Document Review Decision No. 2025001161 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at diez horas cinco minutos del quince de enero de dos mil veinticinco.
Action of unconstitutionality (acción de inconstitucionalidad) brought by Nombre03, in his capacity as Mayor of Curridabat, seeking a declaration that the “Law Removing Two Properties Owned by the Municipality of Curridabat from Public Use and Authorizing Their Donation to the Ministry of Public Education (Escuela José María Zeledón),” No. 10118, published in Supplement No. 36 to La Gaceta No. 33 of 18 de febrero de 2022, is unconstitutional, on the grounds that it violates Articles 50 and 170 of the Political Constitution. The representative of the Procuraduría General de la República, the President of the Asamblea Legislativa, and the Minister of Public Education also participated in the proceedings.

Subsequently, during the legislative proceedings for expediente 22235, the Asamblea Legislativa mandatorily consulted the Concejo Municipal de Curridabat through official letter CPEM-101-2020 del 10 de marzo de 2021 (folio 86 del expediente legislativo), which issued its opinion through the resolution adopted at ordinary session N°47-2021 del 23 de marzo de 2021, artículo 2, capítulo 3. On this occasion, the current Concejo Municipal opposed the bill, considering that it could not compensate for the land parcel segregated from the park with another of the same nature within Urbanización José María Zeledón (folio 113 a 116 del expediente legislativo). Nevertheless, it submitted no technical report rebutting the statements made by the municipal engineer in report DCBIMC- 0153-11-2015 del 25 de noviembre de 2015, to the effect that the potential parcel segregation (segregación) would not affect compliance with artículo 40 de la Ley de Planificación Urbana, which had served as the basis for the request made by the Concejo Municipal at that time.
Subsequently, ten members of the Asamblea Legislativa filed an optional constitutional consultation (consulta facultativa de constitucionalidad), processed under expediente 22-22814-0007-CO, which was declared inadmissible by judgment 2022-00440 de las 9:15 horas del 7 de enero de 2022, because two of the signatories withdrew their support for the consultation. That said, based on the factual circumstances described and the provision ultimately enacted, we consider that no unconstitutionality exists in this case, for the reasons we shall now explain. First, we must note that any violation of municipal autonomy must be ruled out because, as indicated, the legislative initiative had been requested by the Municipalidad de Curridabat itself in 2015, for which purpose the corresponding resolution of its then-serving Concejo Municipal requesting the introduction of the bill was submitted. Additionally, it must be considered that the legal nature of the challenged provision is solely that of an authorizing provision (norma habilitante), and it does not have the capacity to compel the municipal entity to donate the properties in question.
In this regard, this advisory body has repeatedly stated that authorizing statutes (leyes autorizantes), such as the challenged statute, have no effect by themselves. In this regard, see legal opinion (dictamen) C-073-97 del 9 de mayo de 1997. Given that the challenged law is solely an authorizing provision enabling the Municipalidad de Curridabat to donate to MEP the land on which Escuela José María Zeledón Brenes is located, we consider that the provision itself cannot violate municipal autonomy, because the municipal entity must adopt the corresponding resolution authorizing the execution of the deed before the Notaría del Estado. This was noted during the legislative proceedings when this Procuraduría was consulted regarding the bill that served as the basis for Ley 10118. Specifically, in legal opinion OJ-112-2017 del 11 de setiembre de 2017, it was stated: “If enacted, the bill in question would authorize the Municipalidad de Curridabat to dispose of the property under the terms described.
It is important to bear in mind that, on repeated occasions, the Procuraduría has stated that authorization to donate is discretionary rather than mandatory for the active administration (administración activa). Statutes authorizing public institutions to transfer their property have no effect by themselves; both authorization for the respective representatives to execute the deed and the actual transfer of the property are required in order to comply with the principle of legality (principio de legalidad) enshrined in artículo 11 de la Ley General de Administración Pública y 11 de la Constitución Política. (Ver entre otros OJ-095-2001) In this specific case, following approval of the special statute, a resolution of the Consejo Municipal would be required to authorize both the donation of the property and its representative to execute the corresponding transfer deed. Similarly, the Ministerio de Educación Pública, acting through its head, would be required to accept the donation of the properties and authorize the representative of the Procuraduría General de la República to execute the relevant deed.” Having ruled out a violation of municipal autonomy for the reasons stated, we must determine whether there is a violation of the residents’ right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado), given the petitioner’s argument concerning the lack of replacement land to compensate for the park area.
In this regard, it has been established that, although the municipality itself requested that the Asamblea Legislativa enact the challenged provision, the municipality subsequently stated during the legislative proceedings for bill 22235 that the park area being lost needed to be replaced; however, neither the municipality nor the residents found land that could provide such compensation (folios 4 y folio 113 a 116 del expediente legislativo). Nevertheless, as indicated, no technical report was submitted on this occasion to rebut the report issued by engineer Douglas Alvarado, Director de Castro y bienes Inmuebles de la Municipalidad de Curridabat, which stated that “the potential parcel segregation does not affect compliance with artículo 40 de la Ley de Planificación Urbana” (folios y 223 11 del expediente legislativo). This is critically important because, although the Sala Constitucional has protected the existence of parks and community facilities as part of the substance of the right to the environment, it has protected only the minimum percentages established for such areas in artículo 40 de la Ley de Planificación Urbana.
In other words, there is no specific fundamental right to enjoy percentages greater than those established by the legislature. This follows from judgment 2000-4332 de las 10:51 horas del 19 de mayo de 2000, cited in our first section. It should be noted that the challenged provision authorizes only the segregation of two lots with a combined area of 4 580 m2 (artículo 2 de la Ley 10118), while the parent property (finca madre) initially had an area of 24.987 m2. This follows from artículo 1° de la ley, which authorizes the segregation of a first lot measuring 935 m2 from a parent property measuring 11849,58 m2, and a second lot measuring 3645 m2 from a parent property measuring 13 138,25 m2. In other words, the change of designated use (cambio de destino) affected only a very small portion of the land designated as a park, where Escuela José María Zeledón Brenes has also been located since 1992.
Therefore, it is not true that the local residents are unable to enjoy their right to recreation as a consequence of the challenged provision, because for thirty years they have had the same access to the park area, which, even after the authorized segregation, still encompasses more than twenty thousand square meters. Therefore, the municipality itself must demonstrate to the Sala that the current percentage of parkland fails to comply with numeral 40 de la Ley de Planificación Urbana, and the provision must be interpreted in favor of its preservation unless and until the contrary is demonstrated. The foregoing, together with the municipal engineer’s technical report stating that the authorization does not violate artículo 40 de la Ley de Planificación Urbana, leads us to conclude that the challenged provision also does not violate numeral 50 constitucional. It must be borne in mind that the jurisprudence of the Sala recognizing that a community’s park area may not be removed from its public-use designation (desafectar) without corresponding compensation was issued in cases in which community residents were deprived of the minimum percentages established in numeral 40 de la Ley de Planificación Urbana.
That does not appear to be the case here, because the municipal entity has not rebutted the technical opinion of its own municipal engineer, and the legislature expressly considered both this fact and the benefit generated for the community in order to justify the lack of compensation for the land authorized for segregation (ver exposición de motivos del proyecto de ley). It must also be considered that this case does not concern the construction of a new school (cases analyzed by the Sala on other occasions), but rather a school that has already occupied the site for thirty years. Finally, and no less importantly, we must note that this case also requires consideration of the best interests of the children (interés superior de los menores) in the community who attend Escuela José María Zeledón Brenes, which has occupied municipal land for three decades, preventing the Ministerio de Educación Pública from making the improvements and investments needed to effectively guarantee the children’s right to education.
Those best interests are recognized in artículo 3 de la Convención Sobre los Derechos del Niño. Ver además, Sala Constitucional, resolución número 2008-6813 de las diecisiete horas y cincuenta y seis minutos del veintitrés de abril del dos mil ocho. In this case, when balancing the best interests of the children, which the challenged provision seeks to protect, against the residents’ right to recreation—given that they will also continue to have access to the same park area—the balance must favor protection of the former. V. CONCLUSION: In view of the foregoing considerations, the Procuraduría considers that the petitioner (accionante) has standing (legitimación) to bring this constitutional challenge (acción de inconstitucionalidad). As to the merits, the challenged provision is not considered unconstitutional. The response to the hearing granted is hereby submitted in the foregoing terms.
To invest in this expansion of the physical facilities, the property must be registered with the Registro Nacional in the name of the State–MEP. The northern sector of the property is where the new buildings will be constructed; this sector has the appropriate technical characteristics for the expansion. CONCLUSIONS: As shown throughout this presentation, the educational center Escuela Dr. José María Zeledón serves a population of 150 students, projected to reach 300 for the 2024 school year. These students receive not only educational services, but also other services such as the school cafeteria, which enables many of the students who use it to meet not only their educational needs but, in many cases, their nutritional needs as well. The imminent closure of the educational center due to the deterioration of its facilities would cause immeasurable harm to a vulnerable population, namely the minors who use the educational services of Escuela Dr. José María Zeledón.
As the governing authority in educational matters, the Ministerio de Educación Pública has secured the resources to restore and expand the educational facilities. Nevertheless, because the property does not belong to the Ministerio de Educación Pública, and by operation of law, it is materially and legally impossible to invest the funds already available; moreover, as is well known, for budgetary reasons, those funds will no longer be available if they are not spent within the fiscal year. For this reason, Ley N° 10118, entitled “Removal from public-use designation of two properties owned by the Municipalidad de Curridabat and authorization to donate them to the Ministerio de Educación Pública (Escuela José María Zeledón)” (“Desafectación de dos bienes inmuebles propiedad de la Municipalidad de Curridabat y autorización para donarlos al Ministerio de Educación Pública (Escuela José María Zeledón)”), was enacted.
It permits the donation to the Ministerio de Educación Pública of the land occupied by the School for more than thirty years, thereby allowing the necessary work to be performed to ensure the continuity of educational services. A review of the legal provisions invoked by the petitioner makes it abundantly clear that its arguments are mistaken, as evidenced by the absence of proof and arguments demonstrating any infringement of the constitutional principle establishing every person’s right to a healthy and ecologically balanced environment. Furthermore, it has not shown any violation of section 40 of the Urban Planning Law, first because the designated use of those properties is not being changed, since three decades ago the Municipalidad de Curridabat transferred to the Ministerio de Educación Pública the 4500 m2 designated to house the facilities of the Centro Educativo Escuela Dr. José María Zeledón; second, because the established percentages for park area are not being modified, and therefore there is no infringement of the constitutional right of every person to a healthy and ecologically balanced environment; and finally, because the municipality disregards the concept of community facilities (facilidades comunales) contained in the Urban Planning Law and conceptually developed in the Reglamento de Fraccionamientos y Urbanizaciones of the Instituto Nacional de Vivienda y Urbanismo.
Its arguments are erroneously and tendentiously based on the premise that Article 40 of the Urban Planning Law requires the entire area transferred by the developer to be used exclusively as “park area,” and it bases its compensation theory on that premise, seeking to impose a condition that is impossible to satisfy, given that the Municipalidad itself states that no property within the Urbanización meets the requirements it seeks to impose as compensation. RELIEF SOUGHT (PETITORIA): It is requested that the application for a declaration of unconstitutionality be summarily dismissed. Should the merits be considered, it is requested that the application be denied in its entirety.
Magistrado Cruz Castro drafts the opinion; and,
Considering:
I.Regarding the subject matter of the challenge.- The petitioner, in his capacity as Alcalde Municipal, requests that Ley N°10118 del 2 de febrero de 2022, entitled Ley de Desafectación de dos bienes inmuebles propiedad de la Municipalidad de Curridabat y autorización para donarlos al Ministerio de Educación Pública (Escuela José María Zeledón Brenes), be declared unconstitutional. That law provides as follows:
“WITHDRAWAL FROM PUBLIC USE OF TWO PROPERTIES OWNED BY THE MUNICIPALIDAD DE CURRIDABAT AND AUTHORIZATION TO DONATE THEM TO THE MINISTERIO DE EDUCACIÓN PÚBLICA (ESCUELA JOSÉ MARÍA ZELEDÓN BRENES) ARTICLE 1- Two properties owned by the Municipalidad de Curridabat, legal entity identification number three - cero uno cuatro - cero cuatro d1)B cero cuatro siete (N.º 3-014-042047), are withdrawn from public use and the public domain (uso y dominio público), and are described as follows:
A lot measuring novecientos treinta y cinco metros (935 m2), to be segregated from the parent parcel (finca madre) recorded in the Registro Público de la Propiedad under the real-property folio system (sistema de folio real), registration number PRN01 (N.º PRN07), province of San José, canton of Curridabat. The parent parcel is described as follows: land designated as a community park, located in the province of San José, canton 18 Curridabat, district 2° Granadilla, measuring once mil ochocientos cuarenta y nueve metros c 3drados con cincuenta y ocho decímetros cuadrados (11849,58 m:'), with the following boundaries (linderos): to the north, Dirección02 pública, avenida 3 con setenta coma quince metros (70,15m); to the south, Nombre02; to the east, Dirección03); and to the west, the Municipalidad de Curridabat, in accordance with cadastral survey plan (plano catastrado) number PRN08 (N.º 516072-1983).
The second lot measures tres mil seiscientos cuarenta y cinco metros cuadrados (3 645 m2) and is to be segregated from the property recorded in the Registro Público de la Propiedad under the real-property folio system, registration number PRN02 (N.º 295...,7B-000), province of San José, canton of Curridabat. The parent parcel is described as follows: land designated as a community park, located in the province of San José, canton 18 Curridabat, district 1° Curridabat, measuring trece mil ciento treinta y ocho metros con veinticinco decímetros cuadrados (13 138,25 m2), with the following boundaries: to the north, Dirección02; to the south, Dirección02; to the east, Hogares de Costa Rica S.A.; and to the west, Dirección02; there is no registered cadastral survey plan.
The Municipalidad de Curridabat, legal entity identification number three - cero uno cuatro - cero cuatro dos, cero cuatro siete (N.º 3-014-042047), is authorized to donate the two lots withdrawn from public use and described above to the Ministerio de Educación Pública, legal entity identification number dos-uno cero cero-cero cuatro dos cero cero dos (N.º 2-100-042002), free of encumbrances (gravámenes) and notices (anotaciones).
ARTICLE 2- The lot resulting from the consolidation of the two segregated parcels is dedicated to the new use of an educational institution, with an area of cuatro mil quinientos ochenta metros cuadrados (4 580m2), in accordance with cadastral survey plan number siete cinco nueve nueve cero ocho-uno nueve ocho ocho (N.º 759908-1988).
ARTICLE 3- The Notaría del Estado is authorized to prepare the deed of transfer (escritura de traspaso) for the property and arrange for its registration in the Registro Nacional. The Procuraduría General de la República is likewise authorized to correct any defects identified by the Registro Nacional.
Effective upon publication.” The arguments concern the following matters:
1. Violation of constitutional article 170 (municipal autonomy): The petitioner states that the legislative record shows that the Concejo Municipal responded negatively to the consultation. Although the Comisión Permanente de Asuntos Municipales y Desarrollo Local Participativo was aware of the opposition to the bill, the negative response was disregarded, and the legislative process continued until the law was enacted. He considers that disregarding the local government’s position concerning land that it owns and that is designated as parkland contravenes the autonomy granted to it under the Constitution. One of the properties is the site of the municipal swimming pool, and the canton’s future sports projects are therefore adversely affected.
2. Violation of the right to the environment, the rules governing public-domain property (bienes demaniales), and article 40 of the Ley de Planificación Urbana: The petitioner states that the properties in question are designated as parkland; however, the challenged law does not provide for replacement of the areas, as required by article 40 of the Ley de Planificación Urbana. He adds that the challenged law violates article 50 of the Constitución Política, because every citizen has the right to a healthy and ecologically balanced environment, a right realized through the natural spaces and park areas designated for the use and enjoyment of residents of the various communities (see voto n°2007-2942). The Sala Constitucional has held that withdrawing a park area from public use without complying with the corresponding procedure is unconstitutional. Leaving an urban development without a park area infringes the right to enjoy a healthy and ecologically balanced environment (see voto n°2000-4332 y n°2013-9997).
He concludes that, because it was not determined what “other land” would replace the park area to be donated to the MEP, the challenged law is unconstitutional insofar as it withdraws from public use portions of properties owned by the Municipalidad de Curridabat and designated as parks. Finally, he adds that the challenged law plainly violates the protection that the Administration is required to provide to community public-domain property, consisting in this case of two portions of land belonging to parks.
In summary, he states that the challenged law violates municipal autonomy because the Municipalidad de Curridabat opposed its approval during the legislative process; it also violates the residents’ right to enjoy a healthy and ecologically balanced environment because the park area and community facilities were withdrawn from public use without compensation.
II.Rules on standing (legitimación) in actions of unconstitutionality (acciones de inconstitucionalidad) and standing in this case.- Article 75 of the Ley de la Jurisdicción Constitucional governs the prerequisites determining the admissibility of actions of unconstitutionality, requiring the existence of a matter pending resolution in administrative or judicial proceedings in which unconstitutionality is invoked; this requirement is not necessary in the cases provided for in the second and third paragraphs of that article, that is, when, because of the nature of the provision, there is no individual or direct injury; when the action is based on the defense of diffuse interests (intereses difusos) or interests concerning the community as a whole; or when it is filed by the Procurador General de la República, the Contralor General de la República, the Fiscal General de la República, or the Defensor de los Habitantes, in the latter cases within their respective spheres of authority.
Based on the foregoing, the possibility is provided for seeking relief in defense of “diffuse interests,” namely those held by groups of persons who are not formally organized but are united by a particular social need, a physical characteristic, their ethnic origin, a particular personal or ideological orientation, consumption of a certain product, etc. In such cases, the interest is spread, diluted (diffuse) among an unidentified plurality of persons. This Sala has identified various rights that it has characterized as “diffuse,” including the environment, cultural heritage, the defense of the country’s territorial integrity, sound management of public spending, and the right to health, among others. Moreover, the list established by the Sala Constitucional is not exhaustive. This action was admitted insofar as it alleges the defense of diffuse interests in protection of the fundamental right to the environment (Article 50 of the Constitución Política).
Regarding the allegation of violation of municipal autonomy (autonomía municipal), the Sala has stated that “an action of unconstitutionality filed by a municipal Mayor on behalf of a territorial corporation must necessarily be supported by an agreement of the Concejo Municipal authorizing and empowering the Mayor to do so; otherwise, it must be deemed inadmissible.” (see vote No. 2007-007136). In this case, the petitioner states that he was authorized by agreement No. 6 of the Concejo Municipal, recorded in Article 1, Chapter 2, of ordinary session No. 92-2022 of February 1, 2022. Accordingly, there is also standing in this action to defend corporate interests (intereses corporativos), which in this case are those associated with the autonomy of the Municipalidad de Curridabat. The petitioner therefore has sufficient standing to file this action, both in defense of diffuse interests and in defense of corporate interests.
Finally, this is a matter whose constitutionality may properly be reviewed through these proceedings, since a statutory provision is being challenged; moreover, the petitioner complied with the requirements established in Articles 78 and 79 of the governing procedural law (Ley de rito). In conclusion, this action is admissible, and the subject matter and merits of the case must therefore be addressed immediately.
III.Legislative proceedings for Law No. 10118.- As may be gathered from the report submitted by the Procuraduría General de la República and from the legislative records for bill 22235, which gave rise to the challenged law, the following is established:
-Since 1992, the Escuela José María Zeledón Brenes of the canton of Curridabat has been located on a tract of land belonging to the municipality of that canton.
-Given the need to make improvements to the school and the inability of the Dirección de Infraestructura y Equipamiento del Ministerio de Educación Pública to invest resources in land not registered in the name of that ministry, the bill was proposed as a solution to the existing problem (folios 2 and 3 of the legislative record).
-This initiative originated with the Municipalidad de Curridabat itself, which, through official letter SMMC-347-12-2015 of December 3, 2015, forwarded Agreement No. 6 from ordinary session 291-2015 of November 26, 2015, by which the Concejo Municipal then in office authorized the Mayor to submit the bill to the Asamblea Legislativa (folios 5 and 9 through 13 of the legislative record). The Municipalidad placed on record technical report DCBIMC-0153-11-2015 of November 25, 2015, issued by engineer Douglas Alvarado, Director de Castro y bienes Inmuebles de la Municipalidad de Curridabat, which states: “Taking into consideration the area to be donated, corresponding to the properties registered under real-property folio numbers PRN04 and PRN05, it is determined that, according to the site plan for Urbanización José María Zeledón, the proposed segregation (segregación) does not affect compliance with Article 40 of the Ley de Planificación Urbana” (folios 11 and 223 of the legislative record).
-This request initially served as the basis for bill number 20004, which received a favorable committee report but was archived upon expiration of the four-year period on June 20, 2020.
-The initiative was reintroduced as bill number 22.235 on September 29, 2020.
-During the legislative proceedings for file 22235, the Asamblea Legislativa conducted the mandatory consultation (consulta preceptiva) with the Concejo Municipal de Curridabat through official letter CPEM-101-2020 of March 10, 2021 (folio 86 of the legislative record), which provided its opinion through the agreement adopted at ordinary session No. 47-2021 of March 23, 2021, Article 2, Chapter 3. In that regard, the current Concejo Municipal opposed the bill on the grounds that the land is designated for use as a public park and that such use cannot be offset with another parcel located in the area, in accordance with Article 40 of the Ley de Planificación Urbana (folios 113 through 116 of the legislative record).
-The bill received a favorable committee report by majority vote on September 14, 2021.
-Ten legislators filed an optional constitutional consultation (consulta facultativa de constitucionalidad), processed under file 22-22814-0007-CO, which was declared inadmissible by judgment 2022-00440 at 9:15 a.m. on January 7, 2022, because two of the signatory legislators withdrew their support for the consultation.
-The bill was approved on second reading on January 13, 2022, and published in Supplement No. 36 to La Gaceta No. 33 on Friday, February 18, 2022.
IV.Regarding the allegation of violation of municipal autonomy.- In the petitioner’s view, the challenged law violates the principle of municipal autonomy because the legislative record shows that the Concejo Municipal issued an unfavorable opinion on the bill that gave rise to the challenged law. Despite this, the Comisión Permanente de Asuntos Municipales y Desarrollo Local Participativo disregarded that opposition and continued processing the bill until the law was enacted. According to the report submitted by the PGR, the initiative originated with the Municipalidad de Curridabat itself (in 2015, giving rise to bill 20004), and the bill that gave rise to the challenged law (bill 22235 in 2020) was submitted to the Concejo Municipal de Curridabat for consultation. The alleged violation of municipal autonomy must therefore be rejected because the legislative initiative had been requested by the Municipalidad de Curridabat itself since 2015, for which purpose the corresponding agreement of its Concejo then in office was submitted, requesting that the bill be introduced.
In addition, it must be considered that the legal nature of the challenged provision is solely that of an enabling provision (norma habilitante), and it does not have the power to compel the municipal entity to donate the properties in question. Given that the challenged law is merely an enabling provision allowing the Municipalidad de Curridabat to donate to the MEP the land on which the Escuela José María Zeledón Brenes is located, it is considered that the provision itself cannot violate municipal autonomy, since the municipal entity must adopt the corresponding agreement for execution of the deed before the Notaría del Estado. For their part, in their respective reports, the Asamblea Legislativa, the Ministerio de Educación Pública, and the supporting respondent (coadyuvante pasivo) state, respectively, as follows:
-The law constitutes authorization for the Municipalidad de Curridabat to carry out the segregation and conveyance (traspaso), such that the circumstances concerning compensation may change and the Municipalidad might eventually have property with which to provide that compensation.
-The area of the land intended for donation to the Ministerio de Educación Pública is the same area that has been allocated to the school for more than 30 years; the new law does not alter that measurement, and therefore the area designated as a park remains unchanged. The structure of the property used as a school is subject to a sanitary order (orden sanitaria) declaring it uninhabitable, and immediate intervention is therefore required to ensure the safety of both the students and the personnel of the Ministerio de Educación Pública who work at that educational institution. Thus, far from violating the principle of municipal autonomy, it does the opposite.
-Since before 1992, an agreement promoted by the Municipalidad de Curridabat with the Ministerio de Educación provided for the construction of Escuela José María Zeledón Brenes on municipal land in the development bearing the same name, granting the school possession of the area specified in Law No. 10.118. In 2015, that same Concejo Municipal adopted a series of agreements concerning the donation of the land. It also ordered that all studies necessary to satisfy the requirements for introducing a bill be conducted, including opinion DSITNT-0139-011-2016, which stated that this would not affect Article 40 of the Ley de Planificación Urbana. The Mayor’s request for compensation is impossible to fulfill; moreover, such compensation was not required in another case involving a different school.
In this regard, this Chamber concludes that the challenged legislation does not violate the principle of municipal autonomy. As indicated by the PGR, given that the challenged law is merely an enabling provision allowing the Municipalidad de Curridabat to donate to the MEP the land on which the Escuela José María Zeledón Brenes is located, the provision cannot in itself violate municipal autonomy. The law in question empowers the Municipalidad de Curridabat to dispose of the property under the stated terms. However, that statutory provision constitutes discretionary authorization and not a mandate requiring the Municipalidad de Curridabat to donate the land in question. Legislative authorization is a form of permission enabling a particular institution, should it so decide, to adopt the resolution concerning the act it has been permitted to perform. It removes the legal obstacle preventing public institutions from freely disposing of their property.
As this Chamber has stated, “the intervention of the Asamblea Legislativa in this matter is a typically supervisory act of authorization, consisting of the removal of a legal obstacle so that the competent body may carry out the authorized activity.” (see voto n°5026-97). Laws authorizing public institutions to transfer their property have no effect in themselves. For them ultimately to be implemented, this case requires, as indicated by the PGR, first, a resolution of the Municipal Council authorizing the donation of the property, as well as authorization for its representative to execute the corresponding deed of transfer. Second, the head of the Ministerio de Educación Pública would have to accept the donation of the properties and authorize the representative of the Procuraduría General de la República to execute the deed. Thus, municipal autonomy, defined by this Chamber as “the capacity of Municipalities to decide freely and under their own responsibility everything relating to the organization of a particular locality (the canton, in our case).” (voto n°1999-05445), is neither affected nor compromised merely by the existence of a law such as the one challenged, whose purpose is to authorize—and not to obligate, mandate, or compel—the Municipalidad de Curridabat to donate the two decommissioned and described lots to the Ministerio de Educación Pública.
V.Regarding the allegations of violation of the right to the environment and the protection of public-domain property (bienes demaniales).- In the claimant’s view, the challenged law violates Article 50 of the Political Constitution, because every citizen has the right to a healthy and ecologically balanced environment, a right embodied in the natural spaces and park areas designated for the use and enjoyment of residents of the various localities. In this case, authorization is being granted for the Municipalidad de Curridabat to donate to the Ministerio de Educación Pública two portions of land belonging to parks, without compensation (in violation of Article 40 of the Ley de Planificación Urbana); this also entails changing their status from parkland to “land designated for the consolidation of the Escuela José María Zeledón educational center,” thereby removing properties designated as parkland from the public domain (desafectando).
According to the report submitted by the PGR, the law in question involves a change in public-domain use (mutación demanial), rather than a simple removal from the public domain (desafectación del dominio público), because, through the authorization for the Municipalidad de Curridabat to donate two properties to the Ministerio de Educación, the properties intended for park use remain dedicated to public service. In the case of parks and green areas within residential developments, the Sala Constitucional has included their protection within the scope of the right to an environment (see voto n°2332-2000). No technical report was submitted in the legislative record rebutting the report issued by engineer Douglas Alvarado, Director de Catastro y bienes Inmuebles de la Municipalidad de Curridabat, which stated that “the potential segregation (segregación) does not affect compliance with Article 40 of the Ley de Planificación Urbana” (folios and 223 11 of the legislative record).
The Sala Constitucional has protected the existence of parks and community facilities as part of the content of the right to the environment only with respect to the minimum percentages established for such areas in Article 40 of the Ley de Planificación Urbana; there is no specific fundamental right to enjoy percentages exceeding those established by the legislature. It should be noted that the challenged provision merely authorizes the segregation of two lots totaling 4.580 m2 (Article 2 of Ley 10118), while the parent property initially had an area of 24.987 m2. In other words, the change in designated use affected a very small portion of the land designated as parkland, where, moreover, the Escuela José María Zeledón Brenes has been located since 1992. Therefore, it is not true that local residents are unable to enjoy their right to recreation as a result of the challenged provision, because for thirty years they have had the same access to the park area, which, even after the authorized segregation, still encompasses more than twenty thousand square meters.
It concludes that the challenged provision likewise does not violate Article 50 of the Constitution. The Chamber’s case law recognizing that a community’s park area cannot be removed from the public domain without the corresponding compensation was issued in cases where community residents were deprived of the minimum percentages established in Article 40 of the Ley de Planificación Urbana, which does not appear to be the case here. Furthermore, it must be considered that this case does not concern the construction of a new school (cases examined by the Chamber on other occasions), but rather a school that has already been located there for thirty years. Finally, this case must also take into account the best interests of the minors in the community who attend the Escuela José María Zeledón Brenes, which has been located on municipal land for three decades, preventing the Ministerio de Educación Pública from making the improvements and investments needed to effectively guarantee the minors’ right to education.
For their part, in their respective reports, the Asamblea Legislativa, the Ministerio de Educación Pública, and the supporting respondent (coadyuvante pasivo) stated, respectively, that:
-Ley 10118 was enacted in accordance with Article 121.14 of the Political Constitution, and municipal autonomy and the provisions of Article 50 of the Constitution were respected at all times. It is appropriate for the Constitutional Court to analyze the constitutionality of this law under a modern conception of the public domain. Likewise, when tension exists between the right to education and the right to the environment, the greatest optimization of resources must be sought. The law does not violate Article 50; on the contrary, it seeks to allow minors to enjoy the environment.
-The area of the land intended to be donated to the Ministerio de Educación Pública is the same area that has been allocated to the School for more than 30 years; the new law does not change that measurement, and therefore the area designated as parkland remains intact. The structure of the property designated as a school is subject to a health order declaring it uninhabitable, and immediate intervention is therefore required to ensure the safety of both the students and the Ministerio de Educación Pública personnel working at that educational center. The law in question was promoted because of the urgent need to provide the basic educational service to minors. It is abundantly clear that no less than one-third of the area that the developer must convey is to be designated for park use, while the other two-thirds are designated for a purpose other than “park use,” as stated in Article 40 of the Ley de Planificación Urbana itself.
As established in that article, one-third corresponds to the park area (8329,27 m2), and the other two-thirds (16658,55 m2) are to be used for community facilities. The area designated as parkland has not been affected by the presence of the educational infrastructure. Segregating the 4500 m2 specified in the challenged law does not constitute a violation of the provisions of our Constitution. The imminent closure of the educational center because of the deterioration of its facilities would cause incalculable harm to a vulnerable population, namely the minors who use the educational services of the escuela Dr. José María Zeledón. It requests that the action be dismissed in its entirety -Because removal from the public domain involves the transfer of public property to a private party, compensation is logically required; however, if the removal involves transferring property from one public entity to another for public service purposes, with authorization for its donation, the former generally agrees to donate it without charge, and no dispute exists.
Requiring compensation by the Municipalidad for a public service provided for 30 years on land that does not interfere with other sporting and recreational activities and is compatible with a healthy environment, when the transfer should be free of charge, makes that compensation disproportionate and discriminatory.
In this regard, this Chamber does not consider the challenged law in this case to violate the right to the environment, for the reasons explained below:
Furthermore, because of the deterioration of the infrastructure and the health orders issued concerning the building, the bill that gave rise to the law in question was introduced so that the properties could be registered in the name of the State, thereby enabling it to carry out the necessary renovations and construction work.
The term ‘community facilities’ (facilidades comunales) does not have the breadth sought to be attributed to it. It is obvious to this Chamber that it refers to structures essential for the community’s enjoyment of property designated as a green area, park, and recreational space; consequently, the construction of buildings for public services, such as libraries, schools, community halls, etc., is incompatible with the designation as parkland and green areas that the legislature has required for certain properties, and, undoubtedly, for the interested associations to undertake the construction of buildings such as those in which they are interested, they must bear what concerns all members or residents of the locality who will benefit from the public and general use of the property—namely, its cost.” (judgment n°2000-4332 https://nexuspj.poder-judicial.go.cr/document/sen-1-0007-148995). That said, the foregoing does not mean that this Chamber is constitutionalizing specific percentages allocated by land subdividers (fraccionadores de terrenos) in accordance with land-use legislation; it means only that areas designated as parks cannot be entirely deprived of their substance.
In this case, it has been established that the two subdivided properties together measure 24.987,83 m2, with one-third corresponding to the park area (8.329,27 m2) and the other two-thirds (16.658,55 m2) to community facilities, and that the donation in question comprises approximately 4.500 m2. This takes into account that the latter has been used as an educational center for more than 30 years, has infrastructure constructed by the Ministerio de Educación Pública for the purpose of providing educational services to the residents of the community, and that the area designated as a park has not been affected by the presence of the educational infrastructure. This is stated by the Dirección de Infraestructura Educativa in official letter DVM-A-DIEE-DS-CBI-0108-2021, dated 16 de abril de 2021, which reads: “…This land is registered in the name of the Municipalidad de Curridabat as part of the real-property folios (folios reales) of San José PRN03 and PRN06 and has registered cadastral plan (plano catastrado) SJ- 759908- 1988.
A topographical review of the aforementioned registered cadastral plan was conducted, and it was established that its location, area, and dimensions coincide with the land occupied by the José María Zeledón school.” 4) Technical report states that the subdivision (segregación) does not affect art.40 of the Urban Planning Law: As the PGR points out in its report, the legislative record contains the technical report issued by engineer Douglas Alvarado, Director de Catastro y bienes Inmuebles de la Municipalidad de Curridabat, which stated that “the potential subdivision does not affect the provisions of Article 40 of the Urban Planning Law” (pages 223 and 11 of the legislative record). To date, no technical report contradicting that statement exists. Therefore, quite apart from the fact that determining whether the statute in question conflicts with another statute (art.40 Urban Planning Law) exceeds this Chamber’s jurisdiction, the fact remains that it has not been shown that the environmental rights protected by the Urban Planning Law are infringed by the challenged provision.
VI.Conclusion.- Given that the challenged statute does not violate the principle of municipal autonomy, because it constitutes an authorization and not an obligation imposed by the legislature on the municipal entity; given that the challenged statute does not violate the right to the environment because the land remains public in nature; because the change in purpose from “park” to “educational center” had already occurred in practice thirty years ago; because the case law of this Chamber has protected the designation of municipal land as parkland but has not constitutionalized specific percentages of land for this purpose; because, according to the technical report in the record, the subdivision does not affect art.40 of the Urban Planning Law; because the donation in question comprises approximately 4.500 m2, leaving a total of more than 20.000 m2, a substantial percentage of which the Municipality may readily designate as parkland, and because it was not shown that those 4.500 m2 were taken specifically from the one-third park area (8.329,27 m2), or that part of the other two-thirds (16.658,55 m2) intended for community facilities could not also be designated as parkland; and because this Chamber must balance the challenged matter against minors’ right to education and the best-interests-of-the-child principle with respect to approximately 300 students for the 2024 school year. There are no grounds for granting this constitutional challenge (acción de inconstitucionalidad), which must therefore be dismissed, as it hereby is.-
With respect for the majority’s position, I dissent in part regarding the admissibility of the challenge, because I consider that the person who filed it did not properly invoke the standing (legitimación) required to assess the alleged violation of the principle of municipal autonomy.
It follows from the application instituting the constitutional challenge that the argument concerning standing to bring the challenge was based on the defense of diffuse interests (intereses difusos), and the Presidency of the Chamber processed this case on that basis. Thus, the petitioner did not substantiate the standing required to seek protection of the aforementioned principle of autonomy. Upon closer examination, the petitioner also did not submit to the record of this proceeding the municipal resolution authorizing the institution of these constitutional-review proceedings (proceso de control de constitucionalidad). Accordingly, I consider that this Court should not, on its own initiative, add grounds for recognizing standing and examine the merits of that claim.
From my perspective, given the characteristics of constitutional challenges, it is not for this Chamber to remedy deficiencies in the petitioner’s arguments and add grounds different from those asserted in the initiating pleading (libelo de interposición). This is the position I have maintained in the past and which should be reiterated on this occasion. In that regard, in my dissenting opinion in judgment n.°2021-01158, I stated the following:
“I have considered it necessary to dissent and to dismiss this constitutional challenge, but on grounds of standing.
First, it must be emphasized what this Court has stated concerning the nature of and formalities that must be strictly observed in constitutional challenges. In this regard, the Chamber has insisted that the legislature designed these constitutional-review proceedings as formal proceedings. Accordingly, for purposes of admissibility, a series of requirements established for that purpose in the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional, LJC) must be satisfied. In addition to establishing compliance with the conditions of admissibility and standing (powers of attorney and certifications), the Law requires compliance with certain important formalities, such as expressly identifying the challenged provision, providing proper grounds, and specifically citing the constitutional provisions and principles alleged to have been infringed (art. 78), as well as providing a verbatim certification of the pleading in which the constitutional objection (reserva de inconstitucionalidad) was raised in the prior proceeding (art. 79). If one or more of these requirements are not satisfied, the Presidency of the Chamber may request that the aforementioned formal defects be cured and, if the order is not complied with, the President must deny the processing of the constitutional challenge (art. 80).
In dissent, I have stated that both the interpretation of arts. 78 and 79 and that of art. 80 itself of the Law governing this jurisdiction should be broad, for the benefit of those who come before this Chamber, so that access to constitutional justice is not unnecessarily restricted. Nevertheless, compliance with the corresponding requirements for initiating constitutional review of legal provisions must be verified. (…)
Thus, it does not appear valid to use ‘the guise’ of a diffuse consumer interest to establish the admissibility of a constitutional challenge when the actual objective is to safeguard other kinds of rights or interests that in fact encompass a broader economic community (vehicle importers), and it is even contradictory to seek to protect both interests in the same amparo proceeding (proceso de amparo), which in turn serves as the basis for this constitutional challenge.
Finally, I must point out that, if the petitioner based his standing on an amparo petition (recurso de amparo), this Court should not unilaterally recognize additional standing on the following grounds:
‘In this regard, the Chamber considers that, in addition to the amparo petition that has been admitted as the prior proceeding forming the basis for this constitutional challenge, the petitioner also has sufficient standing to challenge the constitutionality of the contested provision under the terms of Article 75, second paragraph, of the Constitutional Jurisdiction Law, because this concerns the defense of an interest affecting the national community as a whole, namely, the economic interests of consumers.’ In this regard, as noted supra, a constitutional challenge is a formal proceeding and, if it contains any deficiency, that deficiency cannot be disregarded by this Chamber and must be cured by the petitioner. Therefore, this Court may not, on its own initiative, supplement or cure deficiencies in the petition invoked as the underlying proceeding, because in this case doing so would also entail intervening in aspects of the admissibility of the challenge that the petitioner was required to satisfy.
Based on the foregoing, I consider it improper for this Court to add, on its own initiative, reasons to justify the admissibility of this constitutional challenge (acción de inconstitucionalidad): first, because it was not argued by the party and, moreover, because the respondent authorities were not given a hearing regarding that new argument unilaterally added by the Chamber.
Consequently, because I consider the writ of amparo (recurso de amparo) inadmissible, I also consider the present constitutional challenge inadmissible. Therefore, I deny it, but on these grounds concerning standing (legitimación) and the admissibility of the proceeding.” (Emphasis not in the original).
The majority of this Chamber itself has stated the following on other occasions:
“Furthermore, the petitioner stated in the filing that, should the Chamber consider diffuse interests (intereses difusos) applicable, the challenge should be admitted on that basis; however, the petitioner provided no further grounds or justification. Such a request is entirely improper and unacceptable, given that it is not the responsibility of this Court to justify the petitioners’ standing on its own initiative or to remedy the omission of the required justification. In light of the foregoing, this Court finds that this constitutional challenge must be summarily dismissed (rechazar de plano).” (Emphasis not in the original). (See judgment n.°2020-024182).
Accordingly, consistent with my voting position, I consider that this challenge must be partially dismissed insofar as it concerns the defense of the principle of municipal autonomy (principio de autonomía municipal).
The parties are hereby advised that, if they submitted any document on paper, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the Court’s office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
Por tanto:
The challenge is DENIED. Justice Garro Vargas partially dissents (salva parcialmente el voto) and rejects the admissibility of this constitutional challenge insofar as it concerns the alleged violation of the principle of municipal autonomy.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cinco minutos del quince de enero de dos mil veinticinco .
Acción de inconstitucionalidad promovida por Nombre03, en su condición de Alcalde de Curridabat, para que se declare inconstitucional la “Ley de desafectación de dos bienes inmuebles propiedad de la Municipalidad de Curridabat y autorización para donarlos al Ministerio de Educación Pública (Escuela José María Zeledón)”, n.° 10118, publicada en el Alcance n.° 36 a la Gaceta n.° 33 del 18 de febrero de 2022, por estimarla violatoria de los artículos 50 y 170 de la Constitución Política. Intervinieron también en el proceso el representante de la Procuraduría General de la República, el Presidente de la Asamblea Legislativa y el Ministro de Educación Pública.
Resultando:
acción, que se acude en defensa de intereses difusos, no opera el efecto suspensivo de la interposición (véase voto n.° 537-91 del Tribunal Constitucional).”
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Sobre el objeto de la impugnación.- El accionante, en calidad de Alcalde Municipal, solicita que se declare inconstitucional la Ley N°10118 del 2 de febrero de 2022, denominada Ley de Desafectación de dos bienes inmuebles propiedad de la Municipalidad de Curridabat y autorización para donarlos al Ministerio de Educación Pública (Escuela José María Zeledón Brenes). Dicha ley establece lo siguiente:
“DESAFECTACIÓN DE DOS BIENES INMUEBLES PROPIEDAD DE LA MUNICIPALIDAD DE CURRIDABAT Y AUTORIZACIÓN PARA DONARLOS AL MINISTERIO DE EDUCACIÓN PÚBLICA (ESCUELA JOSÉ MARÍA ZELEDÓN BRENES) ARTÍCULO 1- Se desafectan del uso y dominio público dos bienes inmuebles propiedad de la Municipalidad de Curridabat, cédula jurídica número tres - cero uno cuatro - cero cuatro d1)B cero cuatro siete (N.º 3-014-042047), los cuales se describen de la siguiente· manera:
Un lote de novecientos treinta y cinco metros (935 m2), que se segrega de la finca inscrita en el Registro Público de la Propiedad, bajo el sistema de folio real matrícula número PRN01 (N.º PRN07), provincia de San José, cantón de Curridabat. La finca madre se describe de la siguiente manera: terreno destinado a parque comunal, ubicado en la provincia de San José, cantón 18 Curridabat, distrito 2° Granadilla, con una medida de once mil ochocientos cuarenta y nueve metros c 3drados con cincuenta y ocho decímetros cuadrados (11849,58 m:'), con los siguientes linderos: al norte con Dirección02 pública, avenida 3 con setenta coma quince metros (70,15m); al sur con Nombre02; al este con Dirección03) y al oeste con la Municipalidad de Curridabat, de conformidad con el plano catastrado número PRN08 (N.º 516072-1983).
El segundo lote mide tres mil seiscientos cuarenta y cinco metros cuadrados (3 645 m2), que se segrega de la finca inscrita en el Registro Público de la Propiedad, bajo el sistema de folio n:al matrícula número PRN02 (N.º 295...,7B-000) provincia de San José, cantón de Curridabat. La finca madre se describe de la siguiente manera: terreno destinado a parque comunal, ubicado en la provincia de San José, cantón 18 Curridabat, distrito 1° Curridabat, con una medida de trece mil ciento treinta y ocho metros con veinticinco decímetros cuadrados (13 138,25 m2) por los siguientes linderos: al norte con Dirección02; al sur con Dirección02; al este con Hogares de Costa Rica S.A., y al oeste con Dirección02; no hay plano catastrado registrado.
Se autoriza a la Municipalidad de Curridabat, cédula jurídica número tres - cero uno cuatro - cero cuatro dos, cero cuatro siete (N.º 3-014-042047), para que done los dos lotes desafectados y descritos anteriormente al Ministerio de Educación Pública, cédula jurídica número dos-uno cero cero-cero cuatro dos cero cero dos (N.º 2-100-042002), libres de gravámenes y anotaciones.
ARTÍCULO 2- El lote resultante de la unión de ambos terrenos segregados se afecta al nuevo uso de centro educativo, con una medida de cuatro mil quinientos ochenta metros cuadrados (4 580m2), de conformidad con el plano catastrado número siete cinco nueve nueve cero ocho-uno nueve ocho ocho (N.º 759908-1988).
ARTÍCULO 3- Se autoriza a la Notaría del Estado para que confeccione la escritura de traspaso del bien inmueble y proceda a su inscripción en el Registro Nacional. Asimismo, se autoriza a la Procuraduría General de la República para que corrija los defectos que señale el Registro Nacional.
Rige a partir de su publicación.” Los alegatos están referidos a los siguientes aspectos:
1. Violación al artículo 170 constitucional (autonomía municipal): Indica el accionante que, consta en el expediente legislativo que el Concejo Municipal evacuó la consulta en forma negativa. A pesar de que la Comisión Permanente de Asuntos Municipales y Desarrollo Local Participativo conoció de la oposición al proyecto, la respuesta negativa fue ignorada y se continuó con la tramitación hasta llegar a la promulgación de la ley. Considera que, desconocer la posición del gobierno local respecto a terrenos que son de su propiedad y de naturaleza de parque, contraviene la autonomía que le es otorgada constitucionalmente. Uno de los inmuebles es donde se ubica la piscina municipal, por lo que se genera afectación a los proyectos deportivos futuros del cantón.
2. Violación del derecho al ambiente, de los bienes demaniales y del artículo 40 de la Ley de Planificación Urbana: Indica el accionante que los inmuebles en cuestión son naturaleza de parque, sin embargo la ley impugnada no establece la compensación de las áreas, conforme lo establece el artículo 40 de la Ley de Planificación Urbana. Agrega que la ley impugnada está violentando el artículo 50 de la Constitución Política, por cuanto todo ciudadano tiene derecho a un ambiente sano y ecológicamente equilibrado, derecho que se materializa con los espacios naturales y áreas de parque que se destinan para el uso y disfrute de los vecinos de las distintas localidades (ver voto n°2007-2942). La Sala Constitucional ha indicado que resulta inconstitucional la desafectación de un área de parque sin que se haya cumplido el procedimiento correspondiente. Dejar sin área de parque a una urbanización es una infracción al derecho a gozar de un ambiente sano y ecológicamente equilibrado (ver voto n°2000-4332 y n°2013-9997).
Concluye que, debido a que no se determinó cuál será ese “otro terreno” que vendrá a compensar el área de parque que se donará al MEP, ello conlleva a que la ley impugnada sea inconstitucional por desafectar porciones de inmuebles destinados a parque propiedad de la Municipalidad de Curridabat. Finalmente agrega que, la ley impugnada viene a ser un evidente quebranto a la protección que la Administración está obligada a hacer de un bien demanial de la comunidad, como es este caso, dos porciones de terreno que pertenecen a parques.
En síntesis indica que la ley impugnada violenta la autonomía municipal, por cuanto la Municipalidad de Curridabat se opuso durante el trámite legislativo a su aprobación; y además, el derecho de los vecinos a disfrutar de un ambiente sano y ecológicamente equilibrado, pues se desafectó el área de parque y facilidades comunales sin compensación.
II.Las reglas de legitimación en las acciones de inconstitucionalidad y la legitimación en este caso.- El artículo 75 de la Ley de la Jurisdicción Constitucional regula los presupuestos que determinan la admisibilidad de las acciones de inconstitucionalidad, exigiendo la existencia de un asunto pendiente de resolver en sede administrativa o judicial en el que se invoque la inconstitucionalidad, requisito que no es necesario en los casos previstos en los párrafos segundo y tercero de ese artículo, es decir, cuando por la naturaleza de la norma no haya lesión individual o directa; cuando se fundamente en la defensa de intereses difusos o que atañen a la colectividad en su conjunto, o cuando sea presentada por el Procurador General de la República, el Contralor General de la República, el Fiscal General de la República o el Defensor de los Habitantes, en estos últimos casos, dentro de sus respectivas esferas competenciales.
A partir de lo dicho, se prevé la posibilidad de acudir en defensa de "intereses difusos", que son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos. Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país, el buen manejo del gasto público, y el derecho a la salud, entre otros. Por otra parte, la enumeración que ha hecho la Sala Constitucional no es taxativa. Ahora bien, esta acción fue admitida en tanto se alega la defensa de intereses difusos, en protección del derecho fundamental al ambiente (artículo 50 de la Constitución Política).
Sobre el alegato de violación de la autonomía municipal, la Sala ha indicado que “la acción de inconstitucionalidad interpuesta por un Alcalde municipal, en representación de una corporación territorial, debe contar, ineludiblemente, con un acuerdo del Concejo Municipal que así lo autorice y habilite, caso contrario debe tenerse como inadmisible.” (ver voto n°2007-007136). En este caso, el accionante indica que fue autorizado mediante acuerdo del Concejo Municipal n°6 que consta en el artículo 1°, capítulo 2° de la sesión ordinaria n°92-2022 del 1 de febrero de 2022. Por lo tanto, en esta acción también se cuenta con legitimación para la defensa de intereses corporativos, como lo son, en este caso, los relacionados con la autonomía de la Municipalidad de Curridabat. Así entonces, el accionante cuenta con la legitimación suficiente para presentar esta acción, tanto por la defensa de intereses difusos como por la defensa de intereses corporativos.
Finalmente se trata de materia cuya constitucionalidad procede revisar en esta vía, pues se trata de la impugnación de una normativa legal; y además el actor cumplió los requisitos estipulados en los numerales 78 y 79 de la Ley de rito. En conclusión, la presente acción es admisible, por lo que debe entrarse de inmediato a discutir el objeto y el fondo del asunto.
III.Sobre el trámite legislativo de la Ley n°10118.- Según se desprende del informe rendido por la Procuraduría General de la República, de las actas legislativas del proyecto de ley 22235, el cual dio origen a la ley impugnada, consta lo siguiente:
-Desde el año 1992 se ubicó a la Escuela José María Zeledón Brenes del cantón de Curridabat, sobre un área de terreno que pertenece a la municipalidad de ese cantón.
-Dada la necesidad de realizarle mejoras a la escuela y la imposibilidad de la Dirección de Infraestructura y Equipamiento del Ministerio de Educación Pública de invertir recursos en un terreno que no se encuentra a nombre de dicho ministerio, el proyecto de ley se planteó como una solución para atender la problemática existente (folios 2 y 3 del expediente legislativo).
-Esta iniciativa nació de la propia Municipalidad de Curridabat, la cual por oficio SMMC-347-12-2015 del 3 de diciembre de 2015, remitió el acuerdo N° 6 de la sesión ordinaria 291-2015 del 26 de noviembre de 2015, mediante el cual el Concejo Municipal de entonces autorizó al alcalde para que presentara ante la Asamblea Legislativa el proyecto de ley (folios 5 y 9 a 13 del expediente legislativo). La Municipalidad hizo constar el informe técnico DCBIMC-0153-11-2015 del 25 de noviembre de 2015, emitido por el ingeniero Douglas Alvarado, Director de Castro y bienes Inmuebles de la Municipalidad de Curridabat, en el cual se señala que: “Tomando en consideración el área a donar que corresponde a las fincas inscritas al folio real números PRN04 y PRN05, se determina que según el diseño de sitio de la Urbanización José María Zeledón, la eventual segregación no afecta lo establecido en el artículo 40 de la Ley de Planificación Urbana” (folios 11 y 223 del expediente legislativo).
-Esta solicitud sirvió de base inicialmente al proyecto de ley número 20004, el cual fue dictaminado de manera positiva pero archivado por vencimiento del plazo cuatrienal el 20 de junio de 2020.
-La iniciativa fue presentada nuevamente bajo el número de proyecto de ley 22.235, en fecha 29 de setiembre del 2020.
-Durante el trámite legislativo del expediente 22235, la Asamblea Legislativa consultó preceptivamente al Concejo Municipal de Curridabat mediante el oficio CPEM-101-2020 del 10 de marzo de 2021 (folio 86 del expediente legislativo), el cual rindió su criterio mediante el acuerdo tomado en la sesión ordinaria N°47-2021 del 23 de marzo de 2021, artículo 2, capítulo 3. Al respecto, el actual Concejo Municipal se opuso al proyecto de ley al considerar que son terrenos destinados a parque público y no es posible compensar el uso con otro terreno ubicado en la zona, de conformidad como lo indica el artículo 40 de la Ley de Planificación Urbana (folio 113 a 116 del expediente legislativo).
-El proyecto fue dictaminado de forma afirmativa, por mayoría, el 14 de setiembre del 2021.
-Diez diputados presentaron una consulta facultativa de constitucionalidad, tramitada bajo el expediente 22-22814-0007-CO, la cual fue declarada inadmisible mediante sentencia 2022-00440 de las 9:15 horas del 7 de enero de 2022, en virtud de que dos diputados firmantes retiraron su apoyo a la consulta.
-El proyecto fue votado en segundo debate el 13 de enero de 2022, y publicado en el Alcance n°36 a la Gaceta n°33 del viernes 18 de febrero de 2022.
IV.Sobre el alegato de violación a la autonomía municipal.- En criterio del accionante, la ley impugnada viola el principio de autonomía municipal por cuanto en el expediente legislativo consta que el Concejo Municipal se pronunció en forma negativa sobre el proyecto de ley que dio origen a la ley impugnada. A pesar de ello, la Comisión Permanente de Asuntos Municipales y Desarrollo Local Participativo ignora tal negativa y continuó con la tramitación hasta llegar a la promulgación de la ley. Según el informe rendido por la PGR, la iniciativa nació de la propia Municipalidad de Curridabat (año 2015 que dio origen al proyecto 20004) y el proyecto que dio origen a la ley impugnada (año 2020 proyecto 22235) fue consultado al Concejo Municipal de Curridabat. Así debe descartarse la violación a la autonomía municipal por cuanto, la iniciativa legislativa fue requerida por la propia municipalidad de Curridabat desde el año 2015, para lo cual se aportó el respectivo acuerdo de su Concejo de entonces solicitando la presentación del proyecto de ley.
Adicionalmente, debe considerarse que la naturaleza jurídica de la norma impugnada es únicamente de norma habilitante y no tiene la capacidad de obligar al ente municipal a donar los inmuebles en cuestión. Partiendo de que la ley impugnada es únicamente una norma habilitante para que la Municipalidad de Curridabat pueda donar al MEP los terrenos donde se encuentra la Escuela José María Zeledón Brenes, estima que la norma en sí misma no puede violentar la autonomía municipal, pues el ente municipal debe adoptar el acuerdo respectivo para la firma de la escritura ante la Notaría del Estado. Por su parte, en sus respectivos informes, la Asamblea Legislativa, el Ministerio de Educación Pública y el coadyuvante pasivo indican en su orden lo siguiente:
-La ley se trata de una autorización a fin de que la Municipalidad de Curridabat pueda hacer la segregación y traspaso, de tal forma que la situación sobre la compensación puede cambiar y la Municipalidad eventualmente podría contar con un bien con el cual realizar la compensación.
-La cabida del terreno que se pretende donar al Ministerio de Educación Pública es la misma que desde hace más de 30 años se tiene destinada para la Escuela, con la nueva ley no cambia dicha medida, por lo que la zona destinada a parque se mantiene incólume. La estructura del inmueble destinado a escuela cuenta con una orden sanitaria que la declaran inhabitable, por lo que se requiere de una intervención inmediata para garantizar la seguridad tanto de los estudiantes como del personal del Ministerio de Educación Pública que labora en dicho centro educativo. Así, no vulnera el principio de autonomía municipal, muy por el contrario.
-Desde antes de 1992 medió un acuerdo promovido por la Municipalidad de Curridabat con el Ministerio de Educación para edificar en terrenos municipales la Escuela José María Zeledón Brenes en la Urbanización del mismo nombre, otorgándole a la Escuela la posesión del área indicada en la Ley n°10.118. El mismo Concejo Municipal en el año 2015 tomó una serie de acuerdos para la donación de los terrenos. Además se ordenó realizar todos los estudios necesarios para cumplir con los requisitos para la presentación de un proyecto de ley, entre los estudios está el dictamen DSITNT-0139-011-2016 donde se indicaba que ello no afectaba el artículo 40 de la Ley de Planificación Urbana. La solicitud del Alcalde de compensación es de imposible cumplimiento, además, en otro caso de otra escuela no se exigió tal compensación.
Al respecto, esta Sala concluye que la normativa impugnada no violenta el principio de autonomía municipal. Tal como lo indica la PGR, partiendo de que la ley impugnada es únicamente una norma habilitante para que la Municipalidad de Curridabat pueda donar al MEP los terrenos donde se encuentra la Escuela José María Zeledón Brenes, la norma en sí misma no puede violentar la autonomía municipal. La ley cuestionada faculta a la Municipalidad de Curridabat, a disponer del bien en los términos referidos. Pero tal disposición normativa constituye una autorización de carácter facultativo y no un imperativo para que la Municipalidad de Curridabat pueda donar los terrenos en cuestión. La autorización legislativa es una especie de permiso para que una determinada institución pueda, si así se decide, tomar el acuerdo del acto que le ha sido permitido. Es la remoción del obstáculo jurídico que le impide a las instituciones públicas disponer libremente de sus bienes.
Tal como lo ha indicado esta Sala “la intervención de la Asamblea Legislativa en esta materia es un acto de autorización típicamente tutelar, que consiste en la remoción de un obstáculo legal para que el órgano competente, realice la actividad autorizada.” (ver voto n°5026-97). Las leyes que autorizan a las instituciones públicas a traspasar sus bienes carecen de efectividad por sí mismas. Para que puedan finalmente ejecutarse se requiere en este caso, tal como lo indica la PGR, primero, de un acuerdo del Consejo Municipal autorizando la donación del bien, pero además autorización a su representante para firmar la escritura de traspaso respectiva. En segundo lugar, el jerarca del Ministerio de Educación Pública debería aceptar la donación de los inmuebles y autorizar al representante de la Procuraduría General de la República para firmar la escritura. Así entonces, la autonomía municipal, definida por esta Sala como “la capacidad que tienen las Municipalidades de decidir libremente y bajo su propia responsabilidad, todo lo referente a la organización de determinada localidad (el cantón, en nuestro caso).” (voto n°1999-05445) no se ve afectada ni comprometida por la sola o mera existencia de una ley como la cuestionada, cuyo objetivo es la autorización -y no la obligación, el mandato o el imperativo- a la Municipalidad de Curridabat, para que done los dos lotes desafectados y descritos al Ministerio de Educación Pública.
V.Sobre los alegatos de violación al derecho al ambiente y a la protección de bienes demaniales.- En criterio del accionante, la ley impugnada está violentando el artículo 50 de la Constitución Política, por cuanto todo ciudadano tiene derecho a un ambiente sano y ecológicamente equilibrado, derecho que se materializa con los espacios naturales y áreas de parque que se destinan para el uso y disfrute de los vecinos de las distintas localidades. En este caso, dos porciones de terrenos que pertenecen a parques se están autorizando donar de la Municipalidad de Curridabat al Ministerio de Educación Pública, lo cual se hace sin compensación (en violación del artículo 40 de la Ley de Planificación Urbana), y además supone cambiar la naturaleza de parque a “terreno destinado a la consolidación del centro educativo Escuela José María Zeledón”, desafectando inmuebles destinados a parque.
Según el informe rendido por la PGR, la ley en cuestión se trata de una mutación demanial y no de una simple desafectación del dominio público, pues con la autorización de donación de dos inmuebles de la Municipalidad de Curridabat al Ministerio de Educación los inmuebles con vocación de parque siguen estando afectados al servicio público. En el caso de los parques y las zonas verdes de las urbanizaciones, la Sala Constitucional ha incluido su protección dentro del ámbito del derecho a un ambiente (ver voto n°2332-2000). En el expediente legislativo, no se presentó ningún informe técnico que desvirtuara el emitido por el ingeniero Douglas Alvarado, Director de Catastro y bienes Inmuebles de la Municipalidad de Curridabat, en el cual señalaba que “la eventual segregación no afecta lo establecido en el artículo 40 de la Ley de Planificación Urbana” (folios y 223 11 del expediente legislativo).
La Sala Constitucional ha protegido la existencia de parques y facilidades comunales como parte del contenido del derecho al ambiente, únicamente de los porcentajes mínimos establecidos en el artículo 40 de la Ley de Planificación Urbana para dichas áreas, no existe un derecho fundamental específico a disfrutar de porcentajes más allá de los fijados por el legislador. Nótese que la norma impugnada únicamente autoriza la segregación de dos lotes cuya extensión alcanza los 4.580 m2 (artículo 2 de la Ley 10118) y la finca madre contaba con una extensión inicial de 24.987 m2. En otras palabras, el cambio de destino ocurrió sobre una porción muy pequeña del terreno destinado a parque donde, además, desde el año 1992 se encuentra la Escuela José María Zeledón Brenes. Por tanto, no es cierto que los vecinos del lugar no puedan disfrutar de su derecho al esparcimiento como consecuencia de la norma impugnada, pues desde hace treinta años han tenido el mismo acceso a la zona de parque que, además, aun con la segregación autorizada, cuenta con más de veinte mil metros cuadrados de extensión.
Concluye que, la norma impugnada tampoco resulta violatoria de lo dispuesto en el numeral 50 constitucional. La jurisprudencia de la Sala que reconoce la imposibilidad de desafectar el área de parque de una comunidad sin la respectiva compensación, ha sido emitida en supuestos donde se priva a los vecinos de la comunidad de los porcentajes mínimos dispuestos en el numeral 40 de la Ley de Planificación Urbana, lo cual no parece ser este caso. Además, debe considerarse que en este caso no se trata de la construcción de una nueva escuela (casos analizados por la Sala en otras oportunidades), sino de una escuela que ya ha estado en el lugar por treinta años. Finalmente, en este caso debe valorarse también el interés superior de los menores de la comunidad que acuden a la Escuela José María Zeledón Brenes, la cual ha estado durante tres décadas en un terreno municipal, impidiendo que el Ministerio de Educación Pública pueda realizar las mejoras y la inversión que se necesita para garantizar en forma efectiva el derecho a la educación de los menores.
Por su parte, en sus respectivos informa, la Asamblea Legislativa, el Ministerio de Educación Pública y el coadyuvante pasivo indicando en su orden que:
-La ley 10118 se aprobó en consonancia con el artículo 121.14 de la Constitución Política, en todo momento se respetó la autonomía municipal y lo dispuesto en el artículo 50 constitucional. Es oportuno que el Tribunal Constitucional analice la constitucionalidad de esta ley bajo una concepción moderna del dominio público. Asimismo, cuando existe tensión entre el derecho a la educación y el derecho al ambiente, debe buscarse la mayor optimización de los recursos. La ley no viola el artículo 50, todo lo contrario, busca ofrecer a las personas menores de edad el disfrute del ambiente.
-La cabida del terreno que se pretende donar al Ministerio de Educación Pública es la misma que desde hace más de 30 años se tiene destinada para la Escuela, con la nueva ley no cambia dicha medida, por lo que la zona destinada a parque se mantiene incólume. La estructura del inmueble destinado a escuela cuenta con una orden sanitaria que la declaran inhabitable, por lo que se requiere de una intervención inmediata para garantizar la seguridad tanto de los estudiantes como del personal del Ministerio de Educación Pública que labora en dicho centro educativo. Motivados por la urgencia de poder brindar el servicio básico el Educación a las personas menores de edad, es que se promueve la promulgación de la ley en cuestión. Con claridad meridiana se colige que para uso de parque se debe destinar no menos de un tercio del área que debe ceder el urbanizador, quedando los otros dos tercios destinados a un fin distinto al de “uso de parque”, como lo señala el mismo artículo 40 de la Ley de Planificación Urbana.
Según lo establece dicho artículo, un tercio corresponde al área de parque (8329,27 m2) y los otros dos tercios (16658,55 m2) servirán para instalar facilidades comunales. La zona destinada a parque no se ha visto afectada por la presencia de la infraestructura educativa. Segregar los 4500 m2 que señala la ley impugnada, no representa una violación a lo instituido en nuestra carta magna. Con el inminente cierre por deterioro de las instalaciones del centro educativo se generaría un perjuicio invaluable a una población vulnerable como lo son las personas menores de edad usuarias del servicio educativo de la escuela Dr. José María Zeledón. Solicita declarar sin lugar, en todos sus extremos -Como la desafectación es el paso de un bien público a un sujeto privado resulta lógica la indemnización; empero, si la desafectación es de un bien de un ente público hacia otro de servicio público, con autorización de donación, por lo general hay aquiescencia del primero en donar gratuitamente y no existe conflictividad.
La compensación cobrada por la Municipalidad a un servicio público cumplido por 30 años, en un terreno que no afecta las otras actividades deportivas y de recreación, en armonía con un ambiente sano debiendo ser a título gratuito, la hace desproporcionada y discriminatoria.
Al respecto, esta Sala no considera que en este caso la ley impugnada resulte violatoria del derecho al ambiente, conforme a las razones que se explican a continuación:
El término "facilidades comunales" no tiene la amplitud que se le quiere implicar. Resulta obvio para esta Sala que se refiere a construcciones indispensables para el disfrute comunal del bien destinado a área verde, parque y esparcimiento; consiguientemente, la construcción de edificios para servicios públicos a manera de ejemplo bibliotecas, escuelas, salones comunales, etc, resultan incompatibles con el destino de áreas de parque y zona verde que el legislador ha exigido para algunos terrenos, y, sin duda, para que las asociaciones interesadas puedan emprender la construcción de edificaciones como las que resultan de su interés, deben sufragar lo que involucra a todos los miembros o vecinos de la localidad que se van a beneficiar con el uso público y general del inmueble- el costo del mismo.” (voto n°2000-4332 https://nexuspj.poder-judicial.go.cr/document/sen-1-0007-148995). Ahora bien, lo indicado no significa que esta Sala esté constitucionalizando porcentajes específicos realizados por los fraccionadores de terrenos, conforme a la legislación urbanística, sino únicamente que las áreas destinadas a parques no pueden vaciarse de contenido en su totalidad.
En este caso se constata que los inmuebles segregados miden entre ambos 24.987,83 m2, correspondiendo un tercio al área de parque (8.329,27 m2) y los otros dos tercios (16.658,55 m2) para facilidades comunales; y que la donación en cuestión es de aproximadamente 4.500 m2. Tomando en cuenta que, este último, desde hace más de 30 años ha sido destinado al uso como centro educativo, cuenta con infraestructura construida por el Ministerio de Educación Pública destinada para con el fin de brindar el servicio educativo a las personas habitantes de la comunidad, y que la zona destinada a parque no se ha visto afectada por la presencia de la infraestructura educativa. Así lo indica la Dirección de Infraestructura Educativa por medio del oficio DVM-A-DIEE-DS-CBI-0108-2021, de fecha 16 de abril de 2021, que dice: “…Este terreno se encuentra inscrito a nombre de la municipalidad de Curridabat como parte de los folios reales de San José PRN03 y PRN06, cuenta con el plano catastrado SJ- 759908- 1988.
Se llevó a cabo la revisión topográfica del plano catastrado precitado, y se constató que coincide en ubicación, área y dimensiones con el terreno que ocupa la escuela José María Zeledón.” 4) Informe técnico señala que segregación no afecta art.40 de Ley de Planificación Urbana: Tal como lo hace ver la PGR en su informe, en el expediente legislativo consta el informe técnico emitido por el ingeniero Douglas Alvarado, Director de Catastro y bienes Inmuebles de la Municipalidad de Curridabat, en el cual señalaba que “la eventual segregación no afecta lo establecido en el artículo 40 de la Ley de Planificación Urbana” (folios y 223 11 del expediente legislativo). No existiendo a la fecha, informe técnico que se contraponga a tal señalamiento. Por lo tanto, más allá de que excede de la competencia de esta Sala verificar que la ley en cuestión se oponga a otra ley (art.40 Ley de Planificación Urbana), es lo cierto que, no se ha demostrado que los derechos ambientales que tutela la Ley de Planificación Urbana se vean conculcados con la normativa impugnada.
VI.Conclusión.- Dado que la ley impugnada no violenta el principio de autonomía municipal, pues se trata de una autorización y no de una obligación que el legislador le impuso al ente municipal. Dado que la ley impugnada no violenta el derecho al ambiente por cuanto se mantiene la naturaleza pública de los terrenos; por cuanto el cambio de finalidad de “parque” a finalidad de “centro educativo” ya había operado en el plano fáctico desde hace treinta años; por cuanto la jurisprudencia de esta Sala ha tutelado el destino de parque de los terrenos municipales, pero no ha constitucionalizado porcentajes específicos de terreno para este fin; por cuanto el informe técnico que consta en el expediente la segregación no afecta art.40 de Ley de Planificación Urbana; por cuanto la donación en cuestión corresponde a aproximadamente 4.500 m2, restando en total más de 20.000 m2 que la Municipalidad bien puede destinar en un porcentaje amplio para parque, y que no se demostró que esos 4.500 m2 se hayan disminuido propiamente del tercio del área de parque (8.329,27 m2), o que de los otros dos tercios (16.658,55 m2) para facilidades comunales no se pueda destinar también a parque; y por cuanto esta Sala debe ponderar lo cuestionado con el derecho a la educación de menores de edad y el principio de interés superior del menor para un aproximado de 300 alumnos para el ciclo lectivo 2024. No existe mérito para acoger esta acción, la cual se impone declarar sin lugar, tal como en efecto se hace.-
Respetuosa del criterio de la mayoría, salvo parcialmente el voto en lo relativo a la admisibilidad de la acción, pues estimo que quien la interpone no invocó apropiadamente la legitimación que permite evaluar la presunta lesión al principio de autonomía municipal.
Del escrito de interposición de la acción de inconstitucionalidad se desprende que el argumento sobre la legitimación para interponer la acción responde a la defensa de intereses difusos y así fue cursado este expediente por parte de la Presidencia de la Sala. De modo que el accionante no justificó la legitimación que ostenta para reclamar la defensa del aludido principio de autonomía. Si se mira con detalle, tampoco aportó al expediente de esta acción el acuerdo municipal que lo habilita para la formulación de este proceso de control de constitucionalidad. En cuyo caso, considero que no procede que este Tribunal de forma oficiosa sume motivos para admitir la legitimación y examinar ese agravio por el fondo.
Desde mi perspectiva, atendiendo a las características de las acciones de inconstitucionalidad, no le corresponde a esta Sala suplir las deficiencias en la argumentación del accionante y sumar motivos diferentes a los planteados en el libelo de interposición. Esta es la posición que he sostenido en el pasado y que corresponde reiterar en esta oportunidad. Al respecto, en el voto salvado de la sentencia n.°2021-01158 expresé lo siguiente:
“He estimado necesario salvar mi voto y declarar sin lugar la presente acción de inconstitucionalidad, pero por razones de legitimación.
En primer lugar, es preciso subrayar lo que ha dicho este Tribunal en relación con la naturaleza y las formalidades que se deben cumplir rigurosamente en las acciones de inconstitucionalidad. Al respecto, la Sala ha insistido que el legislador diseñó este proceso de control de constitucionalidad como uno formal. De manera que, para efectos de admisibilidad, se deben cumplir una serie de requisitos establecidos al efecto en la Ley de la Jurisdicción Constitucional (LJC). Además de acreditar las condiciones de admisibilidad y de legitimación (poderes y certificaciones), la Ley exige el cumplimiento de ciertas formalidades importantes como la determinación explícita de la normativa impugnada, debidamente fundamentada y con cita concreta de las normas y principios constitucionales que se consideren infringidos (art. 78) y la certificación literal del memorial donde se hizo la reserva de inconstitucionalidad en el asunto previo (art. 79). Si uno o varios de estos requisitos no se cumplen, la Presidencia de la Sala puede solicitar que se subsanen las formalidades mencionadas y, si no se diere el cumplimiento a lo ordenado, el Presidente debe denegar el trámite de la acción de inconstitucionalidad (art. 80).
En tesis de minoría he manifestado que, tanto la interpretación de los arts. 78 y 79 como la del propio art. 80 de la Ley que rige esta jurisdicción, debe ser amplia en beneficio de quienes acuden a esta Sala, con el fin de que el acceso a la justicia constitucional no resulte innecesariamente limitado. Sin embargo, sí se debe verificar el control de los correspondientes requisitos para activar el control de constitucionalidad de las normas. (…)
De este modo, no parece que resulte válido utilizar “el ropaje” de un interés difuso de los consumidores para fundamentar que procede la admisibilidad de una acción de inconstitucionalidad, cuando lo que se procura es el resguardo de otro tipo de derechos o intereses que en realidad engloban a una comunidad económica más amplia (a los importadores de vehículos), siendo incluso contradictorio procurar tutelar ambos intereses en un mismo proceso de amparo que, a su vez, sirva de base para esta acción de inconstitucionalidad.
Finalmente, he de señalar que si el actor fundamentó su legitimación en un recurso de amparo, no procede que este Tribunal unilateralmente le reconozca una legitimación adicional al considerar lo siguiente:
“Sobre el particular, estima la Sala que, además del recurso de amparo que se ha admitido como asunto previo base de esta acción de inconstitucionalidad, la parte actora también ostenta legitimación suficiente para demandar la inconstitucionalidad de la norma impugnada en los términos del artículo 75 párrafo 2º de la Ley de la Jurisdicción Constitucional, ello por cuanto se trata de la defensa de un interés que atañe a la colectividad nacional en su conjunto como lo son los intereses económicos de los consumidores”.
Al respecto, como ya se apuntó supra, la acción de inconstitucionalidad es un proceso formal que, de tener alguna deficiencia, no puede ser obviada por esta Sala y debe ser subsanada por el propio accionante. Por lo que no es admisible que este Tribunal oficiosamente supla o subsane las deficiencias del recurso que se invoca como asunto base, porque en este caso supondría a su vez intervenir en aspectos de la admisibilidad de la acción que correspondían ser cumplidos por parte del accionante.
Partiendo de lo anterior, considero improcedente que este Tribunal agregue oficiosamente razones para justificar la admisión de esta acción de inconstitucionalidad: primero, porque no fue argumentado por la parte y, además, porque no se brindó audiencia a las autoridades recurridas respecto a ese nuevo argumento añadido unilateralmente por la Sala.
En consecuencia, al estimar que el recurso de amparo es inadmisible, considero que también lo es la presente acción de inconstitucionalidad. Por lo tanto, la declaro sin lugar, pero bajo estos argumentos de legitimación y admisibilidad del proceso”. (Lo destacado no corresponde al original).
La propia mayoría de esta Sala en otras oportunidades ha afirmado lo siguiente:
“Por otro lado, el accionante mencionó en el escrito de interposición, que en caso de que la Sala considere que los intereses difusos son los aplicables, sea admitida la acción en ese carácter; sin embargo, no dio mayor fundamento ni justificación. Tal pretensión, resulta totalmente improcedente e inaceptable, visto que no corresponde a este Tribunal, justificar de oficio la legitimación de los accionantes, ni solventar la omisión de la justificación que debe ser brindada. Dado lo expuesto, en criterio de este Tribunal, procede rechazar de plano esta acción de inconstitucionalidad”. (Lo destacado no corresponde al original). (Ver sentencia n.°2020-024182).
De este modo, siendo consecuente con mi línea de votación, considero que esta acción debe rechazarse parcialmente en lo relativo a la defensa del principio de autonomía municipal.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara SIN lugar la acción. La magistrada Garro Vargas salva parcialmente el voto y rechaza la admisibilidad de esta acción de inconstitucionalidad en lo relativo a la alegada lesión del principio de autonomía municipal.
