Document Review Case: 24-024724-0007-CO Decision No. 2025009437 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen on veintiocho de marzo de dos mil veinticinco.

Amparo proceeding (recurso de amparo) processed under case number 24-024724-0007-CO, filed by Nombre09, identity card No. NFP03, Nombre04, identity card No. NFP12, Nombre03, identity card No. NFP04, on behalf of Nombre11, identity card No. NFP05; Nombre02, identity card 0800860893; Nombre03, identity card 0502210932; Nombre01, identity card NFP02, Nombre11, identity card NFP05, Nombre10, identity card NFP01, Nombre01, identity card NFP02; Nombre08, identity card NFP06; Nombre14, identity card NFP09; Nombre17, identity card NFP10; Nombre07, identity card NFP07, Nombre13, identity card NFP08, against the MUNICIPALIDAD DE CAÑAS.

FINDINGS OF FACT:

  1. 1In a written submission received by the Chamber’s Secretariat at 09:30 on 06 de setiembre de 2024, the petitioners filed an amparo proceeding against the MUNICIPALIDAD DE CAÑAS and stated that the protected parties (amparados), Nombre11 and Nombre02, are older adults and the owners of property No. PRN02 in the area known as ANDESA. They stated that the land on which the property is located is a slope (talud) or elevated area where constant “rainfall, strong winds, earthquakes, and other events caused the soil to fall,” and therefore, to protect the physical safety of her children and parents, in 1991 she applied for the corresponding municipal permits to build a wall, which she then constructed. They stated that the lots are extremely small and, in the case of PRN03, it measures 159,33 square meters, and that construction of her parents’ house began with assistance from a housing subsidy (bono de vivienda) in marzo de 1991; throughout all dealings they have had with the municipality, there has never been any proceeding involving instructions related to violations—that is, she has paid her taxes and processed her residential construction permits.Among other arguments, the petitioner complains of several problems involving pollution, stormwater discharge (desfogue de aguas pluviales), and the risk of slope failures. Specifically, she alleges the following: • the failure to construct the “curb and gutter” along the street connecting the MOPT offices with Dirección10 in the ANDESA neighborhood; • the failure of private property owners in ANDESA to construct slope-retaining walls, as well as their performance of earthworks (movimientos de tierras); • the failure to construct the necessary ditches to convey water from southern ANDESA and part of Barrio San Pedro, and the failure to construct “storm drains,” specifically between “Dirección02 and ANDESA,” to ensure proper drainage; • the failure to construct sanitary sewer systems and some problem involving the septic tanks on each property in the ANDESA neighborhood; • pollution problems on MOPT property due to “garbage, overgrown vegetation, and dead animals,” or because of “water flowing down from that property,” “the passage of freight carriers who undermine the slope,” or the failure to construct a retaining wall; • the demolition of a curb and gutter that serves no purpose and was left at a very high elevation, at the point where the slope begins in that area; and • the lack of an adequate stormwater system and sewage system.In this regard, the applicant adds that they have formally submitted the corresponding written requests to the Municipalidad de Cañas and the competent authorities to report the irregularities described above concerning the “(…) water situation and the failure to build better curbs and gutters for our Andesa community, which has been raised at hearings and in letters to mayors and deputy mayors of this Guanacaste canton. The situation involving the Flta (sic) support area (…)”. She submits requests dated 19 de octubre de 2023 and 20 de setiembre de 2024, as well as an email dated 18 de setiembre de 2023, among other submissions made to the respondent Municipality. They complain that this situation affects both the petitioner and the protected parties, some of whom are older adults and minors. She alleges that, as of the date this proceeding was filed, the municipal authorities had not resolved their requests and had failed to perform their duties because they had not arranged for the construction of the infrastructure necessary to prevent the aforementioned problems.
  2. 2Alexander Elizondo Duarte, in his capacity as Municipal Mayor of Cañas, reports under oath as follows:

“1) Background: 1.1. More than 35 years have passed since the basic houses in Urbanización Andesa were built under the housing-subsidy program (excluding the perimeter fences and the additions or extensions to the passageways at the front or rear of the properties). In its first phase, this project began with the construction of approximately 10 social-housing units financed through housing subsidies, and they therefore had construction permits. Over the years, however, their built areas were expanded, including extensions to passageways or rear rooms used as living quarters and perimeter structures. Many of these structures were built without the corresponding construction permits. Most of the perimeter structures lack construction permits and were not supervised by a construction professional who could have guided the owners regarding how the walls should have been built and the corresponding setbacks (retiros) from the slope adjoining these properties.

Nor did they receive guidance on building the walls and observing the required wall depths. The Municipality is specifically aware of the case of the petitioner herein, who built her passageway areas and perimeter structures with permits; however, during the past year, the petitioner constructed a shed in the backyard of her parents’ property (whom she claims to represent, although she has not been appointed as the legal representative of the property owners, who are the parents of the petitioner herein). With regard to the shed built by the petitioner herein, Nombre09, the Municipality notified her that she must legalize the structure because it is unlawful, as it lacks the corresponding permits and does not comply with the slope setbacks applicable when the shed was constructed. It is important to inform the Honorable Justices that the Municipalidad de Cañas has never refused or been indifferent to listening to and assisting the residents of Urbanización Andesa.

On the contrary, they are received at meetings with the various institutional professionals (Environmental Manager, Construction Engineer, and engineer from the Technical Road Management Unit), who listen to them and provide (verbal) assessments of the facts they describe concerning their concern over the possibility that the slope adjoining our Dirección07 (which borders the rear of their properties) may continue to slide. During the meetings, the professionals always issue instructions or recommendations, which are communicated and explained to them, regarding how they must channel stormwater from their yards through gutters and downspouts and convey it to the front of the properties to prevent a greater or accelerated slope washout. They are also instructed not to allow wastewater from their properties to flow across the slope, solely to prevent accelerated soil erosion. The Construction Department verifies compliance with these measures and with the deadlines established under the work plan prepared by the Municipalidad de Cañas in full compliance with the judgment of this Constitutional Chamber issued at nueve horas veinte minutos del veintiséis de mayo de dos mil veintitrés, Decision No. 2023012166, in case 23-007491-0007-CO.

Regarding the reported facts:

1- Since 2010, the Municipality has been aware of the landslide and soil-erosion problems in the Urbanización Andesa area, located in Barrio San Cristóbal Sur. It therefore began conducting regular on-site inspections and obtained the assistance of institutions with significant expertise in the matter, such as the Comisión Nacional de Emergencias. Thus, in 2010, as a result of the inspections conducted by the Municipality’s Construction Department and Technical Road Management Unit, technical opinion number DOS-199-10 was issued, in which the official in charge, Angie Díaz, provided a series of recommendations to the residents. Although not all residents followed them, they helped improve the situation. During that same year, the Comisión Nacional de Emergencias was asked to provide professionals specializing in risk-zone assessment to evaluate a specific property that was vulnerable to collapse (see photograph).

The Comisión Nacional de Emergencia issued opinion number CUE-0623-2012, which specifically addressed the property at risk and set out the measures to be taken to prevent its collapse through a landslide. Those recommendations were directed to the landowner because the slope is located within private property and was the one most at risk of collapsing. The Municipality undertook supervision of the work performed by the owner (see the photographs showing the landslide danger in 2012, the photographs showing the completed retaining wall built by the owner, and how the wall currently appears without any landslide problems).

2- The Municipality has conducted regular on-site inspections from 2012 to the present, verifying that landslides or soil detachments are not continuing at the site (these inspections are conducted regularly from a vehicle and are primarily visual inspections). Through these inspections, we have monitored and confirmed that no landslides have occurred at the site during the past 13 years and that erosion does not exceed three percent of the land. On the contrary, the vegetation and soil stabilization on the slope have improved, even though some property owners continue to act unlawfully and irresponsibly, as it has been confirmed that they continue to construct structures in their yards, including residential buildings, without observing the slope setbacks, and divert both stormwater and wastewater onto the slope, contrary to the Municipality’s instructions. As part of implementing the measures established in the work plan, the following work was performed on 01 de agosto del presente año (2024):

The vegetation cover (cobertura vegetal) on the slope is being maintained.

Trees were pruned to reduce the weight of their branches.

(…)

Additionally, as part of the work, waste found at the site was collected.

As evidenced in the preceding photographs, part of the work consists of maintaining low vegetation cover (cobertura vegetal) (grass and weeds) to prevent erosion or the washing away of land by rainfall or improperly channeled water. It is important to note that maintenance work at this site is included in the schedule for operational personnel responsible for street cleaning and sanitation services; that is, there is a periodic cleaning schedule based on the area of the canton. The site’s current condition is shown below (photographs taken on 25 de septiembre del 2024).

In response to judgment 2023012166 of the Constitutional Chamber concerning the amparo appeal (recurso de amparo) being processed under expediente 23-007491-0007-CO, filed by Nombre16, and the Action Plan submitted by the Municipalidad de Cañas to comply with the order issued by this Chamber, on 18 de setiembre de 2023 a joint inspection was conducted in Barrio ANDESA by officials from the environmental management and road infrastructure departments of the Municipalidad de Cañas, the Ministerio de Salud, and MINAE. The purpose of the inspection by the urban development and control department was to address the irregularities detected regarding construction without municipal permits and the diversion of stormwater (aguas pluviales) that could affect the slope (talud). It should be noted that inspections were also conducted jointly with the Ministerio de Salud on 20 de noviembre de 2023. Accordingly, the respective notices were issued to the residents of Barrio ANDESA based on the findings of the inspection.

It is clarified that notice is not being issued in relation to homes built under approved construction permits, but rather in relation to additions or works subsequently carried out without a municipal permit. In the specific case of Nombre11 and Nombre02, they were informed through official letter DCU-077-24 that water is being improperly managed and that the site-coverage parameter (parámetro de cobertura) established in the zoning plan (plan regulador) has been exceeded. Regarding the structures on property No. PRN04, the structure that lacks the respective permits and fails to comply with the site-coverage requirement is the roofed area used for hanging clothes, as stated by Nombre09 in point EIGHTH of the document received on 20 de setiembre de 2024 by the urban development and control department. It is important to mention that a new inspection will be scheduled because, in that same document, Nombre09 states that they have already made the corrections concerning stormwater management.

It should be emphasized that, pursuant to its authority and the organic law of the Instituto Costarricense de Acueductos y Alcantarillados, that institution is responsible for carrying out and promoting the planning, financing, and development of, and resolving all matters related to, the supply of drinking water and the collection and disposal of sewage; it is also the institution responsible for administering sanitary sewerage (alcantarillado sanitario) in the Cantón de Cañas. It is therefore incorrect to assert that the mayor’s office and the urban development and control department had any involvement in excluding Barrio ANDESA from the construction of the sanitary sewerage system. Regarding the works to be carried out on the street located along the north side of the MOPT facilities in Barrio San Cristóbal in the city of Cañas, I hereby state the following:

a. In accordance with the action plan developed to address this case, the required funding from Ley N" 8114 and its amendments was included in the 2024 Ordinary Budget for the construction of a curb and/or gutter for stormwater drainage along the northern side of the street in question, as well as the funding required for vertical road signage establishing the street as one-way. b. The Road Infrastructure Department is currently preparing the terms of reference for launching, in October, the procurement procedure for the works indicated in the preceding paragraph, which are expected to be carried out during the first four months of 2025. During a recent visual inspection, evidence was documented for presentation to the honorable justices showing the conduct of the residents whose properties border the slope adjoining Dirección07, who are signatories hereto, and how they jeopardize the slope’s integrity and preservation by constructing buildings for residential use, including two-story buildings, with drainage outlets directed toward the slope, waterproofing the soil with cement, and discharging water onto the slope through downspouts.

These are the improper practices that the municipality is correcting jointly with the Ministerio de Salud by notifying the signatories hereto that they must remove the illegal structures that damage or endanger the slope, along with the soil surfaces (yards) waterproofed with cement, which prevent the land from properly absorbing stormwater from the property and cause the water to flow uncontrollably toward the slope. This is compounded by water from the roofs of the structures, even though this same Constitutional Chamber ordered us to preserve and protect the slope pursuant to judgment 2023012166 of the Constitutional Chamber concerning the amparo appeal being processed under expediente 23-007491-0007-CO. However, despite all the problems found at the site, the slope reported herein showed no signs of collapse or landslides (deslizamientos) during the documented field inspection, nor did it exhibit signs of ongoing erosion. On the contrary, we found restored soil with a forested area, where the improved forest growth is binding the soil.

Conclusion:

1- With full knowledge of the case and the subject matter, and based on the field inspections conducted on 25 de septiembre 2024 by the municipality’s expert civil and environmental engineers, we conclude that there is no indication of a landslide on the slope adjoining Dirección07 in the Barrio San Cristóbal Sur sector, along the rear boundary of the Andesa residential development; that the sole problem, which arose in 2010, was resolved in 2012 and early 2013; and that no danger of collapse has arisen again, it being clear that the recommendations contained in the assessments of the Comisión Nacional de Emergencias were followed. 2- We conclude that, according to the reports of the Municipalidad de Cañas’s civil-engineering experts, the slope is showing no indication of collapse. 3- We conclude that the signatory residents of the ANDESA residential development do not wish to bring their structures into legal compliance or remove those that endanger the stability of the slope because they were built beyond the legally required setback from the slope, and they unlawfully waterproofed the soil.

The aggravating circumstance continues because they maintain those structures in the area bordering the slope, with wastewater and stormwater discharging toward it, thereby accelerating erosion of the slope and failing to recognize the need to protect the site in order to prevent landslides. 4- We conclude, and have demonstrated, that there is currently no danger of collapse or displacement of material; that the slope adjacent to the property boundaries of the Andesa residential development is currently stable and presents no risk of landslides; and that the erosion present is normal under natural conditions, although it may be affected by the improper practices of some of the adjoining property owners who are signatories hereto with respect to the discharge of wastewater and stormwater from their properties and by the illegal structures that extend beyond the excess portion of the legally authorized property. 5- Furthermore, there is no garbage or foul odor at the site, contrary to what the petitioning signatories have maliciously represented to this Chamber without evidence.” He requests that the appeal be dismissed.

  1. 3By ruling issued at 11:02 on 24 de febrero de 2025, the proceedings were expanded and the Director of the Área Rectora de Salud de Cañas was given an opportunity to respond.
  2. 4Juan Luis Sánchez Vallejos, in his capacity as Director of the Área Rectora de Salud del Ministerio de Salud in Cañas, Guanacaste, states under oath that:

“FIRST.- In order to comply with an order issued by the Constitutional Chamber of the Supreme Court of Justice, the record shows that Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Área Rectora de Salud de Cañas, conducted inspections of properties affected by the slope (talud) in Andesa; accordingly, pages 0034 through 0040 of the administrative file (expediente administrativo) contain the Inspection Reports (Actas de Inspección) issued under reference numbers MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023 and MS-DRRSCH-DARSCÑ- 496-2023. SECOND.- The record likewise shows that Mayela Sandoval Valle, an official of the Regulatory Team of the Área Rectora de Salud de Cañas, conducted an inspection of a residence located 400 metros al sur y 25 metros al este de la Iglesia Católica del barrio Andesa; accordingly, page 0041 of the administrative file contains the Inspection Report issued under reference number MS-DRRSCH-DARSCÑ- 496-2023, which states as follows: ‘During the visit, it was observed that the wastewater (aguas residuales) is discharged onto the public roadway; it was also observed that the property has been built upon in its entirety and that one of the roofs has no gutters (canoas).

A fluorescein test was conducted. ..’. THIRD.- The record contains official letter MS-DRRSCH-DARSCÑ- IT-297-2024, through which Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Área Rectora de Salud de Cañas, issued a Technical Report (Informe técnico), stating, among other things, the following: ‘On 05 de septiembre del 2023, in response to a request for assistance concerning properties affected by the slope in Andesa, a joint visit was conducted with the Municipality to several homes adjoining the affected slope. Most of the homes have their respective gutters directed toward the curb and gutter (cordón y caño) located in front of the home, while at other homes they are directed toward the slope. The slope identified in that official letter adjoins a public road that has a curb and gutter only at the beginning of the road, while the remainder has none, making it difficult to channel stormwater (aguas pluviales) along that route.

Based on what was verified during the joint visit with the Municipality, the problem described concerns stormwater and infrastructure and must be resolved by the Municipalidad de Cañas. The case will be followed up.’ FOURTH.- On 12 de marzo del 2025, Engineer Paula Murillo Esquivel, an official of the Regulatory Team of the Área Rectora de Salud de Cañas, conducted an inspection in barrio Andesa; accordingly, the record contains an Inspection Report in which that official states the following: ‘A visit was conducted to verify the facts and respond to an amparo appeal (recurso de Amparo). It was observed that the Municipalidad de Cañas has neither performed maintenance nor carried out the necessary works to channel stormwater, such as curbs and gutters; abundant garbage and weeds were also observed.’ FIFTH.- The record contains official letter MS-DRRSCH-DARSCÑ- IT-048-2025, through which Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Área Rectora de Salud de Cañas, issued a Technical Report, stating, among other things, the following: ‘On 12 de marzo del 2025, in response to an amparo appeal, file 24-024724-0007- CO, a visit was conducted to verify the conditions mentioned in that document, and the following was observed: • The Municipalidad de Cañas has not carried out the works necessary to channel stormwater, such as the curb and gutter.

Garbage was observed throughout the roadway. Most of the homes were observed to have their respective gutters.’ CONCLUSION: Based on the foregoing and the documentary evidence submitted, it is clear and evident that this Área Rectora de Salud de Cañas, as part of the Ministerio de Salud, is fully willing to assist all institutions that request our assistance, particularly when there is a public-health problem that can be resolved through interinstitutional action.” It requests that the appeal be denied.

  1. 5The legal requirements have been observed in the proceedings conducted.

Opinion drafted by Justice Garro Vargas; and,

WHEREAS:

I. PRELIMINARY MATTER

Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings (procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 at 8:55 horas del 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), both for issuing a final administrative act (acto final) in an administrative proceeding initiated ex officio or at the request of a party, and for deciding the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception, because it concerns complaints filed with the Municipalidad de Cañas regarding a problem related to the failure to construct better curbs and gutters in the Andesa community, which allegedly have not been addressed. With this point clarified, the Court proceeds to decide the specific situation raised in this amparo proceeding (amparo).

II. SUBJECT MATTER OF THE APPEAL

The appellants state that the protected parties (amparados), Nombre11 and Nombre02, are older adults and owners of property No. PRN02 in the area known as ANDESA. They state that the land on which the property in question is located is a slope or elevation where the constant “rainfall, strong winds, earthquakes, and other events caused soil to fall away.” For that reason, the corresponding municipal permits were requested for the construction of a wall, which was subsequently built. Nevertheless, the appellant alleges several problems involving pollution, stormwater discharge (desfogue de aguas pluviales), and the risk of landslides from the slope. In this regard, she adds that they have formally submitted the corresponding written requests to the Municipalidad de Cañas and the competent authorities, seeking to report irregularities concerning the “water situation and the failure to construct better curbs and gutters for our Andesa community, which has been raised at hearings and in letters to the mayors and deputy mayors of this Guanacaste canton.

The situation with the Flta (sci) support area (…)”. She submits requests dated 19 de octubre de 2023 and 20 de setiembre de 2024, as well as an email dated 18 de setiembre de 2023, filed with the respondent municipality. Nevertheless, she alleges that, as of the date this appeal was filed, the municipal authorities have not ruled on their requests and have failed to perform their duties, insofar as they have not undertaken the necessary infrastructure works to prevent the aforementioned problem.

III. PROVEN FACTS

The following facts are deemed duly proven and relevant to the resolution of this matter, either because they have been established as such or because the respondent failed to address them as directed in the initial order:

  • a)The protected parties are residents of Urbanización Andesa, located in Dirección03, Guanacaste (see the attached report).
  • b)The rear portions of the protected parties’ properties adjoin a slope (see the attached report).
  • c)Since 2010, the respondent municipality has been aware of the landslide and soil-erosion problems in the Urbanización Andesa area and, accordingly, began conducting regular inspections at the site, even accompanied by the Comisión Nacional de Emergencias (see the attached report).
  • d)In Report DOS-199-10 of 4 de noviembre de 2010, the Departamento de Ingeniería y Construcciones de la Municipalidad de Cañas concluded as follows: “The washing away and undercutting of the land adjacent to the properties of residents of Urbanización ANDESA is caused by rainfall and the improper management of sewage and gray water (aguas servidas y jabonosas) by some community residents. Residents of Urbanización ANDESA must direct sewage and gray water to a treatment system approved by the Ministerio de Salud, because discharging this water directly onto the slope causes it to be progressively undercut. The existing vegetation cover (cobertura vegetal) minimizes the impact that rainfall may have on the slope and therefore must be preserved. The weeds may, where appropriate, be cut back slightly so that the area appears somewhat cleaner. Residents of Urbanización ANDESA must not undertake construction without the corresponding municipal permits. Furthermore, any construction carried out in that area must comply with the safety setbacks (retiros) warranted by the circumstances and must have a professional responsible for the construction work” (see ad effectum videndi amparo appeal No. 23-007491-0007-CO).
  • e)In official letter CUE-0623-2012 of 27 de febrero de 2012, addressed to the Director of Disaster Management, the Contraloría de Unidades Ejecutoras of the CNE stated: “An inspection of Urbanización ANDESA was conducted at your request and in response to the documentation submitted by Ms. Karol Ruiz Rodríguez, Coordinator of the Comité Municipal de Emergencias de Cañas. The inspection was conducted in the company of Mr. Lizanías Zúñiga López, in his capacity as Mayor of the Municipalidad de Cañas, municipal technical personnel, and officials from the Ministerio de Salud. The principal matters observed during the visit conducted on 22 de febrero del 2012 are set forth below. DETAILS OF THE VISIT a) Most of the properties to be assessed are located in an area adjoining the public street in Urbanización ANDESA, located in the district of Cañas, canton of Cañas. b) Some dwellings are susceptible to being affected by a landslide (deslizamiento), as they are located along the upper edge of the slope (talud). c) According to verbal statements by officials from the Construction Permits Department of the Municipalidad de Cañas, the walls located along the property boundaries of the dwellings were built without any municipal permit, and the applicable setbacks (retiros) stipulated in the regulations currently in force were not observed. d) Sewage and graywater (aguas negras y jabonosas) are being improperly managed, causing the soil to become saturated and consequently causing material to break away, since the water is discharged directly onto the slope. e) At present, some sections of the land show material breaking away, principally on private property where there is a wall exhibiting the following conditions: • Separation at the wall joints. • Lateral displacement of the wall surfaces. • Exposed reinforcing bars with an advanced degree of deterioration (corrosion). • Exposed foundations. f) To date, this wall has not been demolished, despite demolition having been ordered months ago by the Regional Department of the Ministerio de Salud.

Under these circumstances, there is an increased risk that this wall may cause harm to the physical safety of persons living in the dwellings located immediately adjacent to it. It is important to note that site visits have already been conducted and recommendations have been issued by the following institutions: a. Ministerio de Salud — Regional Department. b. Municipalidad de Cañas — Construction Permits Department. c. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias — Prevention Department. Nevertheless, the residents have not complied with the recommendations provided; therefore, the competent institutions are urged to ensure compliance with the recommendations described. The problem facing the community of Urbanización Andesa de Cañas, Guanacaste, because it involves an evident disregard for the regulations currently in force and because the properties are located largely on private land, must be addressed by the Municipalidad de Cañas.

This is because the damage observed is not connected to an extraordinary event that would permit the use of resources from the Fondo Nacional de Emergencias” (see, ad efectum vivendi, amparo proceeding No. 23-007491-0007-CO).

  • f)The respondent municipal authority has held meetings with the various institutional professionals, namely, the environmental manager, construction engineer, and engineer from the Road Management Technical Unit, during which it listened to the residents and received their verbal assessments of the facts presented by the inhabitants of Andesa concerning their concern that the slope adjoining Dirección07 may continue to slide (see attached report).
  • g)During the meetings, the professionals have consistently issued instructions or recommendations, which have been communicated and explained to the residents, regarding how they must channel stormwater (aguas pluviales) from their yards through gutters and downspouts and convey it to the front of their properties to prevent a larger or accelerated washout of the slope. They have also been instructed not to discharge wastewater (aguas residuales) from their properties across the slope, for the sole purpose of preventing accelerated erosion of the land. The Construction Department verifies compliance with these measures and with the deadlines established under the work plan prepared by the Municipalidad de Cañas (see attached report).
  • h)Since 2012, the Municipalidad de Cañas has conducted regular inspections at the site to verify that landslides or soil detachments do not continue there. Erosion does not exceed three percent of the land; on the contrary, the vegetation on the slope and the stabilization of the soil have improved. This is despite the fact that some property owners continue to act illegally and irresponsibly, as it has been confirmed that they continue constructing structures in their yards and residential buildings without observing the required slope setbacks. They also divert both stormwater and wastewater onto the slope, contrary to the instructions issued by the municipality (see attached report).
  • i)On 18 de setiembre de 2023, a joint inspection was conducted in Barrio ANDESA with officials from the Environmental Management and Road Infrastructure Department of the Municipalidad de Cañas, the Ministerio de Salud, and MINAE. Likewise, on 20 de noviembre de 2023, additional inspections were conducted in the area together with the Ministerio de Salud, after which the respective notices were served on the residents of Barrio ANDESA based on the irregularities identified during the inspection concerning construction without municipal permits and the diversion of stormwater that could affect the slope (see attached report).
  • j)On 1º de agosto de 2024, as part of compliance with the measures set forth in the work plan, the respondent local government carried out the following tasks: “Vegetative cover (cobertura vegetal) is being maintained on the slope; trees were pruned to reduce the weight of branches; and waste found at the site was collected” (see attached report).
  • k)Through official letter DCU-077-24, appellants Nombre11 and Nombre02 were notified that water was being improperly managed and that the coverage parameter established in the zoning plan (plan regulador) was being exceeded. They were also informed that the structures built on that property lacked the respective permits and failed to comply with the coverage requirements for the roofed area used to hang laundry (see attached report).
  • l)During a recent visit to Urbanización Andesa, the respondent municipality documented the conduct of the residents whose properties adjoin the slope bordering Dirección07, who are signatories hereto and who jeopardize the welfare and preservation of the slope by constructing buildings for residential use, including second stories, with drain outlets beside the slope, waterproofing the ground with cement, and discharging water onto the slope through downspouts. These improper practices are being corrected by the municipality in coordination with the Ministerio de Salud, through notices directing the signatories hereto to remove the illegal structures that damage or endanger the slope and the soil, including yards waterproofed with cement, which prevents the land from properly absorbing stormwater from the properties (see attached report).
  • m)On 25 de setiembre de 2024, expert civil and environmental engineers from the respondent authority conducted a site visit and concluded that there was no indication of an impending landslide on the slope adjoining Dirección07 in the barrio San Cristóbal Sur sector, along the rear boundary of urbanización Andesa (see attached report).
  • n)As of the date the report was submitted, the slope adjoining the properties of the residents of Urbanización Andesa showed no signs of collapse or landslides. Nor did it show signs of ongoing erosion; on the contrary, its soil had been restored with a wooded area, and soil stabilization had resulted from the improved forest (see attached report).
  • o)In compliance with the order contained in judgment No. 2023012166 at 09:20 hours on 26 de mayo de 2023, issued in expediente No. 23-007491-0007-CO, the Área Rectora de Salud del Ministerio de Salud en Cañas, Guanacaste, conducted inspections of the properties affected by the slope in Urbanización Andesa, as recorded in inspection reports under consecutive Nos. MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023, and MS-DRRSCH-DARSCÑ-496-2023 (see attached report).
  • p)In inspection report No. MS-DRRSCH-DARSCÑ-496-2023, official Mayela Sandoval Valle of the Regulatory Team of the Área Rectora de Salud de Cañas conducted an inspection of a residence located four hundred meters south and twenty-five meters east of the Catholic Church in barrio Andesa and stated as follows: “During the visit, it was observed that wastewater is discharged onto the public roadway; it was also observed that 100% of the property has been built upon, and that one of the roofs does not have gutters. A fluorescein test was performed” (see attached report).
  • q)In official letter No. MS-DRRSCH-DARSCÑ-IT-297-2024, Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Área Rectora de Salud de Cañas, issued a Technical Report stating as follows: “On 05 de septiembre del 2023, in response to a request to accompany an inspection of properties affected by the slope in Andesa, a joint visit was conducted with the Municipality to several dwellings adjoining the affected slope. Most of the houses have their respective gutters directed toward the curb and gutter (cordón y caño) located in front of the dwelling, while at other dwellings they are directed toward the slope. The slope referenced in that official letter adjoins a public street that has a curb and gutter only at the beginning of the street, while the remainder lacks such infrastructure, making it difficult to channel stormwater along that route. Based on the findings confirmed during the joint visit with the municipality, the problem described concerns stormwater and infrastructure that the Municipalidad de Cañas must address. The case will be monitored” (see attached report).
  • r)On 12 de marzo del 2025, Engineer Paula Murillo Esquivel, an official of the Regulatory Team of the Área Rectora de Salud de Cañas, conducted an inspection in barrio Andesa and stated as follows: “A visit was conducted to verify the conditions and respond to the amparo proceeding (recurso de Amparo). It was observed that the Municipalidad de Cañas has neither performed maintenance nor carried out the work necessary to channel stormwater, such as installing a curb and gutter. Trash and abundant weeds were also observed” (see attached report).
  • s)In official letter No. MS-DRRSCH-DARSCÑ-IT-048-2025, Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Área Rectora de Salud de Cañas, issued a Technical Report in the following terms: “On 12 de marzo del 2025, in response to the amparo proceeding, expediente 24-024724-0007- CO, a visit was conducted to verify the conditions described in that document, and the following was observed: • The Municipalidad de Cañas has not carried out the work necessary to channel stormwater, such as installing the curb and gutter. Trash was observed throughout the roadway. Most of the dwellings were observed to have their respective gutters” (see attached report).

IV. UNPROVEN FACT

The following fact relevant to this decision is not deemed proven:

Sole. That the Municipalidad de Cañas began construction of the curb and/or gutter for stormwater drainage on the northern side of Dirección07, which borders the slope (talud) located along the rear boundary of the Urbanización Andesa.

V. MERITS

In the matter sub lite, it was established that the amparo petitioners (amparados) are residents of Urbanización Andesa, located in Dirección03, Guanacaste. It is likewise inferred that the rear of the petitioners’ properties borders a slope. Regarding this matter, it has been verified that, since 2010, the respondent municipality has been aware of the landslide (deslizamiento) and soil-erosion (erosión del terreno) problems in the Urbanización Andesa area and therefore began conducting regular inspections at the site, even accompanied by the Comisión Nacional de Emergencias. From that point, the following is established: in Report DOS-199-10 of 4 de noviembre de 2010, the Departamento de Ingeniería y Construcciones of the Municipalidad de Cañas concluded as follows: “The washing away and scouring (socavación) experienced by the land adjacent to the properties of residents of Urbanización ANDESA is the result of rainfall and the improper management of sewage and graywater (aguas servidas y jabonosas) by some community residents.

The residents of Urbanización ANDESA must direct sewage and graywater to a treatment system approved by the Ministerio de Salud. This is because discharging this water directly onto the slope causes it to be progressively undermined. The existing vegetation cover (cobertura vegetal) minimizes the impact that rainfall may have on the slope, and it is therefore important that it be preserved. The weeds may, however, be trimmed somewhat so that the area appears cleaner. It is important that the residents of Urbanización ANDESA not undertake construction without the corresponding municipal permits. Furthermore, any construction undertaken in that area must comply with the safety setbacks (retiros) warranted by the circumstances and must be supervised by a professional responsible for the work.” In official letter CUE-0623-2012 of 27 de febrero de 2012, addressed to the director of Gestión de Desastres, the Contraloría de Unidades Ejecutoras of the CNE stated: “The inspection of Urbanización ANDESA was conducted at your request and in response to the documentation submitted by Ms.

Karol Ruiz Rodríguez, Coordinator of the Comité Municipal de Emergencias de Cañas. The inspection was conducted in the company of Mr. Lizanías Zúñiga López, in his capacity as Mayor of the Municipalidad de Cañas, municipal technical personnel, and officials from the Ministerio de Salud. The principal matters observed during the visit conducted on 22 de febrero del 2012 are set out below. DETAILS OF THE VISIT a) The properties being assessed are located primarily in an area bordering the public road in Urbanización ANDESA, located in the district of Cañas, canton of Cañas. b) Some dwellings are susceptible to being affected by a landslide because they are located at the upper edge of the slope. c) According to verbal statements by officials from the Departamento de Permisos de Construcción of the Municipalidad de Cañas, the walls located along the property boundaries of the dwellings were built without any municipal permit, and the applicable setbacks stipulated in the regulations in force were not observed. d) Sewage and graywater are improperly managed, causing the land to become saturated and consequently causing material to break away, because the water is discharged directly onto the slope. e) At present, some sections of the land show material detachments (desprendimientos de material), principally on private property where there is a wall exhibiting the following conditions: • Separation at the wall joints. • Lateral displacement of the wall’s sides. • Exposed reinforcing bars with a high degree of deterioration (corrosion). • Exposed foundations. f) To date, this wall has not been demolished, despite the demolition having been ordered months ago by the Departamento Regional del Ministerio de Salud.

Given these circumstances, there is an increased risk that this wall may harm the physical safety of persons living in the adjoining dwellings. It is important to note that site visits have already been conducted and recommendations have been issued by the following institutions: a. Ministerio de Salud — Departamento Regional. b. Municipalidad de Cañas — Departamento de Permisos de Construcción. c. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias — Departamento de Prevención. Nevertheless, the residents have not complied with the recommendations provided; therefore, the competent institutions are urged to ensure compliance with the recommendations described above. The problems faced by the community of Urbanización Andesa de Cañas, Guanacaste, involving an evident failure to comply with the regulations in force and given that the properties are located, for the most part, on private land, must be addressed by the Municipalidad de Cañas.

This is because the observed damage is not associated with an extraordinary event that would permit the use of resources from the Fondo Nacional de Emergencias.” The respondent municipal authority has held meetings with various institutional professionals, namely an environmental manager, a construction engineer, and an engineer from the Unidad Técnica de Gestión Vial, during which the residents of Andesa have been heard and verbal assessments have been provided regarding the facts they presented, specifically their concern about the possibility that the slope bordering Dirección07 may continue to slide. During these meetings, the professionals have consistently issued instructions or recommendations, which have been communicated and explained to the residents, regarding how they must channel stormwater (aguas pluviales) from their yards through gutters and downspouts and convey it to the front of their properties in order to prevent a more extensive or accelerated washout (deslave) of the slope.

They have also been instructed not to allow wastewater (aguas residuales) from their properties to be discharged across the slope, solely in order to prevent accelerated soil erosion. The Departamento de Construcciones verifies compliance with these measures and observance of the deadlines established under the work plan prepared by the Municipalidad de Cañas. Since 2012, the Municipalidad de Cañas has conducted regular inspections at the site to verify that no further landslides or detachments of land occur there; erosion does not exceed three percent of the land. On the contrary, the vegetation on the slope and the stabilization of the soil have improved. This is despite the fact that some property owners continue to act unlawfully and irresponsibly, as it was confirmed that they continue undertaking construction in their yards and constructing residential buildings without observing the slope setbacks.

They also divert both stormwater and wastewater onto the slope, contrary to the instructions issued by the municipality. On 18 de setiembre de 2023, a joint inspection was conducted in Barrio Andesa with officials from the departamento de gestión ambiental e infraestructura vial of the Municipalidad de Cañas, the Ministerio de Salud, and MINAE. Likewise, on 20 de noviembre de 2023, additional inspections were conducted in the area jointly with the Ministerio de Salud, after which the respective notices were served on the residents of Barrio Andesa based on the irregularities identified during the inspection concerning construction without municipal permits and the diversion of stormwater that could affect the slope. On 1º de agosto de 2024, as part of compliance with the actions set forth in the work plan, the respondent local government carried out the following work: “The vegetation cover on the slope was maintained; trees were pruned to reduce the weight of branches; and waste found at the site was collected.” Through official letter DCU-077-24, the appellants (recurrentes) Nombre11 and Nombre02 were notified that water was being improperly managed and that the site-coverage parameter (parámetro de cobertura) established in the zoning plan (plan regulador) was being exceeded.

They were also informed that the structures built on that property lacked the respective permits and failed to comply with the coverage requirements applicable to the roofed area used for hanging laundry. During a recent visit to Urbanización Andesa, the respondent municipality documented the conduct of the residents whose properties adjoin the slope bordering Dirección07, including the residents signing this action, who threaten the well-being and preservation of the slope by constructing residential buildings, including second stories, with drainage outlets facing the slope, covering the soil with cement, and discharging water onto the slope through downspouts. These improper practices are being corrected by the municipality in collaboration with the Ministerio de Salud, which has notified the signatories hereto that they must remove the unlawful structures that damage or threaten the slope by covering the soil in their yards with cement, thereby preventing the land from properly absorbing stormwater from the properties.

On 25 de setiembre de 2024, civil and environmental engineering experts from the respondent authority conducted a field visit and concluded that there was no risk of a landslide on the slope bordering Dirección07 in the barrio San Cristóbal Sur sector, along the rear boundary of Urbanización Andesa. As of the date the report was issued, the slope bordering the properties of the residents of Urbanización Andesa showed no signs of collapse or landslides. Nor did it show signs of ongoing erosion; on the contrary, its soil had been restored, with a wooded area providing soil stabilization as a result of the improved forest.

It was demonstrated that, in compliance with the order issued in judgment No. 2023012166 at 09:20 hours on May 26, 2023, in case file No. 23-007491-0007-CO, the Health Governing Area of the Ministerio de Salud in Cañas, Guanacaste, conducted inspections of the properties affected by the slope (talud) in Urbanización Andesa, documented in inspection reports under consecutive Nos. MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023, and MS-DRRSCH-DARSCÑ-496-2023. In inspection report No. MS-DRRSCH-DARSCÑ-496-2023, official Mayela Sandoval Valle, of the Regulatory Team of the Health Governing Area of Cañas, inspected a residence located four hundred meters south and twenty-five meters east of the Catholic Church in barrio Andesa and stated the following: “During the visit, it was observed that the wastewater (aguas residuales) is discharged onto the public roadway; it was also observed that 100% of the property has been built upon and that one of the roofs has no gutters.

A fluorescein test was performed.” In official letter No. MS-DRRSCH-DARSCÑ-IT-297-2024, Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Health Governing Area of Cañas, issued a Technical Report stating the following: “On September 05, 2023, in response to a request to accompany an inspection of properties affected by the slope in Andesa, a joint visit was conducted with the Municipality to several homes adjoining the affected slope. Most of the houses have their respective gutters directed toward the curb and gutter (cordón y caño) located in front of the residence, while at other homes they are directed toward the slope. The slope referred to in that official letter adjoins a public street that has curb and gutter only at the beginning of the street, while the remainder has none, making it difficult to channel stormwater (aguas pluviales) along that route.

Based on what was confirmed during the joint visit with the Municipality, the problem described concerns stormwater and infrastructure and must be resolved by the Municipalidad de Cañas. The case will be followed up.” On March 12, 2025, Engineer Paula Murillo Esquivel, an official of the Regulatory Team of the Health Governing Area of Cañas, conducted an inspection in barrio Andesa and stated the following: “A visit was conducted in order to verify the conditions and respond to the amparo proceeding (recurso de Amparo). It was observed that the Municipalidad de Cañas has neither performed maintenance nor carried out the work necessary to channel stormwater, such as installing curb and gutter. Abundant trash and weeds were also observed.” Finally, it is established that, in official letter No. MS-DRRSCH-DARSCÑ-IT-048-2025, Engineer Paula Murillo Esquivel and Mayela Sandoval Valle, both officials of the Regulatory Team of the Health Governing Area of Cañas, issued a Technical Report in the following terms: “On March 12, 2025, in response to an amparo proceeding, case file 24-024724-0007- CO, a visit was conducted to verify the conditions mentioned in that document, and the following was observed: • The Municipalidad de Cañas has not carried out the work necessary to channel stormwater, such as installing curb and gutter.

Trash was observed throughout the roadway. It was observed that most residences have their respective gutters.” Now, in a matter similar to the one currently before it, this Chamber, through judgment No. 2023012166 at 09:20 hours on May 26, 2023, issued in case file No. 23-007491-0007-CO, ruled as follows:

“III.- The specific case. In the case at bar, the petitioner (persona accionante) states that 11 neighboring families in the ANDESA residential development, located in Cañas, Guanacaste, built their homes under permits issued by the Municipalidad de Cañas; however, they began to notice an evident landslide problem on their properties. The petitioner states that, as a result, in 2010 they sent a letter to Luis Fernando Mendoza Jiménez, who at that time was a deputy-elect for the province of Guanacaste, and to Kattya Solórzano Hernández, who was serving as mayor of Cañas. The petitioner recounts that the deputy sought a solution to the problem from the local government. The petitioner states that the Engineering and Construction Department of the Municipalidad de Cañas conducted an inspection on November 4, 2010; nevertheless, it provided a response with which the residents disagreed, because ‘only one resident, from the first house in the residential development, discharges water into the backyard, where there is no curb and gutter.’ The petitioner argues that, on that same day, the mayor sent a letter to Nancy Yépez, director of the Área de Salud de Cañas, requesting that measures be taken to improve water drainage.

The petitioner adds that the aforementioned deputy intervened in 2011 and that Mayor Lizanías Zúñiga López offered his assistance to the residents. The petitioner further states that, in November 2011, the residents of the residential development sent a letter to the president of the CNE. The petitioner maintains that Auriel A. Herrera Barquero, oversight officer of the Contraloría de Unidades Ejecutoras, through official letter CUE-0623-2012 of February 27, 2012, addressed to the director of Disaster Management of the CNE, reported that ‘There are several homes susceptible to being affected by a landslide because they are located along the upper edge of the slope,’ and that ‘According to verbal statements by officials of the Construction Permits Department of the Municipalidad de Cañas, the walls located along the property boundaries of the homes were built without any municipal permit, and the applicable setbacks (retiros) established in the regulations in force were not observed.’ The petitioner asserts that all the properties have municipal permits and that the walls are mostly zinc-panel or wire-mesh boundary fences (tapias), because the soil ‘rejects cement,’ and that they were built to protect the properties from criminals.

The petitioner adds that the boundary fences are located along the edge because land is lost every year. The petitioner explains that, on March 31, 2021, they sent the official letters to Fernando Mendoza, who held the office of mayor, including CNE official letter CUE-0623-2012, which warned: ‘The problem facing the community of Urbanización ANDESA in Cañas, Guanacaste, as it involves an evident failure to comply with the regulations in force and because the properties are located mostly on privately owned land, must be addressed by the Municipalidad de Cañas. This is because the observed damage is not linked to an extraordinary event that would permit the use of National Emergency Fund Resources’; it was further stated that their intention was to establish a record in the event of a landslide accident, demonstrating that they had been taking action for 11 years. The petitioner states that they received no response from the Municipality, the CNE, or the deputy.

The petitioner states that, on June 7, 2021, Gonzalo Quintero Quesada sent a letter to Luis Fernando Mendoza, once again serving as a deputy, in which he reported that the absence of drainage gutters and asphalt had contributed to the wall’s destabilization to a dramatic extent, placing taxpayers’ buildings at risk, as well as other infrastructure such as electrical lines and MOPT buildings. He also explained the need for the local government to activate its Engineering Department to implement a solution involving a retaining wall and fill capable of stopping the collapse of the embankment, such as the construction of a gabion wall, the channeling of stormwater, and the paving of the roadway. The petitioner argues that the foregoing letter received no response. The petitioner makes the following request for relief (petitoria): ‘2.- That the Municipalidad de Cañas be ordered to resolve our problem, because we have been engaged in these proceedings for 12 years and six months without obtaining a solution; moreover, we are citizens who pay taxes and built under permits issued by the Municipality itself.’” The record establishes that the Engineering and Construction Department of the Municipality of Cañas, in inspection report DOS-199-10 of 4 de noviembre de 2010, concluded: “The erosion and scouring experienced by the land adjacent to the properties of residents of Urbanización ANDESA is the result of rainfall and the improper management of sewage and graywater by some community residents.

The residents of Urbanización ANDESA must direct sewage and graywater to a treatment system approved by the Ministry of Health. This is because discharging this water directly onto the slope (talud) causes it to be progressively undermined. The existing vegetation cover minimizes the impact that rainfall may have on the slope, and it is therefore important that it be preserved. Accordingly, the weeds may be trimmed somewhat to make the area look cleaner. It is important that the residents of Urbanización ANDESA refrain from undertaking construction without the corresponding municipal permits. Furthermore, any construction undertaken in that area must comply with the setbacks (retiros) required for safety and must be overseen by a professional responsible for the work.” The Office of the Comptroller of Executing Units of the CNE, in official letter CUE-0623-2012 of 27 de febrero de 2012 addressed to the Director of Disaster Management, stated: “(…) conducted the inspection of Urbanización ANDESA at your request and in response to the documentation submitted by Ms.

Karol Ruiz Rodríguez, Coordinator of the Comité Municipal de Emergencias de Cañas. The inspection was conducted in the company of Mr. Lizanías Zúñiga López, in his capacity as Mayor of the Municipality of Cañas, municipal technical personnel, and officials from the Ministry of Health. The principal matters observed during the visit conducted on 22 de febrero del 2012 are set forth below. DETAILS OF THE VISIT a) The properties to be assessed are located primarily in an area bordering the public street of Urbanización ANDESA, located in the district of Cañas, canton of Cañas. b) Some homes are susceptible to being affected by a landslide because they are located along the upper edge of the slope. c) According to oral statements by officials from the Construction Permits Department of the Municipality of Cañas, the walls located along the property boundaries of the homes were built without any municipal permit, and the applicable setbacks established under current regulations were not observed. d) Sewage and graywater are improperly managed, causing the land to become saturated and, consequently, causing material to break away because the water is discharged directly onto the slope. e) At present, some sections of the land show material detachments, principally on a private property where there is a wall exhibiting the following conditions: • Separation at the wall joints. • Lateral displacement of the wall sections. • Exposed reinforcing bars with a high degree of deterioration (corrosion). • Exposed foundations. f) As of this date, the demolition of this wall, ordered months ago by the Regional Department of the Ministry of Health, has not been carried out.

Under these circumstances, there is an increased risk that this wall may harm the physical safety of persons residing in the homes located adjacent to it. It is important to note that site visits have already been conducted and recommendations have been issued by the following institutions: a. Ministry of Health — Regional Department. b. Municipality of Cañas — Construction Permits Department. c. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias — Prevention Department. Nevertheless, the residents have not complied with the recommendations provided; therefore, the competent institutions are urged to ensure compliance with the recommendations described. The problem facing the community of Urbanización Andesa de Cañas, Guanacaste, involving a clear failure to comply with current regulations and properties located for the most part on privately owned land, must be addressed by the Municipality of Cañas.

This is because the observed damage is not associated with an extraordinary event that would permit the use of resources from the Fondo Nacional de Emergencias.” The Prevention and Mitigation Department of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, through technical report DPM-INF-0053-2012 addressed to Karol Ruiz Rodríguez, coordinator of the Comité Municipal de Emergencias de Cañas, stated: “I. General information At the interested party’s request, on 06 de febrero del 2011 a qualitative visual risk assessment was conducted regarding the soil detachments occurring on a slope behind several homes in Urbanización ANDESA. (…) III. Objectives of the study: A. To provide a preliminary risk diagnosis based on visual estimation, conducted through a site visit and hazard-map analysis. B. To identify processes that may intensify damage caused by natural hazards. C. To provide recommendations to safeguard the integrity of the infrastructure and residents.

IV. Background. In noviembre del 2009, a case near the area was evaluated in which the risk posed by the instability of a slope and a wall affecting several homes was assessed, resulting in report DPM-INF-1708-2009; however, that case is not directly related to the present assessment. V. General analysis of the hazard and vulnerability A. The homes evaluated are located within the Cañas River basin. B. The slope runs in a NE-SW direction. On the NE side, its height does not exceed three meters, while in the SW sector it may reach up to 5 meters. C. The structures of the homes directly adjoin the edge of the slope. D. The hillside consists mainly of residual soil; nevertheless, due to vegetation in certain sectors, it is not possible to determine with certainty the type of material on which the properties were founded, although in certain locations it appears to be fill. E. It was confirmed at the site that considerable soil detachments have occurred, since exposed tree roots can be seen in some sectors.

F. In the NE sector, improper water management is clearly among the factors intensifying the detachments, since the water can be seen being discharged directly onto the slope. G. According to the field verification, the number of houses directly affected is 13 (…) VI. Conclusions A. Surface runoff, rainfall, and improper wastewater management have caused detachments on the slope. B. The proximity of the slope’s edge to the structures poses a risk because, if detachments continue, the homes will be directly affected. VII. Recommendations A. An adequate drainage system must be designed to prevent soil saturation from facilitating ground movement (movimientos de terreno). B. To protect the structural integrity of the buildings, the possibility of constructing a retaining structure on the slope must be assessed. C. Where the slope is higher, consideration may be given to carrying out terracing work to stabilize the hillside.

D. Any work undertaken must be supported by the corresponding study to determine, based on geotechnical characteristics, the best mitigation measure for the site. All work must be performed under the supervision of a qualified professional. VIII. Scope of the report A. This report does not replace the necessary technical studies and is valid only when it bears the original seal of this department. It entails no cost of any kind for the interested parties, who shall be responsible for processing it before the corresponding institutions. B. Acuerdo No. 0443-2011 of the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, acting pursuant to its authority, establishes that reports issued by specialized officials of this institution are technically binding upon the institutions to which the recommendations are addressed.” On 1º de julio de 2021, the Office of the Mayor of the Municipality of Cañas received an official letter from Nombre16 addressed to the Mayor of Cañas, stating: “Returning once again to the matter that concerns us as residents of Urbanización ANDESA—the landslide that, with each rainy season, is visibly affecting our properties and of which you are aware, since while serving as a Deputy in the year 2010 your office received a letter dated 06 de setiembre 2010 requesting your assistance because these homes are our family assets—we once again turn to you to request that you conduct a new inspection, 11 years later, so that you may observe their current condition, going up by Dirección09, a street that is also used as a garbage dump, where dead animals and garbage are discarded, giving off unbearable odors.

On 04 de julio 2011, in Oficio LFMJ-1033-11, you responded to me in my capacity as representative of the residents of this development, stating that the Municipality is the entity authorized to conduct inspections and coordinate with the Comisión Nacional de Emergencia regarding any work to be undertaken, and you suggested that we contact Mr. Lizanías Zúñiga López, who was the Municipal Mayor at that time. For this reason, we now turn to you as Mayor of the City of Cañas, Guanacaste. On 27 de febrero 2012, engineers Auriel A Herrera Barquero and Ericka Zamora Leandro, officials of the CNE, prepared official letter CUE-0623-2012 in response to the inspection conducted at this development, which states verbatim: ‘The problem facing the community of Urbanización ANDESA de Cañas, Guanacaste, involving a clear failure to comply with current regulations and properties located for the most part on privately owned land, must be addressed by the Municipality of Cañas.

This is because the observed damage is not associated with an extraordinary event that would permit the use of resources from the Fondo Nacional de Emergencias.’ It also states that, according to oral statements by officials from the Construction Permits Department of the Municipality of Cañas, the walls located along the property boundaries of the homes were built without a municipal permit and do not comply with the corresponding setbacks established under current regulations. We wish to state that when we built the boundary fences—which in fact are mostly made of zinc sheets because the land cannot support concrete-block structures—the required distance was observed; however, due to the landslides occurring during each rainy season, they have gradually shifted, and some are now almost suspended in the air. We residents were never informed of the visit by the CNE officials, were not invited to accompany the inspection, and they did not take the trouble to ask us why we all had our fences at the edge of our properties.

Furthermore, those fences were installed because of the vandalism we began to experience, since the street was so isolated that people commonly entered our yards and took whatever had been left exposed. It is alarming to see our properties lose more land day by day, placing us at risk of losing our homes at any time. For this reason, we request a new emergency inspection, since the INS will not insure our properties because they were built in a risk area, and its representatives cannot understand how the Municipality originally granted construction permits on that land.

“Our intention is to establish a precedent, in the event of a landslide accident, showing that we did in fact act in a timely manner, since requests for assistance from various entities began 11 years ago, including, initially, the Office of the Mayor of the Municipalidad de Cañas, the Municipal Council (sic) of Cañas, the Local Emergency Committee, you personally in your capacity as Representative of our Province, and the Comisión Nacional de: Emergencias, without receiving a positive response from any of the aforementioned institutions.” On 12 de setiembre de 2022, the Office of the Mayor of the Municipalidad de Cañas received an official letter from Gonzalo Alberto Quintero Quesada addressed to the mayor and the municipal council, both of Cañas, stating: “Through this letter, on behalf of the residents of Barrio Sin Pedro de Cañas, I address you and the Concejo Municipal of our beloved Canton for the purpose of asking you, within your jurisdiction and urban-services responsibilities, specifically those concerning cantonal road infrastructure, to reconsider intervening in the section of road connecting street 3 and Dirección01 south of Barrio San Pedro.

This road section begins 250 meters south of EBAIS San Pedro number two in this community. Considering the definition provided by the Laboratorio Nacional de Materiales y Modelos Estructurales de la Universidad de Costa Rica, road infrastructure consists of all elements that facilitate the safe and comfortable movement of vehicles from one point to another. Its constituent elements include pavements, bridges, vertical and horizontal signage, slopes (taludes), embankments (terraplenes), tunnels, safety devices such as containment barriers, drainage systems, shoulders, among others. All these elements comprise the road network, which must be capable of providing an adequate and efficient transportation service to its users. In the 1990s, residents of this community acquired land from the corporation Andesa S.A., corporate identification number 3-101-020777, subdivided from the property recorded in the Province of Guanacaste under Real Property Folio PRN01, said corporation being represented by Nombre12 and Nombre15.

The plans corresponding to that subdivision (fraccionamiento) were prepared by Licensed Surveyor Jose (sic) Rafael Jimenez (sic) Gamboa, license LA 1269. All the plans were recorded in setiembre de 1989, in compliance with all legal requirements concerning municipal approvals, the respective professional associations, and the Registro Nacional, Catastro Nacional section. The parcels located between Dirección01 and Dirección01, Dirección02 and Dirección03, all adjoin a nine-meter-wide public road to the north and a 12-meter-wide road to the south. (…) The problem affecting the Taxpayers in this section of land specifically concerns the boundary adjoining Dirección01, due to the following circumstances: a- The road providing access to the Ministerio de Obras Públicas y Transportes facility. b- The road providing access to the Regional Traffic Office. c- Dirección01 connects with Dirección01, which in turn provides access to Dirección08. d- MOPT heavy vehicles enter through Barrio San Pedro and travel toward the MOPT facility via Dirección01. e- Light and heavy traffic vehicles enter through Barrio San Pedro and travel toward the Traffic Police Offices via Dirección01. f- Maintenance performed on the road in question.

Although Dirección01 is open to public use, the principal users of this thoroughfare are vehicles belonging to the two institutions mentioned above, because entering from Dirección08 toward the (sic) Dirección01 would require turning around at the turnaround located near the El Gran parqueo service station; for this reason, it is easier for them to enter through the main road of Barrio San Pedro. In view of the foregoing points, to facilitate the passage of heavy vehicles such as dump trucks weighing more than 20 tons and even compaction machinery, coupled with the fact that this road adjoins a slope leading to the Ministerio de Obras públicas y Transporte facility, machinery was brought in to widen the thoroughfare, weakening the base of the bluff on the northern side. (…) After the road-widening work was completed, as of the date of this letter, the construction of gutters and the paving work remain outstanding.

The absence of this work has contributed to the destabilization of the wall to grammatical levels that endanger the buildings of the taxpayers residing there and their property, as well as other State property due to the location of electrical utility poles; moreover, in the event of a landslide, the material would clearly fall onto the buildings of the Ministerio de Obras Públicas y Transporte. We believe it is necessary for the Local Government to activate its Engineering Department to provide a solution involving a retaining wall (muro de contención) and fill capable of stopping the bluff from breaking away, such as constructing a gabion wall, channeling stormwater, and paving the road. Trusting that our request will be addressed, and as a supplement to the actions pursued since 2010, this document is signed by Lic. Gonzalo Alberto Quintero Quesada, identification number NFP11, resident of Cañas Guanacaste, Dirección06.

For purposes of receiving notices, I designate the email address ...01 in accordance with the Reglamento de Notificaciones por Fax y otros medios electrónicos.” The Director of Urban Development and Control of the Municipalidad de Cañas, in official letter DOS-091-23 of 18 de abril de 2023, stated: “In 2010, the site was inspected and report DOS-199-10 was issued, identifying the following: 1. Improper wastewater (aguas residuales) management, with wastewater being discharged untreated onto the public roadway, in violation of Article 285 of the Ley General de la Salud. This situation causes the land adjacent to the properties to be affected by an ongoing erosion process. 2. Although it is true that the Municipalidad authorized the construction permits for the homes, residents of Barrio ANDESA have built structures and walls in their yards, most of them without the corresponding municipal permits and without supervision by an engineering professional. 3.

The importance of maintaining vegetation on the slope to minimize erosion caused by rainfall was noted (sic) at that time. 4. The report stated the importance of residents of Urbanización ANDESA refraining from undertaking construction without the corresponding municipal permits. Furthermore, any construction undertaken in that area must comply with the safety setbacks (retiros) warranted by the circumstances and must have a professional responsible for the work. It should be noted that, as a result of this report, the Office of the Municipal Mayor, through official letter OFC-ALC-00599-10 of 08 de noviembre de 2010, asked the Ministerio de Salud to issue the necessary health orders so that residents would improve their wastewater treatment systems. However, this Department is unaware of the actions taken by the health authorities. According to the photographs included in the various documents submitted by Nombre16, the property most severely affected is property PRN05, which at that time belonged to Nombre06, who made the corresponding corrections and constructed a retaining wall with the appropriate drainage systems.

It should be noted that this property is not located within what is known as Urbanización ANDESA. (Photographs are attached.) It should be noted that, in order to respond to your request, a new inspection was conducted on 18 de abril de 2023, and it was observed that conditions in the ANDESA sector remain unchanged, with residents improperly managing stormwater (aguas pluviales) and wastewater on their properties. Although report DOS-199-10 had recommended that no construction be undertaken without the corresponding permits and a professional responsible for the work, community residents continue this practice, as evidenced by the attached notices, which document noncompliance with the Ley de Construcciones on properties PRN06, PRN07 and PRN08. (Photographs are attached.) Most of the slope has vegetative cover (cobertura vegetal), which minimizes the impact of rainfall upon it. It is important that this cover be maintained.

(See photograph.) The area showing the greatest erosion is behind properties PRN09 and PRN07, owned by Nombre16 and Nombre05; however, it is precisely on property PRN07 that construction was recently undertaken without a permit, and on property Dirección04 the yard was apparently waterproofed. (See photographs.)” The Director of the Road Infrastructure Department of the Municipalidad de Cañas, in official letter OFC-DIV-065-2023 of 17 de abril de 2023, stated: “4. The street located on the northern side of the MOPT facility in Barrio San Cristóbal in the city of Cañas forms part of road code N° 5-06-071, corresponding to Urban Streets (blocks) in the city of Cañas (Kennedy - San Cristóbal sector), an area encompassing the neighborhoods of San Pedro, San Cristóbal and Kennedy. 5. The street located on the northern side of the MOPT facility in Barrio San Cristóbal, like the other streets with aggregate road surfaces (superficie de ruedo en lastre) in the outlying neighborhoods of the city of Cañas, undergoes work annually, during which periodic maintenance activities are performed.

By way of example, the work performed on that street in 2019 and 2021 is summarized in Table N° 1 and Images N° 1, 2 and 3 of the Annexes, taken from reports submitted by this Department to the Junta Vial Cantonal de Cañas. (…) 6. During periodic maintenance activities on the street located on the northern side of the MOPT facility in Barrio San Cristóbal, specifically excavation, cleaning, and grading of ditches (cunetas), sediment is removed at rates or in quantities similar to those generated on any other street or local road in the canton. 7. At least as far as the Road Infrastructure Department is concerned, there is no record during the past 10 years of incidents or cases involving the removal of material caused by landslides or rockfalls on the road surface of the street located on the northern side of the MOPT facility in Barrio San Cristóbal as a result of natural events.” The Environmental Management Unit of the Municipalidad de Cañas stated in official letter OFC-GA-032-23 of 17 de abril de 2023: “On 20 de septiembre del año 2022, the Environmental Department was called to a meeting with several residents of that community and other institutional departments and was informed of this problem; on that occasion, after being apprised of the concerns expressed by the residents, the Department emphasized a relevant issue that aggravates the landslide problems affecting the neighboring properties, namely, the improper disposal of wastewater by residents of that sector, and they were urged to file the necessary complaints with the Ministerio de Salud in order to eliminate or minimize this problem.

Therefore, during the most recent meeting in which it participated, the Environmental Department explained to residents the importance of stopping the improper channeling of wastewater in the affected area.” The Mayor and the President of the Concejo Municipal, both of Cañas, stated in a report dated 19 de abril de 2023: “1.

Since 2010, the Municipality has been aware of the landslide (deslizamiento) and soil erosion (erosión del terreno) problems in the Urbanización Andesa area, located in Barrio San Cristóbal Sur; therefore, it began conducting regular inspections at the site, accompanied by institutions with expertise in the matter, such as the Comisión Nacional de Emergencias. Thus, in 2010, following inspections conducted by the Municipality’s Departamento de Construcciones y Unidad Técnica de Gestión Vial, technical opinion (criterio técnico) number DOS-199-10 was issued, in which the official in charge, Angie Díaz, made a series of recommendations to the residents. Those recommendations were not followed by all the residents, but they helped improve the situation. During that same year, the Comisión Nacional de Emergencias was asked to provide professionals specializing in the assessment of risk zones (zonas de riesgos) to evaluate a specific property that was vulnerable to collapse (derrumbe) (see photograph).

The Comisión Nacional de Emergencia issued opinion number CUE-0623-2012, which specifically addressed the property at risk and set out recommendations to prevent its collapse. Those recommendations were to be carried out by the property owner, since the slope (talud) is located within private property and was the most likely to collapse. The Municipality supervised the work performed by the owner (see photographs showing the collapse hazard in 2012, the completed retaining wall (muro de contención) built by the owner, and the wall as it currently appears, without collapse-related problems). (…) Photographs taken abril 2023 showing the current condition of the only property at risk of collapse in 2012, after the owner, under the Municipality’s supervision, constructed the retaining wall on the property. (…) 2.

The Municipality has conducted regular inspections at the site since 2012, verifying that landslides or soil detachments (desprendimientos de terrenos) have not continued at the site (these inspections are regularly conducted from a vehicle and are primarily visual inspections). We have therefore monitored and inspected the site over the past 12 years; no landslides have occurred, and erosion does not exceed three percent of the land. On the contrary, vegetation and soil stabilization (amarre de la tierra) on the slope have improved. This is despite the fact that some property owners continue to act illegally and irresponsibly, as it was confirmed that they continue constructing residential buildings in their yards without maintaining the required slope setbacks (retiros del talud), and they divert both stormwater (aguas pluviales) and wastewater (aguas residuales) onto the slope, contrary to the Municipality’s instructions.

Photographs showing the current condition, as of abril 2023, of the slope adjoining Dirección07; it can be seen that the landslide or collapse hazard alleged by the petitioners herein does not exist. (…) 1.4 During a recent visual inspection, documentation was obtained for the purpose of showing the Honorable Justices how the neighboring residents whose properties adjoin the slope bordering Dirección07—the residents signing herein—are jeopardizing the slope’s integrity and preservation by constructing buildings for residential use, including two-story buildings, with drainage outlets (salidas de desagües) beside the slope, as well as by erecting zinc-sheet fences with purlins and covering the ground (yards) with impermeable cement. This prevents the soil from properly absorbing stormwater from the properties, causing the water, together with runoff from the roofs of the structures, to flow uncontrollably toward the slope (photographs of these conditions are attached).

(…). 1.5 Nevertheless, despite all the problems found at the site during the documented field inspection, the slope reported herein shows no evidence of collapse or landslide, nor does it show signs of ongoing erosion. On the contrary, we found restored soil with a wooded area (zona boscosa), and the soil stabilization resulting from the forest has improved.” As of 4 de mayo de 2023, the Área Rectora de Salud de Cañas has no administrative case files concerning complaints by residents of the ANDESA neighborhood relating to wastewater, landslides, or flooding.

In this regard, a full reading of the filing instituting the proceeding shows that what the petitioner seeks is for the Municipalidad de Cañas to address the reported problem.

Regarding this matter, the Chamber observes that, in 2021, the appellant notified the Municipalidad de Cañas of a problem that, according to the allegations, dates back to 2010, 2011 and 2012 and is related to a slope (talud) in the ANDESA residential development (urbanización). In this regard, although the mayor and the president of the Concejo Municipal, both of Cañas, reported that no landslides have occurred and that erosion does not exceed three percent of the land, and that the slope has improved in terms of vegetation and soil stabilization, it is equally true that they stated that some property owners continue to commit violations involving construction without municipal permits and the diversion of both stormwater and wastewater. Therefore, even though the Chamber has been informed that there is currently no danger of a landslide or collapse, the local government has not acted diligently to address the impacts that may result from the unlawful actions or omissions of the residents of the development. The municipal authorities even stated that the residents’ conduct threatens the preservation of the slope.

In addition, the evidence submitted by the respondent municipal authorities shows that the director of Desarrollo y Control Urbano of that local government, in official letter DOS-091-23 of 18 de abril de 2023, acknowledged that, according to an inspection conducted that day, residents in the ANDESA sector continue to improperly manage stormwater and wastewater on their properties; she further stated that: “The area showing the greatest erosion is behind properties PRN09 and PRN07, owned by Nombre16 [the appellant herein] and Nombre05; however, it is precisely on property PRN07 that construction was recently carried out without a permit, and on the property at Dirección04, the yard was apparently waterproofed.” Likewise, the Unidad de Gestión Ambiental of the Municipalidad de Cañas, in official letter OFC-GA-032-23 of 17 de abril de 2023, stated that on 20 de setiembre de 2022 it met with several community residents and that the department “emphasized an important issue that exacerbates the landslide problems affecting neighboring properties, namely, the residents’ improper disposal of wastewater in that sector, and they were urged to file the necessary complaints with Ministerio de Salud in order to eliminate or minimize this problem.” In that regard, it cannot be overlooked that the municipal entity is tolerating situations that could pose a risk to individuals. The appeal against it must therefore be granted on the terms to be set forth in the operative portion of this judgment.

It should also be clarified that it is not for the Chamber to determine whether, from a technical and legal standpoint, the local government is or is not responsible for constructing a retaining wall (muro de contención) on the private properties within the development. Nor is it appropriate in this jurisdiction to determine whether the municipality bears any responsibility for having issued construction permits in the area in question. These matters must be resolved in administrative proceedings or ordinary judicial proceedings, so that the parties’ positions may be heard in adversarial proceedings and the corresponding technical evidence may be presented.

Furthermore, there are no current actions or omissions by the CNE or the Área Rectora de Salud de Cañas that may be adjudicated in these constitutional proceedings.

As for the CNE, the case file shows that, since 2012, it issued the corresponding technical opinion addressed to the Comité Municipal de Emergencias de Cañas, and there is no record that its intervention has recently been requested.

With respect to the health authority, its director informed the Chamber that there are no administrative case files concerning complaints by residents of the ANDESA neighborhood regarding matters related to wastewater, landslides or flooding. Although the petitioner stated that the mayor of Cañas requested the intervention of Ministerio de Salud in 2010, for purposes of this jurisdiction it is not possible to deem any omission by that authority proven, not only because the stamp visible on the document is inconclusive as to which institution received it and there are no determinative elements indicating as much, but also because more than 12 years have elapsed since that alleged situation. Without prejudice to the foregoing, that authority shall take note so that, now that it is aware that the reported situation remains ongoing, it may inspect the area within a reasonable period and issue the necessary orders to address the problem insofar as it falls within the scope of its authority.” (…)

Therefore:

“The appeal is partially granted solely against the Municipalidad de Cañas. Gricelda Vargas Segura and José Ángel Acon Wong, respectively the mayor and president of the Concejo Municipal, both of Cañas, or whoever may hold those offices, are ordered, within the scope of their authority, to carry out the necessary coordination, issue the corresponding orders and take the pertinent actions so that, within ONE MONTH, an action plan is designed, together with its corresponding schedule and implementation period, to address the reported problem involving the slope in the ANDESA residential development. Within the framework of municipal powers, that plan must address the violations detected concerning construction without municipal permits and the diversion of both stormwater and wastewater, as well as the risks they pose to the slope and to individuals. In this regard, if they detect any risk, they must take immediate measures to ensure the safety of the residents of that development.

Both authorities are likewise ordered, within TEN DAYS from notice of this judgment, to notify the Área Rectora de Salud de Cañas of the public-health problems detected during the inspections conducted by the local government in the ANDESA residential development. Finally, the president of the Concejo Municipal de Cañas is ordered to IMMEDIATELY bring this judgment to the attention of the body he represents so that the resolutions necessary for compliance may be adopted.” (Emphasis not in the original).

In this regard, as established in the judgment supra, the Chamber was able to confirm that the problem described in the application instituting the proceeding has been known to the Municipalidad de Cañas for a considerable time, without the pertinent measures concerning the slope in the Andesa residential development having been implemented. In this context, although the Alcalde Municipal de Cañas informed this Chamber that the municipality included in its Presupuesto Ordinario 2024, using funds derived from ley No. 8114 and its amendments, the resources required to construct a curb and/or gutter for stormwater drainage along the northern side of the road, and that the works were expected to be carried out during the first four-month period of 2025, the fact remains that, in official letter No. MS-DRRSCH-DARSCÑ-IT-048-2025, officials from the Equipo de Regulación del Área Rectora de Salud de Cañas determined the following: “On 12 de marzo del 2025, in connection with an amparo proceeding (recurso de amparo), expediente 24-024724-0007- CO, a site visit was conducted to verify the conditions mentioned in that document, during which the following was observed: • The Municipalidad de Cañas has not carried out the works necessary to channel stormwater, such as the curb and gutter. Garbage is observed throughout the roadway.” In view of the foregoing, the appeal is granted, with the consequences indicated in the operative portion of this judgment.

VI. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life and the right to enjoy a healthy environment free of pollution (artículo 50, de la Constitución Política), as occurs in this case, which concerns alleged pollution of a natural spring (naciente) in the San Juan de Dios de Upala neighborhood that, according to the appellant, was converted into a drainage ditch and wastewater dumping site by the respondent municipality.

The appellant further alleges that the stagnant water has led to an increase in insects and animals that endanger the lives and health of community residents and pose a public-health risk. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notice of this judgment. Otherwise, any such material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.

THEREFORE:

The appeal is partially granted solely with respect to the Municipalidad de Cañas. Alexander Elizondo Duarte, in his capacity as Alcalde Municipal de Cañas, or whoever may hold that office in his stead, is ordered to adopt the pertinent measures so that, within the framework of his authority, he definitively resolves the problem concerning the slope in the Andesa residential development on the terms established by this Chamber in judgment No. 2023012166 at 09:20 hours on 26 de mayo de 2023. The respondents are advised that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Cañas is ordered to pay the legal costs, damages and losses caused by the events giving rise to this ruling, which shall be assessed in the judgment-enforcement phase before the contentious-administrative jurisdiction. As to the Área Rectora de Salud de Cañas, the appeal is denied. Justice Salazar Alvarado files a note. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintiocho de marzo de dos mil veinticinco .

Recurso de amparo que se tramita en expediente número 24-024724-0007-CO, interpuesto por Nombre09, cédula de identidad NFP03, Nombre04, cédula de identidad NFP12, Nombre03, cédula de identidad NFP04, a favor de Nombre11, cédula de identidad NFP05; Nombre02, cédula de identidad 0800860893; Nombre03, cédula de identidad 0502210932; Nombre01, cédula de identidad NFP02, Nombre11, cédula de identidad NFP05, Nombre10, cédula de identidad NFP01, Nombre01, cédula de identidad NFP02; Nombre08, cédula de identidad NFP06; Nombre14, cédula de identidad NFP09; Nombre17, cédula de identidad NFP10; Nombre07, cédula de identidad NFP07, Nombre13, cédula de identidad NFP08, contra la MUNICIPALIDAD DE CAÑAS.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 09:30 horas del 06 de setiembre de 2024, los recurrentes interponen recurso de amparo contra la MUNICIPALIDAD DE CAÑAS y manifiestan que los amparados Nombre11 e Nombre02, son personas adultas mayores y dueños de la propiedad finca N° PRN02 en la denominada ANDESA. Que el terreno donde se ubica la finca es un talud o elevación donde las constantes “lluvias, vientos recios, temblores y otros ocasionaban la caída de la tierra”, por lo que protegiendo la integridad de sus hijos y sus padres en 1991 solicitó los permisos municipal correspondientes para la construcción de una tapia, la cual realizó. Que los lotes son sumamente pequeños y en el caso de la PRN03 es de 159,33 metros cuadrados y el proceso de construcción para la casa de sus padres inició con ayuda del bono de vivienda en marzo de 1991 y dentro de todas las coordinaciones que han realizado con la municipalidad nunca ha existido ningún trámite con instrucciones relacionadas con infracciones, es decir ha cancelado sus impuestos, tramitado sus permisos para construcción de vivienda.Entre otros argumentos reclama la recurrente varios problemas de contaminación, desfogue de aguas pluviales y riego por deslizamientos del talud. Así específicamente acusa lo siguiente: • la falta de construcción del “condón y caño” de la calle que comunica las oficinas MOPT con la Dirección10 en el barrio ANDESA; • la falta de construcción de parte de los propietarios privados en ANDESA, de las tapias de contención de taludes, así como la realización de movimientos de tierras; • la falta de construcción de los zanjeados respectivos para que discurran las aguas del sur de ANDESA y parte del Barrio San Pedro, la falta de construcción de “sumideros de agua”, específicamente entre “Dirección02 y ANDESA” para el buen drenado de las aguas: • la falta de construcción de red sanitarias y algún problema con los tanques sépticos en cada finca del barrio ANDESA; • los problemas de contaminación en la propiedad del MOPT por “basuras, montazales y animales muertos” o por la “caída de aguas desde esa propiedad”, “por el paso de transportistas que socaban el talud” o por la falta de construcción de una tapia que contención; • el derribe de un cordón y caño que no tiene ninguna utilidad y que quedó muy elevado, el cual inicia en esa área el talud y • la falta de red de agua pluviales adecuada y red de aguas negras.Sobre el particular, agrega la petente que de manera formal y por escrito han planteado las gestiones correspondientes ante la Municipalidad de Cañas y las autoridades con competencia con el deseo de denunciar las irregularidades antes señaladas en cuanto a la “(…) situación de aguas, la falta de construcción de mejores cordones y caños a nuestra comunidad Andesa se ha realizado en audiencias, en cartas a alcaldes y vice alcadesas de este cantón guanacasteco. La situación con la zona de Flta (sci) de apoyo (…)”. Aporta gestiones del 19 de octubre de 2023 y el 20 de setiembre de 2024 y correo electrónico del 18 de setiembre de 2023 entre otros planteadas ante la Municipalidad accionada. Reclaman que esta situación afecta tanto a recurrente como amparados, entre los cuales hay personas adultas mayores y menores de edad. Acusa que a la fecha de interposición de este recurso las autoridades municipales no han resuelto sus solicitudes y han incumplido sus deberes, por cuanto no han procurado la realización de las infraestructuras necesarias para evitar la problemática aludida.
  2. 2Informa bajo juramento Alexander Elizondo Duarte, en su condición de Alcalde Municipal de Cañas, que:

“1) Antecedentes: 1.1. La Urbanización Andesa tiene más de 35 años de haberse construido sus casas básicas construidas bajo la figura de bono de vivienda (sin contar con las cercar perimetrales y sus anexos o ampliaciones de corredores al frente de las propiedades o al sector de atrás de las propiedades), este proyecto en su primera fase, dio inicio con una construcción de aproximadas 10 viviendas, con áreas de construcción de bien social financiadas con bonos de vivienda, por lo que contaban con permisos de construcción, sin embargo con el pasar de los años las mismas fueron ampliando sus áreas de construcción, áreas de ampliación en corredores o cuartos traseros utilizados para vivienda y sus construcciones perimetrales, muchas de estas construcciones se dieron sin los permisos de construcción respectivos, las áreas de construcción perimetral que no cuentan en su gran mayoría con los permisos de construcción y no contaron la supervisión del profesional en construcción que les guiara en cómo debió ser la construcción de las tapias y los retiros correspondiente del talud con el cual colindan estas propiedades, tampoco o contaron con la guía para construir las tapias y respetar las profundidades de las tapias, como Municipalidad conocemos concretamente el caso de la señora aquí recurrente quien construyo sus áreas de corredores y sus áreas perimetrales con permiso, pero en el último año la recurrente realizó construcción de un galerón en el patio trasero de la propiedad de sus padre (a los que ella manifiesta representar, pese a no ser nombrada como figura legal que represente a los dueños de la propiedad, quienes son los padres de la aquí recurrente), sobre el galerón construido por la aquí recurrente Nombre09, es que la Municipalidad le notifica que debe de legalizar la construcción ya que la misma es ilegal por no contar con los permisos respectivos y por no respetar los retiros de talud al momento de construir el galerón.

Es importante hacer del conocimiento de los señores magistrados, que la Municipalidad de Cañas, nunca se ha mostrado ajena o indiferente de escuchar atender a los vecinos de la urbanización Andesa. todo lo contrario se les recibe en reuniones con los diferentes profesionales institucionales (Gestora Ambiental, Ingeniera de Construcciones, ingeniero de la Unidad Técnica de Gestión Vial) y se le escucha y aportan valoraciones (verbales) de los hechos que los mismos exponen, en cuanto a la preocupación que les embarga en la posibilidad de continuar el deslizamiento del talud que colinda con nuestra Dirección07 (misma que colinda con la parte trasera de sus propiedades). Dentro de las reuniones siempre se les emiten recomendaciones, por parte de los profesionales indicaciones o recomendaciones que se les hacen saber y las mismas se les explican de cómo deben de encausar las aguas pluviales de sus patios, por medio de canoas y bajantes y conducirlos al frente de las propiedades para evitar un deslave mayor o acelerado del talud, además se les instruye que no dejen salir las aguas residuales de sus propiedades a través del talud, con el único fin de evitar un aceleramiento en la erosión del terreno.

Hechos que son verificados por el Departamento de Construcciones que se cumplan y se respeten los plazos establecidos según el plan de trabajo elaborado por la Municipalidad de Cañas en pleno cumplimiento de la sentencia de esta Sala constitucional. de las nueve horas veinte minutos del veintiséis de mayo de dos mil veintitrés, número Res. N° 2023012166, dentro del expediente 23-007491-0007-CO.

De los hechos denunciados:

1- La municipalidad desde el año 2010, tiene conocimiento de los problemas del deslizamiento y erosión del terreno en la zona de Urbanización Andesa, ubicada en Barrio San Cristóbal Sur, por ello inicio inspecciones constantes en el sitio y se hizo acompañar de instituciones importantes conocedoras en el tema como es la Comisión Nacional de Emergencias. es así como en el año 2010, a raíz de las inspecciones realizadas por la Municipalidad en el Departamento de Construcciones y Unidad Técnica de Gestión Vial, se emite el criterio técnico número DOS-199-10, en el cual la funcionaria a cargo Angie Díaz procede a emitir una serie de recomendaciones a los vecinos, mismas que no fueron acatadas por la totalidad de los vecinos, pero que ayudo a mejorar la situación. Dentro del mismo año se le pide a la Comisión Nacional de Emergencias proceda con el apone de profesionales especiales en valoración de zonas de riesgos a valorar una propiedad en específico la cual estaba en condiciones vulnerables de derrumbe (ver fotografía) emitiendo la Comisión Nacional de Emergencia el criterio número CUE-0623-2012, dentro del cual se dirige en forma específica a la propiedad en riesgo y emite las recomendaciones a realizarse para evitar el colapso a través del derrumbe, dichas recomendaciones están dirigidas para ser realizadas por el propietario del terreno siendo que el talud está dentro de propiedad privada y el más peligros en derrumbarse, la municipalidad tomo el área de la supervisión de los trabajos que el propietario realizo (ver las fotografías del cómo se mostró el peligro del derrumbe en el año 2012 y las fotografías de como termino el trabajo del muro de contención que levanto el propietario y como se muestra en la actualidad el muro sin problemas de derrumbes).

Fotografías tomadas abril 2023, de cómo se encuentran en la actualidad la única propiedad en riesgo de derrumbe en el año 2012: una vez que el propietario con la supervisión de la Municipalidad realizo el muro de contención en la propiedad.

(…)

2- La Municipalidad realiza inspecciones constantes en el sitio desde el año 2012 y hasta la fecha, verificando que no se estén continúen los deslizamientos o desprendimientos de terrenos en el sitio (inspecciones que se realizan de manera constante de manera vehicular y es más una inspección ocular), con lo que mantenemos vigilado y comprobado que en el sitio durante estos últimos 13 años, no se ha presentado deslizamientos y la erosión no supera el tres por ciento del terreno, todo lo contrario, el terreno de talud ha mejorado en su vegetación y en el amarre de la tierra, esto pese a que aún continúan algunos propietarios, actuando de manera ilegal e irresponsables, ya que se comprobó que continúan realizando construcciones en sus patios, edificios para vivienda, sin contar con los retiros del talud y desvían las aguas tanto pluviales como las residuales al terreno del talud, contrariando las indicaciones realizadas por la Municipalidad. Como parte del cumplimiento de las acciones planteadas en el plan de trabajo, pasado 01 de agosto del presente año (2024), se realizaron las siguientes labores:

Se mantiene la cobertura vegetal sobre el talud.

(…)

Poda de árboles, reducir la cantidad de peso por ramas.

(…)

Asimismo, como parte de las labores, se realizó la recolección de residuos que se encontraron en el sitio.

Como se evidencia en las fotografías anteriores parte de las acciones es mantener la cobertura vegetal baja (zacate, maleza), para evitar la erosión o lavado de los terrenos por las lluvias o aguas mal encausadas. Es importante indicar que las labores de mantenimiento de este sitio, se encuentra toman en consideración dentro de la programación con los funcionarios operativos de servicio de limpieza y aseo de vías, es decir cuentan con un cronograma de limpieza periódica, según el área del cantón. A continuación, se evidencia en sitio en las condiciones que se encuentra actualmente (fotografías tomadas el 25 de septiembre del 2024).

En atención a la sentencia 2023012166 de la Sala Constitucional referente al recurso de amparado que se tramita en el expediente 23-007491-0007-CO interpuesto por Nombre16 y al Plan de Acción presentado por la Municipalidad de Cañas para dar cumplimiento a lo ordenado por esta Sala, el 18 de setiembre de 2023 se procedió a realizar una inspección conjunta funcionarios del departamento de gestión ambiental e infraestructura vial de la Municipalidad de Cañas, Ministerio de Salud y MINAE en Barrio ANDESA. Desde el departamento de desarrollo y control urbano el fin era la atención a las irregularidades detectadas en cuanto a construcciones sin permisos municipales y desviación de aguas pluviales que puedan afectar el talud. Cabe señalar que también se realizaron inspecciones el 20 de noviembre de 2023 en conjunto con el Ministerio de Salud. De manera que se procedió a hacer las notificaciones respectivas a los vecinos de Barrio ANDESA, según lo identificado en la inspección Se aclara que no se está notificando por las viviendas construidas con permiso de construcción aprobado, si no por ampliaciones u obras realizadas posteriormente sin el permiso municipal.

En el caso específico de los señores Nombre11 e Nombre02, mediante oficio DCU-077-24, se les indicó que existe un manejo inadecuado de aguas y que se excede el parámetro de cobertura establecido en el plan regulador. En lo referente a las construcciones dicha propiedad con No. de finca PRN04, la construcción que no cuenta con los permisos respectivos y que incumple con la cobertura es el área techada utilizada para tender ropa, según lo indica la señora Nombre09 en el punto OCTAVO del documento recibido el 20 de setiembre de 2024 en el departamento de desarrollo y control urbano. Es imponente mencionar que se va a programar una nueva inspección, ya que indica ese mismo documento la señora Nombre09, que ya hicieron las correcciones en lo que se refiere al manejo de aguas pluviales. Se debe destacar que por competencias y según ley constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, dicha institución realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras, y es esta institución la que tiene bajo su administración el alcantarillado sanitario en el Cantón de Cañas.

Por lo que no es correcto afirmar que la alcaldía y el departamento de desarrollo y control urbano tienen injerencia en la exclusión de Barrio ANDESA de la construcción de alcantarillado sanitario. De las obras a realizar en calle ubicada al costado norte del plantel del MOPT, en Barrio San Cristóbal de la ciudad de Cañas, me permito manifestarle lo siguiente:

a. De conformidad con lo previsto en el plan de acción formulado para el abordaje de este caso, se incorporó en el Presupuesto Ordinario 2024 de recursos provenientes de la ley N" 8114 y sus reformas. el recurso requerido para la construcción de cordón y/o cuneta para desagüe pluvial en la margen norte de la calle en cuestión, así como el recurso requerido para la demarcación vertical de la vía, implementando un solo sentido para la misma. b. Actualmente el Departamento de infraestructura Vial está preparando los términos de referencia para la promoción en el mes de octubre, del procedimiento de contratación para la ejecución de las obras indicadas en el numeral anterior, las cuales se estima se realizarían durante el primer cuatrimestre del año 2025. En visita ocular resiente, se logra documentar para el fin de mostrar ante los señores magistrados, el proceder de los vecinos colindantes del talud que colinda con la Dirección07, vecinos aquí firmantes, como atentan contra el bienestar y conservación del talud, realizando las construcciones de edificaciones para uso de vivienda, hasta de segunda planta, con salidas de desagües al lado del talud, impermeabilizando los suelos con cemento y lanzando con bajantes las aguas al talud, siendo estas prácticas incorrectas las que la municipalidad está corrigiendo, en labor conjunta con Ministerio de Salud, notificando a los aquí firmantes que procedan a retirar las construcciones ilegales y que destruyen o atentan contra el talud con los suelos (patios) impermeabilizados con cemento, evitando con ello que el terreno haga una correcta absorción de las aguas pluviales de la propiedad, ocasionando que las aguas discurras hasta el talud de una forma descontroladas, sumado a ello las aguas del techo de las construcciones, donde esta misma Sala Constitucional nos mandó a conservar y cuidar según sentencia 2023012166 de la Sala Constitucional referente al recurso de amparado que se tramita en el expediente 23-007491-0007-CO. (adjunto fotografías del hecho).

Sin embargo, pese a todos esos inconvenientes encontrados en el sitio, en la visita de campo realizada y documentada, el talud aquí denunciado no muestra indicios de derrumbe o de deslizamientos, tampoco muestra síntomas de erosión constante, todo lo contrario, encontramos un suelo reconstruido con zona boscosa y amarre del suelo producto del bosque que se ha mejorado.

Conclusión:

1- Procedemos a concluir, con el pleno conocimiento del caso y de la materia, con la prueba de las visitas de campo realizadas el día 25 de septiembre 2024, por los expertos ingenieros civiles y ambientales Municipales, concluimos que no existe tentativa de deslizamiento en el talud que colinda con Dirección07. en el sector de barrio San Cristóbal Sur, en la colindancia trasera de la urbanización Andesa, que la única problemática que se originó en el año 2010 fue solucionada en el año 2012 inicios 2013, que no se ha generado nuevamente en peligro de derrumbe siendo claro que se acataron las recomendaciones de los criterios de la Comisión Nacional de Emergencias. 2- Concluimos que el talud según los reportes de los expertos en ingeniería civil de la Municipalidad de Cañas, no está reflejando tentativa de derrumbes. 3- Concluimos que los vecinos de la urbanización ANDESA aquí firmantes, no quieren poner a derecho sus construcciones ni eliminar todas aquellas que atentan con la estabilidad del talud, porque se realizaron fuera de los límites legales de retiro del talud e impermeabilizaron los suelos de forma ilegal y continúan con la agravante que las mantienen (las construcciones) en la zona perimetral al talud y con desagüe de las aguas residuales y pluviales hacia el talud, contribuyendo con el aceleramiento de la erosión del talud y no siendo conscientes de la protección del sitio para evitar deslizamientos. 4- Concluimos y logramos demostrar que en la actualidad no existe peligro de derrumbe o deslizamiento de material, que el talud contiguo a las colindancias de las propiedades de la urbanización Andesa, en la actualidad es estable y no presenta riesgos de deslizamientos.

Que la erosión que presenta el mismo, es el normal según la naturaleza pero que se puede ver afectado por las malas prácticas de algunos de los colindantes aquí firmantes en cuanto al proceder con el desagüe de las aguas residuales y pluviales de sus propiedades y con las construcciones ilegales que sobre pasan la demasía de la propiedad legalmente autorizada. 5- Además, que no existen basura ni malos olores en el sitio, como lo hacen ver a esta saña y sin pruebas por parte de los recurrentes firmantes”.

Solicita que se declare sin lugar el recurso.

  1. 3Mediante resolución de las 11:02 horas del 24 de febrero de 2025 se amplió el curso y se confirió audiencia al Director del Área Rectora de Salud de Cañas.
  2. 4Informa bajo juramento Juan Luis Sánchez Vallejos, en su condición de Director del Área Rectora de Salud del Ministerio de Salud en Cañas, Guanacaste, que:

“PRIMERO- Que en razón a acatar a un ordenamiento de la Sala Constitucional de la Corte de Suprema Justicia, consta en autos que la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle ambas funcionarias del Equipo de Regulación del Arrea Rectora de Salud de Cañas, realizaron inspecciones en predios afectados por el Talud en Andesa; razón por la cual consta del folio 0034 al folio 0040 del expediente administrativo las Actas de Inspección emitidas mediante los consecutivos MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023 y MS-DRRSCH-DARSCÑ- 496-2023. SEGUNDO- Que así mismo consta en autos que la funcionaria Mayela Sandoval Valle funcionaria del Equipo de Regulación del Arrea Rectora de Salud de Cañas, realizo inspección en una casa de habitación, ubicada 400 metros al sur y 25 metros al este de la Iglesia Católica del barrio Andesa; razón por la cual consta en el folio 0041 del expediente administrativo Acta de Inspección emitida mediante el consecutivo MS-DRRSCH-DARSCÑ- 496-2023, donde se expone lo siguiente "En la visita se logró observar que las aguas residuales son dirigidas a la vía pública, como también se observa que la propiedad está construida al 100% como también se observa que uno de los techos no cuenta con canoas se realiza prueba de Fluoresceína. ..

". TERCERO- Que consta en autos oficio MS-DRRSCH-DARSCÑ- IT-297-2024, mediante el cual la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle ambas funcionarias del Equipo de regulación del Arrea Rectora de Salud de Cañas, emiten Informe técnico; indicando entre otras cosas lo siguiente “ En fecha 05 de septiembre del 2023, ante solicitud de acompañamiento a predios afectados por Talud en Andesa, se realiza visita en conjunto con la Municipalidad a algunas viviendas que colindan con el talud afectado, donde la mayoría de las casas cuenta con sus respectivas canoas dirigidas al cordón y caño ubicada al frente de la vivienda y en otras viviendas son dirigidas hacia el talud. El talud manifestado en dicho oficio colinda con una calle publica, la cual cuenta con cordón y caño solo al inicio de la calle y el resto no dispone, por lo que se dificulta dirigir las aguas pluviales por esa vía.

Por lo corroborado en la vista conjunta con la municipalidad. El problema descrito corresponde a un tema relacionado con aguas pluviales e infraestructura que la municipalidad de Cañas debe resolver. Se le dará seguimiento al caso.” CUARTO- Que el día 12 de marzo del 2025 la Ingeniera Paula Murillo Esquivel funcionaria del Equipo de Regulación del Arrea Rectora de Salud de Cañas, realizo inspección en el barrio Andesa, por lo cual consta en autos Acta de inspección, donde dicha funcionaria expone lo siguiente “ Se realiza visita con el fin de verificar y contestar recurso de Amparo, logrando observar que la Municipalidad de Cañas no le ha dado mantenimiento ni ha realizado las obras necesarias para canalizar las aguas pluviales, como cordón y caño, además se observa basura y maleza abundante”. QUINTO- Que consta en autos oficio MS-DRRSCH-DARSCÑ- IT-048-2025, mediante el cual la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle ambas funcionarias del Equipo de Regulación del Arrea Rectora de Salud de Cañas, emiten Informe Técnico; indicando entre otras cosas lo siguiente “ En fecha 12 de marzo del 2025, ante recurso de amparo, expediente 24-024724-0007- CO, se realiza visita para verificar las condiciones mencionadas en dicho documento, observando lo siguiente: • La Municipalidad de Cañas no ha realizado las obras necesarias para canalizar las aguas pluviales, como el cordón y caño.

Se observa residuos de basura en toda la vía. Se observó que la mayoría de las viviendas cuentan con su respectiva canoa.” CONCLUSIÓN: Con lo dicho supra y con las pruebas documentales que se aporta, es evidente y manifiesto que esta Área Rectora de Salud de Cañas como parte del Ministerio de Salud poseemos toda la disposición de colaborarles a todas las instituciones que no lo soliciten, más cuando exista un problema de salud pública que interinstitucionalmente podamos resolver”.

Solicita que se declare sin lugar el recurso.

  1. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

CONSIDERANDO:

I. DE PREVIO

De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante unas denuncias interpuestas ante la Municipalidad de Cañas por un problema relacionado a la falta de construcción de mejores cordones y caños en la comunidad Andesa que presuntamente no han sido atendidas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

Los recurrentes manifiestan que los amparados Nombre11 e Nombre02 son personas adultas mayores y dueños de la propiedad finca No. PRN02 en la denominada ANDESA. Señala que el terreno donde se ubica la finca en cuestión es un talud o elevación donde las constantes “lluvias, vientos recios, temblores y otros ocasionaban la caída de la tierra”. Por tal razón, solicitó los permisos municipal correspondientes para la construcción de una tapia, la cual realizó. No obstante, la recurrente reclama varios problemas de contaminación, desfogue de aguas pluviales y riego por deslizamientos del talud. Sobre este apartado, acota que de manera formal y por escrito han planteado las gestiones correspondientes ante la Municipalidad de Cañas y las autoridades con competencia con el deseo de denunciar las irregularidades en cuanto a la “situación de aguas, la falta de construcción de mejores cordones y caños a nuestra comunidad Andesa se ha realizado en audiencias, en cartas a alcaldes y vice alcadesas de este cantón guanacasteco.

La situación con la zona de Flta (sci) de apoyo (…)”. Aporta gestiones del 19 de octubre de 2023 y el 20 de setiembre de 2024, así como correo electrónico del 18 de setiembre de 2023 planteadas ante la municipalidad accionada. No obstante, acusa que a la fecha de interposición de este recurso las autoridades municipales no han resuelto sus solicitudes y han incumplido sus deberes, por cuanto no han procurado la realización de las infraestructuras necesarias para evitar la problemática aludida.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)Los amparados son vecinos de la Urbanización Andesa, ubicada en Dirección03, Guanacaste (véase el informe adjunto).
  • b)La parte trasera de las propiedades de los amparados colinda con un talud (véase el informe adjunto).
  • c)Desde el año 2010, la municipalidad recurrida tiene conocimiento de los problemas del deslizamiento y erosión del terreno en la zona de Urbanización Andesa y, por ende, inició inspecciones constantes en el sitio, siendo que incluso se hizo acompañar de la Comisión Nacional de Emergencias (véase el informe adjunto).
  • d)En el Informe DOS-199-10 de 4 de noviembre de 2010, el Departamento de Ingeniería y Construcciones de la Municipalidad de Cañas concluyó lo siguiente: “El proceso de lavado y socavación que han sufrido los terrenos adyacentes a las propiedades de los vecinos de Urbanización ANDESA es producto de las lluvias y del inadecuado manejo de las aguas servidas y jabonosas de algunos vecinos de la comunidad. Los vecinos de urbanización ANDESA, deben dirigir las aguas servidas y jabonosas a un sistema de tratamiento aprobado por el Ministerio de Salud. Ya que al caer estas aguas directamente al talud provocan que se vaya socavando. La cobertura vegetal existente minimiza el impacto que las lluvias puedan producir sobre el talud, por lo cual es importante que se conserve. En su efecto, puede recortarse un poco la maleza, para que se vea un poco más limpio. Es importante que los vecinos de Urbanización ANDESA, no realicen construcciones sin los permisos municipales correspondientes. Además, cualquier construcción que se haga en dicha zona debe cumplir con los retiros que por seguridad amerite y deberá contar con un profesional responsable de la obra” (véase ad efectum vivendi el recurso de amparo No. 23-007491-0007-CO).
  • e)La Contraloría de Unidades Ejecutoras de la CNE, en oficio CUE-0623-2012 de 27 de febrero de 2012 dirigido al director de Gestión de Desastres, consignó: “Realiza la inspección a la Urbanización ANDESA, a solicitud de su persona y en atención a la documentación presentada por la señora Karol Ruiz Rodríguez, Coordinadora del Comité Municipal de Emergencias de Cañas. Se realiza la inspección en compañía del señor Lizanías Zúñiga López, en su condición de Alcalde de la Municipalidad de Cañas, de técnicos municipales y de funcionarios del Ministerio de Salud. A continuación se indican los principales aspectos observados en la visita realizada el 22 de febrero del 2012. DETALLES DE LA VISITA a) Las propiedades a valorar se ubican en mayor parte en una zona que colinda con la calle pública, de la Urbanización ANDESA ubicada en el distrito de Cañas, cantón de Cañas. b) Existen algunas viviendas que presentan susceptibilidad a ser afectadas por un deslizamiento siendo que estas se ubican en el borde superior del talud. c) Según indicaciones verbales de funcionarios del Departamento de Permisos de Construcción de la Municipalidad de Cañas, los muros ubicados en los límites de propiedad de las viviendas, se construyeron sin ningún permiso municipal, y no se respetaron los retiros correspondientes estipulados en la reglamentación vigente. d) Se da un manejo inadecuado de las aguas negras y jabonosas que provocan la saturación terrenos y por ende provoca desprendimientos de material, como las aguas son vertidas directamente sobre el talud. e) Actualmente, los terrenos presentan en algunas secciones desprendimientos de material, principalmente en una propiedad privada donde existe un muro que presenta las siguientes condiciones: • Separación en las juntas de muro. • Deslizamiento lateral de las paredes del muro. • Varillas de refuerzo expuestas con alto grado de deterioro (corrosión). • Cimientos expuestos. f) A la fecha no se ha realizado la demolición de este muro, ordenada por el Departamento Regional del Ministerio de Salud meses atrás.

Ante este panorama se incrementa el riesgo de que este muro ocasione daños a la integridad de las personas, que habitan en las viviendas ubicadas en la parte colindante del mismo. Es importante indicar que ya se han dado visitas al sitio y se han extendido recomendaciones por parte de las siguientes Instituciones: a. Ministerio de Salud — Departamento Regional. b. Municipalidad de Cañas — Departamento de Permisos de Construcción. c. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias — Departamento de Prevención. No obstante, las recomendaciones brindadas a los vecinos no han sido acatadas, por tanto se insta a las instituciones competentes velar por el acatamiento de las recomendaciones descritas. La problemática que enfrenta la comunidad de Urbanización Andesa de Cañas, Guanacaste; al tratarse de un evidente irrespeto por las regulaciones vigentes y que las propiedades se ubican en terrenos privados en su gran mayoría, debe ser atendida por la Municipalidad de Cañas.

Esto por cuanto los daños observados no están ligados a un evento extraordinario que permita utilizar recursos del Fondo Nacional de Emergencias” (véase ad efectum vivendi el recurso de amparo No. 23-007491-0007-CO).

  • f)La autoridad municipal accionada ha realizado reuniones con los diferentes profesionales institucionales, a saber: gestora ambiental, ingeniera de construcciones, ingeniero de la Unidad Técnica de Gestión Vial, donde se le escucha y aportan valoraciones (verbales) de los hechos que los habitantes de Andesa exponen; esto, en cuanto a la preocupación que les embarga en la posibilidad de continuar el deslizamiento del talud que colinda con la Dirección07 (véase el informe adjunto).
  • g)Dentro de las reuniones siempre se les emiten recomendaciones, por parte de los profesionales indicaciones o recomendaciones que se les hacen saber y las mismas se les explican de cómo deben de encausar las aguas pluviales de sus patios, por medio de canoas y bajantes y conducirlos al frente de las propiedades para evitar un deslave mayor o acelerado del talud, además se les instruye que no dejen salir las aguas residuales de sus propiedades a través del talud, con el único fin de evitar un aceleramiento en la erosión del terreno. Hechos que son verificados por el Departamento de Construcciones que se cumplan y se respeten los plazos establecidos según el plan de trabajo elaborado por la Municipalidad de Cañas (véase el informe adjunto).
  • h)Desde el año 2012, la Municipalidad de Cañas realiza inspecciones constantes en el sitio con el fin de verificar que no continúen los deslizamientos o desprendimientos de terrenos en el sitio; la erosión no supera el tres por ciento del terreno, todo lo contrario, el terreno de talud ha mejorado en su vegetación y en el amarre de la tierra; esto, pese a que continúan algunos propietarios actuando de manera ilegal e irresponsables, ya que se comprobó que continúan realizando construcciones en sus patios y edificios para vivienda sin contar con los retiros del talud. Además, desvían las aguas tanto pluviales como las residuales al terreno del talud, contrariando las indicaciones realizadas por la municipalidad (véase el informe adjunto).
  • i)El 18 de setiembre de 2023, se realizó una inspección conjunta con funcionarios del departamento de gestión ambiental e infraestructura vial de la Municipalidad de Cañas, el Ministerio de Salud y el MINAE en Barrio ANDESA. Asimismo, el 20 de noviembre de 2023 se realizaron nuevas inspecciones en la zona en conjunto con el Ministerio de Salud, procediéndose a hacer las notificaciones respectivas a los vecinos de Barrio ANDESA, según lo identificado en la inspección respecto a las irregularidades detectadas en cuanto a construcciones sin permisos municipales y desviación de aguas pluviales que puedan afectar el talud (véase el informe adjunto).
  • j)El 1º de agosto de 2024, como parte del cumplimiento de las acciones planteadas en el plan de trabajo, el gobierno local recurrido realizó las siguientes labores: “Se mantiene la cobertura vegetal sobre el talud; Poda de árboles, reducir la cantidad de peso por ramas; se realizó la recolección de residuos que se encontraron en el sitio” (véase el informe adjunto).
  • k)Mediante oficio DCU-077-24, se le notificó a los recurrentes Nombre11 e Nombre02 que existe un manejo inadecuado de aguas y que se excede el parámetro de cobertura establecido en el plan regulador. Además, se les informó que las construcciones realizadas en dicha propiedad no cuentan con los permisos respectivos e incumplen con la cobertura en el área techada utilizada para tender ropa (véase el informe adjunto).
  • l)En visita reciente a la Urbanización Andesa, la municipalidad recurrida logró documentar el proceder de los vecinos colindantes del talud que limita con la Dirección07, vecinos aquí firmantes, quienes atentan contra el bienestar y conservación del talud realizando las construcciones de edificaciones para uso de vivienda, hasta de segunda planta, con salidas de desagües al lado del talud, impermeabilizando los suelos con cemento y lanzando con bajantes las aguas al talud, siendo estas prácticas incorrectas las que la municipalidad está corrigiendo en labor conjunta con Ministerio de Salud, notificando a los aquí firmantes que procedan a retirar las construcciones ilegales y que destruyen o atentan contra el talud con los suelos (patios) impermeabilizados con cemento, evitando con ello que el terreno haga una correcta absorción de las aguas pluviales de la propiedad (véase el informe adjunto).
  • m)El 25 de setiembre de 2024, expertos ingenieros civiles y ambientales de la autoridad recurrida realizaron una visita de campo y concluyeron que no existe tentativa de deslizamiento en el talud que colinda con Dirección07 en el sector de barrio San Cristóbal Sur, en la colindancia trasera de la urbanización Andesa (véase el informe adjunto).
  • n)A la fecha de rendido el informe, el talud que colinda con los vecinos de la Urbanización Andesa no muestra indicios de derrumbe o de deslizamientos. Tampoco muestra síntomas de erosión constante, todo lo contrario, tiene un suelo reconstruido con zona boscosa y amarre del suelo producto del bosque que se ha mejorado (véase el informe adjunto).
  • o)En cumplimiento con lo ordenado en la sentencia No. 2023012166 de las 09:20 horas del 26 de mayo de 2023, emitida en el expediente No. 23-007491-0007-CO, el Área Rectora de Salud del Ministerio de Salud en Cañas, Guanacaste, ha realizado inspecciones en los predios afectados por el Talud en la Urbanización Andesa, identificadas en las actas de inspección mediante los consecutivos Nos. MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023, y MS-DRRSCH-DARSCÑ-496-2023 (véase el informe adjunto).
  • p)En el acta de inspección No. MS-DRRSCH-DARSCÑ-496-2023, la funcionaria Mayela Sandoval Valle, del Equipo de Regulación del Área Rectora de Salud de Cañas, realizó inspección en una casa de habitación ubicada cuatrocientos metros al sur y veinticinco metros al este de la Iglesia Católica del barrio Andesa y expuso lo siguiente: "En la visita se logró observar que las aguas residuales son dirigidas a la vía pública, como también se observa que la propiedad está construida al 100% como también se observa que uno de los techos no cuenta con canoas se realiza prueba de Fluoresceína” (véase el informe adjunto).
  • q)En el oficio No. MS-DRRSCH-DARSCÑ-IT-297-2024, la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle, ambas funcionarias del Equipo de Regulación del Área Rectora de Salud de Cañas, emitieron un Informe Técnico en el cual indicaron lo siguiente: “En fecha 05 de septiembre del 2023, ante solicitud de acompañamiento a predios afectados por Talud en Andesa, se realiza visita en conjunto con la Municipalidad a algunas viviendas que colindan con el talud afectado, donde la mayoría de las casas cuenta con sus respectivas canoas dirigidas al cordón y caño ubicada al frente de la vivienda y en otras viviendas son dirigidas hacia el talud. El talud manifestado en dicho oficio colinda con una calle publica, la cual cuenta con cordón y caño solo al inicio de la calle y el resto no dispone, por lo que se dificulta dirigir las aguas pluviales por esa vía. Por lo corroborado en la vista conjunta con la municipalidad. El problema descrito corresponde a un tema relacionado con aguas pluviales e infraestructura que la municipalidad de Cañas debe resolver. Se le dará seguimiento al caso” (véase el informe adjunto).
  • r)El 12 de marzo del 2025, la Ingeniera Paula Murillo Esquivel, funcionaria del Equipo de Regulación del Área Rectora de Salud de Cañas, realizó una inspección en el barrio Andesa y expuso lo siguiente: “Se realiza visita con el fin de verificar y contestar recurso de Amparo, logrando observar que la Municipalidad de Cañas no le ha dado mantenimiento ni ha realizado las obras necesarias para canalizar las aguas pluviales, como cordón y caño, además se observa basura y maleza abundante” (véase el informe adjunto).
  • s)En oficio No. MS-DRRSCH-DARSCÑ-IT-048-2025, la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle, ambas funcionarias del Equipo de Regulación del Área Rectora de Salud de Cañas, emitieron un Informe Técnico en las siguientes condiciones: “En fecha 12 de marzo del 2025, ante recurso de amparo, expediente 24-024724-0007- CO, se realiza visita para verificar las condiciones mencionadas en dicho documento, observando lo siguiente: • La Municipalidad de Cañas no ha realizado las obras necesarias para canalizar las aguas pluviales, como el cordón y caño. Se observa residuos de basura en toda la vía. Se observó que la mayoría de las viviendas cuentan con su respectiva canoa” (véase el informe adjunto).

IV. HECHO NO PROBADO

No se estima demostrado el siguiente hecho de relevancia para esta resolución:

Único. Que la Municipalidad de Cañas haya iniciado la construcción del cordón y/o cuneta para desagüe pluvial en la margen norte de la Dirección07 que colinda con el talud que se encuentra en la colindancia trasera de la urbanización Andesa.

V. SOBRE EL FONDO

En el sub lite se tuvo por acreditado los amparados son vecinos de la Urbanización Andesa, ubicada en Dirección03, Guanacaste. Asimismo, se colige que la parte trasera de las propiedades de los amparados colinda con un talud. Sobre este apartado, se verifica que desde el año 2010 la municipalidad recurrida tiene conocimiento de los problemas del deslizamiento y erosión del terreno en la zona de Urbanización Andesa y, por ende, inició inspecciones constantes en el sitio, siendo que incluso se hizo acompañar de la Comisión Nacional de Emergencias. A partir de este punto se coteja lo siguiente: en el Informe DOS-199-10 de 4 de noviembre de 2010 el Departamento de Ingeniería y Construcciones de la Municipalidad de Cañas concluyó lo siguiente: “El proceso de lavado y socavación que han sufrido los terrenos adyacentes a las propiedades de los vecinos de Urbanización ANDESA es producto de las lluvias y del inadecuado manejo de las aguas servidas y jabonosas de algunos vecinos de la comunidad.

Los vecinos de urbanización ANDESA, deben dirigir las aguas servidas y jabonosas a un sistema de tratamiento aprobado por el Ministerio de Salud. Ya que al caer estas aguas directamente al talud provocan que se vaya socavando. La cobertura vegetal existente minimiza el impacto que las lluvias puedan producir sobre el talud, por lo cual es importante que se conserve. En su efecto, puede recortarse un poco la maleza, para que se vea un poco más limpio. Es importante que los vecinos de Urbanización ANDESA, no realicen construcciones sin los permisos municipales correspondientes. Además, cualquier construcción que se haga en dicha zona debe cumplir con los retiros que por seguridad amerite y deberá contar con un profesional responsable de la obra”. La Contraloría de Unidades Ejecutoras de la CNE, en oficio CUE-0623-2012 de 27 de febrero de 2012 dirigido al director de Gestión de Desastres, consignó: “Realiza la inspección a la Urbanización ANDESA, a solicitud de su persona y en atención a la documentación presentada por la señora Karol Ruiz Rodríguez, Coordinadora del Comité Municipal de Emergencias de Cañas.

Se realiza la inspección en compañía del señor Lizanías Zúñiga López, en su condición de Alcalde de la Municipalidad de Cañas, de técnicos municipales y de funcionarios del Ministerio de Salud. A continuación, se indican los principales aspectos observados en la visita realizada el 22 de febrero del 2012. DETALLES DE LA VISITA a) Las propiedades a valorar se ubican en mayor parte en una zona que colinda con la calle pública, de la Urbanización ANDESA ubicada en el distrito de Cañas, cantón de Cañas. b) Existen algunas viviendas que presentan susceptibilidad a ser afectadas por un deslizamiento siendo que estas se ubican en el borde superior del talud. c) Según indicaciones verbales de funcionarios del Departamento de Permisos de Construcción de la Municipalidad de Cañas, los muros ubicados en los límites de propiedad de las viviendas, se construyeron sin ningún permiso municipal, y no se respetaron los retiros correspondientes estipulados en la reglamentación vigente. d) Se da un manejo inadecuado de las aguas negras y jabonosas que provocan la saturación terrenos y por ende provoca desprendimientos de material, como las aguas son vertidas directamente sobre el talud. e) Actualmente, los terrenos presentan en algunas secciones desprendimientos de material, principalmente en una propiedad privada donde existe un muro que presenta las siguientes condiciones: • Separación en las juntas de muro. • Deslizamiento lateral de las paredes del muro. • Varillas de refuerzo expuestas con alto grado de deterioro (corrosión). • Cimientos expuestos. f) A la fecha no se ha realizado la demolición de este muro, ordenada por el Departamento Regional del Ministerio de Salud meses atrás.

Ante este panorama se incrementa el riesgo de que este muro ocasione daños a la integridad de las personas, que habitan en las viviendas ubicadas en la parte colindante del mismo. Es importante indicar que ya se han dado visitas al sitio y se han extendido recomendaciones por parte de las siguientes Instituciones: a. Ministerio de Salud — Departamento Regional. b. Municipalidad de Cañas — Departamento de Permisos de Construcción. c. Comisión Nacional de Prevención de Riesgos y Atención de Emergencias — Departamento de Prevención. No obstante, las recomendaciones brindadas a los vecinos no han sido acatadas, por tanto se insta a las instituciones competentes velar por el acatamiento de las recomendaciones descritas. La problemática que enfrenta la comunidad de Urbanización Andesa de Cañas, Guanacaste; al tratarse de un evidente irrespeto por las regulaciones vigentes y que las propiedades se ubican en terrenos privados en su gran mayoría, debe ser atendida por la Municipalidad de Cañas.

Esto por cuanto los daños observados no están ligados a un evento extraordinario que permita utilizar recursos del Fondo Nacional de Emergencias”. La autoridad municipal accionada ha realizado reuniones con los diferentes profesionales institucionales, a saber: gestora ambiental, ingeniera de construcciones, ingeniero de la Unidad Técnica de Gestión Vial, donde se le escucha y aportan valoraciones (verbales) de los hechos que los habitantes de Andesa exponen; esto, en cuanto a la preocupación que les embarga en la posibilidad de continuar el deslizamiento del talud que colinda con la Dirección07. Dentro de las reuniones siempre se les emiten recomendaciones, por parte de los profesionales indicaciones o recomendaciones que se les hacen saber y las mismas se les explican de cómo deben de encausar las aguas pluviales de sus patios, por medio de canoas y bajantes y conducirlos al frente de las propiedades para evitar un deslave mayor o acelerado del talud, además se les instruye que no dejen salir las aguas residuales de sus propiedades a través del talud, con el único fin de evitar un aceleramiento en la erosión del terreno.

Hechos que son verificados por el Departamento de Construcciones que se cumplan y se respeten los plazos establecidos según el plan de trabajo elaborado por la Municipalidad de Cañas. Desde el año 2012 la Municipalidad de Cañas realiza inspecciones constantes en el sitio con el fin de verificar que no continúen los deslizamientos o desprendimientos de terrenos en el sitio; la erosión no supera el tres por ciento del terreno, todo lo contrario, el terreno de talud ha mejorado en su vegetación y en el amarre de la tierra; esto, pese a que continúan algunos propietarios actuando de manera ilegal e irresponsables, ya que se comprobó que continúan realizando construcciones en sus patios y edificios para vivienda sin contar con los retiros del talud. Además, desvían las aguas tanto pluviales como las residuales al terreno del talud, contrariando las indicaciones realizadas por la municipalidad.

El 18 de setiembre de 2023 se realizó una inspección conjunta con funcionarios del departamento de gestión ambiental e infraestructura vial de la Municipalidad de Cañas, el Ministerio de Salud y el MINAE en Barrio Andesa. Asimismo, el 20 de noviembre de 2023 se realizaron nuevas inspecciones en la zona en conjunto con el Ministerio de Salud, procediéndose a hacer las notificaciones respectivas a los vecinos de Barrio Andesa, según lo identificado en la inspección respecto a las irregularidades detectadas en cuanto a construcciones sin permisos municipales y desviación de aguas pluviales que puedan afectar el talud. El 1º de agosto de 2024, como parte del cumplimiento de las acciones planteadas en el plan de trabajo, el gobierno local recurrido realizó las siguientes labores: “Se mantiene la cobertura vegetal sobre el talud; Poda de árboles, reducir la cantidad de peso por ramas; se realizó la recolección de residuos que se encontraron en el sitio”.

Mediante oficio DCU-077-24 se le notificó a los recurrentes Nombre11 e Nombre02 que existe un manejo inadecuado de aguas y que se excede el parámetro de cobertura establecido en el plan regulador. Además, se les informó que las construcciones realizadas en dicha propiedad no cuentan con los permisos respectivos e incumplen con la cobertura en el área techada utilizada para tender ropa. En visita reciente a la Urbanización Andesa, la municipalidad recurrida logró documentar el proceder de los vecinos colindantes del talud que limita con la Dirección07, vecinos aquí firmantes, quienes atentan contra el bienestar y conservación del talud realizando las construcciones de edificaciones para uso de vivienda, hasta de segunda planta, con salidas de desagües al lado del talud, impermeabilizando los suelos con cemento y lanzando con bajantes las aguas al talud, siendo estas prácticas incorrectas las que la municipalidad está corrigiendo en labor conjunta con Ministerio de Salud, notificando a los aquí firmantes que procedan a retirar las construcciones ilegales y que destruyen o atentan contra el talud con los suelos (patios) impermeabilizados con cemento, evitando con ello que el terreno haga una correcta absorción de las aguas pluviales de la propiedad.

El 25 de setiembre de 2024 expertos ingenieros civiles y ambientales de la autoridad recurrida realizaron una visita de campo y concluyeron que no existe tentativa de deslizamiento en el talud que colinda con Dirección07 en el sector de barrio San Cristóbal Sur, en la colindancia trasera de la urbanización Andesa. A la fecha de rendido el informe, el talud que colinda con los vecinos de la Urbanización Andesa no muestra indicios de derrumbe o de deslizamientos. Tampoco muestra síntomas de erosión constante, todo lo contrario, tiene un suelo reconstruido con zona boscosa y amarre del suelo producto del bosque que se ha mejorado.

Quedó demostrado que en cumplimiento con lo ordenado en la sentencia No. 2023012166 de las 09:20 horas del 26 de mayo de 2023, emitida en el expediente No. 23-007491-0007-CO, el Área Rectora de Salud del Ministerio de Salud en Cañas, Guanacaste, ha realizado inspecciones en los predios afectados por el Talud en la Urbanización Andesa, identificadas en las actas de inspección mediante los consecutivos Nos. MS-DRRSCH-DARSCÑ-339-2023, MS-DRRSCH-DARSCÑ-340-2023, MS-DRRSCH-DARSCÑ-341-2023, MS-DRRSCH-DARSCÑ-342-2023, MS-DRRSCH-DARSCÑ-343-2023, MS-DRRSCH-DARSCN-344-2023, MS-DRRSCH-DARSCÑ-378-2023, y MS-DRRSCH-DARSCÑ-496-2023. En el acta de inspección No. MS-DRRSCH-DARSCÑ-496-2023 la funcionaria Mayela Sandoval Valle, del Equipo de Regulación del Área Rectora de Salud de Cañas, realizó inspección en una casa de habitación ubicada cuatrocientos metros al sur y veinticinco metros al este de la Iglesia Católica del barrio Andesa y expuso lo siguiente: "En la visita se logró observar que las aguas residuales son dirigidas a la vía pública, como también se observa que la propiedad está construida al 100% como también se observa que uno de los techos no cuenta con canoas se realiza prueba de Fluoresceína”.

En el oficio No. MS-DRRSCH-DARSCÑ-IT-297-2024 la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle, ambas funcionarias del Equipo de Regulación del Área Rectora de Salud de Cañas, emitieron un Informe Técnico en el cual indicaron lo siguiente: “En fecha 05 de septiembre del 2023, ante solicitud de acompañamiento a predios afectados por Talud en Andesa, se realiza visita en conjunto con la Municipalidad a algunas viviendas que colindan con el talud afectado, donde la mayoría de las casas cuenta con sus respectivas canoas dirigidas al cordón y caño ubicada al frente de la vivienda y en otras viviendas son dirigidas hacia el talud. El talud manifestado en dicho oficio colinda con una calle publica, la cual cuenta con cordón y caño solo al inicio de la calle y el resto no dispone, por lo que se dificulta dirigir las aguas pluviales por esa vía. Por lo corroborado en la vista conjunta con la municipalidad.

El problema descrito corresponde a un tema relacionado con aguas pluviales e infraestructura que la municipalidad de Cañas debe resolver. Se le dará seguimiento al caso”. El 12 de marzo del 2025 la Ingeniera Paula Murillo Esquivel, funcionaria del Equipo de Regulación del Área Rectora de Salud de Cañas, realizó una inspección en el barrio Andesa y expuso lo siguiente: “Se realiza visita con el fin de verificar y contestar recurso de Amparo, logrando observar que la Municipalidad de Cañas no le ha dado mantenimiento ni ha realizado las obras necesarias para canalizar las aguas pluviales, como cordón y caño, además se observa basura y maleza abundante”. Finalmente, se constata que en oficio No. MS-DRRSCH-DARSCÑ-IT-048-2025 la Ingeniera Paula Murillo Esquivel y Mayela Sandoval Valle, ambas funcionarias del Equipo de Regulación del Área Rectora de Salud de Cañas, emitieron un Informe Técnico en las siguientes condiciones: “En fecha 12 de marzo del 2025, ante recurso de amparo, expediente 24-024724-0007- CO, se realiza visita para verificar las condiciones mencionadas en dicho documento, observando lo siguiente: • La Municipalidad de Cañas no ha realizado las obras necesarias para canalizar las aguas pluviales, como el cordón y caño. Se observa residuos de basura en toda la vía. Se observó que la mayoría de las viviendas cuentan con su respectiva canoa”.

Ahora bien, esta Sala, en un asunto similar al que ahora se plantea, mediante la sentencia No. 2023012166 de las 09:20 horas del 26 de mayo de 2023, emitida en el expediente No. 23-007491-0007-CO, resolvió lo siguiente:

“III.- Sobre el caso concreto. En el sub lite, la persona accionante indica que 11 familias vecinas de la urbanización ANDESA ubicada en Cañas Guanacaste, construyeron sus viviendas con permisos otorgados por la Municipalidad de Cañas; sin embargo, comenzaron a notar un problema evidente de deslizamiento en sus terrenos. Señala que, con ocasión de lo anterior, en 2010 enviaron una nota a Luis Fernando Mendoza Jiménez, en aquel momento diputado electo por la provincia de Guanacaste y a Kattya Solórzano Hernández, quien fungía como alcaldesa de Cañas. Refiere que tal diputado procuró la solución del problema ante el gobierno local. Manifiesta que el Departamento de Ingeniería y Construcciones de la Municipalidad de Cañas efectuó una inspección el 4 de noviembre de 2010; empero, brindó una respuesta con la cual los vecinos no estuvieron de acuerdo, ya que “solo una vecina de la primera casa de la Urbanización bota las aguas al patio trasero en el cual no existe cordón de caño”.

Arguye que, ese mismo día, la alcaldesa remitió una nota a Nancy Yépez, directora del Área de Salud de Cañas, a los efectos de que se procurara una mejor conducción de aguas. Acota que en 2011 intervino el diputado mencionado y el alcalde Lizanías Zúñiga López se puso a disposición de los vecinos. Añade que, en noviembre de 2011, los vecinos de la urbanización remitieron una nota a la presidenta de la CNE. Sostiene que Auriel A. Herrera Barquero, fiscalizador de la Contraloría de Unidades Ejecutoras, mediante oficio CUE-0623-2012 de 27 de febrero 2012 dirigido al director de Gestión en Desastres de la CNE, informó que “Existen algunas viviendas que presentan susceptibilidad a ser afectadas por un deslizamiento siendo que estas se ubican en el borde superior del talud”, así como que “Según indicaciones verbales de los funcionarios del Departamento de Permisos de Construcción de la Municipalidad de Cañas, los muros ubicados en el límite de la propiedad de las viviendas se construyeron sin ningún permiso municipal y no se respetaron retiros correspondientes estipulados en el reglamento vigente”.

Asevera que todas las propiedades tienen permisos municipales y que los muros son tapias de zinc o mallas en su mayoría, ya que el terreno “rechaza el cemento” y se construyeron para proteger sus propiedades del hampa. Añade que las tapias están en el borde, ya que todos los años se pierde terreno. Explica que el 31 de marzo de 2021 remitieron los oficios a Fernando Mendoza, quien ocupaba el cargo de alcalde, entre ellos, el oficio CUE-0623-2012 de la CNE, en el que se advirtió: “La problemática que enfrenta la comunidad de Urbanización ANDESA de Cañas, Guanacaste al tratarse de un evidente irrespeto por las regulaciones vigentes y que las propiedades se ubican en terrenos privados en su mayoría, debe ser atendida por la Municipalidad de Cañas. Esto por cuanto los daños observados no están ligados a un evento extraordinario que permita utilizar Recursos de Fondo Nacional de Emergencia”; además, se consignó que la intención es sentar un precedente en caso de accidente por deslizamiento para evidenciar que actuaron desde hace 11 años.

Afirma que no obtuvieron respuesta de la municipalidad, ni de la CNE ni del diputado. Señala que, el 7 de junio de 2021, Gonzalo Quintero Quesada remitió nota a Luis Fernando Mendoza, nuevamente diputado, en la cual comunicó que la falta de caños y asfalto ha contribuido al proceso de desestabilización del muro a niveles dramáticos que ponen en riesgo las edificaciones de los contribuyentes, así como otras obras como tendido eléctrico y las edificaciones del MOPT; además, expuso la necesidad de que el gobierno local activara su Departamento de Ingeniería con una solución a través de un muro de contención y relleno que permita detener el desprendimiento del paredón, tal como la construcción de un muro de gaviones, la canalización de las aguas pluviales y el asfalto de la vía. Arguye que la nota anterior no fue respondida. Formula la siguiente petitoria: “2.- Que se obligue a la Municipalidad de Cañas a resolver nuestro problema ya que son 12 años y seis meses de estar con estos trámites sin tener una solución, además somos ciudadanos que pagamos impuestos y construimos con permisos emitidos por la misma Municipalidad”.

Del estudio de los autos se tiene por demostrado, que el Departamento de Ingeniería y Construcciones de la Municipalidad de Cañas, por informe de inspección DOS-199-10 de 4 de noviembre de 2010, concluyó: “El proceso de lavado y socavación que han sufrido los terrenos adyacentes a las propiedades de los vecinos de Urbanización ANDESA es producto de las lluvias y del inadecuado manejo de las aguas servidas y jabonosas de algunos vecinos de la comunidad. Los vecinos de urbanización ANDESA, deben dirigir las aguas servidas y jabonosas a un sistema de tratamiento aprobado por el Ministerio de Salud. Ya que al caer estas aguas directamente al talud provocan que se vaya socavando. La cobertura vegetal existente minimiza el impacto que las lluvias puedan producir sobre el talud, por lo cual es importante que se conserve. En su efecto, puede recortarse un poco la maleza, para que se vea un poco más limpio.

Es importante que los vecinos de Urbanización ANDESA, no realicen construcciones sin los permisos municipales correspondientes. Además, cualquier construcción que se haga en dicha zona debe cumplir con los retiros que por seguridad amerite y deberá contar con un profesional responsable de la obra”. La Contraloría de Unidades Ejecutoras de la CNE, en oficio CUE-0623-2012 de 27 de febrero de 2012 dirigido al director de Gestión de Desastres, consignó: “(…) realiza la inspección a la Urbanización ANDESA, a solicitud de su persona y en atención a la documentación presentada por la señora Karol Ruiz Rodríguez, Coordinadora del Comité Municipal de Emergencias de Cañas. Se realiza la inspección en compañía del señor Lizanías Zúñiga López, en su condición de Alcalde de la Municipalidad de Cañas, de técnicos municipales y de funcionarios del Ministerio de Salud. A continuación se indican los principales aspectos observados en la visita realizada el 22 de febrero del 2012.

No obstante, las recomendaciones brindadas a los vecinos no han sido acatadas, por tanto se insta a las instituciones competentes velar por el acatamiento de las recomendaciones descritas. La problemática que enfrenta la comunidad de Urbanización Andesa de Cañas, Guanacaste; al tratarse de un evidente irrespeto por las regulaciones vigentes y que las propiedades se ubican en terrenos privados en su gran mayoría, debe ser atendida por la Municipalidad de Cañas.

Esto por cuanto los daños observados no están ligados a un evento extraordinario que permita utilizar recursos del Fondo Nacional de Emergencias”. El Departamento de Prevención y Mitigación de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, mediante informe técnico DPM-INF-0053-2012 dirigido a Karol Ruiz Rodríguez, coordinadora del Comité Municipal de Emergencias de Cañas, señaló: “I. Información general A solicitud de la interesada, el pasado 06 de febrero del 2011 se realizó la valoración visual cualitativa del riesgo que ocasiona los desprendimientos de terreno en un talud en la parte trasera de unas viviendas de la Urbanización ANDESA. (…) III. Objetivos del estudio: A. Brindar un diagnóstico preliminar de riesgo basado en estimación visual, realizado mediante visita al sitio y análisis de mapa de amenazas. B. Identificar los procesos que puedan intensificar los daños causados por amenazas naturales.

C. Dar recomendaciones para asegurar la integridad de las infraestructuras y los habitantes. IV. Antecedentes. En noviembre del 2009 se evaluó cerca del sector un caso en donde se valora el riesgo por inestabilidad de un talud y un muro que afecta a unas viviendas realizándose el informe DPM-INF-1708-2009, sin embargo este caso no está relacionado directamente con la actual valoración. V. Análisis general de la amenaza y vulnerabilidad A. Las viviendas evaluadas se encuetaran dentro de la cuenca del rio Cañas. B. El talud tiene una dirección NE-SO. En el lado NE las dimensiones no supera los tres metros de alto ya en el sector SO puede llegar hasta 5 metros. C. Las estructuras de las viviendas limitan directamente con el borde del talud D. La ladera está constituida principalmente por suelo residual, no obstante debido a la vegetación en ciertos sectores no se puede determinar con certeza el tipo de material en que fueron cimentadas las propiedades, aunque en ciertos sitios parece relleno.

E. Se pudo comprobar en el sitio que se han dado desprendimientos considerables de terreno ya que en algunos sectores se observa las raíces de los arboles (sic) descubiertas. F. En el sector NE se evidencia como el mal manejo de las aguas está entre los factores que intensifica los desprendimientos, ya que se observa como estas son vertidas directamente sobre el talud. G. Según la verificación de campo las casa directamente afectadas son 13 (…) VI. Conclusiones A. La escorrentía superficial, las lluvias y el mal manejo de las aguas residuales han provocado desprendimientos en el talud. B. La cercanía del borde del talud con las estructuras representa un riesgo, ya que de seguir dándose desprendimientos las viviendas se van a ver directamente afectadas. VII. Recomendaciones A. Se deberá diseñar un sistema de drenaje adecuado para evitar que la saturación de los suelos facilite los movimientos de terreno.

B. Para proteger la integridad de las estructuras se deberá valorar la posibilidad de realizar una obra de contención en el talud. C. En donde el talud es más alto se puede considerara (sic) la posibilidad de realizar un trabajo de terraceo para estabilizar la ladera. D. Cualquier obra que se realice deberá contar con el estudio respectivo, para determinar basándose en las características geotécnicas cual es la mejor medida de mitigación en el sitio. Todo bajo la supervisión de un profesional capacitado. VIII. Alcances del informe A. Este informe no sustituye los estudios técnicos necesarios y es válido únicamente con sello original de este departamento. No devenga ningún tipo de costo para los interesados y serán ellos los responsables de dar trámite al mismo ante las instituciones correspondientes. B. En el Acuerdo No. 0443-2011 de la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, en uso de sus atribuciones, se establece que los informes emitidos por funcionarios especializados de esta institución tienen un carácter técnico vinculante para las instituciones a quienes se dirigen las recomendaciones”.

El 1º de julio de 2021, la Alcaldía de la Municipalidad de Cañas recibió un oficio de Nombre16 dirigido al alcalde de Cañas, en el que señaló: “Retomando nuevamente el caso que nos preocupa a los vecinos de Urbanización ANDESA por el deslizamiento que con cada invierno es notable en nuestras propiedades y del cual usted conoce, ya que ejerciendo como Diputado en el año 2010, se envió a su despacho nota fechada 06 de setiembre 2010 solicitando su ayuda ya que estas viviendas son nuestro patrimonio familiar, nuevamente acudimos a su persona a solicitarle realizar una nueva inspección 11 años después y pueda observar en la condición que se encuentran las mismas el día de hoy, subiendo por la Dirección09, calle que también la utilizan como basurero, botando animales muertos y basura la cual emana olores insoportables. El 04 de julio 2011 en Oficio LFMJ-1033-11 usted responde a mi persona como representante de los vecinos de esta Urbanización, que la Municipalidad es el ente autorizado para realizar inspecciones y coordinar con la Comisión Nacional de Emergencia, cualquier obra a realizar y nos sugería comunicarnos con el señor Lizanías Zúñiga López, Alcalde Municipal en ese momento.

Por este motivo que hoy acudimos a usted como Alcalde de la Ciudad de Cañas, Guanacaste. El día 27 de febrero 2012 los Ingenieros Auriel A Herrera Barquero e Ing Ericka Zamora Leandro funcionarios de la CNE, elaboran oficio CUE-0623-2012 como respuesta de la Inspección realizada a esta Urbanización en la cual textualmente dice “ La problemática que enfrenta la comunidad de Urbanización ANDESA de Cañas, Guanacaste; al tratarse de un evidente irrespeto por las regulaciones vigentes y que las propiedades se ubican en terreno privados en su mayoría, debe ser atendida por la Municipalidad de Cañas. Esto por cuanto los daños observados no están ligados a un evento extraordinario que permita utilizar Recursos del Fondo Nacional de Emergencias. Además comenta que según indicaciones verbales de funcionarios del Departamento de permisos (sic) de Construcción de la Municipalidad de Cañas, los muros ubicados en los límites de propiedad de las viviendas, se construyeron sin permiso municipal y no se respetan los retiros correspondientes estipulados en la reglamentación vigente.

Se manifiesta que cuando construimos las tapias que en realidad en su mayoría son latas de zing (sic) ya que el terreno no soporta las construcciones de block, sí se respetó la distancia sin embargo por los deslizamientos que ocurren en cada invierno se han ido corriendo y algunas se encuentran ya casi en el aire. a los vecinos nunca se nos informó de la visita de los funcionarios de la CNE, no fuimos invitados al recorrido y no se tomaron la molestia de consultarnos porque (sic) todos teníamos nuestras tapias en el borde de la propiedad, además esas tapias se colocaron por el vandalismo que comenzamos a sufrir ya que por ser una calle tan solitaria era común que se metieran a los patios a llevarse lo que estaba expuesto. Es preocupante ver como día a día nuestras propiedades adquieren menos terreno, corriendo el riesgo de perder nuestras viviendas en cualquier momento, motivo por el cual solicitamos una nueva inspección de emergencia ya que en el INS no nos aseguran nuestras propiedades por estar estas construidas en zona de riesgo y no se explican como la Municipalidad dio en su oportunidad permisos de construcción en esos terrenos.

Nuestra intención es dejar un precedente en caso de un accidente por deslizamiento de que efectivamente nosotros sí actuamos en su debido momento ya que desde hace 11 años se inició la solicitud de colaboración a varias entidades tales como la Alcaldía Municipalidad de Cañas en primera instancia, Consejo (sic) Municipal de Cañas, Comité Local de Emergencia, a su persona como Diputado Representante de nuestra Provincia y a la Comisión Nacional de: Emergencias sin obtener respuesta positiva por parte de ninguna de las instituciones antes mencionadas”. El 12 de setiembre de 2022, la Alcaldía de la Municipalidad de Cañas recibió un oficio de Gonzalo Alberto Quintero Quesada dirigido al alcalde y al concejo municipal, ambos de Cañas, en el que se indicó: “Por medio de la presente, en representación de los vecinos de Barrio Sin Pedro de Cañas, me dirijo a usted y al Concejo Municipal de nuestro querido Cantón, con la finalidad de pedirles que en su jurisdicción y función de servicios urbanos, específicamente con lo concerniente a la infraestructura vial cantonal, reconsideren intervenir la sección de camino que comunica calle 3 y Dirección01 sur de Barrio San Pedro.

Sección de camino que inicia 250 metros al sur del EBAIS San Pedro número dos de esta comunidad. Considerando definición obtenida del Laboratorio Nacional de Materiales y Modelos Estructurales de la Universidad de Costa Rica. La infraestructura vial está conformada por todos aquellos elementos que facilitan el desplazamiento de los vehículos de un punto a otro de una manera segura y confortable. Entre los elementos que la conforman se encuentran los pavimentos, puentes, la señalización vertical y horizontal, taludes, terraplenes, túneles, dispositivos de seguridad tales como barreras de contención, drenajes, espaldón, entre otros. Todos estos elementos conforman la red vial, la cual debe ser capaz de permitir un servicio de transporte con un nivel adecuado, eficiente para sus usuarios. En los años 90 vecinos de esta comunidad adquirieron terrenos a la sociedad Andesa S.A. cédula 3-101-020777, fraccionado de la finca inscrita en la Provincia de Guanacaste Folio Real PRN01, representada dicha sociedad por los señores Nombre12 y Nombre15.

Los planos correspondientes a dicho fraccionamiento fueron confeccionados por el Licenciado Agrimensor Jose (sic) Rafael Jimenez (sic) Gamboa, carnet LA 1269. Planos inscritos en su totalidad en setiembre de 1989, bajo todos los requisitos de ley de visados Municipales (sic), Colegios (sic) respectivos y Registro Nacional sección de Catastro Nacional. Los terrenos que se ubican entre Dirección01 y Dirección01, Dirección02 y Dirección03, colindan todos con calle pública al norte nueve metros de ancho y sur calle de 12 metros de ancho. (…) La problemática que aqueja a los Contribuyentes de este esta sección de terreno obedece específicamente con la colindancia con Dirección01, por las siguientes situaciones: a- El camino con acceso al plantel de Ministerio de Obras Públicas y Transportes b- El camino con acceso a la oficina Regional del Transito c- Dirección01 se enlaza con Dirección01 que a su vez da acceso a la Dirección08. d- Los vehículos pesados del MOPT ingresan por Barrio San Pedro hacia el plantel del MOPT por Dirección01. e- Los vehículos del tránsito liviano y pesado, ingresan por Barrio San Pedro hacia las Oficinas de la policía de Tránsito por Dirección01. f- Mantenimiento realizados a la vía en cuestión.

Aunque la Dirección01 es de uso público, los principales usuarios de esta vía de comunicación son los vehículos de las dos instituciones supra mencionadas, lo anterior porque para ingresar por la Dirección08 hacia le (sic) Dirección01 tendría que realizar el giro hasta el retorno ubicado por la estación de servicios El Gran parqueo, razón por la cual se les facilita ingresar por la vía principal de Barrio San Pedro. En razón de los puntos supra indicados, para facilitar el paso de vehículos pesados tales como vagonetas de más 20 toneladas y hasta maquinaria de compactación, aunado al hecho que esta calle colinda con una pendiente que da al plantel del Ministerio de Obras públicas y Transporte, ingresaron maquinaria para ampliar la vía de comunicación, debilitando la base del paredón del lado norte. (…) Luego de realizados los trabajos de ampliación de la vía, hasta la fecha de esta nota se mantienen ausente los trabajo de confección de caños y asfalto.

Estos trabajos ausentes han contribuido al proceso desestabilización del muro a niveles gramáticos que ponen en riesgo las edificaciones de los contribuyentes que ahí habitan y su patrimonio, así como poner en riesgo otros bienes del Estado por la ubicación de postes del tendido eléctrico y en caso de un deslizamiento es evidente que el material caería sobre las edificaciones del Ministerio de Obras Públicas y Transporte. Consideramos necesario que el Gobierno Local active su departamento de Ingeniería con una solución a través de un muro de contención y relleno que permita detener el desprendimiento de paredón, tal como la construcción de un muro de gavión, la canalización las aguas pluviales y el asfalto de la vía. Esperando que se atienda nuestra petitoria y en complemento a gestiones realizadas desde el año 2010 se suscribe Lic. Gonzalo Alberto Quintero Quesada, cedula NFP11, vecino de Cañas Guanacaste, Dirección06.

Con el fin de atender notificaciones señalo la dirección electrónica ...01 de conformidad con lo dispuesto por el Reglamento de Notificaciones por Fax y otros medios electrónicos”. La directora de Desarrollo y Control Urbano de la Municipalidad de Cañas, por oficio DOS-091-23 de 18 de abril de 2023, señaló: “En el 2010, se realizó inspección al sitio y se emitió informe DOS-199-10, en el cual se identificó lo siguiente: 1. Un manejo inadecuado de las aguas residuales las cuales son expulsadas a la vía pública sin ningún tratamiento, en trasgresión a lo que establece la Ley General de la Salud, en su artículo 285. Esta situación provoca que el terreno aledaño a las propiedades se vea afectado por un proceso de constante erosión. 2. Si bien es correcto que la Municipalidad autorizó los permisos de construcción de las viviendas, los vecinos de Barrio ANDESA, han realizado construcciones y tapias en sus patios, en su mayoría sin los respectivos permisos municipales y que no cuentan con la supervisión de un profesional en el área de ingeniería. 3.

Se indico (sic) en su momento la importancia de mantener vegetación en el talud para minimizar el proceso de erosión por efectos de las lluvias. 4. Se indicó en el informe la importancia de que los vecinos de Urbanización ANDESA, no realicen construcciones sin los permisos municipales correspondientes. Además, cualquier construcción que se haga en dicha zona debe cumplir con los retiros que por seguridad amerite y deberá contar con un profesional responsable de la obra. Cabe señalar que a raíz de este informe, la alcaldía municipal solicita al ministerio de salud mediante oficio OFC-ALC-00599-10 del 08 de noviembre de 2010 que se proceda con las ordenes sanitarias a fin de que los vecinos realicen las mejoras en sus sistemas de tratamiento de aguas residuales. Sin embargo, desconoce este departamento las acciones realizadas por las autoridades de salud. En relación con la propiedad tenía mayor afectación según las fotografías presentadas en los diferentes documentos aportados por la señora Nombre16, es la finca PRN05 y pertenecía en su momento al señor Nombre06, quien realizó las correcciones respectivas y construyó un muro de contención con sus respectivos drenajes.

Se debe mencionar que esta propiedad, no se ubica dentro de lo que se conoce Urbanización ANDESA. (Se adjuntan fotografías) Cabe señalar que, a fin de dar respuesta a su solicitud, el día 18 de abril de 2023, se realiza una nueva inspección y se aprecia que en el sector de ANDESA se mantienen las condiciones, mal manejo de aguas pluviales y residuales de parte de los vecinos en sus propiedades. A pesar de que en el informe DOS-199-10, se había recomendado que no se realizarán construcciones sin contar con los permisos respectivos y con un profesional responsable; los vecinos de la comunidad continúan haciendo esta práctica, lo cual se evidencia en actas de notificación adjuntas, donde se evidencia un incumplimiento a la ley de construcciones en las fincas PRN06, PRN07 y PRN08. (Se adjuntan fotografías). En la mayoría del talud hay cobertura vegetal, lo que minimiza el impacto de las lluvias sobre el mismo.

Es importante que esta cobertura se mantenga. (ver fotografía). La zona donde se evidencia mayor erosión es detrás de las fincas PRN09 y PRN07, propiedad de Nombre16 y Nombre05, sin embargo, es precisamente en la finca PRN07 en la cual recientemente realizaron una construcción sin permiso y en la finca Dirección04, en apariencia se realizó una impermeabilización del patio. (Ver fotografías)”. El director del Departamento de Infraestructura Vial de la Municipalidad de Cañas, por oficio OFC-DIV-065-2023 de 17 de abril de 2023, señaló: “4. La calle ubicada al costado norte del plantel del MOPT en Barrio San Cristóbal de la ciudad de Cañas, forma parte del código de camino N° 5-06-071 correspondiente a Calles Urbanas (cuadrantes) de la ciudad de Cañas (sector Kennedy - San Cristóbal), sector que abarca los barrios San Pedro, San Cristóbal y Kennedy. 5. La calle ubicada al costado norte del plantel del MOPT en Barrio San Cristóbal, al igual que las restantes calles con superficie de ruedo en lastre existentes en los barrios periféricos de la ciudad de Cañas, se intervienen anualmente, ejecutándose las actividades de mantenimiento periódico.

Como ejemplo de las intervenciones realizadas en dicha calle en los años 2019 y 2021, se resumen en el Cuadro N° 1 y las Imágenes N° 1, 2 y 3 de Anexos, provenientes de informes que este Departamento rindió a la Junta Vial Cantonal de Cañas. (…) 6. Durante la ejecución de las actividades de mantenimiento periódico en la calle ubicada al costado norte del plantel del MOPT en Barrio San Cristóbal, específicamente en la actividad de excavación, limpieza y conformación de cunetas, se remueven sedimentos de tasas o cantidades similares a las que se generan en cualquier otra calle o camino vecinal del cantón. 7. Al menos para el Departamento de Infraestructura Vial, en los últimos 10 años no existen antecedentes de incidentes o casos de remoción de materiales ocasionados por deslizamientos o derrumbes, en la superficie de ruedo de la calle ubicada al costado norte del plantel del MOPT en Barrio San Cristóbal, que hayan sido generados por eventos naturales”.

La Unidad de Gestión Ambiental de la Municipalidad de Cañas, en oficio OFC-GA-032-23 de 17 de abril de 2023, consignó: “el pasado 20 de septiembre del año 2022, se convocó al departamento de ambiente a una reunión con varios vecinos de esa comunidad y otros departamentos institucionales, y se informó sobre dicha problemática; en esta ocasión el departamento al ponerse en contexto con lo externado por los vecinos, hizo hincapié en un tema de relevancia y que amplifica los problemas de deslizamientos de las propiedades vecinas, el cual es el tema de la mala disposición de aguas residuales que realizan los vecinos de ese sector, y se les instó a realizar las denuncias necesarias ante Ministerio de Salud, con el fin de eliminar o minimizar esta problemática. Por lo tanto, el departamento de ambiente durante la última reunión que participó externó a los vecinos la importancia de detener la mala canalización de aguas residuales en la zona afectada”.

La alcaldesa y el presidente del Concejo Municipal, ambos de Cañas, en informe fechado 19 de abril de 2023, señalaron: “1. La municipalidad desde el año 2010, tiene conocimiento de los problemas del deslizamiento y erosión del terreno en la zona de Urbanización Andesa, ubicada en Barrio San Cristóbal Sur, por ello inicio (sic) inspecciones constantes en el sitio y se hizo acompañar de instituciones importantes conocedoras en el tema como es la Comisión Nacional de Emergencias, es así como en el año 2010, a raíz de las inspecciones realizadas por la Municipalidad en el Departamento de Construcciones y Unidad Técnica de Gestión Vial, se emite el criterio técnico número DOS-199-10, en el cual la funcionaria a cargo Angie Díaz procede a emitir una serie de recomendaciones a los vecinos, mismas que no fueron acatadas pro (sic) la totalidad de los vecinos, pero que ayudo (sic) a mejorar la situación.

Dentro del mismo año se le pide a la Comisión Nacional de Emergencias proceda con el aporte de profesionales especiales en valoración de zonas de riesgos a valorar una propiedad en específico la cual estaba en condiciones vulnerables de derrumbe (ver fotografía) emitiendo la Comisión Nacional de Emergencia el criterio número CUE-0623-2012, dentro del cual se dirige de forma específica a la propiedad en riesgo y emite las recomendaciones a realizarse para evitar el colapso a través del derrumbé (sic), dichas recomendaciones están dirigidas para ser realizadas por el propietario del terreno siendo que el talud esta (sic) dentro de propiedad privada y el más peligros (sic) en derrumbarse, la municipalidad tomo (sic) el área de la supervisión de los trabajos que el propietario realizo (sic) (ver fotografías del como (sic) se mostró el peligro de derrumbe en e (sic) año 2012 y las fotografías de como (sic) termino (sic) el trabajo del muro de contención que levanto (sic) el propietario y como se muestra en la actualidad el muro sin problemas de derrumbes.

(…) Fotografías tomadas abril 2023, de como (sic) se encuentran en la actualidad la única propiedad en riesgo de derrumbe en el año 2012, una ves (sic) que el propietario con la supervisión de la Municipalidad realizo (sic) el muro de contención en la propiedad. (…) 2. La Municipalidad realiza inspecciones constantes en el sitio desde el año 2012, verificando que no se estén continúen (sic) los deslizamientos o desprendimientos de terrenos en el sitio (inspecciones que se realizan de manera constante de manera vehicular y es más una inspección ocular), con lo que mantenemos vigilado y comprobado el sitio durante estos últimos 12 años, no se ha presentado deslizamientos y la erosión no supera el tres por ciento del terreno, todo lo contrario, el terreno de talud ha mejorado su vegetación y en el amarre de la tierra, esto pese a que aún continúan algunos propietarios, actuando de manera ilegal e irresponsables, ya que se comprobó que continúan realizando construcciones en sus patios, edificios para vivienda, sin contar con los retiros del talud y desvían las aguas tanto pluviales como las residuales al terreno del talud, contrariando las indicaciones realizadas por la Municipalidad.

Fotográficas (sic) de cómo se encuentra actualmente abril 2023 el talud que colinda con la Dirección07, se logra apreciar que no existe peligro de deslizamiento o derrumbe que asumen los aquí recurrentes. (… ) 1.4 En visita ocular resiente (sic), se logra documentar para el fin de mostrar ante los señores magistrados, el proceder de los vecinos colindantes del talud que colinda con la Dirección07, vecinos aquí firmantes, como atentan contra el bienestar y conservación del talud, realizando las construcciones de edificaciones para uso de vivienda, hasta de segunda planta, con salidas de desagües al lado del talud, además de realizar tapias en zinc con perlin con suelos (patios) impermeabilizados con cemento, evitando con ello que el terreno haga una correcta absorción de las aguas pluviales de la propiedad, ocasionando que las aguas discurras (sic) hasta el talud de una forma descontroladas (sic), sumado a ello las aguas del techo de las construcciones (adjunto fotografías del hecho).

(…). 1.5 Sin embargo, pese a todos esos inconvenientes encontrados en el sitio en la visita de campo realizada y documentada, el talud aquí denunciado no muestra indicios de derrumbe o de deslizamiento, tampoco muestra síntomas de erosión constante, todo lo contrario, encontramos un suelo reconstruido con zona boscosa y amarre del suelo producto del bosque se ha mejorado”. Al 4 de mayo de 2023 no constan expedientes administrativos en el Área Rectora de Salud de Cañas sobre denuncias de los vecinos del barrio ANDESA, en relación con temas afines a aguas residuales, deslizamientos o inundaciones.

Al respecto, de la lectura íntegra del escrito de interposición, se aprecia que la persona accionante lo que pretende es la atención del problema denunciado por parte de la Municipalidad de Cañas.

Sobre el particular, la Sala observa que, en 2021, la parte recurrente puso en conocimiento de la Municipalidad de Cañas una problemática que, según se alegó, data de los años 2010, 2011 y 2012, la cual se encuentra relacionada con un talud en la urbanización ANDESA. Al respecto, si bien la alcaldesa y el presidente del Concejo Municipal, ambos de Cañas, informaron que no se han presentado deslizamientos y que la erosión no supera el tres por ciento del terreno, así como que el talud mejoró en cuanto a vegetación y amarre de la tierra, no menos cierto es que expusieron que algunos propietarios siguen cometiendo irregularidades en cuanto a construcciones sin permisos municipales y desviación de aguas tanto pluviales como residuales. De ahí que aun cuando se informe a la Sala que actualmente no hay peligro de deslizamiento o derrumbe, el gobierno local no ha actuado de forma diligente a los efectos de atender los impactos que puedan tener las acciones u omisiones ilegítimas de quienes habitan la urbanización. Incluso, las autoridades municipales señalaron que el proceder de los vecinos atenta contra la conservación del talud.

En adición, de la prueba aportada por las autoridades municipales recurridas se desprende, que la directora de Desarrollo y Control Urbano de ese gobierno local, por oficio DOS-091-23 de 18 de abril de 2023, reconoció que, de acuerdo con una inspección llevada a cabo ese día, en el sector de ANDESA se mantienen las condiciones de mal manejo de aguas pluviales y residuales por parte de los vecinos en sus propiedades; además, que “La zona donde se evidencia mayor erosión es detrás de las fincas PRN09 y PRN07, propiedad de Nombre16 [aquí recurrente] y Nombre05, sin embargo, es precisamente en la finca PRN07 en la cual recientemente realizaron una construcción sin permiso y en la finca Dirección04, en apariencia se realizó una impermeabilización del patio”. Asimismo, la Unidad de Gestión Ambiental de la Municipalidad de Cañas, en oficio OFC-GA-032-23 de 17 de abril de 2023, indicó que el 20 de setiembre de 2022 se reunieron con varios vecinos de la comunidad y que el departamento “hizo hincapié en un tema de relevancia y que amplifica los problemas de deslizamientos de las propiedades vecinas, el cual es el tema de la mala disposición de aguas residuales que realizan los vecinos de ese sector, y se les instó a realizar las denuncias necesarias ante Ministerio de Salud, con el fin de eliminar o minimizar esta problemática”.

En ese sentido, no se puede obviar que el ente municipal se encuentra tolerando situaciones que pueden llegar a generar un riesgo para las personas. De ahí que proceda la estimatoria del recurso en su contra, en los términos que se dictarán en la parte dispositiva de esta sentencia.

No está de más aclarar que no corresponde a la Sala determinar si, desde el punto de vista técnico y legal, es competencia o no del gobierno local la construcción de un muro de contención en las propiedades privadas de la urbanización. Tampoco procede determinar en esta jurisdicción si la municipalidad tiene algún tipo de responsabilidad por haber otorgado permisos de construcción en la zona de marras. Estos extremos son propios de ser dilucidados en sede administrativa o jurisdiccional ordinaria, a fin de que se someta a contradictorio la posición de las partes y se evacúe la prueba técnica correspondiente.

Por otra parte, no se aprecian acciones u omisiones actuales por parte de la CNE y el Área Rectora de Salud de Cañas, que sean susceptibles de ser declaradas en esta vía constitucional.

En cuanto a la CNE, se observa en el expediente que desde el 2012 emitió el criterio respectivo dirigido al Comité Municipal de Emergencias de Cañas, sin que conste que se hubiese requerido su intervención de forma reciente.

Con respecto a la autoridad de salud, su directora informó a la Sala que no constan expedientes administrativos sobre denuncias de los vecinos del barrio ANDESA, en relación con temas afines a aguas residuales, deslizamientos o inundaciones. Si bien, la parte accionante señaló que el alcalde de Cañas pidió la intervención del Ministerio de Salud desde el 2010, a los efectos de esta jurisdicción no resulta factible tener por demostrada alguna omisión de esta autoridad, no solo porque el sello visible en el documento no es concluyente en cuanto a la institución que lo recibió y no existen elementos determinantes que así lo indiquen, sino porque han transcurrido más de 12 años desde esa presunta situación. Sin perjuicio de lo anterior, tome nota esta autoridad para que, ahora que tiene conocimiento de que la situación denunciada está vigente y dentro de un plazo un plazo razonable, inspeccione la zona y emita las órdenes necesarias para atender la problemática en lo que respecta al ámbito de sus competencias”.

(…)

Por tanto:

“Se declara parcialmente con lugar el recurso solo en contra de la Municipalidad de Cañas. Se ordena a Gricelda Vargas Segura y José Ángel Acon Wong, por su orden alcaldesa y presidente del Concejo Municipal, ambos de Cañas, o a quienes ocupen tales cargos, que dentro del ámbito de sus competencias, coordinen lo necesario, dicten las órdenes correspondientes y lleven a cabo las actuaciones pertinentes, a efectos de que, en el plazo de UN MES se diseñe un plan de acción con el correspondiente cronograma y plazo de ejecución, para atender la problemática denunciada con respecto al talud de la urbanización ANDESA, lo cual deberá considerar, en el marco de las prerrogativas municipales, la atención a las irregularidades detectadas en cuanto a construcciones sin permisos municipales y desviación de aguas tanto pluviales como residuales, así como los riesgos que provocan sobre el talud y las personas.

En ese sentido, si detectaren algún riesgo, deberán tomar las medidas inmediatas para garantizar la integridad de las personas que habitan tal urbanización. Asimismo, se les ordena a ambas autoridades, dentro del plazo de DIEZ DÍAS contado a partir de la notificación de esta sentencia, comunicar al Área Rectora de Salud de Cañas los problemas de salud pública que detectaron con ocasión de las inspecciones que el gobierno local llevó a cabo en la urbanización ANDESA. Finalmente, se ordena al presidente del Concejo Municipal de Cañas que, de manera INMEDIATA, ponga esta sentencia en conocimiento del órgano que representa, a los efectos de que se tomen los acuerdos necesarios para su cumplimiento”. Al respecto, según se estableció la sentencia supra, la Sala pudo corroborar que la problemática descrita en el líbelo de interposición ha sido de conocimiento de la Municipalidad de Cañas desde hace mucho tiempo, sin que ejecuten lo pertinente concerniente al talud de la urbanización Andesa. En ese contexto, si bien el Alcalde Municipal de Cañas informó a esta Sala que ese municipio incorporó en el Presupuesto Ordinario 2024 de recursos provenientes de la ley No. 8114 y sus reformas, el recurso requerido para la construcción de cordón y/o cuneta para desagüe pluvial en la margen norte de la calle y, que la ejecución de las obras se estima se realizarían durante el primer cuatrimestre del año 2025, lo cierto del caso es que en el oficio No. MS-DRRSCH-DARSCÑ-IT-048-2025, funcionarias del Equipo de Regulación del Área Rectora de Salud de Cañas determinaron lo siguiente: “En fecha 12 de marzo del 2025, ante recurso de amparo, expediente 24-024724-0007- CO, se realiza visita para verificar las condiciones mencionadas en dicho documento, observando lo siguiente: • La Municipalidad de Cañas no ha realizado las obras necesarias para canalizar las aguas pluviales, como el cordón y caño. Se observa residuos de basura en toda la vía”. En virtud de lo expuesto, se procede a declarar con lugar el recurso, con las consecuencias indicadas en la parte dispositiva de esta sentencia.

VI. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se reclama la contaminación de una naciente natural de agua en el barrio San Juan de Dios de Upala, la cual fue convertida en un caño y vertedero de aguas residuales por la municipalidad accionada, según se alega por la recurrente.

La parte recurrente alega, además, que con las aguas estancadas se ha dado el incremento de insectos y animales que ponen en riesgo la vida y salud de los vecinos de la comunidad, e implica un riesgo para la salud pública. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso, únicamente respecto a la Municipalidad de Cañas. Se ordena a Alexander Elizondo Duarte, en su condición de Alcalde Municipal de Cañas, o a quien en su lugar ejerza ese cargo, que adopte las medidas pertinentes para que dentro del marco de sus competencias solucione en forma definitiva, el problema concerniente al talud de la urbanización Andesa en los términos establecidos por esta Sala en la sentencia No. 2023012166 de las 09:20 horas del 26 de mayo de 2023. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Cañas al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Área Rectora de Salud de Cañas, se declara sin lugar el recurso. El Magistrado Salazar Alvarado consigna nota. Notifíquese.
