Document Review Decision No. 2024024101 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on August twenty-third, two thousand twenty-four.
Proceeding on the application for amparo (recurso de amparo) processed under case number 24-020715-0007-CO, filed by [Nombre01 001], [Valor 001], [Nombre01 002], [Valor 002], AND [Nombre01 003], [Valor 003], on behalf of [Nombre01 004], against the MUNICIPALIDAD DE SAN JOSÉ, THE COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS—CNE—AND THE MINISTERIO DE SALUD.
Facts:
Pursuant to Articles 3, 8, 25, and 26 of that same law, all State institutions, particularly the Municipalities, are under a mandatory obligation to prevent disasters and, in particular, local governments must incorporate disaster prevention (prevención de desastres) as a component of urban-development projects, incorporating the concepts of risk and disaster into their programs, including such ordinary management measures as are appropriate and timely to prevent their occurrence, and promoting a culture aimed at reducing them. Likewise, all public institutions must coordinate their prevention programs and activities with the CNE, treating them as a public-policy process that must operate permanently and continuously, in accordance with the systemic approach and the National Risk Management Plan (Plan Nacional de Gestión del Riesgo). Article 27 additionally establishes the obligation to include, in the budgets of each public institution, an allocation of resources for disaster-risk control (control del riesgo de los desastres), treating prevention as a concept consistent with the development practices being promoted and carried out.
The importance of shared responsibility and local commitment by municipalities to risk management (gestión del riesgo) lies in the fact that emergencies and potential disasters may materialize within their territories; consequently, their response and, above all, prevention must form part of their day-to-day activities. Even “large” disasters affecting the national territory are, in reality, the sum of hazards and vulnerabilities occurring simultaneously, locally, and in a highly dynamic manner within municipal territory, as a result of the interconnectedness of physical, social, economic, and political relationships. IV. UNDECLARED OR FIRST-IMPACT EMERGENCIES. It should be noted that, as part of the extraordinary powers established by Ley N°8488, the CNE is authorized to respond to local and minor emergencies through the mechanism of “First Impacts” (Primeros Impactos), since the final paragraph of Article 15 provides: “(…) Except as provided in the preceding subsections, the Commission shall respond, without an emergency declaration by the Executive Branch, to local and minor emergencies which, because of the high frequency with which they occur and the serious harm they cause to communities, require the provision of first-impact humanitarian assistance (servicio humanitario de primer impacto), consisting of the delivery of blankets, food, and sleeping mats and, where necessary, the purchase of materials to restore basic services and open shelters, as well as the contracting of a maximum of one hundred machine-hours for cleaning the most severely affected area of the zone.
(Emphasis added) The final paragraph of Article 15 refers to first-impact humanitarian assistance. The Law uses the term “first impact” to refer to the initial stage of response to a declared emergency. Indeed, Article 30 of the Law, which divides such response into the response phase (fase de respuesta), the rehabilitation phase (fase de rehabilitación), and, finally, the reconstruction phase (fase de reconstrucción), establishes that the response phase begins immediately upon occurrence of the event. This phase includes urgent first-impact measures intended to safeguard life, vital public-service infrastructure, property, and the environment. It also includes mitigation works (obras de mitigación) intended to protect the population, infrastructure, and the environment. Article 4 defines response as actions taken immediately upon the occurrence of an emergency; they seek to bring a situation under control in order to safeguard structures and lives, prevent further damage, and stabilize the area of the region directly affected by the emergency.
Accordingly, without an emergency declaration (declaratoria de emergencia), the Commission may respond to local and minor emergencies, for which purpose the contracting of a maximum of 100 machine-hours is permitted to clean the affected area. Likewise, Article 30(a) of the same law establishes that the Response Phase, which is an operational phase beginning immediately upon occurrence of the event, includes urgent first-impact measures intended to safeguard life, vital public-service infrastructure, and the production of vital goods and services through warning, alarm, evacuation, and relocation measures, among others. In Opinion C-030-2016 of 15 de febrero de 2016, the Procuraduría General de la Republica stated the following regarding first impacts: (…) response to the aforementioned minor and local emergencies, as applicable, using the goods transferred by the CNE.” V. EMERGENCIES DECLARED BY EXECUTIVE DECREE.
With respect to the Emergency Regime (Régimen de Excepción), it arises from a Declaration of a State of Emergency (Declaratoria de Estado de Emergencia), which is issued by the Executive Branch, as provided in Article 29 of Ley N°8488. The Declaration of Emergency allows exceptional treatment notwithstanding budgetary constraints, pursuant to Article 180 of the Constitución Política, so that the Government may promptly obtain sufficient financial, material, or other resources to assist persons and address property and services affected or endangered (Art. 31 Ley N°8488), as required during the different stages of the emergency established in Article 30 of the aforementioned law. To apply the Emergency Regime, there must UNEQUIVOCALLY be a causal nexus (nexo de causalidad) between the event causing the state of necessity and urgency and the damage actually caused. In this regard, in Voto número 3410-92, reiterated in Voto número 1369-2001 of catorce horas treinta minutos del catorce de febrero del dos mil uno, the Sala Constitucional stated: “the existence of a causal nexus is required for CNE intervention between the event that occurred and the investment made, duly supported by an emergency decree issued by the Executive Branch and a General Emergency Plan (Plan General de Emergencias), understood as a definition of functions, responsibilities, and general procedures for institutional response and alerts […]” Once a State of Emergency has been declared, the emergency response is implemented through three phases, as established in Article 30 of the aforementioned law.
These consist of a response phase intended to apply urgent measures to protect life, vital public-service infrastructure, and the production of vital goods and services; a rehabilitation phase, involving stabilization of the affected region through actions aimed at temporarily restoring vital water, transportation, telecommunications, health, commercial, electricity, and other services; and, finally, a reconstruction phase intended to restore the normal operation of affected public services, including the reconstruction and replacement of damaged public and social-interest infrastructure, as well as the implementation of land-use regulation measures (medidas de regulación del uso suelo de la tierra) intended to prevent subsequent damage. Once the Executive Branch has issued the decree declaring the state of emergency, the Commission, through its Executive Directorate and in consultation with its Presidency, shall immediately convene the Institutions having jurisdiction, as well as any others it deems necessary because they fall within the area affected by the emergency, to prepare the General Emergency Plan, an instrument for planning and rationally, efficiently, and systematically channeling the actions to be carried out, the necessary oversight, and the allocation of the required resources.
For this purpose, within a maximum period of two months, the institutions convened must submit an official report on the damage sustained within their respective areas of jurisdiction, including an estimate of the costs and needs to be covered. This damage report must unequivocally establish a cause-and-effect relationship. The General Emergency Plan shall be prepared using the reports submitted and any other documentation verified by the Commission. The General Emergency Plan is the planning instrument that establishes the causal relationship between the event that occurred, the actions taken, and the investment made to address the emergency. It consists of a description of the causal event, an assessment of the damage, and an estimate of the resulting losses, broken down by canton and sector; it also includes a delineation of the actions to be carried out by each institution, including the Commission itself, as well as details of the investment required during each phase of the emergency response, from the response phase through reconstruction of the affected area.
It must also specify immediate action measures, the human and material resources required to address the event, medium-term action measures, such as those concerning the rehabilitation and reconstruction of the affected areas, and the elimination and prevention of the risk situations that caused the emergency. All institutions are required by this Law to provide the information and technical support necessary to prepare the General Emergency Plan. The drafting of this Plan, as well as the responsibilities associated with its subsequent implementation, shall take precedence over the ordinary duties of each individual institution for as long as the state of emergency remains in effect. To carry out the actions, works, and contracts, the Commission shall appoint as Executing Units (Unidades Ejecutoras) those public institutions having jurisdiction in the area where the actions are to be undertaken, provided that they possess a sufficient organizational structure to fulfill the commitments; both the Commission and the Executing Units shall be required to prepare investment plans setting out in detail the actions, works, and financial resources they will use to carry out their assigned responsibilities, which plans must be approved by the Commission’s Board of Directors.
The appointment of Executing Units allows emergency resources to be allocated, which entails the use and management of those resources in accordance with the applicable procedures. In this regard, it should be borne in mind that the second paragraph of Article 51 of the Law provides that the procurement of goods and services financed with resources from the Fund for declared-emergency response (Fondo para la atención de emergencias declaradas) shall be governed by the principles of the Ley de la Contratación Administrativa, the provisions of the Internal Regulations of the Institutional Procurement Office (Reglamento Interno de la Proveeduría institucional), and any specific provisions issued for such procurement. In Legal Opinion N° 044 - J of 20 de julio del 2012, the Procuraduría General de la República addressed the matter, stating: (…) VI. POWERS AND RESPONSIBILITIES OF LOCAL GOVERNMENTS FOR RISK PREVENTION THROUGH LAND-USE PLANNING (ORDENAMIENTO TERRITORIAL).
It is the duty of the municipal government, through planning and the exercise of police power (potestad de policía), to ensure that urban development complies with safety, public-health, and environmental-sustainability criteria. The foregoing is intended to safeguard citizens’ rights. As follows directly from Article 169 of the Constitución Política, the Código Municipal, the Ley de Planificación Urbana, the Ley de Construcciones, and related legislation, the municipalities bear absolute and exclusive responsibility for regulating the territory under their jurisdiction. This inescapable duty has been elaborated upon in various opinions of the Procuraduría General de la República, including C-093-2007 of 27 de marzo de 2007, C-020-2009 of 29 de enero de 2009, C-118-2009 of 4 de mayo de 2009, C-155-2009 of 01 de junio de 2009, C-091-2010 of 03 de mayo de 2010, and several others to the same effect.
The Sala Constitucional has affirmed this responsibility in decisions such as numbers 2153-93, 5305-93, 6706-93, 4205-96, 2000-431, 2000-06653, 2001-07485, 2002-01220, 2002-05996, 2002-07751, 2003-11397, 2004-1915, 2004-14404, 2004-01915, 2004-09439, 2005-04002 and 2005-07516, among many others. In this regard, jurist Eduardo Ortiz Ortiz, cited in Opinion C-032-98 of February 25, 1998, issued by the Procuraduría General de la República, stated: “Municipal authority to adopt urban development plans derives from the law, since it encompasses a matter constitutionally reserved to the law, but it also has a constitutional basis because it is a local matter. This means that the law may delegate that authority only to the Municipality and that a law providing otherwise and empowering, for example, the Executive Branch would be unconstitutional for violating municipal autonomy.” In addition, the Tribunal de lo Contencioso Administrativo y Civil de Hacienda has issued judgments consistent with the position of the Procuraduría General, such as decision N°128-2008 at 10:30 on March 7, 2008, N°209-2011, at 14:30 on June 16, 2011, and N°124-2011, at 09:50 on April 15, 2012, among many others, emphasizing the absolute responsibility of local governments for land-use planning (ordenamiento territorial).
Agreement N°0443 of November 30, 2011, of the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, adopted at Special Session No.10-11, held on Wednesday, November 09, 2011, and published in La Gaceta N°230 of November 30, 2011, entitled: “Recommends that mayors immediately proceed with the eviction of occupants from areas of recognized risk and imminent danger and demolish the buildings located therein,” concludes verbatim as follows: a. Recommend to all mayors in the country: i. That, pursuant to the duties and powers imposed on them by Articles 50 and 169 of the Constitución Política, the Código Municipal, the Ley de Planificación Urbana, the Ley de Construcciones, the Ley Orgánica del Ambiente, Article 33 of the Ley Forestal, and related regulations, the Ley General de Salud, and the extensive case law on the subject, they immediately proceed with the eviction of occupants from areas of recognized risk and imminent danger, as well as the demolition of the buildings located therein, and ensure that such areas are not reoccupied by human settlements, applying the procedural sequence cited in Considerando IV, drawn from decision Nº 12485-2010 of the Sala Constitucional. ii.
That, because of the binding nature conferred on them by the Sala Constitucional, they immediately implement the recommendations repeatedly provided to them over many years, and of which they are aware, by CNE technicians and academic institutions concerning concrete and timely actions to safeguard human life in areas of recognized risk and imminent danger. The studies and technical recommendations historically issued in each case shall be made available to the municipalities at the CNE offices. Internal Audit Offices and Municipal Councils shall ensure compliance with these provisions. Disobedience shall be deemed a breach of duties (incumplimiento de deberes) and shall be brought by the Internal Audit Offices to the attention of the appropriate authority. (…) d. Formally communicate this Agreement to all mayors and to the Defensoría de los Habitantes. e. Publish this Agreement and the country’s summary map of natural hazards (available on the website, Dirección02) in the official gazette and in a newspaper of nationwide circulation.
(Underlining not in the original) At this point, it must be recalled that, because the administration of the canton’s local interests and services falls within the authority of the Local Government under a constitutional mandate, and, in this particular case, the Municipality, as a state legal entity with its own assets and legal personality (Article 2 of Código Municipal N° 7794), has full legal capacity to carry out all types of acts and contracts necessary to fulfill its purposes. VII. REGARDING THE SPECIFIC CASE. a) The ordinary powers of the CNE under Ley N°8488 include the obligation to: (…) b) Regarding the Reports issued by the Unidad de Investigación y Análisis del Riesgo. Through Official Letter N° DPM-INF-0055-2012, dated September 04, 2012, the Unidad de Investigación y Análisis del Riesgo of the CNE issued a technical report concerning the appellant’s allegations. The relevant portion states as follows (the wording and spelling of the original are preserved): “…
VII. Conclusions and recommendations. • It is important that the Municipio de San José, Dirección de Hidrología, conduct a comprehensive assessment of the work performed in the area in order to prevent impacts on the surrounding areas and determine whether there are in fact any repercussions on the right bank, where riprap (enrocado) exists parallel to the property of Ms. [Nombre01 005], ID: [Valor 004], and, if necessary, analyze and propose corrective works. • Establish periodic monitoring of river behavior, particularly in the areas where work has been identified, so that improvements may be incorporated into the process. • The added value of this containment, re-excavation and sediment-cleaning work in the various sectors identified as being at greatest risk from lateral erosion or flooding along the Río María Aguilar reduces the impact but does not entirely eliminate the risk, since comprehensive intervention throughout the entire micro-watershed (microcuenca), together with the involvement of the other municipal stakeholders, is required to provide greater safety to the population exposed to flooding…” Through Official Letter N°CNE-UIAR-INF-0002-2021, dated February 2021, the Unidad de Investigación y Análisis del Riesgo of the CNE issued a technical report concerning the appellant’s allegations.
The relevant portion states as follows (the wording and spelling of the original are preserved): “… IV. General analysis of the hazard and vulnerability. A. The homes visited adjoin the right bank of the bank of the Río María Aguilar. B. River erosion has caused instability on the slope, as evidenced by the damage to the homes. C. A gabion wall (muro de gaviones) on a concrete structure can be seen on the left bank. Conclusions A. Erosion by the Río María Aguilar has placed the homes on the right bank at risk. B. If no erosion-protection work is performed, the land will continue to be undermined, causing damage to the structures on the right bank. Recommendations A. Protective work must be performed on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes. B. Works in a publicly owned watercourse (cauce) must have authorization from the Departamento de Aguas of MINAE; this institution must therefore be notified of the risk so that it may facilitate any necessary procedure.
C. Any work performed must have the corresponding studies and be supervised by a professional accredited by the colegio Federado de Ingenieros y Arquitectos de Costa Rica…” Through Official Letter N°CNE-UIAR-INF-0178-2023, dated March 2023, the Unidad de Investigación y Análisis del Riesgo of the CNE issued a technical report concerning the appellant’s allegations. The relevant portion states as follows (the wording and spelling of the original are preserved): “… IV. Background In January 2021, technical report CNE-UIAR-INF-0002-2021 was prepared, describing the risk faced by the homes of [Nombre01 006] due to erosion by the Río María Aguilar and recommending that protective work be performed on the right bank. V. General analysis of the hazard and vulnerability. A. No protective work has yet been performed on the right bank of the Río María Aguilar. B. River erosion has caused the homes to be currently located at the edge of the riverbank.
C. A gabion wall on a concrete structure can be seen on the left bank. VI. Conclusions A. The absence of protective work on the right bank has placed the structures at risk. B. During the next rainy season, the river’s erosive force will increase, intensifying the risk to the homes. VII. Recommendations A. Protective work must be performed on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes. B. In addition, the possibility of periodically dredging the channel before the rainy season should be assessed to increase hydraulic capacity and reduce the river’s erosive force. C. Works in a publicly owned watercourse must have authorization from the Departamento de Aguas of MINAE; this institution must therefore be notified of the risk so that it may facilitate any necessary procedure. D. Any work performed must have the corresponding studies and be supervised by a professional accredited by the colegio Federado de Ingenieros y Arquitectos de Costa Rica…” Article 25 of law 8488 states that it is the responsibility of the Costa Rican State to prevent disasters; accordingly, all institutions shall be required to take the concepts of risk and disaster into account in their programs and include the ordinary management measures appropriate and timely for them in order to prevent their occurrence, promoting a culture aimed at reducing them.
Agreement N°0443 of November 30, 2011, of the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, adopted at Special Session No.10-11, held on Wednesday, November 09, 2011, and published in La Gaceta N°230 of November 30, 2011, must likewise be borne in mind; it “Recommends that mayors immediately proceed with the eviction of occupants from areas of recognized risk and imminent danger and demolish the buildings located therein.” At this point, it must be recalled that, because the administration of the canton’s local interests and services falls within the authority of the Local Government under a constitutional mandate, and, in this particular case, the Municipality (…), as a state legal entity with its own assets and legal personality (Article 2 of Código Municipal N° 7794), has full legal capacity to carry out all types of acts and contracts necessary to fulfill its purposes.
In a different vein, within the budget and as part of the powers of local governments concerning risk prevention, pursuant to law N° 9907, of October twenty-seven, two thousand twenty, Article 46 bis was added to Ley 8488, addressing the use of the three percent that the municipal system had previously been required to transfer to the Commission. It is the duty of the municipal government, through planning and the exercise of police power (potestad de policía), to ensure that urban development complies with criteria of safety, public health, and environmental sustainability. The foregoing is intended to safeguard citizens’ rights. Arising directly from Article 169 of the Constitución Política, the Código Municipal, the Ley de Planificación Urbana, the Ley de Construcciones, and related regulations, municipalities bear absolute and exclusive responsibility for planning the territory under their jurisdiction.
For the foregoing reasons, it may be observed that this Commission has (sic) acted within the scope of its authority, and three technical reports concerning the location that is the subject of this action were issued by the CNE Risk Analysis Unit, together with the corresponding recommendations to the Municipalidad de San José regarding matters within its jurisdiction. In this regard, it is important to recall that, pursuant to the decisions issued by this Sala Constitucional concerning the technical opinions provided by specialized officials of the CNE and the Technical Advisory Committees (Comités Asesores Técnicos), the recommendations contained in this report are binding upon the institutions to which they are addressed (agreement 443-2011 of the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias). Furthermore, that agreement establishes a series of steps consistent with the country’s current laws and regulations concerning the rules and measures that municipalities must implement in the field of risk management (Gestión del Riesgo).
In conclusion, the CNE has acted proactively within our legal framework and in accordance with the guidelines of the Honorable Sala Constitucional by providing the petitioners with a prompt and complete response and by issuing recommendations, within the scope of our authority, to other government institutions and directly to the Municipal Corporation (Corporación Municipal). In other words, no violation whatsoever of the fundamental rights protections (tutelas fundamentales) alleged by the petitioner has been established. VIII. RELIEF REQUESTED (PRETENSIÓN). Por tanto, a response having been provided within the statutory period and in accordance with the foregoing, we request that this report be deemed duly submitted; that this amparo action (Recurso de Amparo) be dismissed as against this Commission, because the party I represent has not violated any constitutional right of the petitioner; that the case file be closed; and that the party I represent be released from constitutional liability. The foregoing is pursuant to Article 9 of the Ley de la Jurisdicción Constitucional.”

Whereas:
The petitioners, who reside in [Nombre01 004], state that, between 1994 and 1995, the Municipalidad de San José diverted the Ocloro River into the María Aguilar River, thereby increasing the water level and erosion on both banks of the latter river. They explain that, in the year 2011, the Municipalidad de San José built a retaining wall (muro de retención) on the river slope, beside the San Marino residential development, which left the opposite slope, namely [Nombre01 004], without protection, resulting in greater erosion and a rise in the water level; the water rebounded against that slope, and therefore, in the year 2007, the Municipalidad de San José built a partial gabion wall (muro de gaviones) behind the play area and Dirección01, but it did not cover the entire riverbank. They allege that the wall was not maintained and, in 2020, was swept away by the force of the flow. They state that, in the years 2012 and 2021, the CNE issued recommendations to the Municipalidad de San José concerning erosion caused by the María Aguilar River; however, the local government did not comply with them.
They assert that on 20 de junio de 2024, a request and a new CNE report entitled “RISK REASSESSMENT [Nombre 004]” were submitted to the local government of San José, stating: “VI. Conclusions... A. The lack of a protective structure on the right bank has placed the structures at risk. B. During the next rainy season, the erosive force of the river will increase, thereby intensifying the risk to the homes.” They clarify that a copy of the appointment request was sent to the Ministerio de Salud, Comisión Nacional de Emergencias, Defensoría de los Habitantes, Comisión Nacional de Riesgo y Atención de Emergencias Municipalidad de San José, and the Departamento de Aguas del MINAE. They explain that, by memorandum dated 10 de julio de 2024, in response to the request of 20 de junio de 2024, the mayor’s assistant served notice of report GPS-OMGRD-419-2024 prepared by officials of the Municipalidad de San José, which states: “2.-Regarding the request for a protective structure on the right bank to stabilize the slope and protect the homes exposed to risk, the municipal government is unable to invest public funds in private services or properties. 3.-Regarding the request to dredge the riverbed before the beginning of the rainy season, it is stated that this will be assessed by the River Network Maintenance and Construction Section to determine its appropriateness and technical and operational feasibility.” They allege that the municipality once again disregarded the CNE report and fails to appreciate the degree of danger facing the properties and the lives of the persons residing on the southern slope of the María Aguilar River.
They explain that, in mid-June 2024, officials from the Ministerio de Salud inspected the homes on the river slope located in [Nombre01 004] and issued technical reports and a sanitary evacuation order (orden sanitaria de desalojo) concerning house no. 28.
The following facts are deemed duly established and relevant to the decision in this matter:
“IV. Background of the area or sector involved The María Aguilar River channel drains part of the cantons of San José, Curridabat, and Tres Ríos and, according to the history of recent years, has caused serious problems along its course involving overflow, lateral erosion of its banks, destruction of retaining structures, and damage to private property.
At present, the María Aguilar River channel is clogged by a high accumulation of material (sediment, household garbage, and scrap metal). Consequently, because it lacks an adequate hydraulic cross-section (sección hidráulica), overflows and severe erosion occur due to its insufficient capacity to discharge peak flows properly, causing the water level to rise, which results in severe erosion of the banks or even causes its highly contaminated waters to overflow into neighboring communities. In most cases, this requires timely intervention to clean and dredge anthropogenic sediment, as well as the construction of short-term mitigation works (obras de mitigación) (…)
It is important for the Dirección de Hidrología of the Municipio de San José to conduct a comprehensive assessment of the work performed in the area to prevent impacts on the surrounding area and determine whether there are, in fact, any repercussions on the right bank, where riprap (enrocado) exists parallel to the property of Ms. [Nombre01 005], ID: [Valor 004], and, if necessary, to analyze and propose corrective works.
Periodic monitoring should be established regarding the behavior of the rivers, particularly in the identified work sectors, so that improvements may be incorporated into the process.
The added value of these retaining, re-excavation, and sediment-cleaning works in the various sectors identified as being at greatest risk from lateral erosion or flooding along the María Aguilar River reduces the impact but does not entirely eliminate the risk, because comprehensive intervention throughout the entire micro-watershed (microcuenca), as well as the involvement of the other municipal stakeholders, is required to provide greater safety to the population exposed to flooding.” (See documentary evidence).
“IV. General analysis of the hazard and vulnerability.
A. The homes visited adjoin the right bank of the María Aguilar River.
B. River erosion has caused instability of the slope, as evidenced by the damage to the homes.
C. A gabion wall built upon a concrete structure can be seen on the left bank (…)
A. Erosion caused by the María Aguilar River has placed the homes on the right bank at risk.
B. If no erosion-protection structure is built, the land will continue to be undermined, causing damage to the structures on the right bank.
A. A protective structure must be built on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes.
B. Works within a publicly owned watercourse (cauce de dominio público) must have a permit from the Departamento de Aguas del MINAE; therefore, this institution must be notified of the risk so that it may facilitate any necessary procedure.
C. Any work performed must have the corresponding studies and be carried out under the supervision of a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica.” (See documentary evidence).
“VI. Conclusions A. The lack of a protective structure on the right bank has placed the structures at risk.
B. During the next rainy season, the erosive force of the river will increase, thereby intensifying the risk to the homes.
Nombre03. A protective structure must be built on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes.
B. In addition, the possibility of periodically dredging the channel before the rainy season should be assessed in order to increase hydraulic capacity and reduce the river’s erosive force.
C. Works within a publicly owned watercourse must have a permit from the Departamento de Aguas del MINAE; therefore, this institution must be notified of the risk so that it may facilitate any necessary procedure.
D. Any work performed must have the corresponding studies and be carried out under the supervision of a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica.” (See documentary evidence).
“During an inspection conducted by this office on June 26, 2024, an active erosion process was observed on the right bank of the río MÁ1-ia Aguilar adjacent to the properties (…)
External conditions a) Direct discharge of rainwater from the roofs onto the slope (…)
“With regad (sic) to the erosion of the right bank of the río María Aguilar, there is no river-dynamics study indicating that this process is due to the construction of the existing wall on the left bank of the river.
As to the recommendations issued in the Technical Reports of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, CNE, which state that protective works must be undertaken on the slope of the right bank to stabilize it and protect the dwellings, such works do not fall within municipal jurisdiction, because this entity is unable to invest public funds in services or on private land.
Lastly, periodic dredging of the riverbed will be evaluated by this municipio, given that this project is deemed major construction work within a riverbed and requires the corresponding permit from the Dirección de Aguas del MINAE and the corresponding studies as a prerequisite for that permit.” (See documentary evidence).
REGARDING THE MINISTERIO DE SALUD:
“(…) It is very clear that the east bank of the Río María Aguilar, where it passes by the inspected dwellings, requires civil works capable of withstanding the friction and scouring caused by the river as it flows along the boundary with those dwellings. It can be seen how the river ‘eats away’ at the land serving as the setback (retiro) and boundary of the inspected dwellings; the friction between the river’s flow and the land forming part of the riverbank is undermining the stability of the foundations of the walls in the rear yards of the inspected dwellings.
Photo 1 shows civil works constructed across from the east boundary of the inspected dwellings. These works were constructed on the bank of the río María Aguilar and are located directly across from the east boundary of the inspected dwellings. Based on what was observed, these works have fully served their purpose of preventing the river’s flow from gradually ‘washing away’ the land through friction, thereby ensuring that the land serving as the setback between the riverbank and the adjoining dwellings remains in safe condition and, consequently, that the infrastructure is secure and shows no visually evident problems involving destabilization of the supporting soils on which it stands.
It is recommended that works similar to those described in the immediately preceding paragraph be constructed on the bank of the río María Aguilar where it passes by the three inspected dwellings.” (See documentary evidence).
In the case under review (sub examine), the claimant party, whose members reside in [Nombre01 004], states that, between 1994 and 1995, the Municipalidad de San José diverted the río Ocloro into the río María Aguilar, thereby increasing the water level and erosion on both banks of the latter river. They explain that, in 2011, the Municipalidad de San José constructed a retaining wall (muro de retención) on the river slope, alongside [Nombre01 004] San Marino, which left the opposite slope—that of [Nombre01 004]—unprotected, resulting in greater erosion and an increased water level, with the water rebounding against that slope. Accordingly, in 2007, the Municipalidad de San José constructed a partial gabion wall behind the play area and Dirección01, but it did not cover the entire riverbank. They allege that the wall was not maintained and was swept away by the force of the river’s flow in 2020.
They state that, in 2012 and 2021, the CNE issued recommendations to the Municipalidad de San José concerning erosion of the río María Aguilar; however, the local government did not comply with them. They assert that, on June 20, 2024, a request and a new CNE report entitled “RISK REASSESSMENT [Nombre 004]” were submitted to the local corporation of San José, stating: “VI. Conclusions... A. The lack of protective works on the right bank has placed the structures at risk. B. During the next rainy season, the erosive force of the no will increase, thereby intensifying the risk to the dwellings.” They clarify that copies of the cited request were sent to the Ministerio de Salud, the Comisión Nacional de Emergencias, Defensoría de los Habitantes, Comisión Nacional de Riesgo y Atención de Emergencias Municipalidad de San José, and the Departamento de Aguas del MINAE. They explain that, by written submission dated July 10, 2024, in response to the request of June 20, 2024, the mayor’s assistant notified them of report GPS-OMGRD-419-2024 prepared by officials of the Municipalidad de San José, which states: “2.-Regarding the request for protective works on the right bank to stabilize the slope and protect the dwellings exposed to risk, the municipal corporation is unable to invest public funds in services or on private land. 3.-Regarding the request to dredge the riverbed at the beginning of the rainy season, it is stated that this will be assessed by the Sección de Mantenimiento y Construcción de la Red Fluvial to determine its appropriateness and technical and operational feasibility.” They allege that the municipio once again disregarded the CNE report and fails to appreciate the degree of danger facing the properties and the lives of the persons residing on the southern slope of the Río María Aguilar.
They explain that, in mid-June 2024, officials from the Ministerio de Salud inspected the dwellings on the river slope located at [Nombre01 004] and issued technical reports and a health order requiring the evacuation of house no. 28.
This Court finds that, on February 21, 2012, CNE issued the “TECHNICAL REPORT: VULNERABILITY ANALYSIS IN THE VICINITY OF THE PROPERTY OF [Nombre 005] DPM-INF-0055-2012,” which is located on the right bank of the río María Aguilar and which stated: “IV. Background of the area or sector involved. The channel of the río María Aguilar drains part of the cantons of San José, Curridabat, and Tres Ríos and, according to records from recent years, has caused serious problems along its course involving overflows, lateral erosion of its banks, destruction of retaining structures, and damage to private property. At present, the channel of the río María Aguilar is clogged by a large accumulation of material (sediment, household waste, and scrap), and consequently, because it lacks an adequate hydraulic cross-section, overflows and severe erosion occur due to insufficient capacity to adequately discharge peak flows, causing the water level to rise, which results in severe erosion of the banks or even the overflow of its highly polluted waters into neighboring communities.
In most cases, timely intervention is required to clean and dredge anthropogenic sediment, as well as to construct short-term mitigation works (…) VII. Conclusions and recommendations. It is important that the Municipality of San José, Hydrology Directorate, comprehensively assess the work carried out in the area in order to prevent impacts on the surrounding area and determine whether there are indeed any repercussions on the right bank, where there is rock armoring (enrocado) parallel to the property of Ms. [Nombre01 005], ID No.: [Valor 004], and, if necessary, analyze and propose corrective works. Establish periodic monitoring of river behavior, particularly in the designated work sectors, so that improvements may be incorporated into the process. The added value of these retaining works, re-excavation, and sediment removal in the various sectors identified as being at the greatest risk from lateral erosion or flooding along the río María Aguilar reduces the impact but does not eliminate the risk entirely, since comprehensive intervention throughout the entire micro-watershed and by the other municipal stakeholders is required to provide greater safety to the population exposed to flooding.” In a filing (memorial) bearing the Municipality of San José’s receipt stamp dated October 8, 2012, the petitioner (accionante), [Nombre01 002], stated that the río María Aguilar overflowed at [Nombre01 004] park on September 30, 2012.
The petitioner further stated that this occurred because of erosion of the river’s right bank and the local government’s construction of a gabion wall (muro de gaviones) on the opposite side. The petitioner also mentioned that “the Municipality must take such measures as may be necessary to mitigate the vulnerability of the right bank of the Río María Aguilar by constructing gabion walls, welded-wire-mesh walls, or pursuing alternative measures.” In February 2021, CNE issued the “TECHNICAL REPORT: Risk Assessment of Homes in [Nombre01 004] Due to Instability of the río María Aguilar Riverbank,” which states: “IV. General analysis of the hazard and vulnerability. A. The homes visited border the right bank of the Río María Aguilar. B. River erosion has caused instability in the riverbank, as evidenced by the damage to the homes. C. A gabion wall on a concrete structure can be seen on the left bank (…) V. Conclusions.
A. Erosion from the río María Aguilar has placed the homes on the right bank at risk. B. If erosion-protection works are not carried out, the land will continue to be undermined, causing damage to structures on the right bank. VI. Recommendations. A. Protective works must be carried out on the right riverbank to prevent erosion and thereby ensure the stability and safety of the homes. B. Works within a publicly owned watercourse (cauce de dominio público) must have authorization from the Water Department of MINAE; that institution must therefore be notified of the risk so that it may facilitate any necessary procedures. C. Any work performed must be supported by the corresponding studies and supervised by a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica.” In March 2021, CNE issued the “TECHNICAL REPORT: Reassessment of the Risk to [Nombre01 004] from Erosion by the río María Aguilar,” which states: “VI.
Conclusions. A. The absence of protective works on the right bank has placed the structures at risk. B. During the next rainy season, the river’s erosive force will increase, intensifying the risk to the homes. VII. Recommendations. A. Protective works must be carried out on the right riverbank to prevent erosion and thereby ensure the stability and safety of the homes. B. In addition, the possibility of periodically dredging the channel before the rainy season should be evaluated in order to increase its hydraulic capacity and reduce the river’s erosive force. C. Works within a publicly owned watercourse must have authorization from the Water Department of MINAE; that institution must therefore be notified of the risk so that it may facilitate any necessary procedures. D. Any work performed must be supported by the corresponding studies and supervised by a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica.” In a filing dated May 4, 2021, the protected party (amparado), [Nombre01 001], reported to the Municipality of San José that the gabion wall built by that municipality on the right bank of the río María Aguilar had deteriorated, was not receiving adequate maintenance, and had collapsed in November 2020.
The protected party further stated: “The foregoing places both the children’s park and the Dirección03 at risk, because this riverbank is exposed to erosion, collapse of the land, and the resulting danger to the structures of the homes (…) It should be noted that directly opposite, on the river’s left bank (Urbanización San Marino de San Francisco de Dos Ríos), the Municipality constructed, in approximately 2012, a strong and solid gabion wall with four vertical tiers and a poured and anchored foundation, which has caused the water, through a rebound effect, to increase its flow and force along the right bank.” Finally, the protected party requested that, in accordance with report CNE-UIAR-INF-002-2021, the risk to which the homes were exposed be assessed and protective works be arranged to safeguard them. That request was considered by the Concejo Municipal de San José at session no. 53, held on May 11, 2021, and it was resolved to refer the matter to the mayor’s office.
In a filing bearing a Municipality of San José receipt date of July 6, 2022, the protected party, [Nombre01 001], reported that the gabion wall built by the local government on the right bank of the río María Aguilar had not been maintained and had therefore deteriorated; moreover, it had partially fallen into the channel in late 2020, placing the children’s park and several homes at risk. Accordingly, intervention was requested to remedy the situation in accordance with CNE’s recommendations. On June 20, 2024, the appellants (recurrentes), [Nombre01 002] and [Nombre01 001], submitted a filing to the Municipality of San José expressing the concern of [Nombre01 004], located on the right bank of the río María Aguilar, regarding erosion of that bank, and referring to requests made to that local government since 2012, including those made by CNE. They therefore requested “that we be provided with a response regarding the measures that the Municipality will take and whether it will comply with the recommendations issued by CNE in this latest report, since in recent days the river water dislodged the facing of houses numbered 27 and 28, as well as the entire gabion wall of house number 26, the latter having occurred in 2020, of which the Municipality was aware (…) Likewise, we request an inspection by the Municipality of San José as soon as possible so that it may assess the existing damage on the river’s right bank.
At the same time, we request a prompt response, since the situation is extremely dangerous and places the lives of its residents at risk due to the Municipality’s inaction, carelessness (sic), and negligence in failing to comply with the recommendations issued by CNE since 2012 and in subsequent years, thereby violating the constitutional principle of the right to life.” In filing GSP-OMGRD-419-2024 of July 4, 2024, the Oficina Municipal de Gestión de Riesgo a Desastre de la Municipalidad de San José stated: “During an inspection conducted by this office on June 26, 2024, an active erosion process was observed on the right bank of the río MÁ1-ia Aguilar adjoining the properties (…) External conditions: a) Direct discharge of rainwater from roofs onto the riverbank (…) b) Collapse of the sidewalk built behind the homes (…) c) Washing away of the riverbank’s fill material. d) Remnants of the gabion structure are evident in the vicinity of the municipal park and the property of Mr. [Nombre01 001]. e) Loss of vertical alignment of the boundary wall on the property of Mr. [Nombre01 002]. f) Exposure of the foundations of the adjoining boundary walls on both properties. g) Absence of the protection zone (zona de protección). h) Possible expansion of homes into no-build areas (…) 2.-Regarding the request for protective works on the right bank to stabilize the riverbank and protect the homes exposed to risk, the municipal corporation is unable to invest public funds in services or on private land. 3.-Regarding the request to dredge the channel before the start of the rainy season, this will be evaluated by the Sección de Mantenimiento y Construcción de la Red Fluvial to determine its technical and operational appropriateness and feasibility.” In filing MSJ-ALCALDIA-2364-2024 of July 10, 2024, the municipality of San José informed the petitioners: “In response to your official communication concerning the instability of the right bank of the Río María Aguilar in the [Nombre 004] sector, Distrito de Zapote, I hereby forward official communication number GPS-181-2024, signed by Ms.
Dahianna Marín Chacón, Gerente de Provisión de Servicios, who attached technical report No.GPS-OMGRD-419-2024, signed by Mr. Job Villareal Granados and Ms. Lorena Romero Vagas, Encargada de Oficina, both from the Oficina Municipal de Gestión de Riesgo a Desastres.” Lastly, in official communication SCMRP-370-2024 of August 6, 2024, the Sección de Construcción y Mantenimiento Red Pluvial de la Municipalidad de San José stated: “Regarding (sic) the erosion of the right bank of the río María Aguilar, there is no river-dynamics study indicating that this process is attributable to construction of the existing wall on the river’s left bank. As for the recommendations issued in the Technical Reports of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, CNE, which state that protective works must be carried out on the right riverbank to stabilize it and protect the homes, these do not fall within municipal jurisdiction, since this entity is unable to invest public funds in services or on private land.
Lastly, with respect to periodic dredging of the channel, it will be evaluated by this municipality, given that this project is classified as major works within a channel (obra mayor en cauce) and requires the corresponding permit from the MINAE Water Directorate and the corresponding studies as a prerequisite for the permit.” Before ruling as required by law, it is appropriate to note that this Chamber has previously ruled on the erosion of the banks of the María Aguilar River. Nombre04, in judgment No. 2020010630 at 9:15 a.m. on June 12, 2020, held:
“IV.- MUNICIPAL JURISDICTION AND DUTY OF INTERINSTITUTIONAL COORDINATION. Municipal jurisdiction and duty of interinstitutional coordination. Article 169 of the Political Constitution provides that: "The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...)". This provision has been developed by the ordinary legislature; accordingly, Article 3 of the Municipal Code, Law No. 7794 of April 30, 1998, provides that: "The governance and administration of cantonal interests and services shall be entrusted to the municipal government." The Constitutional Chamber has expressed the same view in its case law. Nombre04, in Judgment No. 5445-99 at 2:30 p.m. on July 14, 1999, held as follows:
"VI.- POWERS OF MUNICIPALITIES BASED ON SUBJECT MATTER (THE CONCEPT OF "LOCAL MATTERS"). By express constitutional provision—Article 169—functions or powers concerning "local matters" are assigned to local governments on the basis of subject matter, namely, "the administration of the services and interests" of the locality within their territorial jurisdiction, for which purpose they are granted autonomy (") Thus, their powers are general, insofar as there is no detailed enumeration of their specific responsibilities, but merely a statement of the scope of their jurisdiction; this does not, however, mean that such jurisdiction cannot be determined, as this Court stated in judgment number 6469-97 at four twenty p.m. on October eight, nineteen ninety-seven, in the following terms:
" (...) local matters have such significance that any definition of their scope by the legislature or the courts must preserve the integrity of local interests and services. Thus, not even the legislature could enact rules intended to dismember a Municipality (territorial element) without observing the procedures previously established in the Political Constitution; nor could it enact rules placing its inhabitants (population) at a clear disadvantage relative to the (sic) rest of the country; nor rules affecting the very essence of local matters (government), thereby turning the Corporation into a mere empty vessel that retains only its name while dismantling the entire system as conceived by the National Constituent Assembly. Put differently, certain responsibilities are, by their nature, municipal—local—and cannot be removed from that sphere of jurisdiction and converted into national services or interests, because doing so would dismantle the Municipality or, more precisely, strip it of its constitutional substance. Accordingly, the inviolable boundaries of local matters cannot be established in advance; instead, what does or does not fall within the authority of the communal government must be determined by examining each specific case (...)". The foregoing highlights the fact that, by the express will of our Fundamental Charter, a specific power is assigned to local governments, a power that is also exclusive to them; that is, it is an original power of the municipality and may be displaced, wholly or partially, only by a nationalization or regionalization law."
Consequently, if a group of residents of a municipality, within its territorial jurisdiction, experience flooding that endangers their lives and causes serious harm to their property, psychological well-being, quality of life, and general welfare, this falls within the concept of "local interests and services" under constitutional Article 169. The causes of such problems must be precisely identified and, even more importantly, solutions must be identified so that they may be implemented as soon as possible. To that end, the Municipality must coordinate with national-level institutions having jurisdiction to address the problem. Indeed, the Chamber has already developed the municipality’s duty to coordinate with other State institutions in order to address local "interests" and duly provide "local services." In the aforementioned Judgment No. 5445-99, the Chamber stated:
"(...) they concern the duty of coordination that must exist among local governments, decentralized institutions, and the Executive Branch in carrying out the functions entrusted to them, which must be analyzed in light of the very nature of municipal autonomy. By virtue of Article 170 of the Constitution, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in administering local interests and services (Article 169 of the Political Constitution) (...) There can therefore be no conflict arising from antagonism or competition between the subject matter comprising the general purpose of "local interests and services" and "national" or "State" public interests and services, which are intrinsically distinct from one another but are, in fact, intended to coexist (....) Once the municipality’s subject-matter jurisdiction within a given territorial district has been defined, it is clear that certain responsibilities will, by their nature, be exclusively municipal, alongside others that may be considered national or State responsibilities. It is therefore essential to define the inevitably shared exercise of powers, since the public authority of municipalities is local, while that of the State and other entities is national. It follows that municipal territory is simultaneously State and institutional territory, to the extent required by the circumstances. In other words, municipalities may share their powers with the Public Administration generally, a relationship that must operate under the terms defined by law (Article 5 of the former Municipal Code and Article 7 of the new Code), which establishes a duty of "coordination" between municipalities and the public institutions participating in the exercise of their respective powers, in order to avoid duplication of efforts and contradictions, particularly because only voluntary coordination is compatible with municipal autonomy, as an expression thereof. In other words, municipalities are called upon to enter into cooperative relationships with other public entities, and vice versa, given that, in many cases, their interests concerning a particular matter are concurrent or overlapping. Legal scholarship defines coordination based on the existence of several independent centers of action, each with its own responsibilities and decision-making powers, which may at times diverge. Nevertheless, there must be commonality of purpose with respect to the subject matter through concurrence, insofar as the object receiving the final results of the activities and acts of each is shared." Coordination therefore consists of ordering the relationships among these various independent activities, taking into account their concurrence with respect to the same object or entity, so as to make them useful to an overarching public plan without eliminating the mutual independence of the participating entities. Because neither decentralized institutions nor the State itself stand in a hierarchical relationship to municipalities, specific conduct cannot be imposed upon municipalities. This gives rise to the indispensable interinstitutional "concerted action," in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overarching framework, within which each performs a role in furtherance of a mission entrusted to the others."
It should also be noted that municipalities are required, by virtue of Article 50 of the Political Constitution, to devote themselves to environmental protection (Judgment No. 2006-7994 at 8:57 a.m. on June 2, 2006).
ACTIONS OF THE Municipalidad de San José AND THE RECOMMENDATIONS ISSUED BY THE Comisión Nacional de Emergencias TO THE Municipalidad de San José. In the case under review, the petitioner alleges that, since 2016, his property has been eroded by the río María Aguilar as a result of accumulations of garbage, sediment, and other materials obstructing the river’s normal channel (cauce), and that, as of the date this amparo action (recurso de amparo) was filed, the respondent authorities had not implemented the recommendations issued by the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) beginning in 2016—IAR-INF-0084-2016, dated 16 de febrero de 2016—. Having analyzed the evidence submitted, this Court finds that the fundamental rights of the protected party (amparado) were violated, at least by the respondent municipal government. The report submitted by the representatives of the Municipalidad de San José—which is deemed to have been given under oath, with the consequences, including criminal penalties, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that the protected party, [Nombre01 001], is a resident of San Francisco de Dos Ríos, San José.
His property has been eroded by the río María Aguilar as a result of accumulations of garbage, sediment, and other materials obstructing the normal channel. It is further established that, on 16 de febrero de 2016, at the protected party’s request, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias issued a technical assessment of the area’s degree of vulnerability and a series of recommendations to prevent further harm. It recommended: “Comprehensively perform channelization work, tree cutting, sediment and garbage removal, and mitigation works (obras de mitigación) in accordance with a comprehensive work plan, in order to prevent greater future harm to the communities adjacent to these rivers, all in compliance with current legislation and under the supervision of qualified professionals. Analyze, at the interinstitutional and intermunicipal levels, the problem of informal settlements located along the banks of these rivers, for the purpose of identifying alternatives for relocating the families living in these highly vulnerable locations to suitable and safer land.
Coordinate with each municipality (tres Ríos, Curridabat and San José) regarding the río María Aguilar in order to undertake comprehensive work, as part of its Operational Plan for prevention and mitigation measures, for the purpose of conducting an annual cleanup intervention at the most vulnerable sites, as well as responding to local emergencies during the rainy season and carrying out mitigation works along many sections of the channels. Establish periodic monitoring of the rivers’ behavior, particularly in the identified work areas, so that improvements may be incorporated into the process.” In addition, in octubre de 2019, at the protected party’s request, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias prepared a new technical report, CNE-UIAR-INF-0923-2019, which stated that, unless some protective work were undertaken at the site, the erosion could cause the property’s perimeter fence to collapse and could affect the remainder of the property in the future.
It recommended evaluating the possibility of constructing some type of structure to protect the river’s left bank and prevent further erosion. Lastly, it was determined that the problem caused by pollution of the channel or río María Aguilar by sediment (household garbage) and organic matter in the center of the channel, as well as erosion of the banks, particularly the left bank, must be addressed by the Municipality itself. For its part, through Official Letter No. ALCALDÍA-A2-00506-2020, the Municipalidad de San José informed the protected party: “…In response to your request that machinery and trained personnel be sent to dredge the river, I hereby forward the opinion issued by geographer Lorena Romero Vargas, Head of the Oficina Municipal de Gestión de Riesgo, and Engineer Marco Vinicio Corrales Xatruch, Manager of Provisión de Servicios, in which they address your request…” That official letter stated: “…In compliance with the current legal framework, the Municipalidad de San José does not carry out mitigation measures within the channel, except in emergency situations where CNE authorizes them or pursuant to an order from the Sala Cuarta…”.
It should be noted that, although the respondent municipal authority reports that the Gerencia de Provisión y Servicios and the Sección de Construcción y Mantenimiento de la Red Pluvial, and that the Municipalidad de San José, are working on all administrative, legal, and engineering aspects of the matter, it is nonetheless clear from the record that the problem persists and that, although the Comisión Nacional de Emergencias has issued recommendations since 2016, with the most recent technical report being No. CNE-UIAR-INF-0923-2019, dated octubre de 2019, the Municipality has still not definitively resolved the problem, even (sic) though it is aware of the extensively (sic) reported pollution of the river. In this regard, this Constitutional Court was able to verify the existence of the problem reported by the claimant, which is known to the respondent municipality and directly affects the petitioner, and for which no solution had been provided as of the date this action was filed; this constitutes a violation of the protected party’s fundamental rights.
Additionally, this Constitutional Court has repeatedly recognized and confirmed that the Commission’s authority to conduct the relevant inspections and issue the corresponding recommendations to the respondent Municipality is binding (see, to that effect, judgments No. 12818-2009 at 15:32 on 18 de agosto de 2009 and No. 16389-2010 at 9:17 on 1 de octubre de 2010). Nevertheless, despite the foregoing, no solution has yet been implemented, nor has any information been provided regarding provisional or urgent measures intended to prevent or mitigate the effects of the pollution caused by the Río María Aguilar. This is particularly so in view of the specific authority conferred upon local governments by Article 169 of the Constitución Política, which provides: “The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...).” Accordingly, the alleged violation of the protected party’s fundamental rights is established, and the proper course is to grant the action, subject to the order set forth in the operative portion (parte dispositiva) of this judgment.
THE ACTIONS OF THE MINISTERIO DE AMBIENTE Y ENERGIA. The report submitted by the representatives of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal penalties, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that, on 1° de abril de 2020, the protected party filed a complaint with the Ministerio de Ambiente y Energía concerning the filling operations being carried out on the adjoining property and their possible impact on the protection zone (zona de protección) of the río María Aguilar in the Zapote area. It is further established that, as of the date the amparo action was filed, the Dirección de Agua of the Ministerio de Ambiente y Energía had received no application from the Municipalidad de San José for a permit to perform work within the channel, whether for cleaning, rearrangement, excavation, or reinforcement of the banks—as stated by the petitioner—. Lastly, on 22 de mayo de 2020, the Ministro de Ambiente y Energía was notified of the decision issued at 09:47 on 20 de mayo de 2020, whereby the parties to this action were expanded to include him and he was given an opportunity to respond.
Accordingly, with respect to the actions of the Ministerio de Ambiente y Energía, the amparo action must be dismissed, because it was not until 1° de abril de 2020 that the petitioner submitted to the respondent Ministry the complaint concerning the situation he alleges and for which he sought protection of his rights on 03 de abril de 2020. In this regard, it was established that, as of the date this amparo action was brought—namely, 03 de abril de 2020—the respondent authority was still within the time limit for deciding that complaint and notifying the protected party of the result, pursuant to Article 261 of the Ley General de la Administración Pública, which provides, in general terms, a period of two months for that purpose (it should be noted that the complaint was filed on 1 de abril de 2020). Consequently, this action is premature. In view of the foregoing, the action must be denied with respect to this issue, as is hereby ordered (…).
Por tanto: The appeal for constitutional protection (recurso de amparo) is hereby partially granted solely with respect to the Municipalidad de San José and its failure to comply with the recommendations issued by the Comisión Nacional de Emergencias to resolve the existing problem involving pollution, the overflowing of the río María Aguilar, and its consequences—see IAR-INF-0084-2016, dated 16 de febrero de 2016, recommending: “Comprehensively carry out channelization works (trabajos de canalización), tree cutting, removal of sediment and garbage, and mitigation works (obras de mitigación) in accordance with a comprehensive work plan, for the purpose of preventing greater future impacts on the communities neighboring these rivers, all in compliance with current legislation and under the supervision of qualified professionals. Analyze, at the interinstitutional and intermunicipal levels, the problem of informal settlements located along the banks of these rivers, for the purpose of seeking alternatives to relocate the families living in these highly vulnerable locations to suitable and safer land.
Coordinate with each municipality (tres Ríos, Curridabat and San José), with respect to the río María Aguilar, to undertake comprehensive work under its Operational Plan of prevention and mitigation measures, for the purpose of carrying out an annual cleanup intervention at the most vulnerable sites, as well as in the event of local emergencies during the rainy season, in addition to mitigation works along many sections of the river channels. Establish periodic monitoring of the rivers’ behavior, particularly in the designated work areas, so that improvements may be incorporated into the process.” Likewise, with respect to technical report CNE-UIAR-INF-0923-2019—to assess the possibility of erecting some type of structure to protect the left bank (margen izquierdo) of the river and prevent further erosion—such assessment shall be conducted and it shall be determined whether or not it is appropriate.
Jhonny Araya Monge, in his capacity as Mayor (Alcalde) of the Municipalidad de San José, or whoever holds that office in his stead, is ordered, within the scope of his authority, to adopt the appropriate measures so that, within a maximum period of SIX MONTHS from notification of this decision, he carries out the necessary interinstitutional coordination and a definitive solution is provided to the reported problem affecting the appellant. The foregoing is ordered with the warning that he could incur the offense defined in Article 71 of the Ley de la Jurisdicción Constitucional, which provides that any person who receives an order issued in an appeal for constitutional protection that the person is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de San José is ordered to pay the legal costs, damages, and losses caused by the facts forming the basis of this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). In all other respects, the appeal is denied. Justice Salazar Alvarado adds a note. Let notice be given.” Now, in the sub iudice matter, the Chamber finds a violation of the protected party’s fundamental rights due to the failure of the Municipalidad de San José to address the problem concerning erosion of the right bank (margen derecha) of the río María Aguilar at [Nombre01 004]. In this regard, it should be noted that complaints concerning this problem have been filed with the local government of San José since 2012, without any indication that the appropriate coordination has taken place or that the corresponding actions have been carried out to resolve it.
Additionally, the record shows that, between 2012 and 2021, the CNE issued three technical reports concerning this problem, in which it made several recommendations to the Municipalidad de San José; however, there is likewise no evidence that the local government addressed the matters set forth therein. The foregoing is aggravated by the fact that, since at least 2021, the CNE has indicated that the lack of a protective structure on the right bank of the río María Aguilar has placed structures, including homes, at risk.
In this regard, it should be recalled that, in the “INFORME TÉCNICO ANALISIS DE VULNERABILIDAD EN LOS ALREDEDORES DE LA PROPIEDAD DE [Nombre 005] DPM-INF-0055-2012,” dated 21 de febrero de 2012, the CNE stated: “ It is important that the Municipio de San José, Dirección de Hidrología, comprehensively evaluate the work performed in the area, for the purpose of preventing impacts on the surrounding area and determining whether there are in fact any repercussions on the right bank, where riprap (enrocado) exists parallel to the property of Ms. [Nombre 005], Céd: [Valor 004], and, if necessary, analyze and propose corrective works. Establish periodic monitoring of the rivers’ behavior, particularly in the designated work areas, so that improvements may be incorporated into the process. The added value of this containment, re-excavation, and sediment-cleaning work (obras de contención, recava y limpieza de los sedimentos) in the various areas identified as being at greatest risk from lateral erosion or flooding along the río María Aguilar reduces the impact but does not entirely eliminate the risk, given that comprehensive intervention throughout the entire micro-watershed (microcuenca), as well as participation by the other municipal stakeholders, is required to provide greater safety to the population exposed to flooding” (emphasis added).
Furthermore, in the “INFORME TÉCNICO Valoración de riesgo de viviendas en [Nombre01 004] por inestabilidad de ladera de río María Aguilar” of febrero de 2021, the CNE stated: “V. Conclusions A. Erosion by the río María Aguilar has placed the homes on the right bank at risk. B. If erosion-protection work is not undertaken, the land will continue to be undermined, causing damage to the structures on the right bank. VI. Recommendations A. Protective work must be carried out on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes. B. Work within a publicly owned river channel (cauce de dominio público) must have authorization from the Departamento de Aguas of MINAE; accordingly, this institution must be notified of the risk so that it may facilitate any necessary procedure. C. Any work performed must have the corresponding studies and be supervised by a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica” (boldface added).
For its part, in marzo de 2021, the CNE issued the “INFORME TÉCNICO Revaloración de riesgo de [Nombre01 004] por erosión de rio María Aguilar,” which states: “VI. Conclusions A. The lack of protective work on the right bank has placed the structures at risk. B. During the next rainy season, the river’s erosive force will increase, thereby intensifying the risk to the homes. VII. Recommendations A. Protective work must be carried out on the slope of the right bank to prevent erosion and thereby ensure the stability and safety of the homes. B. In addition, the possibility of periodically dredging (dragado) the river channel before the rainy season must be assessed in order to increase hydraulic capacity and reduce the river’s erosive force. C. Work within a publicly owned river channel must have authorization from the Departamento de Aguas of MINAE; accordingly, this institution must be notified of the risk so that it may facilitate any necessary procedure. D. Any work performed must have the corresponding studies and be supervised by a professional accredited by the Colegio Federado de Ingenieros y Arquitectos de Costa Rica” (emphasis added).
Accordingly, the appeal is granted with respect to the Municipalidad de San José, as stated in the operative part (parte dispositiva) of this ruling.
IV.Having clarified the foregoing, the Chamber finds no violation by the CNE of the protected party’s fundamental rights under the terms in which the appeal was brought. In this regard, the record shows that this authority has issued reports concerning the reported problem; however, it is not responsible for implementing the corresponding solution.
V.Finally, with respect to the Ministerio de Salud, the Chamber finds that, on 17 de junio de 2024, the protected party, [Nombre01 001], sent a written submission (memorial) to the Ministerio de Salud stating that the Municipalidad de San José had been requested to construct protective work for the homes located on the right bank of the río María Aguilar and that this local government had not acted, despite the land having been undermined even further. On 26 de junio de 2024, the Ministerio de Salud inspected homes at [Nombre01 004]. It is also noted that the Ministerio de Salud issued health order (orden sanitaria) MS-DRRSCS-DARSSEM- 2472- 2024, granting the occupants of dwelling no. 28 at [Nombre01 004] two months to vacate it because of the danger it posed. By written submission MS-DRRSCS-DARSSEM-2572-2024 dated 3 de julio de 2024, the Ministerio de Salud made the following recommendation concerning the homes located on the eastern bank of the río María Aguilar: “(…) It is abundantly clear that the eastern bank of the Río María Aguilar, where it passes the inspected homes, requires a civil-engineering structure capable of withstanding the friction and scouring caused by the river as it flows alongside those homes.
It can be seen how the river ‘eats away’ at the land serving as the setback (retiro) and boundary adjoining the inspected homes; the friction between the river’s flow and the land forming part of the riverbank is undermining the stability of the foundations of the walls in the backyards of the inspected homes. Photo 1 shows a civil-engineering structure built opposite the eastern boundary of the inspected homes; it is a structure built on the bank of the río María Aguilar and located directly opposite the eastern boundary of the inspected homes. Based on what was observed, that structure has fully performed the function of preventing the river’s flow, through friction with the land, from ‘washing it away,’ thereby ensuring that the land serving as a setback between the riverbank and the adjoining homes remains in safe condition and that the infrastructure is therefore secure, with no visually evident problems involving destabilization of the supporting soils on which it rests. It is recommended that a structure similar to the one described in the immediately preceding paragraph be built on the bank of the río María Aguilar where it passes the three inspected homes.”
In view of the foregoing, no action or omission by the Ministerio de Salud is found to have infringed the appellant’s fundamental rights under the terms in which the appeal was brought; therefore, the appeal is denied with respect to that ministry.
As a matter of principle, I consider that cases concerning the failure of the Public Administration to repair, construct, modify, or demolish any infrastructure works should be dismissed because such omission is a matter of legality whose adjudication falls within the jurisdiction of the ordinary courts, before which the interested party may present objections more fully. However, when such administrative omission results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits of the matter, as this situation constitutes an exception to my position on this issue, as occurs in this application for amparo (recurso de amparo), in which [Nombre01 004], adjacent to the Río María Aguilar, complain about the vulnerability of the houses along its bank and the failure of the Municipalidad de San José to carry out works to protect and stabilize the slope, since all of this affects the stability of the homes due to rising water levels and the effects of erosion, thereby endangering people’s property and physical integrity.
Although I agree with the majority of the Chamber that the application should be partially granted, I disagree as to the court before which the enforcement phase of the matter should be conducted, given the absence of adequate mechanisms under the regulations governing this constitutional jurisdiction for monitoring compliance with a judgment involving highly complex technical matters, such as definitively resolving the issue raised by the applicant concerning erosion of the right bank of the río María Aguilar in [Nombre01 004]. In contrast, the provisions of the Código Procesal Contencioso-Administrativo regarding enforcement (artículo 155 y siguientes) offer clear advantages, such as the ability to request schedules, impose fines, determine liability, oversee stages of compliance, and so forth. Therefore, pursuant to artículo 56 de la Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Notice is given that any material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, published in the Boletín Judicial nro. 19 del 26 de enero de 2012, as well as the agreement of the Consejo Superior del Poder Judicial, approved in artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
The application is partially granted, solely as against the Municipalidad de San José. Luis Diego Miranda Méndez and Mariana Zúñiga Pérez, respectively mayor and president of the Concejo, both of the Municipalidad de San José, or whoever holds those offices, are ordered to issue the appropriate directives and make the necessary arrangements within the scope of their respective authority so that, within a maximum period of SEIS MESES from notification of this ruling, the issue reported by the applicant concerning erosion of the right bank of the río María Aguilar in [Nombre01 004] is definitively resolved. For this purpose, they must take into consideration the recommendations made by the Comisión Nacional de Prevención de Riesgos Atención de Emergencias in the technical reports of febrero de 2012, as well as febrero y marzo de 2021, referenced in the reasoning section of this judgment. The respondent authorities are advised that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an application for amparo that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de San José is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law court. The remainder of the application is denied. Justice Salazar Alvarado issues a separate note. Justice Garro Vargas dissents regarding enforcement of this judgment and, pursuant to artículo 56 de la Ley de la Jurisdicción Constitucional, directs that enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in artículos 155 y siguientes del Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be sent to that court so that proceedings to enforce this ruling may be initiated. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintitres de agosto de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente número 24-020715-0007-CO, interpuesto por [Nombre01 001], [Valor 001], [Nombre01 002], [Valor 002] Y [Nombre01 003], [Valor 003], a favor de [Nombre01 004], contra la MUNICIPALIDAD DE SAN JOSÉ, LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS -CNE- Y EL MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
La parte accionante, quienes residen en la [Nombre01 004], indica que, entre 1994 y 1995, la Municipalidad de San José desvió el río Ocloro al río María Aguilar, lo que aumentó el nivel de las aguas y la erosión en ambas márgenes del último río mencionado. Detallan que, en el año 2011, la Municipalidad de San José construyó un muro de retención en la ladera del río, al lado de la urbanización San Marino, lo que provocó que la ladera opuesta, sea la [Nombre01 004], quedara sin protección, por lo que se dio una mayor erosión y aumento del nivel de las aguas, mismas que rebotaban en tal ladera, por lo que la Municipalidad de San José construyó un muro de gaviones parcial detrás del play y de la Dirección01 en el año 2007, pero no incluyó la totalidad de la margen del río. Acusan que a tal muro no se le dio mantenimiento y en el 2020 fue arrasado por la fuerza del caudal. Indican que, en los años 2012 y 2021, la CNE emitió recomendaciones a la Municipalidad de San José en relación con la erosión del río María Aguilar; empero, no fueron acatadas por el gobierno local.
Afirman que el 20 de junio de 2024 se entregó ante la corporación local de San José una solicitud y un nuevo informe de la CNE denominado: "REVALORACIÓN DE RIESGO [Nombre 004]", donde se indica: “VI. Conclusiones... A. La falta de una obra de protección en la margen derecha ha puesto en riesgo las estructuras. B. Durante la próxima época lluviosa el poder erosivo del no se incrementará lo que intensifica el riesgo para las viviendas”. Aclara que de la solicitud de cita se le envió copia al Ministerio de Salud, a la Comisión Nacional de Emergencias, Defensoría de los Habitantes, Comisión Nacional de Riesgo y Atención de Emergencias Municipalidad de San José y al Departamento de Aguas del MINAE. Exponen que, por memorial del 10 de julio de 2024, en respuesta a la solicitud de 20 de junio de 2024, el asistente del alcalde notificó el informe de funcionarios de la Municipalidad de San José GPS-OMGRD-419-2024, mediante el que se señala: “2.-Con respecto a la solicitud de la obra de protección en la margen derecha para estabilización de ladera y protección de las viviendas expuestas al riesgo, la corporación municipal se ve imposibilitada a realizar inversión de los recursos públicos en servicios o terrenos privados. 3.-Con respecto a la solicitud del dragado del cauce ante inicios del período lluvioso se indica este será valorado por la sección de Mantenimiento y Construcción de la Red Fluvial para determinar su pertinencia y viabilidad técnica-operativa”.
Alegan que de nuevo el municipio hizo caso omiso al informe de la CNE y no dimensiona el grado de peligrosidad en que se encuentran los inmuebles y las vidas de las personas que viven en la ladera sur del Río María Aguilar. Detallan que, a mediados de junio de 2024, funcionarios del Ministerio de Salud inspeccionaron las viviendas de la ladera del río ubicadas en la [Nombre01 004] y emitieron los informes técnicos y una orden sanitaria de desalojo en relación con la casa nro. 28.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
“IV. Antecedentes del área o sector involucrado El cauce del río María Aguilar, drena parte del cantón de San José, Curridabat y Tres Ríos, el cual de acuerdo con los antecedentes de los últimos años, ha generado a lo largo de su trayectoria serios problemas de desbordamiento, erosión lateral de sus márgenes, destrucción de obras de contención y daños a la propiedad privada.
En la actualidad, el cauce del río María Aguilar, se encuentra saturado por la alta acumulación de material (sedimentos, basura doméstica y chatarra) y como consecuencia, al no tener una sección hidráulica adecuada, se generan desbordamientos y fuertes erosiones debido a la falta de capacidad para evacuar adecuadamente los caudales picos, originando una subida del nivel de las aguas, lo que provoca fuertes erosiones en las márgenes o inclusive desbordándose sus aguas altamente contaminadas, hacia las comunidades aledañas, los cuales, en la mayoría de los casos se requiere de una intervención oportuna en la limpieza y dragado de los sedimentos antropogénicas, así como, de construir obras de mitigación a corto plazo (…)
Es importante que por parte del Municipio de San José, Dirección de Hidrología, evalúe integralmente los trabajos efectuados en el área, con la finalidad de prevenir afectaciones en los alrededores y de establecer si realmente no existen ninguna repercusión en la margen derecha, donde existente un enrocado, paralelo a la propiedad de la señora [Nombre01 005], Céd: [Valor 004] y de ser necesario analizar y proponer obras correctivas.
Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajos definidos, que permita incorporar las mejoras al proceso.
El valor agregado de estos trabajos de obras de contención, recava y limpieza de los sedimentos, en los diferentes sectores identificados como de mayor riesgo por erosión lateral o inundación a lo largo del río María Aguilar, reduce la afectación pero, no la elimina en su totalidad el riesgo, dado que se requiere de la intervención integral de toda la microcuenca y de los demás actores municipales, para dar mayor seguridad a la población expuesta ante las inundaciones”. (Ver prueba documental).
“IV. Análisis general de la amenaza y vulnerabilidad.
A. Las viviendas visitadas limitan con la margen derecha de la margen el Río María Aguilar.
B. La erosión del río ha provocado inestabilidad en la ladera que se evidencia con los daños en las viviendas C. En la margen izquierda se observa un muro de gaviones sobre una estructura de concreto (…)
A. La erosión del río María Aguilar ha puesto en riesgo las viviendas de la margen derecha.
B. De no realizarse alguna obra de protección a la erosión, se seguirá socavando el terreno y provocando daños en las estructuras de la margen derecha
A. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas.
B. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite.
C. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica”. (Ver prueba documental).
“VI. Conclusiones A. La falta de una obra de protección en la margen derecha ha puesto en riesgo las estructuras.
B. Durante la próxima época lluviosa el poder erosivo del río se incrementará lo que intensifica el riesgo para las viviendas.
Nombre03. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas.
B. Además, se debe valorar la posibilidad de realizar un dragado periódico en el cauce, antes de la época lluviosa, para aumentar la capacidad hidráulica y disminuir la fuerza erosiva del rio.
C. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite.
D. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica”. (Ver prueba documental).
“En vista realizada en 26 de junio 2024 por parte de esta oficina, se evidencia el proceso de erosión activo en la margen derecha del río MÁ1-ia Aguilar en la colindancia a las propiedades (…)
Condiciones externas a) Aporte de aguas de lluvia de los techos de forma directa hacia la ladera (…)
“En cuento (sic) a la erosión de la margen derecha del río María Aguilar, no existe ningún estudio de dinámica del río que indique que dicho proceso es debido a la construcción del muro existente en la margen izquierda del río.
Respecto a las recomendaciones emitidas en los Informes Técnicos de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, CNE, en los cuales se indican que se debe realizar una Obra de protección en la ladera de la margen derecha, para la estabilización de esta y la protección de las viviendas, no son competencia municipal, ya que este ente se ve imposibilitado de realizar inversión de los recursos públicos en servicios o en terrenos privados.
Por último, respecto al dragado periódico del cauce, será evaluado por este municipio, en vista de que este proyecto se determina como obra mayor en cauce y requiere del permiso correspondiente de la Dirección de Aguas del MINAE y de los estudios correspondientes como requisito del permiso”. (Ver prueba documental).
SOBRE EL MINISTERIO DE SALUD:
“(…) Se observa con mucha claridad que la margen Este del Río María Aguilar en su paso por las viviendas inspeccionadas necesita de una obra civil que permita soportar la fricción y arrastre que tiene el río a su paso por la colindancia con las viviendas inspeccionadas. Se observa como el río “se come” el terreno que funciona como retiro y colindancia de las viviendas inspeccionadas, la fricción entre el caudal del río y el terreno que pertenece a la margen del río está socavando la estabilidad de las cimentaciones de los muros de los patios traseros de las viviendas inspeccionadas.
En la foto 1, se muestra una obra civil construida al frente de la colindancia Este de las viviendas inspeccionadas, es una obra construida en la margen del río María Aguilar y que se ubica exactamente al frente de la colindancia Este de las viviendas inspeccionadas, según lo visto dicha obra ha cumplido completamente con la función de impedir que el caudal del río al friccionar con el terreno se vaya “lavando” y se dé como efecto que el terreno que funciona como retiro entre el margen del río y las viviendas en colindancia esté en condiciones seguras y por lo tanto la infraestructura pueda estar segura y sin problemas evidentes visualmente de desestabilización del soporte de los suelos donde se asientan.
Una obra similar a la descrita en el párrafo inmediatamente anterior es la que se recomienda construir en la margen del río María Aguilar a su paso por las tres viviendas inspeccionadas”. (Ver prueba documental).
En el sub examine, la parte accionante, quienes residen en la [Nombre01 004], indica que, entre 1994 y 1995, la Municipalidad de San José desvió el río Ocloro al río María Aguilar, lo que aumentó el nivel de las aguas y la erosión en ambas márgenes del último río mencionado. Detallan que, en el año 2011, la Municipalidad de San José construyó un muro de retención en la ladera del río, al lado [Nombre01 004] San Marino, lo que provocó que la ladera opuesta, sea la [Nombre01 004], quedara sin protección, por lo que se dio una mayor erosión y aumento del nivel de las aguas, mismas que rebotaban en tal ladera, por lo que la Municipalidad de San José construyó un muro de gaviones parcial detrás del play y de la Dirección01 en el año 2007, pero no incluyó la totalidad de la margen del río. Acusan que a tal muro no se le dio mantenimiento y en el 2020 fue arrasado por la fuerza del caudal. Alegan que de nuevo el municipio hizo caso omiso al informe de la CNE y no dimensiona el grado de peligrosidad en que se encuentran los inmuebles y las vidas de las personas que viven en la ladera sur del Río María Aguilar. Detallan que, a mediados de junio de 2024, funcionarios del Ministerio de Salud inspeccionaron las viviendas de la ladera del río ubicadas en la [Nombre01 004] y emitieron los informes técnicos y una orden sanitaria de desalojo en relación con la casa nro. 28.
Este Tribunal comprueba que, el 21 de febrero de 2012, la CNE emitió el “INFORME TÉCNICO ANALISIS DE VULNERABILIDAD EN LOS ALREDEDORES DE LA PROPIEDAD DE [Nombre 005] DPM-INF-0055-2012”, la cual está ubicada en la margen derecha del río María Aguilar, en el que se indicó: “IV. Antecedentes del área o sector involucrado El cauce del río María Aguilar, drena parte del cantón de San José, Curridabat y Tres Ríos, el cual de acuerdo con los antecedentes de los últimos años, ha generado a lo largo de su trayectoria serios problemas de desbordamiento, erosión lateral de sus márgenes, destrucción de obras de contención y daños a la propiedad privada. En la actualidad, el cauce del río María Aguilar, se encuentra saturado por la alta acumulación de material (sedimentos, basura doméstica y chatarra) y como consecuencia, al no tener una sección hidráulica adecuada, se generan desbordamientos y fuertes erosiones debido a la falta de capacidad para evacuar adecuadamente los caudales picos, originando una subida del nivel de las aguas, lo que provoca fuertes erosiones en las márgenes o inclusive desbordándose sus aguas altamente contaminadas, hacia las comunidades aledañas, los cuales, en la mayoría de los casos se requiere de una intervención oportuna en la limpieza y dragado de los sedimentos antropogénicas, así como, de construir obras de mitigación a corto plazo (…) VII.
Conclusiones y recomendaciones. Es importante que por parte del Municipio de San José, Dirección de Hidrología, evalúe integralmente los trabajos efectuados en el área, con la finalidad de prevenir afectaciones en los alrededores y de establecer si realmente no existen ninguna repercusión en la margen derecha, donde existente un enrocado, paralelo a la propiedad de la señora [Nombre01 005], Céd: [Valor 004] y de ser necesario analizar y proponer obras correctivas. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajos definidos, que permita incorporar las mejoras al proceso. El valor agregado de estos trabajos de obras de contención, recava y limpieza de los sedimentos, en los diferentes sectores identificados como de mayor riesgo por erosión lateral o inundación a lo largo del río María Aguilar, reduce la afectación pero, no la elimina en su totalidad el riesgo, dado que se requiere de la intervención integral de toda la microcuenca y de los demás actores municipales, para dar mayor seguridad a la población expuesta ante las inundaciones”.
Con memorial con sello de recibido de la Municipalidad de San José del 8 de octubre de 2012, el accionante ([Nombre01 002]) indicó que el 30 de setiembre de 2012 se desbordó el río María Aguilar en el parque [Nombre01 004]. Además, señaló que ese hecho se produjo por el desgaste de la margen derecha del río y debido a la construcción de un muro de gaviones por parte del gobierno local al lado contrario. Asimismo, mencionó que “la Municipalidad debe tornar las medidas que sean necesarias para mitigar la vulnerabilidad de 1a margen derecha del Río María Aguilar, construyendo muros de gaviones, de malla electrosoldados, o buscando medidas alternas”. En febrero de 2021, la CNE emitió el “INFORME TÉCNICO Valoración de riesgo de viviendas en [Nombre01 004] por inestabilidad de ladera de río María Aguilar”, mediante el cual se señala: “IV. Análisis general de la amenaza y vulnerabilidad. A. Las viviendas visitadas limitan con la margen derecha de la margen el Río María Aguilar.
B. La erosión del río ha provocado inestabilidad en la ladera que se evidencia con los daños en las viviendas C. En la margen izquierda se observa un muro de gaviones sobre una estructura de concreto (…) V. Conclusiones A. La erosión del río María Aguilar ha puesto en riesgo las viviendas de la margen derecha. B. De no realizarse alguna obra de protección a la erosión, se seguirá socavando el terreno y provocando daños en las estructuras de la margen derecha VI. Recomendaciones A. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas. B. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite. C. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica”.
En marzo de 2021, la CNE dictó el “INFORME TÉCNICO Revaloración de riesgo de [Nombre01 004] por erosión de río María Aguilar”, en el que se indica: “VI. Conclusiones A. La falta de una obra de protección en la margen derecha ha puesto en riesgo las estructuras. B. Durante la próxima época lluviosa el poder erosivo del río se incrementará lo que intensifica el riesgo para las viviendas. VII. Recomendaciones A. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas. B. Además, se debe valorar la posibilidad de realizar un dragado periódico en el cauce, antes de la época lluviosa, para aumentar la capacidad hidráulica y disminuir la fuerza erosiva del rio. C. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite.
D. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica”. Por memorial fechado 4 de mayo de 2021, el amparado [Nombre01 001] denunció ante la Municipalidad de San José que el muro de gaviones construido por ese municipio en la margen derecha del río María Aguilar se ha deteriorado y no recibe el mantenimiento adecuado, así como que colapsó en noviembre de 2020. Además, indicó: “Lo anterior pone en riesgo tanto al parque infantil como a las Dirección03, ya que esta ribera del río queda expuesta a la erosión, al derrumbamiento del terreno y el consiguiente peligro para las estructuras de las casas (…) Es de anotar que precisamente enfrente. En la margen izquierda del río, (Urbanización San Marino de San Francisco de Dos Ríos) la Municipalidad construyó, aproximadamente en el 2012, un fuerte y sólido muro de gaviones de 4 niveles verticales con una base chorreada y anclada, que ha provocado que las aguas, por efecto rebote, aumenten su caudal y fuerza en la margen derecha”.
Finalmente, se solicitó que, de acuerdo con el informe CNE-UIAR-INF-002-2021, se valore el riesgo al que están sometidas las viviendas y gestionar una obra de protección para salvaguardarlas. Tal gestión fue conocida por el Concejo Municipal de San José en la sesión nro. 53 celebrada el 11 de mayo de 2021 y se acordó trasladar el asunto a la alcaldía. Por memorial con fecha de recibido por la Municipalidad de San José del 6 de julio de 2022, el amparado [Nombre01 001] denunció que el muro de gaviones que construyó el gobierno local en la margen derecha del río María Aguilar no recibió mantenimiento, por lo que se deterioró; además, que se cayó parcialmente al cauce a finales de 2020, lo que pone en riesgo el parque infantil y varias casas. Por lo anterior, se solicitó la intervención para solucionar la situación, de conformidad con lo recomendado por la CNE. El 20 de junio de 2024, los recurrentes ([Nombre01 002]) y [Nombre01 001] dirigieron un memorial a la Municipalidad de San José, mediante la cual se expuso la preocupación de [Nombre01 004] ubicada en la margen derecha del río María Aguilar, debido a su erosión, así como hizo alusión a gestiones efectuadas desde el año 2012 ante ese gobierno local, entre otros, por la CNE.
Por ello se requirió “se nos dé una respuesta de las medidas que tomará la Municipalidad y si la misma acatará las recomendaciones que emite la CNE, en este último informe ya que el agua del río desprendió en estos días el enfocado de las casas número: 27 y 28, de igual manera el desprendimiento total del muro de gaviones de la casa número 26, esto último desde el año 2020, de lo cual la Municipalidad tenía conocimiento (…) De igual forma, requerimos una inspección por parte de la Municipalidad de San José, en el menor tiempo posible a fin de que evalúen el daño existente en la margen derecha del río, al mismo tiempo requerimos una respuesta pronta, ya que la situación es en extremo peligrosa poniendo en riesgo la vida de sus habitantes, debido a la inactividad, decidia (sic) y negligencia por parte del Municipio, al no cumplir con las recomendaciones dadas por la CNE, desde el año 2012 y años subsiguientes, violentando con ello el principio constitucional del derecho a la vida”.
Por memorial GSP-OMGRD-419-2024 del 4 de julio de 2024, la Oficina Municipal de Gestión de Riesgo a Desastre de la Municipalidad de San José indicó: “En vista realizada en 26 de junio 2024 por parte de esta oficina, se evidencia el proceso de erosión activo en la margen derecha del río MÁ1-ia Aguilar en la colindancia a las propiedades (…) Condiciones externas a) Aporte de aguas de lluvia de los techos de forma directa hacia la ladera (…) b) Colapso de acera construida en la parte posterior de viviendas (…) c) Lavado del material del relleno de la ladera. d) Evidencia el resto de la estructura de gaviones en inmediaciones de parque municipal y la propiedad del señor [Nombre01 001]. e) Pérdida de verticalidad la tapia de la propiedad del señor ([Nombre01 002]). f) Exposición de cimientos de las tapias colindantes en ambas propiedades. g) Ausencia de la zona de protección. h) Posible ampliación de viviendas en áreas de no construcción (…) 2.-Con respecto a la solicitud de la obra de protección en la margen derecha para estabilización de ladera y protección de las viviendas expuestas al riesgo, la corporación municipal se ve imposibilitada a realizar inversión de los recursos públicos en servicios o terrenos privados. 3.-Con respecto a la solicitud del dragado del cauce ante inicios del período lluvioso se indica este será valorado por la sección de Mantenimiento y Construcción de la Red Fluvial para determinar su pertinencia y viabilidad técnica-operativa”.
Por memorial MSJ-ALCALDIA-2364-2024 del 10 de julio de 2024, el municipio de San José indicó a los accionantes: “En atención a su oficio, mediante el cual se refieren la inestabilidad de ladera de la margen derecha del Río María Aguilar, en el sector [Nombre 004], Distrito de Zapote, le traslado oficio número GPS-181-2024, suscrito por la señora Dahianna Marín Chacón, Gerente de Provisión de Servicios, quien adjunta informe técnico No.GPS-OMGRD-419-2024, suscrito por el señor Job Villareal Granados y la señora Lorena Romero Vagas, Encargada de Oficina, ambos de la Oficina Municipal de Gestión de Riesgo a Desastres”. Por último, mediante oficio SCMRP-370-2024 del 6 de agosto de 2024, la Sección de Construcción y Mantenimiento Red Pluvial de la Municipalidad de San José indicó: “En cuento (sic) a la erosión de la margen derecha del río María Aguilar, no existe ningún estudio de dinámica del río que indique que dicho proceso es debido a la construcción del muro existente en la margen izquierda del río.
Respecto a las recomendaciones emitidas en los Informes Técnicos de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, CNE, en los cuales se indican que se debe realizar una Obra de protección en la ladera de la margen derecha, para la estabilización de esta y la protección de las viviendas, no son competencia municipal, ya que este ente se ve imposibilitado de realizar inversión de los recursos públicos en servicios o en terrenos privados. Por último, respecto al dragado periódico del cauce, será evaluado por este municipio, en vista de que este proyecto se determina como obra mayor en cauce y requiere del permiso correspondiente de la Dirección de Aguas del MINAE y de los estudios correspondientes como requisito del permiso”.
De previo a resolver lo que en derecho corresponde, resulta oportuno indicar que esta Cámara ya se ha pronunciado antes sobre la erosión de las márgenes del río María Aguilar. Nombre04, en la sentencia nro. 2020010630 de las 9:15 horas del 12 de junio de 2020 se dispuso:
“IV.- COMPETENCIA MUNICIPAL Y OBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL. Competencia municipal y obligación de coordinación interinstitucional. El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Nombre04, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:
"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:
" (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al (sic) resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó:
"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".
Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57 horas de 2 de junio de 2006).
ACTUACIÓN DE LA MUNICIPALIDAD DE SAN JOSÉ Y LAS RECOMENDACIONES GIRADAS POR LA COMISIÓN NACIONAL DE EMERGENCIAS A LA MUNICIPALIDAD DE SAN JOSÉ. En el sub examine, el recurrente acusa que desde el año 2016, su propiedad se ha visto erosionada por el río María Aguilar a raíz de acumulaciones de la basura, sedimentos y demás que obstaculizan el cauce normal del río, sin que, a la fecha de presentación de este recurso, las autoridades recurridas hayan ejecutado las recomendaciones que ha venido dando la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), a partir del 2016 -IAR-INF-0084-2016, del 16 de febrero de 2016-. Ahora bien, después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales del amparado, al menos, por parte de la corporación municipal recurrida. Del informe rendido por los representantes de la Municipalidad de San José -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el amparado [Nombre01 001] es vecino de San Francisco de Dos Ríos, San José.
Su propiedad se ha visto erosionada por el río María Aguilar a raíz de acumulaciones de la basura, sedimentos y demás que obstaculizan el cauce normal. Además, que en fecha 16 de febrero de 2016, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, a solicitud del amparado, brindó un criterio técnico del grado de vulnerabilidad del área y una serie de recomendaciones para prevenir mayores afectaciones. Recomendando “Efectuar integralmente trabajos de canalización, corta de árboles, recolección de sedimentos y basura, obras de mitigación acorde con un plan integral de trabajo, con la finalidad de prevenir mayores afectaciones a futuro en las poblaciones aledaños a estos ríos, todo bajo la legislación actual y supervisado por profesionales calificados. Analizar a nivel interinstitucional e intermunicipal la problemática de los asentamientos marginales, que se localizan en las márgenes de estos ríos, con el propósito de buscar alternativas de trasladar a las familias que habitan estos sitios altamente vulnerables a terrenos aptos y más seguros.
Coordinar con cada municipio (tres Ríos, Curridabat y San José) para el río María Aguilar, un trabajo integralmente, en su Plan Operativo de medidas de prevención y mitigación, con la finalidad de realizar una intervención de limpieza anual en los sitios de mayor vulnerabilidad, así como, en caso de emergencia locales durante el período lluvioso, además, de obras de mitigación en muchas secciones de los cauces. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajo definidos, que permita incorporar las mejoras del proceso.”. Aunado a lo anterior, que en el mes de octubre de 2019 la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias elaboró un nuevo informe técnico CNE-UIAR-INF-0923-2019, a solicitud del amparado, en el cual, se indicó; que de no intervenir el sitio con alguna obra de protección, la erosión podría hacer colapsar la malla perimetral de la propiedad y en un futuro afectar el resto de esta.
Recomiendan valorar la posibilidad de levantar una estructura de algún tipo para proteger el margen izquierdo del río para evitar que se siga dando la erosión. Por último, se determina, que el problema por contaminación del cauce o río María Aguilar por sedimentos (basura doméstica) y materia orgánica en el centro del cauce, así como erosión de las márgenes sobre todo la izquierda, debe ser atendido por el Municipio mismo. Por su parte, la Municipalidad de San José, mediante el Oficio No. ALCALDÍA-A2-00506-2020, la Municipalidad de San José, le indicó al amparado “…En atención a gestión, la cual solicita se envié maquinaria con personal capacitado para el dragado del río, le remito criterio externado por la geógrafa Lorena Romero Vargas, Jefe Oficina Municipal de Gestión de Riesgo y el Ing. Marco Vinicio Corrales Xatruch, Gerente Provisión de Servicios, donde se refieren a su solitud…” indicando en dicho oficio “…La Municipalidad de San José en cumplimiento del marco jurídico vigente no realiza medidas de mitigación en cauce, únicamente ante situaciones de emergencia donde la CNE autorice o por orden de la Sala Cuarta…”.
Nótese, que si bien es cierto la autoridad municipal recurrida informa que la Gerencia de Provisión y Servicios y Sección de Construcción y Mantenimiento de la Red Pluvial, que la Municipalidad de San José se encuentra trabajando en todos los aspectos administrativos, legales y de Ingeniería sobre el tema, no menos cierto resulta que de los autos se desprende que el problema continúa y que pese a que desde el año 2016 se brindaron recomendaciones por parte de la Comisión Nacional de Emergencias, siendo el último informe técnico el No. CNE-UIAR-INF-0923-2019, del mes de octubre de 2019, la Municipalidad a la fecha continúa sin resolver el problema de forma definitiva, aún (sic) teniendo conocimiento de la existencia de la contaminación del río ampliamiente (sic) referida. Al respecto, este Tribunal Constitucional pudo constatar que existe el problema denunciado por el accionante, el cual es conocido por el municipio recurrido y afecta directamente al recurrente, sin que a la fecha de interposición de este recurso se le haya podido dar una solución, con lo cual se verifica una lesión a los derechos fundamentales del amparado.
Adicionalmente, en reiteradas ocasiones este Tribunal Constitucional ha reconocido y avalado que la competencia de la Comisión radica en efectuar a la Municipalidad recurrida las inspecciones y recomendaciones correspondientes, es de carácter vinculante (ver en ese sentido las sentencias No. 12818-2009 de las 15:32 horas del 18 de agosto de 2009 y la 16389-2010 de las 9:17 horas del 1 de octubre de 2010). No obstante, a pesar de lo señalado, aún no se ha llegado a concretar ninguna solución, ni siquiera se informa de medidas provisionales o urgentes dirigidas a evitar o mitigar los efectos de contaminación provocados por el Río María Aguilar. Tomando en consideración la competencia específica que el artículo 169, de la Constitución Política, otorga a los gobiernos local, al disponer que: " La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)”.
Por ello, se acredita la alegada violación a los derechos fundamentales del tutelado, siendo lo procedente declarar con lugar el recurso, con la orden que se indicará en la parte dispositiva de esta sentencia.
LA ACTUACIÓN DEL MINISTERIO DE AMBIENTE Y ENERGIA. Del informe rendido por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el 1° de abril de 2020, ante el Ministerio de Ambiente y Energía, el amparado, denunció la problemática de los rellenos que se están realizando en la propiedad colindante y la posible afectación a la zona de protección del río María Aguilar en la zona de Zapote. Además, que a la fecha de interposición del recurso de amparo, la Dirección de Agua del Ministerio de Ambiente y Energía, no ha recibido solicitud de permiso de obra en cauce por parte de la Municipalidad de San José, para llevar a cabo trabajos dentro del cauce del río María Aguilar, ya sea de limpieza, acomodo, recaba o reforzamiento de las márgenes -tal como señala el recurrente-. Por último que el 22 de mayo de 2020, el Ministro de ambiente y Energía, fue notificado de la resolución de las 09:47 horas del 20 de mayo de 2020, mediante la cual, se tuvo por ampliadas las partes del este recurso y se le dio audiencia.
Así las cosas, en cuanto a la actuación del Ministerio de Ambiente y Energía el amparo debe desestimarse, por cuanto no fue sino hasta el 1° de abril de 2020, que el recurrente presentó ante el Ministerio recurrido la denuncia de la situación que acusa y por la cual, acude en amparo de sus derechos en fecha 03 de abril de 2020. Al respecto, se pudo constatar, a la fecha de planteado este amparo, sea el 03 de abril de 2020, la autoridad recurrida se encuentra aún en plazo para resolver y comunicar el resultado de aquella gestión al tutelado, en atención a lo dispuesto en el artículo 261 de la Ley General de la Administración Pública, que dispone -en términos generales- dos meses para tales efectos, (obsérvese que la denuncia se presentó el 1 de abril de 2020). En consecuencia, este recurso resulta prematuro. En virtud de lo expuesto, se debe declarar sin lugar el recurso en cuanto a este extremo, como en efecto se dispone (…)
Por tanto: Se declara parcialmente con lugar el recurso, únicamente, en cuanto a la Municipalidad de San José y la falta de acatamiento de las recomendaciones brindadas por la Comisión Nacional de Emergencias para solucionar el problema que existe por la contaminación, desbordamiento del río María Aguilar y sus consecuencias -ver IAR-INF-0084-2016, del 16 de febrero de 2016 Recomendando “Efectuar integralmente trabajos de canalización, corta de árboles, recolección de sedimentos y basura, obras de mitigación acorde con un plan integral de trabajo, con la finalidad de prevenir mayores afectaciones a futuro en las poblaciones aledaños a estos ríos, todo bajo la legislación actual y supervisado por profesionales calificados. Analizar a nivel interinstitucional e intermunicipal la problemática de los asentamientos marginales, que se localizan en las márgenes de estos ríos, con el propósito de buscar alternativas de trasladar a las familias que habitan estos sitios altamente vulnerables a terrenos aptos y más seguros.
Coordinar con cada municipio (tres Ríos, Curridabat y San José) para el río María Aguilar, un trabajo integralmente, en su Plan Operativo de medidas de prevención y mitigación, con la finalidad de realizar una intervención de limpieza anual en los sitios de mayor vulnerabilidad, así como, en caso de emergencia locales durante el período lluvioso, además, de obras de mitigación en muchas secciones de los cauces. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajo definidos, que permita incorporar las mejoras del proceso.” así como, el informe técnico CNE-UIAR-INF-0923-2019 -valorar la posibilidad de levantar una estructura de algún tipo para proteger el margen izquierdo del río para evitar que se siga dando la erosión-, en cuanto a este último realizar dicha valoración y verificar si es o no procedente. Se ordena a Jhonny Araya Monge, en calidad de Alcalde de la Municipalidad de San José, o a quien en su lugar ocupe ese cargo, que dentro del ámbito de su competencia, adopte las medidas pertinentes para que, dentro del plazo máximo de SEIS MESES contado a partir de la notificación de esta resolución, realice la coordinación interinstitucional y den una solución definitiva al problema denunciado, que afecta al recurrente.
Lo anterior bajo apercibimiento de que podría incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. Notifíquese”.
Ahora bien, en el sub iudice la Sala verifica la lesión a los derechos fundamentales de la parte tutelada debido a la inacción de la Municipalidad de San José para atender la problemática atinente a la erosión de la margen derecha del río María Aguilar en la [Nombre01 004]. En ese sentido, nótese que desde el año 2012 se han formulado denuncias ante el gobierno local de San José en relación con tal problema, sin que se observe que se haya coordinado lo pertinente y llevado a cabo las actuaciones correspondientes para solventarlo. Adicionalmente, de los autos se desprende que, entre los años 2012 y 2021, la CNE emitió tres informes técnicos concernientes a esa problemática, en los cuales efectuó varias recomendaciones a la Municipalidad de San José; empero, tampoco se verifica que ese gobierno local haya atendido lo ahí consignado. Lo anterior se agrava al considerar que, al menos desde el año 2021, la CNE indicó que la falta de una obra de protección en la margen derecha del río María Aguilar ha puesto en riesgo estructuras, entre ellas, viviendas.
Acerca de esto, recuérdese que, en el “INFORME TÉCNICO ANALISIS DE VULNERABILIDAD EN LOS ALREDEDORES DE LA PROPIEDAD DE [Nombre 005] DPM-INF-0055-2012” del 21 de febrero de 2012, la CNE señaló: “ Es importante que por parte del Municipio de San José, Dirección de Hidrología, evalúe integralmente los trabajos efectuados en el área, con la finalidad de prevenir afectaciones en los alrededores y de establecer si realmente no existen ninguna repercusión en la margen derecha, donde existente un enrocado, paralelo a la propiedad de la señora [Nombre 005], Céd: [Valor 004] y de ser necesario analizar y proponer obras correctivas. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajos definidos, que permita incorporar las mejoras al proceso. El valor agregado de estos trabajos de obras de contención, recava y limpieza de los sedimentos, en los diferentes sectores identificados como de mayor riesgo por erosión lateral o inundación a lo largo del río María Aguilar, reduce la afectación pero, no la elimina en su totalidad el riesgo, dado que se requiere de la intervención integral de toda la microcuenca y de los demás actores municipales, para dar mayor seguridad a la población expuesta ante las inundaciones” (el resaltado fue agregado).
Además, en el “INFORME TÉCNICO Valoración de riesgo de viviendas en [Nombre01 004] por inestabilidad de ladera de río María Aguilar” de febrero de 2021, la CNE indicó: “V. Conclusiones A. La erosión del río María Aguilar ha puesto en riesgo las viviendas de la margen derecha. B. De no realizarse alguna obra de protección a la erosión, se seguirá socavando el terreno y provocando daños en las estructuras de la margen derecha VI. Recomendaciones A. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas. B. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite. C. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica” (la negrita fue incorporada).
Por su parte, en marzo de 2021, la CNE dictó el “INFORME TÉCNICO Revaloración de riesgo de [Nombre01 004] por erosión de rio María Aguilar”, en el que se indica: “VI. Conclusiones A. La falta de una obra de protección en la margen derecha ha puesto en riesgo las estructuras. B. Durante la próxima época lluviosa el poder erosivo del río se incrementará lo que intensifica el riesgo para las viviendas. VII. Recomendaciones A. Se debe realizar una obra de protección en la ladera de la margen derecha, para evitar la erosión y así garantizar la estabilidad y seguridad de las viviendas. B. Además, se debe valorar la posibilidad de realizar un dragado periódico en el cauce, antes de la época lluviosa, para aumentar la capacidad hidráulica y disminuir la fuerza erosiva del rio. C. Las obras en cause (sic) de dominio público deben de contar con permiso del Departamento de Aguas del MINAE; por lo que se debe de dar parte a esta institución del riesgo para que facilite cualquier trámite.
D. Cualquier obra que se realice debe contar con los estudios correspondientes y estar bajo la supervisión de un profesional acreditado por el colegio Federado de Ingenieros y Arquitectos de Costa Rica” (el resaltado fue incorporado).
Por ende, se estima el recurso en cuanto a la Municipalidad de San José, de acuerdo con lo indicado en la parte dispositiva de este pronunciamiento.
IV.Aclarado lo anterior, la Sala no comprueba la lesión a los derechos fundamentales de la parte tutelada por la CNE en los términos en los que fue planteado el recurso. En ese sentido, de los autos se desprende que esa autoridad ha emitido informes en relación con la problemática denunciada; empero, no le compete la ejecución de la solución correspondiente.
V.Por último, en cuanto al Ministerio de Salud, la Sala verifica que, el 17 de junio de 2024, el tutelado [Nombre01 001] envió un memorial al Ministerio de Salud, en el que indicó que se había requerido a la Municipalidad de San José construir una obra de protección de las viviendas ubicadas en la margen derecha del río María Aguilar, así como que ese gobierno local no ha actuado, pese a que el terreno se ha socavado todavía más. El 26 de junio de 2024, el Ministerio de Salud inspeccionó viviendas [Nombre01 004]. También se observa que el Ministerio de Salud dictó la orden sanitaria MS-DRRSCS-DARSSEM- 2472- 2024, mediante la cual confirió dos meses a los ocupantes de la vivienda nro. 28 [Nombre01 004] para desalojarla debido a su peligrosidad. Por memorial MS-DRRSCS-DARSSEM-2572-2024 del 3 de julio de 2024, el Ministerio de Salud recomendó lo siguiente en relación con las viviendas ubicadas en la margen este del río María Aguilar: “(…) Se observa con mucha claridad que la margen Este del Río María Aguilar en su paso por las viviendas inspeccionadas necesita de una obra civil que permita soportar la fricción y arrastre que tiene el río a su paso por la colindancia con las viviendas inspeccionadas.
Se observa como el río “se come” el terreno que funciona como retiro y colindancia de las viviendas inspeccionadas, la fricción entre el caudal del río y el terreno que pertenece a la margen del río está socavando la estabilidad de las cimentaciones de los muros de los patios traseros de las viviendas inspeccionadas. En la foto 1, se muestra una obra civil construida al frente de la colindancia Este de las viviendas inspeccionadas, es una obra construida en la margen del río María Aguilar y que se ubica exactamente al frente de la colindancia Este de las viviendas inspeccionadas, según lo visto dicha obra ha cumplido completamente con la función de impedir que el caudal del río al friccionar con el terreno se vaya “lavando” y se dé como efecto que el terreno que funciona como retiro entre el margen del río y las viviendas en colindancia esté en condiciones seguras y por lo tanto la infraestructura pueda estar segura y sin problemas evidentes visualmente de desestabilización del soporte de los suelos donde se asientan. Una obra similar a la descrita en el párrafo inmediatamente anterior es la que se recomienda construir en la margen del río María Aguilar a su paso por las tres viviendas inspeccionadas”.
En virtud de lo expuesto, no se observa alguna acción u omisión del Ministerio de Salud que haya conculcado los derechos fundamentales de la parte recurrente en los términos en los que fue planteado el recurso, motivo por el cual se declara sin lugar en cuanto a esa cartera ministerial.
En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este amparo, en el que [Nombre01 004], colindante con el Río María Aguilar se quejan de la vulnerabilidad de las casas a su margen, y la omisión de la Municipalidad de San José, de realizar obras de protección y estabilización de la ladera, pues todo esto afecta la estabilidad de las viviendas por el aumento de niveles de agua y el efecto de la erosión, poniendo en peligro la propiedad e integridad de las personas.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar parcialmente con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como lo es que se resuelva de forma definitiva la denunciada planteada por la parte recurrente atinente a la erosión de la margen derecha del río María Aguilar en la [Nombre01 004]. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara parcialmente con lugar el recurso, solo en cuanto a la Municipalidad de San José. Se les ordena a Luis Diego Miranda Méndez y Mariana Zúñiga Pérez, por su orden, alcalde y presidenta del Concejo, ambos de la Municipalidad de San José, o a quienes desempeñen esos puestos, que giren las órdenes pertinentes y dispongan lo necesario dentro del ámbito de sus respectivas competencias, para que en el plazo máximo de SEIS MESES, contado a partir de la notificación de este pronunciamiento, se resuelva de forma definitiva la problemática denunciada por la parte recurrente atinente a la erosión de la margen derecha del río María Aguilar en la [Nombre01 004], para lo cual deberán tomar en consideración las recomendaciones efectuadas por la Comisión Nacional de Prevención de Riesgos Atención de Emergencias en los informes técnicos de febrero de 2012, así como de febrero y marzo de 2021 a los que se hizo referencia en la parte considerativa de esta sentencia.
Se advierte a las autoridades recurridas que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a la presente declaratoria, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás se declara sin lugar el recurso. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
