Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on veintidos de noviembre de dos mil veinticuatro.
Writ of amparo (recurso de amparo) filed by [Nombre 001], residence identification card [Valor 001], against the MUNICIPALIDAD DE CARRILLO.
BACKGROUND:
Justice Hess Herrera drafted the decision; and,
CONSIDERING:
The appellant states that one year ago she filed various complaints with the respondent local government through the email accounts [email protected] and [email protected] concerning the problems affecting her home as a result of the raising of the street level and the diversion of a stream, as well as illegal construction on a corner over a public street; however, she has received no response whatsoever. She asserts that this omission violates her fundamental rights.
Before addressing the merits, it must be clarified that, since Judgment No. 2008-02545 issued at 08:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction—with certain exceptions—matters involving disputes as to whether the public administration complied with the deadlines established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by means of a final administrative act or to adjudicate the applicable administrative appeals. The sub lite matter presents precisely such an exception because it concerns the failure to resolve an environmental complaint. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding.
The following facts relevant to the adjudication of this amparo are deemed proven: 1) On 10 de abril de 2024, [Nombre 002] filed a complaint with the respondent local government through [email protected] and the email addresses [email protected] and [email protected] concerning construction beyond the property line that obstructed a drainage channel, a swimming pool possibly built without construction permits, and the consequences these conditions entail for the protected party’s residence (copy attached to the initial pleading). 2) The channel established by the respondent for receiving complaints is the Municipality’s official website, which is linked to the email address tramitescarrillo2020@gmail (report submitted under oath). 3) By email dated 10 de octubre de 2024, the appellant was informed that her complaint had been assigned sequential number SI-367 (copies attached to the report). 4) That complaint has not been resolved (report submitted under oath).
In this case, the appellant states that one year ago she filed various complaints with the respondent local authority through the email accounts [email protected] and [email protected] concerning the problems affecting her home as a result of the raising of the street level and the diversion of a stream (quebrada), as well as an illegal structure located on a corner along a public street; however, she has received no response whatsoever. She asserts that this omission violates her fundamental rights.
It was established that on 10 de abril de 2024, [Nombre 002] filed a complaint with the respondent local authority through the channel officially designated by the municipality for handling such matters, concerning the problems caused at the protected party’s home by the alleged illegal structures. Furthermore, as explained by the head of the Construction Permits Section of the Municipalidad de Carrillo, due to the lack of interinstitutional coordination, the complaint in question is being processed and has been assigned for inspection. Accordingly, the Chamber finds that the alleged violation has occurred. On this understanding, the appeal must be granted, as set forth below.
I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum (sede administrativa), jurisdiction over the legal dispute lies with the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo), rather than with this Chamber. However, with the recent enactment of Law No. 9097, Petition Right Regulation Act (Ley de Regulación del Derecho de Petición), it has been established that this right is eligible for judicial protection through an amparo proceeding (recurso de amparo) as provided for in Article 32 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional), in connection with Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights.
In my view, the recently enacted legislation does not mean that this Court must alter its line of precedent, since, pursuant to Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may properly be heard within this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
In environmental matters, it is the undersigned’s view that if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the contentious-administrative jurisdiction. Nevertheless, I do address the merits of the matter when other rights of the affected persons are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which it is alleged that the appellant filed a complaint regarding the diversion of a stream bordering her property, thereby affecting her property rights, but that the complaint has not been resolved.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within this period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero de2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, Article LXXXI.
THEREFORE:
The appeal is granted. Diana Méndez Masis and Jesús Abadía Vargas, in their respective capacities as mayor and head of the Construction Permits Section of the Municipalidad de Carrillo, or whoever may hold those positions, are ordered to arrange and coordinate whatever is necessary so that, within TWO MONTHS counted from notification of this judgment, a decision is issued regarding the complaint filed by [Nombre 002], identification card [Valor 002], on 10 de abril de 2024, and that decision is notified to her. The respondents are warned that, pursuant to Article 71 of the Constitutional Jurisdiction Act, any person who receives an order issued in an amparo proceeding that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Carrillo is ordered to pay the legal costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintidos de noviembre de dos mil veinticuatro .
Recurso de amparo promovido por [Nombre 001], cédula de residencia [Valor 001], contra la MUNICIPALIDAD DE CARRILLO.
RESULTANDO:
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
La recurrente acota que hace un año formuló distintas denuncias ante el ente local recurrido, a través de las cuentas de correo electrónico [email protected] y [email protected], por los problemas que sufre en su vivienda, como consecuencia del aumento del nivel de la calle y del desvío de una quebrada, así como por una construcción ilegal en una esquina sobre calle pública; sin embargo, no ha recibido respuesta alguna. Afirma que esa omisión es contraria a sus derechos fundamentales.
Antes de analizar el fondo del asunto debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante la falta de resolución de una denuncia ambiental. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
De relevancia para la decisión del presente amparo se tienen por demostrados los siguientes: 1) El 10 de abril de 2024, [Nombre 002], formuló una denuncia ante el ente local recurrido, a través del medio [email protected] y los correos [email protected] y [email protected], por la construcción fuera de línea de propiedad con obstrucción de canaleta y de una piscina posiblemente sin permisos de construcción, y las consecuencias que estas suponen para la vivienda de la amparada (copia adjunta al libelo de interposición). 2) El medio que tiene establecido la recurrida para recibir denuncias es la página oficial de la municipalidad que está enlazada al correo electrónico tramitescarrillo2020@gmail (informe rendido bajo juramento). 3) Mediante correo electrónico de 10 de octubre de 2024, se comunicó a la recurrente que a su denuncia se le asignó el número consecutivo SI-367 (copias adjuntas al informe). 4) Esa denuncia no se ha resuelto (informe rendido bajo juramento).
En la especie, la recurrente acota que hace un año formuló distintas denuncias ante el ente local recurrido, a través de las cuentas de correo electrónico [email protected] y [email protected], por los problemas que sufre en su vivienda, como consecuencia del aumento del nivel de la calle y del desvío de una quebrada, así como por una construcción ilegal en una esquina sobre calle pública; sin embargo, no ha recibido respuesta alguna. Afirma que esa omisión es contraria a sus derechos fundamentales.
Se acreditó que el pasado 10 de abril de 2024, [Nombre 002], formuló una denuncia ante el ente local recurrido, a través del medio previsto por la municipalidad como oficial para atender ese tipo de gestiones, por los problemas que generan en la vivienda de la amparada las construcciones ilegales reclamadas. Aunado a lo anterior, según explica el jefe de la Sección Permisos de Construcción de la Municipalidad de Carrillo, como consecuencia de la falta de coordinación interinstitucional, la denuncia en cuestión está siendo atendida y se encuentra asignada para inspección. Así las cosas, estima la Sala que se existe la infracción acusada. Bajo esta inteligencia, se impone acoger el recurso, conforme se dirá.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que la recurrente incoó una denuncia por la desviación de una quebrada que colinda con su inmueble, afectando su derecho a la propiedad, pero que no ha sido resuelta.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Diana Méndez Masis y a Jesús Abadía Vargas, en su condición de alcaldesa y de jefe de la Sección Permisos de Construcción de la Municipalidad de Carrillo, o a quienes ejerza esos cargos, que dispongan y coordinen lo necesario a efecto que, en el plazo de DOS MESES, contado a partir de la notificación de esta sentencia, se resuelva y se le notifique lo resuelto respecto de la denuncia formulada por [Nombre 002], cedula [Valor 002], el 10 de abril de 2024. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Carrillo al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo Víquez consigna nota. El Magistrado Salazar Alvarado pone nota. Notifíquese.
