(Name 001) SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at ten forty-eight a.m. on April eighth, two thousand twenty-five.
The constitutional challenge filed by (Name 001) is hereby admitted for consideration, seeking a declaration that Article 18, paragraph 2, of the Ley de Pesca y Acuicultura, No. 8436, is unconstitutional on the grounds that it is contrary to Articles 21, 50, and 74. The PROCURADURÍA GENERAL DE LA REPÚBLICA, the PRESIDENTE DEL INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA, the MINISTRO DE AMBIENTE Y ENERGÍA, the MINISTRO DE AGRICULTURA Y GANADERÍA, and the MINISTRO DE LA PRESIDENCIA are granted a hearing for a period of fifteen days. The petitioner states that the challenged provision has been used as a means of authorizing an activity that has been prohibited in the country for more than ten years because of its manifest and severe impact on the environment, harming not only artisanal fishers but also Costa Ricans generally. In analyzing the challenged text, it is necessary to focus on two fundamental aspects: first, the fact that initially only certain public educational institutions were permitted to market the products obtained in order to cover certain research costs.
Second, private entities or companies were required to provide financial security (garantía económica) in order to participate in and conduct the planned research activity, and were also required to surrender the catch so that INCOPESCA could market or otherwise dispose of it. However, the new version of the provision expands the possibility for the private sector to market the fishery resources obtained and leaves the scope of such marketing subject to the varying conditions of each permit. The amended provision grants privileges to the private sector—the holders of those permits—under the auspices of INCOPESCA, while leaving the circumstances in which the products obtained may be sold excessively open-ended. This amendment not only introduces differential treatment between the private and public sectors without objective and reasonable justification, but also transforms the nature of the research-based developmental fishing permit (permiso de pesca de fomento por investigación), making it so open-ended that it could even stray from its original purpose.
The new wording of the provision substantially modifies the original provisions of the law at issue by eliminating requirements, relaxing existing restrictions, and even redefining the allocation of authority. Thus, based on the argument that the research is conducted under the direction of INCOPESCA, the restrictions and requirements previously imposed on the private fishing sector for entirely clear and justified reasons of legality are relaxed. The original version of the provision limited the marketing of catches to certain public institutions, such as university colleges, universities, and the Instituto Nacional de Aprendizaje (INA), exclusively for the purpose of financing strictly scientific-research costs. The amendment places the private sector on an equal footing regarding access to these resources, without considering that it is not subject to the same safeguards or oversight mechanisms, thereby opening the door to discretionary use of fishery resources.
This, together with the fact that the provision contains minimal technical detail and is extremely open-ended, has produced outcomes such as the revival of a practice that is prohibited nationwide and for which sufficient technical criteria have not been provided to demonstrate that it is not causing irreversible environmental harm. The petitioner indicates that this challenge must be analyzed along two fundamental lines: the clear disparity or asymmetry introduced by the challenged provision through its undue favoritism toward private sectors, granting them permits to undertake activities that, by their very nature, were originally reserved for public, scientific, and educational institutions. Second, the complete lack of technical support underlying that legislation, a circumstance that the Sala Constitucional has consistently identified as an indispensable requirement for any regulation concerning the practice of trawl fishing (pesca de arrastre), given its extremely significant impact on marine resources and the environment generally.
Likewise, from the perspective of fundamental rights, it is important to note that the challenged provision directly violates the right to a healthy and ecologically balanced environment, recognized in Article 50 of the Constitución Política, which not only imposes a duty upon the State to protect natural resources but also establishes the principle of equitable distribution of wealth. Granting permits to private sectors with clear commercial interests in fishing and the marketing of marine species, to the detriment of the public interest and without supporting technical criteria, directly conflicts with the constitutional mandate to guarantee equitable and sustainable access to natural resources, affecting both the environment and the natural heritage of all Costa Ricans. It also violates Article 21 of the Constitution, which guarantees the inviolability of human life, insofar as harm to marine resources through techniques such as trawl fishing jeopardizes the population’s food security by degrading marine ecosystems and reducing opportunities for the sustainable use of those resources.
This is because the issue involves not only harm to marine biodiversity, but also a direct impact on the food sources and livelihoods of coastal communities and the country generally. Lastly, the provision also contradicts Article 74 of the Constitution, which establishes that the rights and benefits derived from the principles of social justice may not be waived, that those principles apply to all factors involved in the productive process, and that they are intended to foster a policy of national solidarity. In this case, opening a loophole that allows private fishing sectors with evident commercial interests to undertake activities previously reserved exclusively for public and scientific institutions violates this principle, insofar as it distorts the public, educational, and scientific purpose that originally motivated the activity. Even more seriously, the new wording would allow those private groups to receive subsidies or benefits for conducting activities intended for their own profit, thereby exacerbating inequality and undermining the public interest.
The petitioner considers that, because the provision lacks an adequate system of checks and balances among technically qualified institutions and delegates authority to an entity whose nature and composition are openly political rather than primarily technical, it creates a dangerous opening that facilitates the use and exploitation of public resources and ecosystems of exceptionally high environmental value by private sectors whose interests are primarily commercial. This omission not only violates the principles of effective environmental protection (tutela efectiva del ambiente), but also contradicts the constitutional mandate to protect and give priority to the public interest of all Costa Ricans, as well as the principle of legal certainty (seguridad jurídica), which must be fundamental in a matter of such importance. This challenge is admitted because it satisfies the requirements set forth in Articles 73 through 79 of the Ley de la Jurisdicción Constitucional.
The petitioner’s standing (legitimación) derives from the amparo proceeding (recurso de amparo) being processed under case file number 23-009158-0007-CO. In that proceeding, decision n° 35978 was issued at five forty-five a.m. on December third, 2024, granting a period in which to file this challenge, in accordance with Article 48 of the Ley de la Jurisdicción Constitucional. Notice of the filing of the challenge shall be published in the Boletín Judicial on three consecutive occasions. Legal effects of filing the challenge: Attention is drawn to the terms of Articles 81 and 82 of the Ley de la Jurisdicción Constitucional, which provide as follows: “Article 81. If the President considers that the aforementioned requirements have been satisfied, the President shall grant the Procuraduría General de la República and the opposing party appearing in the principal matter a hearing for a period of fifteen days so that they may state whatever they deem appropriate.
At the same time, the President shall direct that notice be sent to the court or body hearing the matter, instructing it not to issue a final decision before the Sala has ruled on the challenge, and shall order that a notice be published in the Boletín Judicial on three consecutive occasions, informing the courts and bodies that exhaust administrative remedies (agotan la vía administrativa) that the petition has been filed, so that no final decision shall be issued in proceedings or procedures in which the application of the law, decree, provision, agreement, or decision is at issue until the Sala has issued the corresponding ruling. If the challenge is filed by the Procurador General de la República, the hearing shall be granted to the person appearing as the opposing party in the principal matter.” “Article 82. Se da curso a la acción de inconstitucionalidad interpuesta por (Nombre 001), para que se declare inconstitucional el artículo 18, párrafo 2o, de la Ley de Pesca y Acuicultura. No. 8436, por estimarlo contrario a los artículos 21, 50 y 74. Se confiere audiencia por quince días a la PROCURADURÍA GENERAL DE LA REPÚBLICA, AL PRESIDENTE DEL INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA, el MINISTRO DE AMBIENTE Y ENERGÍA, el MINISTRO DE AGRICULTURA Y GANADERÍA y el MINISTRO DE LA PRESIDENCIA. Manifiesta el actor que la norma que se impugna ha sido utilizada como medio para autorizar la práctica de una actividad que en el país ha sido prohibida desde hace más de diez años, en razón de su absoluta y clara afectación al medio ambiente por perjudicar no solo a los pescadores artesanales sino que también a los costarricenses en general. Al analizar el texto impugnado, es preciso centrarse en dos aspectos fundamentales: primero, el hecho de que inicialmente solo se permitía a ciertas instituciones de índole educativa y pública, comercializar el producto obtenido para cubrir algunos costos de investigación.
Segundo, que existía una exigencia impuesta a entidades o empresas privadas de rendir una garantía económica para participar y llevar a cabo la actividad investigativa planeada, así como la obligación de entregar el producto capturado para que fuera INCOPESCA quien lo comercializara o dispusiera de él. Sin embargo, la nueva versión de la norma amplía la posibilidad a que el sector privado comercialice el recurso pesquero obtenido y deja la determinación del alcance de dicha comercialización sujeta a las condiciones, variantes, de cada permiso. La norma reformada dota de privilegios al sector privado (sujeto de esos permisos), bajo la imagen de INCOPESCA, incluso dejando en exceso abiertas las circunstancias en las que el producto obtenido puede ser vendido. Esta modificación no solo introduce un trato diferenciado entre el sector privado y el público sin una justificación objetiva y razonable, sino que también transforma la naturaleza del permiso de pesca de fomento por investigación, siendo tan abierto que, incluso, se presta a la posibilidad de que se aleje de su finalidad original.
La nueva redacción de la norma modifica sustancialmente las disposiciones originales de la ley discutida, eliminando requisitos, flexibilizando las limitaciones existentes e incluso redefiniendo la distribución de competencias. Así, bajo la argumentación de que las investigaciones se hacen bajo la dirección de INCOPESCA, se atenuan las restricciones y exigencias que anteriormente, por razones absolutamente claras y justificadas de legalidad, se aplicaba al sector pesquero de índole privada. La versión original de la norma limitaba la comercialización de las capturas obtenidas a determinadas instituciones de carácter público, como los colegios universitarios, las universidades y el Instituto Nacional de Aprendizaje (INA), con el propósito exclusivo de financiar costos meramente de investigación científica. La reforma equipara al sector privado en el acceso a estos recursos, sin considerar que este no está sujeto a las mismas salvaguardias ni mecanismos de control, lo que abre la puerta a un uso discrecional de los recursos pesqueros.
Esto, sumado al hecho de que dicha norma es mínimamente técnica y en extremo abierta, ha logrado producir resultados como la vuelta a la vida de una práctica que se encuentra prohibida a nivel nacional y que no ha demostrado tener los suficientes criterios técnicos que prueben que no está causando daños irreversibles en el ambiente. Indica el accionante que esta acción tiene que analizarse desde dos ejes fundamentales: la clara disparidad o asimetría que introduce la norma impugnada al favorecer indebidamente a sectores privados, otorgándoles permisos para desarrollar actividades que, por su propia naturaleza, correspondían en un principio solo a instituciones públicas, científicas y educativas. Y, en segundo lugar, en la absoluta falta de sustento técnico que fundamente la existencia de esa normativa, situación que ha sido señalada de manera consistente por esa Sala Constitucional como un requisito indispensable para cualquier regulación relacionada con la práctica de la pesca de arrastre, dada su altísima incidencia sobre los recursos marinos y el ambiente en genera.
Asimismo, y desde la perspectiva de los derechos fundamentales, es importante señalar que la norma cuestionada vulnera de manera directa el derecho al ambiente sano y ecológicamente equilibrado, reconocido en el artículo 50 de la Constitución Política, el cual no solo impone un deber al Estado de proteger los recursos naturales, sino que también establece el principio de distribución equitativa de la riqueza. El otorgamiento de permisos a sectores privados con claros intereses comerciales en la pesca y comercialización de especies marinas, en detrimento del interés general y sin criterios técnicos que lo sustenten, implica una ruptura directa con el mandato constitucional de garantizar el acceso equitativo y sostenible a los recursos naturales, afectando tanto el ambiente como el patrimonio natural de todos los costarricenses. También lesiona el artículo 21 de la Constitución, que garantiza la inviolabilidad de la vida humana, en tanto la afectación a los recursos marinos mediante técnicas como la pesca de arrastre compromete la seguridad alimentaria de la población, al deteriorar los ecosistemas marinos y reducir las posibilidades de aprovechamiento sostenible de dichos recursos.
Esto, puesto que no se trata solo de la afectación a la biodiversidad marina, sino de un impacto directo sobre las fuentes de alimento y sustento de comunidades costeras y del país en general. Por último, la norma también contradice lo dispuesto en el artículo 74 constitucional, el cual establece la irrenunciabilidad de los derechos y beneficios derivados de los principios de justicia social, aplicables a todos los factores que concurren en el proceso productivo, y orientados a procurar una política de solidaridad nacional. En este caso, al abrirse un portillo para que sectores privados pesqueros, con evidentes intereses comerciales, puedan llevar a cabo actividades que antes estaban reservadas exclusivamente a instituciones públicas y científicas, se quebranta este principio, en tanto se desvirtúa la finalidad pública, educativa y científica que motivaba originalmente la actividad. Aún más grave resulta que, bajo la nueva redacción, se permitiría que dichos grupos privados reciban, incluso, subvenciones o beneficios por realizar actividades orientadas al lucro propio, lo que profundiza la desigualdad y atenta contra el interés general.
Considera el actor que, al carecer la norma de un sistema adecuado de pesos y contrapesos entre instituciones de carácter técnico, y al delegar competencias en una entidad cuya naturaleza y composición son abiertamente políticas y no eminentemente técnicas, se abre un espacio peligroso que facilita que recursos públicos y ecosistemas de altísimo valor ambiental sean utilizados y explotados por sectores privados cuyos intereses son eminentemente comerciales. Esta omisión no solo vulnera los principios de tutela efectiva del ambiente, sino que también contradice el mandato constitucional de proteger y anteponer el interés público de todos los costarricenses, además del principio de seguridad jurídica que debe ser básico en un tema tan importante. Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. La legitimación del accionante proviene del recurso de amparo que se tramita en el expediente número 23-009158-0007-CO.
En ese recurso, se dictó la resolución n° 35978 de las cinco horas con cuarenta y cinco minutos del tres de diciembre de 2024, mediante la cual se dio plazo para interponer la acción, de conformidad con lo dispuesto en el artículo 48 de la Ley de la Jurisdicción Constitucional. Publíquese por tres veces consecutivas un aviso en el Boletín Judicial sobre la interposición de la acción. Efectos jurídicos de la interposición de la acción: Se recuerdan los términos de los artículos 81 y 82 de la Ley de la Jurisdicción Constitucional que disponen lo siguiente “Artículo 81. Si el Presidente considerare cumplidos los requisitos de que se ha hecho mérito, conferirá audiencia a la Procuraduría General de la República y a la contraparte que figure en el asunto principal, por un plazo de quince días, a fin de que manifiesten lo que estimen conveniente. Al mismo tiempo dispondrá enviar nota al tribunal u órgano que conozca del asunto, para que no dicte la resolución final antes de que la Sala se haya pronunciado sobre la acción, y ordenará que se publique un aviso en el Boletín Judicial, por tres veces consecutivas, haciendo saber a los tribunales y a los órganos que agotan la vía administrativa que esa demanda ha sido establecida, a efecto de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho el pronunciamiento del caso.
Si la acción fuere planteada por el Procurador General de la República, la audiencia se le dará a la persona que figure como parte contraria en el asunto principal.”, “Artículo 82. En los procesos en trámite no se suspenderá ninguna etapa diferente a la de dictar la resolución final, salvo que la acción de inconstitucionalidad se refiera a normas que deban aplicarse durante la tramitación.”. Dentro de los quince días posteriores a la primera publicación del citado aviso, podrán apersonarse quienes figuren como partes en asuntos pendientes a la fecha de interposición de esta acción, en los que se discuta la aplicación de lo impugnado o aquellos con interés legítimo, a fin de coadyuvar en cuanto a su procedencia o improcedencia, o para ampliar, en su caso, los motivos de inconstitucionalidad en relación con el asunto que les interese. Se hace saber además, que de conformidad con los artículos 81 y 82 de la Ley de Jurisdicción Constitucional y conforme lo ha resuelto en forma reiterada la Sala (resoluciones 0536-91, 0537-91, 0554-91 y 0881-91) esta publicación no suspende la vigencia de la norma en general, sino únicamente su aplicación en los casos y condiciones señaladas.
La contestación a la audiencia conferida en esta resolución deberá ser presentada una única vez, utilizando solo uno de los siguientes medios: documentación física presentada directamente en la Secretaría de la Sala; el sistema de fax; documentación electrónica por medio del Sistema de GESTIÓN EN LÍNEA; o bien, a la dirección de correo electrónico ...01, la cual es correo exclusivo dedicado a la recepción de informes. En cualquiera de los casos, la contestación y demás documentos deberán indicar de manera expresa el número de expediente al cual van dirigidos. La contestación que se rindan por medios electrónicos, deberá consignar la firma de la persona responsable que lo suscribe, ya sea digitalizando el documento físico que contenga su firma, o por medio de la firma digital, según las disposiciones establecidas en la Ley de Certificados, Firmas Digitales y Documentos Electrónicos, Nº 8454, a efectos de acreditar la autenticidad de la gestión.
Se advierte que los documentos generados electrónicamente o digitalizados que se presenten por el Sistema de Gestión en Línea o por el correo electrónico señalado, no deberán superar los 3 Megabytes. Notifíquese.
