Document Review *240261950007CO* Decision No. 2024030786 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty in the morning on the eighteenth day of October, two thousand twenty-four.

Writ of amparo (recurso de amparo) proceeding under case No. 24-026195-0007-CO, filed by [Name 001], identity card number [Value 001], against the MUNICIPALIDAD DE CURRIDABAT.

Findings:

  1. 1In a written submission received by the Secretariat of the Chamber at 12:33 on September 19, 2024, the petitioner filed a writ of amparo. She states that on July 3, 2024, she sent an email to the Municipalidad de Curridabat requesting the following: “(…)I am writing to request your assistance with the cleaning, maintenance, or inspection of the stormwater infrastructure in Urbanización La Troja, specifically in front of house 69b and the houses along the 100m stretch of that road. In recent weeks, we have observed a significant accumulation of waste and sediment in the stormwater drainage systems in this area. This has resulted in obstructions that impede the proper flow of water, causing flooding and other problems during rainfall. Among the problems is that the street floods, and sewage waste may be exposed, seep between sidewalks and houses, and obstruct access to them by people and pets.To prevent any adverse situation, I consider it urgent and necessary to carry out a thorough cleaning and review of the situation (if the sewer lacks sufficient capacity) involving the sewers, channels, and any other related infrastructure. This intervention will not only ensure the efficiency of the stormwater system but will also contribute to the safety and well-being of residents, pedestrians, and pets. I thank you in advance for your attention to this request and remain available to coordinate any details necessary to carry out this work. I would also appreciate any information regarding the schedule and procedures planned for the requested work. I further note that this matter has already been submitted through the form provided on your website.(…)”. On July 3, she received an email from Xinia Durán stating the following: “Good morning, Ms. [Name 001]. Your email is being forwarded to the institutional email address [email protected] so that they may assign a processing number to your request and forward it to the Departamento de Protección del Medio Ambiente and the Dirección de Gestión Vial.” On July 18, she received notice of document MC-PMA-0580-07-2024, under processing number 14826-2024, which stated: “We will conduct an inspection as soon as possible to confirm the alleged problem you described.” On July 29, she received document MC-PMA-0600-07-2024 from the Municipality, which stated: “On 16-07-2024, our field personnel carried out general cleaning in the La Troja area.No obstructions or signs of any more serious problem requiring attention by this department were found. In other words, the work performed consisted of the usual removal of waste, sediment, and sludge found in the sewers. In addition, on 17-07-2024, the cleaning was inspected, and no signs of blockages or obstructions were found in front of your residence. Accordingly, this department considers its work concluded. Nevertheless, we have asked our colleagues at the Plataforma de Servicios to forward your case to the Unidad de Gestión Vial in the event that an infrastructure issue requires attention.” In this regard, she sent several replies to the email they had sent her; however, she decided to supplement them through a formal request dated July 29, 2024, stating the following: “Further to processing number 14826-2024 and the communications received, MC-PMA-0580-07-2024 and MC-PMA-0600-07-2024, concerning a public-health issue caused by overflowing sanitary sewers, I am submitting two videos that the Unidad de Gestión Vial should consider.” She alleges that she informed the Municipalidad de Curridabat of the public-health issue affecting her due to the overflowing sanitary sewers, which leave foul-smelling waste and restrict her right to freedom of movement because she cannot leave her home when the sewer overflows.She complains that the submitted requests have not been adequately monitored or followed up, as she has received no response since July 29 and, consequently, the problem involving the stormwater sewer system or wastewater in Urbanización La Troja has not been repaired or corrected. She asks that the petition be granted.
  2. 2By an order issued at 7:42 on September 25, 2024, the proceeding was admitted, and reports were requested from the Mayor, the Head of the Departamento de Protección del Medio Ambiente, and the Director of the Dirección de Gestión Vial, all of the Municipalidad de Curridabat. The order was served on the respondent authority on September 26, 2024.
  3. 3Errol Solano Bolaños, in his capacity as Mayor of, Randall Rodríguez Araya, in his capacity as Director of Road Management, and Jose Manuel Retana Vindas, in his capacity as Head of Environmental Protection, all from the Municipalidad de Curridabat, report. They explain: “2.- REGARDING THE RESPONSE TO THE PETITIONER’S REQUEST AND THE REPORT ORDERED BY THE CHAMBER: Engineer Randall Rodríguez Araya, Director of Road Management, reports to this representation, by official letter MC-DGV-0746-10-2024 of 01 de octubre del 2024, regarding this case in Urbanización La Troja, Distrito Curridabat, in which flooding and other problems with the stormwater system (sistema pluvial) during rainfall are reported, as follows: Coordination was undertaken with the Department of Environmental Protection concerning the cleaning of the pipes in the Urbanización La Troja sector, performed by municipal crews (MC-PMA-0600-07-2024 attached), and it was confirmed that the stormwater pipes were not obstructed.The case was subsequently reviewed with staff from the Risk Management Unit, who, by reviewing the weather stations operated by the Municipalidad de Curridabat at various points throughout the canton, monitored the date shown in the video submitted by Ms. Castillo, dated 26 de julio del 2024 (image 02), which shows water overflowing from the drainage channel in front of her home. They determined that this coincided with an extremely heavy downpour that affected the Cantón de Curridabat, causing atypical rises in the flow rates of the Quebrada that runs along Urbanización La Troja and into which the development’s stormwater pipes discharge. As may be seen in image 01 of the aforementioned official letter, which shows a graph of rainfall intensities recorded at the Ibata (sic) weather station in Curridabat, specifically for 26 de julio del 2024 (see RED line), the date of the video (Image 02), rainfall intensity on that particular day exceeded 70mm of precipitation, a situation that affects the stormwater systems installed during construction of the residential development.As can be seen, this increase in rainfall is directly linked to climate change, which affects the entire world, and Curridabat is not exempt from this phenomenon, which generates large amounts of rainfall over very short periods, causing drainage systems to become overwhelmed quickly and water to overflow. This is confirmed once the rainfall ceases and water levels return to normal. Likewise, the same graph shows that, historically, during the month of September over the past 4 years, rainfall events of approximately 60 to 70 mm of precipitation have occurred, generating this type of inconvenience for the population. This situation is addressed jointly with Environmental Protection staff, who conduct scheduled cleanings of the stormwater system to minimize the impact on the population of the increased rainfall typical of the rainy season. (See all statements in the attached official letter.) For his part, biologist José Manuel Retana Vindas, Head of Environmental Protection, by official letter MC-PMA-0859-10-2024 dated 01 de octubre del 2024, reports on the actions carried out by his department: First, proceeding #14826-2024 was formally received, and a response was provided through official letters MC-PMA-0580-07-2024 and MC-PMA-0600-07-2024 (documents attached).In this instance, the case involved a complete inspection of the neighborhood, the corresponding cleaning, and verification of the storm drain inlets (tragantes). No obstructions, signs of sewage (aguas negras), or evidence warranting referral to the Ministerio de Salud were found. The sewer drains contained debris ordinarily found during the cleaning of the public stormwater system administered by the Municipality, and the matter was referred to Road Management in case it involved an infrastructure issue. After our referral to Road Management staff, we received no inquiries or formal resubmission concerning this matter. Second, as part of the work performed during this first week of October 2024, our crews have been servicing the route for cleaning the Bilbaína, Santa Cecilia, la Troja, and Multifamiliares sectors. Accordingly, the crews conducted an inspection and cleaning in the Barrio la Troja sector today, 01-10-2024, and went to the complainant’s residence.There was no response, but it was again verified that the storm drain inlet, which falls within the responsibility of our field personnel, had no obstructions, sediment, or any other debris or condition requiring attention. Nevertheless, what appear to be damp inspection boxes (cajas de registro) were observed on the sidewalk, which we assume may be connected to the home’s own sanitary system, meaning the outlets and cleaning systems associated with the home’s septic tank. As is well known, the cleaning of each home’s sanitary system (usually a septic tank) is the responsibility of its owners; and if there is a formal system approved and operated by AyA for sewage collection, the appropriate course is to make arrangements with that entity if the problem concerns its systems. In addition to the foregoing, and as can be seen from the attachments associated with this amparo proceeding (Recurso de Amparo) number, no additional material relating to this complaint, or the videos mentioned, was provided, since it appears that the matter was directed to the Service Platform and the Road Management Unit after our referral.Finally, as may be seen in the annex section at the end of this document, the municipal crews responsible for the public storm sewer system administered by the Municipality found no problem related to our work. Accordingly, it has been established that our represented party has addressed all requests submitted by the petitioner (recurrente), requesting that the competent institutions, such as the Instituto Costarricense de Acueductos y Alcantarillados, jointly inspect and resolve the petitioner’s problem with our represented party, through official letter MC-DGV-0747-10-2024 (attached). The amparo petition should therefore be dismissed and denied, since her complaint was handled diligently. Furthermore, it must be considered that the heavy rains and inclement weather contributed to an abnormal situation that day and resulted in flooding emergencies in many parts of the country where they had never occurred before; however, inspection of the sewer drains confirmed that they were clean and that the event resulted solely from the excessive amount of rainfall.” They request that the petition be denied.
  4. 4The statutory requirements have been observed in the proceedings followed.

Justice Fernandez Acuña drafted the decision; and,

Considering:

I.Preliminary Matter. Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied with the deadlines established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws governing special administrative proceedings, for resolving an administrative proceeding—initiated ex officio or at the request of a party—through a final administrative act, or for hearing the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception—supported by the majority of this Constitutional Court—because it concerns an environmental complaint that the respondent Municipalidad allegedly failed to resolve within a reasonable period. Having clarified this point, the specific situation raised in this amparo proceeding will now be decided.

II. SUBJECT MATTER OF THE PETITION

The petitioner states that, on 3 de julio de 2024, she sent an email to the Municipalidad de Curridabat requesting its assistance with the cleaning, maintenance, or inspection of stormwater infrastructure in Urbanización La Troja, specifically in front of house 69b and the houses along 100m of that roadway. She did so because rainfall has caused a significant accumulation of debris and sediment in the stormwater drainage systems in that area, obstructing and impeding the proper flow of water and causing flooding and other problems during rainfall that prevent people and pets from entering. She complains that, as of the date the petition was filed, the proceedings undertaken had not been adequately monitored or followed up because she had received no response since 29 de julio, and consequently the problem with the storm sewer system or wastewater in Urbanización La Troja had not been repaired or corrected. She requests that the petition be granted.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent authority failed to address them as ordered in the initial ruling:

On 3 de julio de 2024, the petitioner sent an email to the Municipalidad de Curridabat requesting the following: “(…) I am writing to request your assistance with the cleaning, maintenance, or inspection of the stormwater infrastructure in Urbanización La Troja, specifically in front of house 69b and the houses along 100m of that roadway. In recent weeks, we have observed a significant accumulation of debris and sediment in the stormwater drainage systems in this area. This has caused obstructions that impede the proper flow of water, resulting in flooding and other problems during rainfall. These problems include the street becoming flooded and the possibility that sewage residue may be exposed, seep between sidewalks and homes, and obstruct access to them by people and pets. To prevent any adverse situation, I consider it urgent and necessary to conduct a thorough cleaning and review of the condition (if the sewer lacks sufficient capacity) of the sewer drains, channels, and any other related infrastructure.

This intervention will not only ensure the efficiency of the stormwater system but will also contribute to the safety and well-being of residents, passersby, and pets. I thank you in advance for your attention to this request and remain available to coordinate any details necessary to carry out this work. I would also appreciate any information regarding the schedule and procedures planned for the requested work. I further note that this matter has also been submitted through the form provided on your website. (…)” (see evidence) The email addresses to which the petitioner sent her complaint are designated as official means of communication with the respondent Municipalidad de Curridabat (see report).

On 3 de julio de 2024, municipal official Xinia Durán responded to the petitioner as follows: “Good morning, Ms. [Nombre 001]. Your email is being forwarded to the institutional email address [email protected] so that your request may be assigned a proceeding number and referred to the Department of Environmental Protection and the Directorate of Road Management.” (see evidence).

On July 16, 2024, the respondent Municipality (Municipalidad recurrida), through its field personnel, carried out general cleaning in the La Troja sector. No obstructions or indications of any major problem requiring attention by this department were found. The work performed consisted of the customary removal of waste, sediment, and sludge found in the sewers. (see report), On July 17, 2024, the respondent Municipality inspected the cleaning work and found no indications of blockages or obstructions in front of her residence. Accordingly, it deemed its actions concluded. It requested that the Service Platform refer her case to the Road Management Unit if there was an infrastructure issue requiring attention (see evidence).

On July 18, 2024, the petitioner (recurrente) was served with official letter MC-PMA-0580-07-2024, indicating proceeding number 14826-2024. The details of the case were provided, noting that the entire neighborhood had been inspected and cleaned and that the storm drains (tragantes) had been checked. No obstructions, indications of sewage, or evidence warranting referral to the Ministerio de Salud were found. The sewers contained the waste ordinarily removed during cleaning of the public stormwater system (sistema pluvial público) administered by the Municipality, and a referral to Gestión Vial was requested in case the matter involved an infrastructure issue. After the referral to Gestión Vial, no further inquiries or formal resubmissions concerning this matter were received, and it was stated that “we will conduct an inspection as soon as possible to confirm the alleged problem described by you.” (see report and evidence).

On July 29, 2024, through official letter MC-PMA-0600-07-2024, the respondent Municipality replied: “In follow-up to proceeding 14826-2024 and received official letters MC-PMA-0580-07-2024 and MC-PMA-0600-07-2024. Regarding a public-health matter arising from sanitary sewer overflows. I am attaching two videos for consideration by the Road Management Unit.” (see report) On September 26, 2024, the decision admitting the present proceeding was served on the respondent authority (case record).

On October 01, 2024, crews from the Municipalidad de Curridabat performed cleaning work along the route covering the La Bilbaína, Santa Cecilia, La Troja, and Multifamiliares sectors. The crews conducted an inspection and cleaning in the Barrio La Troja sector and went to the complainant’s residence. As they received a response, they proceeded to verify once again that the storm drain—which falls within the responsibility of municipal field personnel—had no obstructions, sediment, or any other waste or condition requiring attention. The municipal officials observed utility access boxes (cajas de registro) on the sidewalk showing signs of moisture, which might, in principle, be connected to the residence’s own sanitary system, that is, the outlets and cleaning systems associated with the residence’s septic tank. Because cleaning the sanitary system—usually a septic tank—is the responsibility of each homeowner, and if there is a formal sewage collection system approved and operated by AyA, the appropriate course is to take the necessary steps with that entity if the problem concerns its systems (see report and evidence).

The municipal crews responsible for the public stormwater sewer system administered by the Municipality found no problem related to their work. They have addressed all requests made by the petitioner and have contacted the competent institutions, including the Instituto Costarricense de Acueductos y Alcantarillados, through official letter MC-DGV-0747-10-2024 dated October 01, 2024, so that it may jointly inspect the matter with the respondent Municipality and resolve the petitioner’s problem (see report and evidence).

On October 01, 2024, official letter MC-DGV-0748-10-2024 dated October 01, 2024, was issued to petitioner Castillo, informing her of the request for a joint inspection with AyA to assess the problem she reported.

IV. UNPROVEN FACTS

The following facts relevant to the adjudication of this proceeding have not been proven:

  • a)That the petitioner submitted any request or complaint to the Office of the Comptroller of Services (Contraloría de Servicios) of the respondent Municipality and did not receive a response.
  • b)That official letter MC-DGV-0748-10-2024 dated October 01, 2024, in which the respondent Municipalidad de Curridabat informed the petitioner that it had asked the Instituto Costarricense de Acueductos y Alcantarillados to work jointly with the Municipality to assess and resolve the water-overflow problem in front of her property, was communicated to her.

V. THE SPECIFIC CASE

In this matter, the petitioner claims that her request for assistance with the cleaning, maintenance, or inspection of the stormwater or wastewater infrastructure in Urbanización La Troja, specifically in front of house 69b and the houses located along 100m of that road, submitted on July 03, 2024, has not been addressed despite the risk posed by the overflow of water at that location. In its response, the respondent authority informed this Chamber that the complaint submitted by the petitioner was formally assigned proceeding #14826-2024 and that she was provided with a response through official letters MC-PMA-0580-07-2024 and MC-PMA-0600-07-2024 (documents attached).

An analysis of the evidence entered into the case file (expediente) shows that, in official letter MC-PMA-0600-07- 2024 dated July 17, 2024, the environmental inspector from Protección del Medio Ambiente of the Municipalidad de Curridabat clearly informed the applicant (gestionante) of the actions taken to address her request. Specifically, she explained: “On 16-07-2024, our field personnel performed general cleaning in the La Troja sector. No obstructions or indications of any major problem requiring attention by this department were found. In other words, the work performed consisted of the customary removal of waste, sediment, and sludge found in the sewers. In addition, on 17-07-2024, the cleaning work was inspected, and no indications of blockages or obstructions were found in front of your residence. Accordingly, this department deems its actions concluded. Before doing so, however, we asked our colleagues at the Service Platform to refer your case to the Road Management Unit in the event that there is an infrastructure issue requiring attention.” In addition to cleaning and verifying the condition of the storm drains at the location, the petitioner was informed, according to the report submitted to this Chamber, that no obstructions, indications of sewage, or evidence warranting referral to the Ministerio de Salud had been found.

The sewers contained the waste ordinarily removed during cleaning of the public stormwater system administered by the Municipality, and a referral to Gestión Vial was requested in case the matter involved an infrastructure issue.

Subsequently, two and a half months later and after the September 27, 2024 service of the decision admitting this proceeding, on October 01, 2024, crews from the Municipalidad de Curridabat serviced the cleaning route covering the La Bilbaína, Santa Cecilia, La Troja—where the protected party (tutelada) resides—and Multifamiliares sectors. The report on the inspection conducted in October in front of the petitioner’s residence states that no obstructions or sediment requiring removal were observed. The respondent authority also observed “moisture” in what appeared to be cleanout boxes (ceniceros) belonging to the residence, which it believed could be related to obstructions directly involving the septic tank or associated sewage systems.

Despite the measures taken, there is no evidence that the protected party was informed of the work performed by the Municipality on October 01 to resolve the reported problem. Nor is there evidence that the amparo petitioner (amparada) was informed that, regarding the overflow of wastewater from the sewage pipes and access boxes affecting the petitioner, the Municipalidad de Curridabat determined that, because it does not provide drinking-water or sanitary-sewer services—and because it considered those matters to fall within the authority of the Instituto Costarricense de Acueductos y Alcantarillados—it had requested, through official letter MC-DGV-0747-10-2024, a joint inspection with that institution to assess the matter reported by Ms. [Nombre 001].

Accordingly, although this Chamber has evidence that, through MC-DGV-0747-10-2024 dated October 01, 2024, the respondent authority asked the Instituto Costarricense de Acueductos y Alcantarillados on October 01, 2024, to work jointly with the respondent Municipality to assess the wastewater-overflow situation that the petitioner states is affecting her property, there is no evidence that official letter MC-DGV-0748-10-2024 dated October 01, 2024, which was intended to inform petitioner Castillo of the request for a joint inspection with AyA, was actually sent to her.

Because there is no evidence that the response prepared by the Municipalidad de Curridabat as of October 02, 2024, when it submitted its report to this Chamber, was actually sent to the petitioner’s email address, even though she had designated that means for receiving notices, this Court finds that the omission by the authorities of the Municipalidad de Curridabat violated the protected party’s right to prompt and proper administrative proceedings (procedimiento administrativo pronto y cumplido), because they failed to notify the amparo petitioner of the measures adopted in October 2024 in response to her complaint. Consequently, the appeal for constitutional relief (recurso) must be granted, and the respondent Municipality must be ordered to notify the amparo petitioner of the decision concerning her complaint and, within the scope of its authority, seek a final resolution of the complaint submitted by the petitioner, as is hereby ordered.

VI. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant (justiciable) alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo) and not by this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through an amparo proceeding (recurso de amparo) established by article 32 of the Ley de la Jurisdicción Constitucional, in connection with article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts (actos administrativos), or response are affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent (línea jurisprudencial), since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Accordingly, except for those legal-constitutional disputes (controversias jurídico-constitucionales) that this Chamber itself has recognized as exceptional circumstances and that may indeed be heard in this jurisdiction through the constitutional guarantee proceeding of amparo (proceso constitucional de garantía del amparo), in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 on 22 de febrero de 2008), jurisdiction lies with the Judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of the foregoing is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VII.Partial dissenting opinion (voto salvado parcial) of Justice Garro Vargas regarding the operative portion (parte dispositiva) of this judgment.

Although I agree with the majority of the Chamber that the appeal should be granted, I disagree as to the forum in which the enforcement phase (fase de ejecución) of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters, as in this case, where the Municipalidad de Curridabat and the Instituto Costarricense de Acueductos y Alcantarillados are ordered, within a maximum period of three months from notification of this judgment, to coordinate the appropriate actions in order to take the measures necessary to resolve the wastewater overflow problem in Urbanización La Troja del Cantón de Curridabat alleged by the appellant.

In contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement have clear advantages, such as the possibility of requiring schedules, imposing fines, establishing liability, monitoring stages of compliance, etc. Therefore, pursuant to article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase must be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules (reglas de ejecución de sentencia) of that Code.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced through new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The appeal is granted. Errol Solano Bolaños, in his capacity as Mayor, Randall Rodríguez Araya, in his capacity as Director de Gestión Vial, and Jose Manuel Retana Vindas, in his capacity as Jefe de Protección al Medio Ambiente, all of the Municipalidad de Curridabat, or whoever may respectively hold those offices, are ordered, if they have not already done so, to coordinate whatever is necessary to ensure that official communication MC-DGV-0748-10-2024 of 01 de octubre de 2024 is served on the protected party (amparada). They are also ordered, within a maximum period of three months from notification of this judgment, to coordinate with the Instituto de Acueductos y Alcantarillados and to take the necessary and appropriate measures falling within the scope of their authority in order to provide a definitive solution to the water overflow problem in Urbanización La Troja del Cantón de Curridabat reported by the appellant.

The respondents are warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty. The Municipalidad de Curridabat is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. Justice Castillo Víquez files a note. Justice Garro Vargas dissents regarding the enforcement of this judgment and, pursuant to article 56 of the Ley de la Jurisdicción Constitucional, determines that it must be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded to that office so that proceedings to enforce this ruling may be initiated. Let notice be given.

Revisión del Documento *240261950007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del dieciocho de octubre de dos mil veinticuatro .

Recurso de amparo que se tramita en expediente nro. 24-026195-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE CURRIDABAT

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 12:33 horas del 19 de setiembre de 2024, la recurrente interpone recurso de amparo. Señala que el 3 de julio de 2024 remitió correo electrónico a la Municipalidad de Curridabat en la que requirió lo siguiente: “(…)Me dirijo a ustedes para solicitarles su colaboración en la limpieza, mantenimiento o fiscalización de la infraestructura pluvial en la Urbanización La Troja, propiamente frente a la casa 69b y casas sobre los 100m de esa vía. En las últimas semanas, hemos observado una acumulación significativa de residuos y sedimentos en los sistemas de drenaje pluvial de esta área. Esto ha resultado en obstrucciones que dificultan el correcto flujo del agua, lo que ha provocado problemas de inundaciones y otros inconvenientes durante las lluvias. Entre los inconvenientes está que la calle se inunda y es posible que los residuos de aguas negras queden expuestos, se colen entre aceras y casas y obstruyan el ingreso de las personas y mascotas a las mismas.Para prevenir cualquier situación adversa, considero urgente y necesario llevar a cabo una limpieza exhaustiva y revisión de la situación (Si es que la alcantarilla no tiene capacidades) de las alcantarillas, canales y cualquier otra infraestructura relacionada. Esta intervención no solo garantizará la eficiencia del sistema pluvial, sino que también contribuirá a la seguridad y bienestar de los residentes, transeúntes y mascotas. Agradezco de antemano su atención a esta solicitud y quedo a su disposición para coordinar cualquier detalle necesario para llevar a cabo estos trabajos. Apreciaría también cualquier información sobre el calendario y los procedimientos previstos para estas labores solicitadas. Agrego además que este tema se ha solicitado vía formulario dispuesto en su página web.(…)”. El 3 de julio siguiente recibió correo de Xinia Durán, en el cual se le indica lo siguiente “Buenos días doña [Nombre 001] se le está enviando su correo al correo institucional: [email protected], para que le den un número de trámite a su gestión y lo remitan al Departamento de Protección del Medio Ambiente y a la Dirección de Gestión Vial.”.El 18 de julio recibió una notificación del documento MC-PMA-0580-07-2024 con el trámite: 14826-2024 y en ese documento le indican “estaremos realizando inspección a la brevedad para confirmar el presunto problema descrito por su persona.”. El 29 de julio siguiente recibió de la Municipalidad el documento MC-PMA-0600-07-2024 en el que citan lo siguiente: “Para el 16-07-2024 se realizó limpieza general por parte de nuestro personal de campo en el sector de la Troja. No se encontraron obstrucciones o indicios de algún problema mayor que se deba atender por parte de este departamento. Es decir, las labores realizadas correspondieron a las labores habituales de limpieza de residuos, sedimentos y lodos que se encuentran en las alcantarillas. Sumado a esto, para el 17-07-2024 se realizó fiscalización de la limpieza y no se encuentran indicios de atascos u obstrucciones al frente de su vivienda.Por lo cual, por parte de este departamento damos por finalizada nuestra gestión. No sin antes solicitar a los compañeros de Plataforma de Servicios que trasladen su caso a la Unidad deGestión Vial, en caso de que haya un tema de infraestructura que tratar.”. Sobre el particular remitió algunas respuestas al correo que le inviaron; sin embargo, decidió adicionarlos por medio de gestión formal con fecha 29 de julio de 2024, indicando lo siguiente: “En seguimiento al trámite 14826-2024 y oficios recibidos MC-PMA-0580-07-2024 y MC-PMA-0600-07-2024. Sobre un tema de salud pública debido a que se rebalsan los alcantarillados sanitarios. Me permito enviar dos videos que debe considerar la Unidad de Gestión Vial.”. Acusa que se ha expuesto ante la Municipalidad de Curridabat el tema que le afecta sobre salud pública por el problema del rebalse de los alcantarillados sanitarios, que deja residuos con mal olor y les limitación del derecho de circulación dado que le es imposible salir de su casa cuando se rebalsa el alcantarillado.Reclama que no ha existido un adecuado control y seguimiento de los trámites realizado, por cuanto no ha recibido una respuesta desde el pasado 29 de julio y consecuentemente no se ha arreglado o ajustado el problema con el alcantarillado pluvial o aguas residuales en la Urbanización La Troja. Pide se declare con lugar el recurso.
  2. 2Mediante resolución de las 7:42 horas del 25 de setiembre de 2024 se dio curso al proceso y se solicitó informe al Alcalde, el Jefe del Departamento de Protección del Medio Ambiente y el Director de Gestión Vial, todos de la Municipalidad de Curridabat. La misma fue notificada a la autoridad recurrida el 26 de setiembre de 2024.
  3. 3Informan Errol Solano Bolaños, en su condición de Alcalde de, Randall Rodríguez Araya en su calidad de Director de Gestión Vial y Jose Manuel Retana Vindas en su condición de Jefe de Protección al Medio Ambiente todos de la Municipalidad de Curridabat. Explican: “2.- SOBRE LA ATENCION DE LO SOLICITADO POR LA RECURRENTE Y EL INFORME ORDENADO POR LA SALA: El Ing. Randall Rodríguez Araya, director de Gestión Vial informa a esta representación, mediante oficio MC-DGV-0746-10-2024 de 01 de octubre del 2024, con relación a este caso en la Urbanización La Troja, Distrito Curridabat, por medio del cual denuncian inundaciones y otro tipo inconvenientes con el sistema pluvial, durante las lluvias, se indica lo siguiente: Se coordina con el Departamento de Protección al Medio Ambiente lo relacionado con la limpieza de las tuberías en el sector de la Urbanización La Troja realizado por las cuadrillas municipales (MC-PMA-0600-07-2024 adjunto), y se corrobora que no se tiene obstrucción de las tuberías pluviales.Posteriormente se revisa el caso con los compañeros de la Unidad de Gestión de Riesgo quienes por medio de la revisión de las estaciones meteorológicas que posee la Municipalidad de Curridabat en varios puntos del cantón, se monitorea que la fecha indicada en el video que aporta la señora Castillo, con fecha del 26 de julio del 2024 (imagen 02) , donde se muestra el desbordamiento del agua del caño al frente de su vivienda, corresponde a un aguacero sumamente fuerte que afectó el Cantón de Curridabat, generando crecidas atípicas de los caudales de la Quebrada que pasa bordeando la Urbanización La Troja, y es donde desfogan las aguas de las tuberías pluviales de la Urbanización. Como se puede apreciar en la imagen 01, del oficio supra citado, donde se muestra un gráfico de las intensidades de lluvia registradas en la estación meteorológica de la Ibata (sic) en Curridabat, específicamente para el día 26 de julio del 2024 (ver línea ROJA), que es la fecha del video (Imagen 02), se puede apreciar que ese día en particular se presentó una intensidad de lluvia que superó los 70mm de precipitación, situación que afecta los sistemas pluviales instalados durante la construcción de la urbanización.Cómo se puede ver, este incremento de las lluvias está totalmente ligado al cambio climático que afecta a todo el mundo y Curridabat no escapa de este fenómeno, que genera gran cantidad de lluvia en lapsos de tiempo muy corto, lo que provoca que los sistemas de drenaje se colapsen en corto tiempo y las aguas tienden a rebalsarse, situación que se comprueba una vez que pasan las lluvias y los niveles de agua vuelven a la normalidad. Así mismo en ese mismo gráfico, se puede observar que en los últimos 4 años durante el mes de setiembre se han presentado históricamente eventos de lluvia que rondan entre los 60 y 70 mm de precipitación que generan este tipo de inconvenientes a la población, situación que se trabaja de la mano con los compañeros de Protección al medio ambiente, que realizan limpiezas programadas del sistema pluvial para así minimizar la afectación que el incremento de lluvias propias de la época lluvia hacia la población.(Ver todo lo manifestado en el oficio adjunto) Por su parte el biólogo José Manuel Retana Vindas jefe de Protección al Medio Ambiente mediante oficio MC-PMA-0859-10-2024 de fecha 01 de octubre del 2024, informa sobre las acciones realizadas desde su departamento: En primera instancia, se recibió formalmente el trámite #14826-2024, en el cual se le brindó respuesta mediante los oficios MC-PMA-0580-07-2024 y MC-PMA-0600-07-2024 (documentos adjuntos). El detalle del caso en esta oportunidad correspondió al recorrido total del barrio y su correspondiente limpieza, y verificación de tragantes. No se encontraron obstrucciones, o indicios de aguas negras, ni evidencias para elevar un traslado al Ministerio de Salud. Las alcantarillas se encontraron con residuos habituales de la limpieza del sistema pluvial público administrado por el Municipio, y se pidió traslado a Gestión Vial en caso de que fuera algún tema de infraestructura.Posterior a nuestro traslado a los compañeros de Gestión Vial, no tuvimos consultas o algún reingreso formal sobre este tema En segundo lugar, y como parte de las labores de esta primera semana de octubre del 2024, nuestras cuadrillas han estado atendiendo la ruta correspondiente a la limpieza del sector de la Bilbaína, Santa Cecilia, la Troja y los Multifamiliares. Motivo por el cual, las cuadrillas realizaron verificación y limpieza en el sector del Barrio la Troja para el día de hoy 01-10-2024, y se dirigieron a la vivienda de la persona denunciante. No se obtuvo respuesta, pero se verificó nuevamente que el tragante, que es la competencia de nuestro personal de campo, no se encontraba con obstrucciones, sedimentos o cualquier otro residuo o situación que atender. No obstante, se observa sobre la acera, unas aparentes cajas de registro con humedad, que suponemos pueden conectar con el sistema sanitario propio de la vivienda, es decir, las salidas y sistemas de limpieza propios del tanque séptico de la vivienda.Como es sabido, la limpieza del sistema sanitario (usualmente tanque séptico), de cada vivienda es responsabilidad de sus propietarios, y si se posee un sistema formal aprobado y en funcionamiento por el AyA para la recolección de aguas negras, lo correspondiente es realizar las gestiones con dicha entidad, en caso de que el problema refiera con los sistemas de estos. Aunado a lo anterior y como se observa en los adjuntos de este número de Recurso de Amparo, no se contó con material adicional a esta denuncia, o videos mencionados, pues se observa que se dirigió a Plataforma de Servicios y a la Unidad de Gestión Vial una vez realizado el traslado de nuestra parte. Finalmente, y como se puede observar en el apartado de anexos al final del presente documento, por parte de las cuadrillas municipales de alcantarillado pluvial público administrado por el Municipio, no se encuentra algún problema relacionado a nuestras labores.Así las cosas, queda evidenciado que nuestra representada ha atendido todas las solicitudes que se han planteado por la recurrente, solicitando a las instituciones que les compete, como el Instituto Costarricense de Acueductos y Alcantarillados, por medio del oficio MC-DGV-0747-10-2024 (adjunto) para que en forma conjunta con mi representada revisen y den solución al problema de la recurrente, por lo que el amparo debe ser desestimado y declarado sin lugar, pues su queja fue atendida de forma diligente. Además, debe tomarse en cuenta que las fuertes lluvias y las inclemencias del tiempo propiciaron a que una situación anómala se presentara ese día y dio al traste a que en muchos lugares del país se dieran emergencias de inundaciones en lugares donde nunca se habían presentado, pero que revisadas las alcantarillas se pudo constatar que las mismas estaban limpias y fue solo producto del exceso de agua caída.”. Piden se declare sin lugar el recurso.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Fernandez Acuña; y,

Considerando:

I.Cuestión Preliminar. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones–, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción –respaldado por la mayoría de este Tribunal Constitucional–, pues se está ante una denuncia ambiental, la cual presuntamente no ha sido resuelta dentro de un plazo razonable, por parte de la Municipalidad recurrida. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La recurrente expone que, el 3 de julio de 2024 remitió correo electrónico a la Municipalidad de Curridabat en la que requirió su colaboración en la limpieza, mantenimiento o fiscalización de la infraestructura pluvial en la Urbanización La Troja, propiamente frente a la casa 69b y casas sobre los 100m de esa vía. Ello porque con las lluvias se ha provocado una acumulación significativa de residuos y sedimentos en los sistemas de drenaje pluvial de esta área, que obstruyen y dificultan el correcto flujo del agua, provocando inundaciones y otros inconvenientes durante las lluvias, que impiden el ingreso de las personas y mascotas. Reclama que a la fecha de interposición del recurso, no ha existido un adecuado control y seguimiento de los trámites realizado, por cuanto no ha recibido una respuesta desde el pasado 29 de julio y consecuentemente no se ha arreglado o ajustado el problema con el alcantarillado pluvial o aguas residuales en la Urbanización La Troja. Pide se declare con lugar el recurso.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

El 3 de julio de 2024, la recurrente remitió correo electrónico a la Municipalidad de Curridabat en la que requirió lo siguiente: “(…)Me dirijo a ustedes para solicitarles su colaboración en la limpieza, mantenimiento o fiscalización de la infraestructura pluvial en la Urbanización La Troja, propiamente frente a la casa 69b y casas sobre los 100m de esa vía. En las últimas semanas, hemos observado una acumulación significativa de residuos y sedimentos en los sistemas de drenaje pluvial de esta área. Esto ha resultado en obstrucciones que dificultan el correcto flujo del agua, lo que ha provocado problemas de inundaciones y otros inconvenientes durante las lluvias. Entre los inconvenientes está que la calle se inunda y es posible que los residuos de aguas negras queden expuestos, se colen entre aceras y casas y obstruyan el ingreso de las personas y mascotas a las mismas. Para prevenir cualquier situación adversa, considero urgente y necesario llevar a cabo una limpieza exhaustiva y revisión de la situación (Si es que la alcantarilla no tiene capacidades) de las alcantarillas, canales y cualquier otra infraestructura relacionada.

Esta intervención no solo garantizará la eficiencia del sistema pluvial, sino que también contribuirá a la seguridad y bienestar de los residentes, transeúntes y mascotas. Agradezco de antemano su atención a esta solicitud y quedo a su disposición para coordinar cualquier detalle necesario para llevar a cabo estos trabajos. Apreciaría también cualquier información sobre el calendario y los procedimientos previstos para estas labores solicitadas. Agrego además que este tema se ha solicitado vía formulario dispuesto en su página web.(…)”. (ver prueba) Los correo electrónicos a los que la recurrente dirigió su denuncia, se encuentran previstos como mecanismo oficial de comunicación con la Municipalidad de Curridabat recurrida (ver informe).

El 3 de julio de 2024, la funcionaria municipal Xinia Durán, responde a la recurrente, lo siguiente “Buenos días doña [Nombre 001] se le está enviando su correo al correo institucional: [email protected], para que le den un número de trámite a su gestión y lo remitan al Departamento de Protección del Medio Ambiente y a la Dirección de Gestión Vial.”. (ver prueba).

El 16 de julio de 2024 la Municipalidad recurrida realizó limpieza general por parte de su personal de campo en el sector de la Troja. No se encontraron obstrucciones o indicios de algún problema mayor que se deba atender por parte de este departamento. Las labores realizadas correspondieron a las labores habituales de limpieza de residuos, sedimentos y lodos que se encuentran en las alcantarillas. (ver informe), El 17 de julio de 2024, la Municipalidad recurrida realizó fiscalización de la limpieza y no encontró indicios de atascos u obstrucciones al frente de su vivienda. Por lo cual, da por finalizada nuestra gestión. Gestiona ante la Plataforma de Servicios que trasladen su caso a la Unidad de Gestión Vial, en caso de que haya un tema de infraestructura que tratar (ver prueba).

El 18 de julio de 2024, se notifica a la recurrente el oficio MC-PMA-0580-07-2024 con la indicación del número del trámite: 14826-2024. Se brinda el detalle del caso señalando que se hizo el recorrido total del barrio y su correspondiente limpieza, y verificación de tragantes. No se encontraron obstrucciones, o indicios de aguas negras, ni evidencias para elevar un traslado al Ministerio de Salud. Las alcantarillas se encontraron con residuos habituales de la limpieza del sistema pluvial público administrado por el Municipio, y se pidió traslado a Gestión Vial en caso de que fuera algún tema de infraestructura. Posterior al traslado a Gestión Vial, no se tuvo consultas o algún reingreso formal sobre este tema y con la indicación de que “estaremos realizando inspección a la brevedad para confirmar el presunto problema descrito por su persona.” (ver informe y prueba).

El 29 de julio de 2024, por el oficio MC-PMA-0600-07-2024 la Municipalidad recurrida responde: “En seguimiento al trámite 14826-2024 y oficios recibidos MC-PMA-0580-07-2024 y MC-PMA-0600-07-2024. Sobre un tema de salud pública debido a que se rebalsan los alcantarillados sanitarios. Me permito enviar dos videos que debe considerar la Unidad de Gestión Vial.”. (ver informe) El 26 de setiembre de 2024, la resolución que da curso al presente proceso, fue notificada a la autoridad recurrida (los autos).

El 01 de octubre de 2024, las cuadrillas de la Municipalidad de Curridabat han realizado labores de limpieza en la ruta correspondiente al sector de la Bilbaína, Santa Cecilia, la Troja y los Multifamiliares. Las cuadrillas realizaron verificación y limpieza en el sector del Barrio la Troja, se dirigieron a la vivienda de la persona denunciante. Como se obtuvo respuesta, se procedió a verificar nuevamente que el tragante, -que es la competencia del personal de campo municipal-, no presentara obstrucciones, sedimentos o cualquier otro residuo o situación que atender. Al percatarse, los funcionarios municipales de que sobre la acera hay cajas de registro que presentan humedad, que en principio pueden conectar con el sistema sanitario propio de la vivienda, es decir, las salidas y sistemas de limpieza propios del tanque séptico de la vivienda; y al ser la limpieza del sistema sanitario (usualmente tanque séptico),responsabilidad de los propietarios de cada vivienda, y si se posee un sistema formal aprobado y en funcionamiento por el AyA para la recolección de aguas negras, lo correspondiente es realizar las gestiones con dicha entidad, en caso de que el problema refiera con los sistemas de estos (ver informe y prueba).

Por parte de las cuadrillas municipales de alcantarillado pluvial público administrado por el Municipio, no se encuentra algún problema relacionado a sus labores. Y han atendido todas las solicitudes que se han planteado por la recurrente, solicitando a las instituciones que les compete, como el Instituto Costarricense de Acueductos y Alcantarillados, por medio del oficio MC-DGV-0747-10-2024 del 01 de octubre de 2024, para que en forma conjunta con la Municipalidad recurrida revisen y den solución al problema de la recurrente (ver informe y prueba).

El 01 de octubre de 2024, se emite el oficio MC-DGV-0748-10-2024 de 01 de octubre de 2024, dirigido a la recurrente Castillo en el que se le informa de la solitud de inspección conjunta con el AyA para revisar la problemática que ella denuncia.

IV. HECHOS NO DEMOSTRADOS

No se tienen por demostrados los siguientes hechos de importancia para la resolución del presente proceso:

  • a)Que la recurrente haya planteado alguna solicitud o queja a través ante la Contraloría de Servicios de la Municipalidad recurrida y no haya sido respondida.
  • b)Que el oficio MC-DGV-0748-10-2024 del 01 de octubre de 2024, en que la Municipalidad de Curridabat recurrida indica a la recurrente que ha pedido al Instituto Costarricense de Acueductos y Alcantarillados, en forma conjunta con su representada, revisar y dar solución al problema de rebalse de agua frente a su propiedad, le haya sido comunicada.

V. SOBRE EL CASO CONCRETO

En el presente asunto, la recurrente reclama que su solicitud de colaboración en la limpieza, mantenimiento o fiscalización de la infraestructura pluvial o de aguas residuales en la Urbanización La Troja, propiamente frente a la casa 69b y casas sobre los 100m de esa vía, presentada el 03 de julio de 2024, no ha sido atendida, pese al riesgo que representa el desbordamiento de las aguas en el lugar. En su respuesta, la autoridad recurrida informa a esta Sala que a la denuncia planteada por la recurrente se le asignó formalmente el trámite #14826-2024, y se le brindó respuesta mediante los oficios MC-PMA-0580-07-2024 y MC-PMA-0600-07-2024 (documentos adjuntos).

Del análisis de la prueba traída al expediente, consta que efectivamente en el oficio MC-PMA-0600-07- 2024 del 17 de julio de 2024, la inspectora ambiental de Protección del Medio Ambiente de la Municipalidad de Curridabat, le indica claramente a la gestionante los actos encaminados a dar respuesta a su solicitud. Expresamente le explica que: “Para el 16-07-2024 se realizó limpieza general por parte de nuestro personal de campo en el sector de la Troja. No se encontraron obstrucciones o indicios de algún problema mayor que se deba atender por parte de este departamento. Es decir, las labores realizadas correspondieron a las labores habituales de limpieza de residuos, sedimentos y lodos que se encuentran en las alcantarillas. Sumado a esto, para el 17-07-2024 se realizó fiscalización de la limpieza y no se encuentran indicios de atascos u obstrucciones al frente de su vivienda. Por lo cual, por parte de este departamento damos por finalizada nuestra gestión.

No sin antes solicitar a los compañeros de Plataforma de Servicios que trasladen su caso a la Unidad de Gestión Vial, en caso de que haya un tema de infraestructura que tratar.” Además de la limpieza y verificación del estado de los tragantes en el lugar, según el informe dado a esta Sala, a la recurrente se le explica que no se encontraron obstrucciones, o indicios de aguas negras, ni evidencias para elevar un traslado al Ministerio de Salud. Las alcantarillas se encontraron con residuos habituales de la limpieza del sistema pluvial público administrado por el Municipio, y se pidió traslado a Gestión Vial en caso de que fuera algún tema de infraestructura.

Posteriormente, dos meses y medio después y posterior a la notificación del 27 de setiembre de 2024, de la resolución que da curso a este proceso; el 01 de octubre del 2024, las cuadrillas de la Municipalidad de Curridabat atendieron la ruta correspondiente a la limpieza del sector de la Bilbaína, Santa Cecilia, la Troja, donde habita la tutelada, y los Multifamiliares. En la inspección realizada en el mes de octubre, frente a la vivienda de la recurrente, se indica que no se observaron obstrucciones ni sedimentos que retirar. Además, la autoridad recurrida observó “humedad” en presuntos ceniceros de la vivienda, que estima puede relacionarse a obstrucciones directamente con el tanque séptico o sistemas de aguas negras relacionados.

Pese a las medidas tomadas, no consta que a la tutelada se le hayan comunicado las tareas realizadas el 01 de octubre por parte de la Municipalidad, encaminadas dar una solución al problema denunciado. Así como tampoco consta que se le haya informado a la amparada que, la Municipalidad de Curridabat, con relación al tema de desbordamiento de aguas residuales de las tuberías y cajas de registro de aguas negras que afecta a la recurrente, dispuso que, como no brinda los servicios de agua potable ni de alcantarillado sanitario, -y estimar que son competencias del Instituto Costarricense de Acueductos y Alcantarillados-, por medio del oficio MC-DGV-0747-10-2024, solicitó una inspección en conjunto con esta institución para revisar este tema denunciado por la señora [Nombre 001].

Así las cosas, si bien, consta a esta Sala que por el MC-DGV-0747-10-2024 del 01 de octubre de 2024, la autoridad recurrida pidió el mismo 01 de octubre de 2024, al Instituto Costarricense de Acueductos y Alcantarillados, que en forma conjunta con la Municipalidad recurrida revisen la situación de desbordamiento de aguas residuales que describe la recurrente afecta su propiedad, no consta que el oficio MC-DGV-0748-10-2024 de 01 de octubre de 2024, en que se le iba a informar a la recurrente Castillo de la solicitud de inspección conjunta con el AyA, le haya sido efectivamente enviado.

Como no consta que la respuesta que elabora la Municipalidad de Curridabat, al 02 de octubre de 2024 que rinde el informe a esta Sala, haya sido realmente enviada al correo electrónico de la recurrente, pese a que indicó medio para recibir notificaciones; en criterio de este Tribunal, la omisión de las autoridades de la Municipalidad de Curridabat implica una lesión al derecho de la tutelada a un procedimiento administrativo pronto y cumplido, por cuanto, no le han notificado a la amparada, las medidas que, en atención a su denuncia, se adoptaron en octubre de 2024. En consecuencia, procede la estimatoria del recurso, a fin de ordenarle a la Municipalidad recurrida que notifique a la amparada lo resuelto en relación a su denuncia y procure una solución definitiva a la denuncia planteada por la recurrente, en el marco de sus competencias, lo que en efecto se dispone.

VI. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA -Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII. Voto salvado parcial de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia

Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como en este caso, donde se ordena que, en un plazo máximo de tres meses a partir de la notificación de esta sentencia, la Municipalidad de Curridabat y el Instituto Costarricense de Acueductos y Alcantarillados coordinen lo pertinente a efectos de tomar de las medidas necesarias para solucionar la problemática de desbordamiento de aguas residuales en la Urbanización La Troja del Cantón de Curridabat, que acusa la parte recurrente En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Errol Solano Bolaños, en su condición de Alcalde, Randall Rodríguez Araya en su calidad de Director de Gestión Vial y Jose Manuel Retana Vindas en su condición de Jefe de Protección al Medio Ambiente todos de la Municipalidad de Curridabat o a quienes respectivamente ocupen tales cargos, que si aún no lo han hecho, coordinen lo necesario para que se notifique a la amparada el oficio MC-DGV-0748-10-2024 del 01 de octubre de 2024. Asimismo, se les ordena, que en el plazo máximo de tres meses, contado a partir de la notificación de esta sentencia, coordinen con el Instituto de Acueductos y Alcantarillados y tomen las medidas necesarias y pertinentes, que se encuentren dentro de la esfera de sus competencias, a efecto de dar una solución definitiva al problema de desbordamiento de aguas en la Urbanización La Troja del Cantón de Curridabat, que denuncia la recurrente.

Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena la Municipalidad de Curridabat al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, lo que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Castillo Víquez consigna nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicien los procedimientos de ejecución de este fallo. Notifíquese.
