Document Review Decision No. 2025002839 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty in the morning on treinta y uno de enero de dos mil veinticinco.
Application for constitutional relief (recurso de amparo) being processed under case number 24-031181-0007-CO, filed by Nombre01, identity card No. NFP01, against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE SAN JUAN DE SANTA CRUZ and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Findings of Fact:
“1.- The water-supply system lacks sufficient system storage capacity.

In light of the foregoing, the water-supply system lacks the technical and legal feasibility (factibilidad técnica y legal) required to provide service.
It is recommended that certificates of service availability or certificates of water capacity NOT be issued while the status of Water-Deficient Zone remains in effect.” It states that the Board of Directors represented by the undersigned took office and began exercising its functions pursuant to minutes number 27 of the assembly held on September 24, 2023, and, in response to the identified problem, undertook a series of procedures aimed at obtaining water-supply feasibility (viabilidad hídrica). It adds that the Liga de Agua conducted a technical study concluding that the ASADA has only one main source supplying the population of the community of San Juan. This was identified as the first weakness, since it creates a water deficit of 20.52 l/s. The other problem identified was insufficient storage, which currently amounts to only 34.7 cubic meters and is inadequate to serve the number of users and support population growth in the area, especially because the technical study highlights a storage deficit of 129.87 cubic meters.
It states that the analysis sets forth a series of recommendations that this newly constituted Board of Directors considers feasible and has committed to implementing in pursuit of that objective. It asserts that, at the request of the new Administrative Board, the Liga Comunal del Agua has prepared projections to resolve the problem, and another study—this time hydrogeological in nature—has been obtained to identify potential sites for drilling and groundwater extraction, as well as for installing a storage tank. The suggested storage tank alone would cost one hundred twenty-nine thousand dollars, funds that this ASADA does not have to carry out such works. It explains that pages 35-36 of that study contain site recommendations for drilling, which is why steps have been taken to acquire land on which the drilling works and storage-tank works may be constructed. The difficulty is that the ASADA lacks sufficient financial resources to carry out those works, and the Instituto Costarricense de Acueductos y Alcantarillados has not entered into an agreement with this ASADA to provide the technical and financial assistance necessary to complete the project.
Given its scale and significance, the project cannot be funded with the money each subscriber pays monthly under the water-consumption tariff. By virtue of the exclusive statutory mandate, responsibility is vested in the aforementioned Institute, which is responsible not only for financing but also for carrying the project forward, since an ASADA’s work is limited to administering and maintaining the service and collecting consumption charges, in order to ensure the timely fulfillment of a fundamental right: water of adequate quality and quantity for human consumption. It asserts that the existence of the problem is not being denied; rather, solutions have been proposed by this newly constituted Board of Directors since it responsibly assumed management of the ASADA. However, it is unacceptable to require an ASADA with limited income to undertake works capable of meeting a community’s sustained growth in water consumption or its projected needs over twenty-five years.
Justice Salazar Alvarado drafts the opinion; and,
Whereas:
I.Subject matter of the amparo proceeding (recurso de amparo). The petitioner alleges that, since 2020, residents of San Juan de Santa Cruz de Guanacaste have faced difficulties in obtaining water-availability certificates (certificados de disponibilidad de agua). She further alleges that, on October 16, 2024, she reported the situation to the respondent Institute and has received no response.
II.Admissibility. Given its exceptional nature, an amparo proceeding against private-law entities requires first determining whether the matter falls within any of the circumstances that render it admissible and, if so, subsequently deciding whether it should be granted. In this regard, Article 57 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional) provides that an amparo proceeding against the acts or omissions of a private-law entity is admissible when such entities act or are required to act in the exercise of public functions or powers, or when they are, as a matter of law or fact, in a position of power against which ordinary judicial remedies are clearly insufficient or untimely to safeguard the fundamental rights or freedoms referred to in Article 2°, subsection a), of the same statute. In this particular case, those requirements are clearly satisfied with respect to the Associations Administering Water-Supply Systems (Asociaciones Administradoras de los Acueductos), because they are private-law entities in a position of power against which ordinary judicial remedies may be plainly unsuitable for protecting the petitioner’s fundamental rights. The proceeding must therefore be admitted for review by this Court.
III.Review of this case for infringement of Article 41 of the Political Constitution (Constitución Política). Before examining the merits—concerning the alleged violation of the right to prompt and proper administrative proceedings (procedimiento administrativo pronto y cumplido)—it must be clarified that, since Voto N° 2008-02545 of 8:55 hours on February 22, 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa), subject to certain exceptions, matters concerning whether the public administration complied with the time limits established by the General Public Administration Act (Ley General de la Administración Pública) (Articles 261 and 325) or by sector-specific statutes governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at a party’s request—by issuing a final administrative act, or to decide the applicable administrative appeals. This proceeding presents precisely such an exception, because it concerns the failure to decide an application for potable-water availability. With that point clarified, the Court proceeds to decide the specific situation raised in this amparo proceeding.
IV.Proven facts. The following facts relevant to deciding this matter are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
VI.On the drinking-water service. Articles 21 and 50 of the Political Constitution, read together, establish the rights of persons to life, health, and a healthy and ecologically balanced environment, all of which are closely connected, since life, as the supreme constitutional value, requires special protection, because without life, the protection of all other fundamental rights would be of little use. Accordingly, life must be protected in all its dimensions—from the physical and mental perspectives and in relation to one’s surroundings—and it is precisely here that the importance of protecting the environment and natural resources arises, in order to promote people’s well-being. That well-being is achieved, among other means, through the protection and conservation of the quality and quantity of water resources (recursos hídricos), so that the water is safe for human consumption and thus protects people’s health, because, as a resource necessary for hygiene, food, and drinking, its contamination can cause serious harm to public health.
In this regard, the protection and conservation referred to must be provided by the State through the bodies designated for that purpose, which must adopt the measures necessary to guarantee access to that resource for all persons and ensure compliance with those measures. In this context, the right to water (derecho al agua) arises, which may be protected by this Constitutional Court through an amparo proceeding (recurso de amparo) (Judgment N° 2007-005482, at 14:39 hours on April 24, 2007, reiterated in N° 2021005089, at 09:15 hours on March 12, 2021).
VII.On prompt and effective justice (justicia pronta y cumplida). From the review of the record and the established facts, it has been shown that, on October 16, 2024, the appellant sent an email to ...02 reporting the Asada’s failure to comply with the structural plan recommended for the aqueduct; however, the respondent Institute did not deem it received because the correct address is ...01, rather than the one entered by the appellant. In this regard, the authorities of the respondent Institute have not violated any fundamental right of the appellant, and this claim in the appeal must therefore be denied.
VIII.On the right to drinking-water service. The Chamber further found that, since February 2020, the Head of Rural Aqueduct Management at the respondent Institute had recommended that the ASADA Board of Directors undertake a series of improvements to remedy the problems affecting the San Juan de Santa Cruz aqueduct, such as installing and/or constructing one or more higher-capacity storage tanks and conducting a pumping test during the dry season to verify that the aqueduct provides the necessary quantity of water. It was likewise established that the respondent Association has been denying requests for water-availability letters (cartas de disponibilidad de agua) because it is unable to provide drinking-water service due to insufficient storage capacity; although it has sufficient water-resource capacity, it lacks sufficient hydraulic capacity.
In light of the foregoing, the Chamber finds it striking that it was not until almost four years later, in June 2024, that the Association’s Administrative Board engaged services to prepare a technical assessment of the San Juan de Santa Cruz Aqueduct, including recommendations for improvements and a budget, which was delivered to it in December 2024. Throughout all these years, the appellant and the other residents have remained in a state of uncertainty and legal insecurity, awaiting completion of the infrastructure works required by the aqueduct in order to provide drinking-water service. This violates the fundamental right to the proper functioning of public services (buen funcionamiento de los servicios públicos), because the respondent Asada is responsible for an unjustified delay in complying with the recommendations made by the authorities of the Instituto Costarricense de Acueductos y Alcantarillados and in seeking a technical solution, which resulted in a clear and unlawful failure to provide service, contrary to the appellant’s constitutional rights to drinking water and the constitutional principles governing the operation of public services.
The respondent Institute also shares responsibility for that violation because, pursuant to the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Ley N° 2726 of April 14, 1961, it is responsible for directing and overseeing all matters related to providing the inhabitants of the Republic with drinking-water service. Pursuant to Article 2(g) thereof, it may do so even by delegating the administration, operation, maintenance, and development of aqueducts and sewerage systems to organizations duly established for those purposes (administrative associations); however, the Institute remains the governing authority in this field. This is expressly provided in Article 3 of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, Nº 42582-S-MINAE, which states as follows:
“Article 3.- Technical governance: AyA, as the technical governing authority for the provision of public aqueduct, sewerage, and/or wastewater-treatment services, shall carry out all activities relating to the control, oversight, supervision, evaluation, standardization, and sectoral planning of drinking-water and wastewater-treatment services, as well as the direction of the management undertaken by the ASADAS, since management of the system is entrusted to the ASADA by delegation from AyA.
The relationship between AyA and the ASADAS shall be based on the principles of social participation, collaboration, cooperation, adaptability or mutability of services, efficiency and effectiveness, supervision, control, evaluation, standardization, and sectoral planning of drinking-water and wastewater-treatment services, as well as the direction of the management undertaken by the ASADAS.” For their part, pursuant to the cited Reglamento, the sole and specific purposes of the ASADAS are to provide drinking-water supply and wastewater-treatment services, contribute to integrated water-resource management, and provide fire-hydrant service under special legislation. Therefore, under the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, exclusive authority over the supply of drinking water and the construction of aqueduct systems for that purpose rests with that Institution.
For this reason, the Institute is obligated to follow up on the recommendations made in February 2020 through memorandum GSD-UEN-GAR-2020-00667, which issued the “Declaratoria de Zona Deficitaria, San Juan, Santa Cruz, Guanacaste” and directed that no further certificates of service availability (constancias de disponibilidad de servicio) be issued for two reasons: 1) the aqueduct lacked sufficient storage capacity within its system; and 2) the well showed a decrease in flow of 0,9 l/s in the measurement taken on January 20, 2020. It should be noted that the stated water-deficient zone (zona deficitaria) is temporary in nature and contingent upon completion of the infrastructure works that would address the needs of the area and the aqueduct, and the Chamber has no evidence that the Institute took any action to ensure the proper operation of the services provided by the respondent ASADA.
Consequently, both the Institute and the respondent Asada have violated the principle of the proper functioning of public services and the right to drinking-water service by failing to promptly undertake joint actions to ensure completion of the technical studies and infrastructure works needed for the San Juan aqueduct to have greater water-storage capacity and improved water capture, thereby guaranteeing and supplying drinking water to the community. This is because both parties are obligated to ensure the continuity, quantity, and timely provision of the service, thereby upholding the right to health and the human right of access to drinking water and wastewater treatment.
As a corollary to the foregoing considerations, the appeal must be partially granted due to the violation of the appellant’s rights to health and life, and the respondent authorities must be ordered to take the corresponding actions, within their respective spheres of authority, to ensure that the improvements to the aqueduct are carried out.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11, of August 22, 2011, Article XXVI, and published in Boletín Judicial N° 19, of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12, held on May 3, 2012, Article LXXXI.

The appeal is partially granted, solely with respect to the violation of the principle of the proper functioning of public services and the right to drinking-water service. Georgina Garro Mora, in her capacity as Deputy Manager for the Management of Delegated Systems of the Instituto Costarricense de Acueductos y Alcantarillado, and Yanner Estiv Ramírez Aguilar, in his capacity as President of the Asociación Administradora del Acueducto Rural de San Juan de Santa Cruz, are ordered, within UN MES from notice of this judgment, to coordinate the corresponding actions so that the situation raised by the appellant is addressed and resolved, and to comply with the provisions of memorandum N°GSD-UEN-GAR-2020-00667, of February 21, 2020, “Declaratoria de Zona Deficitaria, San Juan, Santa Cruz, Guanacaste.” In addition, the infrastructure works agreed to be necessary for that purpose must be completed within DOCE MESES from notice of this judgment.
The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The appeal is denied in all other respects. The Instituto Costarricense de Acueductos y Alcantarillados and the Asociación Administradora del Acueducto Rural de San Juan de Santa Cruz are ordered to pay the legal costs and damages caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the civil and administrative-litigation courts.- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del treinta y uno de enero de dos mil veinticinco .
Recurso de amparo que se tramita en expediente número 24-031181-0007-CO, interpuesto por Nombre01, cédula de identidad NFP01, contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE SAN JUAN DE SANTA CRUZ y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
“1.- El acueducto no cuenta con suficiente almacenamiento del sistema
disminución en el caudal de 0.9 l/s en comparación con los datos de registro del MINAE.
Tomando en cuenta lo anterior, el acueducto no cuenta con factibilidad técnica y legal para el otorgamiento del servicio.
Se recomienda NO brindar constancias de disponibilidad de servicio o constancias de capacidad hídrica, mientras se mantenga el estado de Zona Deficitaria”.
Acota, que la Junta Directiva que el suscrito representa, entró en posesión de su cargo y en ejercicio de sus funciones a partir del acta número 27 de asamblea celebrada el 24 de septiembre de 2023 y atendiendo el problema evidenciado, se avocó a la realización de una serie de trámites para alcanzar el objetivo de obtener viabilidad hídrica. Añade, que se realizó un estudio técnico por parte de la Liga de Agua, en el que se concluyó, que la ASADA cuenta con una única fuente principal, que se encarga de abastecer la población de la comunidad de San Juan, apreciando que se trata del primer aspecto débil detectado, dado que genera un déficit hídrico de 20.52 l/s, siendo el otro problema detectado, que la insuficiencia en el almacenamiento que actualmente es de tan solo 34.7 metros cúbicos, lo que es insuficiente para abastecer la cantidad de usuarios y, dar sostenibilidad al crecimiento poblacional de la zona, sobre todo, porque el estudio técnico resalta que hay un déficit de 129.87 metros cúbicos de almacenamiento.
Acota, que en dicho análisis, se establecen una serie de recomendaciones, que para esta nueva integración de junta directiva son acatables y, así se ha propuesto satisfacer para el logro del objetivo. Asegura, que la Liga Comunal del Agua, ante el pedido de la nueva junta de administración, ha efectuado proyecciones para solucionar el conflicto y, se ha obtenido otro estudio, esta vez de naturaleza hidrogeológica para definir posibles sitios potenciales de perforación y captación de agua subterránea, así como la instalación de un tanque de almacenamiento, siendo que solo el costo del tanque de almacenamiento sugerido es de ciento veintinueve mil dólares, dinero que esta ASADA no cuenta para llevar a cabo tales obras. Expone, que en las páginas 35-36 de dicho estudio se ha informado sobre recomendaciones de sitio para perforar, razón por la cual, se han efectuado gestiones para poder adquirir terrenos donde sea realizada la obra de la perforación y la obra del tanque de almacenamiento, con el inconveniente que. la ASADA no cuenta con recursos económicos suficientes para efectuar dichas obras y, el Instituto Costarricense de Acueductos y Alcantarillados no ha suscrito el convenio con la presente ASADA, para poder brindar asistencia técnica y económica que permita la realización de la obra, que por su magnitud y trascendencia, no puede ser satisfecha con el dinero que cada uno de los abonados cancela mensualmente por su tarifa de consumo de agua y que, por la reserva exclusiva de ley, se concede a dicho Instituto referido, a quien no solo le corresponde su financiamiento sino también la prosecución de la obra, dado que la labor de una ASADA se limita a la administración del servicio, su mantenimiento y recuperación de tarifas de consumo, en aras de brindar de manera puntualmente la satisfacción de un derecho fundamental, como resultar ser el agua de calidad y cantidad para su consumo humano.
Asegura, que no se está negando la existencia del problema, se están proponiendo las soluciones que esta nueva integración de junta directiva ha brindado desde que asume con responsabilidad la dirección de la ASADA; empero, no es de recibo de la ASADA de ingresos limitados deba realizar obras que satisfagan el crecimiento sostenido de consumo de agua de una comunidad o bien, su proyección a veinticinco años.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La recurrente alega que, desde al año 2020, los vecinos de San Juan de Santa Cruz de Guanacaste han enfrentado una problemática para obtener certificados de disponibilidad de agua. Además, que desde el 16 de octubre de 2024, denunció la situación al Instituto recurrido y no ha obtenido respuesta.
II.Sobre la admisibilidad. Por su excepcional naturaleza, el amparo contra sujetos de derecho privado exige comenzar por examinar si nos encontramos o no ante alguno de los supuestos que lo hacen admisible, para - posteriormente y en caso afirmativo-, dilucidar si es estimable o no. Sobre el particular, la Ley de la Jurisdicción Constitucional, en su artículo 57, estipula que el recurso de amparo contra las acciones u omisiones de un sujeto de Derecho Privado es admisible cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2°, inciso a), del mismo cuerpo normativo. En el caso concreto, es claro el cumplimiento de esos presupuestos, en lo que respecta a las Asociaciones Administradoras de los Acueductos, toda vez que se trata de sujetos de Derecho Privado que están en una situación de poder, frente a la cual los remedios jurisdiccionales comunes pueden resultar francamente impropios para tutelar los derechos fundamentales del recurrente, por lo que el recurso se debe admitir para su análisis por parte de este Tribunal.
III.Sobre el conocimiento de este caso por lesión al artículo 41, de la Constitución Política. Previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento administrativo pronto y cumplido- debe aclararse que, a partir del Voto N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discuta si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este recurso, se plantea un supuesto de excepción pues se está ante la falta de resolución de una solicitud de disponibilidad de agua potable. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.
IV.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
VI.Sobre el servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública.
En ese sentido, la protección y conservación a la que se hace referencia debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en la N° 2021005089, de las 09:15 horas del 12 de marzo de 2021).
VII.Sobre una justicia pronta y cumplida. Del estudio de los autos, y a partir de la relación de hechos probados, se tiene por acreditado, que efectivamente el 16 de octubre de 2024, el recurrente remitió un correo electrónico a ...02 en el que denunció el incumplimiento por parte de la Asada del plan estructural recomendado para el acueducto; sin embargo, el mismo no se tuvo por recibido por parte del Instituto recurrido, dado que la dirección correcta es ...01 y no como la consignó el recurrente. En ese sentido, las autoridades del Instituto recurrido no han lesionado derecho fundamental alguno al recurrente y lo procedente es declarar sin lugar este extremo del recuso.
VIII.Sobre el derecho al servicio de agua potable. Por otra parte, la Sala constató que desde el mes de febrero de 2020, el Encargado de la Gestión de Acueductos Rurales del Instituto recurrido recomendó a la Junta Directiva de la ASADA efectuar una serie de mejoras para solventar la problemática del acueducto de San Juan de Santa Cruz, tales como instalar y/o construir uno o varios tanques de almacenamiento, con mayor capacidad, realizar una prueba de bombeo en época seca, para verificar que cumple con la cantidad de agua necesaria. Asimismo, se verificó que la Asociación recurrida ha estado denegando las solicitudes de cartas de disponibilidad de agua, ya que no les es factible brindar el servicio de agua potable por falta de almacenamiento, pues si bien se cuenta con capacidad hídrica no se tiene la hidráulica.
De lo expuesto, llama la atención a la Sala, que fue hasta casi cuatro años después, o sea en junio de 2024, que la Junta Administradora de la Asociación contrató los servicios para la elaboración de una evaluación técnica del Acueducto de San Juan de Santa Cruz, que incluye las recomendaciones de mejoras y presupuesto, mismo que les fue entregado en el mes de diciembre de 2024. Precisamente, el recurrente y los demás administrados durante todos estos años han permanecido en una situación de incertidumbre e inseguridad jurídica, a la espera que se efectúen las obras de infraestructura que requiere el acueducto para poder brindar el servicio de agua potable. Lo anterior, infringe el derecho fundamental al buen funcionamiento de los servicios públicos, pues existe un retardo injustificado atribuido a la Asada recurrida en acatar las recomendaciones efectuadas por las autoridades del Instituto Costarricense de Acueductos y Alcantarillados y buscar una solución técnica, lo cual se tradujo en una evidente e ilegítima falta de servicio, contraria a los derechos constitucionales del recurrente al agua potable y a los principios constitucionales que rigen el funcionamiento de los servicios públicos.
Por otra parte, el Instituto recurrido también es coparticipe de dicha lesión, ya que de conformidad con la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Ley N° 2726 de 14 de abril de 1961, le corresponde dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable y esto lo puede hacer, de conformidad con el artículo 2, inciso g), Ibidem, incluso, mediante la delegación, administración, operación, mantenimiento y desarrollo de los acueductos y alcantarillado, en organizaciones debidamente constituidas para tales efectos (asociaciones administradoras); sin embargo, el ente rector en la materia seguirá siendo el Instituto. Así lo dispone, expresamente, el artículo 3, del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales, Nº 42582-S-MINAE, que señala lo siguiente:
“Artículo 3.- Rectoría técnica: El AyA como ente rector técnico en la prestación de los servicios públicos de acueducto, alcantarillado y/o saneamiento de las aguas residuales, ejercerá todas las actividades propias del control, vigilancia, fiscalización, evaluación, normalización, planificación sectorial de los servicios de agua potable y saneamiento de aguas residuales y dirección de la gestión que realizan las ASADAS, ya que la gestión del sistema corresponde a la ASADA por delegación del AyA.
La relación entre el AyA y las ASADAS estará basada en los principios de participación social, colaboración, cooperación, adaptabilidad o mutabilidad de los servicios, eficiencia y eficacia, fiscalización, control, evaluación, normalización, planificación sectorial de los servicios de agua potable y saneamiento de aguas residuales y dirección de la gestión que realizan las ASADAS”.
Por su parte, de conformidad con lo dispuesto en el Reglamento citado, las ASADAS tienen como únicos y específicos fines la prestación de los servicios de abastecimiento de agua potable y saneamiento de aguas residuales, contribuir en la gestión integrada del recurso hídrico y brindar el servicio de hidrantes por ley especial. Entonces, de conformidad con la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, la competencia privativa en materia de suministro de agua potable, así como la construcción de los sistemas de acueducto con ese propósito, le corresponde a esa Institución. Razón por la cual, el Instituto tiene la obligación de dar seguimiento a las recomendaciones efectuadas en febrero de 2020, mediante el memorando GSD-UEN-GAR-2020-00667, en el que se hizo la "Declaratoria de Zona Deficitaria, San Juan, Santa Cruz, Guanacaste", en las que se dispuso no emitir más constancias de disponibilidad de servicio por dos razones: 1) el acueducto no contaba con suficiente almacenamiento en su sistema; y 2) que el pozo mostró una disminución de caudal de 0,9 l/s en la medición realizada el 20 de enero de 2020.
Nótese, que la zona deficitaria indicada tiene la condición de temporalidad, y está supeditada a la ejecución de las obras de infraestructura que solventarían las necesidades de la zona y el acueducto, siendo que no le consta a la Sala que el Instituto haya realizado algún acto para garantizar el adecuado funcionamiento en la prestación de los servicios que brinda la ASADA recurrida.
De manera, que tanto el Instituto y la Asada recurrida han quebrantado el principio del buen funcionamiento de los servicios públicos y el derecho al servicio de agua potable, al no efectuar de manera célere las acciones conjuntas para garantizar la realización de los estudios técnicos y las obras de infraestructura para que el acueducto de San Juan cuente con mayor almacenamiento del líquido y mejor captación, para garantizar y dotar de agua potable a la comunidad. Lo anterior porque es obligación de ambas partes, velar por la continuidad, la cantidad y la oportunidad del servicio, afirmando el derecho a la salud y el derecho humano de acceso al agua potable y saneamiento de las aguas residuales.
Corolario de las consideraciones realizadas, se impone declarar parcialmente con lugar el recurso por infracción a los derechos de la recurrente a la salud y a la vida y ordenarles a las autoridades recurridas que ejecuten las acciones correspondientes, en sus respectivos ámbitos de competencia, para que se realicen las mejoras al acueducto.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente en cuanto a la violación del principio del buen funcionamiento de los servicios públicos y el derecho al servicio de agua potable. Se ordena a Georgina Garro Mora, en su condición de Subgerente de Gestión de Sistemas Delegados del Instituto Costarricense de Acueductos y Alcantarillado y a Yanner Estiv Ramírez Aguilar, en su condición de Presidente de la Asociación Administradora del Acueducto Rural de San Juan de Santa Cruz, que dentro del plazo de UN MES, a partir de la notificación de la presente sentencia, procedan a coordinar las acciones correspondientes para que se conozca y solucione la situación planteada por el recurrente, y proceder a cumplir con lo dispuesto en el memorando N°GSD-UEN-GAR-2020-00667, del 21 de febrero de 2020, "Declaratoria de Zona Deficitaria, San Juan, Santa Cruz, Guanacaste”. Además, las obras de infraestructura acordadas como necesarias para tal fin, deberán estar finalizadas dentro del plazo de DOCE MESES, a partir de la notificación de esta sentencia.
Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. En los demás extremos se declara sin lugar el recurso. Se condena al Instituto Costarricense de Acueductos y Alcantarillados y a la Asociación Administradora del Acueducto Rural de San Juan de Santa Cruz el pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil y contencioso administrativo.- Fernando Castillo V.
