Document Review Case: 24-027972-0007-CO Decision No. 2024034771 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on veintidos de noviembre de dos mil veinticuatro.
Constitutional protection action (recurso de amparo) processed under case number 24-027972-0007-CO, filed by [Nombre 001], of legal age, identity card [Valor 001], on behalf of the Asociación de Vecinos del Residencial Valle del Sol -AVASOL-, against the Minister of Environment and Energy.
Findings:
“II. LEGAL CONSIDERATIONS:
FIRST: The constitutional protection action is a judicial proceeding processed before the Constitutional Chamber and constitutes the so-called constitutional jurisdiction for the protection of liberty (jurisdicción constitucional de la libertad); its existence guarantees the continued effectiveness of the fundamental rights established in the Political Constitution and in the international human-rights treaties in force in the country. The Ley de la Jurisdicción Constitucional establishes in section 29 that the constitutional protection action safeguards the fundamental rights and freedoms referred to in that law, except those protected through habeas corpus; it further provides that it may be brought against any provision, agreement, or decision and, in general, against any action, omission, or mere physical act not based on an effective administrative act, by public officials and bodies, that has violated, violates, or threatens to violate any of those rights.
It may be brought not only against arbitrary acts, but also against actions or omissions based on rules that have been erroneously interpreted or improperly applied. SECOND: In the Costa Rican legal system, the constitutional protection action derives from constitutional provisions 10° and 48° of the Political Constitution, which establish that every person has the right to bring a constitutional protection action to maintain or restore the enjoyment of the rights enshrined in the Constitution, as well as fundamental rights established in the international human-rights instruments applicable in the Republic. This body of law contains an entire title establishing a series of individual rights and guarantees, such as the right to life in Article 21; the right to privacy, freedom, and confidentiality of communications in Article 24; the right to equality enshrined in Article 33; the right of consumers and users (of public services) to environmental protection in Article 46; and many others established among social rights and guarantees, such as the right to a healthy and ecologically balanced environment and the corresponding duty of the State to protect it—Article 50—and the State’s duty to protect natural beauty, which entails at least indirect or partial protection of the environment insofar as it concerns one of its constituent aspects: natural landscapes, under Article 89.
THIRD: The Constitutional Chamber is subject only to the Constitution and the law, and its case law and precedents are binding erga omnes, except upon itself. This provision is important because the Chamber’s decisions are binding on all other public bodies, both administrative and judicial, as well as on all private individuals.
With respect to the operative portion of the aforementioned decision, this Office hereby submits its report in the following terms:
FIRST: We bring to the Constitutional Chamber’s attention that the Ministerial Office handles an extremely high volume of correspondence because our jurisdiction is nationwide; consequently, correspondence is addressed in the order received. Even so, we must often undertake internal coordination with centralized or regional directorates or departments, or with decentralized bodies based on the subject matter, which causes delays in handling the various proceedings managed by this Office, without this entailing per se any neglect in attending to them.
SECOND: It is reported that, through official letter DM-768-2024 dated 9 de setiembre, 2024, this Ministry provided the petitioner with the response requested in his letter dated 24 de agosto del año en curso. That official letter was served upon him on 12 de setiembre 2024 at 14:18 hrs., and confirmation of receipt of the aforementioned official letter was requested from him again on 15 de octubre anterior at 15:03.
The documentary evidence submitted in this constitutional protection action demonstrates that this Office acted in good faith in conducting the proceeding.
In accordance with the statements made in this report and the documentary evidence submitted, I request that this constitutional protection action BE DENIED insofar as it concerns the Ministry of Environment and Energy. I request that our Ministry be exempted from the payment of legal costs.”
Justice Garro Vargas drafts the decision; and,
Considerations:
I.Preliminary matter. I, the undersigned Justice Garro Vargas, note that the petitioner is my first cousin; however, because Article 12 of the Código Procesal Civil establishes as grounds for disqualification (causales de impedimento): “2. One of the parties is the spouse, domestic partner, ascendant, descendant, or relative of the judge within the third degree of consanguinity or second degree of affinity,” it is clear that it is not appropriate to request that I be deemed recused, since that relationship does not legally constitute a ground permitting it. I therefore continue to hear this matter.
II.Subject matter of the action. The petitioner alleges that, in his capacity as president of the Asociación de Vecinos del Residencial Valle del Sol, on 06 de setiembre de 2024 he requested information from the Minister of Environment and Energy regarding the creation of Parque Natural Lorne Ross in what is now known as Centro de Conservación Santa Ana. He complains that, as of the date this action was filed, no response had been provided.
III.Proven facts. The following facts are deemed duly proven and relevant to the resolution of this matter, either because they have been established or because the respondent failed to address them as directed in the initial order:
IV.Concerning the rights of petition and access to administrative information. Having analyzed the petitioner’s allegations, the Court notes that the right of petition, established in Article 27 of the Political Constitution, when understood broadly, refers to every citizen’s power to address any public official or government entity in writing for the purpose of presenting a matter of interest. Second, section 30 of the Political Constitution guarantees free access to administrative departments solely for the purpose of obtaining information concerning matters of public interest. It is therefore a mechanism designed to allow governed persons to oversee the proper performance of the various public entities in exercising the administrative function. Accordingly, when Articles 27 and 30 of the Political Constitution are read together, they guarantee every person’s right to approach any public official or government entity to obtain information concerning any issue, subject matter, or information of a public nature. The public nature of the information is precisely the central element determining the right of access to it. This Court so held very early in its case law, stating the following in judgment 1993-006240, issued at 14:00 on 26 de noviembre de 1993:
“…the right to information is based on the community’s interest in knowing about the activities of public officials, as well as their good or poor performance in office, and information that is of public interest and is held in administrative offices or departments. For this reason, the public nature of the information is the cardinal element in defining the right to request it from a public body or entity.” These guarantees are supplemented by the right to receive a prompt response, although the latter does not mean that the private party (administrado) is always entitled to receive a response favorable to its interests. In other words, as regards the freedom of petition (libertad de petición), what is at issue is the right to make a request, not the right to obtain what is requested—even though the public official must decide in strict accordance with the law—because that freedom is based on another principle; namely, that the Administration may not restrict the right of those governed to address public bodies.
V.The specific case. In the case at hand (sub lite), it is established that, by means of a letter dated 24 de agosto de 2024 and received on 06 de setiembre, the appellant, in his capacity as president of the Asociación de Vecinos del Residencial Valle del Sol, requested the following from the minister of Environment and Energy:
“The Board of Directors of the Asociación de Vecinos del Residencial Valle del Sol (AVASOL) is pleased to greet you and, at the same time, to inform you of the following:
On 24 de mayo of this year, we respectfully requested, Mr. Minister, information regarding the planned actions that would be undertaken on the property now known as Centro de Conservación Santa Ana (Annex “A”).
On 7 de junio del 2024, Ms. Ana Luisa Leiva, from the Office of the Minister (MINAE), kindly sent us your response (Annex “B”); however, it omitted answers to the following questions, which we hereby submit to you again:
1. Do you support the installation of a water-fountain park at Centro de Conservación Santa Ana similar in nature to the one located in Lima, Peru?
2. Why have you opposed the creation of Parque Natural Lorne Ross on what is now known as Centro de Conservación Santa Ana, when SINAC itself concluded in a study submitted in setiembre de 2023 that the site qualifies for the creation of a Natural Monument (Monumento Natural) or an Urban Natural Park (Parque Natural Urbano)?
In this regard, the occasion is appropriate to add three further questions, as follows:
1. Why has MINAE, under your authority, not completed the SINAC study for the northern area of the site known to date as Centro de Conservación Santa Ana, given that the Constitutional Chamber (Sala Constitucional) itself has stated that the site constitutes a single ecosystem for nature conservation?
2. In your opinion, is the ‘Parque de Fuentes de Agua’ promoted by your Ministry consistent with the purposes of an Urban Natural Park, and would it be covered by Decreto Ejecutivo No. 42742-MINAE?
3. Is it true that funding from the Global Environment Facility (GEF), through the Transición hacia una Economía Verde Urbana program, made it possible to finance the preparation of a preliminary design (anteproyecto) for the ‘Parque de Agua’ in Santa Ana, in the northern sector of Centro de Conservación Santa Ana? If so, who at MINAE or in the aforementioned program authorized the use of those funds for that preliminary design?
Thanking you for your attention to this letter, we remain cordially yours.” It is established that, by official letter DM-768-2024 of 09 de setiembre de 2024, Franz Tattenbach Capra, in his capacity as minister of Environment and Energy, responded to the appellant’s request in the following terms:
“In response to your letter dated 24 de agosto last, in which you ask about various matters concerning Centro de Conservación Santa Ana, I wish to inform you of the following:
The properties comprising Centro de Conservación Santa Ana are registered as belonging to the State and are administered by the Ministry of Environment and Energy.
Our Ministry is conducting technical and legal studies covering all the properties comprising the site, both the northern and southern portions, to determine the management category (categoría de manejo) that could apply to the entire registered property. The Urban Natural Park category has not been ruled out; however, the technical supporting documentation justifying it must be issued, the internal approval procedures must be exhausted, and the measure must then be formally adopted by means of an Executive Decree (Decreto Ejecutivo). MINAE is making progress in this process: the procedure was first undertaken for Parque Simón Bolívar and has subsequently begun for Centro de Conservación Santa Ana and Santo Domingo.
Regarding your concern about the construction of a park devoted to water resources (recurso hídrico), their conservation, and environmental education, this proposal has not been ruled out, provided that the technical reports find it feasible and compatible. In any event, it will be a project to be reviewed once a comprehensive proposal for the entire area is available. Many aspects will remain subject to the Management Plan (Plan de Manejo) and Use Regulations (Reglamento de uso), which must be issued after formal adoption; it is therefore premature to make assertions before the results are available.
This technical and development support initiative has the internal institutional support of our working group and also that of PNUD, through Proyecto TEVU Transición hacia una Economía Verde Urbana, which supports the transformation of the economy and cities. It forms part of the cooperative assistance provided to the Ministry of Environment and Energy and will assist us during the design stages of various projects.
To date, there is no formal design proposal or preliminary design for Centro de Conservación Santa Ana that has been formally accepted by us. This design process is proceeding in parallel with the institutional process for issuing the technical and legal reports, obtaining approvals, and formalizing the measure, regarding which information will be provided in due course.
Sincerely.” That response was sent to the appellant on 12 de setiembre de 2024 at the email address [email protected]. It is also established that, on 14 de octubre, at 14:27 hours, the respondent authority was served with the ruling issued at 22:20 hours on 11 de octubre. On that same 14 de octubre, at 15:04 hours, the office of the respondent minister sent an email to [email protected] stating the following to the appellant: “Dear Mr. Gastón, I wanted to ask whether this official letter had reached your email. I did not receive confirmation.” However, the appellant’s communication shows that the email address he provided for service of notices was [email protected]. This means that both the response and the subsequent request for confirmation of receipt were sent to incorrect email addresses. It should be noted that, although the username was entered correctly, the domain portion of the email server address was incorrect.
This demonstrates that, because of that error, official letter DM-768-2024 was not communicated to the protected party (tutelado) at the address he provided for that purpose. Accordingly, the alleged violation of the right of petition and prompt response (Article 27 of the Constitución Política) and the right of access to public information (Article 30 of the Constitución Política) is deemed to have occurred, because the appellant remains unaware of the response issued by the respondent Administration.
VI.Conclusion. Consequently, the appropriate course is to grant the application and order the relief specified in the operative part (parte dispositiva) of this judgment.
VII.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of thirty business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Sesión No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in the Boletín Judicial No. 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Sesión No. 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The application is granted. Franz Tattenbach Capra, in his capacity as minister of Environment and Energy, or whoever holds that office, is ordered to coordinate and arrange all actions falling within the scope of his authority so that, within three days from service of this judgment, official letter DM-768-2024 of 09 de setiembre de 2024, which responded to the letter dated 24 de agosto de 2024 and received on 06 de setiembre last, is communicated to the appellant [Name 001]. The respondent, or whoever holds that office, is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in constitutional amparo proceedings (recurso de amparo) that must be complied with or enforced and fails to comply with or enforce it shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be determined in the administrative-litigation judgment-enforcement proceeding (proceso de ejecución de sentencia de lo contencioso administrativo). Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintidos de noviembre de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente número 24-027972-0007-CO, interpuesto por [Nombre 001], mayor, cédula de identidad [Valor 001], a favor de la Asociación de Vecinos del Residencial Valle del Sol -AVASOL-, contra el ministro de Ambiente y Energía.
Resultando:
“II. CONSIDERACIONES JURÍDICAS:
PRIMERO: El recurso de amparo es un proceso judicial que se tramita en la Sala Constitucional y que constituye la denominada jurisdicción constitucional de la libertad, su existencia garantiza la vigencia de los derechos fundamentales establecidos en la Constitución Política y en los tratados internacionales de derechos humanos vigentes en el país. La Ley de la Jurisdicción Constitucional establece en su numeral 29 que el recurso de amparo garantiza los derechos y libertades fundamentales a que se refiere esta ley, salvo los protegidos por el de hábeas corpus, establece además que procede contra toda disposición, acuerdo o resolución y en general, contra toda acción, omisión o simple actuación material no fundada en un acto administrativo eficaz, de los servidores y órganos públicos, que haya violado, viole o amenace violar cualquiera de aquellos derechos. No sólo procede contra los actos arbitrarios, sino también contra las actuaciones u omisiones fundadas en normas erróneamente interpretadas o indebidamente aplicadas.
SEGUNDO: En el ordenamiento jurídico costarricense, el Recurso de Amparo se desprende de las normas constitucionales número 10° y 48° de la Constitución Política establece que toda persona tiene derecho al recurso de amparo para mantener o restablecer el goce de los derechos consagrados en la Constitución, así como de los de carácter fundamental, establecidos en los instrumentos internacionales sobre derechos humanos, aplicables en la República. Existe todo un título dentro de este cuerpo normativo, donde se establecen una serie de derechos y garantías individuales tales como el derecho a la vida en el artículo 21, el derecho a la intimidad, libertad y secreto de las comunicaciones del artículo 24, el derecho de igualdad que se consagra en el artículo 33, derecho que tienen los consumidores y usuarios (de servicios públicos) a la protección del ambiente en el artículo 46 y muchos otros, establecidos dentro de los derechos y garantías sociales, tales como derecho a un ambiente sano y ecológicamente equilibrado y el correlativo deber estatal de tutelarlo, - artículo 50- y el deber estatal de proteger las bellezas naturales, lo que supone una tutela por lo menos indirecta del ambiente o parcial de éste en tanto apunta a un aspecto que lo integra: los paisajes naturales, en el artículo 89.
TERCERO: La Sala Constitucional sólo está sometida a la Constitución, a la Ley y su jurisprudencia y precedentes son vinculantes erga omnes salvo para sí misma. Esta disposición es importante dado que lo resuelto por la Sala es vinculante para los demás órganos públicos, tanto administrativos como judiciales, así como para todos los particulares.
En relación con la parte dispositiva de la citada resolución, este Despacho procede a rendir informe en los siguientes términos:
PRIMERO: Hacemos notar a la Sala Constitucional, que el Despacho Ministerial atiende un altísimo circulante de correspondencia, pues nuestro alcance es de nivel nacional; por consiguiente, se atiende la correspondencia conforme ingresa, aún así muchas veces debemos de realizar la coordinación interna con Direcciones o Departamentos centralizados o regionalizados, o bien órganos desconcentrados por razón de la materia, lo que genera una demora en la atención de los diversos trámites que maneja este Despacho, sin que ello conlleve per sé una desidia en la atención de los mismos.
SEGUNDO: Se informa que por oficio DM-768-2024 del día 9 de setiembre, 2024, este Ministerio le brindó la respuesta al recurrente, conforme fue requerido en su misiva del día 24 de agosto del año en curso, dicho oficio le fue notificado el día 12 de setiembre 2024 a las 14:18 hrs., se le solicitó confirmación nuevamente de recibo del oficio de cita el día 15 de octubre anterior a las 15:03.
Las pruebas documentales que se aportan en este Amparo demuestran la buena fe de parte de este Despacho en el trámite llevado a cabo.
De conformidad con lo estipulado en el presente informe y las pruebas documentales aportadas, solicito SE DECLARE SIN LUGAR el presente Amparo, en lo que corresponda al Ministerio de Ambiente y Energía. Solicito se exima a nuestro Ministerio del pago de costas procesales”.
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Cuestión previa. La suscrita magistrada Garro Vargas advierto que el recurrente es mi primo hermano; sin embargo, en virtud de que el artículo 12 del Código Procesal Civil establece como causales de impedimento “2. Ser una de las partes cónyuge, conviviente, ascendiente, descendiente o pariente hasta el tercer grado de consanguinidad, o segundo de afinidad del juez”, es claro que no corresponde solicitar que se me tenga por inhibida, pues tal parentesco no constituye legalmente una causal que lo permita. De ahí que continúo con el conocimiento del presente asunto.
II.Objeto del recurso. El recurrente alega que, en su condición de presidente de la Asociación de Vecinos del Residencial Valle del Sol, el 06 de setiembre de 2024 solicitó al ministro de Ambiente y Energía información sobre la creación del Parque Natural Lorne Ross en lo que hoy se conoce como Centro de Conservación Santa Ana. Reclama que, a la fecha de interposición de este recurso, no le han brindado respuesta.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre los derechos de petición y acceso a la información administrativa. Analizados los alegatos del recurrente, se le hace ver que el derecho de petición, establecido en el artículo 27 de la Constitución Política, cuando es entendido en sentido amplio, hace referencia a la facultad que posee todo ciudadano para dirigirse por escrito a cualquier funcionario público o entidad oficial con el fin de exponer un asunto de su interés. En segundo lugar, el ordinal 30 de la Constitución Política garantiza el libre acceso a los departamentos administrativos, únicamente, con propósitos de información sobre asuntos de interés público. Se trata, pues, de un mecanismo ideado para permitir a los administrados fiscalizar el correcto desempeño de los diversos entes públicos en el ejercicio de la función administrativa. Por lo tanto, cuando los artículos 27 y 30 de la Constitución Política son tomados en su conjunto, garantizan el derecho de toda persona de dirigirse ante cualquier funcionario público o entidad oficial para obtener información sobre cualquier asunto, materia o información de naturaleza pública. Precisamente, la naturaleza pública de la información es el elemento central que determina el derecho de acceder a ella. Así lo declaró este Tribunal desde muy temprano en su jurisprudencia, indicando, en sentencia 1993-006240 de las 14:00 horas del 26 de noviembre de 1993, lo siguiente:
“…el derecho a la información tiene como fundamento el interés de la comunidad de conocer la actividad del funcionario público, así como su buen o mal desempeño en el ejercicio del cargo y las informaciones que, siendo de interés público, se hallen en las oficinas o departamentos administrativos. Es por esto que la naturaleza pública de la información es el elemento cardinal para definir el derecho a solicitarla al órgano o ente público”.
Estas garantías se complementan con el derecho a obtener pronta respuesta, aunque esto último no significa que el administrado tenga derecho a recibir siempre una contestación favorable a sus intereses. En otras palabras, en lo tocante a la libertad de petición, de lo que se habla es del derecho a pedir y no el derecho a obtener lo que se pide -aun cuando el funcionario público deba resolver con estricta sujeción a la ley-, pues aquella se funda en otro principio; esto es, que la Administración no puede coartar el derecho de los gobernados para dirigirse a los órganos públicos.
V.Sobre el caso concreto. En el sub lite, consta que, mediante nota fechada 24 de agosto de 2024, recibida el 06 de setiembre, el recurrente, en su condición de presidente de la Asociación de Vecinos del Residencial Valle del Sol, solicitó al ministro de Ambiente y Energía lo siguiente:
“La Junta Directiva de la Asociación de Vecinos del Residencial Valle del Sol (AVASOL) tiene el agrado de saludarle y a la vez comentarle lo siguiente:
El 24 de mayo del presente año nos permitimos señor Ministro solicitarle información acerca de las acciones previstas que se estarían tomando en el inmueble que hoy se conoce como Centro de Conservación Santa Ana (Anexo “A”) El 7 de junio del 2024, la Sra. Ana Luisa Leiva, del Despacho del Ministro (MINAE) nos hizo llegar su gentil respuesta (Anexo “B”), sin embargo, la misma omitió responder las siguientes cuestiones que aquí le volvemos a consultar:
1. ¿Usted apoya la instalación de un parque de fuentes de agua en el Centro de Conservación Santa Ana de naturaleza parecida al existente en Lima Perú?
2. ¿Por qué se ha opuesto a la creación del Parque Natural Lorne Ross en lo que hoy se conoce como Centro de Conservación Santa Ana, si el propio SINAC en un estudio entregado en setiembre de 2023 concluyó que dicho sitio califica para crear un Monumento Natural o un Parque Natural Urbano?
En este sentido, es propia la ocasión para adicionar a esas preguntas, otras tres que a continuación le hacemos:
1. ¿Por qué razón el MINAE bajo su tutela, no ha concluido el estudio del SINAC para el área norte del sitio conocido hasta ahora como Centro de Conservación Santa Ana, reconociendo que la misma Sala Constitucional ha indicado que el sitio representa un solo ecosistema para la conservación natural ?
2. A su criterio el "Parque de Fuentes de Agua" impulsado por su Ministerio es conteste a los fines de un Parque Natural Urbano y estaría amparado al Decreto Ejecutivo No. 42742-MINAE?
3. ¿Es cierto que con fondos del Global Environment Facility (GEF) mediante el programa Transición hacia una Economía Verde Urbana, se posibilitó el financiamiento para la elaboración de un anteproyecto del “Parque de Agua” en Santa Ana en el sector norte del Centro de Conservación Santa Ana? De ser así ¿Quién autorizó en el MINAE o en el programa antes mencionado la utilización de esos fondos para dicho anteproyecto?
Agradeciendo su atención a la presente, se suscribe cordialmente”.
Se acredita que, mediante oficio DM-768-2024 del 09 de setiembre de 2024, Franz Tattenbach Capra, en su condición de ministro de Ambiente y Energía, atendió la gestión del recurrente en los siguientes términos:
“En atención a su nota de fecha 24 de agosto pasado, mediante la cual consulta varios aspectos sobre el Centro de Conservación Santa Ana, me permito indicarle los siguiente:
Las fincas que constituyen el Centro de Conservación Santa Ana son de dominio registral del Estado, bajo administración del Ministerio de Ambiente y Energía.
Nuestro Ministerio se encuentra realizando los estudios técnicos y legales para la totalidad de las fincas que conforman el inmueble, sea el lado norte y el lado sur, para determinar la categoría de manejo que podría darse en toda la finca registral, sin que se haya descartado la categoría de Parque Natural Urbano; siendo necesario que se emita el soporte técnico que lo justifique y se agoten las instancias internas que debe dar su aprobación, aparte del acto de formalización por medio de un Decreto Ejecutivo. El MINAE avanza en este proceso, pues primero se realizó la gestión en el Parque Simón Bolívar y seguidamente, se ha iniciado en el Centro de Conservación Santa Ana y para Santo Domingo.
En cuanto a su preocupación sobre la construcción de un parque dedicado al recurso hídrico, su conservación y educación ambiental; es una propuesta que no se descarta, siempre que los informes técnicos lo consideren viable y compatible, en todo caso será una proyecto que se revisará cuando se tenga la propuesta integral de la totalidad del área. Muchos aspectos quedaran supeditados al Plan de Manejo y Reglamento de uso, que deberán emitirse posteriormente a la formalización, por lo que resulta precipitado realizar afirmaciones sin que se tengan los resultados.
Esta gestión de apoyo técnico y de desarrollo, cuanta con el apoyo institucional interno de nuestro grupo de trabajo y también del PNUD, a través del Proyecto TEVU Transición hacia una Economía Verde Urbana, que apoya la transformación de la economía y las ciudades, siendo parte de los apoyos de cooperación que colaboran con el Ministerio de Ambiente y Energía, y nos ayudara en las etapas de diseño de diferentes proyectos.
A la fecha, no se tiene una propuesta formal de diseño ni de anteproyectos para el Centro de Conservación Santa Ana que haya sido aceptada formalmente de nuestra parte. Este proceso de diseño camina en forma paralela a la gestión institucional de emisión de los informes técnicos y legales, aprobaciones y formalización, lo cual se informará en su debido momento.
Atentamente”.
Esa respuesta se le remitió al recurrente el 12 de setiembre de 2024 al correo electrónico [email protected]. Además, consta que el 14 de octubre, a las 14:27 horas, se notificó a la autoridad recurrida la resolución de las 22:20 horas del 11 de octubre. Ese mismo 14 de octubre, a las 15:04 horas, del despacho del ministro recurrido se remitió un correo a la dirección electrónica [email protected] donde se le indicó al recurrente lo siguiente: “Estimado don Gastón, quería consultarle si este oficio le había llegado a su correo? Es que no recibí confirmación”. Sin embargo, de la misiva del recurrente se desprende que el correo electrónico que señaló para atender notificaciones es [email protected]. Lo anterior significa que tanto el envío de la respuesta como la posterior consulta de recibido se remitió a direcciones electrónicas erradas. Nótese que, si bien se consignó correctamente el nombre del usuario, se erró en cuanto a la parte del dominio del servidor del correo.
Lo anterior evidencia que debido a esa situación al tutelado no se le ha comunicado el oficio DM-768-2024 a la dirección que señaló para tal efecto. De ahí que se estima que se configuró la alegada infracción al derecho de petición y pronta respuesta (artículo 27 de la Constitución Política) y al derecho de acceso a la información pública (artículo 30 de la Constitución Política), pues el recurrente desconoce la respuesta de la Administración recurrida.
VI.Conclusión. En consecuencia, lo procedente es declarar con lugar el recurso y con los efectos que se indican en la parte dispositiva de esta sentencia.
VII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Franz Tattenbach Capra, en su condición de ministro de Ambiente y Energía o a quien ocupe ese cargo, coordinar y disponer todas las actuaciones que se encuentren dentro del ámbito de sus competencias, a fin de que dentro del plazo de tres días, contado a partir de la notificación de esta sentencia, se le comunique al recurrente [Nombre 001] el oficio DM-768-2024 del 09 de setiembre de 2024, mediante la cual se atendió la nota fechada 24 de agosto de 2024, recibida el 06 de setiembre pasado. Se advierte al recurrido, o a quien ocupe ese cargo, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en el proceso de ejecución de sentencia de lo contencioso administrativo. Notifíquese.
