Amparo proceeding (recurso de amparo) filed by Nombre01, identity card NFP01, on her own behalf and on behalf of the RESIDENTS OF URBANIZACIÓN SAN CHARBEL DE ALAJUELA, against the MUNICIPALIDAD DE ALAJUELA, the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, and the MINISTERIO DE SALUD.

Findings:

  1. 1In a written submission filed with the Chamber on 08 de agosto de 2024, the petitioner files an amparo proceeding and states that she is a resident of urbanización San Charbel, located in La Guácima, Alajuela. She explains that within that residential development there is a property belonging to the Municipalidad de Alajuela, which that local government received at the time from the developer of the site. She adds that, until two years ago, the developer of the residential development covered the expenses associated with operating the treatment plant, but ceased doing so because it considered that responsibility to lie with the municipality. She states that, since then, the treatment plant has received no maintenance, because the respondent local government did not assume responsibility for it or for paying the water and electricity services necessary for its operation. She recounts that, as a result of this omission, the plant stopped operating for several months, causing a serious environmental and public-health problem in the community.She indicates that this situation led the Ministerio de Salud to issue a health order (orden sanitaria) granting a one-month period to reactivate the plant and indicating that the residents would otherwise be evicted. She asserts that the residents organized to put the plant into operation provisionally, although paying for the electricity—essential to its operation—became difficult because the residents’ contributions were voluntary. She further states that the plant has now stopped operating again, placing more than 100 homes in the residential development at risk, while also worsening environmental pollution and the resulting health problems. She maintains that numerous applications have been filed with the Municipalidad de Alajuela and that, in some of its responses, the respondent institution acknowledged that it was responsible for the plant, yet it has taken no action in that regard.She specifies that the problem described was reported to the respondent local government through proceeding No. 4530-2023 and that, by official letter No. MA-A313-2023 of 17 de enero de 2023, the director of the Office of the Municipalidad de Alajuela referred the matter to the following authorities: the director of the Proceso de Planeamiento y Construcción de Infraestructura, the coordinator of the Subproceso Acueducto y Saneamiento, and the coordinator of the Actividad de Saneamiento. She considers that the events described violate her fundamental rights and those of the protected parties. She requests that the petition be granted and that the Municipalidad de Alajuela be ordered to fulfill its responsibilities, including transferring the electricity meter, the property, and the plant to the Instituto Costarricense de Acueductos y Alcantarillados, as appears to have been deemed appropriate, or taking whatever other measures are necessary to resolve the problem and guarantee the protection of the health and well-being of the residents of urbanización San Charbel.
  2. 2By decision issued at 14:01 on 29 de agosto de 2024, the proceeding is admitted and a report on the facts alleged by the petitioner is requested from the mayor, the director of the Proceso de Planeamiento y Construcción de Infraestructura, the coordinator of the Subproceso Acueducto y Saneamiento, and the coordinator of the Actividad de Saneamiento, all of the Municipalidad de Alajuela.
  3. 3Roberto Hernán Thompson Chacón, in his capacity as mayor of Alajuela, reports under oath as follows:

Official letter N° MA-Identificacion012024 dated 09 de setiembre de 2024, signed by Eng. Luis Francisco Alpízar Barrantes, Coordinator of the Subproceso de Saneamiento, and Eng. José Luis Chacón Ugalde, Coordinator of the Proceso de Acueducto y Saneamiento Municipal, stated that:

“Having reviewed the facts and relief sought by the petitioner, it is understood that, in summary, she requests that the Municipalidad de Alajuela assume responsibility for the operation and maintenance of the wastewater treatment plant (planta de tratamiento de aguas residuales) of urbanización San Charbel or, alternatively, take the appropriate steps to transfer it to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), because she considers her rights to ‘social security,’ ‘justice,’ ‘a healthy life,’ and ‘protection from pollution’ to have been infringed, as she expressly states.

Therefore, it is first necessary to clarify whether the Municipalidad de Alajuela bears responsibility for operating and maintaining the treatment plant at issue. Article 2 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados (Ley 2726 del 14 de abril de 1961) provides that responsibility for ‘directly administering and operating water-supply and sewerage systems throughout the country’ rests with AyA. That article also establishes a residual responsibility for municipalities, stating that ‘systems currently administered and operated by municipal corporations may remain under their control as long as they provide an efficient service.’ Accordingly, the Law clearly provides that the Municipality’s responsibility is to properly administer and operate the systems under its control, but not to receive and operate new systems. Likewise, if the Municipality were unable to provide an efficient service in the locations where it operates, that responsibility would ultimately fall upon AyA as the governing authority.

In the specific case of urbanización San Charbel, although the public areas were transferred to the Municipality at the time, the Municipality has never formally accepted the wastewater treatment plant in the capacity of service operator, since the residential development is located within AyA’s service area, and AyA is the entity that provides drinking-water service and therefore should also administer the sanitation service. As the Proceso de Servicios Jurídicos explains at length in official letter N° MA-PSJ-182-2024, the treatment plant is situated in an area designated for community facilities; consequently, the actions to be taken by the Municipality should focus on transferring the property to the competent entity, in this case AyA, so that it may assume responsibility for its operation and maintenance.

Accordingly, it is recommended that the petitioner’s request that the Municipalidad de Alajuela assume administration of the sanitary sewerage service (servicio de alcantarillado sanitario) in urbanización San Charbel be denied, since doing so would encroach upon AyA’s service area and powers.” Likewise, the Office of the Mayor, through official letter N° MA-A-4357-2024 dated 09 de setiembre de 2024, stated as follows:

“In response to official letter N° MA-PSJ-1447-2024, in which you informed us of the amparo proceeding filed by Ms. Nombre01 and processed under Expediente N° 24021588-0007-CO, I hereby report the following:

Indeed, on 16 de enero del 2023, this Office of the Mayor received Proceeding Nº 4530-2023, signed by the Residents of Urbanización San Charbel—located in Rincón Chiquito, La Guácima—in which they described a situation affecting them in connection with the wastewater treatment plant. To address that request, the then Director of the Office requested a report on the matter through official letter N° MA-A-313-2023, addressed to Eng. Roy Delgado Alpízar, Coordinator of the Proceso de Planeamiento y Construcción de Infraestructura; Eng. Pablo Palma Alán, Acting Coordinator of the Subproceso Acueducto y Saneamiento; and Eng. Francisco Alpízar Barrantes, Coordinator of the Actividad de Saneamiento (folios 01 to 37 of the administrative record compiled in connection with this amparo proceeding).

In response, official letter N° MA-Identificacion022023 was received, signed by Eng. Francisco Alpízar Barrantes, Coordinator of the Actividad de Saneamiento, who clarified that the treatment plant in question has never been accepted by the Municipalidad de Alajuela and that the residents have been duly informed that drinking-water service in the community is provided by AyA; therefore, in that professional’s opinion, AyA is the entity responsible for operating the sanitary sewerage system (folio 36, reverse).

For that reason, official letter N° MA-A-1025-2024 dated 21 de febrero del 2023 was prepared and sent to Eng. Delgado Alpízar, reminding him of the request for information mentioned two paragraphs above and attaching a copy of official letter N° ° MA-SAN-0220032023 (folios 36 to 37).

Information was again requested from Eng. Delgado Alpízar, together with Eng. María Auxiliadora Castro Abarca, Coordinator of the Subproceso Acueducto y Saneamiento, and Eng. Francisco Alpízar Barrantes, Coordinator of the Actividad de Saneamiento, through official letter N° MA-A-3421-2023 (folio 38).

In response, official letter N° MA-PPCI-0591-2023 was received, signed by Eng. Roy Delgado Alpízar, Coordinator of the Proceso de Planeamiento y Construcción de Infraestructura, clarifying that the developer of the residential project was responsible for completing the procedures with the Municipality and ICE to transfer the land and easement (servidumbre) to AyA. That official letter was communicated to the Residents of Urbanización San Charbel through official letter N° MA-A-4355-2023, dated 14 de julio del 2023, signed by the then Director of the Office of this Office of the Mayor (folios 39 to 40).

Additionally, that document was forwarded to Lic. Johanna Barrantes León, Coordinator of the Proceso de Servicios Jurídicos, through official letter N° MA-A-4356-2023, dated 14 de julio del 2023, also signed by the then Director of the Office of this Office of the Mayor, together with the case background, so that she could issue her legal opinion on the matter (folios 41 to 59). Through official letter N° MA-A-5961-2023, dated 25 de setiembre del 2023, a reminder was sent to Lic. Barrantes León, as shown in folios 60 to 65.

In response, official letter N° MA-PSJ-182-2024 was received, signed by the Coordinator of the Proceso de Servicios Jurídicos, stating that the Instituto Costarricense de Acueductos y Alcantarillados could assume responsibility for the treatment plant through an agreement for the management of wastewater sanitation systems (convenio de gestión de los sistemas de saneamiento de aguas residuales), upon the Local Corporation’s express request. For that reason, official letter N° MA-A-1513-2024 dated 14 de marzo del 2024 was sent to Eng. Delgado Alpízar so that he could proceed as appropriate, with notice to the residents (folios 66 to 70).

However, to date, we do not know whether Eng. Delgado Alpízar formally submitted that request to AyA.

It should be noted that the Residents of Urbanización San Charbel have been promptly informed of all actions taken, as shown by the corresponding email transmission receipts (folios 01, 38, 38 front and reverse, 39 to 40 reverse, 59, 60, 65, 66, 70); this demonstrates that they have been duly informed that the entity competent to address their request is the Instituto Costarricense de Acueductos y Alcantarillados.

Attached is the original case file (expediente) compiled in connection with this application for constitutional relief (recurso de amparo), which contains 81 pages.

By official letter N° MA-PPCI-0594-2024 dated 10 de setiembre de 2024, signed by Engineer Roy Delgado Alpízar, Director of the Proceso de Planeamiento y Construcción de Infraestructura Municipal, he stated the following:

“(…) In accordance with the foregoing, I set out the following background:

Through official letter N.º MA-PPCI-0591-2023 of 13 de julio 2023, official letters N.º MA-A313-2023, N.º MA-A-1025-2023, N.º MA-A-3421-2023, and N.º MA-A-3990-2023 were addressed; all of them concern the problem reported by the residents of Urb. San Charbel, located in Rincón Chiquito, La Guácima, through proceeding N.º 4530-2023 regarding the wastewater treatment plant (planta de tratamiento de aguas residuales).

In this regard, as Engineer Francisco Alpízar stated in official letters N.º MA-Identificacion02- 2023 and N.º MASAN-062901-2023, ‘the entity responsible for supplying drinking water in the area is AyA; therefore, the Municipalidad de Alajuela cannot provide drinking-water or wastewater-treatment services because the area lies within AyA’s service area.’ This assertion is consistent with the policy that the entity responsible for providing drinking-water service in an area is the entity that must treat the wastewater generated by that community.

Likewise, through official letter N.º SG-GSP-RT-2022-00317, dated 11 de noviembre del 2022 and signed by Mr. Nombre03 of the UEN Recolección y Tratamiento Periféricos del Instituto Acueducto y Alcantarillados, the residents of Urb. San Charbel were informed of the status of the proceeding for acceptance of that residential development’s sanitation system (sistema de saneamiento), stating: ‘(…) To date, this Institute has received no formal application from the Developer to initiate the process for acceptance of the sanitation system of the San Charbel residential development.’ It further states that, pursuant to the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte Instituto Costarricense de Acueductos y Alcantarillados, agreement 2017- 066, dated 15 de febrero del 2017, in order to assume the administration, operation, and maintenance of sanitation systems, all the requirements of Article 12 must be met; and under Article 13, the requirements specified in Article 12 must be submitted to the Gerencia General del AyA by means of a written application for acceptance filed by the owner or legal representative of the sanitation system. (underlining does not appear in the original).

The land on which the Urbanización San Charbel Treatment Plant is located is a community area (área comunal) registered in the Municipality’s name; it is also encumbered by a high-voltage-line easement (servidumbre) and has an area of 1.463 m2 according to the registry, under cadastral plan (plano catastro) A-1622647-2012.

Accordingly, the Developer must undertake the necessary procedures with the Municipality and ICE to transfer the land and easement to AyA (boldface does not appear in the original).

That being the case, this Process reiterates what was stated in official letters N.º MA-Identificacion022023 and N.º MA-Identificacion032023, signed by Engineer Luis Francisco Alpízar. Furthermore, since Engineer María Auxiliadora Castro Abarca states in official letter N.º MA-SASM285-2023 that, in the matter at issue, ‘(…) the Municipality is responsible for coordinating directly with AyA to transfer the land so that AyA may administer the service,’ this Process considers it advisable to inform the Proceso de Servicios Jurídicos of this situation so that it may determine the legal procedure to be followed to transfer the community area and easement to AyA and thereby resolve the reported problem.

Through official letter N.º MA-PPCI-0353-2024, dated 5 de junio 2024, the Mayor’s Office was informed as follows: official letter N.º MA-A-1513-2024, which describes the situation of the residents of Urb. San Charbel, located in Rincón Chiquito de la Guácima, was addressed, and Engineer José Luis Chacón Ugalde, coordinator of the Acueducto Municipal, was informed so that he could proceed with the transfer of that residential development’s treatment plant to AyA.

Through official letter N.º MA-PPCI-0373-2024, dated 5 de junio 2024, the Dirección del Acueducto Municipal was informed as follows: I am forwarding document N.º MA-A-1513-2024 so that you may process it as appropriate.

Official letter N.º MA-PPCI-0373-2024 was sent to the new Dirección del Acueducto Municipal, a department that went from being a Subprocess to a Process and that now holds a Directorate-level status consistent with the nature of its work involving water, treatment plants, and other matters; it is therefore now independent of this Directorate’s decisions and ordinary duties.

Official letter N.º MA-SASM-264-2024, dated 17 de junio 2024, responds to our official letter N.º MA-PPCI-0373-2024. That letter clarifies that this Process did not participate in any way in the acceptance of the community areas of Urbanización San Charbel and that, under the institutional organizational chart, this Process cannot issue opinions on the matter and has no authority over the matter under review, which falls exclusively within the purview of the Alcaldía Municipal.

According to official letter N.º MA-PAAM-317-2024, dated 19 de julio 2024, which responds to the Alcaldía Municipal regarding official letter N.º MA-A-3538-2024 and mentions our official letter N.º MA-PPCI-0353- 2024, the following conclusions were reached:

I.As of the date this letter was isued (sic), the Subproceso de Saneamiento has not received any proceeding whatsoever concerning Urbanización San Charbel, located in the district of La Guácima, and we have not accepted the treatment plant.

II.The Municipalidad de Alajuela has no water-supply infrastructure in the district of La Guácima and therefore also has no sanitary sewerage system (alcantarillado sanitario) in that district.

III.The Instituto Costarricense de Acueduntos (sic) y Alcantarillados is the operator that provides water service in that community, and therefore that institution is responsible for providing sanitary sewerage service when technically appropriate.

IV.That, through (sic) official letter N.º MA-PPCI-0591-2023, issued by Engineer Roy Delgado Alpízar of the Dirección del Proceso de Planeamiento y Construcción de Infraestructura, it is stated that the land on which the treatment plant is located is a community area registered in the name of the Municipalidad de Alajuela.

That being the case, and since neither the Subproceso de Saneamiento nor this Process has received any proceeding whatsoever concerning Urbanización San Charbel, located in the district of La Guácima, and considering that this Municipality has no water-supply infrastructure in the district of La Guácima and also has no sanitary sewerage system in that district, the proper course is for the entity providing drinking-water supply service to treat the wastewater from this residential development.

Lastly, official letter N.° MA-PPCI-0591-2023 states that ‘the residents have been submitting documents related to this request, which I am attaching to this official letter because they have borne the expenses of keeping the treatment plant operational. However, the plant must receive proper maintenance from AyA; nevertheless, according to the statement made by Mr. Nombre03 in official letter SG-GSP-RT-2022-00317, the necessary procedures must be undertaken with the Municipality to transfer the land to AyA.’ The foregoing background demonstrates that, while this Process was responsible for the Acueducto Municipal, all matters related to the proper operation of that residential development’s treatment plant by the Instituto Costarricense de Acueductos y Alcantarillados were pursued. Now that the Acueducto department is a Process, it is responsible for directly arranging the transfer of the land to AyA through proper coordination with the relevant parties.” It is established that proceeding N° 4530-2023 was addressed by the respective departments in accordance with the law and that the residents have even been informed of all the actions undertaken at the municipal level.

It should be clarified that, as stated in the technical opinion (criterio técnico), the public areas were transferred to the Municipality; however, the Instituto Costarricense de Acueductos y Alcantarillados (AYA) has never formally accepted the wastewater treatment plant in its capacity as service operator. This is because the San Charbel residential development is located within AyA’s service area, and AyA is the entity that provides drinking-water service and therefore should also administer the sanitation service.

It must be made clear that the treatment plant occupies an area designated for community facilities (facilidades comunales). Accordingly, the actions undertaken by the Municipality should focus on transferring the property to the competent entity—AyA in this case—so that it may assume its operation and maintenance.

It is established that, under the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento, for AYA to assume management of wastewater sanitation systems by agreement (convenio), the Municipality, through the institutional attorney for the Acueducto Municipal, must request that they be transferred to the Instituto Costarricense de Acueductos y Alcantarillados and must comply with the requirements established in Article 12(I) of the aforementioned Regulations, since the Instituto Costarricense de Acueductos y Alcantarillados, as the governing entity at the national level, is responsible for assuming the administration and operation of sewerage and water-supply systems held by Municipalities upon the express request of the Local Government.

In view of the foregoing, it is established that this Municipality has not only responded promptly to the requests filed, in accordance with our authority, but it is also extremely important to mention that multiple constitutional judgments have enshrined the right established in Article 27 of the Constitución Política, which refers to every citizen’s right to address any public official or government entity in writing in order to present a matter of interest to that citizen.

That guarantee is supplemented by the right to receive a prompt response, but the latter does not mean a favorable response; in other words, what is guaranteed is the right to make a request, not the right to obtain what is requested, even though the public official must decide the matter in strict accordance with the law, because freedom of petition (libertad de petición) is based on another principle—namely, that the administration may not restrict the right of governed persons to address public bodies.

Nevertheless, the appellant (recurrente) decided to file this application for constitutional relief in order to create confusion and have this Municipality held liable for alleged ‘inaction’ by reporting a problem for which the procedure to be followed has already been explained repeatedly. Indeed, the corresponding responses and possible solutions to the reported problem were provided months ago. Nevertheless, her request was duly addressed within the scope of our authority, and she is fully aware of that fact. Even if the appellant disagrees with the processing of the matter and the responses given by the Municipality, her assertions merely demonstrate her dissatisfaction, discomfort, and even complete lack of knowledge regarding how the municipal level operates and the respective powers exercised at that level.

By virtue of the foregoing, this Municipality considers that it has acted within its authority and that there has been no inaction or violation of constitutional rights; nevertheless, we consider that the petitioner filed this amparo proceeding (Recurso de Amparo) in an attempt to undermine the information provided in the petition initiating the proceeding; however, this Municipality acts within its authority.

It has been established that the Municipalidad de Alajuela performed the duties pertaining to its authority; therefore, I request that the amparo proceeding filed be DISMISSED IN ITS ENTIRETY.”

  1. 4Roy Delgado Alpízar, Luis Francisco Alpízar Barrantes, and José Luis Chacón Ugalde report under oath, in their respective capacities as Director of Infrastructure Planning and Construction, Coordinator of the Municipal Sanitation Subprocess, and Coordinator of the Water Supply and Sanitation Process, all of the Municipalidad de Alajuela, to the same effect as the mayor of that municipality, and request that the proceeding be dismissed.
  2. 5By a ruling issued at 11:21 on 30 de setiembre de 2024, the named parties were expanded and the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados was afforded a hearing concerning the facts alleged by the petitioner and the information reported by the mayor of Alajuela.
  3. 6By a ruling issued at 11:38 on 30 de setiembre de 2024, the parties named in the proceeding were expanded and the Director of the Área Rectora de Salud de Alajuela 2 was afforded a hearing concerning the facts alleged by the petitioner.
  4. 7Juan Manuel Quesada Espinoza reports under oath, in his capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, as follows:

“Based on the evidence submitted, the background relating to the administrative actions taken by AyA for the Urbanización San Charbel is detailed below:

II. RESPONSE TO THE FACTS

FIRST: Based on report UEN-PC-2024-02546 and in accordance with the Administrative Record (Expediente Administrativo) attached as evidence, the construction plans for the Urbanización San Charbel were approved in 2006 pursuant to official letter URB-1072006, BIT-95-2006, with the sanitary sewerage network planned but not in use (as shown in images 100 and 116 of “Expediente 21 Proyecto Habitacional,” which states: “….Based on all of the foregoing, the possibility of contamination of the aquifer is remote; however, the drawback is not the possibility of contamination but rather the low infiltration capacity of the materials in one sector of the project area (AP).

In view of the foregoing, the designer proposes using anaerobic filter tanks in the northern sector of the property, connected to the sewerage pipeline, and a drainage trench in the lower portion of the AP, or southern sector…”) The foregoing meant that wastewater (aguas residuales) had to be disposed of through an individual septic-tank system and its corresponding drainage system, and the institution responsible for granting this approval was the Ministerio de Salud.

Image 106 of Expediente 21 Proyecto Habitacional (Treatment Plant No.) contains availability determination CCO-OM-2005-168, dated 7 de diciembre 2005, which stated that no sanitary sewerage network operated by AyA was available in the area.

Subsequently, a treatment plant (planta de tratamiento) was submitted for approval in 2022 because the housing development proposed discontinuing the use of septic tanks and instead disposing of all wastewater through a Treatment Plant, which AyA rejected pursuant to decision PTRAR-AyA-2022-115 dated 17 de agosto de 2022.

Because a decision rejecting it had been issued, it was not feasible to grant construction permits (permisos constructivos) for that plant, much less to place it into operation by disconnecting the housing units from the septic tank and using the planned network connected to a Treatment Plant.

Image 2 of the Digital Record (Expediente Digital) (Expediente PTAR 4), which is attached as evidence, contains decision PTRAR-AyA-2022-115, setting forth all the deficiencies that had to be corrected before construction could be authorized and proper operation guaranteed:

“…Operation and maintenance manual: It must include equipment for measuring pH, temperature, and settleable solids and, in the case of aerobic domestic-wastewater treatment systems, a dissolved-oxygen meter.

The operation and maintenance manual for the treatment plant and final disposal of the effluent must include a description of the basic equipment used for routine measurements of the water’s physicochemical parameters. It must also identify the basic maintenance equipment required for the type of wastewater treatment, including cleaning equipment.

Design calculations (memoria de cálculo): They must include the technical specifications of all electromechanical equipment and diffusers so that their characteristics and selection criteria can be verified.

Design criteria: This section must be detailed so that it shows not only intermediate and final results but also matters such as the assumptions used for each stage, the sequence of calculations, formulas, application of the formulas, references to the information sources supporting the criteria used, and a clear indication of the safety factors applied.

In the case of residential developments (urbanizaciones) and subdivisions (fraccionamientos), fencing must be installed around the entire perimeter of the land where the wastewater treatment plant (PTAR) will be located. In this case, it must include setbacks (retiros), since they are measured from property boundaries.

A two-meter-high wire fence or wall must be installed along the property boundary as a safety measure to prevent unauthorized persons from entering, and its access gate must allow a truck to enter. A device or accessory designed to deter vandalism must be installed along the top of the wire fence or wall.

The access roads to the treatment plant must have pavement structures and complementary roadworks in accordance with the current Manual de Especificaciones Generales para la Construcción de Carreteras, Caminos y Puentes (CR-2010), issued by MOPT. The road’s design and topographic profile must guarantee access by any type of vehicle used to transport persons or goods, regardless of its load.

If the treatment system uses electromechanical equipment on a daily basis, the electrical design must include an emergency power supply. The plant plan must show the direction of water flow in the receiving water body (cuerpo receptor). Treated wastewater must be discharged into a body of water (stream or river) in the direction of its flow, at an angle of no more than 45°.

The plan sheets must show details of the structures for measuring flow at the inlet and outlet of the wastewater treatment plant, the discharge outlet, the inspection chamber for collecting samples at the wastewater treatment plant outlet, the grit-retention structure, manholes, valve boxes, screen structures (at least two sets, for coarse solids and finer solids), potable-water systems, stormwater and sanitary sewerage systems, and all other supplementary works for the treatment system.

The contour lines of the land on which the wastewater treatment system is located and the alignments and setbacks established by the institutions must be shown. The setback from the northeast corner of the treatment system’s main units to the boundaries of the respective property (vertex 1 of the cadastral plan (plano catastro)), at the corner of the public street, must be dimensioned.

The design must include an outdoor lighting system that is distributed evenly and has the intensity required to illuminate from the plant toward the entire perimeter of the property containing it, providing general illumination of at least 100 lux. The lighting system as a whole must provide greater visual acuity through localized illumination of at least 300 lux in the various areas where processes requiring nighttime activities are carried out. The lighting system must be designed in consideration of the particular features of all processes and activities defined in the operation, maintenance, and control manual. In addition, national energy-efficiency regulations must be observed.

The design must include wastewater sampling chambers at the treatment plant outlet for each treatment module or treatment train and at the point where the effluents from each of them converge. This must be taken into account when there are two or more treatment trains.

The flow-measurement chamber or device must be free from interference by other water flows present at the treatment plant. If a triangular weir is used, its angle must be calculated according to the system’s flow rate.

The screen chamber must include at least two sets of screens inclined between 45° and 60°: one for coarse solids and another for finer solids, both with a tray for dewatering solids.

The design must include at least two modules for conditioning and dewatering sewage sludge (lodos residuales), capable of meeting the capacity required under the design parameters either jointly or in a complementary manner.

Metal components incorporated into the treatment plant must be manufactured from corrosion-resistant materials. When paint must be applied to such components, two coats of epoxy paint must be used. The plans must state the codes of the manufacturing standards specifying the corrosion-resistant characteristics of the metal materials and the paint’s epoxy composition.

Every elevated or partially buried uncovered tank must include walkways at least one meter wide, with side railings around each tank and over the lagoon systems. This must be taken into account when the upper cover is removed.

When additional information is added to the plan sheets in correcting the deficiencies, the design calculations and the operation and maintenance manual must be updated in all applicable sections.

A stormwater-management system must be submitted, extending to the connection with the overall project’s stormwater system or stormwater outfall.

The necessary provisions must be included to allow maintenance or rehabilitation without taking the entire treatment plant out of operation.

The plant design must incorporate at least two water-supply fixtures: one located near the screen chamber and the other at the end opposite the plant’s entrance area, in order to facilitate the cleaning of the structures.

The grit chamber (desarenador) must include at least two chambers to facilitate maintenance and cleaning of the structure. It must be included in the design calculations, manual, and plan sheets in all applicable views.

An internal and external lighting system for the buildings must be submitted.

The plant’s internal piping system, excluding buried piping (tubería enterrada), must comply with the current “Official Standard for the Use of Safety Colors and Their Symbols” issued by MEIC (Decreto N" 12715). Application of the provisions established in standard INTE 31-07-03, “Color Code for the Identification of Piping Systems in Accordance with the Provisions of the MEIC Standard,” is accepted. The direction of flow must be indicated on the piping, which must also comply with the content-labeling requirements established in its technical manufacturing standards. This must be indicated by means of a note on the drawings.

The plant must have sedimentation-tank bottom hoppers with a minimum slope of 45 degrees; designs that include sludge-sweeping mechanisms are acceptable.

Any cover over the treatment units of aerobic systems, particularly in subdivision-development and residential-complex projects, must be fully removable and must include lifting devices or systems when it cannot be handled by one person; the foregoing is intended to permit maintenance and operational activities.

The machine room must contain the electromechanical equipment, control panels, and electrical switchboards. The electromechanical equipment must not be located inside the operator’s and security guard’s booth.

A shower and an area for storing documentation and equipment must be provided in the operator’s booth. Additionally, the plant must have two other rooms: one for the security guard (when this is not required, justification must be provided) and a storage room. Wastewater (aguas residuales) from the booth must discharge into the treatment plant inlet.

The primary and secondary treatment units must include, at a minimum, two modules operating in parallel that, complementarily or jointly, provide the capacity required by the design.

The machine room must comply with appropriate construction methods and materials to ensure proper protection of the equipment, in accordance with the applicable current standards, and must also be provided with adequate ventilation to prevent the equipment from overheating.

Notes:

This act does not include AyA’s review or approval of the wastewater collection system, nor final approval of the design of the effluent outfall pipeline for effluent disposal, because these are included in the processing of the overall project…” (emphasis not in the original) Within this same case file, this Institute has only the Ministry of Health’s authorization for the Treatment Plant siting permit, in image 36, official letter ARSA-2-308-08 dated March 11, 2008, which, pursuant to Decreto 31545-S-MINAE (Regulation for the Approval and Operation of Wastewater Treatment Systems, subsequently repealed by Article 33 of the Regulation for the Approval of Wastewater Treatment Systems, approved through Decreto Ejecutivo N° 39887 dated April 18, 2016), grants approval of the permit under Article 8 thereof.

The cited Article 8 stated:

“…Article 8—The Siting Permit must be requested from the Ministry of Health by means of a written request accompanied by the following information:

a. Name of the overall project.

b. Name of the owner.

c. Location by province, canton, and district, attaching an updated, full-size copy of the cadastral plan.

d. Exact address of the property.

e. Brief explanation of the overall project (residential, tourism, commercial, agricultural, industrial, or other) that will require the treatment system.

f. Brief description of the type, processes, and equipment of the proposed treatment system.

g. Proposed final disposal method for the treated wastewater, duly justified pursuant to Article 9 of this Regulation. If the selected disposal method is discharge into an aquatic receiving body, it must have a permanent flow, as certified by the competent authority.

h. Site plan (Plano de Conjunto) of the overall project within which the treatment system will be located, including at least the following information:

i. Proposed location of the area designated for the treatment system, indicating its preliminary dimensions.

  • ii)Dimensions of the setbacks (retiros) to be maintained between the treatment system and the boundaries of the property on which it will be located (see Table 1).
  • iii)Dimensions of the setbacks to be maintained between the treatment system and existing or proposed buildings on the same property, as identified on the site plan.
  • iv)Proposed location of the discharge headwall or sewer connection, if any.
  • v)Direction of flow of bodies of water crossing or bordering the property.
  • vi)Location of existing or proposed water-supply wells on the same property as the overall project.
  • vii)Location of existing water-supply wells on properties adjoining the overall project, within a radius of 100 meters of the treatment plant.” It should be noted that the standard does not provide for approval by the Ministry of Health at the construction, design, or operational level, but only for the siting of the Plant. Consistently with this, Article 7 of the regulation then in force provided:

“Article 7—This chapter governs the scope of the Siting Permit for Wastewater Treatment Systems. This is an initial requirement that does not create an obligation to grant other permits, nor does it replace requirements imposed by other government agencies.” In light of the foregoing, AyA’s approval of the proposal to construct the Treatment Plant was required; consequently, the Local Government should not have permitted its construction and commencement of operations.

SECOND: Likewise, official letter SG-GSP-RT-2024-00160, which attaches the Technical Opinion issued by the Central Western Region and the Peripheral Systems Collection and Treatment UEN through official letter SG-GSP-RT-2024-00159, determines the following:

“…Although, according to AyA’s Subdivision Developments case file, this project dates from 2006 and was approved with a sanitary sewer system discharging into two shared septic tanks, the developer subsequently constructed a wastewater treatment plant. According to the Programming and Control UEN, the San Charbel Treatment Plant project was submitted for its first review through the APC Platform under CFIA code 1046194. This first review, which resulted in rejection, is recorded in document PTAR-AyA-2022-155, dated August 17, 2022. Despite this notice and the project’s rejection for failure to comply with the established requirements, the comments made during the initial review have not been addressed to date.

The current regulation establishes a maximum period of 14 months for the professional responsible for the project to submit the corrected plans and address the comments made. That period has expired without the project professional submitting the required documents. Therefore, to proceed with the project, the interested party must comply with the plan restamping requirements and restart the review process in accordance with the current documentary and regulatory requirements, as provided in Article 6 of Decreto Ejecutivo N° 43318 dated October 29, 2021.

2. Failure to Comply with Regulatory Requirements:

The sanitation system (sistema de saneamiento) proposed for the plant does not have the required approval from AyA. The plans submitted during the first review indicate discharge into the Doña Ana stream and the use of extended-aeration activated-sludge technology. However, these plans are invalid because they have not yet received regulatory approval from AyA and do not meet the requirements of the regulations currently in force in Costa Rica.

It must be noted that, under the applicable regulations, all sanitation-system projects must obtain technical and regulatory approval before implementation. This includes obtaining the relevant approvals for the wastewater treatment and disposal system, as well as regularizing title to the land where the treatment plant is located. To date, we have not received a request from the Municipalidad de Alajuela for transfer of the land, preventing compliance with the legal requirements for formalizing the project before AyA.

3. Ownership and Legal Status: According to the documents submitted during the initial review, title to the land where the treatment plant is located is registered to Versachi de Centroamérica S.A., corporate identification number 3-101-198276. The treatment plant is currently located on property belonging to the Municipalidad de Alajuela, which that local government received from the site’s developer at the relevant time. Nevertheless, for AyA to approve and formally take possession of the project, the legal status of the land must be clarified and the requirements established in the Regulation for Approval and Acceptance of Sanitation Systems by the Instituto Costarricense de Acueductos y Alcantarillados, Acuerdo N°2022-354, must be met.

It is important to indicate that the Municipalidad de Alajuela is aware of the process required to transfer the PTAR to AyA, pursuant to official letter MA-PSJ182-2024 dated January 30, 2024, issued by the Legal Services Department of the Municipalidad de Alajuela.

Conclusions

1. To date, PTAR San Charbel does not have permits approved by Subdivision Developments – AyA Programming and Control UEN.

2. Under current conditions, operation and maintenance are the responsibility of the Municipalidad de Alajuela.

3. The drinking-water service operator is AyA.

4. AyA has not received a request from the Municipalidad de Alajuela for transfer of the PTAR.

5. The Municipalidad de Alajuela must bring the PTAR into compliance with the requirements established in the Approval Regulation SUBSTANTIVE CONSIDERATIONS It is important to indicate that Costa Rica has two separate sewer systems: one known as the “Storm Sewer System” (Sistema de Alcantarillado Pluvial), whose purpose is to convey rainwater from residential roofs, gutters, and downspouts, as well as rainwater flowing along public roads; and another known as the “Sanitary Sewer System” (Sistema de Alcantarillado Sanitario), whose purpose is to convey only the wastewater generated inside homes from washbasins, sinks, showers, and toilets.

Under the current regulations, storm sewer systems are administered by the municipality of each canton, while the sanitary sewer system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic service area. Pursuant to the Código Municipal and the Ley General de Salud, Municipalities have authority to accept and administer Treatment Plant sanitation systems.

For their part, Local Governments have the authority to establish a series of restrictions on construction and projects through urban planning (planificación urbana); it should be emphasized that, if the conditions they impose are not met, they have a series of coercive mechanisms to enforce their directives, which AyA lacks. In addition, it is clear that the Municipalities are the entities that collect the corresponding amounts for the maintenance and proper functioning of the stormwater drainage system (red pluvial), as provided by Código Municipal No. 7794, in Title IV. Municipal Treasury, Chapter II. Municipal Revenue.

In the present case, it cannot be overlooked that, when Municipalities collect municipal taxes, they include the item corresponding to the maintenance and operation of the stormwater drainage system, which underscores municipal jurisdiction in this field. Furthermore, it is evident that this item should be used for the maintenance and operation of each Municipality’s stormwater drainage system, as stated by the Sala Constitucional in Voto 2001-2320, in Considerando IV, which reads verbatim:

“IV.- Accordingly, based on the provisions of the aforementioned Law and those concerning municipal subject-matter jurisdiction, this Constitutional Court considers that the entity that should have addressed the complaint filed by the petitioner for constitutional relief (amparado) in protection of the right to health was the Municipalidad de Alajuelita, not only because the matter at issue falls within the so-called ‘local interest’ of its canton, but also because, according to Acueductos y Alcantarillados, that municipal government is responsible for administering the storm sewer system (alcantarillado pluvial) where the failure is located. As to the actions of the respondent Institute, the Chamber does not consider it to bear any responsibility for the violation of Mr. Nombre02’s fundamental rights because, although it is true that, as the autonomous governing entity in this field, it has the duty to resolve problems arising in connection with the supply of drinking water, and the collection and disposal of sewage and stormwater in urban areas, it is also true that this is primarily the duty of the municipalities when, as in the present case, they are responsible for administering the canton’s water-supply and sewerage systems; or when, as is also the case here, the problem to be resolved involves the protection of fundamental rights and the remedy does not require specialized or technical knowledge that only a particular entity can provide. For that reason, the petition must be granted on account of the violation of the right to health committed by the Municipalidad de Alajuelita to the detriment of the petitioner.

Likewise, Ley General de Salud No. 5395, specifically regarding the matter before us, provides as follows in Articles 285 and 292:

“ARTICLE 292.- The discharge of sewage, wastewater, and industrial waste into the storm sewer system is prohibited in all cases. The Ministry is authorized to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through excreta, sewage, and wastewater collection systems.

ARTICLE 285.- Excreta, sewage, wastewater, and stormwater shall be disposed of properly and under sanitary conditions so as to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution through conditions that compromise its purity or quality.” In the same vein, Article 1 of Ley de Construcciones N° 833 provides as follows:

“The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, healthfulness, convenience, and beauty in their public thoroughfares and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law in these matters to other administrative bodies.” The foregoing demonstrates the connection between municipal obligations concerning storm sewer systems and the obligation stated above, which are interrelated and fall under the administration of Local Governments as part of the services they are required to provide.

Article 60 of Ley Orgánica del Ambiente, in turn, establishes the following regarding the prevention and control of pollution:

“To prevent and control environmental pollution, the State, the municipalities, and other public institutions shall give priority, among other matters, to the establishment and operation of adequate services in areas fundamental to environmental health, such as:

  • a)The supply of water for human consumption.
  • b)The sanitary disposal of excreta, wastewater, and stormwater.
  • c)The collection and management of waste.
  • d)The control of air pollution.
  • e)The control of sonic pollution.
  • f)The control of chemical and radioactive substances.

These services shall be provided in the manner prescribed by the specific laws and regulations, while seeking the participation of the population and its organizations.” Based on the cited provisions, it is concluded that the Municipalidad de Alajuela is directly responsible for determining the measures required to resolve the problem concerning the administration of the wastewater treatment plant (Planta de Tratamiento de aguas residuales). The Municipality itself previously approved the urban development in that area and, if it decides to transfer administration to AyA, it must comply with Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 of the AyA Board of Directors, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022. This is without prejudice to its coordinating with the entities capable of taking action to ensure that the sewerage system is adequate and likewise ensuring that the owners make proper use of the system, since it accepted under its administration the components and land on which the treatment plant is located.

In this regard, the Municipalidad de Alajuela has the obligation to enforce the laws governing land-use planning (ordenamiento territorial) and to guarantee the inhabitants of the area the enjoyment of a healthy and ecologically balanced environment, given the consequences for their health arising from the nature of the sanitation problem affecting them. Although fully aware of the problem affecting the inhabitants of its canton, the Municipality has confined itself to confirming its existence and evading its responsibility, without taking timely action to mitigate or control it or complying with the requirements set forth in Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 of the AyA Board of Directors, published in ALCANCE No. 171 to GACETA No. 151 of miércoles 10 de agosto del 2022, so that AyA may formally accept the system after the requirements established by the regulations have been fulfilled.

Likewise, consideration must be given to the assessment already made by the Procuraduría General de la República in C-257-2003 San José, 27 de agosto de 2003 (consistent with the substantive assessment conducted by the Sala Constitucional in Expediente 16002436-0007-CO, decision 2016-006368) regarding the requirement that AyA and the Ministerio de Salud verify the technical suitability (idoneidad técnica) of sewage treatment plants. Once the Municipality has given its acceptance, the requirements established by this Institute must be fulfilled before the transfer may proceed, so as to authorize the transfer to the Instituto Costarricense de Acueductos y Alcantarillados of the corresponding portion of the public-use area where the plant is located, thereby enabling the Institute to administer and operate it. In this regard, the aforementioned Opinion states:

“…The Instituto Costarricense de Acueductos y Alcantarillados is the entity that determines, based on the transcribed provision, when urban developments must have sewage treatment plants. In this matter, the municipalities are responsible for ensuring that urban development projects to be carried out in their cantons comply with the standards prescribed by AyA concerning water-supply and sewer systems, including the provision of sewage treatment plants when AyA has so ordered.

Once the works have been constructed, and at the time they are accepted, the municipalities exercise oversight concerning compliance with the applicable regulatory provisions, including those governing the drinking-water facilities and sewage collection and disposal facilities required by the Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities, all in accordance with Article VI.6. of Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, which provides:

“VI.6. Acceptance of works:

The works and public areas shall be accepted in accordance with the regulations in force in the municipality of the canton and the other public bodies that perform oversight functions in that regard. No omission of details from the approved plans shall release the developer and the responsible professional from their obligations concerning the complete and satisfactory delivery of the works, pursuant to the provisions of these regulations.

The developer and the responsible professional who sign the application for approval (visado) of the construction plans guarantee the works’ strict conformity with the applicable regulatory requirements, as provided in the applicable laws.” In other words, although the municipalities do not operate or maintain sewage collection and disposal systems, they ensure that urban developments and the buildings constructed within them comply with the provisions established by the Instituto Costarricense de Acueductos y Alcantarillados and other competent public entities concerning such systems, thereby fulfilling their role of protecting health and the environment within their cantons (…)

(…) although Section 40 of Ley de Planificación Urbana provides that municipalities may authorize the indicated transfer, the fact remains that, unless a municipality is exercising the residual authority discussed above and, consequently, directly administering and operating the respective drinking-water and sewage collection and disposal system, it is required to authorize that conveyance in favor of the competent entity—which, as we have already stated and will conclude below, is the Instituto Costarricense de Acueductos y Alcantarillados—so that the latter may administer and operate the system once it has been verified, at the time the builder, whether a public-law or private-law entity, delivers the works, that the technical provisions established in the regulations and prescribed by AyA itself and the Ministerio de Salud have been met, as already explained.

That is, once AyA and the Ministerio de Salud have verified the technical suitability of the sewage treatment plants, the municipality must accept the works and authorize the transfer to the Instituto Costarricense de Acueductos y Alcantarillados of the corresponding portion of the public-use area where the plant is located, pursuant to the provisions that confer upon that Institute authority to administer and operate drinking-water systems and sewage and wastewater collection and disposal systems, which have already been cited, unless the case is one in which the municipality concerned will operate and administer the system in the exercise of the residual authority already referenced….” It should be noted that this Constitutional Chamber has previously ruled (Exp: 11-010057-0007-CO Res. Nº 2012017743 at nine thirty on catorce de diciembre de dos mil doce) that this Institute assumes responsibility once compliance with the acceptance requirements has been verified and that, until those requirements are met, the Municipality must continue to assume its responsibility:

“…Among the prerequisites that the Municipality must observe are the provisions of Article 21 of the Constitutive Law of the Instituto de Acueductos y Alcantarillados, Ley 2726 of 14 de abril de 1971, which grants ICAA authority to approve ‘Any project involving the construction, expansion, or modification of public or private drinking-water supply and sanitary and stormwater sewerage systems (…) Such prior approval shall be mandatory in all cases involving the construction of subdivisions (fraccionamientos), urban developments (urbanizaciones), or lot divisions (lotificaciones) anywhere in the country, and no other State agency shall issue construction permits or approvals without such approval by the Institute. Violation of this mandate shall render null and void any construction permit issued in contravention of this prohibition (…)’; therefore, no public entity, including municipalities, may issue construction permits unless ICAA has first accepted as satisfactory the water-supply and sanitary-sewer infrastructure works, in accordance with the approved plans and after compliance with all technical specifications required of developers by ICAA under the legislation and regulations in force…

The fact that the permits were issued even though ICAA has not accepted as satisfactory the treatment-plant works and the developer has not even complied with all the technical specifications indicated in various memoranda by ICAA’s internal bodies as a prerequisite for approval of the project plans can be explained only by the failure of other institutions, including INVU and the Municipality, to comply with or observe the existing legal provisions. Likewise, the fact that permits were issued for the construction of homes with septic tanks and individual drainage systems, thereby endangering groundwater, even though the Project is located in an environmentally sensitive area and INVU indicated from the outset that a sanitary-sewer system was required, can be explained only by the Municipality’s failure to comply with the legal and technical regulations in force. Accordingly, the Chamber grants the writ of amparo (recurso de amparo) with respect to the Municipalidad de San Isidro and orders as follows: Suspend the issuance of construction permits in the Lomas Verdes del Zurquí and Lomas del Zurquí Projects until ICAA has accepted as satisfactory from the developer the water-supply and sanitary-sewer works…” RELIEF REQUESTED The Constitutional Chamber should take into account the actions carried out by the Instituto Costarricense de Acueductos y Alcantarillados in fulfillment of its purposes and within the scope of its authority; it has therefore clearly not disobeyed or violated constitutional or environmental rules, guarantees, or principles, and the petition filed against AyA must accordingly be denied in its entirety.”

  1. 8Ronald Enrique Mora Solano, in his capacity as director of the Área Rectora de Salud Alajuela 2, states under oath as follows:

“In response to the hearing granted in expediente 24-021588-0007-CO, as required by the ruling issued at eleven thirty-eight on treinta de setiembre de dos mil veinticuatro by the Constitutional Chamber of the Supreme Court of Justice, Ms. Nombre05, Environmental Manager and official of the Área Rectora de Salud Alajuela 2, appeared at the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) of Urbanización San Charbel, whereupon visual inspection report N° MS-DRRSCN-DARSA2-3084-2024 and the technical report contained in official letter MS-DRRSCN-DARSA2-3164-2024 were issued.

On the day of the visit, Ms. Nombre04, a resident of the area, received Ms. Nombre05. The actions carried out are set forth below:

1. On 22 de noviembre del 2024, as recorded in visual inspection report N° MS-DRRSCNDARSA2-3084-2024, at 11:50 am, a visit was conducted at the wastewater treatment plant (PTAR) of Urbanización San Charbel, where Ms. Nombre04, a resident of the area, attended to the inspection.

2. Ms. Nombre03 stated that the plant had stopped operating approximately 04 months earlier due to a lack of maintenance. However, the residents were carrying out the work necessary to restore its operation. She further stated that the residents could not continue maintaining the plant because of the cost and therefore requested that its owner, in this case the Municipalidad de Alajuela, assume responsibility for the plant’s daily maintenance.

3. Subsequently, accompanied by Ms. Nombre03, we proceeded to the wastewater treatment plant (PTAR) facilities to assess the facts alleged by the amparo petitioner (amparista).

An assessment was made of the facts alleged by the petitioner, as detailed in the following table:

Ms. Nombre03 provided the following information:

• The electric pump was undergoing maintenance.

• The filter must be replaced, and the belts must be serviced.

• The breaker box was replaced because it had been damaged.

To resume operation of the plant, the outstanding changes must be made, and the cost of a wastewater tanker truck must be covered so that it can handle the treatment of the wastewater accumulated to date.

4. Based on the inspection visit conducted, it was concluded that the Wastewater Treatment Plant was not operating and therefore posed a risk to public health and the environment. For this reason, the following was requested of the Municipalidad de Alajuela through sanitary order (orden sanitaria) MS-DRRSCN-DARSA2-OS-271-2024:

“In view of the foregoing, until the corresponding transfer to AyA is completed pursuant to the legislation in force, responsibility for maintaining the sanitation system rests with the owner of the treatment system. The Municipalidad de Alajuela is therefore requested to:

1. Restore the operation and maintenance of the wastewater treatment plant of Urbanización San Charbel. Submit evidence of the actions taken to the Área Rectora de Salud Alajuela 2.

2. The wastewater treatment system must be operated in compliance with the technical regulations in force by submitting Operating Reports (Reportes Operacionales) and ensuring on-site compliance with the requirements of regulation Nº 33601.” 5. Sanitary order MS-DRRSCN-DARSA2-OS-271-2024 was duly served by email dated 25 de noviembre del 2024, and 10 business days were granted for compliance.

This Directorate remains awaiting compliance, within the period granted, with the requirements set forth in the aforementioned sanitary order MS-DRRSCN-DARSA2-OS-271-2024.

In view of the foregoing, this office respectfully informs this Honorable Constitutional Chamber that the Ministerio de Salud has acted diligently, in accordance with the legal system in force and within the scope of its authority, by processing the matter in a timely manner and pursuant to the corresponding internal administrative procedure. The required actions have therefore been taken in a timely manner, and we have neither exceeded reasonable time limits nor incurred excessive and unjustified delay.”

  1. 9In the ruling issued at 11:32 on 11 de diciembre de 2024, additional evidence was requested to enable a better determination of the matter.
  2. 10Ronald Enrique Mora Solano, in his capacity as director of the Área Rectora de Salud Alajuela 2, states under oath as follows:

“The Área Rectora de Salud Alajuela 2 issued Sanitary Order MS-DRRSCN-DARSA2-OS-0271-2024, served on 25 de noviembre del 2024 upon Mr. Roberto Thompson Chacón, mayor of the Municipalidad de Alajuela, requesting the following within 10 business days: ‘1. Restore the operation and maintenance of the wastewater treatment plant of Urbanización San Charbel. 2. The wastewater treatment system must be operated in compliance with the technical regulations in force by submitting Operating Reports and ensuring on-site compliance with the requirements of regulation No.33601.’ On 12 de diciembre del 2024, the Municipalidad de Alajuela notified the Área Rectora de Salud Alajuela 2 of the ‘Motion for Reconsideration with Subsidiary Appeal and Incidental Plea of Nullity (Recurso de Revocatoria con Apelación en subsidio e incidente de nulidad) filed by the Municipalidad de Alajuela against sanitary order N°MS-DRRSCN-DARSA2-OS-0271-2024, issued by the Ministerio de Salud.’ On 13 de diciembre del 2024, that information was forwarded to the Departamento de Asuntos Jurídicos of the Dirección Regional de Rectoría de la Salud Central Norte for a determination.

This Área Rectora Directorate has found no evidence of actions by the Municipalidad de Alajuela demonstrating compliance with sanitary order MS-DRRSCN-DARSA2-OS-0271-2024.

Regarding this matter, it is critically important to inform this Honorable Chamber that the appeals phase does not stay enforcement of the administrative act. This is established in Article 61 of the Organic Law of the Ministerio de Salud, No. 5412, which provides:

‘Article 61.- The filing of appeals shall not stay enforcement of the required act unless, in exceptional cases and by a reasoned interlocutory decision, the Minister orders a provisional stay of the act to prevent an irreparable outcome, in which case the Minister shall do so under the Minister’s own responsibility.’ (…) On 20 de diciembre del 2024, Ms. Nombre04, a resident of Urbanización San Charbel, informed this Área Rectora de Salud by email that the treatment plant was operating again. This work had been paid for from the residents’ funds, and they also submitted documentation supporting the actions taken.

On 06 de enero del 2025, as recorded in visual inspection report N° MS-DRRSCN-DARSA20001-2025, at 10:30 am, a visit was conducted at the wastewater treatment plant (PTAR) of Urbanización San Charbel. Ms. Nombre04, a resident of the area, attended to the visit, and the PTAR facilities were inspected to assess the facts alleged by the petitioner.

1. Regarding the assessment requested by the Constitutional Chamber, the following table is presented:

Aspect to be assessed Condition found Wastewater Treatment Plant It was observed that the plant was operating. The residents of Urbanización San Charbel hired a company to maintain and operate the Treatment Plant.

Ms. Nombre03 provided us with the following information from a report supplied to her by the company hired:

• The electric pump was serviced and reinstalled.

• The discharge hose was replaced with larger-diameter piping.

• The blower’s drive belts were replaced. The “old” belts were still in acceptable condition and were therefore stored for use in the event of a future failure. The blower oil was changed. 2 gallons of oil remain for future oil changes.

• A waterproof electrical junction box was installed.

• The filter was serviced.

• A valve was installed at the sludge discharge outlet of the drying bed.

• The timer was replaced.

• The sludge digester (digestor de lodos), with a capacity of 1.65 m3, was cleaned / The secondary settling digester (digestor sedimentador secundario), with a capacity of 15.7 m3.

Based on the foregoing, it is concluded that the residents of Urbanización San Charbel resumed operation of the Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales).

According to the foregoing, with respect to the provisions of sanitary order (orden sanitaria) N°MS-DRRSCN-DARSA2-OS-02712024, cited above and addressed to the Municipalidad de Alajuela, there is no evidence that it has taken any action in response to the orders issued by this health authority. It should be recalled that, pursuant to Article 61 of the Ley Orgánica del Ministerio de Salud, No. 5412, the filing of appeals suspends the enforcement of the administrative act embodied in the sanitary order at issue.”

  1. 11The statutory requirements have been observed in the proceedings conducted.

Justice Castillo Víquez drafts the opinion; and,

Whereas:

I.Subject matter of the proceeding. The petitioner alleges that she is a resident of Urbanización San Charbel, located in La Guácima de Alajuela, and that the community’s treatment plant is located on municipal land and is not being maintained. She states that this caused it to cease operating and created a serious environmental and health problem, for which reason the Ministerio de Salud issued a sanitary order. She indicates that the described problem was reported to the respondent local government through filing No. 4530-2023; however, as of the date on which she filed this amparo proceeding (recurso de amparo), the problem persisted. She therefore considers that her fundamental rights and those of the community’s residents have been violated.

II.Proven facts. The following facts, which are relevant to the decision in this matter, are deemed duly established, either because they have been proven or because the respondent failed to address them as directed in the initial order:

  • a)On January 16, 2023, the Alcaldía de Alajuela received Filing No. 4530-2023, submitted by the Vecinos de Urbanización San Charbel, located in Rincón Chiquito, La Guácima, in which they described the situation affecting them in relation to the wastewater treatment plant (planta de tratamiento de aguas residuales) (see the report of the respondent alcalde de Alajuela, added to the digital case file).
  • b)The land on which the Planta de Tratamiento de Urbanización San Charbel is located is a community area (área comunal) registered in the name of the Municipalidad de Alajuela (see the report of the respondent alcalde de Alajuela, added to the digital case file).
  • c)The Alcaldía de Alajuela requested opinions from various municipal departments, and it was concluded that the treatment plant should be transferred to the Instituto Costarricense de Acueductos y Alcantarillado, but the corresponding application has not been submitted to that institution (see the report of the respondent alcalde de Alajuela, added to the digital case file).
  • d)The Municipalidad de Alajuela is responsible for determining the measures required to resolve the problem concerning the administration of the wastewater treatment plant. It was also the entity that originally approved the urban development in that area, and, if it decides to transfer administration to the Instituto Costarricense de Acueductos y Alcantarillados, it must comply with the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 on Wednesday, August 10, 2022 (see the report of the respondent presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillado, added to the digital case file).
  • e)On November 22, 2024, the Área Rectora de Salud de Alajuela 2 inspected the wastewater treatment plant at Urbanización San Charbel and concluded that it was not operating and posed a risk to public health and the environment. Accordingly, sanitary order No. MS-DRRSCN-DARSA2-OS-271-2024 was issued, ordering the Municipalidad de Alajuela to do the following: “1. Resume the operation and maintenance of the wastewater treatment plant at Urbanización San Charbel. Submit evidence of the actions taken to the Área Rectora de Salud Alajuela 2. 2. The wastewater treatment system must be operated in compliance with the technical regulations currently in force, through the submission of Operational Reports (Reportes Operacionales) and on-site compliance with the requirements of regulation Nº 33601” (see the report of the respondent director del Área Rectora de Salud Alajuela 2, added to the digital case file).
  • f)On November 25, 2024, sanitary order No. MS-DRRSCN-DARSA2-OS-271-2024 was served on the Municipalidad de Alajuela, which was granted ten business days to comply with it (see the report of the respondent director del Área Rectora de Salud Alajuela 2, added to the digital case file).
  • g)On December 20, 2024, the treatment plant was placed into operation by the community’s residents (see the report of the respondent director del Área Rectora de Salud Alajuela 2, added to the digital case file).

IV.The fundamental right to a healthy and ecologically balanced environment. On repeated occasions, this Court has elaborated upon the substance of this right, enshrined in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disrupt its balance and prevent individuals from developing and functioning in a healthy environment. The State serves as the guarantor of the protection and safeguarding of the environment and natural resources. In this regard, the oversight and supervision of environmental matters and activities constitute an essential function of the State. Consequently, in matters of environmental protection, the functions of governance, oversight, and supervision of environmental matters fall to the State through its various administrative agencies.

V.The specific case. In this matter, the petitioner alleges that she is a resident of Urbanización San Charbel, located in La Guácima de Alajuela, and that the community’s treatment plant is located on municipal land and is not being maintained. She states that this caused it to cease operating and created a serious environmental and health problem, for which reason the Ministerio de Salud issued a sanitary order. She indicates that the described problem was reported to the respondent local government through filing No. 4530-2023; however, as of the date on which she filed the amparo proceeding, the problem persisted. She therefore considers that her fundamental rights and those of the community’s residents have been violated.

In this regard, after analyzing the evidence submitted and the sworn reports provided by the respondent authorities, which were duly warned of the consequences established in Article 44 of the Ley de la Jurisdicción Constitucional, it has been established that the Municipalidad de Alajuela has been aware of the problem involving the wastewater treatment plant alleged by the petitioner since January 16, 2023, through filing No. 4530-2023 submitted by the Vecinos de Urbanización San Charbel. It has also been established that the land on which the Planta de Tratamiento de Urbanización San Charbel is located is a community area registered in the name of the Municipalidad de Alajuela. The respondent municipal authorities explain that the Alcaldía requested opinions from various municipal departments and that it was concluded that the treatment plant should be transferred to the Instituto Costarricense de Acueductos y Alcantarillado, but the corresponding application has not been submitted to that institution.

For his part, the presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillado reports that the Municipalidad de Alajuela is responsible for determining the measures required to resolve the problem concerning the administration of the wastewater treatment plant. It was also the entity that originally approved the urban development in that area, and, if it decides to transfer administration to the Instituto Costarricense de Acueductos y Alcantarillados, it must comply with the Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, published in ALCANCE No. 171 to GACETA No. 151 on Wednesday, August 10, 2022.

It has also been established that, on November 22, 2024, the Área Rectora de Salud de Alajuela 2 inspected the wastewater treatment plant at Urbanización San Charbel and concluded that it was not operating and posed a risk to public health and the environment. Accordingly, sanitary order No. MS-DRRSCN-DARSA2-OS-271-2024 was issued, ordering the Municipalidad de Alajuela to do the following: “1. Resume the operation and maintenance of the wastewater treatment plant at Urbanización San Charbel. Submit evidence of the actions taken to the Área Rectora de Salud Alajuela 2. 2. The wastewater treatment system must be operated in compliance with the technical regulations currently in force, through the submission of Operational Reports and on-site compliance with the requirements of regulation Nº 33601.” In this regard, it follows that, on November 25, 2024, sanitary order No. MS-DRRSCN-DARSA2-OS-271-2024 was served on the Municipalidad de Alajuela, which was granted ten business days to comply with it.

Against this background, the alleged inaction of the municipal authorities is deemed established. Although they determined the actions that needed to be taken, the fact remains that the reported situation currently persists, inasmuch as they have neither taken the appropriate steps to resolve the treatment plant problem nor arranged for its transfer to the Instituto Costarricense de Acueductos y Alcantarillados—which, they assert, should be responsible for its maintenance. This is despite the fact that they have been aware of the problem in question since 2023, with no evidence that any other measure has been taken, that any definite solution to the problem reported by the petitioner exists, or that a date has been set for resolving it. Under these circumstances, this is a serious public-health problem affecting the environment and the health of the community’s inhabitants, and it is established that the Municipalidad de Alajuela has demonstrated an inability to enforce the applicable laws and fulfill its obligation to guarantee the inhabitants of the area the enjoyment of a healthy and ecologically balanced environment, with resulting consequences for their health due to the nature of the public-health problem affecting them.

In consistent case law, the Chamber has held that human beings cannot be denied the right to a healthy environment or the right to health because the corresponding public authorities are unable to exercise effectively the supervisory powers and problem-solving authority granted to them by law. The persistence of the problem demonstrates that the few actions taken have clearly been insufficient.

In light of the foregoing, the appropriate course is to grant the amparo petition (recurso de amparo), so that the authorities of the Municipalidad de Alajuela issue the necessary orders and carry out the corresponding actions within the scope of their powers, in order to definitively resolve the problem reported by the petitioner and verified by the health authorities brought into these amparo proceedings. Although the wastewater treatment plant (planta de tratamiento de aguas residuales) was put into operation on 20 de diciembre del 2024, it was the community’s residents who did so; this does not relieve the municipal authorities of their obligation to undertake the corresponding measures so that the situation described in these proceedings is definitively remedied, since they state that they must arrange for the treatment plant to be operated by the Instituto Costarricense de Acueductos y Alcantarillados.

VI.Furthermore, it must be noted that no action or omission is evident on the part of the health authorities, which, being fully aware of the problem affecting the residents of the area, have monitored the case, verified the existence of the problem, and issued the corresponding health order (orden sanitaria). The same applies with respect to the Instituto Costarricense de Acueductos y Alcantarillados, since it cannot be inferred that it is responsible for maintaining the wastewater treatment plant. Accordingly, the petition must be denied as to those authorities.

VII.Note by Justice Salazar Alvarado. In environmental matters, it is also the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative-law courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Constitución Política), as is the case here, where the petitioner alleges that she is a resident of the Urbanización San Charbel, located in la Guácima de Alajuela, and that the community’s treatment plant is situated on municipal land and has not been maintained, causing it to cease operating and creating a serious environmental and public-health problem. She therefore reported the problem described above to the respondent local government; however, as of the date on which she sought amparo relief, the problem persisted, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of living.

VIII.Partial dissenting opinion (voto salvado parcial) of Justice Garro Vargas regarding the operative portion of this judgment. Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the court before which the enforcement phase of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical issues, as in this case, in which the Municipalidad de Alajuela must, within six months from service of this judgment, provide a definitive and comprehensive response to the complaints raised by the petitioner concerning the wastewater treatment plant of Urbanización San Charbel. By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, determine liability, supervise stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules established in that Code.

IX.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court within a maximum period of thirty business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session No. 43-12, held on 3 de mayo del 2012, Article LXXXI.

Therefore:

The petition is granted solely against the Municipalidad de Alajuela. Roberto Hernán Thompson Chacón, Roy Delgado Alpízar, Luis Francisco Alpízar Barrantes, and José Luis Chacón Ugalde, in their respective capacities as mayor of Alajuela, director of Infrastructure Planning and Construction, coordinator of the Municipal Sanitation Subprocess, and coordinator of the Water Supply and Sanitation Process, all of the Municipalidad de Alajuela, or whoever holds those offices, are ordered, within SIX MONTHS from service of this judgment, to act in a coordinated and joint manner with the Instituto Costarricense de Acueductos y Alcantarillados and the Área Rectora de Salud Alajuela 2 to undertake the actions necessary to eliminate the problem reported by the petitioner concerning the wastewater treatment plant. The respondent authorities, or whoever holds their offices, are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that must be complied with or enforced, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Alajuela is ordered to pay the legal costs and the damages caused by the facts underlying this ruling, which shall be assessed in administrative judgment-enforcement proceedings. Justice Salazar Alvarado appends a note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be transmitted to that court so that proceedings to enforce this ruling may be commenced. Let notice be given.

<span data-mce-type="bookmark" id="mce_1_start" data-mce-style="overflow:hidden;line-height:0px" style="overflow: hidden; line-height: 0px;"></span>Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinticuatro de enero de dos mil veinticinco .

Recurso de amparo promovido por Nombre01, cédula de identidad NFP01, a su favor y de los VECINOS DE LA URBANIZACIÓN SAN CHARBEL DE ALAJUELA, contra la MUNICIPALIDAD DE ALAJUELA, el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y el MINISTERIO DE SALUD.

Resultando:

  1. 1Por escrito presentado ante la Sala el 08 de agosto de 2024, la parte recurrente interpone recurso de amparo y manifiesta que es vecina de la urbanización San Charbel ubicada en la Guácima, Alajuela. Expone que, dentro de dicha urbanización, se encuentra una propiedad que pertenece a la Municipalidad de Alajuela, la cual fue recibida por ese gobierno local, en su momento, del desarrollador del lugar. Agrega que, hasta hace dos años, el desarrollador de la urbanización se encargaba de cubrir los gastos correspondientes al funcionamiento de la planta de tratamiento, pero dejó de hacerlo al considerar que la responsabilidad recaía sobre la municipalidad. Mencionada que, desde entonces, la planta de tratamiento se encuentra sin mantenimiento, ya que el gobierno local recurrido no lo asumió, ni del pago de los servicios de agua y electricidad necesarios para su funcionamiento. Relata que como resultado de la falta la planta dejó de funcionar durante varios meses, lo que provocó un grave problema ambiental y de salud en la comunidad.Señala que esta situación llevó al Ministerio de Salud a emitir una orden sanitaria en la que otorgó un plazo de un mes para reactivar la planta y con la indicación de ser desalojados. Afirma que los vecinos se organizaron para poner la planta en funcionamiento de manera provisional, aunque el pago de la electricidad -esencial para su operación-, se volvió complicado debido a la naturaleza voluntaria de las contribuciones de los vecinos. Adiciona que, actualmente, la planta dejó de operar nuevamente, lo que pone en riesgo a más de 100 viviendas en la urbanización, además de agravar la contaminación ambiental y los consecuentes problemas de salud. Asevera que se han planteado numerosas diligencias ante la Municipalidad de Alajuela y en algunas de las contestaciones la institución recurrida reconoció ser la responsable de la planta, pese a lo cual no ha tomado acción alguna al respecto. Precisa que, mediante trámite No. 4530-2023 se denunció el problema descrito ante el gobierno local recurrido y por oficio No. MA-A313-2023 del 17 de enero de 2023, el director del Despacho de la Municipalidad de Alajuela remitió a las siguientes autoridades su conocimiento: el director del Proceso de Planeamiento y Construcción de Infraestructura, el coordinador del Subproceso Acueducto y Saneamiento y el coordinador de la Actividad de Saneamiento.Estima que los hechos descritos vulneran sus derechos fundamentales y los de los amparados. Solicita que se declare con lugar el recurso y se obligue a la Municipalidad de Alajuela a cumplir con sus responsabilidades, en cuenta, el traspaso del medidor de electricidad, de la propiedad y la planta al Instituto Costarricense de Acueductos y Alcantarillados, como parece haberse considerado procedente, o lo que sea necesario para resolver la problemática y a garantizar la protección de la salud y el bienestar de los habitantes de la urbanización San Charbel.
  2. 2En resolución de las 14:01 horas del 29 de agosto de 2024, se da curso al proceso y solicita informe al alcalde, al director del Proceso de Planeamiento y Construcción de Infraestructura, al coordinador del Subproceso Acueducto y Saneamiento y al coordinador de la Actividad de Saneamiento, todos de la Municipalidad de Alajuela, sobre los hechos alegados por la parte recurrente.
  3. 3Informa bajo juramento Roberto Hernán Thompson Chacón, en su condición de alcalde de Alajuela, lo siguiente:

Mediante el oficio N° MA-Identificacion012024 de fecha 09 de setiembre de 2024, suscrito por el Ing. Luis Francisco Alpízar Barrantes, Coordinador del Subproceso de Saneamiento y al Ing. José Luis Chacón Ugalde, Coordinador del Proceso de Acueducto y Saneamiento Municipal, el cual indicó que:

“Vistos los hechos y pretensiones planteados por la recurrente, se entiende que en síntesis, esta solicita que la Municipalidad de Alajuela se haga cargo de la operación y mantenimiento de la planta de tratamiento de aguas residuales de urbanización San Charbel, o en su defecto que realice las gestiones que correspondan para efectuar el traspaso de la misma al Instituto Costarricense de Acueductos y Alcantarillados (AyA), esto por cuanto considera afectados sus derechos a “seguridad social”, “justicia”, “vida sana” y “protección de la contaminación”, tal como textualmente indica.

Por lo tanto, en primer lugar, conviene aclarar si la Municipalidad de Alajuela tiene o no responsabilidad en la operación y mantenimiento de la planta de tratamiento en cuestión. De acuerdo con la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados (Ley 2726 del 14 de abril de 1961) en su artículo 2 se establece que la responsabilidad de “administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país” le corresponde al AyA. Así mismo, establece este artículo una responsabilidad residual de las municipalidades, para las que se indica que “los sistemas que actualmente están administrados y operados por las corporaciones municipales podrán seguir a cargo de éstas, mientras suministren un servicio eficiente”.

De acuerdo con lo anterior, es clara la Ley en que la responsabilidad de la Municipalidad es la de administrar y operar adecuadamente los sistemas a su cargo, no así de recibir y operar nuevos sistemas. Así mismo, en caso de que la Municipalidad no fuese capaz de brindar un servicio eficiente en los sitios donde opera, esta responsabilidad recaería finalmente en el AyA como ente rector En el caso concreto de urbanización San Charbel, si bien las áreas públicas fueron trasladadas a la Municipalidad en su momento, esta nunca ha hecho una recepción formal de la planta de tratamiento de aguas residuales en calidad de operador del servicio, ya que la urbanización se encuentra dentro de la zona de cobertura del AyA, que es el ente que brinda el servicio de agua potable y por ende el que también debería administrar el servicio de saneamiento. Como ampliamente lo explica el Proceso de Servicios Jurídicos en el oficio N° MA-PSJ-182-2024, la planta de tratamiento corresponde a un espacio destinado a facilidades comunales, por lo que se considera que las acciones a ejecutar por parte de la Municipalidad deberían enfocarse en trasladar el inmueble al ente competente, en este caso el AyA, para que pueda asumir su operación y mantenimiento.

Así las cosas, se recomienda rechazar las pretensiones de la recurrente en cuanto a que sea la Municipalidad de Alajuela la que asuma administración del servicio de alcantarillado sanitario en urbanización San Charbel, pues se estaría usurpando la zona de cobertura y competencias del AyA”.

De igual forma, la Alcaldia mediante el oficio N° MA-A-4357-2024 de fecha 09 de setiembre de 2024, manifestó lo siguiente:

“En atención al oficio N° MA-PSJ-1447-2024, en el cual nos informa acerca del recurso de amparo interpuesto por la señora Nombre01, el cual se tramita en el Expediente N° 24021588-0007-CO, me permito informar lo siguiente:

Efectivamente, el 16 de enero del 2023, se recibió en esta Alcaldía el Trámite Nº 4530-2023 suscrito por los Vecinos de Urbanización San Charbel -ubicada en Rincón Chiquito, La Guácima-, mediante el cual exponen una situación que les afecta con respecto a la planta de tratamiento de aguas residuales. Con el fin atender dicha solicitud, el entonces Director de Despacho requirió un informe al respecto por medio del oficio N° MA-A-313-2023 dirigido al Ing. Roy Delgado Alpízar, Coordinador del Proceso de Planeamiento y Construcción de Infraestructura, Ing. Pablo Palma Alán, Coordinador a.i. del Subproceso Acueducto y Saneamiento, y al Ing. Francisco Alpízar Barrantes, Coordinador de la Actividad de Saneamiento (folios 01 a 37 del expediente administrativo conformado con ocasión del presente recurso de amparo).

Como respuesta se recibió el oficio N° MA-Identificacion022023, suscrito por el Ing. Francisco Alpízar Barrantes, Coordinador de la Actividad de Saneamiento, quien aclaró que la planta de tratamiento en mención nunca ha sido recibida por la Municipalidad de Alajuela, aunado a que los vecinos están debidamente informados en cuanto a que el servicio de agua potable en la comunidad es brindado por el AyA; por lo que -a criterio de dicho profesional- es a dicha entidad a quien le corresponde operar el alcantarillado sanitario (folio 36 vuelto).

Por tal razón, se confeccionó el oficio N° MA-A-1025-2024 con fecha 21 de febrero del 2023, remitido al Ing. Delgado Alpízar, mediante el cual se realizó un recordatorio de la solicitud de información mencionada en el párrafo trasanterior y además, se adjuntó copia del oficio N° ° MA-SAN-0220032023 (folios 36 a 37).

Nuevamente, se requirió información al Ing. Delgado Alpízar, junto con la Ing. María Auxiliadora Castro Abarca, Coordinadora del Subproceso Acueducto y Saneamiento, y el Ing. Francisco Alpízar Barrantes, Coordinador de la Actividad de Saneamiento, por medio del oficio N° MA-A-3421-2023 (folio 38).

Como respuesta se recibió el oficio N° MA-PPCI-0591-2023 suscrito por el Ing. Roy Delgado Alpízar, Coordinador del Proceso de Planeamiento y Construcción de Infraestructura, mediante el cual se aclaró que el desarrollador del proyecto urbanístico es a quien correspondía realizar el trámite con la Municipalidad y el ICE para traspasar el terreno y servidumbre a favor del AyA. Dicho oficio fue comunicado a los Vecinos de la Urbanización San Charbel por medio del oficio N° MA-A-4355-2023, con fecha 14 de julio del 2023, suscrito por el entonces Director de Despacho de esta Alcaldía (folios 39 a 40).

Adicionalmente, dicho documento fue remitido a la Licda. Johanna Barrantes León, Coordinadora del Proceso de Servicios Jurídicos, por medio del oficio N° MA-A-4356-2023, con fecha 14 de julio del 2023, también suscrito por el entonces Director de Despacho de esta Alcaldía, junto con los antecedentes del caso; con el fin de que emitiera su criterio al respecto (folios 41 a 59). Y por medio del oficio N° MA-A-5961-2023, fechado 25 de setiembre del 2023, se remitió un recordatorio a la Licda. Barrantes León, según consta en los folios 60 a 65.

Como respuesta se recibió el oficio N° MA-PSJ-182-2024, suscrito por la Coordinadora del Proceso de Servicios Jurídicos, en el cual se indicó que el Instituto Costarricense de Acueductos y Alcantarillados podría asumir la planta de tratamiento mediante un convenio de gestión de los sistemas de saneamiento de aguas residuales por solicitud expresa de la Corporación Local. Por tal razón, se remitió el oficio N° MA-A-1513-2024 con fecha 14 de marzo del 2024, al Ing. Delgado Alpízar, con el fin de que procediera según correspondía, notificando a los vecinos (folios 66 a 70).

Sin embargo, a la fecha desconocemos si el Ing. Delgado Alpízar formalizó dicha gestión ante el AyA.

Nótese que los Vecinos de la Urbanización San Charbel han sido oportunamente informados de todas las gestiones, tal y como consta en los respectivos comprobantes de envío de correos electrónicos (folios 01, 38, 38 frente y vuelto, 39 a 40 vuelto, 59, 60, 65, 66, 70); lo cual evidencia que están debidamente informados en que la entidad competente para atender su gestión es el el Instituto Costarricense de Acueductos y Alcantarillados.

Adjunto el expediente original conformado con ocasión del presente recurso de amparo, el cual contiene 81 folios.

Mediante el oficio N° MA-PPCI-0594-2024 de fecha 10 de setiembre de 2024, suscrito por el Ing. Roy Delgado Alpízar, Director, del Proceso de Planeamiento y Construcción de Infraestructura Municipal, el mismo indicó lo siguiente:

“(…) De acuerdo con lo anterior le expongo los siguientes antecedentes:

Mediante oficio N.º MA-PPCI-0591-2023 del 13 de julio 2023, se da la atención a los oficios N.º MA-A313-2023, N.º MA-A-1025-2023, N.º MA-A-3421-2023 y N.º MA-A-3990-2023; todos relacionados a la problemática expuesta por los vecinos de la Urb. San Charbel, ubicada en Rincón Chiquito, La Guácima mediante trámite N.º 4530-2023 sobre la planta de tratamiento de aguas residuales.

Al respecto tal y como indicó el Ing. Francisco Alpízar en el oficio N.º MA-Identificacion02- 2023 y N.º MASAN-062901-2023, “el ente que se encarga del suministro de agua potable en la zona es el AyA por lo que la Municipalidad de Alajuela no puede brindar servicios de agua potable, ni de tratamiento de aguas residuales ya que la zona está dentro de la cobertura del AyA”. Dicha afirmación va en concordancia con la política que el ente encargado de brindar el servicio de agua potable en una zona es el que debe tratar las aguas residuales que esta comunidad genere.

En ese mismo sentido, mediante oficio N.º SG-GSP-RT-2022-00317, fechado el 11 de noviembre del 2022, suscrito por el Sr. Nombre03, UEN Recolección y Tratamiento Periféricos del Instituto Acueducto y Alcantarillados, informó a los vecinos de la Urb. San Charbel el estado del trámite de recepción del sistema de saneamiento de dicha urbanización, indicando “(…) A la fecha no existe ante este Instituto una solicitud formal por parte del Desarrollador, para iniciar el proceso de recepción del sistema de saneamiento de la urbanización San Charbel”.

Además, señala que, de acuerdo con el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte Instituto Costarricense de Acueductos y Alcantarillados, acuerdo 2017- 066, fecha 15 de febrero del 2017, para asumir la administración, operación y mantenimiento de sistemas de saneamiento, debe cumplir con todos los requisitos del artículo 12 y según artículo 13, los requisitos indicados en el artículo 12, deberán presentarse en la Gerencia General del AyA, mediante solicitud escrita de gestión de recepción, por parte del propietario o representante legal del sistema de saneamiento. (subrayado no es del original).

El terreno donde se encuentra ubicada la Planta de Tratamiento de Urbanización San Charbel se trata de un área comunal a nombre de la Municipalidad, además es afectada por una servidumbre de una línea de alta tensión y cuenta con un área de 1.463 m2 según registro, con plano catastro A-1622647-2012.

Por lo anterior, el Desarrollador debe realizar las gestiones necesarias con la Municipalidad y el ICE para traspasar el terreno y servidumbre a favor del AyA (negrita no es el del original).

Así las cosas, este Proceso reitera lo indicado en los oficios N.º MA-Identificacion022023 y N.º MA-Identificacion032023; suscrito por el Ing. Luis Francisco Alpízar y, siendo que mediante oficio N.º MA-SASM285-2023 la Ing. María Auxiliadora Castro Abarca señala que para el caso en cuestión “(…) a la Municipalidad lo que le compete es coordinar directamente con el AyA para realizar el traspaso del terreno, y de esta forma el AyA pueda administrar el servicio”. Este proceso considera conveniente informar sobre esta situación al Proceso de Servicios Jurídicos a fin de determinar el proceso legal a seguir para poder realizar el traspaso del área comunal y servidumbre a favor del AyA, para poder dar solución a la problemática denunciada.

Mediante oficio N.º MA-PPCI-0353-2024, con fecha del 5 de junio 2024 se le informa a la Alcaldía: se da la atención al oficio N.º MA-A-1513-2024, donde se expone la situación de los vecinos de Urb. San Charbel, ubicada en Rincón Chiquito de la Guácima, se le informa al Ing. José Luis Chacón Ugalde coordinador del Acueducto Municipal, esto con el fin de que proceda a tramitar el traspaso de la planta de tratamiento de dicha urbanización al AyA.

Con el oficio N.º MA-PPCI-0373-2024, con fecha del 5 de junio 2024 se le informa a la Dirección del Acueducto Municipal: le remito los documentos N.º MA-A-1513-2024 para que proceda a tramitar según corresponda.

El oficio N.º MA-PPCI-0373-2024, se le envió a la nueva Dirección del Acueducto Municipal, en la cual es un departamento que paso de ser un Subproceso a una Proceso, lo cual mantiene ahora un nivel de Dirección que se relaciona a su naturaleza en temas de agua, plantas de tratamiento, entre otros, lo cual ahora es independiente de las decisiones y labores ordinarias de esta Dirección.

De acuerdo con el oficio N.º MA-SASM-264-2024, con fecha del 17 de junio 2024, responde nuestro oficio N.º MA-PPCI-0373-2024, dicho oficio aclara que este Proceso no ha tenido participación alguna en el recibimiento de las áreas comunales de la Urbanización San Charbel, sin que pueda este Proceso, emitir opiniones al respecto según el organigrama institucional, ni cuenta con competencia en este caso bajo análisis, lo cual es resorte exclusivo de la Alcaldía Municipal.

Según el oficio N.º MA-PAAM-317-2024, con fecha del 19 de julio 2024 le responde a la Alcaldía Municipal el oficio N.º MA-A-3538-2024 el cual menciona nuestro oficio N.º MA-PPCI-0353- 2024, concluye las siguientes situaciones:

I.El Subproceso de Saneamiento a la fecha no de emsisión (sic) de esta misiva inclusive no a recibido trámite alguno sobre la Urbanización San Charbel, ubicada en el distrito de la Guácima, siendo que no se a recibido la planta de tratamiento, de nuestra parte.

II.La municipalidad de Alajuela, no cuenta con infraestructura del acueducto en el distrito de la Guácima, razón por la cual tampoco cuenta con alcantarillado sanitario en ese distrito.

III.Que es el Instituto Costarricense de Acueduntos (sic) y Alcantarillados, es el operador que brinda el servicio de agua en esa comunidad, razón por lo cual es competencia de esa institución brindar el servicio de alcantarillado sanitario cuando corresponda técnicamente.

IV.Que mendiante (sic) oficio N.º MA-PPCI-0591-2023, emitido por el Ing. Roy Delgado Alpízar, Dirección del Proceso de Planeamiento y Construcción de Infraestructura, se indica que el terreno donde se encuentra la planta de tratamiento, es un área comunal a nombre de la Municipalidad de Alajuela.

Así las cosas, y en razón de que tanto el Subproceso de Saneamiento, como este Proceso, no hemos recibido trámite alguno de la Urbanización San Charbel, ubicada en el distrito de La Guácima y considerando que esta municipalidad no cuenta con infraestructura del acueducto en el distrito de la Guácima, y tampoco cuenta con alcantarillado sanitario en ese distrito, lo correspondiente es que el ente que brinda el servicio de abastecimiento de agua potable sea el que trate las aguas residuales en esta urbanización.

Finalizando, en el oficio N.° MA-PPCI-0591-2023, se indica que “los vecinos han venido presentando documentos relacionados a esta solicitud, los cuales procedo a adjuntar al presente oficio, dado a que estos han hecho frente a los gastos de mantener en funcionamiento la planta de tratamiento, sin embargo, es necesario que la misma reciba el mantenimiento adecuado por parte del AyA, no obstante, de acuerdo con lo indicado por Sr. Nombre03, mediante oficio SG-GSP-RT-2022-00317, se deben realizar las gestiones necesarias con la Municipalidad para traspasar el terreno a favor del AyA”.

De acuerdo con los antecedentes anteriores se demuestra que, hasta donde este Proceso tuvo a cargo al Acueducto Municipal, se gestionó todo lo relacionado con la debida operación de la planta de tratamiento de dicha urbanización por parte del Instituto Costarricense de Acueductos y Alcantarillados. Actualmente, dado que el departamento de Acueducto es un Proceso, le corresponde a este gestionar directamente el traspaso de los terrenos al AyA mediante la debida coordinación con las partes relacionados”.

Se comprueba que el trámite N° 4530-2023 fue atendido por los departamentos respectivos conforme a derecho, e incluso los vecinos han sido informados de todas gestiones realizadas a nivel municipal.

Conviene aclarar que tal y como se indicó en el criterio técnico, las áreas públicas fueron trasladadas a la Municipalidad sin embargo, el Instituto Costarricense de Acueductos y Alcantarillados (AYA) nunca ha hecho una recepción formal, de la planta de tratamiento de aguas residuales, en calidad de operador del servicio. Lo anterior por cuanto, la urbanización San Charbel, se encuentra dentro de la zona de cobertura del AyA, que es el ente que brinda el servicio de agua potable y por ende el que también debería administrar el servicio de saneamiento.

Y es que debe de dejarse claro que, la planta de tratamiento corresponde a un espacio destinado a facilidades comunales, por lo que se considera que las acciones a ejecutar por parte de la Municipalidad deberían enfocarse en trasladar el inmueble al ente competente, en este caso el AyA, para que pueda asumir su operación y mantenimiento.

Se constata que, según el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento, para que el AYA asuma mediante convenio la gestión de los sistemas de saneamiento de aguas residuales, es necesario que la Municipalidad, por medio del abogado institucional del Acueducto Municipal, solicite el traslado a favor del Instituto Costarricense de Acueductos y Alcantarillados y cumpla la serie de requisitos establecidos en el artículo 12 inciso I del Reglamento indicado supra, ya que le corresponde al Instituto Costarricense de Acueductos y Alcantarillados como ente rector a nivel nacional, de asumir la administración y operación del sistema de alcantarillado y acueducto que están en poder de las Municipalidades por solicitud expresa de la Corporación Local.

En virtud de lo anterior, se constata que, esta Municipalidad, no sólo ha atendido oportunamente la gestiones interpuestas, acorde a nuestras competencias, sino que también es de suma importancia mencionar que, según múltiples sentencias constitucionales, han plasmado el derecho establecido en el artículo 27 de la Constitución Política, hace referencia a la facultad que posee todo ciudadano para dirigirse, por escrito, a cualquier funcionario público o entidad oficial, con el fin de exponer un asunto de su interés.

Esa garantía se complementa con el derecho a obtener pronta respuesta, pero esto último no significa una contestación favorable; en otras palabras, lo que se garantiza es el derecho a pedir y no el derecho a obtener lo que se pide, aun cuando el funcionario público deba resolver con estricta sujeción a la ley, pues la libertad de petición se funda en otro principio, esto es, en que no puede coartarse por la administración el derecho de los gobernados para dirigirse a los órganos públicos.

No obstante, la recurrente, decidió interponer el presente Recurso de Amparo para causar confusión, y que se condene a este Municipio por una supuesta “inacción” denunciando una problemática que ya en reiteradas ocasiones, se ha indicado el procedimiento a seguir, incluso hace meses atrás, se generaron las respuestas respectivas, y las posibles soluciones a la problemática denunciada, no obstante, su gestión fue debidamente atendida, bajo nuestras competencias y la misma tiene pleno conocimiento de ello. Aun cuando la recurrente no esté de acuerdo con el trámite y las respuestas dadas por el municipio, lo cierto es que, con sus afirmaciones, lo que evidencia es, su descontento, incomodidad, e incluso desconocimiento total, de la forma en que funciona a nivel municipal y sus respectivas competencias.

En virtud de lo anterior, considera este Municipio que, se ha actuado de acuerdo a nuestras competencias, y no ha existido inacción o violación a derechos constitucionales; no obstante, consideramos que el recurrente, interpone el presente Recurso, para tratar de desvirtuar la información suministrada en su escrito de interposición, no obstante, este Municipio actúa bajo las competencias de este.

Se comprueba que la Municipalidad de Alajuela realizó las labores propias atinentes a su competencia, por lo que solicito SE DECLARE SIN LUGAR en todos sus extremos el Recurso de Amparo interpuesto”.

  1. 4Informa bajo juramento Roy Delgado Alpízar, Luis Francisco Alpízar Barrantes y José Luis Chacón Ugalde, en sus respectivas condiciones de director de Planeamiento y Construcción de Infraestructura, coordinador del Subproceso Saneamiento Municipal y coordinador del Proceso de Acueducto y Saneamiento, todos de la Municipalidad de Alajuela, en igual sentido que el alcalde de ese municipio y solicitan que se declare sin lugar el recurso.
  2. 5En resolución de las 11:21 horas del 30 de setiembre de 2024, se amplían las partes consignadas y se confiere audiencia al presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, sobre los hechos alegados por la parte recurrente y sobre lo informado por el alcalde de Alajuela.
  3. 6En resolución de las 11:38 horas del 30 de setiembre de 2024, se ampliaron las partes consignadas en el recurso y se confiere audiencia al director del Área Rectora de Salud de Alajuela 2, sobre los hechos alegados por la parte recurrente.
  4. 7Informa bajo juramento Juan Manuel Quesada Espinoza, en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, lo siguiente:

“Con base en las pruebas que se aportan, se detallan los antecedentes relacionados a las acciones administrativas realizadas por el AyA para la Urbanización San Charbel:

Actividad Fecha Responsable Emisión de disponibilidad CCO-OM2005-168, que indicó que en la zona no se dispone de red de alcantarillado sanitario administrada por el AyA, pero que si se contaba con abastecimiento.

7 de diciembre 2005 Región Central Oeste, Operación y Mantenimiento Aprobación de Proyecto Habitacional mediante oficio URB-107-2006, BIT-95-2006, con red prevista y uso de tanque séptico.

II. RESPUESTA A LOS HECHOS

PRIMERO: Con fundamento en el informe UEN-PC-2024-02546, y conforme con el Expediente Administrativo que se adjunta como prueba, los planos constructivos de la Urbanización San Charbel se aprobaron en el año 2006 según el oficio URB-1072006, BIT-95-2006, con la red de alcantarillado sanitario prevista y no en uso (consta en imagen 100 y 116 “Expediente 21 Proyecto Habitacional”, en donde se indica que: “….Con base en lodo lo anterior la posibilidad de contaminación del acuífero es remota sin embargo, el inconveniente no es la posibilidad de contaminación sino la poca capacidad de infiltración que presentan los materiales en un sector del AP Debido a lo anterior el proyectista plantea el uso de tanques de filtro anaeróbico en el sector norte de la finca conectados a la tubería de alcantarillado y una zanja de drenaje en la parte baja del AP o sector Sur…”) Lo anterior significó que debían disponer sus aguas residuales mediante un sistema individual de tanque séptico y su respectivo drenaje, y la institución encargada de esta aprobación fue el Ministerio de Salud.

En la imagen 106 del Expediente 21 Proyecto Habitacional (No de la Planta de Tratamiento), se ubica la resolución de disponibilidad CCO-OM-2005-168, de fecha 7 de diciembre 2005, que indico que en la zona no se dispone de red de alcantarillado sanitario administrada por el AyA.

Posteriormente, ingresa para la gestión para la aprobación, una planta de tratamiento en el año 2022, en virtud de que el desarrollo habitacional propuso ya no la utilización de tanque séptico, sino disponer todas las aguas residuales mediante una Planta de Tratamiento, la cual está rechazada según la resolución PTRAR-AyA-2022-115 con fecha 17 de agosto de 2022, por el AyA.

Al haber emitido pronunciamiento de rechazo, no era factible que se otorgaran los permisos constructivos de dicha planta y mucho menos que entrara en funcionamiento, desconectando las unidades habitacionales del tanque séptico, y se utilizara la red prevista a una Planta de Tratamiento.

En la imagen 2 del Expediente Digital (Expediente PTAR 4) que se adjunta como prueba, consta la resolución PTRAR-AyA-2022-115 que indica todas las deficiencias que debían ser corregidas, para que existiese autorización de construcción y garantía de buen funcionamiento:

“…Manual de operación y mantenimiento: Deberá contar con el equipo de medición para pH, temperatura y sólidos sedimentadles y en el caso de sistemas aeróbicos de tratamiento de aguas ordinarias, un medidor de oxígeno disuelto.

El Manual de operación y mantenimiento de la planta de tratamiento de disposición final del efluente debe incluir la descripción del equipo básico para mediciones rutinarias de parámetros fisicoquímicos del agua. Además, deberá mencionarse el equipo básico de mantenimiento según el tipo de tratamiento de aguas residuales, incluyendo el equipo de limpieza.

Memoria de cálculo: Debe incluir ficha técnica de todos los equipos electromecánicos y difusores para verificación de sus características y criterios de selección.

Criterios de diseño: Esta sección deberá ser detallada, de forma tal que muestre no sólo resultados intermedios y finales, sino también aspectos tales como: suposiciones utilizadas para cada etapa, secuencia de cálculos, fórmulas, uso de las fórmulas, referencias a fuentes de información que sustenten los criterios empleados, e indicación clara de factores de segundad utilizados.

En el caso de Urbanizaciones y Fraccionamientos, el cerramiento debe colocarse en toda la periferia del terreno donde se ubicará la PTAR. En este caso debe incluir retiros, ya que los mismos son medidos con respecto a linderos de propiedad.

Deberá incluirse sobre el lindero de la propiedad una malla o tapia de dos metros de altura, como medida de segundad que evite el ingreso de personas no autorizadas y cuyo portón de acceso permita la entrada de un camión. En la parte superior de la malla o tapia deberá colocarse un dispositivo o accesorio para disminuir los actos de vandalismo.

Los caminos de acceso a la planta de tratamiento deben contar con una estructura de pavimento y obras viales complementarias, de conformidad con lo establecido en el Manual de Especificaciones Generales para la Construcción de Carreteras, Caminos y Puentes (CR-2010) vigente, emitido por el MOPT. El diseño y el perfil topográfico del camino debe garantizar el ingreso de cualquier tipo de vehículo para el transporte de personas o bienes y sin distinción de carga.

Si el sistema de tratamiento utiliza equipo electromecánico de uso diario, deberá incluirse en el diseño eléctrico el suministro en caso de emergencia. En Planta debe mostrarse dirección del flujo de agua del cuerpo receptor. La entrega de las aguas residuales tratadas a un cuerpo de agua (quebrada o río) debe ser hecha siguiendo su flujo con un ángulo no mayor de 45°.

Debe mostrar en láminas detalles de las estructuras para medición de caudal a la entrada y salida de la planta de tratamiento de aguas residuales, cabezal de desfogue, caja de registro para toma de muestras a la salida de la planta de tratamiento de aguas residuales, estructura para retención de arenas, pozos de registro, cajas de válvulas, estructura para rejillas (al menos dos juegos para sólidos gruesos y sólidos más finos), sistemas de agua potable, alcantarilladas pluviales y sanitarios, y demás obras complementa rías del sistema de tratamiento.

Se deben mostrar las curvas de nivel del terreno donde se ubique el sistema de tratamiento de aguas residuales y los alineamientos y retiros que las instituciones hayan fijado. Acotar retiro desde la esquina noreste de las unidades principales del sistema de tratamiento y los linderos del respectivo predio (vértice 1 del plano catastro), en esquina de calle pública.

El diseño debe incluir un sistema de iluminación para exteriores, distribuido homogéneamente y con la intensidad requerida para ¡luminar desde la planta hacia Iodo el perímetro de la propiedad que la contiene, permitiendo una iluminación general de al menos 100 lux. El sistema de iluminación en general debe garantizar un grado mayor de agudeza visual con iluminación localizada de al menos 300 lux, en las diferentes áreas donde se llevan a cabo los procesos que requieren de la ejecución de actividades en horario nocturno. El sistema de iluminación debe diseñarse considerando las particularidades de todos los procesos y actividades definidas en el manual de operación, mantenimiento y control. Adicionalmente, se debe cumplir con la normativa nacional en materia de eficiencia energética.

El diseño debe incluir cámaras para muestreo de aguas residuales a la salida de la plañía de tratamiento, para cada uno de los módulos o trenes de tratamiento y para la reunión de los efluentes de cada uno de éstos. Considerar cuando se cuente con dos o más trenes de tratamiento.

La cámara o dispositivo de medición de caudal debe estar libre de interferencia de otros flujos de agua presentes en la planta de tratamiento. En caso de vertedera triangular, el ángulo debe calcularse según el caudal del sistema.

La cámara de rejillas debe incluir al menos dos juegos de rejillas con inclinación entre 45° y 60°. una para sólidos gruesos, otra para sólidos más finos, ambos con bandeja para deshidratación de sólidos.

El diseño debe incluir dos módulos como mínimo, para el acondicionamiento y deshidratación de lodos residuales, que permitan satisfacer de forma complementaría o en su conjunto la capacidad requerida según parámetros de diseño.

Los elementos metálicos que se incorporen a la planta de tratamiento deben fabricarse con materiales anticorrosivos cuando se requiera aplicar pintura a esos elementos se debe utilizar pintura epóxica a dos capas. En los planos se deben indicar los códigos de las normas de fabricación que especifican la característica anticorrosiva de los materiales metálicos y el epoxi de la pintura.

Todo tanque elevado o semienterrado sin cubierta debe incorporar pasarelas de al menos un metro de ancho, con baranda lateral alrededor de cada tanque y sobre los sistemas de lagunas. Considerar cuando se elimine la cubierta superior.

Cuando al subsanar se incorpore información adicional en láminas, se deberá actualizar memoria de cálculo y manual de operación y mantenimiento, en todas las secciones que corresponda.

Debe presentar sistema de manejo de aguas pluviales hasta conexión con sistema pluvial del proyecto global o desfogue pluvial.

Debe incluirse las previsiones necesarias para posibilitar su mantenimiento o rehabilitación sin sacar de operación toda la planta de tratamiento.

El diseño de la planta debe incorporar al menos dos dispositivos de suministro de agua; uno ubicado cerca de la cámara de rejillas y el otro en el extremo opuesto a la zona de ingreso a la planta; lo anterior para facilitar las actividades de limpieza de las estructuras.

El desarenador debe incluir como mínimo doble cámara para facilitar el mantenimiento y limpieza de la estructura. Debe incluir en memoria, manual y láminas en todas las vistas que corresponda.

Debe presentar Sistema de iluminación interno y externo de las edificaciones.

El sistema de tuberías internas de la planta, excluyendo la tubería enterrada, debe cumplir con la "Norma oficial para la utilización de colores de seguridad y su Simbología" vigente, emitida por el MEIC (Decreto N" 12715). Se acepta aplicarlo establecido en la norma INTE 31 -07-03 " Código de colores para la identificación de los sistemas tuberías acorde con lo establecido en la norma del MEIC”. Se debe indicar la dirección del flujo en tas tuberías y éstas también debe cumplir con los requisitos de rotulado de contenidos en las normas técnicas de fabricación de la misma. Debe indicar mediante nota en láminas.

La planta debe contar con tolvas de fondo de sedimentadores con una pendiente mínima de 45 grados, se acepta que el diseño incluya mecanismos de barrido de lodos.

Toda cubierta sobre las unidades de tratamiento de sistemas aerobios, en especial en proyectos de urbanizaciones y conjuntos residenciales, debe ser removible en su totalidad y debe incluir los dispositivos o sistemas de izaje cuando su manipulación no pueda ser realizada por una sola persona; lo anterior, a efecto de permitir la ejecución de actividades de mantenimiento y de operación.

La cásela de máquinas debe incluir el equipo electromecánico, paneles de control y tableros eléctricos. El equipo electromecánico no deberá estar ubicado dentro de la caseta para el operador y vigilante.

Se deberá habilitar una ducha y un espacio para guardar documentación y equipos en la caseta para el operador. Adicionalmente, la planta deberá contar con otros dos aposentos: uno para el vigilante (cuando no se requiera, deberá justificarse) y una bodega. Las aguas residuales de la caseta deben verter en la entrada de la planta de tratamiento.

Las unidades de tratamiento primario y secundario, deberá contar como mínimo, con dos módulos Que operen en paralelo y que permitan satisfacer de forma complementaria, o en su conjunto, la capacidad requerida según diseño.

La caseta de máquinas deberá cumplir con métodos constructivos y materiales adecuados para la debida protección de los equipos, de acuerdo a las normas vigentes que apliquen, así mismo deberá dotarse de ventilación adecuada para evitar el calentamiento excesivo de los equipos Notas:

El presente acto no incluye la revisión ni aprobación por parte del AyA del sistema de recolección de aguas residuales, ni la aprobación final del diseño de la tubería del emisario del efluente para disposición del efluente, pues estos se incluyen en el trámite del proyecto global…” (el resaltado no es del original) Dentro de este mismo expediente este Instituto únicamente cuenta con la autorización del Ministerio de Salud de permiso de ubicación de la Planta de Tratamiento, en la imagen 36, oficio ARSA-2-308-08 del 11 de marzo del 2008, que de conformidad con el Decreto 31545-S-MINAE (Reglamento de Aprobación y Operación de Sistemas de Tratamiento de Aguas Residuales, que luego fuera derogado por el artículo 33 del Reglamento de Aprobación de Sistemas de Tratamiento de Aguas Residuales, aprobado mediante decreto ejecutivo N° 39887 del 18 de abril del 2016) en su artículo 8 emite la aprobación del permiso.

El artículo 8 indicado citaba:

“…Artículo 8º—El Permiso de Ubicación deberá ser solicitado ante el Ministerio de Salud, mediante nota acompañada con la siguiente información:

a. Nombre del proyecto global.

b. Nombre del propietario.

c. Localización según provincia, cantón y distrito, adjuntando copia del plano catastrado, actualizado y sin reducción.

d. Dirección exacta de la propiedad.

e. Breve explicación del proyecto global (habitacional, turístico, comercial, agropecuario, industrial u otro) que requerirá del sistema de tratamiento.

f. Breve descripción del tipo, procesos y equipos del sistema de tratamiento propuesto.

g. Disposición final propuesta para las aguas residuales tratadas, debidamente justificada según el artículo 9 del presente Reglamento. En caso de que la disposición elegida sea a un medio receptor acuático, deberá ser de caudal permanente, lo cual deberá estar certificado por la autoridad competente.

h. Plano de Conjunto del proyecto global dentro del cual se ubicará el sistema de tratamiento, que incluya al menos la siguiente información:

i. Ubicación propuesta del área destinada al sistema de tratamiento, indicando sus dimensiones preliminares.

  • ii)Acotamiento de los retiros a guardar entre el sistema de tratamiento y los linderos de la propiedad que lo contendrá (ver Cuadro 1).
  • iii)Acotamiento de los retiros a guardar entre el sistema de tratamiento y las edificaciones existentes o proyectadas dentro de la misma propiedad, identificado en el Plano de Conjunto.
  • iv)Ubicación propuesta para el cabezal de desfogue o conexión al alcantarillado, si lo hubiera.
  • v)Dirección del flujo de los cuerpos de agua que atraviesen o colinden con la propiedad.
  • vi)Ubicación de los pozos de abastecimiento de agua existentes o proyectados, dentro de la misma propiedad del proyecto global.
  • vii)Ubicación de los pozos de abastecimiento de agua existentes en las propiedades colindantes con el proyecto global, en un radio de 100 metros de la planta de tratamiento.” Nótese que la norma no indica la aprobación a nivel constructivo, de diseño o funcionamiento, sino de ubicación de la Planta, por parte del Ministerio de Salud, de forma concordante el artículo 7 de ese entonces cuerpo reglamentario determinaba:

“Artículo 7º-El presente capítulo regula el alcance del permiso de ubicación de Sistemas de Tratamiento de Aguas Residuales. Este es un requisito inicial que no obliga a conceder otros permisos, ni sustituye requisitos de otras instancias gubernamentales.” Conforme lo anterior, el requerimiento de aprobación de parte del AyA de la propuesta de construcción de la Planta de Tratamiento era necesaria, y por consiguiente el Gobierno Local no debió haber permitido su construcción y que esta entrara en funcionamiento.

SEGUNDO: De igual manera el oficio SG-GSP-RT-2024-00160, que adjunta el Criterio Técnico emitido por la Región Central Oeste y la UEN de Recolección y Tratamiento de Sistemas Periféricos mediante oficio SG-GSP-RT-2024-00159, determina lo siguiente:

“…Aunque este proyecto según consta en el expediente de Urbanizaciones de AyA es del año 2006, y fue aprobado con un sistema de alcantarillado sanitario que descargaba en dos tanques sépticos comunes, el desarrollador posteriormente construyó una planta de tratamiento de aguas residuales, que según indica la UEN Programación y Control, el proyecto de la Planta de Tratamiento San Charbel ingresó para su primera revisión a través de la Plataforma APC bajo el código CFIA 1046194. Esta primera revisión, cuyo resultado fue rechazado, consta en el documento PTAR-AyA-2022-155, fechado el 17 de agosto de 2022. A pesar de esta notificación y del rechazo del proyecto por incumplir con los requisitos establecidos, hasta la fecha no se han subsanado las observaciones indicadas en la revisión inicial.

El reglamento vigente establece un plazo máximo de 14 meses para que el profesional a cargo del proyecto adjunte los planos corregidos y subsane las observaciones realizadas. Dicho plazo ha expirado sin que el profesional del proyecto haya presentado los documentos requeridos. Por lo tanto, para darle continuidad al proyecto, el interesado deberá cumplir con los requisitos del resello de plano y reiniciar el proceso de revisión, conforme a los requisitos documentales y reglamentarios vigentes, tal como lo dispone el artículo 6 del Decreto Ejecutivo N° 43318 del 29 de octubre de 2021.

2. Incumplimiento de Requisitos Regulatorios:

El sistema de saneamiento propuesto para la planta no cuenta con la aprobación necesaria ante el AyA. Los planos presentados en la primera revisión indican una disposición a la quebrada Doña Ana y el uso de tecnología de lodos activados con aireación extendida. Sin embargo, estos planos no tienen validez debido a que aún no cuentan con la aprobación reglamentaria por parte de AyA y con los requisitos de la normativa vigente en Costa Rica.

Es necesario señalar que, según la normativa aplicable, todos los proyectos de sistemas de saneamiento deben contar con aprobación técnica y regulatoria antes de su implementación. Esto incluye la obtención de las aprobaciones pertinentes para el sistema de tratamiento y disposición de aguas residuales, así como la regularización de los terrenos donde se ubica la planta de tratamiento. A la fecha, no hemos recibido solicitud de traspaso de los terrenos por parte de la Municipalidad de Alajuela, lo que impide el cumplimiento de los requisitos legales para la formalización del proyecto ante el AyA.

3. Propiedad y Situación Legal: Según los documentos presentados en la revisión inicial, la propiedad de los terrenos donde se ubica la planta de tratamiento está registrada a nombre de Versachi de Centroamérica S.A., cédula jurídica 3-101-198276. Actualmente la planta de tratamiento se encuentra una propiedad que pertenece a la Municipalidad de Alajuela, la cual fue recibida por ese gobierno local, en su momento, del desarrollador del lugar. No obstante, para que el AyA pueda aprobar y recibir formalmente el proyecto, es necesario que se aclare la situación legal de los terrenos y cumpla con los requisitos establecidos en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento por parte del Instituto Costarricense de Acueductos y Alcantarillados Acuerdo N°2022-354.

Es importante indicar, que la Municipalidad de Alajuela, tiene conocimiento del proceso requerido para realizar el traspaso de la PTAR al AyA, de conformidad al oficio MA-PSJ182-2024 con fecha del 30 de enero del 2024, emitido por el área de Servicios Jurídicos de la Municipalidad de Alajuela.

(…)

Conclusiones

1. La PTAR San Charbel a la fecha no cuenta con permisos aprobados por Urbanizaciones - UEN Programación y Control AyA.

2. Bajo las condiciones actuales la operación y el mantenimiento le corresponde a la Municipalidad de Alajuela.

3. El operador del servicio de agua potable es el AyA.

4. El AyA no ha recibido solicitud de traspaso de la PTAR por parte de la Municipalidad de Alajuela.

5. La Municipalidad de Alajuela debe acondicionar la PTAR en cumplimiento con los requisitos establecidos en el Reglamento de Aprobación CONSIDERACIONES DE FONDO Resulta de importancia indicar que en Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “Sistema de Alcantarillado Pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “Sistema de Alcantarillado Sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas.

De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura. De conformidad con el Código Municipal y la Ley General de Salud, las Municipalidades tienen competencia para recibir y administrar sistemas de saneamiento de Plantas de Tratamiento.

Por su parte, los Gobiernos Locales cuentan con la facultad de establecer una serie de limitaciones a construcciones y proyectos, mediante la planificación urbana, destacando que en caso de que se incumplan las condiciones que ordenen cuentan con una serie de mecanismos coercitivos para hacer cumplir sus mandatos, de los cuales carece AyA. Aunado a lo anterior, se tiene claro que las Municipalidades son los entes que recaudan los montos respectivos para mantenimiento y buen funcionamiento de la red pluvial, tal y como lo dispone el Código Municipal No. 7794, en el Título IV. Hacienda Municipal, Capítulo II. Los ingresos municipales.

En el presente caso, no se puede dejar de lado que las Municipalidades cuando cobran los impuestos municipales incluyen el rubro correspondiente al mantenimiento y operación de la red pluvial, lo que recalca la competencia municipal en este campo, además de que resulta evidente que este rubro debería ser utilizado en el mantenimiento y operación de la red pluvial de cada Municipalidad, como lo indica la Sala Constitucional en el Voto 2001-2320, en el Considerando IV, que a la letra dice:

“IV.- Así las cosas, de lo expuesto en la Ley supracitada y de lo relativo a la competencia municipal por razón de la materia, este Tribunal Constitucional considera que quien debió atender la denuncia planteada por el amparado en salvaguarda del derecho a la salud, fue la Municipalidad de Alajuelita, no únicamente por el hecho de que el problema en cuestión calza dentro del denominado "interés local" de su cantón, sino también porque de acuerdo a Acueductos y Alcantarillados, ese ayuntamiento es el encargado de administrar el alcantarillado pluvial en donde se encuentra la falla. En cuanto a lo actuado por el Instituto accionado, no estima la Sala que él tenga responsabilidad alguna en la violación de los derechos fundamentales del señor Nombre02, por cuanto, si bien es cierto que como ente autónomo rector en la materia, tiene el deber de solventar los problemas que se susciten en relación con el suministro de agua potable, con la recolección y evacuación de aguas negras y de aguas pluviales en las áreas urbanas, también es cierto que ello es deber prioritario de las municipalidades cuando, como en el presente caso, tienen a su haber la administración de los acueductos y alcantarillados del cantón; o bien, cuando, como también sucede aquí, el problema a solucionar tenga de por medio la tutela de derechos fundamentales cuyo remedio no requiera conocimientos especial o técnicos que solo pueda brindar un ente determinado. En razón de ello, el recurso debe ser declarado con lugar, por la violación al derecho a la salud cometida por la Municipalidad de Alajuelita en perjuicio del amparado.

Asimismo, la Ley General de Salud No. 5395, propiamente sobre el caso que nos ocupa, señala en sus artículos 285 y 292 lo siguiente:

“ARTÍCULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio queda facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas.

ARTÍCULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” En este mismo sentido, el artículo 1 de la Ley de Construcciones N° 833, señala lo siguiente:

"Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes les concedan en estas materias a otros órganos administrativos".

Lo anterior evidencia la conexidad de las obligaciones municipales en materia de alcantarillado pluvial y la obligación señalada supra, las cuales se encuentran ligadas y bajo la administración de los Gobiernos Locales como parte de los servicios que se encuentran obligados a suministrar.

Ahora bien, el artículo 60 de la Ley Orgánica del Ambiente establece, sobre la prevención y control de la contaminación:

“Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como:

  • a)El abastecimiento de agua para consumo humano.
  • b)La disposición sanitaria de excretas, aguas servidas y aguas pluviales.
  • c)La recolección y el manejo de desechos.
  • d)El control de contaminación atmosférica.
  • e)El control de la contaminación cónica.
  • f)El control de sustancias químicas y radiactivas.

Estos servicios se prestarán en la forma que las leyes y los reglamentos específicos lo determinen, procurando la participación de la población y sus organizaciones.” Con base en las normas citadas, se concluye que la Municipalidad de Alajuela, es la responsable directa en la determinación de las medidas requeridas para solucionar el problema de administración de la Planta de Tratamiento de aguas residuales, quien a su vez aprobó en su momento el desarrollo urbanístico en dicha zona y en caso de decidir trasladar la administración al AyA, debe cumplir con lo dispuesto en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, publicado en el ALCANCE No. 171 a la GACETA No. 151 del miércoles 10 de agosto del 2022, esto sin perjuicio de que coordine con los entes que puedan gestionar para que ese alcantarillado sea el adecuado y velar igualmente porque los propietarios hagan uso adecuado del sistema, al haber recibido bajo su administración los componentes y terrenos en donde se ubica la planta de tratamiento.

En este sentido, la Municipalidad de Alajuela tiene la obligación de hacer cumplir las leyes en la materia correspondiente al ordenamiento territorial y la obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. La Municipalidad teniendo pleno conocimiento de la problemática que afecta a los pobladores de su cantón, se ha limitado a constatar su existencia y evadir su responsabilidad y sin realizar las acciones oportunas para mitigar el mismo o controlarlo, así como cumplir con los requisitos que se indican en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, publicado en el ALCANCE No. 171 a la GACETA No. 151 del miércoles 10 de agosto del 2022, para que el AyA asuma la recepción correspondiente previo al cumplimiento de los requisitos establecidos en la normativa.

Así mismo, debe considerarse lo ya valorado por la Procuraduría General de la República mediante C-257-2003 San José, 27 de agosto de 2003 (concordante con la valoración de fondo realizada por la Sala Constitucional en el Expediente 16002436-0007-CO resolución 2016-006368) respecto al requisito de constatación de idoneidad técnica de las plantas de tratamiento de aguas negras por el AyA y el Ministerio de Salud. Con la aceptación de parte de la Municipalidad, para que se habilite el traspaso deben cumplirse los requisitos que este Instituto ha definido, para autorizar el traspaso de la porción correspondiente del área de uso público donde se ubique la planta al Instituto Costarricense de Acueductos y Alcantarillados para que este pueda administrarlo y operarlo. En este sentido, el Dictamen antes citado indica:

“…El Instituto Costarricense de Acueductos y Alcantarillados es el ente que determina, con base en lo que dispone la norma transcrita, cuándo deben las urbanizaciones contar con plantas de tratamiento de aguas negras. A las municipalidades les compete, en este tema, vigilar que los proyectos de urbanizaciones a realizar en su cantón cumplan con las normas indicadas por el AyA en materia de acueductos y cloacas, lo que incluye que tengan previstas las plantas de tratamiento de aguas negras, cuando el AyA así lo haya ordenado.

Una vez construida las obras y al momento de su aceptación, las municipalidades ejercen control en relación con el cumplimiento de las disposiciones normativas correspondientes, entre ellas, las que tienen que ver con las instalaciones de agua potable y de recolección y evacuación de aguas negras ordenadas por el Instituto Costarricense de Acueductos y Alcantarillados, y demás entidades públicas competentes, todo de conformidad con lo que establece el artículo VI.6. del Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, el cual establece:

“ VI.6. Aceptación de obras:

La aceptación de las obras y de las áreas públicas se efectuará conforme a las disposiciones reglamentarias que tengan en vigor la municipalidad del cantón y los demás organismos públicos que al respecto ejerzan funciones de control. Ninguna omisión de detalles en los planos aprobados libera al urbanizador y al profesional responsable de las obligaciones que les conciernen en cuanto al total y satisfactoria entrega de las obras, al tenor de lo establecido en este reglamento.

El urbanizador y el profesional responsable que firman la solicitud de visado de los planos de construcción, son garantes de la estricta conformidad de las obras con los requisitos reglamentarios exigible, conforme a lo indicado en las leyes aplicables.” En otras palabras, si bien las municipalidades no operan ni mantienen los sistemas de recolección y evacuación de aguas negras, controlan que las urbanizaciones, y las edificaciones que en ellas se construyan, cumplan con las disposiciones que el Instituto Costarricense de Acueductos y Alcantarillados, y demás entes públicos competentes, hayan establecido en relación con dichos sistemas, para así cumplir con su papel de tutelar la salud y el ambiente en su cantón (…)

(…) aunque el numeral 40 de la Ley de Planificación Urbana señala que las municipalidades podrán autorizar el traspaso indicado, lo cierto es que, a menos que este ejerciendo aquella competencia residual de que se habló líneas arriba y, consecuentemente, administre y opere directamente el sistema de agua potable y recolección y evacuación de aguas negras respectivo, están obligadas a autorizar dicha cesión a favor del ente competente, que como ya hemos dicho y concluiremos de seguido, es el Instituto Costarricense de Acueductos y Alcantarillados, para que este pueda administrar y operar el sistema, una vez comprobada, al momento de entrega de la obra por el constructor, sea este un sujeto de derecho público o privado, que se cumplen las disposiciones técnicas contempladas en la normativa y dadas por el propio AyA y el Ministerio de Salud, tal y como ha sido explicado ya.

Es decir, que constatada la idoneidad técnica de las plantas de tratamiento de aguas negras por el AyA y el Ministerio de Salud, la municipalidad debe aceptar la obra y autorizar el traspaso de la porción correspondiente del área de uso público donde se ubique la planta al Instituto Costarricense de Acueductos y Alcantarillados en razón de lo que disponen las normas que atribuyen la competencia para administrar y operar los sistemas de agua potable y recolección y evacuación de aguas negras y residuales a dicho Instituto, que ya han sido citadas, si no se está en un caso en el cual la municipalidad de que se trate lo vaya a operar y administrar en ejercicio de la competencia residual a que ya se hizo referencia….” Debe considerarse que ya esta Sala Constitucional, ha dictaminado anteriormente ( Exp: 11-010057-0007-CO Res. Nº 2012017743 a las nueve horas treinta minutos del catorce de diciembre de dos mil doce) que este Instituto asume una vez constatados los requisitos de recepción y hasta que ellos no se cumplan, la Municipalidad debe continuar asumiendo su responsabilidad:

“…Dentro de los requisitos previos que la Municipalidad debe observar, nos encontramos con lo dispuesto por el artículo 21 de la Ley Constitutiva del Instituto de Acueductos y Alcantarillados, Ley 2726 del 14 de abril de 1971, que le atribuye al ICAA la competencia para aprobar “Todo proyecto de construcción, ampliación o modificación de sistemas de abastecimiento de agua potable y disposición de aguas servidas y pluviales, público o privado (…) Dicha aprobación previa será obligatoria en todos los casos de construcción de fraccionamientos, urbanizaciones o lotificaciones en cualquier parte del país y ningún otro organismo estatal otorgará permisos o aprobaciones de construcción sin tal aprobación por parte del Instituto. La infracción de este mandato ocasionará la nulidad de cualquier permiso de construcción otorgada en contravención de esta prohibición(…)”, de tal manera que ningún ente público, entre ellos las municipalidades podrán otorgar permisos de construcción, si previamente el ICAA no ha recibido a satisfacción las obras de infraestructura de acueductos y de alcantarillado sanitario, según los planos aprobados y previo cumplimiento de todas las especificaciones técnicas que conforme con la legislación y reglamentación vigente exija a los desarrolladores el ICAA…a pesar de que el ICAA no ha recibido a satisfacción las obras de la planta de tratamiento y el desarrollador ni siquiera ha cumplido con todas las especificaciones técnicas indicadas mediante diversas notas por los órganos internos del ICAA, como requisito previo para la aprobación de los planos del proyecto; solo se explica por el incumplimiento o inobservancia de otras instituciones entre ellas, el INVU y la Municipalidad de la normativa legal existente.

En igual sentido, el hecho de que a pesar de ubicarse el Proyecto en una zona ambientalmente sensible y de que el INVU señalara desde el principio la necesidad de que se contara con alcantarillado sanitario y se haya otorgado permisos para construcción de viviendas con tanque séptimo y drenaje individual, poniendo en riesgo las aguas subterráneas, solo se explica porque la Municipalidad ha incumplido la normativa legal y técnica vigente. En consecuencia, la Sala acoge el recurso de amparo respecto de la Municipalidad de San Isidro y ordena lo siguiente: Suspender el otorgamiento de permisos de construcción en los Proyectos Lomas Verdes del Zurquí y Lomas del Zurquí hasta tanto, el ICAA no haya recibido a satisfacción del desarrollador las obras de acueducto y alcantarillado sanitario…” PETITORIA Tome en cuenta la Sala Constitucional las actuaciones que ha ejecutado el Instituto Costarricense de Acueductos y Alcantarillados en cumplimiento de sus fines y en el marco de sus competencias, por lo que, de forma evidente no ha desobedecido, violentado normas, garantías o principios constitucionales, ni ambientales, por lo que debe declararse sin lugar el recurso presentado en todos sus extremos en contra de AyA”.

  1. 8Informa bajo juramento Ronald Enrique Mora Solano, en su condición de director del Área Rectora de Salud Alajuela 2, lo siguiente:

“En atención a la audiencia conferida dentro del expediente 24-021588-0007-CO, según lo requerido mediante resolución de las once horas treinta y ocho minutos del treinta de setiembre de dos mil veinticuatro, emitida por la Sala Constitucional de la Corte Suprema de Justicia, se apersona a la planta de tratamiento de aguas residuales (PTAR) de la Urbanización San Charbel, la señora Nombre05, Gestora Ambiental, funcionaria del Área Rectora de Salud Alajuela 2, emitiéndose el acta de inspección ocular N° MS-DRRSCN-DARSA2-3084-2024 y el informe técnico contenido en el oficio MS-DRRSCN-DARSA2-3164-2024.

Que el día de la visita, la señora Nombre04, vecina de la zona, atiende a la señora Nombre05, a continuación se presentan las actuaciones ejecutadas:

1. El 22 de noviembre del 2024, según consta en el acta de inspección ocular N° MS-DRRSCNDARSA2-3084-2024, al ser las 11:50 am, se realizó visita a la planta de tratamiento de aguas residuales (PTAR) de la Urbanización San Charbel, en donde la señora Nombre04, vecina de la zona atiende la diligencia.

2. La señora Nombre03 indica que la planta dejó de funcionar aproximadamente hace 04 meses debido a la falta de mantenimiento, sin embargo, como vecinos están realizando las obras necesarias para reactivar el funcionamiento, además, la señora indica que los vecinos no pueden continuar con el mantenimiento de la planta debido al costo, por lo cual solicitan que el propietario en este caso la Municipalidad de Alajuela se encargue del mantenimiento diario de dicha planta.

3. Posteriormente en compañía de la señora Nombre03, nos apersonamos a las instalaciones de la planta de tratamiento de aguas residuales (PTAR), para valorar los hechos alegados por el amparista.

Se efectúa una valoración de los hechos alegados por la recurrente los cuales se detallan en el siguiente cuadro:

La señora Nombre03 brindó la siguiente información:

• La bomba eléctrica se encuentra en mantenimiento.

• Se debe cambiar el filtro, y dar mantenimiento a las fajas.

• Se realizó el cambio de la caja de Breaker debido a que está se dañó.

Para retomar la operación de la planta se debe realizar los cambios que hacen falta y costear una cisterna de aguas residuales para que se encargue del tratamiento de estas, acumuladas hasta el momento.

4. En virtud de la visita de inspección efectuada se concluye, que la Planta de Tratamiento de Aguas Residuales no se encuentra en funcionamiento por lo cual genera un riesgo a la salud pública y al ambiente, por esta razón se solicita a la Municipalidad de Alajuela mediante la orden sanitaria MS-DRRSCN-DARSA2-OS-271-2024, lo siguiente:

“Expuesto lo anterior, el responsable de realizar el mantenimiento al sistema de saneamiento, hasta tanto no se haga el traslado correspondiente al AyA según la legislación vigente corresponde al propietario del sistema de tratamiento, por lo cual se le solicita a la Municipalidad de Alajuela proceder a:

1. Reactivar el funcionamiento y mantenimiento de la planta de tratamiento de aguas residuales de la Urbanización San Charbel. Presentar ante el Área Rectora de Salud Alajuela 2 la evidencia de las acciones realizadas.

2. El funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente mediante la presentación de Reportes Operacionales y cumplimiento en sitio con las características del reglamento Nº 33601.” 5. Que dicha orden sanitaria MS-DRRSCN-DARSA2-OS-271-2024 fue debidamente notificada mediante correo electrónico de fecha 25 de noviembre del 2024 y se le otorgaron 10 días hábiles para su cumplimiento.

Esta Dirección se mantiene expectante ante lo indicado en la orden sanitaria MS-DRRSCN-DARSA2-OS-271-2024 ya citada dentro del plazo otorgado.

Por lo antes expuesto, respetuosamente hace saber esta instancia a esa Honorable Sala Constitucional, que el Ministerio de Salud ha actuado conforme el ordenamiento jurídico vigente y según sus competencias, de forma diligente en gestionar de forma oportuna y según el trámite interno administrativo correspondiente, por lo cual se han diligenciado de forma oportuna, no nos hemos extralimitado en plazos irrazonables o en una duración excesiva e injustificada”.

  1. 9En resolución de las 11:32 horas del 11 de diciembre de 2024, se solicita prueba para mejor resolver.
  2. 10Informa bajo juramento Ronald Enrique Mora Solano, en su condición de director del Área Rectora de Salud Alajuela 2, lo siguiente:

“El Área Rectora de Salud Alajuela 2 emitió la Orden Sanitaria MS-DRRSCN-DARSA2-OS-0271-2024, notificada el 25 de noviembre del 2024 al señor Roberto Thompson Chacón alcalde la Municipalidad de Alajuela, solicitando en un plazo de 10 días hábiles lo siguiente: “1. Reactivar el funcionamiento y mantenimiento de la planta de tratamiento de aguas residuales de la Urbanización San Charbel. 2. El funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente mediante la presentación de Reportes operacionales y cumplimiento en sitio con las características del reglamento No.33601.” Con fecha del 12 de diciembre del 2024, la Municipalidad de Alajuela notificó al Área Rectora de Salud Alajuela 2 el “Recurso de Revocatoria con Apelación en subsidio e incidente de nulidad de la Municipalidad de Alajuela contra la orden sanitaria N°MS-DRRSCN-DARSA2-OS-0271-2024, emitida por el Ministerio de Salud”. Dicha información se trasladó el 13 de diciembre del 2024 al Departamento de Asuntos Jurídicos de la Dirección Regional de Rectoría de la Salud Central Norte para su resolución.

Que esta Dirección de Área Rectora, no evidencia actuaciones por parte de la Municipalidad de Alajuela, que constaten el cumplimiento de la orden sanitaria MS-DRRSCN-DARSA2-OS-0271-2024.

Sobre este tema resulta de importancia medular señalarle a esta respetable Sala, que la fase recursiva no suspende la ejecución del acto, lo anterior queda establecido en el 61 de la Ley Orgánica del Ministerio de Salud, No. 5412 que indica:

“Artículo 61.- El establecimiento de los recursos no suspende la ejecución del acto requerido, a menos que, en casos muy calificados, en forma razonada, el Titular de la Cartera, interlocutoriamente y para evitar un resultado irreparable, ordene la suspensión provisional del acto, lo cual hará, en todo caso, bajo su responsabilidad.” (…) Que el 20 de diciembre del 2024 mediante correo electrónico, la señora Nombre04, vecina de la Urbanización San Charbel, informa a esta Área Rectora de Salud que la planta de tratamiento ya se encuentra en funcionamiento, dicha acción ha sido cubierta con presupuesto de los residentes de la urbanización, además aportan la documentación que respalda las acciones realizadas.

El 06 de enero del 2025, según consta en el acta de inspección ocular N° MS-DRRSCN-DARSA20001-2025, al ser las 10:30 am, se realiza visita a la planta de tratamiento de aguas residuales (PTAR) de la Urbanización San Charbel, atiende la señora Nombre04, residente de la zona, y se inspeccionan las instalaciones de la PTAR para valorar los hechos alegados por la recurrente.

1. Respecto al criterio solicitado por la Sala Constitucional, se presenta el siguiente cuadro:

Aspecto por valorar Situación encontrada Planta de Tratamiento de Aguas Residuales Se evidencia que la planta se encuentra en funcionamiento. Los residentes de la urbanización San Charbel realizaron la contratación de una empresa para que realizara el mantenimiento y operación de la Planta de Tratamiento.

La señora Nombre03 nos brindó la siguiente información, mediante informe que le brindó la empresa contratada:

• Se realizó el mantenimiento y reinstalación de la bomba eléctrica.

• Se ha cambiado la manguera de descarga por tubería de mayor diámetro.

• Se ha cambiado las fajas de transmisión del soplador. Las fajas “viejas” todavía están en estado aceptable, de manera que se almacenan para el caso de un eventual fallo. Se ha cambiado el aceite del soplador. Quedan 2 galones de aceite para los próximos cambios.

• Colocación de caja impermeable de conexión eléctrica.

• Se realizó el mantenimiento del filtro.

• Se colocó una válvula en la descarga de lodos del lecho del secado.

• Se realizó el cambio del timer.

• Se realizó la limpieza del digestor de lodos cuya capacidad es de 1.65 m3 / El digestor sedimentador secundario cuya capacidad es de 15.7 m3.

Por lo antes expuesto, se concluye que, los residentes de la Urbanización San Charbel reactivaron el funcionamiento de la Planta de Tratamiento de Aguas Residuales.

Que según lo arriba indicado, lo establecido en la orden sanitaria N°MS-DRRSCN-DARSA2-OS-02712024 ya citada, dirigida a la Municipalidad de Alajuela, no se evidencian acciones por parte de esta ante lo ordenado por esta autoridad sanitaria, recordando que según lo establecido en el artículo 61 de la Ley Orgánica del Ministerio de Salud, No. 5412, la interposición de recursos de suspende la ejecución del acto administrativo materializado a través de la orden sanitaria de marras”.

  1. 11En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. La recurrente alega que es vecina de la urbanización San Charbel, ubicada en la Guácima de Alajuela y la planta de tratamiento de la comunidad está en un terreno municipal y se encuentra sin mantenimiento. Señala que esto provocó que dejará de funcionar y un grave problema ambiental y a la salud, por lo que la Ministerio de Salud emitió una orden sanitaria. Indica que mediante trámite No. 4530-2023 se denunció el problema descrito ante el gobierno local recurrido; sin embargo, a la fecha en que acude en amparo la problemática persiste. Por lo anterior estima vulnerados sus derechos fundamentales y de los vecinos de la comunidad.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El 16 de enero de 2023, la Alcaldía de Alajuela recibió el Trámite No. 4530-2023 suscrito por los Vecinos de Urbanización San Charbel, ubicada en Rincón Chiquito, La Guácima, mediante el cual exponen la situación que les afecta con respecto a la planta de tratamiento de aguas residuales (véase informe del alcalde de Alajuela recurrido, agregado al expediente digital).
  • b)El terreno donde se encuentra ubicada la Planta de Tratamiento de Urbanización San Charbel se trata de un área comunal a nombre de la Municipalidad de Alajuela (véase informe del alcalde de Alajuela recurrido, agregado al expediente digital).
  • c)La alcaldía de Alajuela solicitó el criterio de distintos departamentos municipales y se concluyó que la planta de tratamiento debe ser trasladada al Instituto Costarricense de Acueductos y Alcantarillado, pero no se ha realizado la gestión correspondiente ante esa institución (véase informe del alcalde de Alajuela recurrido, agregado al expediente digital).
  • d)La Municipalidad de Alajuela es la responsable en la determinación de las medidas requeridas para solucionar el problema de administración de la planta de tratamiento de aguas residuales, quien a su vez aprobó en su momento el desarrollo urbanístico en dicha zona y en caso de decidir trasladar la administración al Instituto Costarricense de Acueductos y Alcantarillados, debe cumplir con lo dispuesto en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, publicado en el ALCANCE No. 171 a la GACETA No. 151 del miércoles 10 de agosto del 2022 (véase informe del presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillado recurrido, agregado al expediente digital).
  • e)El 22 de noviembre de 2024, el Área Rectora de Salud de Alajuela 2 realizó una inspección a la planta de tratamiento de aguas residuales de la Urbanización San Charbel y se concluyó no se encuentra en funcionamiento y genera un riesgo a la salud pública y al ambiente, por lo que se emitió la orden sanitaria No. MS-DRRSCN-DARSA2-OS-271-2024, mediante la cual se ordenó a la Municipalidad de Alajuela lo siguiente: “1. Reactivar el funcionamiento y mantenimiento de la planta de tratamiento de aguas residuales de la Urbanización San Charbel. Presentar ante el Área Rectora de Salud Alajuela 2 la evidencia de las acciones realizadas. 2. El funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente mediante la presentación de Reportes Operacionales y cumplimiento en sitio con las características del reglamento Nº 33601” (véase informe del director del Área Rectora de Salud Alajuela 2 recurrido, agregado al expediente digital).
  • f)El 25 de noviembre del 2024, la orden sanitaria No. MS-DRRSCN-DARSA2-OS-271-2024 fue notificada a la Municipalidad de Alajuela y se le otorgaron diez días hábiles para su cumplimiento (véase informe del director del Área Rectora de Salud Alajuela 2 recurrido, agregado al expediente digital).
  • g)El 20 de diciembre del 2024, la planta de tratamiento fue puesta en funcionamiento por parte de los vecinos de la comunidad (véase informe del director del Área Rectora de Salud Alajuela 2 recurrido, agregado al expediente digital).

IV.Sobre el derecho fundamental a un ambiente sano y ecológicamente equilibrado. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

V.Sobre el caso concreto. En el presente asunto, la recurrente alega que es vecina de la urbanización San Charbel, ubicada en la Guácima de Alajuela y la planta de tratamiento de la comunidad está en un terreno municipal y se encuentra sin mantenimiento. Señala que esto provocó que dejará de funcionar y un grave problema ambiental y a la salud, por lo que la Ministerio de Salud emitió una orden sanitaria. Indica que mediante trámite No. 4530-2023 se denunció el problema descrito ante el gobierno local recurrido; sin embargo, a la fecha en que acude en amparo la problemática persiste. Por lo anterior estima vulnerados sus derechos fundamentales y de los vecinos de la comunidad.

Al respecto, después de analizar los elementos probatorios aportados y los informes rendidos bajo juramento por las autoridades recurridas, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, se tiene acreditado que la Municipalidad de Alajuela tiene conocimiento de la problemática de la planta de tratamiento de aguas residuales alegada por la promovente desde el 16 de enero de 2023, bajo el trámite No. 4530-2023 suscrito por los Vecinos de Urbanización San Charbel. También, que el terreno donde se encuentra ubicada la Planta de Tratamiento de Urbanización San Charbel se trata de un área comunal a nombre de la Municipalidad de Alajuela. Ahora, justifican las autoridades municipales accionadas que la alcaldía solicitó el criterio de distintos departamentos municipales y se concluyó que la planta de tratamiento debe ser trasladada al Instituto Costarricense de Acueductos y Alcantarillado, pero no se ha realizado la gestión correspondiente ante esa institución.

Por su parte, el presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillado informa que la Municipalidad de Alajuela es la responsable en la determinación de las medidas requeridas para solucionar el problema de administración de la planta de tratamiento de aguas residuales, quien a su vez aprobó en su momento el desarrollo urbanístico en dicha zona y en caso de decidir trasladar la administración al Instituto Costarricense de Acueductos y Alcantarillados, debe cumplir con lo dispuesto en el Reglamento de Aprobación y Recepción de Sistemas de Saneamiento Acuerdo No. 2022-354 de la Junta Directiva del AyA, publicado en el ALCANCE No. 171 a la GACETA No. 151 del miércoles 10 de agosto del 2022.

Ahora, se tiene que el 22 de noviembre de 2024, el Área Rectora de Salud de Alajuela 2 realizó una inspección a la planta de tratamiento de aguas residuales de la Urbanización San Charbel y se concluyó no se encuentra en funcionamiento y genera un riesgo a la salud pública y al ambiente, por lo que se emitió la orden sanitaria No. MS-DRRSCN-DARSA2-OS-271-2024, mediante la cual se ordenó a la Municipalidad de Alajuela lo siguiente: “1. Reactivar el funcionamiento y mantenimiento de la planta de tratamiento de aguas residuales de la Urbanización San Charbel. Presentar ante el Área Rectora de Salud Alajuela 2 la evidencia de las acciones realizadas. 2. El funcionamiento del sistema de tratamiento de aguas residuales deberá realizarse acatando la normativa técnica vigente mediante la presentación de Reportes Operacionales y cumplimiento en sitio con las características del reglamento Nº 33601”. En ese sentido, se colige que el 25 de noviembre del 2024, la orden sanitaria No. MS-DRRSCN-DARSA2-OS-271-2024 fue notificada a la Municipalidad de Alajuela y se le otorgaron diez días hábiles para su cumplimiento.

Ante este panorama, se tiene por constatada la acusada inacción de las autoridades municipales, pues si bien determinaron las acciones que requieren realizar, lo cierto del caso es que actualmente la situación denunciada se mantiene, en el sentido que no han realizado las gestiones correspondientes para solucionar la problemática de la planta de tratamiento ni tampoco su traslado ante el Instituto Costarricense de Acueductos y Alcantarillados –a quienes afirman son los que deberían darle el manteamiento–. Lo anterior, a pesar de que tienen conocimiento de la problemática en cuestión desde el 2023, sin que conste que se haya tomado ninguna otra medida, que exista ninguna solución con certeza del problema denunciado por la recurrente, o que se haya definido una fecha para resolver dicha problemática. Bajo tal estado de las cosas, nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad, y se constata que la Municipalidad de Alajuela ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja.

En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. La persistencia del problema demuestra que las pocas acciones realizadas han sido claramente insuficientes.

Debido a lo expuesto, lo procedente es la estimatoria del recurso a efecto que las autoridades de la Municipalidad de Alajuela emitan las órdenes y lleven a cabo las actuaciones respectivas dentro del ámbito de sus competencias, a fin de solucionar de forma definitiva el problema denunciado por la parte recurrente y constatado por las autoridades sanitarias traídas al proceso de amparo. Ahora, si bien el 20 de diciembre del 2024 la planta de tratamiento fue puesta en funcionamiento, lo cierto es que fue por parte de los vecinos de la comunidad, lo cual no implica que las autoridades municipales deban de llevar las gestiones correspondientes para la situación expuesta en el presente proceso sea subsanada de forma definitiva, pues aluden que deben gestionar que la planta de tratamiento sea administrada por el Instituto Costarricense de Acueductos y Alcantarillados.

VI.Por otra parte, es menester indicar que no se observa alguna acción u omisión por parte de las autoridades sanitarias, quienes por su parte teniendo pleno conocimiento de la problemática que afecta a los pobladores del sector, se han encargado de brindar seguimiento al caso, constatar su existencia y emitir la orden sanitaria del caso. De igual manera respecto al Instituto Costarricense de Acueductos y Alcantarillados, dado que no se colige que sean los responsables de darle el mantenimiento a la planta de tratamiento de aguas residuales. Así las cosas, lo que procede es desestimar el recurso en cuanto a tales autoridades.

VII.Nota del magistrado Salazar Alvarado. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que es vecina de la urbanización San Charbel, ubicada en la Guácima de Alajuela y la planta de tratamiento de la comunidad está en un terreno municipal y se encuentra sin mantenimiento, lo que provocó que dejará de funcionar y un grave problema ambiental y a la salud, por lo que denunció el problema descrito ante el gobierno local recurrido; sin embargo, a la fecha en que acude en amparo la problemática persiste, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VIII.Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en el plazo de seis meses, contado a partir de la notificación de esta sentencia, se le dé atención definitiva e integral por parte de la Municipalidad de Alajuela a las denuncias planteadas por la parte recurrente respecto a la planta de tratamiento de aguas residuales de la Urbanización San Charbel. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

IX.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso, únicamente, en contra la Municipalidad de Alajuela. Se ordena a Roberto Hernán Thompson Chacón, a Roy Delgado Alpízar, a Luis Francisco Alpízar Barrantes y a José Luis Chacón Ugalde, en sus respectivas condiciones de alcalde de Alajuela, director de Planeamiento y Construcción de Infraestructura, coordinador del Subproceso Saneamiento Municipal y coordinador del Proceso de Acueducto y Saneamiento, todos de la Municipalidad de Alajuela, o a quienes ocupen dichos cargos, dentro del plazo de SEIS MESES contado a partir de la notificación de esta sentencia, realicen en forma coordinada y conjunta con el Instituto Costarricense de Acueductos y Alcantarillados y el Área Rectora de Salud Alajuela 2, los actos necesarios para eliminar la problemática denunciada por la parte recurrente sobre la planta de tratamiento de aguas residuales. Se advierte a las autoridades recurridas, o a quienes ocupen su cargo, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en el proceso de ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
