Document Review Decision No. 2025007718 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on March fourteen, two thousand twenty-five.
Writ of amparo (recurso de amparo) filed by Nombre02, identity card NFP03, on behalf of Nombre06, identity card NFP01, and Nombre03, against the MINISTRY OF ENVIRONMENT AND ENERGY (MINAE).
Findings:
He states that implementation of the project entails the daily extraction of 2000 cubic meters of material, with estimated reserves of 18.718.841 cubic meters, resulting in projected operations lasting 374 months, equivalent to 31 years, with long-term environmental impacts. Regarding this first claim, the appellant is incorrect, since the data he cites do not correspond to the recommendations for granting the prospective concession set forth in memorandum DGMCRC2-014-2024 dated 04 de abril del 2024, signed by the Regional Mining Coordinator for Central Region 2; for purposes of this claim, it is appropriate to cite points 18, 19 and 20: 18.- Calculation of reserves. Without a swelling or expansion factor, the volume is 9, 541, 062,29 m3. With a swelling or expansion factor, the volume is 11 926 327,86 m3. 19.- Term stated in the Application for a Quarry Operating Concession (Solicitud de Concesión de Explotación de Cantera), appearing at folio 24, Volume I of the Digital Case File: 25 years. 20.- Proposed extraction rate (estimated production): Not specified.
It is therefore calculated by considering the proposed term of 25 years and the calculated volume of reserves, yielding an annual extraction rate of 381,642.4916 m3/year or 31,803.54 m3/month, without considering the expansion or swelling factor. Therefore, the data provided are far removed from the actual operating program and recommendations, since daily extraction would amount to approximately 1060 cubic meters rather than the 2000 cubic meters claimed; estimated reserves with a swelling factor would be 11 926 327,86 cubic meters, as opposed to the stated figure of 18.718.841 cubic meters, and the term to be granted during the first, ordinary-term stage would be 25 years, as opposed to the 31 years stated by the appellant. Likewise, and although this matter falls within SETENA’s jurisdiction, he does not specify which long-term environmental impacts he is referring to, since this misrepresents the reality of what a project of this kind entails when properly managed by a concession-holding company or individual who, in accordance with the rules and procedures established in the Mining Code (Código de Minería), its regulations, and other related laws, is able to carry out the project in conjunction with environmental protection. 2-He complains that, with respect to the environmental impact study (estudio de impacto ambiental, EsIA) report, it should be noted that it was prepared in 2017, whereas the procedures for the project began in 2016.
Thus, by the current year, 2024, 8 years have elapsed since the commencement of these procedures for the crushing facility. On this point, environmental assessment (evaluación ambiental) falls within the powers delegated by law to the Secretaría Técnica Nacional Ambiental, and therefore this Directorate does not address this claim; it does note, however, that the decision by which that secretariat granted environmental viability (viabilidad ambiental) to the project is dated 08 de setiembre del año 2022, resolution N° 189-2022-SETENA. In addition, the granting recommendations with which the applicant company must fully comply (should its mining title be granted) are dated 04 de abril del año 2024. It is also worth noting that, under mining regulations, every application for a mining concession (concesión minera) must begin processing before this Directorate of Geology by submitting an application to reserve the area; subsequently, once the area has been correctly located in the National Mining Cadastre (Catastro Nacional Minero), the application is forwarded to SETENA for the corresponding environmental-assessment procedure. 3-He argues that the project in question will affect several communities, including Río Jesús de San Ramón, Piedra Blanca de San Ramón, La Angostura de San Ramón, Dulce Nombre de San Mateo and Guadalupe de Esparza; however, these communities are unaware of the situation because they have not been properly informed about the project …
On this point, environmental assessment and its various stages fall within the powers delegated by law to the Secretaría Técnica Nacional Ambiental, and therefore this Directorate does not address this claim. 4-He complains that there is no scientific certainty that contamination and damage will not be caused to the Jesús Maria and Dirección01 rivers or that damage will not occur downstream. Nor is there any guarantee that the contamination and sediment generated by the project will not affect the Refugio de Vida Silvestre de Tivives, located at the mouth of that same river, or cause damage to the Golfo de Nicoya or to the coral reefs, fishing grounds, and natural breeding areas for marine species in the Golfo de Nicoya. He states that implementation of this project entails a series of significant environmental impacts that could adversely affect both the natural environment and the surrounding communities.
On this point, the appellant proceeds from assumptions without proving concrete facts, since the project itself does not exist as of today; moreover, quarry or public-domain riverbed concessions (concesiones en cantera o cauces de dominio) have previously been granted throughout the areas he mentions, without causing the harm he alleges would be caused by the project at issue. The granting of a mining concession does not inherently entail environmental harm; regulations exist to ensure that this does not occur, as does a government agency with authority to impose penalties and apply due process (debido proceso), which may lead to the cancellation of concessions whose representatives fail to comply not only with environmental-protection rules but also with the rules governing the mining obligations incumbent upon concession holders throughout the effective term of their concessions and even during the technical-closure period (periodo de cierre técnico).
Not only are such mining projects or mining concessions subject to oversight and monitoring after they are granted, but a series of technical requirements and standards, from both environmental and geological perspectives, must first be met to ensure their proper operation. Nevertheless, this Directorate notes that the matters alleged fall within the powers delegated by law to the Secretaría Técnica Nacional Ambiental, and therefore this Directorate does not address this claim. 5-He warns that, as established in the EsIA, the project reviewed by SETENA is classified as category A, meaning that it is deemed to have High Environmental Impact Significance (Alta Significancia de Impacto Ambiental). He alleges that implementation of the project entails irreparable ecological devastation, ranging from deforestation to the contamination of bodies of water, loss of biodiversity, and alteration of aquifers and natural habitats.
He adds that, according to the EsIA, reforestation will be carried out in the affected areas after 20 years; however, this promise is insufficient and ambiguous, lacking a concrete plan to guarantee the effective restoration of the degraded areas. Moreover, neither the number of trees to be planted nor the methods for mitigating damage in areas that will be rendered unusable by the process, including the use of explosives and machinery, are specified. This Directorate notes that the matters alleged fall within the powers delegated by law to the Secretaría Técnica Nacional Ambiental, and therefore this Directorate does not address this claim. 6-He maintains that, contrary to and inconsistent with the provisions of the EsIA, this project poses a serious threat to the region’s water resources; feet (sic), the use of explosives and heavy machinery to extract material not only alters the topography and soil permeability but also increases the risk of contamination due to the displacement of materials and toxic substances.
He believes that account must be taken of the proximity of two major rivers to the property, as well as the abundance of water networks within it. He states that such material-extraction activities may result in a significant reduction in water quality and availability, affecting both aquatic ecosystems and the human communities that depend on these resources for consumption, agricultural practices, and tourism. Regarding this claim, although these matters fall within the powers delegated by law to the Secretaría Técnica Nacional Ambiental, it is necessary to cite points 13, 14, 15 and 16 of memorandum DGM-CRC2-014-2024 dated 04 de abril del 2024, signed by the Regional Mining Coordinator for Central Region 2, containing the recommendations for granting the prospective concession: 13.- Hydrogeology. “The hydrogeological context of the project area was characterized by Asesorías Geotec S.A. through study AGT-GE-19-050-OF-002, Hydrogeological Study for the Assessment of Aquifer Vulnerability (Estudio hidrogeológico para la valoración de la vulnerabilidad del acuífero), submitted to and approved by the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA.
This study concludes that no aquifer is present in the area.” (…) in official letter SINAC-ACC-OSR-of-537-2024 dated 02 de abril del 2024, signed by the Acting Head of SINAC’s San Ramón subregional office, which stated: It is important to note that there are no legal or technical restrictions on the development of the cited project in the affected area arising from the fact that it is located within the CBMA, other than those already established by current environmental legislation (protection of water-resource protection areas and forests, to mention specific examples contained in that legislation). Nevertheless, a joint working and management approach is recommended through the following recommendations: 1. If roads are opened or improved, consider installing wildlife crossings to facilitate the movement of wild species. 2. If, as part of the project, restoration or reforestation must be carried out at certain sites, consider priority areas within the CB for that purpose. 3.
If the project must implement a compensation mechanism, it is recommended that it be developed or planned jointly with the biological corridor’s local committee, which is willing to collaborate closely to ensure proper management of the CB. The underlining does not appear in the original. Along these lines, it is appropriate to cite Article 8° of the Código de Minería, the relevant portion of the second paragraph of which provides: Mining operations are prohibited in areas declared to be national parks, biological reserves, forest reserves, and state wildlife refuges. In turn, Article 65 of the same body of law provides with respect to nullity: Permits and concessions granted in violation of the law shall be null and void, particularly the following: b) Permits and concessions granted for areas declared to be mining reserves, pursuant to Article 8º of this law. Since the project at issue does not fall within the legal circumstances specified, as of today there is no legal impediment to its prospective approval, provided that the remaining legal requirements are met. 8-He emphasizes that the project area is located within the Corredor Biológico Paso Montes del Aguacate, which is vital to the connectivity of fauna and flora from Monteverde to the Parque Nacional Carara and other protected areas in the south of the country.
Therefore, implementation of the project would seriously disrupt the natural environmental services protected by this corridor; however, this circumstance was not considered in the environmental impact study or in the concessions granted by SETENA and the Dirección de Geología y Minas, both MINAE entities. Consequently, the approved project is environmentally unsustainable and harmful to the affected communities.
With respect to this allegation, although these are powers delegated by law to the Secretaría Técnica Nacional Ambiental, it is necessary to note that, as of today, no concession (concesión) has been granted; therefore, the claimant is incorrect in stating that: this situation was not addressed in the environmental impact study (estudio de impacto ambiental) or in the concessions granted by SETENA and the Dirección de Geología y Minas. This Dirección took the project’s location into account, a matter documented in memorandum DGM-CRC2-014-2024 dated 04 de abril del 2024, signed by the Coordinador Regional Minero de la Región Central 2, concerning the recommendations for granting the prospective concession, as well as in the memorandum cited in the preceding point and sent to SINAC. 9-The claimant alleges that explosives may release toxic gases such as nitrogen oxides and sulfur dioxide, thereby contributing to air, soil, and water pollution, and may cause respiratory problems in both humans and animals.
The claimant notes that, according to the environmental impact study (Estudio de Impacto Ambiental, EsIA), the project in question will use the explosive ANFO, a mixture of ammonium nitrate and diesel fuel, and warns in this regard that the detonation of ANFO produces gases such as nitrogen dioxide (NO2), nitrogen monoxide (NO), and other nitrogen oxides (NOx), which are air, soil, and water pollutants. They may also affect ambient air quality and, depending on their concentration, may adversely affect the health of workers and nearby communities, contributing to respiratory and cardiovascular problems. Regarding this allegation, reference is again made to the contents of memorandum DGM-CRC2-014-2024 dated 04 de abril del 2024, signed by the Coordinador Regional Minero de la Región Central 2, concerning the recommendations for granting the prospective concession: Use of blasting (voladuras): “When necessary to loosen the material, quarry explosives such as ANFO and Lodex, which are safer to handle, will be used.
The use of explosives will be subcontracted to a company with extensive experience in this type of activity to design the blasts and holding a license to handle and use explosives. No explosives will be stored within the quarry area. One company that provides this type of service is Explotec, S.A.” In addition, it should be noted that, when granting a mining concession (concesión minera), the Poder Ejecutivo establishes guidelines for the proper operation of the project, one of which is set forth in Article 93 of regulation N° 43443 of 28 de abril del 2022, which provides: Compliance with the approved technical project. Every permit holder (permisionario) and concession holder (concesionario) is required to comply fully with the provisions of the technical program (Programa técnico) approved for obtaining the permit or concession. Failure to comply constitutes grounds for the DGM to order the suspension of operations or initiate proceedings to cancel the permit or concession, in accordance with Articles 66 and 67 of the Código de Minería, depending on the seriousness of the case.
If previously approved operations are modified, the permit holder or concession holder must submit an addendum to the technical-geological program (Programa técnico–geológico) to the DGM. If the new operations were not contemplated in the approved Environmental Impact Study (Estudio de Impacto Ambiental), the respective amendment to the environmental viability approval (Viabilidad Ambiental) must be submitted. Under no circumstances may the operations be modified without the DGM’s approval of the aforementioned addendum. Failure to comply with the foregoing shall constitute grounds for cancellation of the permit or concession in accordance with Articles 66 or 67 of the Código de Minería, as applicable. Accordingly, in the present case, the Reglamento al Código de Minería is applied in strict adherence to the principle of legality (Principio de Legalidad), established in the Ley General de la Administración Pública, in conjunction with the special mining legislation, given that the general regulations contain various provisions explaining the content and meaning of the term Public Administration (Administración Pública); section 11 of law N° 6227 provides: “1.- The Administración Pública shall act subject to the legal system and may perform only those acts or provide those public services authorized by that system, in accordance with the hierarchy of its sources. 2.- An act expressly regulated by a written provision shall be deemed authorized, at least as to its grounds or content, even if imprecisely.” The Administración Pública and, consequently, the Dirección de Geología y Minas, if the concession in question is granted, must necessarily and imperatively ensure that their actions comply with the body of legality (bloque de legalidad), understood as the entire legal system and not only statutes formally enacted by the Asamblea Legislativa, but also the Special Regulations (Reglamentos Especiales) issued by the Poder Ejecutivo.
The fundamental consequence is that the Administración Pública requires authorization from the legal system in order to act, possessing by law the powers recognized in a Special Regulation, with Reglamento al Código de Minería No. 43443 being the body of regulations to which concession holders are subject for the proper management of their concessions; otherwise, they risk cancellation of the concession if noncompliance with the obligations set forth therein is verified. This is also stated in the final paragraph of Article 1° of the Código de Minería: Concessions shall in no way affect the State’s ownership rights and shall terminate in the event of failure to comply with the legal requirements for maintaining them (…)”.
Additionally, it is important to note that, in the event of a future technical closure (cierre técnico) of the project, before approving such closure, SETENA would verify that it is carried out in accordance with the environmental commitments (compromisos ambientales) undertaken, regardless of how long it takes to fulfill the environmental commitment—here, the Reforestation Plan (Plan de reforestación); and the Developer must keep the ICOS current throughout every stage of the project, including the technical-closure phase for this type of project. ● They claim that the use of explosives and heavy machinery for material extraction not only alters the topography and soil permeability but also increases the risk of contamination through the displacement of materials and toxic substances. As previously stated, the competent entity in this case, SENARA, states as follows in report SENARA-DIGH-UI-INF-037-2021, included in the environmental impact study (Estudio de Impacto Ambiental, EsIA): “…Por tanto Once the hydrogeological study (estudio hidrogeológico) and its annexes, prepared by Geól.
Leonel Rojas Castro for the project submitted on behalf of “(Quebradores Aralfa S.A),” have been reviewed, it is considered that the information submitted meets the requirements established by SENARA. The intrinsic vulnerability classification is low, and both vulnerability and recharge are considered low. It is determined that the activity poses a low threat and, given the low vulnerability, development of the project is permitted. The construction designs and recommendations for protecting groundwater must be strictly observed…” Likewise, the EsIA Annex sets out all measures and protocols that will be implemented for the use of explosives within the project area (área del proyecto, AP). ● They state that it violates the Plan Estratégico de Manejo del Corredor Biológico Montes del Aguacate, Decreto Ejecutivo No.33106-MINAE, because the project entails noise generation through explosives, which affects the behavior patterns of local wildlife, such as the communities.
This point has already been clarified, and the competent entity has already addressed the matter in official letter SINAC-ACC-OSR-of-537-2024 dated 02 de abril del 2024. ● They allege that the project jeopardizes the local economy because the communities identified have experienced growth in tourism and ecotourism activities, and such activities are wholly incompatible with the disruptive nature of the project. Expediente D1-17546-2016-SETENA complied with the legislation governing the Environmental Assessment process (proceso de Evaluación Ambiental), and was therefore granted Environmental Viability (Viabilidad Ambiental). ● They allege that explosives release toxic substances that contaminate the air, soil, and water and may cause respiratory problems in both humans and animals; the EsIA states that ANFO explosive will be used, which produces pollutants in the air, soil, and water and affects the surrounding air quality.
Regarding the use of explosives, the EsIA and its Annex (items 17 through 20 and 30) set out all measures and protocols that will be implemented for the use of explosives, in compliance with the legislation currently governing this matter; moreover, before using them, the Developer must obtain a permit from the Dirección de Geología y Minas and approval from the Ministerio de Seguridad and the Ministerio de Salud. Finally, it is important to note that, in compliance with the environmental regulations governing Environmental Impact Assessment (Evaluación de Impacto Ambiental), the Developer duly published the EsIA in an official newspaper to inform civil society” (…)”.
Justice Araya García drafted the opinion; and,
Considering:
I.Subject matter of the appeal. The appellant claims that he disagrees with the Quebradores Aralfa Piedra Blanca project, identified by case file No. D1 17546-2016-SETENA, based on the following grievances: 1) the environmental viability granted by SETENA and the approval of the project in question by the Directorate of Geology and Mines violate the right to a healthy and ecologically balanced environment; and 2) violation of the right to public participation. He requests an order immediately suspending all activities related to the “Quebrador Aralfa Piedra Blanca” project until a public, participatory consultation inclusive of the affected communities is conducted and full respect for the fundamental rights of the affected communities is ensured, including the right to a healthy environment, public participation, and legality in environmental decision-making processes.
Facts 1, 3, 5, 6, 7, and 8 are rejected. Fact 2 is upheld. The Developer is ordered to comply within 20 business days with the provisions of the Fourth Operative Provision (Por Tanto Cuarto) of Resolution No.1489-2022-SETENA regarding placement of the sign. Fact 4 is partially upheld. Therefore, because the project has not commenced, the Developer is hereby again cautioned: ‘If the removal of any tree is required, the corresponding permit must be processed before the MINAE office, and if surface bodies of water or wells are located within or along the boundaries of the AP, the legislation in force governing protection zones (zonas de protección) must be applied.’ SECOND: The ordinary remedies (recursos ordinarios) of reconsideration (revocatoria) before SETENA and appeal (apelación) before the Ministro de Ambiente, Energía y Telecomunicaciones may be filed against this resolution within three days beginning on the day following notification.
The legal basis is Article 342 of the Ley General Administración Pública and the Ley Orgánica del Ambiente. THIRD: All documentation submitted to SETENA must clearly state the expediente number, the resolution number, and the project’s full name. An email address must also be provided for receiving notifications from this Secretaría. FOURTH: The original digitally signed documents (Digital Signature) will be available to the interested party at http://www.tramites.setena.go.cr, where they must be verified by any interested party and any public or private entity. FIFTH: Pursuant to Article 8 of Ley 8220, an interested party requesting an administrative procedure may not be required to submit certifications or copies of information already held by another institution, in accordance with the legally established means. SIXTH: The result of the discussion and analysis of the matter at hand is: 4 in favor, 0 against, 1 recusal, and 2 absent; detailed information concerning that vote may be consulted in the corresponding minutes, which are held in the custody of this Secretaría and are publicly accessible” (see report and evidence submitted by the respondent authority).
We clarify that this change of plan does not represent a change in the land or site relative to the original plan; therefore, the attached use authorization is correct. 5- The INTA study refers to the property at issue, PRN02, and to plan A-2198823-2020, which is a child plan of A-986936-2005; therefore, there are no inconsistencies in this regard” (see report and evidence submitted by the respondent authority).
Insofar as relevant, the resolution indicated that the referenced area is located within the Corredor Biológico Montes del Aguacate and stated the following in the final point of its seventh recital (considerando): Analysis of Fact 8. It is correct that part of the project is located within the area designated as the Corredor Biológico Montes del Aguacate; however, this category has no protection established by law and is therefore not binding. Conclusion: The reported fact is rejected. Accordingly, the following must be communicated to this Dirección and its Registro Nacional Minero: - whether any legal or technical restrictions exist for developing the referenced project” (see report and evidence submitted by the respondent authority).
In this specific case, the proposed project is located within the boundaries established for the Corredor Biológico Montes del Aguacate. It is important to note that there are no legal or technical restrictions on developing the referenced project in the affected area due to its location within the CBMA, other than those already established under current environmental legislation (protection of water-resource protection areas, forests, to mention specific examples found within that legislation). Nevertheless, a joint work and management approach is recommended through the following measures: 1. If roads are opened or improved, consider installing wildlife crossings to facilitate the movement of wild species. 2. If restoration or reforestation must be undertaken at certain sites as part of the project, consider priority areas within the CB for that purpose. 3. If a compensation mechanism must be implemented as part of the project, it is recommended that it be developed or planned jointly with the biological corridor’s local committee, which is willing to work collaboratively toward proper management of the CB” (see report and evidence submitted by the respondent authority).

Additional recommendations for mitigating and preventing the environmental impact associated with the work to be performed in the concession area. 24.2.a. Road improvement: If the access roads must be improved, the agreement endorsed by the Municipalidad de San Ramón must be submitted before work begins, and the SINAC recommendations set forth above must be followed. 24.2.b. Control of atmospheric dust emissions: 24.2.b.1. In this regard, irrigation must be scheduled according to the needs arising from the movement of dump trucks and heavy machinery within the concession area (roads, yards, plant area). 24.2.b.2. The crusher must be equipped with water sprinklers to minimize dust emissions during crushing and the unloading of material from conveyor belts. 24.2.c.
SETENA recommendations in Resolution N° 02914-2024-SETENA. 24.2.c.1. ‘If the removal of any tree is required, the corresponding permit must be obtained from the MINAE office, and if surface water bodies or wells are located within or along the boundaries of the project area (área de proyecto, AP), the legislation in force governing protection zones (zonas de protección) must be applied’” (see the report and evidence submitted by the respondent authority).
III.Regarding the right to a healthy and ecologically balanced environment. It must first be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73, and 89 of the Constitución Política), as well as recognized under the international rules applicable in Costa Rica. In this regard, in Judgment No. 2006-005928 issued at 15:00 on May 2, 2006, this Court ruled: “(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the inhabitants of the Republic rest. Similarly, the right to health is grounded in that provision of the political charter, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for proper and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73, and 89 of the Constitución Política.
Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has used the concept of ‘environmental quality’ as a parameter precisely for people’s quality of life, in conjunction with other elements such as health, food, work, and housing, noting that every person has the right to use the environment for their own development, but not without limitation, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible).” Likewise, Article 50 of the Constitución Política gives rise to the State’s obligation to protect the environment. That provision states: “The State shall seek the greatest well-being of all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” This confirms that the various public authorities have an unavoidable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.
IV.Regarding the specific case. In the case at bar (sub lite), the petitioner states that he objects to the Quebradores Aralfa Piedra Blanca project, identified under expediente No. D1 17546- 2016-SETENA, based on the following grievances: 1) the environmental viability granted by SETENA and the approval of the project in question by the Dirección de Geología y Minas violate the right to a healthy and ecologically balanced environment; and 2) the right to citizen participation has been violated. He requests an order immediately suspending all activities related to the “Quebrador Aralfa Piedra Blanca” project until an inclusive public and participatory consultation has been conducted with the affected communities and full respect for the fundamental rights of those communities has been ensured, including the right to a healthy environment, citizen participation, and legality in environmental decision-making processes.
In this regard, this Chamber found it established that the authorities of SETENA and the Dirección de Geología y Minas have, in fact, been evaluating the “Quebrador Aralfa Piedra Blanca” project since 2016 and that each of the requirements imposed for that purpose by our legislation has progressively been met. Accordingly, it was established that the project developer submitted the Environmental Impact Study (Estudio de Impacto Ambiental, EsIA) and complied with the terms of reference established by the respondent authorities, as well as with the requirements imposed by SENARE, whose approval was included in the Environmental Impact Study. Likewise, it was verified that, because the requested requirements had been met, the Secretaría Técnica Nacional Ambiental granted environmental viability to the project on September 8, 2022; for that reason, an application was subsequently submitted to the Dirección de Geología y Minas to obtain a quarry concession (concesión en cantera).
It should be noted that the petitioner’s claims in this proceeding—namely, that the environmental viability and approval of the project impair his right to a healthy and ecologically balanced environment and that the alleged effects he believes will be caused to the environment—were already duly considered by SETENA in Resolution No. 291-2024-SETENA issued at 9:14 on February 22, 2024. That resolution adjudicated an environmental complaint (denuncia ambiental) filed against the project known as Quebradores Aralfa Piedra Blanca, expediente D1-17546-2016-SETENA, as follows: “(…) Analysis of Fact 3. As established in the EsIA, the AP will not directly border the Río María Jesús or Río Obispo; furthermore, the storage and processing area will be located north of both surface water sources. Likewise, once the project is operational, in order to control the potential discharge of sediment into water bodies, the Developer must fully comply with the environmental measures established in the EsIA Management Plan, including, most notably, channels and sedimentation basins (…) Analysis of Fact 8.
It is correct that part of the project is located within the area designated as the corredor biológico montes del aguacate; however, this category has no protection established by law and is therefore not binding (…) FIRST: The complaint submitted to SETENA on December 12, 2023—environmental complaint 44418-2023 from the integrated system for processing and handling environmental complaints (sistema integrado de trámite y atención de denuncias ambientales, SITADA), against the Quebradores Aralfa Piedra Blanca project under expediente D1-17546-2016-SETENA—is partially granted. Facts 1, 3, 5, 6, 7, and 8 are rejected. Fact 2 is granted. The Developer is ordered to comply, within 20 business days, with the requirements concerning installation of the sign set forth in Por Tanto Cuarto of Resolution No.1489-2022-SETENA. Fact 4 is partially granted. Accordingly, because the project has not commenced, the Developer is once again cautioned: ‘If the removal of any tree is required, the corresponding permit must be obtained from the MINAE office, and if surface water bodies or wells are located within or along the boundaries of the AP, the legislation in force governing protection zones must be applied’” (emphasis not in the original).
In addition to the foregoing, regarding the appellant’s disagreement with the environmental viability (viabilidad ambiental) granted, it must be noted that, with respect to challenges to the environmental viability granted by SETENA, this Chamber has ruled that it is not for it to examine whether the granting of environmental viability to a project complies with the technical and legal requirements. For that reason, in judgment No. 2019-011203 at 9:30 a.m. on June 21, 2019—a criterion reiterated in judgment No. 2024-32334 at 9:20 a.m. on November 1, 2024—it concluded as follows:
“From a reading of the filing, the appellant alleged a series of purported irregularities by the Secretaría Técnica Nacional Ambiental and ACOPAC of SINAC, specifically concerning the granting of environmental viability and the issuance of a report, respectively. However, it should be pointed out to the petitioner that amparo proceedings (procesos de amparo) are highly summary in nature, and determining, in this specific case, whether the granting of environmental viability was required to meet the same requirements applicable to a similar project in 2002, or whether a series of irregularities occurred in its issuance, may constitute grievances to be disputed before the Administration itself or, failing that, before the administrative litigation jurisdiction (jurisdicción contenciosa administrativa), where the petitioner will have the evidentiary opportunity to litigate on the merits all the grievances raised here. The same applies to the purported irregularities in an ACOPAC report, regarding which the petitioner alleges that ACOPAC changed its position in order to facilitate viability in 2017 for the ‘V.I.’ project. Consequently, the appeal must be dismissed with respect to these matters” (emphasis not in the original).
In this regard, in the specific case, the established facts show that, before environmental viability was obtained, SETENA reviewed all legally established requirements and verified that the project had completed each of the necessary phases for that purpose. Additionally, as mentioned above, the alleged impacts identified by the appellant in the amparo action (recurso de amparo) had already been examined in an environmental complaint filed with SETENA, in which most of the reported facts were rejected and recommendations and instructions were provided to the company regarding the substantiated matters. It should also be noted that the project in question is at a stage preceding operation of the concession; therefore, the company has not yet undertaken any action or activity that could endanger the environment. In any event, it was duly demonstrated that the environmental impact study (estudio de impacto ambiental) provided by the company set forth response and prevention measures to avoid any environmental harm at the site and prevent adverse impacts in the area. However, as already stated, the project has not yet begun operations, and there are still stages that must be inspected and approved by the respondent authorities before operations may begin; if any irregularity is found, those authorities could prevent its implementation until the issue has been remedied.
Accordingly, given that: 1) the project has completed all stages and requirements necessary for it to be granted environmental viability and authorization by SETENA and the Dirección de Geología y MINAS to operate the quarry concession (concesión de cantera); 2) the environmental impact study includes the preventive measures necessary to avoid adverse impacts on the environment and residents of the area; 3) it is not for this Chamber to determine whether the environmental viability granted by SETENA meets the necessary requirements, because this is a matter of ordinary legality (legalidad ordinaria); and 4) as of this date, the project remains at a stage preceding operation of the concession and there is no environmental damage in the area, since the project has not begun and the competent authorities must still conduct verifications and inspections before approving the commencement of operations, the appropriate course is to dismiss the appeal with respect to this matter. Nevertheless, the respondent authorities are hereby reminded of their obligation to continue verifying compliance with each requirement necessary for the project to begin operations, in accordance with the parameters established by this constitutional jurisdiction for the proper protection of the environment.
V.Finally, the appellant argues that the respondent authorities violated the principle of citizen participation (principio de participación ciudadana) by failing to inform the residents and persons potentially affected about the project in question. Regarding this point, the authorities of the Secretaría Técnica Nacional Ambiental report that, as part of the environmental impact study (EsIA), an analysis was conducted of the local perceptions of certain community leaders from neighboring communities such as Río Jesús de San Ramón and La Angostura de San Ramón. The community of Guadalupe de Esparza is located approximately 2km in a straight line from the project area (AP), while both La Angostura and Dulce Nombre are more than 3.5km away; however, they will not be directly affected by transportation or project operations, because the routes or roads passing through these communities will not be used by the project. Nevertheless, it should be noted that this Court held in judgment No. 6773-2014 at 11:41 a.m. on May 16, 2014—a criterion reiterated in judgments number 2022-25374 at 9:20 a.m. on October 28, 2022, and 2024-33132 at 9:20 a.m. on November 8, 2024, among others—that the proper forum for overseeing compliance with the principle of citizen participation is the ordinary courts, not the constitutional jurisdiction. The aforementioned decision stated as follows:
“IV.- UPON FURTHER CONSIDERATION. QUESTION OF LEGALITY. In amending Article 9 of the Political Constitution, the constituent reforming body sought to give positive legal effect to the Principle of Participation and thus bring those subject to government administration closer to the state decision-making process, as part of what legal scholarship calls the ‘corrective mechanisms’ of representative democracy. Accordingly, except in exceptional cases, the reforming constituent body left the means, scope, and timing of citizen participation to subconstitutional legislation (normativa infra-constitucional). In that regard, the proper forum for overseeing compliance is the ordinary courts, not the constitutional jurisdiction. For that reason, the issues raised in this specific case fall outside and are far removed from this Court’s jurisdiction—namely, the alternative mechanism ordered by the Secretaría Técnica Nacional Ambiental, as a result of the violence and intimidation arising during the hearings of November 9, 2013 and January 25, 2014, to ensure the phase for comments by interested parties and replies by the developer in the environmental assessment procedure (procedimiento de evaluación ambiental) for the project involving a new Container Terminal in Moín, in the name of APM Terminals Moín S.A. In this specific case, Article 22 of the Ley Orgánica del Ambiente does not define whether such participation must be oral, written, or otherwise conducted to satisfy the participation requirement.
This issue must be examined in proceedings allowing for extensive evidence and adversarial argument, which, in our view, does not fit within amparo as a prompt, simple, summary, and special proceeding for protecting fundamental human rights. It is therefore for the judicial review of legality (control de legalidad), and not this Constitutional Court, to determine whether the administrative acts and conduct—whether affirmative or by omission—undertaken by the Secretaría Técnica Nacional Ambiental conform to the subconstitutional legal system (ordenamiento jurídico infra constitucional). For the reasons stated, we consider the issue raised to be far removed from the specific jurisdiction that the Constitutional Chamber is charged with safeguarding, without this meaning that it does not warrant review by the ordinary jurisdiction or through administrative litigation limited to questions of legality, pursuant to Article 49 of the Constitution.
(…)” Based on the foregoing, it is not for this Court to determine, as the appellant requests, whether some form of consultation regarding the project in question should have been conducted in this particular case; nor is it for this Chamber to determine which mechanism the respondent authorities must use to optimally ensure citizen participation. Thus, in accordance with the cited precedent, it is not for this Constitutional Court to determine whether the administrative acts and conduct—whether affirmative or by omission—undertaken by SETENA in this specific case conform to the subconstitutional legal system. All such matters must be challenged by the appellants through the appropriate ordinary legal channels.
VII.Separate Reasoning of Justice Salazar Alvarado. With due respect, I concur with the majority decision dismissing the appeal; however, I base my position on the following reasons:
The protection of a healthy and ecologically balanced environment, under the Costa Rican Legal System, is safeguarded not only by Article 50 of the Political Constitution, but also by a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; the Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to cite only a few. This makes it necessary, in environmental matters, to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, the undersigned is of the opinion that this Chamber, through an amparo proceeding (amparo), should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and if the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a specific person or community.
Otherwise, the issue must be raised and debated through the legality proceedings. Accordingly, the mere breach of obligations and duties legally imposed on the various public administrations in environmental matters is properly heard through legality proceedings—whether administrative or judicial—where the alleged breaches or omissions may be reviewed much more comprehensively. It must be borne in mind that an amparo proceeding is summary, informal, simple, and expeditious; therefore, from the very moment the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding involving the issuance of administrative acts (actos administrativos), consideration of that matter falls outside the scope of this specialized jurisdiction. Accordingly, review of administrative actions taken in connection with an environmental matter that, for proper assessment, requires full adjudicatory proceedings (proceso de conocimiento pleno) is possible only in the ordinary courts, since the design of amparo proceedings is incompatible with comparing or reviewing technical or legal criteria developed under the applicable statutory or regulatory provisions, or with taking additional and more extensive evidence necessary to compare or review the criteria already contained in the administrative case file (expediente administrativo) for the matter.
To hold otherwise would transform amparo into ordinary full adjudicatory proceedings, thereby distorting its nature and defeating the purposes for which it was designed, as a result of which it would lose its status as an instrument for the effective protection of fundamental rights. Consequently, I consider that when a public entity or body has intervened in various ways, or has issued administrative acts concerning an environmental matter, its consideration and review fall within the jurisdiction of the administrative courts (jurisdicción de lo contencioso administrativo). It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of legality proceedings. Consequently, this application should have been summarily dismissed, since its subject matter is properly debated, analyzed, and resolved through legality proceedings.
However, because that was not done, the appropriate course is to deny it, without ruling on the merits of the issue raised, because it falls to the ordinary courts—specifically, the administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the legal system at the statutory level concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.
VIII.Separate reasoning of Justices Cruz Castro and Rueda Leal concerning the right to citizen participation. Drafted by the latter.
Indeed, in judgment nro. 2013-017305 de las 11:32 horas de 20 de diciembre de 2013, this Chamber held that the right to citizen participation in decision-making has become one of the fundamental pillars on which the democratic system rests. In our country, the constitutional legislator enshrined this right in Article 9 of the Political Constitution by providing that the Government of the Republic shall be popular, representative, participatory, alternating, and responsible (emphasis not in the original), pursuant to the amendment enacted by ley nro. 8364 del 1º de julio de 2003, published in La Gaceta nro. 146 de 31 de julio de 2003. This mandate of the Fundamental Law, particularly the quality of being “participatory,” has guided subsequent development of constitutional and infra-constitutional law. Thus, a series of mechanisms has been established to ensure that the right to participatory government can be applied effectively, rather than remaining merely a right on paper; examples include the referendum for the approval or repeal of laws and partial amendments to the Constitution, and the popular initiative in lawmaking (see, among others, judgment nro. 2005-05649 de las 14:39 horas del 11 de mayo del 2005).
The right to participatory government not only embodies recognition at the highest level of positive law of the role played by the inhabitants of the Republic in exercising political oversight, but also signifies a renewed appreciation of their role in the formulation, implementation, and oversight of public policy. By the will of the constitutional legislator, which this Chamber must not and cannot disregard, the right to participatory government stands as a fundamental pillar of our democratic system (a point mistakenly disregarded by the minority opinion, which downgrades citizen participation from a right to a general principle, in clear opposition to this Chamber’s line of precedent, as demonstrated below), consistent with a political system based on tolerance, pluralism, and respect for freedom.
As I stated supra, this characterization of participatory government or citizen participation as a right is explained by the support provided by several international human-rights instruments.
For example, Article 21 of the 1948 Universal Declaration of Human Rights provides that “everyone has the right to participate in the government of their country, directly or through freely chosen representatives” (emphasis not in the original).
Consistent with the foregoing, Article 25 of the International Covenant on Civil and Political Rights expressly recognizes the right of citizens: “( …) to participate in the conduct of public affairs, directly or through freely chosen representatives.” In the same vein, Article 5 of the Inter-American Democratic Charter states: “Representative democracy is strengthened and deepened by permanent, ethical, and responsible participation by the citizenry within a legal framework conforming to the respective constitutional order.” More emphatically, Article 6 of that Charter provides: “It is the right and responsibility of all citizens to participate in decisions relating to their own development. This is also a necessary condition for the full and effective exercise of democracy. Promoting and fostering diverse forms of participation strengthens democracy.” (Emphasis not in the original.)
The United Nations Human Rights Council also recognized citizen participation as fundamental to environmental protection:
“Also recognizing that the exercise of human rights, including the freedom to seek, receive and impart information and to participate effectively in the conduct of governmental and public affairs, and the right to an effective remedy, is fundamental to the protection of a clean, healthy, safe and sustainable environment,” (United Nations Human Rights Council, 46° periodo de sesiones, A/HRC/RES/46/7 de 23 de marzo de 2021).
It is also important to emphasize that, recently, in resolution A/HRC/RES/48/13, adopted on 8 de octubre de 2021, the United Nations Human Rights Council granted effective participation in environmental matters the status of a human right. In this regard, it stated:
“Recognizing that the exercise of human rights, including the rights to seek, receive and impart information and to participate effectively in the conduct of governmental and public affairs and in environmental decision-making, as well as the right to an effective remedy, is fundamental to the protection of a clean, healthy and sustainable environment.” (Emphasis not in the original.)
For its part, in Advisory Opinion OC-23/17 del 15 de noviembre de 2017, the Inter-American Court of Human Rights emphasized:
“226. Public participation constitutes one of the fundamental pillars of instrumental or procedural rights, since it is through participation that individuals exercise democratic oversight of government activities and can thereby question, investigate, and assess the performance of public functions. In this regard, participation allows individuals to take part in the decision-making process and have their opinions heard. In particular, public participation enables communities to hold public authorities accountable for decision-making and, at the same time, improves the efficiency and credibility of governmental processes. As previously noted, public participation requires application of the principles of openness and transparency and, above all, must be supported by access to information, which enables social oversight through effective and responsible participation” (emphasis added).
This position had also been adopted in the judgment of 19 de septiembre de 2006 concerning the case of “Nombre05 y otros vs. Chile,” which held:
“86. In this regard, the State’s conduct must be governed by the principles of publicity and transparency in public administration, making it possible for persons under its jurisdiction to exercise democratic oversight of State actions, so that they may question, investigate, and assess whether public functions are being properly performed. Access to information under the State’s control that is of public interest may enable participation in public administration through the social oversight that can be exercised by means of such access. 87. Democratic oversight by society through public opinion fosters transparency in State activities and promotes accountability among public officials for their public administration. Therefore, for persons to exercise democratic oversight, it is essential that the State guarantee access to information of public interest under its control. Allowing the exercise of such democratic oversight encourages greater participation by persons in matters of societal interest.” (Emphasis added).
In addition, the Inter-American Court of Human Rights, in its judgment of November 27, 2023, issued in the case of “Habitantes de la Oroya vs. Perú,” held:
“B.2.5.2. Right to political participation 150. The right of citizens to participate in the conduct of public affairs is enshrined in Article 23.1(a) of the American Convention270. With respect to environmental matters, the Court has established that participation constitutes a mechanism for integrating the public’s concerns and knowledge into public-policy decisions affecting the environment. Likewise, participation in decision-making increases governments’ capacity to respond promptly to public concerns and demands, build consensus, and improve the acceptance of and compliance with environmental decisions271. In this regard, the Escazú Agreement provides that each State Party ‘shall ensure the public’s right to participation and, for that purpose, undertakes to implement open and inclusive participation in environmental decision-making processes, on the basis of domestic and international regulatory frameworks’272.
151. The Court also notes that the right to political participation in environmental matters is enshrined in various instruments of international law, such as the Stockholm Declaration273, the World Charter for Nature adopted in Nairobi274, the Rio Declaration275, the Aarhus Convention276, and the Convention on Biological Diversity277. At this point, the Court considers it appropriate to recall that reference to sources, principles, and criteria of the international corpus juris, in this case concerning environmental matters, does not mean that it assumes jurisdiction over other treaties or recognizes them as binding upon States. These rules are used as interpretive criteria for determining the scope of the rights protected by the American Convention and other instruments that are binding upon the State and over which the Court has jurisdiction, pursuant to Article 29 of the Convention278.
152. The Court has found that the right to participate in public affairs enshrined in Article 23.1(a) of the American Convention establishes the obligation of States to guarantee the participation of persons under their jurisdiction in decisions and policies that may affect the environment, without discrimination and in an equitable, meaningful, and transparent manner, for which purpose they must first have guaranteed access to relevant information. Likewise, with regard to public participation (participación pública), the State must guarantee opportunities for effective participation from the earliest stages of the decision-making process and inform the public about those opportunities for participation. Finally, public-participation mechanisms in environmental matters are varied and include, among others, public hearings (audiencias públicas), notification and consultations, participation in processes for drafting and implementing laws, and judicial-review mechanisms279.

B.3.6.2. Right to political participation 256. The Court recalls that the right to political participation (participación política) is one of the fundamental pillars of democracy, since through its exercise persons may place limits on State actions and question, investigate, and assess the performance of public functions. Participation enables persons to take part in the decision-making process and thereby participate in the conduct of public affairs affecting the environment. This Court has emphasized that this right entails the obligation of States to guarantee the participation of persons in decisions that may affect the environment, which is related to the obligation to provide relevant information. Such participation must be effective from the earliest stages of the decision-making process, which may be achieved through various mechanisms (supra para. 152).” Accordingly, this recognition under the Convention of citizen participation (participación ciudadana) has a hermeneutical bearing on its legal nature, because it transforms it from a constitutional principle into a genuine collective fundamental right.
Thus, citizen participation represents an essential aspect of this century’s democratic and republican model, in which citizen oversight, transparency, and accountability stand out as defining elements of this type of political regime, which in turn confers far greater legitimacy on political decision-making—a key issue when governance is at stake. Accordingly, within the framework of this type of regime—that is, one featuring active and full citizen participation—participatory government has a stronger impact, fostering decision-making through more open and transparent means.
Indeed, one of the mechanisms devised to comply with Article 9 of the Constitution is the public hearing, through which interested persons may assert their rights or express their views, actively participating in matters of national or local significance and bringing to the Administration’s attention any irregularities or objections concerning a project to be developed.
Accordingly, a public hearing is an instrument typical of a republican democracy, through which citizen participation in the public decision-making process is encouraged. Given its significance, the hearing must be conducted in a manner that guarantees the greatest possible participation by persons who may be affected; therefore, any action or omission that hinders such participation constitutes an overt violation of the constitutional right to citizen participation (see, among others, judgment number 2009-018223, issued at 12:34 p.m. on November 27, 2009).
As for the participatory nature of the public hearing, as noted above, Article 9 of the Political Constitution itself requires it, since the designation “participatory” set forth therein implies, among other things, that the Government must give effect to what has been determined through popular deliberation when such deliberation is mandatory, while, in formulating public policy and within the possibilities afforded by the legal framework currently in force, it is required to hear the views of affected individuals or groups, whether or not those views are binding.
In other words, in today’s republican democracy, citizens enjoy, by constitutional mandate, not only the right to vote in exercising their right to participatory government, but also numerous instruments of various kinds through which they may assist in governmental decision-making and political oversight, thereby enabling them to exert direct influence on major public decisions.
In this context, it bears emphasizing that this Court, in judgment no. 2018004117, issued at 9:15 a.m. on March 13, 2018, elaborated on public consultation (consulta pública) in environmental matters, emphasizing that this mechanism is a pillar of decision-making concerning the environment. Likewise, by way of soft law, it relied on an instrument of particular relevance regarding access to environmental information and citizen participation: the “Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters,” better known as the “Aarhus Convention.” In this regard, the aforementioned ruling stated:
“The Aarhus Convention, for its part, provides in Article 6.2.3.4:
‘2. When an environmental decision-making process is initiated, the public concerned shall be informed, as appropriate, effectively and in a timely manner, by public notice or individually, as the case may be, at the beginning of the process. The information shall refer in particular to:
3. Reasonable time frames shall be established for the different phases of the public-participation procedure, allowing sufficient time to inform the public in accordance with paragraph 2 supra and for the public to prepare and participate effectively throughout the environmental decision-making process.
4. Each Party shall take measures to ensure that public participation begins at the outset of the procedure, that is, when all options and solutions remain possible and the public can exert genuine influence.’ In accordance with the foregoing, consultation must be conducted transparently and with as much information as possible. This results in better administration of natural resources, contributes to transparency, and promotes the proper management of public funds. It should be recalled that environmental matters concern all members of society, not only the government, and therefore every citizen is also responsible for safeguarding environmental conservation (conservación del ambiente) and pursuing sustainable development (desarrollo sostenible). It must therefore comprehensively encompass the different sectors of the population (…).” (Emphasis added).
In addition, in the aforementioned ruling, the Chamber emphasized that a citizen hearing (audiencia ciudadana), as a manifestation of the democratic principle, must not become a mere formality that simply must be placed on the schedule, although neither should it be used merely as an obstacle to the issuance of an administrative decision.
In connection with the foregoing, this Chamber has repeatedly held that the Constitution is characterized by its supremacy and its direct and immediate effect, by virtue of which the rights and guarantees that it confers are directly enforceable and binding upon all Public Authorities. Thus, in judgment nro. 1992-3194 de las 16:00 horas del 27 de octubre de 1992, it stated:
“(…) The Political Constitution, according to the unanimous contemporary understanding thereof, is not only ‘supreme’ as the criterion governing its own validity and that of the rest of the legal system, but is also a body of legally binding fundamental rules and principles, and therefore enforceable in their own right against all public authorities and private parties themselves, without requiring other rules or acts to develop them or make them applicable—except in exceptional qualifying cases in which their application would be impossible without such rules or acts—with the result that both administrative and judicial authorities have the power and duty to apply Constitutional Law directly in its fullest sense, even in the absence of a lower-ranking rule or by declining to apply rules that conflict with it.” For its part, in decision nro. 1995-1185 de las 14:33 horas de 2 de marzo de 1995, this Court confirmed:
“If the Political Constitution has supreme normative status, it must effectively shape and condition the validity and effectiveness of every lower-ranking or subordinate rule, and it serves as the standard for determining the legitimacy or illegitimacy of the conduct of any public authority and even private parties.... In Costa Rica, the principle of constitutional supremacy is not only expressly enshrined in Article 10, but is also very clearly supplemented with regard to the body charged with upholding or preserving it, as we will discuss below. What we have stated thus far revolves around the fact that the Constitution has direct effect and is binding without the intermediation of any other rule. It is for this reason that every authority, in general, has the capacity and power to apply, develop, and expand the fundamental rights contained in the Political Constitution. If this were not so, the entire argument concerning the hierarchy of constitutional rules, principles, and values would be reduced to an unsustainable fantasy.
It would be mere science fiction, an abstraction in which two legal worlds simultaneously exist on different planes without any communication between them.” In conclusion, citizen participation (participación ciudadana) constitutes a constitutional and treaty-based right that is a defining quality of the republican democratic system. In this regard, the rights enshrined in the Fundamental Law, to varying degrees depending on whether their content is more or less programmatic, have direct effect and are binding without the need for any implementing rule. Moreover, their effectiveness through the development and application of subconstitutional legislation is not beyond judicial review of constitutionality (control jurisdiccional de constitucionalidad) when regulations, actions, or omissions are identified that infringe the essential core (Kernbereich) of that constitutional interest.
Furthermore, decision nro. 0291-2024-SETENA de las 9:14 horas del 22 de febrero de 2024 stated:
“Fact 1. The guidelines of the Ley orgánica del ambiente and its regulations, as well as agreement minutes 0087-2008 of the Comisión Plenaria de la SETENA, establish that the public must be informed of the project. At folio 000077 of Administrative File D1-17546-2016-SETENA, a clipping from the newspaper La República dated 19 de octubre del 2017 is provided, through which the project was made public. It should also be clarified that, during preparation of the EsIA, a sociological study is required pursuant to the technical studies established in the Manual de Instrumentos Técnicos para el proceso de evaluación de Impacto Ambiental (D:E: N° 32712-MINAE), and that study was conducted by a professional in the field duly authorized under the legislation in force in the country to conduct this type of study and holding a current registration with SETENA.” Accordingly, we find that the project was indeed made known to the general public so that any interested party could submit comments. Nor does the foregoing indicate any particular impact on inhabited areas in the vicinity.
IX.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced by new technologies, these must be collected from the Court within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 del 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial número 19 del 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 celebrada el 3 de mayo del 2012, Article LXXXI.
Por tanto:
The appeal is denied. The respondent authorities shall take note of the statement in the final paragraph of Considerando IV of this judgment. Magistrate Salazar Alvarado sets forth different grounds, considering that it is for the ordinary courts, specifically the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), to determine whether the challenged administrative actions and conduct are or are not substantively consistent with the provisions of the legal system at the statutory level concerning the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment. Magistrates Cruz Castro and Rueda Leal set forth different grounds regarding citizen participation.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de marzo de dos mil veinticinco .
Recurso de amparo interpuesto por Nombre02, cédula de identidad NFP03, a favor de Nombre06, cédula de identidad NFP01 y de Nombre03, contra el MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. Reclama el recurrente que se encuentra disconforme con el proyecto Quebradores Aralfa Piedra Blanca, identificado con el expediente No. D1 17546- 2016-SETENA, en virtud de los siguientes agravios: 1) con la vialidad ambienta otorgada por SETENA y la aprobación del proyecto en cuestión por parte de la Dirección de Geología y Minas se causa una violación a un ambiente sano y ecológicamente equilibrado y; 2) violación al derecho de participación ciudadana. Solicita que se ordene la suspensión inmediata de todas las actividades relacionadas con el proyecto "Quebrador Aralfa Piedra Blanca", hasta que se realice una consulta pública y participativa, inclusiva con las comunidades afectadas y se asegure el pleno respeto de los derechos fundamentales de las comunidades afectadas, incluyendo el derecho a un ambiente sano, la participación ciudadana y la legalidad en los procesos de toma de decisiones ambientales.
II.Hechos probados: De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Se rechazan los Hechos 1, 3, 5, 6, 7, 8. Se acoge el Hecho 2. Se le ordena al Desarrollador que un plazo de 20 días hábiles cumpla con lo establecido en el Por Tanto Cuarto de la resolución No.1489-2022-SETENA, en cuanto a la colocación del rótulo. Se acoge parcialmente el Hecho 4. Por lo que, al no haber iniciado el proyecto, únicamente se vuelve a prevenir nuevamente al Desarrollador “En caso de requerirse la eliminación de algún árbol, debe de tramitar el permiso correspondiente ante la oficina del MINAE, y en caso que se ubiquen cuerpos de agua superficial o pozos dentro o en los límites del AP, deberá de aplicarse la legislación vigente en materia de zonas de protección.” SEGUNDO: Contra esta resolución cabe interponer dentro del plazo de tres días a partir del día siguiente a la notificación, los recursos ordinarios de revocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente, Energía y Telecomunicaciones.
Con fundamento legal en el artículo 342 de la Ley General Administración Pública y la Ley Orgánica del Ambiente. TERCERO: Toda documentación que sea presentada ante la SETENA deberá indicar claramente el número de expediente, el número de resolución y el nombre completo del proyecto. También se deberá indicar una dirección de correo electrónico, para recibir notificaciones de parte de esta Secretaría. CUARTO: Los documentos originales firmados digitalmente (Firma Digital) estarán a disposición del interesado en la dirección web http://www.tramites.setena.go.cr, donde debe ser verificado por cualquier interesado e instancia pública o privada. QUINTO: De conformidad con el artículo 8 de la Ley 8220, no podrá solicitarse al interesado que requiera un trámite la presentación de certificaciones, copias de información que ya posea otra institución, según los medios legales preestablecidos. SEXTO: El resultado de la discusión y análisis del caso de marras es: 4 a favor, 0 en contra, 1 inhibido y 2 ausentes, el detalle de la información de dicha votación puede ser consultada en el acta correspondiente, la cual se encuentra en custodia de esta Secretaría y es de acceso público” (ver informe y prueba aportada por la autoridad recurrida).
Es correcto que una parte del proyecto se ubica dentro del área establecida como corredor biológico montes del aguacate; sin embargo, esta categoría no tiene protección establecida por Ley, por lo que no es vinculante. Conclusión: Se rechaza el hecho denunciado Por ende, se hace necesario comunicar a esta Dirección y su Registro Nacional Minero lo siguiente: - existencia o no de restricciones legales o técnicas para el desarrollo del proyecto de cita” (ver informe y prueba aportada por la autoridad recurrida).
Para este caso en concreto, el proyecto a desarrollar se encuentra dentro de los límites establecidos para el corredor biológico Montes del Aguacate. Es importante saber que, no existen restricciones legales o técnicas para el desarrollo del proyecto de cita en el área afectada por el hecho de encontrarse dentro del CBMA, más allá, de lo que ya la legislación ambiental vigente establece (resguardo de las áreas de protección de recurso hídrico, bosque, por mencionar ejemplos específicos que se encuentran dentro de dicha legislación). Ahora bien, se recomienda dar un enfoque de trabajo y gestión conjunta a través de las siguientes recomendaciones: 1. En caso de apertura o mejoramiento de vías, considerar la instalación de pasos de fauna para facilitar la movilización de especies silvestres. 2. Si dado el caso de que, como parte del proyecto se deba realizar restauración o reforestación en algunos sitios, considerar áreas prioritarias dentro del CB para este fin. 3.
En el supuesto de que deba implementarse un mecanismo de compensación de parte del proyecto, se recomienda que se construya o planifique en conjunto con el comité local del corredor biológico. El cual se encuentra en disposición de colaborar de la mano para una correcta gestión del CB” (ver informe y prueba aportada por la autoridad recurrida).
En el supuesto de que deba implementarse un mecanismo de compensación de parte del proyecto, se recomienda que se construya o planifique en conjunto con el comité local del corredor biológico. El cual se encuentra en disposición de colaborar de la mano para una correcta gestión del CB. 24.2. Recomendaciones adicionales para la mitigación y prevención del impacto ambiental asociado a las labores a realizar en el área de concesión. 24.2.a. Mejoramiento de vías: En el caso de que se requiera el mejoramiento de las vías de acceso, se deberá presentar previamente al inicio de las obras el acuerdo avalado por la Municipalidad de San Ramón y se deberá cumplir con las recomendaciones de SINAC arriba incluidas. 24.2.b. Control de emisiones de polvo a la atmósfera: 24.2. b.1. En relación a esto, se deberá programar una irrigación en concordancia con las necesidades, por el tránsito de vagonetas y maquinaria pesada en el área de concesión (caminos, patios, área de planta). 24.2. b.2.
El quebrador deberá ser aprovisionado de aspersores de agua para minimizar la emisión de polvo durante el quebrado y la descarga de material desde las bandas transportadoras. 24.2.c. Recomendaciones de SETENA en la Resolución N° 02914-2024-SETENA. 24.2. c.1. “En caso de requerirse la eliminación de algún árbol, debe de tramitar el permiso correspondiente ante la oficina del MINAE, y en caso que se ubiquen cuerpos de agua superficial o pozos dentro o en los límites del AP, deberá de aplicarse la legislación vigente en materia de zonas de protección” (ver informe y prueba aportada por la autoridad recurrida).
III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como, a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia No. 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental.
Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible– ”.
Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.
IV.Sobre el caso concreto. En el sub lite, el recurrente acusa que, se encuentra disconforme con el proyecto Quebradores Aralfa Piedra Blanca, identificado con el expediente No. D1 17546- 2016-SETENA, en virtud de los siguientes agravios: 1) con la vialidad ambienta otorgada por SETENA y la aprobación del proyecto en cuestión por parte de la Dirección de Geología y Minas se causa una violación a un ambiente sano y ecológicamente equilibrado y; 2) violación al derecho de participación ciudadana. Solicita que se ordene la suspensión inmediata de todas las actividades relacionadas con el proyecto "Quebrador Aralfa Piedra Blanca", hasta que se realice una consulta pública y participativa, inclusiva con las comunidades afectadas y se asegure el pleno respeto de los derechos fundamentales de las comunidades afectadas, incluyendo el derecho a un ambiente sano, la participación ciudadana y la legalidad en los procesos de toma de decisiones ambientales.
Al respecto, esta Sala tuvo por acreditado que, efectivamente, las autoridades de SETENA y de la Dirección de Geología y Minas se encuentran evaluando desde el 2016 el proyecto "Quebrador Aralfa Piedra Blanca", para lo cual se han ido cumpliendo cada uno de los requisitos exigidos en nuestra legislación al efecto. De esta forma, se comprobó que, el desarrollador del proyecto cumplió con la presentación del Estudio de Impacto Ambiental y los términos de referencia fijados por parte de las autoridades recurridas e incluso con los requerimientos solicitados por el SENARE, visto bueno que fue aportado dentro del Estudio de Impacto Ambiental. Asimismo, se verificó que, en virtud del cumplimiento de los requisitos solicitados, desde el 8 de setiembre de 2022, la Secretaría Técnica Nacional Ambiental otorgó viabilidad ambiental al proyecto y, por esta razón, posteriormente, se realizó la solicitud de obtención de concesión en cantera ante la Dirección de Geología y Minas.
Nótese que, los reclamos del recurrente en este recurso, en cuando a que estima que la viabilidad ambiental y la aprobación del proyecto afectan su derecho a un ambiente sano y ecológicamente equilibrado y a las presuntas afectaciones que considera se causarán en el medio ambiente, ya fueron debidamente conocidas por SETENA por medio de la resolución No. 291-2024-SETENA de las 9:14 horas de 22 de febrero de 2024, en donde se resolvió una denuncia ambiental presentada en contra del proyecto denominado Quebradores Aralfa Piedra Blanca, expediente D1-17546-2016-SETENA, en el siguiente sentido: “(…) Análisis Hecho 3. Según lo establecido en el EsIA el AP (área de proyecto) no limitará directamente con el Río María Jesús o Río Obispo, además el área de acopio y proceso se ubicará al norte de ambas fuentes de agua superficiales. De igual manera, en el momento que el proyecto se encuentre en operación, el Desarrollador para controlar el posible arrastre de sedimentos a los cuerpos de agua, deberá cumplir a cabalidad con las medidas ambientales establecidas en el Plan de Gestión del EsIA, entre las que destacan canales y sedimentadores (…) Análisis Hecho 8.
Es correcto que una parte del proyecto se ubica dentro del área establecida como corredor biológico montes del aguacate; sin embargo, esta categoría no tiene protección establecida por Ley, por lo que no es vinculante (…) PRIMERO: Acoge de forma parcial denuncia presentada ante la SETENA día 12 de diciembre del 2023, denuncia ambiental 44418-2023 del sistema integrado de trámite y atención de denuncias ambientales (SITADA), contra el proyecto Quebradores Aralfa Piedra Blanca con expediente D1-17546-2016-SETENA. Se rechazan los Hechos 1, 3, 5, 6, 7, 8. Se acoge el Hecho 2. Se le ordena al Desarrollador que un plazo de 20 días hábiles cumpla con lo establecido en el Por Tanto Cuarto de la resolución No.1489-2022-SETENA, en cuanto a la colocación del rótulo. Se acoge parcialmente el Hecho 4. Por lo que, al no haber iniciado el proyecto, únicamente se vuelve a prevenir nuevamente al Desarrollador “En caso de requerirse la eliminación de algún árbol, debe de tramitar el permiso correspondiente ante la oficina del MINAE, y en caso que se ubiquen cuerpos de agua superficial o pozos dentro o en los límites del AP, deberá de aplicarse la legislación vigente en materia de zonas de protección” (el resaltado no pertenece al original).
Aunado a lo anterior, en cuanto a la disconformidad del recurrente con la viabilidad ambiental otorgada, debe indicársele que, el cuestionamiento de la viabilidad ambiental que otorga SETENA, esta Sala ha resuelto que no le corresponde examinar si el otorgamiento de la viabilidad ambiental a un proyecto cumple o no con los requisitos técnicos y legales. Por esa razón, en sentencia No. 2019-011203 de las 9:30 horas del 21 de junio de 2019 -criterio reiterado en la sentencia No. 2024-32334 de las 9:20 horas de 1° de noviembre de 2024-, concluyó lo siguiente:
“De la lectura del escrito de interposición, la parte recurrente alegó una serie de supuestas irregularidades por parte de la Secretaría Técnica Nacional Ambiental y la ACOPAC del SINAC, específicamente por el otorgamiento de la viabilidad ambiental y un informe, respectivamente. Ahora bien, conviene señalarle al accionante, que los procesos de amparo tienen una naturaleza sumarísima y determinar, para este caso en concreto, si el otorgamiento de viabilidad ambiental debía cumplir con los mismos requisitos que en el año 2002 a un proyecto similar o bien, si existieron una serie de irregularidades en la expedición de la misma, podrán ser agravios que discuta ante la propia Administración o en su defecto, ante la jurisdicción contenciosa administrativa, donde contará con la posibilidad probatoria para discutir por el fondo todos los agravios que aquí se pretende. La misma suerte corre las supuestas irregularidades en un informe del ACOPAC, que el accionante acusa un cambio en su postura, en aras de favorecer la viabilidad en el año 2017 para el proyecto “V.I.”. En consecuencia, el recurso debe ser desestimado en cuanto a estos extremos” (el énfasis no es pertenece al original).
En este sentido, en el caso concreto, de la relación de hechos probados se desprende que de previo a la obtención de la viabilidad ambiental SETENA revisó todos los requerimientos legalmente establecidos y verificó que el proyecto cumpliera con cada una de las fases necesarias al efecto. Adicionalmente, tal y como se mencionó antes las presuntas afectaciones que señala el recurrente en el amparo, ya fueron conocidas en una denuncia ambiental planteada por SETENA en donde se rechazaron la mayoría de los hechos denunciados y se brindó recomendaciones e indicaciones a la empresa en cuanto a los hechos procedentes. Adviértase también que, el proyecto en cuestión se encuentra en una etapa previa a la operación de la concesión, por lo que, actualmente, no se ha ejecutado de manera alguna acción o actuación por parte de la empresa que pueda poner en riesgo el medio ambiente. En todo caso, quedó debidamente demostrado que, en el estudio de impacto ambiental proporcionado por la empresa, se presentaron las medidas de atención y prevención para evitar cualquier daño al ambiente en el lugar y para que no se den afectaciones en la zona; sin embargo, como ya se dijo, el proyecto aún no ha iniciado operaciones y aún existen etapas que deben ser inspeccionadas y aprobadas por las autoridades recurridas para su inicio y que, en caso de encontrarse alguna irregularidad, podrían impedir su ejecución, hasta tanto no se subsane cualquier eventualidad.
Así las cosas, al comprobarse que: 1) el proyecto ha cumplido con todas las etapas y requerimientos necesarios para que se les brinde la vialidad ambiental y se les otorgue la autorización para operar la concesión de cantera por parte de SETENA y de la Dirección de Geología y MINAS, 2) el estudio de impacto ambiental incluye las medidas de prevención necesarias para evitar afectaciones al ambiente y vecinos de la zona, 3) no corresponde a esta Sala determinar si la vialidad ambiental otorgada por SETENA cumple o no con los requerimientos necesarios al ser un extremo de legalidad ordinaria y, 4) a la fecha el proyecto se encuentra en una etapa previa a la operación de la concesión y no existe ningún daño ambiental en la zona, dado que el proyecto no ha iniciado y aún existen verificaciones e inspecciones que deben ser realizadas por las autoridades competentes antes de avalar el inicio de las operaciones, es que, lo procedente es declarar sin lugar el recurso, en cuanto a este extremo, no sin antes advertirles a las autoridades recurridas su obligación de continuar verificando el cumplimiento de cada uno de los requerimientos necesarios para que el proyecto pueda iniciar operaciones, cumpliendo con los parámetros necesarios para la debida protección del medio ambiente que ha establecido esta jurisdicción constitucional.
V.Finalmente, el recurrente aduce que las autoridades recurridas violentaron el principio de participación ciudadana, al no comunicar a los vecinos y posibles afectados sobre el proyecto en cuestión. Ahora bien, sobre dicho punto, las autoridades de la Secretaría Técnica Nacional Ambiental informan que como parte del EsIA se realizó un análisis de la percepción local de algunos líderes comunales de comunidades aledañas como Río Jesús de San Ramón y La Angostura de San Ramón, la comunidad de Guadalupe de Esparza se ubica aproximadamente a 2km de distancia en línea recta al AP del proyecto, y tanto La Angostura como Dulce Nombre a más de 3.5km de distancia; sin embargo, no serán afectados directamente por el transporte y actividades de la operación del proyecto, ya que las rutas o carreteras que atraviesan estos poblados no será utilizadas por el proyecto. Sin embargo, es preciso indicar que este Tribunal, estimó en la sentencia No. 6773-2014 de las 11:41 horas de 16 de mayo de 2014 -criterio que ha sido reiterado en las sentencias número 2022-25374 de las 9:20 horas de 28 de octubre de 2022, 2024-33132 de las 9:20 horas de 8 de noviembre de 2024, entre otras-, que la sede natural para vigilar el cumplimiento del principio de participación ciudadana es la justicia ordinaria y no la jurisdicción constitucional. En la referida resolución, se consideró lo siguiente:
“IV.- BAJO UNA MEJOR PONDERACIÓN. DISCUSIÓN DE LEGALIDAD. Al modificar el artículo 9 de la Constitución Política, el órgano constituyente reformador quiso dar positividad al Principio de Participación y así acercar a los administrados al proceso de toma de decisiones estatales, como parte de lo que la doctrina llama “mecanismos de corrección” de la democracia representativa. Así, el Constituyente reformador dejó los medios, alcance y oportunidad de la participación ciudadana a la normativa infra-constitucional, salvo en casos excepcionales. En ese sentido, la sede natural para vigilar su cumplimiento, es la justicia ordinaria y no la jurisdicción constitucional. Por esa razón, son ajenas y lejanas a la competencia de este Tribunal, las cuestiones que se plantean en el caso concreto, a saber, el mecanismo alternativo ordenado por la Secretaría Técnica Nacional Ambiental –a raíz de la violencia y la situación de intimidación generada en las audiencias de 9 de noviembre de 2013 y 25 de enero de 2014– a fin de garantizar la fase de comentarios de los interesados y réplicas del desarrollador en el procedimiento de evaluación ambiental del proyecto de una nueva Terminal de Contenedores en Moín, a nombre de APM Terminals Moín S.A En el caso específico, precisamente el artículo 22 de la Ley Orgánica del Ambiente, no define si esa participación es a viva voz, por escrito o de qué manera se satisface la exigencia de la participación, lo cual requiere ser analizado en un proceso que permita la amplitud de prueba y contradictorio que, desde nuestro punto de vista, no encuadra en el amparo como proceso rápido, sencillo, sumario y especial de protección de derechos humanos fundamentales.
Le corresponde entonces, al control de legalidad y no a este Tribunal Constitucional, determinar si las actuaciones y conductas administrativas desplegadas (activas u omisas), por la Secretaría Técnica Nacional Ambiental, se ajustan o no, al ordenamiento jurídico infra constitucional. Por las razones indicadas, estimamos que el tema planteado está lejos de las competencias específicas, que la Sala Constitucional está llamada a proteger, sin que ello signifique que no merezca análisis en la jurisdicción ordinaria o de mera legalidad contenciosa administrativa, conforme al artículo 49 constitucional. (…)” A partir de lo expuesto, no le corresponde a este Tribunal determinar, tal y como lo pretende el recurrente, si en el caso particular debió realizarse algún tipo de consulta sobre el proyecto en cuestión, así como tampoco le compete a esta Sala verificar cuál es el mecanismo que deben utilizar las autoridades recurridas, para garantizar de forma óptima la participación ciudadana.
De este modo y, conforme con el precedente de cita, no le corresponde a este Tribunal Constitucional determinar si las actuaciones y conductas administrativas desplegadas (activas u omisas) por la SETENA en el caso concreto se ajustan o no al ordenamiento jurídico infra constitucional, todo lo cual, deberá ser cuestionado por los recurrentes en las vías de legalidad ordinaria respectivas.
VII.Razones diferentes del Magistrado Salazar Alvarado. Con el debido respeto, concuerdo con el voto de mayoría que declara sin lugar el recurso; sin embargo, lo fundamento con las siguientes razones:
La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.
De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.
Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
VIII.Razones diferentes de los magistrados Cruz Castro y Rueda Leal en relación con el derecho a la participación ciudadana. Redacta el segundo.
Justamente, en la sentencia nro. 2013-017305 de las 11:32 horas de 20 de diciembre de 2013, esta Sala consideró que el derecho a la participación ciudadana en la toma de decisiones se ha convertido en uno de los pilares fundamentales sobre los que descansa el sistema democrático. En nuestro país, el legislador constitucional recogió este derecho en el artículo 9 de la Constitución Política al disponer que el Gobierno de la República sea popular, representativo, participativo, alternativo y responsable (destacado no corresponde al original), según la reforma propiciada por ley nro. 8364 del 1º de julio de 2003, publicada en La Gaceta nro. 146 de 31 de julio de 2003. Este mandato de la Ley Fundamental, en particular la cualidad de “participativo”, ha orientado un posterior desarrollo normativo constitucional e infra constitucional. Así, se ha establecido una serie de mecanismos que buscan que el derecho al gobierno participativo pueda ser aplicado en forma eficaz y efectiva, de manera que no quede únicamente como un derecho de papel; ejemplos de lo anterior son el referéndum para la aprobación o derogación de leyes y reformas parciales a la Constitución, o la iniciativa popular en la formación de leyes (véase, entre otras, la sentencia nro. 2005-05649 de las 14:39 horas del 11 de mayo del 2005).
El derecho al gobierno participativo no solo encarna un reconocimiento del más alto rango jurídico-positivo a la función del control político por parte de los habitantes de la República, sino que, además, significa una revalorización del papel de estos en los procesos de formulación, aplicación y control de la política pública. Por voluntad del legislador constituyente, que esta Sala no debe ni puede desconocer, el derecho al gobierno participativo se erige como pilar fundamental de nuestro régimen democrático (cuestión erróneamente desconocida por el voto de minoría, que a la participació n ciudadana le baja la categoría de derecho a principio general en clara contraposición a la línea jurisprudencial de esta Sala, como más adelante se demuestra), lo que resulta conteste con un sistema político basado en la tolerancia, el pluralismo y el respeto a la libertad.
Como indico supra, esta categorización del gobierno participativo o de la participación ciudadana como derecho, se explica a través del respaldo convencional contenido en varios instrumentos internacionales de derechos humanos.
Verbigracia, el artículo 21 de la Declaración Universal de los Derechos Humanos de 1948 dispone que “toda persona tiene derecho a participar en el gobierno de su país, directamente o por medio de representantes libremente escogidos” (destacado no corresponde al original).
Concordante con lo anterior, el numeral 25 del Pacto Internacional de Derechos Civiles y Políticos reconoce de modo expreso el derecho de los ciudadanos: “( …) de participar en la dirección de los asuntos públicos, directamente o por medio de representantes libremente elegidos”.
En igual sentido, la Carta Democrática Interamericana señala en su ordinal 5 que: “La democracia representativa se refuerza y profundiza con la participación permanente, ética y responsable de la ciudadanía en un marco de legalidad conforme al respectivo orden constitucional”.
De manera más vehemente, el artículo 6 de esta Carta estatuye que: “La participación de la ciudadanía en las decisiones relativas a su propio desarrollo es un derecho y una responsabilidad. Es también una condición necesaria para el pleno y efectivo ejercicio de la democracia. Promover y fomentar diversas formas de participación fortalece la democracia”. (Destacado no corresponde al original).
El Consejo de Derechos Humanos de las Naciones Unidas tambié n reconoció la participación ciudadana como fundamental para la protección del ambiente:
“Reconociendo tambié n que el ejercicio de los derechos humanos, entre ellos la libertad de buscar, recibir y difundir información y de participar efectivamente en la dirección de los asuntos gubernamentales y públicos y el derecho a un recurso efectivo, es fundamental para la protección de un medio ambiente limpio, saludable, sin riesgos y sostenible,” (Consejo de Derechos Humanos, 46° periodo de sesiones, A/HRC/RES/46/7 de 23 de marzo de 2021).
También, resulta importante resaltar que, recientemente, en la resolución A/HRC/RES/48/13, adoptada el 8 de octubre de 2021, el Consejo de Derechos Humanos de las Naciones Unidades le otorga el estatus de derecho humano a la participación efectiva en materia ambiental. En tal sentido, señaló:
“Reconociendo que el ejercicio de los derechos humanos, entre ellos los derechos a buscar, recibir y difundir información y a participar efectivamente en la dirección de los asuntos gubernamentales y públicos y en la adopción de decisiones relativas al medio ambiente, así como el derecho a un recurso efectivo, es fundamental para la protección de un medio ambiente limpio, saludable y sostenible.”. (El resaltado no corresponde al original).
Por su parte, en la Opinión Consultiva OC-23/17 del 15 de noviembre de 2017, la Corte Interamericana de Derechos Humanos destacó que:
“226. La participación pública representa uno de los pilares fundamentales de los derechos instrumentales o de procedimiento, dado que es por medio de la participación que las personas ejercen el control democrático de las gestiones estatales y así pueden cuestionar, indagar y considerar el cumplimiento de las funciones públicas. En ese sentido, la participación permite a las personas formar parte del proceso de toma de decisiones y que sus opiniones sean escuchadas. En particular, la participación pública facilita que las comunidades exijan responsabilidades de las autoridades públicas para la adopción de decisiones y, a la vez, mejora la eficiencia y credibilidad de los procesos gubernamentales. Como ya se ha mencionado en ocasiones anteriores, la participación pública requiere la aplicación de los principios de publicidad y transparencia y, sobre todo, debe ser respaldado por el acceso a la información que permite el control social mediante una participación efectiva y responsable” (el destacado fue adicionado).
Tesitura que también había sido adoptada en la sentencia de 19 de septiembre de 2006, relativa al caso “Nombre05 y otros vs. Chile”, en la que se dispuso:
“86. En este sentido, el actuar del Estado debe encontrarse regido por los principios de publicidad y transparencia en la gestión pública, lo que hace posible que las personas que se encuentran bajo su jurisdicción ejerzan el control democrático de las gestiones estatales, de forma tal que puedan cuestionar, indagar y considerar si se está dando un adecuado cumplimiento de las funciones públicas. El acceso a la información bajo el control del Estado, que sea de interés público, puede permitir la participación en la gestión pública, a través del control social que se puede ejercer con dicho acceso. 87. El control democrático, por parte de la sociedad a través de la opinión pública, fomenta la transparencia de las actividades estatales y promueve la responsabilidad de los funcionarios sobre su gestión pública. Por ello, para que las personas puedan ejercer el control democrático es esencial que el Estado garantice el acceso a la información de interés público bajo su control. Al permitir el ejercicio de ese control democrá tico se fomenta una mayor participación de las personas en los intereses de la sociedad.”. (El destacado fue adicional).
En adición, la Corte IDH, en la sentencia 27 de noviembre de 2023 dictada en el caso “Habitantes de la Oroya vs. Perú”, dispuso:
“B.2.5.2. Derecho a la participación política 150. El derecho a la participación de los ciudadanos en la dirección de los asuntos públicos se encuentra consagrado en el artículo 23.1.a) de la Convención Americana270 . Con respecto a asuntos ambientales, la Corte ha establecido que la participación representa un mecanismo para integrar las preocupaciones y el conocimiento de la ciudadanía en las decisiones de políticas públicas que afectan al medio ambiente. Asimismo, la participación en la toma de decisiones aumenta la capacidad de los gobiernos para responder a las inquietudes y demandas públicas de manera oportuna, construir consensos y mejorar la aceptación y el cumplimiento de las decisiones ambientales271 . Al respecto, el Acuerdo de Escazú señala que cada Estado Parte “deberá asegurar el derecho de participación del público y, para ello, se compromete a implementar una participación abierta e inclusiva en los procesos de toma de decisiones ambientales, sobre la base de los marcos normativos interno e internacional”272.
151. Asimismo, la Corte advierte que el derecho a la participación política en temas ambientales se encuentra consagrado en diversos instrumentos de Derecho Internacional, tales como la Declaración de Estocolmo273, la Carta Mundial de la Naturaleza de Nairobi274, la Declaración de Río275, la Convención de Aarhus276, y el Convenio sobre Diversidad Biológica277 . En este punto, el Tribunal considera pertinente recordar que la referencia a fuentes, principios y criterios del corpus iuris internacional, en este caso en materia ambiental, no implica que asuma competencia sobre otros tratados o que les reconozca obligatoriedad para los Estados. Esta normativa se utiliza como criterio interpretativo para la determinación del alcance de los derechos protegidos por la Convención Americana y otros instrumentos que son vinculantes para el Estado y sobre los que la Corte tiene competencia, de conformidad con el artículo 29 de la Convención278 .
152. La Corte ha estimado que el derecho de participar en los asuntos públicos consagrado en el artículo 23.1.a) de la Convención Americana establece la obligaci ón de los Estados de garantizar la participación de las personas bajo su jurisdicción en la toma de decisiones y políticas que pueden afectar el medio ambiente, sin discriminación, de manera equitativa, significativa y transparente, para lo cual previamente deben haber garantizado el acceso a la información relevante. Asimismo, que en lo que se refiere a la participación pública, el Estado debe garantizar oportunidades para la participación efectiva desde las primeras etapas del proceso de adopción de decisiones e informar al público sobre estas oportunidades de participación. Finalmente, los mecanismos de participación pública en materia ambiental son variados e incluyen, entre otros, audiencias públicas, la notificación y consultas, participación en procesos de formulación y aplicación de leyes, así como mecanismos de revisi ón judicial279 .
(…)
B.3.6.2. Derecho a la participación política 256. La Corte recuerda que el derecho a la participació n política es uno de los pilares fundamentales de la democracia, pues a través de su ejercicio las personas pueden establecer límites a las gestiones estatales y cuestionar, indagar y considerar el cumplimiento de las funciones públicas. La participación permite a las personas formar parte del proceso de toma de decisiones y así participar en la dirección de los asuntos públicos que afecten el medio ambiente. Este Tribunal ha destacado que este derecho conlleva la obligación de los Estados de garantizar la participación de las personas en la toma de decisiones que pueden afectar el medio ambiente, lo cual se relaciona con la obligación de proveer información relevante. Esta participación debe ser efectiva desde las primeras etapas del proceso de toma de decisiones, lo cual puede realizarse a través de diversos mecanismos (supra párr. 152)” Así las cosas, este reconocimiento convencional a la participación ciudadana incide hermenéuticamente en su naturaleza jurídica, puesto que de principio constitucional lo transforma en verdadero derecho fundamental colectivo.
De este modo, la participación ciudadana representa un aspecto esencial del modelo democrático y republicano de este siglo, en el que el control ciudadano, la transparencia y la rendición de cuentas destacan como elementos expresivos de este tipo de régimen político, lo que a su vez confiere mucha mayor legitimidad a la toma de decisiones políticas, cuestión clave cuando de gobernabilidad se trata. Así, en el marco de este tipo de régimen ‑esto es, con activa y plena participación ciudadana‑, el gobierno participativo impacta con mayor intensidad, favoreciendo la toma de decisiones a través de medios más abiertos y transparentes.
Precisamente, uno de los mecanismos ideados para cumplir lo dispuesto en el numeral 9 constitucional es la audiencia pública, a través de la cual las personas interesadas pueden hacer valer sus derechos o manifestar su criterio, participando de manera activa en temas de relevancia nacional o local, y poniendo en conocimiento de la Administración todas aquellas anomalías o disconformidades en relación con algún proyecto por desarrollar.
Así las cosas, la audiencia pública es un instrumento típico de una democracia republicana, mediante la cual se fomenta la participación del ciudadano en el proceso de toma de decisiones públicas. Por su significado, la audiencia debe efectuarse de tal forma que garantice la mayor participación posible de las personas que puedan verse afectadas, de ahí que cualquier acción u omisión que obstaculice lo anterior configura una abierta vulneración al derecho constitucional a la participación ciudadana (véase, entre otras, la sentencia número 2009-018223 de las 12:34 horas del 27 de noviembre de 2009).
En cuanto al carácter participativo de la audiencia pública, como se indicó, el ordinal 9 de la propia Constitución Política obliga a ello, pues la calificación “participativo ” ahí dispuesta implica, entre otros aspectos, que el Gobierno debe ser un articulador de lo definido por deliberación popular, cuando ello es obligatorio, al tiempo que en la formulación de la política pública, dentro de las posibilidades que el marco jurídico-positivo vigente plantee, está obligado a escuchar el criterio de individuos o grupos afectados, sea este vinculante o no.
En otras palabras, en la democracia republicana actual, los ciudadanos gozan, por mandato constitucional, ya no solo del derecho al voto para ejercer su derecho al gobierno participativo, sino de cantidad de instrumentos de diversa naturaleza para coadyuvar en la toma de decisiones gubernativas y el control político, lo que propicia que puedan ejercer influencia directa en las grandes decisiones públicas.
En este contexto, interesa resaltar que este Tribunal, en la sentencia nro. 2018004117 de las 9:15 horas de 13 de marzo de 2018, realizó un desarrollo respecto a la consulta pública en materia ambiental, destacando que este mecanismo es un pilar en la toma de decisiones relaciones con el medio ambiente. Asimismo, a manera de soft law, acudió a un instrumento particularmente relevante en materia de acceso a la información ambiental y participación ciudadana: el “Convenio sobre el acceso a la información, la participación ciudadana y el acceso a la justicia en la toma de decisiones en temas ambientales”, mejor conocido como “Convenio de Aarhus”. En tal sentido, en el referido pronunciamiento se indicó:
“La Convención de Aarhus, por su parte, en el artículo 6.2.3.4 dispone:
“2. Cuando se inicie un proceso de toma de decisiones respecto del medio ambiente, se informará al público interesado como convenga, de manera eficaz y en el momento oportuno, por medio de comunicación pública o individualmente, según los casos, al comienzo del proceso. Las informaciones se referirán en particular a:
3. Para las diferentes fases del procedimiento de participación del público se preverán plazos razonables que dejen tiempo suficiente para informar al público de conformidad con el párrafo 2 supra y para que el público se prepare y participe efectivamente en los trabajos a lo largo de todo el proceso de toma de decisiones en materia ambiental.
4. Cada Parte adoptará medidas para que la participación del público comience al inicio del procedimiento, es decir, cuando todas las opciones y soluciones son a ún posibles y cuando el público pueda ejercer una influencia real.” De conformidad con lo expuesto, debe propiciarse la consulta de manera transparente y con la mayor información posible. Esto genera una mejor administración de los recursos naturales, contribuye a la transparencia y al adecuado manejo de fondos públicos. Recordemos que el asunto ambiental es un tema de todos los miembros de la sociedad, no solamente del gobierno, por lo que también corresponde a cada ciudadano velar por la conservación del ambiente y procurar un desarrollo sostenible. Es por ello que debe abarcar en forma integral los diferentes sectores de la población (…)”. (El destacado fue adicional).
En adición, en el pronunciamiento aludido, la Sala subrayó que la audiencia ciudadana, por tratarse de una manifestación del principio democrático, no debe convertirse en una simple formalidad que simple y llanamente debe ser agendada, aunque tampoco debe instrumentalizarse como un mero obstáculo para el dictado de una decisión administrativa.
Relacionado con lo anterior, esta Sala ha señalado de modo reiterado, que la Constitución se caracteriza por su supremacía y su eficacia directa e inmediata, merced a las cuales los derechos y garantías que confiere resultan directamente exigibles y vinculantes para todos los Poderes Públicos. Así, en la sentencia nro. 1992-3194 de las 16:00 horas del 27 de octubre de 1992, se puntualizó:
“(…) La Constitución Política en su unánime concepción contemporánea, no sólo es “suprema” en cuanto criterio de validez de sí misma y del resto del ordenamiento jurídico, sino también conjunto de normas y principios fundamentales jurídicamente vinculantes, por ende, exigibles por sí mismos, frente a todas las autoridades públicas, y a los mismos particulares, sin necesidad de otras normas o actos que los desarrollen o hagan aplicables salvo casos calificados de excepción, en que sin ellos resulta imposible su aplicación-; con la consecuencia de que las autoridades tanto administrativas como jurisdiccionales- tienen la atribución-deber de aplicar directamente el Derecho de la Constitución en su pleno sentido, incluso en ausencia de norma de rango inferior o desaplicando las que se le opongan.” Por su parte, en la resolución nro. 1995-1185 de las 14:33 horas de 2 de marzo de 1995, este Tribunal confirmó:
“Si la Constitución Política tiene un carácter normativo supremo, debe efectivamente conformar y condicionar la validez y eficacia de toda norma inferior o subordinada, y sirve de parámetro para legitimar o no la actuación de cualquier autoridad pública y hasta de los sujetos privados.... El principio de supremacía de la Constitución, en el caso costarricense, no solamente lo tenemos expresamente consagrado en el artículo 10, sino que de modo clarísimo, complementado respecto del órgano encargado de mantenerla o preservarla, según lo que adelante analizaremos. Esto que hemos expresado hasta ahora gira alrededor de que la Constitución tiene una eficacia directa y vincula sin necesidad de intermediación de ninguna otra norma. Y, es por ello, que toda autoridad, en general, tiene capacidad y poder para aplicar, desarrollar y expandir los derechos fundamentales contenidos en la Constitución Política.
Si esto no fuera así, toda la argumentación acerca de la jerarquía de las normas, principios y valores constitucionales, caería convertida en una fantasía insubsistente. Sería mera ciencia ficción, una entelequia, en la que simultáneamente existen dos mundos jurídicos ubicados en planos diferentes y sin comunicación entre sí.” En conclusión, la participación ciudadana constituye un derecho constitucional y convencional, que se erige como una cualidad del sistema democrático republicano. Al respecto, los derechos consagrados en la Ley Fundamental, en diverso grado según su contenido sea más o menos programático, tienen una eficacia directa y vinculan sin necesidad de norma alguna. Incluso, su efectividad a través del desarrollo normativo infraconstitucional y la aplicación de este no es ajena al control jurisdiccional de constitucionalidad, cuando se advierten regulaciones, actuaciones u omisiones que representan una lesión al núcleo duro (Kernbereich) de ese bien constitucional.
Asimismo, en la resolución nro. 0291-2024-SETENA de las 9:14 horas del 22 de febrero de 2024 se indicó:
“Hecho 1. Los lineamientos de la Ley orgánica del ambiente y su reglamento, así como el acuerdo acta 0087-2008 de la Comisión Plenaria de la SETENA establecen que debe comunicarse a la población sobre el proyecto, el cual se presenta en folio 000077 del Expediente administrativo D1-17546-2016-SETENA, se presenta el recorte del periódico La República del día 19 de octubre del 2017, donde se hace de conocimiento público. Cabe aclarar que también durante la confección del EsIA, se hace necesario un estudio sociológico según estudios técnicos establecidos en el Manual de Instrumentos Técnicos para el proceso de evaluación de Impacto Ambiental (D:E: N° 32712-MINAE) y el mismo fue realizado por un profesional del área debidamente habilitados por la legislación vigente en el país para realizar este tipo de estudios y con registro vigente en la SETENA”.
En ese tanto, verificamos que el proyecto sí fue puesto en conocimiento general para que el interesado pudiera manifestarse. Tampoco se deriva de lo señalado alguna afectación especial a las áreas habitadas de la zona.
IX.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. Tomen nota las autoridades recurridas de lo indicado en último párrafo del considerando IV de esta sentencia. El Magistrado Salazar Alvarado consigna razones diferentes, al estimar que corresponde a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado. Los magistrados Cruz Castro y Rueda Leal dan razones diferentes en relación con la participación ciudadana.
