Amparo proceeding (recurso de amparo) processed under case file no. 24-027381- 0007-CO, filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE TARRAZÚ.

Background:

  1. 1By a filing entered into the case record on October 1°, 2024, the claimant filed an amparo proceeding against the Municipalidad de Tarrazú. She states that in 2017 a complaint was filed with the respondent municipality concerning stormwater (aguas pluviales) from a large part of the community of Las Tres Marías, in San Marcos de Tarrazú, passing through her property, where her home is located. She indicates that, at that time, this water was creating a large hole at the rear of her property because of its gradient, flow rate, and force. She states that this caused standing water, which produced foul odors and disease vectors and, during periods of heavy rainfall, caused flooding in her home. She recounts that, on that occasion, the municipality inspected the site and installed corrugated PVC piping up to the boundary of her property, which resolved those problems. She adds, however, that this water crosses her entire property—through the center and along one side—and that the replacement of the piping in 2017 extended only to the boundary; that is, the section crossing her property was not replaced with that piping and, to this day, still consists of concrete culverts (alcantarillas) installed more than 30 years ago.She indicates that on September 10, 2023, she filed a new complaint with Mr. Fernando Portuguez, who was deputy mayor at the time, because the problem had worsened. She states that earthworks (movimientos de tierra) resulting from the passage of time, earthquakes, rainfall, etc., have caused gaps to open at all or almost all the culvert joints—some of which cannot be seen—causing the surrounding soil to be eroded by the force of the water and the areas of erosion to grow increasingly larger. She recounts that some of these culverts are located approximately 0.6 meters from the foundations of her home, causing them to weaken over time. She adds that, in addition, during the rainy season this water escapes from the culverts and seeps into the house’s drainage system, causing it to become saturated. Consequently, during that season it is very difficult for the drainage system to function properly and, on several occasions when there has been heavy rainfall for several days, water has overflowed through the toilet, causing minor flooding inside the house with wastewater (aguas residuales).She adds that, following this request, the municipality told them that it would conduct an inspection the following day; however, the municipal representatives did not appear. She indicates that one month later, she and her daughter, Sheyla Rosales, went to the municipal offices to speak with the mayor and deputy mayor, where they presented evidence of what this water was doing to her property and again raised the problems mentioned above. She states that, that same day, the deputy mayor, Mr. Fernando Portugués, and environmental manager Maikel Gamboa inspected the property and confirmed that her statements were accurate. She recounts that, following that inspection, they undertook to send a report on the visit; however, the report was never received. She adds that on March 15, 2024, her children sent an email to the municipality to follow up on the matter, restating the situation and adding a new problem, since they had recently discovered that upstream neighbors were discharging their wastewater into this watercourse (cauce de agua).She indicates that on April 1°, 2024, engineers Yenifer Mora Mora and Estiven Monge Vargas of the Departamento de Gestión Vial de la Municipalidad came to her home in response to the letter sent by her children. She states that, following the inspection, they sent them the report attached as evidence, containing the solution proposed by the municipality. That solution provides for a project costing 28 million colones that would close off this watercourse in the upper part of the neighborhood, diverting it toward the La Rosita 1 and La Rosita 2 sector. For that purpose, they must request the allocation of resources from the Concejo de Distrito because no budget is available. She recounts that it should be noted that La Rosita 1 and 2 have the same problem, because old pipelines carrying large volumes of stormwater also run beneath several homes and through their properties, causing serious problems every winter.She adds that this proposal does not resolve the problem comprehensively because it does not address what will happen to the wastewater from the upstream residents of Las Tres Marías and, moreover, closing off the watercourse would worsen the problem in the neighboring community. She indicates that on April 03, 2024, her daughter was informed that a copy of the project would be sent to the Concejo de Distrito and that it was being followed up on. She states that on August 08, 2024, her daughter contacted the president of the Concejo, who said that they had been addressing projects dating from 2018 onward and that this project was relatively new, and that he would contact the relevant parties to determine whether the project was under evaluation; however, they have not yet received a response.
  2. 2By a decision issued at 16:36 on October 3, 2024, the Presidency of the Chamber admitted the proceeding and requested a report from the mayor of Tarrazú.
  3. 3By a filing entered into the case record on October 14, 2024, Fernando Portuguez Parra, mayor of Tarrazú, reports: “Regarding the allegations made by Ms. [Name 001] in the amparo proceeding, it is important to bear in mind that the Municipalidad de Tarrazú has done everything within its power, since this is a private water passage and the Municipality cannot invest public funds on private property. Furthermore, each property owner is responsible for managing the water on their property. She states that she receives water from properties located at higher elevations, which is inherent to the topography of the land. Regarding the wastewater and sanitary sewage (aguas negras) that the lady states flow through that passage, under the Reglamento de Vertido y Reúso de aguas Residuales these fall within the jurisdiction of the Ministerio de Salud, as the Gestor Ambiental informed the appellant at the time.It is also essential to recall that the persons generating such wastewater bear primary responsibility for it. In official letter MT-GVM-ING-368-2024 from the Departamento de Gestión Vial Municipal, Engineer Yenifer Mora states verbatim: ‘It should be noted that, according to the inspection conducted in the sector, the greatest impact is caused by stormwater from the roofs of neighboring homes and properties, combined with wastewater, which does not fall within the jurisdiction of the Departamento de Gestión Vial.’ The Municipality has carried out the appropriate follow-up and proposed a project to somewhat mitigate the impact that the lady states she is experiencing. However, we must remember that public funds are involved and that everything is subject to due process, which the appellant was informed would have to be pursued. The Municipality submitted the matter to the Concejo de Distrito, whose members informed Doña Virginia that they were processing several projects and would inform her regarding that request.It is evident that very little time has elapsed between the submission to the Departamento de Gestión Vial and the present date for any adverse impact attributable to the Municipality to be alleged. Official letter GA-0154-2024 from the Departamento de Gestión Ambiental, containing the inspection report, is attached, as is report MT-GVM-ING-368-2024 from the Departamento de Gestión Vial Municipal.”
  4. 4The statutory requirements have been observed in the proceedings conducted.

Justice Alvarado Paniagua authored the opinion; and,

Considerations:

I. PRELIMINARY MATTER

Before analyzing the merits of the case—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since judgment no. 2008-02545 issued at 8:55 on February 22, 2008, this Chamber has referred to the administrative-law courts, with certain exceptions, matters involving disputes over whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at a party’s request—through a final decision or to hear the applicable administrative appeals. This case presents precisely such an exception, as supported by the majority of this Constitutional Court, because it concerns a petition filed by an older adult regarding a flooding problem in her home that has not been addressed within a reasonable period. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.

II. SUBJECT MATTER OF THE PROCEEDING

The appellant states that, since 2017, she has reported to the respondent municipality the passage of stormwater through her property, which causes standing water and flooding during heavy rainfall. She maintains that the culverts and pipelines were installed more than 30 years ago and have not been replaced. She emphasizes that on September 10, 2023, she filed a new petition with the respondent authority concerning the aforementioned situation because the problem had worsened; moreover, her daughter, Sheyla Rosales, went to the municipality to explain the situation again. She states that in April 2024, officials of the respondent local government conducted an inspection and determined that certain works were required; nevertheless, by the time she filed this amparo proceeding, the works had not been carried out, and the problem therefore persists.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the resolution of this matter:

  • a)The protected party is an older adult, 70 years of age. (Search conducted on the Tribunal Supremo de Elecciones website).
  • b)Through official letter no. ATI-100-2024 dated March 15, 2024, the Departamento de Gestión Vial of the respondent local government stated: “An inspection was conducted in the sector where the applicant’s home is located, and it was confirmed that an existing stormwater drainage system (alcantarillado) carries water from the Santa Cecilia sector. The drainage system currently exhibits undermining (socavación) problems and causes neighboring homes to sustain damage from water escaping from it. The solution to the problem is to close off the drainage system that runs through all the homes and redirect it through the old Asturiano road sector to national route 226. The project requires the installation of a 30-inch drainage system in the sector indicated in the sketch; it would have a length of 180 linear meters, together with the corresponding repair of the roadway surface, and must also include the necessary inspection chambers and structural concrete components. ₵28.000.000,00 is required to carry out this project; accordingly, the report is being sent to the district council for the appropriate consideration of a resource allocation.” (Documentary evidence).
  • c)The respondent authority was notified of the decision admitting this proceeding on October 8, 2024. (Notices of service added to the case record).

IV. UNPROVEN FACTS

Of significance to the resolution of this matter, it is deemed unproven that the respondent authority carried out the works described in official letter no. ATI-100-2024 to resolve the problem alleged by the petitioner.

V. THE SPECIFIC CASE

In the case at bar, the petitioner states that, since 2017, she has reported to the respondent municipality the passage of stormwater through her property, which causes standing water and flooding during heavy rains. She maintains that the culverts and pipes were installed more than 30 years ago and have not been replaced. She emphasizes that on September 10, 2023, she filed a new request with the respondent authority regarding the aforementioned situation, since the problem had worsened; moreover, her daughter, Sheyla Rosales, went to the municipality to explain the situation again. She states that, in April 2024, officials of the respondent local government conducted an inspection and determined that certain works were necessary; however, when she filed this amparo action (recurso de amparo), they had not been performed, and the problem therefore persists.

The case record establishes that the protected person is an older adult over 70 years of age. By official letter no. ATI-100-2024 of March 15, 2024, the Departamento de Gestión Vial of the respondent local government stated: “An inspection was conducted in the area of the applicant’s residence, and it was confirmed that an existing stormwater sewer carries water from the santa Cecilia area. The sewer is currently experiencing scouring problems and causes neighboring homes to suffer damage from water overflowing from it. The solution to the problem is to seal off the sewer that crosses all the residences and redirect it through the calle antigua asturiano area, discharging onto national route 226. The project requires the construction of a 30-inch sewer in the area shown on the sketch; it will have a length of 180 linear meters, with the corresponding repair of the roadway surface, and must also include the necessary manholes and structural concrete elements.

This project requires ₵28.000.000,00; the report is therefore being sent to the consejo de distrito for the appropriate consideration of funding allocation.” The respondent authority was served with the order admitting this proceeding on October 8, 2024. Furthermore, it has not been established that the respondent authority carried out the works described in official letter no. ATI-100-2024 to resolve the problem alleged by the petitioner.

In this regard, the need for intervention by this constitutional jurisdiction is established.

The record confirms that, at least since March 2024, the respondent authority has had detailed knowledge of the stormwater problem affecting the protected person, since the relevant on-site inspection was conducted and report no. ATI-100-2024 of March 15 of the current year stated: “it was confirmed that an existing stormwater sewer carries water from the santa Cecilia area. The sewer is currently experiencing scouring problems and causes neighboring homes to suffer damage from water overflowing from it.” Likewise, the following solution to the problem was specified: “The solution to the problem is to seal off the sewer that crosses all the residences and redirect it through the calle antigua asturiano area, discharging onto national route 226. The project requires the construction of a 30-inch sewer in the area shown on the sketch; it will have a length of 180 linear meters, with the corresponding repair of the roadway surface, and must also include the necessary manholes and structural concrete elements.” Nevertheless, at the time the action was filed—that is, approximately 7 months later—there was no indication that the respondent authority had performed the referenced works or had even undertaken any action or proceeding to begin such work.

Accordingly, in view of the harm that the protected person (an older adult) states she is suffering as a result of flooding in her home, the action is granted for the violation of Articles 41 and 50 of the Constitution.

Therefore, the action is granted as to this claim, under the terms stated in the operative portion of this judgment.

Finally, although the petitioner also refers in her initial filing to a wastewater problem attributable to local residents, the record does not indicate that this situation was reported to the Ministerio de Salud, the governing authority in that field. Indeed, the action was filed solely against the respondent local government, which likewise notes that, regarding this matter, the petitioner must apply to the aforementioned health authority. Therefore, as to this specific issue, no omission subject to a declaration in this summary proceeding is apparent.

VI. PARTIAL DISSENTING OPINION OF JUSTICE GARRO VARGAS REGARDING THE OPERATIVE PORTION OF THIS JUDGMENT

Although I agree with the majority of the Chamber that the action should be granted, I disagree as to the forum in which the enforcement stage should be conducted, due to the absence of adequate mechanisms under the rules governing this constitutional jurisdiction for monitoring a judgment involving highly complex technical matters, as in this case, since the order requires that, within six months from service of this judgment, the stormwater problem alleged by the petitioner be resolved in accordance with report no. ATI-100-2024 of March 15, 2024. In this context, the provisions of the Código Procesal Contencioso-Administrativo regarding enforcement (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, determine liability, oversee stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement stage should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any document in paper form, as well as any objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, they must retrieve them from the Court within no more than 30 business days from service of this judgment. The parties are warned that any material not retrieved within that period will be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Article XXVI of session no. 27-11 of August 22, 2011, published in Boletín Judicial no. 19 of January 26, 2012, and the decision of the Consejo Superior del Poder Judicial, approved in Article LXXXI of session no. 43-12 held on May 3, 2012.

Por tanto:

The action is partially granted. Fernando Portuguez Parra, in his capacity as mayor of Tarrazú, or whoever holds that office, is ordered to undertake the appropriate coordination, adopt the necessary measures, and issue the corresponding orders within the scope of his authority so that, within SIX MONTHS from service of this judgment, the stormwater problem alleged by the petitioner is resolved in accordance with report no. ATI-100-2024 of March 15, 2024. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order issued in an amparo action that they must comply with or cause to be complied with, and who fails to comply with it or cause compliance with it, provided that the offense is not subject to a more severe penalty.

The Municipalidad de Tarrazú is ordered to pay the legal costs and the damages and losses caused by the events on which this ruling is based, which shall be assessed during enforcement of the judgment in the contentious-administrative jurisdiction. In all other respects, the action is denied. Justice Garro Vargas dissents regarding the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded so that proceedings to enforce this ruling may be commenced. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veinte de diciembre de dos mil veinticuatro .

Recurso de amparo que se tramita en el expediente nro. 24-027381- 0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE TARRAZÚ.

Resultando:

  1. 1Por escrito incorporado al expediente el 1° de octubre de 2024, la parte accionante interpone recurso de amparo contra la Municipalidad de Tarrazú. Manifiesta que en 2017 se planteó una queja ante la municipalidad accionada, por el paso de aguas pluviales de gran parte de la comunidad de Las Tres Marías, en San Marcos de Tarrazú dentro de su propiedad, en donde se encuentra su casa de habitación. Indica que dichas aguas, en aquel momento, estaban provocando un gran hueco en la parte posterior de su propiedad, producto del gradiente, el caudal y la fuerza de estas aguas. Manifiesta que esto generaba estancamientos de agua, que producían malos olores y vectores, y en episodios fuertes de lluvias, causaba inundaciones en su casa de habitación. Narra que en aquella ocasión la municipalidad inspeccionó el lugar e instaló un tubo corrugado de PVC hasta el lindero de su propiedad, lo cual, resolvió dichos problemas.Agrega que, sin embargo, estas aguas atraviesan toda su propiedad (por el centro y por un costado) y el reemplazo de la tubería en 2017 llegó hasta el lindero, es decir, el tramo que atraviesa su propiedad no fue reemplazado por esta tubería, el cual, mantiene hasta el día de hoy, alcantarillas de concreto que fueron colocadas hace más de 30 años. Indica que el 10 de setiembre de 2023, presentó una nueva queja ante el señor Fernando Portuguez (en su momento vicealcalde), debido a que el problema se había agravado. Manifiesta que movimientos de tierra producto del paso del tiempo, temblores, lluvias, etc, han provocado que se abran espacios en todas o casi todas las uniones de las alcantarillas (hay algunas que no pueden verlas), ocasionando que la tierra alrededor se vaya socavando por la fuerza del agua y haciendo los socavamientos cada más grandes. Narra que parte de estas alcantarillas se encuentran a aproximadamente 0.6 metros de distancia de los cimientos de su casa, provocando que estos se debiliten con el paso del tiempo.Agrega que, adicionado a esto, en la época lluviosa estas aguas se salen de las alcantarillas y se filtran dentro del drenaje de la casa, ocasionando que se sature el mismo; por lo cual en esa época es muy difícil que el drenaje funcione correctamente y en varias ocasiones cuando ha llovido en grandes cantidades y por varios días, el agua ha rebalsado el sanitario ocasionando pequeñas inundaciones dentro de la casa con aguas residuales. Agrega que, tras esta petición, de la municipalidad les indicaron que al día siguiente irían a hacer una inspección, sin embargo, los representantes de la municipalidad no se apersonaron. Indica que un mes después, se presentó con su hija (Sheyla Rosales) a las instalaciones de la municipalidad para conversar con la alcaldesa y vicealcalde, en donde se presentaron pruebas de lo que estas aguas están provocando en su propiedad, y se volvió a plantear los problemas mencionados anteriormente.Manifiesta que ese mismo día acudieron a inspeccionar el terreno el vicealcalde, el señor Fernando Portugués y el gestor ambiental, Maikel Gamboa, quienes verificaron que lo mencionado por él era correcto. Narra que luego de dicha inspección, se comprometieron a enviar un reporte de la visita; sin embargo, este reporte no llegó. Agrega que el 15 de marzo de 2024, sus hijos enviaron un correo electrónico a la municipalidad para retomar este tema, replanteando la situación y agregando además, un nuevo problema, pues, recién descubrieron que vecinos aguas arriba, disponen sus aguas residuales a este cauce de agua. Indica que el 1° de abril de 2024, se presentó a su casa de habitación los ingenieros Yenifer Mora Mora y Estiven Monge Vargas, del Departamento de Gestión Vial de la Municipalidad, quienes acudieron a la carta enviada por sus hijos. Manifiesta que, tras la inspección, les enviaron el informe que se adjunta como prueba, con la solución propuesta por la municipalidad, la cual, contempla un proyecto por 28 millones de colones que condenará este cauce en la parte alta del barrio, desviándolo hacia el sector de La Rosita 1 y La Rosita 2 y, para lo cual, deben solicitar ante el Concejo de Distrito la asignación de los recursos, pues, no se tiene el presupuesto.Narra que cabe mencionar que La Rosita 1 y 2, tienen el mismo problema, pues, también antiguas tuberías que transportan caudales voluminosos de aguas pluviales atraviesan varias casas de habitación por debajo y sus propiedades, provocándoles serios problemas cada invierno. Agrega que esta propuesta no resuelve el problema de una manera integral, pues, no menciona qué pasará con las aguas residuales de los vecinos aguas arriba de las Tres Marías y además, al condenar el cauce, incrementaría el problema del poblado vecino. Indica que el 03 de abril de 2024 se le informó a su hija que se le enviaría una copia del proyecto al Concejo de Distrito y que le están dando seguimiento. Manifiesta que su hija se comunicó el 08 de agosto de 2024 con el presidente del Concejo, quien mencionó que han estado tomando proyectos de 2018 en adelante y que este proyecto es relativamente nuevo, además que él se comunicará para ver si este proyecto está en evaluación; sin embargo, aún no han recibido respuesta.
  2. 2Mediante resolución de las 16:36 horas de 3 de octubre de 2024, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al alcalde de Tarrazú.
  3. 3Por escrito incorporado al expediente el 14 de octubre de 2024, Fernando Portuguez Parra, alcalde de Tarrazú, informa: “Respecto a lo que alega la señora [Nombre 001] en el recurso de amparo, es importante tener presente que la Municipalidad de Tarrazú a realizado todo lo que está a su alcance, ya que se trata de un paso de aguas privado y la Municipalidad no puede invertir fondos públicos en propiedad privada, además de que es responsabilidad de cada propietario el manejo de las aguas en su propiedad, señala que recibe aguas de fundos ubicados en posiciones más altas, lo cual es propio de la topografía del terreno. Con respecto a las aguas residuales y aguas negras que señala la señora que circulan por dicho paso, estas según lo establece el Reglamento de Vertido y Reúso de aguas Residuales, son competencia del Ministerio de Salud, como bien el Gestor Ambiental en su momento se lo manifestó a la recurrente, además es sustancial recordar que el principal responsable de estas son las personas que las generan.En oficio MT-GVM-ING-368-2024 del Departamento de Gestión Vial Municipal, la Ingeniera Yenifer Mora textualmente indica: “Cabe mencionar que, según la inspección realizada al sector, la afectación mayor la generan las aguas pluviales de techos de viviendas y propiedades aledañas, asociado con aguas residuales, lo cual no es competencia del Departamento de Gestión Vial.” La Municipalidad le ha dado el seguimiento correspondiente, hizo una propuesta de un proyecto para solucionar un poco la afectación que indica la señora que está sufriendo, pero recordemos que estamos hablando de fondos públicos, y todo tiene su debido proceso, el cual se le informo a la recurrente que se debía gestionar, la Municipalidad hizo el trámite ante el Concejo de Distrito quienes le informaron a Doña Virginia que están sacando varios proyectos y que le informarían sobre esa solicitud, es evidente que desde que se hizo la gestión ante el Departamento de Gestión Vial a la fecha ha paso muy poco tiempo como para alegar alguna afectación por parte de la Municipalidad. Se adjunta oficio GA-0154-2024 del Departamento de Gestión Ambiental con el informe de la inspección, así como el informe del Departamento de Gestión Vial Municipal MT-GVM-ING-368-2024.”.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Alvarado Paniagua; y,

Considerando:

I. CUESTIÓN PREVIA

De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción -respaldado por la mayoría de este Tribunal Constitucional-, pues se está ante una gestión planteada por una persona adulta mayor en relación con una problemática de inundaciones en su vivienda que no ha sido atendida dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La recurrente manifiesta que desde 2017 ha denunciado ante la municipalidad accionada la situación del paso de aguas pluviales por su propiedad, lo cual provoca estancamientos de agua e inundaciones por las fuertes lluvias. Sostiene que las alcantarillas y tuberías fueron colocadas hace más de 30 años y no han sido reemplazadas. Resalta que el 10 de septiembre de 2023 presentó una nueva gestión ante la autoridad accionada por la situación referida, toda vez que el problema se había agravado; además, su hija, Sheyla Rosales acudió a la municipalidad a exponer nuevamente la situación. Expone que, en abril de 2024, funcionarios del gobierno local accionado efectuaron una inspección y determinaron la necesidad de realizar determinadas obras; empero, al momento en que acude en amparo no se había realizado, por lo que continúa la problemática.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)La amparada es una persona adulta mayor de 70 años. (Consulta en la página web del Tribunal Supremo de Elecciones).
  • b)Por medio del oficio nro. ATI-100-2024 de 15 de marzo de 2024, el Departamento de Gestión Vial del gobierno local accionado detalló: “Se realiza inspección en el sector de la casa de habitación de la solicitante y se verifica que se encuentra un alcantarillado existente de aguas pluviales provenientes del sector de santa Cecilia. El alcantarillado presenta problemas de socavación actualmente y provoca que las casas de los vecinos sufran daños por el agua que se sale del mismo. La solución al problema es condenar el alcantarillado que atraviesa todas las casas de habitación y direccionarlo por el sector de la calle antigua asturiano a salir a la ruta nacional 226. Para el proyecto se debe de realizar un alcantarillado de 30 pulgadas en el sector indicado en el croquis; el mismo tiene una longitud de 180 metros lineales con la respectiva reparación de la superficie de ruedo y también incluir cajas de registro necesarias y figuras en concreto estructural. Para poder realizar este proyecto se necesitan ₵28.000.000,00; por lo que se envía el informe al consejo de distrito para el debido estudio de asignación de recursos.”. (Prueba documental).
  • c)La autoridad accionada fue notificada de la resolución de curso de este proceso el 8 de octubre de 2024. (Actas de notificación agregadas al expediente).

IV. HECHOS NO PROBADOS

De importancia para la resolución de este asunto, se estima como no demostrado que la autoridad accionada hubiese realizado las obras descritas en el oficio nro. ATI-100-2024 para resolver la problemática acusada por la accionante.

V. SOBRE EL CASO CONCRETO

En el sub lite, la recurrente manifiesta que desde 2017 ha denunciado ante la municipalidad accionada la situación del paso de aguas pluviales por su propiedad, lo cual provoca estancamientos de agua e inundaciones por las fuertes lluvias. Sostiene que las alcantarillas y tuberías fueron colocadas hace más de 30 años y no han sido reemplazadas. Resalta que el 10 de septiembre de 2023 presentó una nueva gestión ante la autoridad accionada por la situación referida, toda vez que el problema se había agravado; además, su hija, Sheyla Rosales acudió a la municipalidad a exponer nuevamente la situación. Expone que, en abril de 2024, funcionarios del gobierno local accionado efectuaron una inspección y determinaron la necesidad de realizar determinadas obras; empero, al momento en que acude en amparo no se había realizado, por lo que continúa la problemática.

Del estudio de los autos se tiene por demostrado, que la amparada es una persona adulta mayor de 70 años. Por medio del oficio nro. ATI-100-2024 de 15 de marzo de 2024, el Departamento de Gestión Vial del gobierno local accionado detalló: “Se realiza inspección en el sector de la casa de habitación de la solicitante y se verifica que se encuentra un alcantarillado existente de aguas pluviales provenientes del sector de santa Cecilia. El alcantarillado presenta problemas de socavación actualmente y provoca que las casas de los vecinos sufran daños por el agua que se sale del mismo. La solución al problema es condenar el alcantarillado que atraviesa todas las casas de habitación y direccionarlo por el sector de la calle antigua asturiano a salir a la ruta nacional 226. Para el proyecto se debe de realizar un alcantarillado de 30 pulgadas en el sector indicado en el croquis; el mismo tiene una longitud de 180 metros lineales con la respectiva reparación de la superficie de ruedo y también incluir cajas de registro necesarias y figuras en concreto estructural.

Para poder realizar este proyecto se necesitan ₵28.000.000,00; por lo que se envía el informe al consejo de distrito para el debido estudio de asignación de recursos.”. La autoridad accionada fue notificada de la resolución de curso de este proceso el 8 de octubre de 2024. Por otra parte, no se tiene por demostrado que la autoridad accionada hubiese realizado las obras descritas en el oficio nro. ATI-100-2024 para resolver la problemática acusada por la accionante.

Sobre el particular, se constata la necesidad de intervención de esta jurisdicción constitucional.

Al respecto, se verifica que, al menos desde marzo de 2024, la autoridad accionada conoce en detalle la problemática de aguas pluviales que afecta a la tutelada, pues se realizó la respectiva inspección en el sitio y a través del informe nro. ATI-100-2024 de 15 de marzo del año en curso, se consignó: “se verifica que se encuentra un alcantarillado existente de aguas pluviales provenientes del sector de santa Cecilia. El alcantarillado presenta problemas de socavación actualmente y provoca que las casas de los vecinos sufran daños por el agua que se sale del mismo.”. Asimismo, como solución al problema se indicó: “La solución al problema es condenar el alcantarillado que atraviesa todas las casas de habitación y direccionarlo por el sector de la calle antigua asturiano a salir a la ruta nacional 226. Para el proyecto se debe de realizar un alcantarillado de 30 pulgadas en el sector indicado en el croquis; el mismo tiene una longitud de 180 metros lineales con la respectiva reparación de la superficie de ruedo y también incluir cajas de registro necesarias y figuras en concreto estructural.”.

Sin embargo, al momento de interposición del recurso -sea, aproximadamente 7 meses después- no se verifica que la autoridad accionada hubiese realizado las obras referidas; ni siquiera alguna gestión o diligencia para iniciar con tales trabajos.

De tal manera, en consideración a la afectación que indica estar sufriendo la tutelada (persona adulta mayor) por las inundaciones en su vivienda, se declara con lugar el recurso por la transgresión a los ordinales 41 y 50 constitucionales.

Ergo, se declara con lugar el recurso en relación con este extremo, en los términos que se indican en la parte dispositiva de este pronunciamiento.

Finalmente, si bien en su escrito de interposición la recurrente también hace alusión a un problema de aguas residuales atribuible a vecinos de la localidad, no se desprende que tal situación se haya denunciado ante el Ministerio de Salud, ente rector en dicha materia. En tal sentido, incluso el recurso es interpuesto únicamente en contra del gobierno local accionado, quien también advierte que sobre tal aspecto deberá la accionante acudir ante la autoridad sanitaria referida. Ergo, respecto de este punto en particular no se observa omisión alguna susceptible de ser declarada en esta vía sumaria.

VI. VOTO SALVADO PARCIAL DE LA MAGISTRADA GARRO VARGAS RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA

Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso, puesto que, en el plazo de seis meses, contado a partir de la notificación de esta sentencia, se ordena solucionar la problemática relativa a las aguas pluviales acusada por la recurrente, según lo señalado en el informe nro. ATI-100-2024 de 15 de marzo de 2024. En este contexto, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Por tanto:

Se declara parcialmente con lugar el recurso. Se ordena a Fernando Portuguez Parra, en su condición de alcalde de Tarrazú, o a quien ocupe ese cargo, que coordine lo pertinente, tome las medidas necesarias y gire las órdenes correspondientes dentro del ámbito de sus competencias, para que, en el plazo de SEIS MESES contado a partir de la notificación de esta sentencia, se solucione la problemática relativa a las aguas pluviales acusada por la recurrente, según lo señalado en el informe nro. ATI-100-2024 de 15 de marzo de 2024. Se le advierte a la autoridad recurridas que, según lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Tarrazú al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso-administrativo. En lo demás, se declara sin lugar el recurso. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
