Document Review Decision No. 2025000583 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on January 10, 2025 .

Writ of amparo (recurso de amparo) processed under expediente number 24-033317-0007-CO, filed by Nombre03, identity card NFP01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, LA MUNICIPALIDAD DE PUNTARENAS, AND EL MINISTERIO DE SALUD.

FINDINGS OF FACT:

  1. 1By a submission received by the Chamber on November 26, 2024, the petitioner filed a writ of amparo, stating that he lives in El Cocal de Puntarenas, in the houses known as the Seguro Social houses, at Dirección03. He explains that, approximately one month ago, sewage (aguas negras) from the housing development’s internal sewer system (red interna de alcantarillado) began entering his home and those of other neighbors. He explains that this situation is apparently due to a lack of maintenance by the competent authorities. He states that this sewage, which should be discharged into nearby tanks, flows freely because the sewer system has collapsed or become obstructed. He asserts that this endangers his life and the lives of many people in the area, including women, children, and older adults. He reports that approximately fifteen days ago he went to the office of the mayor of Puntarenas to report the situation, but the mayor argued that he does not have the machinery or resources necessary to solve the problem, without regard for the risk this poses to the residents’ health.He states that, because of the foul odors and pollution caused by the sewage, he has suffered health problems such as stomachaches and severe headaches. He further notes that, to protect himself from possible infections and preserve his health, he was forced to move temporarily into relatives’ home. The petitioner emphasizes that, despite the seriousness of the problem, the responsible authorities, including the mayor of Puntarenas, the executive president of Acueductos y Alcantarillados, and the Ministerio de Salud, have taken no action to remedy it. He argues that this inaction not only endangers the residents’ rights to health and life but also causes serious environmental pollution, thereby violating Articles 21 and 50 of the Constitución Política. He requests that the Ministerio de Salud, Acueductos y Alcantarillados, and the Municipalidad de Puntarenas be ordered to take immediate measures necessary to resolve the problem of sewage flowing through the homes. He requests that the petition be granted, with the consequences prescribed by law.
  2. 2By a decision issued at eight fifty-four p.m. on November 29, 2024, the president of the Chamber admitted the amparo proceeding.
  3. 3Dr. Mary Denisse Munive Angermüller, vice president of the Republic and minister of Health, and Dr. Carolina Lizeth Guillén Meléndez, acting director of the Área Rectora de Salud de Puntarenas–Chacarita, report under oath: “STATUTORY REPORT In accordance with the request made in this Writ of Amparo, this statutory report is submitted on the basis of Official Letter N°MS-DRRSPC-DARSPC-0815-2024 dated December 04, 2024, which documents the relevant actions taken by the Ministerio de Salud through the Área Rectora de Salud Puntarenas -Chacarita, which belongs to the Dirección Regional de Rectoría de la Salud Pacífico Central, and states, insofar as relevant: ‘…FIRST In response to a health complaint received by this Área Rectora de Salud through document receipt form N°N°PC-AC-925-2024 concerning the accumulation of wastewater (aguas residuales) in the inspection chambers (cajas de registro) of an easement (servidumbre) that channels wastewater from homes located between Dirección05, a site inspection was conducted on September 19, 2024, as recorded in Visual Inspection Report N°0315-Reg-2024, and it was possible to verify health-related anomalies involving water accumulation in the easement’s inspection chambers and foul odors.SECOND: As a result of the inspection conducted, health order (orden sanitaria) 0112-REG-2024 was served on Mr. Randall Alexis Chavarría Matarrita, in his capacity as Municipal Mayor, on October 04, 2024, requiring that, before October 9, 2024, measures be taken to ensure the proper operation of the easement that channels wastewater from homes located between Dirección03. THIRD: During a field inspection conducted on Thursday, October 10, 2024, no changes were observed at the site compared with the inspection conducted on September 19, 2024. FOURTH: After the deadline granted for compliance with health order 0112-REG-2024 had expired, no physical or digital report was received from the Municipalidad de Puntarenas describing the actions taken in compliance with health order 0112-REG-2024. FIFTH: In view of the Municipalidad de Puntarenas’s failure to comply with health order 0112-REG-2024, health report MS-DRRSPC-DARSPC-0699-2024, establishing the fine for noncompliance, was served on Mr.Randall Alexis Chavarría Matarrita, in his capacity as Municipal Mayor, on October 11, 2024, pursuant to the measures ordered by the health authorities as provided in Articles 378 and 378 bis of Ley General de Salud N°5395. SIXTH: The deadline granted for payment of the corresponding penalty expired on November 8, 2024, without receipt of a written response to the health report or payment to the Government of the Republic. Accordingly, the administrative case file (expediente administrativo) in this matter was forwarded to initiate the corresponding administrative collection proceeding, as provided in Article 13 of Reglamento a la Ley N°9837 "Reforma Ley General de Salud" N°42293-S. SEVENTH: On December 4, 2024, a criminal complaint was filed with the Fiscalía Adjunta del Ministerio Público en Puntarenas concerning the alleged Crime of Disobedience to Authority, seeking, on the basis of Section 314 of the Código Pena, an order requiring the Municipalidad de Puntarenas to respond to the actions requested by this Área Rectora de Salud concerning compliance with health order N°0112-REG-2024 and to pay the fine notified through the health report contained in Official Letter MS-DRRSPC-DARSPC-0699-2024…’ In light of the foregoing, Honorable Justices, this health authority considers that it has not failed to act, and it has been demonstrated that timely steps have been taken to protect the rights of the residents of Cocal de Puntarenas in connection with the wastewater problem in that community, by serving the corresponding administrative acts (actos administrativos) on those responsible for safeguarding the population’s well-being in matters involving easements and cantonal streets and avenues, as documented in the administrative case file maintained by this Área Rectora de Salud Puntarenas – Chacarita.Accordingly, it is entirely clear that the Ministerio de Salud, through the Área Rectora de Salud Puntarenas – Chacarita and the Dirección Regional de Rectoría de la Salud Pacífico Central, has acted effectively and efficiently, performing work in this matter that is both consistent with our authority and essential. The information necessary to resolve the matter submitted to this Honorable Constitutional Chamber is therefore attached, in accordance with the principle of legality established in Article 11 of the Constitución Política and Section 11 of the Ley General de la Administración Pública.” They request that the petition be denied.
  4. 4Emilio Corrales Fallas, head of the Puntarenas Cantonal Office of the Central Pacific Region of the Peripheral Systems Management Subdivision of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath: “Based on report N°GSP-RPC-2024-02610 dated December 05, 2024, prepared by Eng. Karla Ordoñez Sequeira, Director of Collection and Treatment for the Central Pacific Region, which is attached as evidence and forms an integral part of the administrative record (expediente administrativo), it has been demonstrated that: In the INVU sector, known as Barrio El Cocal, located in the province of Puntarenas, AyA provides only drinking-water service; the wastewater collection system was constructed by INVU as a condominium sewer system (sistema de Alcantarillado Condominal), and it was accepted by the Municipalidad de Puntarenas, with the Municipality therefore being responsible for its preventive and corrective maintenance.This wastewater collection system has an internal pipe running through the backyards of all the properties, corresponding to a right-of-way easement (servidumbre de paso), registration reference N°331-07008-01-0900-001. However, access to the right-of-way easement for the collection pipe is obstructed because residents have erected various structures on the easement, including walls, storage sheds, corridors, and a workshop, among others (See report N°GSP-RPC-2024-02610). Moreover, although preventive and corrective maintenance of the INVU Cocal system is the responsibility of the Municipalidad de Puntarenas, AyA, pursuant to sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud, has undertaken maintenance of the sector’s wastewater collection tanks. However, this work is hindered because there is no unobstructed access through the wastewater right-of-way easement designated for this purpose, requiring AyA employees to enter through private property to clear blockages or, alternatively, as may be seen in the image included in the preceding section, exposing their physical safety by having to climb over walls to clear the pipe blockage, since entry through the easement is impossible due to the structures.It is noted that the Municipalidad de Puntarenas is responsible for pursuing the appropriate legal actions to maintain unobstructed access through the easement. (See report N°GSP-RPC-2024-02610). It should be added that, since 2018, Cocal residents have filed two applications for constitutional relief (recursos de amparo) concerning wastewater spills, as this Honorable Court may verify in decision N°2018008599 in expediente N°18-006056-0007-CO and decision N°2019022487 in expediente 19-015715-0007-CO. Both decisions order the Municipality to undertake the appropriate legal actions to allow unobstructed access through the right-of-way easement, to clean and maintain the septic tank, and likewise to coordinate technical efforts with AyA. In this regard, it is worth emphasizing that the Institution has participated in interinstitutional meetings with MINSA and the Municipalidad de Puntarenas in order to provide any cooperation and/or advice required for the proper operation of the wastewater system.(See report N°GSP-RPC-2024-02610). This Constitutional Chamber should be advised that, in response to Sanitary Order OS-0006-REG-2021 issued by MINSA on February 03, 2021, official letter N°GSP-RPC-2021-00138 was issued, reminding MINSA that the party responsible for the proper preventive and corrective maintenance of the Cocal sewer system is the Municipalidad de Puntarenas. It was further informed that: …‘NO further blockage-clearing work will be performed at the site until adequate and safe access to the collection system is available, because it is not justifiable to endanger the employees who perform network-maintenance work due to the lack of adequate conditions for entering the site…’ (see official letter N°GSP-RPC-2021-00138). II. APPLICABLE REGULATIONS. In support of the foregoing, it is necessary to cite the provisions of the Reglamento para la Prestación de los Servicios de AyA, published in the Official Gazette La Gaceta N°27, Supplement N°29 of February 9, 2021, and the Ley General de la Administración Pública, Articles 11 and 13, subsection 1. ‘Article 14—Conditions for the provision of services.AyA shall provide its services once technical feasibility has been established for developed or undeveloped properties intended as residences or for commercial or industrial activities that comply with the requirements and authorized uses set forth in these regulations. AyA shall provide drinking-water and sanitation services along a street or public roadway or over a pipeline and right-of-way easement registered in favor of AyA or registered in favor of third parties, as applicable pursuant to Article 16 of these regulations. The foregoing shall apply provided that operational AyA networks exist…’ Ley General de la Administración Pública, Articles 11 and 13, subsection 1: ‘1. The Public Administration shall act subject to the legal system and may perform only those acts or provide only those public services authorized by that legal system, in accordance with the hierarchical order of its sources.’ ‘1.The Administration shall generally be subject to all written and unwritten rules of administrative law, as well as to the private law supplementing it, and may neither derogate from nor decline to apply them in specific cases.’ In the present case, it has been established that no constitutional right has been violated because, as demonstrated by the technical report forming an integral part of the submission presented herein, AyA has performed corrective work on the INVU Cocal sanitary sewer network, even though the system was accepted by the Municipalidad de Puntarenas, which is responsible for its preventive and corrective maintenance. It is likewise emphasized that the INVU Cocal sanitary sewer system is located on private property, where AyA has no authority to enter. In addition, structures have been erected on the right-of-way easement designated for the wastewater system, preventing unobstructed access.It is the obligation of the MUNICIPALIDAD DE PUNTARENAS to make the easement accessible through the appropriate legal means. I must also state that the Municipality has a duty to monitor and inspect both stormwater drains and wastewater inspection boxes and manholes. AyA has always diligently assisted in addressing and complying with sanitary orders issued by MINSA, specifically by performing work to clear blockages from the Cocal sewer system. Nevertheless, until the Municipalidad de Puntarenas undertakes to identify alternatives for enabling access through the right-of-way easement designated for the wastewater system, the Institution is unable to assist in complying with sanitary orders concerning the Cocal collection system, since endangering employees who perform network-maintenance work is justified by the lack of adequate conditions for entering the site. Accordingly, based on the facts set forth above, it has been demonstrated that none of this Institute’s actions has been capricious, arbitrary, or unfounded.The entity I represent has undertaken and carried out all actions falling within the scope of its authority and within the legal framework governing us. It is therefore concluded that AyA fulfilled all obligations imposed by operation of law, within the constitutional and legal framework and in accordance with the principle of legality (principio de legalidad). Consequently, none of the petitioner’s fundamental rights has been violated.” He requests that the application be denied.
  5. 5Randall Alexis Chavarría Matarrita, Mayor of the Municipalidad del Cantón Central de Puntarenas, reports under oath: “Your Authority is hereby informed of the statements made by Eng. Mauricio Gutiérrez Villafuerte, Director of Territorial and Urban Development of the Municipalidad de Puntarenas, in official letter MP-DDTU-OF-393-12-2024 dated December 05, 2024, which states as follows: ‘The community of El Cocal de Puntarenas does not have a sanitary sewer network. Under its founding law, AyA is the governing authority for sanitary wastewater and stormwater. AyA has a Regional Office in Puntarenas, located in Barranca, and we have made ourselves available on many occasions to assist in containing the problem affecting the social-security houses, Dirección03. Eng. Gutiérrez Villafuerte further states that this housing project was promoted and constructed by the Instituto de Vivienda y Urbanismo, which designed treatment systems using a shared septic tank; consequently, the water discharged by each home flows into a general collection tank serving the entire project.These works should have been transferred to AyA, but INVU failed to do so, which has now caused AyA to claim that it is not responsible for providing a solution, even though it is legally required to do so. As to the overflow problem, according to the petitioner himself, it occurs at each of the homes and inside them—in their yards—the petitioner states. In this regard, the cited report indicates that the Directorate of Territorial and Urban Development has conducted several inspections and determined that the cause of the problem is the absence of grease traps needed to prevent blockages in the piping system. It further explains that because there is a single piping system for all the houses, if one resident fails to perform proper maintenance and cleaning, it affects that resident’s home and those of the others, because the system becomes blocked and the water overflows into the houses.Accordingly, the pipes referenced in the cited report cannot be cleaned from outside or from the front of the properties because they are located in the yards of the homes, making it impossible for the Municipality to act because they are on private property. It further states that the only existing access to the pipeline branch was closed off by all the residents when they built walls, and that a search of the Registro de la propiedad shows that this access corresponds to a water easement (servidumbre de aguas) owned by INVU, which the Municipality likewise cannot access. Finally, the matter that does fall within the authority of the Municipality I represent is the maintenance and cleaning of the communal storage tanks, which the Municipality performs every year because the tanks are located in an area designated for that purpose and accessible from the public street. Accordingly, and based on the referenced technical report submitted as documentary evidence (prueba documental), the reported problem is caused by the local residents’ failure to maintain the pipes and not by failures caused or left unaddressed by the Municipalidad de Puntarenas.In light of all the foregoing, the entity I represent bears no responsibility for addressing the problem raised by the petitioner, nor is it possible to access the location where the problem originates, because it is inside the private properties of the residents of El Cocal de Puntarenas, specifically in the houses known as the Seguro Social houses, Dirección03.’” He requests that the application be denied.
  6. 6Juan Manuel Quesada Espinoza, executive president of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath: “Based on report N°GSP-RPC-2024-02610, dated 05 de diciembre del 2024, prepared by Engineer Karla Ordoñez Sequeira, director of Collection and Treatment for the Central Pacific Region, which is attached as evidence and forms an integral part of the administrative record (expediente administrativo), it has been demonstrated that: In the INVU sector, known as Barrio El Cocal, located in the province of Puntarenas, AyA provides only drinking-water service. The wastewater collection system was constructed by INVU as a condominium sewer system (alcantarillado condominal) and was accepted by the Municipalidad de Puntarenas, which is responsible for its preventive and corrective maintenance. This wastewater collection system has an internal pipe that crosses the backyards of all the properties and is subject to a right-of-way easement (servidumbre de paso), registration reference N°331-07008-01-0900-001.Nevertheless, access to the right-of-way easement for the collection pipe is obstructed because residents have erected various structures on the easement, including walls, storage sheds, covered walkways, and a workshop, among others (See report N°GSP-RPC-2024-02610). Furthermore, although the Municipalidad de Puntarenas is responsible for the preventive and corrective maintenance of the INVU Cocal system, AyA, pursuant to sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud, has undertaken maintenance of the sector’s wastewater collection tanks. However, this work is hindered because there is no unobstructed access through the wastewater right-of-way easement designated for this purpose. AyA personnel must enter through private property to clear obstructions or, as may be seen in the image included in the preceding section, personnel must place their physical safety at risk by climbing over walls to clear the pipe, since access through the easement is impossible due to the existence of structures.It is noted that the Municipalidad de Puntarenas is responsible for taking the appropriate legal action to keep the easement freely accessible. (See report N°GSP-RPC-2024-02610). It should be added that, since 2018, residents of El Cocal have filed two amparo proceedings (recursos de amparo) concerning wastewater spills, as this Honorable Court may verify in decision N°2018008599 in expediente N°18-006056-0007-CO and decision N°2019022487 in expediente 19-015715-0007-CO. In both decisions, the Municipality was ordered to undertake the appropriate legal measures to permit unobstructed access through the right-of-way easement, clean and maintain the septic tank, and coordinate technical matters with AyA. In this regard, it should be emphasized that this Institute has participated in interinstitutional meetings with MINSA and the Municipalidad de Puntarenas to provide any cooperation and/or advice required for the proper operation of the wastewater system (See report N°GSP-RPC-2024-02610).This Sala Constitucional should be informed that, in response to Sanitary Order OS-0006-REG-2021 issued by MINSA on 03 de febrero del 2021, official letter N°GSP-RPC-2021-00138 was issued, reminding MINSA that the Municipalidad de Puntarenas is responsible for the proper preventive and corrective maintenance of the El Cocal sewer system. It was further informed that: ‘…NO further obstruction-clearing work will be performed at the site until adequate and safe access to the collection system is available, because it is unjustifiable to place the personnel who perform network-maintenance work at risk due to the lack of adequate conditions for entering the site…’ (see official letter N°GSP-RPC-2021-00138).” He requests that the amparo petition be denied.
  7. 7On 11 de diciembre del año en curso, the petitioner submitted a filing in the record reiterating the allegations made in this amparo proceeding.
  8. 8The applicable legal requirements have been observed in the proceedings conducted.

Justice Hess Herrera drafts the opinion; and,

WHEREAS:

I. SUBJECT MATTER OF THE AMPARO PROCEEDING

The petitioner alleges that he lives in El Cocal de Puntarenas, in the houses known as the Seguro Social houses, at Dirección03. He states that, approximately one month ago, sewage (aguas negras) from the development’s internal sewer network began entering his home and the homes of other residents. He explains that this situation is apparently due to a lack of maintenance by the competent authorities. He states that this wastewater should be discharged into nearby tanks; however, it is flowing freely because the sewer system has collapsed or become obstructed. He asserts that this situation endangers his life and the lives of many people in the area, including women, children, and older adults. He states that approximately fifteen days ago the protected party (tutelado) went to the office of the mayor of Puntarenas to report the situation, but the mayor told him that he lacked the machinery and resources necessary to solve the problem, without regard for the risk this poses to residents’ health and the environmental pollution it causes. He alleges that, despite the seriousness of the problem, the responsible authorities have taken no action to remedy it. He requests that the Ministerio de Salud, Acueductos y Alcantarillados, and the Municipalidad de Puntarenas be ordered to take immediate measures to resolve the problem of sewage flowing through the homes.

II. PROVEN FACTS

The following facts relevant to the resolution of this matter are deemed duly established:

Ministerio de Salud a) On 17 de setiembre de 2024, the Área Rectora de Salud de Puntarenas – Chacarita received an anonymous complaint, through document-receipt form PC-AC-925-2024, concerning wastewater accumulating in inspection chambers (cajas de registro) located within the easement that channels wastewater from homes located between Dirección05. (report submitted and evidence contained in the record); b) On 19 de setiembre del 2024, an on-site inspection was conducted, during which it was possible to verify sanitary irregularities involving water accumulating in the easement’s inspection chambers and foul odors. (report submitted and evidence contained in the record); c) On 04 de octubre del 2024, as a result of the inspection conducted, sanitary order 0112-REG-2024 was served on Mr. Randall Alexis Chavarría Matarrita, Municipal Mayor, requiring that, before 9 de octubre del 2024, measures be taken to ensure the proper operation of the easement that channels wastewater from homes located between Dirección03.

(report submitted and evidence contained in the record); d) During a field inspection conducted on 10 de octubre del 2024, no changes were observed at the site compared with the inspection conducted on 19 de setiembre del 2024. (report submitted and evidence contained in the record); e) After the deadline granted for compliance with sanitary order 0112-REG-2024 expired, no physical or digital report was received from the Municipalidad de Puntarenas describing the actions taken in compliance with order 0112-REG-2024. (report submitted); f) Because the Municipalidad de Puntarenas failed to comply with sanitary order 0112-REG-2024, sanitary report MS-DRRSPC-DARSPC-0699-2024, imposing a fine for noncompliance, was served on Mr. Randall Alexis Chavarría Matarrita in his capacity as Municipal Mayor on 11 de octubre del 2024. (report submitted); g) On 4 de diciembre del 2024, a criminal complaint was filed against the Municipalidad de Puntarenas before the Fiscalía Adjunta del Ministerio Público en Puntarenas for the alleged Offense of Disobedience to Authority (Delito de Desobediencia a la autoridad). (report submitted).

Instituto Costarricense de Acueductos y Alcantarillados h) In the INVU sector, known as Barrio El Cocal and located in the province of Puntarenas, AyA provides only drinking-water service. The wastewater collection system was constructed by INVU as a condominium sewer system and was accepted by the Municipalidad de Puntarenas, which is responsible for its preventive and corrective maintenance. (report submitted); i) The wastewater collection system has an internal pipe that crosses the backyards of all the properties and is subject to a right-of-way easement, registration reference N°331-07008-01-0900-001; nevertheless, access to the right-of-way easement for the collection pipe is obstructed because residents have erected various structures on the easement, including walls, storage sheds, covered walkways, and a workshop, among others. (report submitted); j) Although the Municipalidad de Puntarenas is responsible for the preventive and corrective maintenance of the INVU Cocal system, AyA, pursuant to sanitary orders issued by the Ministerio de Salud, has undertaken maintenance of the sector’s wastewater collection tanks.

However, this work is hindered because there is no unobstructed access through the wastewater right-of-way easement designated for this purpose, and AyA personnel must enter through private property to clear obstructions. It is noted that the Municipalidad de Puntarenas is responsible for taking the appropriate legal action to keep the easement freely accessible. (report submitted); k) Since 2018, residents of El Cocal have filed two amparo proceedings concerning wastewater spills: decision N°2018008599 and decision N°2019022487. In both, the Municipality was ordered to undertake the appropriate legal measures to permit unobstructed access through the right-of-way easement, clean and maintain the septic tank, and coordinate technical matters with AyA. Accordingly, the Institution has participated in interinstitutional meetings with MINSA and the Municipalidad de Puntarenas to provide any cooperation and/or advice required for the proper operation of the wastewater system. (report submitted).

Municipalidad del Cantón Central de Puntarenas l) According to the director of Desarrollo Territorial y Urbano of the Municipalidad de Puntarenas, in official letter MP-DDTU-OF-393-12-2024 dated 05 de diciembre de 2024: the community of El Cocal de Puntarenas does not have a sanitary sewer network (red de alcantarillado sanitario). Under its founding law, AyA is the governing authority for sanitary wastewater and stormwater. AyA has a Regional office in Puntarenas, located in Barranca, and we have made ourselves available on many occasions to assist in containing the problem affecting the Seguro Social houses, Dirección03. (report submitted); m) That housing project was promoted and constructed by the Instituto de Vivienda y Urbanismo, which designed treatment systems using a common septic tank; consequently, the wastewater discharged by each home flows into a general collection tank serving the entire project.

(report submitted); n) Regarding the overflow problem (rebalse). The Directorate of Territorial and Urban Development has conducted several inspections and has determined that the cause of the problem is the absence of grease traps to prevent obstructions in the piping system. It further states that, because there is a single piping system for all the houses, if one resident fails to perform proper maintenance and cleaning, this affects that resident’s home and those of the others, because the system becomes obstructed and the water overflows into the houses. Accordingly, the pipes referred to in the cited report cannot be cleaned from outside or from the front of the properties, because they are located in the yards of the homes, making it impossible for the municipality to take action because they are on private property. It further states that the only access to the existing pipe branch was closed off by all the neighbors when they built walls, and that a search of the Property Registry shows that this access is part of a water easement (servidumbre de aguas) owned by INVU, to which the municipality likewise cannot gain access. (report submitted):

  • o)The municipality performs maintenance and cleaning of the communal storage tanks every year. (report submitted).

III. BACKGROUND TO THE AMPARO PROCEEDING (ANTECEDENTES DEL RECURSO)

This Court heard amparo proceedings (recursos de amparo) No. 18-006056-0007-CO and No. 19-015715-0007-CO, filed by other petitioners concerning the situation challenged here, involving the problem of sewage (aguas negras) originating from the internal sewer network of the housing development (urbanización) in El Cocal de Puntarenas. Thus, in judgment no. 2019022487 issued at 09:15 on 15 de noviembre de 2019, the Court ruled:

“(…) III.- Merits. In the case at hand, the petitioner, who is 83 years old, states that the INVU sector of the El Cocal de Puntarenas neighborhood has a problem involving pollution, foul odors, sewage backing up through both toilets and yards, and the accumulation of sewage and wastewater (aguas servidas). He explains that, between 1950 and 1960, INVU built 24 houses in the eastern sector of the El Cocal de Puntarenas neighborhood, with a shared dividing pipeline easement (servidumbre medianera de tubería) for water drainage and inspection chambers (cajas de registro) spaced along it for cleaning. He states that the water enters the tank, causing the ‘fecal sludge’ to accumulate, while the remainder of the water flows along the northern side toward the estuary. He argues that in 1961 he purchased house no. 19 and has resided in the housing complex since that year. He mentions that some neighbors inserted objects through the broken covers, causing the pipe to become blocked and, in addition to contaminated water overflowing into the yards, making the toilets unusable.

He states that each tenant gradually enclosed his or her yard, thereby obstructing the easement. He maintains that, despite the foregoing, the easement remains valid because it runs through all the yards and, although some neighbors have built septic tanks, discharge water from washing machines, bathrooms, and kitchens flows through the pipe. He relates that ICAA does not have a sanitary sewer system (alcantarillado sanitario) in the streets of the El Cocal community and that most wastewater from the buildings is discharged into the estuary. He asserts that the water drainage system was designed by INVU; however, it was effectively a deception of the owners, who must endure these conditions. He explains that in 2009 they filed several applications with the Municipalidad de Puntarenas concerning construction by Nombre01 in the yard of house no. 24; however, it was only following the intervention of the Defensoría de los Habitantes that they received a response, through official letter no. PUC-1647-2009 of 24 de agosto de 2009, by which time construction had already been completed.

He adds that this prevents the pipe from being cleaned and obstructions from being removed. He notes that, because of the constant blockages and the municipality’s reluctance to provide a solution, on 6 de febrero de 2017 (minutes no. 17) he appeared before the municipal council, which led to the establishment of a committee of council members, to which representatives of the health authorities, ICAA, the municipality, and two members of the community were invited. He states that the municipality undertook to clean the general septic tank; however, it did not address the remainder of the request. He mentions that the following matters remained pending: ‘a) opening the entrance to the easement, b) installing approximately thirty meters of larger-diameter pipe, c) installing a check valve (válvula de Vaivén) to prevent tidal water from entering the general tank, d) constructing a gate at the entrance to the easement and enlarging the inspection chamber in the area near the children’s playground to facilitate future cleaning by AyA, and e) installing a gate on the northern side at the entrance to the playground to prevent private vehicles from entering.

Only 30 meters of concrete pipe would be installed, rather than along the entire 150-meter route, because the blockages occur in this final section.’ He explains that at some point there was an agreement among officials from Ministerio de Salud, ICAA, and Asociación de Desarrollo Integral de Cocal under which, whenever the pipe became blocked, the neighbors would contact the health offices located in Cocal, which would request the cleaning crews’ services. He argues that the cleaning has been performed at his residence because other neighbors are unwilling to provide access through their homes due to the ‘fecal sludge’ mess left by the crew members. He complains that, during one of the blockages and despite his written request, the new head of ICAA did not authorize the crew to enter private property. He states that there is no other place from which to access the easement because access to it was unlawfully occupied by the construction in the yard of house no. 24.

He contends that government institutions have shown no interest in resolving the health problem and that the neighbors have withdrawn from the effort, leaving him to face the problem alone. He states that the authorities do not even evaluate his proposed solutions. He explains that the municipality should have received the streets, green areas, and easements from INVU for administration. He points out that ICAA has no sanitary sewer network in El Cocal and has no interest in resolving the matter. He relates that Ministerio de Salud issues health orders (órdenes sanitarias) to the public authorities; however, those orders are not obeyed. He seeks compensation for non-pecuniary harm (daño moral), because Municipalidad de Puntarenas failed to respond in a timely manner to the construction of a workshop and the unlawful occupation of the entrance to the sewage easement, which remains unresolved after ten years.

A review of the record establishes that the Puntarenas Cantonal Unit of ICAA, through official letter no. GSP-RPC-PU-2019-000648 of 5 de setiembre de 2019, stated that an amparo proceeding had already been filed concerning that sector (no. 18-006056-0007-CO) and that ICAA provides only potable-water supply services. It indicated that the sector has communal sanitary collection systems and that the INVU system specifically consists of a condominium sewer system (sistema de alcantarillado condominal), under which the homes in a particular block have a sanitary sewer pipe located internally along the pipeline right-of-way easement (servidumbre de paso de tubería), which lies in the backyards of the homes and crosses all the properties involved, and was therefore obstructed by the neighbors. It stated that the sewer system has never been accepted by ICAA; nevertheless, at the request of the governing health authority, interinstitutional meetings have been held with the participation of Ministerio de Salud, Municipalidad de Puntarenas, and the neighbors.

It explained that Ministerio de Salud issues health orders directing ICAA to intervene and resolve the obstruction problem. It contended that, even though ICAA has no authority over the system, it takes action pursuant to the principle of obedience and to safeguard public health. It further asserted that, although ICAA was not held liable in amparo proceeding no. 18-006056-0007-CO, it was ordered to assist Municipalidad de Puntarenas. It stated that, despite the Chamber’s order in the prior proceeding, Municipalidad de Puntarenas merely constructed covers for the water collection tanks, has not cleaned them, and has not taken action to remedy the encroachment upon land within the pipeline right-of-way easement.

Moreover, the Chamber verified that the Director of Urban Development and Control of the Municipalidad de Puntarenas, in official letter No. MP-DCU-483-09-2019 dated 9 de setiembre de 2019, stated: “(…) At the time of the field inspection, at the location described, no fecal contamination, foul odors, or sewage overflows were detected in the area. It should be noted that the inspection was conducted at the point where the pipe connects to the septic tank, as shown in the attached photograph. The reported problem was not detected in the surrounding area. What may be occurring inside the homes could not be determined because they are properties to which access is private, as most are residences. In the area, all the residents have taken possession of the strip of land designated as an easement (servidumbre) for sewage and wastewater pipelines. That strip of land belongs to the INVU, and therefore neither the Municipalidad nor A y A has been able to intervene to secure its clearance.

If an obstruction exists, it was caused by one of the residents through the improper appropriation of the easement. The reasons for authorizing a residential-development design that included this drainage easement are unknown, since the design was prepared and approved by the INVU in 1960. Neither the Municipalidad nor A y A has access to the pipeline because the drainage easement is encroached upon by residents from beginning to end by means of walls, additions, roofs, etc.; consequently, we do not know the condition of the pipeline. Whenever we have received complaints from residents concerning an obstruction, we have relied on A y A so that its personnel, by entering the affected person’s home, can perform clearing work using machinery and staff. This is improper and places the personnel themselves at risk, since operating machinery and equipment inside a home could cause damage that might lead to civil claims; this practice has therefore been discontinued.

(…) The actions undertaken by the Municipalidad to eliminate the problem were carried out at the beginning of this year, when a group of residents stated that sewage was overflowing inside their homes because the sewage collection tank located in the park next to the residential area was completely obstructed. For that reason, the Municipalidad undertook to clean it and directly contracted a company specializing in such work to clean and repair the tank for one million colones. The work was performed in February of this year, but the overflow problem apparently persisted because the pipeline, to which we have no access, was damaged. (…) With respect to our functions concerning the conditions affecting the petitioner, we have no pending work to perform. As is well known, the septic tank must be cleaned periodically; therefore, it is anticipated that there will be no further interventions this year, given that we cleaned it in February.

By law, the management and treatment of sewage and wastewater fall within the responsibility of A y A. Finally, until the legal situation concerning the drainage easement is resolved by the INVU and the residents, interventions to clean the pipeline will become increasingly difficult.” In addition, this Court notes that the Ministerio de Salud has issued a large number of health orders (órdenes sanitarias) to both the Municipalidad de Puntarenas and ICAA; nevertheless, the problem persists. The Environmental Manager for the Health Regulation Process of the Área Rectora de Salud Puntarenas-Chacarita, in technical report n.º MS-DRRSPC-DARSPC-IT-037-2019 of 9 setiembre de 2019, after describing all the actions taken by the institution she represents, stated: “WHEREAS (…) 80. In compliance with the instruction received in ruling N° 2018008599, in expediente N° 18-006056-0007-CO, dated 1 de junio del 2018 (…) 81.

According to the meeting held on 18/06/2018 with the Defensoría de los Habitantes, Municipalidad de Puntarenas, and the community, the following agreements were reached: - the Municipalidad will clean the tanks and construct the tank covers and the gate for the small park; it must also comply with ruling N° 2018008599 by cleaning and maintaining the tanks and arranging technical coordination with the Instituto Costarricense de Acueductos y Alcantarillados. Once access to the easement (servidumbre) is cleared, the residents will be able to perform maintenance, and it has not been accepted by A y A. The Defensoría recommends that the same measures be taken in similar cases analyzed. 82. According to the observations recorded in Visual Inspection Report (Acta de Inspección Ocular) N° 284-Reg-2018 dated 18 de junio 2018, prepared jointly with the Municipalidad de Puntarenas, ‘three uncovered openings corresponding to the wastewater system are observed, and foul odors can be detected.

A vehicle is observed parked inside the park and at the exit from MR. Nombre01’s garage. There is a concrete wall connecting the two homes along the walkways, obstructing the easement.’ 83. At a meeting held on 24/07/2018 with the Defensoría de los Habitantes, Municipalidad de Puntarenas, and the community, among the matters discussed and agreements reached: Engineer Mauricio Gutiérrez suggested that the wastewater management system should be placed under the administration of the Instituto Costarricense de Acueductos y Alcantarillados. - the Municipalidad de Puntarenas must conduct a legal study concerning the easement at Dirección03. 84. At a meeting held on 27/07/2018 with the Defensoría de los Habitantes, Instituto Costarricense de Acueductos y Alcantarillados, Municipalidad de Puntarenas, and the community, among the matters discussed and agreements reached: -the Municipalidad de Puntarenas must conduct a legal study concerning the easement at Dirección03 and arrange joint visits in order to obtain a clear understanding of the problem. 85.

According to Visual Inspection Report N° 295-Reg-2018, during a visit conducted on 6 de agosto del 2018, it was confirmed that the three chambers lacked covers and that two of them contained remnants of the old covers. They contained accumulated sediment, sludge, and water, and foul odors could also be detected. 86. Pursuant to Health Order N° OS-0180REG-2018 and Health Order N° OS-0181-REG-2018, served on 12 de setiembre del 2018 on the Municipal Mayor and the President of the Municipal Council, respectively, they were required to comply with the following: 1. Make the necessary arrangements and issue the appropriate instructions to clean and maintain the septic tanks located on the public roadway in Invu El Cocal; if necessary, technical coordination with the Instituto Costarricense de Acueductos y Alcantarillados must be arranged; this includes installing the respective three covers. 2.

Submit an Action Plan, with its corresponding schedule specifying deadlines of no more than one year and the persons responsible, which shall include: 2.a) Adopt appropriate measures to correct and prevent further obstacles to the normal flow of water, so that any obstruction or structure found within the right-of-way easement (servidumbre de paso) is removed, thereby allowing the proper discharge and flow of wastewater through the ‘sanitary sewer system (red de alcantarillado sanitario),’ so as to prevent wastewater from stagnating and overflowing and thereby affecting public health. 2.b) Ensure that cleaning activities are performed as regularly as necessary; and, if necessary, arrange technical coordination with the Instituto Costarricense de Acueductos y Alcantarillados.’ 87. During a visit conducted on 18 de setiembre del 2018, as recorded in Visual Inspection Report N° 349-Reg-2018, it was confirmed that the wastewater system was obstructed, the three tanks had no covers, sedimentation was present, and the water was not flowing. 88.

Pursuant to Health Order 183-Reg-2018, served on 18/09/2018 upon Mr. Danilo Chavarría Velázquez, cantonal head of the Instituto Costarricense de Acueductos y Alcantarillados, he was instructed, within 1 business day, to take the necessary measures to prevent sewage from overflowing from an inspection chamber located on the public roadway (easement) and within the yards of the homes. 2.- FACTS SUBSEQUENT TO THE COMPLAINT: 89. The complaint was received on 24 de setiembre del 2018, as recorded in Document Receipt Form N° PC-AC-1346-18, from Mr. Nombre02, who stated that the problem caused by the obstruction of the sewage pipes persisted; the Instituto Costarricense de Acueductos y Alcantarillados crew had been there the previous week but had failed to clear the obstruction completely. 90. On 01 de octubre del 2018, visits were conducted at several homes and on the public roadway in Urbanización el Invu.

El Cocal, as recorded in Visual Inspection Reports N° 373-Reg-2018 and N° 375-Reg-2018, during which sedimentation was confirmed in the three uncovered tanks located in the ‘small park,’ and the cleanout located within the wastewater right-of-way easement was found to be full of wastewater due to repeated obstruction. Tests were conducted using sodium fluorescein, and no contamination was established. 91. On 2 de octubre del 2018, as recorded in Visual Inspection Report N° 378-Reg- 2017, visits were conducted at several homes and on the public roadway, during which sedimentation was confirmed in the three uncovered tanks located in the ‘small park,’ and the cleanout located within the wastewater right-of-way easement was found to be full of wastewater due to repeated obstruction. Tests were conducted using sodium fluorescein, and no contamination was established. 92. Pursuant to Health Order N° OS-187-REG-2018, served upon the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados, and Health Order N° OS-189-REG-2018, served upon the Mayor of the Municipalidad de Puntarenas, both served on 3 de octubre del 2018 and allowing 24 hours for compliance, they were required to take the necessary measures to prevent sewage from overflowing from an inspection chamber located on the public roadway and within the yards of the homes. 93.

As recorded in Visual Inspection Report N° 383-Reg-2018 of 4 de octubre del 2018, a follow-up visit was conducted to verify compliance with the Health Orders. At the time of the visit, it was confirmed that neither the Municipalidad de Puntarenas nor the Instituto Costarricense de Acueductos y Alcantarillados had taken any action, as the problem caused by the obstruction of the wastewater disposal system persisted. 94. By means of official communications N° PC-ARS-PC-442-2018 and PC-ARS-PC-443-2018, served on 4 de octubre del 2018, formal judicial complaints for disobedience of authority were filed against the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Puntarenas. 95. As recorded in Visual Inspection Report N° 385-Reg-2018, another visit was conducted on 05 de octubre del 2018. It was confirmed that sediment and rainwater were present in the three uncovered tanks located in the ‘small park,’ and that the problem caused by obstruction of the wastewater disposal system persisted because, although officials from the Instituto Costarricense de Acueductos y Alcantarillados had recently appeared at the site, the required actions had not been taken. 96.

As recorded in Visual Inspection Report N° 386-Reg-2018 of 05 de octubre del 2018, it was confirmed that Mr. Nombre02’s inspection chamber had collapsed. However, it had not overflowed because of the wall surrounding it. The main tanks (three inspection chambers) were full of water; there were no foul odors. Although officials from the Instituto Costarricense de Acueductos y Alcantarillados had recently appeared at the site, the requested actions had not been taken. 97. By means of official communication N° GSP-RPC-PU-201 8-00654, received on 11 de octubre from the Instituto Costarricense de Acueductos y Alcantarillados, information was provided regarding compliance with Health Order 183-Reg-2018. 98. As recorded in Visual Inspection Report N° 512-Reg-2018 of 11 de octubre del 201 8, it was confirmed that Mr. Nombre02’s inspection chamber was obstructed but had not overflowed because of the wall surrounding it. 99.

As recorded in Visual Inspection Report N° 514-Reg2018 of 22 de octubre del 2018, noncompliance with Health Order N° OS-0180-REG-2018 and Health Order N° OS-0181-REG-2018 was confirmed. 100. A complaint was received on 5 de noviembre del 201 8, as recorded in Document Receipt Form N° PCAC-1 560-18, from Mr. Nombre02, who stated that the problem caused by obstruction of the sewage pipes had recurred. 101. As recorded in Visual Inspection Report N° 430-Reg-2018 of 7 de noviembre del 2018, it was confirmed that Mr. Nombre02’s inspection chamber was obstructed. However, it had not overflowed because of the wall surrounding it. The three tanks in the small park remained uncovered, putrid odors could be detected, and they were close to overflowing. 102. Pursuant to Health Order N° OS-208-REG-2018, served upon the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados, and Health Order N° OS-209-REG-2018, served upon the Mayor of the Municipalidad de Puntarenas, both served on 9 de noviembre del 2018 and allowing 24 hours for compliance, they were required to take the necessary measures to prevent sewage from overflowing from an inspection chamber located on the public roadway (easement) and within the yards of the homes. 103.

As recorded in Visual Inspection Report N° 521-Reg-2018 of 12 de noviembre del 2018, a follow-up visit was conducted to verify compliance with the Health Orders. At the time of the visit, it was confirmed that neither the Municipalidad de Puntarenas nor the Instituto Costarricense de Acueductos y Alcantarillados had taken any action, as the problem caused by obstruction of the wastewater disposal system persisted. 104. As recorded in Visual Inspection Report N° 522-Reg-2018 of 13 de noviembre del 2018, a follow-up visit was conducted to verify compliance with Health Orders OS- 208-REG-2018 and Nº -209-REG-2018, and the improvements made by the Instituto Costarricense de Acueductos y Alcantarillados were confirmed. 105. As recorded in Visual Inspection Report N° 523-Reg-2018 of 13 de noviembre del 2018, noncompliance with Health Order N° OS-0180-REG-2018 and Health Order N° OS-0181-REG-2018 was confirmed. 106.

By means of official communication N° PC-ARS-PC-516-2018 dated 13 de noviembre 2018 and addressed to the Municipalidad de Puntarenas concerning the problem of wastewater overflowing into the yards of the homes as a result of the continual obstruction causing the sanitary sewer system at Dirección03, INVU Cocal Puntarenas, to collapse, attention to official communication PC-ARS-PC-0325-2018 and Health Order N° OS-0180-REG-2018 was requested.

107 The note was received on 20 de diciembre del 2018, as recorded in Document Receipt Form N° PC-AC-1776-18, from Mr. Nombre02, stating that machinery was working on the general septic tank and requesting that an official conduct an inspection. 108. As recorded in Visual Inspection Report N° 526-Reg-2018, dated 20 de diciembre del 2018, a visit was conducted, and work was found to be under way at that time in the small park at Invu Cocal, in response to official communications and sanitary orders requesting action by the Municipalidad de Puntarenas. It is urgent that action be taken to prevent environmental contamination and risks to public health caused by work involving sludge from the wastewater tank deposited in a small park in the INVU, barrio el Cocal de Puntarenas, and that the regulations be complied with (Article 24.- Disposal of sludge. The disposal of any type of sludge or biosolids into bodies of water, and of untreated sludge onto soil, is prohibited), in addition to correcting matters related to transportation and final disposal so that suitable vehicles are used.

Occupational health measures must likewise be taken to avoid risks to workers’ health. 109. As recorded in Visual Inspection Report N° 527-Reg-2018, dated 21 de diciembre del 2018, a follow-up visit was conducted regarding the work performed, with no change in the manner in which the machinery and workers were carrying it out. 110. As recorded in Visual Inspection Report N° 001-Reg-2019 dated 9 de enero del 2019, a visit was conducted, and work was found to be under way at that time in the small park at Invu Cocal. It was also confirmed that Mr. Nombre02’s inspection chamber (caja de registro) had backed up but had not overflowed because of the wall surrounding it.111. Pursuant to Sanitary Order N° OS-001-REG-2019, served on the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados, and Sanitary Order N° OS-002-REG-2019, served on the Mayor of the Municipalidad de Puntarenas, both of which were served on 8 de enero del 2019 and provided a period of 3 business days, the necessary measures were requested to prevent sewage from overflowing from an inspection chamber located on the public right-of-way (easement (servidumbre)) and within the yards of the homes. 112.

As recorded in Visual Inspection Report N° 042-Reg-2019, dated 11 de enero del 2019, a follow-up visit was conducted to verify compliance with the Sanitary Order(s) (sic), and the improvements made by the Instituto Costarricense de Acueductos y Alcantarillados were confirmed. Also observed was the work being performed at that time in the small park at Invu Cocal by the Municipalidad de Puntarenas and an outside contractor, with some irregularities. 113. By official communication N° GSPRPC-PU-2019-0018, received on 14 de enero del 2019 from the Instituto Costarricense de Acueductos y Alcantarillados, information was provided regarding compliance with Sanitary Order 001-Reg-2019. 114. The note was received on 22 de abril del 2019, as recorded in Document Receipt Form N° PC-AC-056219, from Mr. Nombre02, stating that the sewage pipes were obstructed. 115. As recorded in Visual Inspection Report N° 086-Reg-2019, dated 26 de abril del 2019, an inspection was conducted and it was confirmed that Mr.

Nombre02’s inspection chamber had backed up but had not overflowed because of the wall surrounding it. Moisture was observed around the recently repaired tanks. 16. Pursuant to Sanitary Order N° OS-041-REG-2019, served on the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados, and Sanitary Order N°OS-042-REG-2019, served on the Mayor of the Municipalidad de Puntarenas, both of which were served on 29 de abril del 2019 and provided a period of 5 business days, the necessary measures were requested to prevent sewage from overflowing from an inspection chamber located on the public right-of-way (easement) and within the yards of the homes. 117. On 30 de abril 2019, a Motion for Reconsideration (Recurso de Revocatoria) was received from the Municipalidad de Puntarenas against N°OS-042-REG-2019, which was addressed through official communication MS-DRRSPCDARSPC- 0176-2019. 118.

The note was received on 5 de agosto del 2019, as recorded in Document Receipt Form N° PC-AC-1 096-19, from Mr. Nombre02, stating that the sewage pipes in his community were obstructed. 119. As recorded in Visual Inspection Reports N° 289-Reg-2019 and N° 290-Reg-2019, dated 13 de agosto del 2019, an inspection was conducted and it was confirmed that Mr. Nombre02’s inspection chamber had backed up but had not overflowed because of the wall surrounding it. It was also confirmed that the planter was no longer located over the easement. 120. Pursuant to Sanitary Order N° OS-1 13-REG-2019, served on the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados on 13 de agosto del 2019 and providing a period of 5 business days, the necessary measures were requested to prevent sewage from overflowing from an inspection chamber located on the public right-of-way (easement) and within the yards of the homes. 121.

By official communication N° GSP-RPCPU-2019-00594, received on 21 de agosto del 2019 from the Instituto Costarricense de Acueductos y Alcantarillados, information was provided regarding compliance with the (sic) Sanitary Order 01 13-Reg-2019. 122. Over the past five years, numerous complaints submitted by residents of the Cocal sector in Puntarenas concerning the wastewater overflow caused by the collapse of the sanitary sewer system (alcantarillado sanitario) have been addressed. Temporary solutions have been provided because that sanitary sewer system periodically becomes obstructed and collapses. 123. Visual inspections have established that an easement exists between the two residential sectors, through which runs the pipe carrying the wastewater generated by these homes. They have also established that access to the northern entrance of this easement has been blocked by a concrete wall, that dividing walls exist between each property, and that modifications have been made to some of the catch basins (ceniceros); these construction modifications were not approved by this Ministerio. 124.

According to various complainants, the housing project was built by the developer INVU and has a wastewater treatment system consisting of inspection chambers for each home and a pipe carrying wastewater (graywater, sewage, and possibly some stormwater) to three sedimentation tanks, which discharge the effluent into the estuary through a pipe of unknown diameter. 125. Neither the physical nor digital files of the Área Rectora contain any document providing information on the discharge from the wastewater collection system into the receiving body (cuerpo receptor), namely the estuary, nor is there a sketch or plan of the system used to dispose of the wastewater, the septic tank, or the drainage system. 126. According to observations by this Ministerio, three sedimentation tanks are located in a public area containing a children’s playground, and no gate is visible; it was confirmed that cement covers have now been installed on these tanks.

It is unknown whether this system fails to meet the characteristics and conditions of a functional and effective system for the treatment and final disposal of wastewater, which could cause serious environmental contamination, place public health at risk, and affect the ecological balance, compounded by the area’s socioeconomic factors.” Likewise, in technical report n.º MS-DRRSPC DARSPC-IT-043-2019 of 24 de setiembre de 2019, the Environmental Manager of the Health Regulation Process of the Área Rectora de Salud Puntarenas-Chacarita stated as follows: “WHEREAS 1. Since 2013, the Área Rectora de Salud Puntarenas - Chacarita has been coordinating specific actions with the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Puntarenas, in cooperation with affected residents, following the increase in complaints regarding obstruction and water overflows in the INVU Cocal ‘Wastewater Network.’ This is documented in greater detail in Technical Report N° MS-DRRSPC-DARSPC-IT-037-2019, which reports on the actions taken by Environmental Manager Bach.

Brook Vega Davies of the Health Regulation Process of this Área Rectora de Salud in response to the Petition for Constitutional Relief (Recurso de Amparo) filed on 2 de setiembre before the Sala Constitucional de la Corte Suprema de Justicia, under Expediente N° 19-015715-0007-CO. 2. The note was received on 18 de setiembre del 2019, as recorded in Document Receipt Form N° PC-AC-1317-19, from Mr. Nombre02, stating that the sewage pipes in his community were obstructed. 3. As recorded in Visual Inspection Report N° 416-Reg-2019, dated 19 de setiembre del 2019, his property was entered with his authorization to verify the reported facts concerning the obstruction of a drainage system shared by several homes, which causes the water level in the inspection chamber to rise. The water is contained by a wall and cover around it, and wastewater was observed at a level close to overflowing. 4. As recorded in Visual Inspection Report N° 419-Reg-2019, dated 19 de setiembre del 2019, in follow-up to OS-0180-Reg-2018, OS-0181-Reg-2018, and official communication PC-ARS-PC-516-2018, three tanks with cement covers and some cracks were observed; no moisture was observed around them, and foul odors emanating from the tanks and the storm sewer were detected.

A vehicle bearing license plate PLA01 was observed parked inside the small park, next to a black metal door; this forms part of the wall that obstructs the right-of-way easement (servidumbre de paso) in its northern sector, adjacent to the children’s park. 5. Pursuant to Sanitary Order N° OS-167-REG-2019, served on the Cantonal Head of the Instituto Costarricense de Acueductos y Alcantarillados on 19 de setiembre del 2019 and providing a period of 5 business days, the necessary measures were requested to prevent sewage from overflowing from an inspection chamber located on the public right-of-way (easement) and within the yards of the homes. 6. In light of the repeated complaints received by this Ministerio, it is evident that the problem has worsened and has not diminished since the Municipalidad cleaned the three tanks located in the park between Dirección05. It is unknown whether high tides may be affecting the wastewater system, which discharges into the estero de Puntarenas.” Pertinent to the matter under review, the Chamber, by judgment No. 2018-008599 at 9:15 hours on 1º de junio de 2018, ruled:

“Whereas:

(…)

IV.Merits. In this particular case, the protected party, a resident of Barrio EL Invu del Cocal de Puntarenas, raises two issues before the respondent authorities. The first concerns the failure to clean the wastewater collection tanks, and the second concerns the lack of maintenance of the sewer system serving the housing development where he resides. Each is analyzed separately. 1) Regarding the failure to clean the wastewater collection tanks: The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal penalties, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of this matter establish, first, that the housing development where the septic tank is located, at the traffic circle and on the public roadway of INVU del Cocal de Puntarenas, was built by INVU, including the collection system, which is not administered by AyA.

Regarding the lack of maintenance of the wastewater collection tanks, the respondent authorities agree in their respective reports that the situation is real, but that cleaning the tanks is an obligation that must be assumed by the owners. In this regard, the Municipal Mayor omits any direct reference to the situation raised by the petitioner and emphasizes that the municipal corporation neither has direct authority nor possesses the equipment needed to clean tanks, a task that, according to the reporting Mayor, is the responsibility of the residents. Accordingly, insofar as the appeal is directed against the respondent Municipality, this Chamber finds that, notwithstanding the Mayor’s assertion that the task of cleaning the specified collection tanks must be undertaken by private parties, the Municipality is aware of the problem affecting the inhabitants of that area and has a duty to take the necessary steps to compel those responsible to resolve a problem known since 2015; nevertheless, it merely notes the problem without doing anything about it.

Similarly, in the report submitted to this Chamber by the Governing Health Area of the Ministerio de Salud, that authority admits that a sanitary problem persists, since it acknowledges that the cover has cracks through which foul odors escape. However, the Chamber does not find that the Ministerio has adopted effective measures to prevent the public-health problem posed by the poor condition of the tank cover, which is not only unsealed but also cracked. The provision of a public service such as that entrusted to the Ministerio de Salud requires a degree of efficiency and diligence perhaps greater than that required of other public bodies, because of the fundamental rights to health and to a healthy environment, within the scope of its authority. Based on the foregoing, the Chamber considers that the failure of the Municipalidad de Puntarenas and the Ministerio de Salud to act in this case violates the protected party’s fundamental rights to health and to a healthy environment.

The appeal against them must therefore be granted, and they must be ordered to take the necessary measures, even drastic ones, and adopt the appropriate decisions to eliminate the sanitary problem that may arise from the tank’s poor condition and the lack of maintenance of the wastewater collection tank. 2) Regarding the lack of maintenance of the housing development’s sewer system. The facts duly established in this matter, particularly the report from the AyA representative, show that the water collection system referred to by the petitioner requires preventive maintenance and intervention by the entity that administers the system, because encroachment upon land subject to a pipeline right-of-way easement (servidumbre de paso de tubería) has been tolerated at the site, preventing access to perform preventive and corrective maintenance on the collection network. The foregoing, particularly the statements made by the AyA representative in his report to this Chamber, shows that the lack of oversight over the proliferation of construction work throughout the affected area, including over the area through which the pipeline runs, has resulted in leaks and difficulties in maintaining the sewers and water collection system.

It is also clear that covers are missing and have not been replaced, and that the water collection network serving the housing project where the petitioner resides lacks maintenance. This leads to the conclusion that the Municipalidad del Cantón Central de Puntarenas has neither coordinated nor, at a minimum, undertaken the actions necessary to remedy the condition of the water collection network and prevent it from worsening, so as to ensure the system’s proper operation. Such passivity also characterizes the limited involvement of the respondent Área de Salud in this area, and this inaction has adversely affected the community, at times causing the collection system to overflow and obstructing the passage of pedestrians and vehicles. Regarding a possible solution to the wastewater disposal problems, the report requested by this Chamber from AyA indicates that this obligation rests with the project developer.

Although, in principle, the work should not be undertaken by the Administration, it is established that neither the respondent Municipality nor the Ministerio de Salud, before which the corresponding complaint was filed, has taken the measures incumbent upon it, within the scope of its authority, to coordinate or issue sanitary orders (órdenes sanitarias), as appropriate, aimed at remedying the problem. On the contrary, far from requiring corrective action, construction has been tolerated on the easement through which the pipeline runs (see the AyA report). Nor, at a minimum, has a preventive approach been adopted, even though both the respondent Municipality and Área de Salud admit that the wastewater disposal problem poses a risk to public health and has been known for several years. The foregoing demonstrates a lack of coordination among the respondent authorities in providing a comprehensive solution to the problem.

For its part, the representative of the Ministerio de Salud attempts to justify its inaction in the report submitted to this Chamber by stating that there is currently no wastewater overflow. Accordingly, in this Court’s view, the passive approach of the Área de Salud, which waits for the wastewater to overflow before acting, is manifestly insufficient, since its plan is to wait until a critical situation arises before attempting to provide a solution, instead of implementing, once and for all, preventive and corrective maintenance of the water collection network, which is known to affect the inhabitants of the area. Consequently, the appeal must be granted insofar as it is directed against the Municipality and the Área de Salud de Puntarenas, as is hereby ordered. (…)

VII. THE AMPARO AGAINST AYA

Lastly, the amparo proceeding (amparo) against the Instituto Costarricense de Acueductos y Alcantarillados must be dismissed because the report submitted shows that the place where the protected party resides has a private wastewater collection system, since AyA provides only drinking-water service in the Cocal area. Thus, the sanitary problem is caused by a wastewater management system that has not been taken over by that institution. Moreover, whenever the Ministerio de Salud, through sanitary orders, has requested the institution’s intervention to resolve the problem because public health is at stake, AyA has complied with those orders. Consequently, the appeal is dismissed as to this claim, as is hereby ordered.

VIII. CONCLUSION

In this particular case, sewer problems have been established at the traffic circle and on the public roadway of INVU del Cocal de Puntarenas, causing wastewater to stagnate and overflow, a situation known to the Área Rectora de Salud and the Municipalidad de Puntarenas. Nevertheless, despite the complaint filed, those authorities have failed to find a solution, using as an excuse that private parties or the developer are responsible for maintaining the water network and cleaning the septic tanks. In addition, to date there is no current order issued by the respondent Municipalidad de Puntarenas to the owners and/or the person responsible for the housing project requiring them to properly maintain the water collection network or clean the septic tank, despite its cracks and broken sections. Nor is there any evidence that the Ministerio de Salud has issued sanitary orders, even though it is responsible for ensuring mandatory compliance with them, as required under the Ley General de Salud, which establishes the Ministerio de Salud’s nondelegable duty either to address the matter directly or to compel the developer to immediately remedy the problem caused by improper wastewater disposal.

That condition is creating the health problem affecting the protected parties and tends to worsen during the rainy season. Accordingly, pursuant to the preventive principle (principio preventivo) applicable in environmental matters, the Municipalidad de Puntarenas and the Área Rectora de Salud de Puntarenas - Chacarita de la Región Pacifico Central del Ministerio de Salud must be ordered to undertake the necessary coordination within the scope of their respective authority and to follow up on the situation, as specified in the operative portion of this judgment. They must also resolve and respond to the complaint filed by the petitioner in diciembre de 2017 within the period specified in the operative portion of this judgment. (…)

Por tanto:

The appeal is GRANTED. Randall Chavarría Matarrita, in his capacity as Alcalde Municipal del Cantón Central de Puntarenas, and/or whoever holds that office in his stead, is ordered to undertake the necessary coordination and issue the appropriate instructions so that, within no more than one month from service of this judgment, the septic tank located at the traffic circle and on the public roadway of INVU del Cocal de Puntarenas identified by the protected party is cleaned and maintained; and, within one year from service of this judgment, to adopt appropriate measures to remedy and prevent further obstructions to the flow of wastewater. Within that same period, he must ensure that such cleaning is performed as regularly as necessary and, if required, must arrange technical coordination with the Instituto Costarricense de Acueductos y Alcantarillados. Pursuant to the preventive principle, Ericka Jiménez Valverde, in her capacity as Directora del Área Rectora de Salud de Puntarenas -Chacarita de la Región Pacifico Central del Ministerio de Salud, or whoever holds that office in her stead, is ordered to issue such sanitary orders as she deems appropriate to ensure the proper operation of the sanitary sewer system (sistema de alcantarillado sanitario), as well as the specified septic tank.” In view of the foregoing, the appeal against the Ministerio de Salud and the Municipalidad de Puntarenas must be partially granted.

In this regard, the appellant referred to a problem that had already been heard in this jurisdiction by virtue of a constitutional protection action (recurso de amparo) filed by another person. In the judgment partially transcribed above, this Court ordered the Municipalidad de Puntarenas to make the necessary arrangements and issue the pertinent instructions not only to clean and maintain the septic tank, but also to adopt appropriate measures to correct and prevent further obstructions to the flow of water; it further ordered that the Municipality ensure that cleaning was performed as regularly as necessary and, if needed, arrange technical coordination with the ICAA. Likewise, on that occasion, the Chamber ordered the Área Rectora de Salud de Puntarenas - Chacarita de la Región Pacifico Central del Ministerio de Salud to issue such health orders (órdenes sanitarias) as it deemed appropriate for the proper operation of the sanitary sewer system (sistema de alcantarillado sanitario), as well as the septic tank.

In this specific case, the evidence submitted by the respondent authorities shows that the problems identified in the previous constitutional protection action persist.

In this regard, although the municipality cleaned the septic tanks in February 2019 (which are connected to the easement (servidumbre)), it stated in its report that it had no outstanding work because it would not perform another cleaning during the remainder of the year. Nevertheless, despite that assertion, it has been established that, after the tanks were cleaned, the ICAA (the entity to which no responsibility was attributed, but only a duty of technical coordination) had to intervene because of sewage overflows, demonstrating that the problem has not been resolved.

In addition, communications from the health authorities expressly acknowledged that, over the past five years, they had addressed multiple complaints filed by residents of El Cocal regarding wastewater overflows caused by the periodic collapse of the sanitary sewer system; they also stated that they were aware that an easement runs through the homes, that its entrance is closed off by a concrete wall, and that it is obstructed by dividing walls between each property. Specifically, the Área de Salud de Puntarenas stated that it did not know whether the system possessed the characteristics and conditions required of a functional and effective system for the treatment and final disposal of wastewater, which could cause serious environmental pollution, placing public health and the balance of ecosystems at risk. This is objectionable because, if a threat or potential harm to the environment and public health is established, appropriate measures must be taken to eliminate it.

Although the Ministerio de Salud has filed a criminal complaint against the mayor of Puntarenas for disobeying an authority and has undertaken a large number of actions, it is no less true that the reported situation persists. Likewise, it cannot be overlooked that the Municipalidad de Puntarenas considers the matter at issue to fall within the jurisdiction of the ICAA, while the latter, in addition to stating that it is not responsible for resolving the matter, also objects that the local government has neither complied with the Chamber’s judgment nor ensured the removal of obstructions from the pipeline easement located in the residents’ yards.

Indeed, one of the principal problems is that the municipal authorities are uncertain about the legal status of the easement because, although they stated that it belonged to the INVU, the court-ordered supplementary evidence (prueba para mejor resolver) requested from the Registro Nacional did not substantiate that assertion. The Ministerio de Salud even required the Municipalidad de Puntarenas to conduct a legal study of the easement, but there is no evidence that it did so.

For the foregoing reasons, the action against the Ministerio de Salud and the Municipalidad de Puntarenas must be granted, so that they make the necessary arrangements to resolve the adverse effects caused by the wastewater and stormwater problems in the INVU sector of the barrio El Cocal de Puntarenas, in connection with the sewer system that crosses the properties through an easement. Accordingly, the Municipalidad de Puntarenas must analyze the current physical and legal status of the easement, as well as its respective legal and technical implications, and submit that report to the Ministerio de Salud. The health authority must also analyze the municipality’s report and issue its own opinion concerning the easement in order to assess the possible liability of the municipality and the property owners and then order provisional and final measures aimed at resolving the reported problem. Finally, the Municipalidad de Puntarenas must comply with any health orders issued against it, without prejudice to the possibility of challenging those administrative acts, as well as their legal and technical feasibility, in ordinary proceedings.

In connection with the foregoing, although it was acknowledged that the area has no sanitary sewer system, that circumstance does not relieve the responsible parties of their duty to ensure adequate wastewater treatment for as long as that situation persists. If the appellant believes that the ICAA must immediately construct a sanitary sewer network in El Cocal, he must submit that request to the institution or pursue it in the ordinary jurisdiction, where the corresponding evidence may be taken in broader proceedings, based on additional information, and a determination made as to whether the request is warranted.

Furthermore, the specific solutions proposed by the appellant must be submitted to those same authorities or pursued in the ordinary jurisdiction. As to the INVU, based on the evidence in the record, the action is denied because it is not evident that it currently has any connection to the allegations; this determination is made without prejudice to the possibility that liability may be established in plenary proceedings. Finally, on the same grounds as the cited precedent, the action against the ICAA is denied; nevertheless, that authority shall take notice so that, within the scope of its powers, it provides the technical support requested by the health authorities. It must also participate in the corresponding coordination efforts with the Ministerio de Salud and the Municipalidad de Puntarenas so that its technical expertise may contribute to resolving the problem.

IV.Note by Justice Salazar Alvarado. In environmental matters, it is the undersigned Justice’s view that, where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (artículo 50, de la Constitución Política), as is the case here, where allegations concern pollution affecting the Estero de Puntarenas due to sewage and wastewater originating in the barrio El Cocal de Puntarenas, which harms the health of local residents and violates the right to enjoy a healthy and ecologically balanced environment and a decent quality of life.

Por tanto:

The application is partially granted solely against the Municipalidad de Puntarenas and the Ministerio de Salud.

  • 1)Randall Chavarría Matarrita, in his capacity as Mayor of Puntarenas; Carlos Manuel Venegas Porras, in his capacity as Regional Director of Health Governance for the Central Pacific Region of the Ministerio de Salud; and Carlos Manuel Venegas Porras, in his capacity as Regional Director of Health Governance for the Central Pacific Region of the Ministerio de Salud, or whoever holds their respective positions, are ordered to coordinate the necessary actions within the scope of their authority so that, within SIX MONTHS from notification of this judgment, a solution is provided for the harm caused by the wastewater (aguas residuales) problems in the INVU sector of the El Cocal neighborhood of Puntarenas, in connection with the sewer system (sistema de alcantarillado) that crosses the properties by means of an easement (servidumbre).
  • 2)Carlos Manuel Venegas Porras, in his capacity as Regional Director of Health Governance for the Central Pacific Region of the Ministerio de Salud, and Ericka Jiménez Valverde, in her capacity as Director of the Área Rectora de Salud de Puntarenas, or whoever holds their respective positions, are ordered to IMMEDIATELY issue the appropriate orders for interim measures (medidas provisionales) to be taken to address wastewater overflows in the INVU sector of the El Cocal neighborhood of Puntarenas and the resulting pollution and foul-odor problems.
  • 3)Randall Chavarría Matarrita, in his capacity as Mayor of Puntarenas, or whoever holds that position, is ordered to issue the appropriate orders and take the necessary measures so that, within a maximum period of ONE MONTH from notification of this judgment, a study is prepared regarding the current condition of the easement recorded under entries No. 331-07008-01-0900-001 (encumbering property No. PRN01 registered in the name of Nombre02), which crosses the INVU sector of the El Cocal neighborhood of Puntarenas; furthermore, within THREE DAYS after the report is issued, he must forward it to the Área Rectora de Salud de Puntarenas and the Regional Directorate.
  • 4)Carlos Manuel Venegas Porras, in his capacity as Regional Director of Health Governance for the Central Pacific Region of the Ministerio de Salud, and Ericka Jiménez Valverde, in her capacity as Director of the Área Rectora de Salud de Puntarenas, or whoever holds their respective positions, are ordered, once the Municipalidad de Puntarenas forwards the study concerning the aforementioned easement to them, to issue a technical and legal opinion concerning it within ONE MONTH of its receipt and, within that same period, to issue the corresponding sanitary orders (órdenes sanitarias) to resolve the wastewater overflows in the INVU sector of the El Cocal neighborhood of Puntarenas and the resulting pollution and foul-odor problems.
  • 5)Randall Chavarría Matarrita, in his capacity as Mayor of Puntarenas, or whoever holds that position, is ordered to comply with the sanitary measures issued by the Ministerio de Salud, without prejudice to the right to challenge those administrative acts (actos administrativos), as well as their legal and technical feasibility, through ordinary proceedings. The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Puntarenas are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified in contentious-administrative judgment-enforcement proceedings (ejecución de sentencia de lo contencioso administrativo). In all other respects, the application is denied. The Instituto Costarricense de Acueductos y Alcantarillados shall take note of the matters stated in Considerando III. Justice Salazar Alvarado adds a separate note. Randall Chavarría Matarrita, in his capacity as Mayor of Puntarenas; Carlos Manuel Venegas Porras, in his capacity as Regional Director of Health Governance for the Central Pacific Region of the Ministerio de Salud; and Ericka Jiménez Valverde, in her capacity as Director of the Área Rectora de Salud de Puntarenas, shall be personally served.”

IV.Regarding the duties of municipalities pursuant to Article 169 of the Constitución Política, this Chamber stated the following in judgment No. 2023011483 at 09:20 on May 19, 2023:

“(…) IV.- In its case law, this Court has recognized the obligation of the municipalities to take effective and prompt action in response to the needs of the territorial district assigned to each municipal corporation, which is closely connected to the population element. Those obligations arise from Articles 169 and 170 of the Constitución Política and encompass a wide range of activities. Accordingly, in judgments N° 2011-12886 at 12:44 on September 23, 2011, and N° 2015010541 at 09:20 on July 17, 2015, among others, this Chamber stated:

“(…) pursuant to Article 169 of the Constitución Política and the Código Municipal, municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, the Municipalidad must establish a comprehensive urban-planning policy (planeamiento urbano) in accordance with the applicable law, aimed at the efficient and harmonious development of urban centers and guaranteeing, at a minimum, efficient electricity and communications services; sound drinking-water supply and sewage-disposal systems; adequate water-supply and sewer systems; urban lighting and beautification systems; and street and other public-road construction, repair, and cleaning services—in general, concrete and practical plans to make life comfortable and safe for the population.” Furthermore, regarding the provision of services, this Chamber has held—for example, in judgment N° 2016-000427 at 09:30 on January 15, 2016—that the proper functioning of such services is a fundamental right (derecho fundamental).

This follows from Articles 139, 140, and 191 of the Constitución Política. It entails an obligation on the part of the various Public Administrations to provide services continuously, regularly, promptly, effectively, and efficiently. Likewise, the organizational provisions of the Fundamental Charter establish a series of principles governing the organization and operation of the Administration, which have been developed through subconstitutional rules such as the Ley General de la Administración Pública. Articles 4, 225, paragraph 1, and 269, paragraph 1, of that law impose on State bodies the duty to guide and sustain administrative organization and operations. Thus, the principle of effectiveness (principio de eficacia) means that the administrative organization must be designed to achieve the objectives and purposes assigned by the legal system itself, which requires planning and accountability.

For its part, efficiency entails achieving the best results through the rational use of the resources available to the various agencies. The Administration is also subject to the principle of simplicity (principio de simplicidad), which must be understood as the obligation to ensure that administrative structures and their powers are easy to understand, without complex procedures that delay the satisfaction of public interests. The principle of promptness (principio de celeridad) requires Public Administrations to fulfill their objectives and purposes in the most expeditious, rapid, and appropriate manner possible, so as to prevent undue and unjustified delays. These principles therefore impose a series of ongoing requirements, responsibilities, and duties on all public entities (…)”.

V. REGARDING THE SPECIFIC CASE

It has been established that the protected party lives in El Cocal de Puntarenas, in the homes known as the Seguro Social houses, at Dirección03. Approximately one month ago, sewage (aguas negras) from the residential development’s internal sewer network began entering his home and the homes of other neighbors. He explains that this situation is apparently due to a lack of maintenance by the competent authorities. He states that the sewage should be discharged into nearby tanks; however, it flows freely because the sewer system has collapsed or become obstructed. He asserts that this situation endangers his life and the lives of many people in the area, including women, children, and older adults, and also endangers the environment. For that reason, he went to the office of the Mayor of Puntarenas to report the situation, but the Mayor argued that he lacked the machinery and resources necessary to solve the problem, disregarding the risk it poses to the residents’ health. The petitioner emphasizes that, despite the seriousness of the problem, the responsible authorities have taken no action to remedy it.

Based on its analysis of the reports submitted and the evidence in the record, the Chamber finds that the protected party’s claim is well founded. This is because the record shows that, since 2018, other residents of El Cocal de Puntarenas have appeared before this Court regarding the same problem affecting them—sewage originating from the residential development’s internal sewer network—and that, as of the date on which the petitioner filed this amparo application, the respondent authorities had not taken the appropriate steps to resolve the problem affecting them, despite the two orders issued by this Court.

For the foregoing reasons, and in accordance with judgment No. 2018-008599 at 9:15 on June 1, 2018, and judgment No. 2019022487 at 09:15 on November 15, 2019, the application filed against the Municipalidad de Puntarenas and the Ministerio de Salud is partially granted for the following reasons:

Regarding the Municipalidad de Puntarenas. Although the mayor reports that the municipality has been carrying out maintenance and cleaning of the communal storage tanks every year, this has evidently not been sufficient, since the problem affecting the community of El Cocal de Puntarenas persists. Indeed, it should be noted that the respondent authorities themselves acknowledge the problem; however, they do not inform the Chamber what definitive actions they intend to take to find a solution to it, since the mayor merely states that the community has no sanitary sewer system (red de alcantarillado sanitario). He states that the housing project was promoted and built by the Instituto de Vivienda y Urbanismo, which designed treatment systems using a communal septic tank (tanque séptico común); consequently, the water discharged by each dwelling flows into a general collection tank for the entire project.

He further states that the inspections conducted did, in fact, establish that the cause of the problem is the absence of grease traps (trampas de grasas) to prevent blockages in the piping system (sistema de tuberías), because there is a single piping system for all the houses, and if one resident fails to perform proper maintenance and cleaning, this affects both that resident’s dwelling and those of the others, as the system becomes obstructed and the water overflows into the houses. Accordingly, the pipes referred to in the cited report cannot be cleaned from outside or from the front of the properties because they are located in the backyards of the dwellings, making it impossible for the municipality to act because these are private properties. He further states that the only existing access to the pipeline branch was closed off by all the residents when they built walls and that a search of the Property Registry shows that this access corresponds to a water easement (servidumbre de aguas) owned by INVU, which the municipality likewise cannot access.

This situation was also noted by the Instituto Costarricense de Acueductos y Alcantarillados, which reported that the wastewater collection system (sistema de recolección de aguas residuales) has an internal pipeline crossing the backyards of all the properties, corresponding to a right-of-way easement (servidumbre de paso) recorded under registration reference N°331-07008-01-0900-001 (the same easement addressed in amparo 19-015715-0007-CO). However, access to the right-of-way easement for the collection pipeline is obstructed because residents have erected various structures on the easement, including walls, storage sheds, corridors, and a workshop, among others. Although preventive and corrective maintenance of the INVU Cocal system is the responsibility of the Municipalidad de Puntarenas, AyA, pursuant to sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud, has undertaken maintenance of the sector’s wastewater collection tanks.

This work is hindered, however, because there is no unobstructed access to the right-of-way easement designated for wastewater, requiring AyA officials to enter through private property to clear the obstructions. It states that the Municipalidad de Puntarenas is responsible for taking the pertinent legal action to keep the easement freely accessible. It further states that, because of this problem, in 2018 the residents of El Cocal filed two amparo actions (recursos de amparo), in which this Tribunal ordered the municipality to undertake the pertinent legal measures to provide unobstructed access to the right-of-way easement, clean and maintain the septic tank, and coordinate technical matters with AyA. Accordingly, the Institution has participated in interinstitutional meetings with MINSA and the Municipalidad de Puntarenas to provide any collaboration and/or advice required for the proper operation of the wastewater system.

Regarding this issue, in the aforementioned decision No. 2019022487 issued at 09:15 on November 15, 2019, the Chamber ordered the following:

(…) 3) Randall Chavarría Matarrita, in his capacity as Mayor of Puntarenas, or whoever holds that office, is ordered to issue the pertinent instructions and take the necessary measures so that, within a maximum period of ONE MONTH from notice of this judgment, a study is prepared concerning the current condition of the easement recorded under references n.º 331-07008-01-0900-001 (encumbering property n.º PRN01 registered in the name of Nombre02), which crosses the INVU sector of the El Cocal neighborhood in Puntarenas; furthermore, within THREE DAYS after the report is issued, he shall forward it to the Área Rectora de Salud de Puntarenas and the Dirección Regional (…)”.

It is evident from the foregoing that the order previously issued by this Tribunal has not been carried out, since the authorities themselves acknowledge the problem caused by that easement, and the mayor of the respondent municipality does not report what measures will be taken to find a solution to the problem.

Regarding the Ministerio de Salud. Although the reports submitted and the evidence in the record establish that the respondent authorities of the Ministerio de Salud -Área Rectora de Salud de Puntarenas – Chacarita- have taken steps to comply with the orders previously issued by this Tribunal, as reflected in the established facts of this judgment, and that, following the Municipalidad de Puntarenas’ failure to comply with sanitary order 0112-REG-2024, a criminal complaint was filed against the Municipalidad de Puntarenas on December 4, 2024, before the Fiscalía Adjunta del Ministerio Público en Puntarenas for the alleged Offense of Disobedience to Authority (Delito de Desobediencia a la Autoridad), the fact remains that, in the Chamber’s view, the ministry’s actions have been insufficient, because it has a duty to require compliance and to guarantee the protection of public health and the environment.

Accordingly, the Chamber finds that the respondent authorities of the Municipalidad de Puntarenas and the Ministerio de Salud have not complied with the order issued by this Tribunal in the judgments in expediente nro. 18-006056-0007-CO and nro. 19-015715-0007-CO. Although the authorities acknowledge the reported problem, as of the date on which the protected party seeks amparo relief—more than six years later—the respondent municipality has provided only temporary remedial measures and has not submitted evidence to the Chamber indicating the actions taken, whether through coordination with any authorities it deems necessary or with the owners of the properties concerned, to provide a comprehensive and definitive solution to the problem affecting the people living in the El Cocal de Puntarenas neighborhood. This situation is contrary to the constitutional principles of efficiency and effectiveness that must govern the performance of public duties.

Consequently, the appropriate course is to grant the action against these two respondent authorities and reiterate the order previously issued by this Chamber in judgment nro. 2019022487 issued at 09:15 on November 15, 2019.

VI.With respect, on the other hand, to the Instituto Costarricense de Acueductos y Alcantarillados, the Chamber finds no evidence that the institution has taken any action affecting the protected party’s fundamental rights, since it is evident that the institute provides only drinking-water service in the INVU sector known as Barrio El Cocal, located in the province of Puntarenas, and that although preventive and corrective maintenance of the INVU Cocal system is the responsibility of the Municipalidad de Puntarenas, AyA, pursuant to sanitary orders issued by the Ministerio de Salud, has undertaken maintenance of the sector’s wastewater collection tanks. Consequently, the action against that institute is denied.

Nevertheless, this authority shall take note that it must provide, within the scope of its powers, any technical support requested by the health authorities. It must also participate in the appropriate coordination with the Ministerio de Salud and the Municipalidad de Puntarenas so that its technical expertise may contribute to resolving the problem.

VII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (artículo 50, de la Constitución Política), as in this case, which concerns the contamination and harm caused by sewage entering from the residential development’s internal sewer network due to lack of maintenance of the sewer system at Dirección03, in the El Cocal de Puntarenas area.

The petitioner states that the corresponding complaints have been filed with the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Puntarenas; however, they have been unable to resolve the principal problem, which adversely affects the health and lives of residents and poses a public-health risk. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioner is advised that, if any paper document, object, or evidence stored on any additional electronic, computer, magnetic, optical, telematic, or new-technology device has been submitted, it must be retrieved from the court office within a maximum period of 30 business days from notice of this judgment. Otherwise, all material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, artículo XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, artículo LXXXI.

POR TANTO:

The application for relief is partially granted solely against the Municipalidad de Puntarenas and the Ministerio de Salud.

  • 1)Randall Alexis Chavarría Matarrita, Mayor of the Municipalidad del Cantón Central de Puntarenas; Dr. Mary Denisse Munive Angermüller, Minister of Health; and Dr. Carolina Lizeth Guillén Meléndez, Acting Director of the Área Rectora de Salud de Puntarenas–Chacarita-, or whoever holds those offices, are ordered to coordinate the necessary actions within the scope of their respective authority so that, within ONE MONTH from service of this judgment, a solution is provided for the adverse effects caused by the wastewater (aguas residuales) problems in the INVU sector of the El Cocal neighborhood of Puntarenas, in connection with the sewerage system (sistema de alcantarillado) that crosses the properties by means of an easement (servidumbre).
  • 2)Dr. Mary Denisse Munive Angermüller, Minister of Health, and Dr. Carolina Lizeth Guillén Meléndez, Acting Director of the Área Rectora de Salud de Puntarenas–Chacarita-, or whoever holds their offices, are ordered to issue, IMMEDIATELY, the appropriate directives for provisional measures to be taken to address wastewater overflows in the INVU sector of the El Cocal neighborhood of Puntarenas and the resulting pollution and foul-odor problems.
  • 3)Randall Alexis Chavarría Matarrita, Mayor of the Municipalidad del Cantón Central de Puntarenas, or whoever holds that office, is ordered to issue the appropriate directives and take the necessary measures so that, within a maximum period of ONE MONTH from service of this judgment, a study is prepared regarding the current condition of the easement recorded under reference no. 331-07008-01-0900-001, which crosses the INVU sector of the El Cocal neighborhood of Puntarenas; furthermore, within THREE DAYS after the report is issued, it must be forwarded to the Área Rectora de Salud de Puntarenas–Chacarita-.
  • 4)Dr. Mary Denisse Munive Angermüller, Minister of Health, and Dr. Carolina Lizeth Guillén Meléndez, Acting Director of the Área Rectora de Salud de Puntarenas–Chacarita-, or whoever holds their offices, are ordered, once the Municipalidad de Puntarenas forwards the study concerning the aforementioned easement, to issue, within ONE MONTH of its receipt, a technical and legal opinion regarding it and, within that same period, to issue the corresponding health orders (órdenes sanitarias) to resolve the wastewater overflows in the INVU sector of the El Cocal neighborhood of Puntarenas and the resulting pollution and foul-odor problems.
  • 5)Randall Alexis Chavarría Matarrita, Mayor of the Municipalidad del Cantón Central de Puntarenas, or whoever holds that office, is ordered to comply with the health measures issued by the Ministerio de Salud, without prejudice to the possibility of challenging those administrative acts, as well as their legal and technical feasibility, through ordinary proceedings (vía ordinaria). The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an application for constitutional relief (recurso de amparo) that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Puntarenas are ordered to pay the costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). In all other respects, the application is denied. The Instituto Costarricense de Acueductos y Alcantarillados shall take note of the statements in Considerando VI of this judgment. Justice Salazar Alvarado files a separate note. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diez de enero de dos mil veinticinco .

Recurso de amparo que se tramita en expediente número 24-033317-0007-CO, interpuesto por Nombre03, cédula de identidad NFP01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, LA MUNICIPALIDAD DE PUNTARENAS Y EL MINISTERIO DE SALUD.

RESULTANDO:

  1. 1Por escrito recibido en la Sala el 26 de noviembre de 2024, la parte recurrente interpone recurso de amparo, indica: que vive en El Cocal de Puntarenas, en las casas conocidas como las del Seguro Social, en la Dirección03. Expone que, hace aproximadamente un mes, en su vivienda y en las de otros vecinos, comenzaron a ingresar aguas negras provenientes de la red interna de alcantarillado de la urbanización. Explica que esta situación se debe, aparentemente, a la falta de mantenimiento por parte de las autoridades competentes. Señala que dichas aguas, que deberían descargarse en unos tanques cercanos, circulan libremente debido al colapso u obstrucción del sistema de alcantarillado. Manifiesta que este hecho pone en peligro su vida y la de muchas personas del sector, incluidas mujeres niños y adultos mayores. Refiere que hace aproximadamente quince días acudió a la oficina del alcalde de Puntarenas para informar sobre la situación, pero el alcalde le argumentó que no dispone de la maquinaria, ni los recursos necesarios para solucionar el problema, sin importarle el riesgo que esto representa para la salud de los habitantes.Afirma que, debido a los malos olores y la contaminación producida por las aguas negras, ha sufrido problemas de salud, tales como dolores de estómago y fuertes dolores de cabeza. Además, destaca que, para protegerse de posibles infecciones y preservar su salud, se vio obligado a mudarse temporalmente a casa de familiares. El recurrente enfatiza que, pese a la gravedad del problema, las autoridades responsables, incluyendo el alcalde de Puntarenas, el presidente ejecutivo de Acueductos y Alcantarillados y el Ministerio de Salud, no han tomado acciones para remediarlo. Aduce que esta inacción no solo pone en peligro el derecho a la salud y la vida de los habitantes, sino que también genera una seria contaminación ambiental, violando así los artículos 21 y 50 de la Constitución Política. Solicita se ordene de manera inmediata al Ministerio de Salud, a Acueductos y Alcantarillados, y a la Municipalidad de Puntarenas adoptar las medidas necesarias para resolver el problema de las aguas negras que circulan por las viviendas. Solicita que se declare con lugar el recurso con las consecuencias de ley.
  2. 2Por resolución de las veinte horas cincuenta y cuatro minutos del veintinueve de noviembre de dos mil veinticuatro, el presidente de la Sala dio curso al amparo.
  3. 3Informan bajo juramento la Dra. Mary Denisse Munive Angermüller, vicepresidenta de la República y ministra de Salud, y la Dra. Carolina Lizeth Guillén Meléndez, directora a.i., del Área Rectora de Salud de Puntarenas–Chacarita: “INFORME DE LEY De conformidad con lo requerido en el presente Recurso de Amparo, se rinde el presente informe de ley con sustento en el Oficio N°MS-DRRSPC-DARSPC-0815-2024 del 04 de diciembre del 2024, evidenciando del mismo las actuaciones pertinentes por parte del Ministerio de Salud, a través del Área Rectora de Salud Puntarenas -Chacarita, misma perteneciente a la Dirección Regional de Rectoría de la Salud Pacífico Central, mencionando en lo que nos ocupa: “…PRIMERO En atención a denuncia sanitaria recibida en esta Área Rectora de Salud mediante boleta de recepción de documentos N°N°PC-AC-925-2024 relacionada con Acumulación de aguas residuales en cajas de registro de servidumbre que canaliza aguas residuales de viviendas ubicadas entre Dirección05, el 19 de setiembre del 2024 se realiza inspección en el sitio como consta en Acta de Inspección Ocular N°0315-Reg-2024 y fue posible comprobar anomalías sanitarias relacionadas con acumulación de aguas en cajas de registro de servidumbre y malos olores.SEGUNDO: Producto de la inspección realizada, el 04 de octubre del 2024 se notificó orden sanitaria 0112-REG-2024 al Sr. Randall Alexis Chavarría Matarrita en su cargo como Alcalde Municipal para que antes del 9 de octubre del 2024 sean tomadas medidas que aseguren el adecuado funcionamiento de servidumbre que canaliza aguas residuales de viviendas ubicadas entre Dirección03. TERCERO: Durante inspección de campo realizada el jueves 10 de octubre del 2024 no se observaron cambios en el sitio en comparación con la inspección realizada el 19 de setiembre del 2024. CUARTO: Después de finalizar el plazo otorgado para cumplir con la orden sanitaria 0112-REG-2024 no se recibió de forma física o digital informe por parte de la Municipalidad de Puntarenas, informando sobre las acciones que ejecutadas en cumplimiento con ordenamiento sanitario 0112-REG-2024. QUINTO: Ante el incumplimiento de la orden sanitaria 0112-REG-2024 por parte de la Municipalidad de Puntarenas, el 11 de octubre del 2024 se notificó informe sanitario MS-DRRSPC-DARSPC-0699-2024 que establece la multa por incumplimiento al Sr. Randall Alexis Chavarría Matarrita en su cargo como Alcalde Municipal según lo establecido en las medidas decretadas por las autoridades de salud conforme lo descrito en los artículos 378 y 378 bis de la Ley General de Salud N°5395.SEXTO: El 8 de noviembre del 2024 finalizó el plazo otorgado para cancelar la infracción correspondiente sin que se haya recibido respuesta por escrito a informe sanitario o entero a favor del Gobierno de la República. Por lo anterior se hizo remisión del expediente administrativo de este caso para dar inicio con el proceso de cobro administrativo correspondiente conforme lo establecido en el artículo 13 del Reglamento a la Ley N°9837 "Reforma Ley General de Salud" N°42293-S. SETIMO: El 4 de diciembre del 2024 se interpuso denuncia penal por el presunto Delito de Desobediencia a la Autoridad ante la Fiscalía Adjunta del Ministerio Público en Puntarenas, para que basados en el numeral 314 del Código Pena se ordene a la Municipalidad de Puntarenas responder a las acciones solicitadas por esta Área Rectora de Salud en cuanto a cumplimiento del ordenamiento sanitario N°0112-REG-2024 y cancelar la multa notificada mediante informe sanitario con oficio MS-DRRSPC-DARSPC-0699-2024…” Es por lo anteriormente expresado señores Magistrados, que esta representación de salud considera que no ha sido omisa en su actuar y se ha demostrado que se han venido realizando las gestiones oportunas para proteger los derechos de los vecinos del Cocal de Puntarenas en cuanto a la problemática de aguas residuales existente en dicha comunidad, notificando los actos administrativos correspondientes a los responsables de velar por el bienestar de la población en cuanto a temas de servidumbres, calles y avenidas cantonales se refiere, tal y como consta en el expediente administrativo que resguarda esta Área Rectora de Salud Puntarenas – Chacarita.Así las cosas, se desprende con total claridad que de manera efectiva y eficiente el Ministerio de Salud a través del Área Rectora de Salud Puntarenas – Chacarita y la Dirección Regional de Rectoría de la Salud Pacífico Central, hemos venido realizando una labor acorde a nuestras competencias y fundamental en cuanto al presente asunto, por lo que se adjunta la información necesaria para resolver lo solicitado por esta Honorable Sala Constitucional en apego al principio de legalidad instituido en el artículo 11 de la Constitución Política y el ordinal 11 de la Ley General de la Administración Pública”. Solicitan se declare sin lugar el recurso.
  4. 4Informa bajo juramento Emilio Corrales Fallas, encargado de la Oficina Cantonal de Puntarenas de la Región Pacífico Central de la Subgerencia de Gestión de Sistemas Periféricos del Instituto Costarricense de Acueductos y Alcantarillados: “Con fundamento en el informe N°GSP-RPC-2024-02610 de fecha 05 de diciembre del 2024, elaborado por la Ingra. Karla Ordoñez Sequeira directora de Recolección y Tratamiento de la Región Pacífico Central, el cual se adjunta como prueba y forma parte integral del expediente administrativo, queda demostrado que: En el sector del INVU, conocido como Barrio El Cocal ubicado en la provincia de Puntarenas, el AyA brinda únicamente el servicio de Agua Potable, el sistema de recolección de aguas residuales fue realizado por el INVU, como un sistema de Alcantarillado Condominal y el mismo fue recibido por la Municipalidad de Puntarenas, correspondiendo al Municipio su mantenimiento preventivo y correctivo.Ahora bien, este sistema de recolección de aguas residuales cuenta con una tubería interna que atraviesa los patios traseros de todas las propiedades, correspondiente a una servidumbre de paso cita de inscripción N°331-07008-01-0900-001 no obstante, el acceso de ingreso a la servidumbre de paso de la tubería de recolección se encuentra obstruido, por cuanto los habitantes han realizado diversas construcciones en la servidumbre, como tapias, bodegas, corredores y un taller entre otros, (Ver informe N°GSP-RPC-2024-02610). Por otra parte, a pesar de que el mantenimiento preventivo y correctivo del sistema del INVU Cocal, le corresponde a la Municipalidad de Puntarenas, el AyA, por medio de órdenes sanitarias generadas por el Ministerio de Salud se ha encargado de brindar mantenimiento en los tanques de recolección de aguas residuales del sector, empero, dicha labor se dificulta por cuanto no existe libre acceso en la servidumbre de paso de las aguas residuales dispuesta para este fin, debiendo ingresar los funcionarios del AyA por medio de propiedad privada para efectuar las desobstrucciones o en su defecto como puede observarse en la imagen inserta en el acápite anterior, los funcionarios exponen su integridad física, debiendo pasar por encima de tapias para realizar la desobstrucción de la tubería, por cuanto es imposible el ingreso por medio de la servidumbre debido a la existencia de edificaciones, se señala que corresponde a la Municipalidad de Puntarenas ejecutar las acciones legales pertinentes para mantener el libre acceso en la servidumbre.(Ver informe N°GSP-RPC-2024-02610). Se acota que, desde el año 2018 los vecinos del Cocal han interpuesto dos recursos de amparo con relación a los derrames de aguas residuales, lo cual esta Honorable Magistratura puede constatar en la resolución N°2018008599 del expediente N°18-006056-0007-CO y la resolución N°2019022487 del expediente 19-015715-0007-CO, en ambas resoluciones se ordena al Municipio a realizar las labores legales pertinentes para permitir el libre acceso en la servidumbre de paso y a ejecutar la limpieza y mantenimiento del tanque séptico, de igual manera gestionar la coordinación técnica con el AyA; para lo cual vale resaltar que la Institución ha participado en reuniones interinstitucionales con el MINSA y la Municipalidad de Puntarenas, con el fin de brindar la colaboración y/o asesoría que se requiera para la correcta ejecución del sistema de aguas residuales. (Ver informe N°GSP-RPC-2024-02610).Es menester indicarle a esta Sala Constitucional, que en respuesta a la Orden Sanitaria OS-0006-REG-2021 emitida por el MINSA en fecha 03 de febrero del 2021, se emite el oficio N°GSP-RPC-2021-00138, en donde se le recuerda al MINSA que el responsable del adecuado mantenimiento preventivo y correctivo del sistema de alcantarillado del Cocal es la Municipalidad de Puntarenas, adicionalmente se le informa que: …”NO se van a realizar más trabajos de desobstrucción en el sitio en el tanto no se cuente con un acceso adecuado y seguro al sistema de recolección, puesto que no es justificable poner en riesgo a los funcionarios que desempeñan labores de mantenimiento de redes debido a la falta de condiciones adecuadas en el ingreso al sitio…” (ver oficio N°GSP-RPC-2021-00138). II. NORMATIVA APLICABLE. En respaldo de lo anteriormente señalado, es menester indicar lo que al respecto establecen el Reglamento para la Prestación de los Servicios de AyA Publicado en el Diario Oficial La Gaceta N°27, Alcance N°29 del 9 de febrero de 2021 y la Ley General de la Administración Pública, artículos 11 y 13 inciso 1.“Artículo 14- De las condiciones para la prestación de los servicios. AyA prestará sus servicios una vez comprobada la factibilidad técnica en inmuebles construidos o por edificar, dedicados a la residencia de personas, para actividades comerciales o industriales que cumplan con los requisitos y usos autorizados en este reglamento. Los servicios de agua potable y de saneamiento los otorgará el AyA sobre calle o vía pública o sobre servidumbre de tubería y de paso inscrita a favor del AyA o inscrita a favor de terceros, según aplique de acuerdo con lo establecido en el artículo 16 de este reglamento. Lo anterior, siempre que existan redes del AyA en funcionamiento…” Ley General de la Administración Pública, artículos 11 y 13 incisos 1 “1. La Administración Pública actuará sometida al ordenamiento jurídico y sólo podrá realizar aquellos actos o prestar aquellos servicios públicos que autorice dicho ordenamiento, según la escala jerárquica de sus fuentes.“1. La Administración estará sujeta, en general, a todas las normas escritas y no escritas del ordenamiento administrativo, y al derecho privado supletorio del mismo, sin poder derogarlos ni desaplicarlos para casos concretos. En el presente caso, se constata que no se ha violentado ningún derecho Constitucional, ya que como ha quedado evidenciado en el informe técnico que forma parte integral del escrito que se presenta en este acto, el AyA ha realizado trabajos correctivos en la red de alcantarillado sanitario del INVU Cocal, a pesar de que el sistema fue recibido por la Municipalidad de Puntarenas, correspondiéndole a esta dar el mantenimiento preventivo y correctivo del sistema, así mismo se recalca que el sistema de alcantarillado sanitario del INVU Cocal está ubicado en propiedad privada, en donde el AyA no tiene competencia de ingreso, adicionalmente la servidumbre de paso dispuesta para el sistema de aguas residuales, tiene edificaciones que impiden el libre acceso, siendo obligación de la MUNICIPALIDAD DE PUNTARENAS, habilitar la servidumbre de paso por los medios legales pertinentes, no omito manifestar, el deber del Municipio de vigilar y fiscalizar tanto los tragantes de aguas pluviales como las cajas de registro y pozos de aguas residuales.El AyA de manera diligente, siempre ha colaborado en la atención y resolución de órdenes sanitarias generadas por el MINSA, específicamente en la ejecución de trabajos de desobstrucción del sistema de alcantarillado del Cocal, no obstante, hasta tanto la Municipalidad de Puntarenas no se ocupe en buscar alternativas para habilitar el acceso por medio de la servidumbre de paso dispuesta para el sistema de aguas residuales, la Institución se ve imposibilitada en cooperar con la resolución de órdenes sanitarias en el sistema de recolección del Cocal, ya que se justifica poner en riesgo a los funcionarios que desempeñan labores de mantenimiento de redes debido a la falta de condiciones adecuadas en el ingreso al sitio. Por ende, de conformidad con los hechos anteriormente expuestos, se demuestra que ninguna de las actuaciones de este Instituto ha sido antojadiza, arbitraria o infundada. Mi representada ha ejecutado y realizado todas las acciones que corresponden al ámbito de sus competencias y dentro del marco de legalidad que nos rige, por lo que se concluye que AyA cumplió con todas las obligaciones impuestas por imperio de ley, en el marco constitucional y legal conforme al principio de legalidad. Por consiguiente, no se ha violentado ninguno de los derechos fundamentales del recurrente”. Solicita se declare sin lugar el recurso.
  5. 5Informa bajo juramento Randall Alexis Chavarría Matarrita, alcalde de la Municipalidad del Cantón Central de Puntarenas: “se informa a su Autoridad, lo señalado por el Ing. Mauricio Gutiérrez Villafuerte, director de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas, mediante oficio MP-DDTU-OF-393-12-2024 de fecha 05 de diciembre de 2024; el cual indica lo siguiente: "la comunidad de El Cocal de Puntarenas, no cuenta con red de alcantarillado sanitario. Que el ente rector en materia de aguas sanitarias y pluviales de acuerdo a su ley constitutiva es el AyA. En Puntarenas existe una oficina Regional del AyA, ubicada en Barranca y nos hemos puesto a disposición muchas veces a efectos de colaborar para dar contención al problema que presenta las casas del seguro social, Dirección03. Indica además, el Ing. Gutiérrez Villafuerte, que dicho proyecto de vivienda fue promovido y construido por el Instituto de Vivienda y Urbanismo, el cual diseñó sistemas de tratamiento por medio de tanque séptico común, por ende, las aguas que descarga cada vivienda van a un tanque de captación general para todo el proyecto.Ahora bien, estas obras debieron ser entregadas al AyA, pero el INVU no lo hizo, causando ahora que AyA alegue no ser responsable de dar una solución, pese a que por ley le corresponde. En cuanto al problema de rebalse, según lo indica el mismo recurrente, se presenta en cada una y dentro de las viviendas --en sus patios-, señala el recurrente; y al respecto Índica el informe citado, que por parte de la Dirección de Desarrollo Territorial y Urbano, han realizado varias inspecciones, y han logrado determinar que la causa del problema es la falta de trampas de grasas para evitar las obstrucciones al sistema de tuberías. Para mayor abundamiento señala que, como es un único sistema de tuberías para todas las casas, si uno de ellos no realiza un mantenimiento y limpieza adecuados, aféela su vivienda y las da los otros, por cuanto el sistema se obstruye y rebalsa las aguas hacia adentro de ¡as casas.Por lo anterior, las tuberías a las que se hace referencia en el informe de cita, no se pueden limpiar desde afuera o por el frente de las propiedades, ya que las mismas se ubican en los patios de las viviendas, y ello ocasiona la imposibilidad para que el municipio pueda accionar, al tratarse de una propiedad privada. Indica además, que el único acceso al ramal de tubería que existía, fue cerrado por todos los vecinos, al construir unas tapias, y que al realizar consulta al Registro de la propiedad, se desprende que dicho acceso corresponde a una servidumbre de aguas propiedad del INVU; a la cual tampoco puede tener acceso el municipio. Finalmente y en lo que sí es competencia del municipio que represento, es en el mantenimiento y limpieza de los tanques de depósito comunales; la cual realiza el municipio todos los años, ya que los mismos se encuentran ubicados en un espacio destinado para dichos efectos, y al cual se puede tener acceso por la calle pública.Así las cosas, y de acuerdo con el informe técnico de referencia y que se aporta como prueba documental, la problemática denunciada es provocada por la falta de mantenimiento de la tubería de los mismos residentes del lugar, y no por fallos ocasionados o no atendidos por la Municipalidad de Puntarenas. Por todo lo anterior, no existe responsabilidad de mi representada, en la atención del problema planteado por el recurrente, y tampoco es posible tener acceso al sitio donde se origina la misma, ya que se trata del interior de las propiedades privadas de los vecinos de El Cocal de Puntarenas, específicamente en las casas conocidas como del Seguro Social Dirección03”. Solicita se declare sin lugar el recurso.
  6. 6Informa bajo juramento Juan Manuel Quesada Espinoza, presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados: “Con fundamento en el informe N°GSP-RPC-2024-02610, de fecha 05 de diciembre del 2024, elaborado por la Ingra. Karla Ordoñez Sequeira, directora de Recolección y Tratamiento de la Región Pacífico Central, el cual se adjunta como prueba y forma parte integral del expediente administrativo, queda demostrado que: En el sector del INVU, conocido como Barrio El Cocal, ubicado en la provincia de Puntarenas, el AyA brinda únicamente el servicio de Agua Potable. El sistema de recolección de aguas residuales fue realizado por el INVU, como un sistema de Alcantarillado Condominal y el mismo fue recibido por la Municipalidad de Puntarenas, correspondiendo al Municipio su mantenimiento preventivo y correctivo. Ahora bien, este sistema de recolección de aguas residuales cuenta con una tubería interna que atraviesa los patios traseros de todas las propiedades, correspondiente a una servidumbre de paso cita de inscripción N°331-07008-01-0900-001 no obstante, el acceso de ingreso a la servidumbre de paso de la tubería de recolección se encuentra obstruido, por cuanto los habitantes han realizado diversas construcciones en la servidumbre, como tapias, bodegas, corredores y un taller entre otros (Ver informe N°GSP-RPC-2024-02610).Por otra parte, a pesar de que el mantenimiento preventivo y correctivo del sistema del INVU Cocal le corresponde a la Municipalidad de Puntarenas, el AyA, por medio de órdenes sanitarias generadas por el Ministerio de Salud, se ha encargado de brindar mantenimiento en los tanques de recolección de aguas residuales del sector. Empero, dicha labor se dificulta por cuanto no existe libre acceso en la servidumbre de paso de las aguas residuales dispuesta para este fin, debiendo ingresar los funcionarios del AyA por medio de propiedad privada para efectuar las desobstrucciones o en su defecto como puede observarse en la imagen inserta en el acápite anterior, los funcionarios exponen su integridad física, debiendo pasar por encima de tapias para realizar la desobstrucción de la tubería, por cuanto es imposible el ingreso por medio de la servidumbre debido a la existencia de edificaciones, se señala que corresponde a la Municipalidad de Puntarenas ejecutar las acciones legales pertinentes para mantener el libre acceso en la servidumbre.(Ver informe N°GSP-RPC-2024-02610). Se acota que, desde el año 2018, los vecinos del Cocal han interpuesto dos recursos de amparo con relación a los derrames de aguas residuales, lo cual esta Honorable Magistratura puede constatar en la resolución N°2018008599 del expediente N°18-006056-0007-CO y la resolución N°2019022487 del expediente 19-015715-0007-CO, en ambas resoluciones se ordenó al Municipio a realizar las labores legales pertinentes para permitir el libre acceso en la servidumbre de paso y a ejecutar la limpieza y mantenimiento del tanque séptico, de igual manera gestionar la coordinación técnica con el AyA; para lo cual vale resaltar que este Instituto ha participado en reuniones interinstitucionales con el MINSA y la Municipalidad de Puntarenas, con el fin de brindar la colaboración y/o asesoría que se requiera para la correcta ejecución del sistema de aguas residuales (Ver informe N°GSP-RPC-2024-02610).Es menester indicarle a esta Sala Constitucional, que en respuesta a la Orden Sanitaria OS-0006-REG-2021 emitida por el MINSA en fecha 03 de febrero del 2021, se emite el oficio N°GSP-RPC-2021-00138, en donde se le recuerda al MINSA que el responsable del adecuado mantenimiento preventivo y correctivo del sistema de alcantarillado del Cocal es la Municipalidad de Puntarenas. Adicionalmente, se le informa que: “…NO se van a realizar más trabajos de desobstrucción en el sitio en el tanto no se cuente con un acceso adecuado y seguro al sistema de recolección, puesto que no es justificable poner en riesgo a los funcionarios que desempeñan labores de mantenimiento de redes debido a la falta de condiciones adecuadas en el ingreso al sitio…” (ver oficio N°GSP-RPC-2021-00138)”. Solicita se declare sin lugar el recurso.
  7. 7El 11 de diciembre del año en curso, el recurrente aporta escrito al expediente donde reitera los alegados del presente recurso de amparo.
  8. 8En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

El recurrente alega que, vive en El Cocal de Puntarenas, en las casas conocidas como las del Seguro Social, en la Dirección03. Expone que, hace aproximadamente un mes, en su vivienda y en las de otros vecinos, comenzaron a ingresar aguas negras provenientes de la red interna de alcantarillado de la urbanización. Explica que esta situación se debe, aparentemente, a la falta de mantenimiento por parte de las autoridades competentes. Señala que dichas aguas, deberían descargarse en unos tanques cercanos; sin embargo, circulan libremente debido al colapso u obstrucción del sistema de alcantarillado. Manifiesta que este hecho pone en peligro su vida y la de muchas personas del sector, incluidas mujeres niños y adultos mayores. Refiere que hace aproximadamente quince días el tutelado acudió a la oficina del alcalde de Puntarenas para informar sobre la situación, pero éste le argumentó que no dispone de la maquinaria, ni los recursos necesarios para solucionar el problema, sin importarle el riesgo que esto representa para la salud de los habitantes y genera contaminación ambiental.

Alega que, pese a la gravedad del problema, las autoridades responsables, no han tomado acciones para remediarlo. Solicita se ordene de manera inmediata al Ministerio de Salud, a Acueductos y Alcantarillados, y a la Municipalidad de Puntarenas adoptar las medidas necesarias para resolver el problema de las aguas negras que circulan por las viviendas.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

Ministerio de Salud a) El 17 de setiembre de 2024, en el Área Rectora de Salud de Puntarenas – Chacarita, se recibió denuncia anónima, mediante boleta de recepción de documentos PC-AC-925-2024 relacionada con acumulación de aguas residuales en cajas de registro de servidumbre que canaliza aguas residuales de viviendas ubicadas entre Dirección05. (informe rendido y prueba que consta en el expediente); b) El 19 de setiembre del 2024, se realiza inspección en el sitio y fue posible comprobar anomalías sanitarias relacionadas con acumulación de aguas en cajas de registro de servidumbre y malos olores. (informe rendido y prueba que consta en el expediente); c) El 04 de octubre del 2024, producto de la inspección realizada, se notificó orden sanitaria 0112-REG-2024 al Sr. Randall Alexis Chavarría Matarrita, alcalde Municipal, para que antes del 9 de octubre del 2024 sean tomadas las medidas que aseguren el adecuado funcionamiento de servidumbre que canaliza aguas residuales de viviendas ubicadas entre Dirección03.

(informe rendido y prueba que consta en el expediente); d) El 10 de octubre del 2024 durante inspección de campo realizada, no se observaron cambios en el sitio en comparación con la inspección realizada el 19 de setiembre del 2024. (informe rendido y prueba que consta en el expediente); e) Después de finalizar el plazo otorgado para cumplir con la orden sanitaria 0112-REG-2024 no se recibió de forma física o digital informe por parte de la Municipalidad de Puntarenas, informando sobre las acciones ejecutadas en cumplimiento de la orden 0112-REG-2024. (informe rendido); f) Ante el incumplimiento de la orden sanitaria 0112-REG-2024 por parte de la Municipalidad de Puntarenas, el 11 de octubre del 2024 se notificó informe sanitario MS-DRRSPC-DARSPC-0699-2024 que establece la multa por incumplimiento al Sr. Randall Alexis Chavarría Matarrita en su cargo como alcalde Municipal. (informe rendido); g) El 4 de diciembre del 2024, se interpuso denuncia penal contra la Municipalidad de Puntarenas, por el presunto Delito de Desobediencia a la autoridad ante la Fiscalía Adjunta del Ministerio Público en Puntarenas. (informe rendido).

Instituto Costarricense de Acueductos y Alcantarillados h) En el sector del INVU, conocido como Barrio El Cocal ubicado en la provincia de Puntarenas, el AyA brinda únicamente el servicio de agua potable. El sistema de recolección de aguas residuales fue realizado por el INVU, como un sistema de alcantarillado condominal y el mismo fue recibido por la Municipalidad de Puntarenas, correspondiendo al Municipio su mantenimiento preventivo y correctivo. (informe rendido); i) El sistema de recolección de aguas residuales cuenta con una tubería interna que atraviesa los patios traseros de todas las propiedades, correspondiente a una servidumbre de paso cita de inscripción N°331-07008-01-0900-001; no obstante, el acceso de ingreso a la servidumbre de paso de la tubería de recolección se encuentra obstruido, por cuanto los habitantes han realizado diversas construcciones en la servidumbre, como tapias, bodegas, corredores y un taller entre otros.

(informe rendido); j) Que a pesar de que el mantenimiento preventivo y correctivo del sistema del INVU Cocal, le corresponde a la Municipalidad de Puntarenas, el AyA, por medio de órdenes sanitarias generadas por el Ministerio de Salud se ha encargado de brindar mantenimiento en los tanques de recolección de aguas residuales del sector, empero, dicha labor se dificulta por cuanto no existe libre acceso en la servidumbre de paso de las aguas residuales dispuesta para este fin, debiendo ingresar los funcionarios del AyA por medio de propiedad privada para efectuar las desobstrucciones, se señala que corresponde a la Municipalidad de Puntarenas ejecutar las acciones legales pertinentes para mantener el libre acceso en la servidumbre.(informe rendido); k) Desde el año 2018 los vecinos del Cocal han interpuesto dos recursos de amparo con relación a los derrames de aguas residuales: la resolución N°2018008599 y la resolución N°2019022487, en ambas se ordena al Municipio realizar las labores legales pertinentes para permitir el libre acceso en la servidumbre de paso y a ejecutar la limpieza y mantenimiento del tanque séptico, de igual manera gestionar la coordinación técnica con el AyA.

Por lo que, la Institución ha participado en reuniones interinstitucionales con el MINSA y la Municipalidad de Puntarenas, con el fin de brindar la colaboración y/o asesoría que se requiera para la correcta ejecución del sistema de aguas residuales. (informe rendido).

Municipalidad del Cantón Central de Puntarenas l) Que según indica el director de Desarrollo Territorial y Urbano de la Municipalidad de Puntarenas, mediante oficio MP-DDTU-OF-393-12-2024 de fecha 05 de diciembre de 2024: la comunidad de El Cocal de Puntarenas no cuenta con red de alcantarillado sanitario. Que el ente rector en materia de aguas sanitarias y pluviales de acuerdo con su ley constitutiva es el AyA. En Puntarenas existe una oficina Regional del AyA, ubicada en Barranca y nos hemos puesto a disposición muchas veces a efectos de colaborar para dar contención al problema que presenta las casas del seguro social, Dirección03. (informe rendido); m) Que dicho proyecto de vivienda fue promovido y construido por el Instituto de Vivienda y Urbanismo, el cual diseñó sistemas de tratamiento por medio de tanque séptico común, por ende, las aguas que descarga cada vivienda van a un tanque de captación general para todo el proyecto.

(informe rendido); n) En cuanto al problema de rebalse. La Dirección de Desarrollo Territorial y Urbano, han realizado varias inspecciones, y han logrado determinar que la causa del problema es la falta de trampas de grasas para evitar las obstrucciones al sistema de tuberías. Para mayor abundamiento señala que, como es un único sistema de tuberías para todas las casas, si uno de ellos no realiza un mantenimiento y limpieza adecuados, afecta a su vivienda y las de los otros, por cuanto el sistema se obstruye y rebalsa las aguas hacia adentro de las casas. Por lo anterior, las tuberías a las que se hace referencia en el informe de cita, no se pueden limpiar desde afuera o por el frente de las propiedades, ya que las mismas se ubican en los patios de las viviendas, y ello ocasiona la imposibilidad para que el municipio pueda accionar, al tratarse de una propiedad privada. Indica, además, que el único acceso al ramal de tubería que existía fue cerrado por todos los vecinos, al construir unas tapias, y que, al realizar consulta al Registro de la Propiedad, se desprende que dicho acceso corresponde a una servidumbre de aguas propiedad del INVU; a la cual tampoco puede tener acceso el municipio. (informe rendido):

  • o)Que el mantenimiento y limpieza de los tanques de depósito comunales, el municipio lo realiza todos los años. (informe rendido).

III. ANTECEDENTES DEL RECURSO

Este Tribunal conoció en los recursos de amparo No. 18-006056-0007-CO y No. 19-015715-0007-CO, interpuestos por otros accionantes, sobre la situación que aquí se acusa, por la problemática de aguas negras provenientes de la red interna de alcantarillado de la urbanización en El Cocal de Puntarenas Así, en sentencia nro. 2019022487 de las 09:15 horas del 15 de noviembre de 2019, se dispuso:

“(…) III.- Sobre el fondo. En el sub lite, el recurrente, quien tiene 83 años, indica que en el sector del INVU del barrio El Cocal de Puntarenas existe un problema de contaminación, malos olores, salida de aguas negras tanto en baños como en patios y estancamiento de aguas negras y servidas. Explica que, entre los años 1950 y 1960, el INVU construyó 24 casas en el sector este del barrio El Cocal de Puntarenas con una servidumbre medianera de tubería para la evacuación de las aguas y cajas de registro espaciadas a lo largo para su limpieza. Manifiesta que las aguas entran al tanque por lo que el “lodo fecal” se va depositando y el resto del agua discurre por el lado norte hacia el estero. Arguye que en 1961 adquirió la casa n.º 19 y desde ese año es residente de la ciudadela. Menciona que por las tapas quebradas algunos vecinos introducían objetos, por lo que la tubería se tapaba y, además del rebalse de las aguas contaminadas en los patios, los baños no podían ser utilizados.

Refiere que cada inquilino fue cerrando su patio y, por tanto, obstruyendo la servidumbre. Sostiene que, pese a lo anterior, la servidumbre tiene validez, pues pasa por todos los patios y, aun cuando algunos vecinos han construido tanques sépticos, el agua de descarga de las lavadoras, baños y cocinas circula por la tubería. Relata que el ICAA no dispone de alcantarillado sanitario en las calles de la comunidad de El Cocal y la mayoría de las aguas de las construcciones son vertidas al estero. Asevera que el sistema de evacuación de aguas fue diseñado por el INVU; sin embargo, fue prácticamente un engaño para los dueños, quienes deben soportar las condiciones. Expone que en 2009 plantearon varias gestiones ante la Municipalidad de Puntarenas por una construcción en el patio de casa n.º 24 por parte de Nombre01; sin embargo, fue con ocasión de la intervención de la Defensoría de los Habitantes, que, mediante oficio n.º PUC-1647-2009 de 24 de agosto de 2009, se les dio una respuesta cuando la construcción ya estaba terminada.

Agrega que lo anterior impide la limpieza y eliminación de las obstrucciones de la tubería. Acota que, ante los constantes taponamientos y la renuencia municipal para brindar una solución, el 6 de febrero de 2017 (acta n.º 17) tuvo audiencia con el concejo municipal, lo cual generó la conformación de una comisión de regidores, para la que se invitó a personeros de las autoridades de salud, del ICAA, de la municipalidad y dos miembros de la comunidad. Refiere que la municipalidad se comprometió a limpiar el tanque séptico general; empero, no atendió el resto de la solicitud. Menciona que quedaron pendientes los siguientes puntos: “a) apertura de la entrada a la servidumbre, b) colocación de unos treinta metros de tubería de mayor diámetro, c) instalación de una válvula de Vaivén, para evitar el ingreso de las mareas al tanque general. d) Construcción de un portón en la entrada de la servidumbre, ampliar la caja de registro en la zona cercana del parquecito de niños, para efecto de las limpiezas futuras por parte del AyA e) colocar un portón al lado norte ingreso al parquecito para evitar el ingreso de vehículos particulares.

La instalación de solo 30 metros de tubería de concreto y no en los 150 metros de todo el recorrido, es porque en este tramo final es en donde se producen los taponamientos”. Expone que en algún momento hubo pacto entre personas del Ministerio de Salud, del ICAA y la Asociación de Desarrollo Integral de Cocal, para que cuando ocurriera un taponamiento de la tubería, los vecinos se comunicaran con las oficinas de salud (destacadas en Cocal), quienes solicitarían el servicio de las cuadrillas para la limpieza. Arguye que la limpieza se ha venido dando en su casa de habitación, pues otros vecinos no tienen voluntad para dar facilidades en sus casas, por la suciedad de “lodo fecal” que dejan los miembros de la cuadrilla. Reclama que en uno de los taponamientos y, pese a haberlo solicitado por escrito, la nueva jerarca del ICAA no autorizó a la cuadrilla a ingresar a zona privada. Afirma que no hay otro sitio para acceder a la servidumbre, ya que el ingreso a la servidumbre fue usurpado por la construcción del patio de la casa n.º 24.

Aduce que las instituciones del gobierno no han mostrado interés en solucionar el problema de salud y que los vecinos se han distanciado de la lucha, por lo que quedó solo con el problema. Manifiesta que las autoridades ni siquiera valoran sus propuestas de solución. Expone que la municipalidad tuvo que haber recibido de parte del INVU las calles, zonas verdes y servidumbres para su administración. Señala que el ICAA no tiene red sanitaria en El Cocal y no tiene interés en resolver el asunto. Relata que el Ministerio de Salud envía órdenes sanitarias a las autoridades públicas; sin embargo, estas no se cumplen. Pide un resarcimiento por daño moral, pues la Municipalidad de Puntarenas no atendió a tiempo la construcción de un taller y la usurpación del ingreso a la servidumbre de aguas negras, lo cual no se ha resuelto luego de diez años.

Del estudio de los autos se tiene por demostrado, que la Unidad Cantonal de Puntarenas del ICAA, por oficio n.º GSP-RPC-PU-2019-000648 de 5 de setiembre de 2019, señaló que en ese sector ya existió un recurso de amparo (n.°18-006056-0007-CO) y que el ICAA únicamente brinda el servicio de abastecimiento de agua potable. Indicó que en el sector existen sistemas de recolección sanitarios comunales y que el del INVU propiamente consiste en un sistema de alcantarillado condominal, en el cual las viviendas de un cuadrante específico cuentan con una tubería de alcantarillado sanitario ubicada internamente a lo largo de la servidumbre de paso de tubería, la cual se encuentra en los patios traseros de las viviendas y cruza todas las propiedades involucradas, por lo que fue obstruida por parte de los vecinos. Refirió que el alcantarillado nunca ha sido recibido por el ICAA; sin embargo, a solicitud del área rectora de salud, se han dado reuniones interinstitucionales en las que participan el Ministerio de Salud, la Municipalidad de Puntarenas y los vecinos.

Expuso que el Ministerio de Salud gira órdenes sanitarias al ICAA para que intervenga y solucione el problema de obstrucción. Adujo que aun cuando el ICAA no tenga injerencia en el sistema, se actúa por el principio de obediencia y para asegurar la salud pública. Aseveró que también, pese a que en el recurso de amparo n.°18-006056-0007-CO no se le estableció responsabilidad al ICAA se le ordenó dar colaboración a la Municipalidad de Puntarenas. Afirmó que, pese a lo ordenado por la Sala en el proceso anterior, la Municipalidad de Puntarenas únicamente construyó las tapas de los tanques de recolección de aguas, no ha realizado la limpieza ni tampoco ha tomado las acciones para corregir los problemas de invasión de terrenos en servidumbre de paso de tubería.

Por otra parte, la Sala comprobó que el Director del Desarrollo y Control Urbano de la Municipalidad de Puntarenas, por oficio n.º MP-DCU-483-09-2019 de 9 de setiembre de 2019, indicó: “(…) Al momento de la inspección de campo, en el lugar descrito, no se pudo determinó ningún tipo de contaminación con material fecal, ni malos olores, ni rebalse de aguas negras en el sector. Cabe destacar que la inspección se realizó en el sitio de convergencia de la tubería con el tanque séptico, según fotografía adjunta. En las inmediaciones no se detectó el problema denunciado. Lo que ocurra dentro de las viviendas, no pudo ser determinado por ser propiedades cuyo acceso es privado, al ser en su mayoría casas de habitación. En el sector todos los vecinos se apoderaron de la franja de terreno destinada a servidumbre de paso de tuberías de aguas negras y residuales. Dicha franja de terreno es propiedad del INVU, por lo que ni la Municipalidad ni el A y A, hemos podido intervenir para buscar la liberación de la misma.

De existir algún problema de obstrucción, el mismo ha sido provocado por alguno de los residentes, al apropiarse de forma indebida de la servidumbre. Se desconoce las razones de haber habilitado un diseño de urbanización incluyendo esa servidumbre de paso de aguas, ya que el mismo fue elaborado y aprobado por el INVU en el año 1960. Ni la Municipalidad ni el A y A, tienen acceso a la tubería ya que la servidumbre de aguas desde el inicio hasta el final se encuentra invadida por los vecinos, mediante tapias, agregados, techos, etc., por lo que desconocemos el estado de la tubería. En cuanto hemos recibido denuncias por parte de los vecinos acerca de alguna obstrucción, nos hemos apoyado del A y A, a fin de que su personal, ingresando dentro de la vivienda del afectado, realice labores de desobstrucción con la maquinaria y el personal; lo cual no es correcto y pone en riesgo al personal mismo; ya que existe el riesgo que por la operación de la maquinaria y equipo dentro de la vivienda se podrían causar daños que conllevarían a denuncias civiles; por lo que esta práctica se ha eliminado.

(…) Las acciones realizadas por la municipalidad para erradicar el problema fueron llevadas a cabo a principios del presente año, cuando un grupo de vecinos indicó que el problema de rebalse de aguas negras dentro de sus casas se suscitaba producto de que el tanque colector de las mismas, ubicado en el parque junto al caserío, se encontraba totalmente obstruido. Por tal razón, la municipalidad adquirió́ el compromiso de limpiarlo, y para ello realizó una contratación directa de una empresa encargada en la materia, para realizar la limpieza y reparación del tanque por un monto de un millón de colones, trabajos que fueron ejecutadas en el mes de febrero del presente año, pero al parecer el problema de rebalse persistió, al ser un daño en la tubería a la cual no tenemos acceso. (…) En cuanto a nuestras funciones, acerca de las afectaciones que aquejan al recurrente, no tenemos ninguna actividad pendiente por realizar; como bien se sabe, cada cierto tiempo se tiene que dar limpieza al tanque séptico; por lo que se estima que para este año no habrán más intervenciones, dado que lo limpiamos en febrero.

El tema del manejo y tratamiento de las aguas negras y servidas por ley le competen al A y A. Finalmente, mientras no se defina la situación jurídica en torno a la servidumbre de paso de las aguas, por parte del INVU y los vecinos, las intervenciones de limpieza de la tubería van a ser cada día más complicadas”.

En adición, este Tribunal observa que el Ministerio de Salud ha girado una gran cantidad de órdenes sanitarias tanto a la Municipalidad de Puntarenas como al ICAA; sin embargo, el problema persiste. La Gestora Ambiental del Proceso de Regulación de la Salud del Área Rectora de Salud Puntarenas-Chacarita, en el informe técnico n.º MS-DRRSPC-DARSPC-IT-037-2019 de 9 setiembre de 2019, luego de exponer todas las actuaciones de su representada, manifestó: “CONSIDERANDO (…) 80. En atención a indicación recibida en resolución N° 2018008599, del expediente N° 18-006056-0007-CO, con fecha 1 de junio del 2018 (…) 81. Según reunión llevada a cabo el 18/06/2018, en compañía con la Defensoría de los Habitantes y Municipalidad de Puntarenas y comunidad los Acuerdos tomados: - la Municipalidad realizará la limpieza de los tanques y la construcción de las tapas de los tanques y el portón del parquecito; además deberá acatar resolución N° 2018008599 de dar limpieza y mantenimiento a los tanques y gestionar la coordinación técnica con el Instituto Costarricense de Acueductos y Alcantarillados.

Una vez libre el paso a la servidumbre los vecinos podrán dar mantenimiento y no ha sido recibido por el A y A. la Defensoría recomienda que las acciones se resuelvan igual en caos (sic) similares analizados. 82. Según lo observado en Acta de Inspección Ocular N° 284-Reg-2018 con fecha del 18 de junio 2018, realizada en conjunto con la Municipalidad de Puntarenas, "se observa tres aberturas sin tapa que corresponde al sistema de aguas residuales, se percibe olores pestilentes. Ser observa vehículo estacionado dentro del parque y salida del garaje del SR. Nombre01. Existe una pared de concreto que une ambas viviendas de las alamedas, generando obstrucción a servidumbre. " 83. En reunión llevada a cabo el 24/07/2018, en compañía con la Defensoría de los Habitantes y Municipalidad de Puntarenas y comunidad; Entre lo mencionado y acuerdos tomados: Ing. Mauricio Gutiérrez sugiere la necesidad de pasar el sistema de manejo de aguas residuales a la administración de Instituto Costarricense de Acueductos y Alcantarillados. - la Municipalidad de Puntarenas deberá realizar estudio legal acerca de servidumbre de Dirección03. 84.

En reunión llevada a cabo el 27/07/2018, en compañía con la Defensoría de los Habitantes Instituto Costarricense de Acueductos y Alcantarillados, Municipalidad de Puntarenas y comunidad; Entre lo mencionado y acuerdos -la Municipalidad de Puntarenas deberá realizar estudio legal acerca de servidumbre de Dirección03 y organizar visitas en conjunto con el fin de tener una visión clara de la problemática. 85. Que según consta en Acta de Inspección Ocular N° 295-Reg-2018; En visita realizada el día 6 de agosto del 2018 se comprueban las tres cajas carecen de tapa y dos de ellas tienen restos de las antiguas tapas en su interior. Presentan acumulación de sedimentos, lodos y aguas, además se perciben malos olores. 86. Que según Orden Sanitaria N° OS-0180REG-2018 y Orden Sanitaria N° OS-0181-REG-2018 notificados el 12 de setiembre del 2018, al alcalde Municipal y al presidente del Concejo Municipal, respectivamente, en donde deberán proceder a cumplir con: 1.Coordinar lo necesario y girar las instrucciones pertinentes para que se proceda a la limpieza y mantenimiento de los tanques sépticos ubicados en la vía pública de Invu El Cocal; de ser necesario, deberá gestionar la coordinación técnica con el Instituto Costarricense de Acueductos y Alcantarillados; esto incluye la colocación de las respectivas tres tapas. 2.

Presentar un Plan de Acción, con su respectivo cronograma con plazos no mayor a un año y responsables, que incluya: 2.a) Adoptar las medidas oportunas a fin de corregir y evitar más obstáculos para el normal discurrir de las aguas, para que se elimine toda obstrucción o construcción encontrada en la servidumbre de paso, que permita una adecuada evacuación y flujo de las aguas residuales en la "red de alcantarillado sanitario " de modo que se evite un estancamiento y rebalse de aguas residuales, y con ello la afectación a la salud pública. 2.b) Velar porque se realicen actividades de limpieza con la regularidad necesaria; y de ser necesario, deberá gestionar la coordinación técnica con el Instituto Costarricense de Acueductos y Alcantarillados. " 87. En visita realizada el día 18 de setiembre del 2018, según consta en Acta de Inspección Ocular N° 349-Reg-2018: se comprueba que existe obstrucción del sistema de aguas residuales, los tres tanques no tienen tapa, hay sedimentación y no hay movimiento del agua. 88.

Que según Orden sanitaria 183-Reg-2018, notificada el 18/09/2018al señor Danilo Chavarría Velázquez, jefe cantonal del Instituto Costarricense de Acueductos y Alcantarillados, en la cual se indica que, en un plazo de 1 día hábil, tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de los patios de las viviendas. 2.- SOBRE LOS HECHOS POSTERIORES A LA DENUNCIA: 89. Se recibe la denuncia el día 24 de setiembre del 2018 según consta en Boleta de Recepción de Documentos N° PC-AC-1346-18 por parte del Sr. Nombre02, en la cual indica que persiste la problemática por obstrucción de las tuberías de aguas negras; la cuadrilla de del Instituto Costarricense de Acueductos y Alcantarillados estuvo la semana pasada y no lograron destapar la obstrucción en su totalidad. 90. Que el 01 de octubre del 2018 se realizan visitas en varias viviendas y la vía pública de la Urbanización el Invu.

El Cocal según consta en Acta de Inspección Ocular N° 373-Reg-2018 y N° 375-Reg-2018, donde se comprueba sedimentación en los tres tanques sin tapa ubicados en "parquecito y que el cenicero ubicado en la servidumbre de paso de aguas residuales se encuentra lleno de aguas residuales debido a reiterada obstrucción. Se realizan pruebas con fluoresceína sódica y no se comprueba contaminación. 91. Que el 2 de octubre del 2018 según consta en Acta de Inspección Ocular N° 378-Reg- 2017, se realizan visitas en varias viviendas y la vía pública, donde se comprueba sedimentación en los tres tanques sin tapa ubicados en "parquecito", y que el cenicero ubicado en la servidumbre de paso de aguas residuales se encuentra lleno de aguas residuales debido a reiterada obstrucción. Se realizan pruebas con fluoresceína sódica y no se comprueba contaminación. 92. Según Orden Sanitaria N° OS-187-REG-2018, notificada al Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados y la Orden Sanitaria N° OS-189-REG-2018, notificada al alcalde de la Municipalidad de Puntarenas, que fueron notificadas el 3 de octubre del 2018, con plazo de 24 horas, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública y dentro de patios de las viviendas. 93.

Según consta en Acta de Inspección Ocular N° 383-Reg-2018, del 4 de octubre del 2018. se realiza visita de seguimiento para verificar el cumplimiento de la Ordenes Sanitarias, al momento de la visita, se logra comprobar que no se han realizado actos por parte de la Municipalidad de Puntarenas ni el Instituto Costarricense de Acueductos y Alcantarillados, ya que la problemática continúa por obstrucción del sistema para disposición de las aguas residuales. 94. Que mediante oficios N° PC-ARS-PC-442-2018 y PC-ARS-PC-443-2018, notificados el 4 de octubre del 2018, se presentan formales denuncias judiciales por desobediencia a la autoridad por parte del Instituto Costarricense de Acueductos y Alcantarillados y de la Municipalidad de Puntarenas. 95. Según consta en Acta de Inspección Ocular N° 385-Reg-2018, de día 05 de octubre del 2018 se realiza nueva visita. Se logra comprobar que existe sedimentación y agua de lluvia en los tres tanques sin tapa ubicados en "parquecito" y que la problemática continúa por obstrucción del sistema para disposición de las aguas residuales, ya que a pesar de que funcionarios del Instituto Costarricense de Acueductos y Alcantarillados se apersonaron recientemente, no se realizaron las acciones requeridas. 96.

Según consta en Acta de Inspección Ocular N° 386-Reg-2018, del día 05 de octubre del 2018 se logra comprobar que la caja de registro del Sr Nombre02 se encuentra colapsada. Pero no se ha rebalsado debido al muro que tiene los tanques principales (tres cajas de registro) se encuentran llanos de agua, no hay malos olores. Que funcionarios del Instituto Costarricense de Acueductos y Alcantarillados se apersonaron recientemente, no se realizaron las accione (sic) solicitadas. 97. Que mediante oficio N° GSP-RPC-PU-201 8-00654, recibido el 11 de octubre, por parte del Instituto Costarricense de Acueductos y Alcantarillados, se informa sobre la atención al Orden sanitaria 183-Reg-2018. 98. Según consta en Acta de Inspección Ocular N° 512-Reg-2018, del día 11 de octubre del 201 8 se logra comprobar que la caja de registro del Sr. Nombre02 se encuentra obstruida pero no se ha rebalsado debido al muro que tiene a su alrededor. 99.

Según consta en Acta de Inspección Ocular N° 514-Reg2018, del día 22 de octubre del 2018 se logra comprobar el incumplimiento de las Orden Sanitaria N° OS-0180-REG-2018 y Orden Sanitaria N° OS-0181-REG-2018. 100. Se recibe la denuncia el día 5 de noviembre del 201 8, según consta en Boleta de Recepción de Documentos N° PCAC-1 560-18, por parte del Sr. Nombre02, en la cual indica que nuevamente se presentó la problemática por obstrucción de las tuberías de aguas negras. 101. Según consta en Acta de Inspección Ocular N° 430-Reg-2018, del día 7 de noviembre del 2018 se logra comprobar que la caja de registro del Sr Nombre02 se encuentra obstruida. Pero no se ha rebalsado debido al muro que tiene a su alrededor Los tres tanques en el parquecito continúan sin tapa, se perciben olores putrefactos y está próximo a rebalsarse. 102. Según Orden Sanitaria N° OS-208-REG-2018 notificada al Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados y la Orden Sanitaria N° OS-209-REG-2018, notificada al Alcalde de la Municipalidad de Puntarenas, que fueron notificadas el 9 de noviembre del 2018 con plazo de 24 horas, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de patios de las viviendas. 103.

Según consta en Acta de Inspección Ocular N° 521-Reg-2018, del 12 de noviembre del 2018, se realiza visita de seguimiento para verificar el cumplimiento de la (sic) Ordenes (sic) Sanitarias. Al momento de la visita, se logra comprobar que no se han realizado actos por parte de la Municipalidad de Puntarenas ni el Instituto Costarricense de Acueductos y Alcantarillados, ya que la problemática continúa por obstrucción del sistema para disposición de las aguas residuales. 104. Según consta en Acta de Inspección Ocular N° 522-Reg-2018, del 13 de noviembre del 2018, se realiza visita de seguimiento para verificar el cumplimiento de la (sic) Ordenes (sic) Sanitarias OS- 208-REG-2018 y Nº -209-REG-2018, se comprueba las mejoras realizadas por parte del Instituto Costarricense de Acueductos y Alcantarillados. 105. Según consta en Acta de Inspección Ocular N° 523-Reg-2018, del 13 de noviembre del 2018 se logra comprobar el Incumplimiento de las Orden (sic) Sanitaria N° OS-0180-REG-2018 y Orden Sanitaria N° OS-0181-REG-2018. 106.

Que mediante oficio N° PC-ARS-PC-516-2018 con fecha del 13 de noviembre 2018 dirigido a la Municipalidad de Puntarenas según con referencia al problema de rebalse de aguas residuales en los patios de las viviendas, producto de la continua obstrucción que genera el colapso del alcantarillado sanitario en la Dirección03, el INVU Cocal Puntarenas, se solicita su atención al oficio PC-ARS-PC-0325-2018 y el Ordenamiento Sanitario N° OS-0180-REG-2018. 107 Se recibe la nota el día 20 de diciembre del 2018, según consta en Boleta de Recepción de Documentos N° PC-AC-1776-18, por parte del Sr. Nombre02, en la cual indica que hay presencia de maquinaria trabajando en tanque séptico general y solicita funcionario a inspeccionar. 108. Según consta en Acta de Inspección Ocular N° 526-Reg-2018, del 20 de diciembre del 2018, se realiza visita de, encontrándose trabajos realizados en este momento en el parquecito del Invu Cocal, en respuesta a oficios y ordenamientos sanitarios que solicitan acción por parte de la Municipalidad de Puntarenas, es urgente que se realicen acciones para prevenir la contaminación al ambiente y riesgo a la salud pública, por los trabajos realizados con lodos del tanque de aguas residuales dispuestos en un parquecito en el INVU, barrio el Cocal de Puntarenas, y se acaten la normativa (Articulo 24.- Del vertido de lodos.

Se prohíbe el vertido de cualquier tipo de lodos y biosólidos a cuerpos de agua y de lodos sin tratamiento a los suelos), además de corregirlo relacionada con el transporte y disposición final, para que se utilicen vehículos óptimos. Igualmente que se tomen las medidas de salud ocupacional para que no se incurra en riesgos a la salud de los trabajadores. 109. Según consta en Acta de Inspección Ocular N° 527-Reg-2018, del 21 de diciembre del 2018, se realiza visita de seguimiento a los trabajos realizados, sin variación en la manera que la maquinaria y trabajadores realizan los mismos. 110. Según consta en Acta de Inspección Ocular N° 001-Reg-2019 del 9 de enero del 2019, se realiza visita encontrándose trabajos realizados en este momento en el parquecito del Invu Cocal. Además, se logra comprobar que la caja de registro del Sr. Nombre02 se encuentra colapsada, pero no se ha rebalsado debido al muro que tiene.111.

Según Orden Sanitaria N° OS-001-REG-2019, notificada al Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados y la Orden Sanitaria N° OS-002-REG-2019, notificada a la Alcaldesa de la Municipalidad de Puntarenas que fueron notificadas el 8 de enero del 2019, con plazo de 3 días hábiles, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de patios de las viviendas. 112. Según consta en Acta de Inspección Ocular N° 042-Reg-2019, del 11 de enero del 2019, se realiza visita de seguimiento para verificar el cumplimiento de la Ordenes (sic) Sanitarias, se comprueba las mejoras realizadas por parte del Instituto Costarricense de Acueductos y Alcantarillados. Además, los trabajos realizados en este momento en el parquecito del Invu Cocal por parte de la Municipalidad de Puntarenas y contratación externa; con algunas anomalías. 113.

Que mediante oficio N° GSPRPC-PU-2019-0018, recibido el 14 de enero del 2019, por parte del Instituto Costarricense de Acueductos y Alcantarillados, se informa sobre la atención al Orden sanitaria 001-Reg-2019. 114. Se recibe la nota el día 22 de abril del 2019, según consta en Boleta de Recepción de Documentos N° PC-AC-056219, por parte del Sr. Nombre02 en la cual indica que hay obstrucción de las tuberías de aguas negras. 115. Según consta en Acta de Inspección Ocular N° 086-Reg-2019, del 26 de abril del 2019, se realiza se logra comprobar que la caja de registro del Sr. Nombre02 se encuentra colapsada, pero no se ha rebalsado debido al muro que tiene. Se observa humedad alrededor de los tanques recientemente reparados. 16. Según Orden Sanitaria N° OS-041-REG-2019, notificada a Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados y la Orden Sanitaria N°OS-042-REG-2019 notificada a la Alcaldesa de la Municipalidad de Puntarenas, que fueron notificadas el 29 de abril del 2019, con plazo de 5 días hábiles, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de patios de las viviendas. 117.

Que el 30 de abril 2019, se recibe Recurso de Revocatoria por parte de la Municipalidad de Puntarenas, contra N°OS-042-REG-2019, la cual es atendida por medio del oficio MS-DRRSPCDARSPC- 0176-2019. 118. Se recibe la nota el día 5 de agosto del 2019, según consta en Boleta de Recepción de Documentos N° PC-AC-1 096-19, por parte del Sr. Nombre02, en la cual en la cual indica que hay obstrucción de las tuberías de aguas negras en su comunidad. 119. Según consta en Acta de Inspección Ocular N° 289-Reg-2019 y N° 290-Reg-2019, del 13 de agosto del 2019, se realiza, se logra comprobar que la caja de registro del Sr. Nombre02 se encuentra colapsada, pero no se ha rebalsado debido al muro que tiene. Además de que ya no existe macetera encima de la servidumbre. 120. Mediante Orden Sanitaria N° OS-1 13-REG-2019, notificada a Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados el 13 de agosto del 2019, con plazo de 5 días hábiles, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de patios de las viviendas. 121.

Que mediante oficio N° GSP-RPCPU-2019-00594, recibido el 21 de agosto del 2019, por parte del Instituto Costarricense de Acueductos y Alcantarillados, se informa sobre la atención al (sic) Orden sanitaria 01 13-Reg-2019. 122. Que a través de los últimos cinco años se han atendido múltiples denuncias interpuestas por los vecinos del sector del Cocal en Puntarenas con referencia al problema de rebalse de aguas residuales producto del colapso del alcantarillado sanitario, se han brindado soluciones temporales, ya que dicho sistema de alcantarillado sanitario se obstruye y colapsa periódicamente. 123. Que mediante inspecciones oculares se hace constancia de que, entre los dos sectores de viviendas existe una servidumbre, por la cual pasa la tubería que conduce las aguas residuales que se generan en estas viviendas. Asimismo, que la entrada norte de esta servidumbre se le ha cerrado el paso con pared de concreto, existen muros divisorios entre cada propiedad y existen modificaciones en algunos de los ceniceros, estas modificaciones constructivas no fueron avaladas por este Ministerio. 124.

Que según lo indicado por diferentes denunciantes el proyecto habitacional fue construido por desarrolladora INVU, posee un sistema de tratamiento para las aguas residuales que consta de cajas de registro para cada vivienda, una tubería que conduce las aguas residuales (grises negras y posiblemente algunas aguas pluviales), hacia tres tanques de sedimentación, que, por medio de tubería de diámetro desconocido, dispone el afluente al estero. 125. Que no hay constancia en archivo físico ni digital del Área Rectora de algún documento que informe sobre el desfogue del sistema de recolección de aguas residuales en el cuerpo receptor estero ni se cuenta con un croquis o plano del sistema para disponer las aguas residuales, el tanque séptico o el drenaje. 126. Según lo observado por este Ministerio hay tres tanques de sedimentación ubicados en una zona pública donde hay un área de juegos para niños y no se observa portón; se verifica que ya se les colocó tapa de cemento en estos tanques.

Y se desconoce si dicho sistema no reúne las características y condiciones de un sistema funcional y efectivo en el tratamiento y disposición final de aguas residuales, lo que podría ocasionar grave contaminación ambiental, situando en riesgo la salud pública y esto afectaría el equilibrio de los ecosistemas, aunado a los factores socio económicos de la zona”. Asimismo, la Gestora Ambiental del Proceso de Regulación de la Salud del Área Rectora de Salud Puntarenas-Chacarita, por informe técnico n.º MS-DRRSPC DARSPC-IT-043-2019 de 24 de setiembre de 2019, refirió lo siguiente: “CONSIDERANDO 1. Que desde el año 2013, el Área Rectora de Salud Puntarenas - Chacarita, ha venido gestionando acciones puntuales en conjunto con el Instituto Costarricense de Acueductos y Alcantarillados y Municipalidad de Puntarenas, en colaboración con vecinos afectados, desde el incremento en las denuncias sobre los problemas de obstrucción y rebalse de aguas en la “Red de aguas Residuales” del INVU Cocal.

Esto se evidencia con mayor detalle en Informe Técnico N° MS-DRRSPC-DARSPC-IT-037-2019, el cual informa acerca de lo realizado por gestora ambiental Bach. Brook Vega Davies, del Proceso de Regulación de la Salud de esta Área Rectora de Salud, en respuesta al Recurso de Amparo presentado el 2 de setiembre ante la Sala Constitucional de la Corte Suprema de Justicia, según Expediente N° 19-015715-0007-CO. 2. Se recibe la nota el día 18 de setiembre del 2019, según consta en Boleta de Recepción de Documentos N° PC-AC-1317-19, por parte del Sr. Nombre02, en la cual en la cual indica que hay obstrucción de las tuberías de aguas negras en su comunidad. 3. Según consta en Acta de Inspección Ocular N° 416-Reg-2019, del 19 de setiembre del 2019; se ingresa en su propiedad con su autorización para verificar los hechos denunciados, ante obstrucción del sistema de drenaje compartido, entre varias viviendas, lo cual provoca aumento del nivel del agua en caja de registro.

Las aguas son contenidas por muro y tapa a su alrededor, ser observan aguas residuales en nivel cercano a rebalsarse. 4. Según consta en Acta de Inspección Ocular N° 419-Reg-2019, del 19 de setiembre del 2019; en seguimiento de OS-0180-Reg-2018, OS-0181-Reg-2018 y oficio PC-ARS-PC-516-2018; se observan tres tanques con tapa de cemento, con algunas grietas, no se observa humedad alrededor de estos y se perciben malos olores provenientes de tanques y el alcantarillado pluvial. Se observa un vehículo estacionado dentro del parquecito, con placa PLA01, el cual ser encuentra contiguo a una puerta metálica color negro, esto corresponde a la pared construida que obstruye la servidumbre de paso, en su sector norte, contiguo al parque para niños. 5. Mediante Orden Sanitaria N° OS-167-REG-2019, notificada a Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados el 19 de setiembre del 2019, con plazo de 5 días hábiles, se solicita tomar las medidas necesarias para evitar el rebalse de aguas negras en caja de registro ubicada en vía pública (servidumbre) y dentro de patios de las viviendas. 6.

Que ante constantes denuncias recibidas en este Ministerio, se puede evidenciar que la problemática ha venido en aumento y que no ha disminuido desde que se realizó la limpieza del los tres tanques ubicados en parque entre Dirección05, esto por parte de la Municipalidad. Se desconoce si hay influencia por las llenas de las mareas que podría generar afectación en el sistema de aguas residuales, el cual desfoga en el estero de Puntarenas”.

Atinente al sub examine, la Sala, mediante sentencia n.º 2018-008599 de las 9:15 horas del 1º de junio de 2018, resolvió:

“Considerando:

(…)

IV.Sobre el fondo. En el caso particular, son dos los temas que plantea el tutelado, vecino del Barrio EL Invu del Cocal de Puntarenas, ante las autoridades recurridas. Por un lado el problema con la falta de limpieza los tanques de captación de aguas negras y por otro, el problema de falta de mantenimiento del alcantarillado del desarrollo habitacional en que habita. Cada uno de ellos se analiza por separado. 1) Sobre la falta de limpieza los tanques de captación de aguas negras: De los informes rendidos por los representantes de las autoridades recurridas -que se tienen por dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción-, y la prueba aportada para la resolución del presente asunto, se constata por un lado que el desarrollo habitacional donde está el tanque séptico en la rotonda y vía pública del INVU del Cocal de Puntarenas, en cuestión, fue realizado por el INVU incluyendo el sistema de recolección, que no es administrado por el AyA.

Sobre el problema de falta de mantenimiento de los tanques de captación de aguas negras, las autoridades recurridas son contestes en sus respectivos informes al indicar que la situación es real pero la limpieza de los tanques es una obligación que deben asumir los propietarios. Sobre el particular, el Alcalde Municipal omite referirse directamente a la situación planteada por el recurrente y hace énfasis en que esa corporación municipal no cuenta con la atribución directa ni tiene el equipo para realizar una tarea de limpieza de tanques; labor que corresponde, según afirma el Alcalde informante, a los vecinos. Así las cosas, en cuanto el recurso se dirige contra la Municipalidad recurrida esta Sala determina que pese al dicho del Alcalde según el cual la tarea de limpiar los tanques de captación indicados debe ser asumida por los particulares; lo cierto del caso es que conoce de la problemática que afecta a los habitantes de esa zona, y es su deber disponer lo necesario para conminar a los responsables a dar una solución al problema que se conoce desde el año 2015, no obstante se limita a señalar la problemática sin hacer nada al respecto.

En el mismo sentido, del informe dado a esta Sala por parte del Área Rectora del Ministerio de Salud esta admite que existe un problema sanitario subsiste, pues admite que la tapa contiene grietas que permiten la salida de malos olores. Pero, no observa la Sala que el Ministerio haya adoptado medidas efectivas para evitar el problema de salud pública que supone el mal estado de la tapa del tanque, que no solo no está sellada sino tiene grietas. La prestación de un servicio público como el que está en manos del Ministerio de Salud exige una eficiencia y diligencias acaso más allá de la necesaria en por parte de otros órganos públicos, por causa de los derechos fundamentales a la salud y al ambiente sano, en lo que atañe a sus competencias. Con base en lo expuesto, la Sala considera que la inactividad de la Municipalidad de Puntarenas y del Ministerio de Salud, en este caso es violatoria del derecho fundamental a la salud y a un ambiente sano del amparado, por lo que procede estimar el recurso en su contra y ordenar que se disponga las medidas necesarias, incluso radicales, y adopte las decisiones pertinentes a fin de eliminar el problema sanitario que puede surgir del mal estado en que se encuentra y la falta de mantenimiento del tanque de captación de aguas negras. 2) Sobre la falta de mantenimiento del alcantarillado del desarrollo habitacional.

De los hechos que se tienen por debidamente demostrados en este asunto, y en particular del informe del representante del AyA se desprende que, el sistema de recolección de aguas al que se refiere el recurrente, requiere de mantenimiento preventivo y es necesaria la intervención del ente administrador del sistema, pues en el lugar se ha tolerado la invasión de terrenos en servidumbre de paso de tubería, lo que ha impedido el acceso para realizar los trabajos de mantenimiento preventivo y correctivo de la red de recolección. De lo expuesto, y particularmente de lo que indica en su informe el representante del AyA ante esta Sala, se desprende que la falta de seguimiento de obras por doquier en la zona afectada, aún sobre el área donde pasa la tubería, ha traído como consecuencia que se den fugas y dificultades para dar mantenimiento a las alcantarillas y sistema de recolección de aguas. Además queda claro que faltan tapas que no han sido reparadas y la carencia de mantenimiento que caracteriza la red de colección de aguas del proyecto habitacional donde reside el recurrente; lleva a concluir que la Municipalidad del Cantón Central de Puntarenas no ha coordinado y cuanto menos realizado las acciones necesarias tendientes a corregir y a evitar que se agrave la situación de la red de recolección de aguas, con el fin de garantizar el buen funcionamiento del sistema.

Tal pasividad también caracteriza la poca injerencia del Área de Salud recurrida en esta zona, inercia que ha incidido negativamente en la comunidad, pues en ocasiones ha provocado el rebalse de captación y ha limitado el paso de peatones y vehículos. Ahora bien, en cuanto a la probable solución a los problemas de disposición de aguas residuales, del informe pedido por esta Sala al AyA se tiene que tal obligación recae en el desarrollador del proyecto. No obstante, en principio las obras no deberían ser asumidas por la Administración, se constata que ni la Municipalidad recurrida ni el Ministerio de Salud, ante quienes se planteó la respectiva denuncia, han dispuesto lo que les corresponde, dentro de sus atribuciones, para coordinar o emitir las órdenes sanitarias, según corresponde, dirigidas a corregir el problema. Al contrario, lejos de exigir una posición correctiva, -en el lugar se ha tolerado la construcción sobre la servidumbre donde pasa la tubería (véase el informe del AyA).

Cuanto menos se ha adoptado una actitud preventiva, pese a que tanto la Municipalidad como el Área de Salud recurridos, admiten que existe el problema de disposición de aguas que pone en riesgo la salud pública y que es conocido desde hace varios años. De lo expuesto, se denota la falta de coordinación de parte de las autoridades recurridas, para dar una solución integral al problema. Por su parte, el representante del Ministerio de Salud intenta justificar su inercia en el informe rendido ante esta Sala, al indicar que en este momento no hay una situación de desbordamiento de aguas. Así las cosas, a criterio de este Tribunal, la actitud pasiva del Área de Salud, que espera el desbordamiento de las aguas para actuar es a todas luces insuficiente, pues el plan es esperar a que se dé una situación límite para procurar dar una solución; en vez de implementar el mantenimiento preventivo y correctivo de la red de recolección de aguas, que se sabe afecta a los habitantes del lugar, de una buena vez. Como consecuencia procede acoger el recurso, en cuanto se dirige contra la Municipalidad y el Área de Salud de Puntarenas, como en efecto se dispone. (…)

VII. DEL AMPARO CONTRA EL AYA

Por último, procede desestimar el amparo contra el Instituto Costarricense de Acueductos y Alcantarillados, por cuanto del informe rendido se desprende que en el lugar donde habita el tutelado, lo que existe es un sistema de recolección privada de aguas residuales, ya que en el sector del Cocal, el AyA únicamente da el servicio de agua potable. Así, el problema sanitario está generado por un sistema de manejo de aguas residuales que no ha sido recibido por esa institución. Por otro lado, las veces que por mandato del Ministerio de Salud -mediante órdenes sanitarias-, ha pedido la intervención de la institución para la resolución del problema, ya que media la salud pública, el AyA ha acatado lo ordenado. Como consecuencia se desestima el recurso, en cuanto a este extremo, lo que en efecto se dispone.

VIII. CONCLUSIÓN

En el caso particular, se comprueban los problemas del alcantarillado en la rotonda y en la vía pública del INVU del Cocal de Puntarenas, que provocan estancamiento y desbordamiento de las aguas, situación que es conocida por el Área Rectora de Salud y la Municipalidad de Puntarenas. No obstante, pese a la denuncia planteada, tales autoridades han omitido encontrar una solución, bajo la excusa de que corresponde a los particulares o al desarrollador el mantenimiento de la red de agua, así como limpiar los tanques sépticos. A lo anterior se suma que no existe a la fecha ninguna orden vigente dirigida por las autoridades de la Municipalidad de Puntarenas recurrida, a los propietarios o/y al encargado del proyecto habitacional, para que den el debido mantenimiento a la red de recolección de aguas, ni procedan a la limpieza del tanque séptico, pese a que tiene fisuras y partes rotas. Tampoco consta que se haya girado órdenes sanitarias por parte del Ministerio de Salud, que es el responsable de velar por su obligatorio cumplimiento tal y como le compete según lo determina la Ley General de Salud, que establece el deber ineludible de parte del Ministerio de Salud de atender en forma directa o bien obligar al desarrollador a corregir de forma inmediata el problema que se está ocasionando por la incorrecta disposición de las aguas residuales, situación que está generando el problema de salud que afecta a los amparados y que tiene a agravarse en época de lluvias.

Así las cosas, en aplicación del principio preventivo que opera en materia ambiental, procede ordenar a la Municipalidad de Puntarenas y al Área Rectora de Salud de Puntarenas - Chacarita de la Región Pacifico Central del Ministerio de Salud coordinar lo necesario dentro del ámbito de sus atribuciones, y darle seguimiento a la situación, conforme se indica en la parte dispositiva de esta resolución. Asimismo, deberán resolver y contestar la denuncia planteada por el recurrente desde diciembre de 2017, en el plazo que se indica en la parte dispositiva de esta resolución. (…)

Por tanto:

Se declara CON LUGAR el recurso. Se ordena a Randall Chavarría Matarrita en su condición de Alcalde Municipal del Cantón Central de Puntarenas y o a quien en su lugar ocupe dicho cargo, coordinar lo necesario y girar las instrucciones pertinentes para que en el plazo máximo de un mes contado a partir de la notificación de esta sentencia, se proceda a la limpieza y mantenimiento del tanque séptico que se encuentra ubicado en la rotonda y en la vía pública del INVU del Cocal de Puntarenas señalado por el tutelado; y en el plazo de un año contado a partir de la notificación de esta sentencia, adoptar las medidas oportunas a fin corregir y evitar más obstáculos para el discurrir de las aguas. En ese mismo plazo, deberá velar porque se realice tal actividad de limpieza con la regularidad necesaria; y, de ser necesario, deberá gestionar la coordinación técnica con el Instituto Costarricense de Acueductos y Alcantarillados. En aplicación del principio preventivo, se ordena a Ericka Jiménez Valverde en su calidad de Directora del Área Rectora de Salud de Puntarenas -Chacarita de la Región Pacifico Central del Ministerio de Salud o a quien en su lugar ocupe el cargo, girar las órdenes sanitarias que considere, para el buen funcionamiento del sistema de alcantarillado sanitario, así como del tanque séptico indicado”.

Desde este panorama, procede acoger parcialmente con lugar el recurso contra el Ministerio de Salud y la Municipalidad de Puntarenas.

Sobre el particular, el recurrente hizo referencia a una problemática que ya había sido conocida en esta jurisdicción en virtud de un recurso de amparo que planteó otra persona. Este Tribunal en la sentencia parcialmente transcrita ordenó a la Municipalidad de Puntarenas coordinar lo necesario y girar las instrucciones pertinentes para que no solo se procediera con la limpieza y mantenimiento del tanque séptico, sino también que se adoptaran las medidas oportunas a fin corregir y evitar más obstáculos para el discurrir de las aguas; además, que debería velar por que se realizara la limpieza con la regularidad necesaria y, de ser necesario, gestionar la coordinación técnica con el ICAA. De igual forma, en esa oportunidad, la Sala ordenó al Área Rectora de Salud de Puntarenas - Chacarita de la Región Pacifico Central del Ministerio de Salud girar las órdenes sanitarias que considerara, para el buen funcionamiento del sistema de alcantarillado sanitario, así como del tanque séptico.

En el caso concreto, de la prueba aportada por las autoridades recurridas, se desprende que los problemas detectados en el recurso de amparo anterior se mantienen.

Al respecto, se observa que, si bien la municipalidad realizó una limpieza de los tanques sépticos en febrero de 2019 (los cuales están conectados a la servidumbre), en su informe expuso que no tenía ninguna tarea pendiente, pues no iba a hacer una nueva en lo que restaba del año. Ahora, pese a lo indicado, se constata que, luego de la limpieza de los tanques, el ICAA (ente al que no se le imputó responsabilidad sino únicamente el deber de coordinación técnica) ha tenido que intervenir por el rebalse de aguas negras, lo que demuestra que el problema no se ha solventado.

En adición, los oficios de las autoridades de salud expresamente reconocieron que en los últimos cinco años se han atendido múltiples denuncias interpuestas por los vecinos de El Cocal por el rebalse de aguas residuales que se produce porque el alcantarillado sanitario colapsa periódicamente; asimismo, manifestaron conocer que las viviendas son atravesadas por una servidumbre, cuya entrada se encuentra cerrada por una pared de concreto y está obstruida por muros divisorios entre cada propiedad. Precisamente, el Área de Salud de Puntarenas señaló que desconocía si el sistema reunía las características y condiciones de un sistema funcional y efectivo en el tratamiento y disposición final de aguas residuales, lo que podría ocasionar grave contaminación ambiental, situando en riesgo la salud pública y el equilibrio de los ecosistemas. Lo expuesto resulta reprochable pues, si se constata una amenaza o potencial afectación al ambiente y la salud pública, se deben tomar las medidas adecuadas para que estas desaparezcan.

Ahora, aun cuando el Ministerio de Salud ha denunciado penalmente al alcalde de Puntarenas por desobediencia a la autoridad y ha ejecutado una gran cantidad de actuaciones, no menos cierto es que la situación denunciada se mantiene. De igual manera, no se puede obviar que la Municipalidad de Puntarenas considera que el problema de marras es competencia del ICAA y este último, además de indicar que no le corresponde la solución, también reprocha que el gobierno local, no solo no ha cumplido la sentencia de la Sala sino que tampoco ha velado por que se eliminen las obstrucciones de la servidumbre de la tubería que se encuentra en el patio de los vecinos.

De hecho, uno de los principales problemas es que las autoridades municipales no tienen certeza de la situación jurídica de la servidumbre, pues aun cuando manifestaron que le pertenecía al INVU, de la prueba para mejor resolver ordenada al Registro Nacional, no se evidenció tal afirmación. Incluso, el Ministerio de Salud le requirió a la Municipalidad de Puntarenas que efectuara un estudio legal de la servidumbre, pero no consta que eso haya ocurrido.

Por las consideraciones expuestas, se impone estimar el recurso contra el Ministerio de Salud y la Municipalidad de Puntarenas, a los efectos de que coordinen lo necesario para que se solucionen las afectaciones que provocan los problemas de aguas residuales y pluviales del sector del INVU en el barrio El Cocal de Puntarenas, en relación con el sistema de alcantarillado que atraviesa las propiedades por medio de una servidumbre. En ese sentido, la Municipalidad de Puntarenas deberá analizar la condición actual (física y jurídica) de la servidumbre así como sus respectivas implicaciones desde un punto de vista legal y técnico, y remitir tal informe al Ministerio de Salud. Asimismo, la autoridad de salud deberá analizar el informe de la municipalidad y emitir su propio criterio sobre la servidumbre a los efectos de evaluar la posible responsabilidad de la municipalidad y de los propietarios de los inmuebles, para que así dicte las medidas provisionales y definitivas que procuren la solución de la problemática denunciada. Finalmente, la Municipalidad de Puntarenas deberá acatar las órdenes sanitarias que se dicten en su contra, sin perjuicio de que en la vía ordinaria se puedan cuestionar tales actos administrativos dictados, así como su viabilidad jurídica y técnica.

En relación con lo anterior, si bien se reconoció que en la zona no hay alcantarillado sanitario, esa situación no exime a los responsables de procurar un adecuado tratamiento de las aguas residuales mientras subsista tal situación. Ahora, si el recurrente considera que el ICAA debe construir una red sanitaria en El Cocal de forma inmediata, deberá gestionarle ante esa institución, o bien, en la jurisdicción ordinaria para que, con mayores elementos, en una vía amplia se evacúe la prueba correspondiente y se determine su procedencia o no.

Por otra parte, sobre las soluciones específicas que propone el recurrente, estas deberán ser planteadas ante las mismas autoridades, o bien, en la jurisdicción ordinaria. Además, en cuanto al INVU, de acuerdo con los elementos que constan en autos, se declara sin lugar el recurso, toda vez que no resulta evidente que tenga alguna conexión actual con lo acusado; lo anterior se dispone sin perjuicio de que en una vía plena se pueda determinar alguna posible responsabilidad. Finalmente, en los mismos términos del precedente citado, se desestima el recurso en contra del ICAA; sin embargo, deberá tomar nota esta autoridad a los efectos de que brinde, dentro del ámbito de sus competencias, el apoyo técnico que le requieran las autoridades de salud. Asimismo, deberá participar de las coordinaciones correspondientes con el Ministerio de Salud y la Municipalidad de Puntarenas, para que con su conocimiento técnico contribuya a la solución del problema.

IV.Nota del Magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan problemas de contaminación que afecta al Estero de Puntarenas, por las aguas negras y aguas servidas, provenientes del barrio El Cocal de Puntarenas, lo que afecta la salud de los vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

Por tanto:

Se declara parcialmente con lugar el recurso únicamente en contra la Municipalidad de Puntarenas y el Ministerio de Salud.

  • 1)Se ordena a Randall Chavarría Matarrita, en su condición de Alcalde de Puntarenas, a Carlos Manuel Venegas Porras, en su condición de Director Regional de Rectoría de la Salud de la Región Pacífico Central del Ministerio de Salud y a Carlos Manuel Venegas Porras, en su condición de Director Regional de Rectoría de la Salud de la Región Pacífico Central del Ministerio de Salud, o a quienes ocupen sus cargos, que coordinen lo necesario dentro del ámbito de sus competencia a efectos de que, en el plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, se brinde una solución a las afectaciones que provocan los problemas de aguas residuales del sector del INVU en el barrio El Cocal de Puntarenas, en relación con el sistema de alcantarillado que atraviesa las propiedades por medio de una servidumbre.
  • 2)Se ordena a Carlos Manuel Venegas Porras, en su condición de Director Regional de Rectoría de la Salud de la Región Pacífico Central del Ministerio de Salud y a Ericka Jiménez Valverde, en su condición de Directora del Área Rectora de Salud de Puntarenas, o a quienes ocupen sus cargos, que, de manera INMEDIATA, giren las órdenes pertinentes para que se tomen las medidas provisionales a efectos de que se atiendan los rebalses de aguas residuales en el sector del INVU del barrio El Cocal de Puntarenas y los consecuentes problemas de contaminación y malos olores.
  • 3)Se ordena a Randall Chavarría Matarrita, en su condición de Alcalde de Puntarenas, o a quien ocupe ese cargo, que gire las órdenes pertinentes y tome las medidas necesarias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se elabore un estudio de la condición actual de la servidumbre con citas n.º 331-07008-01-0900-001 (que pesa sobre la finca n.º PRN01 inscrita a nombre de Nombre02) y que atraviesa el sector del INVU del barrio El Cocal de Puntarenas; además, dentro de los TRES DÍAS posteriores a la emisión del informe deberá remitirlo al Área Rectora de Salud de Puntarenas la Dirección Regional.
  • 4)Se ordena a Carlos Manuel Venegas Porras, en su condición de Director Regional de Rectoría de la Salud de la Región Pacífico Central del Ministerio de Salud y a Ericka Jiménez Valverde, en su condición de Directora del Área Rectora de Salud de Puntarenas, o a quienes ocupen sus cargos, una vez que la Municipalidad de Puntarenas les remita el estudio sobre la servidumbre mencionada, deberán, dentro del plazo de UN MES, a partir de su recibido, emitir un criterio técnico y jurídico sobre ella y, en ese mismo plazo, dictar las órdenes sanitarias correspondientes para la solución de los rebalses de aguas residuales en el sector del INVU del barrio El Cocal de Puntarenas y los consecuentes problemas de contaminación y malos olores.
  • 5)Se ordena a Randall Chavarría Matarrita, en su condición de Alcalde de Puntarenas, o a quien ocupe ese cargo, acatar las medidas sanitarias que dicte el Ministerio de Salud, sin perjuicio de que en la vía ordinaria se puedan cuestionar tales actos administrativos dictados, así como su viabilidad jurídica y técnica. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Puntarenas al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Tome nota el Instituto Costarricense de Acueductos y Alcantarillados de lo consignado en el considerando III. El Magistrado Salazar Alvarado pone nota. Notifíquese a Randall Chavarría Matarrita, en su condición de Alcalde de Puntarenas, a Carlos Manuel Venegas Porras, en su condición de Director Regional de Rectoría de la Salud de la Región Pacífico Central del Ministerio de Salud y a Ericka Jiménez Valverde, en su condición de Directora del Área Rectora de Salud de Puntarenas, en forma personal”.

IV.Sobre las funciones de las municipalidades de conformidad con el artículo 169 de la Constitución Política, esta Sala en sentencia nro. 2023011483 de las 09:20 horas del 19 de mayo de 2023, indicó:

“(…) IV.- Este Tribunal, en su jurisprudencia, ha reconocido la obligación de las Municipalidades de ejecutar acciones eficaces y céleres en función de las necesidades de la circunscripción territorial asignada a cada corporación municipal, y que se encuentra íntimamente ligado al elemento de población. Tales obligaciones, derivan de lo contemplado en los artículos 169 y 170, de la Constitución Política, siendo que abarca un amplio número de actividades. Así, en sentencias N° 2011-12886 de las 12:44 horas de 23 de setiembre de 2011 y N° 2015010541 de las 09:20 horas de 17 de julio de 2015, entre otras, esta Sala indicó:

“(…) conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, adecuados sistemas de acueductos y alcantarillado, sistemas de iluminación y ornato de las ciudades; servicios de construcción, reparación y limpieza de calles y otras vías públicas; en general planes concretos y prácticos para hacer confortable y segura la vida de la población”.

Además, en materia de prestación de servicios, esta Sala ha señalado –v. gr. sentencia N° 2016-000427 de las 09:30 horas de 15 de enero de 2016- que el buen funcionamiento de estos corresponde a un derecho fundamental. Esto, a partir del contenido de los artículos 139, 140 y 191 de la Constitución Política. Esto se traduce en la obligación de las distintas Administraciones Públicas de prestar servicios de forma continua, regular, célere, eficaz y eficiente. Asimismo, de la parte orgánica de la Carta Fundamental, se erigen una serie de principios de la organización y función de la Administración, los cuales han sido desarrollados por normas infra constitucionales, tales como la Ley General de la Administración Pública, que en sus artículos 4, 225, párrafo 1 y 269, párrafo 1, impone el deber de los órganos del Estado, de orientar y nutrir la organización y la función administrativa. Así, el principio de eficacia supone que la organización administrativa está diseñada para la obtención de objetivos y fines asignados por el propio ordenamiento jurídico, lo que obliga la existencia de planificación y rendición de cuentas.

Por su parte, la eficiencia implica la obtención de los mejores resultados con el uso racional de los recursos con los que cuentan las diferentes dependencias. Asimismo, se impone a la Administración el principio de simplicidad, el cual se debe entender como la obligación de que las estructuras administrativas y sus competencias sean de fácil comprensión, sin procedimientos complejos que retarden la satisfacción de los intereses públicos. El principio de celeridad, impone la obligación a las Administraciones Públicas a cumplir con sus objetivos y fines, de la forma más expedita, rápida y acertada posible, para evitar retardos indebidos e injustificados. Así, estos principios imponen una serie de exigencias, responsabilidades y deberes permanentes a todos los entes públicos (…)”.

V. SOBRE EL CASO CONCRETO

Se acredita que, el tutelado vive en El Cocal de Puntarenas, en las casas conocidas como las del Seguro Social, en la Dirección03. Que, hace aproximadamente un mes, en su vivienda y en las de otros vecinos, comenzaron a ingresar aguas negras provenientes de la red interna de alcantarillado de la urbanización. Explica que esta situación se debe, aparentemente, a la falta de mantenimiento por parte de las autoridades competentes. Señala que dichas aguas, deberían descargarse en unos tanques cercanos; sin embargo, circulan libremente debido al colapso u obstrucción del sistema de alcantarillado. Manifiesta que este hecho pone en peligro su vida y la de muchas personas del sector, incluidas mujeres niños y adultos mayores y peligro al ambiente. Por lo anterior, acudió a la oficina del alcalde de Puntarenas para informar sobre la situación, pero éste argumentó que no dispone de la maquinaria, ni los recursos necesarios para solucionar el problema, sin importarle el riesgo que esto representa para la salud de los habitantes. El recurrente enfatiza que, pese a la gravedad del problema, las autoridades responsables, no han tomado acciones para remediarlo.

Del análisis de los informes rendidos, así como, de la prueba que consta en autos, la Sala determina que lleva razón el tutelado en su alegato. Lo anterior, porque, consta que desde el 2018, otros vecinos de El Cocal de Puntarenas acudieron a este Tribunal por la misma problemática que les aqueja, sobre aguas negras provenientes de la red interna de alcantarillado de la urbanización, situación que, a la fecha cuando el recurrente acude a este amparo, las autoridades accionadas no habían realizado las gestiones correspondientes para solucionar el problema que les aqueja, pese a las dos órdenes que este Tribunal emitió.

Por lo anterior, y en concordancia con la sentencia nro. 2018-008599 de las 9:15 horas del 1º de junio de 2018 y la sentencia nro. 2019022487 de las 09:15 horas del 15 de noviembre de 2019, se procede a acoger de manera parcial el recurso interpuesto en cuanto a la Municipalidad de Puntarenas y el Ministerio de Salud, por las siguientes razones:

En cuanto a la Municipalidad de Puntarenas. Si bien, el alcalde informa que ese municipio ha venido realizando el mantenimiento y limpieza de los tanques de depósito comunales, todos los años; no obstante, se aprecia que esto no ha sido suficiente, ya que el problema que aqueja a la comunidad de El Cocal de Puntarenas, persiste. En efecto, nótese, que las mismas autoridades accionadas reconocen la problemática; sin embargo, no informan a la Sala, qué acciones definitivas vayan a realizar a fin de encontrar una solución al problema, ya que el alcalde solamente, se limita a indicar que la comunidad no cuenta con red de alcantarillado sanitario. Que dicho proyecto de vivienda fue promovido y construido por el Instituto de Vivienda y Urbanismo, el cual diseñó sistemas de tratamiento por medio de tanque séptico común, por ende, las aguas que descarga cada vivienda van a un tanque de captación general para todo el proyecto y que efectivamente en las inspecciones realizadas se logró determinar que la causa del problema es la falta de trampas de grasas para evitar las obstrucciones al sistema de tuberías, ya que como es un único sistema de tuberías para todas las casas, si uno de ellos no realiza un mantenimiento y limpieza adecuados, afecta a su vivienda y las de los otros, por cuanto el sistema se obstruye y rebalsa las aguas hacia adentro de las casas.

Por lo anterior, las tuberías a las que se hace referencia en el informe de cita, no se pueden limpiar desde afuera o por el frente de las propiedades, ya que las mismas se ubican en los patios de las viviendas, y ello ocasiona la imposibilidad para que el municipio pueda accionar, al tratarse de una propiedad privada. Indica, además, que el único acceso al ramal de tubería que existía fue cerrado por todos los vecinos, al construir unas tapias, y que, al realizar consulta al Registro de la propiedad, se desprende que dicho acceso corresponde a una servidumbre de aguas propiedad del INVU; a la cual tampoco puede tener acceso el municipio.

Situación que fue igualmente señalada por parte del Instituto Costarricense de Acueductos y Alcantarillados, quien informó que, el sistema de recolección de aguas residuales cuenta con una tubería interna que atraviesa los patios traseros de todas las propiedades, correspondiente a una servidumbre de paso cita de inscripción N°331-07008-01-0900-001 (misma servidumbre que se conoció en el amparo 19-015715-0007-CO); no obstante, el acceso de ingreso a la servidumbre de paso de la tubería de recolección se encuentra obstruido, por cuanto los habitantes han realizado diversas construcciones en la servidumbre, como tapias, bodegas, corredores y un taller entre otros. Que a pesar de que el mantenimiento preventivo y correctivo del sistema del INVU Cocal, le corresponde a la Municipalidad de Puntarenas, el AyA, por medio de órdenes sanitarias generadas por el Ministerio de Salud se ha encargado de brindar mantenimiento en los tanques de recolección de aguas residuales del sector; sin embargo, dicha labor se dificulta por cuanto no existe libre acceso en la servidumbre de paso de las aguas residuales dispuesta para este fin, debiendo ingresar los funcionarios del AyA por medio de propiedad privada para efectuar las desobstrucciones.

Señala que le corresponde a la Municipalidad de Puntarenas ejecutar las acciones legales pertinentes para mantener el libre acceso en la servidumbre. Asimismo, que por esa problemática en el 2018, los vecinos del Cocal han interpuesto dos recursos de amparo, donde este Tribunal ordena al Municipio a realizar las labores legales pertinentes para permitir el libre acceso en la servidumbre de paso y a ejecutar la limpieza y mantenimiento del tanque séptico, de igual manera gestionar la coordinación técnica con el AyA. Por lo que, la Institución ha participado en reuniones interinstitucionales con el MINSA y la Municipalidad de Puntarenas, con el fin de brindar la colaboración y/o asesoría que se requiera para la correcta ejecución del sistema de aguas residuales.

Sobre este tema, la Sala en el voto mencionado No. 2019022487 de las 09:15 horas del 15 de noviembre de 2019, ordenó lo siguiente:

(…) 3) Se ordena a Randall Chavarría Matarrita, en su condición de Alcalde de Puntarenas, o a quien ocupe ese cargo, que gire las órdenes pertinentes y tome las medidas necesarias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se elabore un estudio de la condición actual de la servidumbre con citas n.º 331-07008-01-0900-001 (que pesa sobre la finca n.º PRN01 inscrita a nombre de Nombre02) y que atraviesa el sector del INVU del barrio El Cocal de Puntarenas; además, dentro de los TRES DÍAS posteriores a la emisión del informe deberá remitirlo al Área Rectora de Salud de Puntarenas la Dirección Regional (…)”.

De lo anterior, se aprecia que, lo ordenado en su momento por este Tribunal no se ha realizado, pues las mismas autoridades reconocen de la problemática que se genera de dicha servidumbre, y no informa el alcalde del municipio accionado, qué medidas se van a realizar a fin de buscar una solución al problema.

Sobre el Ministerio de Salud. Si bien, de los informes rendidos y de la prueba que consta en autos, se acredita que las autoridades accionadas del Ministerio de Salud -Área Rectora de Salud de Puntarenas – Chacarita-, han realizado gestiones a fin de cumplir con las ordenes que en su momento dio este Tribunal, tal como se aprecian en los hechos probados de esta sentencia, y que, ante el incumplimiento de la orden sanitaria 0112-REG-2024 por parte de la Municipalidad de Puntarenas, el 4 de diciembre del 2024, se interpuso denuncia penal contra la Municipalidad de Puntarenas, por el presunto Delito de Desobediencia a la Autoridad ante la Fiscalía Adjunta del Ministerio Público en Puntarenas; sin embargo, lo cierto del caso es que, para esta Sala su deber ha sido insuficiente, pues dicho ministerio demanda la observancia, así como, el garantizar la protección de la salud de la población y del medioambiente.

Por lo anterior, la Sala aprecia que, las autoridades accionadas de la Municipalidad de Puntarenas y del Ministerio de Salud, no han cumplido con la orden que dictó este Tribunal, en las sentencias de los expedientes nro. 18-006056-0007-CO y nro. 19-015715-0007-CO, pues si bien las autoridades reconocen la problemática denunciada y a la fecha que el tutelado acude en amparo -más de seis años después-, la municipalidad accionada solamente da soluciones paliativas, y no aporta pruebas a la Sala, en donde se indique las acciones tomadas, ya sea de coordinación con las autoridades que estime necesario, así como, con los dueños de las propiedades que se requiera, a fin de dar una solución integral y definitiva al problema que aqueja a las personas que viven en el barrio El Cocal de Puntarenas , situación contraria a los principios constitucionales de eficiencia y eficacia que debe imperar en los deberes de la función pública.

En consecuencia, lo que corresponde es declarar con lugar el recurso en cuanto a estas dos autoridades accionadas, y reiterar la orden que anteriormente fue dada por esta Sala, en la sentencia nro. 2019022487 de las 09:15 horas del 15 de noviembre de 2019.

VI.Por otra parte, en cuanto al Instituto Costarricense de Acueductos y Alcantarillados, la Sala, no encuentra elementos que indiquen que dicha institución haya incurrido en actuaciones que afecten los derechos fundamentales del tutelado, pues se aprecia que dicho instituto brinda únicamente el servicio de agua potable en el sector del INVU, conocido como Barrio El Cocal ubicado en la provincia de Puntarenas y que, a pesar de que el mantenimiento preventivo y correctivo del sistema del INVU Cocal, le corresponde a la Municipalidad de Puntarenas, el AyA, por medio de órdenes sanitarias generadas por el Ministerio de Salud se ha encargado de brindar mantenimiento en los tanques de recolección de aguas residuales del sector. En consecuencia, en cuanto a dicho instituto se declara sin lugar el recurso.

Sin embargo, deberá tomar nota esta autoridad a los efectos de que brinde, dentro del ámbito de sus competencias, el apoyo técnico que le requieran las autoridades de salud. Asimismo, deberá participar de las coordinaciones correspondientes con el Ministerio de Salud y la Municipalidad de Puntarenas, para que con su conocimiento técnico contribuya a la solución del problema.

VII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se reclama la contaminación y afectaciones que generan el ingreso de aguas negras provenientes de la red interna de alcantarillado de la urbanización, por falta de mantenimiento del sistema de alcantarillado, en la Dirección03, de la zona de El Cocal de Puntarenas.

La parte recurrente señala que ha interpuesto las denuncias correspondientes ante el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Puntarenas; sin embargo, no han logrado resolver el problema principal, lo que produce una afectación a la salud y a la vida de los vecinos, e implica un riesgo para la salud pública. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso únicamente en contra la Municipalidad de Puntarenas y el Ministerio de Salud.

  • 1)Se ordena a Randall Alexis Chavarría Matarrita, alcalde de la Municipalidad del Cantón Central de Puntarenas, a la Dra. Mary Denisse Munive Angermüller, ministra de Salud, y a la Dra. Carolina Lizeth Guillén Meléndez, directora a.i., del Área Rectora de Salud de Puntarenas–Chacarita-, o a quienes ocupen esos cargos, que coordinen lo necesario dentro del ámbito de sus competencias a efectos de que, en el plazo de UN MES, contado a partir de la notificación de esta sentencia, se brinde una solución a las afectaciones que provocan los problemas de aguas residuales del sector del INVU en el barrio El Cocal de Puntarenas, en relación con el sistema de alcantarillado que atraviesa las propiedades por medio de una servidumbre.
  • 2)Se ordena a la Dra. Mary Denisse Munive Angermüller, ministra de Salud, y a la Dra. Carolina Lizeth Guillén Meléndez, directora a.i., del Área Rectora de Salud de Puntarenas–Chacarita-, o a quienes ocupen sus cargos, que, de manera INMEDIATA, giren las órdenes pertinentes para que se tomen las medidas provisionales a efectos de que se atiendan los rebalses de aguas residuales en el sector del INVU del barrio El Cocal de Puntarenas y los consecuentes problemas de contaminación y malos olores.
  • 3)Se ordena a Randall Alexis Chavarría Matarrita, alcalde de la Municipalidad del Cantón Central de Puntarenas, o a quien ocupe ese cargo, que gire las órdenes pertinentes y tome las medidas necesarias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se elabore un estudio de la condición actual de la servidumbre con citas n.º 331-07008-01-0900-001 y que atraviesa el sector del INVU del barrio El Cocal de Puntarenas; además, dentro de los TRES DÍAS posteriores a la emisión del informe deberá remitirlo al Área Rectora de Salud de Puntarenas–Chacarita-.
  • 4)Se ordena a la Dra. Mary Denisse Munive Angermüller, ministra de Salud, y a la Dra. Carolina Lizeth Guillén Meléndez, directora a.i., del Área Rectora de Salud de Puntarenas–Chacarita-, o a quienes ocupen sus cargos, una vez que la Municipalidad de Puntarenas les remita el estudio sobre la servidumbre mencionada, deberán, dentro del plazo de UN MES, a partir de su recibido, emitir un criterio técnico y jurídico sobre ella y, en ese mismo plazo, dictar las órdenes sanitarias correspondientes para la solución de los rebalses de aguas residuales en el sector del INVU del barrio El Cocal de Puntarenas y los consecuentes problemas de contaminación y malos olores.
  • 5)Se ordena Randall Alexis Chavarría Matarrita, alcalde de la Municipalidad del Cantón Central de Puntarenas, o a quien ocupe ese cargo, acatar las medidas sanitarias que dicte el Ministerio de Salud, sin perjuicio de que en la vía ordinaria se puedan cuestionar tales actos administrativos dictados, así como su viabilidad jurídica y técnica. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Puntarenas al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Tome nota el Instituto Costarricense de Acueductos y Alcantarillados de lo indicado en el Considerando VI de esta sentencia. El Magistrado Salazar Alvarado consigna nota. Notifíquese.
