Document Review Decision No. 2025012047 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on veinticinco de abril de dos mil veinticinco.
Writ of amparo (recurso de amparo) filed by Nombre01, identity card CED01, against the MINISTER OF ENVIRONMENT AND ENERGY.
Whereas:
Additionally, this Office has undertaken efforts to address the aforementioned infrastructure in the best possible manner, for example through DM-0407-2024 (SEE EVIDENCE N°17), by which it was decided to suspend the activities carried out during Fundazoo’s administration, because properties of historical and architectural interest (the adobe house and sugar mill, pursuant to Decreto Ejecutivo Decreto N°19640-C) were being made available for recordings by Televisora de Costa Rica. However, since there was no opinion from the entities with jurisdiction over the matter endorsing an activity of that nature, the activity and request were suspended and denied. Additionally, coordination notes have been exchanged between this Office and the Ministerio de Cultura y Juventud, as evidenced by this Office’s letter DM-0581-2024 (SEE EVIDENCE N°18) and note MCJ-DM-1129-2024 from the Ministerio de Cultura y Juventud (SEE EVIDENCE N°19), through which the appropriate coordination was arranged to address the deterioration and damage to the CCSA infrastructure.
Regarding the second point cited above, this Office considers that the petitioner is incorrect, because although the CCSA is currently closed to the public, this has been the case while the necessary steps are taken to establish the appropriate protected wildlife area (área silvestre protegida, ASP) management category—such as conducting the technical studies—which, as should be understood, is a time-consuming process, as may be seen in report CARTA-SINAC-ACC-IRT-018-2025 (SEE EVIDENCE N°20), which provides a brief summary of the actions taken by SINAC. Continuing with the point made in the preceding paragraph, it cannot be overlooked that, pursuant to Article 36 of Ley Orgánica del Ambiente N°7554, these technical studies are an indispensable requirement for the creation of new protected wildlife areas; this is based on the understanding that every decision by the Public Administration on environmental matters must have technical or scientific support justifying it (principle of the binding nature of science and technology (principio de vinculación de la ciencia y la técnica)).
Additionally, one of the final steps for creating new ASP, pursuant to Article 36 cited above, is the required enactment of a Law or Executive Decree. In this regard, it should be stated that the aforementioned Decree creating PANU CCSA is currently undergoing the signature process before the President of the Republic, having been transmitted through DAJ-MINAE-0368-2025. In this context, the petitioner cannot expect MINAE to open the aforementioned property to the public, and therefore this cannot be deemed to constitute any infringement of the constitutional right to a healthy and ecologically balanced environment (derecho constitucional a un ambiente sano y ecológicamente equilibrado), particularly because opening the CCSA to the public without a technical opinion, as the petitioner appears to seek, would indeed constitute a violation of Article 50 of the Constitution, as well as of people’s lives and safety.
In this context, it may be concluded that there has been no violation whatsoever of the community’s right to use and enjoy environmental assets (bienes ambientales). 8. Environmental complaint (denuncia ambiental). With respect to this allegation, if the complaint was in fact filed through the SITADA platform, it will proceed through the corresponding process. 9. Recent vandalism. In this regard, we wish to reiterate part of the arguments presented under points 6 and 7 concerning the fact that much of the infrastructure delivered by Fundazoo after 30 years of administration was severely deteriorated. Likewise, regarding vandalism, this Ministry has been carrying out monitoring and oversight to prevent such situations. Conclusion: Based on the arguments and evidence attached to this report, it is clear not only that the petitioner is incorrect in her allegations, but also that her allegations do not involve constitutional matters that should be adjudicated in this forum.
Accordingly, this Office considers that there has been no constitutional violation, because none of those complaints or reports infringes upon the natural heritage (patrimonio natural); for example, vandalism does not affect biodiversity, the management of a nursery, the issue of the fencing, or the actions taken to create a PNAU do not affect the property or biodiversity, much less infringe upon any constitutional right. Ultimately, in addition to being matters of administrative law (derecho administrativo)—as shown by the evidence attached to this submission—they are also being duly addressed by this Ministry.” It requests that the appeal be dismissed.
Justice Solano Aguilar authors the opinion; and,
Whereas:
The appellant—in her capacity as a member of the Legislative Assembly—states that, as of 09 de mayo de 2024, Fundazoo transferred the administration of the Centro de Conservación Santa Ana to MINAE, culminating a process of more than 10 years since the country decided to eliminate zoos holding wild animals in captivity and instead establish wildlife management centers (centros de manejo de vida silvestre). She states that since MINAE assumed the administration, there have been multiple acts of vandalism, burning, contamination of water sources, waste pollution, and destruction of State property. She asserts that MINAE has not implemented protective measures and that the CCSA is in a state of complete abandonment.
The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial order:
From the report submitted by the respondent authority, which was given under oath with the legal consequences that this entails, it follows that SINAC, through report SINAC-ACC-DRFVS-of-189-2024, analyzed the trees in the nursery and further reported that certain useful species had been donated to the Municipalidad de San José for the programs it manages (primarily parks and watersheds), including species of all types as indicated in the report (native trees, shrubs, and palms, timber species, endangered species, ornamental species, fruit trees for wildlife, and certain selected exotic species), and that the relevant recommendations were issued for their disposition. It was established that, through official letters DM-26-2025 and DM-091-2025, MINAE addressed the appellant’s concerns, informing her that the installation of billboards on the CCSA state-owned property was carried out pursuant to a private contract entered into directly between Publiex S, S.A., corporate identification number 3-101-255079, and JC Decaux Top Media CR, S.A., corporate identification number 3-101-234986, the owners of the billboards, and Fundación Pro-Zoológicos during the term of the Convenio de Administración MINAE-FUNDAZOO governing the administration of those properties.
It was demonstrated that MINAE initiated a preliminary review and assessment process, which led to the commencement of the relevant legal proceedings to issue administrative orders directed to the owners of those structures—a proceeding that is currently at the appeal stage. It was verified that MINAE, in coordination with SINAC and Fuerza Pública officials, has kept the properties under constant surveillance—through notice DECI-081-2024 dated 17 de setiembre de 2024, information was provided regarding the monitoring patrols conducted at the CCSA on that same 17 de setiembre de 2024 by officials from this Ministry, SINAC, and Fuerza Pública, during which no evidence of occupation was found at that time. It was shown that MINAE processed the declaration establishing the Urban Natural Park Management Category (Categoría de Manejo Parque Natural Urbano, PANU), using as technical input the “Technical Report on the Proposal for a Protected Wildlife Area and Assignment of a Management Category to the Centro de Conservación Santa Ana” (“Informe Técnico de Propuesta de Área Silvestre Protegida y asignación de categoría de manejo del Centro de Conservación Santa Ana”)—this process is in its final stage and is currently awaiting the President of the Republic’s signature on the Decreto Ejecutivo containing the PANU declaration.
It was proven that, in view of the year’s dry season, MINAE issued a press release on 12 de marzo de 2025 stating: “…The Forest Fire Brigade of the Área de Conservación Central (ACC), of the Sistema Nacional de Áreas de Conservación (MINAE-SINAC), is carrying out firebreak maintenance work in the area that will soon be declared the Parque Natural Urbano (PANU) Lorne Ross, specifically to protect the existing structures in the southern sector of the site. The regional directorate had requested that firebreaks and perimeter rings be established as a preventive measure to protect the existing infrastructure and prevent damage to it in the event of a fire in the sector, given the presence of grasslands where, on various occasions, human activities, whether accidental or deliberate, have caused forest fires that affect the ecosystem in the area, with the corresponding environmental and socioeconomic consequences.
Furthermore, the future PANU, comprising approximately 50 hectares, is currently divided by Dirección02, and periodic on-site enforcement operations are conducted to prevent unlawful entry and consequent vandalism of the facilities…”. It was verified that, in connection with taking possession of the property, this Ministry coordinated the corresponding visit to the property with officials from Ministerio de Cultura, during which the following was observed: • The lack of maintenance has caused the vegetation to grow rapidly. • The adobe house has subsidence in the exterior corridor. • The cement plaster has cracked and detached. Vegetation is present on the roofs of all the buildings. • The sugar mill (trapiche) has posts and beams damaged by wood-boring organisms. • The wattle-and-daub house (casa de bahareque) has damage to its walls and columns. • The large wooden house has damage to the wall planks, fascia, and roof sheet metal.
The window screens are also damaged. • The circular structure has sustained considerable damage. • The walls have no render, and the window has no protection. • The roof has vegetation and openings through which water seeps. • The small earthen-architecture house has water leaks due to roof damage. • The recently constructed buildings have minor damage due to lack of maintenance.” It was demonstrated that, on 02 de abril del 2025, officials from the Dirección de Patrimonio Cultural conducted an on-site inspection (inspección in situ) and found: Lack of maintenance of green areas and roofs. • Necessary structural replacements involving wood, adobe, and sheet metal have not been carried out. • Deficiencies persist in the plaster, roofs, and restoration of traditional walls. Finally, it was verified that, as of the date on which the amparo proceeding (recurso de amparo) was decided, a procurement contract by the NGO ASANA, awarded by the Organización para Estudios Tropicales (OET) under Proyecto TEVU, was being performed and included: • Management plan. • Infrastructure and landscape rehabilitation proposal. • Sustainability strategy.
However, these deliverables have not yet been implemented and do not reflect any physical actions involving direct rehabilitation of the site. Based on the foregoing, the following conclusions may be reached:
The entrance to the property is being used to park automobiles from a repair shop. 5.2. Recommendations: Maintain the green areas and vegetation in general. Repair the adobe house by removing the clay tiles from the area where the subsidence is located and filling the area. Replace the cement plaster with lime-and-sand render from the original construction system. Remove the vegetation from the roof and reposition the clay roof tiles. Replace the sugar mill posts that are damaged with pieces of the same dimensions. Replace the damaged beams with others having the same characteristics. Clear all vegetation from the roof. Repair the roofs of all the buildings and remove the vegetation present. Replace the missing adobe blocks in the circular structure. Provide protection for the window and door. For the large wooden house, replace the rotten wooden pieces with others having the same characteristics.
Replace the sheet metal that is in poor condition. Replace the damaged screens. Restore the earthen walls (adobe and wattle-and-daub) of the buildings that have them, using traditional construction techniques. Maintain the recently constructed buildings. Find a way to prevent the entrance to the property from being used as a parking area.” 4.) On 06 de marzo de 2025, the Decreto Ejecutivo entitled “DAJ-D-001-025 “CREACIÓN DEL PARQUE NATURAL URBANOI LORNE ROSS ASHLEY” was forwarded to the Dirección de Leyes y Decretos.
Accordingly, the appropriate course is to grant the application (recurso) for the reasons stated below: Although it is true that the authorities of the Ministerio de Ambiente y Energía received the property in Santa Ana known as Finca Lornessa in a state of abandonment, on 10 de julio de 2024 report No. IA-023-2024 was issued containing a series of recommendations that, to date, have not been implemented. The recommendations are as follows: • Maintain the green areas and vegetation in general. • Repair the adobe house by removing the clay tiles from the area where the subsidence is located and filling in the area. • Replace the cement plaster with lime-and-sand render from the original construction system. • Remove the vegetation from the roof and reposition the clay roof tiles. • Replace the damaged posts of the sugar mill with pieces of the same dimensions. • Replace the damaged beams with others having the same characteristics. • Clear the roof of all vegetation. • Repair the roofing of all buildings and remove the vegetation present. • Restore the missing adobe blocks in the circular structure. • Protect the window and door. • For the large wooden house, replace the rotten wooden pieces with others having the same characteristics. • Replace the sheet-metal components that are in poor condition. • Replace the damaged screens. • Restore the earthen walls (adobe and wattle and daub (bahareque)) of the buildings in which they are present, using traditional construction techniques.
As demonstrated during the inspection conducted on 02 de abril, the properties remain in the same state of abandonment described in report No. IA-023-2024—that is, the aforementioned recommendations have not been addressed—and the only action taken has been to arrange contract TH-CRO-CSP-015-2025 with the NGO ASANA (Asociación Amigos de la Naturaleza del Pacífico Central), which was awarded by the Asociación Organización para Estudios Tropicales (OET) through the Proyecto Transición hacia una Economía Verde Urbana (TEVU), with the following scope and deliverables: a. General management plan. b. Design of the required infrastructure (permeable trails, sites for placing camera traps, birdwatching towers). c. Landscape rehabilitation proposal. d. Sustainability proposal. In view of this situation, and considering that despite the time elapsed (more than nine months), the respondent authority has not taken the appropriate steps to comply with the recommendations issued in report No. IA-023-2024 dated 10 de julio de 2024, the appropriate course is to grant the application, with the consequences set forth in the operative portion of this judgment.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Ronny Rodríguez Chaves, in his capacity as acting minister of Ambiente y Energía, or whoever holds that office in his stead, is ordered to proceed IMMEDIATELY with implementing the recommendations issued in report No. IA-023-2024 dated 10 de julio de 2024. He shall report to this Chamber every THREE MONTHS on the actions taken until all the issued recommendations have been implemented. The respondent is warned that, pursuant to article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an application for amparo relief (recurso de amparo) that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticinco de abril de dos mil veinticinco .
Recurso de amparo presentado por Nombre01, cédula de identidad CED01, contra el MINISTRO DE AMBIENTE Y ENERGÍA.
Resultando:
Redacta el Magistrado Solano Aguilar; y,
Considerando:
La recurrente -en su calidad de diputada- afirma que desde el 09 de mayo de 2024, Fundazoo entregó la administración del Centro de Conservación Santa Ana al MINAE como culminación de un proceso de más de 10 años desde que el país decidió eliminar los zoológicos con animales silvestres en cautiverio, y optar por centros de manejo de vida silvestre. Dice que desde que el MINAE asumió la administración se han presentado múltiples actos de vandalismo, quemas, contaminación de fuentes de agua, contaminación por residuos y destrucción del patrimonio del Estado. Asegura que el MINAE no ha implementado medidas de resguardo y el CCSA se encuentra en estado de abandono absoluto.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Del informe rendido por la autoridad recurrida el cual es dado bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que el SINAC mediante informe SINAC-ACC-DRFVS-of-189-2024 hizo un análisis de los árboles en vivero, además donde se informa que se procedió a la donación de algunas especies que eran de utilidad a la municipalidad de San José para los programas que ellos manejan (principalmente parques y cuencas) y en donde se encontraban especies de todo tipo como lo indica el informe (árboles, arbustos y palmas nativas, especies maderables, especies en peligro de extinción, especies ornamentales, árboles frutales para fauna, algunas especies exóticas seleccionadas) y en el que se emitieron las recomendaciones pertinentes para la disposición de los mismos. Se acreditó que mediante oficios DM-26-2025 y DM-091-2025 el MINAE atendió las inquietudes a la recurrente, a quien se le informó que la instalación de las vallas publicitarias en el inmueble estatal del CCSA, fue realizado a la luz de un contrato privado suscrito directamente por las sociedades Publiex S, S.A., cédula jurídica 3-101-255079 y JC Decaux Top Media CR, S.A., cédula jurídica 3-101-234986, dueñas de las vallas publicitarias, con la Fundación Pro-Zoológicos durante la vigencia del Convenio de Administración MINAE-FUNDAZOO para la administración de esas propiedades.
Quedó demostrado que el MINAE inició un proceso de estudio y valoración preliminar, aspecto que generó el inicio de las gestiones legales pertinentes para emitir las ordenes administrativas dirigidas hacia los propietarios de esas infraestructuras -proceso que se encuentra en fase recursiva-. Se constató que el MINAE en coordinación con funcionarios del SINAC y Fuerza Pública, han estado en constante vigilancia de los inmuebles -por medio del comunicado DECI-081-2024 de fecha 17 de setiembre de 2024 se informó sobre los recorridos de control realizados en el CCSA ese mismo 17 de setiembre de 2024, por funcionarios de este Ministerio, SINAC y Fuerza Pública, en los que en ese momento no se encontró ningún indicio de ocupaciones-. Se evidenció que el MINAE tramitó la declaratoria de Categoría de Manejo Parque Natural Urbano (PANU) utilizando como insumo técnico el “Informe Técnico de Propuesta de Área Silvestre Protegida y asignación de categoría de manejo del Centro de Conservación Santa Ana” -este trámite se encuentra en su etapa final, y de momento se encuentra a la espera de que el Decreto Ejecutivo de la Declaratoria de PANU sea firmado por el presidente de la República-.
Quedó probado que el MINAE atendiendo a la época seca del año emitió el 12 de marzo de 2025 un Comunicado de Prensa indicando: “…La Brigada de Incendios Forestales del Área de Conservación Central (ACC), del Sistema Nacional de Áreas de Conservación (MINAE-SINAC), realizan labores de rondas cortafuego en el área donde se declarará próximamente el Parque Natural Urbano (PANU) Lorne Ross, específicamente, con el objetivo de proteger las estructuras existentes en el sector sur del sitio. La dirección regional había solicitado realizar rondas y anillos perimetrales de manera preventiva, para proteger las infraestructuras existentes y evitar daños a estos, por motivo de un incendio en el sector, dada la presencia de pastizales que, en diversas ocasiones, producto de actividades humanas de manera involuntaria o en forma premeditada, han provocado incendios forestales que afectan el ecosistema presente en la zona, con las respectivas consecuencias ambientales y socioeconómicas.
Por otra parte, el futuro PANU de aproximadamente 50 hectáreas, actualmente se encuentra dividido por la Dirección02, siendo que, periódicamente, se realizan operativos de control en sitio, con el propósito de evitar ingresos ilegales y con ello, vandalismo a las instalaciones…”. Se constató que en atención a la entrada en posesión del inmueble, este Ministerio coordinó la visita respectiva al inmueble con funcionarios del Ministerio de Cultura, donde se evidenció lo siguiente: • La falta de mantenimiento ha provocado que la vegetación crezca rápidamente. • La casa de adobes presenta un hundimiento en el pasillo exterior. • Los repellos de cemento se han reventado y desprendido. Existe presencia de vegetación en los techos de todas las edificaciones. • El trapiche presenta horcones y vigas dañadas por xilófagos. • La casa de bahareque presenta daños en paredes y columnas. • La casona de madera, presenta daños en los tablones de paredes, precinta y hojalatería de cubierta.
El cedazo de las ventanas también está dañado. • La estructura circular se encuentra con daños considerables. • Las paredes no tienen revocos, la ventana no tiene protección. • La cubierta presenta vegetación y aberturas por donde se filtra el agua. • La pequeña casa de arquitectura de tierra, presenta filtraciones de agua debido a los daños en el techo. • Las edificaciones recientes, presentan daños leves por falta de mantenimiento”. Se demostró que en fecha 02 de abril del 2025, funcionarios de la Dirección de Patrimonio Cultural realizaron una inspección in situ y constataron: Falta de mantenimiento a zonas verdes y techos. • No se han realizado sustituciones estructurales necesarias en madera, adobes ni hojalatería. • Persisten deficiencias en repellos, cubiertas y restauración de paredes tradicionales. Finalmente se verificó que, a la fecha de resolver el recurso de amparo, se encuentra en ejecución una contratación por parte de la ONG ASANA, adjudicada por la Organización para Estudios Tropicales (OET) bajo el Proyecto TEVU, que incluye: • Plan de manejo. • Propuesta de infraestructura y rehabilitación paisajística. • Estrategia de sostenibilidad. Sin embargo, estos productos aún no se han implementado ni reflejan acciones materiales de rehabilitación directa sobre el sitio. Partiendo de lo anterior es posible concluir lo siguiente:
Las edificaciones recientes, presentan daños leves por falta de mantenimiento. La entrada a la propiedad está siendo usada como parqueo de automóviles de un taller. 5.2. Recomendaciones: Dar mantenimiento a las áreas verdes y vegetación en general. Reparar la casa de adobes, retirando las losetas de barro del sector donde se encuentra el hundimiento y rellenar el área. Sustituir los repellos de cemento por revocos de cal y arena del sistema constructivo original. Limpiar la vegetación presente en el techo y acomodar las tejas de barro Sustituir los horcones del trapiche que se encuentran dañados por piezas con las mismas dimensiones. Sustituir las vigas dañadas por otras con las mismas características. Limpiar el techo de todo tipo de vegetación. Reparar las cubiertas de todas las edificaciones y eliminar la vegetación presente. En la estructura circular, restituir los adobes faltantes. Dar protección a la ventana y puerta.
Para a casona de madera, sustituir las piezas de madera que se encuentran podridas por otras con las mismas características. Sustituir la hojalatería en mal estado. Sustituir los cedazos dañados. Restaurar las paredes de tierra (adobes y bahareque) de las edificaciones que presentan, utilizando la técnica constructiva tradicional. Dar mantenimiento a las edificaciones de construcción reciente. Buscar la forma de evitar que la entrada de la propiedad sea utilizada como parqueo”.
Así las cosas lo procedente es declarar con lugar el recurso por las razones que se indican: Si bien es cierto las autoridades del Ministerio de Ambiente y Energía recibieron el inmueble en Santa Ana conocido como Finca Lornessa en condiciones de abandono; desde el 10 de julio de 2024 se emitió el informe No. IA-023-2024 con una serie de recomendaciones que, a la fecha no han sido cumplidas. Las recomendaciones consisten en lo siguiente: • Dar mantenimiento a las áreas verdes y vegetación en general. • Reparar la casa de adobes, retirando las losetas de barro del sector donde se encuentra el hundimiento y rellenar el área. • Sustituir los repellos de cemento por revocos de cal y arena del sistema constructivo original. • Limpiar la vegetación presente en el techo y acomodar las tejas de barro • Sustituir los horcones del trapiche que se encuentran dañados por piezas con las mismas dimensiones. • Sustituir las vigas dañadas por otras con las mismas características. • Limpiar el techo de todo tipo de vegetación. • Reparar las cubiertas de todas las edificaciones y eliminar la vegetación presente. • En la estructura circular, restituir los adobes faltantes. • Dar protección a la ventana y puerta. • Para a casona de madera, sustituir las piezas de madera que se encuentran podridas por otras con las mismas características. • Sustituir la hojalatería en mal estado. • Sustituir los cedazos dañados. • Restaurar las paredes de tierra (adobes y bahareque) de las edificaciones que presentan, utilizando la técnica constructiva tradicional.
Tal y como se logró demostrar en la inspección realizada el pasado 02 de abril, los inmuebles se encuentran en las mismas condiciones de abandono señaladas en el informe No. IA-023-2024 –es decir no se han atendido las recomendaciones mencionadas-; sino que únicamente se ha gestionado el contrato TH-CRO-CSP-015-2025 con la ONG ASANA (Asociación Amigos de la Naturaleza del Pacífico Central), que fue adjudicada por parte de la Asociación Organización para Estudios Tropicales (OET), a través del Proyecto Transición hacia una Economía Verde Urbana (TEVU) con el siguiente alcance y productos: a. Plan general de manejo. b. Diseño de infraestructura requerida (senderos permeables, sitios para colocar cámaras trampas, torres avistamiento aves). c. Propuesta para rehabilitación del paisaje. d. Propuesta de sostenibilidad. Ante ese panorama y tomando en cuenta que pese al tiempo transcurrido (más de nueve meses) la autoridad recurrida no ha realizado las gestiones que corresponden en aras de cumplir con las recomendaciones emitidas en el informe No. IA-023-2024 de fecha 10 de julio de 2024 lo procedente es declarar con lugar el recurso con las consecuencias que se indican en la parte dispositiva de esta sentencia.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara CON lugar el recurso. Se ordena a Ronny Rodríguez Chaves, en su condición de ministro a.i. de Ambiente y Energía o a quien en su lugar ocupe el cargo que proceda de FORMA INMEDIATA al cumplimiento de las recomendaciones emitidas en el informe No. IA-023-2024 de fecha 10 de julio de 2024. Deberá informar a esta Sala cada TRES MESES sobre lo actuado en tanto se acaten todas las recomendaciones emitidas. Se le advierte al recurrido que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
