Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on July twelve, two thousand twenty-four.
Writ of amparo (recurso de amparo) filed by [Nombre62 001], identity card [CED01 ], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA) AND THE ASOCIACIÓN DE ACUEDUCTOS DE CIPRESES DE OREAMUNO DE CARTAGO.
Findings of Fact:
On the other hand, there are health orders (órdenes sanitarias) and amparo actions (recursos de amparo) filed against the ASADA of Cipreses de Oreamuno. For example, Health Order MS-DRRSCEDARSO-OS-0091-2022, mentioned in the official letter submitted by the ASADA, states the following: “Immediately communicate to the community of Cipreses, correctly and assertively and through as many channels as possible, the situation affecting the ASADA of Cipreses regarding metabolites of the pesticide chlorothalonil and the application of the precautionary principle (principio precautorio), for the purpose of preventing health problems among the population, as well as supplying water by tanker trucks.” Regarding the decision of the Sala Constitucional in connection with this case, N° 2022-026065, the POR TANTO orders the following: “1) comprehensively and definitively resolve the contamination by chlorothalonil metabolites in the Nombre25392 and Carlos Calvo springs (nacientes) of the ASADA of Cipreses de Oreamuno; and 2) investigate whether the contamination problem in the aforementioned springs has harmed other communities in the area.
In the interim, the aforementioned authorities shall guarantee the supply of drinking water to the affected communities by means of tanker trucks or another alternative.” The Sala Constitucional has likewise ordered application of the precautionary principle in connection with the analyses of chlorothalonil metabolites. From a chemical standpoint, there is no basis for the ASADA to question the contamination of the springs supplying the community, and it must communicate with users in a manner consistent with these data. The course established by the committee and the technical studies related to this process was set forth in official letter GSD-UEN-GAR-2022-03379 of August 2022 and reiterated in official letter PRE-2023-01429; accordingly, the solutions proposed by the ASADA should focus on the matters requested therein and be consistent with the recommendations provided by the Institution. 4.5 Technical noncompliance by the ASADA of Cipreses de Oreamuno (operational management of the ASADA of Cipreses system).
The hydrogeological study (estudio hidrogeológico) was rejected by official letter UEN-GA-2023-02102 of the UEN Gestión Ambiental. It is therefore reiterated that approval from the UEN Gestión Ambiental is required before the proposal for the new well may begin to be evaluated, and that every new source proposed for incorporation into the drinking-water supply system administered by the ASADA Cipreses de Oreamuno under a Delegation Agreement (convenio de Delegación) with AyA must be tested for the presence of metabolites of the fungicide chlorothalonil, given that the ASADA’s two springs have been closed for human consumption under a health order issued by the Ministerio de Salud and pursuant to the precautionary principle by order of the Sala Constitucional. The conclusions from the analysis include the following: ▪ The system has a considerable water deficit, since the output of one of its main sources has declined significantly; combined with the water stress affecting the country due to the ENSO phenomenon, this creates critical conditions for the production of its sources. ▪ It is important to emphasize that, with respect to the source identified as Nombre01, the ASADA does not have the studies or the corresponding approvals required to carry out construction work, since no final proposals have been reviewed and the civil engineer responsible for the proposed works is unknown. ▪ The “Pavilla” well, formerly called the Nombre9571 Well, has connections in addition to those it initially had when the Technical Study (Estudio Técnico) for the Urb.
Las Pavillas project was reviewed, since it is that project’s main supply source; during the latest inspection, an additional branch from the well was observed, and it is unclear where that connection leads and which additional sectors it supplies. ▪ Regarding the storage tanks, the photographs supplied by ASADA personnel show algae residue resulting from stagnant water and oxygen loss, which promotes the growth of algae and mold. ▪ The Asada Cipreses de Oreamuno has not shown a willingness to work jointly with AyA and comply with the directives, recommendations, and studies that it must undertake in order to comply not only with the orders of the Sala Constitucional, but also with all matters related to the provision of the service delegated to it and the proper use of the public funds it receives. Likewise, despite the regular monthly meetings attended by the Defensoría de los Habitantes, the Municipalidad de Oreamuno, the ASADA, and AyA, there have been no coordinated actions to bring about compliance with the Mesa Tripartita, either with respect to the authorizations required under Article 45 of the Reglamento de Asadas or the investments made without the Institution’s approval. ▪ Por tanto, the Asada de Cipreses has not complied with the agreements of the Mesa Tripartita among the Municipalidad de Oreamuno, Asada de Cipreses, and the Instituto Costarricense de Acueductos y Alcantarillados. ▪ According to the financial analysis conducted by the competent professionals of the Subgerencia de Sistemas Delegados concerning both the general and financial information of the ASADA of Cipreses, it is concluded that, although this community organization reports surpluses in its Statement of Income for the 2022 and 2023 periods, there are inconsistencies in the administration of public funds.
According to its financial reports, this Association acquired land during 2023, reports investments in the “Works under Design and Construction” account, and shows an increase in current liabilities arising from short-term debt, without authorization from AyA as required by Articles 53, “Administrative Management,” and 58, “Indebtedness of the ASADAS,” of the Reglamento de ASADAS Decreto N. 42582-S-MINAE. ▪ Following the engineering assessment conducted by ORAC Central Este and the Dirección de Ingeniería of UEN Asadas concerning the findings from the field inspection in May 2024, which was conducted to determine the condition of the water intakes (captaciones) and other works, it was determined that unreliable and unsafe sources may be entering the aqueduct system. A monitoring and follow-up process must therefore be initiated to prevent possible cross-contamination by agents harmful to human health, such as the excessive levels of nitrates and nitrites present in sources not authorized for use in supplying the community, in connection with the administration, operation, and maintenance of the Asada de Cipreses and its management of the aqueduct.
An administrative act (acto administrativo) closing the control valves of the Edwin Coto and Pozo Nuevo sources is required, in coordination with the Ministerio de Salud, to prevent the use of sources that are not authorized for handling, incorporation, or utilization by the Cipreses Aqueduct supply systems. As can be seen from the statements made, the case has been subject to continuous monitoring and oversight. As reflected in meeting logs dated April 24, 2024, and June 12, 2024, among others, efforts have been made in recent months to coordinate with the ASADA regarding compliance with all technical and legal requirements, without success. Various official letters have therefore recommended resuming the administrative act whereby AyA would assume the delegated aqueduct system of the Asada Cipreses de Oreamuno by operation of law (de pleno derecho) for its administration, development, maintenance, and operation.
At the time, that act could not be carried out because of the ASADA’s refusal. As stated in the official letter dated April 23, 2021, report PRE-J-2021-01402 regarding implementation of resolution N° 2021-124 was submitted to the AyA Board of Directors. Representatives of the Dirección Jurídica and the Subgerencia de Sistemas Delegados appeared at the offices of the Asada de Cipreses de Oreamuno, where a group of approximately 40 people was present and resisted implementation of the administrative act, thereby preventing possession from being taken of the system and assets administered by the Asada de Cipreses de Oreamuno. Following representations made by the ASADA of Cipreses and the Municipalidad de Oreamuno before the AyA Board of Directors, AyA’s senior administration ordered the immediate suspension of all actions related to the case, and resolution N° 2021-383 was issued for the purpose of establishing a technical committee to prepare a final report and work with the ASADA.
The technical committee was composed of a high-level team from AyA’s Rectoría, Subgerencia de Ambiente, Investigación y Desarrollo, and Presidencia Ejecutiva. In September 2021, the “Mesa Técnica” issued its report, which was reviewed by the Board of Directors, resulting in the adoption of resolution N° 2022-64 dated February 22, 2022. That resolution directs the Subgerencia de Gestión de Sistemas Delegados to undertake a series of actions to implement an ASADA Improvement Plan (Plan de Mejoramiento de la ASADA), which the Asada Cipreses de Oreamuno has not fully complied with. This demonstrates the need for AyA to assume control of the aqueduct system in order to guarantee the provision of the public service in compliance with the principles governing it. This has not been possible because of the refusal and opposition of the ASADA to comply with the opinions, instructions, and orders issued by the Instituto, which are mandatory for ASADAS pursuant to Articles 2 subsection 27), 28 subsections a) and g), 31 subsections c), d), and e), and 105 of the Reglamento de Asadas Decreto Ejecutivo N° 42582-S-MINAE. It requests that the Chamber dismiss the amparo action.
Justice Salazar Alvarado is the reporting Justice; and,
Considering:
I.Admissibility of the proceeding. With respect to amparo proceedings brought against private parties, as is the case here, the Chamber has been clear in stating: “Because of its exceptional nature, the ordinary processing of amparo proceedings against private-law parties requires first examining whether the particular case falls within any of the circumstances that render it admissible and—subsequently, if so—determining whether or not it has merit” (Judgment N° 151-97). Article 57 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional) provides that this type of action may be granted against acts or omissions by private-law parties when they act or are required to act in the exercise of public functions or powers, or when they are, in law or in fact, in a position of power with respect to which ordinary judicial remedies are clearly insufficient or untimely to safeguard the fundamental rights or freedoms referred to in article 2, subsection a), of that same Law. In the sub judice case, the Chamber finds that the Asociación Administradora del Acueducto de Cipreses de Oreamuno is acting in the exercise of a public function; the amparo proceeding is therefore appropriate (see Judgment N° 2010-005400 at 10:15 on 19 de marzo de 2010).
II.Subject matter of the proceeding. The petitioner alleges that he purchased a lot in a single-family housing project located on the property bearing registration number located in Santiago, cantón Paraíso, provincia Cartago. He states that, at the time of purchase, the respondent ASADA guaranteed water service for thirty-eight lots in that project, including his own; however, several months ago he asked the ASADA to install his potable-water service connection, whereupon he was told: “(…) there is insufficient water capacity, based on the flow-measurement records (registro de aforos), which state verbatim that a considerable decrease in the sources is evident. The foregoing restriction shall remain in place until the Asada has updated technical and hydrogeological studies, technically and legally sufficient for the sustainability of the service and duly reviewed and approved by AyA (…)”; this infringes his right of access to potable water.
III.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven as such or because the respondent failed to address them as ordered in the initial ruling:
IV.Technical impossibilities hindering the supply of potable water. In Judgment N° 2010-001516 at 18:36 on 26 de enero de 2010, this Chamber addressed technical or legal impossibilities affecting the provision of potable-water service. On that occasion, it held as follows:
“IV.- The legal or formal impossibility of providing potable-water service does not violate fundamental rights.- This Chamber has repeatedly held that, under the Costa Rican legal system, the supply of potable water is considered a public service and that, as such, every public-service provider—whether a public or private party—is required to provide the service continuously and efficiently, under conditions of equality, and must adapt to technological changes (see, in this regard, Judgment 2001-09676 at eleven twenty-five on veintiséis de setiembre del dos mil uno and Judgment 2004-08161 at ten fifty-three on veintitrés de julio del dos mil cuatro). In this regard, it is clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public service of potable water, is also required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants.
Nevertheless, despite everything just established, the case law of this Constitutional Court has also held that, when there is a legal impossibility (meaning failure to satisfy requirements established in the applicable regulations) or a formal impossibility (meaning the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when no potable-water distribution network exists and infrastructure must be built. Thus, in such cases, it has been made clear that this does not constitute a denial of access to potable-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impossibility, namely, the lack of infrastructure. AyA, as a state entity primarily responsible for providing potable-water service, is of course under an obligation to continue expanding its infrastructure so that ever more people may gain access to this precious resource; however, while gaps remain, the cooperation of the interested parties is essential (see rulings Nº 2006-014218 at fifteen oh-four on veintiséis de septiembre del dos mil seis and Nº 2007-11190 at fourteen thirty-six on siete de agosto del dos mil siete).
In other words, provided that the failure to supply potable-water service is not capricious, arbitrary, or unfounded, but is instead justified by a legal or material impossibility, there is no violation of fundamental rights.”
V.Regarding the specific case. In this matter, the petitioner alleges that he acquired a lot in a single-family housing project located on the registered property situated in Santiago, canton of Paraíso, province of Cartago. He states that, at the time of purchase, the respondent ASADA guaranteed water service for thirty-eight lots in that project, including his own; however, several months ago, he asked the ASADA to install a potable water service connection (paja de agua), and was told: “(…) there is insufficient water capacity, based on the flow-measurement records, which expressly indicate that a considerable decrease can be observed in the sources. The foregoing restriction shall remain in effect until the ASADA has technically and legally updated technical and hydrogeological studies concerning the sustainability of the service, duly reviewed and approved by AyA (…)”; this infringes his right of access to potable water.
In this regard, the Chamber finds it proven that, by email dated February 24, 2024, the petitioner requested the installation of a meter or water service connection for the purpose of carrying out a housing project in Nombre02, located in the district of Cervantes, Paraíso. However, through official letter N° AC-039-2024, the protected party was notified of the reasons why water availability was being denied at that time, since a restriction had been established by several sanitary orders (órdenes sanitarias) issued by the Ministerio de Salud; accordingly, until that ministry lifts those sanitary orders, the aqueduct cannot issue water-availability certifications. Following the evidence ordered by the Chamber for a more informed decision (prueba para mejor resolver) in this amparo proceeding (recurso de amparo), this Court finds two matters important to the resolution of this case to have been proven: first, that pursuant to sanitary orders numbers 0092-2022 and 0093-2022, issued by the Ministerio de Salud on October 20, 2022, the Instituto Costarricense de Acueductos y Alcantarillados was ordered to: “Urgently inform the community of Cipreses, accurately and assertively and through as many channels as possible, of the situation affecting the ASADA de Cipreses concerning the metabolites of the pesticide Chlorothalonil and the application of the precautionary principle (principio precautorio), for the purpose of preventing health problems among the population, as well as the supply of water by tanker trucks.
(…)” Second, that those sanitary orders were required to be complied with immediately. In view of these circumstances, the Chamber considers that the petition must be granted. As the case law of this Constitutional Court has stated, when there is a legal impediment (imposibilidad jurídica)—that is, failure to comply with requirements established in the applicable regulations—or a formal impediment (imposibilidad formal)—that is, the absence of a water-distribution network—it is reasonable not to grant service requests. Thus, in such cases, it has been made clear that this does not constitute a denial of access to potable water service, but rather an inability to provide it or the need for the interested party to participate in removing a technical or legal impediment. In the sub examine, although sufficient water capacity and approval from the competent agencies apparently existed when the lot was purchased, the fact remains that, pursuant to sanitary orders numbers 0092-2022 and 0093-2022, issued by the Ministerio de Salud on October 20, 2022, contamination was detected in the ASADA de Cipreses aqueduct, and the distribution of potable water by tanker trucks was even ordered.
Nevertheless, this Chamber notes that those sanitary orders were issued by the Ministerio de Salud in 2022, that is, two years ago; moreover, according to the explanation provided by the Ministra de Salud in the evidence ordered for a more informed decision, those sanitary orders were required to be complied with immediately. The Chamber therefore questions why the ASADA continues to deny new public potable water services on the basis of those sanitary orders, when they date from 2022 and required immediate compliance. It is therefore highly likely that the circumstances have since changed, given that two years have elapsed since the situation involving the ASADA de Cipreses aqueduct was described. On that understanding, the Chamber considers it appropriate to grant the amparo petition solely for the purpose of requiring AyA and ASADA de Cipreses to coordinate with the Ministerio de Salud to determine whether the situation set forth in the cited sanitary orders continues to exist as of this date; otherwise, they shall work with ASADA de Cipreses to enable new water services, including that of the petitioner, provided that the other established legal requirements are met.
This Chamber must advise the parties that, if they submitted any paper documents, objects, or evidence stored on any additional device or by electronic, computer, magnetic, optical, or telematic means, or produced using new technologies, such materials must be retrieved from the court office within thirty business days after notification of this judgment is received; otherwise, all such materials shall be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial N°19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on May 03, 2012, article LXXXI.
POR TANTO:
The petition is granted. Vladimir Mesén Montenegro, in his capacity as Head of the Oficina Regional Central Este de Atención de ASADAS de Acueductos y Alcantarillados, and Virgilio Ulloa Ulloa, in his capacity as President and General Attorney-in-Fact with a Monetary Limit (Apoderado Generalísimo con Límite de Suma) of ASADA de Cipreses de Oreamuno de Cartago, or whoever may hold those offices in their stead, are ordered to issue the appropriate directives and undertake all actions within the scope of their authority so that, within THREE MONTHS from notification of this judgment, they coordinate with the Ministerio de Salud to determine whether the situation set forth in sanitary orders numbers 0092-2022 and 0093-2022, issued on October 20, 2022, continues to exist as of this date; otherwise, they shall work with ASADA de Cipreses to enable new water services, including that of the petitioner, provided that the other established legal requirements are met.
The respondent authorities are warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados and ASADA de Cipreses are ordered to pay the costs, damages, and losses caused by the events underlying this judgment, which shall be assessed in the enforcement of the judgment before the administrative-litigation and civil jurisdictions, respectively.- Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del doce de julio de dos mil veinticuatro .
Recurso de amparo interpuesto por [Nombre62 001], cédula de identidad [CED01 ], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA) Y LA ASOCIACIÓN DE ACUEDUCTOS DE CIPRESES DE OREAMUNO DE CARTAGO.
Resultando:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Admisibilidad del recurso. Tratándose de acciones de amparo dirigidas contra sujetos privados, como es aquí el caso, la Sala ha sido clara al decir: "Por su excepcional naturaleza, el trámite ordinario de los recursos de amparo contra sujetos de derecho privado exige comenzar por examinar si, en la especie, estamos o no ante alguno de los supuestos que lo hacen admisible, para –posteriormente y en caso afirmativo– dilucidar si es estimable o no" (Sentencia N° 151-97). Establece el artículo 57, de la Ley de la Jurisdicción Constitucional, que esta clase de demandas se conceden contra las acciones u omisiones de sujetos de derecho privado cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a), de la misma Ley. En el sub judice, considera la Sala que la Asociación Administradora del Acueducto de Cipreses de Oreamuno está actuando en ejercicio de una función pública por lo que resulta procedente el amparo (ver Sentencia N° 2010-005400 de las 10:15 horas del 19 de marzo de 2010).
II.Objeto del recurso. La parte recurrente alega que adquirió un lote en un proyecto de vivienda unifamiliar, el cual se ubica en la propiedad matricula de número localizada en Santiago, cantón Paraíso, provincia Cartago. Comenta que al momento de la compra, la ASADA recurrida garantizó el agua para treinta y ocho lotes de dicho proyecto, incluyendo el suyo; empero, hace algunos meses solicitó a la ASADA que le instalara la disponibilidad del servicio de agua potable, siendo que se le indicó: "(…) hay una incapacidad hídrica y se basa en el registro de aforos, y que textualmente indica, se visualiza una disminución considerable en las fuentes. La anterior restricción se mantendrá, hasta tanto la Asada cuente con los estudios técnicos e hidrogeológicos actualizados técnica y legal para la sostenibilidad del servicio debidamente revisados y aprobados por el AyA (…)", lo cual lesiona su derecho de acceso al agua potable.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre las imposibilidades técnicas que obstaculizan el abastecimiento de agua potable. Esta Sala, en Sentencia N° 2010-001516 de las 18:36 horas del 26 de enero de 2010, se refirió a lo relativo a las imposibilidades técnicas o legales para brindar el servicio de agua potable. En esa oportunidad estableció lo siguiente:
“IV.- Sobre como la imposibilidad jurídica o formal para dotar del servicio de agua potable no es violatorio de derechos fundamentales.- Reiterada jurisprudencia de esta Sala ha indicado que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos –sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). En este sentido, resulta claro concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargado de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes.
Ahora bien, a pesar de todo lo que se acaba de establecer, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. Por supuesto, el AyA como un ente estatal encargado mayormente de la prestación del servicio de agua potable, tiene la obligación de ir expandiendo su infraestructura para que tengan acceso a este preciado líquido cada vez más y más personas, pero mientras queden vacíos resulta indispensable la colaboración de los interesados (véase las resoluciones Nº 2006-014218 de las quince horas y cuatro minutos del veintiséis de septiembre del dos mil seis y Nº 2007-11190 de las catorce horas y treinta y seis minutos del siete de agosto del dos mil siete).
En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales”.
V.Sobre el caso concreto. En la especie, la parte recurrente alega que adquirió un lote en un proyecto de vivienda unifamiliar, el cual se ubica en la propiedad matricula de localizada en Santiago, cantón Paraíso, provincia Cartago. Comenta que al momento de la compra, la ASADA recurrida garantizó el agua para treinta y ocho lotes de dicho proyecto, incluyendo el suyo; empero, hace algunos meses solicitó a la ASADA que le instalara la disponibilidad del servicio de agua potable, siendo que se le indicó: "(…) hay una incapacidad hídrica y se basa en el registro de aforos, y que textualmente indica, se visualiza una disminución considerable en las fuentes. La anterior restricción se mantendrá, hasta tanto la Asada cuente con los estudios técnicos e hidrogeológicos actualizados técnica y legal para la sostenibilidad del servicio debidamente revisados y aprobados por el AyA (…)", lo cual lesiona su derecho de acceso al agua potable.
Al respecto, la Sala tiene por demostrado que el recurrente solicitó, vía correo electrónico, en fecha 24 de febrero del año 2024, la instalación de un medidor o paja de agua con la intención de realizar un proyecto de vivienda en Nombre02 ubicada en el distrito de Cervantes Paraíso. Sin embargo, mediante oficio N° AC-039-2024, se le notificó al amparado las razones por las cuales se le niega la disponibilidad de agua en este momento, pues existe una restricción establecida por varias órdenes sanitarias emitidas por el Ministerio de Salud, de manera que hasta que el ministerio aludido no levante las órdenes sanitarias, ese acueducto no puede brindar certificaciones de disponibilidad. Luego de la prueba para mejor resolver ordenada por la Sala dentro de este amparo, este Tribunal tiene por demostrados dos aspectos importantes para la resolución de este asunto: primero, que en virtud de las órdenes sanitarias números 0092-2022 y 0093-2022, emitidas por el Ministerio de Salud en fecha 20 de octubre del 2022, se ordenó al Instituto Costarricense de Acueductos y Alcantarillados: “Comunicarle urgentemente a la comunidad de Cipreses de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA de Cipreses, sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio precautorio, con la finalidad de prevenir problemas de salud en la población, así como el suministro del agua por medio de cisternas.
(…)”. Segundo, que dichas órdenes sanitarias se debían cumplir en un plazo inmediato. Ante este panorama, la Sala estima que se debe declarar con lugar el recurso. Como lo ha señalado la jurisprudencia de este Tribunal Constitucional, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una red de distribución de aguas), es razonable no atender las solicitudes de servicio. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica o jurídica. En el sub examine, pese a que en el momento de la compra del lote, aparentemente sí se contaba con capacidad hídrica y el aval de las dependencias competentes, lo cierto del caso es que en virtud de las órdenes sanitarias número 0092-2022 y 0093-2022, emitidas por el Ministerio de Salud en fecha 20 de octubre del 2022, se detectó una situación de contaminación en el acueducto de la ASADA de Cipreses, siendo que inclusive se ordenó la distribución de agua potable mediante camiones cisternas.
Ahora bien, esta Sala aprecia que dichas órdenes sanitarias fueron emitidas por el Ministerio de Salud desde el año 2022, es decir, hace dos años; además, según lo explicado por la Ministra de Salud en la prueba para mejor resolver, dichas órdenes sanitarias debías ser acatadas de manera inmediata. De este modo, salta la duda a la Sala sobre las razones por las cuales la ASADA continúa denegando nuevos servicios públicos de agua potable, bajo el argumento de la existencia de dichas órdenes sanitarias, cuando las mismas datan del año 2022 y su cumplimiento era inmediato. De allí que es muy probable que, para este momento, el escenario haya cambiado, pues han transcurrido dos años desde la situación descrita con el acueducto de la ASADA de Cipreses. Bajo esa inteligencia, estima la Sala que lo propio es acoger el amparo, únicamente con el propósito que el AyA y la ASADA de Cipreses coordinen con el Ministerio de Salud a efectos de establecer si la situación establecida en las citadas órdenes sanitarias se mantiene a la fecha, caso contrario, procurar con la ASADA de Cipreses la habilitación de los nuevos servicios de agua, entre ellos el del recurrente, en la medida que se cumplan con los demás requisitos legales establecidos.
Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 03 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se le ordena a Vladimir Mesén Montenegro, en su calidad de Jefe de la Oficina Regional Central Este de Atención de ASADAS de Acueductos y Alcantarillados, y a Virgilio Ulloa Ulloa, en su condición de Presidente y Apoderado Generalísimo con Límite de Suma de la ASADA de Cipreses de Oreamuno de Cartago, o a quienes en sus lugares ocupen dichos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de su competencia para que, dentro del plazo de TRES MESES, contado a partir de la notificación de esta sentencia, coordinen con el Ministerio de Salud a efectos de establecer si la situación establecida en las órdenes sanitarias números 0092-2022 y 0093-2022, emitidas en fecha 20 de octubre del 2022, se mantiene a la fecha; caso contrario, procurar con la ASADA de Cipreses la habilitación de los nuevos servicios de agua, entre ellos el del recurrente, en la medida que se cumplan con los demás requisitos legales establecidos.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados y a la ASADA de Cipreses al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo, y civil, respectivamente.- Fernando Castillo V.
