACLAC), en respuesta al oficio CARTA-SINAC-ACLAC-PPCP-046-2025, de fecha 20 de mayo de 2025, dirigido al suscrito, que amplía los oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, en relación con mi nota AEL-00168- 2025 sobre intervenciones indebidas en humedales y bosques colindantes al proyecto urbanístico de la Cooperativa Coopetrauto R.L. Agradezco su respuesta, pero considero que el contenido del oficio no aborda adecuadamente la gravedad de las violaciones ambientales denunciadas ni cumple con el nivel de rigurosidad esperado de un funcionario que actúa como policía ambiental, sirviendo como los “ojos” de jueces y fiscales en el campo.
A continuación, detallo mis observaciones y solicitudes: 1. Insuficiencia en la Identificación del Sitio Denunciado: Su oficio califica de “ambigua” la ubicación reportada (“frente o colindante” al proyecto de la Cooperativa Coopetrauto R.L.), lo que resulta injustificado dado que las referencias proporcionadas son claras. La intervención incluye una carretera que divide un humedal y zanjas de gran tamaño que impiden su restauración, hechos que no se mencionan en su respuesta. Solicito un informe exhaustivo, acompañado de fotografías satelitales, que detalle el verdadero cuadro fáctico de estas intervenciones, permitiendo a jueces y fiscales evaluar adecuadamente la situación. 2. Omisión de Impactos Más Amplios en el Ecosistema: El oficio ignora que el ecosistema de humedal trasciende los límites de la propiedad de la Cooperativa Coopetrauto R.L. Además, no se menciona la preocupante actividad de drenajes y rellenos de humedales en la zona, especialmente ante la eventual construcción del futuro Hospital de Limón.
Estas acciones, de manera inexplicable, no han sido investigadas por las autoridades de SINAC-ACLAC, lo que refleja una reacción pasiva que depende exclusivamente de gestiones de parte. 3. Falta de Rigor en el Cumplimiento de Funciones: Como Coordinador del Programa de Prevención, Control y Protección, su rol exige proporcionar a las autoridades judiciales información precisa y completa. Sin embargo, el oficio no evidencia un seguimiento riguroso a la orden de paralización mencionada en la causa 24-000066-472-PE, ni detalla medidas concretas para la restauración del ecosistema afectado. Solicito que se realice una inspección urgente en el área, documentada con evidencia visual y técnica, para garantizar el cumplimiento de las medidas cautelares y evaluar los daños. 4. Uso Inapropiado del Artículo 295 del Código Procesal Penal: La invocación del Artículo 295 para limitar la entrega de información resulta desproporcionada y obstaculiza la transparencia.
Como denunciante, tengo un interés legítimo en conocer las acciones emprendidas, conforme lo permite el propio artículo. Insto a que se proporcione un informe detallado y accesible sobre las medidas tomadas, en un plazo no mayor a diez días hábiles, en cumplimiento de mi solicitud original. 5. Uso de la Plataforma SITADA: Si bien se me solicita presentar denuncias a través de la plataforma SITADA, esto no exime a SINAC-ACLAC de investigar proactivamente las violaciones ambientales reportadas, especialmente cuando se trata de ecosistemas protegidos como los humedales. Solicito que se aclare cómo se está dando seguimiento a estas denuncias en SITADA y qué medidas preventivas se han implementado en la zona. En virtud de lo anterior, respetuosamente solicito: • La elaboración de un informe detallado, con evidencia satelital y fotográfica, que describa las intervenciones en el humedal (carretera, zanjas, drenajes, y rellenos) y su impacto en el ecosistema, incluyendo áreas más allá de la propiedad de la Cooperativa Coopetrauto R.L. • Una inspección inmediata y exhaustiva en el área afectada, con un reporte claro sobre el cumplimiento de las medidas cautelares de la causa 24-000066-472-PE. • La adopción de medidas urgentes para detener cualquier actividad que degrade el humedal y para iniciar la restauración del ecosistema, conforme a la legislación ambiental. • Un informe accesible sobre las acciones emprendidas, dentro de un plazo de diez días hábiles, que garantice transparencia y rendición de cuentas.
Adjunto una copia de mi nota original AEL-00168-2025 para su referencia. Espero su pronta respuesta y acciones concretas para proteger los ecosistemas de humedal y bosque en la zona. Quedo a su disposición para cualquier aclaración o información adicional”. (Prueba aportada por la parte accionante).
i. El recurrente, por oficio AEL-00172-2025 de 12 de abril de 2025 dirigido al encargado de Control y Protección del ACLAC, señaló: “Ref: Solicitud de informe de seguimiento y acciones urgentes en la causa penal contra la Cooperativa Coopetrauto por presunto drenaje y relleno de humedal Estimado señor: Por medio de la presente, me dirijo a usted en su calidad de Encargado de Control y Protección del Área de Conservación Amistad Caribe (ACLAC), con el propósito de solicitar respetuosamente un informe detallado sobre el seguimiento a la causa penal iniciada contra la Cooperativa Coopetrauto, cédula jurídica 3-004-727922, por el presunto drenaje y relleno de un humedal en un proyecto inmobiliario ubicado en Santa Rosa, según el plano catastrado L-0036944-2023. Dado que los humedales suelen trascender las áreas donde se localizan y considerando su importancia ecológica, solicito de manera respetuosa que se realice una investigación exhaustiva utilizando fotografías históricas de la zona.
Esta investigación debería abarcar los antecedentes de cambio de uso del suelo tanto de la propiedad de la Cooperativa Coopetrauto como de la finca madre de la cual fue segregada dicha propiedad. Esta información es fundamental para efectos legales orientados a la protección y restauración del humedal afectado. Cabe destacar que los humedales forman parte del Patrimonio Natural del Estado, conforme lo establecen los artículos 262 del Código Civil, 2 de la Ley de Aguas, 13, 14, 15 y 39 inciso i) de la Ley Forestal, 32 y 38 de la Ley Orgánica del Ambiente, y 22 y 28 de la Ley de Biodiversidad. Este carácter prevalece incluso si dichas áreas han sido desprovistas de su vegetación original, lo que refuerza la necesidad de actuar con celeridad. Asimismo, reitero la urgencia de que, en el ámbito de sus competencias, interceda ante la Fiscalía para que se adopten medidas inmediatas de protección orientadas a la restauración del humedal.
En particular, solicito que se ordene el cierre de los drenajes realizados, con el fin de propiciar la recuperación del ecosistema. Los procesos judiciales en la vía ordinaria suelen prolongarse por años, lo que podría agravar el daño ambiental si no se toman acciones prontas. Agradeciendo de antemano su atención a esta solicitud y confiando en su compromiso con la conservación de nuestro patrimonio natural, quedo a la espera de su pronta respuesta”. (Prueba aportada por la parte accionante).
ii. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-037-2025 de 22 de abril de 2025 dirigido a Nombre01, refirió: “ASUNTO: Respuesta AEL-00172-2025. Estimada Don Nombre01, En atención a lo solicitado, como se indicó en el oficio CARTA-SINAC-ACLAC-PPCP-035-2025, el seguimiento que se lleva sobre esta causa denunciada ante la Fiscalía de Limón, bajo la causa judicial 23-000011-0472-PE, se ha entregado lo requerido a esa instancia según como ha correspondido. En el cumplimiento administrativo y del orden judicial en resolución de los casos denunciados, esta dependencia es respetuosa del seguimiento que esta lleva en el proceso de resolución por parte del Ministerio Publico. Por lo que se le reitera que los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente”. (Prueba aportada por la parte accionante).
Concerniente a los principios preventivo y precautorio, en la sentencia nro. 2021024807 de las 9:20 horas del 5 de noviembre de 2021, esta Sala precisó:
“En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos. Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente.
De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos (…)” Justamente, el principio precautorio debe ser entendido como se contempla en el principio XV de la Declaración de Río sobre el Medio Ambiente y el Desarrollo: “Cuando haya peligro de daño grave o irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”.
Es decir, no se trata de la exigencia de tener estudios científicos para arribar a la ‘certeza absoluta’ de la inocuidad de una actividad para con el ambiente (en tesis de principio una seguridad total difícilmente es alcanzable), sino, más bien, de que, aunque el peligro de un daño grave o irreversible al ambiente no esté del todo asegurado, tal incertidumbre jamás justificará ni excusará que se postergue la ejecución de medidas efectivas para impedir la degradación del ambiente. Al respecto, obsérvese, por un lado, que no se está ante cualquier tipo de amenaza, pues plausiblemente debe involucrar un peligro serio, y, por otro, que la medida demanda un uso eficaz y eficiente de los recursos empleados. En el sentido expuesto, aun cuando el principio precautorio está ligado a un cierto nivel de incerteza científica, ello no implica que se pueda emplear de forma irrestricta con el argumento de que cualquier actividad podría generar daños al ambiente lo que desnaturalizaría su razón de ser, sino que es menester que se cuente con cierto grado de identificación de los peligros de un daño grave o irreversible que se podría generar, cuya determinación varía en atención de las particularidades propias del caso concreto.
Así, cuando se está ante una situación que exige la aplicación del principio precautorio, los entes y órganos públicos deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación que razonablemente conlleve un riesgo grave; incluso, se encuentran obligados a suspender las actividades que se estén desarrollando. Paralelamente tienen que adoptar con eficiencia y efectividad todas las medidas requeridas para la preservación de un ambiente sano y ecológicamente equilibrado.
El referido principio se recoge de igual modo en una fuente jurídica del hard law, toda vez que el principio 3 de la Convención Nombre01 de las Naciones Unidas sobre el Cambio Climático ratificada por Costa Rica mediante la ley nro. 7414 del 13 de junio de 1994 y por todos los estados miembros de la OEA- estatuye:
“3. Las Partes deberían tomar medidas de precaución para prever, prevenir o reducir al mínimo las causas del cambio climático y mitigar sus efectos adversos. Cuando haya amenaza de daño grave o irreversible, no debería utilizarse la falta de total certidumbre científica como razón para posponer tales medidas, teniendo en cuenta que las políticas y medidas para hacer frente al cambio climático deberían ser eficaces en función de los costos a fin de asegurar beneficios mundiales al menor costo posible. A tal fin, esas políticas y medidas deberían tener en cuenta los distintos contextos socioeconómicos, ser integrales, incluir todas las fuentes, sumideros y depósitos pertinentes de gases de efecto invernadero y abarcar todos los sectores económicos. Los esfuerzos para hacer frente al cambio climático pueden llevarse a cabo en cooperación entre las Partes interesadas” El principio precautorio también se encuentra previsto en el Convenio de Estocolmo sobre Contaminantes Orgánicos Persistentes, el cual se encuentra ratificado por 32 Estados Miembros de la OEA, entre ellos, Costa Rica véase ley nro. 8538 del 23 de agosto de 2006 , en la que se lee:
“ARTÍCULO 1 Objetivo Teniendo presente el principio de precaución consagrado en el principio 15 de la Declaración de Río sobre el Medio Ambiente y el Desarrollo, el objetivo del presente Convenio es proteger la salud humana y el medio ambiente frente a los contaminantes orgánicos persistentes (…)”.
Igualmente, tal principio está contemplado el Convenio sobre la Diversidad Biológica ratificado por 34 Estados Miembros de la OEA, incluido Costa Rica, por medio de la ley nro. 7416 del 30 de junio de 1994, en cuyo preámbulo se establece: “(…) Observando que es vital prever, prevenir y atacar en su fuente las causas de reducción o pérdida de la diversidad biológica. Observando también que cuando exista una amenaza de reducción o pérdida sustancial de la diversidad biológica no debe alegarse la falta de pruebas científicas inequívocas como razón para aplazar las medidas encaminadas a evitar o reducir al mínimo esa amenaza (…)”.
En consonancia con la referida normativa vigente en el país, la Corte Interamericana de Derechos Humanos también se refirió al principio precautorio en la OC 23/17 del 15 de noviembre de 2017:
“180. (…) Por tanto, esta Corte entiende que, los Estados deben actuar conforme al principio de precaución, a efectos de la protección del derecho a la vida y a la integridad personal, en casos donde haya indicadores plausibles que una actividad podría acarrear daños graves e irreversibles al medio ambiente, aún en ausencia de certeza científica. Por tanto, los Estados deben actuar con la debida cautela para prevenir el posible daño. En efecto, en el contexto de la protección de los derechos a la vida y a la integridad personal, la Corte considera que los Estados deben actuar conforme al principio de precaución, por lo cual, aún en ausencia de certeza científica, deben adoptar las medidas que sean “eficaces” para prevenir un daño grave o irreversible” Posterior a tal resolución y por medio de una sentencia, en Comunidades Indígenas miembros de la Asociación lhaka Honhat (nuestra tierra) vs. Argentina, la Corte IDEH se pronunció el 6 de febrero de 2020 de esta forma: “el derecho a un medio ambiente sano “debe considerarse incluido entre los derechos [...] protegidos por el artículo 26 de la Convención Americana”, dada la obligación de los Estados de alcanzar el “desarrollo integral” de sus pueblos, que surge de los artículos 30, 31, 33 y 34 de la Carta”.
De alta significación, se debe subrayar que, en este pronunciamiento, la Corte IDH remite a la opinión consultiva nro. OC-23/17 con la finalidad de desarrollar el contenido y alcance de tal derecho, merced a lo cual las consideraciones jurídicas de la última lógicamente han venido a alcanzar la obligatoriedad jurídica propia de una sentencia. En tal sentido, el órgano jurisdiccional internacional reitera “que el derecho a un medio ambiente sano “constituye un interés universal” y “es un derecho fundamental para la existencia de la humanidad”, y que “como derecho autónomo [...] protege los componentes del [...] ambiente, tales como bosques, mares, ríos y otros, como intereses jurídicos en sí mismos, aun en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta”.
Lo anterior no obsta, desde luego, a que otros derechos humanos puedan ser vulnerados como consecuencia de daños ambientales”. Precisamente, en el desarrollo de la conceptualización del derecho al ambiente, la Corte IDH con toda claridad detalla las obligaciones estatales frente a posibles daños al ambiente, tales como el deber de prevención, el principio de precaución, la obligación de cooperación y el acceso a la información.
En suma, la aplicación del principio precautorio implica que cuando existan indicadores de que cierta actividad plausiblemente podría ocasionar daños graves e irreversibles al ambiente, la falta de certeza o evidencia científica absoluta al respecto no exime de la obligación de adoptar todas aquellas medidas eficientes y eficaces para impedir una vulneración al ambiente.
Tocante al principio preventivo, en el primer informe de la ONU sobre el estado del derecho ambiental internacional, documento A/73/419 de 30 de noviembre de 2018 elaborado por su secretario general en cumplimiento de la resolución de la asamblea general de 10 de mayo de 2018 (nro. A/72/L.51), se le conceptualiza como pauta normativa del derecho internacional consuetudinario “confirmada por la práctica pertinente en muchos tratados relativos al medio ambiente y los principales proyectos de codificación”.
Ahora, si bien en el informe antedicho se subraya la prevención del daño transfronterizo, lo cierto es que este principio general de derecho, como bien se consigna en el documento ‘95 Principios Jurídicos Medioambientales para un Desarrollo Ecológicamente Sustentable’ (aprobados en la XIX Edición de la Cumbre Judicial Iberoamericana‑2018 y por la Corte Plena en el artículo XIX de la sesión nro. 28-2020 del 25 de mayo de 2020) , tiene un alcance mucho mayor, toda vez que, como guía hermenéutica, conduce a que “las causas y las fuentes de los problemas ambientales se atenderán en forma prioritaria e integrada, tratando de prevenir los efectos negativos que sobre el ambiente se puedan producir. El criterio de prevención prevalecerá entonces, sobre cualquier otro en la gestión pública y privada del medio ambiente y los recursos naturales”. Lo anterior tiene todo sentido, pues es consecuente con el deber de prevenir la consumación de un daño ambiental, y no limitarse a decidir acerca de la reparación de las consecuencias perjudiciales ya corroboradas, incluso disponiendo la paralización de los efectos dañinos.
Tal instituto se refleja, entre otras normas, en los ordinales 194.1 de la Convención de las Naciones Unidas sobre el Derecho del Mar (ratificada por Costa Rica mediante ley nro. 7291) y 5 y Anexo II del Acuerdo de las Naciones Unidas sobre Peces Transzonales y Altamente Migratorios (ratificado mediante ley nro. 8059), así como en la jurisprudencia constitucional (ver sentencias nros. 2021024807 de las 9:20 horas del 5 de noviembre de 2021 y 2018016383 de las 17:00 horas del 28 de setiembre de 2018, entre muchas otras) y en la convencional, verbigracia, e la opinión consultiva nro. OC-23/17 de 15 de noviembre de 2017, párrafos: 127 a 174 e incisos a) y b) del párrafo 242 y la sentencia de 24 de noviembre de 2022 Nombre02 vs. Chile. Justamente, en la última señala la Corte IDH de manera expresa:
“208. Sin perjuicio de lo anterior, en materia específica ambiental, debe destacarse que el principio de prevención de daños ambientales, forma parte del derecho internacional consuetudinario, y entraña la obligación de los Estados de llevar adelante las medidas que sean necesarias ex ante la producción del daño ambiental, teniendo en consideración que, debido a sus particularidades, frecuentemente no será posible, luego de producido tal daño, restaurar la situación antes existente. En virtud del deber de prevención, la Corte ha señalado que “los Estados están obligados a usar todos los medios a su alcance con el fin de evitar que las actividades que se lleven a cabo bajo su jurisdicción, causen daños significativos al […] ambiente”200. Esta obligación debe cumplirse bajo un estándar de debida diligencia, la cual debe ser apropiada y proporcional al grado de riesgo de daño ambiental201. Por otro lado, si bien no es posible realizar una enumeración detallada de todas las medidas que podrían tomar los Estados con el fin de cumplir este deber, pueden señalarse algunas, relativas a actividades potencialmente dañosas: i) regular; ii) supervisar y fiscalizar; iii) requerir y aprobar estudios de impacto ambiental; iv) establecer planes de contingencia, y v) mitigar en casos de ocurrencia de daño ambiental202”.
Por su parte, el principio in dubio pro natura significa, según la ‘Declaración Mundial de la Unión Internacional para la Conservación de la Naturaleza (UICN) acerca del Estado de Derecho en materia ambiental’ que “en caso de duda, todos los procesos ante tribunales, órganos administrativos y otros tomadores de decisión deberán ser resueltos de manera tal que favorezcan la protección y conservación del medio ambiente, dando preferencia a las alternativas menos perjudiciales. No se emprenderán acciones cuando sus potenciales efectos adversos sean desproporcionados o excesivos en relación con los beneficios derivados de los mismos” (ver principio V).
En tal sentido, según el documento ‘95 Principios Jurídicos Medioambientales para un Desarrollo Ecológicamente Sustentable’ (aprobados en la XIX Edición de la Cumbre Judicial Iberoamericana‑2018 y por la Corte Plena en el artículo XIX de la sesión nro. 28-2020 del 25 de mayo de 2020), “Todo operador de las normas ambientales deberá tener siempre presente el principio pro naturaleza, conforme al cual se evitarán los riesgos, se privilegiarán los intereses colectivos generales sobre los particulares, se favorecerá la preservación del medio ambiente y en caso de duda se preferirá la interpretación que en forma más amplia proteja el entorno”.
El principio in dubio pro natura, entonces, no depende de que haya peligro de daño grave o irreversible -como sucede con el principio precautorio‑, sino que implica una “regla general de comportamiento, para la relación del Estado -y la sociedad en general- con el medio ambiente, aplicable a todos los ámbitos de decisiones en que exista un riesgo de afectación al medio ambiente, y que nos obliga a evitar optar por aquellas conductas que puedan causar daño al medio ambiente, cuando existan otras opciones” (Olivares y Lucero, 2018).
Por otra parte, en la sentencia nro. 2012013367 de las 11:33 horas del 21 de setiembre de 2012, este Tribunal Constitucional se refirió a los principios de progresividad y de no regresión en materia ambiental en este sentido:
“V. Sobre los principios de progresividad y no regresión de la protección ambiental. El principio de progresividad de los derechos humanos ha sido reconocido por el Derecho Internacional de los Derechos Humanos; entre otros instrumentos internacionales, se encuentra recogido en los artículos 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales, artículo 1 y 26 de la Convención Americana sobre Derechos Humanos y artículo 1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales. Al amparo de los estas normas, el Estado asume la obligación de ir aumentando, en la medida de sus posibilidades y desarrollo, los niveles de protección de los derechos humanos, de especial consideración aquellos, que como el derecho al ambiente (art. 11 del Protocolo), requieren de múltiples acciones positivas del Estado para su protección y pleno goce por todos sus titulares.
Del principio de progresividad de los derechos humanos y del principio de irretroactividad de las normas en perjuicio de derechos adquiridos y situaciones jurídicas consolidadas, recogido en el numeral 34 de la Carta Magna, se deriva el principio de no regresividad o de irreversibilidad de los beneficios o protección alcanzada. El principio se erige como garantía sustantiva de los derechos, en este caso, del derecho a un ambiente sano y ecológicamente equilibrado, en virtud del cual el Estado se ve obligado a no adoptar medidas, políticas, ni aprobar normas jurídicas que empeoren, sin justificación razonable y proporcionada, la situación de los derechos alcanzada hasta entonces. Este principio no supone una irreversibilidad absoluta pues todos los Estados viven situaciones nacionales, de naturaleza económica, política, social o por causa de la naturaleza, que impactan negativamente en los logros alcanzados hasta entonces y obliga a replantearse a la baja el nuevo nivel de protección.
En esos casos, el Derecho a la Constitución y los principios bajo examen obligan a justificar, a la luz de los parámetros constitucionales de razonabilidad y proporcionalidad, la reducción de los niveles de protección. En este sentido, la Sala Constitucional ha expresado en su jurisprudencia, a propósito del derecho a la salud: “…conforme al PRINCIPIO DE NO REGRESIVIDAD, está prohibido tomar medidas que disminuyan la protección de derechos fundamentales. Así entonces, si el Estado costarricense, en aras de proteger el derecho a la salud y el derecho a la vida, tiene una política de apertura al acceso a los medicamentos, no puede -y mucho menos por medio de un Tratado Internacional- reducir tal acceso y hacerlo más restringido, bajo la excusa de proteger al comercio. (Sentencia de la Sala Constitucional Nº 9469-07). En relación con el derecho al ambiente dijo: “Lo anterior constituye una interpretación evolutiva en la tutela del ambiente conforme al Derecho de la Constitución, que no admite una regresión en su perjuicio.” (Sentencia de la Sala Constitucional Nº 18702-10)”. (Lo destacado no corresponde al original). (En el mismo sentido, las sentencias 2014-012887, 2017-002375, 2017-005994, 2019-012745 y 2019-017397)”.
De este modo, de acuerdo con el principio de progresividad, el Estado asume la obligación de aumentar, en la medida de lo posible, los niveles de protección de los derechos humanos, incluido el derecho al ambiente sano y ecológicamente equilibrado. Por su parte, la aplicación del principio de no regresión consiste en una garantía que constriñe al Estado a abstenerse de adoptar medidas, políticas o normas que empeoren, sin una justificación razonable y proporcionada, el grado de protección a los derechos fundamentales ya alcanzado, y que, dado el caso, se tienen que ponderar las medidas de compensación que correspondan.
Finalmente, este Tribunal explicó el principio de objetivación de la tutela ambiental en estos términos:
“En cuanto al ambiente, objeto del derecho fundamental expuesto, nuestra Carta Magna exige además que sea “sano”. La exigencia “sano” nos conduce a la “capacidad regenerativa” y a la “capacidad de sucesión” para garantizar la vida. De ambos requisitos: “sano” y equilibrado” se desprende la necesidad de un desarrollo sostenible y sustentable; la calidad de vida y la calidad ambiental dependen de ello. Ahora bien, con los conceptos de “ambiente”, “sano” “ecológicamente equilibrado”, la norma constitucional introdujo la ciencia y la técnica en las decisiones ambientales, sean estas legislativas o administrativas, de tal manera que, en los términos de los ordinales 16 de la Ley General de la Administración Pública y 38 de la Ley Orgánica del Ambiente, las actuaciones estatales en materia ambiental deben fundarse y no pueden contradecir las reglas unívocas de la ciencia y la técnica en aras de lograr el goce pleno y universal a un ambiente sano y ecológicamente equilibrado y, además, un “mayor bienestar para todos los habitantes del país”.
En cuanto al sometimiento de las decisiones legislativas y administrativas a las reglas unívocas de la ciencia y la técnica, la Sala lo ha denominado principio de objetivación de la tutela ambiental: “De la objetivación de la tutela ambiental (…) es un principio que en modo alguno puede confundirse con el anterior [principio precautorio o “principio de la evitación prudente”], en tanto, como derivado de lo dispuesto en los artículos 16 y 160 de la Ley General de la Administración Pública, se traduce en la necesidad de acreditar con estudios técnicos la toma de decisiones en esta materia, tanto en relación con actos como de las disposiciones de carácter general –tanto legales como reglamentarias–, de donde se deriva la exigencia de la vinculación a la ciencia y a la técnica con lo cual, se condiciona la discrecionalidad de la Administración en esta materia. De manera que en atención a los resultados que se deriven de esos estudios técnicos –tales como los estudios de impacto ambiental–, si se evidencia un criterio técnico objetivo que denote la probabilidad de un evidente daño al ambiente, los recursos naturales o a la salud de las personas, es que resulta obligado desechar el proyecto, obra o actividad propuestas; y en caso de una "duda razonable" resulta obligado tomar decisiones en pro del ambiente (principio pro-natura), que puede traducirse en la adopción, tanto de medidas compensatorias como precautorias, a fin de proteger de la manera adecuada el ambiente.” (Sentencia de la Sala Constitucional Nos. 21258-10, 17126-06, 14293-05)” (el resaltado fue agregado). (Resolución nro. 2012-13367 de las 11:33 horas del 21 de setiembre de 2012).
IV.Sobre el caso concreto. En el sub lite, la parte accionante indica que el 11 de abril de 2025 formuló ante el coordinador del programa de Prevención, Control y Protección del ACLAC un reclamo urgente (oficio AEL-00168-2025), por la intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R. L. Asevera que al día siguiente planteó una “una solicitud de informe de seguimiento y acciones urgentes” (oficio AEL-00172-2025) con respecto a la causa penal contra la Cooperativa Coopetrauto R. L. por presunto drenaje y relleno de humedales (expediente 23-000011-0472-PE). Menciona que recibió los oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, ambas de 22 de abril de 2025; sin embargo, son contradictorias, ya que hacen referencia al expediente 23-000011-0472-PE, pese a que las denuncias corresponden a hechos distintos y características diferentes e, incluso, en propiedades distintas.
Considera que lo anterior evidencia una presunta omisión en la realización de las visitas de campo indispensables para verificar los hechos denunciados, relacionados con el cambio de uso del suelo, drenaje y relleno de humedales, lo cual constituye una violación al derecho a un ambiente sano y equilibrado. Formula la siguiente pretensión: “1. Admitir el presente recurso de amparo por la violación al derecho fundamental a un ambiente sano y equilibrado, consagrado en el artículo 50 de la Constitución Política. 2. Ordenar al Ing. Alexis Salas Rodríguez, en su calidad de Coordinador del Programa de Prevención, Control y Protección del Área de Conservación Amistad Caribe (ACLAC), realizar de inmediato las inspecciones de campo correspondientes a las denuncias presentadas en los oficios AEL-00168-2025 y AEL-00172-2025, a fin de documentar la situación actual de las zonas afectadas por el presunto drenaje, relleno de humedales y cambio de uso del suelo. 3.
Requerir al Área de Conservación Amistad Caribe (ACLAC) un informe detallado sobre las acciones tomadas para garantizar la protección de los humedales y bosques denunciados, así como el cumplimiento de las disposiciones legales aplicables. 4. Suspender cualquier actividad de la Cooperativa Coopetrauto R.L. que implique intervención en los humedales y bosques denunciados, hasta que se realicen las inspecciones y se determinen las responsabilidades correspondientes”.
En relación con lo anterior, la Sala observa que la persona recurrente alude que sus denuncias están referidas a hechos y lugares distintos. Por consiguiente, serán analizada de forma separada a fin de valorar el abordaje brindado por el ACLAC en cada una de ellas.
IV.1. Sobre la gestión formulada por medio del oficio AEL-00168-2025.
Con respecto a este extremo, la Sala tiene por demostrado que el accionante, mediante oficio AEL-00168-2025 de 11 de abril de 2025 dirigido al encargado de Protección y Control del ACLAC, indicó: “Ref: Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L. Estimado señor: Me dirijo a usted en su calidad de Encargado de la Protección y Control del Área de Conservación Amistad Caribe (ACLAC), con el propósito de formular un enérgico reclamo y solicitar su inmediata intervención para garantizar la protección y restauración de los humedales y bosques ubicados frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L. (cédula jurídica 3-004-727922), en el sector de Santa Rosa, provincia de Limón. Resulta alarmante y de suma gravedad que, en el contexto del anunciado proyecto de construcción del nuevo Hospital de Limón en la zona de Santa Rosa, se estén llevando a cabo actividades que atentan directamente contra el equilibrio ambiental de la zona.
En particular, se ha constatado el fraccionamiento de bosques, el drenaje de humedales y la tala de árboles en el área antes mencionada, acciones que contravienen flagrantemente la normativa ambiental vigente, incluyendo la Ley Orgánica del Ambiente (N° 7554), la Ley Forestal (N° 7575) y los compromisos internacionales de Costa Rica en materia de conservación de humedales, como la Convención Ramsar. El día de hoy, hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L. Estas actividades, lejos de ser hechos aislados, sugieren una clara intención de fraccionar los bosques, alterar el uso del suelo y drenar los humedales, lo que representa un daño ambiental de difícil o imposible reparación. Tales actos no solo comprometen la biodiversidad y los servicios ecosistémicos de la zona, sino que también afectan los derechos fundamentales de las comunidades locales a un ambiente sano y ecológicamente equilibrado, consagrados en el artículo 50 de la Constitución Política.
En consecuencia, SOLICITO de manera inmediata las siguientes acciones: 1. La paralización total de cualquier actividad de tala, drenaje o fraccionamiento en los humedales y bosques del sector señalado. 2. Una inspección urgente por parte de las autoridades competentes de ACLAC en el área afectada, con el fin de evaluar los daños ocasionados y determinar las responsabilidades correspondientes. 3. La adopción de medidas efectivas para la restauración de los ecosistemas degradados y la sanción de los responsables de estas actividades ilícitas, conforme lo establece la legislación ambiental. 4. La presentación de un informe detallado sobre las acciones emprendidas por su oficina para atender esta denuncia, en un plazo no mayor a diez días hábiles. Don Alexis, su rol como Encargado de la Protección y Control le impone la ineludible obligación de velar por la conservación de los recursos naturales bajo su jurisdicción.
La inacción o demora en este asunto sería no solo una omisión de sus deberes, sino también una afrenta a los principios de sostenibilidad y justicia ambiental que deben guiar la gestión pública. Sin otro particular, le reitero la urgencia de su intervención y quedo atento a cualquier comunicación”. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-035-2025 de 22 de abril de 2025 dirigido a Nombre01, consignó: “ASUNTO: Respuesta AEL-00168-2025. Estimada Don Nombre01, En atención a lo solicitado con respecto a la denuncia realizada por la afectación de la propiedad asociada a la Cooperativa Coopetrauto R.L, se informa lo siguiente: • Este caso actualmente se encuentra judicializado desde el 2023, en donde consta en la causa judicial 23-000011-0472-PE. • En su momento, se giro (sic) una orden de paralización de cualquier actividad que afectara el entorno ecológico de la propiedad señalada dentro del Registro Nacional de Humedales. • Por parte del SINAC, el sitio ha sido visitado, con el propósito de informar a la Fiscalía el estado actual, así como el incumplimiento de las medidas cautelares ordenadas. • Las medidas de restauración deberán ser solicitadas en su momento por la fiscalía, para que, por orden de un juez de la república, se le impongan a los responsables o representantes de Coopetrauto R.L. • Los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente.
En comprensión por su preocupación por la afectación al ecosistema de humedal, se le informa que esta dependencia a realizado lo que los procedimientos requieren para identificar la ilegalidad por afectación a artículos de ley asociados a este caso”. El 19 de mayo de 2025, las autoridades recurridas fueron notificadas del curso de este proceso. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-046-2025 de 20 de mayo de 2025 dirigido a Nombre01, indicó: “ASUNTO: Aclaración y ampliación nota AEL-00168-2025. Ref. SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025. Estimado señor, A efectos de ampliar nuestros oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, en respuesta a su nota AEL-00168-2025, se le remite la siguiente respuesta aclaratoria, para los cuatro puntos detallados: 1. La paralización total de cualquier actividad de tala, drenaje o fraccionamiento en los humedales y bosques del sector señalado.
R/ Le indicó (sic) que en el análisis e interpretación de la ubicación de donde ocurre lo denunciado, resulta con poca claridad y ambiguo la ubicación brindada, siendo esto poco preciso en la interpretación de lo indicado “Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L.” o “hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L.”. Es decir, al frente o colindante requiere de mayor exactitud puesto que resultan contradictorios. Le indico que en el análisis e interpretación de la ubicación de donde ocurre lo denunciado, resulta con poca claridad y ambigua la ubicación brindada, siendo esto poco preciso en la interpretación de lo indicado “Reclamo urgente por intervención indebida en humedales y bosques frente al proyecto urbanístico de la Cooperativa Coopetrauto R.L.” o “hemos sido testigos de la presencia de un operario realizando labores de tala de árboles dentro de un humedal y bosque colindante con el proyecto urbanístico de la Cooperativa Coopetrauto R.L.”.
Agradecemos nos brinde el sitio que usted desea reportar con mayor precisión, de manera que contemos con mayores herramientas para valorar si es requerido una nueva inspección, dado que, como se indica en este momento resulta inexacta. 2. Una inspección urgente por parte de las autoridades competentes de ACLAC en el área afectada, con el fin de evaluar los daños ocasionados y determinar las responsabilidades correspondientes. R/ A pesar de que no se cuenta con exactitud el sitio que desea reportar, le reiteramos que en función a lo solicitado en la nota AEL-00168-2025, se aclara que esta dependencia, asumiendo que al indicar “frente o colindante” interpretemos que hace referencia al costado noreste de la propiedad donde se lleva el caso de la Cooperativa Coopetrauto R.L (causa 23-000011-0472-PE); siendo así, y con el afán de facilitarle información respecto de las atenciones en cuanto a delitos ambientales en el sitio, desde las acciones del Programa de Prevención Control y Protección del Área de Conservación Amistad Caribe, se tramitó la correspondiente denuncia por afectación al medio ambiente específicamente por el daño y modificación del ecosistema de humedal presente en la zona, dicha denuncia responde al número de causa 24-000066-472-PE, por lo que se informa lo siguiente: • Este caso actualmente se encuentra judicializado desde el 2024, en donde consta en la causa judicial 24-000066-472-PE. • En su momento, se giró una orden de paralización de cualquier actividad que afectara el entorno ecológico de la propiedad señalada dentro del Registro Nacional de Humedales y la determinación de nuevas áreas de humedal. • Por parte del SINAC, el sitio ha sido visitado, con el propósito de informar a la Fiscalía el estado actual, así como el incumplimiento de las medidas cautelares ordenadas. 3.
La adopción de medidas efectivas para la restauración de los ecosistemas degradados y la sanción de los responsables de estas actividades ilícitas, conforme lo establece la legislación ambiental. R/ Las medidas de restauración deberán ser solicitadas en su momento por la fiscalía, para que, por orden de un juez de la república, se le impongan a los responsables o representantes de la propiedad en cuestión. 4. La presentación de un informe detallado sobre las acciones emprendidas por su oficina para atender esta denuncia, en un plazo no mayor a diez días hábiles. R/ Los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente. Se le recuerda en cuanto a información específica como la solicitada, que consta en una causa judicial, se debe respetar lo indicado en el Artículo 295 del Código Procesal Penal en cuanto a la privacidad de las actuaciones: “el procedimiento preparatorio no será público para terceras personas, no obstante, las actuaciones pueden ser examinadas por las partes o sus representantes.
A las personas abogadas que invoquen un interés legítimo, la fiscala o el fiscal del Ministerio Público, luego de constatar ese interés, puede informar acerca de los hechos que se investigan. Así mismo, todas las partes y personas funcionarias que participaron en la investigación deben guardar secreto sobre la misma”. En comprensión por su preocupación por la afectación al ecosistema de humedal y forestal, se le informa que esta dependencia ha realizado lo que los procedimientos requieren para identificar la ilegalidad por afectación a artículos de ley asociados a este caso. Por lo que también se le solicita realizar estas denuncias ambientales en la plataforma oficial SITADA, de manera que se le pueda dar seguimiento a estos delitos”. El accionante, por oficio AEL-00224-2025 de 20 de mayo de 2025 dirigido al coordinador del programa de Prevención, Control y Protección del ACLAC, expuso: “Asunto: Respuesta al Oficio CARTA-SINAC-ACLAC-PPCP-046- 2025 y Solicitud de Aclaraciones Estimado señor: Me dirijo a usted en su calidad de Coordinador del Programa de Prevención, Control y Protección del Área de Conservación Amistad Caribe (SINAC-ACLAC), en respuesta al oficio CARTA-SINACACLAC-PPCP-046-2025, de fecha 20 de mayo de 2025, dirigido al suscrito, que amplía los oficios SINAC-ACLAC-PPCP-035-2025 y SINAC-ACLAC-PPCP-037-2025, en relación con mi nota AEL-00168- 2025 sobre intervenciones indebidas en humedales y bosques colindantes al proyecto urbanístico de la Cooperativa Coopetrauto R.L.
Agradezco su respuesta, pero considero que el contenido del oficio no aborda adecuadamente la gravedad de las violaciones ambientales denunciadas ni cumple con el nivel de rigurosidad esperado de un funcionario que actúa como policía ambiental, sirviendo como los “ojos” de jueces y fiscales en el campo. A continuación, detallo mis observaciones y solicitudes: 1. Insuficiencia en la Identificación del Sitio Denunciado: Su oficio califica de “ambigua” la ubicación reportada (“frente o colindante” al proyecto de la Cooperativa Coopetrauto R.L.), lo que resulta injustificado dado que las referencias proporcionadas son claras. La intervención incluye una carretera que divide un humedal y zanjas de gran tamaño que impiden su restauración, hechos que no se mencionan en su respuesta. Solicito un informe exhaustivo, acompañado de fotografías satelitales, que detalle el verdadero cuadro fáctico de estas intervenciones, permitiendo a jueces y fiscales evaluar adecuadamente la situación. 2.
Omisión de Impactos Más Amplios en el Ecosistema: El oficio ignora que el ecosistema de humedal trasciende los límites de la propiedad de la Cooperativa Coopetrauto R.L. Además, no se menciona la preocupante actividad de drenajes y rellenos de humedales en la zona, especialmente ante la eventual construcción del futuro Hospital de Limón. Estas acciones, de manera inexplicable, no han sido investigadas por las autoridades de SINAC-ACLAC, lo que refleja una reacción pasiva que depende exclusivamente de gestiones de parte. 3. Falta de Rigor en el Cumplimiento de Funciones: Como Coordinador del Programa de Prevención, Control y Protección, su rol exige proporcionar a las autoridades judiciales información precisa y completa. Sin embargo, el oficio no evidencia un seguimiento riguroso a la orden de paralización mencionada en la causa 24-000066-472-PE, ni detalla medidas concretas para la restauración del ecosistema afectado.
Solicito que se realice una inspección urgente en el área, documentada con evidencia visual y técnica, para garantizar el cumplimiento de las medidas cautelares y evaluar los daños. 4. Uso Inapropiado del Artículo 295 del Código Procesal Penal: La invocación del Artículo 295 para limitar la entrega de información resulta desproporcionada y obstaculiza la transparencia. Como denunciante, tengo un interés legítimo en conocer las acciones emprendidas, conforme lo permite el propio artículo. Insto a que se proporcione un informe detallado y accesible sobre las medidas tomadas, en un plazo no mayor a diez días hábiles, en cumplimiento de mi solicitud original. 5. Uso de la Plataforma SITADA: Si bien se me solicita presentar denuncias a través de la plataforma SITADA, esto no exime a SINAC-ACLAC de investigar proactivamente las violaciones ambientales reportadas, especialmente cuando se trata de ecosistemas protegidos como los humedales.
Solicito que se aclare cómo se está dando seguimiento a estas denuncias en SITADA y qué medidas preventivas se han implementado en la zona. En virtud de lo anterior, respetuosamente solicito: • La elaboración de un informe detallado, con evidencia satelital y fotográfica, que describa las intervenciones en el humedal (carretera, zanjas, drenajes, y rellenos) y su impacto en el ecosistema, incluyendo áreas más allá de la propiedad de la Cooperativa Coopetrauto R.L. • Una inspección inmediata y exhaustiva en el área afectada, con un reporte claro sobre el cumplimiento de las medidas cautelares de la causa 24-000066-472-PE. • La adopción de medidas urgentes para detener cualquier actividad que degrade el humedal y para iniciar la restauración del ecosistema, conforme a la legislación ambiental. • Un informe accesible sobre las acciones emprendidas, dentro de un plazo de diez días hábiles, que garantice transparencia y rendición de cuentas.
Adjunto una copia de mi nota original AEL-00168-2025 para su referencia. Espero su pronta respuesta y acciones concretas para proteger los ecosistemas de humedal y bosque en la zona. Quedo a su disposición para cualquier aclaración o información adicional”.
Desde este panorama, procede declarar parcialmente con lugar lo reclamado por la parte accionante.
Ciertamente, el ACLAC contestó de forma célere la primera gestión; empero, no se observa que se haya atendido la situación denunciada. En efecto, el 11 de abril de 2025, el recurrente puso en conocimiento de tal dependencia presuntas afectaciones graves al ambiente, tales como fraccionamiento de bosques, drenaje de humedales y tala de árboles; incluso, se afirmó expresamente que ese mismo día estaba un “operario realizando labores de tala de árboles dentro de un humedal y bosque”. Pese a lo anterior, la autoridad recurrida se limitó a señalar que el caso estaba judicializado desde 2023, así como que en su momento se había girado una orden de paralización de cualquier actividad; además, que el SINAC había visitado el sitio para informar a la Fiscalía el incumplimiento de las medidas cautelares. En adición, con ocasión de este recurso de amparo, el ACLAC señaló que hubo poca claridad en cuanto a la propiedad denunciada y amplió la respuesta sobre la existencia de otra causa penal incoada en 2024; no obstante, nuevamente se limitó a señalar que el caso se encontraba judicializado y que en su momento también se había girado una orden de paralización de actividades, así como que se había visitado el sitio para informar al Ministerio Público el incumplimiento de las medidas cautelares.
Asimismo, se constata que, en ambas respuestas, ante el requerimiento de un detalle de las acciones emprendidas en virtud de la denuncia, se consignó explícitamente que los informes del caso se dirigen a la fiscalía para que se incorporen al expediente.
Sobre lo anterior, es menester señalar que la judicialización de una situación ambiental no exime al SINAC de cumplir las competencias administrativas que le otorga el ordenamiento jurídico (siempre que no obstaculicen la investigación penal ni resuelvan extremos propios de ser ventilados en esta última), sin perjuicio de que posteriormente ponga en conocimiento de las autoridades penales los hechos que considere pertinentes. Máxime cuando se trata de denuncias, en las que se alude a algún criterio de urgencia y actualidad, como sucede en el sub examine donde se mencionaron acciones en curso (“tala de árboles dentro de un humedal y bosque”, así como el “drenaje de humedales”) que presuntamente se estaban ejecutando al momento de su interposición. De ahí que resulta ilegítimo que el ACLAC tome una actitud pasiva y evasiva (por haber denunciado los hechos en la vía penal y emitido órdenes de paralización en años anteriores), por cuanto la propia denuncia administrativa hace referencia a situaciones actuales que ameritan una pronta intervención.
Justamente, debe mencionarse que la vía penal no es excluyente per se de aquellas acciones que puede llegar a ejecutar el SINAC (siempre dentro del ámbito administrativo) para resguardar el ambiente, evitar daños aún mayores, o bien, impedir repercusiones negativas adicionales a las ya denunciadas judicialmente. Nótese incluso que el ordenamiento jurídico nacional le otorga el carácter de autoridad de policía a los funcionarios de la Administración Forestal (artículo 54 de la Ley Forestal) y a los inspectores de Vida Silvestre (numeral 15 de la Ley de Conservación de la Vida Silvestre). Lo anterior tampoco exime a tal institución de dar cuentas sobre su actuar a los denunciantes administrativos (verbigracia, aquellas actuaciones de naturaleza pública sobre la atención de denuncias ambientales administrativas), sin perjuicio de que se reserven aquellos datos o documentos dirigidos a las autoridades penales que sí estén contemplados por la privacidad de las actuaciones contemplada en el artículo 295 del Código Procesal Penal Atinente al sub iudice, la Sala, en la sentencia nro. 2024004807 de las 9:20 horas de 23 de febrero de 2024, resolvió:
“En primer lugar, la Sala observa que la solicitud planteada ante el Sinac expone la afectación al “humedal laguna Carrizal” por el levantamiento de infraestructuras y la realización de quemas, además, solicita la investigación de lo planteado y que se ejecuten acciones de control, resguardo y sanción; empero, tal órgano desconcentrado del Minae solo llevó a cabo una inspección en la zona e interpuso una denuncia ante el Ministerio Público (en la que no se abordaron la totalidad de los extremos alegados en la gestión del recurrente). Nótese que en el “Informe por daños al ambiente” enviado a la fiscalía, se aludió únicamente a construcciones y la apertura de un camino dentro del área de protección de la laguna Carrizal. En todo caso, la actuación del Sinac en sede administrativa no puede limitarse, una vez constatada alguna posible situación de relevancia ambiental, a la remisión del asunto a la fase investigativa en la vía penal. Precisamente, tal dependencia tiene potestad de instaurar los procedimientos sobre denuncias que se formulen por infracciones a la normativa ambiental y emitir actos administrativos para procurar su cumplimiento. De ahí que la omisión en atender el fondo de la situación denunciada constituye un extremo de relevancia constitucional a los efectos de procurar la tutela del numeral 50 constitucional.
En relación con lo anterior, la Ley de Biodiversidad indica:
“ARTÍCULO 22 Sistema Nacional de Áreas de Conservación Créase el Sistema Nacional de Áreas de Conservación, en adelante denominado Sistema, que tendrá personería jurídica propia; será un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio del Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica. Conforme a lo anterior, la Dirección General de Vida Silvestre, la Administración Forestal del Estado y el Servicio de Parques Nacionales ejercerán sus funciones y competencias como una sola instancia, mediante la estructura administrativa del Sistema, sin perjuicio de los objetivos para los que fueron establecidos. Queda incluida como competencia del Sistema la protección y conservación del uso de cuencas hidrográficas y sistemas hídricos.
(…)
ARTÍCULO 28.- Áreas de Conservación El Sistema estará constituido por unidades territoriales denominadas Áreas de Conservación bajo la supervisión general del Ministerio del Ambiente y Energía, por medio del Consejo Nacional de Áreas de Conservación, con competencia en todo el territorio nacional, según se trate de áreas silvestres protegidas, áreas con alto grado de fragilidad o de áreas privadas de explotación económica. Cada área de conservación es una unidad territorial del país, delimitada administrativamente, regida por una misma estrategia de desarrollo y administración, debidamente coordinada con el resto del sector público. En cada uno se interrelacionan actividades tanto privadas como estatales en materia de conservación sin menoscabo de las áreas protegidas. Las Áreas de Conservación se encargarán de aplicar la legislación vigente en materia de recursos naturales, dentro de su demarcación geográfica.
Deberán ejecutar las políticas, las estrategias y los programas aprobados por el Consejo Nacional de Áreas de Conservación, en materia de áreas protegidas; asimismo, tendrá a su cargo la aplicación de otras leyes que rigen su materia, tales como la Ley de conservación de la vida silvestre, No. 7317, de 30 de octubre de 1992, y la Ley Forestal, No. 7575, de 13 de febrero de 1996, Ley Orgánica, No. 7554, de 4 de octubre de 1995, y la Ley de Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. Basado en las recomendaciones del Consejo, el Ministerio del Ambiente y Energía definirá la división territorial que técnicamente sea más aconsejable para las Áreas de Conservación del país, así como sus modificaciones”.
Asimismo, la Ley de Conservación de Vida Silvestre señala:
“Artículo 7.- El Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía tiene las siguientes funciones en el ejercicio de su competencia:
(*)(Modificada su denominación por el artículo 3° de la ley N° 9106 del 20 de diciembre del 2012, anteriormente decía "flora y fauna silvestre")
La delimitación de los humedales se hará por decreto ejecutivo, según criterios técnicos.
(Así reformado por el artículo 1 de la ley N° 9106 del 20 de diciembre de 2012)”.
En adición, el numeral 99 de la Ley Orgánica del Ambiente establece:
“Artículo 99.- Sanciones administrativas. Ante la violación de las normativas de protección ambiental o ante conductas dañinas al ambiente claramente establecidas en esta ley, la Administración Pública aplicará las siguientes medidas protectoras y sanciones:
Estas sanciones podrán imponerse a particulares o funcionarios públicos, por acciones u omisiones violatorias de las normas de esta ley, de otras disposiciones de protección ambiental o de la diversidad biológica” En consecuencia, procede la estimatoria del recurso en cuanto al Sinac a los efectos de que, con independencia de la remisión del asunto a la vía penal, analice íntegramente la situación denunciada en la vía administrativa a la luz del ordenamiento jurídico, resuelva la totalidad de los extremos alegados y, de resultar procedente, emita los actos administrativos que correspondan.
Por otra parte, la Municipalidad de Garabito también recibió la denuncia de la parte accionante en la que solicitó la intervención del gobierno local dentro del ámbito de sus competencias, verbigracia, entre otros aspectos, en lo relativo a los permisos municipales y la afectación de las obras en el aludido humedal; sin embargo, no consta que, luego de más de dos meses, se hubiese atendido la situación denunciada ni que se hubiera notificado alguna respuesta. Máxime que, según lo autos, en la inspección efectuada por las autoridades municipales se constató la inexistencia de permisos municipales. De ahí que, al estar de por medio la posible afectación al ambiente, corresponde la estimatoria del recurso también contra el municipio accionado.
(…)
Por tanto:
Se declara con lugar el recurso. Se ordena: 1) A David Chavarría Morales y Jeffrey Hernández Espinoza, por su orden director ejecutivo a.i. y director regional del Área de Conservación Pacífico Central, ambos del Sistema Nacional de Áreas de Conservación, o quienes ocupen esos cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se analice íntegramente la situación denunciada por el accionante en la gestión de 25 de octubre de 2023, se resuelvan la totalidad de extremos alegados y, de resultar procedente, se emitan los actos administrativos que correspondan al ámbito de competencia del Sistema Nacional de Área de Conservación, todo lo cual deberá ser notificado al recurrente al medio señalado para tales efectos dentro del mismo plazo otorgado ut supra. (…)”.
En virtud de las consideraciones expuestas y tomando en consideración el precedente de cita, procede la estimatoria parcial de este extremo, en los términos que se dictarán en la parte dispositiva de este pronunciamiento.
Por otra parte, lo correspondiente a la adopción de medidas para la restauración de ecosistemas y las sanciones de los responsables de las actividades ilícitas, son aspectos propios de ser dilucidados en las vías ordinarias.
Finalmente, la persona recurrente aporta otra gestión fechada 20 de mayo de 2025; empero, ella fue formulada durante la tramitación de este proceso, por lo que prima facie se descarta alguna omisión a las nuevas solicitudes que hizo ahí. Sin embargo, no está de más señalar que la solicitud de informes “con evidencia satelital y fotográfica, que describa las intervenciones en el humedal (…) y su impacto en el ecosistema” que pretende que se emitan (en esos términos específicos), así como la inspección solicitada con el consecuente reporte de cumplimiento de medidas cautelares dictadas en una causa penal, corresponden a la elaboración de prueba técnica cuya procedencia o falta de emisión es propia de ser ventilada en las vías ordinarias y no en esta jurisdicción constitucional.
IV.2. Sobre la gestión planteada mediante oficio AEL-00172-2025.
Concerniente a este alegato, la Sala tiene por comprobado que el recurrente, por oficio AEL-00172-2025 de 12 de abril de 2025 dirigido al encargado de Control y Protección del ACLAC, señaló: “Ref: Solicitud de informe de seguimiento y acciones urgentes en la causa penal contra la Cooperativa Coopetrauto por presunto drenaje y relleno de humedal Estimado señor: Por medio de la presente, me dirijo a usted en su calidad de Encargado de Control y Protección del Área de Conservación Amistad Caribe (ACLAC), con el propósito de solicitar respetuosamente un informe detallado sobre el seguimiento a la causa penal iniciada contra la Cooperativa Coopetrauto, cédula jurídica 3-004-727922, por el presunto drenaje y relleno de un humedal en un proyecto inmobiliario ubicado en Santa Rosa, según el plano catastrado L-0036944-2023. Dado que los humedales suelen trascender las áreas donde se localizan y considerando su importancia ecológica, solicito de manera respetuosa que se realice una investigación exhaustiva utilizando fotografías históricas de la zona.
Esta investigación debería abarcar los antecedentes de cambio de uso del suelo tanto de la propiedad de la Cooperativa Coopetrauto como de la finca madre de la cual fue segregada dicha propiedad. Esta información es fundamental para efectos legales orientados a la protección y restauración del humedal afectado. Cabe destacar que los humedales forman parte del Patrimonio Natural del Estado, conforme lo establecen los artículos 262 del Código Civil, 2 de la Ley de Aguas, 13, 14, 15 y 39 inciso i) de la Ley Forestal, 32 y 38 de la Ley Orgánica del Ambiente, y 22 y 28 de la Ley de Biodiversidad. Este carácter prevalece incluso si dichas áreas han sido desprovistas de su vegetación original, lo que refuerza la necesidad de actuar con celeridad. Asimismo, reitero la urgencia de que, en el ámbito de sus competencias, interceda ante la Fiscalía para que se adopten medidas inmediatas de protección orientadas a la restauración del humedal.
En particular, solicito que se ordene el cierre de los drenajes realizados, con el fin de propiciar la recuperación del ecosistema. Los procesos judiciales en la vía ordinaria suelen prolongarse por años, lo que podría agravar el daño ambiental si no se toman acciones prontas. Agradeciendo de antemano su atención a esta solicitud y confiando en su compromiso con la conservación de nuestro patrimonio natural, quedo a la espera de su pronta respuesta”. El coordinador del programa de Prevención, Control y Protección del ACLAC, por oficio CARTA-SINAC-ACLAC-PPCP-037-2025 de 22 de abril de 2025 dirigido a Nombre01, refirió: “ASUNTO: Respuesta AEL-00172-2025. Estimada Don Nombre01, En atención a lo solicitado, como se indicó en el oficio CARTA-SINAC-ACLAC-PPCP-035-2025, el seguimiento que se lleva sobre esta causa denunciada ante la Fiscalía de Limón, bajo la causa judicial 23-000011-0472-PE, se ha entregado lo requerido a esa instancia según como ha correspondido.
En el cumplimiento administrativo y del orden judicial en resolución de los casos denunciados, esta dependencia es respetuosa del seguimiento que esta lleva en el proceso de resolución por parte del Ministerio Publico. Por lo que se le reitera que los informes que se elaboran para esta causa son dirigidos a la fiscalía, para que sean incorporados al expediente correspondiente”.
Sobre este aspecto, la Sala observa que la parte recurrente lo que solicitó fue “un informe detallado sobre el seguimiento a la causa penal iniciada contra la Cooperativa Coopetrauto y acciones urgentes en la causa penal (…) por el presunto drenaje y relleno de un humedal”, así como “que se realice una investigación exhaustiva utilizando fotografías históricas de la zona (…). Esta investigación debería abarcar los antecedentes de cambio de uso del suelo tanto de la propiedad de la Cooperativa Coopetrauto como de la finca madre de la cual fue segregada dicha propiedad”. De igual forma pidió que se “interceda ante la Fiscalía para que se adopten medidas inmediatas de protección orientadas a la restauración del humedal” y también que “se ordene el cierre de los drenajes realizados, con el fin de propiciar la recuperación del ecosistema”.
Al respecto, es importante resaltar que esta gestión es sustancialmente diferente a la abordada en el considerando anterior, pues no se aludió a alguna afectación ambiental ya en curso, sino que se habla del “presunto” drenaje y relleno de humedal que ocurrió. Ahora, tal como se indicó ut supra, la requerida adopción de medidas para la restauración de ecosistemas es un aspecto, en principio, propio de ser dilucidado en las vías ordinarias. Asimismo, la solicitud de informes “para efectos legales”, así como los requerimientos específicos que pide que se incluyan como “fotografías históricas (…) antecedentes de cambio de uso del suelo”, corresponden a la elaboración de prueba técnica, cuya procedencia o falta de emisión es propia de ser ventilada en las vías ordinarias y no en esta jurisdicción constitucional. Incluso, el accionante, en la gestión de marras pidió al ACLAC que intercediese ante la fiscalía para que se tomasen medidas y se ordenase el cierre de los drenajes; empero, en principio, estos aspectos son propios de ser dilucidados en la vía penal, según las particularidades del caso concreto. Por lo que, en los términos planteados en esta gestión, no se observa alguna acción u omisión que amerite la intervención de la Sala. Ergo, se declara sin lugar este extremo.
V.Voto salvado del Magistrado Salazar Alvarado. Con el debido respeto, disiento del voto de mayoría que declara con lugar el recurso, con base en las siguientes razones:
La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.
De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.
Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
VI.Documentación aportada al expediente. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso. Se ordena a Maylin Mora Arias y Alexis Salas Rodríguez, por su orden directora regional a. i. y encargado del programa de Control y Protección, ambos del Área de Conversación Amistad Caribe del Sistema Nacional de Área de Conservación, o a quienes ocupen tales cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se analice íntegramente la situación expuesta por el accionante en la gestión de 11 de abril de 2025 (oficio AEL-00168-2025) y se resuelvan los extremos correspondientes a las actividades en curso denunciadas de “tala, drenaje o fraccionamiento en los humedales y bosques”; además, de resultar procedente, se emitan los actos administrativos que correspondan al ámbito de competencia del Sistema Nacional de Área de Conservación, todo lo cual deberá ser notificado a la parte accionante al medio señalado para tales efectos dentro del mismo plazo otorgado ut supra.
Se advierte a las autoridades recurridas que, de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Sistema Nacional de Área de Conservación al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado salva el voto y declara sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado. Notifíquese.
