Document Review Case File (Exp.): 24-020676-0007-CO Decision (Res.) No. 2024029778 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen on once de octubre de dos mil veinticuatro.
Application for constitutional relief (recurso de amparo) processed under case file (expediente) N° 24-020676-0007-CO, filed by [Nombre 001], residence identification card [Valor 001], on BEHALF OF HIMSELF AND [Nombre 002], corporate identification number N° [Valor 002], against the CONSEJO NACIONAL AMBIENTAL AND THE TRIBUNAL AMBIENTAL ADMINISTRATIVO.
BACKGROUND:
“FIRST: Article 103 of the Ley Orgánica del Ambiente (published in La Gaceta N° 215 of 13 de noviembre de 1995) establishes that the Tribunal Ambiental Administrativo (TAA) is a decentralized body (órgano desconcentrado) of the Ministerio de Ambiente y Energía, with exclusive jurisdiction and functional independence in the performance of its duties.
In accordance with the powers of the Tribunal Ambiental Administrativo under the Ley Orgánica del Ambiente, this institution acts upon the filing of a complaint at the request of a party (Art. 108 of LOA) or on its own initiative (Art. 111 of LOA).
SECOND: Before responding to the arguments raised in this application for constitutional relief, it is important to set out the background relating to administrative case file number [Valor 004], as follows:
The parties were summoned to an oral and public hearing (audiencia oral y pública) on 24 de febrero de 2023. See pages 2280 to 2286 of the administrative case file.
THIRD: Regarding the composition of the Tribunal Ambiental Administrativo. Background:

FOURTH: REGARDING THE FACTS ALLEGED BY THE APPELLANT.
In summary, the protected party (amparado) states: “...that he files this amparo on behalf of [Nombre 002]. He states that expediente n.° 1 74-09-03-TAA has been pending before the Tribunal Ambiental Administrativo for 15 years. He states that it was necessary to file an amparo proceeding (expediente n. 22-014523-0007-CO), in which that Tribunal was ordered to move forward with and decide the case. He explains that, despite delays, hearings were held over several weeks at the end of last year and, at the beginning of 2024, the case was ready for judgment. Nevertheless, in the middle of this year, they were informed that issuance of the judgment had been suspended due to the resignation of one of the judges.
He notes that they waited a few weeks to see whether the situation at the Tribunal Ambiental Administrativo would be resolved, but when they inquired a few days ago, they were told that the judges had still not been appointed (Official Letter 649-24-TAA)... He alleges that, since the beginning of this administration, replacement judges have not been appointed, which impedes the progress of the proceedings. He requests the appointment of one presiding judge and three alternate judges to the Tribunal Ambiental Administrativo.” Pursuant to the powers granted by law to this Tribunal Ambiental Administrativo, the allegations are broken down and answered as follows:
FIFTH: Regarding the argument: “He states that expediente n.° [Valor 004] has been pending before the Tribunal Ambiental Administrativo for 15 years. He states that it was necessary to file an amparo proceeding (expediente n. 22-014523-0007-CO), in which that Tribunal was ordered to move forward with and decide the case. He explains that, despite delays, hearings were held over several weeks at the end of last year and, at the beginning of 2024, the case was ready for judgment. Nevertheless, in the middle of this year, they were informed that issuance of the judgment had been suspended due to the resignation of one of the judges (...)” This argument therefore does not concern a disputed fact before this Tribunal, since it is true that the complaint in administrative expediente [Valor 004] was filed in 2009 and that, because of the ordinary administrative proceeding (procedimiento ordinario administrativo), the difficulty and scope of the investigation, the evidence collected, and the parties involved, an administrative record comprising Fifteen Volumes has been assembled. The oral and public hearing (audiencia oral y pública) was conducted over 7 appearances, the last of which concluded on 17 de noviembre de 2023, when the parties were granted 5 days to submit their closing arguments. See folios 3213 to 3214 of the administrative record.
Thereafter, through Resolution No. 93-2024-TAA of 26 de enero de 2024, this Tribunal requested evidence to clarify adjudication (prueba para mejor resolver); see folios 3271 to 3278. The parties were notified of that evidence through Resolution 339-2024-TAA of 18 de marzo de 2024; see folio 3413.
Thereafter, from 19 de marzo de 2024 through 10 de abril de 2024, MSc. Alexandra González Arguedas was on vacation leave (in accordance with the vacation form), and her resignation became effective on 11 de abril de 2024.
Accordingly, on 10 de abril de 2024, Resolution No. 397-2024-TAA was issued, suspending time limits (suspensión de plazos) due to the Tribunal’s incomplete composition. See folios 3448 to 3453.
The status of expediente [Valor 004] is therefore that the parties were notified of the Evidence to Clarify Adjudication, and review by the full bench (Órgano Colegiado) (three Judges) of the briefs and motions submitted remains pending, so that it may determine, in light of that evidence, whether any further procedural step is appropriate and thereafter issue the final administrative act (acto final). It is therefore necessary to appoint the presiding judge of the Tribunal Ambiental Administrativo in order to conclude the administrative case.
SIXTH: Regarding the argument: “He notes that they waited a few weeks to see whether the situation at the Tribunal Ambiental Administrativo would be resolved, but when they inquired a few days ago, they were told that the judges had still not been appointed (Official Letter 649-24-TAA).
He alleges that, since the beginning of this administration, replacement judges have not been appointed, which impedes the progress of the proceedings. He requests the appointment of one presiding judge and three alternate judges to the Tribunal Ambiental Administrativo.” This argument is true, subject to certain clarifications regarding the actions of this Tribunal.
It is true—or at least this Tribunal has not been notified—that the Consejo Nacional Ambiental has appointed the presiding judge and alternate judges. Therefore, for certain actions, including issuance of the Final Administrative Act, the principle of legality (principio de legalidad) requires that the full bench be duly constituted. This is because administrative expediente number [Valor 004], to which the appellant is a party, is at the stage of evaluating the evidence, closing arguments, and facts “for issuance of the Final Administrative Act,” following the conclusion of the public hearing and receipt of the closing arguments in accordance with the ordinary administrative proceeding. As evidence of the foregoing, Article 10 of Decreto Ejecutivo N° 34136-MINAE, Regulations on Procedure of the Tribunal Ambiental Administrativo (Reglamento de Procedimiento del Tribunal Ambiental Administrativo), as amended by Decreto 43795-MINAE and published in the Official Gazette La Gaceta N° 230 of primero de diciembre de 2022, states, in relevant part: “...The Judges shall be responsible for issuing decisions in cases individually, up to and including the opening of the ordinary administrative proceeding and motions for reconsideration (recursos de revocatoria)...
The hearing and issuance of final decisions shall be the responsibility of the full bench sitting in plenary session…” It is therefore necessary for the full bench to be duly constituted so that it may validly sit.
In the same vein, Article 8 of Decreto Ejecutivo N° 341 36-MINAE addresses the composition necessary for a valid session: “-Validity of sessions. For the Tribunal to sit validly, all three members must be present. The Tribunal’s deliberations shall be private, votes shall be taken by roll call, and decisions shall be adopted by simple majority. Interlocutory orders (autos) and final decisions shall be drafted in strict rotation and within the period established for that purpose by the General Law on Public Administration (Ley General de la Administración Pública).” In this regard, see Resolution N° 2024-018803, issued at nine hours and thirty minutes on cinco de julio del dos mil veinticuatro by the Sala Constitucional de la Corte Suprema de Justicia. (Attached as evidence.)
The failure to appoint the presiding judge and the three alternate judges has resulted in the suspension, from 19 de marzo del 2024 to date, of the ordinary administrative proceedings in cases that have reached the stage at which the public hearing is to be held or the final administrative act is to be issued, and consequently of all related actions at those stages that require the full bench.
Currently, only two Presiding Judge positions have been validly filled: the undersigned, Adriana Bejarano Alfaro, as President, and Ms. Ana María de Montserrat Gómez de la Fuente Quiñonez, as Vice President, pursuant to the vote conducted each year as required by Article 105 of the Organic Environmental Law (Ley Orgánica del Ambiente). This year’s appointments were ratified in Resolution No. 1701-2023- TAA, issued at twelve hours and thirty-five minutes on dieciocho de diciembre del dos mil veintitrés. (Attached as evidence.)
It is clarified that this loss of the full bench’s required composition took effect when Ms. Alexandra González Arguedas took vacation leave from 19 de marzo de 2024 through 10 de abril de 2024 and subsequently resigned from her position as Presiding Judge effective 11 de abril de 2024. She could not be replaced by an Alternate Judge because the alternate judges of the Tribunal Ambiental Administrativo had resigned in the following order: Licda. Marcela Rodríguez Porras submitted her resignation as Alternate Judge on 17 de noviembre del 2021, effective as of that date; on 11 de enero del 2024, Alternate Judge Licda. Elizabeth Araya Jiménez submitted her resignation as Alternate Judge due to retirement, effective as of that date; and Alternate Judge Licda. Carla Vanessa Agüero Zeledón submitted her irrevocable resignation as Alternate Judge of the Tribunal Ambiental Administrativo, effective as of that same date, 16 de enero del 2024. No new appointments have been made to date.
That said, the relief sought by the appellant before the Constitutional Court, “(...) the appointment of one regular judge and three alternate judges to the Tribunal Ambiental Administrativo,” falls outside the scope of this Court’s authority. In accordance with the principle of legality, the appointment of regular and alternate judges must be made by the Consejo Nacional Ambiental (a body created pursuant to Article 77 of the Ley Orgánica del Ambiente), as stipulated by Article 104 of the Ley Orgánica del Ambiente: “Composition of the Tribunal. The Tribunal Ambiental Administrativo shall be composed of three regular members and three alternate members, all appointed by the Consejo Nacional Ambiental for a term of six years. They shall be sworn in by the president of that Council.” (Boldface not in the original) Since the dissolution of the collegial body (órgano colegiado) known as the “Tribunal Ambiental Administrativo,” and out of concern regarding that situation, official letters have been sent reporting and reiterating the need for appointments:
Accordingly, the amparo proceeding (recurso de amparo) and the claims against this Tribunal Ambiental Administrativo are unfounded because what the petitioner seeks falls outside the scope of its powers, and it has already taken the actions legally available to it.” In view of the foregoing considerations, she requests that the proceeding be dismissed.
“...II.- MERITS: First, it should be noted that I do not have jurisdiction to decide upon the review and processing of case file N.° [Valor 004]; therefore, any delay in its handling is a matter that pertains specifically to the Tribunal Ambiental Administrativo. It should be noted that its processing has taken more than 15 years, a situation that cannot be attributed to the problem concerning the Tribunal’s composition that arose between the end of 2020 and April of this year.
In this regard, in a similar matter, this Chamber stated the following in judgment N.° 2024018803 issued at 9:30 on 05 de julio de 2024, in which the Tribunal Ambiental Administrativo argued that the delay in processing the matters was due to the absence of judges:
“In that same vein, it should be noted that the statement by the President of that Tribunal—that because the body is not fully constituted, due to the resignation of the regular judge and the alternate judges, it cannot continue addressing briefs and pending applications in the aforementioned proceeding—is unacceptable. This is because, under oath, the Ministro de Ambiente y Energía, also acting as Secretary of the Consejo Nacional Ambiental, reported and clarified the following to this Chamber regarding the matter:
‘(...) In accordance with all the foregoing, the TAA has legal tools that allow it to continue operating, and the failure to appoint a judge is not a reason to stop processing case files. Thus, the entire ordinary proceeding may be handled by the judges without the TAA having to be fully constituted; that is, the presiding judge (Juez instructor) may process and conduct the proceeding and issue certain decisions, except for the final decision (...).’ It is therefore clear that, although the current absence of a judge needed to constitute the Tribunal Ambiental Administrativo prevents the issuance of the final decision in the case, the judge in charge of the proceeding does have the authority to continue processing and conducting it, including issuing decisions, in order to guarantee and protect, through other mechanisms, the affected neighbors’ rights to the environment and health in relation to the actions established in this proceeding.
Nevertheless, according to the respondent President herself, such actions have been lacking in this matter.” In another vein, it must be stated that the situation of the Tribunal Ambiental Administrativo, and its lack of a full composition, was not brought to my attention in my capacity as President of the Consejo Nacional Ambiental; rather, it was communicated to the Ministro de Ambiente y Energía, according to the table provided by the respondent Tribunal itself, appearing on pages 10 through 13 of official letter 682-2024-TAA dated 12 de agosto de 2024.
Notwithstanding the foregoing, we will use our good offices to address the situation facing the Tribunal Ambiental Administrativo due to the lack of judges needed to constitute it.
Finally, it should be noted that I had no direct involvement in the actions alleged by the appellant, as the request was brought directly to the attention of the Ministro de Ambiente y Energía. Nevertheless, I must emphasize my steadfast commitment to safeguarding the constitutional rights and guarantees that we, as public officials, are required to honor. I request that the Chamber dismiss the proceeding.” In view of the foregoing considerations, she requests that the proceeding be dismissed.
Justice Salazar Alvarado drafts the opinion; and,
CONSIDERING:
The appellant asserts that case file N° [Valor 004] is being processed before the Tribunal Ambiental Administrativo, but the proceeding—which is ready for judgment—has been unable to advance because no replacement judges have been appointed to the Tribunal Ambiental Administrativo. He considers that the situation described violates his right to prompt administrative justice.
The following relevant facts are deemed duly established and material to the resolution of this proceeding:
By decision N° 397-2024-TAA dated 10 de abril de 2024, the Tribunal Ambiental Administrativo stayed the time limits in case file [Valor 004] because there were not enough members to constitute the Tribunal. Specifically, it ruled: “In accordance with Articles 11, 21, 41, 46, 50, 74 and 89 of the Constitución Política, in relation to provisions 1, 2, 4, 61, 98 through 101, 103, 106, 107, 108, 109, 110 and 111 of the Ley Orgánica del Ambiente; Articles 8, 9, 11, 45, 54, 105 and 109 of the Ley de Biodiversidad; Article 4 of the Ley Forestal; Articles 11, 63, 66, 69, 175, 214, 259, 263, 270, 282 et seq., 292, 308, 309, 313, 330, 331, 340 and related provisions of the Ley General de la Administración Pública; Article 13 of the Ley de la Jurisdicción Constitucional; Articles 66 and related provisions of the Código Procesal Contencioso Administrativo; Articles 37 and related provisions of the Código Procesal Civil; and Articles 1, 10, 11 and 24 et seq. of the Reglamento de Procedimientos del Tribunal Ambiental Administrativo, it is hereby decided: SOLE PROVISION: Based on the matters stated in the preceding recitals (considerandos) of this decision, and due to the declared material impossibility arising from the Tribunal’s lack of composition, the administrative proceeding in administrative case file Nº 174- 09-03TAA is hereby stayed, and the time limits for continuing it through completion are suspended until the Collegial Body is reconstituted” (see in this regard the report submitted by the President of the Tribunal Ambiental Administrativo, the report submitted by the Ministro de Ambiente y Energía, and the evidence provided by the Tribunal Ambiental Administrativo).
At present, only two of the regular judicial positions at the Tribunal Ambiental Administrativo have been filled: Adriana Bejarano Alfaro, in her capacity as President, and Ana María de Monserrat Gómez de la Fuente Quiñones, in her capacity as Vice President. The Tribunal ceased to be fully constituted on 19 de marzo de 2024 because its other member, Alexandra González Arguedas, took vacation leave from that date through 10 de abril de 2024 and subsequently resigned from her position as a regular judge effective 11 de abril de 2024. As for the alternate judges, they resigned in the following order: Maricela Rodríguez Porras on 17 de noviembre de 2021; Elizabeth Araya Jiménez on 11 de enero de 2024; and Carla Vanessa Agüero Zeledón on 16 de enero de 2024 (see in this regard the report submitted by the President of the Tribunal Ambiental Administrativo).
By official letter N° 342-2024-TAA dated 10 de abril de 2024, Adriana Bejarano Alfaro, in her capacity as President, and Ana María Monserrat Gómez de la Fuente, in her capacity as Vice President, both of the Tribunal Ambiental Administrativo, informed Franz Tattenbach Capra, Ministro de Ambiente y Energía and Executive Secretary of the Consejo Nacional Ambiental, that no Regular Judge or Alternate Judges had been appointed to process case file [Valor 004], and therefore requested that the appointments be made urgently (see in this regard the report submitted by the President of the Tribunal Ambiental Administrativo and the evidence she provided).
On 9 de mayo de 2024, by official letter N° 375-2024-TAA dated 23 de abril de 2024, signed by the Tribunal Ambiental Administrativo and addressed to the President of the Republic, with a copy to the Ministra de la Presidencia, the Tribunal reported the failure to appoint its members (see in this regard the report submitted by the President of the Tribunal Ambiental Administrativo and the evidence provided by the Tribunal Ambiental Administrativo).
On July 15, 2024, the petitioner submitted a request for information concerning case file [Valor 004] (see, in this regard, the report submitted by the President of the Administrative Environmental Tribunal).
By official letter N° 649-24-TAA dated July 24, 2024, the President and Vice President of the Administrative Environmental Tribunal, regarding case file [Valor 004] and his request, informed the protected party as follows: “Please accept our cordial greetings. We, the undersigned, Adriana Bejarano Alfaro, President, and Ana María de Montserrat Gómez de la Fuente Quiñónez, Vice President of the Administrative Environmental Tribunal, address you in connection with your written submission dated July 15, 2024, Request for Information, to respond to your inquiries as follows: Regarding your first inquiry: ‘...I respectfully request that I be informed whether the judges still needed to constitute the Administrative Environmental Tribunal have already been appointed, as indicated in the ruling issued at eight thirty in the morning on April ten, two thousand twenty-four.’ In this regard, as of the date of issuance of this official letter, we have not been officially informed of the appointment of the remaining permanent Judge or the Alternate Judges of the Administrative Environmental Tribunal.
Regarding your second inquiry: ‘...I request that I be informed how many judges should constitute the Administrative Environmental Tribunal…’ In this regard, Article 104 of the Organic Law of the Environment is transcribed below: ‘...Article 104—Composition of the Tribunal. The Administrative Environmental Tribunal shall be composed of three permanent members and three alternate members, all appointed by the National Environmental Council for a term of six years. They shall be sworn in by the president of that Council...’ Regarding your third inquiry: ‘...I request that I be informed how many judges are currently appointed to the Administrative Environmental Tribunal and their names...’ We are currently appointed to the positions of Permanent Judge: Presiding Judge: MSC. Adriana Bejarano Alfaro. Vice-Presiding Judge: MSC. Ana María de Montserrat Gómez de la Fuente Quiñónez. Regarding your fourth inquiry: ‘...I request that I be informed how many panels of judges the Administrative Environmental Tribunal has…’ The Administrative Environmental Tribunal does not have panels; it is composed solely as provided in Article 104 of the Organic Law of the Environment.
Regarding your fifth inquiry: ‘...I request that I be informed how many cases are currently pending before the Administrative Environmental Tribunal.’ In this regard, as of June 19, 2024, the Administrative Environmental Tribunal has 4271 active case files. Regarding your sixth and seventh inquiries: ‘...I request that I be informed when case file 174-09-03…7 will be reactivated.’ Given that this case file is in its final stage, I request that I be informed when a judgment or final decision is expected to be issued in case file 174-09-03…’ In this regard, Article 10 of Decreto Ejecutivo 34136, Regulations on Procedures of the Administrative Environmental Tribunal, provides: ‘...Article 10.—Decisions. The judges shall be responsible for issuing decisions in case files individually, through and including the commencement of ordinary administrative proceedings and motions for reconsideration.
Decisions concerning reports and inspections shall be issued by the attorney handling the matter. The hearing and the issuance of final decisions shall be the responsibility of the full collegiate body. When, in deciding a case, any judge disagrees with the majority decision, that judge must issue a dissenting opinion stating the reasons and, in all cases, must sign the corresponding decision together with the other members. The dissenting opinion must appear as an integral part of the decision following the operative provisions...’ As amended by Article 1° of executive decree N° 43795 dated September 21, 2022) Emphasis in bold is not in the original. Therefore, until the Administrative Environmental Tribunal is duly constituted, the final act cannot be issued as may be appropriate under the law.” The digital signature on that document was affixed on July 24, 2024 (see, in this regard, the evidence submitted in the record).
On July 26, 2024, by official letter N° 651-2024-TAA dated July 26, 2024, the Administrative Environmental Tribunal informed Franz Tattenbach Capra, Minister of Environment and Energy, that the Tribunal was not constituted due to the lack of judges, described the situation regarding the case files, and again requested the appointment of one permanent judge and alternate judges (see, in this regard, the report submitted by the President of the Administrative Environmental Tribunal and the evidence she provides).
For purposes of ruling on this appeal, the following relevant fact is deemed unproven:
SOLE FACT. That the National Environmental Council has appointed the necessary judges—permanent and alternate—to constitute the Administrative Environmental Tribunal so that it may continue processing case file [Valor 004] (see, in this regard, the report submitted by )
This Constitutional Chamber heard a prior amparo appeal filed by the petitioner against the Administrative Environmental Tribunal and the Ministry of Environment and Energy, case file N° 22-014523-0007-CO. The appeal was granted by Judgment N° 2022-17133 issued at 9:15 a.m. on July 22, 2022, on the basis of the following considerations:
“V.—Regarding the specific case. In the case at hand, the petitioner alleges that years ago, together with a group of residents, he filed an environmental complaint with the Environmental Tribunal against the RIU hotel complex for the alleged destruction of a wetland and harm to a beach, biodiversity, and a watercourse, which is being processed under case file No. [Valor 004]. He claims that, while the proceedings were at the oral and public hearing stage, they were ordered suspended until an assessment report was submitted by (SINAC); however, although (SINAC) had completed the pertinent requirements, the Environmental Tribunal has not decided the case brought before it.
A review of the record establishes that, since 2012, the protected party has appeared as a complainant in Case File number [Valor 004], alleging the destruction of a wetland and harm to a beach, biodiversity, and a watercourse by the RIU hotel complex. It is further established that, by administrative decision number 1008-12-TAA dated October 31, 2012, the Environmental Tribunal determined ‘to suspend this conciliation hearing, the continuation thereof being scheduled for Wednesday, November twenty-eighth of this year, at nine o’clock in the morning...’ In addition, by decision number 80-12-TAA dated January 20, 2012, clarification concerning the amount of the assessment was requested in the Third Recital; and by official letter ACT-OR-DR-2017 dated February 15, 2012, signed by Nelson Marín Mora, Regional Director of the Tempisque Conservation Area-SINAC, the Environmental Tribunal received a response.
Finally, Case File number [Valor 004] is currently at the investigation stage and consists of eleven volumes: Volume I (Folio 01-120), Volume II (Folio 121-266), Volume III (Folio 267-500), Volume IV (501-769), Volume V (770-1027), Volume VI (1028-1253), Volume VII (1254-1468), Volume VIII (1469-1710), Volume IX (1711-1962), Volume X (1963-2140), Volume XI (2141-2260) Against this background, the right to prompt and effective justice is deemed to have been violated. In this regard, although it is true that the case file involves a degree of complexity, it is no less true that this Chamber, by Judgment Number 2016-2168 issued at 9:05 a.m. on February 12, 2016, stated:
‘In the Chamber’s view, the Administrative Environmental Tribunal’s failure to advance the proceedings has caused undue delay or unjustified tardiness that has violated the fundamental right to prompt and effective administrative proceedings. Article 110 of the Organic Law of the Environment enshrines the principle of expeditiousness in processing administrative proceedings relating to environmental complaints, expressly providing as follows: “The Administrative Environmental Tribunal shall, on its own motion, advance the proceedings and the processing of matters within its jurisdiction with the speed required by the affected situation. The ruling must be issued within no more than thirty days; in special cases, the period may be extended by up to an additional thirty days. The administration is hereby placed under an obligation to provide a prompt and effective response.”’ In this regard, this Tribunal understands that environmental cases may be complex in nature and require extensive adversarial proceedings; nevertheless, it cannot consider it reasonable that a complaint filed in 2012 is still at the investigation stage, as reported.
It should be noted that there is currently not even an approximate time frame for issuing the final decision on the complaint, which is contrary to Constitutional Law, particularly when the preliminary investigation stage has lasted so many years.
By virtue of the foregoing, the delay observed in processing these proceedings undoubtedly constitutes a violation of the fundamental right to obtain prompt and effective administrative proceedings, established in Article 41 of the Political Constitution.” The following order was set forth in the operative provisions:
“The appeal is granted. Ana María de Montserrat Gómez de la Fuente Quiñónez, in her capacity as Vice President of the Administrative Environmental Tribunal, or whoever serves in that position in her stead, is ordered, within a period not exceeding ONE MONTH—calculated from notice of this judgment and once all required evidence is available—to issue, without undue delay, a final decision on the environmental complaint filed by the protected party and to give notice of the decision. She is advised that failure to comply with said order could constitute the offense of disobedience and that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, anyone who receives an order issued in an amparo appeal that must be complied with or enforced and who fails to comply with or enforce it shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.” Subsequently, in response to a motion alleging non-enforcement filed by the petitioner on February 18, 2023, by Decision N° 2023-32992 issued at 9:15 a.m. on December 20, 2023, the President of the Administrative Environmental Tribunal was again directed to comply immediately with the order issued in Judgment N° 2022-017133 at 9:15 a.m. on July 22, 2022. The foregoing was based on the following considerations:
“II.—REGARDING THE MOTION ALLEGING NON-ENFORCEMENT. In this case, the petitioner files a motion alleging disobedience in connection with judgment no. 2022017133 issued at 9:15 a.m. on July 22, 2022.
In this regard, it must be clarified that the Chamber ordered: ‘that, within a period not exceeding ONE MONTH—calculated from notice of this judgment and once all required evidence is available—a final decision be issued, without undue delay, on the environmental complaint filed by the protected party and that notice of the decision be given.’” In this regard, in response to evidence ordered for better adjudication (prueba para mejor resolver), the authority clarifies that the status of the case file is as follows: “That on 30 de junio de 2023, the oral and public hearing commenced in administrative case file No. [Valor 004] (see the minutes of the oral and public hearing appearing at folios 2644 to 2645 of the administrative case file). During the hearing, the parties raised preliminary matters; Lic. Mauricio Castro Lizano, in his capacity as Attorney General of the Republic, requested the three-day period established in article 50 of Ley 8508 to analyze the documentation submitted and present his statements in writing. (See minutes 1:21:47 to 1:30:27 of audio 01 of the oral and public hearing). At that hearing, the Tribunal ruled that the three-day period would be granted, stating:
‘…Having analyzed article 50 of the Administrative Judicial Procedure Code (Código Procesal Contencioso Administrativo), this Tribunal indeed finds the request made by Attorney Mauricio Castro Lizano to be consistent therewith, and in view of the other parties’ consent to granting the three-day period, this Tribunal deems it appropriate to grant the parties three days to address the documentation concerning the defenses raised today and to submit their observations to the Tribunal in writing…’ (See Audio 2, 0:12 seconds to 00:55 seconds of the Oral and Public Hearing). By Resolution No. 1391- 2023-TAA issued at ten hours and ten minutes on seis de octubre de dos mil veintitrés, appearing at folios 2692 to 2706 of the administrative case file, this Tribunal proceeded to: ‘…FIRST: DISMISS AS UNTIMELY the filing submitted on 28 de julio de 2023 by Mr. Gad Amid Kaufman, in his capacity as complainant.
SECOND: DENY THE MOTION FOR COMPULSORY JOINDER (INTEGRACIÓN DE LITIS) filed by Mr. Gad Amid, in his capacity as complainant. THIRD: REJECT THE RES JUDICATA DEFENSE (EXCEPCIÓN DE COSA JUZGADA) raised by Lic. Fabián Volio Echeverría, in his capacity as special administrative attorney-in-fact for SF Costa Rica Hotelera de Guanacaste, and Lic. Roberto Echeverría, in his capacity as general judicial attorney-in-fact for SF COSTA RICA HOTELERA DE GUANACASTE S.A., PRHORESA COSTA RICA S.A. and YITZAK INVESTMENTS S.A. FOURTH: DENY THE MOTIONS FOR NULLITY (INCIDENTES DE NULIDAD) filed by Lic. Cesar Reyes, representative of the Municipalidad de Carrillo, and Lic. Roberto Echeverría, in his capacity as general judicial attorney-in-fact for SF COSTA RICA HOTELERA DE GUANACASTE S.A., PRHORESA COSTA RICA S.A. and YITZAK INVESTMENTS S.A. FIFTH: Deny the request to update the Economic Valuation of Environmental Damage (Valoración Económica del Daño Ambiental) submitted by Attorney Mauricio Castro Lizano.
SIXTH: Order Lic. Mauricio Lizano to provide a copy of Official Letter 1418-12- DRG. SEVENTH: Notify the parties of the documentation submitted by Mr. [Nombre 001], in his capacity as complainant, appearing at folios 2682 to 2684 of the administrative case file, so that the parties may address it during the taking of evidence (evacuación de prueba), corresponding to the continuation of the oral and public hearing. EIGHTH: Maintain the validity of charging resolution (resolución de imputación de cargos) number 1473-2022-TAA issued at 08 hours on 02 de noviembre de 2022; the continuation of the oral and public hearing is scheduled for 17 de octubre de 2023, 18 de octubre de 2023 and 19 de octubre de 2023, at 8:30 hours at the facilities of the Tribunal Ambiental Administrativo, with all parties identified in the Seventh Recital (Considerando Sétimo) of this resolution being summoned…’ See folios 2692 to 2706 of the administrative case file.
That folios 2755 to 2759 contain a filing submitted on 13 de octubre de 2023 and signed by Lic. César Reyes Carvajal, in his capacity as Legal Counsel to the Municipalidad de Guanacaste (sic), through which he filed a motion for nullity. That by Resolution No. 1425-2023-TAA issued at fourteen hours and eleven minutes on trece de octubre de dos mil veintitrés, this Tribunal ruled: ‘…FIRST: Deny the motion for nullity filed by Lic. César Reyes Carvajal, in his capacity as Legal Counsel to the Municipalidad de Guanacaste (sic). SECOND: Deny Mr. Roger Gutiérrez Vindas’s request to be excused as a witness in this case file. THIRD: Deny the request submitted by Mr. Max Villalobos Solís and inform him that he must appear on all three specified days. FOURTH: Maintain the validity of charging resolution number 1473-2022-TAA issued at 08 hours on 02 de noviembre de 2022; the continuation of the oral and public hearing is scheduled for 17 de octubre de 2023, 18 de octubre de 2023 and 19 de octubre de 2023, at 8:30 hours at the facilities of the Tribunal Ambiental Administrativo, with all parties identified in the Seventh Recital of this resolution being summoned…’ See folios 2760 to 2764 of the administrative case file.
That on 16 de octubre de 2023, this Office received by email the ruling issued by the Sala Constitucional at fourteen hours and fifty-three minutes on trece de octubre de dos mil veintitrés. See folios 2811 to 2812 of the administrative case file. That folios 2813 to 2814 of the administrative case file contain a motion for reconsideration (recurso de revocatoria) filed by Lic. Fabian Volio Echeverría. That by Resolution No. 1433-2023-TAA issued at thirteen hours and fifteen minutes on dieciséis de octubre de dos mil veintitrés, this Tribunal ruled: ‘…FIRST: Deny the request of Lic. Fabian Volio Echeverría because he lacks authority to represent PRHORESA COSTA RICA S.A., corporate identification number 3-101-450627. SECOND: Suspend the hearing scheduled for 17, 18 and 19 de octubre del 2023, for the reasons stated in the Sole Recital (considerando único) of this resolution, and reschedule the oral and public hearing for 24, 26 and 27 de octubre at 08 hours 30 minutes at the seat of this Tribunal, while maintaining the validity of charging resolution number 1473-2022 TAA issued at 08 hours on 02 de noviembre de 2022…’ See folios 2824 to 2828 of the administrative case file.
That folios 2878 to 2882 contain a filing submitted by Mr. Gad Amid, in his capacity as complainant, in which he requests: ‘…I am compelled to request that the TAA hearing scheduled for the 26 be rescheduled for the following week…’ See folio 2881 of the case file. That folios 2886 to 2887 contain a motion for nullity filed by Lic. Roberto Echeverría Alfaro. That by Resolution No. 1476-2023-TAA issued at fifteen hours on dieciocho de octubre de 2023, this Tribunal ruled: ‘…FIRST: Order Lic. Bernal Gamboa Mora to submit a copy of the proof of service issued by the Tribunal Contencioso Administrativo, in accordance with the first recital of this resolution. SECOND: Deny the motion for nullity filed by Lic. Roberto Echeverría Alfaro, in his capacity as General Judicial Attorney-in-Fact for PRHORESA COSTA RICA S.A., SF COSTA RICA HOTELERA DE GUANACASTE S.A. AND YITZAK INVESTMENTS S.A., as established in the second recital of this resolution.
THIRD: The continuation of the oral and public hearing shall remain scheduled for 24, 26 and 27 de octubre del 2023, and 30 and 31 de octubre and 1 de noviembre are additionally designated, with proceedings beginning at 08 hours 30 minutes on each specified day at the seat of this Tribunal, to ensure the proper presentation of the testimony of the witnesses identified in the Charging Resolution, while maintaining the validity of charging resolution number 1473-2022-TAA issued at 08 hours on 02 de noviembre de 2022, as stated in the third recital of this resolution. FOURTH: With respect to summoning Mr. Nelson Marín Mora as a witness, the Tribunal will address the matter at the corresponding taking-of-evidence stage during the continuation of the oral and public hearing…’ (See folios 2893 to 2900 of the administrative case file). In light of the foregoing, the Honorable Sala Constitucional is informed that this Tribunal has proceeded as required by law and that the continuation of the oral and public hearing remains scheduled for 24, 26 and 27 de octubre de 2023; the Tribunal also designated 30 and 31 de octubre and 1 de noviembre for that hearing.
In consideration of the foregoing, I request that the report be deemed submitted on the following terms.” Now, although the respondent explains the procedural course (iter) followed in processing the protected party’s complaint, it is no less true that, as of this date, 17 months have elapsed since judgment 2022017133, issued at 9:15 hours on 22 de julio de 2022, was served upon the respondent—that is, the period originally granted has been exceeded by almost 16 months—without any indication to date that a final decision has been issued on the environmental complaint underlying this proceeding. This situation plainly constitutes manifest disobedience of this Tribunal’s order. The application alleging noncompliance (gestión de desobediencia) is therefore granted.” In this case, the petitioner alleges a new matter not contemplated in the enforcement of the aforementioned judgment. Specifically, he explains that the proceedings before the Tribunal Ambiental Administrativo in case file N° [Valor 004] have been unable to advance—although the matter is ready for judgment—because substitute judges have not been appointed to the Tribunal Ambiental Administrativo.
Regarding the alleged facts, the President of the Tribunal Ambiental Administrativo, the Ministra de la Presidencia—who, on behalf of the Presidente de la República, represents the Consejo Nacional Ambiental—and the Ministro de Ambiente y Energía, who serves as Executive Secretary of that Council, were each given an opportunity to be heard.
The President of the Tribunal Ambiental Administrativo states that, indeed, in the case described by the protected party (case file [Valor 004]), by Resolution N° 397-2024-TAA of 10 de abril de 2024, the Tribunal Ambiental Administrativo stayed the procedural time limits (suspendió los plazos) because there were insufficient members to constitute the Tribunal. She further states that the case file is at the stage of evaluating the evidence, conclusions, and facts for issuance of the final administrative act (acto final). Thus, this case differs from others processed before this Sala Constitucional, such as case file 24-010364-0007-CO cited by the Ministra de la Presidencia (judgment N° 2024-18803 issued at 9:30 hours on 5 de julio de 2024): the case file is virtually ready for decision, and the failure to constitute the collegiate body (órgano colegiado) is causing the violation of the right to prompt administrative justice.
As to the Tribunal’s current composition, it is explained that only two permanent judicial positions are filled: Adriana Bejarano Alfaro, in her capacity as President, and Ana María de Monserrat Gómez de la Fuente Quiñones, in her capacity as Vice President. Furthermore, according to the President of that Tribunal, the loss of quorum (desintegración) occurred on 19 de marzo de 2024 because the other member, Ms. Alexandra González Arguedas, took vacation leave from that date through 10 de abril de 2024 and subsequently resigned from her position as a permanent judge effective 11 de abril de 2024. The alternate judges submitted their resignations in the following order: a) on 17 de noviembre de 2021, Maricela Rodríguez Porras; b) on 11 de enero de 2024, Elizabeth Araya Jiménez; and c) on 16 de enero de 2024, Carla Vanessa Agüero Zeledón.
At this point, it is necessary to explain that the Political Constitution implicitly recognizes the fundamental right of persons subject to the administration (administrados) to the proper and efficient operation of public services, that is, to have such services provided according to high quality standards. This necessarily entails the corresponding obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently. That obligation is heightened in cases involving the safeguarding of environmental protection, as derived from Article 50 of the Political Constitution. In this regard, it is necessary to note that environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making it necessary for the Public Authorities to intervene with respect to factors that may disrupt its balance and prevent individuals from developing and thriving in a healthy environment.
Consequently, the State—and, in this particular case, the Consejo Nacional Ambiental—should have acted as guarantor of the protection and safeguarding of the environment and natural resources by promptly appointing suitable persons so that the Tribunal Ambiental Administrativo could perform the duties entrusted to it. It should be noted that, with respect to the alternate judges, one person resigned in November 2021 and the others in January of this year, yet the corresponding appointments were not made. Thus, when this amparo proceeding (recurso de amparo) was filed—30 de julio de 2024—more than two and a half years had elapsed with respect to the first individual and more than six months with respect to the others. Accordingly, because that obligation was not fulfilled, when the regular member resigned in March of this year, the Tribunal could no longer be duly constituted to issue the final decisions in the proceedings before it—including [Valor 004], which is the subject of this proceeding.
Regarding the delay in processing those appointments, the Ministro de Ambiente y Energía, who serves as Executive Secretary of the aforementioned Consejo Nacional Ambiental, acknowledges that efforts have “…been made to appoint the regular judge and subsequently the alternate judges; however, to date, none of the proposed candidates has accepted the position, for various reasons, whether justified or not…”. He later stated that efforts had been made to “…find a suitable person for the position of Regular Judge and suitable persons for the positions of Alternate Judges so that the Tribunal may continue operating, and it has been materially impossible for us to make those appointments.” He further states that, “…to date, no agreement exists for the Appointment of the regular and alternate judge or judges, and it will therefore be incumbent upon the Consejo Nacional Ambiental to evaluate the résumés in accordance with the requirements set forth in section 105 of the Ley Orgánica del Ambiente, Ley N°7554, in order to comply with the Law.” For her part, the Ministra de la Presidencia stated, regarding “…the situation of the Tribunal Ambiental Administrativo, that this situation was not brought to my attention in my capacity as President of the Consejo Nacional Ambiental, and that said lack of a duly constituted panel was communicated to the Ministro de Ambiente y Energía…”; she further stated that “we will use our good offices to address the situation facing the Tribunal Ambiental Administrativo due to the lack of judges needed to constitute it.” This Constitutional Court finds that, regardless of whether notice was given concerning the appointment of members of the Consejo—which, in any event, the President of the Tribunal Ambiental Administrativo states did occur (official letters N° 342-2024-TAA del 10 de abril de 2024, N° 375-2024-TAA del 23 de abril de 2024 and N° 651-2024-TAA del 26 de julio de 2024, some addressed to the Ministro de Ambiente y Energía and Executive Secretary of the Consejo Nacional Ambiental, and another to the Presidente de la República, with a copy to the Ministra de la Presidencia)—the fact remains that Article 104 of the Ley Orgánica del Ambiente clearly assigns responsibility for appointing the members of the Tribunal Ambiental Administrativo to the Consejo Nacional Ambiental, stating that the latter shall be “…composed of three regular members and three alternates, all appointed by the Consejo Nacional Ambiental for a period of six years…”. It must therefore ensure at all times, including on its own motion (de oficio), that the Tribunal Ambiental Administrativo is duly constituted so that it may perform the duties entrusted to it.
Thus, although there was an administrative delay (mora administrativa) during the processing of the case file that is the subject of this proceeding, [Valor 004], for which the Tribunal Ambiental Administrativo was responsible and which was reviewed by this Constitutional Chamber in amparo proceeding 22-014523-0007-CO, partially cited above, as concerns this amparo proceeding, it is clear that responsibility for the current administrative delay lies exclusively with the Consejo Nacional Ambiental. Consequently, the proceeding must be granted, subject to the terms set forth in the operative portion (parte dispositiva) of this judgment.
The Tribunal Ambiental Administrativo shall take note that, as soon as the missing members are appointed, it must immediately comply with the order issued by this Constitutional Chamber in Judgment N° 2022-17133 de las 9:15 horas de 22 de julio de 2022, which was reiterated in Resolution N° 2023-32992 de las 9:15 horas de 20 de diciembre de 2023.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days counted from service of notice (notificación) of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session N° 27-11 del 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 del 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at Session N° 43-12 celebrada el 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The proceeding is granted. Laura Fernández Delgado, in her capacity as Ministra de la Presidencia and as representative of the President of the Consejo Nacional Ambiental, or whoever holds that office in her stead, is ordered, within TWO MONTHS—counted from service of notice of this judgment—to undertake all actions within the scope of her authority necessary to appoint the missing members of the Tribunal Ambiental Administrativo. She is warned that failure to comply with this order may constitute the offense of disobedience and that, pursuant to Article 71 of the Ley la Jurisdicción Constitucional, any person who receives an order that they are required to comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo).- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del once de octubre de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente N° 24-020676-0007-CO, interpuesto por [Nombre 001], cédula de residencia [Valor 001], a favor de SÍ MISMO Y DE LA [Nombre 002], cédula jurídica N° [Valor 002], contra el CONSEJO NACIONAL AMBIENTAL Y EL TRIBUNAL AMBIENTAL ADMINISTRATIVO.
RESULTANDO:
“PRIMERO: Que el Tribunal Ambiental Administrativo (TAA) por disposición del artículo 103 de la Ley Orgánica del Ambiente (publicada en La Gaceta N° 215 del 13 de noviembre de 1995). establece que es un órgano desconcentrado del Ministerio de Ambiente y Energía, con competencia exclusiva e independencia funcional en el desempeño de sus atribuciones.
Acorde con las potestades del Tribunal Ambiental Administrativo conforme a la Ley Orgánica del Ambiente. esta institución actúa a partir de ser presentada la denuncia a instancia de parte (Art. 108 de LOA) o de oficio (Art. 111 de LOA).
SEGUNDO: De previo a contestar los argumentos del presente recurso de amparo es importante señalar los antecedentes en relación con el expediente administrativo número [Valor 004]. a saber:
Se cita a audiencia oral y pública para el día 24 de febrero de 2023. Ver folios 2280 a 2286 del expediente administrativo.
TERCERO: Respecto de la conformación del Tribunal Ambiental Administrativo. Antecedentes:
(…)
CUARTO: SOBRE LOS HECHOS ALEGADOS POR EL RECURRENTE.
Manifiesta el amparado. en resumen: "...que interpone el amparo a favor de Ia [Nombre 002]. Comenta que en el Tribunal Ambiental Administrativo se está tramitando el expediente n.° 1 74-09-03-TAA desde hace 15 años. Comenta que se tuvo que interponer un recurso de amparo (expediente n. 22-014523-0007-CO), donde se le ordenó a dicho tribunal avanzar y resolver el caso. Explica que aún con atrasos, a finales del año pasado se realizaron las audiencias durante varias semanas y, a inicios de 2024, el expediente quedó listo para sentencia. No obstante, a mediados de este año, tes informaron que, por renuncia de una de las juezas, quedaba suspendido el dictado de la sentencia Apunta que se esperaron unas semanas para ver si se regularizaba la situación en el Tribunal Ambiental Administrativo, pero, hace unos días. se preguntó, respondieron que aún no se habían nombrado a los jueces (oficio 649-24-TAA)... Acusa que, desde el inicio de esta administración, no se han nombrado jueces sustitutos, lo que entraba el avance de los procesos. Solicita el nombramiento de un juez titular y tres suplentes para el Tribunal Ambiental Administrativo. " Conforme a las competencias dada por Ley a este Tribunal Ambiental Administrativo, se desglosa y da respuesta en los siguientes términos:
QUINTO: En cuanto al argumento: "Comenta que en el Tribunal Ambiental Administrativo se está tramitando el expediente n.° [Valor 004] desde hace 15 años. Comenta que se tuvo que interponer un recurso de amparo (expediente n. 22-014523-0007-CO), donde se te ordenó a dicho tribunal avanzar y resolver et caso. Explica que aún con atrasos, a finales del año pasado se realizaron las audiencias durante varias semanas y, a inicios de 2024, el expediente quedó listo para sentencia. No obstante, a mediados de este año, les informaron que, por renuncia de una de las juezas, quedaba suspendido el dictado de la sentencia (..)
Por lo que en cuanto este argumento no es un hecho controvertido para este Tribunal, en atención a que es cierto que el expediente administrativo [Valor 004] se encuentra con una denuncia presentada desde el 2009 y conforme al procedimiento ordinario administrativo, la dificultad y amplitud de la investigación, prueba recabada y partes involucradas han conllevado que se forme un expediente administrativo conformado por Quince Tomos, donde se llevó a cabo la audiencia oral y pública en 7 comparecencias, la cual culmina con la última realizada en fecha 17 de noviembre de 2023, donde se otorga a las partes plazo de 5 días para presentar sus conclusiones. Ver folios 3213 a 3214 del expediente administrativo.
Con posterioridad a esto, este Tribunal solicitó prueba para mejor resolver mediante Resolución No. 93-2024-TAA del 26 de enero de 2024, ver folios 3271 a 3278 y se puso en conocimiento de la Prueba para mejor resolver mediante Resolución 339-2024-TAA del 18 de marzo de 2024 ver folios 3413.
Con posterioridad a esto, a partir del 19 de marzo de 2024 hasta el 10 de abril de 2024, la MSc. Alexandra González Arguedas se encontraba de vacaciones (De conformidad con boleta de vacaciones) y a partir del 11 de abril de 2024, ya su renuncia se hacía efectiva.
Por lo que en fecha 10 de abril de 2024, se procedió a dictar la Resolución No. 397-2024-TAA de suspensión de plazos por desconformación del Tribunal. Ver folios 3448 a 3453.
Por lo que el estado del expediente [Valor 004], es que se puso en conocimiento de la Prueba para Mejor Resolver, pendiente de ver los escritos y gestiones presentadas por el Órgano Colegiado (tres Jueces) para determinar en razón de la prueba para mejor resolver, para ver si corresponde algún otro trámite y el consecuente dictado del acto final. Por lo que es necesario nombrar al Juez titular del Tribunal Ambiental Administrativo para concluir con el expediente administrativo.
SEXTO: En cuanto al argumento: "Apunta que se esperaron unas semanas para ver si se regularizaba la situación en el Tribunal Ambiental Administrativo, pero, hace unos días, se preguntó, respondieron que aún no se habían nombrado a los jueces (oficio 649-24-TAA).
Acusa que, desde el inicio de esta administración, no se han nombrado jueces sustitutos, lo que entraba el avance de los procesos. Solicita el nombramiento de un juez titular y tres suplentes para el Tribunal Ambiental Administrativo." En cuanto a este argumento es cierto, pero con algunas aclaraciones de las actuaciones de este Tribunal.
Es cierto, o por lo menos a este Tribunal no lo han puesto en conocimiento de que se hayan nombrado al Juez propietario y los jueces suplentes por el Consejo Nacional Ambiental, por lo que, para algunas de las actuaciones, entre ella, la emisión del Acto final, por principio de legalidad se requiere que este conformado el Órgano Colegiado, en atención a que en el expediente administrativo número, [Valor 004] en el que es parte el recurrente, conforme al procedimiento ordinario administrativo concluida la audiencia pública, recibida las conclusiones, se encuentra en la etapa de valoración de la prueba, conclusiones y hechos "para para la emisión del Acto Final". Como prueba de lo manifestado, el artículo 10 del Decreto Ejecutivo N° 34136-MINAE, Reglamento de Procedimiento del Tribunal Ambiental Administrativo, modificado mediante Decreto 43795-MINAE. publicado en el Diario Oficial La Gaceta N° 230 del primero de diciembre de 2022, indica en lo que interesa:"...Corresponderá a los Jueces el dictado de las resoluciones de los expedientes de manera unipersonal, hasta inclusive la apertura del procedimiento ordinario administrativo y los recursos de revocatoria... La audiencia y el dictado de las resoluciones finales corresponderá al órgano colegiado en pleno…", siendo necesario que el órgano colegiado este conformado para poder sesionar válidamente.
En el mismo orden de ideas, el artículo 8 del Decreto Ejecutivo N° 341 36-MINAE, indica de la necesaria integración para sesionar con validez"-Validez para sesionar. Para que el Tribunal sesione válidamente, se requerirá la concurrencia de los tres miembros. Las deliberaciones del Tribunal serán privadas y la votación se recibirá en forma nominal, tomándose las decisiones por mayoría simple. La redacción de los autos y resoluciones finales, será por riguroso turno y dentro del término establecido al efecto por la Ley General de la Administración Pública." En este sentido la resolución N° 2024-018803 de las nueve horas treinta minutos del cinco de julio del dos mil veinticuatro emitida por la Sala Constitucional de la Corte Suprema de Justicia. (Se adjunta como prueba) El no nombramiento del Juez propietario y los tres suplentes han conllevado que se suspendan el procedimiento ordinario administrativo de los expedientes que se encuentran en la etapa para la realización de la audiencia pública desde el 19 de marzo del 2024 a la fecha y de la emisión del acto final, y como consecuencia de todos los actos correlativos a esas etapas que requiera el Órgano Colegiado.
Actualmente se encuentra válidamente nombradas solo dos de los puestos de Juez Propietario, la suscrita, Adriana Bejarano Alfaro. en calidad de Presidenta y la señora Ana María de Montserrat Gómez de la Fuente Quiñonez, en calidad de Vicepresidenta, en atención a la votación que año a año se realiza conforme lo exige el artículo 105 de la Ley Orgánica del Ambiente, quedando ratificado la de este año en la Resolución No. 1701-2023- TAA de las doce horas, treinta y cinco minutos del día dieciocho de diciembre del dos mil veintitrés. (Se adjunta como prueba).
Se aclara, que esta desintegración del Órgano Colegiado (TAA) se concretó a partir de que la señora Alexandra González Arguedas, sacó vacaciones desde el día 19 de marzo de 2024 al 10 de abril de 2024, y posteriormente presentó la renuncia a su puesto de Juez propietario a partir del 11 de abril de 2024, efectiva desde ese momento. Sin que se pudiera suplir con un Juez Suplente, en atención a los jueces suplentes del Tribunal Ambiental Administrativo, presentaron su renuncia según este orden: la Licda. Marcela Rodríguez Porras, presentó la renuncia como Juez Suplente desde el 17 de noviembre del 2021, efectiva a partir de ese momento, el 11 de enero del 2024, la Jueza Suplente, Licda. Elizabeth Araya Jiménez presentó su renuncia como Jueza Suplente por pensión, efectiva a partir de esa misma fecha y la Jueza Suplente Licda. Carla Vanessa Agüero Zeledón, presentó su renuncia irrevocable como Jueza Suplente del Tribunal Ambiental Administrativo, efectiva a partir de esa misma fecha, 16 de enero del 2024, sin que a la fecha se hayan realizado los nuevos nombramientos.
Ahora bien, lo que el recurrente solicita ante el Tribunal Constitucional, "(...) el nombramiento de un juez titular y tres suplentes para el Tribunal Ambiental Administrativo", esta petición esta fuera del ámbito de acción de este Tribunal. de conformidad con el principio de legalidad los nombramientos de los Jueces propietario y suplentes lo debe realizar el Consejo Nacional Ambiental,(Órgano creado a partir del artículo 77 de la Ley Orgánica del Ambiente) por así estipularlo la Ley Orgánica del Ambiente en el Artículo 104: "Integración del Tribunal. El Tribunal Ambiental Administrativo estará integrado por tres miembros propietarios y tres suplentes, todos de nombramiento del Consejo Nacional Ambiental, por un periodo de seis años. Serán juramentados por el presidente de este Consejo." (La negrita no es del original) Desde que se dio la desintegración del Órgano Colegiado "Tribunal Ambiental Administrativo" preocupadas por esa situación. se han enviado oficios informando y reiterando de la necesidad de nombramiento: 1) al Señor Presidente de la República mediante el oficio 375- 2024-TAA del 23 de abril del 2024 con copia a la Ministra de la Presidencia y los restantes integrantes del Consejo Nacional Ambiental (artículo 79 de la Ley Orgánica del Ambiente), 2) al señor Franz Tattenbach Cabra.
Ministro de Ambiente, en calidad de Secretario del Consejo Nacional Ambiental también se envió el oficio 342.2024-TAA del 10 de abril del 2024 con respecto al expediente administrativo [Valor 004], informando de la imposibilidad material para proseguir el trámite del expediente, y que mediante resolución número 397-2024-TAA de las ocho horas con treinta minutos del día diez de abril de dos mil veinticuatro se suspendió el procedimiento administrativo del expediente de marras por esa situación, además se le solicita de manera urgente el nombramiento del Juez (a) Titular así como de los Jueces Suplentes del Tribunal Ambiental Administrativo, para poder integrar el órgano colegiado de conformidad con lo dispuesto en los artículos 103 y siguientes de la Ley General de la Administración Pública y de esta manera poder continuar con el trámite del expediente administrativo número [Valor 004], ; 3 ) muy recientemente mediante el oficio O-651-2024-TAA del 26 de julio del 2024. al señor Franz Tattenbach Cabra, Ministro de Ambiente, en calidad de Secretario del Consejo Nacional Ambiental, en el que se le informa la condición de este TM, y el impacto de la no integración del Órgano Colegiado, acudiendo respetuosamente para solicitar nuevamente de manera urgente el nombramiento del Juez Titular así como de los Jueces Suplentes del Tribunal Ambiental Administrativo, y así poder integrar el órgano colegiado de conformidad con lo dispuesto en los artículos 103 y siguientes de la Ley General de la Administración Pública y de esta manera poder continuar con el trámite de los expedientes administrativos en este Tribunal. 4) Oficios notificando al Ministro, el Señor Franz Tattenbach Cabra, de la suspensión de los procesos y expedientes administrativo que se encuentran imposibilitados de continuar con el procedimiento Ordinario Administrativo. por estar desintegrado el Órgano Colegiado (ver cuadro del punto Tercero de este escrito).
Conforme a lo anterior, no corresponde el recurso de amparo n las pretensiones contra este Tribunal Ambiental Administrativo, en razón, que lo que quiere el petente está fuera del ámbito de competencias, y lo que jurídicamente puede hacer ya lo ha realizado".
En atención a las consideraciones expuestas, solicita se declare sin lugar el recurso.
“…II.- SOBRE EL FONDO: Se advierte que en primer término que el conocimiento y tramitación del expediente N.° [Valor 004], no es una situación en la que tenga competencia para resolver, por lo que cualquier atraso en la diligencia del mismo, es un asunto ateniente propiamente al Tribunal Ambiental Administrativo. Se advierte que la tramitación del mismo ha tardado más de 15 años, situación que no se puede atribuir a la problemática en relación con la integración del tribunal que se produjo entre finales de 2020 y abril de este año.
Al respecto, esta Sala indicó en un asunto similar mediante sentencia N.° 2024018803 de las 9:30 horas del 05 de julio de 2024, en el que el Tribunal Ambiental Administrativo argumentó que el retardo en la tramitación de los asuntos se debía a la ausencia de jueces, lo siguiente:
“En ese mismo orden de consideraciones, cabe señalar que no resulta de recibo lo señalado por la Presidenta de dicho Tribunal, en el sentido que, al no estar integrado dicho órgano en su totalidad (ante la renuncia de la jueza propietaria y las suplentes), no se puede continuar con la atención de escritos y de gestiones pendientes en el citado procedimiento. Lo anterior, ya que, bajo la solemnidad de juramento, el Ministro de Ambiente y Energía, en calidad también de Secretario del Consejo Nacional Ambiental, informó y aclaró a esta Sala, sobre el particular, lo siguiente:
“(…) De conformidad con todo lo expuesto, el TAA tiene herramientas legales para seguir operando, y la falta de integración de un juez o jueza no es motivo para que dejar de tramitar los expedientes. Por lo que, todo el procedimiento ordinario puede ser instruido por los o las juezas, sin necesidad que el TAA esté integrado, es decir, el Juez instructor puede tramitar, instruir y emitir algunas resoluciones, salvo el dictado de la resolución final (…)”.
De este modo, se desprende con claridad que si bien, ante la ausencia actualmente de un juez que conforme el Tribunal Ambiental Administrativo, no se puede emitir la resolución final del caso, lo cierto es que el juez a cargo del procedimiento sí tiene la potestad de continuar tramitando e instruyendo este último; incluso, de emitir resoluciones, en aras de garantizar y proteger, haciendo uso de otros mecanismos, el derecho al ambiente y a la salud de los vecinos afectados con las acciones acreditadas en este proceso. Actuaciones anteriores que, sin embargo, según el dicho de la propia Presidenta recurrida, se echan de menos en este asunto.” En otro orden de ideas, es preciso indicar que la situación del Tribunal Ambiental Administrativo, que esta situación no fue puesta en conocimiento en mi condición de Presidente del Consejo Nacional Ambiental, que dicha ausencia de integración le fue comunicada al Ministro de Ambiente y Energía, de acuerdo al cuadro aportado por el propio tribunal recurrido visible de página 10 a 13 del oficio 682-2024-TAA de fecha 12 de agosto de 2024.
No obstante, lo anterior, se interpondrá nuestros buenos oficios para atender la situación en la que se encuentra el Tribunal Ambiental Administrativo ante la falta de jueces para la integración de este.
Finalmente, se advierte que, dentro de las actuaciones alegadas por la parte recurrente, no he tenido participación directa al ser una gestión que fue puesta en conocimiento directo del Ministro de Ambiente y Energía. Sin embargo, se hace imperioso indicar mi fiel compromiso de velar por los derechos y garantías constitucionales, que como funcionarios debemos honrar. Solicito a la Sala declare sin lugar el recurso”.
En atención a las consideraciones expuestas, solicita se declare sin lugar el recurso.
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
El recurrente asegura en el Tribunal Ambiental Administrativo se está tramitando el expediente N° [Valor 004], pero no se ha podido continuar el avance del procedimiento -que está listo para sentencia- debido a que no se han designado jueces sustitutos en el Tribunal Ambiental Administrativo. Considera que la situación descrita vulnera su derecho a una justicia administrativa pronta.
De importancia para la resolución del presente recurso, se estiman como debidamente demostrados los siguientes hechos de relevancia:
Por resolución N° 397-2024-TAA de 10 de abril de 2024, el Tribunal Ambiental Administrativo suspendió los plazos en el expediente [Valor 004], debido a la falta de miembros para conformar el Tribunal. En concreto, resolvió: “De conformidad con lo dispuesto en los artículos 11, 21, 41, 46, 50, 74 y 89 de la Constitución Política, en relación a los preceptos 1, 2, 4, 61, 98 a 101, 103, 106, 107, 108, 109, 110 y 111 de la Ley Orgánica del Ambiente, artículos 8, 9, 11, 45, 54, 105 y 109 de la Ley de Biodiversidad, artículo 4 de la Ley Forestal, artículos 11, 63, 66, 69, 175, 214, 259, 263, 270, 282 y siguientes, 292, 308, 309, 313, 330, 331, 340 y concordantes de la Ley General de la Administración Pública, artículo 13 de la Ley de la Jurisdicción Constitucional, artículos 66 y concordantes del Código Procesal Contencioso Administrativo, 37 y concordantes del Código Procesal Civil, así como artículos 1, 10, 11 y 24 y siguientes del Reglamento de Procedimientos del Tribunal Ambiental Administrativo, se acuerda: ÚNICO: Con fundamento en lo señalado en los considerandos anteriores de esta resolución, y por imposibilidad material que se declara al no estar integrado el Tribunal, se tiene por suspendido el procedimiento administrativo del presente expediente administrativo Nº 174- 09-03TAA, con suspensión de los plazos para continuarlo hasta su conclusión hasta tanto no se integre de nuevo el Cuerpo Colegiado” (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo y el informe rendido por el Ministro de Ambiente y Energía y la prueba aportada por el Tribunal Ambiental Administrativo).
Actualmente, en el Tribunal Ambiental Administrativo están designados solo dos de los puestos de jueces propietarios: Adriana Bejarano Alfaro en su condición de Presidenta y Ana María de Monserrat Gómez de la Fuente Quiñones en calidad de Vice Presidenta. La desintegración del Tribunal ocurrió desde el 19 de marzo de 2024, ya que el otro miembro, sea la señora Alexandra González Arguedas, sacó vacaciones desde esa fecha y hasta el 10 de abril de 2024 y, posteriormente, presentó su renuncia al puesto de juez propietario a partir del 11 de abril de 2024. En cuanto a los jueces suplentes, presentaron su renuncia según el siguiente orden: el 17 de noviembre de 2021 Maricela Rodríguez Porras, el 11 de enero de 2024 Elizabeth Araya Jiménez, el 16 de enero de 2024 Carla Vanessa Agüero Zeledón el 16 de enero de 2024 (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo).
Por oficio N° 342-2024-TAA del 10 de abril de 2024, Adriana Bejarano Alfaro en su condición de Presidenta y Ana María Monserrat Gómez de la Fuente en su condición de Vicepresidenta, ambas del Tribunal Ambiental Administrativo, le comunicaron a Franz Tattenbach Capra, Ministro de Ambiente y Energía y Secretario Ejecutivo del Consejo Nacional Ambiental, que no cuentan con nombramientos de Juez Titular ni Jueces Suplentes, a efecto de tramitar el expediente [Valor 004], por lo que solicitó la designación de manera urgente (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo y la prueba que aporta).
El 9 de mayo de 2024, por oficio N° 375-2024-TAA del 23 de abril de 2024, suscrito por el Tribunal Ambiental Administrativo dirigido al Presidente de la República, con copia a la Ministra de la Presidencia informó acerca de la omisión en designar los miembros de ese Tribunal Ambiental (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo y la prueba aportada por el Tribunal Ambiental Administrativo).
El 15 de julio de 2024, el recurrente presentó una solicitud de información respecto al expediente [Valor 004] (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo).
Por oficio N° 649-24-TAA del 24 de julio de 2024, la Presidenta y Vicepresidenta del Tribunal Ambiental Administrativo, respecto al expediente [Valor 004] y su gestión planteada, le indicaron al tutelado lo siguiente: “Reciba de nuestra parte un cordial saludo. Las que suscriben Adriana Bejarano Alfaro, Presidenta y Ana María de Montserrat Gómez de la Fuente Quiñónez Vicepresidenta del Tribunal Ambiental Administrativo, nos dirigimos a usted en relación con su escrito de fecha 15 de julio del 2024, Solicitud de información, para indicar en cuanto a sus consultas lo siguiente: En cuanto a la primera consulta: "...Respetuosamente solicito se me informe si ya se nombraron los jueces faltantes para integrar el Tribunal Ambiental Administrativo, conforme se indicó en la resolución de las ocho horas con treinta minutos del día diez de abril de dos mil veinticuatro. " En este sentido a la fecha de la emisión del presente oficio, no se nos ha comunicado de manera oficial del nombramiento del Juez titular faltante ni de los Jueces Suplentes del Tribunal Ambiental Administrativo.
En cuanto a su segunda consulta: "...Solicito se me informe cuantos jueces deberían integrar el Tribunal Ambiental Administrativo… " En este sentido, se transcribe lo indicado en el artículo 104 de la Ley Orgánica del Ambiente el cual indica: " ..Artículo 104- Integración del Tribunal. El Tribunal Ambiental Administrativo estará integrado por tres miembros propietarios y tres suplentes, todos de nombramiento del Consejo Nacional Ambiental, por un periodo de seis años. Serán juramentados por el presidente de este Consejo... " En cuanto a su tercera consulta: “...Solicito se me informe cuantos jueces tiene nombrados en la actualidad el Tribunal Ambiental Administrativo y sus nombres... " Actualmente nos encontramos nombradas en los puestos de Juez Titular: Jueza Presidenta: MSC. Adriana Bejarano Alfaro. Jueza Vicepresidenta: MSC. Ana María de Montserrat Gómez de la Fuente Quiñónez. En cuanto a su cuarta consulta: "...Solicito se me informe cuantas secciones de jueces tiene el Tribunal Ambiental Administrativo…
" El Tribunal Ambiental Administrativo no cuenta con secciones únicamente se encuentra conformado como lo indica el artículo 104 de la Ley Orgánica del Ambiente. En cuanto a su quinta consulta: ...Solicito me informe cuantos casos están en trámite en la actualidad en el Tribunal Ambiental Administrativo. " En este sentido, al 19 de junio de 2024 el Tribunal Ambiental Administrativo cuenta con 4271 expediente activos. En cuanto a su sexta y sétima consulta: “...Solicito se me informe para cuando se reactivará el expediente 174-09-03…7.” Siendo que este expediente está en fase final, solicito se me informe para cuando se proyecta que exista una sentencia o resolución final en el expediente 174-09-03… " En este sentido indica el artículo 10 del Decreto Ejecutivo 34136 Reglamento de Procedimientos del Tribunal Ambiental Administrativo. " ...Articulo 10.- Resoluciones. Corresponderá a los jueces el dictado de las resoluciones de los expedientes de manera unipersonal, hasta inclusive la apertura del procedimiento ordinario administrativo y los recursos de revocatoria.
El dictado de resoluciones de informes e inspección corresponderán al abogado tramitador. La realización de la audiencia y el dictado de resoluciones finales corresponderá al órgano colegiado en pleno. Cuando la resolución de un caso algún juez se aparta de la decisión de mayoría, deberá salvar su voto razonando los motivos, y en todo caso, debe firmar conjuntamente con los demás integrantes la resolución correspondiente. El voto salvado deberá constar como parte integral de la resolución a continuación de la parte dispositiva..." Así reformado por el artículo 1° del decreto ejecutivo N° 43795 del 21 de setiembre del 2022) La negrita no corresponde al original. Por lo cual hasta que el Tribunal Ambiental no se encuentre debidamente conformado, no se puede proceder con el dictado del acto final según en derecho corresponda”. La firma digital de ese documento fue consignada el 24 de julio de 2024 (véase al respecto la prueba aportada en autos).
El 26 de julio de 2024, por oficio N° 651-2024-TAA del 26 de julio de 2024, el Tribunal Ambiental Administrativo le indicó a Franz Tattenbach Capra, Ministro de Ambiente y Energía, que no estaba conformado el Tribunal por falta de jueces, la situación respecto a los expediente y, nuevamente, solicitó la designación de un juez propietario y suplentes (véase al respecto el informe rendido por la Presidenta del Tribunal Ambiental Administrativo y la prueba que aporta).
De importancia para la resolución de este recurso, se estima como no demostrado el siguiente hecho de relevancia:
ÚNICO. Que el Consejo Nacional Ambiental haya designado a los jueces necesarios -propietario y suplentes- para conformar el Tribunal Ambiental Administrativo, a efectos que pueda continuar la tramitación del expediente [Valor 004] (véase al respecto el informe rendido por )
Esta Sala Constitucional, conoció un recurso de amparo anterior interpuesto por el recurrente contra el Tribunal Ambiental Administrativo y el Ministerio de Ambiente y Energía, expediente N° 22-014523-0007-CO. El recurso, se declaró con lugar el recurso, por Sentencia N° 2022-17133 de las 9:15 horas de 22 de julio de 2022, de conformidad con las siguientes consideraciones:
“V.- Sobre el caso concreto. En el sub lite, el recurrente alega que desde hace años junto a un grupo de vecinos, se interpuso ante el Tribunal Ambiental una denuncia ambiental por la presunta destrucción de un humedal, afectación de playa, biodiversidad y cause de agua contra el complejo hotelero RIU que se tramita bajo el expediente No. [Valor 004]. Acusa que, estando el proceso en la audiencia oral y pública, se ordenó suspender hasta tanto no fuera presentado un informe de valoración por parte del (SINAC) no obstante; estando cumplido lo pertinente por parte del (SINAC) el Tribunal Ambiental no ha resuelto el caso puesto a su conocimiento.
Del estudio de los autos, se tiene por comprobado que, desde el año 2012, el amparado figura como denunciante en el Expediente número [Valor 004], acusando presunta destrucción de un humedal, afectación de playa, biodiversidad y cause de agua contra el complejo hotelero RIU. Además que, mediante resolución administrativa número 1008-12-TAA del 31 de octubre del 2012, el Tribunal Ambiental determinó "suspender la presente audiencia de conciliación y se señala la continuación de la misma para el día miércoles veintiocho de noviembre del presente año, a las nueve horas...". Aunado a lo anterior que, mediante la resolución número 80-12-TAA del 20 de enero del 2012, se solicitó en el Considerando Tercero aclaración en cuanto al monto de la valoración; y es por oficio ACT-OR-DR-2017 del 15 de febrero 2012, suscrito por Nelson Marín Mora, Director Regional del Área Conservación Tempisque-SINAC, que el Tribunal Ambiental obtuvo respuesta.
Finalmente que, actualmente, el Expediente número [Valor 004], se encuentra en etapa de investigación, además se encuentra conformado por once tomos Tomo I (Folio 01-120), Tomo II (Folio 121-266), Tomo III (Folio 267-500), Tomo IV (501-769), Tomo V (770-1027), Tomo VI (1028-1253 ), Tomo VII (1254-1468), Tomo VIII (1469- 1710) Tomo IX (1711- 1962), Tomo X (1963-2140), Tomo XI (2141-2260) Desde este panorama, se estima violentado el derecho a la justicia pronta y cumplida. Sobre el particular, si bien es cierto el expediente revierte un grado de complejidad, no menos cierto resulta que esta Sala, mediante sentencia Número 2016-2168 de las 9:05 horas de 12 de febrero de 2016, indicó:
"En criterio de la Sala, la falta de impulso procesal por parte del Tribunal Ambiental Administrativo ha producido una dilación indebida o retardo injustificado que ha vulnerado el derecho fundamental a un procedimiento administrativo pronto y cumplido. El artículo 110, de la Ley Orgánica del Ambiente, consagra el principio de celeridad en el trámite de los procedimientos administrativos relacionados con denuncias ambientales, al establecer, en forma expresa, lo siguiente: "De oficio, el Tribunal Ambiental Administrativo deberá impulsar el procedimiento y el trámite de los asuntos de su competencia, con la rapidez requerida por la situación afectada. El fallo deberá dictarse en un término no mayor de treinta días; en casos especiales, el plazo podrá ampliarse hasta por treinta días más. Se establece la obligación de la administración de dar respuesta pronta y cumplida".
Al respecto, este Tribunal comprende que los casos ambientales pueden ser de naturaleza compleja y requerir de un contradictorio amplio; sin embargo, no puede estimar razonable que una denuncia presentada en el año 2012 todavía se encuentre en etapa de investigación, tal y como fue informado. Nótese que, en la actualidad, no se tiene ni siquiera un periodo de tiempo aproximado para el dictado de la resolución final de la denuncia, aspecto que resulta contrario al Derecho de la Constitución, máxime cuando la etapa de investigación preliminar ha durado tantos años.
En virtud de lo expuesto, la dilación observada en la tramitación de este procedimiento, deviene, sin lugar a dudas, en un quebranto al derecho fundamental a obtener un procedimiento administrativo pronto y cumplido, estatuido en el ordinal 41 de la Constitución Política”.
En la parte dispositiva se consignó la siguiente orden:
“Se declara con lugar el recurso. Se ordena a Ana María de Montserrat Gómez de la Fuente Quiñónez, en su condición de Vicepresidenta del Tribunal Ambiental Administrativo, o a quien ocupe ese cargo en su lugar, que dentro del plazo no mayor a UN MES -contado a partir de la notificación de esta sentencia y se cuente con toda la prueba requerida-, se resuelva de forma definitiva y sin dilaciones indebidas, la denuncia ambiental planteada por el tutelado y notifique lo resuelto. Se advierte que de no acatar la orden dicha, podría incurrir en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley la Jurisdicción Constitucional, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado”.
Posteriormente, ante una gestión de inejecución planteada por el recurrente el 18 de febrero de 2023, por Resolución N° 2023-32992 de las 9:15 horas de 20 de diciembre de 2023, se le reiteró a la Presidenta del Tribunal Ambiental Administrativo el cumplimiento inmediato de lo ordenado en la Sentencia N° 2022-017133 de las 9:15 horas de 22 de julio de 2022. Lo anterior, de conformidad con las siguientes consideraciones:
“II.- SOBRE LA GESTIÓN DE INEJECUCIÓN PLANTEADA. En la especie, el recurrente planea gestión de desobediencia en relación con la sentencia nro. 2022017133 de las 9:15 horas de 22 de julio de 2022.
Al respecto, es necesario aclarar que lo ordenado por la Sala fue que: “que dentro del plazo no mayor a UN MES -contado a partir de la notificación de esta sentencia y se cuente con toda la prueba requerida-, se resuelva de forma definitiva y sin dilaciones indebidas, la denuncia ambiental planteada por el tutelado y notifique lo resuelto”.
En este sentido, ante una prueba para mejor resolver, la autoridad aclara que el estado del expediente es el siguiente: “Que en fecha 30 de junio de 2023, se dio inicio la audiencia oral y pública seguida bajo el expediente administrativo No. [Valor 004], (ver acta de audiencia oral y pública visible a folios 2644 a 2645 del expediente administrativo). Durante la realización de la audiencia, las partes plantearon cuestiones previas; el Lic. Mauricio Castro Lizano en su condición de Procurador General de la República, solicitó el plazo de tres días de conformidad con lo establecido en el artículo 50 de la Ley 8508, para analizar la documentación presentada y presentar por escrito sus manifestaciones. (Ver minutos 1:21:47 a 1:30:27 al del audio 01 audiencia oral y pública). En dicha audiencia, el Tribunal resolvió, otorgar el plazo de tres días indicando:
“…Analizado el artículo 50 del Código Procesal Contencioso Administrativo, en efecto hay una concordancia para este Tribunal con la petición realizada por el Procurador Licenciado Mauricio Castro Lizano, y en razón de la anuencia de las demás partes en cuanto a conceder el plazo de tres días este Tribunal considera pertinente otorgarle a las partes el plazo de tres días para que se refieran a las documentaciones de excepción planteadas el día de hoy, y presenten sus observaciones de manera escrita ante el Tribunal…” (Ver Audio 2 0:12 segundos a 00:55 segundos de Audiencia Oral y Pública) Mediante Resolución No. 1391- 2023-TAA de las diez horas con diez minutos del día seis de octubre de dos mil veintitrés, visible a folios 2692 a 2706 del expediente administrativo, este Tribunal procedió a: “…PRIMERO: RECHAZAR POR EXTEMPORÁNEO el escrito presentado en fecha 28 de julio de 2023, por parte del Sr. Gad Amid Kaufman, en su condición de denunciante.
SEGUNDO: RECHAZAR LA SOLICITUD DE INTEGRACIÓN DE LITIS presentado por el Sr. Gad Amid, en su condición de denunciante TERCERO: RECHAZAR LA EXCEPCIÓN DE COSA JUZGADA presentada por el Lic. Fabián Volio Echeverría, en su condición de apoderado special administrativo de la empresa SF Costa Rica Hotelera de Guanacaste y el Lic. Roberto Echeverría, en su condición de apoderado general judicial de las empresas SF COSTA RICA HOTELERA DE GUANACASTE S.A., PRHORESA COSTA RICA S.A. y YITZAK INVESTMENTS S.A. CUARTO: RECHAZAR LOS INCIDENTES DE NULIDAD interpuesto por EL Lic. Cesar Reyes, representante de la Municipalidad de Carrillo y por el Lic. Roberto Echeverría, en su condición de apoderado general judicial de las empresas SF COSTA RICA HOTELERA DE GUANACASTE S.A., PRHORESA COSTA RICA S.A. y YITZAK INVESTMENTS S.A. QUINTO: Rechazar la solicitud de actualización de Valoración Económica del Daño Ambiental, solicitada por el Procurador Lic. Mauricio Castro Lizano.
SEXTO: Prevenir al Lic. Mauricio Lizano que aporte copia del Oficio 1418-12- DRG. SETIMO: Poner en conocimiento de las partes de la documentación presentada por el Sr. [Nombre 001], en su condición de denunciante, misma que consta a folios 2682 a 2684 del expediente administrativo, se pone en conocimiento de las partes, para que se refieran a la misma en la etapa de evacuación de prueba, correspondiente a la continuación de la audiencia oral y pública. OCTAVO: Mantener válida la resolución de imputación de cargos número 1473-2022-TAA de las 08 horas del día 02 de noviembre de 2022, se señala continuación de audiencia oral y pública para los días 17 de octubre de 2023, 18 de octubre de 2023 y 19 de octubre de 2023, a las 8:30 horas en las instalaciones del Tribunal Ambiental Administrativo, citándose a todas las partes indicadas en el Considerando Sétimo de la presente resolución…” Ver folios 2692 a 2706 del expediente administrativo.
Que consta a folios 2755 a 2759 consta escrito presentado en fecha 13 de octubre de 2023, suscrito por el Lic. César Reyes Carvajal, en su condición de Asesor Legal de la Municipalidad de Guanacaste (sic), mediante el cual interponer incidente de Nulidad. Que mediante Resolución No. 1425-2023-TAA de las catorce horas con once minutos del día trece de octubre de dos mil veintitrés, este Tribunal resuelve: “…PRIMERO: Rechazar el incidente de nulidad planteado por el Lic. César Reyes Carvajal, en su condición de Asesor Legal de la Municipalidad de Guanacaste (sic). SEGUNDO: Rechazar la petición del Sr. Roger Gutiérrez Vindas de ser excluido como testigo en el presente expediente. TERCERO: Rechazar la solicitud realizada Sr. Max Villalobos Solís, y se le indica que deberá presentarse los tres días indicados. CUARTO: Mantener válida la resolución de imputación de cargos número 1473-2022-TAA de las 08 horas del día 02 de noviembre de 2022, se señala continuación de audiencia oral y pública para los días 17 de octubre de 2023, 18 de octubre de 2023 y 19 de octubre de 2023, a las 8:30 horas en las instalaciones del Tribunal Ambiental Administrativo, citándose a todas las partes indicadas en el Considerando Sétimo de la presente resolución…” Ver folios 2760 a 2764 del expediente administrativo.
Que el día 16 de octubre de 2023, fue recibido mediante correo electrónico, en este Despacho la resolución de las catorce horas cincuenta y tres minutos del trece de octubre de dos mil veintitrés dictada por la Sala Constitucional. Ver folio 2811 a 2812 del expediente administrativo Que a folios 2813 a 2814 del expediente administrativo consta recurso de revocatoria interpuesto por el Lic. Fabian Volio Echeverría. Que mediante Resolución No. 1433-2023-TAA de las trece horas con quince minutos del día dieciséis de octubre de dos mil veintitrés, este Tribunal resuelve: “… PRIMERO: Rechazar la petición del Lic. Fabian Volio Echeverría por carecer de representación de la sociedad PRHORESA COSTA RICA S.A., cédula jurídica número 3-101-450627. SEGUNDO: Suspender la audiencia señalada para los días 17, 18 y 19 de octubre del 2023, por las razones indicada en el considerando único de la presente resolución, y reprogramar la celebración de la audiencia oral y pública para los días 24, 26 y 27 de octubre a las 08 horas 30 minutos en la sede de este Tribunal, manteniendo válida la resolución de imputación de cargos número 1473-2022 TAA de las 08 horas del día 02 de noviembre de 2022…” Ver folios 2824 a 2828 del expediente administrativo.
Que a folio 2878 a 2882 consta escrito presentado por el Sr. Gad Amid, en su condición de denunciante, mediante el cual solicita: “…me veo obligado a solicitar que se reprograme la realización de la audiencia del TAA del día 26 para la semana siguiente…” Ver folio 2881 del expediente. Que a folios 2886 a 2887 consta incidente de Nulidad presentado por el Lic. Roberto Echeverría Alfaro. Que mediante Resolución No. 1476-2023-TAA de las quince horas del dieciocho de octubre de 2023, este Tribunal resolvió: “…PRIMERO: Prevenir al Lic. Bernal Gamboa Mora, que presente copia del comprobante de la notificación realizada por el Tribunal Contencioso Administrativo, conforme el considerando primero de la presente resolución. SEGUNDO: Rechazar el incidente de nulidad planteado por el Lic. Roberto Echeverría Alfaro, en su condición de Apoderado General Judicial de las empresas PRHORESA COSTA RICA S.A., SF COSTA RICA HOTELERA DE GUANACASTE S.A. Y YITZAK INVESTMENTS S.A., conforme lo establecido en el considerando segundo de la presente resolución.
TERCERO: Se mantiene la celebración de la continuación de la audiencia oral y pública para los días 24, 26 y 27 de octubre del 2023, y se habilitan los días 30 y 31 de octubre y 1 de noviembre con inicio todos los días señalados a las 08 horas 30 minutos en la sede de este Tribunal, para una adecuada disposición de las declaraciones de los testigos indicados en la Resolución de Imputación de Cargos, manteniendo válida la resolución de imputación de cargos número 1473-2022-TAA de las 08 horas del día 02 de noviembre de 2022, conforme se indica en el considerando tercero de la presente resolución. CUARTO: En relación con el llamado de testigo al señor Nelson Marín Mora, el Tribunal se referirá sobre ello en la etapa de evacuación de prueba correspondiente en la continuación de la audiencia oral y pública…” (Ver folios 2893 a 2900 del expediente administrativo) Por lo anterior, se informa a la Honorable Sala Constitucional que este Tribunal ha procedido como en Derecho corresponde, y que la continuación de la audiencia oral y pública se mantiene para los días 24, 26 y 27 de octubre de 2023, además el Tribunal habilitó los días 30 y 31 de octubre y 1 de noviembre para la citada audiencia. En consideración de lo anterior solicito se tenga por rendido el informe en los siguientes términos”.
Ahora, si bien la parte recurrida explica el iter que ha seguido la tramitación de la denuncia del tutelado, no menos cierto es que a la fecha ha transcurrido 17 meses desde la notificación de la sentencia 2022017133 de las 9:15 horas de 22 de julio de 2022 a la parte recurrida -es decir, que el plazo originalmente otorgado ha sido excedido en casi 16 meses-, sin que a la fecha conste que se haya resuelto en forma definitiva la denuncia ambiental objeto de este recurso. Tal situación se traduce, a todas luces, en una evidente desobediencia a lo dispuesto por este Tribunal. De ahí que se acoja la gestión de desobediencia”.
En este caso, el recurrente acusa un nuevo extremo, no contemplado en la ejecución de la referida sentencia. En concreto, explica que en el Tribunal Ambiental Administrativo en la tramitación del expediente N° [Valor 004], no se ha podido continuar el avance del procedimiento -que está listo para sentencia- debido a que no se han designado jueces sustitutos en el Tribunal Ambiental Administrativo.
Respecto a los hechos acusados, se le concedió audiencia a la Presidenta del Tribunal Ambiental Administrativo, a la Ministra de la Presidencia -quien en representación del Presidente de la República ostenta la representación del Consejo Nacional Ambiental- y, además, al Ministro de Ambiente y Energía, quien ostenta la Secretaría Ejecutiva del referido Consejo.
La Presidenta del Tribunal Ambiental Administrativo, refiere que efectivamente, en el caso expuesto por el tutelado (expediente [Valor 004]), por resolución N° 397-2024-TAA de 10 de abril de 2024, el Tribunal Ambiental Administrativo suspendió los plazos, debido a la falta de miembros para conformar el Tribunal. Además, indica que el expediente está en etapa de valoración de la prueba, conclusiones y hechos para la emisión del acto final. Así, este caso, es diferente de otros tramitados ante este Sala Constitucional, por ejemplo, el expediente 24-010364-0007-CO citado por la Ministra de la Presidencia (sentencia N° 2024-18803 de las 9:30 horas de 5 de julio de 2024), el expediente está prácticamente listo para fallo y es la falta de conformación del órgano colegiado, lo que está provocando la violación del derecho a una justicia administrativa pronta.
Ahora bien, en cuanto a la conformación actual del Tribunal, se explica que están designados solo dos de los puestos de jueces propietarios: Adriana Bejarano Alfaro en su condición de Presidenta y Ana María de Monserrat Gómez de la Fuente Quiñones en calidad de Vice Presidenta. Además, según informa la Presidenta de ese Tribunal, la desintegración ocurrió desde el 19 de marzo de 2024, ya que el otro miembro, sea la señora Alexandra González Arguedas, sacó vacaciones desde esa fecha y hasta el 10 de abril de 2024 y, posteriormente, presentó su renuncia al puesto de juez propietario a partir del 11 de abril de 2024. En cuanto a los jueces suplentes, presentaron su renuncia según el siguiente orden: a) el 17 de noviembre de 2021, Maricela Rodríguez Porras, b) el 11 de enero de 2024 Elizabeth Araya Jiménez y, c) el 16 de enero de 2024, Carla Vanessa Agüero Zeledón.
En este punto, es necesario que explicar, que la Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es: que sean prestados con elevados estándares de calidad. Lo que tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Obligación que se acentúa tratándose de casos en los que está de por medio la tutela de la protección ambiental, derivado del artículo 50, de la Constitución Política. En cuanto a este extremo, es necesario señalar que la protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano.
En consecuencia, el Estado y, este caso en particular, el Consejo Nacional Ambiental, debió constituirse en garante en la protección y tutela del medio ambiente y los recursos naturales, por medio de la designación pronta de las personas idóneas, para que el Tribunal Ambiental Administrativo pueda ejecutar las labores que le han sido encomendadas. Nótese, que en cuanto a los jueces suplentes, hay una persona que renunció en noviembre de 2021 y, las otras, en enero de este año y, pese a ello, no realizaron la designación correspondiente. Así, al momento de que se interpone este recurso -30 de julio de 2024-, había trascurrido respecto a la primera de ellas, más de dos años y medio y, en el caso de las segundas, más de seis meses. Así, al no cumplir con esa obligación, en el momento en que la persona propietaria renunció en marzo de este año, no se pudo continuar conformando el Tribunal a efectos de dictar los actos finales de los procedimientos seguidos -entre ellos el [Valor 004], objeto de este recurso-.
Respecto a la dilación en tramitar esos nombramientos, el Ministro de Ambiente y Energía, quien ostenta la Secretaría Ejecutiva del referido Consejo Nacional Ambiental, reconoce que se han “…hecho esfuerzos por nombrar el juez titular y subsecuentemente los suplentes, sin embargo a la fecha, ninguno de los candidatos propuestos ha aceptado el cargo, por diversas razones, con o sin justificarse…”. Más adelante, refirió que se ha tratado de “…buscar una persona idónea para el cargo de Juez Titular y de Jueces Suplentes para que el funcionar del Tribunal siga adelante y nos ha sido materialmente imposible lograr esos nombramientos”. Incluso, expone que a “…la fecha no existe un acuerdo para el Nombramiento del juez o jueza titular y suplentes, siendo que le corresponderá al Consejo Nacional Ambiental, valorar los currículos, según los requisitos indicados en el ordinal 105 de la Ley Orgánica del Ambiente, Ley N°7554, con el fin de cumplir con lo establecido por la Ley”.
Por su parte, la Ministra de la Presidencia, refirió que “…la situación del Tribunal Ambiental Administrativo, que esta situación no fue puesta en conocimiento en mi condición de Presidente del Consejo Nacional Ambiental, que dicha ausencia de integración le fue comunicada al Ministro de Ambiente y Energía…” y, además, refiere que “se interpondrá nuestros buenos oficios para atender la situación en la que se encuentra el Tribunal Ambiental Administrativo ante la falta de jueces para la integración de este”.
Considera este Tribunal Constitucional, que con independencia de que existiera o no una comunicación respecto a la designación de miembros del Consejo, que en todo caso, afirma la Presidenta del Tribunal Ambiental Administrativo que sí se realizó (oficios N° 342-2024-TAA del 10 de abril de 2024, N° 375-2024-TAA del 23 de abril de 2024 y N° 651-2024-TAA del 26 de julio de 2024, dirigidos unos al Ministro de Ambiente y Energía y Secretario Ejecutivo del Consejo Nacional Ambiental y, otro, al Presidente de la República, con copia a la Ministra de la Presidencia), lo cierto, es que el artículo 104, de la Ley Orgánica del Ambiente, es claro en consignar la responsabilidad que ostenta el Consejo Nacional Ambiental en la designación de los miembros del Tribunal Ambiental Administrativo al señalar que éste último, estará“…integrado por tres miembros propietarios y tres suplentes, todos de nombramiento del Consejo Nacional Ambiental, por un periodo de seis años…”. Así, debe velar siempre, incluso de oficio, por la integración del Tribunal Ambiental Administrativo, a fin de que pueda realizar las funciones que le han sido encomendadas.
Así, si bien ha existido a lo largo de la tramitación del expediente objeto de este recurso [Valor 004], una mora administrativa que fue responsabilidad del Tribunal Ambiental Administrativo y que fue objeto del conocimiento de esta Sala Constitucional en el recurso de amparo 22-014523-0007-CO parcialmente citado líneas atrás, en lo que concierne a este recurso de amparo, es claro que la responsabilidad por la mora administrativa actual, es exclusiva del Consejo Nacional Ambiental. En consecuencia, corresponde estimar el recurso, según las consideraciones que se dirán en la parte dispositiva de esta sentencia.
Deberá tomar nota el Tribunal Ambiental Administrativo, que en cuanto se designen los miembros faltantes, deben proceder de inmediato a dar cumplimiento a lo ordenado por esta Sala Constitucional en la Sentencia N° 2022-17133 de las 9:15 horas de 22 de julio de 2022, que le fue reiterada por Resolución N° 2023-32992 de las 9:15 horas de 20 de diciembre de 2023.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Laura Fernández Delgado, en su condición de Ministra de la Presidencia y, en representación, del Presidente del Consejo Nacional Ambiental, o a quien ocupe ese cargo en su lugar, que dentro del plazo de DOS MESES -contado a partir de la notificación de esta sentencia-, se realicen todas las actuaciones, dentro del ámbito de sus competencias, a fin de designar a los miembros faltantes en el Tribunal Ambiental Administrativo. Se advierte que de no acatar la orden dicha, podría incurrir en el delito de desobediencia y que, de conformidad con el artículo 71, de la Ley la Jurisdicción Constitucional, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.- Fernando Castillo V.
