Document Review Case: 24-032775-0007-CO Decision No. 2025002056 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen on veinticuatro de enero de dos mil veinticinco.
Proceeding for protection of constitutional rights (recurso de amparo) processed under expediente número 24-032775-0007-CO, filed by Nombre02, of legal age, identity card NFP01, against the Municipalidad de Naranjo, the Ministerio de Salud, and the Consejo Nacional de Vialidad.
Findings:
“I hereby appear before the Honorable Constitutional Chamber to submit a report on the actions taken, within the period granted.
1. “(…) “report on the matters alleged by the petitioner…
These facts involve:
1. Failure to fulfill the orders issued concerning improvements to an open channel and the management of both wastewater and stormwater. This refers to a complaint filed by the petitioner with the Ministerio de Salud in 2018.
2. At present, the environmental damage in the area where they live has increased due to the large number of new buildings in the upper areas, where the Municipalidad de Naranjo has disregarded certain plans concerning the management of stormwater and wastewater, which discharge onto Dirección02.
3. The problem has grown and is now highly visible due to the driveways built to provide vehicle access to homes along Dirección02 under CONAVI’s jurisdiction, where culverts have been installed without sufficient capacity for stormwater, where no future projections have been made, and where no drainage system has been built to mitigate the damage.
1. The records of this Ministerio de Salud include complaint file D-N043-2018, filed by Nombre02 concerning flooding during the rainy season caused by the inability of the stormwater-management channel to accommodate the volume of water and by obstructions consisting of garbage, stones, and gravel from road repairs or construction in the area above Alto Murillo, Naranjo.
It also reports the construction of buildings without any planning and the improper management of wastewater discharged into this channel, where it accumulates during the dry season and creates breeding grounds for disease vectors.
2. The first inspection was conducted on veintiuno de marzo del dos mil dieciocho at the site in Alajuela, Candelaria, 1200 mts south of Súper Las Américas, Dirección05, where stormwater drainage was observed on each side of Dirección03. Report CO-ARS-NRS-0322-2018 (case-file pages 00005-00006) states that the drainage system on the south side was dry and clean, thereby ruling out improper wastewater management in that area, while the system on the north side presented problems involving weeds and waste. 3. Sanitary order (orden sanitaria) N°OS-CO-DARS-N-076-2018 was prepared and served on CONAVI, requiring maintenance and cleaning of the drainage system on the north side of Dirección03, 1200 mts west of Súper Las Américas.
4. The complainant was notified of the actions taken on tres de mayo del año dos mil dieciocho through official letter CO-DARS-N-0515-2018.
5. On diecinueve de junio del dos mil dieciocho, the health authority followed up on the degree of compliance with order N°OS-CO-DARS-N-076- 2018. It was determined that the ditch system (sistema de cunetas) had been cleaned. The order was deemed fulfilled. Report CO-ARS-N-RS-0619-2018, case-file pages 00014-00015.
6. The complainant was informed of the actions taken on cuatro de julio del año dos mil dieciocho by official letter CO-DARS-N-0749-2018.
7. On veinticuatro de agosto del dos mil dieciocho, a statement was received from the complainant, Nombre02, addressing the intervention by the Ministerio de Salud and stating that the improper management of wastewater from existing and new buildings persisted.
8. As a result of that submission, a new inspection was conducted on cuatro de septiembre del año dos mil dieciocho, expanding the area under review.
The report describes a channel that collects water from two stormwater systems or areas and redirects it to a third channel, where the flows converge. The dimensions of the channel conveying water from the two topographically higher areas to its discharge point (desfogue) into a third channel were assessed. This channel crosses private properties under what appears to be a right-of-way easement (servidumbre de paso). Its dimensions were considered adequate, and the importance of cleaning it periodically to prevent obstructions was noted. Wastewater was observed in the stormwater system and, based on tracing its course, four dwellings were identified as possible sources. Regarding new construction undertaken without planning and the improper management of stormwater and wastewater, what was observed at that time was a lot on which a real-estate project was supposedly being developed, with no buildings or homes yet constructed and no identified risks from vectors or inorganic waste.
The report concludes that coordination with other agencies and subsequent follow-up are necessary to address the residential properties. Report CO-ARS-N-RS-0947-2018 9. A description of the complaint was forwarded to the Municipalidad de Naranjo by official letter CO-DARS-N-1071-2018 for its attention.
10. On veinte de noviembre del año dos mil dieciocho, the four houses suspected of discharging wastewater into the channel were visited. Three effective follow-up inspections were completed, determining that one dwelling did not discharge its water into the roadside drain (caño), while two did. One inspection could not be conducted because no one was present to receive the authority.
11. Reports CO-ARS-N-RS-1379-2018, CO-ARS-N-RS-1378-2018, CO-ARS-NRS-1376-2018, and CO-ARS-N-RS-1377-2018 12. Administrative orders (actos administrativos) N°OS-CO-DARS-N-305- 2018 and N°OS-CO-DARS-N-306-2018 were prepared and served, requiring ordinary wastewater from showers, washbasins, washing machines, and sinks to be conveyed to a wastewater treatment system (sistema de tratamiento de agua residual). Deadline: siete de febrero del dos mil diecinueve. The complainant was informed of the foregoing by official letter CODARS-N-1453-2018.
13. Additional visits were made to the property that remained to be inspected, without success because no one could be found at the site. Accordingly, sanitary order N°OS-CO-DARS-N-159-2019 was issued to coordinate an inspection. The inspection was completed on dos de octubre del año dos mil diecinueve, documenting that water from this property was not discharged into the roadside drain of the public right-of-way (vía pública). Report CO-ARS-N-RS1226-2019 14. On veinte de marzo del dos mil diecinueve, the degree of compliance with sanitary orders N°OS-CO-DARS-N-305-2018 and No. OS-CODARS-N-306-2018 was verified. The two identified houses remained in violation of the regulations concerning the disposal of wastewater into the channel identified in the complaint. The situation remained unchanged.
15. Reports CO-ARS-N-RS-0342-2019 and Report CO-ARS-N-RS-0343-2019 On veintinueve de marzo del año dos mil diecinueve, Nombre02 filed a written submission reiterating the flooding problems caused by the open channel, which lacks the capacity to handle the water collected in the upper areas. He again reported that the stormwater-management system was obstructed by garbage, soil, stones, and gravel. He added that stagnant wastewater was accumulating, resulting in mosquito breeding grounds.
16. By means of official letter CO-DARS-N-0363-2019, a response was provided to Mr. Nombre02, informing him which houses were in fact discharging their wastewater into the drainage ditch, the actions taken by this Ministry regarding them, and the results of the follow-up. He was also advised that neither the capacity of the channel to drain stormwater nor its maintenance falls within the responsibilities of the Ministry of Health.
17. On nueve de abril del dos mil diecinueve, another general inspection of the system was conducted. The health authority reported observing little waste, some ballast material, light vegetation, and a slight flow of wastewater from the residences that had failed to comply with the health order (orden sanitaria). At that time, there was no standing water. Report CO-ARS-N-RS-0417-2019.
18. Mr. Nombre02 was notified of these latest findings by means of official letter CO-DARS-N-0545-2019.
19. Official warnings concerning special measures (medidas especiales) were issued to the owners of the dwellings that had failed to comply with the health order, seeking correction of the situation. Official letters CO-DARS-N-1510-2019 and CO-DARS-N-1511-2019 20. On treinta de abril del año dos mil veinte, as a possible special measure to be taken for failure to comply with health orders, both buildings with inadequate wastewater treatment were assessed to determine their habitability. The health authority concluded that the homes were habitable and, therefore, that this special measure was not applicable in this case. Reports MS-DRRSCODARSN-RS-0515-2020 and N°MS-DRRSCO-DARSN-RS-0516-2020 21. Once again, official warnings were issued to the owners of the dwellings that had failed to comply with the health order, seeking correction of the situation. Official letters MS-DRRSCO-DARSN-0608-2020 and MS-DRRSCO-DARSN0609-2020.
22. On veinticinco de agosto del dos mil veinte, another inspection was conducted, during which it was observed that the inadequate management of wastewater continued at both buildings. Reports MS-DRRSCO-DARSN-RS-1102-2020 and No. MS-DRRSCO-DARSN-RS1103-2020 23. Health reports were prepared and served for the collection of a fine as a penalty for failure to comply with health orders N°OS-CO-DARS-N-305-2018 and N°OS-CO-DARS-N-306-2018. These reports were subsequently annulled by a ruling granting the appeal filed by the owners of the properties involved. 24. On seis de septiembre del año dos mil veintidós, another follow-up was conducted regarding the inadequate management of wastewater in a stormwater channel. The follow-up was unsuccessful because no one was found in the related premises; nevertheless, the drainage ditch was inspected and found to be completely dry, with no traces of soapy water. Report N°MS-DRRSCO-DARSN-RS-1339-2022.
25. The proceeding remained inactive on the part of the parties throughout the remainder of año dos mil veintidós and all of año dos mil veintitrés; therefore, the expiration (caducidad) of health orders N°OS-CO-DARS-N-305-2018 and N°OS-CO-DARS-N-306-2018 was declared on treinta y uno de enero del año dos mil veinticuatro through acts N°MS-DRRSCO-DARS-N-0092-2024 and N°MS-DRRSCO-DARS-N-0091-2024. Those same acts directed that proceedings be initiated ex officio (de oficio).
26. For this reason, on veinte de junio del año dos mil veinticuatro, another inspection was conducted, during which the drainage ditch was observed to be dry at that time. The health authority recommended closing the proceeding. Report No. MS-DRRSCO-DARSN-RS1101-2024.
HAVING SET FORTH THE FACTS, THE CHALLENGED MATTERS ARE ADDRESSED:
“1. Failure to fulfill the commitments ordered regarding improvements to an open channel and the management of both wastewater and stormwater. This refers to a complaint filed by the appellant with the Ministry of Health in año 2018.” It is not the responsibility of the Ministry of Health to perform work on the stormwater channel, and the complainant was so notified.
As for the complaint from dos mil dieciocho, it was addressed. In junio del presente, no wastewater was observed in the channel involved in this matter.
The environmental pollution case involving wastewater was closed.
“2. At present, the environmental damage in the area where they live has increased due to the large number of new buildings in the upper areas, where the Municipalidad de Naranjo has disregarded certain proposals regarding the management of stormwater and wastewater, which discharge onto Dirección02 del CONAVI.
In año dos mil dieciocho, the existence of new buildings was not confirmed because none were observed at the site.
There is no current complaint concerning this matter in our files.
Urban planning falls within the exclusive jurisdiction of the municipal authority.
“3. The problem has worsened and is now highly visible because of the entrances that have been built to allow residents to drive their vehicles into their homes. These structures were built alongside Dirección02 del CONAVI, where culverts lacking sufficient stormwater capacity have been installed, with no future projections and no sewer system built to mitigate the damage.” We again state before the Honorable Chamber that these grievances are considered new and that this Ministry became aware of them through this action. We further note that resolving the issue of structures built over the stormwater treatment system does not fall within the jurisdiction of this Ministry; therefore, our course of action would be to refer the matter to the competent entity.
IN LIGHT OF THE FOREGOING, WE REQUEST THAT THE HONORABLE CONSTITUTIONAL CHAMBER CONSIDER:
1. Absence of New Buildings in 2018 During the inspections conducted in año 2018, as documented in technical report CO-ARS-N-RS-0947-2018, no new buildings were observed in the affected area. The conditions at that time did not significantly compromise the stormwater system.
It is important to emphasize that any construction that arose after the 2018 inspections was not within the knowledge of the Ministry of Health at that time, and urban-planning assessments did not fall within our jurisdiction.
On behalf of the Health Authority, and considering the provisions of Artículo 35 of the Ley de la Jurisdicción Constitucional, we submit the following arguments in defense against the amparo action (recurso de amparo) filed:
Application of Artículo 35 in the Context of the Amparo Action:
The article provides that an amparo action may be filed at any time while the violation continues, or up to two months after its direct effects have entirely ceased.
Regarding the events originating in 2018, we consider that the actions and measures taken at the time by the Health Authority adequately addressed the complaints and brought their direct effects to an end, as was documented and communicated to the relevant parties.
2. Newly Discovered Facts and Timely Notice:
Although the article allows the action to be filed while the violation continues, it is important to note that the facts alleged in 2024 are presented as new and were not reported to the Health Authority until the action was filed. This means that the Authority had no opportunity to act on these new facts within the scope of its jurisdiction before the action was filed. The absence of prior notice limits the Health Authority’s ability to respond and should be considered when assessing the admissibility of the action under the premise of “newly discovered facts” (hechos de nueva noticia).
3. Jurisdiction and Responsibility of the Health Authority:
We reiterate that the Health Authority’s responsibilities do not include urban planning or the regulation of construction with respect to the matters complained of, as these fall within the jurisdiction of the municipality and other government entities.
The actions taken by the Health Authority regarding the facts known in 2018 were appropriate and timely in light of the complaints received and the Authority’s jurisdiction.
4. Summary: We argue that the absence of notice and the clear delineation of jurisdiction justify finding this action inadmissible under the circumstances presented. The Health Authority has fulfilled its duty regarding the complaints and the known and documented facts, acting within the scope of its lawful jurisdiction.

1. We request that the Chamber consider the absence of timely notice from the protected party (amparado) concerning the new facts, as well as the specific scope of the Health Authority’s jurisdiction, when assessing the admissibility of the action.
2. Recognize that although the amparo action is permissible under Artículo 35 LJC while the violation continues, it requires a clear showing that the relevant authorities were duly notified and failed to intervene within a reasonable time frame.
3. Therefore, we request that the amparo action be declared inadmissible on the basis of these legal grounds.”
“The esteemed members of the CHAMBER are hereby informed that the event forming the subject matter of the action occurred along national route 148 under CONAVI, toward Dirección05, 100 metros south of mueblería Chinchilla. It should be noted that the matter concerns the management of residential wastewater and stormwater, for which the homeowners are responsible. It is unknown which orders the appellant is referring to regarding work on an open channel; if any such orders exist, they are null and void. The same applies to the mitigation work, which, as previously indicated, does not fall within our jurisdiction. The appellant evidently erred in the processing of his request. It should also be noted that the appellant knows that this is a national route and nevertheless insists that we must make improvements at the site, even though the Municipal Technical Units lack authority to intervene in, perform maintenance work on, or rehabilitate routes belonging to the National Road Network, including both the roadway surface and the drainage systems associated with the road, pursuant to Ley General de Caminos Públicos N. 5060 Art. 4 Inc. a).
Cases such as the appellant’s are referred to the appropriate authorities, as was done by Ing. Joseph Esteban Salazar Madrigal of Unidad Técnica de Gestión Vial, who, by email, referred the issue reported by the appellant in this action to the technical department responsible for administering the Red Vial Nacional, specifically to Ing. Alejandro Badilla Vargas of CONAVI. See Oficio UTGV-MN-CI-459-2024 and the email dated 04 diciembre de 2024 09:35 as documentary evidence.
Regarding the construction work, Departamento de Construcciones, through its director, states that it verified that the work performed on the properties neighboring the appellant’s property complied with the requirements governing stormwater conveyance under Artículo 121 of Reglamento de la ley de Construcciones. It was confirmed that stormwater is directed to a public collector connected to the storm sewer network and that the stormwater drainage systems along the national route fall within the jurisdiction of CONAVI. See oficio MN-DPU-234-2024, signed by Marcos Octavio Picado López, Jefe del Departamento de Planificación Urbana, as documentary evidence.
Relief Requested Please deny the action on jurisdictional grounds.”
“I. SERVICE ORDER:
The ruling issued at eleven fifty-two in the morning on seis de enero de dos mil veinticinco was served on the Consejo Nacional de Vialidad on 06 de enero del 2025; accordingly, the facts mentioned are hereby answered in the manner and within the time prescribed by law.
The ruling in question specifically addresses the facts alleged by the petitioner:

AUTHORITY OF THE CONSEJO NACIONAL DE VIALIDAD Before analyzing the merits of this application, it is important to emphasize and state that the authority of the Consejo Nacional de Vialidad is limited by its enabling statute, number 7798.
(…)
In summary, the filing by which the petitioner submitted the application for amparo relief recounts the following facts:

For its part, in order to submit the report requested by the Chamber in these proceedings, this Consejo asked the Gerencia de Conservación de Vías y Puentes, through its Regional Director, to issue a technical report regarding the petitioner’s allegations; that report was issued through official letter No. DRC-06-2025-0016 (0189) dated 07 de enero del 2025, in accordance with the matters stated by the petitioner and those falling within that Gerencia’s authority.
It should be noted that the situation reported by the petitioner in this application for amparo relief was first addressed in 2018 and was initially directed to the Ministerio de Salud and the Municipalidad de Naranjo; this Zone Engineering Office became aware of the matter because it involved a culvert (alcantarilla) on Dirección03.
However, according to report DRC-06-2025-0016 (0189) dated 07 de enero del 2025, the site referred to in the request was visited again to verify its current condition.

As stated in official letter DRC-06-2025-0016 (0189) dated 07 de enero del 2025, issued by the Gerencia de Conservación de Vías y Puentes:
“It is important to note that the terrain’s topography naturally determines the drainage outlet (desfogue) for the water; the water likely flowed through the existing property without any significant issue. As the property was subdivided and construction took place near the drainage channel, the increase in the number of houses built caused more rainwater to be deposited in the existing roadside ditch (cuneta).
The road existed before the buildings, as did the natural drainage outlet, which has been modified by the access points to the houses.
It is also important to state that the channel is outside the route’s right-of-way (derecho de vía), where its proper maintenance is the responsibility of the property owner, as provided by law.
Proper maintenance of the channel allows the water to drain without causing damage until it reaches the point of discharge; the landowners are responsible for maintaining an adequate setback (retiro) and not overcrowding the lots with buildings.
It is important to inform the landowners that blocking the culverts’ cross-flow passage is prohibited, because doing so would cause problems downstream from the ditch…” Likewise, it is important to state that articles 20 and 21 of the Ley General de Caminos, Ley N 5060 de 22 de agosto de 1972, provide as follows regarding this matter:

These provisions have been reiterated in article 75 of the Código Municipal, which provides, insofar as relevant, as follows:
(…)
As the cited articles indicate, it is reiterated that all inhabitants who own property adjoining public streets have an obligation to keep the roadsides in good condition, with the drains clean and unobstructed. When private parties fail to comply, the Municipalities are authorized to remedy the omission of those duties by directly carrying out the work, particularly when the situation poses a danger to both pedestrians and homes, and subsequently charging the property owner for the work performed.
It should also be noted that the petitioner’s allegation states as follows:
“…He states that environmental damage in the area where he lives has now increased because of the large number of new buildings in the higher areas, where the Municipalidad de Naranjo has disregarded certain planning requirements concerning the management of stormwater and wastewater, which discharge onto Dirección02 under CONAVI, an impact that has increased because of inclement weather and heavy rains…” (emphasis added) Accordingly, it must be considered that the Municipalidad de Naranjo has failed to address the situation affecting the petitioner—which falls outside CONAVI’s authority—given that, as he states in his allegation, environmental damage in the area where he lives has increased because of the large number of new buildings, while taking into account that the road existed before those buildings. It must also be noted that the natural drainage outlet was modified by the access points to the houses and that the channel is outside the route’s right-of-way. (see photograph 1) For the foregoing reasons, the petitioner’s allegations are wholly devoid of legal basis, because there is no evidence demonstrating that any fundamental right has been violated as a consequence of work performed or inaction by the Consejo Nacional de Vialidad.
For the factual and legal reasons set forth above, I request that the honorable Constitutional Chamber of the Corte Suprema de Justicia dismiss this application for amparo relief and absolve the undersigned, in the capacity stated, of all liability, as well as the Consejo Nacional de Vialidad, which I represent.”
Justice Garro Vargas authored the opinion; and,
Considering:
I.Subject matter of the application. The petitioner alleges that the Alcalde de Naranjo and the Directora del Área Rectora de Salud de Naranjo del Ministerio de Salud have failed to fulfill the commitments ordered regarding improvements to works in an open channel and the management of both wastewater and stormwater. He states that he first reported this situation in 2018 because of flooding at his residence, located at Dirección05, 100 metros al sur de la Mueblería Chinchilla, as well as at the homes of his relatives and children. He adds that, as a mitigation measure, the respondents merely partially covered a catch basin (caja de registro) into which water from the higher areas of a sector on the left side of Dirección03 drained, an action that only partially remedied the damage at that time because water runoff (escorrentía) flows along both sides of that road. He states that environmental damage in the area where he lives has now increased because of the large number of new buildings in the higher areas, where the Municipalidad de Naranjo has disregarded certain planning requirements concerning the management of stormwater and wastewater, which discharge onto ruta No. 148 under CONAVI, an impact that has increased because of inclement weather and heavy rains.
He recounts that the problem has worsened and is now highly visible because of the driveways that have been built to allow vehicles to enter the residences, structures erected alongside ruta No. 148 under CONAVI, where culverts lacking sufficient stormwater-flow capacity have been installed, with no future planning and no sewer system (sistema de alcantarillado) having been built to mitigate the damage affecting the population in this sector. This occurs on the right-hand side of the road from Naranjo toward Palmares whenever it rains heavily, causing stormwater to flow downstream along both sides of the road and form what resembles a river; even now, it overflows toward the left side of ruta No. 148 under CONAVI, in turn causing it to spill over in certain sectors and flood houses, as has occurred. He adds that it is regrettable to see what is happening while no one does anything, including the municipality, which is responsible for making the improvements or, at the very least, coordinating with the appropriate entity so that this problem will be resolved in the future.
He states that, during the recent flooding, when señora Nombre01 saw the impact caused by the heavy downpours, she called the Fuerza Pública and 911 to report the heavy downpours occurring at the location and the consequences they were causing. He complains that the respondents’ inaction has caused them financial losses and violations of their fundamental rights.
II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondents failed to address them as ordered in the initial order:
III.Municipal obligations regarding storm sewers (alcantarillado pluvial). Pursuant to article 169 of the Constitución Política, municipalities are responsible for administering local interests and services in each canton. From this derives the municipalities’ authority to plan and oversee urban development in their respective localities. This includes the duty to establish a comprehensive urban-planning policy that ensures urban development consistent with the efficient operation of a system for supplying drinking water and collecting, treating, and finally disposing of wastewater. Likewise, the foregoing gives rise to the obligation to adopt the measures required to provide the canton with an adequate storm sewer system, in order to guarantee its inhabitants the right to health and to an environment free from pollution. Regarding the specific issue of municipal obligations concerning storm sewers, in judgment number 2008-04210 issued at 13:59 on 14 de marzo de 2008, reiterated, among others, in judgment 2015-010562 issued at 09:20 on 17 de julio de 2015, this Chamber stated:
“This Court has repeatedly recognized in its case law that the right to enjoy a healthy and ecologically balanced environment is a fundamental right derived from Article 50 of the Constitution, which not only enshrines every citizen’s right to enjoy a healthy and ecologically balanced environment, but also requires the State to guarantee the exercise of that right through the means established for that purpose by the legislation in force. Specifically, as this Chamber stated in judgment number 2005-009900, issued at ten o’clock on July twenty-ninth, two thousand five, the Municipality must build the infrastructure necessary to ensure the proper flow of water, thereby guaranteeing the right to health and to an environment free of pollution, without harming third parties: ‘(…) Regarding municipal obligations concerning stormwater drainage.—It should be borne in mind that Article 169 of the Political Constitution provides that the administration of local interests and services in each canton shall be entrusted to the Municipal Government.
Local interests and services have been defined by the Chamber as indeterminate legal concepts whose precise content is not resolved by law for their application to specific cases; consequently, the person responsible for applying them must rely on value judgments and experience to determine their content. The creation of adequate drainage facilities within a community so as not to cause damage to property or health, or environmental problems for its residents, is, within the terms set forth in the Political Constitution, an interest of the canton and is among the services that the Municipality is required to provide (…) For that reason, the Municipalidad de Goicoechea is required to undertake specific action to fulfill its purposes by adopting the measures necessary to provide the protected community with an efficient stormwater drainage system. In accordance with criteria of reasonableness, the Municipality must build the infrastructure necessary to ensure the proper flow of that water, thereby guaranteeing the right to health and to an environment free of pollution, without harming third parties.’”
IV.Merits. First, it should be clarified that the appellant filed the remedy of amparo (recurso de amparo) processed under expediente No. 18-007747-0007-CO, in which he alleged that “a property located 150 meters from his home is being subdivided into lots, and its stormwater and wastewater are being improperly managed. He states that surface runoff flowing toward his residence has increased, and that the municipal and health authorities have therefore been informed of this situation. He adds that the Concejo Municipal de Naranjo reviewed the case and granted permission for a road to be built or modified within that property. He states that on February 9 and 12, 2018, he filed the respective complaints with the Municipalidad de Naranjo and the Ministerio de Salud; however, he has received no solution to the problem. He believes that the foregoing violates his fundamental rights.” The matter was granted by judgment No. 2018-013309, issued at 09:20 hours on August 17, 2018. The Directora del Área Rectora de Salud de Naranjo was ordered to serve him with official letter No. CO-DARS-N-0515-2018, and the Alcalde de Naranjo was ordered to respond to the complaint he had filed on February 09, 2018.
In this matter, which the appellant had raised in the aforementioned expediente and which was ordered to be processed as a new amparo because it involved different facts, the appellant alleges the purported inaction of the respondent authorities in addressing the flooding problem in the area where he lives in Candelaria de Naranjo, Dirección05, caused by the improper management of wastewater and stormwater. He first reported this situation in 2018.
None of the respondent authorities—namely, the Municipalidad de Naranjo and CONAVI—denies that such flooding has occurred, but neither accepts responsibility. The municipality states that “the event giving rise to the amparo occurs on national route 148, which is under CONAVI, at Dirección05, 100 meters south of mueblería Chinchilla. It should be noted that it refers to the management of household wastewater and stormwater, for which the homeowners are responsible (…) Cases such as the appellant’s are referred to the appropriate bodies, as was done by Ing. Joseph Esteban Salazar Madrigal of the Unidad Técnica de Gestión Vial, who, by email, referred the problem reported by the appellant in this amparo to the Technical Department that administers the Red Vial Nacional, specifically to Ing. Alejandro Badilla Vargas of CONAVI. See official letter UTGV-MN-CI-459-2024 and the email dated December 04, 2024, 09:35, as documentary evidence.” Finally, the acting Director Ejecutivo of CONAVI reports that “the topography of the land naturally determines where the water drains.
The water probably used to flow through the existing property without causing any significant issue. As the property was subdivided and construction took place near the drainage channel, the increase in the number of houses built resulted in a greater volume of rainwater being deposited in the existing ditch. The road existed before the buildings were constructed, as did the natural drainage outlet, which has been modified by the accessways to the houses. It is also important to note that the channel is outside the route’s right-of-way (derecho de vía), where its proper maintenance is the responsibility of the property owner, as provided by law.” Nevertheless, the fact remains that the record in the matter under review (sub examine) does not show that this problem has been duly addressed, nor is there any indication that action will be taken to that end.
For the reasons stated, having established the existence of this problem—irrespective of the converging causes that produce it and of how it should be resolved—this Chamber must intervene to safeguard the rights of the residents of that area who may be affected during the rainy season. Accordingly, it must order the local government and CONAVI to seek definitive solutions to remedy the problem affecting the appellant, which worsens during the rainy season. In view of the foregoing, the amparo must be granted against both authorities, with the consequences detailed in the operative part (parte dispositiva) of this judgment.
V.Finally, this Court does not find that the Ministerio de Salud violated the fundamental rights of the protected party (parte amparada) in the terms alleged in the amparo. This is because the record shows that the representative of the Ministerio de Salud reports that the Área Rectora de Salud de Naranjo addressed the complaint filed by the appellant in 2018, while the facts alleged in 2024 were presented as new and were not brought to its attention until this amparo was filed. The 2018 complaint, as noted, was reviewed by this Chamber in the amparo processed under expediente No. 18-007747-0007-CO.
Therefore, the amparo is not granted insofar as the Ministerio de Salud is concerned.
VI.Conclusion. Under this reasoning, because the appellant’s fundamental rights have been violated in this case, this amparo must be granted with respect to the authorities of the aforementioned municipal corporation and CONAVI, with the consequences set forth in the operative part of this judgment. With respect to the Área Rectora de Salud de Naranjo of the Ministerio de Salud, the amparo is denied in accordance with the foregoing.
VII.Note by Justice Salazar Alvarado. As a matter of principle, I consider that cases related to action or inaction by the Public Administration concerning the repair, construction, modification, or demolition of any infrastructure project should be dismissed because such omission is a matter of legality whose adjudication belongs to the ordinary courts, before which the interested person may argue their objections more fully. However, where such administrative conduct—whether by omission or otherwise—results in a violation of other fundamental rights protected by this constitutional jurisdiction, or affects groups regarded as vulnerable, I do examine the merits because such circumstances constitute an exception to my position on this matter. That is the situation here, where the appellant alleges that the Alcalde de Naranjo and the Directora del Área Rectora de Salud de Naranjo of the Ministerio de Salud failed to comply with the obligations ordered concerning improvements to structures in an open channel, as well as the management of both wastewater and stormwater affecting his community, because culverts lacking sufficient stormwater-flow capacity have been installed, no provision has been made for future needs, and no sewerage system has been built to mitigate the harm affecting the population in this area.
Although I agree with the Chamber’s majority that the amparo should be granted, I disagree as to the jurisdiction in which the enforcement phase of the matter should be lodged, given the lack of adequate mechanisms under the rules governing this constitutional jurisdiction to ensure proper follow-up.
As is well known, under the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional, LJC), enforcement of the orders issued by the Sala Constitucional is, in principle, to be supervised by the Chamber itself. However, art. 56 of the LJC provides for exceptional circumstances in which the Chamber itself may order that enforcement of the judgment be lodged with the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). The provision in question states as follows:
“Art. 56. The enforcement of judgments shall be the responsibility of the Sala Constitucional, except with respect to the assessment and payment of compensation and monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case enforcement shall proceed through the contentious-administrative courts under the judgment-enforcement procedure established in the law governing that jurisdiction.” (Emphasis not in the original).
It should be recalled that the bill debated for the LJC originally provided as follows:
“Art. 56. Judgments in favor of the appellant shall be enforced through the contentious-administrative courts under the judgment-enforcement procedure established in the law governing that jurisdiction.” (Emphasis not in the original).
However, the text was amended by motion so that the provision would be consistent with art. 153 of the Political Constitution, and the following explanation was given:
“THE SECRETARY:
Motion No. 68 (32-19) by Deputy Chacón Jiménez:
‘Article 57 (formerly 56): to amend the text to read as follows: “The enforcement of judgments shall be the responsibility of the Sala Constitucional, except with respect to the assessment and payment of compensation or monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case enforcement shall proceed through the contentious-administrative courts under the judgment-enforcement procedure established in the law governing that jurisdiction.”’ THE PRESIDENT:
Is there any discussion of the motion as read?
Doctor Piza Escalante:
There was a contradiction here with the general principle that courts enforce their own judgments, because it assigned all enforcement to the Contentious-Administrative Jurisdiction; this left the other articles that allowed the Chamber to enforce them without a clear basis.
Deputy Corrales Bolaños:
That section says: ‘or other matters that the Chamber itself deems appropriate...’; what does that refer to?
Doctor Piza Escalante:
The idea is for the Chamber, in the judgment enforcement proceedings (ejecución de sentencia), to decide what it considers to fall within its purview. Everything else is referred to the Contentious-Administrative Jurisdiction (vía Contencioso Administrativa).

Debated. Approved (unanimously, five members of the Legislative Assembly present).” (Sic. See the records concerning the approval of the LJC. Emphasis not in the original).
Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to decide what it considers to concern it and, should it deem appropriate, it may refer to the contentious-administrative jurisdiction those matters that it determines should be handled there.
In this particular case, the judgment provides as follows:
“Randall Vega Blanco and Cristhian Arroyo Gamboa, in their respective capacities as Alcalde de Naranjo and acting Director Ejecutivo del Consejo Nacional de Vialidad, or whoever holds those offices, are ordered to coordinate and arrange all actions falling within the scope of their authority so that, within a maximum period of six months from notification of this judgment and following coordination with each other, all appropriate measures and works are undertaken to provide a comprehensive and permanent solution to the flooding problem affecting appellant (recurrente) Nombre02 in the community of Candelaria de Naranjo, Dirección05.” It is evident that the order entails a certain degree of complexity, and its enforcement can hardly be effectively supervised by this Sala Constitucional. By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (art. 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, oversee stages of compliance, and so forth. Therefore, pursuant to article 56 of the LJC, in my view, this judgment should be enforced before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules established in that Code.
Accordingly, I dissent with respect to the enforcement of the judgment, which, pursuant to art. 56 of the LJC, must be lodged with the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. To that end, I order that a copy of this decision be forwarded so that proceedings to enforce this judgment may be initiated.
VIII.Documentation submitted to the case file (expediente). The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, such materials must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión No. 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Sesión No. 43-12 held on 3 de mayo del 2012, article LXXXI.
Por tanto:
The amparo appeal (recurso de amparo) is granted solely against the Municipalidad de Naranjo and the Consejo Nacional de Vialidad. Randall Vega Blanco and Cristhian Arroyo Gamboa, in their respective capacities as Alcalde de Naranjo and acting Director Ejecutivo del Consejo Nacional de Vialidad, or whoever holds those offices, are ordered to coordinate and arrange all actions falling within the scope of their authority so that, within a maximum period of six months from notification of this judgment and following coordination with each other, all appropriate measures and works are undertaken to provide a comprehensive and permanent solution to the flooding problem affecting appellant Nombre02 in the community of Candelaria de Naranjo, Dirección05. The respondents (recurridos), or whoever holds those offices, are advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in amparo proceedings that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Naranjo and the Consejo Nacional de Vialidad are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined in the contentious-administrative judgment-enforcement proceedings. With respect to the Ministerio de Salud, the appeal is denied. Justice Salazar Alvarado adds a separate note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to article 56 of the Ley de la Jurisdicción Constitucional, directs that it be carried out before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded to that office so that proceedings to enforce this judgment may be initiated. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinticuatro de enero de dos mil veinticinco .
Recurso de amparo que se tramita en expediente número 24-032775-0007-CO, interpuesto por Nombre02, mayor, cédula de identidad NFP01, contra la Municipalidad de Naranjo, el Ministerio de Salud y el Consejo Nacional de Vialidad.
Resultando:
“Al respecto me apersono ante la Honorable Sala Constitucional con el objeto de rendir informe de lo actuado, dentro del plazo conferido.
1. “(…) “informe sobre los dispuestos alegados por el recurrente…
Estos hechos implican:
1. Omisión a los compromisos ordenados en cuanto a mejoras de obras de un canal a cielo abierto, manejo de las aguas tanto residuales, como pluviales. Esto en alusión a denuncia interpuesta por la parte recurrente ante el Ministerio de Salud en el año 2018.
2. En la actualidad los daños ambientales en la zona donde viven se han incrementado con la gran cantidad de construcciones nuevas en las partes altas, en donde la Municipalidad de Naranjo ha irrespetado algunos planteamientos en cuanto al manejo de las aguas pluviales y residuales, mismas que desfogan en la Dirección02.
3. El problema se ha incrementado y es muy visible en la actualidad, con las entradas que han construido para ingresar con sus vehículos a sus viviendas, construcciones que han hecho a la orilla de la Dirección02 del CONAVI, en donde han instalado alcantarillas sin capacidad de paso de aguas pluviales donde no hay proyecciones a futuro, ni se ha construido un sistema de alcantarillado que mitigue los daños.
1. Consta en los archivos de este Ministerio de Salud expediente denuncia D-N043-2018 interpuesta por Nombre02 por inundaciones presentadas en época lluviosa por incapacidad de canal de manejo de agua pluvial para soportar el volumen, obstrucción con basura, piedra y lastre de reparaciones de caminos o de construcciones en sector arriba del Alto Murillo, Naranjo.
Indica además levantamiento de construcciones sin ninguna planificación e inadecuado manejo de aguas residuales depositadas en este canal que en verano se acumula y provoca criaderos de vectores de enfermedades.
2. Se realiza primera inspección el día veintiuno de marzo del dos mil dieciocho a sitio Alajuela, Candelaria, del Súper Las Américas, 1200 mts al sur, Dirección05, donde se visualiza la existencia de alcantarillado de agua pluvial sobre cada lado de Dirección03. Describe el informe CO-ARS-NRS-0322-2018 (folio del expediente 00005-00006) el alcantarillado al lado sur se encuentra seco y limpio, por lo cual se descarta inadecuado manejo de agua residual de esa zona, mientras el sistema ubicado al lado norte presenta problemas de maleza y residuos. 3. Se confecciona y notifica al CONAVI orden sanitaria N°OS-CO-DARS-N-076-2018 con el contenido de efectuar el mantenimiento de limpieza al alcantarillado lado norte Dirección03, 1200 mts oeste del súper Las Américas.
4. Se notifica al denunciante de lo llevado a cabo el día tres de mayo del año dos mil dieciocho a través de oficio CO-DARS-N-0515-2018.
5. El diecinueve de junio del dos mil dieciocho se da seguimiento por parte de la autoridad en salud al grado de acatamiento de la orden N°OS-CO-DARS-N-076- 2018. Se determina el sistema de cunetas fue sometido a limpieza. Se da por cumplido el acto. Informe CO-ARS-N-RS-0619-2018 folio del expediente 00014-00015.
6. Se informa de lo actuado al denunciante el cuatro de julio del año dos mil dieciocho por medio de oficio CO-DARS-N-0749-2018.
7. Se recibe el veinticuatro de agosto del dos mil dieciocho pronunciamiento por parte del denunciante señor Nombre02 donde se manifiesta sobre lo intervenido por el Ministerio de Salud, describiendo persiste el inadecuado manejo de aguas residuales de construcciones existentes y nuevas.
8. A raíz de dicha nota se procede a un nuevo reconocimiento el cuatro de septiembre del año dos mil dieciocho ampliando la zona de revisión.
Se describe un canal que recoge las aguas de dos sistemas pluviales o sectores y que redirige estas aguas a un tercer canal donde se unen. Se valora las dimensiones del canal que traslada las aguas de los dos sectores superiores topográficamente hasta el desfogue a un tercero. Este canal pasa por propiedades privadas bajo la figura que aparenta servidumbre de paso. Se considera de dimensiones adecuadas y la importancia de su limpieza periódica para evitar obstrucciones. Sobre las aguas residuales se observan las mismas en el sistema de agua pluvial y por recorrido se relaciona a cuatro moradas como las posibles fuentes. Sobre construcciones nuevas sin planificación e incorrecto manejo de aguas pluviales y residuales lo que se observa a ese momento es un lote donde se supone se está llevando a cabo un proyecto inmobiliario, sin ninguna edificación o vivienda construida, sin identificar riesgos por vectores o residuos inorgánicos.
Se concluye la necesidad de coordinación con otras dependencias y seguimiento posterior para abordaje de casas de habitación. Informe CO-ARS-N-RS-0947-2018 9. Se remite por oficio CO-DARS-N-1071-2018 a la Municipalidad de Naranjo descripción de la denuncia para su atención.
10. El veinte de noviembre del año dos mil dieciocho se procede a visitar las cuatro casas sospechosas de verter aguas residuales al canal logrando concretar tres seguimientos efectivos, donde una morada no depositaba sus aguas a caño y dos sí. Una inspección no fue posible de efectuar por no encontrarse a nadie que recibiera a la autoridad.
11. Informes CO-ARS-N-RS-1379-2018, CO-ARS-N-RS-1378-2018, CO-ARS-NRS-1376-2018 y CO-ARS-N-RS-1377-2018 12. Se confeccionan y notifican los actos administrativos N°OS-CO-DARS-N-305- 2018 y N°OS-CO-DARS-N-306-2018, cuya ordenanza es conducir las aguas residuales ordinarias provenientes de ducha, lavamanos, lavadora y pilas a sistema de tratamiento de agua residual. Vencimiento siete de febrero del dos mil diecinueve. De lo anterior se participa al denunciante mediante oficio CODARS-N-1453-2018.
13. Se realizan nuevas visitas a la infraestructura pendiente, con un resultado infructuoso por no ubicar a nadie en sitio, por lo cual se emite orden sanitaria N°OS-CO-DARS-N-159-2019 para coordinación de inspección. Esta se concreta el dos de octubre del año dos mil diecinueve documentando las aguas de esta propiedad no son depositadas en caño de vía pública. Informe CO-ARS-N-RS1226-2019 14. El veinte de marzo del dos mil diecinueve se realiza verificación de grado de acatamiento a las órdenes sanitarias N°OS-CO-DARS-N-305-2018 y No. OS-CODARS-N-306-2018, de las dos casas identificadas incumplen la normativa en alusión a disposición de agua residual hacia el canal denunciado. La situación permanece igual.
15. Informes CO-ARS-N-RS-0342-2019 e Informe CO-ARS-N-RS-0343-2019 El veintinueve de marzo del año dos mil diecinueve el señor Nombre02 presenta escrito donde reitera problemas de inundaciones por canal abierto, el cual no tiene capacidad de manejar las aguas recolectadas en sectores de la parte alta. Insiste en la obstrucción del sistema de manejo de agua pluvial con basura, tierra, piedras y lastre. Agrega acumulación de aguas residuales estancadas, lo que se traduce en criaderos de zancudos.
16. Por medio de oficio CO-DARS-N-0363-2019 se contesta al señor Nombre02 donde se le menciona las casas que efectivamente vierten sus aguas residuales a caño, las acciones tomadas por este Ministerio con estas, y el resultado de seguimiento. Se le aclara además que la capacidad del canal, así como su mantenimiento, para desaguar las aguas pluviales no es una competencia del Ministerio de Salud llevar a cabo.
17. El nueve de abril del dos mil diecinueve se realiza nuevo recorrido general por el sistema, describiendo la autoridad en salud observar pocos residuos, algunos de lastre, ligera maleza y ligero caudal de aguas residuales provenientes de las residencias que incumplieron la orden sanitaria. No existen a ese momento estancamientos. Informe CO-ARS-N-RS-0417-2019.
18. Se notifica de estos últimos hallazgos al señor Nombre02 mediante oficio CO-DARS-N-0545-2019.
19. Se elevan oficios de apercibimiento de medidas especiales a las propietarias de las moradas que incumplen la orden sanitaria en búsqueda de que se corrija la situación. Oficios CO-DARS-N-1510-2019 y CO-DARS-N-1511-2019 20. El treinta de abril del año dos mil veinte, como posible medida especial a tomar por incumplimiento a órdenes sanitarias, se valoran ambas edificaciones con tratamiento inadecuado de aguas residuales para determinar habitabilidad El criterio de la autoridad en salud es que las viviendas son habitables y por ende esta medida especial no es aplicable en este caso. Informes MS-DRRSCODARSN-RS-0515-2020 y N°MS-DRRSCO-DARSN-RS-0516-2020 21. Nuevamente se elevan oficios de apercibimiento a las propietarias de las moradas que incumplen la orden sanitaria en búsqueda de que se corrija la situación. Oficios MS-DRRSCO-DARSN-0608-2020 y MS-DRRSCO-DARSN0609-2020.
22. El veinticinco de agosto del dos mil veinte se realiza nueva visita observando se mantiene el inadecuado manejo de agua residual en ambas construcciones. Informes MS-DRRSCO-DARSN-RS-1102-2020 y No. MS-DRRSCO-DARSN-RS1103-2020 23. Se confeccionan y notifican informes sanitaria s para cobro de multa como sanción por incumplimiento a las órdenes sanitarias N°OS-CO-DARS-N-305-2018 y N°OS-CO-DARS-N-306-2018. Estos informes son anulados posteriormente por fallo con lugar a recurso de apelación interpuesto por las propietarias de los inmuebles implicados. 24. El seis de septiembre del año dos mil veintidós se da otro seguimiento al inadecuado manejo de agua residual en canal para manejo de aguas pluviales siendo inefectivo al no encontrarse a nadie en los aposentos relacionados, no obstante, se revisa el caño y se encuentra completamente seco, sin rastros de aguas jabonosas. Informe N°MS-DRRSCO-DARSN-RS-1339-2022.
25. El proceso se mantiene inactivo por las partes durante lo restante del año dos mil veintidós y todo el año dos mil veintitrés, por lo cual se dicta caducidad a las órdenes sanitarias N°OS-CO-DARS-N-305-2018 y N°OS-CO-DARS-N-306-2018 el treinta y uno de enero del año dos mil veinticuatro a través de los actos N°MS-DRRSCO-DARS-N-0092-2024 y N°MS-DRRSCO-DARS-N-0091-2024. Se indica en estas mismas actuaciones iniciar el proceso de oficio.
26. Es por esta razón que el veinte de junio del año dos mil veinticuatro se realiza nueva inspección donde se observa un caño en ese momento seco. Recomienda la autoridad en salud cerrar el trámite. Informe No. MS-DRRSCO-DARSN-RS1101-2024.
UNA VEZ EXPUESTOS LOS HECHOS SE RETOMAN LOS ASPECTOS RECURRIDOS:
“1. Omisión a los compromisos ordenados en cuanto a mejoras de obras de un canal a cielo abierto, manejo de las aguas tanto residuales, como pluviales. Esto en alusión a denuncia interpuesta por la parte recurrente ante el Ministerio de Salud en el año 2018.” No corresponde al Ministerio de Salud, y así se le notificó al denunciante, realizar obras sobre el canal para manejo de agua pluvial.
En cuanto a la denuncia del dos mil dieciocho fue abordada. En junio del presente no se observan aguas residuales en el canal implicado en el presente asunto.
Los hechos de contaminación ambiental por aguas residuales fueron archivados.
“2. En la actualidad los daños ambientales en la zona donde viven se han incrementado con la gran cantidad de construcciones nuevas en las partes altas, en donde la Municipalidad de Naranjo ha irrespetado algunos planteamientos en cuanto al manejo de las aguas pluviales y residuales, mismas que desfogan en la Dirección02 del CONAVI.
En el año dos mil dieciocho no se determinó como cierto la existencia de construcciones nuevas, al no visualizar las mismas en sitio.
No existe denuncia actual en nuestros archivos sobre este asunto.
La planificación urbana es competencia exclusiva del ente Municipal.
“3. El problema se ha incrementado y es muy visible en la actualidad, con las entradas que han construido para ingresar con sus vehículos a sus viviendas, construcciones que han hecho a la orilla de la Dirección02 del CONAVI, en donde han instalado alcantarillas sin capacidad de paso de aguas pluviales donde no hay proyecciones a futuro, ni se ha construido un sistema de alcantarillado que mitigue los daños.” Nuevamente reiteramos ante la honorable sala estas molestias son consideradas como nuevas y de conocimiento de este Ministerio mediante el presente recurso. Agregamos el tema de construcciones sobre sistema de tratamiento de agua pluvial no es de competencia de este Ministerio resolver y nuestro proceder por ende sería referir a la entidad competente.
POR LO ANTERIOR SOLICITAMOS A LA HONORABLE SALA CONSTITUCIONAL CONSIDERAR:
1. Ausencia de Construcciones Nuevas en 2018 En las inspecciones realizadas en el año 2018, tal y como consta en el informe técnico CO-ARS-N-RS-0947-2018, no se observaron construcciones nuevas en la zona afectada. La situación en ese momento reflejaba condiciones que no comprometían el sistema pluvial de forma significativa.
Es relevante recalcar que cualquier construcción que haya surgido con posterioridad a las inspecciones de 2018 no estaba dentro del ámbito de conocimiento del Ministerio de Salud en ese momento, y no se encontraba en nuestras competencias la evaluación urbanística.
En representación de la Autoridad de Salud, y considerando la disposición del Artículo 35 de la Ley de la Jurisdicción Constitucional, presentamos los siguientes argumentos ajustados en defensa ante el recurso de amparo interpuesto:
Aplicación del Artículo 35 en el Contexto del Recurso de Amparo:
El artículo establece que el recurso de amparo puede interponerse en cualquier tiempo mientras subsista la violación o hasta dos meses después de que hayan cesado totalmente sus efectos directos En relación con los hechos originados en 2018, consideramos que las acciones y medidas tomadas por la Autoridad de Salud en su momento abordaron adecuadamente las denuncias y cesaron sus efectos directos, lo cual fue documentado y notificado a las partes pertinentes.
2. Hechos de Nueva Noticia y Notificación Oportuna:
Aunque el artículo permite la interposición del recurso mientras subsista la violación, es relevante destacar que los hechos alegados en 2024 son presentados como nuevos y no fueron notificados a la Autoridad de Salud hasta la interposición del recurso. Esto implica que la Autoridad no tuvo la oportunidad de actuar sobre estos nuevos hechos dentro del marco de sus competencias antes de la presentación del recurso. La falta de notificación previa limita la capacidad de respuesta de la Autoridad de Salud y debería ser considerada en la evaluación de la procedencia del recurso bajo la premisa de los "hechos de nueva noticia".
3. Competencia y Responsabilidad de la Autoridad de Salud:
Reiteramos que la responsabilidad de la Autoridad de Salud no incluye la planificación urbana ni la regulación de construcciones en los aspectos aquejados, siendo estas competencias de la municipalidad y otras entidades de gobierno.
Las acciones tomadas por la Autoridad de Salud respecto a los hechos conocidos en 2018 fueron adecuadas y oportunas según las denuncias recibidas y las competencias de la Autoridad.
4. Síntesis: Argumentamos que la falta de notificación y la clara delimitación de competencias justifican la evaluación de este recurso como improcedente bajo las circunstancias presentadas. La Autoridad de Salud ha cumplido con su deber conforme a las denuncias y hechos conocidos y documentados, actuando dentro de sus competencias legales.
• Ley Jurisdicción Constitucional • Ley General de Administración Publica
Como prueba ofrezco fotocopia certificada en formato digital PDF del expediente especifico de denuncia D-N-127-2019 conformado con 00221 folios.
1. Solicitamos que la Sala considere la falta de notificación oportuna sobre los nuevos hechos por parte del amparado y la especificidad de las competencias de la Autoridad de Salud al evaluar la procedencia del recurso.
2. Reconocer que el recurso de amparo, aunque permisible bajo el Artículo 35 LJC, mientras subsista la violación, requiere una demostración clara de que las autoridades pertinentes han sido debidamente notificadas y han fallado en su intervención dentro de un marco temporal razonable.
3. Por lo tanto, solicitamos que se declare la improcedencia del recurso de amparo en base a estos fundamentos legales”.
“Se le informa a los estimados miembros de la SALA que el hecho objeto del recurso se produce en una ruta nacional la 148 del CONAVI, dirección Dirección05, 100 metros al sur de la mueblería Chinchilla, nótese que hace referencia a manejo de aguas residenciales y pluviales siendo responsables los propietarios de las viviendas. Se desconoce de cuales ordenanzas habla el recurrente en cuanto a obras en canal a cielo abierto y de existir son nulas, así como de la obra de mitigación, como antes se indicó no es de nuestra competencia. Evidentemente existió error por el recurrente en cuanto a la tramitación de su gestión. Nótese además que el recurrente sabe que esta ruta es nacional y aun así insiste que debemos realizar las mejoras en sitio, cuando las Unidades Técnicas de las Municipalidades carecen de potestades para intervenir, realizar obras de mantenimiento o rehabilitación, en las rutas de la Red Vial Nacional, incluyendo tanto la superficie de ruedo como los drenajes correspondientes a la vía conforme a la Ley General de Caminos Públicos N. 5060 Art. 4 Inc. a).
Casos como los del recurrente son trasladados a las instancias correspondientes, lo cual fue realizado por el Ing. Joseph Esteban Salazar Madrigal, Unidad Técnica de Gestión Vial, quien vía correo electrónico trasladó la problemática denunciada por el recurrente en este recurso al Departamento técnico que administra la Red Vial Nacional al Ing. Alejandro Badilla Vargas del CONAVI. Ver Oficio UTGV-MN-CI-459-2024 y el correo electrónico de fecha 04 diciembre de 2024 09:35, como documentos de prueba.
En cuanto a las construcciones realizadas el Departamento de Construcciones por medio de su jefatura indica que ha verificado que las obras realizadas en las propiedades vecinas del recurrente, cumplan con los requisitos establecidos para la conducción de aguas pluviales conforme al Artículo 121 del Reglamento de la ley de Construcciones, comprobándose que las aguas pluviales son dirigidas a colector público, el cual se encuentra conectado a la red de alcantarillado pluvial y que los sistemas de evacuación pluvial existentes en la ruta nacional son competencia de CONAVI. Ver oficio MN-DPU-234-2024 suscrito por Marcos Octavio Picado López Jefe del Departamento de Planificación Urbana, como documentos de prueba.
Petitoria Favor declarar el recurso Sin Lugar, esto por competencia”.
“I. RESOLUCION DE TRASLADO:
La resolución de las once horas cincuenta y dos minutos del seis de enero de dos mil veinticinco, fue notificada al Consejo Nacional de Vialidad el día 06 de enero del 2025, por lo que se procede a responder los hechos mencionados, en el tiempo y forma de ley.
La resolución en cuestión aborda de manera específica los hechos alegados por la parte recurrente:
(…)
COMPETENCIAS DEL CONSEJO NACIONAL DE VIALIDAD Previo a analizar el fondo del presente recurso, es importante recalcar e indicar que las competencias del Consejo Nacional de Vialidad se encuentran limitadas en su ley de creación número 7798.
(…)
El escrito de interposición del Recurso de Amparo presentado por el recurrente, en síntesis, relata los hechos los cuales en resumen son:
(…)
Por su parte, a efectos de presentar el informe solicitado por la Sala dentro del presente recurso, este Consejo solicitó a la Gerencia de Conservación de Vías y Puentes, por medio de su Director Regional, emitir un informe técnico respecto a los alegatos de la recurrente; mismo que fue emitido mediante oficio No. DRC-06-2025-0016 (0189) de fecha 07 de enero del 2025, de acuerdo a lo mencionado por la recurrente y a lo que compete a dicha Gerencia.
Es menester indicar, que dicha situación denunciada en el presente Recurso de Amparo por el recurrente fue atendida por primera vez en el año 2018 y dirigido inicialmente al Ministerio de Salud y la Municipalidad de Naranjo, esta ingeniería de Zona conoció del tema por tratarse de una alcantarilla de la Dirección03.
Sin embargo, según informe DRC-06-2025-0016 (0189) de fecha 07 de enero del 2025, se realizó nuevamente la visita al sitio de la solicitud planteada, para verificar el estado actual del lugar.
(…)
Según se señala en el oficio DRC-06-2025-0016 (0189) de fecha 07 de enero del 2025, emitido por la Gerencia de Conservación de Vías y Puentes.
“Importante anotar que la topografía del terreno es la que indica naturalmente el desfogue de las aguas, las misma probablemente corrían por la propiedad existente sin mayor tema, al ir segregando la propiedad y construir cerca del canal de desfogue, al aumentar la cantidad de casas construidas, se genera mayor deposición de aguas de lluvia en la cuneta existente.
La carretera existe desde antes de las construcciones, así como el desfogue natural, el cual se ha sido modificado por el acceso a las casas.
Importante también indicar que el canal, está fuera del derecho de vía de la ruta, donde ya es responsabilidad del dueño de la propiedad su adecuado mantenimiento, como lo indica la Ley.
El adecuado mantenimiento del canal permite escurrir las aguas sin afectaciones hasta la deposición de las aguas, es menester de los dueños del terreno dejar un retiro adecuado y no sobrepoblar con construcciones los terrenos.
Es importante indicar a los dueños del terreno que es prohibido tapar el paso transversal de las alcantarillas, dado que ocasionaría problemas aguas debajo de la cuneta…” Asimismo, es importante indicar que, sobre el particular, en los artículos 20 y 21 de la Ley General de Caminos, Ley N 5060 de 22 de agosto de 1972, se dispone lo siguiente:

Disposiciones que han sido reiteradas en el Código Municipal en el artículo 75, el que dispone, en lo conducente, lo siguientes:
(…)
Como lo indica el articulado se reitera que existe una obligación para todos los habitantes que tengan una propiedad colindante con calles públicas de mantener las orillas de las vías en buenas condiciones, con los desagües limpios y sin obstrucciones. Ante el incumplimiento de los administrados, las Municipalidades están facultadas para suplir la omisión de los deberes referidos realizando en forma directa las obras, máxime, cuando se trata de una situación de peligro tanto para los peatones como para las viviendas, trasladando, posteriormente, al propietario el cobro de las obras realizadas.
Nótese además que el alegato del recurrente expone lo siguiente:
“…Indica que en la actualidad los daños ambientales en la zona donde vive se han incrementado con la gran cantidad de construcciones nuevas en las partes altas en donde la Municipalidad de Naranjo ha irrespetado algunos planeamientos en cuanto al manejo de las aguas pluviales y residuales mismas que desfogan en la Dirección02 del CONAVI, afectación que se han incrementado con las inclemencias del tiempo por las lluvias fuertes…” (el subrayado es nuestro) Así las cosas, debe considerarse que existe una omisión de la Municipalidad de Naranjo en atender la situación que aqueja al recurrente-lo cual se encuentra fuera de las competencias del CONAVI-, que como indica en su alegato que los daños ambientales en la zona donde vive se han incrementado con la gran cantidad de construcciones nuevas, tomando en consideración que la carretera existe antes de las construcciones, y no menos indicar que el desfogue natural fue modificado por el acceso a las casas y que el canal, esta fuera del derecho de vía de la ruta. (ver fotografía 1) Por lo anterior, los alegatos del recurrente resultan desprovistas de todo fundamento jurídico, al no existir elementos que demuestren que se le haya conculcado algún derecho fundamental como consecuencia de una obra ejecutada o por una inacción del Consejo Nacional de Vialidad.
Por las razones de hecho y de derecho expuestas solicito a la honorable Sala Constitucional de la Corte Suprema de Justicia, se declare sin lugar el presente recurso de amparo y se absuelva al suscrito, en calidades indicadas, de toda responsabilidad, así como al Consejo Nacional de Vialidad, al cual represento”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. El recurrente alega que el Alcalde de Naranjo y la Directora del Área Rectora de Salud de Naranjo del Ministerio de Salud han sido omisos con los compromisos ordenados en cuanto a mejoras de obras en un canal a cielo abierto, manejos de las aguas tanto residuales, como pluviales. Indica que dicha situación la denunció por primera vez en 2018 por inundaciones a su casa de habitación que se encuentra ubicada Dirección05, 100 metros al sur de la Mueblería Chinchilla, así como las casas de sus familiares e hijos. Agrega que los recurridos, como obra de mitigación, lo que hicieron fue tapar a medias una caja de registro en donde desaguaban las aguas que venían de las partes altas de un sector del lado izquierdo en la Dirección03, hecho que solucionó a medias los daños en ese momento, debido a que la escorrentía de las aguas fluye por ambos lados de dicha vía. Indica que en la actualidad los daños ambientales en la zona donde vive se han incrementado con la gran cantidad de construcciones nuevas en las partes altas en donde la Municipalidad de Naranjo ha irrespetado algunos planeamientos en cuanto al manejo de las aguas pluviales y residuales, mismas que desfogan en la ruta No. 148 del CONAVI, afectación que se han incrementado con las inclemencias del tiempo por las lluvias fuertes.
Narra que el problema se ha incrementado y es muy visible en la actualidad, con las entradas que han construido para ingresar con sus vehículos a sus viviendas, construcciones que han hecho a la orilla de la ruta No. 148 del CONAVI, en donde han instalado alcantarillas sin capacidad de paso de aguas pluviales, donde no hay proyecciones a futuro, ni se ha construido un sistema de alcantarillado que mitigue los daños que afectan a la población en este sector, esto sobre el margen derecho de la carretera que va de Naranjo hacia Palmares, lo que sucede cada vez que llueve con gran intensidad, provocando que el agua pluvial escurra aguas abajo por la carretera a ambos lados, formándose como un río, incluso en estos momentos en que se desborda hacia el lado izquierdo de la ruta No. 148 del CONAVI, provocando a su vez que se rebalse en algunos sectores y se inunden casas, como ha acontecido. Agrega que es lamentable ver lo que acontece y que nadie hace nada, incluso la municipalidad que es la que tiene que realizar las mejoras o si no por lo menos gestionar el ente para que solucione a futuro este problema.
Indica que, para estos días, que se han provocado estas inundaciones, la señora Nombre01, al ver la situación de la afectación de los fuertes aguaceros, llamó a la Fuerza Pública y al 911 para reportar los hechos de los fuertes aguaceros que están ocurriendo en el lugar y lo que estaban provocando. Reclama que la inacción de los recurridos les ha generados pérdidas económicas y vulneraciones a sus derechos fundamentales.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre las obligaciones municipales en materia de alcantarillado pluvial. Corresponde a las municipalidades la administración de los intereses y servicios locales en cada cantón, de conformidad a lo dispuesto en el artículo 169 de la Constitución Política. De ahí se deriva la competencia de las municipalidades para planificar y vigilar el desarrollo urbano de su localidad. Esto incluye el deber de establecer una política integral de planeamiento urbano, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales. Igualmente, de lo anterior se deriva la obligación de adoptar las medidas requeridas para proveer al cantón de un adecuado sistema de alcantarillado pluvial, a fin garantizar a sus habitantes el derecho a la salud y a un ambiente libre de contaminación. En cuanto al tema específico de las obligaciones municipales en materia de alcantarillado pluvial, en sentencia número 2008-04210 de las 13:59 horas del 14 de marzo de 2008, reiterada, entre otras, en la sentencia 2015-010562 de las 09:20 horas del 17 de julio de 2015, esta Sala señaló:
“Este Tribunal en jurisprudencia reiterada ha reconocido que el derecho a gozar de un ambiente sano y ecológicamente equilibrado es un derecho fundamental que deriva del artículo 50 Constitucional, según el cual, no sólo consagra el derecho de todo ciudadano a gozar de un medio ambiente sano y ecológicamente equilibrado, sino que además obliga al Estado a garantizar el ejercicio de dicho derecho, mediante los medios establecidos al efecto por la legislación vigente. Concretamente, tal como lo ha dicho esta Sala en la sentencia número 2005-009900 de las diez horas del veintinueve de julio del dos mil cinco debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente las aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros: “ (…) Sobre las obligaciones municipales en materia de alcantarillado pluvial.- Es conveniente tomar en cuenta que el artículo 169 de la Constitución Política establece que la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal.
Los intereses y servicios locales han sido definidos por la Sala como conceptos jurídicos indeterminados donde la ley no resuelve con exactitud su contenido para su aplicación a casos concretos, por lo que resulta necesario acudir a criterios de valor y de experiencia, por parte de quien le corresponde aplicarlo, para determinar su contenido. La creación de medios de drenaje adecuados dentro de una comunidad a efectos de no causar daños a la propiedad, a la salud ni problemas de ambientales a sus vecinos es, dentro de los términos indicados por la Constitución Política, de interés del cantón y es parte de los servicios que la Municipalidad está en la obligación de brindar (…) Por tal motivo, la Municipalidad de Goicoechea, está obligada a asumir un determinado comportamiento para la satisfacción de sus fines, tomando las medidas requeridas para proveer a la comunidad amparada, de un sistema eficiente de drenaje de las aguas pluviales.
Ajustado a criterios de razonabilidad debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente esas aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros”.
IV.Sobre el fondo. Primeramente, es de mérito aclarar que el recurrente interpuso el recurso de amparo que se tramitó en el expediente No. 18-007747-0007-CO, donde alegó que “un terreno ubicado a 150 metros de su casa de habitación se está lotificando y hay un mal manejo de las aguas pluviales y residuales. Precisa que se ha incrementado la escorrentía superficial que discurre hacia su vivienda, por lo que se ha puesto en conocimiento de esta situación a las autoridades municipales y de salud. Agrega que el Concejo Municipal de Naranjo conoció el caso y concedió permiso para que se construyera o se modificara un camino dentro de ese predio. Refiere que el 9 y 12 de febrero de 2018 interpuso las denuncias respectivas ante la Municipalidad de Naranjo y el Ministerio de Salud; sin embargo, no ha recibido solución alguna al problema. Estima que, lo anterior, es violatorio de sus derechos fundamentales”. Asunto declarado con lugar por sentencia No. 2018-013309 de las 09:20 horas del 17 de agosto de 2018. Se ordenó a la Directora del Área Rectora de Salud de Naranjo notificarle el oficio No. CO-DARS-N-0515-2018 y al Alcalde de Naranjo darle respuesta a la denuncia que había planteado el 09 de febrero de 2018.
En este asunto, que había presentado el recurrente en el citado expediente y se ordenó tramitar como amparo nuevo, por ser hechos diferentes, acusa el recurrente la supuesta inacción de las autoridades recurridas en la atención a la problemática por inundaciones en el sector donde vive en Candelaria de Naranjo, Dirección05, producidas por el mal manejo de agua residuales y pluviales. Situación que denunció por primera vez en el año 2018.
Respecto a tales inundaciones, no las niegan ninguna de las autoridades recurridas, a saber: Municipalidad de Naranjo y CONAVI, pero tampoco aceptan la responsabilidad. El ayuntamiento dice que “el hecho objeto del recurso se produce en una ruta nacional la 148 del CONAVI, dirección Dirección05, 100 metros al sur de la mueblería Chinchilla, nótese que hace referencia a manejo de aguas residenciales y pluviales siendo responsables los propietarios de las viviendas (…) Casos como los del recurrente son trasladados a las instancias correspondientes, lo cual fue realizado por el Ing. Joseph Esteban Salazar Madrigal, Unidad Técnica de Gestión Vial, quien vía correo electrónico trasladó la problemática denunciada por el recurrente en este recurso al Departamento técnico que administra la Red Vial Nacional al Ing. Alejandro Badilla Vargas del CONAVI. Ver Oficio UTGV-MN-CI-459-2024 y el correo electrónico de fecha 04 diciembre de 2024 09:35, como documentos de prueba”.
Finalmente, el Director Ejecutivo en ejercicio del CONAVI informa que “la topografía del terreno es la que indica naturalmente el desfogue de las aguas, las mismas probablemente corrían por la propiedad existente sin mayor tema, al ir segregando la propiedad y construir cerca del canal de desfogue, al aumentar la cantidad de casas construidas, se genera mayor deposición de aguas de lluvia en la cuneta existente. La carretera existe desde antes de las construcciones, así como el desfogue natural, el cual se ha sido modificado por el acceso a las casas. Importante también indicar que el canal, está fuera del derecho de vía de la ruta, donde ya es responsabilidad del dueño de la propiedad su adecuado mantenimiento, como lo indica la Ley”. Empero, es lo cierto que en el sub examine no consta que tal problemática haya sido debidamente atendida, ni se vislumbra que se vaya a actuar en ese sentido.
En razón de lo expuesto, al constatarse este problema -independientemente, de las causas que convergen para ocasionarlo, así como debe ser solucionado- esta Sala debe intervenir para garantizar los derechos de los habitantes de ese sector, posibles afectados en épocas de lluvia, y por ende ordenar, la búsqueda de soluciones definitivas entre el gobierno local y el CONAVI para remediar el problema que aqueja al recurrente y lo cual se agrava durante el invierno. En virtud de lo expuesto, el amparo debe acogerse contra ambas autoridades con las consecuencias que se detallan en la parte dispositiva de esta sentencia.
V.Finalmente, este Tribunal no comprueba la lesión a los derechos fundamentales de la parte amparada por parte de Ministerio de Salud en los términos en los que fue planteado el recurso. Ello por cuanto, de los autos se desprende que la representante del Ministerio de Salud informa que el Área Rectora de Salud de Naranjo atendió la denuncia interpuesta por el recurrente el año 2018 y los hechos alegados en el año 2024 son presentados como nuevos y no les fueron notificados hasta la interposición de este recurso de amparo. Denuncia del 2018 que, como se indicó, fue conocida por esta Sala en el recurso de amparo que se tramitó en el expediente No. 18-007747-0007-CO
Ergo, no se estima el amparo en cuanto al Ministerio de Salud concierne.
VI.Conclusión. Bajo dicha inteligencia, al tenerse por violentados, en la especie, los derechos fundamentales del recurrente, lo que procede es acoger este amparo, en cuanto a las autoridades de la citada corporación municipal y el CONAVI, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia. Respecto al Área Rectora de Salud de Naranjo del Ministerio de Salud, se desestima el amparo en concordancia con lo antes expuesto.
VII.Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que el Alcalde de Naranjo y la Directora del Área Rectora de Salud de Naranjo del Ministerio de Salud han sido omisos con los compromisos ordenados en cuanto a mejoras de obras en un canal a cielo abierto, así como manejo de las aguas tanto residuales como pluviales que afectan su comunidad, pues se han instalado alcantarillas sin capacidad de paso de aguas pluviales, donde no hay proyecciones a futuro, ni se ha construido un sistema de alcantarillado que mitigue los daños que afectan a la población en este sector.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde corresponde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar un adecuado seguimiento.
Como bien se sabe, de conformidad con la Ley de la Jurisdicción Constitucional (LJC) la ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por la propia Sala. Sin embargo, el art. 56 de la LJC contempla supuestos de excepción en los que, por determinación de la propia Sala, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa. La norma en cuestión establece lo siguiente:
“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).
Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:
“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).
Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:
“EL SECRETARIO:
Moción No. 68 (32-19) del diputado Chacón Jiménez:
“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.
Diputado Corrales Bolaños:
En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?
Doctor Piza Escalante:
La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala a que resuelva lo que ella considera que le atañe y podría, de estimarlo así, derivar en la jurisdicción contenciosa administrativa los aspectos que ella valore que así corresponde.
En el caso concreto, la sentencia dispone lo siguiente:
“Se ordena a Randall Vega Blanco y a Cristhian Arroyo Gamboa, respectivamente, en su condición de Alcalde de Naranjo y de Director Ejecutivo en ejercicio del Consejo Nacional de Vialidad o a quienes ocupen esos cargos, coordinar y disponer todas las actuaciones que se encuentren dentro del ámbito de su competencias, a fin de que, dentro del plazo máximo de seis meses, contado a partir de la notificación de esta sentencia, previa coordinación entre sí, se realicen todas las gestiones y obras pertinentes para solucionar de manera integral y definitiva el problema de inundaciones de la comunidad de Candelaria de Naranjo, Dirección05, que afecta al recurrente Nombre02”.
Es palmario que lo ordenado reviste cierta complejidad, cuya ejecución difícilmente puede seguirse con eficacia en esta Sala Constitucional. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la LJC, a mi juicio, la ejecución de esta sentencia debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Por lo anterior, salvo el voto respecto de la ejecución de la sentencia, la cual, de conformidad con el art. 56 de la LJC, corresponde ser residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. A tales efectos, ordeno remitir una copia de esta resolución para que se inicien los procedimientos de ejecución de este fallo.
VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso, únicamente, contra la Municipalidad de Naranjo y el Consejo Nacional de Vialidad. Se ordena a Randall Vega Blanco y a Cristhian Arroyo Gamboa, respectivamente, en su condición de Alcalde de Naranjo y de Director Ejecutivo en ejercicio del Consejo Nacional de Vialidad o a quienes ocupen esos cargos, coordinar y disponer todas las actuaciones que se encuentren dentro del ámbito de su competencias, a fin de que, dentro del plazo máximo de seis meses, contado a partir de la notificación de esta sentencia, previa coordinación entre sí, se realicen todas las gestiones y obras pertinentes para solucionar de manera integral y definitiva el problema de inundaciones de la comunidad de Candelaria de Naranjo, Dirección05, que afecta al recurrente Nombre02. Se advierte a los recurridos, o a quienes ocupen esos cargos, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Naranjo y al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en el proceso de ejecución de sentencia de lo contencioso administrativo. Respecto al Ministerio de Salud, se declara sin lugar el recurso. El magistrado Salazar Alvarado pone nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
