CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes on the fourteenth of February two thousand twenty-five.
Amparo action processed in case file No. 24-031068- 0007-CO, filed by Nombre55761, identity card CED28285, on behalf of Nombre55762, identity card CED28286, against the MUNICIPALITY OF ESCAZÚ.
WHEREAS:
Name55788, as recorded in inspection report MS-DRRSCS-DARSE-AIO-AFS-405-2023, a dye test was performed by pouring dye into the sanitary fixtures of the property; following up on that test, as verified in inspection report MS-DRRSCS-DARSE-AIO-AFS-406-2023, the surroundings were checked and personnel remained on site for a 10-minute period; however, no presence of dye was observed. Subsequently, official communication MS-DRRSCS-DARSE-1949-2023 was issued to the Defensoría de los Habitantes detailing the actions taken to date (folios 688-696). On May 21, 2024, during an inspection at the home of Ms. Name55774, as recorded in inspection report MS-DRRSCS-DARSE-AFS-155-2024, a dye test was performed in the property's toilet; upon verification at the affected property, inspection report MS-DRRSCS-DARSE-AIO-AFS-156-2024, no presence of dye was observed. On May 31, 2024, again at the home of Ms. Name55774, the dye test was performed, this time for soapy water, as evidenced in inspection report MS-DRSCS-DARRSE-AIO-AFS-167-2024; dye was poured into the sanitary fixtures of the dwelling, and the presence of dye was observed in the surroundings, so the test was assessed as positive.
On June 24, 2024, official communication MS-DRRSCS-DARSE-1585-2024 was issued with case updates to the Defensoría de los Habitantes. On July 12, 2024, Ms. Name55774 was notified of sanitary order MS-DRRSCS-DARSE-OS-103-2024, ordering her to carry out the corresponding repairs for adequate wastewater management, given that an inadequate disposal of generalized wastewater was evidenced on the reported property, and therefore, a breach of the provisions of the Ley General de Salud, the Reglamento de Construcciones, the Código de Instalaciones Hidráulicas y Sanitarias en Edificaciones, and other binding legislation. On July 16, 2024, official communication No. 08070-2024-DHR was received from the Defensoría de los Habitantes, with recommendations for the case, its receipt being acknowledged via official communication MS-DRRSCS-DARSE-1437-2024. On July 31, 2024, according to inspection report MS-DRRSCS-DARSE-AIO-AFS-249-2024, follow-up on the complaint was conducted and a dye test was carried out at the home of Name55775 (deceased), currently inhabited by Mr.
Name55789, in which dye was poured into the property's sanitary fixtures, this for soapy water; subsequently, the affected area was checked, as recorded in inspection report MS-DRRSCS-DARSE-AIO-AFS-250-2024, but no dye outflow was observed. On August 27, 2024, as recorded in inspection reports MS-DRRSCS-DARSE-AIO-AFS-275-2024 and MS-DRRSCS-DARSE-AIO-AFS-276-2024, with a dye test for blackwater at the home of Mr. Name55789, dye was poured into the dwelling's toilet and subsequently verification was performed at the point of impact where no dye outflow was observed. On August 28, 2024, via official communication MS-DRRSCS-DARSE-1685-2024, a complaint for disobedience to authority was filed with the Pavas Prosecutor's Office, arising from non-compliance with the sanitary order issued to Ms. Name55774. Subsequently, the Prosecutor's Office requested a re-inspection of the dwelling to determine whether the sanitary order had been complied with; it was communicated via official communication MS-DRRSCS-DARSE-1853-2024 that the repairs had not been made, as follows from inspection report MS-DRRSCS-DARSE-AIO-AFS-283-2024.
On October 8, 2024, as recorded in inspection reports MS-DRRSCS-DARSE-AIO-ARC-303-2024, MS-DRRSCS-DARSE-AIO-ARC-304-2024, and MS-DRRSCS-DARSE-AIO-ARC-305-2024, a follow-up inspection was conducted at the home of Ms. Name55773; a dye test for soapy water was performed, where dye was poured into all sanitary fixtures of the dwelling; after the dye test, the point of impact was verified where the presence of dye was observed, resulting in a positive test. On October 22, 2024, according to inspection reports MS-DRRSCS-DARSE-AIO-ARC-323-2024 and MS-DRRSCS-DARSE-AIO-ARC-324-2024, again at the home of Ms. Name55773, the dye test for blackwater was performed, depositing sodium fluorescein-based dye in the sanitary service of the dwelling; later, verification was conducted at the point of impact, but no presence of dye was observed. On November 5, 2024, an inspection was conducted at the home of Mr.
Christian Pérez Rojas, as recorded in inspection reports MS-DRRSCS-DARSE-AIO-ARC-343-2024 and MS-DRRSCS-DARSE-AIO-ARC-344-2024, applying a dye test for soapy water, pouring dye into all sanitary fixtures of the dwelling; after the dye test, the point of impact was verified; however, at that moment no presence of dye was observed. On November 9, 2024, as recorded in inspection reports MS-DRRSCS-DARSE-AIO-ARC-356-2024 and MS-DRRSCS-DARSE-AIO-ARC-357-2024, the dye test for blackwater was performed at the home of Mr. Christian Pérez Rojas, where sodium fluorescein dye was deposited in the sanitary service of the dwelling; later, verification was conducted at the point of impact, but no presence of dye was observed either. In this vein, it can be seen that the Área Rectora de Salud Escazú has not been neglectful in fulfilling its duties, and in response to the complaint, it has taken the appropriate actions in accordance with its delegated powers, issuing the necessary administrative acts and following up on the case at hand; therefore, the petitioner's claim that this Authority has not acted on said complaint is emphatically rejected.
It must be noted here and clearly understood that the logistics of handling complaints such as the one before us, as demonstrated by the actions described above, do not allow for an immediate approach that would bring the impact to a swift conclusion, given that dye tests based on sodium fluorescein must be applied—the sole qualitative tracer for ordinary and stormwater wastewater—which, as noted, is applied in each and every sanitary fixture of the properties, and cannot be performed on several properties at once, as this could generate biases and disrespect for the principles of attribution and notification, which would result in defenselessness for the administered parties. Added to the above, as indicated earlier, the panorama that unfolded between 2020, 2021, and 2022 must be considered, with the declaration of the state of emergency Decreto Ejecutivo N° 42227-MP-S, in effect from March 16, 2020, until August 2022, during which this Ministry of Health played a predominant role in primary care for the disease, causing the routine functions involving attention to complaints of inadequate water disposal to take a back seat.
Notwithstanding the foregoing, note that the administrative proceedings regarding the complaint brought by the petitioner here have not been neglected, and since it involves a large number of properties to test, the total completion of the fieldwork to be applied is delayed. Also relevant is the refusal of the reported parties to cooperate with ministerial actions, or even their lack of seriousness and commitment to addressing the sanitary problem that evidences a latent risk to Public Health, in response to which time and functions must be expended on opening judicial proceedings to claim disobedience to Authority. It is worth mentioning, with respect to the alleged demolition of buildings due to lack of municipal permits, that this administrative body has no knowledge whatsoever of a supposed demolition declaration notified by the Municipalidad de Escazú in December 2022, an institutional entity which, by competence, would be responsible for ruling on the matter." It requests that the appeal be declared without merit.

CONSIDERING:
Before analyzing the merits of the case—regarding the alleged violation of the right to a swift and completed procedure—it must be clarified that, starting from judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied or not with the timeframes established by the Ley General de la Administración Pública (articles 261 and 325) or by sectoral laws relating to special administrative procedures, both for resolving an administrative procedure by final act—initiated ex officio or at the request of a party—and for hearing the admissible administrative appeals. Precisely in this case, an exception is raised, as it concerns a lack of response and action on the part of the respondent authority in resolving a complaint made regarding problems of diversion of sewage and stormwater onto the petitioner's property.
The appellant alleges that the petitioner is the owner of property No. 79965-000, located fifty meters south of the Iglesia del Corazón de Jesús, in the district of San Antonio de Escazú. She indicates that the petitioner has filed several complaints before the Municipalidad de Escazú, warning about the existence of irregular constructions on the property bordering the south of her land, which has caused the diversion of sewage and stormwater onto her property. She states that, as a result of the complaints filed, the respondent municipality ordered the demolition of said constructions; however, she accuses that as of the date of filing this matter, said order has not been executed. She requests the intervention of the Chamber.
Of importance for the decision in this matter, the following facts are deemed duly proven:
Regarding the Municipalidad de Escazú 1. The petitioner Name55762 is the owner of property No. 79965-000, located fifty meters south of the Iglesia del Corazón de Jesús, in the district of San Antonio de Escazú. (reports rendered and filing brief); 2. In 2014, the petitioner filed complaints before the respondent municipality regarding the existence of irregular constructions on the property bordering the south of her land, which cause the diversion of sewage and stormwater onto the petitioner's property, a situation that has caused unsanitary problems, deterioration in the property's structures, and environmental damage in the area. (reports rendered and filing brief); 3. The complaints filed by the petitioner before the respondent municipality are processed under case files: PA-20-14; PA-46-14; and PA-OO8-16. (report rendered); 4. By resolution NOT-IG-2023 of 10:00 a.m. on November 16, 2023, the respondent municipality issued a demolition order for the constructions on the reported property.
(report rendered and evidence provided); 5. On January 23, 2024, the resolution of the demolition order was notified to the interested parties. (report rendered and evidence provided); 6. On October 25, 2024, the interested parties filed an extraordinary appeal for review against the demolition order issued by the respondent municipality. (report rendered); 7. By resolution RES-DAME-323-2024 of November 6, 2024, the respondent municipality proceeded to resolve the extraordinary appeal for review, rejecting it outright. (report rendered); 8. On November 13, 2024, the respondent municipality formally communicated to the petitioner that the execution of the demolition was pending due to the existence of appeals to be resolved, in order to exhaust the administrative channel. (report rendered).
Regarding the Área Rectora de Salud de Escazú 9. On May 8, 2019, the Municipalidad de Escazú forwarded to that Área Rectora de Salud a complaint filed before said municipality against a group of dwellings located at Address104, Address3164, for inadequate disposal of wastewater. (report rendered and evidence provided); 10. On May 15, 2019, the petitioner filed before that area a formal complaint for poor management of wastewater and stormwater reported against a group of dwellings located at Address104, Address3164, for inadequate disposal of wastewater. (report rendered and evidence provided); 11. The complaint was processed under case file No. 14259-19, against the properties on the southern boundary of the property. (report rendered and evidence provided); 12. From June 18, 2019, until November 9, 2024, the respondent Área Rectora de Salud has carried out numerous actions on the indicated property, which consists of 19 rights, such as dye tests in the reported properties and issued the respective sanitary orders. (report rendered and evidence provided).
From the report rendered under oath by the respondent authority, under the warnings, including criminal ones, set forth in article 44 of the Ley de la Jurisdicción Constitucional, and the documentation provided to the case file, it is accredited that the appellant appears in amparo and alleges that the petitioner is the owner of property No. 79965-000, located fifty meters south of the Iglesia del Corazón de Jesús, in the district of San Antonio de Escazú. She indicates that the petitioner has filed multiple complaints before the Municipalidad de Escazú, warning about the existence of irregular constructions on the property bordering the south of her land, which affects her property by the diversion of sewage and stormwater. She states that, as a result of the complaints, the respondent municipality ordered the demolition of said constructions; however, she accuses that, as of the date of filing this matter, said order has not been executed.
From the foregoing, it is accredited that, due to the complaints made by the petitioner, the respondent authorities carried out the respective site inspections and thereby determined the existence of irregular constructions that affect the petitioner's property, regarding the issue of water diversion. For this reason, the respondent municipality issued a demolition order for the illegal constructions on the reported property, in order to resolve the problem afflicting the petitioner. Thus, it is on record that the respondent authorities have already concluded the procedure, and that the execution of the demolition of the works was pending, due to the existence of appeals to be resolved in order to exhaust the administrative channel, a situation of which the interested party has been made aware.
Now, what this Chamber observes is that the interested party appears in amparo due to the lack of execution of an administrative provision, specifically the demolition of works located on a property adjoining hers. On this matter, the petitioner is warned that what is alleged constitutes an ordinary legality dispute outside the sphere of competence of this Jurisdiction. Indeed, this Court cannot, nor should it, supplant public offices in resolving matters that, by their nature and by express mandate of the Law, must be resolved by them, nor does it correspond to execute the final decisions of administrative entities and bodies, such as the decreed demolition order, an aspect that exceeds the purpose of the amparo appeal. In any case, the Chamber notes that, as of the filing date of this amparo, that administrative act was not even final, as the process of resolving the corresponding challenge appeals against such act was underway. Thus, the appellant shall—if she deems it appropriate—file her claim and manage whatever is appropriate before the respondent entity itself, or through the competent jurisdictional channel, venues where she may, in a broad manner, discuss the merits of the matter and assert her claims.
For the foregoing reasons, the appeal is declared without merit.
The parties are forewarned that, if any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or produced by new technologies has been provided, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 4l3-12 held on May 3, 2012, article LXXXI.
THEREFORE:
The appeal is declared without merit. Notify.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de febrero de dos mil veinticinco .
Recurso de amparo que se tramita en expediente número No. 24-031068- 0007-CO, interpuesto por Nombre55761, cédula de identidad CED28285, a favor de Nombre55762, cédula de identidad CED28286, contra la MUNICIPALIDAD DE ESCAZÚ.
RESULTANDO:
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
Antes de analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se trata de falta de respuesta y acción por parte de la autoridad accionada, en resolver una denuncia realizada por problemas de desvío de aguas servidas y pluviales hacia la propiedad de la tutelada.
La recurrente alega, que la amparada es propietaria de la finca No. 79965-000, ubicada cincuenta metros al sur de la Iglesia del Corazón de Jesús, en el distrito de San Antonio de Escazú. Señala, que la tutelada ha presentado varias denuncias ante la Municipalidad de Escazú, alertando sobre la existencia de construcciones irregulares en la propiedad colindante al sur de su terreno, que ha generado el desvío de aguas servidas y pluviales hacia su propiedad. Indica que, a raíz de las denuncias presentadas, la municipalidad accionada ordenó la demolición de dichas construcciones; sin embargo, acusa que a la fecha de interposición del presente asunto, no se ha procedido a ejecutar dicha orden. Solicita la intervención de la Sala.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Sobre la Municipalidad de Escazú 1. La tutelada Nombre55762, es propietaria finca No. 79965-000, ubicada cincuenta metros al sur de la Iglesia del Corazón de Jesús, en el distrito de San Antonio de Escazú. (informe rendidos y escrito de interposición); 2. En el año 2014, la amparada presentó denuncias ante la municipalidad accionada, sobre la existencia de construcciones irregulares en la propiedad colindante al sur de su terreno, que generan el desvío de aguas servidas y pluviales hacia la propiedad de la amparada, situación que ha provocado problemas de insalubridad, deterioro en las estructuras del inmueble y daños ambientales en la zona. (informe rendidos y escrito de interposición); 3. Las denuncias presentadas por la tutelada, ante la municipalidad accionada, se tramitan en los expedientes: PA-20-14; PA-46-14 y; PA-OO8-16. (informe rendido); 4. Por resolución NOT-IG-2023 de las 10:00 horas del 16 de noviembre de 2023, la municipalidad recurrida giró orden de demolición de las construcciones en la propiedad denunciada.
(informe rendido y prueba aportada); 5. El 23 de enero de 2024, se notificó a las partes interesadas la resolución de la orden de demolición. (informe rendido y prueba aportada); 6. El 25 de octubre de 2024 se presentó por parte de los interesados, recurso extraordinario de revisión contra la orden de demolición ordenada por el municipio accionado. (informe rendido); 7. Mediante resolución RES-DAME-323-2024 del 6 de noviembre de 2024, la municipalidad recurrida procedió o resolver el recurso extraordinario de revisión, rechazándolo de plano. (informe rendido); 8. El 13 de noviembre de 2024, el municipio accionado comunicó formalmente a la tutelada, que la ejecución de la demolición se encontraba pendiente, por la existencia de recursos por resolver, a fin de agotar la vía administrativa. (informe rendido).
Sobre el Área Rectora de Salud de Escazú 9. El 8 de mayo del 2019, la Municipalidad de Escazú, trasladó a esa Área Rectora de Salud, denuncia interpuesta ante dicho municipio, contra un grupo de viviendas ubicadas en Dirección104, Dirección3164, por inadecuada disposición de aguas residuales. (informe rendido y prueba aportada); 10. El 15 de mayo del 2019, la amparada presentó ante esa área rectora, denuncia formal por mal manejo de aguas residuales y pluviales denunciado contra un grupo de viviendas ubicadas en Dirección104, Dirección3164, por inadecuada disposición de aguas residuales. (informe rendido y prueba aportada); 11. La denuncia se tramitó bajo el expediente N° 14259-19, contra los inmuebles de la colindancia sur de la propiedad. (informe rendido y prueba aportada); 12. Desde el 18 de junio de 2019 y hasta el 09 de noviembre de 2024, el área Rectora de Salud recurrida, ha realizado numerosas actuaciones en la propiedad indicada, la cual consta de 19 derechos, como pruebas de decoloración en los inmuebles denunciados y dictó las respectivas órdenes sanitarias. (informe rendido y prueba aportada).
Del informe rendido bajo fe de juramento por la autoridad recurrida, bajo los apercibimientos, incluso penales, señalados en el numeral 44 de la Ley de la Jurisdicción Constitucional, y la documentación aportada al expediente, se acredita, que la recurrente acude en amparo y alega, que la amparada es propietaria de la finca No. 79965-000, ubicada cincuenta metros al sur de la Iglesia del Corazón de Jesús, en el distrito de San Antonio de Escazú. Señala, que la tutelada ha presentado múltiples denuncias ante la Municipalidad de Escazú, alertando sobre la existencia de construcciones irregulares en la propiedad colindante al sur de su terreno, que afecta su propiedad por el desvío de aguas servidas y pluviales. Indica que, a raíz de las denuncias, la municipalidad accionada ordenó la demolición de dichas construcciones; sin embargo, acusa que, a la fecha de interposición del presente asunto, no se ha procedido a ejecutar dicha orden.
De lo expuesto, se tiene por acreditado que, debido a las denuncias realizadas por parte de la tutelada, las autoridades recurridas realizaron las respectivas inspecciones al sitio y con ello, se determinó sobre la existencia de construcciones irregulares que afectan la propiedad de la amparada, sobre el tema del desvío de aguas. Por lo anterior, la municipalidad recurrida giró orden de demolición de las construcciones ilegales en la propiedad denunciada, a fin de resolver el problema que le aqueja a la tutelada. Así, consta, que las autoridades accionadas ya concluyeron el procedimiento, y que la ejecución de la demolición de las obras se encontraba pendiente de realizar, por la existencia de recursos por resolver, a fin de agotar la vía administrativa, situación que se le ha puesto en conocimiento a la interesada.
Ahora bien, lo que aprecia la Sala es que la interesada acude en amparo, debido a la falta de ejecución de una disposición administrativa, específicamente la demolición de unas obras que se encuentran en una propiedad que colinda con la suya. Sobre este tema, se le advierte a la tutelada, que lo alegado constituye un conflicto de legalidad ordinaria ajeno al ámbito de competencia de esta Jurisdicción. En efecto, este Tribunal no puede, ni debe suplantar a los despachos públicos en la resolución de los asuntos que, por su naturaleza y por mandato expreso de la Ley, que deban ser resueltos por ellos, ni tampoco corresponde ejecutar las decisiones firmes de los entes y órganos administrativos, como la orden de demolición decretada, aspecto que excede el objeto del recurso de amparo. En todo caso, la Sala aprecia que, para la fecha de interposición de este amparo ese acto administrativo ni siquiera estaba en firme, pues estaba en proceso de resolver los recursos de impugnación correspondientes contra tal acto. Así, deberá la recurrente -si a bien lo tiene- presentar su reclamo y gestionar lo que corresponda, ante la propia entidad recurrida, o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.
Por lo expuesto, se declara sin lugar el recurso.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 4l3-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Notifíquese.
