FURTHERMORE, THE DIRECTOR OF THE BUENOS AIRES GOVERNING HEALTH AREA IS ORDERED, WITHIN A MAXIMUM PERIOD OF FIFTEEN DAYS, TO ISSUE THE PERTINENT HEALTH ORDERS AGAIN IF NECESSARY TO PROTECT THE LIFE, PHYSICAL INTEGRITY, AND HEALTH OF THE MINORS CURRENTLY ATTENDING THE SCHOOL, AS WELL AS THE TEACHING AND ADMINISTRATIVE STAFF. THEY MUST PROVIDE CONTINUOUS AND PERMANENT FOLLOW-UP ON COMPLIANCE WITH SAID HEALTH ORDERS WITHIN THE DEADLINES SET FORTH, ENSURING COMPLIANCE AND, IN THE EVENT OF NON-COMPLIANCE, TAKING THE PERTINENT MEASURES IN A TIMELY MANNER TO ESTABLISH RESPONSIBILITIES FOR THE OMISSIVE OFFICIALS. VCG08/2024 “(…) IV.- SPECIFIC CASE. From the report rendered under oath by the respondent authorities, with the consequences, even criminal, provided for in numeral 44 of the Law of Constitutional Jurisdiction, an infringement of the fundamental rights of the appellant is established, based on the considerations set forth below. In this regard, it is established that in official communication DREGT-SCE-02-0032-2023 of February 24, 2023, the Supervisor of Educational Centers Circuit 02 requested the Director of Educational Infrastructure: “1. Official communication CEEP846-016-2023, where the director of Esc. El Peje, MSc. Roberto Granados Chavarría, enumerates, describes, and comments on the situation caused by the poor infrastructure of said educational center. 2. Attached to this communication and email are a series of documents and plans demonstrating the actions taken over the last eight years regarding the specific case of the construction of the educational center: 1. Diagnosis DDIE_0653_2014_C0846_Escuela El Peje_IDP_18.12.2014 2. DIEE-DDIE-214-2017_18 INST L2 Y L3_START ORDER_31.03.2017 3. DIEE-DDIE-231-2017_18 INST L2 Y L3_PROCESS DETAIL_31.03.2017 4. VISIT ENGINEERS DIEE_ 22.05.2017 5. VISIT DIEE_13.01.2018 6. DIEE-DDIE-782-19_18 CS_O.I Stage 2_L2_03.09.2019 7. Construction_Plans_10.2019 8. Design New School El Peje_2021 3. I record the concern of the director of the educational center and this servant regarding the danger posed to students, teaching and administrative staff, and the educational community of Escuela El Peje code 0846 by the situation described and reported in these documents. 4. I request a detailed report on the progress of the process of the Project for the construction of the El Peje school code 0846, Circuit 02 Regional Directorate of Education of Grande del Térraba. Thus, I request your good offices, collaboration, and actions to find a strategy for a solution to this problem.” Subsequently, in an official communication of March 1, 2023, the Director of Escuela El Peje requested the Infrastructure Directorate of the Ministry of Public Education that “From 2014 to date, the school administration and the education board have managed the new El Peje school project; however, the slow procedures and lack of execution response have caused the educational center to be in vulnerable conditions in 2023. Some infrastructure problems are: 1. Roof in poor condition that leaks and does not drain properly during the rainy season. 2. Classrooms without an adequate structure to allow proper ventilation given the high temperatures in the community. 3. It is a zone of high seismicity that affects the school infrastructure, which does not comply with the safety parameters of the College of Engineers. 4. The facilities do not comply with Law No. 7600. 5. Access to the enclosures is in poor condition and the walkway is not roofed. 6. The electrical installation is in poor condition. It is obsolete, generating short circuits on several occasions that highlight the possibility of a fire. 7. The sanitary facilities are insufficient for the 132 students served and are not suitable for schoolchildren's use; they are in poor condition. 8. As evidenced by the inspection of architect Morales (Preliminary Diagnostic Report, DIEE-DDIE-0653-2014), in the section “Institutional Social Risk,” p. 3, the El Peje school is classified as “citizen security risk.” It was also indicated that on February 24, 2023, the Student Evacuation Protocol was activated. The electrical installation collapsed, and a short circuit occurred, producing a fire outbreak that was controlled by the Costa Rica Fire Department, Buenos Aires station, who confirmed that a new school project is necessary. Therefore, I requested your collaboration to undertake the necessary actions to finalize the new El Peje school project. Also, to know the actual progress of the project and an estimated deadline for consolidation. In official communication DREGT-SCE-02-0056-2023 of April 25, 2023, the Supervisor of Educational Centers Circuit 02 requested the Director and the Education Board of Escuela El Peje to comply with health order MS-DRRSBRU-DARS-BA-OS-0059- 2023 Escuela El Peje by preparing a remedial plan, if not already done, and to follow up. Furthermore, it is verified that on November 3, 2023, representatives of the Regional Director of the Grande del Térraba Regional Directorate held a meeting with officials from the Educational Infrastructure Directorate of the MEP, where the infrastructure needs of educational centers in the Regional Directorate of Education of Grande del Térraba requiring urgent attention from the DIE were presented. Among the urgent needs of educational centers analyzed in that meeting, Escuela El Peje, code 0846, belonging to Circuit 02, located in the district of Volcán, stands out. Additionally, within the Educational Infrastructure Directorate of the Ministry of Public Education, there is a project associated with this Educational Center for the construction of new works and maintenance of Escuela El Peje, located in the community of El Peje, in the district of Volcán, Buenos Aires canton, Puntarenas province. The construction project for Escuela El Peje has recently approved construction plans sealed by APC, Federated College of Engineers and Architects (CFIA). Actions are currently being taken to obtain the environmental feasibility of the project from the National Environmental Technical Secretariat (SETENA). The Education Board has ¢9,040,000.00 in the Single State Fund for payment of professional services. The total cost of the project amounts to approximately ¢456,782,515.75 (according to the referential budget), so the request for resources must be managed in the first quarter of 2025, allowing works to begin in the second half of 2025. From the facts presented, the Chamber concludes that the authorities of the Ministry of Public Education have openly violated the fundamental rights of the students and teachers of the respondent educational center, as Escuela El Peje is in very poor condition. It should be noted that this Tribunal is not unaware that procedures must be carried out and technical requirements met for this type of project; however, the time elapsed—and that remaining to wait—is excessive and unreasonable, violating the fundamental rights of the students and teaching staff of the educational center, which is why the appeal is granted against said authority.

V.- Furthermore, it is established that in Health Order MS-DRRSBRU-DARS-BA-OS-0059-2023, the Buenos Aires Health Area confirmed a series of deficiencies at Escuela El Peje. Additionally, it is verified that on March 19, 2024, a joint visit was conducted with Regional engineer Marvin Salamanca, who on April 19, 2024, signed report MS-DRRSBRU-URS-IT-38- 2024 detailing: “It is the criterion of this Governing Unit to declare the main pavilion of Escuela El Peje uninhabitable due to danger, having already exceeded its useful life; regarding the four additional classrooms of the second pavilion, their roof and covering structures must be repaired; the gym's electrical installation must be reviewed by a professional in the field and corrective measures taken if necessary. It is recommended that the Governing Health Area issue a health order for the main pavilion to be demolished and a new one built in its place; regarding the improvements to be made in the second pavilion and gym, a reasonable time will be given for their execution. Additionally, it is recommended that the Governing Health Area proceed with the approved methodology for declarations of uninhabitability of public buildings.” In official communication MS-DRRSBRU-DARS-BA-0185-2024 of August 5, 2024, the Buenos Aires Governing Health Area submitted technical report MS-DRRSBRU-DARS-BA-IT-0314-2024 to the Regional Directorate and, following internal protocols, requested an evaluation for the high-impact closure of the El Peje educational center. Furthermore, the Buenos Aires Governing Health Area reported under oath that health order MS-DRRSBRU-DARSBA-OS-0059-2023 has not been complied with. The foregoing shows that the actions of the Ministry of Health authorities have been insufficient, to the detriment of the fundamental rights of the staff and students of the school in question. For these reasons, this Tribunal considers that the Ministry of Health bears a share of responsibility in this matter and, therefore, the appeal is also granted against it. (…)” ... Consequently, the State has the obligation to ensure adequate protection of the environment, for which it must take the necessary measures so that the environment is free from contamination, and that the alterations produced by both man and nature, in the near or distant surroundings, do not constitute harm to the environment or to the health of the people who inhabit it. VI.- PARTIAL DISSENTING VOTE OF JUDGE GARRO VARGAS REGARDING THE OPERATIVE PART OF THIS JUDGMENT. Although I agree with the majority of the Chamber that the appeal must be granted, I differ on where the execution phase of the matter should reside, due to the lack of adequate mechanisms provided by the regulations governing this constitutional jurisdiction to follow up on a judgment that involves highly complex technical aspects, as is the case here concerning the first order issued in the operative part, that is, so that within twelve months, counted from the notification of this judgment, the construction of the Escuela El Peje is carried out, which is located in the community of El Peje, in the district of Volcán, Buenos Aires canton, Puntarenas province. In contrast, the provisions of the Contentious-Administrative Procedure Code regarding execution (article 155 et seq.) have evident advantages, such as the possibility of requesting schedules, imposing fines, establishing responsibilities, supervising compliance stages, etc. Therefore, in accordance with the provisions of article 56 of the Law of Constitutional Jurisdiction, I consider that the execution phase must be carried out before the Execution Area of the Contentious-Administrative and Civil Treasury Tribunal, under the judgment execution rules of said Code.

Amparo appeal filed by [Name 001], identity card [Value 001], on behalf of THE STUDENTS OF THE EL PEJE SCHOOL, against the MINISTRY OF PUBLIC EDUCATION.

WHEREAS:

1.- By written submission provided to the Secretariat of the Chamber on June 10, 2024, the appellant files an amparo appeal and states that the El Peje School is located in the community of El Peje, in the district of Volcán, Buenos Aires canton, Puntarenas province, and belongs to the Grande del Térraba Regional Directorate, specifically to circuit 02. Said educational center structurally consists of 5 classrooms, of which 3 are used for the general education of groups from first to sixth grade, one corresponds to the computer classroom, and the last one to the special education classroom. It also has a student dining hall and a multi-purpose room. They allege that the school is in deplorable structural conditions, where the concrete and masonry work is crumbling in pieces, the ceramic floors lack anti-slip properties, the ceiling is not fixed in place, doors are detaching from their structure, the electrical installation has generated 4 short-circuit events, endangering the safety and integrity of the minors. Furthermore, the institution has a health order from the Ministry of Health, due to the structural conditions it possesses, for endangering the integrity of the minor students. They detail that "The National Fire Department has attended the electrical emergencies that have occurred at the Educational Center, issuing reports determining that it is urgent to replace the electrical installation, as there is a very high risk of fire at the school. SIXTH: The Costa Rican Red Cross had to attend an emergency involving one of the students of the Educational Center, where due to the deterioration of the facilities, one of the glass doors of the computer classroom shattered, causing cuts and injuries to a student who was receiving classes in that classroom. SEVENTH: There is an internal procedure within the Educational Infrastructure Directorate of the MEP, where the construction of a new Educational Center for the community of El Peje was approved; however, the process is stalled and there is no progress, nor are the procedures submitted by the Directorate of the Educational Center and the Supervision of Circuit 02 being addressed when inquiries are made on the matter." Based on the arguments presented, they consider fundamental rights violated. They request that the appeal be granted.

2.- By resolution of 3:03 p.m. on June 11, 2024, the process is admitted and reports are requested from the respondent authorities.

3.- Gabriel Emilio Mora Monge, in his capacity as Regional Director of the Grande del Térraba Regional Directorate, reports under oath that on March 25, 2022, a meeting was held at the Santa Marta High School, located in the district of Brunka, with Mrs. Catalina Salas González, Director of the DIE, with the participation of Supervisors of the Regional Directorate of Education of Grande del Térraba, and this servant, in which an analysis was conducted of the infrastructure projects requiring urgent attention, containing funds allocated in the Single Fund, and the progress status of associated projects. In that meeting, among other infrastructure cases, the existing need for Escuela Del Peje, code 0846, is analyzed. Following the meeting, via official communication DREGT-DIR-O-0101-2022, dated March 25, 2022, a consolidated Excel spreadsheet is forwarded to Mrs. Catalina Salas Hernández, Director of the Infrastructure Directorate, Administrative Office, Ministry of Public Education, with information on Single Fund resources in the name of the Education Boards and Administrative Boards of the Educational Centers of the DREGT, according to the report of the Supervisors of the Regional Directorate. See Appendix 1. DREGT-DIR-O- 0101-2022 Single Fund Report, Appendix 2. Regional Consolidated Single Fund 03-25-2022 and Appendix 3. Email sent to DIE 03-27-2022. On Friday, November 3, 2023, a meeting was held with an official from the Educational Infrastructure Directorate of the MEP, Brenda Aymerich Pérez, representing the Director of the DIE, Lourdes Sáurez Barboza. In that meeting, the infrastructure needs of educational centers of the Regional Directorate of Education of Grande del Térraba requiring urgent attention from the DIE were presented. Among the urgent needs of educational centers analyzed in that meeting, Escuela El Peje, code 0846, belonging to Circuit 02, located in the district of Volcán, stands out. In the Excel document named Conectividad infraestructura- primaria, Escuela El Peje, code 0846, is cited for Circuit 02. On that same date, Friday, November 3, 2023, the documentation analyzed in the meeting described above was formally forwarded via email to Mrs. Brenda Aymerich Pérez, official of the DIE, with a copy to Lourdes Sáurez Barboza, Director of the Educational Infrastructure Directorate. On February 24, 2023, Official communication DREGT-SCE-02-0032-2023 was sent to Licentiate Lourdes Sáurez Barboza, Director of the Educational Infrastructure Directorate, with a report on the current situation of the infrastructure of the El Peje educational center in Volcán, code 0846, Circuit 02, Regional Directorate of Education of Grande del Térraba. This was a procedure carried out by the supervision in response to Official communication CEEP846-016-2023 Subject: Incident reported to 911 and request for intervention in the New School Project. On March 30, 2023, official communication DREGT-SCE-02-0051-2023 was sent. Subject: Proposal Circuit 02 for the Model Educational Centers Project, Escuela El Peje code 0846, addressed to Dr. Gabriel Emilio Mora Monge, Regional Directorate of Education of Grande del Térraba. This was in response to Official communication DVM-PICR 03-2023 requesting the proposal of one educational center selected per Circuit for the Model Educational Centers Project. (Appendix 6). On April 25, 2023, Official communication DREGT-SCE-02-0056-2023 was sent. SUBJECT: Attention Health Order MS-DRRSBRU-DARS-BA-OS-0059-2023 Escuela El Peje, addressed to the director and Education Board of Escuela El Peje, in response to Official communication DREGT-DIR-O-0130-2023 SUBJECT: Attention MSDRRSBRU- DARS-BA-OS- 0059-2023 Escuela El Peje. (Appendix 7 and 7.1). At this point, a response was received via email on May 8, 2023, with attachments: Remedial Plan of Esc. El Peje and Official communication CEEP846-065-2023. On May 16, 2023, Official communication DREGT-SCE-02-0073-2023 was sent, SUBJECT: Attention Official communication DREGT-DIR-O-0130-2023 and Health Order Escuela El Peje addressed to Dr. Gabriel Emilio Mora Monge, Regional Directorate of Education of Grande del Térraba, attaching: Remedial Plan of Esc. El Peje and Official communication CEEP846-065-2023. On September 27, 2023, Official communication DREGT-SCE-02-0128-2023 was sent, Subject: Forwarding of agreement and request for project support addressed to Licentiate Lourdes Suárez Barboza, Director of the Educational Infrastructure Directorate. This was a procedure carried out by the supervision in response to a Letter from the Education Board of Escuela El Peje. A series of emails were generated with Engineer Tatiana Vargas Jiménez, Coordinator of the Programming and Monitoring Department of the DIE (attached) (Appendix 8). On September 28, 2023, an email was sent to Esc. El Peje acknowledging receipt and informing them of full support for the procedures carried out by the administration and the Education Board of the El Peje educational center, code 0846, before the ministry authorities and the DIE, in pursuit of achieving the construction of the school. This was in response to Official communication CEEP846-121- 2023 regarding the Laboratory Short Circuit Report. (Appendix 9 and 9.1). On Monday, May 27, 2024, the Education Supervisor met at Escuela El Peje from 3:00 p.m. to 5:00 p.m. with parents, the director of the educational center, and the lawyer representing them to analyze the case, listen to their presentations, statements, and complaints. The Regional Directorate of Education, through the Department of Administrative and Financial Services, has always been and will be attentive to support the processes necessary to successfully achieve the infrastructure project of the El Peje Educational Center. The Regional Directorate of Education of Grande del Térraba has reported on the need to address the infrastructure case of the El Peje Educational Center and has been diligent in the coordination processes with the competent entities and officials of this Ministry of Public Education regarding educational infrastructure. The Regional Directorate of Education is not responsible for tasks related to the allocation of economic resources, nor design, contracting, or execution processes for infrastructure projects in educational centers, nor compliance with health orders involving new construction, as this matter corresponds to the Educational Infrastructure Directorate (DIE) in coordination with the Education Boards and Administrative Boards of educational centers. Regarding functions related to the infrastructure of educational centers, the DIE is the competent entity in this specific case, in coordination with the Education Boards and Administrative Boards; this Regional Directorate and Supervision 02 have taken supportive actions to ensure compliance with the health order weighing on the educational center and to achieve the execution of the required infrastructure project at Escuela El Peje, code 0846, and through the Department of Administrative and Financial Services of the Regional Directorate of Education of Grande del Térraba, we will continue to fulfill the responsibility of supporting the necessary processes in this matter.

4.- Lourdes Sáurez Barboza, in her capacity as Director of the Educational Infrastructure Directorate of the Ministry of Public Education, reports under oath that according to the records of this Directorate, there is a project associated with this Educational Center for the construction of new works and maintenance, which is being addressed. The project already has recently approved construction plans sealed by APC, Federated College of Engineers and Architects (CFIA). Actions are currently being taken to obtain the environmental feasibility (viabilidad ambiental) of the project before the National Environmental Technical Secretariat (SETENA). Likewise, it is reported that the Board has ₡9,040,000.00 in the Single State Fund for payment of professional services. The total cost of the project amounts to approximately ₡456,782,515.75 (according to the referential budget), so the request for resources must be managed in the first quarter of 2025, allowing works to begin in the second half of 2025. The public procurement procedure to award the construction company is estimated to be executed in the second quarter of 2025. According to the deadlines indicated above, it is estimated that works will begin during the second half of 2025, and it is clarified that the construction of the project is subject to the approval of the 2025 budget. Requests that the appeal be dismissed.

5.- In a record dated July 18, 2024, Judicial Technician 3 and Acting Secretary, both of the Constitutional Chamber, indicate that, having checked the COSTA RICAN JUDICIAL OFFICE MANAGEMENT SYSTEM for RECEIVED DOCUMENTS CONTROL AND THIS EXPEDIENT at nine hours thirty-six minutes on July eighteenth, two thousand twenty-four, it did not appear that from June fourteen to July seventeen, 2024, the Director of Escuela El Peje de Volcán de Buenos Aires had filed any written submission or document to render the report requested in the resolution issued at fifteen hours thirty-eight minutes on June eleventh, two thousand twenty-four.

6.- Randall Bejarano Campos, in his capacity as Director of the Buenos Aires Governing Health Area, reports under oath that health order MS-DRRSBRU-DARS BA-OS-0059- 2023 was personally notified to the then Director of the El Peje educational center on March 29, 2023, and to the Supervisor of the corresponding Circuit on March 31, 2023. The order for the correction of most critical points required, within a maximum period of 3 months, the presentation of a schedule with start and completion dates for the works. On May 16, 2023, a copy of official communication number DREGT-SCE-02-0073-2023 was received, addressed to MSc. Gabriel Emilio Mora Monge, detailing what had been done and citing the remedial plan CEEP846-063-2023, signed by the director of the educational center. It should be noted that the remedial plan has a maximum compliance deadline of the 2025 school year; however, it details that those responsible for executing the activities are the education board and the administration of the educational center. It also details that the new school project will be managed before the DIE. Through Technical Report MS-DRRSBRU-DARS-BA-IT-00525-2023 -carried out by Licda. Joselyn Valverde Villalobos-, the ocular inspection record, and the visit logbook, what was observed in the inspection conducted jointly with the architect on November 23, 2023, is detailed. That inspection determined that there is a project with plans detailing that almost the entire educational center will be demolished. As clarified by the architect, these documents held by the director of the educational center constitute a preliminary project. A joint tour of the entire educational center was conducted, and it was assessed to continue with Health Order MS-DRRSBRU-DARS-BA-OS-0059-2023, adding new deficiencies via the Technical Report due to the deterioration mainly of the educational center's electrical installation. Therefore, as recommended by the architect, an evaluation request was made to Regional engineer Marvin Salamanca, so that he could issue his professional opinion regarding the materials and foundations of the physical structure.

On March 19, 2024, a joint visit was conducted with Regional Engineer Marvin Salamanca, who on April 19, 2024, issued report MS-DRRSBRU-URS-IT-38-2024 detailing: “It is the criterion of this Unidad de Rectoría to declare the main wing of Escuela El Peje uninhabitable due to being dangerous, having already exceeded its useful life; with respect to the four additional classrooms of the second wing, their roof structures and coverings must be repaired; regarding the gymnasium’s electrical installation, it must be reviewed by a professional in the field and, if necessary, corrective measures taken. It is recommended that the Área Rectora de Salud issue a sanitary order (orden sanitaria) for the main wing to be demolished and a new one built in its place; regarding the improvements to be made to the second wing and gymnasium, a reasonable period will be granted for their execution. Separately, it is recommended that the Área Rectora de Salud proceed with the approved methodology for declarations of uninhabitability of public buildings.” By means of official communication MS-DRRSBRU-DARS-BA-0185-2024, dated August 5, 2024, technical report MS-DRRSBRU-DARS-BA-IT-0314-2024 was submitted to the Regional Directorate and, following internal protocols, an assessment was requested for the high-impact closure (clausura de alto impacto) of the El Peje educational center. Although the schedule requested through sanitary order MS-DRRSBRU-DARSBA-OS-0059-2023 was submitted on time and in proper form, the fact is that none of the indicated works were carried out, and to date the infrastructure remains in extremely poor condition; therefore, approval was requested to proceed with the high-impact closure.

7.- In the processing of the case, the prescriptions of law have been observed.

Considering:

Therefore:

I.- PURPOSE OF THE APPEAL. The appellant states that Escuela El Peje is located in the community of El Peje, in the district of Volcán, canton of Buenos Aires, province of Puntarenas, and belongs to the Dirección Regional Grande del Térraba, specifically to circuit 02. He claims that the school is in deplorable structural conditions, where the masonry work is crumbling to pieces, the floor tiles lack anti-slip properties, the ceiling does not stay fixed in place, the doors are detaching from their structure, and the electrical installation has caused 4 short-circuit events, endangering the safety and physical integrity of the minors. Moreover, the institution has a sanitary order from the Ministry of Health, by virtue of its structural conditions, for endangering the integrity of the minor students. He details that: “The Cuerpo Nacional de Bomberos has attended the electrical emergencies that have developed at the Educational Center, issuing reports determining that it is urgent to replace the electrical installation, as there is a very high risk of fire at the school. SIXTH: The Cruz Roja Costarricense had to attend an emergency involving one of the students of the Educational Center, where, due to the deterioration of the facilities, one of the glass doors of the computer lab burst, causing cuts and injuries to one of the students who was receiving classes in that classroom. SEVENTH: There is an internal procedure at the Dirección de Infraestructura Educativa of MEP, where the construction of a new Educational Center for the community of El Peje was approved; however, the process is stalled, and there is no progress, nor are the requests submitted by the Directorate of the Educational Center and the Supervision of Circuit 02 addressed when inquiries are made in this regard.” II.- PROVEN FACTS. The following facts, relevant to resolving this amparo appeal, are deemed accredited:

• a)In official communication No. DREGT-DIR-O-0101-2022 of March 25, 2022, the Regional Director of the Dirección Regional de Educación Grande del Térraba forwarded to the Director of the Dirección de Infraestructura and the Administrative Office of the Ministerio de Educación Pública a consolidation of information on funds in the Caja Única in the name of the Juntas de Educación y Administrativas of the Educational Centers of the DREGT, according to a report from the Supervisors of the Regional Directorate (report of the competent respondent authority).
• b)In official communication DREGT-SCE-02-0032-2023 of February 24, 2023, the Supervisor, Circuit 02 Educational Centers, requested the Director of the Dirección de Infraestructura Educativa: “1. Official communication CEEP846-016-2023, where the director of Esc. El Peje, MSc. Roberto Granados Chavarría, enumerates, describes, and comments on the scenario caused by the poor infrastructure of said educational center. 2. Attached to this communication and email are a series of documents and plans demonstrating the efforts made over the last eight years regarding the specific case of the construction of the educational center: 1. Diagnóstico DDIE_0653_2014_C0846_Escuela El Peje_IDP_18.12.2014 2. DIEE-DDIE-214-2017_18 INST L2 Y L3_ORDEN DE INICIO_31.03.2017 3. DIEE-DDIE-231-2017_18 INST L2 Y L3_DETALLE PROCESO_31.03.2017 4. VISITA INGENIEROS DIEE_ 22.05.2017 5. VISITA DIEE_13.01.2018 6. DIEE-DDIE-782-19_18 CS_O.I Etapa 2_L2_03.09.2019 7. Planos_constructivos_10.2019 8. Diseño Escuela Nueva El Peje_2021 3. I record the concern of the director of the educational center and this public servant regarding the danger posed to students, teaching and administrative staff, and the educational community of Escuela El Peje, code 0846, by the situation described and reported in these documents. 4. I request a detailed report on the progress made in the process of the Construction Project for Escuela El Peje, code 0846, Circuit 02, Dirección Regional de Educación Grande del Térraba. Therefore, I request your good offices, collaboration, and efforts to find a strategy to solve this problem” (report of the competent respondent authority).
• c)In an official communication dated March 1, 2023, the Director of Escuela El Peje requested the Dirección de Infraestructura of the Ministerio de Educación Pública that “From 2014 to date, the school administration and the Junta de Educación have managed the Escuela Nueva El Peje project; however, the slow bureaucracy and lack of execution response have caused the educational center to be in vulnerable conditions in 2023. Some infrastructure problems are: 1. Roof in poor condition that leaks during the rainy season and does not channel water properly. 2. Classrooms without an adequate structure that allows suitable ventilation given the high temperatures in the community. 3. It is a zone of high seismicity that affects the school infrastructure, which does not meet the safety parameters of the Colegio de Ingenieros. 4. The facilities do not comply with Ley No. 7600. 5. Access to the premises is in poor condition and the passageway is not roofed. 6. The electrical installation is in poor condition. It is obsolete, generating short circuits on several occasions that highlight the possibility of a fire. 7. The sanitary facilities (baterías sanitarias) are insufficient for the 132 students served and are not suitable for schoolchildren’s use; they are in poor condition. 8. As evidenced by the inspection of architect Morales (Informe Diagnóstico Preliminar, DIEE-DDIE-0653-2014), in the section “Riesgo Institucional Social,” p. 3, Escuela El Peje is categorized as “public safety risk.” It was also indicated that on February 24, 2023, the Student Evacuation Protocol for the classrooms was activated. The electrical installation collapsed and a short circuit occurred, causing a fire outbreak that was controlled by the Unidad de Bomberos de Costa Rica, Buenos Aires station, who confirmed that the new school project is necessary. Therefore, I requested your collaboration to undertake the necessary steps to realize the Escuela Nueva El Peje project. Also, to know the real progress of the project and an estimated deadline for consolidation (report of the competent respondent authority).
• d)In Sanitary Order MS-DRRSBRU-DARS-BA-OS-0059-2023 issued by the Área de Salud de Buenos Aires, a series of deficiencies were noted at Escuela El Peje (report of the Área Rectora de Salud de Buenos).
• e)In official communication DREGT-SCE-02-0056-2023 of April 25, 2023, the Supervisor, Circuit 02 Educational Centers, requested the Director and the Junta de Educación of Escuela El Peje to comply with what was ordered in sanitary order MS-DRRSBRU-DARS-BA-OS-0059-2023 Escuela El Peje by preparing a remedial plan, if they had not already done so, and to follow up (report of the competent respondent authority).
• f)On November 3, 2023, representatives of the Regional Director of the Dirección Regional Grande del Térraba held a meeting with officials of the Dirección de Infraestructura Educativa of the MEP, in which the infrastructure needs of educational centers of the Dirección Regional de Educación de Grande del Térraba requiring urgent attention from the DIE were presented. Among the urgent needs of educational centers analyzed in said meeting, Escuela El Peje, code 0846, belonging to Circuit 02, located in the district of Volcán, stands out (report of the competent respondent authority).
• g)That before the Dirección de Infraestructura Educativa of the Ministerio de Educación Pública, there exists a project associated with this Educational Center for the construction of new works and maintenance of Escuela El Peje, which is located in the community of El Peje, in the district of Volcán, canton of Buenos Aires, province of Puntarenas.
• h)The construction project for Escuela El Peje has newly approved construction plans (planos constructivos) stamped and sealed by APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Steps are currently being taken to obtain environmental feasibility (viabilidad ambiental) for the project from the Secretaría Técnica Nacional Ambiental (SETENA). The Junta de Educación has ₡9,040,000.00 available in the Caja Única del Estado for payment of professional services. The total cost of the project amounts to approximately ₡456,782,515.75 (according to the reference budget), so the request for resources must be managed in the first quarter of 2025, allowing the works to begin in the second semester of 2025 (report of the competent respondent authority).

• j)In official communication MS-DRRSBRU-DARS-BA-0185-2024 of August 5, 2024, the Área Rectora de Salud de Buenos Aires submitted to the Regional Directorate technical report MS-DRRSBRU-DARS-BA-IT-0314-2024 and, following internal protocols, requested an assessment for the high-impact closure of the educational center El Peje (report of the competent respondent authority).
• k)That sanitary order MS-DRRSBRU-DARSBA-OS-0059-2023 has not been complied with (report of the Área Rectora de Salud de Buenos).

III.- ON THE RIGHT TO ENJOY A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT IN EDUCATIONAL CENTERS. This Chamber, in Judgment No. 2019-3032 of 9:45 a.m. on February 22, 2019, stated the following: “III.- On the right to enjoy a healthy and ecologically balanced environment in Educational Centers- The right to health recognized in Articles 21 of the Political Constitution, 1 and 11 of the American Declaration of the Rights and Duties of Man, 4 of the American Convention on Human Rights, and 10 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights, is intimately linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental parameter of quality of life; along with health, food, work, housing, education, among others. Consequently, the State has the obligation to provide adequate protection to the environment, for which it must take the necessary measures so that the environment is free from pollution, and that the alterations produced both by man and by nature, in the near or distant surroundings, do not constitute harm to the environment or to the health of the people who inhabit it. This right is especially recognized when it is associated with other fundamental rights, such as the right to education. The latter is configured as a fundamental right, which translates into the public service provided by the State in the different educational centers of the country. Therefore, the least the State can do is, when providing this public service, not harm other fundamental rights, such as the right to health and to a healthy environment, both of the students and of the teaching and administrative staff of the educational institution.” IV.- SPECIFIC CASE. From the report rendered under oath by the respondent authorities, with the consequences, including criminal ones, provided for in Article 44 of the Ley de la Jurisdicción Constitucional, an infringement of the fundamental rights of the appellant party is accredited, based on the considerations set forth below. In this regard, it is accredited that in official communication DREGT-SCE-02-0032-2023 of February 24, 2023, the Supervisor, Circuit 02 Educational Centers, requested the Director of the Dirección de Infraestructura Educativa: “1. Official communication CEEP846-016-2023, where the director of Esc. El Peje, MSc. Roberto Granados Chavarría, enumerates, describes, and comments on the scenario caused by the poor infrastructure of said educational center. 2. Moreover, it is verified that on November 3, 2023, representatives of the Regional Director of the Dirección Regional Grande del Térraba held a meeting with officials of the Dirección de Infraestructura Educativa of the MEP, in which the infrastructure needs of educational centers of the Dirección Regional de Educación de Grande del Térraba requiring urgent attention from the DIE were presented. Among the urgent needs of educational centers analyzed in said meeting, Escuela El Peje, code 0846, belonging to Circuit 02, located in the district of Volcán, stands out. Furthermore, before the Dirección de Infraestructura Educativa of the Ministerio de Educación Pública, there exists a project associated with this Educational Center for the construction of new works and maintenance of Escuela El Peje, which is located in the community of El Peje, in the district of Volcán, canton of Buenos Aires, province of Puntarenas. The construction project for Escuela El Peje has newly approved construction plans stamped and sealed by APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Steps are currently being taken to obtain environmental feasibility for the project from the Secretaría Técnica Nacional Ambiental (SETENA). From the facts set forth, the Chamber concludes that the authorities of the Ministerio de Educación Pública have openly violated the fundamental rights of the students and teachers of the respondent educational center, since Escuela El Peje is in very poor condition. It should be noted that this Court does not ignore that procedures must be carried out and technical requirements met for this type of project; however, the time elapsed—and the time yet to wait—is excessive and unreasonable, violating the fundamental rights of the students and teaching staff of the educational center, which is why the appeal is granted with respect to said authority.

V.- Furthermore, it is accredited that in Sanitary Order MS-DRRSBRU-DARS-BA-OS-0059-2023, the Área de Salud de Buenos Aires noted a series of deficiencies at Escuela El Peje. Additionally, it is verified that on March 19, 2024, a joint visit was conducted with Regional Engineer Marvin Salamanca, who on April 19, 2024, issued report MS-DRRSBRU-URS-IT-38-2024 detailing: “It is the criterion of this Unidad de Rectoría to declare the main wing of Escuela El Peje uninhabitable due to being dangerous, having already exceeded its useful life; with respect to the four additional classrooms of the second wing, their roof structures and coverings must be repaired; regarding the gymnasium’s electrical installation, it must be reviewed by a professional in the field and, if necessary, corrective measures taken. It is recommended that the Área Rectora de Salud issue a sanitary order for the main wing to be demolished and a new one built in its place; regarding the improvements to be made to the second wing and gymnasium, a reasonable period will be granted for their execution. Separately, it is recommended that the Área Rectora de Salud proceed with the approved methodology for declarations of uninhabitability of public buildings.” In official communication MS-DRRSBRU-DARS-BA-0185-2024 of August 5, 2024, the Área Rectora de Salud de Buenos Aires submitted to the Regional Directorate technical report MS-DRRSBRU-DARS-BA-IT-0314-2024 and, following internal protocols, requested an assessment for the high-impact closure of the educational center El Peje. Moreover, the Área Rectora de Salud de Buenos Aires reported under oath that sanitary order MS-DRRSBRU-DARSBA-OS-0059-2023 has not been complied with. The foregoing shows that the actions of the Ministry of Health authorities have been insufficient, to the detriment of the fundamental rights of the staff and students of the school in question. For these reasons, this Court finds that there is a share of responsibility on the part of the Ministry of Health in this matter and, therefore, the appeal against it is also granted.

VI.- PARTIAL DISSENTING VOTE OF JUDGE GARRO VARGAS REGARDING THE OPERATIVE PART OF THIS JUDGMENT. While I agree with the majority of the Chamber that the appeal should be granted, I differ on where to place the execution phase of the matter, due to the lack of adequate mechanisms provided by the regulations governing this constitutional jurisdiction to follow up on a judgment involving highly complex technical aspects, as in this case, concerning the first order issued in the operative part, that is, for the construction of Escuela El Peje, which is located in the community of El Peje, in the district of Volcán, canton of Buenos Aires, province of Puntarenas, to be carried out within a period of twelve months, counted from the notification of this judgment. In contrast, the provisions of the Código Procesal Contencioso-Administrativo regarding execution (Article 155 and following) have clear advantages, such as the ability to request schedules, impose fines, establish responsibilities, oversee compliance stages, etc. Therefore, in accordance with the provisions of Article 56 of the Ley de Jurisdicción Constitucional, I believe that the execution phase must take place before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment execution rules of said Code.

VII.- DOCUMENTATION PROVIDED TO THE FILE. The parties are warned that if any paper document has been provided, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new technology-produced device, these must be withdrawn from the office within a maximum period of 30 working days counted from the notification of this judgment. Otherwise, any material not withdrawn within this period will be destroyed, pursuant to the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in session number 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial, in session number 43-12 held on May 3, 2012, Article LXXXI.

THEREFORE:

The appeal is granted. Lourdes Sáurez Barboza, in her capacity as Director of the Dirección de Infraestructura Educativa, and Gabriel Emilio Mora Monge, in his capacity as Regional Director of the Dirección Regional Grande del Térraba, both officials of the Ministerio de Educación Pública, or whoever holds their positions, are ordered to issue the necessary directives, within their respective spheres of competence, and take the corresponding steps so that, within a maximum period of TWELVE MONTHS counted from the notification of this judgment, the construction of Escuela El Peje is carried out. Said property must guarantee the right to health and a healthy and adequate environment for the education of the students of that educational center. Likewise, while definitive decisions are being made, they must adopt and execute, IMMEDIATELY, the necessary provisional measures that allow the continuity and development of classes and other educational activities, so as not to obstruct the educational process of the students. Furthermore, Randall Bejarano Campos, in his capacity as Director of the Área Rectora de Salud de Buenos Aires, or whoever holds that position, is ordered, within a maximum period of FIFTEEN DAYS, counted from the notification of this judgment, if necessary again, to issue the pertinent sanitary orders to protect the life, physical integrity, and health of the minors currently attending the school, as well as the teaching and administrative staff. They must continuously and permanently follow up on compliance with said sanitary orders within the deadlines set, ensuring their compliance and, in case of non-compliance, take timely pertinent measures to establish responsibilities for the negligent officials. The foregoing under warning that, based on the provisions of Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that they must comply with or enforce, issued in an amparo appeal, and fails to comply with it or fails to enforce it, provided the offense is not more severely punished. The State is ordered to pay the costs, damages, and losses caused by the facts serving as the basis for this declaration, which shall be liquidated in the execution of judgment phase of the administrative contentious jurisdiction. Judge Garro Vargas dissents regarding the execution of this judgment and, in accordance with Article 56 of the Ley de la Jurisdicción Constitucional, orders that it must take place before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the execution rules established in Articles 155 and following of the Código Procesal Contencioso Administrativo. Likewise, she orders that a copy of the judgment be sent so that the execution procedures of this ruling may commence. Notify.

023273-24. EDUCACIÓN. SE ORDENA AL MINISTERIO DE EDUCACIÓN PÚBLICA, QUE GIREN LAS DIRECTRICES NECESARIAS, EN EL RESPECTIVO ÁMBITO DE SUS COMPETENCIAS, Y GESTIONEN LO CORRESPONDIENTE PARA QUE, EN EL PLAZO MÁXIMO DE DOCE MESES, SE REALICE LA CONSTRUCCIÓN DE LA ESCUELA EL PEJE. DICHO INMUEBLE DEBERÁ GARANTIZAR EL DERECHO A SALUD, Y UN AMBIENTE SANO Y ADECUADO PARA LA EDUCACIÓN DE LOS ESTUDIANTES DE ESE CENTRO EDUCATIVO. ASIMISMO, MIENTRAS SE TOMAN LAS DECISIONES DEFINITIVAS, DEBERÁN ADOPTAR Y EJECUTAR DE INMEDIATO, LAS MEDIDAS NECESARIAS DE CARÁCTER PROVISIONAL QUE PERMITAN LA CONTINUIDAD Y EL DESARROLLO DE LAS LECCIONES Y DEMÁS ACTIVIDADES EDUCATIVAS, A FIN DE OBSTACULIZAR EL PROCESO EDUCATIVO DE LOS ESTUDIANTES. POR OTRA PARTE, SE ORDENA AL DIRECTOR DEL ÁREA RECTORA DE SALUD DE BUENOS AIRES, QUE DENTRO DEL PLAZO MÁXIMO DE QUINCE DÍAS, DE SER NECESARIO NUEVAMENTE, GIRE LAS ÓRDENES SANITARIAS PERTINENTES PARA PROTEGER LA VIDA, INTEGRIDAD FÍSICA Y SALUD DE LOS MENORES DE EDAD QUE ASISTEN ACTUALMENTE A LA ESCUELA, ASÍ COMO DEL PERSONAL DOCENTE Y ADMINISTRATIVO. DEBERÁ DARLE SEGUIMIENTO CONTINUO Y PERMANENTE AL CUMPLIMIENTO DE DICHAS ÓRDENES SANITARIAS EN LOS PLAZOS QUE ASÍ SE DISPONGAN, PROCURANDO SU CUMPLIMIENTO Y, EN CASO DE QUE NO SE CUMPLAN, TOMAR OPORTUNAMENTE LAS MEDIDAS PERTINENTES PARA SENTAR RESPONSABILIDADES A LOS FUNCIONARIOS OMISOS. VCG08/2024 “(…) IV.- CASO CONCRETO. Del informe rendido bajo juramento por las autoridades recurridas, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que en oficio DREGT-SCE-02-0032-2023 del 24 de febrero de 2023, el Supervisor, Centros Educativos Circuito 02 solicitó a la Directora Dirección de Infraestructura Educativa: “1. Oficio CEEP846-016-2023, donde el director de la Esc. El Peje MSc. Roberto Granados Chavarría enumera, describe y comenta el escenario generado por la mala infraestructura de dicho centro educativo. 2. Se adjuntan a este oficio y correo una serie de documentos y planos donde se demuestran las gestiones realizadas durante los últimos ocho años sobre el caso específico de la construcción del centro educativo: 1. Diagnóstico DDIE_0653_2014_C0846_Escuela El Peje_IDP_18.12.2014 2. DIEE-DDIE-214-2017_18 INST L2 Y L3_ORDEN DE INICIO_31.03.2017 3. DIEE-DDIE-231-2017_18 INST L2 Y L3_DETALLE PROCESO_31.03.2017 4. VISITA INGENIEROS DIEE_ 22.05.2017 5. VISITA DIEE_13.01.2018 6. DIEE-DDIE-782-19_18 CS_O.I Etapa 2_L2_03.09.2019 7. Planos_constructivos_10.2019 8. Diseño Escuela Nueva El Peje_2021 3. Dejo constancia de la preocupación del director del centro educativo y este servidor sobre el peligro que presenta para los estudiantes, personal docente y administrativo y comunidad educativa de la Escuela El Peje código 0846 la situación descrita y reportada en estos documentos. 4. Solicito un informe detallado sobre cuál es el avance que ha tenido el proceso del Proyecto de la construcción de la escuela El Peje código 0846, Circuito 02 Dirección Regional de Educación Grande del Térraba. Así las cosas, solicito sus buenos oficios, colaboración y realizar las gestiones que permitan buscar una estrategia para encontrar la solución a esta problemática”. Posteriormente, en oficio del 1 de marzo de 2023, el Director de la Escuela El Peje solicitó a la Dirección de Infraestructura del Ministerio de Educación Pública que “Desde el 2014 y hasta la fecha, la dirección escolar y la junta de educación han gestionado el proyecto escuela nueva El Peje, sin embargo, lo lento de la tramitología y la poco respuesta de ejecución ha provocado que en 2023 el centro educativo se encuentre en condiciones vulnerables. Algunos problemas de infraestructura son: 1. Techo en malas condiciones que en época lluviosa gotea y no canaliza adecuadamente. 2. Aulas sin una adecuada estructura que permita la ventilación idónea ante las altas temperaturas en la comunidad. 3. Es una zona de alta sismicidad que afecta la infraestructura escolar, la cual no cumple con los parámetros de seguridad del Colegio de Ingenieros. 4. Las instalaciones no cumplen con la ley No. 7600. 5. El acceso a los recintos está en mal estado y el pasadizo no esta techado. 6. La instalación eléctrica se encuentra en mal estado. Es obsoleta, generando en varias ocasiones cortos circuitos que ponen en evidencia la posibilidad de un incendio. 7. Las baterías sanitarias son insuficientes para los 132 estudiantes que se atienden y las mismas no son idóneas para la atención de escolares, están en mal estado. 8. Tal cual lo evidencia la inspección del arquitecto Morales (Informe Diagnóstico Preliminar, DIEE-DDIE-0653-2014), en el apartado “Riesgo Institucional Social”, p. 3, la escuela El Peje se cataloga como “riesgo seguridad ciudadana”. Además se indicó que el 24 de febrero de 2023 se activó el Protocolo de Evacuación de Estudiantes de las aulas. La instalación eléctrica colapsó y se hizo un corto circuito produciendo un conato de incendio que fue controlado por la Unidad de Bomberos de Costa Rica, sede Buenos Aires, quienes ratificaron que es necesario el proyecto de escuela nueva. Por lo anterior solicitó su colaboración para interponer las gestiones necesarias para concretar el proyecto de escuela nueva El Peje. Además conocer el avance real del proyecto y un plazo estimado para la consolidación. En oficio DREGT-SCE-02-0056-2023 del 25 de abril de 2023, el Supervisor Centros Educativos Circuito 02 solicitó al Director y a la Junta de Educación de la Escuela El Peje cumplir con lo ordenado en la orden sanitaria MS-DRRSBRU-DARS-BA-OS-0059- 2023 Escuela El Peje elaborando un plan remedial, sino lo hubiese realizado y dar seguimiento. Por otra parte, se constata que el 03 de noviembre de 2023 personeros de la Director Regional de la Dirección Regional Grande del Térraba realizaron una reunión con funcionarias de la Dirección de Infraestructura Educativa del MEP en la cual se expusieron las necesidades de infraestructura de centros educativos de la Dirección Regional de Educación de Grande del Térraba que requieren atención urgente por parte de la DIE. Entre las necesidades urgentes de centros educativos que se analizan en dicha reunión destaca La Escuela Peje, código 0846, perteneciente al Circuito 02, ubicado en el distrito de Volcán. Además, ante la Dirección de Infraestructura Educativa del Ministerio de Educación Pública existe un proyecto asociado a este Centro Educativo para la construcción de obra nueva y mantenimiento de La Escuela El Peje que se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas. El proyecto de construcción de La Escuela El Peje dispone de planos constructivos recién aprobados y sellados por APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Actualmente se realizan las gestiones para obtener la viabilidad ambiental del proyecto ante la Secretaría Técnica Nacional Ambiental (SETENA). La Junta de Educación dispone de ¢9,040,000.00 en la Caja Única del Estado para pago de servicios profesionales. El costo total del proyecto asciende aproximadamente a los ¢456,782,515.75 (de acuerdo con presupuesto referencial), por lo que se debe gestionar la solicitud de recursos en el primer trimestre de 2025, permitiendo el inicio de las obras en el segundo semestre de 2025. De los hechos expuestos, la Sala logra concluir que las autoridades del Ministerio de Educación Pública han lesionado abiertamente los derechos fundamentales de los estudiantes y docentes del centro educativo recurrido, pues la Escuela El Peje se encuentra en muy mal estado. Cabe señalar que este Tribunal no desconoce que deben realizarse trámites y cumplirse requisitos técnicos para este tipo de proyectos; sin embargo, el plazo transcurrido -y el que resta por esperar- resulta excesivo e irrazonable, violentando los derechos fundamentales de los estudiantes y personal docente del centro educativo, motivo por el cual en cuanto a dicha autoridad se declara con lugar el recurso.

V.- Por otra parte, se acredita que en Orden Sanitaria MS-DRRSBRU-DARS-BA-OS-0059-2023 el Área de Salud de Buenos Aires se constaron una serie de deficiencias en la Escuela El Peje. Además, se constata que 19 de marzo del 2024, se realizó visita en conjunto con ingeniero Regional Marvin Salamanca, quien el 19 de abril del 2024 suscribe el informe MS-DRRSBRU-URS-IT-38- 2024 que detalla: “Es criterio de esta Unidad de Rectoría declarar el pabellón principal de la Escuela El Peje inhabitable por peligroso al haber ya sobrepasado su vida útil, en lo que respecta a las cuatro aulas adicionales del segundo pabellón estas deberán ser reparadas sus estructuras de techos y cubiertas, el gimnasio en lo que respecta a la instalación eléctrica, debe ser revisada por un profesional en la materia y de ser necesario realizar medidas correctivas. Se recomienda al Área Rectora de Salud girar orden sanitaria para que el pabellón principal sea demolido y en su lugar construir uno nuevo, en lo que respecta a las mejoras a efectuar en el segundo pabellón y gimnasio se les estará girando un tiempo prudencial para que se ejecuten. Aparte se le recomienda al Área Rectora de Salud proceder con la metodología aprobada para declaraciones de inhabitabilidad de edificaciones públicas”. En oficio MS-DRRSBRU-DARS-BA-0185-2024 del 5 de agosto de 2024, el Área Rectora de Salud de Buenos Aires elevó a la Dirección Regional el informe técnico MS-DRRSBRU-DARS-BA-IT-0314-2024 y siguiendo los protocolos internos se solicita la valoración para la clausura de alto impacto del centro educativo El Peje. Además, el Área Rectora de Salud de Buenos Aires informó bajo juramento que la orden sanitaria MS-DRRSBRU-DARSBA-OS-0059-2023 no ha sido cumplida. Lo anterior evidencia que la actuación de las autoridades del Ministerio de Salud han sido insuficientes en detrimento de los derechos fundamentales del personal y estudiantes de la escuela en cuestión. Por estas razones, estima este Tribunal que existe una cuota de responsabilidad por parte del Ministerio de Salud en este asunto y, por ello, también se acoge el recurso en su contra. (…)” ... ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA “(…) III.- SOBRE EL DERECHO A GOZAR DE UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO EN LOS CENTROS DE EDUCACIÓN. Esta Sala, en Sentencia N° 2019-3032 de las 9:45 horas de 22 de febrero de 2019, indicó lo siguiente: “III.- Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan. Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa”. VI.- VOTO SALVADO PARCIAL DE LA MAGISTRADA GARRO VARGAS RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso, concerniente a la primera orden emitida en la parte dispositiva, es decir, para que en el plazo de doce meses, contado a partir de la notificación de esta sentencia, se realice la construcción de la Escuela El Peje, la cual se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

Recurso de amparo interpuesto por [Nombre 001], cédula de identidad [Valor 001], a favor de LOS ESTUDIANTES DE LA ESCUELA EL PEJE, contra el MINISTERIO DE EDUCACIÓN PÚBLICA.

RESULTANDO:

1.- Por escrito aportado en la Secretaría de la Sala el 10 de junio de 2024, la parte recurrente interpone recurso de amparo y manifiesta que la Escuela El Peje se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas y, pertenece a la dirección Regional Grande del Térraba, específicamente al circuito 02. Dicho centro educativo se conforma estructuralmente por 5 aulas, de las cuales 3 se destinan a la enseñanza general de los grupos de primero a sexto, una corresponde al aula de informática y, la última, al aula de enseñanza especial. Además cuenta con un comedor estudiantil y un salón multiuso. Alega que la escuela se encuentra en condiciones estructurales deplorables, donde la obra gris se desvanece a pedazos, la cerámica de los pisos carece de antideslizante, el cielo raso no se mantiene en un punto fijo, las puertas se despegan de su estructura, la instalación eléctrica ha generado 4 eventos por corto circuito poniendo en riesgo la seguridad e integridad de las personas menores de edad. Incluso, la institución tiene una orden sanitaria por parte del Ministerio de Salud, en virtud de las condiciones estructurales que posee, por poner en riesgo la integridad de los estudiantes menores de edad. Detalla que "El Cuerpo Nacional de Bomberos ha atendido las emergencias eléctricas que se han desarrollado en el centro Educativo, levantando informes en los cuales determina que es urgente se reemplace la instalación eléctrica, pues existe un altísimo riesgo de incendio de la escuela. SEXTO: La Cruz Roja Costarricense debió atender una emergencia de uno de los estudiantes del Centro Educativo, donde debido al deterioro de las instalaciones, una de las puertas de vidrio del aula de informática se reventó, ocasionado cortaduras y lesiones a uno de los estudiantes que se encontraba recibiendo clases en esa aula. SÉPTIMO: Existe un procedimiento interno en la Dirección de Infraestructura Educativa del MEP, donde se aprobó la construcción de un Centro Educativo nuevo para la comunidad del Peje, no obstante, el proceso se encuentra relegado y no existen avances ni se atienden las gestiones presentadas por la Dirección del Centro Educativo ni la Supervisión del Circuito 02, cuando se plantean consultas al respecto". Con base en los alegatos expuestos, estima conculcados derechos fundamentales. Pide se declare con lugar el recurso.

2.- Por resolución de las 15:3 horas del 11 de junio de 2024, se le da curso al proceso y se requieren los informes a las autoridades recurridas.

3.- Informa bajo juramento Gabriel Emilio Mora Monge, en su condición de Director Regional de la Dirección Regional Grande del Térraba, que el 25 de marzo de 2022 se realizó reunión en el Liceo Santa Marta, ubicado en el distrito de Brunka, con la Sra. Catalina Salas González, Directora de la DIE, con la participación de Supervisores (as) de la Dirección Regional de Educación Grande del Térraba, y este servidor, en la cual se realiza un análisis de los proyectos de infraestructura que requieren atención urgente, que contienen fondos asignados en Caja Única y estado de avance de proyectos asociados. En dicha reunión, entre otros casos de infraestructura, se analiza la necesidad existente de la Escuela Del Peje, código 0846. Posterior a la reunión, mediante oficio DREGT-DIR-O-0101-2022, con fecha 25 de marzo de 2022, se realiza traslado a la Sra. Catalina Salas Hernández, Directora de la Dirección de Infraestructura, Despacho Administrativo, Ministerio de Educación Pública consolidado en Excel con información de fondos en Caja Única a nombre de las Juntas de Educación y Administrativas de los Centros Educativos de la DREGT, según reporte de los Supervisores/as de la Dirección Regional. Ver Anexo 1. DREGT-DIR-O- 0101-2022 Informe Caja Única, Anexo 2. Consolidado Regional Caja única 25-03-2022 y Anexo 3. Correo enviado a la DIE 27-03-2022. En fecha viernes 03 de noviembre de 2023, se realiza reunión con funcionaria de la Dirección de Infraestructura Educativa del MEP, Brenda Aymerich Pérez, quien representa a la Directora de la DIE, Lourdes Sáurez Barboza. En dicha reunión se exponen las necesidades de infraestructura de centros educativos de la Dirección Regional de Educación de Grande del Térraba que requieren atención urgente por parte de la DIE. Entre las necesidades urgentes de centros educativos que se analizan en dicha reunión destaca La Escuela Peje, código 0846, perteneciente al Circuito 02, ubicado en el distrito de Volcán. En el documento en excel denominado Conectividad infraestructura- primaria, se cita en el caso del Circuito 02, centro educativo La Escuela Peje, código 0846. En esa misma fecha, viernes 03 de noviembre de 2023, se realiza formal traslado de la documentación analizada en la reunión, descrita anteriormente, mediante correo electrónico, a la Sra. Brenda Aymerich Pérez, funcionaria de la DIE, con copia a Lourdes Sáurez Barboza, Directora de la Dirección de Infraestructura Educativa. El 24 de febrero del 2023 se remite Oficio DREGT-SCE-02-0032-2023 a la Licenciada Lourdes Sáurez Barboza Directora Dirección de Infraestructura Educativa con informe sobre la situación actual de la infraestructura del centro educativo El Peje de Volcán código 0846, Circuito 02 Dirección Regional de Educación Grande del Térraba. Lo anterior como gestión realizada por la supervisión en atención del Oficio CEEP846-016-2023 Asunto: Incidencia reportada al 911 y solicitud de intervención en el Proyecto de Escuela Nueva. El 30 de marzo del 2023 se envió oficio DREGT-SCE-02-0051-2023. Asunto: Propuesta Circuito 02 para el Proyecto Centros Educativos Modelo, Escuela El Peje código 0846, dirigido al Dr. Gabriel Emilio Mora Monge, Dirección Regional de Educación Grande del Térraba. Lo anterior en respuesta al Oficio DVM-PICR 03-2023 donde se solicita la propuesta de un centro educativo seleccionado por Circuito para el Proyecto Centros Educativos Modelo. (Anexo 6). El 25 de abril del 2023 se remite Oficio DREGT-SCE-02-0056-2023 ASUNTO: Atención Orden Sanitaria MS-DRRSBRU-DARS-BA-OS-0059-2023 escuela El Peje, dirigido al director y Junta de Educación Escuela El Peje, lo anterior atendiendo el Oficio DREGT-DIR-O-0130-2023 ASUNTO: Atención MSDRRSBRU- DARS-BA-OS- 0059-2023 Escuela El Peje. (Anexo 7 y 7.1). En este punto se recibió respuesta vía correo, el 08 de mayo del 2023, adjuntos: Plan Remedial de la Esc. El Peje y el Oficio CEEP846-065-2023. El 16 de mayo del 2023 se remite el Oficio DREGT-SCE-02-0073-2023, ASUNTO: Atención Oficio DREGT-DIR-O-0130-2023 y a la Orden Sanitaria Escuela El Peje dirigido al Dr. Gabriel Emilio Mora Monge, Dirección Regional de Educación Grande del Térraba donde se adjunta: Plan Remedial de la Esc. El Peje y el Oficio CEEP846-065-2023. El 27 de setiembre del 2023 se remite Oficio DREGT-SCE-02-0128-2023, Asunto: Traslado de acuerdo y solicitud de apoyo al proyecto dirigido a la Licenciada Lourdes Suárez Barboza, Directora Dirección de Infraestructura Educativa. Lo anterior como gestión realizada por la supervisión en atención a Carta Junta de Educación Escuela El Peje. Se genera una seguidilla de correos con la Ingeniera Tatiana Vargas Jiménez Coordinadora Departamento de Programación y Seguimiento de la DIE (adjunta) (Anexo 8). El 28 de setiembre del 2023 se remite correo a la Esc. El Peje donde se le da acuse de recibido, se hace de su conocimiento que se brinda el total apoyo a las gestiones que realice la dirección y la Junta de Educación del centro educativo El Peje código 0846, ante las autoridades del ministerio y la DIE, en aras de lograr la construcción de la escuela. Lo anterior en respuesta al Oficio CEEP846-121- 2023 sobre Reporte Corto Circuito Laboratorio. (Anexo 9 y 9.1). El lunes 27 de mayo del 2024 el Supervisor de Educación se reunió en el Escuela El Peje de 3:00 p.m. a 5:00 p.m. con padres de familia, el director del centro educativo y el abogado que los representa para analizar el caso, escuchar sus ponencias, manifestaciones y quejas. La Dirección Regional de Educación, por medio del Departamento de Servicios Administrativos y Financieros siempre ha estado y estará atenta en apoyar los procesos que sean necesarios para lograr con éxito el proyecto de infraestructura del Centro Educativo El Peje. La Dirección Regional de Educación Grande del Térraba, ha informado sobre la necesidad de atender el caso de infraestructura del Centro Educativo El Peje y ha sido diligente de los procesos de coordinación con los entes y funcionarios competentes de este Ministerio de Educación Pública en materia infraestructura educativa. Que no le corresponde a la Dirección Regional de Educación, tareas relativas a la asignación de recursos económicos, ni procesos de diseño de obra, ni de contratación, ni de ejecución de proyectos infraestructura en centros educativos, ni cumplimiento de órdenes sanitarias, que involucren construcción de obra nueva, pues esta materia corresponde a la Dirección de Infraestructura Educativa (DIE) en coordinación con las Juntas de Educación y Juntas Administrativas de centros educativos. Las funciones relativas a la infraestructura de centros educativos, es DIE el ente competente para el caso en concreto, en coordinación con las Juntas de Educación y Juntas Administrativas; siendo que por parte de esta Dirección Regional y de la Supervisión 02, se han llevado a cabo acciones de apoyo para que se cumpla con la orden sanitaria que pesa sobre el centro educativo y se logre la ejecución del proyecto de infraestructura que se requiere en Escuela El Peje, código 0846 y por medio Departamento de Servicios Administrativos y Financieros de LA Dirección Regional de Educación Grande del Térraba se seguirá cumpliendo con la responsabilidad de apoyar los procesos que sean necesarios en esta materia.

4.- Informa bajo juramento Lourdes Sáurez Barboza, en su condición de Directora de la Dirección de Infraestructura Educativa del Ministerio de Educación Pública que de acuerdo con los registros de esta Dirección, consta que existe un proyecto asociado a este Centro Educativo para la construcción de obra nueva y mantenimiento, mismo que está siendo atendido. El proyecto ya dispone de planos constructivos recién aprobados y sellados por APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Actualmente se realizan las gestiones para obtener la viabilidad ambiental del proyecto ante la Secretaría Técnica Nacional Ambiental (SETENA). Así mismo, se informa que la Junta dispone de ₡9,040,000.00 en la Caja Única del Estado para pago de servicios profesionales. El costo total del proyecto asciende aproximadamente a los ₡456,782,515.75 (de acuerdo con presupuesto referencial), por lo que se debe gestionar la solicitud de recursos en el primer trimestre de 2025, permitiendo el inicio de las obras en el segundo semestre de 2025. El procedimiento de contratación pública para adjudicar la empresa constructora se estima ejecutar en el segundo trimestre de 2025. De acuerdo con los plazos indicados anteriormente se estima iniciar las obras durante el segundo semestre de 2025 y se aclara que la construcción del proyecto está sujeta a la aprobación del presupuesto 2025. Solicita que se declara sin lugar el recurso.

5.- En constancia con fecha 18 de julio de 2024, el Técnico Judicial 3 y Secretaria a. i., ambos de la Sala Constitucional indican que revisado, a las nueve horas treinta y seis minutos del dieciocho de julio de dos mil veinticuatro, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no apareció que del catorce de junio al diecisiete de julio del 2024, el Director de la Escuela El Peje de Volcán de Buenos Aires haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las quince horas treinta y ocho minutos del once de junio de dos mil veinticuatro.

6.- Informa bajo juramento Randall Bejarano Campos, en su condición de Director del Área Rectora de Salud de Buenos Aires que la orden sanitaria MS-DRRSBRU-DARS BA-OS-0059- 2023 se notificó de manera personalísima al entonces Director del centro educativo El Peje el 29 de marzo de 2023 y al Supervisor del Circuito correspondiente, el día 31 de marzo de 2023. La ordenanza para la subsanación de la mayoría de puntos críticos requirió a plazo máximo de 3 meses la presentación de un cronograma con fecha de inicio y finalización de obras. El 16 de mayo del 2023, se recibe copia del oficio número DREGT-SCE-02-0073-2023, dirigido al MSc. Gabriel Emilio Mora Monge, donde se detalla lo actuado y se cita el plan remedial CEEP846-063-2023, suscrito por el director del centro educativo. Cabe resaltar que, el plan remedial posee como plazo máximo de cumplimiento, el ciclo lectivo 2025, sin embargo, detalla que los responsables de ejecutar las actividades son la junta de educación y la dirección del centro educativo. Asimismo, detalla que, se gestionará el proyecto de Escuela Nueva ante la DIE. Mediante el Informe Técnico MS-DRRSBRU-DARS-BA-IT-00525-2023 -realizado por la Licda Joselyn Valverde Villalobos-, el acta de inspección ocular y la bitácora de visita, se detalla lo observado en la inspección realizada en conjunto con el arquitecto el 23 de noviembre del 2023. En dicha inspección se determina que se cuenta con un proyecto con planos que detallan que se va a demoler casi en su totalidad el centro educativo. Según aclara el arquitecto, estos documentos que posee el director del centro educativo, se tratan de un anteproyecto. Se realiza en conjunto un recorrido por todo el centro educativo y se valora continuar con la Orden Sanitaria MS-DRRSBRU-DARS-BA-OS-0059-2023 adicionando nuevas deficiencias mediante el Informe Técnico debido al deterioro principalmente de la instalación eléctrica del centro educativo. Por lo que, se realiza según recomendación del arquitecto, una solicitud de valoración por el ingeniero Regional Marvin Salamanca, para que emita su criterio profesional con respecto a los materiales y cimientos de la estructura física. El 19 de marzo del 2024, se realizó visita en conjunto con ingeniero Regional Marvin Salamanca, quien el 19 de abril del 2024 suscribe el informe MS-DRRSBRU-URS-IT-38- 2024 que detalla: “Es criterio de esta Unidad de Rectoría declarar el pabellón principal de la Escuela El Peje inhabitable por peligroso al haber ya sobrepasado su vida útil, en lo que respecta a las cuatro aulas adicionales del segundo pabellón estas deberán ser reparadas sus estructuras de techos y cubiertas, el gimnasio en lo que respecta a la instalación eléctrica, debe ser revisada por un profesional en la materia y de ser necesario realizar medidas correctivas. Se recomienda al Área Rectora de Salud girar orden sanitaria para que el pabellón principal sea demolido y en su lugar construir uno nuevo, en lo que respecta a las mejoras a efectuar en el segundo pabellón y gimnasio se les estará girando un tiempo prudencial para que se ejecuten. Aparte se le recomienda al Área Rectora de Salud proceder con la metodología aprobada para declaraciones de inhabitabilidad de edificaciones públicas”. Por medio de oficio MS-DRRSBRU-DARS-BA-0185-2024, del 5 de agosto de 2024 se eleva a la Dirección Regional el informe técnico MS-DRRSBRU-DARS-BA-IT-0314-2024 y siguiendo los protocolos internos se solicita la valoración para la clausura de alto impacto del centro educativo El Peje. Aunque el cronograma que se solicitó medio de la orden sanitaria MS-DRRSBRU-DARSBA- OS-0059-2023 se presentó en tiempo y forma, lo cierto es que ninguna de las obras indicadas se llevó a cabo y al día de hoy la infraestructura sigue en paupérrimas condiciones, por lo se solicitó el aval para proceder con la clausura de alto impacto.

7.- En la substanciación del proceso se han observado las prescripciones de ley.

Redacta la Magistrada Alvarado Paniagua; y,

Considerando:

Por tanto:

I.- OBJETO DEL RECURSO. El recurrente manifiesta que la Escuela El Peje se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas y, pertenece a la Dirección Regional Grande del Térraba, específicamente al circuito 02. Reclama que la escuela se encuentra en condiciones estructurales deplorables, donde la obra gris se desvanece a pedazos, la cerámica de los pisos carece de antideslizante, el cielo raso no se mantiene en un punto fijo, las puertas se despegan de su estructura, la instalación eléctrica ha generado 4 eventos por corto circuito poniendo en riesgo la seguridad e integridad de las personas menores de edad. Incluso, la institución tiene una orden sanitaria por parte del Ministerio de Salud, en virtud de las condiciones estructurales que posee, por poner en riesgo la integridad de los estudiantes menores de edad. Detalla que: “El Cuerpo Nacional de Bomberos ha atendido las emergencias eléctricas que se han desarrollado en el centro Educativo, levantando informes en los cuales determina que es urgente se reemplace la instalación eléctrica, pues existe un altísimo riesgo de incendio de la escuela. SEXTO: La Cruz Roja Costarricense debió atender una emergencia de uno de los estudiantes del Centro Educativo, donde debido al deterioro de las instalaciones, una de las puertas de vidrio del aula de informática se reventó, ocasionado cortaduras y lesiones a uno de los estudiantes que se encontraban recibiendo clases en esa aula. SÉPTIMO: Existe un procedimiento interno en la Dirección de Infraestructura Educativa del MEP, donde se aprobó la construcción de un Centro Educativo nuevo para la comunidad del Peje, no obstante, el proceso se encuentra relegado y no existen avances ni se atienden las gestiones presentadas por la Dirección del Centro Educativo ni la Supervisión del Circuito 02, cuando se plantean consultas al respecto”.

II.- HECHOS PROBADOS. De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

• a)En oficio No. DREGT-DIR-O-0101-2022 del 25 de marzo de 2022, el Director Regional de la Dirección Regional de Educación Grande del Térraba remitió a la Directora de la Dirección de Infraestructura y al Despacho Administrativo del Ministerio de Educación Pública consolidado de información de fondos en Caja Única a nombre de las Juntas de Educación y Administrativas de los Centros Educativos de la DREGT, según reporte de los Supervisores/as de la Dirección Regional (informe de la autoridad recurrida competente).
• b)En oficio DREGT-SCE-02-0032-2023 del 24 de febrero de 2023, el Supervisor, Centros Educativos Circuito 02 solicitó a la Directora Dirección de Infraestructura Educativa: “1. Oficio CEEP846-016-2023, donde el director de la Esc. El Peje MSc. Roberto Granados Chavarría enumera, describe y comenta el escenario generado por la mala infraestructura de dicho centro educativo. 2. Se adjuntan a este oficio y correo una serie de documentos y planos donde se demuestran las gestiones realizadas durante los últimos ocho años sobre el caso específico de la construcción del centro educativo: 1. Diagnóstico DDIE_0653_2014_C0846_Escuela El Peje_IDP_18.12.2014 2. DIEE-DDIE-214-2017_18 INST L2 Y L3_ORDEN DE INICIO_31.03.2017 3. DIEE-DDIE-231-2017_18 INST L2 Y L3_DETALLE PROCESO_31.03.2017 4. VISITA INGENIEROS DIEE_ 22.05.2017 5. VISITA DIEE_13.01.2018 6. DIEE-DDIE-782-19_18 CS_O.I Etapa 2_L2_03.09.2019 7. Planos_constructivos_10.2019 8. Diseño Escuela Nueva El Peje_2021 3. Dejo constancia de la preocupación del director del centro educativo y este servidor sobre el peligro que presenta para los estudiantes, personal docente y administrativo y comunidad educativa de la Escuela El Peje código 0846 la situación descrita y reportada en estos documentos. 4. Solicito un informe detallado sobre cuál es el avance que ha tenido el proceso del Proyecto de la construcción de la escuela El Peje código 0846, Circuito 02 Dirección Regional de Educación Grande del Térraba. Así las cosas, solicito sus buenos oficios, colaboración y realizar las gestiones que permitan buscar una estrategia para encontrar la solución a esta problemática” (informe de la autoridad recurrida competente).
• c)En oficio del 1 de marzo de 2023, el Director de la Escuela El Peje solicitó a la Dirección de Infraestructura del Ministerio de Educación Pública que “Desde el 2014 y hasta la fecha, la dirección escolar y la junta de educación han gestionado el proyecto escuela nueva El Peje, sin embargo, lo lento de la tramitología y la poco respuesta de ejecución ha provocado que en 2023 el centro educativo se encuentre en condiciones vulnerables. Algunos problemas de infraestructura son: 1. Techo en malas condiciones que en época lluviosa gotea y no canaliza adecuadamente. 2. Aulas sin una adecuada estructura que permita la ventilación idónea ante las altas temperaturas en la comunidad. 3. Es una zona de alta sismicidad que afecta la infraestructura escolar, la cual no cumple con los parámetros de seguridad del Colegio de Ingenieros. 4. Las instalaciones no cumplen con la ley No. 7600. 5. El acceso a los recintos está en mal estado y el pasadizo no esta techado. 6. La instalación eléctrica se encuentra en mal estado. Es obsoleta, generando en varias ocasiones cortos circuitos que ponen en evidencia la posibilidad de un incendio. 7. Las baterías sanitarias son insuficientes para los 132 estudiantes que se atienden y las mismas no son idóneas para la atención de escolares, están en mal estado. 8. Tal cual lo evidencia la inspección del arquitecto Morales (Informe Diagnóstico Preliminar, DIEE-DDIE-0653-2014), en el apartado “Riesgo Institucional Social”, p. 3, la escuela El Peje se cataloga como “riesgo seguridad ciudadana”. Además se indicó que el 24 de febrero de 2023 se activó el Protocolo de Evacuación de Estudiantes de las aulas. La instalación eléctrica colapsó y se hizo un corto circuito produciendo un conato de incendio que fue controlado por la Unidad de Bomberos de Costa Rica, sede Buenos Aires, quienes ratificaron que es necesario el proyecto de escuela nueva. Por lo anterior solicitó su colaboración para interponer las gestiones necesarias para concretar el proyecto de escuela nueva El Peje. Además conocer el avance real del proyecto y un plazo estimado para la consolidación (informe de la autoridad recurrida competente).
• d)En Orden Sanitaria MS-DRRSBRU-DARS-BA-OS-0059-2023 emitida por el Área de Salud de Buenos Aires se constaron una serie de deficiencias en la Escuela El Peje (informe del Área Rectora de Salud de Buenos).
• e)En oficio DREGT-SCE-02-0056-2023 del 25 de abril de 2023, el Supervisor Centros Educativos Circuito 02 solicitó al Director y a la Junta de Educación de la Escuela El Peje cumplir con lo ordenado en la orden sanitaria MS-DRRSBRU-DARS-BA-OS-0059- 2023 Escuela El Peje elaborando un plan remedial, sino lo hubiese realizado y dar seguimiento (informe de la autoridad recurrida competente).
• f)El 03 de noviembre de 2023 personeros de la Director Regional de la Dirección Regional Grande del Térraba realizaron una reunión con funcionarias de la Dirección de Infraestructura Educativa del MEP en la cual se expusieron las necesidades de infraestructura de centros educativos de la Dirección Regional de Educación de Grande del Térraba que requieren atención urgente por parte de la DIE. Entre las necesidades urgentes de centros educativos que se analizan en dicha reunión destaca La Escuela Peje, código 0846, perteneciente al Circuito 02, ubicado en el distrito de Volcán (informe de la autoridad recurrida competente).
• g)Que ante la Dirección de Infraestructura Educativa del Ministerio de Educación Pública existe un proyecto asociado a este Centro Educativo para la construcción de obra nueva y mantenimiento de La Escuela El Peje que se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas h) El proyecto de construcción de La Escuela El Peje dispone de planos constructivos recién aprobados y sellados por APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Actualmente se realizan las gestiones para obtener la viabilidad ambiental del proyecto ante la Secretaría Técnica Nacional Ambiental (SETENA). La Junta de Educación dispone de ₡9,040,000.00 en la Caja Única del Estado para pago de servicios profesionales. El costo total del proyecto asciende aproximadamente a los ₡456,782,515.75 (de acuerdo con presupuesto referencial), por lo que se debe gestionar la solicitud de recursos en el primer trimestre de 2025, permitiendo el inicio de las obras en el segundo semestre de 2025 (informe de la autoridad recurrida competente).
• i)El 19 de marzo del 2024, se realizó visita en conjunto con ingeniero Regional Marvin Salamanca, quien el 19 de abril del 2024 suscribe el informe MS-DRRSBRU-URS-IT-38- 2024 que detalla: “Es criterio de esta Unidad de Rectoría declarar el pabellón principal de la Escuela El Peje inhabitable por peligroso al haber ya sobrepasado su vida útil, en lo que respecta a las cuatro aulas adicionales del segundo pabellón estas deberán ser reparadas sus estructuras de techos y cubiertas, el gimnasio en lo que respecta a la instalación eléctrica, debe ser revisada por un profesional en la materia y de ser necesario realizar medidas correctivas. Aparte se le recomienda al Área Rectora de Salud proceder con la metodología aprobada para declaraciones de inhabitabilidad de edificaciones públicas” (informe de la autoridad recurrida competente).
• j)En oficio MS-DRRSBRU-DARS-BA-0185-2024 del 5 de agosto de 2024, el Área Rectora de Salud de Buenos Aires elevó a la Dirección Regional el informe técnico MS-DRRSBRU-DARS-BA-IT-0314-2024 y siguiendo los protocolos internos se solicita la valoración para la clausura de alto impacto del centro educativo El Peje (informe de la autoridad recurrida competente).
• k)Que la orden sanitaria MS-DRRSBRU-DARSBA-OS-0059-2023 no ha sido cumplida (informe del Área Rectora de Salud de Buenos).

III.- SOBRE EL DERECHO A GOZAR DE UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO EN LOS CENTROS DE EDUCACIÓN. Esta Sala, en Sentencia N° 2019-3032 de las 9:45 horas de 22 de febrero de 2019, indicó lo siguiente: “III.- Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan. Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa”.

IV.- CASO CONCRETO. Del informe rendido bajo juramento por las autoridades recurridas, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que en oficio DREGT-SCE-02-0032-2023 del 24 de febrero de 2023, el Supervisor, Centros Educativos Circuito 02 solicitó a la Directora Dirección de Infraestructura Educativa: “1. Oficio CEEP846-016-2023, donde el director de la Esc. El Peje MSc. Roberto Granados Chavarría enumera, describe y comenta el escenario generado por la mala infraestructura de dicho centro educativo. 2. Se adjuntan a este oficio y correo una serie de documentos y planos donde se demuestran las gestiones realizadas durante los últimos ocho años sobre el caso específico de la construcción del centro educativo: 1. Diagnóstico DDIE_0653_2014_C0846_Escuela El Peje_IDP_18.12.2014 2. DIEE-DDIE-214-2017_18 INST L2 Y L3_ORDEN DE INICIO_31.03.2017 3. DIEE-DDIE-231-2017_18 INST L2 Y L3_DETALLE PROCESO_31.03.2017 4. VISITA INGENIEROS DIEE_ 22.05.2017 5. VISITA DIEE_13.01.2018 6. DIEE-DDIE-782-19_18 CS_O.I Etapa 2_L2_03.09.2019 7. Planos_constructivos_10.2019 8. Diseño Escuela Nueva El Peje_2021 3. Dejo constancia de la preocupación del director del centro educativo y este servidor sobre el peligro que presenta para los estudiantes, personal docente y administrativo y comunidad educativa de la Escuela El Peje código 0846 la situación descrita y reportada en estos documentos. 4. Solicito un informe detallado sobre cuál es el avance que ha tenido el proceso del Proyecto de la construcción de la escuela El Peje código 0846, Circuito 02 Dirección Regional de Educación Grande del Térraba. Así las cosas, solicito sus buenos oficios, colaboración y realizar las gestiones que permitan buscar una estrategia para encontrar la solución a esta problemática”. Posteriormente, en oficio del 1 de marzo de 2023, el Director de la Escuela El Peje solicitó a la Dirección de Infraestructura del Ministerio de Educación Pública que “Desde el 2014 y hasta la fecha, la dirección escolar y la junta de educación han gestionado el proyecto escuela nueva El Peje, sin embargo, lo lento de la tramitología y la poco respuesta de ejecución ha provocado que en 2023 el centro educativo se encuentre en condiciones vulnerables. La instalación eléctrica colapsó y se hizo un corto circuito produciendo un conato de incendio que fue controlado por la Unidad de Bomberos de Costa Rica, sede Buenos Aires, quienes ratificaron que es necesario el proyecto de escuela nueva. Por lo anterior solicitó su colaboración para interponer las gestiones necesarias para concretar el proyecto de escuela nueva El Peje. Además conocer el avance real del proyecto y un plazo estimado para la consolidación. En oficio DREGT-SCE-02-0056-2023 del 25 de abril de 2023, el Supervisor Centros Educativos Circuito 02 solicitó al Director y a la Junta de Educación de la Escuela El Peje cumplir con lo ordenado en la orden sanitaria MS-DRRSBRU-DARS-BA-OS-0059- 2023 Escuela El Peje elaborando un plan remedial, sino lo hubiese realizado y dar seguimiento. Por otra parte, se constata que el 03 de noviembre de 2023 personeros de la Director Regional de la Dirección Regional Grande del Térraba realizaron una reunión con funcionarias de la Dirección de Infraestructura Educativa del MEP en la cual se expusieron las necesidades de infraestructura de centros educativos de la Dirección Regional de Educación de Grande del Térraba que requieren atención urgente por parte de la DIE. Entre las necesidades urgentes de centros educativos que se analizan en dicha reunión destaca La Escuela Peje, código 0846, perteneciente al Circuito 02, ubicado en el distrito de Volcán. Además, ante la Dirección de Infraestructura Educativa del Ministerio de Educación Pública existe un proyecto asociado a este Centro Educativo para la construcción de obra nueva y mantenimiento de La Escuela El Peje que se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas. El proyecto de construcción de La Escuela El Peje dispone de planos constructivos recién aprobados y sellados por APC, Colegio Federado de Ingenieros y de Arquitectos (CFIA). Actualmente se realizan las gestiones para obtener la viabilidad ambiental del proyecto ante la Secretaría Técnica Nacional Ambiental (SETENA). La Junta de Educación dispone de ₡9,040,000.00 en la Caja Única del Estado para pago de servicios profesionales. El costo total del proyecto asciende aproximadamente a los ₡456,782,515.75 (de acuerdo con presupuesto referencial), por lo que se debe gestionar la solicitud de recursos en el primer trimestre de 2025, permitiendo el inicio de las obras en el segundo semestre de 2025. De los hechos expuestos, la Sala logra concluir que las autoridades del Ministerio de Educación Pública han lesionado abiertamente los derechos fundamentales de los estudiantes y docentes del centro educativo recurrido, pues la Escuela El Peje se encuentra en muy mal estado. Cabe señalar que este Tribunal no desconoce que deben realizarse trámites y cumplirse requisitos técnicos para este tipo de proyectos; sin embargo, el plazo transcurrido -y el que resta por esperar- resulta excesivo e irrazonable, violentando los derechos fundamentales de los estudiantes y personal docente del centro educativo, motivo por el cual en cuanto a dicha autoridad se declara con lugar el recurso.

V.- Por otra parte, se acredita que en Orden Sanitaria MS-DRRSBRU-DARS-BA-OS-0059-2023 el Área de Salud de Buenos Aires se constaron una serie de deficiencias en la Escuela El Peje. Además, se constata que 19 de marzo del 2024, se realizó visita en conjunto con ingeniero Regional Marvin Salamanca, quien el 19 de abril del 2024 suscribe el informe MS-DRRSBRU-URS-IT-38- 2024 que detalla: “Es criterio de esta Unidad de Rectoría declarar el pabellón principal de la Escuela El Peje inhabitable por peligroso al haber ya sobrepasado su vida útil, en lo que respecta a las cuatro aulas adicionales del segundo pabellón estas deberán ser reparadas sus estructuras de techos y cubiertas, el gimnasio en lo que respecta a la instalación eléctrica, debe ser revisada por un profesional en la materia y de ser necesario realizar medidas correctivas. Se recomienda al Área Rectora de Salud girar orden sanitaria para que el pabellón principal sea demolido y en su lugar construir uno nuevo, en lo que respecta a las mejoras a efectuar en el segundo pabellón y gimnasio se les estará girando un tiempo prudencial para que se ejecuten. Aparte se le recomienda al Área Rectora de Salud proceder con la metodología aprobada para declaraciones de inhabitabilidad de edificaciones públicas”. En oficio MS-DRRSBRU-DARS-BA-0185-2024 del 5 de agosto de 2024, el Área Rectora de Salud de Buenos Aires elevó a la Dirección Regional el informe técnico MS-DRRSBRU-DARS-BA-IT-0314-2024 y siguiendo los protocolos internos se solicita la valoración para la clausura de alto impacto del centro educativo El Peje. Además, el Área Rectora de Salud de Buenos Aires informó bajo juramento que la orden sanitaria MS-DRRSBRU-DARSBA-OS-0059-2023 no ha sido cumplida. Lo anterior evidencia que la actuación de las autoridades del Ministerio de Salud han sido insuficientes en detrimento de los derechos fundamentales del personal y estudiantes de la escuela en cuestión. Por estas razones, estima este Tribunal que existe una cuota de responsabilidad por parte del Ministerio de Salud en este asunto y, por ello, también se acoge el recurso en su contra.

VI.- VOTO SALVADO PARCIAL DE LA MAGISTRADA GARRO VARGAS RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso, concerniente a la primera orden emitida en la parte dispositiva, es decir, para que en el plazo de doce meses, contado a partir de la notificación de esta sentencia, se realice la construcción de la Escuela El Peje, la cual se localiza en la comunidad de El Peje, en el distrito de Volcán, cantón Buenos Aires de la provincia de Puntarenas. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

VII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a Lourdes Sáurez Barboza, en su condición de Directora de la Dirección de Infraestructura Educativa y a Gabriel Emilio Mora Monge, en su condición de Director Regional de la Dirección Regional Grande del Térraba, ambos personeros del Ministerio de Educación Pública, o a quienes en su lugar ocupen los cargos, que giren las directrices necesarias, en el respectivo ámbito de sus competencias, y gestionen lo correspondiente para que, en el plazo máximo de DOCE MESES contado a partir de la notificación de esta sentencia, se realice la construcción de la Escuela El Peje. Dicho inmueble deberá garantizar el derecho a salud, y un ambiente sano y adecuado para la educación de los estudiantes de ese centro educativo. Asimismo, mientras se toman las decisiones definitivas, deberán adoptar y ejecutar DE INMEDIATO, las medidas necesarias de carácter provisional que permitan la continuidad y el desarrollo de las lecciones y demás actividades educativas, a fin de obstaculizar el proceso educativo de los estudiantes. Por otra parte, se ordena a Randall Bejarano Campos, en su condición de Director del Área Rectora de Salud de Buenos Aires, o a quien en su lugar ocupe ese cargo, que dentro del plazo máximo de QUINCE DÍAS, contados a partir de la notificación de esta sentencia, de ser necesario nuevamente, gire las órdenes sanitarias pertinentes para proteger la vida, integridad física y salud de los menores de edad que asisten actualmente a la escuela, así como del personal docente y administrativo. Deberá darle seguimiento continuo y permanente al cumplimiento de dichas órdenes sanitarias en los plazos que así se dispongan, procurando su cumplimiento y, en caso de que no se cumplan, tomar oportunamente las medidas pertinentes para sentar responsabilidades a los funcionarios omisos. Lo anterior bajo apercibimiento que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
