Document Review Decision No. 2024035644 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty in the morning on veintinueve de noviembre de dos mil veinticuatro.

Constitutional protection action (recurso de amparo) processed under case number 24- 031126-0007-CO, filed by [Nombre 001], identification card [Valor 001], against the MINISTERIO DE SALUD and the MUNICIPALIDAD DE MONTES DE ORO Background:

  1. 1In a written submission entered into this Court’s Online Management System on 05 de noviembre de 2024, the petitioner filed a constitutional protection action against the Ministerio de Salud and the Municipalidad de Montes de Oro. She states that she owns property located in the province of Puntarenas, specifically in Montes de Oro. She indicates that the land has been adversely affected because, in response to stormwater (aguas pluviales) problems several years ago, the municipality channeled the water toward the culvert (alcantarilla) that discharges onto her property. In addition, she indicates that the culvert has neither a headwall (cabezal) nor the corresponding inspection chambers (cajas de registro), and lacks a gradient, causing it to discharge with great force the water collected from the roadside ditches (cunetas) along the streets surrounding her property. She adds that wastewater (aguas servidas) discharged by neighbors into the ditches mixes with this stormwater.She argues that, as a result, all the stormwater, wastewater, and soapy water reaches her property, causing damage to her property and endangering her own physical safety and that of the livestock grazing there. Furthermore, this causes a considerable environmental impact because the water stagnates, creating a public-health problem. For these reasons, she alleges that she filed a request with the Municipalidad de Montes de Oro on 3 de octubre de 2017, stating: “(…) I refer to the storm-sewer system (alcantarillado) that runs from the corner of the Banco Nacional westward. This sewer system drains toward my property, causing instability in the land and large channels through which the water flows, which could pose a risk to public health. Therefore, I request that the problem be resolved by piping or channeling the water with concrete and managing it appropriately so as to prevent further damage to my property and others (…)”.She states that she received a response to that request on 6 de marzo de 2018, informing her that only stormwater from a culvert crossing was discharged there, and that it was discharged from the lowest point of the land. She alleges that she renewed her request on 3 de setiembre de 2021, stating: “(…) I request that you resolve the problem by piping or channeling this water through ditches along the frontage of my property and managing it appropriately. By channeling the water westward from the bank, the municipality is preventing its natural flow and channeling it directly toward the properties, causing damage. At this time, I am directly affected because I cannot use the land for construction, which is a near-term project, and my cattle may also be injured by the channels (…)”. She indicates that, through official letter JVC No. 003-2022 of 11 de febrero de 2022, the municipality responded as follows: “(…) During that inspection, it was agreed that the JVC could carry out work to improve water management only within the boundaries of the public roadway.Most of the members, with copies to the Municipal Mayor’s Office and the UTGV Department, agreed that resources under ley 8114/9324 cannot be invested on private property. The site was therefore inspected, and the members of the JVC themselves, by general consensus, proposed the construction of a headwall with a grade break (quiebra gradiente), with an outlet (…) whose floor must be stone-paved (zampeado) to reduce the speed of the water, which flows naturally (…)”. Nevertheless, she complains that this work was not performed, causing the problem to worsen. In response, on 12 de abril de 2023, she filed a complaint with the Ministerio de Salud, stating: “(…) The neighbors across from my property allow wastewater to flow freely, and it makes its way onto my land. This causes public-health problems because there are foul odors, stagnant water, and mosquitoes. The problem is that it is not known which house or houses are allowing this water to flow freely toward my property.This complaint had been filed previously, but unfortunately the problem has not been resolved (...)”. Nevertheless, she asserts that neither the Municipalidad de Montes de Oro nor the Ministerio de Salud has definitively resolved the reported problem, thereby violating her fundamental rights. She requests the intervention of this Constitutional Court to compel those entities to resolve the complaints filed.
  2. 2In a written submission dated 14 de noviembre de 2024, Dr. Carolina Lizeth Guillén Meléndez, director of the Dirección del Área Rectora de Salud Montes de Oro, reports as follows: a) On 18 de abril del 2023, the authorities of the Dirección del Área Rectora de Salud de Montes de Oro received a complaint concerning wastewater runoff (escurrimiento de aguas servidas) passing through the property of Ms. [Nombre 001], stating that it causes public-health problems because there are foul odors, stagnant water, and mosquitoes. According to the complaint, it is not known from which residence the wastewater is flowing (pages 00002, 00003). b) The foregoing complaint was registered under case number 23051 (page 00001). c) The authorities of the Área Rectora de Salud Montes de Oro conducted the respective inspections concerning the reported matter on 18 de julio del 2023 and 04 de abril del 2024, and administrative acts (actos administrativos) were served on 28 de octubre del 2024 (pages 00004, 00005, 00006, 00007, 00008, 00009, 00010, 00011, 00012, 00013, 00014, 00015,00034, 00035, 00036, 00037, 00038, 00039, 00040, 00041). d) Regarding the allegations made by the petitioner: 1-.The authorities of the Dirección del Área Rectora de Salud de Montes de Oro first addressed the complaint on 18 de julio del año 2023, together with the Municipal Mayor of the Municipalidad de Montes de Oro, Mr. Luis Alberto Villalobos Artavia; at the time of the visit, no stormwater or wastewater runoff through the storm-sewer system was observed (page 00004). 2.- Because it was not known which residence was discharging wastewater into the storm-sewer system, on 04 de abril del año 2024, the Health Regulation Environmental Officers (Gestoras Ambientales de Regulación de la Salud) of the Dirección del Área Rectora de Salud de Montes de Oro conducted house-by-house inspections in the reported area, performing dye tests to determine which residences had improper wastewater-disposal arrangements, and inspected a total of 10 homes (pages 00005, 00006, 00007, 00008, 00009, 00010, 00011, 00012, 00013, 00014). 3.- As a result of the inspections, it was established that 8 of the 10 homes visited improperly discharged wastewater, mainly from washing machines, utility sinks, and showers, into the storm-sewer system (pages 00015, 00016, 00017, 00018, 00019, 00020, 00021, 00022, 00023, 00024, 00025, 00026, 00027, 00028, 00029). 4.- On 28 de octubre del 2024, a health order (ordenamiento sanitario) was served on 04 of the homes found to be improperly discharging wastewater into the storm-sewer system, requiring that, within 30 business days, wastewater from the property’s washbasins, utility sinks, showers, washing machines, or similar fixtures be conveyed to an appropriate wastewater-treatment system.This was intended to prevent the spread of foul odors, the stagnation of wastewater, and the proliferation of animals or disease vectors that could affect the health or safety of persons; such water is prohibited from flowing along the public gutter or onto third-party properties (pages 00030, 00031, 00032, 00033, 00035, 00037, 00038, 00039). 5.- The remaining 4 homes could not be served because no one was present at the residence at the time service was attempted, or because the property owner had died; it must therefore be determined who must currently be served (pages 00034, 00036, 00040,00041). 6.- On 13 de noviembre del 2024, Ms. [Nombre 001] was notified by email of the actions taken by this Área Rectora de Salud regarding the complaint filed (pages 00002, 00003, confidential case file).
  3. 3In a brief entered into the electronic case file on 18 de noviembre de 2024, Anthony Fallas Jiménez, mayor, and Erick Alpízar Mena, head of the Unidad Técnica de Gestión Vial, both of the Municipalidad de Montes de Oro, report as follows: 1.- Through official letter JVC N.° 003-2022, issued on 11 de febrero de 2022, a response was provided to the request submitted by Ms. [Nombre 001] and sent to the email address [...]. That communication informed her that a headwall with a grade break and an outlet consisting of concrete arms had to be constructed. See pages 01 through 04. 2.- For administrative and budgetary reasons, it was not possible to perform the work during the period originally scheduled. 3.- Through the Unidad Técnica de Gestión Vial, this Local Government has initiated a procedure (procedimiento) on the SICOP platform under number 0062024000700025. This process provides for the construction of a headwall and the installation of 200 meters of sewer piping, intended to mitigate the impact of the water on Ms. [Nombre 001]’s property.Evidence and images of the award process (proceso de adjudicación), as well as the tender specifications (pliego de condiciones), are also attached in support of the foregoing. The Unidad Técnica de Gestión Vial undertakes to address this situation and improve drainage conditions in the area, thereby seeking to help resolve the problems caused. Ms. [Nombre 001] will be kept informed of the project’s progress.
  4. 4The legal requirements have been observed in the proceedings conducted.

Justice Hess Herrera authored the decision; and,

Considering:

I. PRELIMINARY MATTER

Before examining the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso administrativa), with certain exceptions, those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by means of a final administrative act (acto final), or to hear the available administrative appeals (recursos administrativos). This case specifically presents such an exception because it concerns a complaint filed with the Ministerio de Salud and the Municipalidad de Montes de Oro regarding an environmental situation. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this constitutional protection action.

II. SUBJECT MATTER OF THE ACTION

- The petitioner states that she filed the corresponding complaints with the respondent authorities because stormwater, wastewater, and soapy water are discharged onto her property, causing damage to her property and endangering her own physical safety. Nevertheless, she asserts that neither the Municipalidad de Montes de Oro nor the Ministerio de Salud has definitively resolved the reported problem, thereby violating her fundamental rights.

III. PROVEN FACTS (HECHOS PROBADOS)

The following facts relevant to the decision in this matter are deemed duly established, either because they have been so proven or because the respondent failed to address them as ordered in the initial order:

REGARDING THE ACTIONS OF THE MINISTERIO DE SALUD.

  • a)On 18 April 2023, the Área Rectora de Salud de Montes de Oro received a complaint regarding sewage runoff (escurrimiento de aguas servidas) flowing through the property of the protected party (amparada), stating that it caused public-health problems because of foul odors, standing water, and mosquitoes. The complaint was registered under expediente number 23051. (see report submitted by the Área de Salud and evidence provided).
  • b)On 18 July 2023, the respondent Área Rectora conducted an inspection of the site together with the mayor of Montes de Oro. The inspection report stated, insofar as relevant: “(…) no water is observed flowing through the municipal sewer system; a damaged culvert is observed, and the mayor will therefore send personnel to remedy the situation. It is not raining at the time of the inspection.” (see report submitted by the Área de Salud and evidence provided).
  • c)On 04 April 2024, the respondent Área Rectora inspected 10 homes adjacent to the reported site and conducted a dye test (prueba de tintura) at each of them to determine which homes had improper wastewater disposal (disposición de aguas residuales). (see report submitted by the Área de Salud and evidence provided).
  • d)On 27 May 2024, the respondent authority issued 8 technical reports numbered as follows: N° MS-DRRSPC-DARSMO-IT-00078-2024, N° MS-DRRSPC-DARSMO-IT-00079-2024, N° MS-DRRSPC-DARSMO-IT-00080-2024, N° MS-DRRSPC-DARSMO-IT-00081-2024, N° MS-DRRSPC-DARSMO-IT-00082-2024, N° MS-DRRSPC-DARSMO-IT-00083-2024 and N° MS-DRRSPC-DARSMO-IT-00084-2024, in which it recommended issuing a sanitary order (orden sanitaria) to each of the homes visited, requiring that their wastewater be directed to an approved treatment system. (see report submitted by the Área de Salud and evidence provided).
  • e)On 28 October 2024, the respondent authority served sanitary orders on 04 of the homes found to be improperly discharging sewage into the storm sewer (alcantarillado pluvial), requiring them, within 30 business days, to direct wastewater from the property’s washbasins, utility sinks, showers, washing machines, or similar fixtures to an appropriate wastewater treatment system. This was intended to prevent the spread of foul odors, the accumulation of standing sewage, and the proliferation of animals or disease vectors that could affect people’s health or physical integrity. Such water was prohibited from flowing along the gutter of the public roadway or onto third-party properties. (see report submitted by the Área de Salud and evidence provided).
  • f)According to the respondent authority, the remaining 4 homes could not be served because no one was present at the residence when service was attempted or because the property owner had died; it was therefore necessary to determine who should currently be served. (see report submitted by the Área de Salud and evidence provided).
  • g)On 13 November 2024, the respondent authority notified the protected party of the actions taken. (see report submitted by the Área de Salud and evidence provided).

REGARDING THE ACTIONS OF THE MUNICIPALIDAD DE MONTES DE ORO.- h) On 11 February 2022, through official letter JVC N.° 003-2022, the respondent municipal entity replied to the request submitted by the protected party. The reply was sent to the email address [...]. That communication stated that a drainage headwall (cabezal) with a grade break and outlets through concrete arms had to be constructed. (see report submitted by the Municipalidad and evidence provided).

  • i)According to the respondent authority, the works could not be carried out within the originally scheduled period for administrative and budgetary reasons. (see report submitted by the Municipalidad and evidence provided).
  • j)On 08 November 2024, the Unidad Técnica de Gestión Vial of the respondent municipality initiated a proceeding on the SICOP platform under number 0062024000700025. This process provides for the construction of a headwall and the installation of 200 meters of sewer line to mitigate the impact of the water on the appellant’s property. (see report submitted by the Municipalidad and evidence provided).

IV.REGARDING THE ACTIONS OF THE MINISTERIO DE SALUD.- Based on the reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, subject to the consequences, including criminal penalties, provided for in artículo 44 of the Law governing this Jurisdiction—and on the body of evidence, it has been established that, on 18 April 2023, the Área Rectora de Salud de Montes de Oro received a complaint regarding sewage runoff flowing through the property of the protected party, stating that it caused public-health problems because of foul odors, standing water, and mosquitoes. The complaint was registered under expediente number 23051. Regarding the processing of the complaint, it has been established that, on 18 July 2023, the respondent Área Rectora inspected the site together with the mayor of Montes de Oro. The inspection report stated, insofar as relevant: “(…) no water is observed flowing through the municipal sewer system; a damaged culvert is observed, and the mayor will therefore send personnel to remedy the situation.

It is not raining at the time of the inspection.” Subsequently, on 04 April 2024, the respondent Área Rectora inspected 10 homes adjacent to the reported site and conducted a dye test at each of them to determine which homes had improper wastewater disposal. Accordingly, on 27 May 2024, the respondent authority issued 8 technical reports numbered as follows: N° MS-DRRSPC-DARSMO-IT-00078-2024, N° MS-DRRSPC-DARSMO-IT-00079-2024, N° MS-DRRSPC-DARSMO-IT-00080-2024, N° MS-DRRSPC-DARSMO-IT-00081-2024, N° MS-DRRSPC-DARSMO-IT-00082-2024, N° MS-DRRSPC-DARSMO-IT-00083-2024 and N° MS-DRRSPC-DARSMO-IT-00084-2024, in which it recommended issuing a sanitary order to each of the homes visited, requiring that their wastewater be directed to an approved treatment system. It has likewise been established that, on 28 October 2024, the respondent authority served sanitary orders on 04 of the homes found to be improperly discharging sewage into the storm sewer, requiring them, within 30 business days, to direct wastewater from the property’s washbasins, utility sinks, showers, washing machines, or similar fixtures to an appropriate wastewater treatment system.

This was intended to prevent the spread of foul odors, the accumulation of standing sewage, and the proliferation of animals or disease vectors that could affect people’s health or physical integrity. Such water was prohibited from flowing along the gutter of the public roadway or onto third-party properties. Notwithstanding the foregoing, according to the respondent authority, the remaining 4 homes could not be served because no one was present at the residence when service was attempted or because the property owner had died; it was therefore necessary to locate the current owners of the properties. Finally, it has been established that, on 13 November 2024, the respondent authority notified the protected party of the actions taken.

Accordingly, this amparo appeal (recurso de amparo) must be granted for the following reasons: a) Regarding the claimant’s complaint that she did not know the status of the complaint or have any information concerning the response to the reported problem, the Court notes that the protected party was not informed of the status of the complaint until 13 November 2024—that is, after notice of the order admitting this amparo proceeding; b) Furthermore, although this Chamber finds that the complaint has been processed by the respondent Área de Salud, as evidenced by the on-site inspections, the issuance of the corresponding reports, and even the recommendation that sanitary orders be issued, the fact remains that there is no evidence of adequate and timely follow-up. Indeed, the respondent health authority itself admits that 4 of the 8 sanitary orders issued have not been served and that the owners of the properties must be located. In other words, although approximately 1 year and 6 months have elapsed since the complaint in question was filed, uncertainty remains regarding a definitive solution to the reported problem. Consequently, the appeal must be granted on the terms set forth in the operative part (parte dispositiva).

V.REGARDING THE ACTIONS OF THE MUNICIPALIDAD DE MONTES DE ORO.- Based on the reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, subject to the consequences, including criminal penalties, provided for in artículo 44 of the Law governing this Jurisdiction—and on the body of evidence, it has been established that, on 11 February 2022, through official letter JVC N.° 003-2022, the respondent municipal entity replied to the request submitted by the protected party. The reply was sent to the email address [...]. That communication stated that a headwall with a grade break and outlets through concrete arms had to be constructed. It has likewise been established that, according to the respondent authority, the works could not be carried out within the originally scheduled period for administrative and budgetary reasons. Finally, it has been established that, on 08 November 2024, the Unidad Técnica de Gestión Vial of the respondent municipality initiated a proceeding on the SICOP platform under number 0062024000700025. This process provides for the construction of a headwall and the installation of 200 meters of sewer line to mitigate the impact of the water on the appellant’s property.

Accordingly, the violation of the protected party’s fundamental rights has been established. This is because it has been determined that, on 11 February 2022, the municipal entity informed the appellant that it would carry out works to resolve the reported problem; however, as the respondent authority itself acknowledges, those works have not been carried out because of budgetary circumstances, which are not attributable to the claimant and do not relieve the municipality of its obligations. Likewise, it should be noted that a procurement proceeding (proceso licitatorio) was not prepared until 08 November 2024; however, no schedule or approximate completion date is even provided for the works required to mitigate the reported problem. For the foregoing reasons, the appeal is granted on the terms set forth in the operative part.

VI. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice at the administrative level (sede administrativa), jurisdiction over the legal dispute lies with the Contentious-Administrative Courts and not with this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through a writ of amparo (recurso de amparo) as established by artículo 32 of the Ley de la Jurisdicción Constitucional, in relation to artículo 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, its administrative acts (actos administrativos), or its response are affecting the petitioner’s fundamental rights. In my view, the newly enacted legislation does not require this Court to modify its line of precedent, since, pursuant to numeral 7 of its Law, it has exclusive authority to define its own jurisdiction.

Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional cases and that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo (proceso constitucional de garantía del amparo), in all other cases, and for the reasons stated by this Court (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with numeral 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is my position that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction. Nevertheless, I do address the merits of the matter when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (artículo 50 of the Constitución Política), as is the case here, in which the appellant states that she filed the corresponding complaints with the respondent authorities because her property receives the discharge of all stormwater, sewage, and graywater, causing property damage and endangering her own physical safety. Nevertheless, she asserts that neither the Municipalidad de Montes de Oro nor the Ministerio de Salud has definitively resolved the reported problem, thereby violating her fundamental rights.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the appellant that, if she submitted any document, whether on paper, as well as objects or evidence stored on any additional device or through electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, these must be collected from the court office within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI and published in Boletín Judicial número 19 del 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

The petition is granted. A) Dra. Carolina Lizeth Guillén Meléndez, directora de la Dirección del Área Rectora de Salud Montes de Oro, or whoever holds that office in her stead, is ordered to issue the necessary directives within the scope of her authority so that the complaint filed by the appellant on 18 de abril de 2023 is resolved as appropriate within ONE MONTH from notice of this judgment. B) Anthony Fallas Jiménez, alcalde, and Erick Alpízar Mena, jefe de la Unidad Técnica de Gestión Vial, both of the Municipalidad de Montes de Oro, or whoever holds those offices, are ordered to take the necessary measures and issue the corresponding directives within the scope of their authority so that, within a maximum period of TWELVE MONTHS from notice of this judgment, the problem reported by the appellant concerning the impact of water on the protected party’s property, which is the subject of this petition, is resolved.

The respondents are advised that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a writ of amparo proceeding that must be obeyed or enforced and fails to obey or enforce it shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Montes de Oro are ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the contentious-administrative jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintinueve de noviembre de dos mil veinticuatro .

Recurso de amparo que se tramita en expediente número 24- 031126-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE MONTES DE ORO

Resultando:

  1. 1Por escrito incorporado al Sistema de Gestión en Línea de este Despacho el 05 de noviembre de 2024, la recurrente interpone recurso de amparo contra el Ministerio de Salud y la Municipalidad de Montes de Oro. Manifiesta que es propietaria de un inmueble ubicado en la provincia de Puntarenas, propiamente en Montes de Oro. Indica que dicho terreno ha presentado afectación, pues, ante problemas por aguas pluviales, desde hace varios años, la municipalidad las canalizó hacia la alcantarilla que desfoga en su propiedad. Aunado a ello, indica que la alcantarilla no cuenta con un cabezal ni las cajas de registro respectivas y no tiene gradiente, lo que provoca que este desfogue con mucha fuerza el agua recolectada de las cunetas de las calles aledañas a su finca. Añade que a esas aguas pluviales se le suman aguas servidas que los vecinos depositan en las cunetas. Arguye que todo ello ocasiona que a su propiedad lleguen todas las aguas pluviales, servidas y jabonosas, con consecuencias patrimoniales y poniendo en riesgo la integridad física propia y de semovientes que pastan en el inmueble.Además, ello causa un impacto ambiental considerable, pues las aguas se estacan, creando un problema de salud pública. Por tales motivos, alega que interpuso una gestión ante la Municipalidad de Montes de Oro, en fecha 3 de octubre de 2017, indicando: "(…) Me refiero al alcantarillado que viene de la esquina del Banco Nacional en dirección hacia el Oeste. Este alcantarillado desagua hacia mi propiedad provocando inestabilidad en el terreno, grandes zanjas donde corren dichas aguas y podrían ser un riesgo a la salud pública. Por lo tanto, solicito que se solucione el problema, entubando o canalizando con concreto dichas aguas, dándole un manejo apropiado, para así evitar mayores daños a mi propiedad y otros (…)". Refiere que recibió respuesta a dicha gestión, en fecha 6 de marzo de 2018, indicándole que solo se desfogan aguas pluviales de un paso de alcantarilla, y lo hace desde el punto más bajo del terreno.Alega que reiteró su gestión el 3 de setiembre de 2021, indicando: "(…) solicito que solucionen el problema, entubando o canalizando dichas aguas con cunetas el frente de mi propiedad, dándole un manejo apropiado. Al canalizar las aguas desde el banco hacia el oeste la municipalidad no está permitiendo el flujo natural de estas, se están canalizando directamente hacia las fincas causando daños. Este momento me veo afectada directamente por que no puedo utilizar el terreno para construir, cual es un proyecto cercano y además mi ganado puede sufrir lesiones por las zanjas (…)". Indica que, mediante oficio JVC No. 003-2022 de 11 de febrero de 2022, la municipalidad le dio respuesta, indicando: "(…) En dicha inspección se acordó que la JVC podría realizar trabajos de mejoras para el manejo de agua únicamente lo que este (sic) en rango de la vía pública. Los miembros en CC Alcaldía Municipal, Departamento de la UTGV, su mayoría acordaron que no se puede invertir recursos de la ley 8114/9324 en propiedad privado.Para lo cual se inspeccionó el lugar, donde los mismo miembros de la JVC en consenso general propusieron que se realice la construcción un cabezal con quiebra gradiente, con salida (…) cuyo piso deberá ser zampeado para la disminución de la velocidad de agua, que corre de forma natural (…)". No obstante, reclama que dichas obras no se realizaron, lo que ha conllevado que el problema de agrave. Ante ello, el 12 de abril de 2023, interpuso una denuncia ante el Ministerio de Salud, indicando: "(…) Los vecinos frente a mi propiedad dejan caer las aguas servidas libremente, estas hacen pasos hacia mi terreno. Esto causa problemas de salud pública ya que hay malos olores, aguas estancadas, mosquitos. El problema está en que no se sabe cuál es la casa o las casas que dejan estas aguas fluir libremente hacia mi propiedad. Esta denuncia se había interpuesto anteriormente pero desafortunadamente no se soluciona el problema (...)".No obstante, afirma que ni la Municipalidad de Montes de Oro ni el Ministerio de Salud han resuelto, de manera definitiva, el problema denunciado, lo que lesiona sus derechos fundamentales. Solicita la intervención de este Tribunal Constitucional, para que se obligue a esas entidades a resolver las denuncias planteadas.
  2. 2Mediante escrito de fecha 14 de noviembre de 2024, la Dra. Carolina Lizeth Guillén Meléndez, directora de la Dirección del Área Rectora de Salud Montes de Oro, informa en los siguientes términos: a) Que el día 18 de abril del 2023, las autoridades de la Dirección del Área Rectora de Salud de Montes de Oro, reciben denuncia por escurrimiento de aguas servidas que pasan por el terreno de la señora [Nombre 001], indicando que causa problemas de salud pública ya que hay malos olores, aguas estancadas y mosquitos. Según se indica en la denuncia, no se sabe de cual casa de habitación es que escurren las aguas servidas (folio 00002, 00003). b) La anterior denuncia, se registró bajo el número de expediente 23051 (folio 00001). c) Las autoridades del Área Rectora de Salud Montes de Oro, procedieron a realizar las inspecciones respectivas al caso denunciado, en fechas 18 de julio del 2023 y 04 de abril del 2024 y se procedió a notificar actos administrativos el día 28 de octubre del 2024 (folios 00004, 00005, 00006, 00007, 00008, 00009, 00010, 00011, 00012, 00013, 00014, 00015,00034, 00035, 00036, 00037, 00038, 00039, 00040, 00041). d) Sobre los alegatos expuestos por la recurrente: 1-.Que las autoridades de la Dirección del Área Rectora de Salud de Montes de Oro, da una primera atención a la denuncia interpuesta, el día 18 de julio del año 2023, en conjunto con el Alcalde Municipal de la Municipalidad de Montes de Oro, el señor Luis Alberto Villalobos Artavia, en donde en el momento de la visita, no se verifica escurrimiento de agua ni pluvial ni residual, por el alcantarillado pluvial (folio 00004). 2.- Que al no saberse cuál es la vivienda que está disponiendo de las aguas servidas al alcantarillado pluvial, el día 04 de abril del año 2024, las Gestoras Ambientales de Regulación de la Salud de la Dirección del Área Rectora de Salud de Montes de Oro, realizan inspecciones en el sector denunciado, vivienda por vivienda, realizando pruebas de tintura, para verificar cuales son las casas de habitación que tienen inadecuada disposición de aguas residuales, inspeccionando un total de 10 viviendas (folios 00005, 00006, 00007, 00008, 00009, 00010, 00011, 00012, 00013, 00014). 3.- Que, a raíz de las inspecciones realizadas, se verifican que 8 de las 10 viviendas visitadas, disponen de manera inadecuada las aguas servidas provenientes de las lavadoras, pilas y duchas principalmente, al alcantarillado pluvial (folios 00015, 00016, 00017, 00018, 00019, 00020, 00021, 00022, 00023, 00024, 00025, 00026, 00027, 00028, 00029). 4.- Que el día 28 de octubre del 2024, se notifica ordenamiento sanitario a 04 de las viviendas que se verificaron sus disposiciones inadecuadas de aguas servidas al alcantarillado pluvial, para que en un plazo de 30 días hábiles, se dispongan las aguas residuales provenientes del lavamanos, pilas, duchas, lavadoras o similares de la propiedad, a un sistema de tratamiento de aguas adecuado, esto con el fin de evitar propagación de malos olores, estancamiento de aguas servidas, propagación de animales o vectores de enfermedades, que pueden afectar la salud o integridad de las personas, estando prohibido que estas aguas escurran por el cordón del caño público o a terceras propiedades (folios 00030, 00031, 00032, 00033, 00035, 00037, 00038, 00039). 5.- Que, las restantes 4 viviendas que no se lograron notificar, se debió a que no se encontraba nadie en el momento de la notificación en la vivienda o la persona propietaria ha fallecido, por lo que se debe de investigar a quién se debe de notificar actualmente (folio 00034, 00036, 00040,00041). 6.- Que el día 13 de noviembre del 2024, mediante correo electrónico, se notifica del actuar de esta Área Rectora de Salud con respecto a la denuncia interpuesta, a la señora [Nombre 001] (folio 00002, 00003 expediente confidencial).
  3. 3Por memorial incorporado al expediente electrónico el 18 de noviembre de 2024, Anthony Fallas Jiménez, alcalde y Erick Alpízar Mena, jefe de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de Montes de Oro, informan que: 1.- Que, mediante el oficio JVC N.° 003-2022, emitido el 11 de febrero de 2022, se dio respuesta a la solicitud presentada por la señora [Nombre 001], el cual fue remitido al correo electrónico [...]. En dicha comunicación se le indicó que debía llevarse a cabo la construcción de un cabezal con quiebra gradiente, con salida mediante brazos de concreto. Ver folios del 01 al 04. 2.- Que, por razones de índole administrativa y presupuestaria, no fue posible ejecutar las obras en el período originalmente previsto. 3.- Que, este Gobierno Local, por medio de la Unidad Técnica de Gestión Vial ha iniciado un procedimiento en la plataforma SICOP con el número 0062024000700025.Este proceso contempla la construcción de un cabezal y la instalación de 200 metros de alcantarillado, destinado a mitigar el impacto de las aguas en la propiedad de la señora [Nombre 001]. Asimismo, se adjuntan pruebas e imágenes del proceso de adjudicación, así como del pliego de condiciones, que respaldan lo mencionado. La Unidad Técnica de Gestión Vial se compromete a atender esta situación y mejorar las condiciones de drenaje en la zona, buscando así contribuir a la solución de los problemas ocasionados. Se mantendrá informada a la señora [Nombre 001] sobre los avances del proyecto.
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. DE PREVIO

De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción pues, se está ante una denuncia interpuesta ante el Ministerio de Salud y la Municipalidad de Montes de Oro por una situación ambiental. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

- Manifiesta la recurrente que interpuso las denuncias correspondientes ante las autoridades recurridas, toda vez que, que su propiedad desfogan aguas pluviales, servidas y jabonosas, con consecuencias patrimoniales y poniendo en riesgo la integridad física propia. No obstante, afirma que ni la Municipalidad de Montes de Oro ni el Ministerio de Salud han resuelto, de manera definitiva, el problema denunciado, lo que lesiona sus derechos fundamentales.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

SOBRE LAS ACTUACIONES DEL MINISTERIO DE SALUD.

  • a)El 18 de abril del 2023, el Área Rectora de Salud de Montes de Oro, recibió denuncia por escurrimiento de aguas servidas que pasan por el terreno de la amparada, indicando que causa problemas de salud pública ya que hay malos olores, aguas estancadas y mosquitos; misma que, se registró bajo el número de expediente 23051. (ver informe rendido por Área de Salud y prueba aportada).
  • b)El 18 de julio de 2023 el Área Rectora recurrida realizó inspección del sitio en conjunto con el alcalde de Montes de Oro, consignándose en el acta de inspección en lo que interesa: “(…) no se observa aguas escurriendo por el alcantarillado municipal, se observa que hay una alcantarilla que se encuentra dañada por lo que el alcalde va a enviar personal para arreglar la situación. En el momento de la inspección no se encuentra lloviendo.” (ver informe rendido por Área de Salud y prueba aportada).
  • c)El 04 de abril de 2024 el Área Rectora recurrida realizó inspección de 10 viviendas aledaña al sitio denunciado y se aplicó prueba de tintura en cada de ellas, para verificar cuales son las casas de habitación que tienen inadecuada disposición de aguas residuales. (ver informe rendido por Área de Salud y prueba aportada).
  • d)El 27 de mayo de 2024 la autoridad recurrida emitió 8 informes técnicos numerados de la siguiente forma: N° MS-DRRSPC-DARSMO-IT-00078-2024, N° MS-DRRSPC-DARSMO-IT-00079-2024, N° MS-DRRSPC-DARSMO-IT-00080-2024, N° MS-DRRSPC-DARSMO-IT-00081-2024, N° MS-DRRSPC-DARSMO-IT-00082-2024, N° MS-DRRSPC-DARSMO-IT-00083-2024 y N° MS-DRRSPC-DARSMO-IT-00084-2024, en los cuales, recomendó emitir orden sanitaria a cada una de las viviendas visitadas, para que dirijan a un sistema de tratamiento aprobado las aguas residuales. (ver informe rendido por Área de Salud y prueba aportada).
  • e)El 28 de octubre de 2024 la autoridad recurrida notificó orden sanitaria a 04 de las viviendas que se verificaron sus disposiciones inadecuadas de aguas servidas al alcantarillado pluvial, para que en un plazo de 30 días hábiles, se dispongan las aguas residuales provenientes del lavamanos, pilas, duchas, lavadoras o similares de la propiedad, a un sistema de tratamiento de aguas adecuado, esto con el fin de evitar propagación de malos olores, estancamiento de aguas servidas, propagación de animales o vectores de enfermedades, que pueden afectar la salud o integridad de las personas, estando prohibido que estas aguas escurran por el cordón del caño público o a terceras propiedades. (ver informe rendido por Área de Salud y prueba aportada).
  • f)Que según informa la autoridad recurrida, las restantes 4 viviendas que no se lograron notificar, se debió a que no se encontraba nadie en el momento de la notificación en la vivienda o la persona propietaria ha fallecido, por lo que se debe de investigar a quién se debe de notificar actualmente (ver informe rendido por Área de Salud y prueba aportada).
  • g)El 13 de noviembre de 2024, la autoridad recurrida notificó a la amparada las actuaciones realizadas. (ver informe rendido por Área de Salud y prueba aportada).

SOBRE LAS ACTUACIONES DE LA MUNCIPALIDAD DE MONTES DE ORO.- h) El 11 de febrero de 2022 el ente municipal accionado mediante el oficio JVC N.° 003-2022, dio respuesta a la solicitud presentada por la amparada, el cual fue remitido al correo electrónico [...]. En dicha comunicación se le indicó que debía llevarse a cabo la construcción de un cabezal con quiebra gradiente, con salida mediante brazos de concreto. (ver informe rendido por la Municipalidad y prueba aportada).

  • i)Que según informa la autoridad recurrida, por razones de índole administrativa y presupuestaria, no fue posible ejecutar las obras en el período originalmente previsto. (ver informe rendido por la Municipalidad y prueba aportada).
  • j)El 08 de noviembre de 2024 la Unidad Técnica de Gestión Vial de la municipalidad recurrida, inició un procedimiento en la plataforma SICOP con el número 0062024000700025. Este proceso contempla la construcción de un cabezal y la instalación de 200 metros de alcantarillado, destinado a mitigar el impacto de las aguas en la propiedad de la recurrente. (ver informe rendido por la Municipalidad y prueba aportada).

IV.SOBRE LAS ACTUACIONES DEL MINISTERIO DE SALUD.- Al respecto de los informes rendidos por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que el 18 de abril del 2023, el Área Rectora de Salud de Montes de Oro, recibió denuncia por escurrimiento de aguas servidas que pasan por el terreno de la amparada, indicando que causa problemas de salud pública ya que hay malos olores, aguas estancadas y mosquitos; misma que, se registró bajo el número de expediente 23051. Sobre la tramitación de la denuncia, se tiene que el 18 de julio de 2023 el Área Rectora recurrida realizó inspección del sitio en conjunto con el alcalde de Montes de Oro, consignándose en el acta de inspección en lo que interesa: “(…) no se observa aguas escurriendo por el alcantarillado municipal, se observa que hay una alcantarilla que se encuentra dañada por lo que el alcalde va a enviar personal para arreglar la situación.

En el momento de la inspección no se encuentra lloviendo.” Posteriormente, el 04 de abril de 2024 el Área Rectora recurrida realizó inspección de 10 viviendas aledaña al sitio denunciado y si se aplicó prueba de tintura en cada de ellas, para verificar cuales son las casas de habitación que tienen inadecuada disposición de aguas residuales. Así entonces, el 27 de mayo de 2024 la autoridad recurrida emitió 8 informes técnicos numerados de la siguiente forma: N° MS-DRRSPC-DARSMO-IT-00078-2024, N° MS-DRRSPC-DARSMO-IT-00079-2024, N° MS-DRRSPC-DARSMO-IT-00080-2024, N° MS-DRRSPC-DARSMO-IT-00081-2024, N° MS-DRRSPC-DARSMO-IT-00082-2024, N° MS-DRRSPC-DARSMO-IT-00083-2024 y N° MS-DRRSPC-DARSMO-IT-00084-2024, en los cuales, recomendó emitir orden sanitaria a cada una de las viviendas visitadas, para que dirijan a un sistema de tratamiento aprobado las aguas residuales. De igual forma, se tiene que, el 28 de octubre de 2024 la autoridad recurrida notificó orden sanitaria a 04 de las viviendas que se verificaron sus disposiciones inadecuadas de aguas servidas al alcantarillado pluvial, para que en un plazo de 30 días hábiles, se dispongan las aguas residuales provenientes del lavamanos, pilas, duchas, lavadoras o similares de la propiedad, a un sistema de tratamiento de aguas adecuado, esto con el fin de evitar propagación de malos olores, estancamiento de aguas servidas, propagación de animales o vectores de enfermedades, que pueden afectar la salud o integridad de las personas, estando prohibido que estas aguas escurran por el cordón del caño público o a terceras propiedades.

Pese a lo anterior, según informa la autoridad recurrida, las restantes 4 viviendas que no se lograron notificar, se debió a que no se encontraba nadie en el momento de la notificación en la vivienda o la persona propietaria ha fallecido, por lo que se debe de investigar a quién se debe de notificar actualmente. Finalmente, se tiene que, el 13 de noviembre de 2024, la autoridad recurrida notificó a la amparada las actuaciones realizadas.

Así las cosas, el presente recurso de amparo debe ser acogido, por los siguientes motivos: a) Respecto al reclamo de la accionante por cuanto aduce que, desconoce el estado de la denuncia ni tiene noticia sobre la atención de la problemática denunciada, se observa que fue hasta el 13 de noviembre de 2024 -sea con posterioridad a la notificación de la resolución de curso del presente amparo- que se le comunicó a la tutelada el estado de la denuncia; b) Por otra parte, si bien esta Sala verifica que la denuncia formulada ha venido siendo tramitada por el Área de Salud accionada, pues se observa la realización de inspecciones in situ, la emisión de los informes respectivos e incluso se recomendó la emisión de ordenes sanitarias; lo cierto es, no se evidencia un seguimiento adecuado y oportuno de la misma, pues véase que, incluso a la autoridad de salud accionada admite que 4 de las 8 órdenes sanitarias emitidas no han podido ser notificadas y que deben ubicar a los dueños de las propiedades. Es decir, pese a que han transcurrido aproximadamente 1 año y 6 meses, desde la interposición de la denuncia en cuestión, se mantiene la incerteza en cuanto a la solución definitiva de la problemática denunciada. En consecuencia, el recurso debe estimarse en los términos que se indican en la parte dispositiva.

V.SOBRE LAS ACTUACIONES DE LA MUNICIPALIDAD DE MONTES DE ORO.- De los informes rendidos por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que el 11 de febrero de 2022 el ente municipal accionado mediante el oficio JVC N.° 003-2022, dio respuesta a la solicitud presentada por la amparada, el cual fue remitido al correo electrónico [...]. En dicha comunicación se le indicó que debía llevarse a cabo la construcción de un cabezal con quiebra gradiente, con salida mediante brazos de concreto. Asimismo, se tiene que, según informa la autoridad recurrida, por razones de índole administrativa y presupuestaria, no fue posible ejecutar las obras en el período originalmente previsto. Finalmente, se tiene que, el 08 de noviembre de 2024 la Unidad Técnica de Gestión Vial de la municipalidad recurrida, inició un procedimiento en la plataforma SICOP con el número 0062024000700025. Este proceso contempla la construcción de un cabezal y la instalación de 200 metros de alcantarillado, destinado a mitigar el impacto de las aguas en la propiedad de la recurrente.

Así las cosas, se acredita la lesión a los derechos fundamentales de la amparada. Lo anterior, por cuanto se determina que desde el 11 de febrero de 2022 el ente municipal comunicó a la recurrente que procedería a realizar obras para solventar la problemática denunciada; sin embargo, y como bien lo admite la autoridad recurrida, las mismas no han podido realizarse por situaciones presupuestarias, lo cual, circunstancias que no son achacables a la gestionante y que tampoco eximen a municipalidad de cumplir con sus obligaciones. De igual forma, véase que fue hasta el 08 de noviembre de 2024, que se confeccionó un proceso licitatorio; sin embargo, ni siquiera se indica un cronograma o fecha aproximada de finalización de las obras que se requieren para mitigar la problemática denunciada. Por lo expuesto, se declara con lugar el recurso en los términos que se indican en la parte dispositiva.

VI. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente indica que interpuso las denuncias correspondientes ante las autoridades recurridas, toda vez que, que su propiedad desfoga todas las aguas pluviales, servidas y jabonosas, con consecuencias patrimoniales y poniendo en riesgo la integridad física propia. No obstante, afirma que ni la Municipalidad de Montes de Oro ni el Ministerio de Salud han resuelto, de manera definitiva, el problema denunciado, lo que lesiona sus derechos fundamentales.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. A) Se le ordena a la Dra. Carolina Lizeth Guillén Meléndez, directora de la Dirección del Área Rectora de Salud Montes de Oro, o quien en su lugar ejerza ese cargo, girar las órdenes necesarias dentro del ámbito de sus competencias, para que se resuelva como corresponda la denuncia planteada por la recurrente en fecha 18 de abril de 2023, dentro del plazo de UN MES contados a partir de la notificación de esta sentencia. B) Se ordena a Anthony Fallas Jiménez, alcalde y Erick Alpízar Mena, jefe de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de Montes de Oro, o a quienes ocupen esos cargos, que tome las medidas necesarias y gire las órdenes que correspondan dentro del ámbito de sus competencias, a fin de que, en el plazo máximo de DOCE MESES, contados a partir de la notificación de esta sentencia, se solucione el problema denunciado por la parte recurrente relacionado con el impacto de aguas en la propiedad de la amparada, objeto de este recurso.

Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y la Municipalidad de Montes de Oro al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
