Amparo proceeding (recurso de amparo) processed under expediente number 24-034446-0007-CO, filed by Nombre01, identity card NFP06, Nombre02, identity card NFP03, Nombre04, identity card NFP04, Nombre07, identity card NFP01, Nombre05, identity card NFP02, and Nombre03, identity card NFP05, against the MUNICIPALIDAD DE GOLFITO.

Background:

  1. 1In a written submission filed before this Chamber at 14:18 on 06 de diciembre de 2024, the petitioners filed an amparo proceeding against the Municipalidad de Golfito. They state that, through letters dated 31 de enero de 2021, 15 de octubre de 2021, and 28 de noviembre de 2022, they submitted written requests and appeared before the Concejo and its mayor, asking them to budget funds to carry out a series of public works in Barrio KM1 de Golfito because the situation places them at risk and they have been unable to obtain any kind of solution. They state that the entire community pays curb-and-gutter taxes (impuestos de cordón y caño) so that emergencies of this kind will be addressed, but two municipal administrations have already passed and neither has seen fit to resolve the deterioration of the drainage channels (caños) adjacent to their homes, which pose an increasing danger whenever it rains.They state that the works they have urgently requested include the construction and repair of the floors and walls of the two large drainage channels in the center of the neighborhood; construction of drainage channels and sidewalks all the way around from the neighborhood Escuela to Bazar Priscila]; concrete construction of the large drainage channel that currently has an earthen bed, from the entrance to the former granary to the sixth row of KM1, and, in parallel with construction of the drainage channel, the installation of a sidewalk in accordance with Ley 7600; and construction of gabions (gaviones) beside the houses in the La Bolsa KM1 residential area. In a document addressed to the Concejo on 31 de enero de 2021, they informed the Municipalidad of the poor-quality work performed on the pavement of the streets of KM1 de Golfito, as well as the failure to complete 80 meters of the road leading up to the El Disco neighborhood and ending at the mountain; these had been prepared by the construction company through completion of the final base but without application of the asphalt, and the Municipalidad failed to supervise to ensure that the work was completed in full and that the asphalt layer was not substandard. They consider that this omission violates their fundamental rights.
  2. 2By decision issued at 15:15 on 13 de diciembre de 2024, the Presidency of the Chamber admitted this amparo proceeding and requested a report from the mayor and the president of the Concejo, both of the Municipalidad de Golfito, concerning the facts alleged by the petitioners.
  3. 3In a written submission added to the digital expediente at 12:27 on 06 de enero de 2025, Freiner Lara Blanco and Alfonso Rojas Loría, under oath and in their respective capacities as mayor and president of the Concejo Municipal, both of Golfito, report as follows:

“FIRST: With reference to the written submission filed by Mr. Nombre01 AND OTHERS, it is clear that they are reporting a problem concerning the adjacent drainage channels in the KM 1 neighborhood, among other matters. SECOND: Regarding the statements made by the protected party, I must inform you that, following an assessment conducted pursuant to official letter OF-MG-UTG-354-12-2024, it was determined that the Km 1 area (Dirección04, up to the sixth row) does not experience flooding as a consequence of the absence of roadside ditches (cunetas). THIRD: Along the same lines, we must indicate that the Municipalidad de Golfito is conducting a topographic survey (levantamiento topográfico) in the curb-and-gutter area to determine the conditions in the area and proceed with the construction of roadside ditches during the first half of 2025. FOURTH: The survey is intended to determine whether the homes are located within the right-of-way (derecho de vía).

According to the road inventory, the road identified by code PRN01 (Dirección02) has a right-of-way of 10 meters and a traveled surface of 4 meters. Under the regulations currently in force, the law requires a right-of-way of 14 meters; therefore, the original infrastructure does not meet current standards because it was built during the Compañía Bananera period. FIFTH: Regarding the gabion wall, it is reported that the affected properties have not left the space stipulated by law. (Article 33 of Ley Forestal) establishes that owners of land crossed by rivers must maintain a 15-meter setback (retiro) in rural areas and a 10-meter setback in urban areas on each side of rivers and streams if the land is flat. If the land is sloped, the setback must be 50 meters. In this case, the properties violated that setback requirement. SIXTH: Regarding the paving work, it is reported that pavements have an estimated useful life of 10 years, and the roadway in question has been in place for 18 years since its construction, meaning that it has already completed its useful life cycle.

It is therefore currently being scheduled for improvement in 2026. Regarding the 80 meters mentioned between the El Disco sector and the mountain, it is clarified that this area is not registered in the municipal road inventory and therefore cannot be considered for the requested improvements. In view of the foregoing observations, the Municipalidad, Unidad Técnica de Gestión Vial, and Concejo Municipal have addressed the needs of the sector in question within the legal framework under which this municipality is authorized to act. Based on the foregoing statements and evidence, we respectfully request that the protected party’s application be denied. Official letter OF-MG-UTG-354-12-2024 is attached.”

  1. 4The legal requirements have been observed in the proceedings conducted.

Justice Castillo Víquez drafts the opinion; and,

Considerations:

I.Subject matter of the proceeding. The petitioners state that, through letters dated 31 de enero de 2021, 15 de octubre de 2021, and 28 de noviembre de 2022, they submitted requests to the Concejo Municipal and the Alcaldía de Golfito for funds to be allocated to the execution of works in Barrio KM1, without having received an effective solution. They state that, although the community pays curb-and-gutter taxes, two municipal administrations have passed without addressing the deterioration of the drainage channels adjacent to their homes, which pose an increasing risk, particularly during the rainy season. The requested works include the construction and repair of the floors and walls of the two large drainage channels in the center of the neighborhood; the construction of drainage channels and sidewalks from the neighborhood Escuela to Bazar Priscila; concrete construction of the large drainage channel that currently has an earthen bed, from the entrance to the former granary to the sixth row of KM1; and the installation of a sidewalk in accordance with Ley 7600.

They have also requested the placement of gabions beside the homes in the La Bolsa KM1 residential area. Likewise, in the written submission addressed to the Concejo on 31 de enero de 2021, they reported the deficient execution of the pavement on the streets of KM1 de Golfito and the failure to construct 80 meters of road in the sector leading up to the El Disco neighborhood and ending at the mountain. They state that the construction company prepared the road base but did not apply the corresponding asphalt layer, and that the Municipalidad failed to supervise the proper completion of the work or the quality of the material used. They therefore request the intervention of this Court.

II.Preliminary matter. Before examining the merits of the case—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which the issue is whether the public administration has complied with the time limits established by Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, both for issuing a final administrative act (acto final) resolving an administrative proceeding initiated ex officio or at the request of a party and for adjudicating the available administrative appeals (recursos administrativos). This case presents precisely such an exception because it concerns repeated requests for the execution of works in Barrio KM1 de Golfito that the respondent Municipalidad allegedly failed to address within a reasonable period, causing flooding that affects members of the community. Having clarified this point, the Chamber now rules on the specific situation raised in this amparo proceeding.

III.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondent authorities failed to address them as ordered in the initial ruling:

  • 1)On 31 de enero de 2021, through a letter addressed to the Concejo Municipal de Golfito, the petitioners expressly requested the following: “1) Construction and repair of the floors and walls of the 2 large drainage channels in the center of km1. 2) Construction of drainage channels and sidewalks all the way around from the km1 Escuela to Bazar Priscilla. 3) Concrete construction of the large drainage channel from the entrance to the former granary to the sixth row of km1. And, in parallel, a sidewalk in the same direction to the sixth row. 4) Construction beside the houses in the area known as La Bolsa, at the stream, and installation of gabions.” (See the initiating submission and the evidence provided in the digital expediente.)
  • 2)On 15 de octubre de 2021, petitioner Nombre06, through a letter addressed to the Concejo Municipal de Golfito, requested the following: “The residents of km1 de Golfito submitted a written statement signed by several citizens of this community concerning a serious problem with the 2 large drainage channels and the poor-quality asphalt work on Dirección05. We received a document from the Secretaría Municipal stating that, by agreement, a commission had been appointed for that purpose. Six months later, the stated objective has not been fulfilled. Councilwomen and Councilmen, we want to know what happened to that commission and whether the inspection will be carried out so that we can await their arrival, since this problem involving the streets, drainage channels, and other matters needs to be included in the budget so that the work can be performed” (see the initiating submission and the evidence provided in the digital expediente).
  • 3)On November 28, 2022, the petitioners submitted a written request addressed to the Municipalidad de Golfito, in which they stated as follows: “Members of the Municipal Council of the Canton of puerto Golfito, regarding the matter before us, which also concerns us as residents of the Dirección05 neighborhood, on 17 -03 -2021 we submitted a document signed by more than 50 people. On that occasion, we requested that a committee inspect the site of the 3 existing latent problems. According to a receipt from the municipality dated Thursday, October 27, 2021, we reiterated our request for the committee to take action. That committee conducted the field inspection on Thursday, February 10, 2022; as noted, it took far too long—12 months—to assess the situation. On the day of the field inspection, it was agreed with the members of the Municipal committee, Mr. Luis Fernando Bustos, Mr. Serafín, and Mr.

Alcides Rueda, that top priority would be assigned to the 2 large drainage channels (caños), which have holes and may collapse; moreover, the 2 drainage channels with subsidence no longer exist—the 2 channels have deep subsidence—raising the risk of loss of human life if the local government does not give the matter the appropriate attention. It is regrettable for the Kilómetro uno neighborhood group to have to ask again, 10 months later, what report that committee submitted to the collegial body of the Municipalidad de Golfito, since nothing has been communicated to date. We wish to know whether the Municipal Council has already issued a decision regarding the emergencies experienced in this neighborhood and whether it budgeted sufficient funds to perform the work that is urgently needed in this neighborhood next summer. However, on 14 -10 -2022, at the UTGV office, they filled out an inspection request for us, which I attach.

In this inspection request from the municipal technical road-management unit, they appear not to understand the seriousness of the matter despite our efforts, and we understand that this will remain so until we pay for the legal inspection of the site. We, the undersigned residents of Dirección05, request that you adopt a final municipal resolution declaring the Dirección05 neighborhood to be in a state of emergency, and that the respective Council hold a Municipal session as soon as possible in the heart of km 1, and that the municipal resolution request funding to address the existing problems once and for all, namely: Construction and repair of the floors and walls of the 2 large drainage channels in the center of km1. Construction of drainage channels and sidewalks all the way around the km1 school and up to Bazar Priscilla. Construction of a handmade drainage channel from the entrance to the former grain warehouse to the sixth row of km1.

And, in parallel, a sidewalk running in the same direction to the sixth row. Installation of gabions (gaviones) along the houses in the neighborhood known as la bolsa, beside the stream. We hope to have the full Municipal Council meet in km1, something not very common, but it can be done, it is feasible, and you will do it. Thank you.” (see the initial petition and the evidence submitted in the digital case file).

  • 4)The Municipalidad de Golfito is conducting a topographic survey (levantamiento topográfico) in the curb-and-gutter area (área de cordón y caño) to determine conditions in Barrio KM1 de Golfito and proceed with constructing the required gutters during the first half of 2025 (see the report of the respondent authorities and the evidence submitted in the digital case file).
  • 5)The Municipalidad de Golfito conducted a survey to determine whether the homes are located within the right-of-way (derecho de vía). According to the road inventory, the road identified by code PRN01 (Dirección02) has a 10-meter right-of-way and a 4-meter traveled surface (superficie de ruedo). However, under the regulations currently in force, the law requires a 14-meter right-of-way; therefore, the original infrastructure does not meet current standards because it was built during the Compañía Bananera period. Regarding the paving work, it was reported that pavements have an estimated useful life of 10 years, while the roadway in question has been in service for 18 years since its construction and has therefore reached the end of its useful life. Consequently, improvements to it are currently being scheduled for 2026 (see the report of the respondent authorities and the evidence submitted in the digital case file).

IV.Regarding the request for gutters and paving in Barrio km1 de Golfito. The appellants state that, through letters dated January 31, 2021, October 15, 2021, and November 28, 2022, they submitted requests to the Concejo Municipal and the Alcaldía de Golfito for funds to be allocated to carry out work in Barrio KM1, without receiving an effective solution. They state that, even though the community pays curb-and-gutter taxes, two municipal administrations have passed without addressing the deterioration of the drainage channels adjacent to their homes, which pose a growing risk, particularly during the rainy season. The requested work notably includes constructing and repairing the floors and walls of the two large drainage channels in the center of the neighborhood; constructing drainage channels and sidewalks from the neighborhood’s Escuela to Bazar Priscila; constructing a concrete lining for the large drainage channel that currently has an earthen bed, from the entrance to the former granary to the sixth row of KM1; and providing a sidewalk in accordance with Ley 7600. Nevertheless, they state that, as of the date on which this amparo proceeding (recurso de amparo) was filed, their requests had been disregarded.

In this regard, it must be noted that the actions of public institutions must be characterized by promptness and efficiency, particularly in providing the services within their purview. Because municipalities are responsible for addressing local interests and needs, their work encompasses a broad range of responsibilities. On this matter, in Judgment No. 2011-012886, issued at 12:44 p.m. on September 23, 2011, this Chamber ruled as follows:

“As established by Article 169 of the Political Constitution and the Municipal Code, municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipality must establish a comprehensive urban-planning policy in accordance with the applicable law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electrical and communications services; sound systems for supplying drinking water and disposing of wastewater; adequate aqueduct and sewerage systems; city lighting and beautification systems; and services for constructing, repairing, and cleaning streets and other public roads; in general, concrete and practical plans to make the lives of the population comfortable and safe. In the specific case, the respondent Mayor states that the roads mentioned by the appellant were not included in the annual strategic plan that public institutions must submit and that, therefore, public funds cannot be committed unless they have been budgeted.

He states that they will conduct a site visit to arrange for the repair of the roads referred to by the appellants. Apart from the report rendered under oath, nothing is said about the processing of the request for information concerning the lack of maintenance of public roads serving a social interest, nor is there any indication that a response was provided, even though the request was submitted in May 2011. Under these circumstances, this Chamber finds that the local government clearly failed to safeguard the appellants’ fundamental rights, because its failure to exercise fully the powers granted to it by law allowed the problems reported by the appellants to arise and persist, particularly those caused by the lack of maintenance of public roads, whose damaged condition leaves the residents of the Nueve Millas, Moín Limón community cut off. Furthermore, the case file does not establish that the municipal authorities responded to the letter submitted on May 16, 2011, to the Technical Unit of the Municipality of the Canton’s Road Board, requesting information regarding the lack of maintenance of public roads of concern to them.

Consequently, in this Court’s judgment, through its omission, the Municipality endangered the appellants’ and the community residents’ freedom of movement, as well as their right to enjoy a healthy and ecologically balanced environment” (Emphasis and underlining not in the original).

In the present case, this Chamber finds that the protected party’s (amparado) fundamental rights were violated, since an analysis of the case file reveals an unjustified omission by the Municipalidad de Golfito in addressing the requests submitted by the appellants. Since 2021, they have repeatedly sought the construction of gutters and the paving of the streets of Barrio KM1, without the administration providing an effective solution to their requests. Although the appellants have approached the Concejo Municipal and the Alcaldía on multiple occasions to request that resources be allocated to carry out this essential work, the municipality has postponed its intervention, limiting itself to conducting technical studies and making long-term plans without adopting concrete and immediate measures.

The construction of gutters is an essential function for the proper management of public space and urban infrastructure. In this case, the municipality has stated that a topographic survey is underway to determine conditions in the area and proceed with constructing the gutters during the first half of 2025. However, this assertion does not justify the prolonged failure to address the requests, since years have passed since the appellants explained the need for this work, without any intervention having been carried out at the site. The municipal administration is obligated to ensure proper water channeling and the protection of road infrastructure; therefore, the delay in implementing solutions directly impairs the appellants’ right to receive efficient public services.

Regarding paving, the municipality has stated that the streets in question have an estimated useful life of ten years but that eighteen years have passed since their construction and they are therefore deteriorated. Despite acknowledging this situation, the administration has stated that the improvement work is not scheduled until 2026, unnecessarily prolonging the harm suffered by the neighborhood’s residents. Likewise, regarding the 80 meters of roadway in the El Disco sector, the municipality has stated that this area is not recorded in the municipal road inventory. However, this does not relieve the administration of its obligation to address the community’s road needs and provide a clear and definitive response concerning its jurisdiction in the matter, rather than leaving the appellants in a state of uncertainty.

The justifications offered by the Municipality do not negate its administrative inaction. Long-term planning of public works cannot serve as an excuse for indefinitely postponing urgent interventions. The prolonged failure to construct gutters (cunetas) and the lack of immediate attention to street paving (pavimentación) directly affect the petitioners’ right to the proper provision of municipal services and to a prompt administrative resolution of their requests.

In this context, the conduct of the municipal administration violates the fundamental rights of the petitioners, who have been subjected to an unjustified delay in addressing their basic infrastructure needs. The right to a prompt administrative resolution requires public entities to respond clearly and within reasonable periods to citizens’ requests, avoiding unjustified delays or failures to perform their duties. Accordingly, the lack of effective intervention in constructing gutters and paving the streets of Barrio KM1, coupled with the absence of specific responses concerning road management, constitutes a violation of the fundamental rights of the protected parties (amparados), whose legitimate expectations of having adequate infrastructure in their community have been deferred. Consequently, the petition for amparo (recurso de amparo) must be granted with respect to these claims.

V.Regarding the gabion wall (muro de gaviones). With respect to the request to construct a gabion wall in Barrio KM1, this Chamber finds no violation of the petitioners’ fundamental rights, because the Municipality of Golfito’s refusal is based on technical and regulatory grounds that restrict the execution of the requested project. According to the report submitted under oath by the municipal authorities, the properties in the area have not complied with the mandatory setback (retiro obligatorio) established by current legislation governing the protection of natural watercourses (cauces naturales), which prevents the administration from allocating resources to intervene in an area that is in violation of the applicable regulations.

Article 33 of the Ley Forestal provides that owners of land crossed by rivers and streams must maintain a strip of 15 meters in rural areas and 10 meters in urban areas on each side of the watercourses when the land is flat. Where the terrain is uneven, the setback must be 50 meters. In this case, the municipality has determined that the properties for which construction of the gabion wall is requested have failed to comply with this provision because they are located within the restricted zone (zona de restricción). This circumstance not only prevents the project from being carried out but also makes it legally impossible for the administration to intervene in an area that, by legal mandate, may not be occupied or altered by permanent structures. Based on this information, it is clear that this is not merely an administrative refusal, but rather the application of current environmental regulations, which prohibit allocating public funds to a project whose execution would contravene legal provisions. Furthermore, the petitioners have not demonstrated that conditions in the area would permit municipal intervention without violating the requirements established by forestry legislation; therefore, their claim lacks merit. Consequently, the claim on this point must be dismissed.

VI.Note by Justice Castillo Víquez regarding prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo), rather than by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the petition for amparo provided for in article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights.

In my view, the newly enacted legislation does not mean that this Court must modify its line of precedent, as, pursuant to section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional cases properly heard in this jurisdiction through the constitutional amparo proceeding (proceso constitucional de garantía del amparo), in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (el Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VII.Dissenting opinion (voto salvado) of Justice Garro Vargas. Although I have joined the majority in cases raising similar grievances, upon further consideration I believe that complaints of this kind—in which no serious risk to the health, physical integrity, or life of the protected persons is apparent—must be raised through the ordinary legal channels (vías ordinarias de legalidad). This is particularly so when the record does not establish the existence of a properly identified person who requires the protection of this jurisdiction because of threats to the fundamental rights already identified, or who belongs to a vulnerable group requiring this Chamber’s intervention.

I consider that, in such circumstances, the inaction must first be challenged before the authorities responsible for administering the road and stormwater infrastructure of Barrio KM1 de Golfito and then, if the omission persists, before the contentious-administrative jurisdiction. That judicial forum, with its broader range of tools, can conduct an in-depth examination and assessment of the underlying complaint, evaluate the administrative conduct, issue specific orders to address the identified problem, and, of course, monitor compliance with the judgment.

In the case at bar (sub lite), the petitioners complain of the lack of municipal intervention in constructing gutters and paving streets in Barrio KM1 de Golfito. Thus, without identifying or specifying any particular individual, they assert that this omission has caused flooding and infrastructure deterioration, affecting residents’ quality of life. In my view, that fact alone is sufficient to dismiss the petition for amparo. This Court has stated that, based on the effects conferred upon the petition for amparo by the Ley de la Jurisdicción Constitucional (arts. 41 and 49), it must be concluded that any person may file such a petition, provided that the person identifies the individuals whose fundamental rights he or she believes were violated (see, for example, judgments numbers 2019-003879, 2021-017532 and 2022-009133, among others). Consequently, respectfully and from my perspective, it does not appear valid, based on a generic assertion that residents have been affected, for this Court to adjudicate administrative inaction that should more properly be brought before the contentious-administrative jurisdiction.

In addition, in this specific case it must be noted that the report submitted under penalty of perjury emphasized that the Municipality of Golfito had conducted a topographical survey (levantamiento topográfico) in the area to determine the conditions in Barrio KM1 and proceed with construction of the gutters during the first half of 2025. It was also reported that the street paving is being scheduled for improvement in 2026, in accordance with municipal planning and budget availability.

In light of these factors, I consider that no direct and imminent threat to the aforementioned fundamental rights has been established. Rather, this Court’s intervention could disrupt the respondent municipality’s proper administrative planning for the execution of works that are inherently costly and could affect the proper management and allocation of the resources available to that municipal corporation for such purposes. Moreover, as already stated, administrative omissions of this kind that do not demonstrate an imminent threat or injury to the fundamental rights of any specific person—the petitioners refer only to residents and inhabitants of the area—must be raised and resolved through the ordinary legal channels.

In view of the foregoing, I dissent and deny the petition for amparo.

VIII.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced by new technologies, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena in Sesión No. 27-11 of 22 de agosto del 2011, article XXVI and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial in Sesión No. 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The petition is partially granted. Accordingly, Freiner Lara Blanco and Alfonso Rojas Loría, in their respective positions as mayor and president of the Concejo Municipal, both of Golfito, or whoever may hold such position, are ordered to take the necessary measures so that, within a maximum period of SEIS MESES from notification of this judgment, the works required to construct gutters and pave road code PRN01 (Dirección02) are completed. The respondent party is warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in a petition for amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipality of Golfito is ordered to pay the costs and damages caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. In all other respects, the petition is denied. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Justice Garro Vargas dissents and would deny the petition. Let notice be given.

Recurso de amparo que se tramita en expediente número 24-034446-0007-CO, interpuesto por Nombre01, cédula de identidad NFP06, Nombre02, cédula de identidad NFP03, Nombre04, cédula de identidad NFP04, Nombre07, cédula de identidad NFP01, Nombre05, cédula de identidad NFP02 y Nombre03, cédula de identidad NFP05, en contra de la MUNICIPALIDAD DE GOLFITO.

Resultando:

  1. 1Por escrito presentado ante esta Sala a las 14:18 horas del 06 de diciembre de 2024, la parte recurrente interpone recurso de amparo en contra del Municipalidad de Golfito. Manifiesta que mediante notas de 31 de enero de 2021, de 15 de octubre de 2021 y de 28 de noviembre de 2022, enviaron escritos y se apersonaron ante el Concejo y su alcalde, solicitándoles que presupuestaran fondos para llevar a cabo una serie de obras en el Barrio KM1 de Golfito, pues, los pone en riesgo y no ha sido posible que se les de ningún tipo de solución. Indican que toda la comunidad paga impuestos de cordón y caño, con el fin de que se les atienda este tipo de emergencias, pero, ya han pasado dos administraciones municipales y ninguna se ha dignado resolverles el problema del deterioro que tienen los caños aledaños a sus viviendas, que representan un peligro creciente cada vez que llueve. Manifiestan que entre las obras que han solicitado con urgencia, está la construcción y reparación de los pisos y las paredes de los dos grandes caños del centro del barrio; construcción de caños y aceras a vuelta redonda en la Escuela del barrio hasta el Bazar Priscila]; construcción en cemento del caño grande que se encuentra en tierra desde la entrada del antiguo granero hasta la sexta fila del KM1 y paralelo a la construcción del caño que se habilite una acera de acuerdo a la Ley 7600; construcción de gaviones al lado de las casas de la barriada de La Bolsa KM1; en documento dirigido al Concejo el 31 de enero de 2021, dieron a conocer a la municipalidad los malos trabajos realizados en el pavimento de las calles del KM1 de Golfito, así como el incumplimiento en 80 metros de la carretera que sube al barrio El disco hasta pegar con la montaña, los cuales fueron preparados por la empresa constructora hasta su base final menos la aplicación del asfalto, y la municipalidad no supervisó que ese trabajo quedara terminado en su totalidad y que la capa de asfalto no fuera ruinosa. Estima que tal omisión resulta violatoria de sus derechos fundamentales.
  2. 2Por resolución de las 15:15 horas del 13 de diciembre de 2024, la Presidencia de la Sala dio curso a este amparo y se le solicitó informe al alcalde y al presidente del Concejo, ambos de la Municipalidad de Golfito, sobre los hechos alegados por la parte recurrente.
  3. 3Mediante escrito incorporado al expediente digital a las 12:27 horas del 06 de enero de 2025, informan bajo juramento Freiner Lara Blanco y Alfonso Rojas Loría, en sus respectivos cargos de alcalde y presidente del Concejo Municipal, ambos de Golfito, lo siguiente:

“PRIMERO: En referencia al escrito presentado por el señor Nombre01 Y OTROS, es claro que denuncian una problemática sobre los caños aledaños en el barrio KM 1 entre otros aspectos. SEGUNDO: De lo manifestado por el amparado, debo hacer de su conocimiento que tras una evaluación realizada según oficio OF-MG-UTG-354-12-2024 se determina que la zona Km 1 (Dirección04, hasta la sexta fila) no presenta inundaciones como consecuencia de la falta de cunetas. TERCERO: En ese mismo orden de ideas, debemos indicar que la Municipalidad de Golfito está realizando un levantamiento topográfico en el área del cordón y caño con el objetivo de determinar las condiciones de la zona y de proceder con la construcción de cunetas en el primer semestre del 2025. CUARTO: El levantamiento tiene como objetivo determinar si las viviendas están ubicadas dentro del derecho de vía. De acuerdo con el inventario de caminos, el camino con código PRN01 (Dirección02) establece que el derecho de vía es de 10 metros, con una superficie de ruedo de 4 metros.

Según la normativa vigente, la ley exige un derecho de vía de 14 metros, por lo que la infraestructura original no cumple con los estándares actuales, ya que fue construida durante el período de la Compañía Bananera. QUINTO: En relación con el muro de gaviones, se informa que las propiedades afectadas no han dejado el espacio estipulado por la ley. (El artículo 33 de la Ley Forestal) establece que los propietarios de terrenos atravesados por ríos deben respetar una franja de 15 metros en zona rural y de 10 metros en zona urbana, a cada lado de los ríos y quebradas si el terreno es plano. Si el terreno es quebrado, el retiro debe ser de 50 metros. En este caso, las propiedades infringieron dicha normativa de retiro. SEXTO: Respecto al trabajo de pavimentación, se informa que los pavimentos tienen una vida útil estimada de 10 años, y la calzada en cuestión tiene 18 años desde su construcción, por lo que ya ha cumplido su ciclo útil.

En consecuencia, se encuentra en el proceso de programación para ser mejorada en el año 2026. En cuanto a los 80 metros mencionados entre el sector El Disco y la montaña, se aclara que dicha área no se encuentra registrada en el inventario de caminos municipales, por lo que no puede ser considerada para los mejoramientos solicitados. Dadas las observaciones anteriores, tanto la municipalidad, Unidad Técnica de Gestión Vial y Concejo Municipal han dado atención a las necesidades del sector en cuestión, bajo el marco legal que le permite a este municipio actuar. Por lo expuesto y demostrado solicitamos con el debido respeto que se rechace la solicitud planteada por el amparado. Se adjunta el oficio OF-MG-UTG-354-12-2024.”

  1. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. Los recurrentes señalan que, mediante notas del 31 de enero de 2021, 15 de octubre de 2021 y 28 de noviembre de 2022, presentaron solicitudes ante el Concejo Municipal y la Alcaldía de Golfito para que se asignaran fondos para la ejecución de obras en el Barrio KM1, sin haber recibido una solución efectiva. Indican que, pese a que la comunidad paga impuestos de cordón y caño, han transcurrido dos administraciones municipales sin que se atienda el deterioro de los caños aledaños a sus viviendas, los cuales representan un riesgo creciente, especialmente en temporada de lluvias. Entre las obras solicitadas, destacan la construcción y reparación de los pisos y paredes de los dos grandes caños del centro del barrio; la edificación de caños y aceras desde la Escuela del barrio hasta el Bazar Priscila; la construcción en cemento del caño grande que actualmente se encuentra en tierra, desde la entrada del antiguo granero hasta la sexta fila del KM1, así como la habilitación de una acera conforme a la Ley 7600.

Además, han requerido la colocación de gaviones junto a las viviendas de la barriada de La Bolsa KM1. Asimismo, en el escrito dirigido al Concejo el 31 de enero de 2021, denunciaron la deficiente ejecución del pavimento en las calles del KM1 de Golfito y el incumplimiento en la construcción de 80 metros de carretera en el sector que sube al barrio El Disco hasta la montaña. Señalan que la empresa constructora preparó la base de la vía, pero no se aplicó la capa de asfalto correspondiente, sin que la Municipalidad supervisara la correcta finalización de los trabajos ni la calidad del material utilizado. Por lo anterior, solicita la intervención de este Tribunal.

II.Cuestión preliminar. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se trata de reiteradas solicitudes para la ejecución de obras en el Barrio KM1 de Golfito que, presuntamente, no han sido atendidas dentro de un plazo razonable por la municipalidad recurrida, causando inundaciones que afectan a los miembros de la comunidad. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque las autoridades recurridas hayan omitido referirse a ellos según lo prevenido en el auto inicial:

  • 1)El 31 de enero de 2021, los promoventes mediante una nota dirigida al Concejo Municipal de Golfito, requirió expresamente, lo siguiente: “1) Construcción, y reparación de pisos y paredes de los 2 grandes caños del centro del km1. 2) Construcción de caños y aceras a vuelta redonda de la escuela de km1 hasta el bazar Priscilla. 3) Construcción en cemento del caño grande desde la entregada del antiguo granero hasta la sexa fila de km1. Y paralelamente una acera en la misma dirección hasta la sexta fila. 4) Construcción al lado de las casas de la conocida barriada de la bolsa en la quebrada instalación de gaviones.” (véase el escrito de interposición y la prueba aportada al expediente digital).
  • 2)El 15 de octubre de 2021, el recurrente Nombre06, a través de una nota dirigida al Concejo Municipal de Golfito solicitó lo siguiente: “Los vecinos del km1 de Golfito presentamos un escrito firmado por varios ciudadanos de esta comunidad, sobre un grave problema en los 2 caños grandes, y el mal trabajo en el asfaltado de las Dirección05. Nos llego por parte de la secretaría Municipal un documento donde se nombre por acuerdo, una comisión dpara tal efecto. Seis meses después y no se ha cumplido con el objetivo dado a conocer. Señoras y Señores regidores queremos saber que sucedió con dicha comisión, si se va a llegar ha cabo dicha inspección, para esperarlos ya que este problema tanto de las calles como de los caños y otros, necesitan ser presupuestados, para su ejecución” (véase el escrito de interposición y la prueba aportada al expediente digital).
  • 3)El 28 de noviembre de 2022, los accionantes presentaron un escrito dirigido a la Municipalidad de Golfito, en el que indicaron lo siguiente: “Señores consejo municipal del Cantón de puerto Golfito de acuerdo al tema que nos ocupa, y ha que la vez nos preocupa a los habitantes del barrio Dirección05, con fecha 17 -03 -2021 entregamos un documento firmado por más de 50 personas. En esa ocasión solicitamos una inspección de una comisión al sitio de los 3 latentes problemas existentes. Con un recibido de la municipalidad el jueves 27 de octubre 2021 insistimos sobre el accionar de la comisión. Dicha comisión llevó a cabo la inspección de campo, el jueves 10 de febrero del año 2022 como se menciona evaluar la situación se tardó demasiado 12 meses. Este día de la inspección de campo, donde se acordó con los señores de la comisión Municipal Señor Luis Fernando Bustos, Señor Serafín, y Señor Alcides Rueda se acordó asignar como prioritario el número uno, los 2 grandes caños que están perforados y que existen las posibilidades de hundimiento, además los 2 caños con hundimiento no existen los 2 caños con hundimientos profundos, aumentando pérdidas de seres humanos si el gobierno local no le da la atención pertinente Es penoso para el grupo del barrio Kilómetro uno, insistir nuevamente 10 meses más tarde que tipo de pronunciamiento presente esa comisión al grupo colegiado de la municipalidad de Golfito Ya que no se ha comunicado nada a la fecha.

Deseamos saber si el consejo municipal ya se pronunció sobre las emergencias vividas en este barrio, y si presupuestaron suficientes fondos para llevar a cabo los trabajos, que urgen en este barrio para el próximo verano. Sin embargo, el 14 -10 -2022 en la oficina de la UTGV le llenaron una solicitud de inspección la cual adjunto, en esta solicitud de inspección de la unidad técnica de gestión vial municipal, parecen no entender los esfuerzos de la gravedad del asunto, y entendemos que hasta que paguemos la inspección legal al sitio. Nos abajo firmantes vecinos de Dirección05 les solicitamos tomar un acuerdo municipal en firme nombrando al barrio de Dirección05 en estado de emergencia, y que el respectivo consejo solicite con sesión Municipal lo mas pronto posible en el acuerdo municipal que se soliciten fondos en el pleno centro del km 1 para tratar los problemas existentes de una vez por todas como son: Construcción, y reparación de pisos y paredes de los 2 grandes caños del centro del km1.

Construcción de caños y aceras a vuelta redonda de la escuela de km1 hasta el bazar Priscilla. Construcción de un caño artesanal con la entrada del antiguo engranero hasta la sexta fila de km1. Y paralelamente una acera en la misma dirección hasta la sexta fila. Engavionar el lado de las casas de la conocida barriada de la bolsa en la quebrada instalación de gaviones En espera de contar con la sección municipal en pleno en el km1, algo no muy usual, pero se puede, es realizable y lo van hacer Gracias.” (véase el escrito de interposición y la prueba aportada al expediente digital).

  • 4)La Municipalidad de Golfito realiza una levantamiento topográfico en el área de cordón y caño, con el objetivo de determinar las condiciones del Barrio KM1 de Golfito y proceder con la construcción de las cunetas requeridas para el primer semestre del año 2025 (véase el informe de las autoridades recurridas y la prueba aportada al expediente digital).
  • 5)La Municipalidad de Golfito realizó un levantamiento con el objetivo de determinar si las viviendas están ubicadas dentro del derecho de vía. De acuerdo con el inventario de caminos, el camino identificado con el código PRN01 (Dirección02) establece que el derecho de vía es de 10 metros, con una superficie de ruedo de 4 metros. Sin embargo, conforme a la normativa vigente, la ley exige un derecho de vía de 14 metros, por lo que la infraestructura original no cumple con los estándares actuales, dado que fue construida durante el período de la Compañía Bananera. En relación con los trabajos de pavimentación, se informó que los pavimentos tienen una vida útil estimada de 10 años, mientras que la calzada en cuestión tiene 18 años desde su construcción, por lo que ha cumplido su ciclo útil. En consecuencia, se encuentra en proceso de programación para ser mejorada en el año 2026 (véase el informe de las autoridades recurridas y la prueba aportada al expediente digital).

IV.Sobre la solicitud de cunetas y pavimentación en el Barrio km1 de Golfito. Los recurrentes señalan que, mediante notas del 31 de enero de 2021, 15 de octubre de 2021 y 28 de noviembre de 2022, presentaron solicitudes ante el Concejo Municipal y la Alcaldía de Golfito para que se asignaran fondos para la ejecución de obras en el Barrio KM1, sin haber recibido una solución efectiva. Indican que, pese a que la comunidad paga impuestos de cordón y caño, han transcurrido dos administraciones municipales sin que se atienda el deterioro de los caños aledaños a sus viviendas, los cuales representan un riesgo creciente, especialmente en temporada de lluvias. Entre las obras solicitadas, destacan la construcción y reparación de los pisos y paredes de los dos grandes caños del centro del barrio; la edificación de caños y aceras desde la Escuela del barrio hasta el Bazar Priscila; la construcción en cemento del caño grande que actualmente se encuentra en tierra, desde la entrada del antiguo granero hasta la sexta fila del KM1, así como la habilitación de una acera conforme a la Ley 7600. Sin embargo, señalan que a la fecha de interposición del presente recurso de amparo se ha hecho caso omiso a sus solicitudes.

Al respecto, es preciso señalar que la actuación de las instituciones públicas debe caracterizarse por celeridad y eficiencia, especialmente en la prestación de los servicios que les competen. En el caso de las municipalidades, al estar encargadas de atender los intereses y necesidades locales, su labor comprende un amplio conjunto de responsabilidades. Sobre esta materia, en la sentencia Nº 2011-012886 de las 12:44 horas del 23 de septiembre de 2011, esta Sala se pronunció en los siguientes términos:

“Conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población.

En el caso concreto, el Alcalde recurrido manifiesta que los caminos mencionados por el recurrente no fueron incluidos en el plazo estratégico anual que deben presentar las instituciones públicas, por lo que no se pueden comprometer fondos públicos sin estar presupuestados. Que estarán realizando una visita de campo para gestionar reparar los caminos que alegan los recurrentes. Además del informe rendido bajo juramento no se dice nada acerca del trámite que se le diera a la solicitud de información respecto a la falta de mantenimiento de caminos públicos de interés social, ni se indica que se le hubiera dado respuesta, pese a que la gestión fue presentada desde mayo del dos mil once. Así las cosas, estima esta Sala que existe una clara omisión en la tutela de los derechos fundamentales de los recurrentes atribuible al gobierno local, toda vez que la omisión del pleno ejercicio de las facultades que la ley le otorga a este ente, ha permitido que se llegue a dar y persistan los problemas denunciados por los recurrentes, sobre todo provocados por la falta de mantenimiento de caminos públicos, los cuales, al estar dañados dejan incomunicados a los vecinos de la comunidad Nueve Millas, Moín Limón.

Además, del expediente no se logra acreditar que las autoridades municipales hubieran dado respuesta a la nota presentado el 16 de mayo del 2011, en la Unidad Técnica de la Junta Vial de la Municipalidad del Cantón, por medio del cual se solicitaba información respecto a la falta de mantenimiento de caminos públicos de su interés. Por consiguiente, a juicio de este Tribunal, con su omisión, la Municipalidad ha puesto en situación de peligro el libre transitar de los recurrentes y vecinos de la comunidad en cuestión, así como el derecho a disfrutar de un ambiente sano y equilibrado” (Lo destacado y subrayado no corresponde al original).

En el presente caso, esta Sala verifica la lesión de los derechos fundamentales del amparado, ya que del análisis del expediente se desprende una omisión injustificada por parte de la Municipalidad de Golfito en la atención de las solicitudes presentadas por los recurrentes. Desde el año 2021, han gestionado reiteradamente la construcción de cunetas y la pavimentación de las calles del Barrio KM1, sin que la administración haya brindado una solución efectiva a sus solicitudes. Pese a que los recurrentes han acudido en múltiples ocasiones ante el Concejo Municipal y la Alcaldía, solicitando que se destinen recursos para la ejecución de estas obras esenciales, la municipalidad ha postergado su intervención, limitándose a realizar estudios técnicos y programaciones a largo plazo sin adoptar medidas concretas e inmediatas.

La construcción de cunetas es una función esencial para la adecuada gestión del espacio público y la infraestructura urbana. En este caso, la municipalidad ha indicado que se encuentra en proceso un levantamiento topográfico para determinar las condiciones del área y proceder con la construcción de las cunetas en el primer semestre de 2025. Sin embargo, esta afirmación no justifica la omisión prolongada en la atención de las solicitudes, ya que han transcurrido años desde que los recurrentes expusieron la necesidad de estas obras, sin que se haya ejecutado intervención alguna en el sitio. La administración municipal tiene la obligación de garantizar la adecuada canalización del agua y la protección de la infraestructura vial, por lo que la demora en la implementación de soluciones constituye una afectación directa al derecho de los recurrentes a recibir servicios públicos eficientes.

Respecto a la pavimentación, la municipalidad ha señalado que las calles en cuestión tienen una vida útil estimada de diez años, pero que ya han transcurrido dieciocho desde su construcción, por lo que se encuentran deterioradas. Pese a reconocer esta situación, la administración ha indicado que las obras de mejoramiento están programadas hasta el año 2026, lo que prolonga innecesariamente la afectación que sufren los habitantes del barrio. Asimismo, en relación con los 80 metros de vía en el sector de El Disco, la municipalidad ha señalado que esta área no se encuentra registrada en el inventario de caminos municipales. Sin embargo, esto no exime a la administración de su obligación de atender las necesidades viales de la comunidad y de brindar una respuesta clara y definitiva sobre su competencia en el caso, en lugar de mantener en incertidumbre a los recurrentes.

Las justificaciones ofrecidas por la Municipalidad no desvirtúan la inacción administrativa. La planificación de obras a largo plazo no puede servir como excusa para postergar indefinidamente la ejecución de intervenciones urgentes. La omisión prolongada en la construcción de cunetas y la falta de atención inmediata a la pavimentación de las calles afectan directamente el derecho de los recurrentes a una adecuada prestación de los servicios municipales y a una pronta resolución administrativa de sus gestiones.

En este contexto, la conducta de la administración municipal vulnera los derechos fundamentales de los recurrentes, quienes han sido objeto de una dilación injustificada en la atención de sus necesidades básicas de infraestructura. El derecho a una pronta resolución administrativa exige que los entes públicos resuelvan de manera clara y en plazos razonables las solicitudes de los ciudadanos, evitando prolongaciones injustificadas o la omisión de sus funciones. Así las cosas, la falta de intervención efectiva en la construcción de cunetas y la pavimentación de las calles del Barrio KM1, sumada a la ausencia de respuestas concretas sobre la gestión de los caminos, configura una violación de los derechos fundamentales de los amparados, quienes han visto postergadas sus legítimas expectativas de contar con una infraestructura adecuada en su comunidad. Por consiguiente, lo procedente es declarar con lugar el recurso, en cuanto a estos extremos.

V.Respecto al muro de gaviones. En cuanto a la solicitud de construcción de un muro de gaviones en el Barrio KM1, esta Sala no advierte lesión a los derechos fundamentales de los recurrentes, pues la negativa de la Municipalidad de Golfito se fundamenta en razones técnicas y normativas que restringen la ejecución de la obra solicitada. Conforme al informe rendido bajo juramento por las autoridades municipales, las propiedades de la zona no han respetado el retiro obligatorio que establece la legislación vigente en materia de protección de cauces naturales, lo que impide que la administración destine recursos para intervenir en un área que se encuentra en contravención con la normativa.

El artículo 33 de la Ley Forestal dispone que los propietarios de terrenos atravesados por ríos y quebradas deben respetar una franja de 15 metros en zonas rurales y de 10 metros en áreas urbanas a cada lado de los cauces, cuando el terreno es plano. En aquellos casos donde el terreno es quebrado, el retiro debe ser de 50 metros. En este caso, la municipalidad ha determinado que las propiedades para las cuales se solicita la construcción del muro de gaviones han incumplido esta disposición, pues se encuentran dentro de la zona de restricción. Esta circunstancia no solo impide la ejecución de la obra, sino que, además, coloca a la administración en la imposibilidad jurídica de intervenir en un área que, por mandato legal, no puede ser ocupada ni alterada con construcciones permanentes. A partir de esta información, es claro que no se trata de una simple negativa administrativa, sino de la aplicación de la normativa ambiental vigente, que impide destinar fondos públicos a una obra cuya ejecución resultaría contraria a las disposiciones legales. Asimismo, los recurrentes no han demostrado que las condiciones del área permitan una intervención municipal sin contravenir los requisitos establecidos por la legislación forestal, por lo que su reclamo carece de sustento. En consecuencia, el reclamo en este punto debe ser desestimado.

VI.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII.Voto salvado de la Magistrada Garro Vargas. Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches ‒en los cuales no se aprecia un grave riesgo para la salud, integridad física o la vida de las personas amparadas‒ se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si, de los autos, no se constata la existencia de una persona debidamente individualizada que requiera del amparo de esta jurisdicción por las amenazas a los derechos fundamentales ya indicados o que pertenezca a un grupo vulnerable que demanda la intervención de esta Sala.

Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes en administrar la infraestructura vial y pluvial del Barrio KM1 de Golfito y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia.

En el sub lite, los recurrentes acusan la falta de intervención municipal en la construcción de cunetas y la pavimentación de calles en el Barrio KM1 de Golfito. Por ello, sin ninguna determinación subjetiva o individualización, aducen que esta omisión ha provocado problemas de inundaciones y deterioro de la infraestructura, afectando la calidad de vida de los vecinos. Ya solo ese elemento, en mi criterio, es suficiente para desestimar el recurso de amparo. Este Tribunal ha advertido que, partiendo de los efectos que la Ley de la Jurisdicción Constitucional confiere al recurso de amparo (arts. 41 y 49), debe concluirse que cualquier persona puede interponerlo, siempre y cuando individualice a los sujetos cuyos derechos fundamentales considera fueron conculcados (ver, por ejemplo, las sentencias números 2019-003879, 2021-017532 y 2022-009133, entre otras). En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que, a tenor de un argumento genérico de la afectación a vecinos, se conozca en esta sede sobre una inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa.

Aunado a lo anterior, en el caso concreto se hace necesario evidenciar que en el informe rendido, bajo la gravedad del juramento, se subrayó que la Municipalidad de Golfito ha realizado un levantamiento topográfico en el área con el objetivo de determinar las condiciones del Barrio KM1 y proceder con la construcción de las cunetas en el primer semestre del año 2025. Asimismo, se informó que la pavimentación de las calles se encuentra en proceso de programación para ser mejorada en el año 2026, en atención a la planificación municipal y la disponibilidad presupuestaria.

A la luz de tales elementos, considero que no se encuentra acreditada una amenaza directa e inminente a los derechos fundamentales supra mencionados. Más bien, la intervención de este Tribunal podría alterar la debida planificación administrativa de la municipalidad recurrida para la ejecución de unas obras de suyo onerosas y que pueden afectar la adecuada administración y previsión de los recursos con los que cuenta dicha corporación para tales efectos. Por lo demás, como ya se advirtió, este tipo de omisiones administrativas que no evidencian una amenaza o lesión inminente a los derechos fundamentales de alguna persona en concreto ‒los recurrentes únicamente refieren los vecinos y habitantes de la zona‒ deben ser planteadas y resueltas en las sedes ordinarias de legalidad.

En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.

VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso. En consecuencia, se ordena a Freiner Lara Blanco y Alfonso Rojas Loría, en sus respectivos cargos de alcalde y presidente del Concejo Municipal, ambos de Golfito, o a quien ocupe dicho cargo, que adopte las medidas necesarias para que, en un plazo máximo de SEIS MESES, contado a partir de la notificación de esta sentencia, se realicen las obras necesarias para la construcción de cunetas y la pavimentación del camino código PRN01 (Dirección02). Se apercibe a la parte recurrida que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Golfito al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Castillo Víquez pone nota. El magistrado Salazar Alvarado consigna nota. La magistrada Garro Vargas salva el voto y declara sin lugar el recurso. Notifíquese.
