SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty-five in the morning on dieciseis de mayo de dos mil veinticinco.
Amparo proceeding (recurso de amparo) being processed under expediente número 23-024390-0007-CO, filed by Nombre02, identity card CED01, JUAN PABLO RAMÍREZ ALFARO, identity card CED02, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) and the MINISTERIO DE AMBIENTE Y ENERGÍA.
BACKGROUND:
For those procedures, it is necessary to meet requirements such as an official letter (oficio) signed by the ASADA’s legal representative detailing the request, a water balance (balance hídrico), the geographic coordinates of the water sources, the type of source, a water-quality analysis, and information regarding the property where the source is located (parcel and survey plan). With respect to the protection area (área de protección) of untapped sources (the areas referred to in art. 34 of the Ley Forestal), its demarcation or alignment falls within the authority of INVU, while boundary marking (amojonamiento) is the responsibility of the property owner. The foregoing is in accordance with legal opinion PRE- J-2023-03040. See evidence 3. This Office sent an email on 14 de setiembre de 2022 to the Submanagement Office for Delegated Systems Management, providing certain recommendations that we requested be taken into account in the formal response that the Submanagement Office for Delegated Systems Management was to issue to FEDAPRO.
See evidence 1. On 03 de noviembre de 2022, ORAC once again reiterated the considerations that we suggested be taken into account. See evidence 2. This was pursuant to official letters DA-1957-08-2022 and DA-0392-2023 from the Water Directorate of MINAE. The Metropolitan ORAC does not know whether the Submanagement Office for Delegated Systems Management responded to either the Water Directorate or FEDAPRO.” The foregoing indicates that this is a complex case requiring a comprehensive analysis, the performance of functions by other institutions (Water Directorate), and compliance with the requirements established for each operator (ASADA) under the Reglamento de ASADAS, as well as requests signed by the representatives of each delegated operator; it is not a simple request that can be addressed generally by AyA alone. The foregoing demonstrates that AyA has fulfilled its obligations regarding the appellant’s request, in consideration of the ASADA’s obligations, in accordance with Articles 1 and 2 of the Ley Constitutiva de AyA, as well as Articles 05; 21 subsections a), b), c), and i); 28 subsections a) and g); 37 subsection f); 41; 42; and 48 of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS).
All of the foregoing was done without infringing the appellant’s fundamental rights. It has therefore been demonstrated, as stated in the fourth and fifth facts, that AyA completed the procedures requested by the appellant within reasonable timeframes. It is clear to this Institute that, in the matter at issue, sufficient grounds exist to justify what was requested of and communicated to the ASADA so that, within the Institute’s authority, the actions necessary to provide a definitive solution to the situation may be addressed. This entails the participation of these organizations and their fulfillment of the obligations imposed on them by the Reglamento de Asadas: “It is reiterated that each ASADA must follow due process (debido trámite) when submitting a request for a flow allocation (asignación de caudal) or for the correction of any of its sources with respect to geographic coordinates, allocated flow, or source type,” as previously explained and taken into account in analyzing the request submitted, given the required coordination.
As stated above, this requires technical studies and contracting for studies by the ASADA in order to resolve the situation. In conclusion, we can state the following: 1-There are operators (ASADAS) within their area of jurisdiction that have obligations and rights concerning the provision of service in the Naranjo de Alajuela sector. 2- Using the funds derived from service-rate revenues, those ASADAS must address the quality of environmental management and water resources, with the guidance of AyA as the Governing Authority, as stated by the Metropolitan ORAC: “It is reiterated that each ASADA must follow due process when submitting a request for a flow allocation or for the correction of any of its sources with respect to geographic coordinates, allocated flow, or source type.” 3- In accordance with the provisions established by the Metropolitan ORAC through official letter GSD- UEN-GAR-2023-03716, the appellant’s request has already been processed so that the procedure may continue within AyA’s authority. 4- Input from and coordination with the Water Directorate are required in connection with the appellant’s request.
For the reasons stated, we can affirm that the entity I represent has neither failed to fulfill its responsibilities nor violated the appellant’s fundamental rights, much less the appellant’s right to health or life or right to a response.”
Subsequently, on October 10, 2022, by means of official letter DA-1541-2022 dated October 4, 2022, addressed to Ms. Pilar DallAnesse, Deputy Manager of Delegated Aqueduct Systems at AyA, she was requested to review the information provided regarding the geolocation of the water intakes registered in that institution’s name throughout the country, the political-administrative division, as well as the type of source assigned and the registered flow rate, for the purpose of updating the National Registry of Water and Watercourse Concessions. As of the date of this report, one year having elapsed since notification of the aforementioned official letter, this Directorate has received no response from that institution. On October 19, 2022, by means of official letter DA-1779-2022 dated October 18, 2022, addressed to Mr. Roberto Guzmán Gutiérrez, Executive President of the Costa Rican Institute of Aqueducts and Sewers, he was requested to update the information stored in the National Concessions Registry associated with AyA throughout the country, given that registered sources have been found that are no longer in use, as well as field changes to water intakes, cartographic locations, the application of protection setback areas pursuant to Article 31 of the Water Law due to errors in the location of sources in the field or in the system, etc., which causes difficulties both for institutions and for the general public.
As of the date of this report, and with only a few days remaining until one year has elapsed since notification of the aforementioned official letter, this Directorate has received no response from that institution. As a follow-up to official letter DA-1957-08-2022 dated August 19, 2022, which was duly served on November 10, 2022, official letter DA-0392-223 dated February 16, 2023, duly served on February 17, 2023, was sent to Ms. Rosa María Gómez Arce, Director of the Rural Aqueduct Management Strategic Business Unit of the Costa Rican Institute of Aqueducts and Sewers, informing her that the information requested by this Directorate relates to a request submitted by Nombre02 and Pablo Ramírez Alfaro, representing the Federation of Aqueducts of the El Cayote Protected Zone (FEDAPRO), who require verification and possible correction of the geolocation of the water intakes registered in the names of various ASADAS in the canton of Naranjo, as well as the typology or classification of those bodies of water.
As of the date of this report, and seven days short of 8 months since the follow-up letter was sent, this Directorate has received no response from that institution. It is clear from the foregoing that the Water Directorate has acted diligently and proactively in its efforts to ensure that the information contained in the National Registry of Water and Watercourse Concessions, as well as in the National Information System for Integrated Water Resources Management (Sinigirh), is correct, taking the pertinent actions so that the entities responsible for supplying the information review and verify it, in order to guarantee the reliability of the information entered into said registry; however, despite these efforts and repeated requests, no response has been received to date from the Costa Rican Institute of Aqueducts and Sewers. The Water Directorate will continue to follow up on the steps taken to obtain the required information, so that it may subsequently be entered into the National Registry of Water and Watercourse Concessions, as well as into the National Information System for Integrated Water Resources Management (Sinigirh).”
Justice Cruz Castro authored the decision; and,
Whereas:
Before examining the merits of the matter—concerning the alleged violation of the right to prompt and proper administrative proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), both for issuing a final administrative act (acto final) concluding an administrative proceeding—initiated ex officio (de oficio) or at a party’s request (a instancia de parte)—and for adjudicating the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception because it concerns a complaint filed regarding a problem related to the registration and location of water sources. Having clarified that point, the Court proceeds to rule on the specific situation raised in this amparo proceeding (amparo).
The petitioning party files a petition for amparo (recurso de amparo) and states that there is a serious failure to update and ensure the accuracy of official records concerning water sources in the canton of Naranjo, a situation that they consider to violate the constitutional rights to a healthy environment, access to environmental information, and protection of water resources (arts. 21, 50 and related provisions of the Constitución Política). They maintain that, after conducting technical studies and fieldwork, they detected significant inconsistencies between the actual springs (nacientes), rivers, and streams in the canton of Naranjo and the information recorded in the Sistema Nacional de Información del Recurso Hídrico and the Registro Nacional de Concesiones y Aprovechamientos de Agua. They specifically state that at least 122 springs were incorrectly classified as rivers or streams and that many of these sources were poorly georeferenced (georreferenciación), which could cause irreversible environmental damage, affect legally established protected areas (áreas de protección), and jeopardize the drinking-water supply for thousands of people.
They state that on 19 de mayo de 2022 they filed a complaint with the Dirección de Aguas, identifying the risks of maintaining inaccurate records. In response, through official letter DA-1906-08-2022, the Dirección claimed that it was not responsible for updating the information, attributing that task to ICAA. They consider that this response reflects excessive formalism that prevents diligent and timely action in the face of a serious environmental problem. Subsequently, on 12 de septiembre de 2022, they also filed a complaint with ICAA, requesting that the records be updated and that the corresponding interinstitutional coordination be undertaken. However, they assert that more than one year later no effective action has been taken to correct the information, perpetuating what they describe as “serious underrecording” (mal subregistro), which affects not only the canton of Naranjo but possibly the entire national territory, jeopardizing the right of future generations to a healthy environment and access to water.
They request that the Sala Constitucional order: 1. The urgent correction of erroneous data concerning springs and streams in the canton of Naranjo, prioritizing sources used for human consumption. 2. Effective coordination among the Dirección de Aguas, ICAA, Ministerio de Ambiente y Energía, SINAC, and Ministerio de Salud to reverse the situation involving irregularities and illegal encroachments in protected areas. 3. The review and correction of records nationwide. 4. The submission of detailed reports on the actions taken with respect to the ASADAS in both the canton of Naranjo and the rest of the country. 5. The preparation of a correction and monitoring schedule, with the participation of the interested parties and an accessible copy thereof. They maintain that the alleged omission constitutes a violation of the principles of access to environmental information, environmental protection, and protection of water resources recognized by the Constitution and the case law of the Sala Constitucional.
The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondent authority failed to address them, as directed in the initial order:
Facts related to the Instituto Costarricense de Acueductos y Alcantarillados:
1. On 12 de septiembre de 2022, the Federación de Acueductos Comunales (FEDAPRO) submitted to the Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (AyA) a document without an official-letter number, in which it reported errors in the categorization and geographic location of water sources in the canton of Naranjo, according to records of the Dirección de Aguas del MINAE. It also requested that this information be corrected and that interinstitutional measures be implemented to address illegal encroachments in spring protection zones (zonas de protección de nacientes) (see report submitted by the respondent authorities).
2. On 14 de septiembre de 2022, the Oficina Regional de Acueductos Comunales (ORAC) Metropolitana del AyA sent an email to the Subgerencia de Gestión de Sistemas Delegados containing recommendations for formally responding to FEDAPRO. Subsequently, on 3 de noviembre de 2022, ORAC reiterated those considerations, referring to official letters DA-1957-08-2022 and DA-0392-2023 issued by the Dirección de Aguas del MINAE (see report submitted by the respondent authorities).
3. The Subgerencia de Gestión de Sistemas Delegados del AyA processes requests such as the allocation of flow (asignación de caudal) or correction of coordinates (rectificación de coordenadas), upon submission of specific requirements by each ASADA, including an official letter signed by its legal representative, a water balance (balance hídrico), a water-quality analysis, and documentation concerning ownership of the source (see report submitted by the respondent authorities).
4. On 02 de mayo de 2025, through official letter N.° GSD-UEN-GAR-2025-01619, the Subgerencia de Gestión de Sistemas Delegados addressed official letters DA-1957-08-2022, dated 19 de agosto de 2022, concerning the verification and correction of the geolocation and classification of ASADA water sources in the canton of Naranjo; DA-1541-2022, dated 04 de octubre de 2022, concerning the review of georeferencing data, source type, and intake flow rates nationwide; and DA-0392-223, dated 16 de febrero de 2023, following up on official letter DA-1957-08-2022. The letter detailed the updating process that the Subgerencia had been carrying out as part of a continuous-improvement policy, as well as the proceedings still awaiting resolution, recorded in Anexo 2 (SG-GSD-2025-00245). It also reported the matters resolved by the Dirección de Aguas (Anexo 3) and reminded the ASADAS of their responsibility for water-resource management (gestión del recurso hídrico) through official letter GSD-UEN-GAR-2025-01622 (Anexo 4) (see report submitted by the respondent authorities).
5. To correct data such as coordinates or source type, each ASADA must submit a technical case file (expediente técnico) containing: a formal request, identification of the professional responsible for the study, graphic evidence, detailed technical information concerning the sources, and a field-verification table containing high-precision data (see report submitted by the respondent authorities).
6. With respect to official letter DA-1779-2022 dated 18 de octubre de 2022, concerning the updating of the Registro Nacional de Concesiones, it was stated that no formal notice or assignment of the case had been received and that the matter had therefore not been addressed (see report submitted by the respondent authorities).
7. Lic. Sergio Romero, of the Dirección de Planificación del AyA, was designated through official letter PRE-2020-00087 dated 29 de enero de 2020 as liaison with the Dirección de Agua del MINAE. Since that date, he has received no new update requests from the SINIGIRH administrator, but a measure was announced to create a new geoservice (geoservicio) through the AyA internal portal to facilitate the updating of data by MINAE (see report submitted by the respondent authorities).
8. There is no joint schedule for correcting inconsistencies in water-source records nationwide or in the canton of Naranjo, and progress in this area depends on institutional capacity and the receipt of new requests (see report submitted by the respondent authorities).
Facts related to the Dirección de Aguas del Ministerio de Ambiente y Energía:
1. On 19 de mayo de 2022, FEDAPRO filed a written complaint with the Dirección de Aguas describing the possible adverse consequences of maintaining inaccurate records for both captured and uncaptured springs (nacientes captadas como no captadas), streams, and their respective protection zones (see report submitted by the respondent authorities).
2. Through official letter DA-1906-08-2022 dated 18 de agosto de 2022, the Dirección de Agua responded that, although it maintains the aforementioned records, it is not the entity responsible for updating them because that function formally falls to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), which must provide the verified information. That official letter also stated that on 12 de septiembre de 2022 an environmental complaint (denuncia ambiental) was filed with AyA, requesting that the data be updated and that interinstitutional coordination be undertaken, but no satisfactory response had been received (see report submitted by the respondent authorities).
3. Through official letter DA-1541-2022 dated 4 de octubre de 2022, addressed to the Subgerente de Sistemas de Acueductos Delegados del AyA, the Dirección de Aguas requested a review of the registered intakes (tomas inscritas) nationwide, including geolocation data, source type, and flow rate (see report submitted by the respondent authorities).
4. Through official letter DA-1779-2022 dated 18 de octubre de 2022, addressed to the Presidente Ejecutivo del AyA, the Dirección de Aguas requested that the records associated with the Instituto be updated after identifying sources that were unused or incorrectly located (see report submitted by the respondent authorities).
5. Through official letter DA-1957-08-2022 dated 19 de agosto de 2022, served on 10 de noviembre de 2022, the Dirección de Aguas sent the Directora de la UEN Gestión de Acueductos Rurales del AyA a list of sources registered by various ASADAS in the canton of Naranjo, for the purpose of verifying their location and source type (see report submitted by the respondent authorities).
6. Through official letter DA-0392-223 dated 16 de febrero de 2023, served on 17 de febrero de 2023, the Dirección de Aguas reiterated the previous request and stated that the action had been taken in response to a submission by FEDAPRO, presented by Nombre02 and Pablo Ramírez Alfaro, concerning the possible correction of water-source data (see report submitted by the respondent authorities).
7. The Dirección de Aguas has been unable to make corrections in the Registro Nacional de Concesiones de Agua or the Sistema Nacional de Información para la Gestión Integrada del Recurso Hídrico (SINIGIRH), because any modification requires official confirmation from AyA, particularly concerning geographic coordinates, flow rates, and source classification; altering such records without documentary support could have legal implications, particularly with respect to the protection regime (régimen de protección) established in Article 31 of the Ley de Aguas (see report submitted by the respondent authorities).
8. The Dirección de Aguas conducted field inspections as part of its technical oversight plan (plan de control técnico), which revealed discrepancies between the locations reported by AyA and those observed on site. In these cases, the Dirección notified AyA in writing and requested the corresponding corrections, but received no response (see report submitted by the respondent authorities).
9. The records for the canton of Naranjo remain unchanged because no official information has been received from AyA that would allow the data to be validated or corrected. Nevertheless, in early 2025, through official letters SB-AID-2025-000016 dated 15 de enero de 2025 and UEN-GA-2025-00065-SB-AID-2025, AyA requested the removal of duplicate sources registered under administrative case file (expediente administrativo) 602-R; the request was processed and implemented by the Dirección de Aguas, although it was not specified whether those sources are located in the canton of Naranjo (see report submitted by the respondent authorities).
Regarding this issue, in judgment no. 2022022070 at 9:20 hours on 23 de setiembre de 2022, this Court stated:
“Concerning the nature of the grievances alleged in the case at hand (sub lite), this Court has ruled repeatedly on the right to a healthy and ecologically balanced environment. For example, in judgment no. 2021024807 at 9:20 hours on 5 de noviembre de 2021, this Chamber stated:
“On repeated occasions, the case law of this Chamber has emphasized that the right to a healthy and ecologically balanced environment is recognized at both the constitutional and conventional levels. It has likewise indicated that the effective protection of that right requires resources to be used rationally, in which context the State and the general public must act in accordance with the principles governing environmental matters. In this regard, specialized legal scholarship has stated that the preventive principle (principio preventivo) requires that, when there is certainty regarding possible harm to the environment, the activity causing the harm must be prohibited, limited, or made subject to compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; it is also useful when no technical reports or administrative permits guarantee the sustainability of an activity, but sufficient elements exist to foresee potential adverse impacts.
The precautionary principle (principio precautorio), in turn, provides that, where there is a danger of serious and irreversible harm, the lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation. It follows that this principle is based on reasonable scientific uncertainty together with the threat of serious and irreversible environmental harm. In general terms, a relevant distinction between the preventive and precautionary principles lies in the degree of knowledge and certainty regarding the risks posed by an activity or project. Whereas such certainty exists under the former, the latter involves a state of doubt resulting from scientific information or technical studies. Thus, the Costa Rican State is required to adopt measures that ensure the effective defense and preservation of the environment in accordance with those principles.
However, that objective obligation does not inevitably entail a subjective right (derecho subjetivo) for individuals to demand, through judicial bodies, that a particular measure be taken; it does entail the right to have suitable measures adopted to safeguard that right in the face of openly negligent conduct by authorities or by natural and legal persons, in accordance with the recognized theory of the horizontal effect of fundamental rights (eficacia horizontal de los derechos fundamentales) (Drittwirkung der Menschenrechte), one of whose procedural manifestations is the amparo proceeding (amparo) against persons governed by private law.
It is also important to emphasize that the Inter-American Court of Human Rights, in Advisory Opinion OC-23/17 of 15 de noviembre de 2017, elaborated on State obligations concerning the environment in order to safeguard the human rights enshrined in the American Convention on Human Rights.
In that opinion, the Court recognized the interrelationship between environmental protection and the realization of other rights, insofar as environmental degradation affects the effective enjoyment and development of human rights. In this regard, it stated:
“47. This Court has recognized the existence of an undeniable relationship between environmental protection and the realization of other human rights, insofar as environmental degradation and the adverse effects of climate change affect the effective enjoyment of human rights. Likewise, the preamble to the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (hereinafter, the “Protocol of San Salvador”) highlights the close relationship between the effectiveness of economic, social and cultural rights—which include the right to a healthy environment—and that of civil and political rights, and indicates that the different categories of rights constitute an indivisible whole grounded in recognition of the dignity of the human person; consequently, they require permanent protection and promotion in order to achieve their full effectiveness, and the violation of some rights can never be justified for the sake of realizing others (…)
49. For its part, the Inter-American Commission has emphasized that several fundamental rights require a minimum level of environmental quality as a necessary precondition for their exercise and are profoundly affected by the degradation of natural resources. Similarly, the OAS General Assembly has recognized the close relationship between environmental protection and human rights (supra para. 22) and has emphasized that climate change has adverse effects on the enjoyment of human rights. 50. In the European sphere, the European Court of Human Rights has recognized that severe environmental degradation may affect an individual’s well-being and, consequently, result in violations of personal rights, such as the rights to life, respect for private and family life68, and private property. Similarly, the African Commission on Human and Peoples’ Rights has indicated that the right to a “generally satisfactory environment favorable to development” is closely related to economic and social rights insofar as the environment affects an individual’s quality of life and security (…) 52.
Furthermore, international law broadly recognizes the interdependent relationship among environmental protection, sustainable development, and human rights. This interrelationship has been affirmed since the Stockholm Declaration on the Human Environment (hereinafter, the “Stockholm Declaration”), which established that “[e]conomic and social development is essential for ensuring a favorable living and working environment for man and for creating conditions on earth that are necessary for the improvement of the quality of life,” thereby affirming the need to balance development with the protection of the human environment. Subsequently, in the Rio Declaration on Environment and Development (hereinafter, the “Rio Declaration”), States recognized that “[h]uman beings are at the centre of concerns for sustainable development” and also emphasized that “[i]n order to achieve sustainable development, environmental protection shall constitute an integral part of the development process.” Following from the foregoing, the Johannesburg Declaration on Sustainable Development established the three pillars of sustainable development: economic development, social development, and environmental protection.
Likewise, in the corresponding Plan of Implementation of the World Summit on Sustainable Development, States recognized that consideration should be given to the possible relationship between the environment and human rights, including the right to development. 53. In addition, when adopting the 2030 Agenda for Sustainable Development, the United Nations General Assembly recognized that the realization of the human rights of all persons depends on achieving the three dimensions of sustainable development: economic, social, and environmental. Similarly, several instruments within the inter-American sphere have addressed environmental protection and sustainable development, such as the Inter-American Democratic Charter, which provides that “[t]he exercise of democracy promotes the preservation and sound management of the environment”; accordingly, “it is essential that the states of the Hemisphere implement policies and strategies to protect the environment, including application of various treaties and conventions, to achieve sustainable development for the benefit of future generations” (…) 55.
As a consequence of the close connection among environmental protection, sustainable development, and human rights (supra paras. 47 to 55), currently (i) multiple human-rights protection systems recognize the right to a healthy environment as a right in itself, particularly the inter-American human rights system, while there is no doubt that (ii) many other human rights are vulnerable to environmental degradation, all of which entails a series of environmental obligations for States in order to fulfill their obligations to respect and guarantee those rights. Indeed, another consequence of the interdependence and indivisibility of human rights and environmental protection is that, when determining these State obligations, the Court may draw upon the principles, rights, and obligations of international environmental law, which, as part of the international corpus juris, decisively help to establish the scope of the obligations arising from the American Convention in this area (supra paras. 43 to 45) (…) 59.
The human right to a healthy environment has been understood as a right with both individual and collective dimensions. In its collective dimension, the right to a healthy environment constitutes a universal interest owed to both present and future generations. The right to a healthy environment also has an individual dimension, insofar as its violation may have direct or indirect repercussions on persons because of its connection with other rights, such as the rights to health, personal integrity, and life, among others. Environmental degradation may cause irreparable harm to human beings; consequently, a healthy environment is a fundamental right for the existence of humanity.”.
This interrelationship between the environment and the enjoyment of other human rights has also been recognized by the United Nations Human Rights Council, which, in resolution A/HRC/RES/46/7, adopted on 23 de marzo de 2021 during its 46° session, held:
“Recognizing also that sustainable development and environmental protection, including the protection of ecosystems, contribute to human well-being and the enjoyment of human rights, particularly the rights to life, to the enjoyment of the highest attainable standard of physical and mental health, to an adequate standard of living, to adequate food, to safe drinking water and sanitation, and to housing, as well as cultural rights.”.
More recently, in resolution A/HRC/RES/48/13, adopted on 8 de octubre de 2021, that Council stated:
“(…) Recognizing that sustainable development, in its three dimensions (social, economic and environmental), and the protection of the environment, including ecosystems, contribute to and promote human well-being and the enjoyment of human rights, including the enjoyment of the rights to life, to the highest attainable standard of physical and mental health, to an adequate standard of living, to adequate food, to housing, to safe drinking water and sanitation, and to participation in cultural life, for present and future generations (…)
Further recognizing that environmental degradation, climate change, and unsustainable development are among the most pressing and serious threats to the ability of present and future generations to enjoy human rights, including the right to life (…)
Recognizing the importance of a clean, healthy, and sustainable environment as essential to the enjoyment of all human rights (…)
1. Recognizes the right to a clean, healthy, and sustainable environment as a human right important for the enjoyment of human rights; 2. Notes that the right to a clean, healthy, and sustainable environment is related to other rights and existing international law (…)”. (Emphasis not in the original).
This reflects the particular importance of the fundamental right to a healthy and ecologically balanced environment, whose defense transcends the protection of this constitutional interest in itself, since its preservation is an essential factor in effectively safeguarding other fundamental human interests (such as life, health, property, and equality); thus, if the former is not protected, the latter cannot be effectively safeguarded.
Furthermore, in the aforementioned opinion, the Inter-American Court of Human Rights recognized the right to a healthy environment as an autonomous right capable of protection irrespective of any risk of harm to individual persons. In this regard, it held:
“62. This Court considers it important to emphasize that the right to a healthy environment as an autonomous right, unlike other rights, protects environmental components such as forests, rivers, seas, and others as legally protected interests in themselves, even in the absence of certainty or evidence regarding risks to individual persons. Nature and the environment must be protected not only because of their connection to a benefit for human beings or because of the effects their degradation could have on other individual rights, such as health, life, or personal integrity, but also because of their importance to the other living organisms with which the planet is shared, which likewise merit protection in themselves. In this regard, the Court notes a trend toward recognizing legal personality and, consequently, rights of nature, not only in judicial decisions but even in constitutional legal systems. 63. Accordingly, the right to a healthy environment as an autonomous right is distinct from the environmental content arising from the protection of other rights, such as the right to life or the right to personal integrity.”. (Emphasis not in the original).
This position was adopted in the judgment of 6 de febrero de 2020 concerning the case “Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina,” in which, moving beyond an anthropocentric approach, the CorteIDH affirmed that the right to a healthy environment, in addition to being fundamental to the very existence of human beings, constitutes an autonomous and universal right; consequently, the protection of various environmental components (such as forests, seas, rivers, and others) constitutes a legally protected interest in itself. In the words of the CorteIDH: “The purpose is to protect nature,” not only because of its “usefulness” or “effects” with respect to human beings, “but because of its importance to the other living organisms with which the planet is shared.” Given the significance of this statement, it is appropriate to reproduce this passage from the aforementioned decision:
“203. The Court has already addressed the content and scope of this right, taking into account various relevant provisions, in its Advisory Opinion OC-23/17, to which it therefore refers. On that occasion, it affirmed that the right to a healthy environment “constitutes a universal interest” and “is a fundamental right for the existence of humanity,” and that “as an autonomous right […] it protects environmental components, such as forests, seas, rivers, and others, as legally protected interests in themselves, even in the absence of certainty or evidence regarding risks to individual persons. The purpose is to protect nature,” not only because of its “usefulness” or “effects” with respect to human beings, “but because of its importance to the other living organisms with which the planet is shared.” The foregoing does not preclude, of course, the possibility that other human rights may be violated as a consequence of environmental harm.”. (Emphasis not in the original).
Based on the foregoing, this Chamber, as guarantor of fundamental rights, must ensure compliance with treaty and constitutional obligations, which require the State not only to recognize the rights enshrined therein, but also to establish the legal measures necessary to safeguard them” (emphasis in the original).
Furthermore, the United Nations General Assembly recently adopted resolution no. A/RES/76/1-A/RES/76/300 of 28 de julio de 2022, which states:
“1. Recognizes the right to a clean, healthy, and sustainable environment as a human right; 2. Notes that the right to a clean, healthy, and sustainable environment is related to other rights and existing international law; 3. Affirms that promoting the human right to a clean, healthy, and sustainable environment requires the full implementation of multilateral environmental agreements in accordance with the principles of international environmental law; 4. Calls upon States, international organizations, businesses, and other relevant stakeholders to adopt policies, enhance international cooperation, strengthen capacity-building, and continue sharing good practices in order to intensify efforts to ensure a clean, healthy, and sustainable environment for all”.
This resolution is the formal expression of the will of the principal deliberative, policymaking, and representative body of the United Nations. Consequently, it constitutes a universal political commitment that must be regarded as a highly significant source of soft law.
Specifically, resolution no. A/RES/76/1-A/RES/76/300 affirms that the right to a healthy and ecologically balanced environment is a human right. To a considerable extent, this contributes to its codification, resulting in its technical understanding as a “fundamental right.” It likewise reinforces the notion that environmental protection is an “autonomous” human right—that is, one that has value in itself—such that, on the one hand, it possesses its own conceptual existence, distinct from the environmental content that undoubtedly arises from the protection of other rights (such as life or health), and, on the other hand, the object of its protection extends beyond human beings because it safeguards the various components of nature due to their importance in preserving the existence of living organisms generally, irrespective of their usefulness to human beings.
It also reiterates and thereby strengthens the position that the right to a healthy and ecologically balanced environment is linked to other human rights, meaning that its violation may result in the infringement of health, life, and democratic sustainable development, to cite only a few examples. This gives the right in question particularly significant legal meaning.
In addition, the UN General Assembly provides that protecting the right to a healthy and ecologically balanced environment requires the full implementation of treaty-based rights relating to the environment, in accordance with the principles of international environmental law. It follows that this right must necessarily be included within this Chamber’s judicial review of constitutionality (control jurisdiccional de constitucionalidad).
Lastly, in keeping with the recognized theory of the horizontal effect of fundamental rights (eficacia horizontal de los derechos fundamentales) (Drittwirkung der Menschenrechte), resolution no. A/RES/76/1-A/RES/76/300 provides that the obligation to safeguard the environment extends beyond States to international organizations, businesses, and other stakeholders, the latter term encompassing human beings generally. It is precisely in this regard that the Ley de la Jurisdicción Constitucional provides for amparo proceedings (amparo) against private-law entities.
In sum, under the conceptual framework explained ut supra, this Constitutional Court, as guarantor of fundamental rights, must ensure compliance with the treaty and constitutional commitments that impose upon the Costa Rican State and society generally not only the obligation to recognize environmental rights, principles, and values, but also the obligation to implement all measures and actions necessary to ensure their effective protection” (emphasis in the original).
After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party (amparada) were violated. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, established in article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of this matter duly establish that the problem reported by the petitioner (parte recurrente), concerning inconsistencies in the classification and georeferencing of multiple water sources in the canton of Naranjo, has not been addressed with due diligence and has not led to sufficient institutional action to ensure the proper updating of official records. Indeed, although the record shows that AyA and the Dirección de Aguas exchanged communications and that the former did not issue official letter N.° GSD-UEN-GAR-2025-01619, as a partial response to several prior requests, until 2 de mayo de 2025, those efforts were belated, fragmented, and lacked effective follow-up.
It should be noted that, although AyA did respond through official letter N.° GSD-UEN-GAR-2025-01619 of 2 de mayo de 2025 to some of the requests submitted by the Dirección de Aguas—including official letters DA-1957-08-2022, DA-1541-2022, DA-0392-2023, and DA-1779-2022—that response constitutes belated action, taken almost three years after the problem first arose. Moreover, the response submitted by AyA was incomplete, lacked final technical determinations regarding the critical points identified, and did not include an operational timetable for reviewing and updating the erroneous data at either the local or national level.
Moreover, the Dirección de Aguas has acknowledged that it cannot make corrections to the records without first receiving formal confirmation from AyA, which has created an administrative standstill that perpetuates the existence of incorrect or outdated data concerning sources used for human water supply. While it is understood that the Dirección de Aguas cannot, on its own initiative, modify georeferenced data, flow rates, or typological classifications without the corresponding official confirmation from AyA, consistent with the allocation of administrative powers, this does not relieve it of its constitutional duty to act diligently in the face of substantial environmental risks. The passive, wait-and-see approach adopted by both institutions reveals a pattern of institutional inaction incompatible with the precautionary and preventive principles governing environmental matters and with international standards of enhanced due diligence in protecting water resources.
In this regard, the structural failure to act, by both AyA and the Dirección de Aguas, constitutes a real and present threat to the right to a healthy and ecologically balanced environment, as well as to the right of access to environmental information and the safeguarding of water resources, particularly because these are springs (nacientes), rivers, and streams that constitute public-domain property (bienes de dominio público), the use and conservation of which are essential to the lives and health of thousands of people. The failure to update and verify this data may not only have serious and irreversible environmental consequences, such as harm to legally protected areas, but also compromises the principle of sustainability in water-resource management. In this regard, this Court finds that the response given by the competent authorities has been shaped by excessive formalism, contrary to the principle of effectiveness in the protection of fundamental rights.
Neither robust interinstitutional coordination nor a clear timetable of specific measures to correct the erroneous information has been pursued. Likewise, the absence of a comprehensive policy or national timetable for updating water-source records has been established, further reinforcing the perception that the state apparatus has failed to act on an issue of great environmental and social sensitivity. It should be emphasized that the inaccurate registration of a spring as a stream or river entails substantive legal consequences, such as the improper reduction of protected areas, exposure of the flow to unregulated water withdrawals (captaciones), failure to oversee the use of the resource, and the lack of protection for sensitive ecosystems. Far from being merely technical or administrative, these consequences affect the essential core of fundamental rights protecting people’s lives, health, and well-being, as well as the environment.
Accordingly, it is concluded that the alleged failure to act violates the fundamental rights invoked, particularly the right to a healthy environment (Article 50 of the Constitution), the right to health (Article 21 of the Constitution), and access to environmental information. Consequently, this constitutional protection action (recurso de amparo) is granted to ensure the immediate updating, verification, and correction of the identified records, as stated in the operative portion of this judgment.
VI.NOTE BY JUSTICE CASTILLO VÍQUEZ CONCERNING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE (JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, jurisdiction over the legal dispute lies with the Tribunales de lo Contencioso-Administrativo rather than this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the constitutional protection action provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner believes that the Administration’s physical actions, administrative acts, or response are affecting the petitioner’s fundamental rights.
In my view, the recently enacted legislation does not require this Court to modify its line of precedent, since, under Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through constitutional amparo proceedings (proceso constitucional de garantía del amparo), in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days following notice of this judgment. Otherwise, any material not collected within that period shall be destroyed, in accordance with the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The constitutional protection action is GRANTED. Consequently, JUAN MANUEL QUESADA ESPINOZA, in his capacity as Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, and JOSÉ MIGUEL ZELEDÓN CALDERÓN, in his capacity as Director de la Dirección de Agua del Ministerio de Ambiente y Energía, are ordered, within SIX MONTHS following notice of this judgment, to: 1. Verify and, where appropriate, correct the georeferencing, typological classification, and other technical data pertaining to the water sources registered in the cantón de Naranjo, giving priority to those used for human consumption by the ASADAS; 2. Jointly submit to this Chamber a detailed and complete report on the measures taken, the results obtained, and the matters still pending resolution in connection with the foregoing; 3. Design and implement a public timetable for reviewing, verifying, and updating the national water-source records (SINIGIRH and Registro Nacional de Concesiones), with the participation of the ASADAS and interested organizations, which shall specify deadlines, responsible institutions, and mechanisms for public monitoring and oversight. 4.
Ensure that the official designated by the Instituto Costarricense de Acueductos y Alcantarillados as liaison with SINIGIRH coordinates with the Dirección de Agua del MINAE and the Dirección de Sistemas de Información del AyA to initiate the procedure for updating and publishing the corrected data. The respondents are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional protection action that the person is required to comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in proceedings to enforce the judgment before the contentious-administrative jurisdiction. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del dieciseis de mayo de dos mil veinticinco .
Recurso de amparo que se tramita en el expediente número 23-024390-0007-CO interpuesto por Nombre02, cédula de identidad CED01, JUAN PABLO RAMÍREZ ALFARO, cédula de identidad CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) y el MINISTERIO DE AMBIENTE Y ENERGÍA.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante una denuncia interpuesta por un problema relacionado con el registro y localización de fuentes de agua. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
La parte recurrente interpone recurso de amparo y expone que existe una grave omisión en la actualización y veracidad de los registros oficiales sobre fuentes de agua en el cantón de Naranjo, situación que consideran vulnera los derechos constitucionales al ambiente sano, al acceso a información ambiental y a la protección del recurso hídrico (arts. 21, 50 y conexos de la Constitución Política). Sostienen que, tras realizar estudios técnicos y trabajo de campo, detectaron inconsistencias significativas entre la realidad de las nacientes, ríos y quebradas del cantón de Naranjo y la información registrada en el Sistema Nacional de Información del Recurso Hídrico y el Registro Nacional de Concesiones y Aprovechamientos de Agua. Señalan, en particular, que al menos 122 nacientes fueron incorrectamente clasificadas como ríos o quebradas y que existe una mala georreferenciación de muchas de estas fuentes, lo cual puede provocar daños ambientales irreversibles, afectar las áreas de protección legalmente establecidas y comprometer el abastecimiento de agua potable para miles de personas.
Refieren que el 19 de mayo de 2022 presentaron una denuncia ante la Dirección de Aguas, señalando los riesgos de mantener registros inexactos. Como respuesta, mediante el oficio DA-1906-08-2022, la Dirección alegó no ser responsable de actualizar la información, atribuyendo esa labor al ICAA. Consideran que esta respuesta incurre en un exceso de formalismo que impide la acción diligente y oportuna ante una problemática ambiental grave. Posteriormente, el 12 de septiembre de 2022, también denunciaron ante el ICAA, solicitando la actualización de los registros y la coordinación interinstitucional correspondiente. Sin embargo, afirman que más de un año después no se ha realizado ninguna acción efectiva para corregir la información, perpetuando lo que describen como un “mal subregistro” que afecta no solo al cantón de Naranjo, sino posiblemente a todo el territorio nacional, poniendo en riesgo el derecho de las generaciones futuras a un ambiente sano y al acceso al agua.
Solicitan a la Sala Constitucional ordenar: 1. La corrección urgente de los datos erróneos sobre nacientes y quebradas en el cantón de Naranjo, priorizando las fuentes utilizadas para consumo humano. 2. La coordinación efectiva entre la Dirección de Aguas, el ICAA, el Ministerio de Ambiente y Energía, el SINAC y el Ministerio de Salud, para revertir la situación de irregularidades e invasiones ilegales en áreas de protección. 3. La revisión y corrección de los registros a nivel nacional. 4. La rendición de informes detallados sobre las acciones tomadas respecto a las ASADAS tanto del cantón de Naranjo como del resto del país. 5. La elaboración de un cronograma de corrección y seguimiento, con participación de los interesados y copia accesible del mismo. Sostienen que la omisión denunciada constituye una violación a los principios de acceso a información ambiental, tutela del ambiente y protección del recurso hídrico reconocidos constitucionalmente y por la jurisprudencia de la Sala Constitucional.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Hechos relacionados con el Instituto Costarricense de Acueductos y Alcantarillados:
1. El 12 de septiembre de 2022, la Federación de Acueductos Comunales (FEDAPRO) presentó ante la Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (AyA) un documento sin número de oficio, mediante el cual denunció errores en la categorización y localización geográfica de fuentes de agua en el cantón de Naranjo, según registros de la Dirección de Aguas del MINAE. Asimismo, se solicitó la corrección de dicha información y la implementación de medidas interinstitucionales para atender las invasiones ilegales en zonas de protección de nacientes (ver informe rendido por parte de las autoridades accionadas).
2. El 14 de septiembre de 2022, la Oficina Regional de Acueductos Comunales (ORAC) Metropolitana del AyA remitió un correo electrónico a la Subgerencia de Gestión de Sistemas Delegados, en el que formuló recomendaciones para responder formalmente a FEDAPRO. Posteriormente, el 3 de noviembre de 2022, la ORAC reiteró dichas consideraciones haciendo referencia a los oficios DA-1957-08-2022 y DA-0392-2023 emitidos por la Dirección de Aguas del MINAE (ver informe rendido por parte de las autoridades accionadas).
3. La Subgerencia de Gestión de Sistemas Delegados del AyA da trámite a solicitudes como la asignación de caudal o rectificación de coordenadas, previa presentación de requisitos específicos por parte de cada ASADA, tales como oficio firmado por su representante legal, balance hídrico, análisis de calidad del agua, y documentación sobre la propiedad de la fuente (ver informe rendido por parte de las autoridades accionadas).
4. El 02 de mayo de 2025, la Subgerencia de Gestión de Sistemas Delegados mediante oficio N.° GSD-UEN-GAR-2025-01619, atendió los oficios DA-1957-08-2022, de 19 de agosto de 2022, , referente a la verificación y corrección de geolocalización y clasificación de fuentes de agua de ASADAS en el cantón de Naranjo; DA-1541-2022, de 04 de octubre de 2022, sobre la revisión de datos de georreferenciación, tipo de fuente y caudal de tomas a nivel nacional y; DA-0392-223, de 16 de febrero de 2023, en seguimiento al oficio DA-1957-08-2022. En este, se detalló el proceso de actualización que ha venido desarrollando la Subgerencia como parte de una política de mejora continua, así como los trámites aún pendientes de resolución, registrados en el Anexo 2 (SG-GSD-2025-00245). Asimismo, se comunicaron las gestiones resueltas por la Dirección de Aguas (Anexo 3) y se recordó a las ASADAS su responsabilidad en la gestión del recurso hídrico, mediante el oficio GSD-UEN-GAR-2025-01622 (Anexo 4) (ver informe rendido por parte de las autoridades accionadas).
5. Para la rectificación de datos como coordenadas o tipo de fuente, cada ASADA debe presentar un expediente técnico con: solicitud formal, identificación del profesional responsable del estudio, evidencia gráfica, información técnica detallada sobre las fuentes y cuadro de verificación de campo con datos de alta precisión (ver informe rendido por parte de las autoridades accionadas).
6. En relación con el oficio DA-1779-2022 de 18 de octubre de 2022, relacionado con la actualización del Registro Nacional de Concesiones, se indicó que no se había recibido notificación formal ni asignación del caso, por lo que no se había dado atención al mismo (ver informe rendido por parte de las autoridades accionadas).
7. El Lic. Sergio Romero, de la Dirección de Planificación del AyA, fue designado mediante el oficio PRE-2020-00087 del 29 de enero de 2020 como enlace con la Dirección de Agua del MINAE. Desde esa fecha, no ha recibido nuevas solicitudes de actualización por parte del administrador del SINIGIRH, pero se anunció la medida de crear un nuevo geoservicio desde el portal interno del AyA para facilitar la actualización de datos por parte del MINAE (ver informe rendido por parte de las autoridades accionadas).
8. No existe un cronograma conjunto para la corrección de inconsistencias de los registros de fuentes de agua a nivel nacional ni para el cantón de Naranjo, y los avances en esta materia dependen de la capacidad institucional y del ingreso de nuevas solicitudes (ver informe rendido por parte de las autoridades accionadas).
Hechos relacionados con la Dirección de Aguas del Ministerio de Ambiente y Energía:
1. El 19 de mayo de 2022, FEDAPRO presentó una denuncia escrita ante la Dirección de Aguas, exponiendo las posibles consecuencias negativas de mantener registros inexactos, tanto en nacientes captadas como no captadas, quebradas y sus respectivas zonas de protección (ver informe rendido por parte de las autoridades accionadas).
2. Mediante el oficio DA-1906-08-2022 del 18 de agosto de 2022, la Dirección de Agua respondió que, aunque conserva los registros mencionados, no es la entidad responsable de actualizarlos, ya que esa función corresponde formalmente al Instituto Costarricense de Acueductos y Alcantarillados (AyA), quien debe aportar la información verificada. En dicho oficio se indicó además que el 12 de septiembre de 2022, se presentó ante el AyA una denuncia ambiental con solicitud de actualización de datos y coordinación interinstitucional, sin que se hubiera recibido respuesta satisfactoria (ver informe rendido por parte de las autoridades accionadas).
3. Mediante oficio DA-1541-2022 del 4 de octubre de 2022, la dirigido a la Subgerente de Sistemas de Acueductos Delegados del AyA, la Dirección de Aguas solicitó la revisión de las tomas inscritas a nivel nacional, incluyendo datos de geolocalización, tipo de fuente y caudal (ver informe rendido por parte de las autoridades accionadas).
4. Mediante oficio DA-1779-2022 del 18 de octubre de 2022, dirigido al Presidente Ejecutivo del AyA, la Dirección de Aguas pidió la actualización de los registros asociados al Instituto, tras identificar fuentes no utilizadas o con ubicación errónea (ver informe rendido por parte de las autoridades accionadas).
5. Mediante oficio DA-1957-08-2022 del 19 de agosto de 2022, notificado el 10 de noviembre de 2022, la Dirección de Aguas remitió a la Directora de la UEN Gestión de Acueductos Rurales del AyA, junto con un listado de fuentes inscritas por distintas ASADAS del cantón de Naranjo, con el fin de verificar su localización y tipo de fuente (ver informe rendido por parte de las autoridades accionadas).
6. Mediante oficio DA-0392-223 del 16 de febrero de 2023, notificado el 17 de febrero de 2023, la Dirección de Aguas reiteró la solicitud anterior e indicó que la gestión respondía a un planteamiento de FEDAPRO, presentado por los señores Nombre02 y Pablo Ramírez Alfaro, relativo a la posible corrección de datos de fuentes de agua (ver informe rendido por parte de las autoridades accionadas).
7. La Dirección de Aguas no ha podido realizar correcciones en el Registro Nacional de Concesiones de Agua ni en el Sistema Nacional de Información para la Gestión Integrada del Recurso Hídrico (SINIGIRH), dado que cualquier modificación requiere confirmación oficial por parte del AyA, especialmente en lo relativo a coordenadas geográficas, caudales y clasificación de las fuentes, alterar tales registros sin respaldo documental puede tener implicaciones legales, particularmente en cuanto al régimen de protección previsto en el artículo 31 de la Ley de Aguas (ver informe rendido por parte de las autoridades accionadas).
8. La Dirección de Aguas realizó inspecciones de campo como parte de su plan de control técnico, las cuales evidenciaron discrepancias entre las ubicaciones reportadas por el AyA y las observadas en sitio. En estos casos, la Dirección informó al AyA por escrito, solicitando las correcciones pertinentes, aunque sin obtener respuesta (ver informe rendido por parte de las autoridades accionadas).
9. Los registros del cantón de Naranjo se mantienen sin modificación alguna, en tanto no se ha recibido información oficial por parte del AyA que permita validar o corregir los datos. No obstante, a inicios de 2025, mediante los oficios SB-AID-2025-000016 del 15 de enero de 2025 y UEN-GA-2025-00065-SB-AID-2025, el AyA solicitó la eliminación de fuentes duplicadas inscritas bajo el expediente administrativo 602-R, trámite que fue atendido y ejecutado por la Dirección de Aguas, aunque no se precisó si dichas fuentes corresponden al cantón de Naranjo (ver informe rendido por parte de las autoridades accionadas).
En cuanto a este tema, en la sentencia nro. 2022022070 de las 9:20 horas del 23 de setiembre de 2022, este Tribunal señaló:
“Concerniente a la naturaleza de los agravios acusados en el sub lite, este Tribunal se ha pronunciado en reiteradas ocasiones respecto al derecho a un ambiente sano y ecológicamente equilibrado. Verbigracia, en la sentencia n.° 2021024807 de las 9:20 horas del 5 de noviembre de 2021, esta Cámara señaló:
“En reiteradas ocasiones, la jurisprudencia de esta Sala ha subrayado que el derecho a un ambiente sano y ecológicamente equilibrado se encuentra reconocido tanto a nivel constitucional como convencional. Asimismo, se ha indicado que la protección efectiva a ese derecho requiere que los recursos sean utilizados de manera racional, contexto en que el Estado y la ciudadanía en general deben actuar según los principios que rigen la materia ambiental. En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos.
Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente. De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos. Así, el Estado costarricense se encuentra obligado a adoptar las medidas que garanticen la defensa y preservación efectiva del ambiente conforme a tales principios.
Ahora, tal obligación objetiva no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los órganos jurisdiccionales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades, o bien, de personas físicas y jurídicas, conforme la reconocida teoría de la eficacia horizontal de los derechos fundamentales (Drittwirkung der Menschenrechte), entre cuyas manifestaciones procesales se encuentra el amparo contra sujetos de derecho privado.
Interesa también resaltar que la Corte Interamericana de Derechos Humanos, en la Opinión Consultiva OC-23/17 de 15 de noviembre de 2017, desarrolló lo atinente a las obligaciones estatales en relación con el medio ambiente, en aras de la salvaguardia a los derechos humanos consagrados en la Convención Americana sobre Derechos Humanos.
En esa opinión, la Corte reconoció la interrelación entre la protección del medio ambiente y la realización de otros derechos, en tanto la degradación ambiental afecta el goce y desarrollo efectivo de los derechos humanos. En tal sentido, señaló:
“47. Esta Corte ha reconocido la existencia de una relación innegable entre la protección del medio ambiente y la realización de otros derechos humanos, en tanto la degradación ambiental y los efectos adversos del cambio climático afectan el goce efectivo de los derechos humanos. Asimismo, el preámbulo del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales (en adelante “Protocolo de San Salvador”), resalta la estrecha relación entre la vigencia de los derechos económicos, sociales y culturales -que incluye el derecho a un medio ambiente sano - y la de los derechos civiles y políticos, e indica que las diferentes categorías de derechos constituyen un todo indisoluble que encuentra su base en el reconocimiento de la dignidad de la persona humana, por lo cual exigen una tutela y promoción permanente con el objeto de lograr su vigencia plena, sin que jamás pueda justificarse la violación de unos en aras de la realización de otros (…)
49. Por su parte, la Comisión Interamericana ha resaltado que varios derechos de rango fundamental requieren, como una precondición necesaria para su ejercicio, una calidad medioambiental mínima, y se ven afectados en forma profunda por la degradación de los recursos naturales. En el mismo sentido, la Asamblea General de la OEA ha reconocido la estrecha relación entre la protección al medio ambiente y los derechos humanos (supra párr. 22) y destacado que el cambio climático produce efectos adversos en el disfrute de los derechos humanos. 50. En el ámbito europeo, el Tribunal Europeo de Derechos Humanos ha reconocido que la degradación severa del medio ambiente puede afectar el bienestar del individuo y, como consecuencia, generar violaciones a los derechos de las personas, tales como los derechos a la vida, al respeto a la vida privada y familiar68 y a la propiedad privada. De manera similar, la Comisión Africana de Derechos Humanos y de los Pueblos ha indicado que el derecho a un “medio ambiente general satisfactorio, favorable al desarrollo” está estrechamente relacionado con los derechos económicos y sociales en la medida en que el medio ambiente afecta la calidad de vida y la seguridad del individuo (…) 52.
Por otra parte, existe un amplio reconocimiento en el derecho internacional sobre la relación interdependiente entre la protección al medio ambiente, el desarrollo sostenible y los derechos humanos. Dicha interrelación se ha afirmado desde la Declaración de Estocolmo sobre el Medio Ambiente Humano (en adelante “Declaración de Estocolmo”), donde se estableció que “[e]l desarrollo económico y social es indispensable para asegurar al hombre un ambiente de vida y trabajo favorable y crear en la Tierra las condiciones necesarias para mejorar la calidad de la vida”, afirmándose la necesidad de balancear el desarrollo con la protección del medio humano. Posteriormente, en la Declaración de Río sobre el Medio Ambiente y el Desarrollo (en adelante “Declaración de Río”), los Estados reconocieron que “[l]os seres humanos constituyen el centro de las preocupaciones relacionadas con el desarrollo sostenible” y, a la vez, destacaron que “a fin de alcanzar el desarrollo sostenible, la protección del medio ambiente deberá constituir parte integrante del proceso de desarrollo”.
En seguimiento de lo anterior, en la Declaración de Johannesburgo sobre el Desarrollo Sostenible se establecieron los tres pilares del desarrollo sostenible: el desarrollo económico, el desarrollo social y la protección ambiental. Asimismo, en el correspondiente Plan de Aplicación de las Decisiones de la Cumbre Mundial sobre el Desarrollo Sostenible, los Estados reconocieron la consideración que se debe prestar a la posible relación entre el medio ambiente y los derechos humanos, incluido el derecho al desarrollo. 53. Además, al adoptar la Agenda 2030 para el Desarrollo Sostenible, la Asamblea General de las Naciones Unidas reconoció que el alcance de los derechos humanos de todas las personas depende de la consecución de las tres dimensiones del desarrollo sostenible: la económica, social y ambiental. En el mismo sentido, varios instrumentos del ámbito interamericano se han referido a la protección del medio ambiente y el desarrollo sostenible, tales como la Carta Democrática Interamericana la cual prevé que “[e]l ejercicio de la democracia facilita la preservación y el manejo adecuado del medio ambiente”, por lo cual “es esencial que los Estados del Hemisferio implementen políticas y estrategias de protección del medio ambiente, respetando los diversos tratados y convenciones, para lograr un desarrollo sostenible en beneficio de las futuras generaciones” (…) 55.
Como consecuencia de la estrecha conexión entre la protección del medio ambiente, el desarrollo sostenible y los derechos humanos (supra párrs. 47 a 55), actualmente (i) múltiples sistemas de protección de derechos humanos reconocen el derecho al medio ambiente sano como un derecho en sí mismo, particularmente el sistema interamericano de derechos humanos, a la vez que no hay duda que (ii) otros múltiples derechos humanos son vulnerables a la degradación del medio ambiente, todo lo cual conlleva una serie de obligaciones ambientales de los Estados a efectos del cumplimiento de sus obligaciones de respeto y garantía de estos derechos. Precisamente, otra consecuencia de la interdependencia e indivisibilidad entre los derechos humanos y la protección del medio ambiente es que, en la determinación de estas obligaciones estatales, la Corte puede hacer uso de los principios, derechos y obligaciones del derecho ambiental internacional, los cuales como parte del corpus iuris internacional contribuyen en forma decisiva a fijar el alcance de las obligaciones derivadas de la Convención Americana en esta materia (supra párrs. 43 a 45) (…) 59.
El derecho humano a un medio ambiente sano se ha entendido como un derecho con connotaciones tanto individuales como colectivas. En su dimensión colectiva, el derecho a un medio ambiente sano constituye un interés universal, que se debe tanto a las generaciones presentes y futuras. Ahora bien, el derecho al medio ambiente sano también tiene una dimensión individual, en la medida en que su vulneración puede tener repercusiones directas o indirectas sobre las personas debido a su conexidad con otros derechos, tales como el derecho a la salud, la integridad personal o la vida, entre otros. La degradación del medio ambiente puede causar daños irreparables en los seres humanos, por lo cual un medio ambiente sano es un derecho fundamental para la existencia de la humanidad.”.
Esta interrelación entre el medio ambiente y el disfrute de otros derechos humanos también ha sido reconocida por el Consejo de Derechos Humanos de las Naciones Unidas, quien en la resolución A/HRC/RES/46/7, adoptada el 23 de marzo de 2021 en el 46° periodo de sesiones, sostuvo:
“Reconociendo también que el desarrollo sostenible y la protección del medio ambiente, incluidos los ecosistemas, contribuyen al bienestar humano y al disfrute de los derechos humanos, en particular los derechos a la vida, al disfrute del más alto nivel posible de salud física y mental, a un nivel de vida adecuado, a una alimentación adecuada, al agua potable y el saneamiento y a la vivienda, y los derechos culturales.”.
También, recientemente, en la resolución A/HRC/RES/48/13, adoptada el 8 de octubre de 2021, ese Consejo señaló:
“(…) Reconociendo que el desarrollo sostenible, en sus tres dimensiones (social, económica y ambiental), y la protección del medio ambiente, incluidos los ecosistemas, contribuyen al bienestar humano y al disfrute de los derechos humanos y promueven ambos, incluido el disfrute de los derechos a la vida, al más alto nivel posible de salud física y mental, a un nivel de vida adecuado, a una alimentación adecuada, a la vivienda, al agua potable y el saneamiento y a la participación en la vida cultural, para las generaciones presentes y futuras (…)
Reconociendo además que la degradación del medio ambiente, el cambio climático y el desarrollo insostenible son algunas de las amenazas más acuciantes y graves a la capacidad de las generaciones presentes y futuras de disfrutar de los derechos humanos, incluido el derecho a la vida (…)
Reconociendo la importancia de un medio ambiente limpio, saludable y sostenible como algo fundamental para el disfrute de todos los derechos humanos (…)
1. Reconoce el derecho a un medio ambiente limpio, saludable y sostenible como un derecho humano importante para el disfrute de los derechos humanos; 2. Observa que el derecho a un medio ambiente limpio, saludable y sostenible está relacionado con otros derechos y el derecho internacional vigente (…)”. (El resaltado no corresponde al original).
De este modo, se refleja la particular relevancia del derecho fundamental a un ambiente sano y ecológicamente equilibrado, cuya defensa trasciende la protección de este bien constitucional en sí, toda vez que su preservación constituye un factor esencial para el resguardo efectivo de otros bienes primordiales del ser humano (como la vida, la salud, la propiedad, la igualdad), de modo que si en lo primero se falla, el resguardo efectivo de lo segundo no se alcanza.
Allende de lo anterior, la Corte Interamericana de Derechos Humanos, en la opinión supra aludida, reconoció el derecho a un ambiente sano como uno autónomo, susceptible de protección con independencia de algún riesgo de afectación a personas individuales. En tal sentido, dispuso:
“62. Esta Corte considera importante resaltar que el derecho al medio ambiente sano como derecho autónomo, a diferencia de otros derechos, protege los componentes del medio ambiente, tales como bosques, ríos, mares y otros, como intereses jurídicos en sí mismos, aún en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza y el medio ambiente no solamente por su conexidad con una utilidad para el ser humano o por los efectos que su degradación podría causar en otros derechos de las personas, como la salud, la vida o la integridad personal, sino por su importancia para los demás organismos vivos con quienes se comparte el planeta, también merecedores de protección en sí mismos. En este sentido, la Corte advierte una tendencia a reconocer personería jurídica y, por ende, derechos a la naturaleza no solo en sentencias judiciales sino incluso en ordenamientos constitucionales. 63. De esta manera, el derecho a un medio ambiente sano como derecho autónomo es distinto al contenido ambiental que surge de la protección de otros derechos, tales como el derecho a la vida o el derecho a la integridad personal.”. (El resaltado no corresponde al original).
Esta tesitura fue adoptada en la sentencia de 6 de febrero de 2020 relativa al caso “Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina”, en la que, superando un enfoque antropocéntrico, la CorteIDH afirma que el derecho al ambiente sano, amén de ser fundamental para la propia existencia del ser humano, constituye un derecho autónomo y universal, de manera que la protección a diversos componentes del ambiente (como bosques, mares, ríos y otros) configura un interés jurídico por sí mismo. En palabras de la CorteIDH: “Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta.” Dada la trascendencia de esta afirmación, resulta oportuno transcribir este apartado de la referida resolución:
“203. La Corte ya se ha referido al contenido y alcance de este derecho, considerando diversas normas relevantes, en su Opinión Consultiva OC-23/17, por lo que se remite a dicho pronunciamiento. Afirmó en esa oportunidad que el derecho a un medio ambiente sano “constituye un interés universal” y “es un derecho fundamental para la existencia de la humanidad”, y que “como derecho autónomo […] protege los componentes del […] ambiente, tales como bosques, mares, ríos y otros, como intereses jurídicos en sí mismos, aun en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta”. Lo anterior no obsta, desde luego, a que otros derechos humanos puedan ser vulnerados como consecuencia de daños ambientales.”. (El resaltado no corresponde al original).
Con base en lo expuesto, esta Sala, como garante de los derechos fundamentales, debe velar por el respeto a las obligaciones convencionales y constitucionales, que constriñen al Estado no solo a reconocer los derechos ahí consagrados, sino también a imponer las medidas jurídicas requeridas para su resguardo” (el resaltado es del original).
Aunado a lo anterior, recientemente, la Asamblea General de las Naciones Unidad adoptó la resolución nro. A/RES/76/1-A/RES/76/300 del 28 de julio de 2022, en la que se consignó:
“1. Reconoce el derecho a un medio ambiente limpio, saludable y sostenible como un derecho humano; 2. Observa que el derecho a un medio ambiente limpio, saludable y sostenible está relacionado con otros derechos y el derecho internacional vigente; 3. Afirma que la promoción del derecho humano a un medio ambiente limpio, saludable y sostenible requiere la plena aplicación de los acuerdos multilaterales relativos al medio ambiente con arreglo a los principios del derecho ambiental internacional; 4. Exhorta a los Estados, las organizaciones internacionales, las empresas y otros interesados pertinentes a que adopten políticas, aumenten la cooperación internacional, refuercen la creación de capacidad y sigan compartiendo buenas prácticas con el fin de intensificar los esfuerzos para garantizar un medio ambiente limpio, saludable y sostenible para todos”.
Esta resolución es la expresión formal de la voluntad del órgano principal de deliberación, adopción de políticas y representación de la Organización de Naciones Unidas. En consecuencia, constituye un compromiso político de carácter universal que debe ser valorado como fuente de soft law de la mayor relevancia.
Precisamente, la resolución nro. A/RES/76/1-A/RES/76/300 afirma que el derecho a un ambiente sano y ecológicamente equilibrado tiene naturaleza de derecho humano. Con esto, en buena medida contribuye a su positivización, de lo que resulta su comprensión técnica como “derecho fundamental”. Asimismo, robustece la noción de que la protección al ambiente es un derecho humano “autónomo”, esto es, que vale por sí mismo, de manera que, por un lado, tiene una existencia conceptual propia y distinta al contenido ambiental que sin duda surge de la protección de otros derechos (como la vida o la salud) y, por otro, su objeto de protección trasciende al ser humano, puesto que brinda cobijo a los diversos componentes de la naturaleza debido a su trascendencia para preservar la existencia de los organismos vivos en general, independientemente de su utilidad para con los seres humanos.
Asimismo, reitera y, por esa vía, fortalece la tesitura de que el derecho a un ambiente sano y ecológicamente equilibrado se encuentra vinculado con otros derechos humanos, lo que implica que su transgresión puede acarrear la vulneración de la salud, la vida, el desarrollo sostenible democrático, por citar tan solo algunos ejemplos. Lo anterior confiere un significado jurídico particularmente relevante al derecho de marras.
En adición, la Asamblea General de la ONU preceptúa que la protección al derecho a un ambiente sano y ecológicamente equilibrado demanda la plena aplicación de los derechos convencionales relacionados con el ambiente en consonancia con los principios del derecho ambiental internacional. De lo anterior se colige su imprescindible inclusión dentro del control jurisdiccional de constitucionalidad por parte de esta Sala.
Por último, en armonía con la reconocida teoría de la eficacia horizontal de los derechos fundamentales (Drittwirkung der Menschenrechte), la resolución nro. A/RES/76/1-A/RES/76/300 regula que la obligación de resguardar al ambiente, allende de los estados, se extiende a organizaciones internacionales, empresas y otros interesados, término último que comprende a los seres humanos en general. Justamente es en ese sentido, que la Ley de la Jurisdicción Constitucional contempla el amparo contra sujetos de derecho privado.
En suma, bajo el marco conceptual explicado ut supra, este Tribunal Constitucional, como garante de los derechos fundamentales, debe velar por el cumplimiento de los compromisos convencionales y constitucionales que al Estado costarricense y a la sociedad en general le imponen no solo la obligación de reconocer los derechos, principios y valores de la materia ambiental, sino también la de implementar todas aquellas medidas y actuaciones que se precisan para asegurar la efectiva protección a aquellos” (el resaltado es del original).
Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, que el problema denunciado por la parte recurrente, relativo a inconsistencias en la clasificación y georreferenciación de múltiples fuentes de agua en el cantón de Naranjo, no ha sido abordado con la debida diligencia ni ha generado acciones institucionales suficientes para garantizar una actualización adecuada de los registros oficiales. En efecto, si bien consta que el AyA y la Dirección de Aguas han intercambiado comunicaciones y que el primero remitió, hasta el 2 de mayo de 2025, el oficio N.° GSD-UEN-GAR-2025-01619 como respuesta parcial a varias solicitudes anteriores, lo cierto es que dichas gestiones han sido tardías, fragmentadas y carentes de seguimiento efectivo.
Nótese que, si bien es cierto que el AyA respondió mediante el oficio N.° GSD-UEN-GAR-2025-01619 del 2 de mayo de 2025 a algunas de las solicitudes remitidas por la Dirección de Aguas -entre ellas, los oficios DA-1957-08-2022, DA-1541-2022, DA-0392-2023, y DA-1779-2022-, dicho pronunciamiento constituye una actuación tardía, producida casi tres años después de iniciada la problemática. A ello se suma que la respuesta remitida por el AyA fue incompleta, careciendo de resoluciones técnicas finales sobre los puntos críticos señalados, y sin incorporar un cronograma operativo para la revisión y actualización de los datos erróneos, tanto a nivel local como nacional.
De otra parte, la Dirección de Aguas ha reconocido que no puede realizar correcciones en los registros sin recibir previamente confirmación formal del AyA, lo que ha generado una parálisis administrativa que perpetúa la existencia de datos incorrectos o desactualizados sobre fuentes utilizadas para el abastecimiento humano. Si bien se entiende que la Dirección de Aguas no puede modificar por cuenta propia los datos georreferenciados, los caudales o las clasificaciones tipológicas sin la correspondiente confirmación oficial del AyA, lo que responde a una lógica de competencias administrativas, esto no le exime de su deber constitucional de actuar con diligencia frente a riesgos ambientales sustantivos. La actitud pasiva y de espera adoptada por ambas instituciones revela un patrón de inacción institucional incompatible con los principios de precaución y prevención que rigen la materia ambiental, y con los estándares internacionales de debida diligencia reforzada frente a la protección del recurso hídrico.
En ese sentido, la omisión estructural, tanto por parte del AyA como de la Dirección de Aguas, representa una amenaza cierta y actual al derecho a un ambiente sano y ecológicamente equilibrado, así como al derecho al acceso a información ambiental y al resguardo del recurso hídrico, máxime tratándose de nacientes, ríos y quebradas que constituyen bienes de dominio público cuyo uso y conservación es esencial para la vida y la salud de miles de personas. La falta de actualización y verificación de estos datos no solo puede tener consecuencias ambientales graves e irreversibles, como la afectación de áreas de protección legal, sino que compromete también el principio de sostenibilidad en la gestión del recurso hídrico. Al efecto, este Tribunal advierte que la respuesta dada por las autoridades competentes ha estado mediada por un formalismo excesivo, contrario al principio de eficacia en la protección de los derechos fundamentales.
No se ha promovido una coordinación interinstitucional robusta ni se ha impulsado un cronograma claro de acciones concretas para corregir la información errónea. Asimismo, se ha constatado la inexistencia de una política integral o cronograma nacional de actualización de registros de fuentes de agua, lo cual refuerza la percepción de omisión por parte del aparato estatal en un asunto de alta sensibilidad ambiental y social. Cabe resaltar que la inscripción inexacta de una naciente como quebrada o río implica efectos jurídicos materiales, tales como la reducción indebida de las áreas de protección, la exposición del caudal a captaciones no reguladas, la omisión en la fiscalización del uso del recurso y la desprotección de ecosistemas sensibles. Estas consecuencias, lejos de ser meramente técnicas o administrativas, inciden sobre el núcleo esencial de derechos fundamentales que protegen la vida, la salud y el bienestar de las personas, así como, el ambiente.
En consecuencia, se concluye que la omisión denunciada vulnera los derechos fundamentales invocados, particularmente el derecho a un ambiente sano (artículo 50 constitucional), el derecho a la salud (artículo 21 constitucional), y el acceso a información ambiental. Consecuentemente, se estima el presente recurso para garantizar la actualización, verificación y corrección inmediata de los registros señalados, tal como se indica en la parte dispositiva de esta sentencia.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara CON LUGAR el recurso. Consecuentemente, se ordena a JUAN MANUEL QUESADA ESPINOZA, en condición de Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, así como, a JOSÉ MIGUEL ZELEDÓN CALDERÓN, en condición de Director de la Dirección de Agua del Ministerio de Ambiente y Energía que: en el plazo de SEIS MESES, contado a partir de la notificación de la presente sentencia, 1. Verifiquen y, en su caso, rectifiquen la georreferenciación, clasificación tipológica y demás datos técnicos de las fuentes de agua registradas en el cantón de Naranjo, priorizando aquellas utilizadas para consumo humano por parte de las ASADAS; 2. Remitan conjuntamente un informe detallado y completo a esta Sala sobre las acciones realizadas, los resultados obtenidos y las gestiones pendientes de resolución en relación con lo anterior; 3. Diseñen y pongan en ejecución un cronograma público de revisión, verificación y actualización de los registros nacionales de fuentes de agua (SINIGIRH y Registro Nacional de Concesiones), con participación de las ASADAS y organizaciones interesadas, el cual deberá contener plazos, responsables institucionales y medios de seguimiento y fiscalización pública. 4.
Que el funcionario designado como enlace ante el SINIGIRH por el Instituto Costarricense de Acueductos y Alcantarillados, proceda a coordinar con la Dirección de Agua del MINAE y con la Dirección de Sistemas de Información del AyA, la activación del procedimiento de actualización y publicación de los datos corregidos. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
