Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty-five on trece de setiembre de dos mil veinticuatro.
Amparo proceeding (recurso de amparo) being processed under expediente número 24-012859-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALIDAD DE PURISCAL, the COMISIÓN NACIONAL DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, and the MINISTERIO DE SALUD.
Findings of Fact:
“follow the due process (debido proceso) for a possible drainage-ditch construction project, which consists of submitting the request through the area’s Asociación de Desarrollo so that it may include it in its work plan and refer it to the Concejo de Distrito, which may assign it priority if deemed appropriate, subject to the respective approvals. You are therefore advised to appear before the Asociación de Desarrollo de San Juan to request that the project be considered… because the Municipalidad has no budget to carry out the project.” She specifies that, regarding the second report filed by the petitioner herein, dated 20 de setiembre de 2023, N° 2023-09-20-01953, the Comisión Municipal de Emergencias coordinated an on-site inspection, which was conducted by the municipal architect, who determined that: “it is recommended that the case be referred to the Unidad Técnica to provide a solution for stormwater management (manejo de aguas Pluviales) along the road.” She explains that, on 9 de octubre de 2023, report UT-EM-050-2023 from the Unidad Técnica was received, stating: “…it should be noted that this visit was conducted while it was raining in order to assess the amount of water flowing across the frontage in question.
The attached photographs show that there is insufficient surface area for such grading because a slope within the property prevents work from being performed with a motor grader, which could clear drainage ditches that are overgrown or do not exist so that they may be formed. Intervention with machinery in the aforementioned area is not recommended because, if an attempt is made to form drainage ditches or channels through which the water may flow, the property or dwelling would be seriously affected by dislodged soil, since it is practically embedded in the aforementioned slope, affecting the surface of the concrete slab, whose foundations would be compromised.” It acknowledges that, in 2023, the municipality informed the protected party that she was required to process the drainage-ditch (cuneta) project through the Asociación de Desarrollo Integral, as this was the proper procedure for including it in the following year’s budget.
Likewise, it was explained to the protected party in person that the Municipality operates under a budget and that, for that reason, the request must be submitted to the Asociación de Desarrollo so that it may present it to the expanded Concejo de Distrito, which then forwards the various projects to the Junta Vial, where they are ultimately discussed and approved before being submitted to the Concejo Municipal for inclusion in the following year’s budget. It adds that the foregoing is part of annual planning conducted through the Junta Vial, which is responsible for collecting the road-related projects of the various Asociaciones de Desarrollo in order to ensure participation and the proper distribution of public funds within the canton. It reiterates that incidents reported to 911 are handled by the Comisión Municipal de Emergencias and that, in the protected party’s case, the first report was made on 9 de noviembre de 2022, incident N° 2022-11-09-02109; the second report was made on 20 de setiembre de 2023, incident N° 2023-09-20-01953; and the third report was made on 10 de abril de 2024, through incident N° 2024-04-10- 1551.
All were handled by the Comisión Municipal de Emergencia and the Comisión Nacional de Emergencia, and interinstitutional coordination has been undertaken so that the appellant’s family may receive a housing subsidy, although this remains subject to the appellant’s willingness to comply with the instructions of COOPEPURISCAL R.L, Grupo Mutual, and Instituto Mixto de Ayuda Social. It states that, regarding the problem itself, the appellant fails to mention that the geologist’s report stated: “The best option is to retrofit the dwelling on the same property, but this situation requires assistance at the interinstitutional level because of the family’s circumstances.” It states that the problem affecting the appellant is due to improper management of the slope (talud), since, beginning in 2019, the Gestión Ambiental department (see report MP-AM-DU-GA-INF-014-2019, appearing at folio 0143 of the certified case file) addressed a complaint concerning earthworks (movimiento de tierra) on what is now the property of the appellant’s mother, which concluded that: “—Likewise, because of the proximity of the excavation, there may be a risk of affecting the public road connecting San Juan and Santiago in the areas closest to the roadway.” It clarifies that the structure does not have a building permit because it lies within the right-of-way (derecho de vía); see topographic survey UT-TP-038-2020, appearing at folio 0168 of the certified case file, which states: “that part of the constructed roof is indeed located within the area designated as a front setback…” The structure is located directly below the slope formed by the earth cut made in 2019.
Note that report MP-AM-CU-CC-0179-2024 from the construction department states: “The property remains subject to the closure notice because no construction permit of any kind could be granted without satisfying the road-alignment requirements and obtaining the MINAE report; moreover, no application by the property owners is on record. This department has issued no permit for earthworks or construction work on property 1-287982.” It specifies that report MPAM-UT-170-2024, issued by the Unidad Técnica de Gestión Vial Municipal, states: “4- According to the inspection report, photographs were taken and the principal observations arising from the visit were recorded, including: 4.1 A slope failure caused by water seepage (afloramiento de agua). 4.2 The presence of springs (nacientes) and significant bodies of water. 4.3 Construction of a dwelling at the toe of the slope, thereby reducing its stability. 6- It should be emphasized that, apparently, the cause of the damage reported by Ms.
Palacios is improper management of the slope cut when the dwelling was built. The dwelling adjoins a public road and lacks authorization and permits from the Local Government, and the resulting earthworks jeopardize the stability of the roadway surface. 7- There is an existing water diversion upstream from the lot, and therefore runoff toward Ms. Palacios’s property is minimal; that is, the channeling of water from the public road is not a direct cause of the slope failure. Consequently, the possible construction of a section of lined drainage ditches along the right side would not resolve either the water seepage or the slope-stability problem.” It specifies that, if drainage ditches are constructed or lined with concrete, or if an anchored retaining structure or any other stabilization work is undertaken, the appellant must relocate her dwelling, as recommended by the geologist, because the right-of-way must be recovered.
The following important points must be stated very specifically: “1. The house is built directly at the toe of the slope, and therefore a retaining wall could not be constructed without affecting the appellant’s dwelling, since the dwelling was placed directly within the right-of-way. 2. The land does not meet the minimum requirements necessary to provide the appellant with stability in the event of a disaster. Note that there is water seepage and there are springs, in addition to the fact that Quebrada San José runs along one side of the property; for that reason, efforts have been made to assist the family in obtaining a housing subsidy suited to its needs. 3. Construction of the drainage ditch is a mitigating measure, but natural conditions of the land—the slope cut made without technical specifications and the water seepage—suggest that the situation may continue.” It specifically states that the appellant was informed that funds would be budgeted in the 2025 budget to construct a drainage ditch at the site for channeling stormwater; however, the matter must first be processed through the Asociaciones de Desarrollo of the various communities, after which it goes to the Junta Vial and then receives approval from the Concejo.
This entire process takes place one year before a project of this type can be carried out. In the present case, because the Asociaciones de Desarrollo did not cooperate, the project will be processed for 2025 in order to provide a solution, although not a definitive one because, as stated, the water seepage and proximity to the creek make the land potentially unstable. What is untrue is that this municipality has done nothing during the three years since the first incident was reported, because technical personnel from various departments were coordinated, visited the site, and recommended action by institutions that have taken measures, including CNE, IMAS, COPEPURISCAL R.L, MUTUAL LA VIVIENDA, and Ministerio de Salud. It notes that, on 24 de noviembre de 2022, the Comisión Municipal de Emergencias sent official letter MP-AM CME-006- 2022 to COOPEPURISCAL R.L and that, on 14 de mayo de 2024, an official of COOPEPURISCAL R.L informed them by telephone: “Dayana was received at the Cooperativa, was provided with the information, and was told that the only thing she must pay for is a social worker, in the amount of ₡45 mil colones, in order to apply for a subsidy under Article 59… …It is a regular subsidy, with the difference being that the house has three bedrooms and costs approximately 9 million, and she could qualify for the 11 million subsidy for a dwelling of approximately 50 square meters.” It states that, on 17 de abril 2024, a response was received by email from Grupo Mutual de Puriscal, which stated: “Good morning, regarding this case, Dayana came to the office yesterday, was interviewed, and was given the possible options for processing a housing subsidy.
Those requirements must be met for her to qualify, whether on this same property or another qualifying property.” It adds that, despite this, according to those entities, the appellant has not processed the corresponding subsidy and has not complied with their requirements. It details that, on 8 de abril 2024, an email was sent to Ministerio de Salud forwarding official letter CME-Puriscal -OF-0009-2024 with the following request:
“The CME has duly followed up and has arranged interinstitutional collaboration as part of the recommendations issued by the CNE Geologist (which is attached for review). It states that the ground is unstable. Taking into consideration the emergency faced by Ms. Palacios, whose affected home is occupied by her and her daughters, the CME respectfully asks you to request an engineer from San José to inspect the home of [Nombre 001] and thereby determine whether it should be declared uninhabitable or what action is appropriate according to the criteria of the Ministerio de Salud.” It explains that the IMAS, in official letter IMAS-DDS-ARDSS-ULDSPUR-0144-2024, stated: “…Under institutional regulations, in order to grant a home-improvement benefit, the property must be registered in the name of the person requesting that benefit. In the case at issue, the real property is not registered in Ms.
Dayana’s name; therefore, an assessment for that benefit is not appropriate. As regards a housing subsidy, the institution does not offer that benefit as part of its programs. It is important to clarify that, as of this date, the family has been approved for the institutional benefit (basic needs)….” It concludes that: “1. The house is built directly at the foot of the slope (talud), meaning that a retaining wall (muro de contención) could not be built without affecting the appellant’s home, since the home was placed directly within the right-of-way (derecho de vía). 2. The land does not meet the minimum requirements to ensure stability for the appellant in the event of a disaster; it should be noted that there are water seepages and springs (nacientes), not to mention that Quebrada San José runs along one side of the property. 3. Construction of the drainage ditch (cuneta) is a palliative measure, but there are natural conditions of the land that would make it impossible to ensure that incidents cease to occur. 4.
Since 2022, the Comisión Municipal de Emergencias has coordinated with COOPEPURISCAL R.L to secure housing assistance for Ms. Palacios, requesting assistance through a housing subsidy, for which she must cover the cost of a social worker at the Mutual. They are awaiting her fulfillment of the requirements necessary for it to be granted; however, those are requirements that she must satisfy and it is beyond our ability to assist her with them, since coordination has already taken place with the institutions in order to provide her with solutions. 5. The Municipalidad and the CME informed her, through official letter CME-0007-2024, that it is planned to include these works in the 2025 ordinary budget. This is because the projects for 2024 had already been duly designated, not to mention that the Municipalidad is governed by the Public Budgets Law. This means that once a year (Article 100 et seq. of the Código Municipal), from July (Article 103 of the Código Municipal) through August (Article 104 of the Código Municipal), the Municipalidad budgets, through its annual operating plan, the investments, projects, expenditures, and other items that the local government will have for the following year.
Accordingly, the municipality could not carry out a project of this magnitude this year because no budget has been allocated for that purpose, since the Contraloría General de la República approved the funds and investments on which this Municipality would work before January 1, 2024. 6. Another important point to be taken into account when ruling on this amparo action (recurso de amparo) is that local governments include an entity known as the Junta Vial Cantonal (hereinafter, JVC). These entities originated under Law No. 8114, Article 5(b), with the creation of a single fuel tax allocated to the Municipalidades for the maintenance and preservation of the roads within their cantons. They are currently governed by Executive Decree No. 40138-MOPT; Article 9 states that it is an advisory body for planning and evaluation matters concerning road management within the canton and for proposing the allocation of the resources specified in Article 12 of Law No. 9329, which amended Article 5(b) of Law No. 8114, for the purpose of providing funding for the transfer of powers, in accordance with Article 170 and its transitional provision of the Constitución Política.
The regulation entrusts the JVC or district board with the use of municipal resources under the participatory public-works implementation model: ‘This model refers to the coordination and cooperation established among the municipal government, the Central Government, community organizations, and the civil society of a canton for the purpose of planning, carrying out, monitoring, and evaluating works of various kinds included within road preservation and construction, with the understanding that the use of resources does not entail their horizontal transfer from one organization to another.’ (See Article 8 of Decree No. 40138-MOPT). Thus, through the JVCs or district boards, municipal governments achieve a higher level of participatory road preservation; that is, when deciding which roads will receive investment, each Concejo Municipal takes into account the recommendation made by the JVC or district board, which consists of representatives from sectors or groups representative of the community that are always present in every canton.
Accordingly, a need originates with a group of residents, is channeled through the Asociación de Desarrollo, then through the Concejo de Distrito, and ultimately reaches the Junta Vial, which is responsible for seeking from the Concejo Municipal the annual prioritization of the routes on which work is to be performed. 7. Furthermore, it is my duty to point out to the distinguished Sala Constitucional that its functions consist of safeguarding the dignity, freedoms, and fundamental rights of persons enshrined in our Constitución Política and in international human-rights instruments. The Tribunal Contencioso Administrativo, for its part, plays a crucial role in ensuring legality and justice in relations between citizens and the public administration in Costa Rica, taking into account judicial review of legality, claims brought by citizens or companies against the administration, and prejudicial matters such as administrative litigation proceedings.
It is evident from a comprehensive reading of the amparo action filed by the appellant herein that what she seeks is for priority to be given to the drainage-ditch construction project—which is the mitigation measure specified in the CNE reports—using the Sala Constitucional as a safe-conduct to expedite a process that has its own inherent legal framework, since every action taken by the municipality complies with budgetary rules that cannot be disregarded. In ruling on this case, please take into account that this municipality has acted in accordance with the functions conferred by Article 10(c) of the Ley Nacional de Emergencias y Prevención del Riesgo, coordinating interinstitutional assistance and solutions for Ms. [Nombre 001]. Nevertheless, the drainage-ditch project on the side opposite her home requires an investment that must be planned and budgeted before it can be carried out. 8.
As to the appellant’s prayer for relief, she states: ‘I request drainage ditches and a retaining wall.’ However, it should be taken into account that the drainage ditches would be on the side opposite her home and are already included in our planning for 2025, in addition to what was stated by the Engineer of the Unidad técnica de Gestión Vial in report MP-AM-UT-170-2024 (items 4, 5, 6, 7). The drainage-ditch measure would not eliminate the danger faced by the occupants of the home. As to the retaining wall, it should be taken into account that the slope was undercut through the actions of the appellants herein and that Ms. Palacios’s house was built there without a municipal permit and was ordered closed; therefore, carrying out a project of this magnitude would require demolishing the appellant’s house in order to perform the work. Relocating the family is therefore unquestionably one of the most viable solutions; however, this requires action by Ms.
Dayanna before institutions unaffiliated with the municipality I represent. This Municipality and the CME have acted diligently within our legal framework and in accordance with our authority by providing the appellant with a prompt and complete response, as well as coordinating with public-law institutions in order to provide her with a solution. Moreover, she has already been informed that the drainage ditch recommended by the CNE would be constructed in 2025. Accordingly, no violation whatsoever of the fundamental rights alleged by the appellant has been established on the part of this Municipality or the CME.” It requests that the action be dismissed.
Concejo, all of Puriscal, or the Director of the Área Rectora de Salud Puriscal Turrubares, had submitted any brief or document for the purpose of providing the report requested of them.
Justice Salazar Alvarado writes the opinion; and,
Considering:
I.Subject matter of the action. The appellant states that she is a resident of Puriscal and that, since 2022, she has made reports to 911 concerning the instability of a slope located beside her house. The Comisión Nacional de Emergencias informed her that the problem was the lack of drainage ditches, which were to be constructed by the Municipalidad; however, that Corporation told her that it lacked jurisdiction and had no budget. She recounts that another landslide occurred this year and that the geologist from the Comisión de Emergencias reported that it was caused by the lack of drainage ditches. She notes that, in response, the Municipalidad explained that it would construct them in 2025 and further told her that, because of the danger, she had to vacate the property pursuant to the instructions of the Ministerio de Salud, even though the problem is caused by the lack of drainage ditches. She states that she lives with her mother and her minor daughters, one of whom has a disability, and that she has been denied assistance, including by the IMAS. She considers her right to prompt and effective justice to have been violated.
II.Preliminary matters. Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and full proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, beginning with Judgment Nº 2008-02545, issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), in order to conclude, by means of a final administrative act (acto final), an administrative proceeding initiated ex officio or at the request of a party, or to hear the applicable administrative appeals (recursos administrativos).
This case specifically presents an exceptional circumstance—supported by the majority of this Constitutional Court—because it concerns administrative applications alleging flooding problems originating in the stormwater drainage system (alcantarillado pluvial), which could place the lives and physical integrity of persons at risk. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this amparo proceeding (amparo).
Furthermore, according to a certificate added to the case file (expediente), the Head of the Unidad Técnica de Gestión Vial, the Head of the Comité Municipal de Emergencias, and the President of the Concejo, all of Puriscal, as well as the Director of the Área Rectora de Salud Puriscal Turrubares, have submitted a brief or document for the purpose of providing the report requested of them. Accordingly, pursuant to article 45 of the Ley de la Jurisdicción Constitucional, if the report required from the respondent party is not submitted within the period granted for that purpose, as occurred in this case, the facts shall be deemed true and the amparo proceeding shall be decided without further formalities. Nevertheless, that circumstance is not sufficient grounds for automatically granting the appeal, since the admissibility and merits of the appeal must be examined on the basis of the arguments presented and the other evidence entered into the record.
III.Proven facts. For purposes of deciding this matter, the following facts are deemed duly proven, either because they have been established as such or because the respondent failed to address them as ordered in the initial ruling:

The dwelling adjoins a public road and lacks authorization and permits from the Local Government; the earthworks therefore endanger the stability of the road surface. 7- There is a water cutoff uphill from the lot, so runoff toward Ms. Palacios’s property is minimal; that is, the channelling of water from the public road is not a direct cause of the slope collapse. Consequently, the possible construction of a section of lined drainage ditches along the right-hand side would not resolve either the water seepage or the slope-stability problem” (see report of the respondent authority and copy of the report).
V.Regarding the right to prompt and effective justice. Article 41 of the Political Constitution recognizes the right to justice, which must be provided in a timely and expeditious manner. The Administration is therefore obligated to ensure prompt and effective justice (justicia pronta y cumplida), meaning that persons subject to the Administration, in addition to having the right to resort to judicial bodies to resolve conflicts of interest among themselves and between themselves and the various administrative bodies, have the right to have administrative justice decide their claims diligently and expeditiously. It is also important to note that, by virtue of Article 48 of the Political Constitution, international provisions concerning the protection of human rights are incorporated into our legal system, including, notably, Article 8, first paragraph, of the American Convention on Human Rights, which requires the Administration to decide requests filed by persons subject to it within a reasonable time.
VI.Regarding the National Commission for Risk Prevention and Emergency Response. It should be noted that one of the State’s duties is to warn of risks that may affect its population. It must therefore undertake preventive measures to protect people’s lives and property from harm caused by a disaster. An emergency certainly cannot be avoided, but its effects can be mitigated, which requires preventive action by the Public Administration. Although the Administration cannot prevent a public calamity from occurring, it may be held responsible for failing to anticipate the consequences that the disaster could cause. In this regard, the National Emergency and Risk Prevention Law (Ley Nacional de Emergencias y Prevención del Riesgo), Ley N° 8488, governs the actions of the National Commission for Risk Prevention and Emergency Response and provides as follows in Article 14, subsection c):
“Article 14. The Commission’s ordinary prevention powers. The Commission shall be the governing entity for risk prevention and preparedness to respond to emergency situations. It shall exercise the following powers: (… )
(… ) c) Issue binding decisions regarding situations of risk, disaster, and imminent danger, based on technical and scientific criteria, intended to guide regulatory and oversight actions for their effective prevention and management, and requiring or providing for their effective implementation by State institutions, the private sector, and the general population. Officials of the bodies and entities responsible for executing or implementing such binding decisions may under no circumstances decline to apply them (… ).” As may be seen, the cited law grants the Commission the authority to issue binding administrative acts (actos administrativos) concerning situations of risk, disaster, and imminent danger, based on technical and scientific criteria. Under this provision, officials of the competent bodies and entities are obligated to execute or implement such decisions because they are binding and may under no circumstances decline to apply them.
This is because the Public Administration’s actions are governed by the principle of legality (principio de legalidad), and officials have a duty to comply with the legal system. In the case at hand (sublite), the Chamber found that, after the municipal authorities received reports that soil from a slope had collapsed onto the petitioner’s dwelling, they conducted on-site inspections and the geologist issued the relevant recommendations in reports CNE-UIAR-INF1311-2022, dated 18 de noviembre del 2022, and CNE-UIAR-INF-0459-2024, dated 12 de abril del 2024. It should be noted that these reports stated that the reported events had recurred since noviembre de 2022 because of the slope’s instability, that the cracking had increased, and that the competent authorities had not taken mitigation measures to minimize surface runoff toward the slope. Since that time, they had been advised to address the situation through interinstitutional action and provide a satisfactory solution, including reconfiguring the dwelling on the same property. Thus, it is the administrative entities concerned that have taken no action despite the warnings issued by the Risk Research and Analysis Unit of the National Commission.
Consequently, the National Commission has not violated the petitioner’s fundamental rights, because it was established that the competent professionals prepared the corresponding report containing the appropriate recommendations to prevent and avoid greater risks in the reported area.
It follows that the proper course is to deny the petition as it pertains to the respondent Commission.
VII.Regarding the Municipalidad de Puriscal. Article 169 of the Constitución Política establishes the duty of the country’s Municipalities to safeguard the interests of the inhabitants within their jurisdiction; accordingly, in repeated rulings, this Chamber has held that such corporations are obligated to eliminate any type of threat that endangers the rights to health and to a healthy and ecologically balanced environment of the persons living in their canton (see, to that effect, Judgments N° 2008-11739, at 12:12 on 25 July 2008, and N° 2011-003043, at 16:03 on 08 March 2011).
From a review of the record and the statement of proven facts, it has been established that, since November 2022, the Comité de Emergencia Municipal was aware of the landslide involving an earthen slope adjacent to the petitioner’s home, which damaged its walls. Consequently, the corresponding administrative actions were promptly undertaken to verify the situation, and the intervention of the Instituto Mixto de Ayuda Social was requested to provide some form of social assistance because of the damage sustained. In turn, once the report from the geologist of the Comisión Nacional was available, the respondent Corporation learned that protective works could not be performed on the slope because of the instability of the property, but that it was recommended that drainage be installed along the upper portion of the municipal road and that the dwelling be reconfigured within the same property.
In compliance with that recommendation, the respondent Corporation asked COOPEPURISCAL R.L to assess the protected party’s case for a housing subsidy or other social assistance and instructed the interested party to present the case to an Asociación de Desarrollo in order to begin the procedure for authorization of the budget appropriation needed to construct the drainage ditches. Under that procedure, the application would be submitted to the Concejo de Distrito, then to the Junta Vial, and would be discussed by the Concejo Municipal. Afterward, however, the record discloses no further activity in this regard, because the Corporation waited for the petitioner to approach the Asociación de Desarrollo to submit the application for funding to channel the water and to complete the procedure for obtaining a housing subsidy. It is noted that, on 31 May 2023, the Comisión Municipal de Emergencia sent the petitioner official letter CME-Puriscal-OF-0026-2023 by email, detailing the actions taken and reiterating the recommendations made, with which the record likewise does not show that the interested party complied.
Then, in September 2023, another report was received concerning the slope landslide toward the petitioner’s house. An inspection was promptly conducted, and it was found that there was insufficient surface area to build drainage ditches or perform clearing because, as the property was embedded in the slope, it would be affected by the work, as would the concrete slab of the street. On this occasion, the respondent authority issued no administrative act to remedy the reported situation, even on a provisional basis, and instead reiterated to the user that she had to submit the construction request to the Asociación de Desarrollo.
Subsequently, on 10 April 2024, another report was received from the protected party, again concerning soil falling from the slope because of the rains. The respondent authority addressed it promptly and once again confirmed the need to construct the drainage ditches to mitigate the problem and waterproof the runoff channel to rule out seepage. The report prepared on that occasion by the Comisión Nacional de Emergencia emphasized that soil could continue to fall during the rainy season and reiterated that the best option was to reconfigure the dwelling on the same property, although this situation would require interinstitutional assistance because of the family’s circumstances. Accordingly, the respondent Corporation again referred the protected party’s case to the Grupo Mutual de Puriscal for processing of the housing subsidy and to the Instituto Mixto de Ayuda Social, and consideration was given to including the drainage-ditch construction request in the 2025 budget.
The foregoing shows that the respondent authority has not disregarded the risk posed by the landslide of the earthen slope toward the protected party’s house. Nevertheless, the problem is that the dwelling was built without a municipal permit, stands directly at the foot of the slope, and there are water outcrops and springs (nacientes), which reduce the stability of the land. According to the technical opinion, neither a retaining wall could be built nor machinery brought through to channel the water without affecting the dwelling, because part of it is situated within the right-of-way (derecho de vía), meaning that it occupies an area of land owned by the State and specifically designated for use as a public road, with adjacent areas used for all related facilities and works, such as sidewalks and drainage ditches. Thus, the respondent Corporation faces the problem that the land does not meet the minimum requirements needed to ensure stability, and, according to the professionals, constructing a drainage ditch would be a palliative measure, while natural factors suggest that the situation could continue. Accordingly, whether the drainage ditches should be constructed or lined with concrete, an anchored retaining structure installed, or any other civil stabilization work performed is not a matter for this Chamber to decide, since these are technical issues.
Accordingly, the respondent authority is obligated to comply with the recommendations issued by the geologist of the Unidad de Investigación y Análisis del Riesgo de la Comisión, pursuant to Article 14 of the Ley Nacional de Emergencias y Prevención del Riesgo, Ley N° 8488. Although it has undertaken interinstitutional coordination to assist the petitioner, the fact remains that it has not carried out any specific civil works to prevent the collapse of the slope, even though two years have already elapsed, and it has yet to find a solution to the problem.
In this regard, this Court acknowledges that the respondent Municipalidad has informed the protected party of the follow-up undertaken in the case and provided her with copies of the case files opened in response to the complaints submitted. It has also sought interinstitutional cooperation as part of the recommendations issued by the CNE geologist and plans to include the construction of drainage ditches on the cantonal road in front of the dwelling in the 2025 budget. In addition, it is awaiting the hydrological studies to be conducted by MINAE to determine the underlying cause of the flow network in the area before any mitigation work is performed.
Despite the foregoing, the fact remains that construction of the drainage ditches has repeatedly been recommended as a means of mitigating the problem, yet those works are only now to be included in the 2025 budget. Consequently, no solution is apparent, even on a temporary basis, to address the petitioner’s complaint, and the problem remains unresolved, aggravated by the onset of the rainy season.
It follows that the respondent authority has infringed the right to prompt and effective justice (justicia pronta y cumplida), and the appropriate course is therefore to grant the petition with respect to this claim.
VIII.Regarding the Ministerio de Salud. As to this authority, the Chamber finds no infringement of any fundamental right of the protected party, since there is no evidence that she submitted any application that went unanswered. Notably, contrary to the petitioner’s assertion, the building has not to date been declared uninhabitable. It was in response to the request made by the respondent Municipalidad that, in May of this year, the health inspector visited the reported site and verified the vulnerability of the petitioner’s dwelling due to soil falling from the slope as a result of stormwater discharge caused by the absence of drainage from the public road. The inspector requested that the respondent Corporation obtain an assessment by a professional qualified to recommend the civil works needed to stabilize the slope. Accordingly, that authority has not infringed any fundamental right of the protected party, and the petition must be denied as to that entity.
IX.Note by Justice Castillo Víquez regarding prompt and effective administrative justice. I have supported this Court’s position that, when a litigant alleges an infringement of the right to prompt and effective justice in administrative proceedings, the legal dispute must be heard by the Tribunales de lo Contencioso-Administrativo, rather than by this Chamber. Nevertheless, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where petitioners believe that the material actions, administrative acts, or response of the Administration are affecting their fundamental rights.
In my view, the newly enacted legislation does not require this Court to alter its line of precedent, as, pursuant to section 7 of its Law, it has exclusive authority to determine its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional amparo guarantee proceeding, in all other cases—and for the reasons given by this Court (Judgment N° 2008-02545 at 8:55 on 22 February 2008)—jurisdiction lies with the Judges of the contentious-administrative jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.
As a matter of principle, I consider that cases involving the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure work should be dismissed because such an omission raises a question of legality, the resolution of which belongs to the ordinary courts, before which the interested person may address their objections more fully. However, when such administrative inaction results in an infringement of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits of the case, because such a situation constitutes an exception to my position on this matter. That is the situation here, where the complaint concerns the landslide of an earthen slope adjacent to the protected party’s dwelling, a situation that has been reported on several occasions without the problem having been resolved by the date on which the petition was filed. The situation described constitutes an exception to my general position on this matter, and I therefore consider it necessary for this Constitutional Court to examine the merits of the case in order to verify or reject the petitioner’s allegations.
Although I agree with the majority of the Chamber that the petition (recurso) should be granted, I disagree as to where the enforcement phase (fase de ejecución) of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical aspects, such as, in this case, providing a definitive solution to the alleged problem by carrying out the civil works necessary to minimize surface runoff (escorrentía superficial) toward the slope (talud) at issue in this petition and constructing any feasible mitigation works (construcciones de mitigación). By contrast, the provisions governing enforcement in the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, oversee stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Constitutional Jurisdiction Law (Ley de Jurisdicción Constitucional), I consider that the enforcement phase should be conducted before the Enforcement Division of the Administrative Litigation and Civil Court of the Treasury (Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda), under the judgment-enforcement rules of that Code.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computing, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of thirty business days, counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Full Court (Corte Plena) in Session N° 27-11, del 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin (Boletín Judicial) N° 19, del 26 de enero del 2012, as well as pursuant to the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in Session N° 43-12, celebrada el 3 de mayo del 2012, Article LXXXI.
Por tanto:
The petition is granted solely with respect to the Municipalidad de Puriscal. Iris Cristina Arroyo Herrera, in her capacity as Mayor of the Municipalidad de Puriscal, is ordered to take the appropriate measures, within the scope of her authority, so that, within six months following notification of this judgment, the civil works necessary to minimize surface runoff toward the slope are carried out, hydrological studies are obtained, together with any other studies necessary to reach an accurate diagnosis of the conditions of the earthen slope and the property of the protected party, and so that, within twelve months thereafter, any feasible mitigation works are constructed. The foregoing is ordered with the warning that, pursuant to Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), imprisonment for three months to two years, or a fine of twenty to sixty day-fines, shall be imposed on any person who receives an order issued in an amparo proceeding (recurso de amparo) that he or she is required to comply with or enforce and fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty.
As to the other respondent authorities, the petition is denied. The Municipalidad de Puriscal is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment in administrative litigation proceedings. Justice Castillo Víquez and Justice Salazar Alvarado each submit separate opinions. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Constitutional Jurisdiction Law, determines that enforcement must be conducted before the Enforcement Division of the Administrative Litigation and Civil Court of the Treasury, under the enforcement rules established in Article 155 et seq. of the Code of Administrative Litigation Procedure. She further orders that a copy of the judgment be forwarded to that Division so that proceedings to enforce this ruling may be initiated. - Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cinco minutos del trece de setiembre de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente número 24-012859-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE PURISCAL, la COMISIÓN NACIONAL DE RIESGOS Y ATENCIÓN DE EMERGENCIAS y el MINISTERIO DE SALUD.
Resultando:
“realizar el debido proceso para posible proyecto de construcción de cunetas el cual consiste en canalizar la solicitud ante la asociación de Desarrollo de la zona para que lo incluyan dentro del plan de trabajo elevándolo al Concejo de Distrito, para que de considerarlo lo asignen como prioridad, quedando sujeto a las aprobaciones respectivas. Por lo que se le recomienda que se presenten a la Asociación de Desarrollo de San Juan para solicitar que se tome en cuenta el proyecto… esto porque la Municipalidad no cuenta con presupuesto para la realización del proyecto”. Especifica, que con respecto al segundo reporte por parte de la aquí amparada con fecha de 20 de setiembre de 2023, N° 2023-09-20-01953, la Comisión Municipal de Emergencias coordinó inspección en sitio, la cual, fue atendida por el arquitecto municipal y determinó que: “se recomienda trasladar el caso a la Unidad Técnica para dar solución al manejo de aguas Pluviales en la carretera”.
Expone, que el 9 de octubre de 2023, se recibió el informe de la Unidad Técnica UT-EM-050-2023 que indica: “…cabe mencionar que esta visita se realizó mientras llovía para valorar la cantidad de agua que fluye a través de dicho frente, en donde con fotografías adjuntas se evidencia que no existe suficiente superficie para dicha conformación ya que un talud dentro de la propiedad impide la realización de trabajos con una moto niveladora máquina que podría realizar la limpieza de cunetas cubiertas con maleza o no existentes para su conformación. No se recomienda intervenir con maquinaria la zona mencionada ya que, si se tratan de conformar cunetas o canales para que fluya el agua, la propiedad o la vivienda se verían seriamente afectadas por la tierra desprendida ya que se encuentra prácticamente enclavada en el talud antes mencionado afectando la superficie de losa de concreto que se vería afectada en sus bases”.
Acepta, que en el año 2023, el municipio le indicó a la administrada, que debía gestionar ante la Asociación de Desarrollo Integral el proyecto de cunetas siendo el debido proceso para incluirlo en el presupuesto del año siguiente, en igual sentido se le explicó a la tutelada, de forma presencial, que la Municipalidad trabaja bajo presupuesto y que por eso se debe de realizar la solicitud ante la Asociación de Desarrollo para que lo presente al Concejo de Distrito ampliado y estos eleven los diferentes proyectos a la Junta Vial y por último sean discutidos y aprobados para ser remitidos al Concejo Municipal, para proceder a presupuestarlos para el año siguiente. Agrega, que lo anterior obedece a una planificación anual por medio de la Junta Vial, que es la encargada de recabar los proyectos de las diferentes Asociaciones de Desarrollo en materia vial, para garantizar una participación y una buena distribución de los fondos públicos dentro del cantón.
Recapitula, que los incidentes reportados ante el 911, son atendidos por la Comisión Municipal de Emergencias, y en el caso de la tutelada, el primer reporte fue el 9 de noviembre de 2022, incidente N° 2022-11-09-02109: el segundo reporte lo fue el 20 de setiembre de 2023, incidente N° 2023-09-20-01953, y el tercer reporte, el 10 de abril de 2024, mediante incidente N° 2024-04-10- 1551, todas atendidas por la Comisión Municipal de Emergencia y la Comisión Nacional de Emergencia, siendo que se ha realizado la coordinación interinstitucional con el fin de que la familia de la recurrente pueda ser beneficiada con un bono de vivienda, sin embargo esto queda sujeto a la anuencia de la recurrente en cumplir con las indicaciones de COOPEPURISCAL R.L, el Grupo Mutual y el Instituto Mixto de Ayuda Social. Relata que en cuanto al problema en sí, la recurrente omite indicar, que en el informe rendido por el geólogo se dijo que “La mejor opción es readecuar la vivienda en el mismo terreno, pero esta situación implica una ayuda a nivel interinstitucional, debido a las condiciones de la familia”.
Enuncia, que el problema que aqueja la recurrente se debe a un mal manejo del talud, ya que desde el año 2019, el departamento de Gestión Ambiental (véase el informe MP-AM-DU-GA-INF-014-2019 visible en folio 0143 del expediente certificado) atiende una denuncia por un movimiento de tierra en lo que es hoy la propiedad de la madre de la recurrente, en el que se concluyó que “- De igual forma por la cercanía del corte efectuado puede existir riesgo de afectar la vía pública que comunica a San Juan con Santiago, en los sectores más cercanos a la calzada”. Esclarece, que la construcción no cuenta con permiso de construcción, ya que esta se encuentra dentro del derecho de vía, véase el levantamiento topográfico UT-TP-038-2020 visible en el expediente certificado en folio 0168 donde se indica: “que parte del techo construido si se encuentra dentro del área destinada como antejardín…”, ubicado justo debajo del talud por el corte de tierra realizado en el año 2019.
Nótese en el informe del departamento de construcciones MP-AM-CU-CC-0179-2024, el cual indica: “La finca mantiene aún la alerta clausura, ya que sin los requisitos de alineamiento vial e informe del MINAE no se podría otorgar ningún tipo de licencia constructiva, pero tampoco se registra ninguna solicitud por parte de los propietarios de la finca. Este departamento no ha emitido ninguna licencia para movimiento de tierra, ni de obra constructiva en la finca 1-287982”. Precisa, que en el informe otorgado por la Unidad Técnica de Gestión Vial Municipal MPAM-UT-170-2024 se indica: “4- De acuerdo con el informe de inspección, se realizó levantamiento fotográfico y principales observaciones derivadas de la visita, entre ellas; 4.1 Existencia de desprendimiento de talud por causa de afloramiento de agua. 4.2 Presencia de nacientes y cuerpos de agua importantes. 4.3 Construcción de vivienda dentro del pie de talud, restando estabilidad al mismo 6- Cabe resaltar, que en apariencia; la causa de la afectación denunciada por la Sra. Palacios, se debe a un mal manejo al corte del talud al momento de realizar la vivienda misma que colinda con calle pública y que no cuenta con la autorización ni permisos del Gobierno Local, siendo que; producto de los movimientos de tierra pone en riesgo la estabilidad de la superficie de ruedo. 7- Existe un corte de agua anterior al lote por lo que la escorrentía hacia la propiedad de la Sra. Palacios es mínima, es decir; la canalización de las aguas de la vía pública no representa una causa directa al desprendimiento del talud, por lo que la posible construcción de un tramo de cunetas revestidas al margen derecho no representa la solución al afloramiento de agua ni a la problemática de estabilidad que presenta en el talud”.
Concreta, que si se construye o se revisten las cunetas con concreto o se realice una pantalla anclada o cualquier obra de estabilización la recurrente debe reubicar su casa de habitación como lo recomienda el geólogo, ya que se debe recuperar el derecho de vía, se deben tomar en cuenta los siguientes puntos importantes a mencionar de manera muy concreta: “1. La casa está construida justo al pie de talud, por lo que no se podría realizar un muro de contención sin afectarle la vivienda a la recurrente ya que se colocó la vivienda justo en el derecho de vía 2. El terreno no cumple con requerimientos mínimos para asegurarle una estabilidad ante un desastre a la recurrente, nótese que existen afloramientos de agua, nacientes, esto sin dejar de lado que por uno de los costados de la propiedad esta la Quebrada San José, razón por la que se ha tratado de colaborar con un bono de vivienda según las necesidades de la familia. 3.
La construcción de la cuneta es una medida paliativa, pero existen factores naturales del terreno (corte de talud sin especificaciones técnicas, afloramiento de agua) que hacen pensar que la situación podría continuar”.
Puntualiza, que se le indicó a la recurrente que para el presupuesto 2025, se presupuestará para realizar en el sitio cuneta para la canalización de aguas pluviales; sin embargo, primero se gestiona antes las Asociaciones de Desarrollo de las diferentes comunidades, esto va a junta vial y posterior a ello tiene aprobación de Concejo, todo esto pasa un año antes de que se pueda llevar a cabo una gestión de este tipo, y en el caso que nos ocupa ante la no colaboración de las Asociaciones de Desarrollo, se gestionará para el año 2025 y darle una solución aunque no definitiva como indicamos el afloramiento de agua y la cercanía a la quebrada lo hace un terreno potencialmente inestable), lo que no es cierto es que este municipio durante estos tres años no haya hecho nada desde el reporte del primer incidente, ya que se coordinó personal técnico de diferentes áreas quienes han realizado visitas al sitio recomendando acciones de instituciones las cuales han accionado como el CNE, el IMAS, COPEPURISCAL R.L, MUTUAL LA VIVIENDA, el Ministerio de Salud.
Advierte, que el 24 de noviembre de 2022, se envió por parte de la Comisión Municipal de Emergencias, el oficio MP-AM CME-006- 2022 a COOPEPURISCAL R.L y el 14 de mayo de 2024, la funcionaria de COOPEPURISCAL R.L les indicó a través de llamada telefónica: “Que recibieron en la Cooperativa a Dayana, se le dio la información y se le indicó que lo único que debe pagar es una trabajadora social por un monto de ₡45 mil colones para poder aplicar un bono basado en el Artículo 59… …Es un bono normal con diferencia, que la casa es de tres cuartos un aproximado de 9 millones y ella podría ser beneficiada para el de 11 millones con una vivienda de un aproximado de 50 metros cuadrados”. Expresa, que el 17 de abril 2024, se recibió respuesta vía correo electrónico por parte del Grupo Mutual de Puriscal, quien indicó: “Buenos días, Con respecto a este caso ayer se presentó la Dayana a la oficina y se le realizo la entrevista y se le dieron las posibles opciones para un trámite de bono, se deben cumplir con esos requisitos para que aplique, ya sea en esta misma propiedad o en otra que aplique.
Acota, que pese a ello, según lo dicho por dichos entes, la recurrente no ha gestionado el respectivo bono y no ha cumplido con lo que ellos le han requerido. Detalla, que 8 de abril 2024, se envió un correo electrónico al Ministerio de Salud donde se le trasladó el oficio CME-Puriscal -OF-0009-2024 con la siguiente solicitud:
“La CME le ha brindado el debido seguimiento y se ha gestionado la colaboración interinstitucional como parte de las recomendaciones emitidas por el Geólogo de la CNE (el cual se adjunta para su revisión). En el mismo se indica que existe inestabilidad del terreno Tomando en consideración la situación de emergencia que presenta la señora Palacios, donde la vivienda afectada se encuentra habitada por ella y sus hijas, la CME le pide, por favor, solicitar algún ingeniero de San José con el fin de revisar la vivienda de [Nombre 001], y, determinar así, si se debe declarar inhabitable o lo que procede de acuerdo con el criterio del Ministerio de Salud”. Dilucida, que el IMAS, en el oficio IMAS-DDS-ARDSS-ULDSPUR-0144-2024, indicó: “…Según normativa institucional, para otorgar un beneficio de mejoramiento de vivienda el inmueble debe estar a nombre de la persona que solicita dicho beneficio, el caso en referencia el bien inmueble no está a nombre de la señora Dayana por lo que no procede la valoración para dicho beneficio, en lo que respecta a bono de vivienda la institución no tiene ese beneficio en la oferta programática.
Es importante aclarar que a la fecha la familia tiene aprobado el beneficio institucional (necesidades básicas)…”. Concluye, que “1. La casa está construida justo al pie de talud, por lo que no se podría realizar un muro de contención sin afectarle la vivienda a la recurrente ya que se colocó la vivienda justo en el derecho de vía. 2. El terreno no cumple con requerimientos mínimos para asegurarle una estabilidad ante un desastre a la recurrente, nótese que existen afloramientos de agua, nacientes, esto sin dejar de lado que por uno de los costados de la propiedad esta la Quebrada San José. 3. La construcción de la cuneta es una medida paliativa, pero existen factores naturales del terreno que no asegurarían que se dejen de generar los incidentes. 4. Desde el año 2022, la Comisión Municipal de Emergencias coordino con COOPEPURISCAL R.L para la colaboración de la vivienda de la señora Palacios, solicitando colaboración con un bono de la vivienda, en la cual esta debe costear el pago de un (a) trabajadora Social.
En la Mutual, los cuales están a la espera de que esta cumpla con los requisitos para otorgarle uno, sin embargo, son requisitos que esta debe cumplir y se salen de nuestras manos en poder colaborarle ya que se ha coordinado con las instituciones para poder brindarle soluciones. 5. Que desde la Municipalidad y la CME, se lo indicó mediante oficio CME-0007-2024 se tiene planificado incluir estos trabajos en el presupuesto ordinario 2025. Esto por motivo que para el año 2024 ya los proyectos habían sido designados oportunamente, esto sin dejar de mencionar que la Municipalidad se rige por la Ley de Presupuestos públicos, esto quiere decir que una vez al año (artículo 100 y siguientes del Código Municipal), en los meses de julio (artículo 103 del Código Municipal) hasta agosto (artículo 104 del Código Municipal) la Municipalidad presupuesta por medio de su plan operativo anual, las inversiones, proyectos, gastos y demás que deberá tener el gobierno local el año entrante, por lo que un proyecto de gran magnitud no podría el municipio ejecutarlo este año debido a que no existe presupuesto asignado para este fin, ya que la Contraloría General de la República, aprobó el dinero y las inversiones en las que trabajara este Municipio desde antes del 1 de enero del 2024. 6.
Otro punto importante para que se tome en cuenta en la resolución de este recurso de amparo es que dentro de los gobiernos locales existe la figura de la Junta Vial Cantonal (en adelante JVC), estas nacen con la Ley n.° 8114, artículo 5, inciso b), con la creación de un impuesto único a los combustibles destinado a las Municipalidades para el mantenimiento y conservación de los caminos que tienen en sus cantones, actualmente, lo reglamenta el decreto ejecutivo n.° 40138-MOPT; el artículo 9, indica que es un órgano asesor en materia de planificación y evaluación en gestión vial en el cantón, y de proposición del destino de los recursos indicados en el artículo 12 de la Ley n.° 9329 que modificó el inciso b) del artículo 5 de la Ley n°. 8114; con la finalidad de darle contenido económico a la transferencia de competencias, de conformidad con lo que establecen el artículo 170 y su transitorio de la Constitución Política.
El reglamento encomienda a la JVC o distrital la ejecución de los recursos municipales bajo la modalidad participativa de ejecución de obras: “Dicha modalidad se refiere a la coordinación y cooperación que se establece entre la municipalidad, el Gobierno Central, las organizaciones comunales y la sociedad civil de un cantón, con la finalidad de planificar, ejecutar, controlar y evaluar obras de diversa índole, contempladas dentro de la conservación y construcción vial, en el entendido que la ejecución de recursos no implica el traslado horizontal de los mismos de una organización a otra.” (Véase el artículo 8 del decreto n.° 40138-MOPT). Entonces, por medio de las JVC o distritales las municipalidades alcanzan un mayor nivel de conservación vial participativa, es decir, que al momento de decidir en qué caminos se invertirán los recursos cada Concejo Municipal toma en cuenta la sugerencia que haga la JVC o distrital, las cuales están conformadas por representantes de sectores o grupos representativos de la comunidad que siempre existen en todo cantón, es por ello que una necesidad nace desde un grupo de vecinos, se canaliza por medio de la Asociación de Desarrollo, después de ello por medio del Concejo de Distrito hasta llegar a la Junta Vial que es la encargada de gestionar ante el Concejo Municipal la priorización de las rutas a intervenir año con año. 7.
Por otra parte, es mi deber hacerle ver a la excelentísima Sala Constitucional que sus funciones radican en garantizar la dignidad, las libertades y los derechos fundamentales de las personas consagrados en nuestra Constitución Política y en los instrumentos internacionales de derechos humanos. Por su parte el Tribunal Contencioso Administrativo desempeña un papel crucial en garantizar la legalidad y la justicia en las relaciones entre los ciudadanos y la administración pública en Costa Rica, tomando en cuenta el control de legalidad, demandas de los ciudadanos o empresas en contra de la administración y cuestiones perjudiciales como lo son procesos contenciosos administrativos. Evidentemente el recurso de amparo presentado por la aquí recurrente de la lectura integral del mismo indica lo que pretende es que se le dé prioridad al proyecto de construcción de cunetas (que es la medida de mitigación que indican los informes de la CNE), utilizando a la Sala Constitucional, como un salvo conducto para aligerar un proceso que tiene una legalidad intrínseca ya que todo lo actuado por el municipio obedece a normas de presupuesto, que son imposibles dar por alto, tome en cuenta para la resolución del presente caso que este municipio ha actuado conforme a las funciones otorgadas por la Ley Nacional de Emergencias y Prevención del Riesgo artículo 10 inciso c), coordinando a nivel interinstitucional ayudas y soluciones a la señora [Nombre 001] sin embargo el proyecto de cunetas al lado opuesto de su casa de habitación requiere de inversión, la cual debe de planificarse, presupuestarse, para su ejecución. 8.
En cuanto a la petitoria de la señora recurrente indica: “solicito cunetas, un muro de contención”, sin embargo, tómese en cuenta que las cunetas serian a lado opuesto de su vivienda y ya están dentro de nuestra planificación para el 2025 además de lo indicado por el Ingeniero de la Unidad técnica de Gestión Vial en su informe MP-AM-UT-170-2024 (punto 4, 5, 6, 7) siendo que la medida de cunetas no es algo que elimine el peligro que existe para las ocupantes de la vivienda y en cuento al Muro de contención tómese en cuenta que el talud se socavó por el accionar de los aquí recurrentes y fue ahí donde se asentó la casa de la señora Palacios, sin permiso municipal y clausurada, por lo que realizar una obra de esta magnitud implicaría derribar la casa de la recurrente para poderla llevar acabo. Por lo que indudablemente reubicar la familia es una de las soluciones más viables sin embargo ello requiere del accionar de doña Dayanna en instituciones ajenas al municipio que represento.
Este Municipio y la CME, ha realizado una labor diligente dentro de nuestro marco de legalidad y de acuerdo con nuestras competencias en cuanto a brindar respuesta pronta y cumplida a la recurrente, y además de coordinar con instituciones de derecho público con el objeto de darle una solución, sin dejar de lado que ya se le indicó a la señora que en el 2025 se realizaría la cuneta que recomendó la CNE, por lo que no se acredita de ninguna forma violación alguna a los derechos fundamentales alegados por la recurrente, de parte de este Municipio y desde la CME”. Solicita se declare sin lugar el recurso.
Concejo, todos de Puriscal, así como el Director del Área Rectora de Salud Puriscal Turrubares, hayan presentado escrito o documento alguno, a fin de rendir el informe que se les solicitó.
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La recurrente manifiesta, que es vecina de Puriscal, y que desde el año 2022, ha hecho reportes al 911, sobre la inestabilidad de un talud que se ubica al lado de su casa, por lo que la Comisión Nacional de Emergencias, le indicó que el problema estaba en la falta de cunetas, las que debían ser construidas por la Municipalidad; sin embargo, dicha Corporación se le ha dicho que no son competentes y que, no tienen presupuesto. Relata que para este año hubo otro deslizamiento, y el geólogo de la Comisión de Emergencias informó, que fue provocado por la falta de cunetas. Apunta, que, ante ello, la Municipalidad le explicó, que las harían en el año 2025, y además, se le dijo, que debía desalojar el inmueble, debido al peligro, según lo dispuesto por el Ministerio de Salud; pese a que el problema es ocasionado por la falta de cunetas. Señala, que ella vive con su madre y sus hijas, menores de edad, una discapacitada y, la ayuda se le ha denegado, incluso, de parte del IMAS. Considera lesionado su derecho a una justicia pronta y cumplida.
II.Cuestiones preliminares. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la Sentencia Nº 2008-02545, de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción -respaldado por la mayoría de este Tribunal Constitucional-, pues se está ante gestiones administrativas en las que se alegan problemas de inundaciones provenientes del alcantarillado pluvial, con lo cual se podrían poner en riesgo la vida e integridad físicas de personas. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
Por otra parte, según constancia agregada al expediente, el Jefe de la Unidad Técnica de Gestión Vial, el Jefe del Comité Municipal de Emergencias y el Presidente del Concejo, todos de Puriscal, así como el Director del Área Rectora de Salud Puriscal Turrubares, hayan presentado escrito o documento, a fin de rendir el informe que se les solicitó. De manera, que de conformidad con lo dispuesto en el artículo 45, de la Ley de la Jurisdicción Constitucional, si el informe requerido a la parte recurrida no es rendido dentro del plazo conferido a tal efecto, como sucedió en el presente caso, se tendrán por ciertos los hechos y se entrará a resolver el amparo sin más trámite. Sin embargo, dicha situación no es motivo suficiente para la estimatoria automática del recurso, toda vez que se debe entrar a estudiar la procedencia del recurso con base en los alegatos esgrimidos y demás elementos probatorios allegados a los autos.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
A.- En cuanto a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias:
V.Sobre el derecho a una justicia pronta y cumplida. El artículo 41, de la Constitución Política, reconoce el derecho a una justicia, mismo que debe otorgarse de forma oportuna y célere, por lo que la Administración tiene la obligación de garantizar el cumplimiento de justicia pronta y cumplida, lo que se traduce en que, los administrados, además de tener el derecho de acudir a los órganos jurisdiccionales para la solución de sus conflictos de interés entre sus pares, y entre los administrados y los diversos órganos administrativos, tienen el derecho a que la justicia administrativa decida con diligencia y celeridad los reclamos planteados por estos. Asimismo, es importante señalar que, en virtud del artículo 48, de la Constitución Política, se introducen en nuestro ordenamiento las disposiciones de carácter internacional en materia de protección de los derechos humanos, dentro de los cuales destaca el contenido del artículo 8, párrafo primero, de la Convención Americana sobre Derechos Humanos, norma que impone la obligación de que la administración resuelva las gestiones que presentan los administrados en un tiempo razonable.
VI.En cuanto a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias. Es menester indicar, que el Estado tiene entre sus misiones advertir riesgos que puedan afectar a su población. De manera que, debe ejercer una labor preventiva con el fin de evitar que la vida de las personas y bienes sufran por causa de un siniestro. Ciertamente, la emergencia no puede evitarse; pero sí pueden atenuarse sus efectos, para lo cual se requiere una labor de prevención por parte de la Administración Pública, que si bien no puede evitar que una calamidad pública se produzca, pero sí puede imputársele responsabilidad por no prever las consecuencias que ese siniestro pueda generar. Al respecto, la Ley Nacional de Emergencias y Prevención del Riesgo, Ley N° 8488, regula el accionar de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, y en su artículo 14 inciso c), establece:
“Artículo 14. Competencias ordinarias de prevención de la comisión. La Comisión será la entidad rectora en lo que se refiera a la prevención de riesgos y a los preparativos para atender situaciones de emergencia. Deberá cumplir las siguientes competencias: (… )
(… ) c) Dictar resoluciones vinculantes sobre situaciones de riesgo, desastre y peligro inminente, basadas en criterios técnicos y científicos, tendientes a orientar las acciones de regulación y control para su eficaz prevención y manejo, que regulen o dispongan su efectivo cumplimiento por parte de las instituciones del Estado, el sector privado y la población en general. Los funcionarios de los órganos y entes competentes para ejecutar o implementar tales resoluciones vinculantes, en ningún caso, podrán desaplicarlas (… )”.
Como puede apreciarse, la ley citada otorga a la Comisión la facultad de dictar actos administrativos vinculantes sobre situaciones de riesgo, desastre y peligro inminente, basadas en criterios técnicos y científicos. Según esta norma, los funcionarios de los órganos y entes competentes tienen la obligación de ejecutar o implementar tales resoluciones, ya que son vinculantes, siendo que en ningún caso, podrán desaplicarlas. Lo anterior por cuanto la Administración Pública rige su accionar por el principio de legalidad, siendo que los funcionarios tienen el deber de acatar lo dispuesto por el ordenamiento jurídico. En el sublite, la Sala tuvo por constatado, que una vez que las autoridades municipales recibieron los reportes por el desprendimiento de tierra de un talud sobre la vivienda de la recurrente, realizaron las inspecciones en el sitio y el geólogo rindió las recomendaciones al respecto, mediante los informes CNE-UIAR-INF1311-2022, del 18 de noviembre del 2022, y el CNE-UIAR-INF-0459-2024, del 12 de abril del 2024.
Nótese, que en los mismos se detalló, que existe una reincidencia de los eventos denunciados desde el mes de noviembre de 2022, debido a la inestabilidad del talud, siendo que el agrietamiento se ha incrementado, y las autoridades competentes no han tomado medidas de mitigamiento para minimizar a escorrentía superficial hacia el talud, siendo que desde entonces se aconsejó atender la situación de forma interinstitucional, y dar una solución satisfactoria, sea readecuando la vivienda en el mismo terreno. Así las cosas, han sido las entidades administrativas vinculadas que no han realizado acción alguna, pese a las advertencias de la Unidad de Investigación y Análisis del Riesgo de la Comisión Nacional.
En consecuencia, la Comisión Nacional no ha lesionado los derechos fundamentales de la recurrente, ya que se acreditó que los profesionales competentes elaboraron el informe respectivo con las recomendaciones del caso, para prevenir y evitar mayores riesgos en la zona denunciada.
Corolario de ello, lo procedente es declarar sin lugar el recurso en cuanto a la Comisión recurrida.
VII.En relación con la Municipalidad de Puriscal. El artículo 169, de la Constitución Política, dispone el deber de las Municipalidades del país de velar por los intereses de los habitantes de su jurisdicción, de ahí que, en reiterados pronunciamientos, esta Sala ha señalado que dichas corporaciones se encuentran en la obligación de eliminar cualquier tipo de amenaza que ponga en riesgo los derechos a la salud y a un medio ambiente sano y ecológicamente equilibrado de las personas que viven en su cantón (véanse en ese sentido las Sentencias N° 2008-11739, de las 12:12 horas del 25 de julio de 2008 y N° 2011-003043, de las 16:03 horas del 08 de marzo de 2011).
Del estudio de los autos, y a partir de la relación de hechos probados, se tiene por acreditado, que desde el mes de noviembre de 2022, el Comité de Emergencia Municipal tuvo conocimiento del deslizamiento de un talud de tierra ubicado contiguo a la vivienda de la recurrente, lo cual le afectó las paredes y debido a ello, se ejecutaron a la brevedad, los actos administrativos correspondientes para verificar la situación, siendo que se solicitó la intervención del Instituto Mixto de Ayuda Social para otorgar algún tipo de ayuda social debido a los daños sufrido. A su vez, una vez, que se contó con el informe del geólogo de la Comisión Nacional, la Corporación recurrida tuvo conocimiento que no se podían hacer obras de protección en el talud, dado la inestabilidad de la propiedad, pero que se recomendaba efectuar una canalización en la parte superior del camino municipal y a su vez, readecuar la vivienda dentro del mismo terreno.
En acatamiento a dicha recomendación, la Corporación recurrido solicitó COOPEPURISCAL R.L valorar el caso de la tutelada para un bono de la vivienda u otra ayuda social e instruyó a la interesada de exponer el caso ante una Asociación de Desarrollo para iniciar con el procedimiento para la autorización del contenido presupuestario para construir las cunetas, por lo que según el trámite, la gestión sería elevada al Concejo de Distrito, luego a la Junta Vial y ser discutiría en el Concejo Municipal. Sin embargo, posterior a ello, no se desprende ninguna actividad al respecto, dado que la Corporación se quedó a la espera a que la recurrente acudiera a la Asociación de Desarrollo a plantear la gestión para obtener el presupuesto para la canalización de las aguas y cumplir con el trámite para la obtención de un bono de vivienda. Se advierte, que el 31 de mayo de 2023, la Comisión Municipal de Emergencia le comunicó a la recurrente mediante correo electrónico el oficio CME-Puriscal-OF-0026-2023, el detalle de las actuaciones realizadas y le reiteró las recomendaciones hechas, lo cual tampoco consta que la interesada haya cumplido.
Luego, en setiembre de 2023, se recibió otro reporte por el deslizamiento del talud hacia la casa de la recurrente, a la prontitud, se realizó la inspección y se constató, que no existía suficiente superficie para la conformación de cunetas ni para la limpieza, ya que la propiedad al estar enclavada en el talud, se vería afectada con los trabajos, lo mismo que la losa de concreto de la calle. En esta ocasión, la autoridad recurrida no dictó ningún acto administrativo para solventar lo denunciado, ni tampoco de manera provisional siendo que le reiteró a la usuaria, que debía realizar la solicitud para la construcción ante la Asociación de Desarrollo.
Posteriormente, el 10 de abril de 2024, se recibió otro reporte por parte de la tutelada, nuevamente por desprendimiento de tierra del talud debido a las lluvias; y de manera célere, la autoridad recurrida lo atendió, y verificó, de nuevo, la necesidad de construir la cunetas para mitigar el problema e impermeabilizar la escorrentía para descartar la filtración; siendo que en el informe realizado por la Comisión Nacional de Emergencia, para la ocasión, se insistió que el desprendimiento podía continuar por la estación lluviosa y se reiteró que la mejor opción es readecuar la vivienda en el mismo terreno, pero esta situación implica una ayuda a nivel interinstitucional, debido a las condiciones de la familia. En razón de lo anterior, de nuevo, la Corporación recurrida remitió el caso de la tutelada al Grupo Mutual de Puriscal para el trámite del bono de vivienda, al Instituto Mixto de Ayuda Social y se consideró ingresar la gestión de la construcción de las cunetas para el presupuesto del año 2025.
De lo expuesto, se desprende que la autoridad recurrida no ha desatendido el riesgo que presenta el deslizamiento del talud de tierra hacia la casa de la tutelada; no obstante, el problema radica en que la vivienda fue construida sin permiso municipal, está edificada justo al pie de talud, existen afloramientos de agua, nacientes, lo que le resta estabilidad al terreno y según criterio técnico, no se podría realizar un muro de contención ni pasar la maquinaria para canalizar aguas, sin afectarla, ya que parte está colocada en el derecho de vía, es decir que ocupa una superficie de terreno, que es propiedad del Estado, destinada precisamente al uso de una vía pública, con zonas adyacentes utilizadas para todas las instalaciones y obras complementarias; tales como aceras, cunetas, etc. De manera, que la Corporación recurrida se encuentra con el problema que el terreno no cumple con requerimientos mínimos para asegurar una estabilidad, y según el dicho de los profesionales, la construcción de una cuneta es una medida paliativa, pero existen factores naturales, que hacen pensar que la situación podría continuar. Así las cosas, si se construye o se revisten las cunetas con concreto o se realiza una pantalla anclada o cualquier obra civil de estabilización, ello no corresponde ser dilucido por esta Sala, ya que se trata de asuntos técnicos.
Así las cosas, la autoridad recurrida se encuentra en la obligación de acatar las recomendaciones dadas por el geólogo de la Unidad de Investigación y Análisis del Riesgo de la Comisión, según lo dispuesto en el artículo 14, de la Ley Nacional de Emergencias y Prevención del Riesgo, Ley N° 8488; y si bien, ha efectuado las coordinaciones inter institucionales para ayudar a la recurrente; lo cierto es que no ha realizado alguna obra civil en concreto para evitar el derrumbe del talud, pese a que ya han transcurrido dos años, y aún no ha encontrado una solución al problema.
En ese sentido, este Tribunal reconoce que la Municipalidad recurrida ha comunicado el seguimiento del caso a la tutelada y le ha brindado copia de los expediente abiertos por las quejas planteadas, así como también ha gestionado la colaboración interinstitucional como parte de las recomendaciones emitidas por el geólogo de la CNE, así como también tiene contemplado incluir los trabajos de construcción de cunetas en la calle cantonal frente a la vivienda en el presupuesto de año 2025, aunado a que está a la espera de la que el MINAE realice los estudios de hidrología para determinar el origen de causa de la red de flujo en el sector, previo a cualquier obra de mitigación.
Pese a lo anterior, lo cierto es que reiteradamente, se ha recomendado la construcción de las cunetas para amortiguar, y apenas, dichas obras van a ser incluidas en el presupuesto del año 2025, por lo que no se vislumbra una solución, ni siquiera de manera temporal, para atender la denuncia de la recurrente, por lo que el problema continúa latente, con el agravante del inicio de la época lluviosa.
Corolario de ello, la autoridad recurrida ha lesionado el derecho a una justicia pronta y cumplida, y por ende, lo procedente es declarar con lugar el recurso, en cuanto a este extremo del recurso.
VIII.En cuanto al Ministerio de Salud. Sobre esta autoridad, la Sala no verifica que haya lesionado algún derecho fundamental a la amparada, toda vez, que no consta que haya presentado alguna gestión y que no haya sido atendida. Llama la atención, que contrario al dicho de la administrada, a la fecha no se ha declarado inhabitable la edificación, y fue con ocasión a la solicitud efectuada por la Municipalidad recurrida, que en el mes de mayo en curso , el inspector sanitario se apersonó al sitio denunciado y verificó el problema de vulnerabilidad de la vivienda de la recurrente por el desprendimiento de talud producto de descarga de aguas pluviales por la falta de no canalización desde la vía pública y requirió a la Corporación accionada la valoración por parte de un profesional que pueda recomendar las obras civiles necesarias para estabilizar el talud. Por ende, dicha autoridad no ha lesionado derecho fundamental alguno a la tutelada, y lo procedente es declarar sin lugar el recurso en cuanto a este ente.
IX.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en el cual, se reclama que el deslizamiento de un talud de tierra contiguo a la vivienda de la tutelada, situación que ha sido denunciada en varias ocasiones, sin que a la fecha de interposición del recurso se haya resuelto el problema. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analice por el fondo el asunto, con el fin de verificar o descartar los alegatos de la recurrente.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como lo es en este caso brindar una solución definitiva a la problemática alegada, ello mediante la realización de las obras civiles necesarias para minimizar a escorrentía superficial hacia el talud objeto de este recurso y las respectivas construcciones de mitigación que sean factibles. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso, únicamente en relación con la Municipalidad de Puriscal. Se ordena a Iris Cristina Arroyo Herrera, en su condición de Alcaldesa de la Municipalidad de Puriscal, tomar las medidas correspondientes y dentro del ámbito de sus competencias, para que, dentro del plazo de seis meses, posteriores a la notificación de esta sentencia, se realicen las obras civiles necesarias para minimizar a escorrentía superficial hacia el talud, se cuenten con los estudios hidrológicos, y cualesquiera otros que resulten necesarios para obtener un diagnóstico certero de las condiciones del talud de tierra y del terreno de la tutelada, para que, dentro del plazo de doce meses posterior a ello, se realicen las construcciones de mitigación, que sean factibles. Lo anterior, bajo la advertencia de que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
En cuanto a las demás autoridades recurridas, se declara sin lugar el recurso. Se condena a la Municipalidad de Puriscal al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez y Salazar Alvarado consignan notas, de manera separada. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. - Fernando Castillo V.
