CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours forty-five minutes on the twenty-first of May, two thousand twenty-four.
Amparo action (Recurso de amparo) filed by [Name 001], holder of identity card [Value 001], against the Ministry of Health, the District Municipal Council of Cóbano, and the Municipality of Puntarenas.
Whereas:
1.- By brief received in this Chamber on September 2, 2022, the petitioner filed an amparo action for problems in solid waste collection in Cóbano.
2.- By judgment 2022-025834 at thirteen hours twenty-two minutes on October 28, 2022, the petitioner's claim was upheld, and this Chamber ordered the respondent authorities to comply with the sanitary orders issued by the Peninsular Health Rectorate Area to solve the reported problem.
3.- On November 17, 2022, the petitioner alleges that the waste collection problems continue.
4.- By interlocutory judgment number 2023-005292 of March 7, 2023, the non-compliance proceeding was dismissed.
5.- On November 28, 2023, the petitioner appears and alleges that the waste collection problems continue.
6.- By resolution at seven hours and five minutes on December 12, 2023, the respondent authorities were given a hearing so that they could pronounce on the alleged disobedience.
7.- Favio José López Chacón, in his capacity as Municipal Intendant of the District Municipal Council of Cóbano de Puntarenas, attends the granted hearing and states that they have made efforts and coordination so that situations and problems in garbage collection such as those that occurred in 2022 do not arise. That the order issued in sanitary order OS-DARSPE-095-2022 of September 20, 2022, was complied with. He adds that the petitioner's proceeding is a new complaint, corresponding to a fortuitous and isolated event that again caused a delay in garbage collection, which was counteracted in the shortest possible time. He requests that the proceeding be dismissed.
8.- Miguel Díaz Vega, in his capacity as president of the Council of Puntarenas, attends the granted hearing, stating that sanitary orders OS-DARSPE-093-2022, OS-DARSPE-094-2022, and OS-DARSPE-095-2022 have already been complied with.
9.- Wilber Madriz Arguedas, in his capacity as mayor of the central canton of Puntarenas, attends the granted hearing, stating that respecting municipal autonomy and the competence held by the District Municipal Councils, he respects the administrative and technical actions taken according to their service resolution plan.
10.- Juan Gabriel Ledezma Arce, in his capacity as Director of the Peninsular Health Rectorate Area, attends the granted hearing, stating that during the current year, no formal complaints had been filed regarding waste collection problems in the district of Cóbano de Puntarenas before this Health Rectorate Area office. Until November 22, when the undersigned noted on social media people complaining about accumulated waste in Santa Teresa, and immediately photos and a link to the comments were sent to the WhatsApp chat of the municipal intendant of Cóbano, who denied the situation and mentioned that it was only the Monday of that week and that it would be resolved on Friday. That although the intendant denied the accumulation of waste, I warned him two days later via the same chat that I was going to gather evidence of the waste accumulation that very day, November 24, during a nighttime operation (a screenshot of the WhatsApp chat with the intendant from Nov 24, 2023, is attached). These inspections resulted in a report by engineer María Arrieta. Consequently, given what was found by the engineer on Friday, November 24, during the nighttime operation, it was decided to order the municipal intendancy and the municipal council the following 2 sanitary orders: 1. MS-DRRSPC-DARSPE-OS-0100-2023 Muni Cóbano accumulated waste signature and 2. MS-DRRSPC-DARSPE-OS-0101-2023 CMD Muni Cóbano accumulated waste. He mentions that the notified sanitary order was sent with a copy to the petitioner, with whom communication was maintained on November 27, the same day the sanitary order was notified to the intendancy and the Council. After the sanitary notifications, the order was complied with, and said compliance was verified through inspection report AI-MF-32 garbage santa teresa of December 18, 2023, a copy of which is attached. And in which it is verified by our Environmental Engineer María Arrieta that the situation is resolved. Therefore, the sanitary orders are deemed complied with. And the waste collection service is reestablished, functioning efficiently.

Considering:
SOLE.- The petitioner appears on November 28, 2023, and alleges that the waste collection problems, the subject of this amparo, continue. The respondent authorities were given a hearing to pronounce on the alleged non-compliance. When rendering the granted hearing, both the authorities of the Peninsular Health Rectorate Area and the District Municipal Council of Cóbano de Puntarenas provided this Court with evidence showing the actions and coordination undertaken by each within the exercise of their competencies, in order to comply with judgment 2022-025834 of thirteen hours twenty-two minutes on October 28, 2022, issued by this Chamber. Additionally, it is inferred from the case file that the situation of accumulated waste that occurred in November 2023 in the district of Cóbano, and which the petitioner denounces as disobedience, cannot be upheld because it resulted from different circumstances than those that gave rise to the granting of this action in 2022. Added to this, the health authorities affirm that said situation was addressed and has already been resolved, with the waste collection service reestablished and functioning efficiently. Based on such facts, it is deemed appropriate to dismiss the non-compliance proceeding.
THEREFORE:
The proceeding filed is dismissed.

Sala Constitucional Clase de asunto: Recurso de amparo Analizado por: SALA CONSTITUCIONAL Sentencia con datos protegidos, de conformidad con la normativa vigente Res. Nº 2024013700 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas cuarenta y cinco minutos del veintiuno de mayo de dos mil veinticuatro .
Recurso de amparo interpuesto por [Nombre 001], portador de la cédula de identidad [Valor 001], contra el Ministerio de Salud, el Concejo Municipal de Distrito de Cóbano y la Municipalidad de Puntarenas.
Resultando:
1.- Por escrito recibido en esta Sala el 2 de setiembre del año 2022, la parte recurrente interpuso recurso de amparo por problemas en la recolección de residuos sólidos en Cóbano.
2.- Por sentencia 2022-025834 de las trece horas veintidós minutos del 28 de octubre del año 2022, se acogió el reclamo del recurrente, y esta Sala ordenó a las autoridades recurridas dar cumplimiento a las órdenes sanitarias emitidas por el Area Rectora de Salud Peninsular para solucionar el problema denunciado.
3.- El 17 de noviembre del año 2022, el recurrente acusa que los problemas de la recolección de desechos continúa.
4.- Por sentencia interlocutoria número 2023-005292 del 7 de marzo del año 2023, se desestimó la gestión de incumplimiento.
5.- El 28 de noviembre del año 2023, el recurrente se apersona y acusa que los problemas de la recolección de desechos continúa.
6.- Por resolución de las siete horas y cinco minutos del 12 de diciembre del año 2023, se dio traslado a las autoridades recurridas, a fin de que se pronunciaran sobre la desobediencia acusada.
7.- Atienden audiencia conferida Favio José López Chacón, en su condición de Intendente Municipal del Concejo Municipal de Distrito de Cóbano de Puntarenas, y manifiesta que han realizado esfuerzos y coordinaciones para que no se presenten situaciones y problemas en la recolección de basura como las que se presentaron el año 2022. Que se cumplió con lo ordenado en la orden sanitaria OS-DARSPE-095-2022 del 20 de setiembre del 2022. Agrega que la gestión del recurrente se trata de una nueva denuncia, que corresponden a un hecho fortuito y aislado que provocó nuevamente el retraso en la recolección de basura, que fue contrarrestado en el menor tiempo posible. Solicita se desestime la gestión.
8.- Atiende audiencia conferida Miguel Díaz Vega, en su condición de presidene del Concejo de Puntarenas, que las órdenes sanitarias OS-DARSPE-093-2022, la OS-DARSPE-094-2022 y la OS-DARSPE-095-2022 ya fueron cumplidas.
9.- Atiende audiencia conferida Wilber Madriz Arguedas, en su condición de alcalde del cantón central de Puntarenas, que en respeto de la autonomía municipal y competencia con la que cuentan los Concejo Municipales de Distrito, respeta las gestiones administrativas y técnicas que se dispongan de acuerdo a su proyección de resolución del servicio.
10.- Atiende audiencia conferida Juan Gabriel Ledezma Arce, en su condición de Director del Area Rectora de Salud Peninsular, que durante el año en curso, no se habían presentado denuncias formales sobre problemas de recolección de residuos en el distrito de Cóbano de Puntarenas, ante esta dirección de Área rectora de Salud. Hasta el 22 de noviembre que el suscrito notó en redes sociales, personas quejándose por residuos acumulados en Santa Teresa, y de inmediato se le pasaron fotos y un enlace a los comentarios, al chat de whatsapp del señor intendente municipal de Cóbano, que negó la situación y mencionó que fue solamente el lunes de esa semana y que el viernes se resolvería. Que a pesar de que el intendente negó la acumulación de residuos, le advertí dos días después por el mismo chat, que iba a levantar evidencia de la acumulación de residuos ese mismo día 24 de noviembre, en operativo nocturno (se adjunta Foto de chat de wpp con intendente 24 nov 2023). Dichas inspecciones derivaron en un acta de la ingeniera María Arrieta. En consecuencia, de lo encontrado por la ingeniera el viernes 24 de noviembre en operativo nocturno, se decidió ordenar a la intendencia municipal y al concejo municipal las siguientes 2 órdenes sanitarias: 1. MS-DRRSPC-DARSPE-OS-0100-2023 Muni Cóbano residuos acumulados firma y 2. MS-DRRSPC-DARSPE-OS-0101-2023 CMD Muni Cóbano residuos acumulados. Menciona que la orden sanitaria notificada, se envió con copia al recurrente, con quien se mantuvo comunicación el día 27 de noviembre, mismo día en que se notificó la orden sanitaria a la intendencia y al Concejo. Luego de las notificaciones sanitarias, se cumplió con lo ordenado, y se comprobó dicho cumplimiento mediante acta de inspección AI-MF-32 basura santa teresa del 18 de diciembre de 2023, de la cual se adjunta copia. Y en la que se comprueba por parte de nuestra Ing. Ambiental María Arrieta, que la situación está resuelta. De modo que se dan por cumplidas las órdenes sanitarias. Y está restablecido el servicio de recolección de residuos, de forma eficiente.
