Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty on veinte de diciembre de dos mil veinticuatro.
Amparo proceeding (recurso de amparo) processed under expediente nro. 24- 033200-0007-CO, filed by [Nombre 001], identity card [Valor 001], [Nombre 002], identity card [Valor 002], [Nombre 003], identity card [Valor 003], [Nombre 004], identity card [Valor 004], [Nombre 005], identity card [Valor 005], against the MUNICIPALIDAD DE ALAJUELITA and the MINISTERIO DE SALUD.
Findings:
Justice Alvarado Paniagua drafts the opinion; and,
Whereas:
I.Preliminary clarification. Before analyzing the merits of the matter, it must be clarified that, beginning with judgment number 2008-02545, issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the contentious-administrative jurisdiction—with certain exceptions—those matters in which the issue is whether the Public Administration complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to resolve an administrative proceeding—initiated ex officio or at the request of a party—through a final administrative act, or to adjudicate the applicable administrative appeals. In the matter sub lite, precisely such an exception is presented, because it concerns submissions related to environmental and public-health complaints that allegedly were not resolved within a reasonable period. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
II.Subject Matter of the Petition. The petitioners file an amparo petition (recurso de amparo) against the Municipalidad de Alajuelita and the Ministerio de Salud. They state that on 13 de setiembre de 2024 they reported to the respondent municipality the operation of a “garbage dump and scrapyard” that operates without the required legal authorizations and in clear violation of environmental regulations. They indicate that, as a result, the residential area near the río Tiribi is being polluted, which considerably aggravates the environmental and public-health impacts arising from its operation. They add that the accumulated waste may flow into the river and pollute it. They assert that it is also harmful to public health because it encourages the spread of pests and generates foul odors, as stated in the complaint filed with the local government. They add that they requested an inspection of the site to verify their allegations, as well as its closure and the collection of the waste (with its corresponding transfer to a site where it would receive proper treatment).
They complain that they have gone to the respondent municipality to locate the corresponding case file (expediente), but it cannot be found. They allege that on 13 de setiembre de 2024 they filed a complaint regarding these events with the Dirección del Área Rectora de Salud de Alajuelita of the Ministerio de Salud, but it has neither issued a decision nor taken action. They request a declaration that the respondent authorities failed to resolve the pollution problem and breached their duty of interinstitutional coordination. They consider it urgent that the waste be collected so that it can receive proper treatment. They believe that their complaints must be answered and that they must be informed why no action has been taken. They state that what is required is the immediate closure of the “dump and scrapyard.”
On 13 de setiembre de 2024, the Dirección del Área Rectora de Salud de Alajuelita received a complaint in the name of [Nombre 003], which stated: “A written document explaining the complaint is attached. Scrapyard and dump operating illegally and causing harm to the surrounding community. It affects public health through the spread of pests and foul odors and also affects the health of the people living nearby”; in addition, the attached document made the following requests: “1.- That an inspection be conducted to verify our statements and that we be informed what (sic) actions will be taken to resolve the reported problem. 2.- The Ministerio de Salud is requested to issue a health order (orden sanitaria) to the Municipalidad de Alajuelita and the property owner requiring them to collect the waste located at the dump and scrapyard and take it to a site where it can receive proper treatment.” This complaint was assigned sequential number 110-24 and listed [email protected] as the email address for service of notices. (Evidence submitted by the Ministerio de Salud).
On 28 de noviembre de 2024, an official from the Ministerio de Salud called the complainant three times “to identify the problem,” but received no response. (Evidence submitted by the Ministerio de Salud).
On 28 de noviembre de 2024, inspection report (acta de inspección) A-059-2024 recorded that an attempt was made to contact the complainant, but she did not answer; it also recorded that the reported location could not be found. (Evidence submitted by the Ministerio de Salud).
On 29 de noviembre de 2024, inspection report A-065-2024 recorded the following regarding the address “200 m east of the pequeño (sic) mundo (sic) in Alajuelita”: “There is a workshop in the area; it does not have a sanitary operating permit (permiso sanitario de funcionamiento, PSF). Plastic-waste shredding activities are carried out there, similar to those of an authorized solid-waste manager (gestor autorizado de residuos sólidos); however, they do not have a sanitary operating permit, which violates Decreto Ejecutivo N ̊ 43432. The gentleman operating the workshop is Alexander Betancourt Cason, who states that he rents part of the reported property and that the waste beside the río Tiribí is the property owner’s responsibility. He states that the owner is outside the country. Solid waste can be seen along the boundary between the reported property and the Río Tiribí. During the inspection, no vehicles or trucks were observed moving or depositing waste. No foul odors were detected either. Due to the complexity of the case, coordination was undertaken with the Municipalidad de Alajuelita to close the premises. It was agreed that the necessary measures would be carried out on 03 de diciembre del año 2024.” (Evidence submitted by the Ministerio de Salud).
On 3 de diciembre de 2024, inspection report A-067-2024 recorded that, in connection with complaint 110-29, the “unlicensed scrapyard” was closed. (Evidence submitted by the Ministerio de Salud).
On 3 de diciembre de 2024, closure report (acta de clausura) MS-DRRSCS-ARSAL-1169-2024 was issued, stating: “The undersigned, Bach. Mauricio Díaz Chavarría, Environmental Manager and official of the Ministerio de Salud, Área Rectora de Salud de Alajuelita, has proceeded to close the establishment: Scrapyard Without a Sanitary Operating Permit located in Urba Alajuelita cadastral record N ̊ 2018-70247-C (…), an action taken on the basis of VISUAL INSPECTION REPORT N ̊ A-067-2024 dated 03/12/2024 (…).” (Evidence submitted by the Ministerio de Salud).
On 13 de setiembre de 2024, it received a complaint filed by the petitioners herein, in which they stated that the operation of a “garbage dump and scrapyard” located “500 mts southeast of Pequeño Mundo de Alajuelita (…), distrito Horizontes, on the left-hand side adjoining the río Tiribí,” which operates without authorizations or permits, harms people and pollutes the environment by failing to comply with technical standards; they also made the following requests: “1.- That an inspection be conducted to verify our statements and that we be informed what actions will be taken to resolve the reported problem. 2.- The mayor’s office is requested to collect the waste and send it to a site where it can receive proper treatment. If this falls to MinSa, it is requested that a health order be issued to the Muni (sic) and the owner requiring the waste to be collected and taken to a site. (…) 3.- We request that the premises be closed if appropriate. And it is recommended (sic) that the Municipalidad develop a project for the enjoyment of the residents of the canton, or that the passageway be restored (sic) in order to protect the adjoining Río.” The complaint listed [email protected] and [email protected] as the means for receiving notices. (Evidence submitted by the Municipalidad de Alajuelita).
In the commercial-premises closure report 170-2024 of 3 de diciembre de 2024, regarding the commercial activity of a “Recycling Facility” and in relation to “Property: 223097,” the local government’s Inspection Subprocess recorded: “A telephone conversation is held with (…) the owners of the business activity, and they are informed that the premises will be closed for failure to hold the corresponding license, as provided by the Municipal code (sic), Art. 88, with the participation of the Ministerio de Salud. The seals will not be removed until the necessary permits have been obtained.” (Evidence submitted by the Municipalidad de Alajuelita).

V.The Specific Case. In the sub lite, the petitioners file an amparo petition against the Municipalidad de Alajuelita and the Ministerio de Salud. They state that on 13 de setiembre de 2024 they reported to the respondent municipality the operation of a “garbage dump and scrapyard” that operates without the required legal authorizations and in clear violation of environmental regulations. They indicate that, as a result, the residential area near the río Tiribi is being polluted, which considerably aggravates the environmental and public-health impacts arising from its operation. They add that the accumulated waste may flow into the river and pollute it. They assert that it is also harmful to public health because it encourages the spread of pests and generates foul odors, as stated in the complaint filed with the local government. They add that they requested an inspection of the site to verify their allegations, as well as its closure and the collection of the waste (with its corresponding transfer to a site where it would receive proper treatment).

From the examination of the case file, with respect to the Ministerio de Salud, it is deemed proven that, on 13 de setiembre de 2024, the Dirección del Área Rectora de Salud de Alajuelita received a complaint in the name of [Nombre 003], in which she stated: “A written document explaining the complaint is attached. Scrap yard and dump operating illegally and detrimentally to the surrounding community. It affects public health through the spread of pests and foul odors and also affects the health of the people living nearby”; furthermore, in the attached document, she made the following requests: “1.- That an inspection be conducted to verify our assertions and that we be informed what (sic) actions will be taken to resolve the reported problem. 2.- The Ministerio de Salud is requested to issue a sanitary order (orden sanitaria) to the Municipalidad de Alajuelita and the owner of the property, requiring them to collect the waste located at the dump and scrap yard and take it to a site where it can receive proper treatment.” This complaint was assigned consecutive number 110-24, and the email address [email protected] was provided for notifications.
On 28 de noviembre de 2024, an official of the Ministerio de Salud called the complainant three times “to identify the problem,” but received no response. The inspection record (acta de inspección) A-059-2024 dated 28 de noviembre de 2024 stated that an attempt had been made to contact the complainant, but she did not answer; it also stated that the reported location could not be found. With respect to the address “200 m east of the small (sic) world (sic) of Alajuelita,” inspection record A-065-2024 dated 29 de noviembre de 2024 stated: “There is a workshop in the area; it does not have a PSF; plastic-waste shredding activities are carried out, similar to those of an authorized solid-waste manager; however, it does not have an operating health permit (permiso sanitario de funcionamiento), which violates Decreto Ejecutivo N ̊ 43432. The gentleman operating the workshop is Alexander Betancourt Cason, who states that he rents a portion of the reported property and that the waste beside the río Tiribí is the responsibility of the property owner.
He states that the owner is outside the country. Solid waste can be observed along the boundary between the reported property and the Río Tiribí. During the inspection, no vehicles or trucks were observed moving or depositing waste. Nor were any foul odors detected. Due to the complexity of the case, coordination is undertaken with the Municipalidad de Alajuelita to close the premises. It is agreed that the necessary steps will be taken on 03 de diciembre del año 2024.” Inspection record A-067-2024 dated 3 de diciembre de 2024 stated that, in connection with complaint 110-29, the “scrap yard operating without a permit” was closed. On 3 de diciembre de 2024, closure record (acta de clausura) MS-DRRSCS-ARSAL-1169-2024 was issued, stating: “The undersigned, Bach. Mauricio Díaz Chavarría, Environmental Manager, an official of the Ministerio de Salud assigned to the Área Rectora de Salud de Alajuelita, has proceeded to close the establishment: Scrap Yard Without an Operating Health Permit, located in Urba Alajuelita, cadastral survey N ̊ 2018-70247-C (…), an action taken on the basis of VISUAL INSPECTION RECORD N ̊ A-067-2024 dated 03/12/2024 (…).” Furthermore, with regard to the Municipalidad de Alajuelita, it was established that on 13 de setiembre de 2024 it received a complaint filed by the petitioners herein, in which they asserted that the operation of a “garbage dump and scrap yard,” located “500 mts southeast of Pequeño Mundo de Alajuelita (…), distrito Horizontes, on the left-hand side adjoining the río Tiribí,” which operates without authorizations or permits, affects people and pollutes the environment by failing to comply with technical standards; they also made the following requests: “1.- That an inspection be conducted to verify our assertions and that we be informed what actions will be taken to resolve the reported problem. 2.- The mayor’s office is requested to collect the waste and send it to a site where it can receive proper treatment.
If this falls to the MinSa, it is requested that it issue a sanitary order to the Muni (sic) and the owner, requiring them to collect the waste and take it to an appropriate site. (…) 3.- We request that the premises be closed if appropriate. And it is recommended (sic) that the Municipalidad develop a project for the enjoyment of residents of the canton or, alternatively, that the passageway be restored (sic) in order to safeguard the adjoining Río.” This complaint provided the following means for receiving notifications: [email protected] or [email protected]. In the commercial-premises closure record 170-2024 dated 3 de diciembre de 2024, concerning the commercial activity described as a “Recycling Facility” and relating to “Property: 223097,” the local government’s Inspection Subprocess stated: “A telephone conversation is held with (…) the owners of the business, and they are informed that the premises will remain closed because they do not have the corresponding license, as required by the codigo (sic) Municipal Art. 88, with the participation of the Ministerio de Salud.
The seals will not be removed until the necessary permits have been obtained.” Moreover, it was not established that the Municipalidad de Alajuelita had notified the petitioners of any resolution concerning the complaint filed on 13 de setiembre de 2024. Nor was it established that the Ministerio de Salud had notified [Nombre 003] of any resolution concerning the complaint filed on 13 de setiembre de 2024.
Against this background, and under the terms set forth in the filing, the amparo petition (recurso de amparo) must be partially granted.
Although it can be seen that, more than two months after the complaints were filed and during the processing of these proceedings, the respondent authorities closed the site at issue in the sub examine, there is no indication that each authority, within the scope of its powers, analyzed the reported problems concerning the management of the existing waste, the possible environmental harm, the alleged pollution of the river, and the cited public-health concerns. It should be noted that both the ministerial body and the municipality limited themselves to describing their actions relating to the closure of the premises; however, they did not resolve through administrative proceedings (sede administrativa) the remaining matters raised in the submissions. Indeed, they did not even demonstrate that they had notified the petitioners of the resolution of the complaints concerning the problems mentioned ut supra.
Consequently, because the reported matters could have environmental and public-health implications, intervention by the Sala is necessary to ensure that such matters are assessed within a reasonable period and that the requesting parties are duly notified. Accordingly, a violation of section 41 of the Constitución Política is established, because the submissions have not been addressed promptly and, due to their content, are relevant for purposes of artículo 50 eiusdem.
Moreover, although the petitioners allege that the case file does not appear in the municipality’s records, it is no less true that they did not mention the dates on which they allegedly requested it, nor did they submit evidence of any request in that regard. Ergo, prima facie, any violation in that respect capable of being declared in this amparo proceeding is ruled out. Likewise, if they believe that the problems they reported must be resolved in a particular manner, or that the reasons why the authorities have not acted must be explained to them, they may submit whatever arguments and requests they deem appropriate through administrative proceedings.
VI.Note by Magistrado Salazar Alvarado. I consider that environmental matters, where the Administración Pública has already intervened, fall within the jurisdiction of the administrative courts (jurisdicción contenciosa administrativa) for adjudication and resolution. Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (artículo 50, de la Constitución Política), as occurs in this case, in which the petitioner asserts that she reported—among other matters—to the respondent municipality the operation of a “garbage dump and scrap yard” without the required legal authorizations and in clear violation of environmental regulations, thereby affecting the protected party’s and other residents’ right to enjoy a healthy and ecologically balanced environment and a decent quality of life.
VII.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, such items must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.

The petition is partially granted. María del Rosario Siles Fernández and Roberto Madrigal Abarca, in their respective capacities as alcaldesa de Alajuelita and director del Área Rectora de Salud de Alajuelita del Ministerio de Salud, or whoever holds those offices, are ordered to undertake the necessary coordination, issue the appropriate orders, and carry out all actions within the scope of their powers so that, within a maximum period of ONE MONTH from notification of this judgment, the situations reported in the submissions dated 13 de setiembre de 2024 are fully analyzed (in relation to the management of the existing waste, the possible environmental harm, the cited pollution of the river, and the reported public-health problems) and, if appropriate, the corresponding administrative acts (actos administrativos) are issued. Those authorities are also ordered to resolve the submissions made by the requesting parties concerning the problems mentioned ut supra, which entails communicating the actions carried out and the measures taken to address the reported situations; notice thereof must be provided within the same period granted ut supra using the means designated for that purpose.
The respondent authorities are warned that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that must be obeyed or enforced and fails to obey or enforce it shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Alajuelita are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the administrative courts. In all other respects, the petition is denied. Magistrado Salazar Alvarado records a separate note. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veinte de diciembre de dos mil veinticuatro .
Recurso de amparo que se tramita en el expediente nro. 24- 033200-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], [Nombre 002], cédula de identidad [Valor 002], [Nombre 003], cédula de identidad [Valor 003], [Nombre 004], cédula de identidad [Valor 004], [Nombre 005], cédula de identidad [Valor 005], contra la MUNICIPALIDAD DE ALAJUELITA y el MINISTERIO DE SALUD.
Resultando:
Redacta la Magistrada Alvarado Paniagua; y,
Considerando:
I.Aclaración previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante gestiones relacionadas con denuncias ambientales y de salud pública que presuntamente no han sido resueltas dentro de un plazo razonable. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.
II.Objeto del recurso. Las personas accionantes plantean recurso de amparo contra la Municipalidad de Alajuelita y el Ministerio de Salud. Indican que el 13 de setiembre de 2024 denunciaron ante la municipalidad recurrida la operación de un “botadero y chatarrería de basura” que funciona sin las debidas autorizaciones legales y en clara violación de la normativa ambiental. Señalan que debido a lo anterior se está contaminando la zona residencial próxima al río Tiribi, lo cual agrava considerablemente los impactos ambientales y de salud pública que se derivan de su funcionamiento. Añaden que la acumulación de desechos puede desembocar en el río y contaminarlo. Refieren que también resulta perjudicial a la salud pública al propiciar la expansión de plagas y generar malos olores, lo cual fue mencionado en la denuncia ante el gobierno local. Agregan que solicitaron la inspección del lugar para que se comprobara lo reclamado, así como su clausura y que se recogieran los residuos (con su respectivo envío a un sitio en el que se les diera el tratamiento adecuado).
Reclaman que han acudido a la municipalidad accionada para buscar el expediente correspondiente, pero no aparece. Acusan que el 13 de setiembre de 2024 plantearon una denuncia por tales hechos ante la Dirección del Área Rectora de Salud de Alajuelita del Ministerio de Salud, pero no ha resuelto ni tampoco ha actuado. Piden que se declare la omisión de las autoridades recurridas de solucionar el problema de contaminación, así como la transgresión al deber de coordinación interinstitucional. Consideran que es urgente la recolección de residuos para que se les brinde un tratamiento adecuado. Estiman que se les deben contestar las denuncias para que se les aclare por qué no han actuado. Manifiestan que lo requerido es el cierre inmediato del “botadero y chatarrera”.
El 13 de setiembre de 2024, la Dirección del Área Rectora de Salud de Alajuelita recibió una denuncia a nombre de [Nombre 003], en la que describió: “Se adjunta escrito con la explicación de la denuncia. Chatarrera y botadero con funcionamiento ilegal y perjudicial para la comunidad a su alrededor. Afecta la salud pública con la expansión de plagas, malos olores, además afecta la salud de las personas que habitan en los alrededores”; además, en el documento adjunto formuló la siguiente petitoria: “1.- Que se haga una inspección para comprobar nuestro decir y se nos señale que (sic) acciones se harán para resolver la problemática denunciada. 2.- Se solicita al Ministerio de Salud que envíe orden sanitaria a la Municipalidad de Alajuelita y al propietario del inmueble para que recoja los residuos que se encuentran en el botadero y chatarrero para llevarlos a un sitio donde les den un tratamiento adecuado”. A esta denuncia se le asignó el consecutivo 110-24 y en ella señaló el correo para notificaciones [email protected]. (Prueba aportada por el Ministerio de Salud).
El 28 de noviembre de 2024, un funcionario del Ministerio de Salud llamó en tres ocasiones a la denunciante “para identificar la problemática”, pero no obtuvo respuesta. (Prueba aportada por el Ministerio de Salud).
El 28 de noviembre de 2024 se consignó en el acta de inspección A-059-2024 que se procuró contactar a la denunciante, pero no contestó; asimismo, que no se encontró el lugar denunciado. (Prueba aportada por el Ministerio de Salud).
El 29 de noviembre de 2024 se consignó en el acta de inspección A-065-2024 con respecto a la dirección: “200 m este del pequeño (sic) mundo (sic) de Alajuelita”: “Hay un taller en la zona, no tiene PSF, se realizan actividades de trituración de residuos plásticos, similar a un gestor autorizado de residuos sólidos, sin embargo no cuentan con permiso sanitario de funcionamiento, lo cual incumple del Decreto Ejecutivo N ̊ 43432. El sr que opera el taller es Alexander Betancourt Cason, indica que él alquila un sector de la propiedad denunciada, y los residuos al lado del río Tiribí son asunto del dueño de la propiedad. Menciona que el dueño está fuera del país. Se observan residuos sólidos en la colindancia de la propiedad denunciada con el Río Tiribí. Durante el tiempo de la inspección no se observan vehículos o camiones moviendo o depositando residuos. Tampoco se perciben malos olores. Debido a la complejidad del caso se coordina con la Municipalidad de Alajuelita para clausurar el lugar. Se acuerda realizar las gestiones el día 03 de diciembre del año 2024”. El 3 de diciembre de 2024 se consignó en el acta de inspección A-067-2024, que, con ocasión de la denuncia 110-29 se clausuró la “chatarrera sin permiso”. (Prueba aportada por el Ministerio de Salud).
El 3 de diciembre de 2024 se emitió el acta de clausura MS-DRRSCS-ARSAL-1169-2024, en la que se consignó: “El suscrito, Bach. Mauricio Díaz Chavarría, Gestor Ambiental, funcionario del Ministerio de Salud, del Área Rectora de Salud de Alajuelita, ha procedido a efectuar la clausura del establecimiento: Chatarrera Sin Permiso Sanitario de Funcionamiento situado en Urba Alajuelita catastro N ̊ 2018-70247-C (…), acción que se toma con base en el ACTA DE INSPECCIÓN OCULAR N ̊ A-067-2024 de fecha 03/12/2024 (…)”. El 13 de setiembre de 2024 recibió una denuncia planteada por las personas aquí accionantes, en la que expusieron que la operación de un “botadero y chatarrería de basura” ubicado “500 mts sudeste del Pequeño Mundo de Alajuelita (…), distrito Horizontes, a mano izquierda colindante con el río Tiribí” que funciona sin autorizaciones ni permisos, afecta a las personas y contamina el ambiente al no cumplir estándares técnicos; además, formularon las siguientes pretensiones: “1.- Que se haga una inspección para comprobar nuestro decir y se nos señale qué acciones se harán para resolver la problemática denunciada. 2.- Se solicita a la alcaldía que recojan los residuos y que los envíen a un sitio que les den el tratamiento adecuado. Si es al MinSa se pide que envíen orden sanitaria a la Muni (sic) y al propietario para que recoja los residuos para llevarlos a un sitio. (…) 3.- Pedimos que de ser procedente se clausure el lugar. Y se recomiendo (sic) a la Municipalidad se desarrolle algún proyecto para el disfrute de los vecinos del cantón, o bien, que se restauré (sic) el pasaje con el fin de mantener el cuidado del Río colindante”. En esta denuncia se señalaron los medios para recibir notificaciones [email protected] o [email protected]. (Prueba aportada por la Municipalidad de Alajuelita).
El Subproceso de Inspección del gobierno local, en el acta de clausura de locales comerciales 170-2024 de 3 de diciembre de 2024 con respecto a la actividad comercial de “Recicladera” y en relación con la “Finca: 223097”, consignó: “Se conversa vía telefónica con (…) dueños de la actividad y se les indica que el lugar quedará clausurado por no tener la licencia correspondiente como lo indica el codigo (sic) Municipal Art. 88, en acompañamiento del Ministerio de Salud. No se levantarán sellos hasta contar con los permisos necesarios”. (Prueba aportada por la Municipalidad de Alajuelita).
IV.Hechos no probados. De importancia para la resolución de este asunto se estiman como no demostrados lo siguientes hechos:
Que la Municipalidad de Alajuelita les haya notificado a las personas recurrentes alguna resolución de la denuncia planteada el 13 de setiembre de 2024.
Que el Ministerio de Salud le haya notificado a [Nombre 003] alguna resolución de la denuncia formulada el 13 de setiembre de 2024.
V.Sobre el caso concreto. En el sub lite, las personas accionantes plantean recurso de amparo contra la Municipalidad de Alajuelita y el Ministerio de Salud. Indican que el 13 de setiembre de 2024 denunciaron ante la municipalidad recurrida la operación de un “botadero y chatarrería de basura” que funciona sin las debidas autorizaciones legales y en clara violación de la normativa ambiental. Señalan que debido a lo anterior se está contaminando la zona residencial próxima al río Tiribi, lo cual agrava considerablemente los impactos ambientales y de salud pública que se derivan de su funcionamiento. Añaden que la acumulación de desechos puede desembocar en el río y contaminarlo. Refieren que también resulta perjudicial a la salud pública al propiciar la expansión de plagas y generar malos olores, lo cual fue mencionado en la denuncia ante el gobierno local. Agregan que solicitaron la inspección del lugar para que se comprobara lo reclamado, así como su clausura y que se recogieran los residuos (con su respectivo envío a un sitio en el que se les diera el tratamiento adecuado).

Del estudio de los autos, con respecto al Ministerio de Salud, se tiene por demostrado, que, el 13 de setiembre de 2024, la Dirección del Área Rectora de Salud de Alajuelita recibió una denuncia a nombre de [Nombre 003], en la que describió: “Se adjunta escrito con la explicación de la denuncia. Chatarrera y botadero con funcionamiento ilegal y perjudicial para la comunidad a su alrededor. Afecta la salud pública con la expansión de plagas, malos olores, además afecta la salud de las personas que habitan en los alrededores”; además, en el documento adjunto formuló la siguiente petitoria: “1.- Que se haga una inspección para comprobar nuestro decir y se nos señale que (sic) acciones se harán para resolver la problemática denunciada. 2.- Se solicita al Ministerio de Salud que envíe orden sanitaria a la Municipalidad de Alajuelita y al propietario del inmueble para que recoja los residuos que se encuentran en el botadero y chatarrero para llevarlos a un sitio donde les den un tratamiento adecuado”.
A esta denuncia se le asignó el consecutivo 110-24 y en ella señaló el correo para notificaciones [email protected]. El 28 de noviembre de 2024, un funcionario del Ministerio de Salud llamó en tres ocasiones a la denunciante “para identificar la problemática”, pero no obtuvo respuesta. El 28 de noviembre de 2024 se consignó en el acta de inspección A-059-2024 que se procuró contactar a la denunciante, pero no contestó; asimismo, que no se encontró el lugar denunciado. El 29 de noviembre de 2024 se consignó en el acta de inspección A-065-2024 con respecto a la dirección: “200 m este del pequeño (sic) mundo (sic) de Alajuelita”: “Hay un taller en la zona, no tiene PSF, se realizan actividades de trituración de residuos plásticos, similar a un gestor autorizado de residuos sólidos, sin embargo no cuentan con permiso sanitario de funcionamiento, lo cual incumple del Decreto Ejecutivo N ̊ 43432.

El 3 de diciembre de 2024 se consignó en el acta de inspección A-067-2024, que, con ocasión de la denuncia 110-29 se clausuró la “chatarrera sin permiso”. El 3 de diciembre de 2024 se emitió el acta de clausura MS-DRRSCS-ARSAL-1169-2024, en la que se consignó: “El suscrito, Bach.
Mauricio Díaz Chavarría, Gestor Ambiental, funcionario del Ministerio de Salud, del Área Rectora de Salud de Alajuelita, ha procedido a efectuar la clausura del establecimiento: Chatarrera Sin Permiso Sanitario de Funcionamiento situado en Urba Alajuelita catastro N ̊ 2018-70247-C (…), acción que se toma con base en el ACTA DE INSPECCIÓN OCULAR N ̊ A-067-2024 de fecha 03/12/2024 (…)”.
Además, en cuanto a la Municipalidad de Alajuelita, se comprobó que el 13 de setiembre de 2024 recibió una denuncia planteada por las personas aquí accionantes, en la que expusieron que la operación de un “botadero y chatarrería de basura” ubicado “500 mts sudeste del Pequeño Mundo de Alajuelita (…), distrito Horizontes, a mano izquierda colindante con el río Tiribí” que funciona sin autorizaciones ni permisos, afecta a las personas y contamina el ambiente al no cumplir estándares técnicos; además, formularon las siguientes pretensiones: “1.- Que se haga una inspección para comprobar nuestro decir y se nos señale qué acciones se harán para resolver la problemática denunciada. 2.- Se solicita a la alcaldía que recojan los residuos y que los envíen a un sitio que les den el tratamiento adecuado. Si es al MinSa se pide que envíen orden sanitaria a la Muni (sic) y al propietario para que recoja los residuos para llevarlos a un sitio.
(…) 3.- Pedimos que de ser procedente se clausure el lugar. Y se recomiendo (sic) a la Municipalidad se desarrolle algún proyecto para el disfrute de los vecinos del cantón, o bien, que se restauré (sic) el pasaje con el fin de mantener el cuidado del Río colindante”. En esta denuncia se señalaron los medios para recibir notificaciones [email protected] o [email protected]. Por otra parte, no se constató que la Municipalidad de Alajuelita les haya notificado a las personas recurrentes alguna resolución de la denuncia planteada el 13 de setiembre de 2024. Tampoco que el Ministerio de Salud le haya notificado a [Nombre 003] alguna resolución de la denuncia formulada el 13 de setiembre de 2024.
Desde este panorama, en los términos planteados en el escrito de interposición, procede declarar parcialmente con lugar el recurso.
Si bien, se observa que, más de dos meses después de planteadas las denuncias y durante la tramitación de este proceso, las autoridades recurridas clausuraron el sitio aludido en el sub examine, no se observa que hayan analizado, cada una dentro del ámbito de sus competencias, los problemas aludidos sobre el manejo de los residuos existentes, la posible afectación ambiental, la supuesta contaminación del río y los referidos inconvenientes de salud pública. Nótese que tanto el órgano ministerial como el ayuntamiento se limitaron a exponer sus actuaciones relacionadas con la clausura del local; empero, no resolvieron en sede administrativa lo correspondiente al resto de aspectos mencionados en las gestiones. Incluso, ni siquiera demostraron haber notificado a las personas accionantes la resolución de las denuncias en cuanto a los problemas mencionados ut supra.
En consecuencia, como lo denunciado podría tener implicaciones ambientales y de salud pública, la intervención de la Sala se vuelve necesaria a fin de que, dentro de un plazo razonable, se valoren tales aspectos y se les notifique a las partes gestionantes lo correspondiente. De ahí que se acredita la transgresión al numeral 41 de la Constitución Política, por cuanto las gestiones no han sido atendidas dentro de un plazo célere, las cuales, debido a su contenido, tienen relevancia a los efectos del artículo 50 eiusdem.
Por otra parte, aun cuando las personas accionantes acusan que no aparece el expediente en la municipalidad, no menos cierto es que no mencionaron las fechas en que presuntamente lo solicitaron, ni tampoco aportaron alguna gestión al respecto. Ergo, prima facie se descarta alguna transgresión en ese sentido, susceptible de ser declarada en este recurso de amparo. Asimismo, si consideran que los problemas que denunciaron deben ser resueltos de una forma determinada, o bien, que se les deben aclarar los motivos por los cuales las autoridades no han actuado, pueden plantear los alegatos y gestiones que estimen pertinentes en sede administrativa.
VI.Nota del Magistrado Salazar Alvarado. Considero que asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente asegura haber denunciado -entre otros aspectos- ante la municipalidad recurrida la operación de un “botadero y chatarrería de basura” que funciona sin las debidas autorizaciones legales y en clara violación de la normativa ambiental, lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida a la amparada y demás vecinos.
VII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso. Se ordena a María del Rosario Siles Fernández y Roberto Madrigal Abarca, por su orden alcaldesa de Alajuelita y director del Área Rectora de Salud de Alajuelita del Ministerio de Salud, o a quienes ocupen tales cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se analicen íntegramente las situaciones denunciadas en las gestiones del 13 de setiembre de 2024 (en relación con el manejo de los residuos existentes, la posible afectación ambiental, la aludida contaminación del río y los referidos problemas de salud pública) y, de resultar procedentes, se emitan los actos administrativos correspondientes. Asimismo, se les ordena a tales autoridades, resolver las gestiones planteadas por las personas gestionantes en cuanto a los problemas mencionados ut supra, lo cual implica comunicar las acciones llevadas a cabo y las medidas tomadas dirigidas a atender las situaciones denunciadas, lo cual les deberá ser notificado dentro del mismo plazo otorgado ut supra a los medios señalados para tales efectos.
Se advierte a las autoridades recurridas que, de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Alajuelita al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. En lo demás, se declara sin lugar el recurso. El magistrado Salazar Alvarado consigna nota. Notifíquese.
