En virtud de lo expuesto, se constata una insuficiente cantidad y suministro de agua, así como una deficiente calidad de la misma para consumo, esto en el sistema que abastece a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco. Document Review Decision No. 2025008608 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty on veintiuno de marzo de dos mil veinticinco .
Amparo proceeding (recurso de amparo) filed by Nombre02, identity card No. NFP01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS AND THE MINISTERIO DE SALUD.
Background:
Resolution N° 2018021434, from expediente N° 18-018889-0007-CO of the Sala Constitucional de la Corte Suprema de Justicia, ordering Nombre03 and Sirlene Jiménez Aguilar, or whoever holds those positions, “(…) immediately upon notification of the judgment, to undertake the issuance of the corresponding administrative acts to remedy the quality of the water resource supplying the community, so that within six months from notification of the judgment, those actions are fully underway. Likewise, during that period, they must guarantee water quality by distributing it through tanker trucks or other appropriate measures, in order to minimize the shortage of drinking water in the community. (…)” Following this meeting, MSc. Natalia Gabriela García Campos, from the Proceso de Regulación de la Salud, conducted an inspection in the communities on 27 de febrero del 2023, as recorded in visual inspection report N° DARSPA-NGC-017-2023.
During that inspection, a random sample of the communities supplied by this system was surveyed, producing the following results: at a person’s home in Bejuco, it was reported that they had water-supply problems and that, when the water arrived, it looked like mud; a person in Condominio Costa Sol reported that during the summer they had experienced problems due to a lack of water and that the water arrived dirty; in Málaga, we were told that the water inlet valve had been shut off and that the flow rate had fallen from 8 l/s to a flow rate of 0,5 l/s to 2 l/s (the internal plumbing of the homes was inspected, and no water came out when it was opened); at a home in Esterillos Este, it was reported that there was little water and that it sometimes came out brown; in Esterillos Centro, it was reported that water reached them, but that it often arrived dirty; and in Esterillos Oeste, it was reported that there was little water, that it arrived dirty, and that residents had to get up before dawn in order to obtain clean water.
On 14 de marzo del 2023, a meeting of the Comisión Municipal de Emergencias was held, at which it was agreed to convene a meeting regarding the drinking-water problem in Esterillos, inviting the regional official in charge of AyA, the administrator of AyA Parrita, the administrator of AyA Jacó, the director of the Ministerio de Salud Parrita, two representatives of CCE Bejuco, CCCI de Parrita, the head of operations of the Comisión Nacional de Emergencias, the administrator of ASADA Loma Bandera, the territorial board of directors, and Mr. Herberth González of INDER. A request was also sent to the official liaison of the Comisión Nacional de Emergencias seeking a declaration of a cantonal emergency due to the drinking-water problem in Esterillos. Following this event, and as a follow-up to the problem that has been addressed through this process over the years, technical report N° MS-DRRSPC-DARSPA-IT0133-2023 was prepared, setting out the problem caused by the lack of drinking water in the homes of residents of the communities of Esterillos Oeste, Esterillos Centro, Esterillos Este, and Bejuco.
It is worth noting that this report states the following: (…) since the beginning of 2019 to date, this system has remained in place, and these communities still do not have a supply of drinking water in their homes and must travel to the locations of the aforementioned tanks to obtain this resource. Based on the foregoing, it is determined that there may be cases in the communities in which people have difficulty moving about and in which traveling every day creates limitations, for example, for older adults, persons with disabilities, and persons with health conditions that limit their ability to perform this task, which would also have repercussions for their health. (…) Accordingly, on 18 de abril del 2023, health order (orden sanitaria) N° MS-DRRSPCDARSPA-OS-037-2023 was served on Sirlene Jiménez Aguilar, administrator of the Esterillos Drinking-Water Supply System network, ordering her to: “Submit an action plan detailing the activities, the person responsible, and the timeframe for providing drinking water, in accordance with the parameters established in the Reglamento para la Calidad del Agua Potable, to the communities supplied through the household supply system, as well as the short-term actions for ensuring the quantity, quality, safety, and accessibility of the service provided to the communities through the system of installed tanks.” On 22 de mayo del 2023, the Área Rectora de Salud de Parrita received Memorandum N° GSP-RPC-J2023-00196, which identified the following measures for the Action Plan to comply with the health order: 1.
The Public-Private Partnership signed by AyA and the developer Místico, which is scheduled for completion in December of this year; that project will leave the outlet pipeline from the Tulín 1 well installed at the intersection with the coastal highway, where AyA is currently arranging the installation of the additional pipeline needed to convey the water to the Esterillos system. The institution must subsequently carry out the corresponding improvements to complete the interconnection to the well site where the Esterillos supply sources are located. 2. The Tulín 1 well under the Partnership will make it possible to supply current users with quality water, but not to meet new demand; such demand will be met by the Tulín 2 well, which is at the drilling stage as part of a possible public/private partnership alternative. 3. Studies conducted on the aquifers from the Tulín bridge toward Parrita have indicated that they contain elevated levels of iron and manganese; therefore, the water needed to supply the community of Esterillos with chlorinated water of drinking-water quality must be brought in from other aquifers.
Taking this document into account, health order N° MS-DRRSPC-DARSPAOS-077-2023 was issued on 14 de junio del 2023, with a compliance deadline of 31 de enero del 2024, ordering: 1. Completion of the drinking-water supply system works by the developer. 2. Submission of an action plan for continuation of the Esterillos aqueduct system interconnection project. Water analyses corresponding to the first half of 2023 were received, yielding the following values: (…) Water analyses corresponding to the second half of 2023 were received, yielding the following values: (…) On 16 de febrero del 2024, the Área Rectora de Salud de Parrita received document N° GSP-RPC-J-2024-00058, stating that it had not been possible to comply with the work schedule established for fulfillment of the public-private Partnership set forth in health order N° MS-DRRSPC-DARSPA-077-2023 and indicating that: 1. The Partnership, signed in April 2023 as the “Convenio para la construcción y traspaso de obras, servidumbres e inmuebles para el proyecto de construcción de mejoras para el acueducto de la comunidad de Esterillos y Bejuco del cantón de Parrita, entre el instituto Costarricense de Acueductos y Alcantarillados y Místico Comunidad de Playa,” had expired, and not all tasks in the work schedule had been completed. 2.
Both participants are assessing and studying a new Partnership that would allow the progress made under the previous one to be completed, and meetings are being scheduled for that purpose, as indicated by the Dirección Regional. Given that no actions have yet been taken to provide these communities with drinking water and that, although the corresponding administrative acts have been undertaken, the actions indicated by the local and regional levels of the Instituto Costarricense de Acueductos y Alcantarillados have not been completed, a meeting was held on 6 de marzo del 2024 with the administrator of the cantonal office in Garabito of the Instituto Costarricense de Acueductos y Alcantarillados. The case was discussed with her, and she stated that the process was being handled by AyA Management and that this limited her ability at the local level to take actions and make decisions to prioritize the project.
It was therefore agreed that an administrative act would be directed to AyA Management so that the corresponding measures would be taken to prioritize the project. It is important to emphasize that this is a legal proceeding that began at the start of 2019; nevertheless, no improvements to the system have yet been made. Instead, the problem concerning the quantity and quality of the water in this area of the canton of Parrita has worsened, with the population exposed throughout these years to water containing levels of iron and manganese that place its health at risk. In addition, consideration must be given to the possibility that community residents, upon receiving water in their homes with acceptable organoleptic characteristics (condiciones organolépticas), may use it for consumption because of the difficulty of traveling to the tanks installed in the (sic) (…) Based on the foregoing, it is determined that these communities are not being supplied with drinking water and that the water is not being provided continuously, in sufficient quantities to meet people’s needs, or at the pressure required for the proper operation of the sanitary fixtures in use.
Article N° 2 of the Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados states that the Instituto Costarricense de Acueductos y Alcantarillados is responsible for: a) Directing and overseeing all matters related to providing the inhabitants of the republic with drinking-water service and with the collection and disposal of sewage, liquid industrial waste, and stormwater in urban areas; b) Determining the priority, advisability, and feasibility of the various projects proposed for constructing, renovating, expanding, or modifying aqueduct and sewerage works, which may not be carried out without its approval; (…) (bold and underlining not in the original) Accordingly, in light of the time elapsed and the process undertaken, this project must be prioritized so as not to harm the health of the population supplied by this system. Therefore, on 02 de abril del 2024, health order N° MS-DRRSPC-DARSPA-OS-0056- 2024 was served, ordering María Alejandra Mora Segura, General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, to: “Submit an action plan detailing the activities, the person responsible, and the timeframe for providing drinking water, in accordance with the parameters established in the Reglamento para Calidad de Agua Potable, to the communities supplied through the household supply system.” On 20 de mayo del 2024, the Área Rectora de Salud de Parrita received an Excel database containing information on AyA processes, indicating that a response had been provided to the Minister of the Ministerio de Salud through official letter GG-2024-00967, which stated: “This concerns an order issued to the Oficina Cantonal de Jaco, which manages the Esterillos system that supplies the communities of Esterillos Oeste, Centro, Este, and Bejuco.
The Convenio Místico had been signed, through which progress was made in drilling the Tulín 1 well; ownership of the well site and protection zone was transferred to AyA; a right-of-way easement (servidumbre de paso) in favor of AyA was registered to provide access to the well; and an electrical-network easement (servidumbre de red eléctrica) in favor of ICE was registered.
Currently, a new agreement is being negotiated for the construction of hydraulic infrastructure to provide a water-quality solution to the Community of Esterillos and Bejuco; therefore, an implementation schedule cannot yet be established, since it depends on the progress of that agreement.” CONCLUSION: The Área Rectora de Salud de Parrita has conducted a process since 2018, with continuous follow-up, to ensure that action is taken to provide drinking water through this aqueduct’s distribution system (sistema de distribución) to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro and Bejuco (…) REQUEST: In light of the foregoing, I respectfully request that the Honorable Sala Constitucional exempt the undersigned and the entity I represent from all liability, since, as explained above, from 2018 to the present, the authorities of the Dirección del Área Rectora de Salud de Parrita have been monitoring the drinking-water problem affecting the Sistema de Esterillos, which is managed by AyA’s cantonal office in Jacó and supplies the communities of Esterillos Este, Esterillos Centro, Esterillos Oeste and Bejuco; periodic monitoring of water analyses has been conducted in accordance with the parameters established in the Reglamento para la Calidad del Agua Potable; Health Orders (Ordenes Sanitarias) N° OS013-2018 and N° MS-DRRSPC-DARSPA-OS-058-2022 have been issued to the official responsible for the Instituto Costarricense de Acueductos y Alcantarillados in the affected area; follow-up has been conducted regarding the Public-Private Partnership Agreements (Convenios de Alianza Pública/Privada) with the developer Místico de Playa, which provide for the construction of public works to supply both the Development Project and the surrounding communities—“an agreement under which AyA may begin using water from Tulín 1 to supply the Esterillos Bejuco system”; interinstitutional meetings have been held with the Municipalidad de Parrita, Benemérito Cuerpo de Bomberos, Casa Presidencial, Instituto Costarricense de Acueductos y Alcantarillados, Condominio Málaga and Área Rectora de Salud de Parrita in search of a solution to the drinking-water problem affecting the Esterillos system; and a new agreement is currently being negotiated for the construction of hydraulic infrastructure to provide a water-quality solution to the community of Esterillos and Bejuco.
All these actions demonstrate that the authorities of the Dirección del Área Rectora de Salud de Parrita are addressing the problem in question within the scope of their authority and have issued the corresponding administrative acts (actos administrativos) in an effort to ensure that drinking water is provided through this aqueduct’s distribution system to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro and Bejuco.”
Accordingly, the actions related to compliance with the health orders (órdenes sanitarias) and the system’s drinking-water quality conditions are described, on the basis of which it has been determined that iron and manganese levels in the distribution network remain within the limits established by the regulations governing drinking-water quality; nevertheless, an administrative act (acto administrativo) will be issued to ensure compliance with the residual chlorine level. The necessary information is therefore attached as evidence to assist the Constitutional Chamber in reaching a decision, in accordance with the principle of legality (principio de legalidad) enshrined in Article 11 of the Political Constitution and Article 11 of the General Law of Public Administration (…) - RELIEF REQUESTED In view of the foregoing, the Honorable Constitutional Court is respectfully requested to DISMISS the present WRIT OF AMPARO (RECURSO DE AMPARO) and to absolve both the entity I represent and the undersigned of all liability, since, as stated by Dr. Eric Brenes Gómez, Acting Director of the Parrita Health Governing Area Directorate, Central Pacific Regional Health Governance Directorate, in the report detailed above, the aforementioned Governing Area has monitored the orders issued in this case and determined that the drinking-water quality conditions of the aqueduct system supplying the communities of Esterillos Este, Oeste, Centro and Bejuco comply with the iron and manganese limits established in the Regulations for Drinking-Water Quality; and, with respect to residual chlorine, an administrative act will be issued to ensure compliance with the level established in those regulations.”
Justice Araya García drafts the opinion; and,
Considerations:
I.Subject matter of the petition. The petitioner alleges a violation of his fundamental rights, stating that he lives in Esterillos Oeste and has had a water connection installed on his property since 2006; nevertheless, he has recently experienced an ongoing problem with the water supply to his home, leaving him for hours without receiving a single drop. He states that he is ill and therefore requires water service. Accordingly, he has contacted the Instituto Costarricense de Acueductos y Alcantarillados to report the lack of water at his home, but to date that institution has taken no action to resolve the problem. He adds that the ICAA has told him that water tanks are available, but he asserts that, because of his health condition, he cannot carry a bucket of water from more than one kilometer away. Furthermore, they do not indicate the time or the street where the tanker truck will be located. Likewise, those tanker trucks are not in suitable condition to supply water. He adds that the water consumed in that community is not potable.
II.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:
- Regarding the continuity and quantity of potable water in the system:
Tanker-truck service is provided inversely to the sectorization being implemented; thus, if Esterillos Oeste is the system without service in the morning, tanker-truck service is provided there, and vice versa with respect to Esterillos Este and Centro, as well as Bejuco, while the tanks are kept filled by tanker truck (see the reports submitted and the evidence provided).
That initiative was analyzed and accepted at the time by the Subgerencia de Sistemas Periféricos and was submitted to the Dirección de Planificación for consideration by the Comité de directores de Proyectos through official communication SG-GSP-2021-01023 dated 10 de agosto del 2021 (see the reports submitted and the evidence provided).
The community is always informed through AyA’s official channels, and tanker trucks are stationed at strategic points so that the community has access to potable water when the dry season affects well production and consequently prevents continuous service. For this reason, the rate currently charged in the Esterillos and Bejuco sector is the special rate; this rate was requested through memorandum No. GSP-RPC-2017-00202 by official William Chaves Soto on 13 de junio de 2017 and applied pursuant to Article 97 of the Reglamento para la Prestación de los Servicios de Acueductos y Alcantarillados AR-PSAYA-2013, based on memorandum No.GSP-RPC-J-2017-00278 prepared by official and engineer Bernal Sancho on 8 de junio de 2017, in which he reports that the water supplied to Esterillos and Bejuco contains iron and manganese levels exceeding the limits for potable-water quality. For that reason, a fixed rate is charged throughout the community, meaning that the cubic meters consumed each month are not taken into account; billing therefore consists of fixed charges for hydrants, the fixed water rate and protection of water resources.
Consequently, under the rate indicated above, users in the communities of Esterillos and Bejuco have paid a monthly fixed rate of ¢2000 colones, plus the fixed charge for hydrants and protection of water resources, with the rate listed in the OPEN system as ‘EM1 Esp. Sin Calidad. Residencial’; this remains in effect to date” (see the reports submitted and the evidence provided).
- Regarding the quality of potable water in the system:
Proposed course of action: a. Installation of tanks at various points in the distribution network (Escuela Esterillos Oeste, Escuela Esterillos Centro, Escuela Bejuco, Gasolinera La Cruz del Sur, Esterillos Oeste, Super Sol Esterillos Oeste, Condominio Málaga Bejuco and Dirección02), which will contain potable water and will be filled by tanker trucks. b. Acquisition of the identified property, which has two wells (Pozos Columbus 1 y 2), and integration of this water into the system over the long term. c. Conducting a public information campaign to inform the population that the water is not potable and that water for consumption will be distributed by tanker trucks through the tanks installed in the communities.” Accordingly, the proposed action plan was approved, but a timeframe for completion of this new system was requested (see the reports submitted and the evidence provided).
Among the alternatives analyzed, it was determined that a public-private partnership under Article 38 of the Ley de Planificación Urbana would be the most appropriate means of resolving the problems affecting the current users of the Esterillos Bejuco system. On 13 de abril del 2021, the ‘Agreement for the construction and transfer of works, easements (servidumbres), and real property for the project to construct improvements to the aqueduct serving the community of Esterillos and Bejuco in the canton of Parrita, between the Instituto Costarricense de Acueductos y Alcantarillados and Místico Comunidad de Playa’ was signed. The purpose of the project is to convey 32,6 l/s from a well known as Tulín 1, located in Mata de Plátano de Turrubares, to the Esterillos-Bejuco system. According to the AyA’s UEN de Gestión Ambiental, the Tulín well has a production capacity of 50 l/s. The property where the well is located has already been donated to AyA by the developer, as has the access easement to the property.
The property’s real-property folio is PRN01, with cadastral plan number SJ-2247227-2020 and an area of 900 m2. The developer Místico is currently preparing the plans, which must be submitted to AyA for approval. These plans include the infrastructure necessary to convey the water to the Esterillos Bejuco system, including a well-pumping station, a disinfection station, and a transmission pipeline. The same developer will be responsible for constructing all the works specified in the plans once the required construction permits have been obtained under national law (CFIA, SETENA, among others). According to the schedule approved for the Agreement, the project is expected to be completed by the end of 2023, and it is anticipated that, upon completion of the Agreement, AyA will be able to begin using water from Tulín 1 to supply the Esterillos Bejuco system” (see the reports submitted and the evidence provided).
Studies conducted on the aquifers (mantos acuíferos) from the Tulín bridge toward Parrita have indicated that they maintain high levels of iron and manganese and, therefore, the water needed to supply the Esterillos community with potable, chlorinated water must be brought in from other aquifers.” Thus, that document concludes that “the water currently supplied to users of the Esterillos system cannot be chlorinated and, therefore, as the population has been advised since the system was taken over, water from the network is not for drinking or cooking; hence the installation of storage tanks throughout the system. The definitive solution regarding the quality of the water provided through the system will be achieved upon completion of the works contemplated in the public-private Partnership currently under implementation, for which the person responsible at the regional level is the Director (…) together with the Sub-Gerencia de Sistemas Periféricos.
There is an alternative solution presented in AyA’s Project Portfolio, and the Subgerencia de Ambiente and Investigación y Desarrollo are evaluating new alternative solutions” (see the reports submitted and the evidence provided).
The Convenio Místico had been signed, through which progress was made on drilling the Tulín 1 Well; ownership of the well site and protection zone was transferred to AyA; a right-of-way easement (servidumbre de paso) in favor of AyA was registered to provide access to the well; and an electrical-grid easement (servidumbre de red eléctrica) in favor of ICE was registered. A new agreement is currently being negotiated for the construction of hydraulic infrastructure to provide a solution regarding water quality to the communities of Esterillos and Bejuco; therefore, an implementation schedule cannot yet be defined, as it depends on the progress of said agreement.’ CONCLUSION: The Área Rectora de Salud de Parrita has conducted a process since 2018, with continuous follow-up, so that action will be taken to provide potable water through this aqueduct’s distribution system to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro, and Bejuco” (see the reports submitted and the evidence provided).
IV.Regarding the right to consume potable water. This Constitutional Court has recognized in its case law that the rights to life and health are fundamental rights whose enjoyment requires access to potable water. For human beings to enjoy good health, they must be guaranteed a set of minimum conditions necessary to attain an adequate and harmonious psychological, physical, and environmental balance, as well as to prevent the emergence of dysfunctions that impair their full growth and development. One of those conditions is precisely the supply of water fit for human consumption. Accordingly, this Chamber has concluded that, as part of Constitutional Law, there is a fundamental right to the supply of potable water. Thus, in Judgment N° 2003-04654, issued at 15:44 hours on 27 de mayo del 2003, reiterated in N° 2018-014649, issued at 9:20 hours on 7 de setiembre de 2018, this Chamber held: “(…) The Chamber recognizes, as part of Constitutional Law, a fundamental right to potable water, derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: it is thus expressly included in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also articulated in the International Conference on Population and Development held in Cairo (principle 2) and declared in numerous other instruments of International Humanitarian Law.
Within our Inter-American Human Rights System, the country is particularly bound in this regard by the provisions of Article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (‘Protocol of San Salvador’ of 1988), which provides: ‘Article 11. Right to a healthy environment. 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.’ Furthermore, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right that, in addition to being essential for leading a healthy life, is a prerequisite for the realization of all other human rights.”
V.Prior proceeding before this Court. Before analyzing the present matter, it is important to note that this Constitutional Chamber has already examined the conditions of the water service provided by the Esterillos aqueduct. Thus, in judgment 2018-021434, issued at 09:20 hours on 21 de diciembre de 2018 in expediente no. 18-018889-0007-CO, the following was established:
“IV.- The Specific Case. In the present case, the evidence submitted in the case file, as well as the information provided under oath by the authorities of the respondent Institute, establishes that there has been an unlawful threat to the protected person’s right to health and to that of the other members of the Esterillos community, as well as a violation of her right to the proper functioning of public services and to access to drinking water (agua potable). The record shows that the Instituto Costarricense de Acueductos y Alcantarillados is the entity responsible for providing drinking-water service to the affected community and that, to date, it has been unable to resolve the problem that arose. Moreover, since December 22, 2016, the date on which it took over the water-supply system (acueducto), the respondent Institute has conducted various studies to identify a solution to the problem of iron and manganese concentrations in the Esterillos-Bejuco system, which cause the water to have a dark coloration.
According to the Head of the Institute’s Laboratorio Nacional de Aguas, ‘...the combined concentrations of Iron and Manganese do not comply with the Reglamento para la Calidad del Agua Potable 38924-8, which affects the water’s appearance and causes visual rejection by users of the Water-Supply System. Nevertheless, it is important to clarify that consuming the water does not cause any harm to Health.’ Thus, although the water being distributed is not harmful to health, it nevertheless fails to comply with the Reglamento para Calidad de Agua Potable. Accordingly, two years have passed and the respondent Institute has been unable either to resolve the water-supply system problem or to implement the necessary corrective measures to ensure that this infrastructure operates properly, even though the tests issued by the Laboratorio Nacional de Aguas are conclusive in this regard. The appellant is therefore correct concerning the quality of the water supplied to her by the respondent authority.
In light of the foregoing, the AyA authorities have failed to fulfill their constitutional duty to safeguard the health of the inhabitants of that community and the proper functioning of public services. These constitutional principles must be observed and respected at all times, without exception, by the public officials responsible for managing and providing such services. They constitute a non-waivable legal obligation imposed upon every administrative entity or body by virtue of their direct and immediate normative effect, given that the body or standard of legality (bloque o parámetro de legalidad) (Article 11 of the Constitución Política) with which their actions must comply includes, among other elements, the general principles of administrative law (Article 6 of the Ley General de la Administración Pública). In view of the foregoing, because of the prolonged violation of the fundamental right to drinking water and to an efficient public service, the appropriate course is to grant the amparo proceeding (recurso de amparo) and, consequently, order the respondent Institute to implement the corresponding improvements to the water-supply system that it operates and that serves the various Esterillos communities, and to comply with the requirements of the Reglamento de Control de Calidad de Agua.
This includes taking the measures necessary to reduce the degree of risk to public health and the vulnerability of the systems, as well as continuously monitoring the quality of the drinking water consumed by the inhabitants of the affected community. To that end, the respondent Institute must also perform the work required to guarantee the quality of the water resource (recurso hídrico) and the maintenance required by that water-supply system. Furthermore, the respondent is reminded that, whenever the reported problem occurs, it must ensure that drinking water is distributed in the area by tanker trucks.
(…) Por tanto: The amparo proceeding is GRANTED. Yamilette Astorga Espeleta and Sirlene Jiménez Aguilar, respectively Presidenta Ejecutiva and Encargada la Unidad Cantonal de Jacó-Región Pacífico Central, both officials of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, are ordered, IMMEDIATELY upon notification of this judgment, to undertake the issuance of the corresponding administrative acts (actos administrativos) to remedy the quality of the water resource from the water-supply system serving the Esterillos community, so as to comply with the provisions of the Reglamento de Control de Calidad de Agua, such that those actions are fully underway within SIX months from notification of this judgment. Likewise, during that period, they must guarantee the quality of the water by distributing it through tanker trucks or by taking other appropriate measures to minimize as much as possible the shortage of drinking water in the community.
The respondents are warned that failure to comply with the foregoing orders will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in proceedings to enforce the judgment before the administrative litigation jurisdiction (ejecución de sentencia de lo contencioso administrativo). Justice Hernández López appends a note. Yamilette Astorga Espeleta and Sirlene Jiménez Aguilar, respectively Presidenta Ejecutiva and Encargada la Unidad Cantonal de Jacó-Región Pacífico Central, both officials of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, shall be personally served.”
VI.Regarding the continuity and quantity of the system’s drinking water. After analyzing the evidence submitted, this Court finds a violation of the appellant’s fundamental rights with respect to this issue. This is because the reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, subject to the consequences, including criminal consequences, provided for in Article 44 of the Law Governing This Jurisdiction—and the evidence submitted for resolution of the matter have duly established that the system supplying the communities of Esterillos Este, Oeste, Centro and Bejuco, which is operated by the Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados, normally exhibits atypical behavior that becomes more pronounced during the summer season, when production is insufficient to meet demand in the area and supply users.
This is due to factors such as: a.-) the decline in production from the spring (naciente) known as Memo Vega, which supports the system and is located in Playa Hermosa; b.-) the seasonal increase in the population using the service, since, as a coastal area, it is a tourist vacation destination; c.-) at times, the system is affected by unscheduled outages caused by a lack of electricity in the supply system, which relies 100% on wells (there are three wells), and the remaining spring water, depending on production, is transferred to the Esterillos system; this situation occurred on 17 de marzo 2024, when replacement of the damaged three-phase electrical equipment prolonged the response to the failure; d.-) work performed by the Municipalidad that interferes with the normal provision of the service and is not planned for, as occurred on 21 de marzo, which was resolved immediately with the cooperation of the same Municipalidad, but nevertheless caused a delay in the arrival of service to residents of Esterillos Este and Bejuco.
Thus, with respect to the supply shortage, in order to ensure that the population has access to drinking water, the Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados has adopted and implemented the following actions and operational measures: a.-) the Esterillos area is supplied with drinking water for consumption by the population through tanks that have been located at different points in the system since the year 2017, since the water reaching their homes is intended for household tasks because of its iron and manganese levels; for this reason, no user is billed for consumption, and drinking water is supplied through 12 tanks at different points in the distribution system. For the year 2024, in addition to the tanker truck that keeps the tanks filled daily, drinking-water service has been provided using a second tanker truck and pickup-type vehicles equipped with 1000-liter tanks for distribution in areas that are difficult for the tanker truck to access. b.-) due to high consumption in the area and based on system pressure indicators and flow rates measured at different times during system production, the decision was made to divide the service into sectors (sectorizar el servicio), beginning in February, so that one sector receives service in the mornings and another in the afternoons.
Tanker-truck service is provided in the reverse order of the sector-based service schedule being implemented, so that if Esterillos Oeste is the system without service in the morning, it receives tanker-truck service, and vice versa with respect to Esterillos Este and Centro, as well as Bejuco, while the tanks are kept filled by tanker truck. In addition, the Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados has proposed a comprehensive solution to the problems affecting the three systems served by the Memo Vega spring, regarding water quality (excess iron and manganese), as well as the quantity and continuity of service, through new supply sources, storage-tank components, and improvements to hydraulic infrastructure. It proposes establishing prioritization guidelines for the development of master plans so that they may be implemented by the Dirección de Control, Planes y Proyectos, providing a comprehensive, long-term vision of the goals, objectives, and actions required for the alternative to succeed and to guarantee the current and future population a sustainable long-term solution, taking into account the project life cycle.
This cycle begins with the initiative identifying the need to be resolved and addressed, which was submitted by the Dirección de la Región Pacífico Central through official letter GSP-RPC-2021- 00732 dated 9 de agosto del 2021, entitled “Project Profile for Supplying the Quebrada Amarilla, Playa Hermosa and Esterillos Systems,” which details its scope, including its main objective of identifying and developing a feasibility study, design, and construction process that will make it possible to obtain new sources of drinking-quality water for human consumption, thereby integrating the three water-supply systems and guaranteeing the quality, quantity, and continuity of service for current and potential users. That initiative was analyzed and accepted at the time by the Subgerencia de Sistemas Periféricos and submitted to the Dirección de Planificación for consideration by the Comité de directores de Proyectos through official letter SG-GSP-2021-01023 dated 10 de agosto del 2021.
Likewise, on 23 de marzo de 2023, the Proceso de Regulación de la Salud issued technical report N° MS-DRRSPC-DARSPA-IT-0133-2023, setting out the problem caused by the lack of drinking water in the homes of residents of the communities of Esterillos Oeste, Esterillos Centro, Esterillos Este and Bejuco. That report states as follows: “(…) since the beginning of the year 2019 and up to the present, this system has remained in place, and these communities still do not have drinking-water service in their homes, requiring residents to travel to the locations of the specified tanks to obtain this resource. Based on the foregoing, it is determined that there may be cases in these communities in which individuals have mobility difficulties and daily travel creates limitations, for example, in the case of older adults, persons with disabilities, and persons with health conditions that limit their ability to perform this task, which would also adversely affect their health (…)”.
Similarly, through TECHNICAL INSPECTION REPORT MS-DRRSPC-DARSPA-IT-0264-2024 dated 27 de junio de 2024, the official in charge of the Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita informed the director of that Área Rectora as follows: “(…) Based on the foregoing, it is determined that these communities are not being supplied with drinking water and that it is not being provided continuously, in sufficient quantity to meet residents’ needs, or at the pressure required for the proper operation of the plumbing fixtures in use (…)”. Finally, according to technical report No. GSP-RPC-PA-2025-00074 dated 12 de marzo del 2025 from the Unidad Cantonal AyA Parrita, the following was established: “Regarding the continuity and quantity of drinking water from system PC-A-28, which supplies the communities of Esterillos and Bejuco, the effects of the dry season prevent continuous service because the wells do not produce the required volume of water.
Improvements have therefore been made to the Quebrada Amarilla system in order to remove the community of Quebrada Amarilla from the equation and use production from the Memo Vega spring to transfer water to the communities of Playa Hermosa and Esterillos. In response to this situation, service is divided into sectors, meaning that water service is suspended during certain hours in portions of the communities of Esterillos and Bejuco so that the systems can recover and water can be transferred to the higher areas of the community. The community is always notified through AyA’s official channels, and tanker trucks are stationed at strategic locations so that the community has access to drinking water when the dry season affects well production and thus prevents continuous service. For this reason, the rate currently charged in the Esterillos and Bejuco sector is the special rate; this rate was requested through memorandum No. GSP-RPC-2017-00202 by official William Chaves Soto on 13 de junio de 2017 and applied pursuant to Article 97 of the Reglamento para la Prestación de los Servicios de Acueductos y Alcantarillados AR-PSAYA-2013, and on the basis of memorandum No.GSP-RPC-J-2017-00278 prepared by official and engineer Bernal Sancho on 8 de junio de 2017, which reports that the water supplying Esterillos and Bejuco contains iron and manganese levels exceeding drinking-water quality limits.
For that reason, a flat rate is charged throughout the community, meaning that the cubic meters consumed each month are not taken into account; billing therefore consists of the fixed charges for fire hydrants, the flat water rate, and water-resource protection. Consequently, under the rate indicated above, users in the communities of Esterillos and Bejuco have paid a monthly flat rate of ¢2000 colones, plus the fixed charge for fire hydrants and water-resource protection, with the rate appearing in the OPEN system as ‘EM1 Esp. Sin Calidad. Residencial’; this remains in effect to date.”
In summary, it is established that the system supplying the communities of Esterillos Este, Oeste, Centro and Bejuco, which is operated by the Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados, normally exhibits atypical behavior that becomes more pronounced during the summer season, when production is insufficient to meet demand in the area and supply users. In this regard, and in order to ensure that the population has access to drinking water, the Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados has adopted and implemented several actions and operational measures, such as supplying drinking water for consumption by the population through tanks located at different points in the system since the year 2017. Thus, drinking water is supplied through 12 tanks at different points in the distribution system. For the year 2024, in addition to the tanker truck that keeps the tanks filled daily, drinking-water service has been provided using a second tanker truck and pickup-type vehicles equipped with 1000-liter tanks for distribution in areas that are difficult for the tanker truck to access.
Likewise, the decision was made to divide the service into sectors so that one sector receives service in the mornings and another in the afternoons. Tanker-truck service is provided in the reverse order of the sector-based service schedule being implemented, so that if Esterillos Oeste is the system without service in the morning, it receives tanker-truck service, and vice versa with respect to Esterillos Este and Centro, as well as Bejuco, while the tanks are kept filled by tanker truck.
Thus, there is indeed a shortage in the system, because production is insufficient to meet demand in the area and supply users. In response to this situation, the Instituto Costarricense de Acueductos y Alcantarillados has taken measures such as placing water trucks and tanks throughout the community. In addition, the service has been divided into sectors. In any event, although measures have been taken to mitigate the shortage, there is still no clarity regarding a comprehensive solution to this problem. This is because, while several projects intended to provide a comprehensive solution are mentioned, there is currently no clarity regarding the time frames for carrying out those projects or when they would be fully implemented. It should be noted that this shortage has existed since at least 2017; therefore, it is unacceptable that, to date, there is still no clarity regarding a comprehensive solution to this problem.
In this regard, it has been established that the ICAA authorities have failed to fulfill their constitutional duty to safeguard the health of the residents of that community and ensure the proper operation of public services. These constitutional principles must be observed and respected at all times and without exception by the public officials responsible for managing and providing such services, and they constitute a nonwaivable legal obligation imposed upon every administrative entity or body by virtue of their direct and immediate normative effect, given that the body or standard of legality (bloque o parámetro de legalidad) (Article 11 of the Constitución Política) with which their actions must comply includes, among other elements, the general principles of administrative law (principios generales del derecho administrativo) (Article 6 of the Ley General de la Administración Pública). In view of the foregoing, due to the prolonged violation of the fundamental right to drinking water and to efficient public service.
VII.Regarding the drinking-water quality (calidad del agua potable) of the system. Furthermore, the appellant claims that the water consumed in that community is not potable. On this point, it has been duly established that, in 2018, in connection with the water analysis for the first half of the year, the Área Rectora de Salud de Parrita del Ministerio de Salud received the water analyses for the Esterillos water-supply system (sistema de abastecimiento de agua), corresponding to the first half of that year, the results of which showed that the concentration levels of iron and manganese exceeded the parameters established in the Reglamento para la Calidad del Agua Potable. Following these results, the Área Rectora de Salud de Parrita del Ministerio de Salud received a complaint stating that the water in Esterillos was not potable and contained fecal coliforms. An inspection determined that the water did not meet the residual-chlorine (cloro residual) parameter when tests were conducted in homes, and previous analyses had shown that the system had an iron and manganese problem.
In view of the results obtained, the Área Rectora de Salud de Parrita del Ministerio de Salud ordered, through health order (orden sanitaria) N° OS-013-2018 of February 15, 2019, that chlorination of the water in the system be maintained at levels between 0,2 and 0,6 mg/L. Accordingly, on March 04, 2019, the Área Rectora de Salud de Parrita received the technical study submitted in response to health order N° OS-013-2018 by Eng. Rafael Barboza Tooping of the Instituto Costarricense de Acueductos y Alcantarillados, which stated the following: “1. The Instituto Costarricense de Acueductos y Alcantarillados maintains that chlorinating the water worsens and further degrades its quality because oxidation of the iron and manganese gives the water an undesirable taste, odor, and color. 2. The reddish and brown stains caused by iron and manganese, respectively, cannot be removed with detergent. 3.
Water contaminated with iron and manganese usually contains iron and manganese bacteria, which do not cause health problems. 4. In view of the foregoing points, consideration should be given to not chlorinating the water and, to prevent risks to the population, water should be supplied by tanker trucks so that the water reaching homes may be used for activities other than consumption. 5. Proposed course of action: a. Place tanks at various points along the network (Escuela Esterillos Oeste, Escuela Esterillos Centro, Escuela Bejuco, Gasolinera La Cruz del Sur, Esterillos Oeste, Super Sol Esterillos Oeste, Condominio Málaga Bejuco and Dirección02), which will contain potable water and will be filled by tanker trucks. b. Acquire the identified property containing two wells (Pozos Columbus 1 y 2) and incorporate this water into the system over the long term. c. Conduct a public-information campaign advising the population that the water is not potable and that water for consumption will be distributed by tanker trucks through the tanks installed in the communities.” The proposed action plan was therefore approved, but a timetable for completion of this new system was requested.
Subsequently, on February 22, 2021, the Área Rectora de Salud de Parrita del Ministerio de Salud requested, through official letter MS-DRRSPC-DARSPA-0059- 2021, a report on the progress of the actions undertaken to fulfill the planned work. Accordingly, official letter N° GSP-RPC-J-2021-00071 of March 08, 2021 stated that, as progress on this project, at an ordinary meeting of the AyA Board of Directors, a public-private partnership agreement (convenio de alianza pública/privada) was signed with the developer Místico de Playa. The agreement provides for the construction of public works that will supply the Development Project and neighboring communities, thereby supplying the current population without creating capacity to supply new urban developments. It was stated that the project would be completed within 14 months after the agreement was signed. With respect to the water analysis for the second half of 2021, the Área Rectora de Salud de Parrita del Ministerio de Salud received a water analysis; however, it did not include iron and manganese values, information on water quality, or information on the maintenance provided to the water tanks placed in the community to supply potable water, and this information was requested by official letter.
It was therefore determined that no information had been submitted regarding the condition of the potable-water tanks. Consequently, the Área Rectora de Salud de Parrita del Ministerio de Salud issued health order N° MS-DRRSPC-DARSPA-OS-058-2022 of August 08, 2022, ordering the submission of a report on the actions undertaken to maintain and sanitize the potable-water tanks placed in the communities; the submission of the N1 analyses for the three points in the distribution network and for the potable-water tanks placed at various locations in the communities supplied by the system; and the submission of a progress report on the actions undertaken in compliance with the Technical Study in Response to health order N° OS-13-2018. Likewise, on September 02, 2022, the administrator of the Unidad Cantonal de Jacó of the Instituto Costarricense de Acueductos y Alcantarillados communicated official letter GSP-RPC-J-2022-00278 to the Área Rectora de Salud de Parrita del Ministerio de Salud.
That letter submitted the requested water analyses and evidence of the actions undertaken to maintain the water tanks placed in the communities and, in response regarding progress on the Technical Study in Response to health order N° OS-13-2018, stated: “The Esterillos-Bejuco potable-water supply system has three supply sources. The 3 sources are wells drilled along one bank of the Río Tulin. The subsoil in this area contains high levels of soluble iron and manganese that are carried by groundwater to the wells. The iron and manganese levels in the water extracted from these wells do not comply with the quality parameters established by national regulations, and it is therefore necessary to seek new alternatives for supplying potable water to the population. Among the alternatives analyzed, it was determined that a public-private partnership under Article 38 of the Ley de Planificación Urbana would be the most appropriate means of resolving the problem faced by the current users of the Esterillos Bejuco system.
On April 13, 2021, the ‘Agreement for the construction and transfer of works, easements (servidumbres), and real property for the project to construct improvements to the aqueduct serving the community of Esterillos y Bejuco in the canton of Parrita, between the Instituto Costarricense de Acueductos y Alcantarillados and Místico Comunidad de Playa’ was signed. The purpose of the project is to convey 32,6 l/s from a well known as Tulín 1, located in Mata de Plátano de Turrubares, to the Esterillos-Bejuco system. According to AyA’s UEN de Gestión Ambiental, the Tulín well has a production capacity of 50 l/s. The property on which the well is located has already been donated to AyA by the developer, as has the access easement to the property. The property’s real-property folio is PRN01, its cadastral-plan (plano catastro) number is SJ-2247227-2020, and its area is 900 m2. The developer Místico is currently preparing the plans, which must be submitted to AyA for approval.
These plans include the infrastructure necessary to convey the water to the Esterillos Bejuco system. The works include a well pumping station, a disinfection station, and a transmission pipeline (tubería de conducción). The developer itself will be responsible for constructing all the works specified in the plans once they have obtained the construction permits required under national law (CFIA, SETENA, among others). According to the timetable approved for the Agreement, the project is expected to be completed by the end of 2023. It is anticipated that, upon completion of the Agreement, AyA will be able to begin using water from Tulín 1 to supply the Esterillos Bejuco system.” Subsequently, on February 27, 2023, the Proceso de Regulación de la Salud conducted an inspection in the communities, as recorded in visual-inspection report (acta de inspección ocular) N° DARSPA-NGC-017-2023. During the inspection, a random sample of residents in the communities supplied by this system was questioned, with the following results: a resident of Bejuco stated that they had water-supply problems and that, when the water did arrive, it looked like mud; a person in Condominio Costa Sol stated that during the summer they had experienced problems due to a lack of water and that the water arrived dirty; in Málaga, residents stated that their water inlet valve had been shut off and that the flow rate (caudal) had fallen from 8 l/s to between 0,5 l/s and 2 l/s (the internal piping in the homes was inspected and, when opened, no water came out); a resident of Esterillos Este stated that there was little water and that it sometimes came out brown; residents of Esterillos Centro stated that they received water, but that it often arrived dirty; and residents of Esterillos Oeste stated that they had little water, that it arrived dirty, and that they had to get up before dawn to obtain clean water.
Accordingly, on March 14, 2023, a meeting of the Comisión Municipal de Emergencias was held, at which it was agreed to convene a meeting concerning the potable-water problem in Esterillos, inviting the AyA regional manager, the administrator of AyA Parrita, the administrator of AyA Jacó, the director of the Ministerio de Salud Parrita, two representatives of CCE Bejuco, CCCI de Parrita, the head of operations of the Comisión Nacional de Emergencias, the administrator of ASADA Loma Bandera, the territorial board of directors, and Mr. Herberth González of INDER. A request was also sent to the official liaison of the Comisión Nacional de Emergencias seeking a declaration of a cantonal emergency due to the potable-water problem in Esterillos. Subsequently, on April 18, 2023, 2023 health order N° MS-DRRSPC-DARSPA-OS-037-2023 was served on the administrator of the Esterillos Potable-Water Supply System network, ordering her to do the following: “Submit an action plan specifying the activities, the person responsible, and the deadline for supplying potable water, in accordance with the parameters established in the Reglamento para la Calidad del Agua Potable, to the communities served through the household supply system, as well as the short-term actions required to ensure the quantity, quality, safety, and accessibility of the service provided to the communities through the installed tank system.” Therefore, on May 22, 2023, the Unidad Cantonal de Jaco of ICAA communicated Memorandum N° GSP-RPC-J2023-00196 to the Área Rectora de Salud de Parrita, identifying the following measures for the Action Plan to comply with the health order: “1.
The Public-Private Partnership signed by AyA with the developer Místico is scheduled for completion in December of this year; that project will install the outlet pipeline from the Tulín 1 well at the intersection with the Costanera, where AyA is currently arranging for the installation of the additional pipeline needed to convey the water to the Esterillos system. The institution must then make the corresponding improvements to establish the interconnection up to the well site where the Esterillos supply sources are located. 2. The Tulín 1 well under the Partnership will make it possible to supply current users with quality water, but not to meet new demand; that demand will be met by the Tulín 2 well, which is in the drilling stage as a possible alternative for a public-private partnership. 3.
Studies conducted on the aquifers (mantos acuíferos) from the Tulín bridge toward Parrita have indicated that they contain elevated levels of iron and manganese and, therefore, the water that makes it possible to supply the community of Esterillos with chlorinated drinking-quality water must be brought in from other aquifers.” Thus, that document concludes that “the water currently supplied to users of the Esterillos system cannot be chlorinated and, therefore, as the population has been informed since the system was taken over, water from the network is not for drinking or cooking; hence the installation of storage tanks throughout the system. The permanent solution to the quality of the water provided through the system will be achieved upon completion of the works contemplated in the public-private partnership (Alianza público-privada) currently being implemented, for which the person responsible at the regional level is the Director (…) together with the Deputy Management Office for Peripheral Systems.
There is an alternative solution submitted in AyA’s Project Portfolio, and the Deputy Management Office for Environment and the Research and Development Department are evaluating new alternative solutions.” Accordingly, on 14 de junio de 2023, the Área Rectora de Salud de Parrita issued sanitary order (orden sanitaria) N° MS-DRRSPC-DARSPA-OS-077-2023, with a compliance deadline of 31 de enero del 2024, ordering the following: “1. The developer must have drinking-water supply system (sistema de abastecimiento de agua potable) works in place. 2. Submit an action plan for continuing the project to interconnect the Esterillos water-supply system.” In response, on 16 de febrero de 2024, the Unidad Cantonal de Jaco of ICAA sent the Área Rectora de Salud de Parrita document N° GSP-RPC-J-2024-00058, stating that it had not been possible to comply with the work schedule established for fulfillment of the public-private partnership specified in sanitary order N° MS-DRRSPC-DARSPA-077-2023 and indicating that: “1.
It is reported that the partnership signed in abril del 2023 as the ‘Agreement for the construction and transfer of works, easements (servidumbres), and real property for the project to construct improvements to the water-supply system of the community of Esterillos and Bejuco in the canton of Parrita, between the Instituto Costarricense de Acueductos y Alcantarillados and Místico Comunidad de Playa’ expired, and not all tasks in the work schedule could be completed. 2. A new partnership that would make it possible to complete the progress made under the previous one is currently being evaluated and studied by both participants, for which meetings are being scheduled, as indicated by the Regional Directorate. Therefore, an extension of the deadline under that sanitary order is requested, on the understanding that work is under way on a new partnership and that notice will be provided once it has been signed by both parties.” Thus, through sanitary order N° MS-DRRSPC-DARSPA-OS-0056- 2024 of 02 de abril de 2024, the Área Rectora de Salud de Parrita ordered María Alejandra Mora Segura, General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, to “Submit an action plan detailing the activities, the person responsible, and the deadline for providing drinking water, in accordance with the parameters established in the Reglamento para Calidad de Agua Potable, to the communities supplied through the household water-supply system,” within 20 business days, expiring on 02 de mayo de 2024.
Consequently, through TECHNICAL INSPECTION REPORT MS-DRRSPC-DARSPA-IT-0264-2024 of 27 de junio de 2024, the official responsible for the Health Regulation Process of the Área Rectora de Salud de Parrita informed the director of that Área Rectora as follows: “Subject: Actions by the Área Rectora de Salud de Parrita in response to the drinking-water problem affecting the Esterillos System, administered by the AyA cantonal office in Jacó (…) Based on the foregoing, it is determined that these communities are not being supplied with drinking water and that water is not being provided continuously or in sufficient quantity to meet people’s needs, nor at the pressure required to allow the plumbing fixtures in use to function properly (…) On 20 de mayo del 2024, the Área Rectora de Salud de Parrita received an Excel database containing information on AyA processes, indicating that a response had been provided to the Minister of the Ministerio de Salud through official letter GG-2024-00967, which stated: ‘This concerns an order issued to the Oficina Cantonal de Jaco, which manages the Esterillos system that supplies the communities of Esterillos Oeste, Esterillos Centro, Esterillos Este, and Bejuco.
The Convenio Místico had been signed, which made it possible to make progress on drilling the Pozo Tulín 1; the land containing the well and its protection zone (zona de protección) was transferred to AyA; a right-of-way easement (servidumbre de paso) was registered in favor of AyA to provide access to the well; and an electrical-network easement (servidumbre de red eléctrica) was registered in favor of ICE. A new agreement is currently being negotiated for the construction of hydraulic infrastructure to provide a solution to the water-quality problem affecting the communities of Esterillos and Bejuco; therefore, an implementation schedule cannot yet be established, since it depends on progress on that agreement.’ CONCLUSION: The Área Rectora de Salud de Parrita has conducted a process since 2018, with continuous follow-up, to ensure that action is taken so that drinking water is provided through this water-supply system’s distribution network to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro, and Bejuco.” In summary, as of that latest inspection technical report of 27 de junio de 2024, both the ICAA and the corresponding Health Governing Area verified that the concentrations of iron and manganese in the water from that system exceeded the parameters established in the Reglamento para la Calidad del Agua Potable; likewise, the water did not meet the residual chlorine (cloro residual) parameter. In other words, it was indeed verified that the water supplied by that system was not potable.
Subsequently, in febrero de 2025, the Parrita Health Governing Area received water analyses performed in setiembre del 2024, the results of which showed that, although iron and manganese levels in the wells exceeded the permitted values, the iron and manganese levels in the distribution network complied with the parameters of the regulations; nevertheless, residual chlorine levels were below those permitted under national regulations, and it was therefore determined that the corresponding administrative act (acto administrativo) would be issued. Thereafter, on 10 de marzo de 2025, the Parrita Health Governing Area received laboratory analyses performed in enero del año 2025, which showed that the iron and manganese levels in the well were higher than those established in the regulations; nevertheless, because the water was mixed with water from springs (nacientes), the levels in the network complied with the parameters established in the Reglamento para la Calidad del Agua Potable; however, residual chlorine levels continued to be below those established in national regulations.
In conclusion, those last two water analyses determined that, although iron and manganese levels in the wells exceeded the permitted values, the iron and manganese levels in the distribution network complied with the parameters of the regulations. Thus, they complied with the parameters established in the Reglamento para la Calidad del Agua Potable. However, residual chlorine levels were below those permitted under national regulations, and it was therefore determined that the corresponding administrative act would be issued. Accordingly, it was established that the residual chlorine parameter was still not being met.
Nevertheless, notwithstanding the latest findings regarding iron and manganese levels, the latest technical report of the Laboratorio Nacional de Aguas, No. PRE-LNA-2025-00282 of 11 de marzo del 2025, cited by both the Deputy Manager for Peripheral Systems Management and the Jaco Cantonal Chief, both from the Instituto Costarricense de Acueductos y Alcantarillados, stated as follows: “Based on the LNA methodology for obtaining annual system-quality data, the quality of the water supplied by the PC-A-28 Esterillos de Parrita system in the year 2024 was determined. After reviewing the most recently available data, from enero 2025, we find that the PC-A-28 Esterillos de Parrita system is not potable, according to data from the year 2024, due to noncompliance regarding E. coli, iron, and manganese, in addition to having remained unchlorinated during the first three quarters of 2024. Chlorination was implemented in the system beginning in Setiembre 2024; nevertheless, the data recorded in 2025 indicate that the free-chlorine concentration is not being maintained within the range prescribed by regulation 38924-S, which supports the conclusion that the PC-A-28 Esterillos de Parrita system supplies water of non-potable quality according to data from 2024 and 2025.” In other words, this latest report concludes that the parameters for E. coli, iron, and manganese have not been met, nor is the free-chlorine concentration being maintained within the range prescribed by regulation 38924-S, which supports that conclusion regarding the PC-A-28 Esterillos de Parrita system. Consequently, the water quality is not potable according to data from 2024 and 2025.
Therefore, in light of this divergence of opinions between the Parrita Health Governing Area and the Instituto Costarricense de Acueductos y Alcantarillados, this Court finds it established that the concentrations of iron and manganese in the water from that system exceed the parameters established in the Reglamento para la Calidad del Agua Potable; likewise, the water does not meet the residual chlorine parameter. In other words, it was indeed verified that the water supplied by that system is not potable. This finding is based on the following: a) since the year 2018, multiple reports have verified that the concentrations of iron and manganese exceed the parameters established in the Reglamento para la Calidad del Agua Potable (for example, Memorandum N° GSP-RPC-J2023-00196 of 22 de mayo de 2023; the INSPECTION TECHNICAL REPORT MS-DRRSPC-DARSPA-IT-0264-2024 of 27 de junio de 2024, issued by the officer responsible for the Health Regulation Process of the Parrita Health Governing Area, which established “that these communities are not being supplied with potable water”; as well as multiple water analyses conducted since the year 2018 by the Parrita Health Governing Area of the Ministerio de Salud); b) the technical report of the Laboratorio Nacional de Aguas No. PRE-LNA-2025-00282 of 11 de marzo del 2025 is the most recent report; and c) this Chamber must place greater emphasis on the possibility that there is, in fact, a latent danger associated with the quality of the water supplied to the population of that community, and therefore applies the precautionary principle (principio precautorio), which requires the adoption of immediate and effective measures to prevent irreparable harm, for the purpose of preventing health problems among the population. Accordingly, the technical position that protects the health of the population must be preferred.
Accordingly, this Court reiterates that it finds it established that the concentrations of E. coli, iron, and manganese in the water from that system exceed the parameters established in the Reglamento para la Calidad del Agua Potable; likewise, the water does not meet the residual chlorine parameter. In other words, it was indeed verified that the water supplied by that system is not potable. Consequently, it is reiterated that the ICAA authorities have failed to fulfill their constitutional duty to guarantee the health of the inhabitants of that community and the proper functioning of public services.
VIII.Regarding the sanitary orders (órdenes sanitarias). As analyzed in the preceding recital (considerando), the Parrita Health Governing Area issued five sanitary orders concerning the water quality in the system at issue: - sanitary order N° OS-013-2018 of 15 de febrero de 2019; - sanitary order N° MS-DRRSPC-DARSPA-OS-058-2022 of 08 de agosto de 2022; - sanitary order N° MS-DRRSPC-DARSPA-OS-037-2023 of 18 de abril de 2023; - sanitary order N° MS-DRRSPC-DARSPA-OS-077-2023 of 14 de junio de 2023; - sanitary order N° MS-DRRSPC-DARSPA-OS-0056- 2024 of 02 de abril de 2024.
In this regard, as previously established, the Parrita Health Governing Area has conducted a proceeding since the year 2018, with continuous follow-up, to ensure that measures are taken so that potable water is supplied through this aqueduct’s distribution system to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro, and Bejuco. However, as established in the preceding recital, it has been verified that the concentrations of E. coli, iron, and manganese in the water from that system exceed the parameters established in the Reglamento para la Calidad del Agua Potable; likewise, the water does not meet the residual chlorine parameter. In other words, it was indeed verified that the water supplied by that system is not potable.
For the foregoing reasons, this Court finds a violation of the petitioner’s fundamental rights attributable to the Parrita Health Governing Area because, in application of the principle of coordination in environmental matters (principio de coordinación en materia ambiental), it must coordinate with the Instituto Costarricense de Acueductos y Alcantarillados so that the population of that community may have access to potable water service in accordance with the parameters established in recital VI of this judgment concerning the right to consume potable water.
IX.Conclusion. In view of the foregoing, it is established that the quantity and supply of water are insufficient and that its quality for consumption is deficient in the system supplying the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro, and Bejuco. It is therefore determined that these communities are not being supplied with potable water and that water is not being provided continuously and in sufficient quantities to meet people’s needs. Accordingly, the appropriate course is to grant the petition (recurso).
X.Partial dissenting opinion (voto salvado parcial) of Justice Garro Vargas concerning the operative portion of this judgment. Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the forum in which the enforcement phase of this matter should be conducted, due to the absence of adequate mechanisms under the rules governing this constitutional jurisdiction for monitoring compliance with a judgment involving highly complex technical matters, as in this case, so that immediately upon notification of this judgment, the corresponding administrative acts are issued to remedy the quality of the water resources of the aqueduct supplying the community of Esterillos, in order to comply with the provisions of the Reglamento de Control de Calidad de Agua, such that, within six months from notification of this judgment, those measures are fully underway.
Likewise, during that period, water quality must be guaranteed through distribution by tanker trucks or other appropriate measures to minimize the shortage of potable water in the community. Similarly, through some provisional alternative, a sufficient daily supply of potable water to meet the population’s basic needs must be guaranteed immediately whenever service is interrupted for periods exceeding eight hours. By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (artículo 155 and following) offer clear advantages, such as the possibility of requesting schedules, imposing fines, assigning responsibility, monitoring stages of compliance, and so forth. Therefore, pursuant to artículo 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, such items must be collected from the court within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.
Por tanto:
The application is granted. Pamela María Castro Leitón, in her capacity as Deputy Manager of Peripheral Systems Management, and Yaneth Valverde Salas, in her capacity as Cantonal Head of Jaco, both of the Instituto Costarricense de Acueductos y Alcantarillados, as well as Mary Denisse Munive Angermuller, in her capacity as Minister of Health, or whoever may hold those offices in their stead, are ordered to immediately establish all coordination mechanisms falling within their respective areas of authority in order to: a) Ensure that the infrastructure development and water potability assurance projects for the water resources supplied by the ICAA to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro and Bejuco receive technical support from the health authorities; b) Ensure that the Ministerio de Salud follows up on the health orders (órdenes sanitarias) issued, the most recent being health order N° MS-DRRSPC-DARSPA-OS-0056- 2024 of 02 de abril de 2024, and, if appropriate, establishes new provisions so that, within the time limits established in the corresponding health orders and within a maximum period of twenty-four months from notification of this judgment, the ICAA provides drinking-water service with guaranteed potability and continuity of service; c) Ensure that the ICAA complies with the health orders issued in accordance with the time limits specified by the Ministerio de Salud in the respective health orders, so that, within the aforementioned maximum period of twenty-four months from notification of this judgment, drinking-water service is provided to the communities of Esterillos Oeste, Esterillos Este, Esterillos Centro and Bejuco under the terms stated above.
The respondent authorities are warned that failure to comply with the aforementioned orders shall constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an application for constitutional relief (recurso de amparo), which that person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados and the State are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in the administrative litigation proceedings. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that it be carried out before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded so that proceedings to enforce this ruling may be initiated. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintiuno de marzo de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre02, cédula de identidad NFP01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y EL MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. El recurrente reclama violación a sus derechos fundamentales, pues señala que vive en Esterillos Oeste y desde el 2006 cuenta con instalación de agua en su propiedad; no obstante, actualmente ha tenido un problema continuo con el suministro de agua en su casa, por lo que pasa horas sin recibir una sola gota. Asegura que está enfermo, por lo que requiere del servicio de agua. De esa forma, ha acudido al Instituto Costarricense de Acueductos y Alcantarillados para denunciar el faltante de agua en su casa, pero a la fecha esa institución no ha realizado ninguna gestión para solventar el problema. Agrega que en el ICAA le han indicado que hay tanques de agua, pero afirma que por su condición de salud no puede estar cargando un balde de agua a más de un kilómetro de distancia. Además, no indican la hora ni la calle donde estará la cisterna. Igualmente, esas cisternas no están en condiciones adecuadas de suministrar agua. Añade que el agua que consumen en esa comunidad no es potable.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
- Sobre la continuidad y cantidad del agua potable del sistema:
El servicio con el camión cisterna se da de forma inversa a la sectorización que se esté realizando de modo que, si Esterillos Oeste es el sistema que por la mañana no tiene servicio es al que se le brinda el servicio de cisterna y viceversa con respecto a Esterillos Este y Centro, así como Bejuco, y se mantienen los tanques llenos con cisterna (ver los informes rendidos y la prueba aportada).
Dicha iniciativa fue analizada y aceptada por la Subgerencia de Sistemas Periféricos en su momento y se eleva ante la Dirección de Planificación, para ser conocida por el Comité de directores de Proyectos con oficio SG-GSP-2021-01023 de fecha 10 de agosto del 2021 (ver los informes rendidos y la prueba aportada).
- Sobre la calidad del agua potable del sistema:
Propuesta de acción: a. Ubicación de tanques en distintos puntos de la red (Escuela Esterillos Oeste, Escuela Esterillos Centro, Escuela Bejuco, Gasolinera La Cruz del Sur, Esterillos Oeste, Super Sol Esterillos Oeste, Condominio Málaga Bejuco y Dirección02), los cuales contarán con agua potable, que se llenarán por medio de camiones cisterna. b. Adquisición de terreno identificado que cuenta con dos pozos (Pozos Columbus 1 y 2) e implementar esta agua al sistema, en un lapso largo de tiempo. c. Realizar campaña de comunicación a la población de que el agua no es potable y que para consumo se estará distribuyendo agua por medio de los camiones cisterna en los tanques instalados en las comunidades”. Así, se aprueba el plan de acciones propuestas, pero, se solicita se indique tiempo de cumplimiento para contar con este nuevo sistema (ver los informes rendidos y la prueba aportada).
Dentro de las alterativas que se analizaron se determinó que una alianza público-privada de acuerdo con el artículo 38 de la Ley de Planificación Urbana resultaría la más adecuada para solucionar la problemática de los usuarios actuales del sistema de Esterillos Bejuco. El 13 de abril del 2021 se firmó el “Convenio para la construcción y traspaso de obras, servidumbres e inmuebles para el proyecto de construcción de mejoras para el acueducto de la comunidad de Esterillos y Bejuco del cantón de Parrita, entre el instituto Costarricense de Acueductos y Alcantarillados y Místico Comunidad de Playa”. El proyecto tiene como fin trasladar 32,6 l/s de un pozo conocido como Tulín 1, ubicado en Mata de Plátano de Turrubares, hasta el sistema Esterillos-Bejuco. El pozo Tulín tiene una capacidad de producción de 50 l/s según UEN de Gestión Ambiental del AyA, el terreno donde se ubica el pozo ya fue donado por el desarrollador al AyA, así como la servidumbre de acceso al terreno, el folio real de la propiedad es PRN01 con número de plano catastro SJ-2247227-2020 y un área de 900 m2.
En la actualidad el desarrollador Místico se encuentra en la etapa de confección de los planos, los cuales deben ser presentados al AyA para su visto bueno. Estos planos incluyen la infraestructura necesaria para conducir el agua hasta el sistema de Esterillos Bejuco, dentro de las obras se incluye: una estación de bombeo del pozo, estación de desinfección y tubería de conducción. El mismo desarrollador será el encargado de construir todas las obras indicadas en los planos una vez que estos hayan cumplido con los permisos constructivos requeridos por la legislación nacional (CFIA, SETENA, entre otros). Según el cronograma que se aprobó para el Convenio se espera que el proyecto esté finalizado a finales del año 2023, es de esperarse que para la finalización del Convenio el AyA podrá empezar a utilizar el agua de Tulín 1 para el abastecimiento del sistema de Esterillos Bejuco” (ver los informes rendidos y la prueba aportada).
Los estudios que se han realizado a los mantos acuíferos desde el puente Tulín hacia Parrita han indicado que mantienen niveles elevados de hierro y manganeso y por tanto, el agua que permite abastecer a la comunidad de Esterillos de agua de calidad potable y clorada se debe traer de otros mantos acuíferos”. Así, en dicho documento se concluye que “el agua que actualmente se suministra a los usuarios del sistema de Esterillos no se puede clorar y, por tanto, como se le ha indicado a la población desde que se asumió el sistema el agua de la red no es para beber o cocinar; por eso la instalación de los tanques de almacenamiento en todo el sistema. Que la solución definitiva a la calidad de agua que se brinda en el sistema se va a solucionar con la finalización de obras que contemplan la Alianza público- privada que está en ejecución y que el responsable a nivel regional es el Director (…) junto con la Sub-Gerencia de Sistemas Periféricos.
Existe una alternativa de solución presentado en la Cartera de Proyectos de AyA, quien, a través de la Subgerencia de Ambiente, la Investigación y Desarrollo están valorando nuevas alternativas de solución” (ver los informes rendidos y la prueba aportada).
Se había firmado Convenio Místico, con lo cual se logró avanzar en la perforación del Pozo Tulín 1, se traspasó el terreno del pozo y zona de protección a favor de AyA, se inscribió servidumbre de paso a favor de AyA para acceso al pozo y servidumbre de red eléctrica a favor del ICE. Actualmente, se está negociando un nuevo convenio para la construcción de infraestructura hidráulica, para llevar solución de calidad de agua a la Comunidad de Esterillos y Bejuco; por lo que aún no se puede definir un cronograma de ejecución, ya que depende del avance de dicho convenio.” CONCLUSIÓN: Se ha llevado un proceso por parte del Área Rectora de Salud de Parrita desde el año 2018 y con seguimientos continuos, con el fin de que se tomen acciones para que se brinde agua potable por medio del sistema de distribución de este acueducto a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco” (ver los informes rendidos y la prueba aportada).
IV.Sobre el derecho a consumir agua potable. Este Tribunal Constitucional ha reconocido en su jurisprudencia que el derecho a la vida y a la salud son derechos fundamentales cuyo goce exige el acceso al agua potable. Para que el ser humano disfrute de salud requiere que se le garanticen un conjunto de condiciones mínimas necesarias para alcanzar un adecuado y armónico equilibrio psíquico, físico y ambiental, así como para impedir el surgimiento de disfunciones que alteren su pleno crecimiento y desarrollo. Una de esas condiciones es precisamente el suministro de agua apta para el consumo humano. Por lo que esta Sala ha concluido que, como parte del Derecho de la Constitución, existe un derecho fundamental al suministro de agua potable. Así, en Sentencia N° 2003-04654, de las 15:44 horas del 27 de mayo del 2003, reiterada en la N° 2018-014649, de las 9:20 horas del 7 de setiembre de 2018, esta Sala resolvió: “(…) La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario.
En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que: "Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos". Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos”.
V.Antecedente ante este Tribunal. Previo del análisis del presente asunto, es importante mencionar que esta Sala Constitucional ya analizó las condiciones del servicio de agua en el acueducto de Esterillos. Así, mediante 2018-021434 de las 09:20 horas del 21 de diciembre de 2018, dictada dentro del expediente no. 18-018889-0007-CO, se estableció lo siguiente:
“IV.- Sobre el caso concreto. En el presente caso, de las pruebas aportadas al expediente, así como, de lo informado bajo juramento por las autoridades del Instituto recurrido, se constata que ha existido una amenaza ilegítima al derecho a la salud de la persona amparada y demás miembros de la comunidad de Esterillos, así como una violación a su derecho al buen funcionamiento de los servicios públicos y, al acceso al agua potable. De los autos se desprende que el Instituto Costarricense de Acueductos y Alcantarillados es la entidad responsable de brindar el servicio de agua potable a la comunidad afectada la cual, a la fecha no ha logrado solventar el problema gestado. Es más, desde el 22 de diciembre de 2016, fecha en que asumió el acueducto, el Instituto recurrido ha realizado diversos estudios, con el fin de establecer una solución a la problemática de la concentración de hierro y manganeso que presenta el sistema de Esterillos- Bejuco, lo que produce una coloración oscura en el agua, lo cual, según lo indicado por el Encargado del Laboratorio Nacional de Aguas del Instituto "....la suma de las concentraciones de Hierro y Manganeso, no cumplen con el Reglamento para la Calidad del Agua Potable 38924-8, lo cual afecta la estética del agua y el rechazo visual por parte de los usuarios del Acueducto.
No obstante, es importante aclarar que el consumo del agua no causa ningún daño a la Salud". De manera, que si bien el agua que se distribuye no es perjudicial para la salud, lo cierto es que no cumple con el Reglamento para Calidad de Agua Potable. Así las cosas, han transcurrido dos años y el Instituto recurrido no ha sido capaz de resolver el problema del acueducto, ni de presentar las medidas correctivas necesarias que garanticen un adecuado funcionamiento de este implemento, pese a que en las pruebas emitidas por el Laboratorio Nacional de Aguas, son contudentes al respecto. Así las cosas, lleva razón la recurrente en cuanto a la calidad del agua que le es abastecida por la autoridad recurrida. En virtud de lo anterior, las autoridades del AyA han omitido su deber constitucional de garantizar la salud de los habitantes de esa comunidad y el buen funcionamiento de los servicios públicos.
Estos principios constitucionales deben ser observados y respetados, en todo momento y sin excepción alguna, por los funcionarios públicos encargados de su gestión y prestación y constituyen una obligación jurídica de carácter indeclinable, impuesta a cualquier ente u órgano administrativo por su eficacia normativa directa e inmediata, habida cuenta que el bloque o parámetro de legalidad (artículo 11, de la Constitución Política) al que deben ajustarse en sus actuaciones está integrado, entre otros elementos, por los principios generales del derecho administrativo (artículo 6, de la Ley General de la Administración Pública). En mérito de lo expuesto, debido a la vulneración prolongada del derecho fundamental al agua potable y a un servicio público eficiente, lo procedente es declarar con lugar el recurso y, en consecuencia, ordenar al Instituto recurrido implementar las mejoras correspondientes en el sistema de acueducto que administra y abastece a las diferentes comunidades de Esterillos, y se ajuste a lo ordenado en el Reglamento de Control de Calidad de Agua.
Lo anterior, incluye tomar las medidas necesarias con el fin de disminuir el grado de riesgo, para la salud de la población, y vulnerabilidad de los sistemas, así como dar una vigilancia continua a la calidad del agua potable que consumen los habitantes de la comunidad afectada, para cuyo efecto también deberá el Instituto recurrido realizar los trabajos para garantizar la calidad del recurso hídrico de mantenimiento que ese acueducto requiera. Además, se le recuerda a la recurrida que cuando se presenta el problema denunciado, debe asegurar la repartición de agua potable con camiones cisterna en la zona.
(…) Por tanto: Se declara CON LUGAR el recurso. Se ordena a Yamilette Astorga Espeleta, y a Sirlene Jiménez Aguilar, por su orden, Presidenta Ejecutiva y Encargada la Unidad Cantonal de Jacó-Región Pacífico Central, ambas funcionarias del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen dichos cargos, que en FORMA INMEDIATA a la notificación de esta sentencia se avoquen a dictar los actos administrativos correspondientes para solventar la calidad del recurso hídrico del acueducto que abastece a la comunidad de Esterillos, a fin de ajustarse a lo dispuesto en el Reglamento de Control de Calidad de Agua, de modo que en el plazo de SEIS meses contado a partir de la notificación de esta sentencia, dichas acciones se encuentren plenamente en ejecución. Asimismo, en el transcurso de dicho plazo deberá de garantizar la calidad del agua, a través del reparto mediante camiones cisterna u otras medidas pertinentes, para disminuir al máximo la carencia del agua potable en la comunidad.
Se le advierte a las recurridas, que de no acatar las ordenes dichas, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Hernández López pone nota. Notifíquese en forma personal a Yamilette Astorga Espeleta, y a Sirlene Jiménez Aguilar, por su orden, Presidenta Ejecutiva y Encargada la Unidad Cantonal de Jacó-Región Pacífico Central, ambas funcionarias del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen dichos cargos”.
VI.Sobre la continuidad y cantidad del agua potable del sistema. Después de analizar los elementos probatorios aportados, este Tribunal verifica la violación a los derechos fundamentales del recurrente en cuanto a este punto. Lo anterior, porque en los informes rendidos por los representantes de las autoridades recurridas -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el sistema que abastece a la comunidad de Esterillos Este, Oeste, Centro y Bejuco y que es administrada por la Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados, presenta comportamientos atípicos normalmente que se acentúan en la época de verano, en el que la producción y la demanda en la zona para abastecer a los usuarios resulta insuficiente; por cuanto, se presentan factores como son: a.-) la baja en la producción de la Naciente llamada Memo Vega que apoya el sistema y está ubicada en Playa Hermosa; b.-) el aumento estacional de la población que utiliza el servicio, ya que por tratarse de zona costera, es destino de turistas para vacacionar; c.-) en ocasiones el sistema se afecta por cortes no programados por la falta de fluido eléctrico en el sistema de abastecimiento que es 100% pozos (se cuenta con tres pozos ) y el remanente de la naciente que depende de la producción se traslada al sistema de Esterillos; situación enfrentada el pasado 17 de marzo 2024, que por la sustitución del trifásico dañado se hizo más larga la atención del daño; d.-) trabajos realizados por la Municipalidad que interfieren la normal prestación del servicio y que no están contemplados, tal fue el caso del pasado 21 de marzo y que se resolvió de inmediato con la colaboración de la misma municipalidad, pero que eso provocó retraso en que les llegara a los vecinos de Esterillos Este y Bejuco el servicio.
Así, respecto al desabastecimiento, en aras de que la población tengan acceso al agua potable, la Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados ha adoptado y ejecutado las siguientes acciones y maniobras: a.-) la zona de Esterillos se mantiene con agua potable para consumo de la población por medio de tanques que están ubicados desde el año 2017 en diferentes puntos del sistema; pues el agua que les llega a su domicilio es para labores domésticas por los niveles de hierro y manganeso; razón por la cual no se factura el consumo a ningún usuario y se abastece de agua potable por medio de los 12 tanques en diferentes puntos del sistema de distribución, para el año 2024, además del cisterna que mantiene el llenado diario de los tanques, se ha dado el servicio de agua potable con un segundo cisterna y vehículos tipo pick up con tanques de 1000 litros para repartir en las zonas donde el cisterna se le dificulta el acceso. b.-) debido al alto consumo en la zona y con fundamento en los indicadores de presiones del sistema y caudales que se miden en la producción del sistema a diferentes horas, se tomó la decisión de sectorizar el servicio, esto desde el mes de febrero con el fin de que en las mañanas se le brinde el servicio a un sector y por las tardes a otro.
El servicio con el camión cisterna se da de forma inversa a la sectorización que se esté realizando de modo que, si Esterillos Oeste es el sistema que por la mañana no tiene servicio es al que se le brinda el servicio de cisterna y viceversa con respecto a Esterillos Este y Centro, así como Bejuco, y se mantienen los tanques llenos con cisterna. Además, la Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados tiene planteada una solución integral para la problemática de los tres sistemas que se atienden con la naciente Memo Vega, en cuanto a la calidad (exceso de hierro y manganeso), así como la cantidad y la continuidad del servicio mediante nuevas fuentes de abastecimiento, componentes de tanques para almacenamiento y mejoras de infraestructura hidráulica, proponiendo establecer los lineamientos de priorización para el desarrollo de los planes maestros, con el propósito de que sean implementados por la Dirección de Control, Planes y Proyectos, proporcionando una visión integral y a largo plazo de las metas, objetivos y acciones requeridas para lograr el éxito de la alternativa y garantizar a la población actual y futura una solución sostenible en el tiempo, considerando el ciclo de vida del proyecto, el cual se inicia con la iniciativa de la necesidad por resolver y atender, que fue presentada por la Dirección de la Región Pacífico Central con oficio GSP-RPC-2021- 00732 de fecha 9 de agosto del 2021, el cual se denomina “Perfil de proyecto para abastecer los sistemas de Quebrada Amarilla, Playa Hermosa y Esterillos”, donde se detalla los alcances del mismo, como su objetivo principal de identificar y desarrollar un estudio de factibilidad, diseño y construcción que permita obtener nuevas fuentes de abastecimiento de calidad potable para consumo humano, logrando así integrar los tres sistemas de acueductos, garantizando calidad, cantidad y continuidad de los demandantes del servicio actual y potencial.
Dicha iniciativa fue analizada y aceptada por la Subgerencia de Sistemas Periféricos en su momento y se eleva ante la Dirección de Planificación, para ser conocida por el Comité de directores de Proyectos con oficio SG-GSP-2021-01023 de fecha 10 de agosto del 2021. Asimismo, el 23 de marzo de 2023, el Proceso de Regulación de la Salud emitió informe técnico N° MS-DRRSPC-DARSPA-IT-0133-2023, en el cual se expone la problemática por falta de agua potable en los hogares de las personas de las comunidades de Esterillos Oeste, Esterillos Centro, Esterillos Este y Bejuco. En ese informe se indica lo siguiente: “(…) desde inicios del año 2019 hasta ahora se ha mantenido este sistema y aún estas comunidades no cuentan con abastecimiento de agua potable en sus hogares, teniendo que desplazarse a los puntos con los tanques indicados para contar con este recurso. De lo anterior, se determina que, en las comunidades pueden presentarse casos que dificulten la movilidad de las personas y que desplazarse diariamente genere limitaciones, por ejemplo, en el caso de adultos mayores, personas con discapacidad, personas con afecciones a la salud que les limite realizar esta acción, lo cual repercutiría también en la salud de ellos (…)”.
Igualmente, mediante INFORME TÉCNICO DE INSPECCIÓN MS-DRRSPC-DARSPA-IT-0264-2024 del 27 de junio de 2024, el encargado del Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita le comunicó al director de esa Área Rectora lo siguiente: “ (…) De lo anterior, se determina que estas comunidades no están siendo abastecidas por agua potable y que no se está brindando en forma continua y cantidad suficiente para satisfacer las necesidades de las personas y con presión necesaria para permitir el correcto funcionamiento de los artefactos sanitarios en uso (…)”. Por último, según el informe técnico No. GSP-RPC-PA-2025-00074 del 12 de marzo del 2025 de la Unidad Cantonal AyA Parrita, se estableció lo siguiente: “Con relación a la continuidad y cantidad del agua potable del sistema PC-A-28 que abastece a las comunidades de Esterillos y Bejuco, por los efectos que provoca la época seca impide dar un servicio continúo debido a que los pozos no producen el volumen de agua requerido, por lo que se han realizado mejoras en el sistema de Quebrada Amarilla, con el fin de sacar a la comunidad de Quebrada Amarilla de la ecuación, y utilizar la producción de la naciente de Memo Vega con el fin de trasegar agua a la comunidad de Playa Hermosa y Esterillos.
Ante esta situación se aplica la sectorización, es decir quitar el servicio de agua en ciertas horas en parte de la comunidad de Esterillos y Bejuco con el fin de que los sistemas de recuperen y se pueda trasegar el agua hasta las zonas más alta de la comunidad; lo anterior siempre informando a la comunidad por los medios oficiales de AyA, así como las cisternas instaladas en puntos estratégicos, con el fin de que la comunidad tenga acceso al agua potable cuando la época seca afecta la producción de los pozos, y por ende no permite dar un servicio continuo, es por esto que la tarifa que se cobra actualmente en el sector de Esterillos y Bejuco corresponde a la tarifa especial; tarifa solicitada mediante el memorando No. GSP-RPC-2017-00202 por el funcionario William Chaves Soto el día 13 de junio de 2017 aplicada mediante el artículo 97 del Reglamento para la Prestación de los Servicios de Acueductos y Alcantarillados AR-PSAYA-2013, y con base al memorando No.GSP-RPC-J-2017-00278 realizado por el funcionario e ingeniero Bernal Sancho el día 8 de junio de 2017 en el que informa que el agua que abastece a Esterillos y Bejuco contiene niveles de hierro y manganeso que sobrepasan los límites para la calidad del agua potable, por esa razón se cobra una tarifa fija para toda la comunidad, siendo así que no se contempla los metros cúbicos consumidos mensualmente por lo tanto se factura con los de cargos fijos de hidrantes, tarifa fija de agua y protección del recurso hídrico. en consecuencia, los usuarios de la comunidad Esterillos y Bejuco según la tarifa indicada en línea anteriores han pagado mensualmente una tarifa fija de ¢2000 colones más cargo fijo de hidrantes y protección de recurso hídrico, siendo la tarifa desde el sistema OPEN “EM1 Esp. Sin Calidad. Residencial”; manteniéndose hasta la fecha”.
En resumen, se constata que el sistema que abastece a la comunidad de Esterillos Este, Oeste, Centro y Bejuco y que es administrada por la Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados, presenta comportamientos atípicos normalmente que se acentúan en la época de verano, en el que la producción y la demanda en la zona para abastecer a los usuarios resulta insuficiente. Al respecto, y en aras de que la población tenga acceso al agua potable, la Sucursal cantonal de Jaco del Instituto Costarricense de Acueductos y Alcantarillados ha adoptado y ejecutado varias acciones y maniobras como es mantener agua potable para consumo de la población por medio de tanques que están ubicados desde el año 2017 en diferentes puntos del sistema. Así, se abastece de agua potable por medio de los 12 tanques en diferentes puntos del sistema de distribución, para el año 2024, además de la cisterna que mantiene el llenado diario de los tanques, se ha dado el servicio de agua potable con un segundo cisterna y vehículos tipo pick up con tanques de 1000 litros para repartir en las zonas donde el cisterna se le dificulta el acceso.
Igualmente, se tomó la decisión de sectorizar el servicio, con el fin de que en las mañanas se le brinde el servicio a un sector y por las tardes a otro. El servicio con el camión cisterna se da de forma inversa a la sectorización que se esté realizando de modo que, si Esterillos Oeste es el sistema que por la mañana no tiene servicio es al que se le brinda el servicio de cisterna y viceversa con respecto a Esterillos Este y Centro, así como Bejuco, y se mantienen los tanques llenos con cisterna.
De ese modo, efectivamente existe un desabastecimiento del sistema, debido a la producción y la demanda en la zona para abastecer a los usuarios resulta insuficiente. Ahora bien, ante esta situación, el Instituto Costarricense de Acueductos y Alcantarillados ha realizado acciones como tener cisternas y tanques a lo largo de la comunidad. Además, se ha sectorizado el servicio. En todo caso, aunque se han realizado acciones tendientes a minimizar el problema del desabastecimiento, lo cierto es que no existe claridad sobre una solución integral a este problema. Lo anterior, pues si bien es cierto se menciona varios proyectos para darle una solución integral a este problema, también es cierto que a la fecha no se tiene claridad respecto a los plazos sobre cuándo se llevaría a cabo esos proyectos y para cuándo tendrían una implementación definitiva. Nótese que ese problema de desabastecimiento se ha dado por lo menos desde el 2017, por lo que no es aceptable que a la fecha no existe claridad sobre una solución integral a dicho problema.
En este sentido, se verifica que las autoridades del ICAA han omitido su deber constitucional de garantizar la salud de los habitantes de esa comunidad y el buen funcionamiento de los servicios públicos. Estos principios constitucionales deben ser observados y respetados, en todo momento y sin excepción alguna, por los funcionarios públicos encargados de su gestión y prestación y constituyen una obligación jurídica de carácter indeclinable, impuesta a cualquier ente u órgano administrativo por su eficacia normativa directa e inmediata, habida cuenta que el bloque o parámetro de legalidad (artículo 11, de la Constitución Política) al que deben ajustarse en sus actuaciones está integrado, entre otros elementos, por los principios generales del derecho administrativo (artículo 6, de la Ley General de la Administración Pública). En mérito de lo expuesto, debido a la vulneración prolongada del derecho fundamental al agua potable y a un servicio público eficiente.
VII.Sobre la calidad del agua potable del sistema. Por otra parte, el recurrente reclama que el agua que consumen en esa comunidad no es potable. Sobre este punto, ha sido debidamente demostrado que, en el año 2018, correspondiente al análisis de agua del primer semestre, en el Área Rectora de Salud de Parrita del Ministerio de Salud se reciben los análisis de agua del sistema de abastecimiento de agua Esterillos, correspondiente al I semestre de ese año, en el cual se tiene como resultado que el nivel de concentración de Hierro y manganeso sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable. Posterior a estos resultados, en el Área Rectora de Salud de Parrita del Ministerio de Salud se recibe denuncia, en la cual se indica que en Esterillos el agua no es potable y tiene coliformes fecales, ante lo que se determina en inspección que el agua no cumple con el parámetro de cloro residual al realizar pruebas en viviendas, y por análisis realizados anteriormente, se conoce que se presenta problema de hierro y manganeso en el sistema.
Dado los resultados encontrados, el Área Rectora de Salud de Parrita del Ministerio de Salud ordena, por medio de la orden sanitaria N° OS-013-2018 del 15 de febrero de 2019, mantener la cloración del agua en el sistema con valores entre 0,2 a 0,6 mg/L. Así, el 04 de marzo de 2019, se recibe ante el Área Rectora de Salud de Parrita el estudio técnico para respuesta a orden sanitaria N° OS-013-2018, del Ing. Rafael Barboza Tooping, del Instituto Costarricense de Acueductos y Alcantarillados, en el cual se indica los siguientes puntos: “1. Se estipula que por parte del Instituto Costarricense de Acueductos y Alcantarillados que el clorar el agua empeora y más bien deteriora aún más la calidad de esta; ya que, por la oxidación del hierro y manganeso produce en el agua un sabor, olor y color indeseable. 2. Las manchas causadas por el hierro y manganeso, rojizas, cafés correspondientemente no son eliminadas por el detergente. 3.
Que el agua contaminada con hierro y manganeso usualmente contienen bacterias de hierro y manganeso, las cuales no causan problemas de salud. 4. Por los puntos anteriores, se considere la no cloración del agua y para evitar el riesgo a la población se provea agua por medio de camiones cisterna, con el fin de que el agua que llega a las viviendas sea utilizable en más actividades no correspondientes al consumo. 5. Propuesta de acción: a. Ubicación de tanques en distintos puntos de la red (Escuela Esterillos Oeste, Escuela Esterillos Centro, Escuela Bejuco, Gasolinera La Cruz del Sur, Esterillos Oeste, Super Sol Esterillos Oeste, Condominio Málaga Bejuco y Dirección02), los cuales contarán con agua potable, que se llenarán por medio de camiones cisterna. b. Adquisición de terreno identificado que cuenta con dos pozos (Pozos Columbus 1 y 2) e implementar esta agua al sistema, en un lapso largo de tiempo. c. Realizar campaña de comunicación a la población de que el agua no es potable y que para consumo se estará distribuyendo agua por medio de los camiones cisterna en los tanques instalados en las comunidades”.
Así, se aprueba el plan de acciones propuestas, pero, se solicita se indique tiempo de cumplimiento para contar con este nuevo sistema. Posteriormente, el 22 de febrero de 2021, el Área Rectora de Salud de Parrita del Ministerio de Salud solicita, por medio de oficio MS-DRRSPC-DARSPA-0059- 2021, que se brinde informe con avance de las acciones realizadas para el cumplimiento de lo programado. De ese modo, mediante oficio N° GSP-RPC-J-2021-00071 del 08 de marzo del 2021, en el cual se indica que como avance a este proyecto en sesión ordinaria de la Junta Directiva del AyA se firma convenio de alianza pública/privada con el desarrollador Místico de Playa, con el cual se contempla la construcción de obra pública que permita abastecer el Proyecto del Desarrollo y a las comunidades aledañas, con el cual se abastecería la población actual y no generaría capacidad para abastecer nuevos desarrollos urbanísticos, se indica que una vez firmado el convenio se tendría en 14 meses ejecutado el proyecto.
Respecto al análisis de agua del segundo semestre del año 2021, en el Área Rectora de Salud de Parrita del Ministerio de Salud se recibe análisis de agua; no obstante, no adjuntan valores de Hierro y Manganeso, ni información de la calidad del agua, ni el mantenimiento brindado a los tanques de agua que se han colocado en la comunidad para brindar agua potable y se solicita información vía oficio. Por ende, se determina que no se presentó información correspondiente a la condición de tanques de agua potable. Por lo tanto, el Área Rectora de Salud de Parrita del Ministerio de Salud emitió orden sanitaria N° MS-DRRSPC-DARSPA-OS-058-2022 del 08 de agosto de 2022, en la cual se ordena presentar informe de acciones realizadas para el mantenimiento e higiene de los tanques de agua potable colocados en las comunidades, presentar los análisis N1 de los tres puntos de red de distribución y los tanques de agua potable colocados en varios puntos de las comunidades que abastece el sistema, presentar un avance de las acciones realizadas en cumplimiento al estudio Técnico para Respuesta de la orden Sanitaria N° OS-13-2018.
Igualmente, el 02 de setiembre de 2022, la administradora de la Unidad Cantonal de Jacó, del Instituto Costarricense de Acueductos y Alcantarillados le comunicó al Área Rectora de Salud de Parrita del Ministerio de Salud el oficio GSP-RPC-J-2022-00278, en donde se presentan los análisis de agua solicitados, pruebas de las acciones realizadas en el mantenimiento de los tanques de agua colocados en las comunidades y como respuesta al avance del estudio Técnico para Respuesta de la orden Sanitaria N° OS-13-2018 se indica que: “El sistema de abastecimiento de agua potable de Esterillos-Bejuco cuenta con tres fuentes de sistema de abastecimiento. Las 3 fuentes son pozos que se encuentran perforados en una margen del Río Tulin, el subsuelo de este sector presenta altos niveles de Hierro y Manganeso solubles que son arrastrados por las aguas subterráneas hasta los pozos. Los niveles de hierro y manganeso del agua extraída de estos pozos incumplen los parámetros de calidad de la reglamentación nacional y por lo tanto es necesario buscar nuevas alternativas para abastecer de agua potable a la población.
Dentro de las alterativas que se analizaron se determinó que una alianza público-privada de acuerdo con el artículo 38 de la Ley de Planificación Urbana resultaría la más adecuada para solucionar la problemática de los usuarios actuales del sistema de Esterillos Bejuco. El 13 de abril del 2021 se firmó el “Convenio para la construcción y traspaso de obras, servidumbres e inmuebles para el proyecto de construcción de mejoras para el acueducto de la comunidad de Esterillos y Bejuco del cantón de Parrita, entre el instituto Costarricense de Acueductos y Alcantarillados y Místico Comunidad de Playa”. El proyecto tiene como fin trasladar 32,6 l/s de un pozo conocido como Tulín 1, ubicado en Mata de Plátano de Turrubares, hasta el sistema Esterillos-Bejuco. El pozo Tulín tiene una capacidad de producción de 50 l/s según UEN de Gestión Ambiental del AyA, el terreno donde se ubica el pozo ya fue donado por el desarrollador al AyA, así como la servidumbre de acceso al terreno, el folio real de la propiedad es PRN01 con número de plano catastro SJ-2247227-2020 y un área de 900 m2.
En la actualidad el desarrollador Místico se encuentra en la etapa de confección de los planos, los cuales deben ser presentados al AyA para su visto bueno. Estos planos incluyen la infraestructura necesaria para conducir el agua hasta el sistema de Esterillos Bejuco, dentro de las obras se incluye: una estación de bombeo del pozo, estación de desinfección y tubería de conducción. El mismo desarrollador será el encargado de construir todas las obras indicadas en los planos una vez que estos hayan cumplido con los permisos constructivos requeridos por la legislación nacional (CFIA, SETENA, entre otros). Según el cronograma que se aprobó para el Convenio se espera que el proyecto esté finalizado a finales del año 2023, es de esperarse que para la finalización del Convenio el AyA podrá empezar a utilizar el agua de Tulín 1 para el abastecimiento del sistema de Esterillos Bejuco”. Posteriormente, el 27 de febrero de 2023, se realiza inspección en comunidades por parte de Proceso de Regulación de la Salud, según consta en el acta de inspección ocular N° DARSPA-NGC-017-2023, durante la cual se hacía consulta en un muestreo aleatorio de las comunidades abastecidas por este sistema con la cual se tiene como resultado que en vivienda de persona en Bejuco se indica que tienen problemas de abastecimiento de agua y cuando llega es como barro, con persona en Condominio Costa Sol indica que en verano tuvieron problemas por falta de agua y que les llegaba sucia, en Málaga nos indican que les cerraron la llave de entrada de agua y que caudal paso de 8 l/s a un caudal de 0,5 l/s a 2 l/s (se hace revisión en tubería interna de viviendas y al abrirla no sale agua), en vivienda en Esterillos Este indican que tiene poca agua y sale en ocasiones café, en Esterillos Centro indican que les llega agua; pero, que llega muchas veces sucia y en Esterillos Oeste indican que tienen poca agua, les llega sucia y para poder tener agua limpia madrugan.
Así, el 14 de marzo del 2023 se realiza reunión de la Comisión Municipal de Emergencias en la cual se acuerda convocar a reunión por problemática de agua potable en Esterillos invitando al encargado regional del AyA, la administradora del AyA Parrita, a la Administradora del AyA Jacó, director del Ministerio de Salud Parrita, dos representantes del CCE Bejuco, CCCI de Parrita, jefe de operaciones de la Comisión Nacional de Emergencias, administradora de la ASADA Loma Bandera, a la junta directiva territorial y al señor Herberth González del INDER. Y se envía solicitud al enlace oficial de la Comisión Nacional de Emergencias para la solicitud de declaración de emergencia cantonal la problemática de agua potable en Esterillos. Subsiguientemente, el 18 de abril de 2023, se notificó la 2023 orden sanitaria N° MS-DRRSPC-DARSPA-OS-037-2023 hacia la Administradora de la red del Sistema de Abastecimiento de Agua Potable de Esterillos, con la que se le ordena lo siguiente: “Presentar un plan de acciones, con el detalle de actividades, encargado y plazo, para brindar agua potable, según los parámetros establecidos en el Reglamento para la Calidad del Agua Potable, a las comunidades abastecidas por medio del sistema de abastecimiento domiciliar y las acciones a corto plazo para asegurar la cantidad, calidad, seguridad y accesibilidad del servicio a las comunidades por medio del sistema de tanque colocados”.
Por lo tanto, el 22 de mayo de 2023, la Unidad Cantonal de Jaco del ICAA le comunicó al Área Rectora de Salud de Parrita el Memorando N° GSP-RPC-J2023-00196, en el que se indica como medidas para el Plan de Acción para el cumplimiento de la orden sanitaria los siguientes puntos: “1. La Alianza Público-Privada firmada por el AyA con el desarrollador Místico que está para finalizar en el mes de diciembre del presente año; dicho proyecto deja instalada la tubería de salida del pozo Tulín 1 en la intersección de la costanera donde el AyA actualmente está tramitando la instalación de la tubería adicional para llevar el agua al sistema de Esterillos. Posteriormente la institución debe realizar las mejoras que corresponden para hacer la interconexión hasta el punto de pozos donde se ubica las fuentes de abastecimiento de Esterillos. 2. El pozo Tulín 1 de la Alianza permitirá abastecer a los actuales usuarios con agua de calidad no así a nuevas demandas; estas estarán siendo cubiertas con el pozo Tulín 2 que está en etapa de perforación para una posible alternativa de alianza público/privada. 3.
Los estudios que se han realizado a los mantos acuíferos desde el puente Tulín hacia Parrita han indicado que mantienen niveles elevados de hierro y manganeso y, por tanto, el agua que permite abastecer a la comunidad de Esterillos de agua de calidad potable y clorada se debe traer de otros mantos acuíferos”. Así, en dicho documento se concluye que “el agua que actualmente se suministra a los usuarios del sistema de Esterillos no se puede clorar y, por tanto, como se le ha indicado a la población desde que se asumió el sistema el agua de la red no es para beber o cocinar; por eso la instalación de los tanques de almacenamiento en todo el sistema. Que la solución definitiva a la calidad de agua que se brinda en el sistema se va a solucionar con la finalización de obras que contemplan la Alianza público- privada que está en ejecución y que el responsable a nivel regional es el Director (…) junto con la Sub-Gerencia de Sistemas Periféricos.
Existe una alternativa de solución presentado en la Cartera de Proyectos de AyA, quien, a través de la Subgerencia de Ambiente, la Investigación y Desarrollo están valorando nuevas alternativas de solución”. De ese modo, el 14 de junio de 2023, el Área Rectora de Salud de Parrita emitió la orden sanitaria N° MS-DRRSPC-DARSPA-OS-077-2023, con plazo de cumplimiento al día 31 de enero del 2024, con la que se ordena: “1. Contar con obras del sistema de abastecimiento de agua potable por parte del desarrollados. 2. Presentar plan de acciones para la continuación de proyecto de interconexión del sistema de acueducto de Esterillos”. Ante esto, el 16 de febrero de 2024, la Unidad Cantonal de Jaco del ICAA le comunicó al Área Rectora de Salud de Parrita el documento N° GSP-RPC-J-2024-00058, en el cual se indica que no fue posible cumplir con el cronograma de trabajo establecido para el cumplimiento de la Alianza pública privada establecida en la orden sanitaria N° MS-DRRSPC-DARSPA-077-2023 y se indica que: “1.
Se informa que dicha alianza firmada en abril del 2023 como “Convenio para la construcción y traspaso de obras, servidumbres e inmuebles para el proyecto de construcción de mejoras para el acueducto de la comunidad de Esterillos y Bejuco del cantón de Parrita, entre el instituto Costarricense de Acueductos y Alcantarillados y Místico Comunidad de Playa se venció y no se lograron concretas todas las tareas del cronograma de trabajo. 2. Se encuentra en la etapa de valoración y estudio por ambos participantes una nueva Alianza que permita finalizar los avances de la anterior, para lo cual se está en programación de reuniones, según se indica en la Dirección Regional. Por lo tanto, se solicita la ampliación de plazo de dicha orden sanitaria en el entendido de que se está trabajando en una nueva Alianza y se estará informando una vez que se encuentre firmada por ambas partes”. Así, mediante orden sanitaria N° MS-DRRSPC-DARSPA-OS-0056- 2024 del 02 de abril de 2024, el Área Rectora de Salud de Parrita, en la cual se le ordena a María Alejandra Mora Segura, Gerente General del Instituto Costarricense de Acueductos y Alcantarillados “Presentar un plan de acciones, con el detalle de actividades, encargado y plazo, para brindar agua potable, según los parámetros establecidos en el Reglamento para Calidad de Agua Potable, a las comunidades abastecidas por medio del sistema de abastecimiento domiciliar”, esto, en el plazo de 20 días hábiles y con vencimiento el 02 de mayo de 2024.
Por ende, mediante INFORME TÉCNICO DE INSPECCIÓN MS-DRRSPC-DARSPA-IT-0264-2024 del 27 de junio de 2024, el encargado del Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita le comunicó al director de esa Área Rectora lo siguiente: “Asunto: Acciones por parte del Área Rectora de Salud de Parrita en atención de problemática de Agua Potable del Sistema de Esterillos, administrado por la oficina cantonal del AyA, Jacó (…) De lo anterior, se determina que estas comunidades no están siendo abastecidas por agua potable y que no se está brindando en forma continua y cantidad suficiente para satisfacer las necesidades de las personas y con presión necesaria para permitir el correcto funcionamiento de los artefactos sanitarios en uso (…) El día 20 de mayo del 2024, se recibe ante el Área Rectora de Salud de Parrita, base Excel con información de procesos correspondientes al AyA, en la cual se indica que se dio respuesta a la ministra, del Ministerio de Salud por medio del oficio GG-2024-00967, en el cual se indicó que: “Corresponde a una orden generada a la Oficina Cantonal de Jaco, que maneja el sistema de Esterillos que abastece las Comunidades Esterillos Oeste, Centro, Este y Bejuco.
Se había firmado Convenio Místico, con lo cual se logró avanzar en la perforación del Pozo Tulín 1, se traspasó el terreno del pozo y zona de protección a favor de AyA, se inscribió servidumbre de paso a favor de AyA para acceso al pozo y servidumbre de red eléctrica a favor del ICE. Actualmente, se está negociando un nuevo convenio para la construcción de infraestructura hidráulica, para llevar solución de calidad de agua a la Comunidad de Esterillos y Bejuco; por lo que aún no se puede definir un cronograma de ejecución, ya que depende del avance de dicho convenio.” CONCLUSIÓN: Se ha llevado un proceso por parte del Área Rectora de Salud de Parrita desde el año 2018 y con seguimientos continuos, con el fin de que se tomen acciones para que se brinde agua potable por medio del sistema de distribución de este acueducto a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco”.
En resumen, hasta ese último informe técnico de inspección del 27 de junio de 2024, se comprobó, tanto por el ICAA como por el Área Rectora de Salud correspondiente, que el nivel de concentración de Hierro y manganeso en el agua de ese sistema sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable; igualmente, el agua no cumple con el parámetro de cloro residual. Es decir, sí se comprobó que la calidad de agua de ese sistema no es potable.
Ahora bien, posteriormente, en febrero de 2025, en el Área Rectora de Salud de Parrita se reciben análisis de agua realizados en el mes de setiembre del 2024, en cuyos resultados se observa que, aunque en pozos se sobrepasa valor de hierro y manganeso, en la red de distribución se cuenta con valores de hierro y manganeso cumpliendo con parámetros del reglamento; no obstante, se tiene valores de cloro residual menores a lo permitido en la normativa nacional, por lo que se determina que se realizará el correspondiente acto administrativo. Subsiguientemente, el 10 de marzo de 2025, en el Área Rectora de Salud de Parrita se reciben análisis de laboratorio, realizados el mes de enero del año 2025 en los cuales se observa que valores de hierro y manganeso en pozo son mayores a lo establecido en reglamento; no obstante, por mezcla que se realiza con aguas de nacientes, en red se tienen que cumplen con parámetros establecidos en el Reglamento para la Calidad del Agua Potable; sin embargo, el valor de cloro residual continua con valores menores a lo establecido en la normativa nacional.
En conclusión, en esos dos últimos análisis de agua se determinó que, aunque en pozos se sobrepasa valor de hierro y manganeso, en la red de distribución se cuenta con valores de hierro y manganeso cumpliendo con parámetros del reglamento. Así, se tienen que cumplen con parámetros establecidos en el Reglamento para la Calidad del Agua Potable. Sin embargo, se tiene valores de cloro residual menores a lo permitido en la normativa nacional, por lo que se determina que se realizará el correspondiente acto administrativo. De ese modo, se constata que todavía no cumple con el parámetro de cloro residual.
No obstante, a pesar de lo último constatado sobre los valores de hierro y manganeso, en el último informe técnico del Laboratorio Nacional de Aguas No. PRE-LNA-2025-00282 del 11 de marzo del 2025, al cual hacen referencia tanto la subgerente de Gestión de Sistemas Periféricos como el jefe cantonal de Jaco, ambos del Instituto Costarricense de Acueductos y Alcantarillados, se estableció lo siguiente: “Basados en la metodología del LNA para la obtención de los datos anuales de calidad de los sistemas, se determina la calidad el agua aportada por el sistema PC-A-28 Esterillos de Parrita en el año 2024, revisados los datos disponibles más actualizados, de enero 2025, tenemos que el sistema PC-A-28 Esterillos de Parrita, es No potable, según datos del año 2024, con incumplimientos en E coli, Hierro, Manganeso además de que fue No clorado los primeros tres trimestres del 2024. A partir de Setiembre 2024 se implementó la cloración en el sistema, no obstante, los datos registrados en el 2025 indican que no se está manteniendo la concentración de cloro libre en el ámbito dictado por el reglamento 38924-S, lo que permite concluir que el sistema PC-A-28 Esterillos de Parrita, entrega calidad de agua No potable según datos 2024 y 2025”.
Es decir, de este último informe se concluye que no se ha cumplido con los parámetros de E coli, Hierro, Manganeso ni es está manteniendo la concentración de cloro libre en el ámbito dictado por el reglamento 38924-S, lo que permite concluir que el sistema PC-A-28 Esterillos de Parrita. Por consiguiente, la calidad del agua no es potable según datos 2024 y 2025.
Por lo tanto, ante esta divergencia de criterios entre el Área Rectora de Salud de Parrita y el Instituto Costarricense de Acueductos y Alcantarillados, este Tribunal tiene por comprobado que el nivel de concentración de Hierro y manganeso en el agua de ese sistema sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable; igualmente, el agua no cumple con el parámetro de cloro residual. Es decir, sí se comprobó que la calidad de agua de ese sistema no es potable. Esto, por lo siguiente: a) desde el año 2018 múltiples informes han comprobado que el nivel de concentración de Hierro y manganeso sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable (por ejemplo, Memorando N° GSP-RPC-J2023-00196 del 22 de mayo de 2023, el INFORME TÉCNICO DE INSPECCIÓN MS-DRRSPC-DARSPA-IT-0264-2024 del 27 de junio de 2024 del encargado del Proceso de Regulación de la Salud del Área Rectora de Salud de Parrita en donde se estableció “que estas comunidades no están siendo abastecidas por agua potable”, así como múltiples análisis de agua desde el año 2018 del Área Rectora de Salud de Parrita del Ministerio de Salud; b) el informe técnico del Laboratorio Nacional de Aguas No. PRE-LNA-2025-00282 del 11 de marzo del 2025 es el informe más reciente; c) esta Sala debe considerar con mayor énfasis la posibilidad de que exista, de hecho, un peligro latente asociado con la calidad del agua que abastece a la población de esa comunidad, por lo que se atiende el principio precautorio que establece la adopción de medidas inmediatas y efectivas para prevenir daños irreparables con la finalidad de prevenir problemas de salud en la población. Así, debe preferirse la posición técnica que protege la salud de la población.
De ese modo, se reitera que este Tribunal tiene por demostrado que el nivel de concentración de E coli, Hierro y manganeso en el agua de ese sistema sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable; igualmente, el agua no cumple con el parámetro de cloro residual. Es decir, sí se comprobó la calidad de agua de ese sistema no es potable. Por consiguiente, se reitera que las autoridades del ICAA han omitido su deber constitucional de garantizar la salud de los habitantes de esa comunidad y el buen funcionamiento de los servicios públicos
VIII.Sobre las órdenes sanitarias. Ahora bien, tal y como se analizó en el considerando anterior, el Área Rectora de Salud de Parrita emitió cinco órdenes sanitarias respecto a la calidad del agua en el sistema en cuestión: - orden sanitaria N° OS-013-2018 del 15 de febrero de 2019; - orden sanitaria N° MS-DRRSPC-DARSPA-OS-058-2022 del 08 de agosto de 2022; - orden sanitaria N° MS-DRRSPC-DARSPA-OS-037-2023 del 18 de abril de 2023; - orden sanitaria N° MS-DRRSPC-DARSPA-OS-077-2023 del 14 de junio de 2023; - orden sanitaria N° MS-DRRSPC-DARSPA-OS-0056- 2024 del 02 de abril de 2024.
Al respecto, tal y como se constató anteriormente, se ha llevado un proceso por parte del Área Rectora de Salud de Parrita desde el año 2018 y con seguimientos continuos, con el fin de que se tomen acciones para que se brinde agua potable por medio del sistema de distribución de este acueducto a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco. Sin embargo, según lo establecido en el considerando anterior, se verifica que el nivel de concentración de E coli, Hierro y manganeso en el agua de ese sistema sobrepasa los parámetros establecidos en el Reglamento para la Calidad del Agua Potable; igualmente, el agua no cumple con el parámetro de cloro residual. Es decir, sí se comprobó la calidad de agua de ese sistema no es potable.
Por lo anterior, este Tribunal constata una lesión a los derechos fundamentales del recurrente respecto al Área Rectora de Salud de Parrita, pues, en aplicación del principio de coordinación en materia ambiental, debe coordinar con el Instituto Costarricense de Acueductos y Alcantarillados para que población de esa comunidad pueda acceder a un servicio de agua potable según los parámetros establecidos en el considerando VI de esta sentencia respecto al derecho a consumir agua potable.
IX.Conclusión. En virtud de lo expuesto, se constata una insuficiente cantidad y suministro de agua, así como una deficiente calidad de la misma para consumo, esto en el sistema que abastece a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco. Por ende, se determina que estas comunidades no están siendo abastecidas por agua potable y que no se está brindando en forma continua y cantidad suficiente para satisfacer las necesidades de las personas. De esa forma, lo procedente es declarar con lugar el recurso.
X.Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en forma inmediata a la notificación de esta sentencia se avoquen a dictar los actos administrativos correspondientes para solventar la calidad del recurso hídrico del acueducto que abastece a la comunidad de Esterillos, a fin de ajustarse a lo dispuesto en el Reglamento de Control de Calidad de Agua, de modo que en el plazo de seis meses contado a partir de la notificación de esta sentencia, dichas acciones se encuentren plenamente en ejecución.
Asimismo, en el transcurso de dicho plazo deberá de garantizar la calidad del agua, a través del reparto mediante camiones cisterna u otras medidas pertinentes, para disminuir al máximo la carencia del agua potable en la comunidad. Igualmente, de forma inmediata, garanticen a través de alguna alternativa provisional, el suministro diario suficiente de agua potable para suplir las necesidades básicas de la población, cuando la interrupción del servicio sea por periodos de más ocho horas. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Pamela María Castro Leitón, en su condición de subgerente de Gestión de Sistemas Periféricos, y a Yaneth Valverde Salas, en su condición de jefe cantonal de Jaco, ambas del Instituto Costarricense de Acueductos y Alcantarillados, así como a Mary Denisse Munive Angermuller, en su condición de ministra de Salud, o a quienes en sus lugares ocupen esos cargos, que establezcan de inmediato todas las instancias de coordinación que se encuentren dentro de sus respectivos ámbitos de competencia, para: a) Que los proyectos de desarrollo de infraestructura y garantía de potabilidad del recurso hídrico que suministre el ICAA en las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco cuente con el acompañamiento técnico de las autoridades de Salud; b) Que el Ministerio de Salud brinde seguimiento a las órdenes sanitarias dictadas, siendo la última la orden sanitaria N° MS-DRRSPC-DARSPA-OS-0056- 2024 del 02 de abril de 2024, y si es del caso, establezca nuevas disposiciones para que dentro de los plazos que se establezcan en las órdenes sanitarias correspondientes, y en un plazo máximo de veinticuatro meses contado a partir de la notificación de esta sentencia, el ICAA brinde el servicio de agua potable en un marco de garantía de potabilidad y continuidad del servicio; c) Que el ICAA deberá cumplir con las órdenes sanitarias dictadas de conformidad con los plazos señalados por el Ministerio de Salud en las respectivas órdenes sanitarias, para que en el referido plazo máximo de veinticuatro meses contado a partir de la notificación de esta sentencia, se esté brindando a las comunidades de Esterillos Oeste, Esterillos Este, Esterillos Centro y Bejuco el servicio de agua potable en los términos señalados.
Se le advierte a las recurridas, que de no acatar las ordenes dichas, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
