SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nueve horas quince minutos del veinticuatro de enero de dos mil veinticinco.

Petition for constitutional relief (recurso de amparo) processed under expediente N°25-000545-0007-CO, filed by Nombre02, identity card NFP01, against the MINISTERIO DE AMBIENTE Y ENERGÍA.

BACKGROUND:

  1. 1In a written submission added to the digital case file at 11:36 hours on 09 de enero de 2025, the petitioner filed a petition for constitutional relief against the Ministerio de Ambiente y Energía and stated that, since approximately 1999, he has exercised acts of possession and occupation over a parcel of land measuring 4440m2, bounded as follows: to the north, Nombre01; to the south, a mangrove swamp; to the east, Nombre03; and to the west, the Océano Pacífico. The parcel forms part of the Refugio Nacional de Vida Silvestre Ostional, in the sector known as el golfo, at playa pelada de Nosara. He states that he has a rustic shelter on that land, measuring approximately four meters across the front and six meters deep. He explains that officials of the Refugio de Vida Silvestre Ostional filed a complaint with the Ministerio Público concerning the alleged offense of encroachment upon a protected area (invasión a un área de protección), under expediente judicial N° 22-001597-0412-PE.He mentions that, through oficio N°ACT-OR-DR-1356-2023, Mr. Marín Mora, in his capacity as Director del Área de Conservación Tempisque, granted him a period of twenty business days to voluntarily vacate the land, failing which the authorities would proceed through an eviction proceeding (proceso de desalojo) and file a criminal complaint for disobedience of authority (desobediencia a la autoridad). He states that, by summons (cédula de citación), the Tribunal del Segundo Circuito Judicial de Guanacaste summoned him to a hearing scheduled for 16 de enero de 2025. He requests that the officials of the respondent ministry be ordered to refrain from disturbing or intimidating him. He requests the intervention of this Chamber.
  2. 2By the ruling issued at 13:57 hours on 10 de enero de 2024, the present proceeding was admitted, and the Ministro de Ambiente y Energía and the Director Regional del Área de Conservación Tempisque were given an opportunity to respond regarding the facts alleged by the petitioner.
  3. 3Jorge Mario Rodríguez Zúñiga and Nelson Marín Mora, respectively Ministro de Ambiente y Energía and Director del Área de Conservación Tempisque, state under oath that, on 29 de agosto de 2022, a complaint was received from the petitioner concerning the alleged closure of streets and roads providing access to the Playa Pelada sector within the Refugio de Vida Silvestre Ostional, based on his claim that he is the possessor and occupant of land within the refuge. Accordingly, through oficio N°ACT-RNVSO-074-2022 de fecha 15 de septiembre del 2022, it was explained that no streets or public roads exist within the refuge and that there is no record of the petitioner as a duly registered occupant of the properties within the Refugio de Vida Silvestre Ostional. They state that, in that same year, the Fiscal Ambiental detected the installation of fences, which were removed. It was subsequently observed that the posts and barbed wire had been installed again, and these were likewise removed, giving rise to the filing of the corresponding complaint, which is being processed under expediente 22-001597-0412-PE.They assert that, following those events, the petitioner requested recognition as a possessor, but he was informed that the corresponding complaint had been filed and that his request could not be granted. On 21 de septiembre del 2023, through oficio N°ACT-OR-DR-1356- 2023, the petitioner was informed that, because he had encroached upon Patrimonio Natural del Estado and a complaint was pending before the Ministerio Público, he was required to voluntarily vacate the land at issue in this proceeding, located within the refuge, within no more than twenty business days. They state that, on 14 de noviembre de 2023, the petitioner requested an interim measure (medida cautelar) before the Tribunal Contencioso Administrativo against the eviction ordered against him. Based on the foregoing, they request that the petition be denied.
  4. 4The legal requirements have been observed in the proceedings conducted.

CONSIDERING:

I. SUBJECT MATTER OF THE PETITION

The petitioner alleges that, for several years, he has occupied land in the vicinity of the Refugio de Vida Silvestre Ostional. Despite this, the Área de Conservación Tempisque filed a criminal complaint against him and also threatens him with eviction. He requests the intervention of this Chamber.

II. PROVEN FACTS

The following relevant facts are deemed duly established and material to the resolution of this matter:

  • a)The petitioner carries out acts of occupation over land located within the Refugio de Vida Silvestre Ostional (see the report submitted and evidence provided by the respondent authority).
  • b)A criminal proceeding is pending against the protected party (tutelado) under expediente N° 22-001597-0412-PE for the offense of Encroachment upon State Land (Invasión a Terrenos del Estado) (see the report submitted and evidence provided by the respondent authority).
  • c)Through oficio N°ACT-OR-DR-1356-2023, de fecha 21 de septiembre de 2023, the Área de Conservación Tempisque informed the petitioner that, because he had encroached upon Patrimonio Natural del Estado and a complaint was pending before the Ministerio Público, he was required to voluntarily vacate the land located within the refuge within no more than twenty business days (see the report submitted and evidence provided by the respondent authority).
  • d)On 14 de noviembre de 2023, the petitioner requested an interim measure in the administrative litigation jurisdiction (vía contenciosa administrativa) against the decision set forth in oficio N°ACT-OR-DR-1356-2023 (see the report submitted and evidence provided by the respondent authority).

III. MERITS

In the matter at hand (sub lite), the beneficiary of constitutional protection (amparado) alleges that, for several years, he has occupied land in the vicinity of the Refugio de Vida Silvestre Ostional. Despite this, the Área de Conservación Tempisque filed a criminal complaint against him and also threatens him with eviction.

First, it is necessary to clarify that this Chamber does not review the legality of actions or decisions of the Administration. Likewise, it is not for this Chamber to determine, under the subconstitutional rules (normativa infra constitucional) governing the matter, whether the respondent authority should recognize the protected party as the lawful occupant of the land he claims. Such circumstances concern a dispute involving mere legality (conflicto de mera legalidad), the resolution of which falls outside the jurisdiction of this Tribunal. Furthermore, the petitioner alleges that he has been threatened with eviction; however, the body of proven facts shows that he instituted administrative litigation proceedings (proceso contencioso administrativo) against those decisions.

In view of all the foregoing, if the petitioner considers that he has a superior legal right (mejor derecho), or that the ordered eviction is improper, that is a matter he may raise in the various judicial proceedings that have been instituted in connection with the matter examined herein (sub examine), so that the appropriate ruling may be issued in accordance with law. Therefore, the petition must be dismissed in its entirety, as is hereby ordered.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced by new technologies, such items must be collected from the Court Office within a maximum period of thirty business days counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI and published in the Boletín Judicial N° 19, del 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinticuatro de enero de dos mil veinticinco .

Recurso de amparo que se tramita en el expediente N°25-000545-0007-CO, interpuesto por Nombre02, cédula de identidad NFP01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA.

RESULTANDO:

  1. 1Por escrito incorporado al expediente digital al ser las 11:36 horas del 09 de enero de 2025, la parte recurrente interpone recurso de amparo contra el Ministerio de Ambiente y Energía, y manifiesta que desde el año 1999, aproximadamente, realiza actos de posesión y ocupación sobre un terreno que registra una medida de 4440m2 y las colindancias son: al norte, Nombre01; al sur un manglar; al este, Nombre03 y al oeste el Océano Pacífico, que forma parte del Refugio Nacional de Vida Silvestre Ostional, sector conocido como el golfo, en playa pelada de Nosara. Señala que, en ese terreno, tiene un rancho rústico con una medida aproximada de cuatro metros de frente y seis metros de fondo. Precisa que funcionarios del Refugio de Vida Silvestre Ostional presentaron una denuncia ante el Ministerio Público por el supuesto delito de invasión a un área de protección, según expediente judicial N° 22-001597-0412-PE.Menciona que por oficio N°ACT-OR-DR-1356-2023, el señor Marín Mora, en su condición de Director del Área de Conservación Tempisque, le otorgó un plazo de veinte días hábiles para que realice el abandono voluntario del terreno y de no hacerlo lo realizará a través de un proceso de desalojo con la interposición de la denuncia penal, por desobediencia a la autoridad. Indica que por cédula de citación el Tribunal del Segundo Circuito Judicial de Guanacaste lo convoca a una audiencia programada para el 16 de enero de 2025. Solicita se ordene a los funcionarios del ministerio recurrido, abstenerse de perturbarlo e intimidarlo. Solicita la intervención de esta Sala.
  2. 2A través de la resolución de las 13:57 horas del 10 de enero de 2024, se dio curso al presente proceso y se concedió audiencia al Ministro de Ambiente y Energía y al Director Regional del Área de Conservación Tempisque, sobre los hechos alegados por la parte recurrente.
  3. 3Informan bajo juramento Jorge Mario Rodríguez Zúñiga y Nelson Marín Mora, por su orden Ministro de Ambiente y Energía y Director del Área de Conservación Tempisque, que el 29 de agosto de 2022 se recibió una denuncia del recurrente, por la presunta clausura de calles y caminos que dan acceso al sector de Playa Pelada, dentro del Refugio de Vida Silvestre Ostional y al considerar que es poseedor y ocupante de un terreno dentro del refugio. Por ello, mediante el oficio N°ACT-RNVSO-074-2022 de fecha 15 de septiembre del 2022, se explicó que dentro del refugio no existen calles ni vías públicas y que no se tiene registro del recurrente como un ocupante debidamente registrado en los predios del Refugio de Vida Silvestre Ostional. Señalan que, en ese mismo año, se detectó por parte del Fiscal Ambiental, la colocación de cercas, las cuales fueron retiradas. Posteriormente, se observó que se colocaron nuevamente los postes y alambre de púas que también fueron retirados, lo que dio pie a la interposición de la denuncia correspondiente, el cual se tramita bajo el expediente 22-001597-0412-PE.Aseguran que, luego de esos actos, el recurrente solicitó ser reconocido como poseedor, a lo que se le indicó que se había interpuesto la denuncia correspondiente y que su solicitud no podía ser acogida. En fecha 21 de septiembre del 2023, mediante oficio N°ACT-OR-DR-1356- 2023 se comunicó al recurrente que por haber realizado invasión a Patrimonio Natural del Estado y encontrarse denuncia ante el Ministerio Público, se solicitó abandono voluntario del terreno objeto de este proceso ubicado en el refugio, lo anterior en un plazo no mayor a veinte días hábiles. Indican que el 14 de noviembre de 2023, el recurrente solicitó una medida cautelar contra el desalojo dictado en su contra, ante el Tribunal Contencioso Administrativo. Por lo expuesto, solicitan se declare sin lugar el recurso.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

La parte recurrente alega que ocupa, desde hace varios años, un terreno en las inmediaciones del Refugio de Vida Silvestre Ostional. A pesar de ello, el Área de Conservación Tempisque presentó una denuncia penal en su contra y, además, amenaza con su desalojo. Solicita la intervención de esta Sala.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos de relevancia:

  • a)El recurrente realiza actos de ocupación de un terreno ubicado dentro del Refugio de Vida Silvestre Ostional (véase informe rendido y prueba aportada por la autoridad recurrida).
  • b)Dentro del expediente N° 22-001597-0412-PE se tramita una causa penal contra el tutelado, por el delito de Invasión a Terrenos del Estado (véase informe rendido y prueba aportada por la autoridad recurrida).
  • c)Mediante oficio N°ACT-OR-DR-1356-2023, de fecha 21 de septiembre de 2023, el Área de Conservación Tempisque comunicó al recurrente que, por haber realizado invasión a Patrimonio Natural del Estado y encontrarse denuncia ante el Ministerio Público, debía ejecutar el abandono voluntario del terreno ubicado en el refugio, en un plazo no mayor a veinte días hábiles (véase informe rendido y prueba aportada por la autoridad recurrida).
  • d)El 14 de noviembre de 2023, el recurrente solicitó en la vía contenciosa administrativa una medida cautelar contra lo dispuesto en el oficio N°ACT-OR-DR-1356-2023 (véase informe rendido y prueba aportada por la autoridad recurrida).

III. SOBRE EL FONDO

En el sub lite, el amparado alega que ocupa, desde hace varios años, un terreno en las inmediaciones del Refugio de Vida Silvestre Ostional. A pesar de ello, el Área de Conservación Tempisque presentó una denuncia penal en su contra y, además, amenaza con su desalojo.

En primer lugar, es necesario aclarar que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración; asimismo, no le corresponde determinar, según la normativa infra constitucional que rige la materia, si procede o no que la autoridad recurrida reconozca al tutelado como legítimo ocupante del terreno que reclama. Tales situaciones hacen referencia a un conflicto de mera legalidad, cuya resolución es ajena al ámbito de competencia de este Tribunal. Por otro lado, el recurrente acusa que ha sido amenazado con un desalojo; sin embargo, del elenco de hechos probados se desprende que, contra esas disposiciones, planteó un proceso contencioso administrativo.

Por todo lo expuesto, si el recurrente considera que le asiste un mejor derecho, o bien, que el desalojo decretado es improcedente, es un asunto que, como tal, podrá plantear en los diferentes procesos judiciales que se han instaurado, relacionados con lo conocido en el sub examine, para que se resuelva lo que en derecho corresponda. Ergo, el recurso debe ser desestimado en todos sus extremos, como en efecto se dispone.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes, que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del Despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
