Document Review Decision No. 2024-024395 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at thirteen hours and forty-five minutes on August twenty-third, two thousand twenty-four.

Optional judicial consultation filed by Juan Carlos Jiménez Marín, in his capacity as Substitute Criminal Judge of the Tribunal Penal de Pococí, by means of a decision issued at 15:41 hours on May 29, 2024, within case file N° 21-000318-1263-PE, a criminal proceeding brought against [Nombre01 001] for the offense of “Illegal Trafficking in Hazardous, Bioinfectious, or Radioactive Waste or Substances,” with respect to Articles 7 (illegal transportation and distribution of petroleum-derived fuels or mixtures thereof), 17 (seizure of petroleum-derived fuels), and 20 (regulations implementing this law), contained in the “Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas”, Ley N° 9852 of June 16, 2020.

Background:

  1. 1In a submission received by the Chamber’s Secretariat at 13:26 hours on June 19, 2024, and pursuant to Articles 8, subsection 1), of the Ley Orgánica del Poder Judicial; 2, subsection b); 3, 13, 102, and 104 of the Ley de la Jurisdicción Constitucional, the consulting court requests that this Chamber rule on its doubts concerning the constitutionality of Articles 7, 17, and 20 of the Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas. The constitutional concern lies in the fact that Article 7 of the aforementioned Law purportedly violates the principle of specificity in criminal law (principio de tipicidad), because, in defining the indicated conduct as an offense, it penalizes the illegal transportation of fuel without specifying what constitutes lawful transportation. The provision is even more confusing when it states “or without due authorization from RECOPE or MINAE,” because the purpose of the law would be set forth in Article 1°, which states that it penalizes “unlawful activities related to the illegal appropriation of fuels,” as well as “the illegal introduction of fuels” “into the national territory.” The constitutional issue arises when gasoline is purchased lawfully (at a gas station) and transported on public roads, which would not permit the elements of the offense (configuración típica) under the challenged Article 7 to be established.Article 20 is likewise questioned because it states that the “absence of implementing regulations shall not prevent the application of this law or mandatory compliance therewith,” thereby raising problems under the principle of specificity, since it requires the application of a criminal offense (tipo penal) that violates that principle. Finally, although the return of property that was lawfully acquired at a gasoline outlet and transported by a third party may be requested, the time required to resolve the criminal proceeding results in the loss of that property because the seized product deteriorates.
  2. 2Despite the notice granted to the parties in the principal matter by the unnumbered decision issued at 15:41 hours on May 29, 2024, by Substitute Trial Judge MSc. Juan Carlos Jiménez Marín of the Tribunal Penal del II Circuito Judicial de la Zona Atlántica, the parties did not appear before the Chamber.
  3. 3By decision issued at 12:32 hours on June 21, 2024, the Presidency of the Chamber ordered the consulting judge, Juan Carlos Jiménez Marín, to state, within twenty-four hours and with the warning that the consultation would not be processed in the event of noncompliance, whether the court hearing case file N° 21-000318-1263-PE was a single-judge or collegiate body. In a submission filed at 01:05 hours on June 24, 2024, the Judge informed the Chamber that the case in question was being heard by a single-judge body.
  4. 4By order issued at 14:57 hours on June 24, 2024, the Presidency of the Chamber admitted the consultation for processing and granted a hearing to the Procuraduría General de la República.
  5. 5Iván Vinicio Vincenti Rojas, Procurador General de la República, responded to the hearing granted, stating that he had doubts regarding the admissibility of the judicial consultation submitted. He explained that, unlike constitutional challenges (acciones de inconstitucionalidad), which are driven by a personal interest, judges’ constitutional consultations must be entirely objective, with the aim of helping ensure that the legal system conforms to the constitutional order. Accordingly, there must be a genuine constitutional doubt, and the consultation must be duly reasoned. He maintains that the consultation concerning Articles 17 and 20 of Ley N° 9852 is improper because the consulting judge need not apply them to the specific case. He further states that “… it is necessary to point out an aspect of the present consultation that warrants attention, namely that the issue raised is not new, because precisely in case file 22-000391-0007-CO (in which the action was summarily dismissed), the same constitutional challenge was processed after being submitted on that occasion by Lic. George Paisano Saborío, who is in fact acting as attorney for the Civilly Liable Third Party (Tercero Interesado Civil) in criminal case 21-000318-1263-PE, the underlying case giving rise to the consultation filed by the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí seat. Of particular note is the fact that the wording of the filing initiating that action contains passages very similar to those submitted by the consulting Court.

As evidence of the foregoing, it may be observed that the action filed by Lic. Paisano Saborío in 2022, when challenging Articles 7, 17, and 20 of Ley 9852, contains wording that is reproduced in the consultation submitted by the judge, such that we question whether the original challenge is the judge’s own work. For example, in the second, third, fourth, fifth, and sixth recitals (considerandos) of the consultation submitted by the Trial Court, the legal reasoning is identical to that appearing in sections of the grounds for the action filed by Lic. Paisano Saborío.

This matter is by no means insignificant, since it could mean that the consultation was not initiated exclusively by the Judicial Office and that the wording of the central challenge apparently originates instead from an attorney representing the interested third party in the underlying criminal proceeding, who had already petitioned the Sala Constitucional and whose application was summarily dismissed.

As may be observed in case file 21-000318-1263-PE, at folio 158, the trial-hearing record reflects that the interested third party represented by Lic. Paisano Saborío stated that the provision was not consistent with constitutional law and requested review of the constitutional challenge, whereupon the judge decided to submit the corresponding consultation to the Sala Constitucional.

The problem arising from the court’s ruling, and which relates to the grounds for the consultation submitted, is precisely the use of the same wording—for the central challenges—as the constitutional challenge previously filed by the attorney representing the interested third parties. Thus, the independent legal analysis required when a judge submits a constitutional consultation ceases to be the judge’s own inquiry and becomes, apparently, an echo of an action already filed and not admitted. In our view, this fails to satisfy the duty to provide reasons required of every judicial decision, and the consultation submitted should therefore be dismissed.

In light of the foregoing, this advisory and impartial Body of the Sala Constitucional believes that the judicial consultation before us suffers from certain admissibility defects (which have been duly established), and we therefore request that they be so declared and that the present judicial application be ruled inadmissible.” As to the merits, with respect to Article 7, it is necessary to weigh the act of illegally transporting or distributing petroleum-derived fuels or mixtures thereof within the national territory against Article 1° of Ley N° 9852, whose purpose is to penalize unlawful activities involving the illegal appropriation of fuels owned by Refinadora Costarricense de Petróleo. It describes the acts constituting the offense and, regarding distribution and transportation, cites opinion C-134-2011 of the Procuraduría General de la República, which states that fuel distribution is a public service and that, although transportation “by other means” is not a public service regulated under Ley N° 7536, the Reglamento para la Regulación del Transporte de Combustible, Decreto Ejecutivo 36627 of June 23, 2011, establishes that transportation of fuel by land transportation unit is a public service and that ARESEP sets the corresponding rates.

In addition, the challenged provision refers to transportation and distribution without the required permits from Recope or MINAE—that is, without the respective permits. It is an abstract-endangerment offense (delito de peligro abstracto) arising from the act of transporting fuel, an inflammable and polluting substance. The risk is inherent in the conduct undertaken, thereby protecting several legally protected interests (bienes jurídicos), such as public safety, health, and the environment. In our country, transporting fuel requires compliance with the regulations of Reglamento N° 36627-MINAE; therefore, failure to hold the required permits constitutes punishable conduct. The legislature considered that doing so without any form of authorization is an inherently hazardous activity, as provided in Article 7; moreover, the law establishes other aggravating circumstances so as to ensure that anyone transporting fuel complies with the requirements. He requests that the consultation be declared inadmissible for failure to satisfy the requirements and, on the merits, that it be denied.

Considerations:

I.Admissibility. Title IV of the Ley de la Jurisdicción Constitucional, concerning constitutional questions, establishes certain procedural remedies (remedios procesales) for correcting the legal system. Thus, private parties may safeguard the broad array of individual rights and interests implicated in their disputes by filing a constitutional challenge, while public and institutional authorities may file constitutional challenges or institute other proceedings, such as constitutional consultations, to bring before the constitutional jurisdiction constitutional conflicts they have identified. Clearly, the purpose is to ensure that an objective standard grounded in the body of constitutional law (bloque de constitucionalidad), or the Law of the Constitution (Derecho de la Constitución), prevails over the rest of the legal system, so that the former retain their supremacy, effectiveness, and direct applicability.

This is the case with a judicial consultation, which authorizes the judicial body—that is, the judge—to consult the Sala Constitucional when it has well-founded doubts concerning the constitutionality of an act or provision that it must apply in a proceeding before it. To that end, the Chamber’s case law has repeatedly established the admissibility requirements. Those prerequisites were analyzed in detail in Judgment N° 1997-01617 of this Chamber, issued at 14:54 hours on March 17, 1997, as follows:

"A. That it be submitted by a “judge” (juez), a generic term that—of course—applies both to single-judge courts and to multi-judge panels, regarding which it is unnecessary to specify anything beyond the following: a) the authorities must be vested with judicial power (poder jurisdiccional), which excludes consultations submitted by administrative tribunals but does include those submitted by arbitrators in matters subject to their decision (it should be noted that what is relevant in every case is that proceedings are underway that will culminate in a judgment or arbitral award having the authority of res judicata (cosa juzgada)); and b) at the time the consultation is submitted, the judge must be duly authorized to exercise that jurisdiction (since it could hardly be maintained that a ruling that is invalid in the proceeding in question could have the effect of initiating a procedure that, like this one, is purely incidental in nature).

B. That there be “well-founded doubts” (dudas fundadas) concerning the constitutionality of the provision, act, conduct, or omission that must be applied or adjudicated. This means that the challenge must be reasonable and carefully considered. It also means that it cannot concern matters on whose constitutionality the Chamber has already ruled. This is so not only because accepting otherwise would entail disregarding the erga omnes effect of the decisions of this jurisdiction, but also because a consultation under such circumstances would clearly lack a current interest. However, it should be emphasized, given its relevance to the matter under examination (sub examine), that the circumstance described arises only from those rulings in which the Chamber has expressly confirmed that the provision, act, conduct, or omission conforms to constitutional standards. Consequently, if a provision has previously passed an explicit constitutional review (whether through a constitutional challenge (acción de inconstitucionalidad) or a consultation), a new challenge on the same point would not be viable, although a challenge concerning an act, conduct, or omission based on the same provision could be, particularly because—in that case—there always remains the possibility of a constitutional violation, not in the provision itself, but in its interpretation or application.

Conversely, the fact that an act, conduct, or omission has previously been upheld (perhaps through an amparo proceeding (amparo) or habeas corpus (hábeas corpus)) does not mean that doubts cannot exist concerning the constitutionality of the provision itself on which they are based. In that situation, the judicial consultation (consulta judicial) is appropriate.

C. That there be a case pending before the judge or court. As with a constitutional challenge, a judicial consultation never arises in a vacuum or from merely academic interest; rather, it must be relevant to the decision or resolution of the so-called “underlying” or “principal” matter. Finally, D. That, in that underlying matter, the provision must be applied or the act, conduct, or omission giving rise to the constitutional doubt must be adjudicated, an aspect that—because of its relevance to the case—should be clarified. Indeed, the phrase “the provision must be applied or the act, conduct, or omission must be adjudicated” has a very definite present-tense meaning, entirely different from what it would have if the law stated that “the provision may be applied or the act, conduct, or omission may be adjudicated.” A judicial consultation is not appropriate based merely on the possibility that those circumstances may arise, since—as explained above—such an approach would be equivalent to devoting the resources of the constitutional jurisdiction to a merely academic or doctrinal exercise.

For the consultation to be viable, the judge must be faced, with certainty and at the present time, with applying the provision or adjudicating the act, conduct, or omission that gives rise to a constitutional doubt.” What is required is a review of the admissibility requirements (presupuestos de admisibilidad) for the consultation submitted by the Substitute Criminal Judge of the Tribunal Penal de Pococí, by means of the ruling issued at 15:41 hours on May 29, 2024, in expediente N° 21-000318-1263-PE, as noted by the Procuraduría General de la República.

II. Grounds for the judicial consultation

This Chamber has declared judicial consultations incapable of being answered (inevacuables) when their stated grounds are deficient, as well as when certain other defects affect the rulings through which the consultations are submitted. The Chamber likewise so held regarding formal defects, including those concerning the hearing granted to the parties so that they could appear before the Sala Constitucional.

Sentencia N° 2015-13860 de las 9:25 horas del 2 de septiembre de 2015 held that:

“In the case under review, the matter raised by the Judge does not satisfy all the formal requirements imposed by the Ley de la Jurisdicción Constitucional. Article 104 clearly provides that the consulting judge must issue a ruling identifying, with supporting grounds, the provision or act that gives rise to the doubt and, in addition, the reasons supporting that doubt. The judge must also summon the parties to appear before this Court if they so wish and stay the proceedings until the Chamber rules.” In another ruling, Sentencia N° 2015-17352 de las 9:30 horas del 4 de noviembre de 2015, the Chamber held that:

“A constitutional consultation (consulta de constitucionalidad) is a mechanism that allows a judge, when doubts arise regarding the constitutionality of one or more provisions that must be applied in a specific case, to request that the Chamber resolve those doubts, after first providing information that substantiates and explains the question raised. Article 104 clearly provides that the consulting judge must issue a ruling identifying, with supporting grounds, the provision or act that gives rise to the doubt and, in addition, the reasons supporting that doubt.” Sentencia N° 2022-20359, de las 9:30 horas del 31 de agosto de 2022 stated that:

“In this specific case, the consulting judges submitted this consultation by means of a ruling issued in criminal proceeding n.° [Valor 001]. This complies only partially with Article 102 of the Ley de la Jurisdicción Constitucional, since nothing stated by that court shows that the question truly involves a doubt that is well-founded and reasonable on constitutional grounds.”

III. Submission of the consultation and the problems arising from its origin

Upon carefully analyzing each of the admissibility requirements set forth above, the Procuraduría General de la República, in its capacity as adviser to the Sala Constitucional, notes that the claims of unconstitutionality repeat those raised in another constitutional challenge brought against Articles 7, 17, and 20 of Ley N° 9852, processed under Sala Constitucional expediente N° 22-000391-0007-CO.

Accordingly, this Sala Constitucional undertook to verify the accuracy of the Procuraduría General’s statement, which enabled it to determine that the wording is indeed identical and concerns the same underlying matter N° 21-000318-1263-PE. Although the Chamber confirms the advisory body’s warning, through this conduct the consulting judge plainly perpetuates the deficiency affecting the grounds for the constitutional challenge that was previously sought to be brought before the Sala Constitucional. Clearly, no genuine grounds are provided for the doubt the judge claims to have, because the judge merely transcribes a submission that was considered in a constitutional challenge summarily dismissed by Sentencia N° 2022-05564 de las 9:20 horas del 9 de marzo de 2022. Nevertheless, the petitioner in that action expressed disagreement by requesting clarification and supplementation (aclaración y adición); that request was resolved by Sentencia N° 2022-07432 a las 9:45 horas del 30 de marzo de 2022 with respect to the procedural and substantive matters that, in the petitioner’s view, had been omitted from the ruling.

Thus, under Article 104 of the Ley de la Jurisdicción Constitucional, the judge must issue a ruling identifying, with supporting grounds, the provision or act that gives rise to the doubt and, in addition, the reasons supporting that doubt. Consequently, this Chamber faces the difficulty that, given that the same application was resolved by Sentencia N° 2022-05564 de las 9:200 horas del 9 de marzo de 2022 and by resolución 2022-07432, de las 9:45 horas del 30 de marzo de 2022, the reuse of the same written submission also entails a failure to state reasons, which would undermine the very purpose of the consultation, in addition to the obvious fact that res judicata would apply to the same initiating submission that the Chamber rejected. Hence, none of these arguments could serve as a basis for having the Chamber review again the arguments that were summarily rejected.

Finally, upon reviewing the ruling through which the judicial consultation was submitted, the consulting judge did summon the parties within a period of three days; however, the judge did not indicate where they were to appear—that is, before the Sala Constitucional, as established by the case law. This circumstance clearly fails to comply with Article 104 of the Ley de la Jurisdicción Constitucional.

For all the foregoing reasons, under these circumstances, the submitted consultation shall not be answered.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that if they submitted any paper document, as well as any objects or evidence contained in an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from the notification of this judgment. Otherwise, any such material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Sesión N° 27-11 del 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 del 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12 celebrada el 3 de mayo del 2012, Article LXXXI.

Res. 2024-024395 DISSENTING OPINION OF JUSTICE RUEDA LEAL. First, regarding the admissibility of judicial constitutional consultations, Article 102 of the Ley de la Jurisdicción Constitucional establishes the admissibility requirements. This provision sets forth certain essential conditions for such consultations to proceed, including the following: that the consultation be submitted by a judge; that there be “well-founded doubts” concerning the constitutionality of the provision, act, conduct, or omission that must be applied or adjudicated; that there be a case pending before the judge or court; and that, in that underlying matter, the provision must be applied or the act, conduct, or omission giving rise to the constitutional doubt must be adjudicated. Those requirements were analyzed in detail in this Chamber’s sentencia nro. 01617-97 de las 14:54 horas de 17 de marzo de 1997, as follows:

“A. That it be submitted by a “judge,” a generic term that—of course—applies both to single judges and to multi-member courts, concerning which it is unnecessary to specify anything further than: a) that they must be authorities vested with adjudicatory power (poder jurisdiccional), which excludes consultations submitted by administrative tribunals but does include those submitted by arbitrators in matters subject to their decision (it should be noted that what is relevant in all cases is that there be proceedings leading to the issuance of a judgment or arbitral award, vested with res judicata effect (autoridad de la cosa juzgada)); and b) that, at the time the consultation is submitted, the judge must be duly authorized to exercise that jurisdiction (since it could hardly be thought that a ruling that is invalid in the proceedings at issue could have the effect of initiating a proceeding that, like this one, is purely incidental in nature).

B. That there be “well-founded doubts” regarding the constitutionality of the provision, act, conduct, or omission that must be applied or adjudicated. This means that the challenge must be reasonable and carefully considered. It also means that it cannot concern matters on whose constitutionality the Chamber has already ruled. This is so not only because accepting the contrary would disregard the erga omnes effect of the decisions issued by this jurisdiction, but also because a consultation under such circumstances would clearly lack a present interest. It should be emphasized, however, given its relevance to the case under review (sub examine), that the circumstance described arises only from those rulings in which the Chamber has expressly validated the conformity of the provision, act, conduct, or omission with constitutional standards. Consequently, if a provision has previously passed an express constitutional review (whether through an action or consultation), a new challenge on the same point would not be viable, although a challenge concerning an act, conduct, or omission based on that same provision could be, particularly because—in that situation—there is always the possibility of a constitutional violation, not in the provision itself but in its interpretation or application.

Conversely, the fact that an act, conduct, or omission was previously upheld (perhaps through amparo or habeas corpus proceedings) does not mean that doubts cannot exist as to the constitutionality of the provision itself on which they are based. In that situation, the judicial consultation (consulta judicial) is appropriate.

C. That there be a case before the judge or court. As with an action of unconstitutionality (acción de inconstitucionalidad), a judicial consultation never occurs in a vacuum or solely as an academic exercise; rather, it must be relevant to the decision or resolution of the so-called “preliminary” or “principal” matter (…)

D. That, in that preliminary matter, the provision must be applied or the act, conduct, or omission giving rise to the constitutional doubt must be adjudicated, an aspect that—given its relevance to the case—should be clarified. Indeed, the phrase “the provision must be applied or the act, conduct, or omission adjudicated” has a very definite present-tense meaning, entirely different from what it would mean if the law stated that “the provision may be applied or the act, conduct, or omission adjudicated.” A judicial consultation is not appropriate based on the mere possibility that those circumstances may arise, since—as explained above—such an understanding would amount to expending the resources of the constitutional jurisdiction on a mere academic or doctrinal exercise. For the consultation to be viable, the judge must be faced, with certainty and in the present, with applying the provision or adjudicating the act, conduct, or omission that gives rise to a constitutional doubt.” Likewise, section 104 thereof requires that the judicial consultation be submitted in a reasoned ruling (resolución fundada), that the parties be summoned within three days, and that the proceedings be stayed until the Chamber has resolved the consultation.

That being so, I find that the aforementioned admissibility requirements are met in the case at bar (sub iudice), since the consultation was submitted by a judge of the Tribunal Penal del II Circuito Judicial de la Zona Atlántica through the ruling issued at 15:41 hours on 29 de mayo de 2024. In that ruling, the judge asserts reasonable doubts as to the constitutionality of sections 7, 17, and 20 of ley nro. 9852 (Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas) and sets forth the grounds for those challenges. Likewise, the consultation was submitted in expediente nro. 21-000318-1263-PE, a matter pending resolution by the consulting court. In addition, pursuant to section 104, it is apparent that the consultation was submitted by means of a reasoned ruling (ruling issued at 15:41 hours on 29 de mayo de 2024), which also summoned the parties to appear within three days and stayed the underlying proceedings until resolution of the case at bar.

In view of the foregoing, it is appropriate to examine the merits of the consultation submitted regarding the provisions that the consulting court must apply in the judicial proceeding before it, as follows.

First, the constitutionality of section 7 of ley nro. 9852 is challenged. It provides: “ARTICLE 7—Illegal transportation and distribution of petroleum-derived fuels or mixtures thereof. A term of imprisonment of one to four years shall be imposed on anyone who, within the national territory, illegally or without due authorization from Recope or the Ministerio de Ambiente y Energía (Minae), brings in, transports, or distributes petroleum-derived fuels or mixtures thereof.

On this point, the consulting court finds that the cited provision violates the principle of definiteness (principio de tipicidad), because, with respect to “transportation,” it penalizes anyone who does so “illegally.” Accordingly, it contends that the term “illegal” is a normative element of the criminal offense (elemento normativo del tipo penal) that must be defined by the provision at issue, since otherwise determining the legality or illegality of the conduct for purposes of bringing it within the criminal offense would be left to the discretion of the legal decision-maker. It further argues that the normative element “illegal” cannot be determined through regulations.

However, as the Procuraduría General de la República (PGR) explains in its report, the challenged provision must be considered in conjunction with section 1º of ley nro. 9852 itself, which specifically sets forth the purpose of that body of law. Thus, that provision states: “ARTICLE 1—Purpose of the law. The purpose of this law is to penalize unlawful activities related to the illegal taking of petroleum-derived fuels and mixtures thereof owned by the Refinadora Costarricense de Petróleo, hereinafter Recope, as well as the illegal introduction of petroleum-derived fuels and mixtures thereof into the national territory.” (Emphasis not in the original).

Thus, as the PGR correctly states, the illegality of transporting or distributing petroleum-derived fuels or mixtures thereof is determined by the unlawful “taking” of those substances. In this regard, it bears emphasizing that section 2 thereof provides: “ARTICLE 2—General prohibition. The exclusive importation of petroleum-derived fuels falls to Recope, as the public enterprise that administers the State monopoly over the importation, refining, and wholesale distribution of crude oil and its derivatives; therefore, any importation carried out by a third party not authorized by Recope is illegal, and any natural or legal person shall accordingly be subject to the penalties established in this law and in any other provision in force.” Consistent with this latter provision, section 1º of ley nro. 7356 states: “Article 1º—The importation, refining, and wholesale distribution of crude oil and its derivatives, including fuels, asphalt, and naphtha, to meet national demand, are a State monopoly.” Based on the foregoing, as the PGR states, it readily follows that bringing fuel into the national territory without due authorization from Recope or Minae is done illegally; therefore, the taking for transportation or distribution of those unlawfully introduced substances likewise becomes “illegal.” Thus, as the government attorney states in his report: “it is understood that the first conduct governed by section 7 of ley 9852, encompassing the transportation and distribution of fuel resulting from a taking, is entirely clear and does not require any reference to a regulation, as the Consulting Court appears to understand.” The challenged provision also governs another form of criminal conduct, namely when transportation or distribution is carried out without the required permits from Recope or Minae, even though the petroleum-derived fuel or mixtures thereof were lawfully brought into the country.

Thus, the provision is premised on an abstract danger (peligro abstracto), because fuel is a flammable and polluting substance, such that transporting it without the required permits creates a risk to public safety, health, and the environment. Specifically, as the PGR notes, the transportation of fuel must comply with reglamento nro. 36627-MINAE; consequently, carrying out such activity without meeting the applicable requirements and without due authorization creates a particularly significant risk, which the challenged criminal legislation legitimately penalizes.

In view of the foregoing, the undersigned finds that section 7 of ley nro. 9852 does not present the alleged constitutional defects.

Additionally, the consulting court also challenges section 20 thereof, which states: “ARTICLE 20—Regulations implementing this law. The Executive Branch shall issue regulations implementing this law within a maximum period of six months from its effective date. The absence of regulations shall not prevent the application or mandatory observance of this law.” (Emphasis not in the original). In this regard, it states that the provision is unconstitutional because it compels judges to apply section 7 cited above, even though, in its view, that provision violates the principle of definiteness.

As noted, the consulting court’s claim regarding Article 20 is ancillary to its arguments concerning section 7. Thus, because the alleged unconstitutionality of the latter provision has not been established, neither is any defect apparent from the fact that section 20 requires the application of ley nro. 9852, which is specifically what the consulting court challenges.

Finally, section 17 thereof is challenged. It states: “ARTICLE 17—Seizure (decomiso) of petroleum-derived fuels. Petroleum-derived fuels or mixtures thereof that, pursuant to Ley 6588, Ley que Regula a la Refinadora Costarricense de Petróleo (Recope), de 30 de julio de 1981, fall within Recope’s monopoly, lack Recope’s authorizations, or originate from offenses penalized under this law may be seized by law-enforcement agencies, judicial authorities, and the Ministerio Público (…)”. However, as framed by the consulting court, it is not apparent that this provision is directly applicable to the underlying judicial proceeding. In this regard, the court does not specifically explain in the consultation how the provision applies to the case before it, but instead states generally that this regulation affects the community of Tortuguero del distrito de Colorado de Pococí and the Asociación de Boteros y Transportistas de Barra del Tortuguero.

In this regard, the PGR emphasizes in its report that, in the criminal case file, what appears is a record of the seizure (decomiso) of fuel carried out by the Fuerza Pública, without any indication that the seized material is in the custody of the judicial authority in charge of the criminal proceedings; hence, it argues: “because the seizure was carried out by a police body, the condition contained in that provision is not a matter that must be applied by the judge in the proceedings invoked as the basis for submitting the consultation.” Consequently, the consultation submitted in those terms is inadmissible.

In light of the foregoing considerations, I find no defect that may be declared in these constitutional review proceedings (proceso de control de constitucionalidad).

Case file: 24-016500-0007-CO Decision No. 2024-024395 DISSENTING OPINION (VOTO SALVADO) OF JUSTICES GARRO VARGAS AND HESS HERRERA, drafted by the former We, the undersigned justices, respectfully depart from the majority opinion because we consider the judicial consultation (consulta judicial) admissible and, on the merits, find no constitutional defect.

I. ADMISSIBILITY OF THE JUDICIAL CONSULTATION

Article 102 of the Ley de la Jurisdicción Constitucional (LJC) establishes the requirements for admitting judicial consultations in the following terms:

Every judge shall have standing to consult the Sala Constitucional when the judge has well-founded doubts regarding the constitutionality of a provision or act that must be applied, or of an act, conduct, or omission that must be adjudicated in a case submitted for the judge’s consideration.

Four fundamental conditions for admissibility follow from this provision: a) that it be submitted by a judge; b) that there be “well-founded doubts” regarding the constitutionality of the provision, act, conduct, or omission that must be applied or adjudicated; c) that a case be pending before the judge or court; and d) that, in that underlying matter, the provision must be applied or the act, conduct, or omission giving rise to the constitutional doubt must be adjudicated. Likewise, Article 104 of the same law requires that the judicial consultation be submitted through a reasoned decision, that the parties be given notice within three days, and that the proceedings be stayed until the Sala has answered the consultation.

The provisions of the LJC must be interpreted together with Article 8 of the Ley Orgánica del Poder Judicial (LOPJ), which provides, insofar as relevant, as follows:

Article 8.- Officials who administer justice may not:

  1. 1Apply laws or other provisions or acts of any nature that are contrary to the Constitución Política or to international or community law in force in the country.

If they have doubts regarding the constitutionality of such provisions or acts, they must consult the constitutional jurisdiction (jurisdicción constitucional). (Emphasis not in the original).

As can be seen, the judicial consultation is incidental in nature, similar to an action filed pursuant to Article 75, first paragraph, of the LJC, and it must be understood that the purpose of the judicial consultation is to protect the rights of one of the parties to the proceedings. Indeed, Article 105 of the LJC confirms the subjective and incidental purpose of judicial consultations, since it authorizes parties with standing to follow the procedure for converting a judicial consultation into an action of unconstitutionality (acción de inconstitucionalidad). The second paragraph of the provision under review states as follows:

Nevertheless, any of them who has standing to bring an action may request that the Sala, within the period granted for appearance, give the matter the nature and effects of such an action of unconstitutionality, in which case they must formally file that action within the following fifteen days. If they do so, the action shall be processed accordingly, and the Sala shall refrain from answering the consultation as such, but must rule on it in its judgment.

In responding to the legally required hearing, the Procuraduría General de la República (PGR) reports that, in the specific case, the constitutional challenges raised in another action of unconstitutionality are repeated. That action had been filed against Articles 7, 17, and 20 of Law No. 9852 and processed under Sala Constitucional case file No. 22-000391-0007-CO. The PGR therefore objects to the admissibility of the judicial consultation because it “ceases to be an independent challenge and becomes, apparently, an echo of an action already filed that was not admitted.” That position was adopted by the majority of this Sala.

Nevertheless, in this regard, this minority found that there are at least two recent judicial consultations in which the consulting judges based their reasoning on the arguments advanced by the parties to the principal proceedings. Thus, the fact that the reasoning originates with one of the parties does not preclude a judge from adopting as their own the constitutional doubts presented to them (see, in this regard, judicial consultations Nos. 2022-008751 and 2024-001728, in which, although Justice Garro Vargas set out her own reasons, she did not reject the consultations as inadmissible because the constitutional doubt arose from the reasoning of one of the parties). Consequently, given the nature of the judicial consultation—even if based on the arguments from an earlier action or on the reasoning of one of the litigants—it may be admissible because it has caused the judge to have a constitutional doubt regarding the provisions that must be applied.

In the case at bar (sub lite), it was established that the judicial consultation was submitted by Judge Juan Carlos Jiménez, acting as alternate judge of the Tribunal Penal de Pococí (Tribunal del Segundo Circuito Judicial de la Zona Atlántica), through a decision issued at 15:41 on 29 May 2024. In that decision, he explained that he was responsible for deciding criminal proceeding No. 21-000318-1263-PE, which had been instituted precisely for the alleged commission of the offense of illegal transportation and distribution of fuel, criminalized in Article 7 of Law No. 9852. The judge candidly stated that, on 03 November 2021, during the continuation of the hearing, the unconstitutionality of the challenged provisions was invoked as a reasonable means of protecting the infringed rights. Finally, the judge reasonably substantiated his constitutional doubts, principally with respect to the alleged violation of the principle of specificity in criminal law (principio de tipicidad).

It was established that, in the above-cited decision, the judge gave the parties notice to make the appropriate submissions and stayed the criminal proceedings pending resolution of the judicial consultation.

In light of these considerations, the judicial consultation is deemed admissible, and it is appropriate to answer it on the merits.

II. MERITS

A.- Provisions submitted for consultation The consulting judge raises constitutional doubts regarding Articles 7, 17, and 20 of the Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas, No. 9852. Those provisions state as follows:

Article 7- Illegal transportation and distribution of petroleum-derived fuels or mixtures thereof. A prison sentence of one to four years shall be imposed on anyone who, within the national territory, illegally or without due authorization from Recope or the Ministerio de Ambiente y Energía (Minae), brings in, transports, or distributes petroleum-derived fuels or mixtures thereof.

Article 17- Seizure of petroleum-derived fuels. Petroleum-derived fuels or mixtures thereof that, pursuant to Ley 6588, Ley que Regula a la Refinadora Costarricense de Petróleo (Recope), of 30 July 1981, fall within Recope’s monopoly, lack Recope’s authorization, or originate from the offenses punishable under this law may be seized by police bodies, judicial authorities, and the Ministerio Público.

The Refinadora Costarricense de Petróleo (Recope) must immediately, within no more than three days, go to the locations where the authorities discover petroleum-derived fuels or mixtures thereof that lack Recope’s authorization; provide the assistance required by those authorities; and collect, transport, and safeguard the seized material using the techniques intended for that purpose.

Article 20- Regulations implementing this law. The Poder Ejecutivo shall issue regulations implementing this law within a maximum period of six months from its entry into force. The absence of implementing regulations shall not prevent the application or mandatory observance of this law. (Underlining not in the original).

Although it was not submitted for consultation, Article 1 of the law is reproduced below because it provides the context for applying the special criminal offense (tipo penal especial) contained in the provision (Article 7):

Article 1- Purpose of the law. The purpose of this law is to punish unlawful activities related to the illegal appropriation of petroleum-derived fuels and mixtures thereof owned by the Refinadora Costarricense de Petróleo, hereinafter Recope, as well as the illegal introduction of petroleum-derived fuels and mixtures thereof into the national territory. (Underlining not in the original).

In addition, Article 2 illustrates the general prohibition established by the legislation under review:

Article 2- General prohibition. Recope, as the public enterprise that administers the State monopoly over the importation, refining, and wholesale distribution of crude oil and its derivatives, has the exclusive right to import petroleum-derived fuels; therefore, any importation carried out by a third party not authorized by Recope is illegal (*), and every natural or legal person is consequently subject to the penalties established in this law and in any other provision in force.

B.- Argument of the consulting judge The criminal judge asks this Sala to rule on his constitutional doubts regarding Articles 7, 17, and 20 of the Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas.

The constitutional doubt is based on the assertion that provision 7—in his view—violates the principle of specificity in criminal law because, in defining the conduct at issue as an offense, it punishes the illegal transportation of fuel without clarifying that element:

“The normative element of the criminal offense (elemento normativo del tipo penal), ‘illegal,’ must, as a matter of law, be defined in the provision at issue; otherwise, when the provision is applied, the administrative or judicial authority is left with unfettered discretion to determine whether the transportation is legal or illegal, as occurred in the case in which the unconstitutionality of the provision was invoked (…)

The application of challenged Article 7, which defines a defective and indeterminate criminal offense, entails two problems: 1) The impossibility of using the ‘regulatory power’ (potestad reglamentaria) to fill or remedy deficiencies in the normative and descriptive elements defining the offense (tipicidad), which result from poor legislative drafting. (…) The second problem arising from the application of challenged Article 7 lies in the language of Article 20 of Law 9852 (…) the absence of implementing regulations shall not prevent the application or mandatory observance of this law (sic).”

C.- PGR Report The PGR frames the challenged provisions within two important considerations. First, the regulation must be weighed against the provisions of Art. 1 of Law 9852|, since the purpose of the law is to punish unlawful activities related to the illegal appropriation of petroleum-derived fuels and their blends owned by Refinadora Costarricense de Petróleo (RECOPE). Second, it notes that, when the State monopoly over the importation, refining, and wholesale distribution of crude oil and its derivatives (fuels, asphalt, and naphtha) was decreed by Law No. 7536 of 24 de agosto de 1993, the legislature determined that such distribution is a public service. This service is operated through RECOPE, a public enterprise holding the concession for the wholesale fuel distribution service. It further notes that, although transportation by other means has not been designated as a regulated public service under Law No. 7593, the Reglamento para la Regulación del Transporte de Combustible, Executive Decree No. 36627 of 23 de junio de 2011, provides that the transportation of fuel by land transportation units constitutes a public service and that its rates shall be set by the Autoridad Reguladora de los Servicios Públicos (ARESEP).

Thus, with respect to the first conduct described in the provision under analysis, the unlawfulness of the punishable conduct is established for anyone who distributes fuel resulting from an appropriation that plainly cannot be lawful. Accordingly, the first conduct regulated in section 7 of Law No. 9852, which encompasses the transportation and distribution of fuel resulting from appropriation, is entirely clear and requires no referral to a regulation. As for the second form of criminal conduct described in Art. 7, it refers to anyone who transports or distributes fuel without the required permits from RECOPE or the Ministerio de Ambiente (MINAE); this provision is directed at anyone seeking to transport fuel—even if it was not illegally brought into the country—but who does so without the corresponding permits. In this regard, it is explained that, under criminal law, this conduct constitutes an abstract-endangerment offense (delito de peligro abstracto), because transporting fuel without the required permits—fuel being an inflammable and polluting substance—entails a risk inherent in the conduct itself, thereby encompassing the protection of a series of legally protected interests (bienes jurídicos), such as public safety, health, and the environment.

The PGR concludes as follows:

“[T]o transport fuel in our country, the regulations contained in Reglamento 36627-MINAE must be complied with; consequently, failure to hold the permits required for that purpose constitutes punishable conduct, because the legislature considered that engaging in such activity without any form of authorization represents an inherently hazardous activity. For that reason, not only was the basic offense (tipo simple) set forth in Article 7 retained, but an aggravated offense (tipo agravado) was also added, increasing the penalty for all other conduct contained in Law 9852 and establishing several aggravating circumstances, most notably: when there is a danger to the health or lives of persons (transportation under improper conditions may create a risk to the lives or health of third parties); or when environmental damage occurs (an aspect arising precisely from transportation under improper conditions), since the very purpose of issuing permits is to ensure that anyone transporting fuel does so in compliance with the applicable requirements, without endangering health, life, or the environment.” D.- Decision in the specific case Based on a comprehensive assessment of the legislation submitted for analysis and the PGR report, we, the undersigned justices, conclude that the criminal offense (tipo penal) does not exhibit the deficiencies attributed to it by the consulting judge.

First, the wording of Art. 2 of the provision establishes that the importation of petroleum-derived fuels is exclusively entrusted to RECOPE; therefore, any importation carried out by a third party not authorized by that authority is deemed unlawful, and every natural or legal person is accordingly subject to the penalties established by law. A comprehensive reading of the legislation makes clear that bringing petroleum-derived fuels or their blends into the country is a service entrusted exclusively to RECOPE, such that any person other than that authority could engage in the unlawful conduct detailed in the provision. Furthermore, the transportation or distribution of fuels requires, as reported by the PGR, authorization from RECOPE or MINAE. Anyone who carries out such activity without those permits likewise engages in conduct punishable under our legal system because of the danger it entails. Such criminalization reflects the legislature’s determination to prevent potential risks to the legally protected interests safeguarded by the provision, and this Chamber has upheld its constitutionality (see, for example, Judgment No. 2019-019608). In this regard, this minority does not find that the criminal provision suffers from the defects identified by the consulting judge.

Accordingly, since the unlawfulness (antijuricidad) of the conduct is already defined in the legislation itself, the fact that Law No. 9852 must additionally be implemented through regulations does not appear to violate the principle of specificity in criminal law (principio de tipicidad) or the principle of legality in criminal law (principio de legalidad penal) (Art. 20 under consultation).

Finally, regarding the forfeiture (decomiso) of the fuels, we consider that this issue is not, or does not appear to be, applicable to the specific case. Indeed, in the criminal proceedings, the court must determine whether the conduct attributed to the accused falls within the circumstances set forth in Art. 7, but it is not made clear that the court must decide any matter related to forfeiture. Therefore, the provision does not appear to be applicable in this respect to the underlying proceeding.

III. CONCLUSIONS

As a corollary to the foregoing considerations, we find that the judicial consultation is admissible and that, on the merits, the constitutional defects alleged by the consulting judge are not apparent.

Consulta judicial facultativa formulada por Juan Carlos Jiménez Marín, en su condición de Juez Suplente Penal de Tribunal Penal de Pococí, mediante resolución de las 15:41 horas del 29 de mayo de 2024, dictada dentro del expediente N° 21-000318-1263-PE, que es proceso penal instaurado en contra de [Nombre01 001], por el delito de “Tráfico Ilícito de residuos o sustancias peligrosas, bioinfecciosos o radioactivos”, con respecto a los artículos 7 (transporte y distribución ilegal de combustibles derivados del petróleo o sus mezclas), 17 (decomiso de combustibles derivados del petróleo), y 20 (reglamentación de esta ley), contenidos en la “Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas”, Ley N° 9852 del 16 de junio de 2020.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 13:26 horas del 19 de junio de 2024, y con fundamento en los artículos 8, inciso 1), de la Ley Orgánica del Poder Judicial; 2, inciso b); 3, 13, 102 y 104, de la Ley de la Jurisdicción Constitucional, el despacho consultante solicita a esta Sala que se pronuncie sobre las dudas de constitucionalidad que tiene sobre los artículos 7, 17, y 20, de la Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas. La duda de constitucionalidad radica en que el artículo 7, de la mencionada Ley, estaría quebrantando el principio de tipicidad, dado que al tipificar la conducta señalada, sanciona el transporte de combustible en forma ilegal, sin que se indique cuál es una forma legal, no se dice cuál es esa forma. Es más confusa la norma cuando dice “o sin la debida autorización de RECOPE o del MINAE”, pues el objeto de la ley estaría en el artículo 1°, que dice sancionar “actividades ilícitas relacionadas con el apoderamiento ilegal de combustibles”, como también, “la introducción ilegal de combustibles” “en el territorio nacional”.La cuestión de constitucionalidad se presenta cuando hay compra de gasolina en forma legal (en una gasolinera), y se transporte por las vías públicas, lo que no permitiría la configuración típica del artículo 7, cuestionado. Cuestiona de igual manera el artículo 20, que menciona que la “falta de reglamentación no impedirá la aplicación de esta ley ni su obligatoria observancia”, por problemas de tipicidad, pues obliga a aplicar un tipo penal que lesiona el principio de tipicidad. Finalmente, el decomiso de la propiedad que fue adquirida en forma legal en un expendio de gasolina, y fue transportada por un tercero, puede solicitarse la devolución del bien, sin embargo porque lleva tiempo que se resuelva el proceso penal, está ante una pérdida de su propiedad ya que el producto decomisado llega a degradarse.
  2. 2Pese al emplazamiento conferido a las partes dentro del asunto principal, por resolución sin número, de las 15:41 horas del 29 de mayo de 2024, del Juez Suplente de Juicio del Tribunal Penal del II Circuito Judicial de la Zona Atlántica, MSc. Juan Carlos Jiménez Marín, no se apersonaron las partes ante la Sala.
  3. 3Mediante resolución de las 12:32 horas del 21 de junio de 2024, la Presidencia de la Sala previno al juez consultante, Juan Carlos Jiménez Marín, para que indicara, en el plazo de veinticuatro horas, y bajo apercibimiento de no dar trámite a la consulta en caso de omisión, si el Tribunal que conoce el expediente N° 21-000318-1263-PE es un órgano unipersonal o colegiado. Por escrito presentado a la 01:05 horas del 24 de junio de 2024, el Juez informa a la Sala que el expediente en cuestión lo conoce un órgano unipersonal.
  4. 4Mediante auto de las 14:57 horas del 24 de junio de 2024, la Presidencia de la Sala dio curso a la consulta, confiriendo audiencia a la Procuraduría General de la República.
  5. 5Iván Vinicio Vincenti Rojas, Procurador General de la República, contesta a la audiencia conferida, indicando que tiene dudas sobre la admisibilidad de la consulta judicial formulada. Expresa que, a diferencia de las acciones de inconstitucionalidad que están impulsadas por un interés personal, las consultas de constitucionalidad de los juzgadores deben ser totalmente objetivas, en el afán de coadyuvar que el sistema jurídico esté ajustado al ordenamiento constitucional. De ahí, debe haber una verdadera duda de constitucionalidad, y esa consulta debe estar debidamente fundamentada. Sostiene que no procede la consulta respecto de los artículos 17 y 20, de la Ley N° 9852, dado que no los debe aplicar al caso concreto. Pero además, señala que “… es necesario hacer ver un aspecto que llama la atención en la presente consulta, que viene dado sobre el cuestionamiento que no es un tema nuevo, ya que precisamente en el expediente 22-000391-0007-CO ( el cual se rechazó de plano la acción), se tramitó el mismo cuestionamiento de constitucionalidad presentado en esa oportunidad por el Lic. George Paisano Saborío quien justamente figura como abogado representante del Tercero Interesado Civil, en la causa penal 21-000318-1263-PE, que es la causa precedente que genera la consulta promovida por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí, destacando el hecho que el escrito de interposición de dicha acción guarda aspectos de redacción muy similares a los que ha presentado el Tribunal consultante.

Como muestra de lo señalado supra, se puede observar que en la acción promovida por el Lic. Paisano Saborío en el año 2022 al momento de cuestionar el artículo 7, 17 y 20 de la ley 9852, se detalla una redacción que es retomada en la consulta formulada por el señor juez, de tal suerte que entramos en duda sobre si el cuestionamiento originario es de propia cosecha del juzgador. Por ejemplo, en los considerandos, segundo, tercero, cuarto, quinto y sexto de la consulta remitida por el Tribunal de Juicio, se hace una argumentación intelectiva idéntica, en los apartados, de la fundamentación de la acción presentada por el Lic. Paisano Saborío.

Este aspecto que no es de menor importancia, pues podría resultar en que la consulta promovida no es de resorte exclusivo del Despacho Judicial, y pareciera más bien que el cuestionamiento medular en su redacción aparentemente proviene de un abogado representante del tercero interesado en el proceso penal precedente, quien justamente recurrió a la Sala Constitucional y su gestión fue rechazada de plano.

Como se puede observar, en el expediente 21-000318-1263-PE, a folio 158, se ubica el acta de debate en el cual el tercero interesado representado por el Lic. Paisano Saborío, señala que la norma no está apegada al derecho de la Constitución y solicita se revise la acción de inconstitucionalidad, aspecto sobre el cual el juzgador resuelve realizar la consulta correspondiente a la Sala Constitucional.

El problema que se deriva de lo resuelto por el tribunal, y que guarda relación con la fundamentación de la consulta presentada, es justamente la utilización de la misma redacción (para los cuestionamientos medulares) de la acción de inconstitucionalidad que fue interpuesta en su momento por parte del abogado representante de los terceros interesados, de tal suerte que el análisis intelectivo que se exige en la presentación de una consulta de constitucionalidad por parte de un juzgador, deja de ser un cuestionamiento propio para convertirse (en apariencia) en eco de una acción ya instaurada y que no fue admitida. Esto, en nuestro criterio, incumple el deber de fundamentación que se exige en toda resolución judicial, lo que debe llevar al rechazo de la consulta formulada.

Por lo que se lleva dicho, cree este Órgano asesor e imparcial de la Sala Constitucional, que la consulta judicial que nos ocupa adolece de algunos vicios de admisibilidad (los que han sido debidamente acreditados), razón por la cual solicitamos que así se declaren, declarando inadmisible la presente gestión judicial”.

En cuanto al fondo, el artículo 7, es necesario ponderar la acción en el territorio nacional de transporte o distribución de combustibles derivados del petróleo o sus mezclas de forma ilegal, con el artículo 1°, de la Ley N° 9852 cuyo objeto es sancionar las actividades ilícitas de apoderamiento ilegal de combustibles propiedad de la Refinadora Costarricense de Petróleo. Describe las acciones del tipo, además, sobre la distribución y transporte menciona el dictamen de la Procuraduría General de la República C-134-2011, señala que la distribución de combustible es un servicio público, y que, si bien el transporte “por otros medios” no es servicio público regulado en la Ley N° 7536, el Reglamento para la Regulación del Transporte de Combustible, Decreto Ejecutivo 36627 de 23 de junio de 2011, pero establece para el transporte de combustible los es por unidad de transporte terrestre como un servicio público, y la ARESEP fija esas tarifas.

Además, la norma impugnada alude a transporte y distribución sin los debidos permisos de Recope o MINAE, es decir, sin los permisos respectivos, es un delito de peligro abstracto, por el hecho de transportar combustible, sustancia inflamable y contaminante. El riesgo está implícito a la acción desplegada, con ello se tutela varios bienes jurídicos como la seguridad común, la salud, el medio ambiente. En nuestro país, para transportar combustible se requiere cumplir las regulaciones del Reglamento N° 36627-MINAE, y por eso, no contar con ellos constituye una conducta punible. El legislador consideró que hacerlo sin autorización de algún tipo es una actividad eminentemente riesgosa, lo que está en el artículo 7, pero además, la ley contempla otras agravantes, con el fin de que, quien transporte combustible lo haga cumpliendo requisitos. Pide declarar la inadmisibilidad por falta de requisitos, y por el fondo, la improcedencia.

  1. 6En el procedimiento se cumplió con las formalidades establecidas por ley.

Redacta el magistrado Salazar Alvarado; y,

Considerando:

I.Sobre la admisibilidad. El Título IV, relacionado a las cuestiones de constitucionalidad, en la Ley de la Jurisdicción Constitucional, establece algunos remedios procesales para sanear el ordenamiento jurídico. Así, los particulares pueden velar mediante la acción de inconstitucionalidad por el gran crisol de derechos e intereses particulares que les asiste en sus conflictos, o también, las autoridades públicas e institucionales al formular acciones de inconstitucionalidad u otros procesos como las consultas de constitucionalidad, para presentar en la jurisdicción constitucional los conflictos de constitucionalidad que hayan detectado. Claramente, tiene el fin de asegurar la prevalencia de un criterio de objetividad sobre el resto del ordenamiento jurídico con el bloque de constitucionalidad, o el Derecho de la Constitución, para que estos últimos mantengan su supremacía, eficacia y aplicabilidad directa.

Este es el caso de la consulta judicial que habilita al órgano jurisdiccional, es decir, al juzgador, a consultarle a la Sala Constitucional cuando tuviere dudas fundadas sobre la constitucionalidad de un acto o norma que debe aplicar en el proceso sometido a su conocimiento. Para ello, la jurisprudencia de la Sala, en forma reiterada, ha establecido cuáles son los requisitos de admisibilidad. Tales presupuestos fueron analizados, en detalle, en la Sentencia de esta Sala N° 1997-01617 de las 14:54 horas del 17 de marzo de 1997, de la siguiente manera:

"A. Que la formule un "juez", término genérico que -desde luego- se aplica tanto a los juzgadores unipersonales como a los tribunales colegiados, y sobre lo cual es innecesario precisar más que: a) que debe tratarse de autoridades dotadas de poder jurisdiccional, lo cual excluye las consultas formuladas por tribunales administrativos, pero sí incluye las que hagan los árbitros en el marco de los asuntos sujetos a su decisión (nótese que lo relevante en todos los casos es que se esté ante el trámite de un proceso conducente al dictado de una sentencia o laudo arbitral, dotados de la autoridad de la cosa juzgada); y, b) que el juzgador debe estar, al momento de formular la consulta, debidamente habilitado para ejercer esa competencia (ya que mal podría pensarse que una resolución que sea inválida en el proceso en cuestión pueda surtir el efecto de dar inicio a un trámite que, como éste, posee un carácter puramente incidental).

B. Que existan "dudas fundadas" sobre la constitucionalidad de la norma, acto, conducta u omisión que se deba aplicar o juzgar. Esto quiere decir que el cuestionamiento debe ser razonable y ponderado. Además, implica que no puede versar sobre aspectos sobre cuya constitucionalidad la Sala ya se haya pronunciado. Ello es así no sólo porque aceptar lo contrario implicaría desconocer la eficacia erga omnes de las resoluciones de esta jurisdicción, sino también dado que una consulta bajo esas circunstancias evidentemente carecería de interés actual. Pero subráyese, por su relevancia para el sub examine, que la explicada circunstancia sólo deriva de aquéllos pronunciamientos en que la Sala haya validado expresamente la adecuación de la norma, acto, conducta u omisión a los parámetros constitucionales. En consecuencia, si una norma ha superado anteriormente el examen explícito de constitucionalidad (en vía de acción o consulta), no sería viable un nuevo cuestionamiento sobre el mismo punto, pero sí podría serlo respecto de un acto, conducta u omisión basados en la misma norma, particularmente porque -en este caso- siempre existe la posibilidad de un quebranto constitucional, ya no en la norma en sí, sino en su interpretación o aplicación.

A la inversa, el hecho de que un acto, conducta u omisión haya sido refrendado anteriormente (quizás en vía de amparo o hábeas corpus) no significa que no puedan existir dudas sobre la constitucionalidad de la norma misma en que aquéllos se fundamenten. Y, en esta hipótesis, la consulta judicial es pertinente.

C. Que exista un caso sometido al conocimiento del juzgador o tribunal. Al igual que en la acción de inconstitucionalidad, la consulta judicial nunca se da en el vacío o por mero afán académico, sino que ella debe ser relevante para la decisión o resolución del llamado "asunto previo" o "principal". Finalmente, D. Que, en ese asunto previo, deba aplicarse la norma o juzgarse el acto, conducta u omisión que suscite la duda de constitucionalidad, aspecto que -por su relevancia para el caso- resulta conveniente precisar. En efecto, la expresión "deba aplicarse la norma o juzgarse el acto, conducta u omisión", conlleva un sentido actual muy definido y totalmente distinto a que si la ley hablara en términos de que "pueda aplicarse la norma o juzgarse el acto, conducta u omisión". La consulta judicial no procede ante la mera eventualidad de que acaezcan esas circunstancias, ya que -como se explicó arriba- esta concepción equivaldría a que se inviertan los recursos de la jurisdicción constitucional en un simple ejercicio académico o doctrinario. Para que la consulta sea viable, el juzgador debe estar enfrentado, con certidumbre y en tiempo presente, a la aplicación de la norma o al juzgamiento del acto, conducta u omisión que le suscite una duda de constitucionalidad".

Lo que procede es hacer una revisión de los presupuestos de admisibilidad de la consulta formulada por el Juez Suplente Penal de Tribunal Penal de Pococí, mediante resolución de las 15:41 horas del 29 de mayo de 2024, dictada dentro del expediente N° 21-000318-1263-PE, según lo señalado por la Procuraduría General de la República.

II. Sobre la fundamentación de la consulta judicial

Esta Sala ha declarado inevacuables las consultas judiciales cuando éstas presentan problemas en su fundamentación, así como algunos otros problemas relativos a las resoluciones en las que se formulan las consultas. Así lo señaló la Sala, a los problemas de forma, también en la materia de la audiencia a las partes, para que pudieran apersonarse a la Sala Constitucional.

En Sentencia N° 2015-13860 de las 9:25 horas del 2 de septiembre de 2015, se estableció que:

“En el caso en estudio, lo que la Juez plantea no cumple todos los requisitos formales que exige la Ley de la Jurisdicción Constitucional. El artículo 104 indica claramente que el/la Juez(a) consultante deberá dictar una resolución en que señalará, de manera fundada, la disposición o acto que le suscita duda y, además, los motivos que sustentan esa duda. Además, debe emplazar a las partes para que se apersonen, si así lo desean, ante este Tribunal y suspender la tramitación del proceso hasta que la Sala resuelva”.

En otra Sentencia N° 2015-17352 de las 9:30 horas del 4 de noviembre de 2015, en cuya oportunidad la Sala estableció que:

“La consulta de constitucionalidad es un instrumento que permite al Juez, frente a una duda que le surgen en relación con la constitucionalidad de una o varias normas que debe aplicar en un caso concreto, solicitar a la Sala la evacue, brindando previamente elementos que justifiquen y expliquen su cuestionamiento. El artículo 104 indica claramente que el/la Juez(a) consultante deberá dictar una resolución en que señalará, de manera fundada, la disposición o acto que le suscita duda y, además, los motivos que sustentan esa duda”.

Por Sentencia N° 2022-20359, de las 9:30 horas del 31 de agosto de 2022, se indicó que:

“En el caso concreto, los jueces consultantes formularon esta consulta mediante una resolución emitida dentro del proceso penal n.° [Valor 001], lo cual es consecuente pero solo parcialmente con lo dispuesto en el artículo 102 de la Ley de la Jurisdicción Constitucional, toda vez que no se advierte de lo expresado por ese tribunal que se trate realmente de una duda fundada y razonable en motivos de constitucionalidad”.

III. Sobre la formulación de la consulta y los problemas de su origen

Al hacer un detenido análisis en cada uno de los presupuestos de admisibilidad enunciados con anterioridad, la Procuraduría General de la República, como asesor de la Sala Constitucional, señala que se repiten los reclamos de inconstitucionalidad formulados en otra acción de inconstitucionalidad, que se había interpuesto en contra de los artículos 7, 17, y 20, de la Ley N° 9852, tramitada bajo el expediente de la Sala Constitucional N° 22-000391-0007-CO.

Esta Sala Constitucional, en consecuencia, se avocó a determinar la veracidad de lo señalado por la Procuraduría General, lo que le permite encontrar que en efecto se trata de la misma redacción dentro del mismo asunto base N° 21-000318-1263-PE. Si bien, la Sala constata la advertencia del órgano asesor, con esta conducta, claro está, el Juez consultante mantiene el inconveniente de la afectación a la fundamentación de la acción de constitucionalidad que se intentó promover en la Sala Constitucional. Como es obvio, no se observa una verdadera fundamentación de la duda que dice tener el juez, al transcribir un escrito que fue conocido en una acción de inconstitucional rechazada de plano por Sentencia N° 2022-05564 de las 9:20 horas del 9 de marzo de 2022. Y no obstante, el accionante en aquella acción manifestó su inconformidad al solicitar la aclaración y adición, ello fue resuelto en la Sentencia N° 2022-07432 a las 9:45 horas del 30 de marzo de 2022, sobre los aspectos procesales y de fondo que en su criterio fueron omitidos en la Sentencia.

De este modo, a la luz del artículo 104, de la Ley de la Jurisdicción Constitucional, el juez deberá dictar una resolución en que señalará, de manera fundada, la disposición o acto que le suscita duda y, además, los motivos que sustentan esa duda. De ahí que, esta Sala se encuentra en el predicamento de que si la misma gestión quedó resuelta por Sentencia N° 2022-05564 de las 9:200 horas del 9 de marzo de 2022, y mediante la resolución 2022-07432, de las 9:45 horas del 30 de marzo de 2022, hay a su vez una falta de motivación por la utilización del mismo memorial, lo que minaría el mismo propósito de la consulta, además de la obvia razón de que habría cosa juzgada respecto del mismo escrito de interposición que fue rechazado por la Sala. De ahí, que ninguno de estos argumentos podrían servir para hacer que la Sala vuelva a revisar los argumentos que fueron rechazados de plano.

Finalmente, al revisar la resolución en la que se formula la consulta judicial, el Juez consultante efectivamente emplazó a las partes dentro del plazo de tres días; sin embargo, no indicó dónde debían apersonarse; o sea, ante la Sala Constitucional como lo ha indicado la jurisprudencia, situación que evidentemente, no cumple con el artículo 104, de la Ley de la Jurisdicción Constitucional.

Por todo lo anterior, bajo estas circunstancias, no ha lugar a evacuar la consulta formulada.

III. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Por mayoría, se declara inevacuable la consulta. El magistrado Rueda Leal y las magistradas Garro Vargas y Hess Herrera salvan el voto y evacuan la consulta formulada en el sentido de que las normas no tienen el vicio de inconstitucionalidad alegado.- Fernando Castillo V.

Res. 2024-024395 VOTO SALVADO DEL MAGISTRADO RUEDA LEAL. En primer lugar, sobre la admisibilidad de las consultas judiciales de constitucionalidad, el artículo 102 de la Ley de la Jurisdicción Constitucional establece los presupuestos de admisión. De esta disposición se desprenden algunos elementos condicionantes y fundamentales para su procedencia, como los siguientes: que sea formulada por un juez; que existan “ dudas fundadas” sobre la constitucionalidad de la norma, acto, conducta u omisión que se deba aplicar o juzgar; que exista un caso sometido al conocimiento del juzgador o tribunal; y que en ese asunto previo deba aplicarse la norma o juzgarse el acto, conducta u omisión que suscite la duda de constitucionalidad. Tales presupuestos fueron analizados en detalle en la sentencia de esta Sala nro. 01617-97 de las 14:54 horas de 17 de marzo de 1997, de esta forma:

“ A. Al igual que en la acción de inconstitucionalidad, la consulta judicial nunca se da en el vacío o por mero afán académico, sino que ella debe ser relevante para la decisión o resolución del llamado "asunto previo" o "principal" (…)

D. Que, en ese asunto previo, deba aplicarse la norma o juzgarse el acto, conducta u omisión que suscite la duda de constitucionalidad, aspecto que -por su relevancia para el caso- resulta conveniente precisar. En efecto, la expresión "deba aplicarse la norma o juzgarse el acto, conducta u omisión", conlleva un sentido actual muy definido y totalmente distinto a que si la ley hablara en términos de que "pueda aplicarse la norma o juzgarse el acto, conducta u omisión". La consulta judicial no procede ante la mera eventualidad de que acaezcan esas circunstancias, ya que -como se explicó arriba- esta concepción equivaldría a que se inviertan los recursos de la jurisdicción constitucional en un simple ejercicio académico o doctrinario. Para que la consulta sea viable, el juzgador debe estar enfrentado, con certidumbre y en tiempo presente, a la aplicación de la norma o al juzgamiento del acto, conducta u omisión que le suscite una duda de constitucionalidad.” Asimismo, el numeral 104 eiusdem exige que la consulta judicial se formule en resolución fundada, se emplace a las partes dentro de tercero día, y se suspenda la tramitación del proceso, hasta tanto la Sala no haya evacuado la consulta.

Así las cosas, estimo que en el sub iudice se cumplen los presupuestos de admisibilidad antedichos, toda vez que la consulta fue formulada por un juez del Tribunal Penal del II Circuito Judicial de la Zona Atlántica a través de la resolución de las 15:41 horas de 29 de mayo de 2024. En ese pronunciamiento, el juzgador aduce dudas razonables de inconstitucionalidad de los ordinales 7, 17 y 20 de la ley nro. 9852 (Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas), y plasma el fundamento de tales cuestionamientos. Asimismo, la consulta fue formulada en el expediente nro. 21-000318-1263-PE, asunto pendiente de resolver por el tribunal consultante. En adición, en los términos del ordinal 104, se observa que la consulta fue formulada mediante resolución fundada (resolución de las 15:41 horas de 29 de mayo de 2024), en la que, además, se emplazó a las partes para dentro de tercer día y se suspendió la tramitación del proceso base hasta la evacuación del sub iudice.

En virtud de lo anterior, corresponde analizar por el fondo la consulta formulada respecto de las normas que el tribunal consultante debe aplicar en el proceso jurisdiccional que tramita, como de seguido se hace.

En primer lugar, se cuestiona la constitucionalidad del canon 7 de la ley nro. 9852, que dispone: “ARTÍCULO 7-Transporte y distribución ilegal de combustibles derivados del petróleo o sus mezclas. Se impondrá la pena de prisión de uno a cuatro años, a quien, en el territorio nacional, introduzca, transporte o distribuya combustibles derivados del petróleo o sus mezclas de forma ilegal o sin la debida autorización de Recope o del Ministerio de Ambiente y Energía (Minae).

Acerca de este punto, el tribunal consultante estima que la norma citada quebranta el principio de tipicidad, toda vez que en lo atinente al “transporte” sanciona a quien lo haga de “forma ilegal”. En ese tanto, aduce que el término “ilegal” es un elemento normativo del tipo penal que debe estar definido por la norma en cuestión, pues de lo contrario quedaría al arbitrio del operador jurídico el determinar la legalidad o ilegalidad de la conducta a los efectos de subsumirla en el tipo penal. Arguye, a su vez, que el elemento normativo “ilegal” no puede determinarse vía reglamentaria.

Ahora bien, como explica la Procuraduría General de la República (PGR) en su informe, la norma cuestionada se debe ponderar con lo regulado en el precepto 1º de la propia ley nro. 9852, que justamente desarrolla el objeto de ese cuerpo normativo. De este modo, la referida norma contempla: “ARTÍCULO 1-Objeto de la ley. La presente ley tiene como objeto sancionar las actividades ilícitas relacionadas con el apoderamiento ilegal de combustibles derivados del petróleo y sus mezclas, que sean propiedad de la Refinadora Costarricense de Petróleo, en adelante Recope, así como la introducción ilegal de combustibles derivados del petróleo y sus mezclas, en el territorio nacional.”. (El resaltado no corresponde al original).

De tal forma, como bien afirma la PGR, la ilegalidad de la conducta de transporte o distribución de combustibles derivados del petróleo o sus mezclas está determinada por el “apoderamiento” ilegítimo de estas sustancias. En ese sentido, conviene resaltar que el numeral 2 eiusdem establece: “ARTÍCULO 2-Prohibición general. La importación exclusiva de combustibles derivados del petróleo le corresponde a Recope, como empresa pública que administra el monopolio del Estado en la importación, refinación, distribución al mayoreo del petróleo crudo y sus derivados; por lo tanto, toda importación realizada por un tercero no autorizado por Recope es ilegal, por lo que toda persona física o jurídica queda sujeta a las sanciones establecidas en esta ley y en cualquier otra norma vigente.”.

En concordancia con esta última disposición, el ordinal 1º de la ley nro. 7356 indica: “Artículo 1º- La importación, refinación y distribución al mayoreo de petróleo crudo y sus derivados, que comprenden combustibles, asfaltos y naftas, para satisfacer la demanda nacional, son monopolio del Estado.”.

A partir de lo anterior, como afirma la PGR, se desprende fácilmente que la introducción de combustible al territorio nacional, sin la debida autorización de Recope o Minae, se realiza de manera ilegal; de modo que el apoderamiento para transporte o distribución que se haga de esas sustancias introducidas de manera ilegítima deviene también “ilegal”. Así, como afirma el procurador en su informe: “se entiende que la primera conducta regulada en el numeral 7 de la ley 9852 que comprende el transporte y distribución de combustible derivado de apoderamiento es completamente clara y no amerita ninguna remisión a un reglamento como parece entenderlo el Tribunal Consultante.”.

Por otra parte, la norma cuestionada también regula otro supuesto de comisión delictiva, que es cuando las acciones de transporte o distribución se realicen sin los debidos permisos de Recope o Minae, pese a que el combustible derivado del petróleo o sus mezclas hayan sido introducidos al país legalmente. Así, la norma parte de un peligro abstracto, ya que el combustible es una sustancia inflamable y contaminante, de modo que su transporte sin los debidos permisos ocasiona un riesgo para la seguridad común, la salud y el medio ambiente. Precisamente, como advierte la PGR, atinente al transporte de combustible se debe acatar el reglamento nro. 36627-MINAE, de manera que efectuar tal acción sin el cumplimiento de los requerimientos correspondientes y sin la debida autorización genera un riesgo de especial envergadura, que la normativa penal cuestionada sanciona de forma legítima.

En virtud de lo expuesto, el infrascrito no advierte que el ordinal 7 de la ley nro. 9852 presente los vicios de constitucionalidad alegados.

Ahora, de forma complementaria, el tribunal consultante también cuestiona el canon 20 eiusdem, que indica: “ARTÍCULO 20-Reglamentación de esta ley. El Poder Ejecutivo reglamentará la presente ley en un plazo máximo de seis meses a partir de su vigencia. La falta de reglamentación no impedirá la aplicación de esta ley ni su obligatoria observancia”. (El resaltado no corresponde al original). En ese sentido, señala que es inconstitucional al compeler a los jueces a aplicar el precepto 7 citado ut supra, pese a que, a su juicio, tal norma quebranta el principio de tipicidad.

Al respecto, como se apuntó, el alegato que hace el tribunal respecto del artículo 20 resulta complementario a lo argüido en cuanto al numeral 7. Así, al no constatarse la alegada inconstitucionalidad de esta última norma, tampoco se evidencia vicio alguno por el hecho de que el referido canon 20 estatuya la obligatoria aplicación de la ley nro. 9852, que en concreto es lo cuestionado por el tribunal consultante.

Finalmente, se cuestiona el precepto 17 eiusdem, que señala: “ARTÍCULO 17-Decomiso de combustibles derivados del petróleo. Los combustibles derivados del petróleo o sus mezclas, que según la Ley 6588, Ley que Regula a la Refinadora Costarricense de Petróleo (Recope), de 30 de julio de 1981, correspondan al monopolio de Recope, que no cuenten con las autorizaciones de Recope o provengan de los delitos sancionados por esta ley, podrán ser decomisados por los órganos policiales, jurisdiccionales y el Ministerio Público (…)”. Sin embargo, en los términos formulados por el consultante, no se advierte que esa norma sea aplicación directa al proceso jurisdiccional base. En ese sentido, en la consulta, el tribunal no explica en concreto la aplicabilidad de la norma al caso sometido a su conocimiento, sino que, en general, expone que tal regulación afecta a la comunidad de Tortuguero del distrito de Colorado de Pococí y a la Asociación de Boteros y Transportistas de Barra del Tortuguero.

Al respecto, la PGR resalta en su informe que, en el expediente penal, lo que se observa es un acta de decomiso de combustible realizado por la Fuerza Pública, sin que se desprenda que el material decomisado se encuentre bajo la custodia de la autoridad jurisdiccional en el proceso penal a su cargo, de ahí que arguye: “al haberse materializado el decomiso por parte de un órgano policial, el presupuesto contenido en dicho numeral no es un aspecto que deba de ser aplicado por el señor juez en el proceso que se invoca como antecedente para formular la consulta.”. Por consiguiente, resulta improcedente la consulta formulada en tales términos.

En virtud de las consideraciones expuestas, no advierto vicio alguno susceptible de ser declarado en este proceso de control de constitucionalidad.

Res. n.°2024-024395 VOTO SALVADO DE LAS MAGISTRADAS GARRO VARGAS Y HESS HERRERA, con redacción de la primera Las suscritas magistradas respetuosamente nos separamos del voto de la mayoría, pues consideramos que la consulta judicial es admisible y, por el fondo, estimamos que no hay vicio de inconstitucionalidad.

I. SOBRE LA ADMISIBILIDAD DE LA CONSULTA JUDICIAL

El art. 102 de la Ley de la Jurisdicción Constitucional (LJC) establece los presupuestos de admisión de las consultas judiciales en los siguientes términos:

Todo juez estará legitimado para consultarle a la Sala Constitucional cuando tenga dudas fundadas sobre la constitucionalidad de una norma o acto que deba aplicar, o de un acto, conducta u omisión que deba juzgar en un caso sometido a su conocimiento.

De esta norma se desprenden cuatro elementos condicionantes y fundamentales para su procedencia que son los siguientes: a) que sea formulada por un juez; b) que existan “dudas fundadas” sobre la constitucionalidad de la norma, acto, conducta u omisión que se deba aplicar o juzgar; c) que exista un caso sometido al conocimiento del juzgador o tribunal y d) que, en ese asunto previo, deba aplicarse la norma o juzgarse el acto, conducta u omisión que suscite la duda de constitucionalidad. Asimismo, el art. 104 de la misma ley, exige que la consulta judicial se formule en resolución fundada, se emplace a las partes dentro de tercero día y se suspenda la tramitación del proceso, hasta tanto la Sala no haya evacuado la consulta.

Las normas de la LJC se deben interpretar juntamente con lo dispuesto en el art. 8 de la Ley Orgánica del Poder Judicial (LOPJ) que regula, en lo conducente, lo siguiente:

Art. 8.- Los funcionarios que administran justicia no podrán:

  1. 1Aplicar leyes ni otras normas o actos de cualquier naturaleza, contrarios a la Constitución Política o al derecho internacional o comunitario vigentes en el país.

Si tuvieren duda sobre la constitucionalidad de esas normas o actos, necesariamente deberán consultar ante la jurisdicción constitucional. (Lo resaltado no corresponde al original).

Tal y como se aprecia, la consulta judicial tiene un talante incidental, similar al que tiene la acción interpuesta a tenor del artículo 75 párrafo primero de la LJC, y ha de entenderse que la consulta judicial tiene por objeto amparar el derecho de alguna de las partes procesales. Nótese, inclusive, que el art. 105 de la LJC confirma el propósito subjetivo e incidental de las consultas judiciales, toda vez que autoriza a las partes legitimadas a realizar el trámite de conversión de consulta judicial a acción de inconstitucionalidad. En el párrafo segundo de la norma bajo análisis se regula lo siguiente:

No obstante, cualquiera de ellas que estuviere legitimada para plantear una acción podrá solicitarle a la Sala, dentro del término del emplazamiento, que se le dé al asunto el carácter y los efectos de dicha acción de inconstitucionalidad, en cuyo caso deberán interponer formalmente esta última dentro de los quince días siguientes. Si lo hicieren, se le dará a la acción el trámite correspondiente, y la Sala se abstendrá de evacuar la consulta como tal, pero deberá pronunciarse sobre ésta en el fallo.

Al contestar la audiencia de ley, la Procuraduría General de la República (PGR) informa que en el caso concreto se repiten los reclamos de inconstitucionalidad formulados en otra acción de inconstitucionalidad, que se había interpuesto en contra de los arts. 7, 17, y 20 de la ley n.°9852, tramitada bajo el expediente de la Sala Constitucional n.°22-000391-0007-CO y, por tanto, objeta la admisibilidad de la consulta judicial, pues “deja de ser un cuestionamiento propio para convertirse (en apariencia) en eco de una acción ya instaurada y que no fue admitida”. Dicha tesis fue la adoptada por la mayoría de esta Sala.

No obstante, al respecto, esta minoría constató que, al menos, existen dos consultas judiciales recientes en las que los jueces consultantes fundan sus razonamientos en los argumentos planteados por las partes del proceso principal. De modo que el hecho de que el razonamiento provenga de una de las partes no inhibe la posibilidad de que un juez asuma como propias las dudas de constitucionalidad que se le formulan (ver, al respecto, las consultas judiciales números 2022-008751 y 2024-001728, en las cuales, si bien la magistrada Garro Vargas consignó sus propias razones, no desestimó la admisibilidad de las consultas por el hecho de que la duda de constitucionalidad provenga del razonamiento de alguna de las partes). En consecuencia, atendiendo al carácter de la consulta judicial –aunque se base en los alegatos de una acción anterior o los razonamientos de alguno de los litigantes– esta podría ser admisible porque ha motivado en el juez una duda de constitucionalidad sobre la normativa que debe aplicar.

En el sub lite se acreditó que la consulta judicial se realizó por parte del juez Juan Carlos Jiménez, actuando como juez suplente del Tribunal Penal de Pococí (Tribunal del Segundo Circuito Judicial de la Zona Atlántica), mediante resolución de las 15:41 horas de 29 de mayo de 2024, en la que expuso que le corresponde resolver el proceso penal n.°21-000318-1263-PE instaurado justamente por la presunta comisión del delito de transporte y distribución ilegal de combustible, tipificado en el art. 7 de la ley n.°9852. De forma transparente, el juzgador consignó que el día 03 de noviembre del 2021, durante la continuación de la audiencia, se invocó la inconstitucionalidad de las normas cuestionadas como medio razonable para amparar los derechos lesionados. Finalmente, el juez fundó razonablemente sus dudas de constitucionalidad, principalmente en lo relativo a la supuesta infracción al principio de tipicidad.

Se constató que, en la supra citada resolución, el juez emplazó a las partes para que manifestaran lo correspondiente y se suspendió el proceso penal hasta la resolución de la consulta judicial.

En virtud de estas consideraciones, se estima que la consulta judicial es admisible y procede evacuarla por el fondo.

II. SOBRE EL FONDO

A.-Normas consultadas El juez consultante plantea sus dudas de constitucionalidad en relación con los arts. 7, 17 y 20 de la Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas, n.°9852. Los numerales establecen lo siguiente:

Art. 7- Transporte y distribución ilegal de combustibles derivados del petróleo o sus mezclas. Se impondrá la pena de prisión de uno a cuatro años, a quien, en el territorio nacional, introduzca, transporte o distribuya combustibles derivados del petróleo o sus mezclas de forma ilegal o sin la debida autorización de Recope o del Ministerio de Ambiente y Energía (Minae).

Art. 17- Decomiso de combustibles derivados del petróleo. Los combustibles derivados del petróleo o sus mezclas, que según la Ley 6588, Ley que Regula a la Refinadora Costarricense de Petróleo (Recope), de 30 de julio de 1981, correspondan al monopolio de Recope, que no cuenten con las autorizaciones de Recope o provengan de los delitos sancionados por esta ley, podrán ser decomisados por los órganos policiales, jurisdiccionales y el Ministerio Público.

La Refinadora Costarricense de Petróleo (Recope) deberá acudir inmediatamente, en un plazo no mayor a tres días, a los lugares donde las autoridades descubran la existencia de combustibles derivados del petróleo o sus mezclas, que no cuenten con la autorización de Recope, prestarle la asistencia que requieran; captar, transportar y custodiar el material decomisado, según las técnicas destinadas para este fin.

Art. 20- Reglamentación de esta ley. El Poder Ejecutivo reglamentará la presente ley en un plazo máximo de seis meses a partir de su vigencia. La falta de reglamentación no impedirá la aplicación de esta ley ni su obligatoria observancia. (Lo subrayado no corresponde al original).

Ahora bien, aunque no está consultado, se transcribe a continuación el art. 1° de la ley, pues nos refiere al contexto de aplicación del tipo penal especial contenido en la norma (art. 7):

Art.1- Objeto de la ley. La presente ley tiene como objeto sancionar las actividades ilícitas relacionadas con el apoderamiento ilegal de combustibles derivados del petróleo y sus mezclas, que sean propiedad de la Refinadora Costarricense de Petróleo, en adelante Recope, así como la introducción ilegal de combustibles derivados del petróleo y sus mezclas, en el territorio nacional. (Lo subrayado no corresponde al original).

Además, el art. 2 ilustra la prohibición general de la normativa bajo análisis:

Art.2 -Prohibición general. La importación exclusiva de combustibles derivados del petróleo le corresponde a Recope, como empresa pública que administra el monopolio del Estado en la importación, refinación, distribución al mayoreo del petróleo crudo y sus derivados; por lo tanto, toda importación realizada por un tercero no autorizado por Recope es ilegal (*), por lo que toda persona física o jurídica queda sujeta a las sanciones establecidas en esta ley y en cualquier otra norma vigente.

B.- Alegato del juez consultante El juez penal solicita a esta Sala que se pronuncie sobre las dudas de constitucionalidad que tiene sobre los arts. 7, 17, y 20 de la Ley para sancionar el apoderamiento y la introducción ilegal de los combustibles derivados del petróleo y sus mezclas.

La duda de constitucionalidad radica en que el numeral 7 –a su juicio– estaría quebrantando el principio de tipicidad, dado que, al tipificar la conducta señalada, sanciona el transporte de combustible en forma ilegal, sin que se clarifique ese aspecto:

“El elemento normativo del tipo penal "ilegal", debe por imperativo de ley, estar definido en la norma en cuestión, caso contrario, al momento de aplicar la norma, queda al libre arbitrio de la autoridad administrativa o judicial determinar si el transporte es legal o ilegal, como sucedió en el caso donde se invocó la inconstitucionalidad de la norma (…)

La aplicación del artículo 7 cuestionado, el cual es un tipo penal defectuoso, indeterminado, conlleva dos problemas: 1) La imposibilidad de que, mediante la "potestad reglamentaria", se pueda llenar o suplir las falencias de elementos normativos y descriptivos de la tipicidad, por la mala técnica legislativa. (…) El segundo problema derivado de la aplicación del artículo 7 cuestionado, radica en la letra del artículo 20 de la ley 9852 (…) la falta de reglamentación no impedirá la aplicación de esta ley ni su obligatoria observancia (sic)”.

C.- Informe de la PGR La PGR enmarca las normas cuestionadas dentro de dos aspectos de importancia. En primer lugar, que la regulación debe ser ponderada con lo que dispone el art. 1° de la ley 9852| siendo que el objeto de la ley es sancionar las actividades ilícitas relacionadas con el apoderamiento ilegal de combustibles derivados del petróleo y sus mezclas que sean propiedad de la Refinadora Costarricense de Petróleo (RECOPE). En segundo lugar, se refieren a que al decretarse el monopolio del Estado en la importación, refinación y distribución al mayoreo del petróleo crudo y sus derivados (combustibles, asfaltos y naftas), por ley n.°7536 de 24 de agosto de 1993, el legislador determinó que esa distribución es un servicio público. Un servicio explotado a través de RECOPE, empresa pública concesionaria del servicio de distribución de combustibles al mayoreo. Luego, que no obstante que el transporte por otros medios no ha sido previsto como servicio público regulado en la ley n.°7593, el Reglamento para la Regulación del Transporte de Combustible, decreto ejecutivo n.°36627 de 23 de junio de 2011 dispone que el transporte de combustible por unidades de transporte terrestre constituye un servicio público y que sus tarifas serán fijadas por la Autoridad Reguladora de los Servicios Públicos (ARESEP).

Entonces, dentro de la primera conducta descrita en la norma en análisis, se tiene que lo ilegal de la conducta que se sanciona está determinada para quien distribuya combustible producto de un apoderamiento el cual no puede ser evidentemente legal. De modo que la primera conducta regulada en el numeral 7 de la ley n.°9852, que comprende el transporte y distribución de combustible derivado de apoderamiento, es completamente clara y no amerita ninguna remisión a un reglamento. En cuanto al segundo aspecto de comisión delictiva que se describe en el art. 7, el mismo hace alusión a quien transporte o distribuya combustible sin los debidos permisos de RECOPE o del Ministerio de Ambiente (MINAE), y tal determinación se dirige a quien quiera transportar combustible –aunque no haya sido introducido de manea ilegal al país–, pero que dicho transporte se realice sin contar con los permisos respectivos.

Al respecto, se explica que esta acción en sentido jurídico penal corresponde a un delito de peligro abstracto ya que el hecho de no contar con los permisos para transportar combustible –siendo ésta una sustancia inflamable y contaminante–implica un riesgo implícito en la acción desplegada, lo que abarca la tutela de una serie de bienes jurídicos como la seguridad común, la salud y el medio ambiente.

Concluye la PGR, lo siguiente:

“[P]ara transportar combustible en nuestro país, se requiere cumplir con las regulaciones que están contenidas en el reglamento 36627-MINAE, de ahí que el no contar con los permisos para tal fin constituye una conducta punible, ello viene dado por el hecho que el legislador consideró que de hacerlo sin ningún tipo de autorización representa una actividad eminentemente riesgosa. Por ello no solo se dejó el tipo simple comprendido en el artículo 7, sino que se agregó un tipo agravado que establece un aumento en la sanción de todas otras conductas contenidas en la ley 9852, determinando como agravantes varios presupuestos entre los que destacan: cuando exista peligro para la salud o la vida de las personas ( el transporte en condiciones inadecuadas puede generar un riesgo para la vida o la salud de terceros); o bien cuando exista un daño ambiental ( aspecto que deriva justamente del transporte en condiciones inadecuadas) siendo que la emisión de los permisos lo que busca justamente es que aquella persona que transporte combustible lo haga cumpliendo con los requisitos para ello sin poner en riesgo la salud, la vida o el medio ambiente”.

D.- Resolución del caso concreto Conforme a una valoración integral de la normativa sometida a análisis y el informe de la PGR, las suscritas magistradas llegamos a la conclusión de que el tipo penal no presenta las deficiencias que el juez consultante le atribuye.

En primer término, a partir del enunciado del art. 2 de la norma, se tiene que la importación de combustibles derivados del petróleo se encuentra de forma exclusiva en manos de RECOPE, por lo que toda importación realizada por un tercero no autorizado por parte de aquella autoridad se reputa como ilegal, de modo que toda persona física o jurídica queda sujeta a las sanciones establecidas en la ley. La lectura integral de la normativa permite comprender que la introducción de combustibles derivados del petróleo o sus mezclas es un servicio encomendado exclusivamente a RECOPE, de modo que cualquier persona que no sea dicha autoridad podría incurrir en la conducta ilícita que la norma detalla. De otra parte, se tienen las acciones de transporte o distribución de combustibles que, como se informó por parte de la PGR, requieren de una autorización de RECOPE o del MINAE. En caso de no contar con aquellos permisos para la actividad, del mismo modo, se incurre en una conducta sancionada por nuestro ordenamiento jurídico en virtud de la peligrosidad que acarrea.

Una tipificación así obedece a la determinación del legislador de procurar evitar riesgos potenciales en los bienes jurídicos que se tutelan y esta Sala ha avalado su constitucionalidad (ver, por ejemplo, la sentencia n.°2019-019608). Al respecto, esta minoría no aprecia que se trate de una norma penal que incurra en los vicios apuntados por el juez consultante.

Así las cosas, como lo relativo a la antijuricidad de la conducta ya se encuentra definido en la propia legislación, no se aprecia que el hecho de que, además, se deba reglamentar la ley n.°9852 implique una lesión al principio de tipicidad o de legalidad penal (art. 20 consultado).

Finalmente, en lo relativo al decomiso de los combustibles, consideramos que no se trata o no se vislumbra que sea un aspecto de aplicación en el caso concreto. En efecto, en el proceso penal el juzgador deberá determinar si la conducta atribuida a la persona imputada encuadra en los supuestos del art. 7, pero no se clarifica que, al respecto, deba resolver algún extremo relacionado con el decomiso. En cuyo caso, no se observa sobre el particular que la norma sea de aplicación al juicio base.

III. CONCLUSIONES

Corolario de las consideraciones realizadas, estimamos que la consulta judicial es admisible y que, por el fondo, no se aprecian los vicios de inconstitucionalidad formulados por el juez consultante.
