Document Review Decision No. 2024031513 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nueve horas veinte minutos on veinticinco de octubre de dos mil veinticuatro.
Writ of amparo (recurso de amparo) filed by [Nombre 001], identity card [Valor 001], and [Nombre 002], identity card [Valor 002], against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO (ASADA) DE CASTILLA DE ORO, BELÉN, CARRILLO, GUANACASTE, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).
Findings of Fact:
This situation experienced by both operators adversely affects good-faith third parties (terceros de buena fe), who have been waiting for years for water-supply service so that they can build a decent home, since, as reiterated, neither of these two water-supply operators (ASADA – Committee) can currently issue certificates of service availability (constancias de disponibilidad de servicios) or provide new services. To date, it remains pending for ASADA Castilla de Oro to add to its billing database the users in the sector operated illegally by Comité Castilla de Oro El Guácimo and to carry out the works necessary to interconnect the two systems. It has refused to take these actions because of disagreements among the members of its Board of Directors, whose internal power struggle is preventing compliance with the principles governing public services, disregarding the fact that the improper conduct of ASADA officials may affect an entire community and involves an essential service.
It must be clarified that the interconnection works to be carried out by ASADA Castilla de Oro are not a prerequisite for expanding its area of jurisdiction and operating the water-supply system of Comité Castilla de Oro El Guácimo, because the ASADA may operate that system independently (as a satellite system). This is because the Committee does have a legally authorized supply source, with a flow allocation granted to AyA. The necessary interconnection improvements (installation of piping) are required to resolve the technical infeasibility affecting the respondent ASADA, which uses an illegal well and needs to connect to the well that currently supplies the Committee. Accordingly, merely by adding the Committee’s users to the ASADA Castilla de Oro billing database, the ASADA could begin operating that system as a satellite system and resolve the problem affecting the petitioners and other interested persons.
Finally, it is stated that ASADAs with a delegation agreement (convenio de delegación) are required to provide the delegated public water-supply service in compliance with the regulations in force and subject to the principle of legality (principio de legalidad), particularly because of the essential nature of that service. The Constitutional Chamber has repeatedly held that access to drinking water is a human right protected by our Political Constitution, since human survival is impossible without water, as people require this vital resource for nourishment and basic, everyday activities, and even to gain access to decent housing, because construction permits cannot be processed without a certificate of service availability. The work of ASADAs is therefore of the utmost importance, and internal disagreements within their administration cannot justify depriving persons who, in good faith, expect an operator to perform its duties of this right. It requests that the Chamber dismiss the petition.
With respect to the information on each subscriber: As of today, we have not received detailed information on each of the 63 new subscribers; each owner is responsible for providing all documentation relating to their property so that they may be entered into the system; they must submit the completed application, together with the Property Registry Study (Estudio Registral del Inmueble), registered cadastral survey (plano catastrado), and meter number for each of the 63 services. As proof of this fact, I attach the acknowledgment of receipt for the complete letter and the Technical Diagnostic Report (Informe de Diagnóstico Técnico) issued as an annex. On 16 de agosto del 2024, ASADA CASTILLA DE ORO once again requested a duly substantiated extension, since the primary purpose of ANY integration of water-supply systems (acueductos) must be improved management; however, WITHOUT COMPLETING THE MINIMUM IMPROVEMENTS that must be made to the system, it is not feasible for the ASADA to take them over, for all the reasons stated above.
We are aware that agreements have been reached, that AyA has provided assistance, that the Comité del Guácimo continues working, and that logs, work plans, meetings, and accounting reports have been produced, but the MINIMUM works HAVE NOT BEEN COMPLETED due to a lack of financial resources. I submit images taken on 09 de octubre del 2024 that substantiate my statement: the intake tank (tanque de captación) has still not been installed and interconnected with the new pipeline; the pipes are not connected to the meters; and 300 metros of new pipeline and two branches remain to be installed. Under no circumstances can we irresponsibly accept a sector in which we DO NOT have the financial resources to invest, since the service that an ASADA must maintain must, under the parameters established by law, be provided optimally in terms of quality, quantity, continuity, reliability, universal access, efficiency, timeliness, and sustainability.
ASADA CASTILLA DE ORO and COMITÉ DEL GUACIMO are currently working diligently to make improvements to the water-supply systems in both sectors so that we may provide or supply a service under conditions of quality, continuity, efficiency, and effectiveness, in order to GUARANTEE OPTIMAL SERVICE, as required by our laws. It is not true that the appellant [Nombre 002], owner of property 5-217994-000, has in any way been deprived of the sacred human and constitutional rights set forth in article 21,50 y 65—the right to human life and to a healthy environment—or that the State or our institution, in its capacity as administrator, is restricting any of her rights. The State must promote the construction of affordable housing, but in accordance with the existing legal system (ordenamiento jurídico); however, this CANNOT serve as an argument for granting water services when they are NOT warranted because of insufficient water or hydraulic capacity, as in this specific case.
The ASADA is NOT required to provide service unless it has previously issued a positive certificate of service availability (constancia de disponibilidad de servicios), which would have allowed individuals to obtain the necessary municipal permits for the construction of their properties, as established in sections 67 y 68 of the Reglamento para la Prestación de servicios. It requests that the Chamber dismiss the appeal.
Justice Salazar Alvarado authors the opinion; and,
Considering:
I.Subject matter of the appeal. The appellant alleges that they are the owners of property N° 5-217994-000, located in Belén de Carrillo, Guanacaste, where they intend to build their home, for which they require a certificate of drinking-water service availability (constancia de disponibilidad de servicio de agua potable). However, they claim that the respondent ASADA is not issuing such certificates because of administrative problems, since the well they use is not under a concession (concesión) in its favor and therefore cannot be used. They claim that AyA has not intervened diligently in the matter.
II.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
III.Regarding the fundamental right to a drinking-water supply. In other similar matters, this Court has held that the fundamental right to a drinking-water supply forms part of Constitutional Law (Derecho de la Constitución). Specifically, Judgment N° 2003-4654 of fifteen hours and forty-four minutes on veintisiete de mayo de dos mil tres held, insofar as relevant:
“V.- The Chamber recognizes, as part of Constitutional Law, a fundamental right to drinking water derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica. Thus, it is expressly included in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also stated in the International Conference on Population and Development held in El Cairo (principle 2), and declared in numerous other instruments of International Humanitarian Law (Derecho Internacional Humanitario). Within our Inter-American Human Rights System (Sistema Interamericano de Derechos Humanos), the country is particularly bound in this area by article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (“Protocolo de San Salvador” de 1988), which provides: “Article 11.
Right to a healthy environment 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.” Furthermore, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right that, in addition to being essential for leading a healthy life, is a prerequisite for the realization of all other human rights. VI.- The foregoing regulatory framework (marco normativo) gives rise to a series of fundamental rights linked to the State’s obligation to provide basic public services. This means, on the one hand, that people may not unlawfully be deprived of those services; however, in the case of drinking water, it cannot be maintained that any individual holds an enforceable right requiring the State to provide drinking-water service immediately and wherever requested. Instead, as provided in the Protocolo de San Salvador itself, rights of this kind require States to adopt measures, as established in article one of that same Protocol (…)”.
IV.Regarding the specific case. In the case at bar (sub lite), the petitioners come before this Chamber because they own property N° 5-217994-000, located in Belén de Carrillo, Guanacaste, where they intend to build their home, for which they require a certificate of potable-water service availability (constancia de disponibilidad de servicio de agua potable). However, they allege that the respondent ASADA is not issuing such certificates due to administrative problems, because the well they use has not been licensed to it and therefore cannot be used. They allege that AyA has not intervened diligently in the matter. In this regard, the Chamber deems it established that, since febrero de 2023, the respondent ASADA had been formally notified that it could no longer issue water-availability certificates because its water-supply system (acueducto) lacked the technical and legal feasibility required for operation.
It was established that the well is not registered in the name of the respondent ASADA with the Dirección de Aguas del MINAE and that the pipe diameters are insufficient. As a result, a donation of 332 pvc pipes was arranged through the program for small communities at sanitary risk, so that ASADA Castilla de Oro-Ojochal could connect to the well in the neighboring Castilla de Oro-El Guácimo sector, which is legally authorized. The well to which the respondent ASADA intends to connect recently underwent water-quality testing and a 72-hour pumping test, with satisfactory results indicating that it can supply both communities. The technical, short-term solution is for ASADA Castilla de Oro to expand its service area and operate the water-supply system of Comité Castilla de Oro El Guácimo. On 10 de junio del 2024, the ORAC Región Chorotega of AyA processed the application for an increased flow rate (aumento de caudal) before the Subgerencia de Gestión de Sistemas Comunales in order to supply ASADA users and meet the system’s new demand.
ASADA Castilla de Oro must still add the users of the Comité to its billing database and implement the works necessary to interconnect the two water-supply systems, which are actions that fall to the ASADA itself. The respondent ASADA is using an illegal well that the Dirección de Aguas del MINAE instructed it to seal; it is therefore placing its current users at risk, since they could at any time lose the water resource that is being used illegally. AyA explains to the Chamber that this situation is harming good-faith third parties who have waited years for water-supply service so that they may build decent homes because, as reiterated, neither of these two water-supply operators (ASADA – Comité) can currently issue service-availability certificates or provide new services. To date, ASADA Castilla de Oro must still add to its billing database the users in the sector illegally operated by Comité Castilla de Oro El Guácimo and carry out the works necessary to interconnect the two systems.
In view of these circumstances, the Chamber finds that the petition for a writ of amparo (amparo) must be granted against both AyA and, especially, the respondent ASADA, because they are currently infringing not only the protected parties’ fundamental right of access to water, but also the right of other persons in that area seeking access to the requested public service. Indeed, this Court notes that, although a series of actions, meetings, and coordination efforts have taken place, and AyA has issued official communications and recommendations to the respondent ASADA, both respondents acknowledge that the situation persists and has not been resolved. A review of the record shows that the ASADA is principally responsible for delaying the improvements and other actions that must be completed before the issuance of service-availability letters (cartas de disponibilidad) can resume. For example, as AyA explains under oath, ASADA Castilla de Oro must still add to its billing database the users in the sector illegally operated by Comité Castilla de Oro El Guácimo and carry out the works necessary to interconnect the two systems.
It is even evident that materials were donated to achieve the interconnection between the communities; nevertheless, the works have not been performed. This proven delay and neglect by the respondent ASADA is violating the fundamental rights of the petitioners, as well as those of the other residents interested in the expansion of coverage and the performance of the works. In its response to this petition for amparo, the respondent ASADA advances a series of arguments and justifications before this Chamber; nevertheless, none is sufficient to excuse the delays verified by both AyA and this Court. Furthermore, although AyA has undertaken a series of actions aimed at resolving the problems suffered by both the protected parties and the other residents of the community, those actions have not been sufficiently coercive to compel the respondent ASADA to fulfill its legal and constitutional obligations.
This Chamber cannot allow the right of access to potable water in highly vulnerable rural communities that have endured severe periods of drought during the dry season, such as the sector of Carrillo, Guanacaste, to be obstructed by merely administrative or personal disagreements or by the respondent ASADA’s lack of willingness. Consequently, the proper course in the matter under examination (sub examine) is to grant the petition for amparo, first, against ASADA de Castilla de Oro, so that it adds to its billing database the users in the sector illegally operated by Comité Castilla de Oro El Guácimo and carries out the works necessary to interconnect the two systems. The petition must also be granted against AyA so that it supervises compliance with the outstanding requirements and procedures, thereby ultimately enabling the respondent ASADA to resume issuing potable-water service-availability letters, which would benefit both the petitioners and the other persons awaiting authorization for this public service.
This is especially so considering that, according to the information provided under oath, the well to which the respondent ASADA intends to connect recently underwent water-quality testing and a 72-hour pumping test, with satisfactory results indicating that it can supply both communities. In other words, hydraulic capacity (capacidad hidráulica) to provide the public service does exist, but the petitioners and the other residents of the community have been harmed by the lack of interest in addressing the problem.
V.Finally, it should be clarified to the respondent ASADA that its concern regarding the lack of financial resources to perform the required works cannot be resolved in these proceedings. The ASADA’s representative states that the minimum required works have not been completed due to a lack of financial resources. She submits photographic images taken on 09 de octubre del 2024 showing that the collection tank (tanque de captación) has yet to be installed and interconnected with the new pipeline, that the pipes have not been connected to the meters, and that 300 metros of the new pipeline and two branch lines remain to be installed, among other outstanding works. However, financing for the completion of these works must be addressed through ordinary legal proceedings, whether before AyA or in the ordinary courts, since this Court has jurisdiction solely to determine the existence of a violation of the petitioners’ fundamental right of access to potable water, which was established in the record. The manner in which those outstanding works for the improvement of the water-supply system administered by ASADA de Castilla de Oro are to be financed is, however, plainly a matter of ordinary law that must not be resolved in this jurisdiction.
The parties are hereby advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these items must be collected from the court within a maximum period of treinta días hábiles counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI and published in the Boletín Judicial N° 19 del 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Therefore (Por tanto):
The petition is granted. Georgina Garro Mora, in her capacity as Sub Gerente de Gestión de Sistemas Delegados del AyA, or whoever may hold that office in her stead, is ordered to issue the pertinent directives and undertake all actions within the scope of her authority to ensure that, within DOCE MESES counted from notification of this Judgment, ASADA de Castilla de Oro has completed the outstanding procedures, requested improvements, and any other actions required so that the issuance of public-service availability letters may resume in the community of Belén de Carrillo, Guanacaste. In addition, Juana Lizbeth Barrantes Gutiérrez, in her capacity as Apoderada Judicial y Extrajudicial con carácter de Apoderada Generalísima sin límite de suma de la ASADA de Castilla de Oro, Belén, Carrillo, Guanacaste, or whoever may hold that office in her stead, is ordered to issue the pertinent directives and undertake all actions within the scope of her authority so that, within the same period of DOCE MESES counted from notification of this Judgment, she adds to its billing database the users in the sector illegally operated by Comité Castilla de Oro El Guácimo and carries out the works necessary to interconnect the two systems, so that the issuance of potable-water service-availability letters may resume upon expiration of that same period.
The respondent authorities are warned that, in accordance with artículo 71, de la Ley de la Jurisdicción Constitucional, any person who receives an order issued in amparo proceedings that must be complied with or enforced, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. AyA and ASADA Castilla de Oro, respectively, are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the Judgment before the administrative-law courts and through the corresponding civil proceedings.- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticinco de octubre de dos mil veinticuatro .
Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], y [Nombre 002], cédula de identidad [Valor 002], contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO (ASADA) DE CASTILLA DE ORO, BELÉN, CARRILLO, GUANACASTE, y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).
Resultando:
aportar la solicitud llena, con su Estudio Registral del Inmueble, plano catastrado, número de medidor de cada uno de los 63 servicios. Como prueba de este hecho, adjunto recibido de la carta completa y de Informe de Diagnóstico Técnico emitido en anexo. La ASADA CASTILLA DE ORO, el día 16 de agosto del 2024, solicitó una vez más una prórroga debidamente fundamentada, ya que TODA integración de acueductos debe tener como fin principal un mejoramiento en la gestión; sin embargo SIN TERMINAR LAS MEJORAS MÍNIMAS que deben realizar en el sistema, no es factible que la ASADA los asuma, por todo lo anteriormente expuesto. Somos conscientes que se han generado acuerdos, que el AyA ha colaborado, el Comité del Guácimo continúa trabajando, se han generado bitácoras, planes de trabajo, reuniones, informes contables, pero las obras MÍNIMAS NO SE HAN TERMINADO, por falta de recursos económicos, aporto imágenes captadas el día 09 de octubre del 2024, donde demuestro mi dicho, aún se encuentra el tanque de captación sin instalar e interconectar con la nueva tubería, las tuberías no se encuentran conectadas a los medidores, falta la instalación de 300 metros de la nueva tubería y dos ramales, de ninguna forma podemos irresponsablemente aceptar un sector en el cual NO tenemos los recursos económicos para invertir, ya que el servicio que una ASADA debe mantener debe ser bajo los parámetros establecidos por la legislación prestación óptima en cuanto a calidad, cantidad, continuidad, confiabilidad, acceso universal, eficiencia, oportunidad, sostenibilidad.
La ASADA CASTILLA DE ORO y el COMITÉ DEL GUACIMO en la actualidad estamos trabajando arduamente por realizar las mejoras en los acueductos de ambos sectores y así poder brindar o suministrar un servicio en condiciones de calidad, continuidad, eficiencia, eficacia, para GARANTIZAR un SERVICIO ÓPTIMO, tal y como lo indica nuestra legislación. No es cierto que a la recurrente [Nombre 002], dueña del inmueble 5-217994-000 se les violente de alguna manera los sagrados derechos humanos y constitucionales estipulados en el artículo 21,50 y 65, el Derecho a la vida humana, a un ambiente sano o que el estado o nuestra institución en condición de administradores le estemos limitando algún derecho, el estado debe promover la construcción de viviendas populares, pero de acuerdo con el ordenamiento jurídico existente, sin embargo, ese NO puede ser este un argumento para otorgar servicios de agua cuando NO proceden, debido a la falta de capacidad hídrica o hidráulica en este caso específico.
La ASADA NO está obligada a prestar el servicio si no ha otorgado previamente una constancia de disponibilidad de servicios positiva, que permitiera a las personas gestionar los debidos permisos municipales de construcción de sus inmuebles conforme lo establecido en los numerales 67 y 68 del Reglamento para la Prestación de servicios. Solicita a la Sala que declare sin lugar el recurso.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La parte recurrente alega que son propietarios de la finca N° 5-217994-000, situada en Belén de Carrillo, Guanacaste y en ella pretenden construir su vivienda, para lo cual requieren la constancia de disponibilidad de servicio de agua potable. Sin embargo, acusan que la ASADA recurrida no está entregando dichas constancias, debido a problemas administrativos ya que el pozo que utilizan no está concesionado a su favor y por eso no lo pueden usar. Acusa que el AyA no ha intervenido diligentemente en el asunto.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el derecho fundamental al suministro de agua potable. Este Tribunal ha dispuesto, en otros asuntos similares, que como parte del Derecho de la Constitución existe un derecho fundamental al suministro de agua potable, siendo que específicamente en Sentencia N° 2003-4654 de las quince horas con cuarenta y cuatro minutos del veintisiete de mayo de dos mil tres, se dispuso, en lo conducente:
“V.- La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que: “Artículo 11.
Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos. VI.- Del anterior marco normativo se deriva una serie de derechos fundamentales ligados a la obligación del Estado de brindar los servicios públicos básicos, que implican, por una parte, que no puede privarse ilegítimamente de ellos a las personas, pero que, como en el caso del agua potable, no puede sostenerse la titularidad de un derecho exigible por cualquier individuo para que el Estado le suministre el servicio público de agua potable, en forma inmediata y dondequiera que sea, sino que, en la forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan a los Estados a adoptar medidas, conforme lo dispone el artículo primero del mismo Protocolo (…)”.
IV.Sobre el caso concreto. En el sub lite, la parte recurrente acude ante esta Sala, debido a que son propietarios de la finca N° 5-217994-000, situada en Belén de Carrillo, Guanacaste y en ella pretenden construir su vivienda, para lo cual requieren la constancia de disponibilidad de servicio de agua potable. Sin embargo, acusan que la ASADA recurrida no está entregando dichas constancias, debido a problemas administrativos ya que el pozo que utilizan no está concesionado a su favor y por eso no lo pueden usar. Acusa que el AyA no ha intervenido diligentemente en el asunto. Al respecto, la Sala tiene por demostrado que desde febrero de 2023 se notificó formalmente a la ASADA recurrida que no podía seguir brindando constancias de disponibilidad de agua, porque su acueducto carecía de factibilidad técnica y legal para la operación. Se acreditó que el pozo no se encuentra registrado a nombre de la ASADA recurrida ante la Dirección de Aguas del MINAE, además de que los diámetros de tubería son insuficientes.
En virtud de ello, se logró tramitar una donación de 332 tubos de pvc, mediante el programa de pequeñas comunidades en riesgo sanitario, a fin de que la ASADA Castilla de Oro-Ojochal se pudiera conectar con el pozo del sector aledaño Castilla de Oro-El Guácimo, el cual sí goza de legalidad. El pozo al cual se pretende conectar la ASADA accionada se le realizaron recientemente unos exámenes de calidad de agua y una prueba de bombeo de 72 horas, dando un resultado satisfactorio para poder abastecer ambas poblaciones. La solución técnica y a corto plazo es que la ASADA Castilla de Oro amplíe su zona de competencia y opere el sistema de acueducto del Comité Castilla de Oro El Guácimo. La ORAC Región Chorotega del AyA tramitó el 10 de junio del 2024 la solicitud de aumento de caudal ante la Subgerencia de Gestión de Sistemas Comunales, para abastecer los usuarios de la ASADA y la nueva demanda del sistema.
Actualmente se encuentra pendiente por parte de la ASADA Castilla de Oro, la inclusión de los usuarios del Comité en su base de datos de facturación y la implementación de las obras necesarias para la interconexión de ambos sistemas de acueducto, que corresponden a acciones propias de la ASADA. La ASADA accionada está utilizando un pozo ilegal, mismo que la Dirección de Aguas del MINAE les indicó que se debía sellar, por lo cual, están poniendo en riesgo a sus usuarios actuales, pues en cualquier momento pueden quedarse sin el recurso hídrico que están utilizando de forma ilegal. El AyA explica a la Sala que la situación causa afectación a los terceros de buena fe, quienes tienen años a la espera de un servicio de acueducto, para poder construir una casa digna, pues se reitera, en la actualidad ninguno de estos dos operadores de acueducto (ASADA – Comité) pueden emitir constancias de disponibilidad de servicios u otorgar nuevos servicios.
A la fecha, se encuentra pendiente que la ASADA Castilla de Oro incluya en su base de datos de facturación a las personas usuarias del sector que opera ilegalmente el Comité Castilla de Oro El Guácimo y realice las obras necesarias para la interconexión de ambos sistemas. Ante este panorama, la Sala estima que se debe acoger el amparo, tanto contra el AyA pero especialmente contra la ASADA accionada, por estar lesionando en este momento no solo el derecho fundamental de acceso al agua en perjuicio de los amparados, sino de otros interesados de esa zona en acceder al servicio público demandado. En efecto, este Tribunal aprecia si bien se han venido realizando una serie de acciones, reuniones y diversas coordinaciones, así como oficios y recomendaciones por parte del AyA hacia la ASADA accionada, ambos recurridos aceptan que la situación continúa y no ha podido ser solventada. De lo revisado en los autos, se aprecia que la ASADA es quien, principalmente, está retrasando las mejoras y demás actuaciones que deben concretarse para que se pueda retomar la emisión de cartas de disponibilidad.
Verbigracia, según explica el AyA bajo juramento, se encuentra pendiente que la ASADA Castilla de Oro incluya en su base de datos de facturación a las personas usuarias del sector que opera ilegalmente el Comité Castilla de Oro El Guácimo y realice las obras necesarias para la interconexión de ambos sistemas. Incluso, se observa que se ha efectuado una donación de materiales para lograr la interconexión entre las comunidades; empero, las obras no se han ejecutado. Este retraso y desidia comprobada por parte de la ASADA accionada hace que se estén vulnerando los derechos fundamentales de los promoventes, así como de los demás vecinos interesados en la ampliación de la cobertura y la ejecución de las obras. La ASADA recurrida esgrime una serie de argumentos y justificaciones en la contestación que brinda a esta Sala en el presente recurso de amparo; empero, ninguna de ellas es suficiente para validar los retrasos verificados tanto por parte del AyA como de este Tribunal.
Aunado a lo anterior, si bien el AyA ha desarrollado una serie de actuaciones tendentes a resolver la problemática que sufren tanto los tutelados como demás vecinos de la localidad, lo cierto del caso es que las mismas no han sido suficientemente coercitivas para obligar a la ASADA accionada a cumplir con sus obligaciones legales y constitucionales. Esta Sala no puede permitir que el derecho de acceso al agua potable en comunidades rurales tan vulnerables y que han sufrido groseros periodos de sequías en la época de verano, como lo es el sector de Carrillo, Guanacaste, sea obstaculizado por desacuerdos meramente administrativos o de índole personal, así como falta de voluntad por parte de la ASADA accionada. En consecuencia, lo procedente en el sub examine es acoger el amparo, en primer lugar, contra la ASADA de Castilla de Oro, con el propósito que incluya en su base de datos de facturación a las personas usuarias del sector que opera ilegalmente el Comité Castilla de Oro El Guácimo y realice las obras necesarias para la interconexión de ambos sistemas.
Además, contra el AyA, con el fin de que supervise el cumplimiento de los requisitos y trámites faltantes a efectos de que, finalmente, la ASADA accionada pueda retomar la emisión de cartas de disponibilidad de agua potable, que beneficiarían tanto a los recurrentes como a las demás personas que están esperando por la autorización de este servicio público, sobre todo tomando en consideración que, según se informó bajo juramento, el pozo al cual se pretende conectar la ASADA accionada se le realizaron recientemente unos exámenes de calidad de agua y una prueba de bombeo de 72 horas, dando un resultado satisfactorio para poder abastecer ambas poblaciones. Es decir, que sí existe capacidad hidráulica para brindar el servicio público, pero por la falta de interés en atender el problema, los recurrentes y demás vecinos de la localidad se han visto perjudicados.
V.Finalmente, valga aclararle a la ASADA recurrida que su preocupación por la falta de presupuesto económico para realizar las obras requeridas, no es posible dirimirlo en esta vía. La representante de la ASADA indica que las obras mínimas no se han terminado, por falta de recursos económicos. Aporta imágenes fotográficas captadas el día 09 de octubre del 2024, donde demuestra que aún se encuentra el tanque de captación sin instalar e interconectar con la nueva tubería, las tuberías no se encuentran conectadas a los medidores, falta la instalación de 300 metros de la nueva tubería y dos ramales, entre otros trabajos pendientes. Sin embargo, el financiamiento para concluir estas obras debe ser discutido en la vía de la legalidad, sea ante el AyA o en la sede ordinaria, toda vez que a este Tribunal le compete únicamente verificar la existencia de la lesión al derecho fundamental de acceso al agua potable, en perjuicio de los recurrentes, lo cual así se demostró en autos; no obstante, ya la forma en que deberán financiarse tales obras pendientes para el mejoramiento del acueducto que administra la ASADA de Castilla de Oro, es un tema de evidente legalidad que no debe resolverse en esta jurisdicción.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se le ordena a Georgina Garro Mora, en su condición de Sub Gerente de Gestión de Sistemas Delegados del AyA, o a quienes en sus lugares ocupen dichos cargos, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de su competencia para que, dentro del plazo de DOCE MESES, contado a partir de la notificación de esta Sentencia, se garantice que la ASADA de Castilla de Oro haya concluido con los trámites pendientes, mejoras solicitadas y demás actuaciones que se requieran, para que se retome la emisión de cartas de disponibilidad del servicio público en la comunidad de Belén de Carrillo, Guanacaste. Además, se le ordena a Juana Lizbeth Barrantes Gutiérrez, en su condición de Apoderada Judicial y Extrajudicial con carácter de Apoderada Generalísima sin límite de suma de la ASADA de Castilla de Oro, Belén, Carrillo, Guanacaste, o a quienes en sus lugares ocupen dichos cargos, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de su competencia para que, dentro del mismo plazo de DOCE MESES, contado a partir de la notificación de esta Sentencia, incluya en su base de datos de facturación a las personas usuarias del sector que opera ilegalmente el Comité Castilla de Oro El Guácimo y realice las obras necesarias para la interconexión de ambos sistemas, de manera que pueda retomar la emisión de cartas de disponibilidad de agua potable al finalizar ese mismo plazo.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al AyA y a la ASADA Castilla de Oro, respectivamente, al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de Sentencia de lo contencioso administrativo, así como en la vía civil correspondiente.- Fernando Castillo V.
