CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes on the twelfth of April two thousand twenty-four.
An amparo action processed under case file no. 24-003231-0007-CO, filed by [Nombre 001], identity card [Valor 001], on behalf of [Nombre 002] and [Nombre 003], against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DEL ASENTAMIENTO MONSEÑOR MORERA and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

In the brief notified to the appellant herein on June 1, 2022, it is clearly mentioned in the second point: "...The ASADA does NOT have a technical study, nor a specific study on the quantity of water that well can provide, there is NO capacity test (aforo), therefore we CANNOT irresponsibly grant ANY water availability. The Service Provision Regulation clearly states in its Article 9 'it is the obligation of the drinking water service provider ... to provide them within the parameters of optimal provision regarding quality, quantity, continuity, reliability, universal access, efficiency, timeliness, sustainability...'; since there is no technical feasibility study nor a hydraulic network where Mr. [Name 001]'s property is located, 250 meters from the settlement, the Board of Directors cannot grant any availability....". The service currently provided by the Asada is distributed within the perimeter of the Asada, where the last service connection (prevista) is located 600 meters from the storage tank and the rest of the area surrounding us consists of livestock farms, including his.
It was explained to him that we are d) a very small ASADA and that our piping is old, so we cannot irresponsibly extend branches, much less for farm consumption, leaving the 80 families we were supplying at that time without the resource. The situation of his property was clarified to him, as having an area greater than 5,000 meters and having livestock, it was considered an agricultural farm. Above all, it was stated to him that the ASADA DOES NOT HAVE the budget to carry out the studies and works necessary to have technical feasibility to grant a new service on his farm and that he had to wait for the ASADA to have sufficient funds to perform the well capacity test, according to the AYA technical standard of 72 hours on the only existing well, where the quantity of water is verified in summer. At all times, the dismissal of his request has been substantiated, motivated, and justified on technical and legal grounds.
Our ASADA DOES NOT have a hydraulic network that extends 2 kilometers away. (I present images of the settlement provided by INDER). The aqueduct association was formed for the purpose of providing drinking water service; however, this entity CANNOT act in a disorderly, arbitrary, or irresponsible manner, putting the existing population in need, falling into imprudence or recklessness on our part; we have the essential obligation to ensure the services already granted and that they receive the service efficiently. We must manage and efficiently exploit the precious liquid, safeguarding sustainable development in the face of the scarcity (sic) of the precious liquid. We are working every day on improving the network, but we must prioritize administrative needs: paying for electricity, the plumber, the C.C.S.S. payroll, the INS policy, the billing system, water quality tests, inventory, etc.; we had to make changes to the collection tank, acquire computer equipment for the electronic billing required by the Ministry of Finance; recently, two plots of land were donated to us on which we established an office; real estate for which we had to bring the real estate tax payments up to date, as well as for the lands where the well and the collection tank are located. 2) h) This Board of Directors has been requesting quotes for the pumping tests as well as the corresponding Technical Study, to include them in the Annual Plan and Budget for the year 2025; however, the investment for that project is approximately 8,927,000.00 (eight million nine hundred twenty-seven thousand exact colones), so we are currently in talks with the Municipality of Tilarán, INDER, and the entity ACTIVA, which was the one that donated the well drilling to us, seeking resources or donations that they can grant us to carry it out.
The Board of Directors is very active and searching for resources that allow us to continue growing and to be able to extend branches, so that in the future the entire network continues to grow, doing everything possible so that projects are carried out in a timely manner, always seeking speed, efficiency, and effectiveness of the association's actions despite our scarce economic resources. Our Board of Directors has met on two occasions with Mr. [Name 001] and his wife, and we have discussed the entire situation of the existing aqueduct; at all times, it has been explained to the gentleman that we cannot extend piping, nor install branches capriciously and without complying with technical standards. The appellant, knowing the entire situation, and having been informed of the budget the ASADA needs to conduct the studies, seems to ignore everything answered and informed, filing this appeal as a new form of pressure, despite having explained all the existing drawbacks.
Every human being of legal age must be responsible for their actions; it was Mr. [Name 001] who voluntarily decided to buy a property that did NOT have drinking water service, knowing that the ASADA did NOT have water availability, a situation that was reported to him since April 2021, and even so he decided in December of the same year to acquire the property. This ASADA has at NO time incurred in the violation of the Constitutional, Human, or Elderly Person Rights or Principles of Mr. [Name 001] or his family, and who irresponsibly, 4 months ago, brought an elderly person over 90 years old to live with him, being aware that he does NOT have drinking water and knowing the health status of the elderly person with the medical opinions he provides; at all times, he has been given a response, he even provides the responses received to Your Authority, nor has there been discrimination as he tries to portray; quite the contrary, the appellant lies, trying to take advantage of a false fact, leading a Constitutional Judge into the falsehood of not having a; he has a registered well on his property and states that he lives at: 255 meters; In this regard, the Constitutional Chamber in its rulings; see judgments: 2006-1898, 2007-13310, 2008-16311, 2018-8650, 2018-007369, and resolution N°2020012942, mentions (...) Therefore, IT IS NOT TRUE that this ASSOCIATION violates his fundamental right under Articles 27, 21, or 33 of the Political Constitution."

Considering:
I.ON ADMISSIBILITY.- This amparo appeal, despite having been filed against a private law entity, is admissible, in accordance with Article 57 of the Law of this jurisdiction, since it is clear that the respondent acts in the exercise of public functions or powers, and is, de jure and de facto, in a position of power against which common jurisdictional remedies are clearly insufficient or tardy to guarantee the fundamental rights or freedoms referred to in Article 2, subsection a) of the Constitutional Jurisdiction Law. In the specific case, compliance with these conditions is clear, as it concerns a private law entity that is exercising public powers by providing a public service, such as the supply of drinking water, and due to the specific circumstances, it is in a position to infringe upon the constitutional rights of the appellant, without common jurisdictional remedies being sufficient or timely.
II.Purpose of the appeal. The appellant claims that the respondent Asada arbitrarily denies him water service; he notes that he lives with an elderly person with health problems, so it should provide him the service. He asserts that his last two requests (April 25, 2022, and December 19, 2023) were not addressed.
III.Proven facts. Of importance for the decision of this matter, the following facts are deemed duly proven, either because they have been accredited or because the respondent has omitted to refer to them, as provided in the initial order:
IV.On the specific case. In the sub examine, the appellant claims that the respondent Asada arbitrarily denies him water service. He asserts that his last two requests (April 25, 2022, and December 19, 2023) were not addressed. Having analyzed the case file, the Chamber found it proven that the appellant resides on an agricultural-use farm that has an artisanal well (pozo artesanal). His dwelling was built without having water availability from the respondent Asada. With respect to the request of April 25, 2022, the Chamber verified that the petitioner requested before the respondent Asada: "1. As indicated by you in letter dated February 21, 2022, our property is located outside the perimeter of the Parcelas Monseñor Morera settlement, so I request that you indicate to us: Which institution is responsible for the provision of drinking water service on our property, if not the ASADA MONSEÑOR MORERA VEGA? 2. Please indicate to us by means of a certificate what the current water capacity and/or water balances (Balances hídricos) maintained by the ASADA MONSEÑOR MORERA VEGA are as of today."
The claim regarding the response to that note cannot prosper. First, it is recalled that the exercise of the right of petition is limited when dealing with a private law entity:
"V.- ON THE RIGHT OF PETITION BEFORE PRIVATE LAW ENTITIES: THE CASE OF THE AQUEDUCT AND SANITARY SEWER ADMINISTRATIVE ASSOCIATIONS. The Constitutional Chamber has established, on multiple occasions, that the right of petition and prompt resolution, guaranteed in Article 27 of the Political Constitution, can only be exercised against Public Administrations. It is recalled that, regarding requests for information presented before private law entities, such as associations, the rights of members will be protected for violation of the right of association. In this regard, this Chamber has indicated:
'(...) As the respondent party is a private association, no violation of Article 27 of the Constitution is possible. That said, this Chamber recognizes that the members of an association do have the right to obtain information from it, precisely because of their status as members, and if the information is not provided to them, the right of association enshrined in Article 25 of the Political Constitution is violated (...)' (see Judgment No. 2003-15266 of 13:52 hours on December 19, 2003)." (Judgment No. 2022001090 of 9:20 a.m. on January 14, 2022).
In the sub lite, the protected party seeks to belong to the respondent Asada and obtain its service; ergo, he does not have the status of subscriber or member, required to exercise the rights linked to such status, in the terms of the transcribed precedent.
A second reason to dismiss the claim arises from the response provided to the appellant through a note dated June 1, 2022, given that a letter from September 18, 2020, was sent to him, informing him: "The Asada does NOT have a technical study, nor a specific study on the quantity of water that well can provide, there is NO capacity test (aforo), therefore we CANNOT irresponsibly grant ANY water availability (...) The ASADA Monseñor Morera is currently UNABLE to grant an aqueduct service for which WE DO NOT HAVE TECHNICAL, WATER, OR HYDRAULIC FEASIBILITY (sic)...". It is considered that the previous response addresses the interested party's request regarding the competence of the respondent Asada.
Finally, it is also inappropriate to seek to have this claim accepted via amparo, given that a period just under two years elapsed between the filing of the request (April 25, 2022) and the filing of this appeal (February 7, 2024), which means the possibility of accepting this claim in this venue has lapsed (Article 35 of the Constitutional Jurisdiction Law).
V.Regarding the request of December 19, 2023, the Chamber observes that two months had not elapsed between that moment and the filing of the amparo (February 7, 2024), so such filing is deemed premature.
"...the denial was based on the lack of technical feasibility due to insufficient water and hydraulic capacity in the area's supply system, therefore there is no availability of drinking water service for new development projects.
Thus, it is proven that the sub lite does not concern an arbitrary denial of drinking water service, as this was based on the lack of technical feasibility. In this line, note that this Constitutional Court is not a controller of the legality of the actions or resolutions of the respondent authority, nor can it replace the active Administration in the management of its competencies, so it is not appropriate to usurp the powers that have been legally conferred on other dependencies, bodies, or entities, such as AyA. Nor does this Court act as a mediator before a specific physical or legal person —whether public or private— to intercede so that what the appellant seeks is granted..." (Judgment No. 2021-18977 of 11:50 a.m. on August 24, 2021).
To that extent, the Chamber does not consider the Asada's response to be arbitrary, given that it cites the lack of technical capacity to provide the intended service, which does not constitute arbitrary action, as indicated in the transcribed jurisprudence. By virtue of the foregoing, the appeal is dismissed.
VII.Documentation provided to the case file. The parties are warned that if they have submitted any paper documents, as well as objects or evidence contained in any electronic, computer, magnetic, optical, telematic device or one produced by new technologies, they must be removed from the office within a maximum period of 30 business days counted from the notification of this judgment. It is warned that any material not removed within this period will be destroyed, pursuant to the provisions of the "Regulation on the Electronic Case File before the Judicial Branch", approved by the Full Court in Article XXVI of session No. 27-11 of August 22, 2011, published in Judicial Bulletin No. 19 of January 26, 2012, as well as in the agreement of the Superior Council of the Judicial Branch, approved in Article LXXXI of session No. 43-12 held on May 3, 2012.
Therefore:
The appeal is dismissed.

Sentencia con datos protegidos, de conformidad con la normativa vigente SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del doce de abril de dos mil veinticuatro .
Recurso de amparo que se tramita en el expediente nro. 24-003231-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], a favor de [Nombre 002] y de [Nombre 003], contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DEL ASENTAMIENTO MONSEÑOR MORERA y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.SOBRE LA ADMISIBILIDAD.- El presente recurso de amparo, a pesar de haber sido interpuesto contra un sujeto de derecho privado, es admisible, de conformidad con el artículo 57 de la Ley de esta jurisdicción, pues es claro que el recurrido actúa en ejercicio de funciones o potestades públicas, y se encuentra, de derecho y de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resultan claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la Ley de la Jurisdicción Constitucional. En el caso concreto, es claro el cumplimiento de esos presupuestos, pues se trata de un sujeto de derecho privado que está ejerciendo potestades públicas al prestar un servicio público, como lo es el suministro de agua potable, y por las circunstancias concretas está en la posibilidad de infringir los derechos constitucionales del recurrente, sin que los remedios jurisdiccionales comunes sean suficientes u oportunos.
II.Objeto del recurso. La parte recurrente acusa que la Asada accionada le niega el servicio de agua de manera arbitraria; señala que convive con un adulto mayor con problemas de salud, por lo que debería brindarle el servicio. Afirma que sus últimas dos gestiones (25 de abril de 2022 y 19 de diciembre de 2023) no fueron atendidas.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
IV.Sobre el caso concreto. En el sub examine, la parte recurrente acusa que la Asada accionada le niega el servicio de agua de manera arbitraria. Afirma que sus últimas dos gestiones (25 de abril de 2022 y 19 de diciembre de 2023) no fueron atendidas. Analizados los autos, la Sala tuvo por probado que la parte recurrente habita en una finca de uso agrícola que tiene un pozo artesanal. Su vivienda fue construida sin contar con disponibilidad de agua de la Asada accionada. Con respecto a la gestión del 25 de abril de 2022, la Sala verificó que la parte accionante gestionó ante la Asada recurrida: “1. Según indicación de ustedes en misiva 21 de febrero de 2022, nuestra propiedad se encuentra fuera del perímetro asentamiento Parcelas Monseñor Morera, por lo que solicito se nos indique ¿A qué institución le corresponde la prestación de Servicio de agua potable en nuestra propiedad, si no es a la ASADA MONSEÑOR MORERA VEGA? 2. Se nos indique mediante constancia cuál es la capacidad hídrica y/o Balances hídricos que mantiene la ASADA MONSEÑOR MORERA VEGA al día de hoy”.
El reclamo por la atención de esa nota no puede prosperar. En primer lugar, se recuerda que el ejercicio del derecho de petición es limitado cuando se trata de un sujeto de derecho privado:
“V.- SOBRE EL DERECHO DE PETICIÓN ANTE SUJETOS DE DERECHO PRIVADO: EL CASO DE LAS ASOCIACIONES ADMINISTRADORAS DE ACUEDUCTO Y ALCANTARILLADO SANITARIO. La Sala Constitucional ha establecido, en múltiples ocasiones, que el derecho de petición y pronta resolución, garantizado en el artículo 27, de la Constitución Política, sólo puede ser ejercido frente a las Administraciones Públicas. Recuérdese que, en cuanto a las solicitudes de información presentadas ante sujetos de derecho privado, como lo son las asociaciones, se tutelará a los asociados, por violación al derecho de asociación. Al respecto, esta Sala ha indicado:
“(…) Tratándose la parte recurrida de una asociación de índole privada, no hay violación posible al artículo 27, de la Constitución. No obstante lo dicho, esta Sala reconoce que los miembros de una asociación sí tienen derecho a obtener información de ésta, precisamente por su calidad de asociados, y si no se les brinda la información, se violenta el derecho de asociación consagrado en el artículo 25, de la Constitución Política (…)" (ver Sentencia Nº 2003-15266 de las 13:52 horas del 19 de diciembre del 2003)”. (Sentencia nro. 2022001090 de las 9:20 horas del 14 de enero de 2022).
En el sub lite, el amparado busca pertenecer a la Asada recurrida y obtener su servicio; ergo, no cuenta con la condición de abonado o asociado, requerida para ejercer los derechos vinculados a tal condición, en los términos del precedente transcrito.
Un segundo motivo para desestimar el reclamo surge a partir de la respuesta brindada al recurrente mediante nota del 1 de junio de 2022, toda vez que se le remitió un oficio del 18 de setiembre de 2020, comunicándole: “La Asada NO cuenta con un estudio técnico, ni estudio específico sobre la cantidad de agua que puede proveer ese pozo, NO existe aforo, por lo tanto NO podemos de manera irresponsable brindar NINGUNA disponibilidad de agua (…) La ASADA Monseñor Morera en este momento se encuentra IMPOSIBILITADA para otorgar un servicio de acueducto para el cual NO TENEMOS VIABILITAD TECNICA (sic), NI HIDRICA (sic), NI HIDRAULICA (sic)…”. Se considera que la respuesta anterior atiende la gestión del interesado en lo que concierne a la competencia de la Asada recurrida.
Finalmente, también resulta improcedente pretender que se acoja tal extremo vía amparo, visto que transcurrió un plazo poco menor a los dos años entre la presentación de la gestión (25 de abril de 2022) y la interposición de este recurso (7 de febrero de 2024), lo que conlleva que decaiga la posibilidad de acoger tal extremo en esta vía (artículo 35 de la Ley de la Jurisdicción Constitucional).
V.Atinente a la gestión del 19 de diciembre de 2023, la Sala observa que no transcurrieron dos meses entre ese momento y la interposición del amparo (7 de febrero de 2024), por lo que se estima prematura tal interposición.
“…la denegatoria se sustentó en la falta de factibilidad técnica debido a la insuficiencia de capacidad hídrica e hidráulica en el sistema de abastecimiento de la zona, por lo que no se tiene disponibilidad del servicio de agua potable para nuevos proyectos de desarrollo.
Así las cosas, se acredita que el sub lite no versa sobre una denegatoria arbitraria del servicio de agua potable, pues esta se fundamentó en la falta de factibilidad técnica. En esta línea, adviértase que este Tribunal Constitucional no es un contralor de la legalidad de las actuaciones o resoluciones de la autoridad recurrida y tampoco puede reemplazar a la Administración activa en la gestión de sus competencias, de modo que no le corresponde usurpar las atribuciones que le han sido legalmente conferidas a otras dependencias, órganos o entes, como el AyA. Tampoco este Tribunal funge como mediador ante una determinada persona física o jurídica -ya sea de derecho público o privado-, para interceder a fin de que se le conceda lo que la parte recurrente pretende…” (Sentencia nro. 2021-18977 de las 11:50 horas de 24 de agosto de 2021).
En ese tanto, la Sala no estima que la respuesta de la Asada sea arbitraria, visto que aduce la falta de capacidad técnica para brindar el servicio pretendido, lo que no constituye un actuar arbitrario, según lo indicado en la jurisprudencia transcrita. En virtud de lo expuesto, se declara sin lugar el recurso.
VII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso.
