De ahí que al margen de que con ocasión de este recurso, el ente local recurrido planteara formalmente una denuncia procurando la clausura del establecimiento por carecer de los requisitos legales, consintió la actividad por muchos meses. Bajo esta inteligencia, estima la Sala que se produjo la infracción acusada. En lo que atañe al Área Rectora de Salud de Santo Domingo de Heredia, echa de menos la Sala el seguimiento oportuno de la noticia dada por funcionarios del ministerio recurrido, en cuanto a que se estaba valorando utilizar el Nombre02 como escombrera, puesto que lo único que se indicó sobre el particular fue que, dado que se consideraba esta una actividad nueva, se debía contar con los permisos respectivos. En este particular, el hecho que no existiera denuncia alguna o solicitud de permiso para realizar la actividad, no le eximía de iniciar las acciones que echa de menos la parte actora, para garantizar su derecho a un ambiente sano y ecológicamente equilibrado, máxime que por oficio No. MS-DRRSSCN-DARSSD-IT-429-2021 de 26 de marzo de 2021, se notificó al Ministerio de Obras Públicas y Transportes que debería solicitar el permiso de funcionamiento al Ministerio de Salud y a la Municipalidad de Santo Domingo, gestión que nunca realizó. En este sentido, si bien con ocasión de las gestiones del ente local recurrido que se previno nuevamente al ministro de Obras Públicas y Transportes, que pusiera en regla la actividad y aportara el Permiso Sanitario de Funcionamiento, ese proceder no es más que una muestra de la desatención reclamada, pues no solo se produjo mucho tiempo después de la primera prevención, sino que permite acreditar que las acciones correctivas reclamadas no se tomaron oportunamente como se ameritaba. Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at fourteen hours zero minutes on treinta de julio de dos mil veinticuatro.
Amparo proceeding (recurso de amparo) processed under case number 24-015790- 0007-CO, filed by [Nombre01 001], identity card [CED01], against the MUNICIPALIDAD DE SANTO DOMINGO DE HEREDIA.
RESULTS:
2[Nombre01 006]By order issued at 09:44 hours on 14 de junio de 2024, this amparo proceeding was admitted for consideration.
“(…) a) As recorded in the Minutes of Ordinary Session N°20-2021 held on 6 de abril del 2021, under Article I, the Concejo Municipal received Engineer Carlos Martí, Technical Director of Circunvalación Norte, at a hearing (PROJECT: CIRCUNVALACIÓN NORTE; CONSORTIUM: [Nombre 002]; SUBJECT: ESCOMBRERA TAJO MONTANO). At that proceeding, a formal presentation regarding the aforementioned project was made, as evidenced by the cited Minutes and the presentation attached as evidence to this report. That presentation did, in fact, concern the use by the successful bidder of the property owned by the Ministerio de Obras Públicas (ESCOMBRERA TAJO MONTANO) to deposit material that would come, and currently comes, from construction of the Circunvalación Norte ring road. The record of this presentation includes statements by the Alcalde Municipal and the Presidencia del Concejo Municipal for that term (…) b) Based on the foregoing background and the facts alleged by the appellant, the following is established: • It is true that, during Ordinary Session N°20-2021 held on 6 de abril del 2021, under Article I, the Concejo Municipal received Engineer Carlos Martí, Technical Director of Circunvalación Norte, at a hearing. • PARTIALLY TRUE.
The Municipalidad, through the Departamento de Catastro, as the body ‘(…) I oppose the proceeding filed. The matter referred to by the appellant involved a good-fa action through which the Municipalidad was informed of the activities to be carried out by the State on that property in connection with the widely known Circunvalación Norte Project. The fact is that no municipal agreement or resolution exists in favor of any private company. Rather, the State (MOPT) owns registered property where, according to information provided by the Departamento de Catastro Municipal by email dated 3 de junio of this year, quarrying (TAJO) activities had been conducted and a considerable amount of material had been removed; in 2021, land-use authorization was requested for filling and use as a rubble dump, which is essentially the reverse process. Attached to that email was land-use authorization 343-21, which states that use as a rubble dump at the site where the property is located IS COMPLIANT.
In this regard, the activity is permissible under the zoning rules and therefore requires only the authorizations of the Ministerio de Salud and SETENA, in accordance with their respective powers, as stated in the LAND-USE AUTHORIZATION document itself. The SETENA Environmental Permit (Permiso Ambiental) for the Circunvalación Norte project, which includes rubble disposal as a secondary activity, was attached to the land-use authorization application: RESOLUCIÓN 734- 2020-SETENA of 13 hours 25 minutes on 22 de abril del 2020. The appellant had requested information in this regard, and unfortunately, although the case was being reviewed internally and information was being obtained, a formal response containing the documents collected and referenced had not been sent directly to the appellant. The Contraloría de Servicios sent it to Mr. Luis Paulino Madrigal Rodríguez (who belongs to the same community organization), but not to the appellant.
In any event, it is reported that the response was issued today after instructions were given for it to be prepared immediately, and the relevant evidence is attached. Finally, after receiving a response today from the SALUD office in Santo Domingo stating that no sanitary operating permit (permiso sanitario de funcionamiento) exists for the property Nombre02, we formally filed a complaint with that authority so that, pursuant to its powers under the Ley General de Salud, it may close the establishment operating without a sanitary permit. (…)’.” The official requests that the proceeding be dismissed.

7. By decision issued at 22:23 hours on 3 de julio de 2024, the proceeding was deemed expanded to include the Área Rectora de Salud del Santo Domingo de Heredia.
Magistrada Hess Herrera drafts the opinion; and,
WHEREAS:
The petitioner states that, since 6 de abril de 2021, the Municipalidad de Santo Domingo de Heredia, at its ordinary virtual session 20- 2021, granted the company [Nombre 002] a permit and land-use authorization (uso de suelo) to deposit waste from the Circunvalación Norte project on land owned by the Ministerio de Obras Públicas y Transportes, known as Escombrera Montano, located at Dirección01, in Santa Rosa de Santo Domingo de Heredia, and bordering the río Virilla watershed (cuenca). The petitioner argues that the property has been subject to a sanitary closure (cierre sanitario) imposed by the Ministerio de Salud since 2014 to control the illegal dumping of rubble and waste from the region, and that it was reopened for the deposit of new rubble, resulting in the passage of approximately 60 and 80 dump trucks each day, which cause traffic congestion and pollution and adversely affect the population.
The following facts are deemed duly proven and relevant to the resolution of this matter, either because they have been substantiated or because the respondent authority failed to address them, as directed in the initial order:
In this case, the petitioner states that, since 6 de abril de 2021, the Municipalidad de Santo Domingo de Heredia, at its 20- 2021 ordinary virtual session, granted [Nombre 002] a permit and land-use authorization (uso de suelo) to deposit waste from the Circunvalación Norte project on land owned by the Ministry of Public Works and Transportation, known as Escombrera Montano, located at Dirección01 in Santa Rosa de Santo Domingo de Heredia and adjoining the río Virilla watershed (cuenca). The petitioner argues that the Ministry of Health had placed that land under a health closure (cierre sanitario) since 2014 to control the illegal dumping of construction debris and waste from the region, and that it was reopened for the deposit of additional debris, resulting in the passage of approximately 60 to 80 dump trucks daily, which cause traffic congestion and pollution and affect the population.
It should first be noted that, with respect to the closure of Nombre02 as an illegal disposal site for construction debris and waste, the allegation bears no relation whatsoever to the issue in these proceedings because, as may be inferred from the report of the Santo Domingo Health Governing Area, those events concerned the use of the property by third parties who dumped and burned waste at the site. In this regard, Health Order no. 077-2016 ordered the respondent ministry to do the following: “Implement immediate measures to prevent the dumping of garbage along the banks of the rio Virilla and in the vicinity of the land occupied by Tajo El Montano. Restrict access to that property in order to prevent the entry of vehicles and persons seeking to dump garbage on that land. Mark the boundaries of the property and thereby prevent persons from encroaching upon that land under the belief that it is vacant.” From that perspective, it is unnecessary to rule on this matter.
As to the actual issue in dispute, it is established that the Ministry of Public Works and Transportation owns the property registered in the Heredia registry district under the real-property folio system, registration number , located in Santa Rosa de Santo Domingo de Heredia. It was also established that, during the inspection conducted by the respondent Health Governing Area at the reported site on 23 de marzo de 2021, officials of the Ministry of Health were informed that use of the site as a construction-debris disposal site was under consideration, and they stated that, because this was a new activity, the corresponding permits were required. Moreover, it was confirmed not only that, in the year 2021, the Cadastral Department of that Municipality issued a Certificate of Conforming Land Use authorizing landfill and construction-debris disposal activities, but also that such activities had been conducted without compliance with the applicable statutory and regulatory requirements.
The fact that the Circunvalación Norte project had Environmental Viability and Exclusivity did not mean that the Ministry could disregard compliance with those requirements in carrying out the challenged activity, particularly because it had previously been warned in that regard. Thus, irrespective of the fact that, in connection with this proceeding, the respondent local government formally filed a complaint seeking closure of the establishment for failure to satisfy the legal requirements, it had allowed the activity to continue for many months. On that understanding, the Chamber finds that the alleged violation occurred.
Regarding the Santo Domingo de Heredia Health Governing Area, the Chamber finds that there was no timely follow-up to the information provided by officials of the respondent ministry that use of Nombre02 as a construction-debris disposal site was under consideration, since all that was stated on the matter was that, because this was considered a new activity, the corresponding permits were required. In this respect, the absence of any complaint or permit application for the activity did not exempt it from initiating the measures whose omission the petitioner challenges, in order to safeguard her right to a healthy and ecologically balanced environment, particularly because, by official letter No. MS-DRRSSCN-DARSSD-IT-429-2021 dated 26 de marzo de 2021, the Ministry of Public Works and Transportation was notified that it was required to apply for an operating permit from the Ministry of Health and the Municipalidad de Santo Domingo, an application it never filed.
In this regard, although the efforts of the respondent local government led to the Minister of Public Works and Transportation once again being directed to bring the activity into compliance and submit the Operating Health Permit, that action merely demonstrates the alleged neglect, because it not only occurred long after the first warning but also establishes that the requested corrective measures were not taken as promptly as necessary. Accordingly, as far as this agency is concerned, the Chamber also finds that the alleged harm occurred.
Finally, the petitioner is advised that, with respect to the submission dated 19 de julio of the current year, it is inappropriate to order the expansion of the petition because any dispute concerning the existence and scope of the authorizing instrument (título habilitante) that the petitioner alleges is lacking involves matters of ordinary legality rather than constitutionality. This specialized proceeding is not the proper forum for determining whether the Ministry of Public Works and Transportation could authorize the use of Nombre02 as a construction-debris disposal site or whether the company awarded the Circunvalación Norte project could use that property for a purpose other than the one approved, as alleged.
In sum, the petition must be granted, as set forth below.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session number 27-11 of 22 de agosto de 2011, article XXVI, and published in Judicial Bulletin number 19 of 26 de enero de2012, as well as the resolution approved by the Higher Council of the Judiciary at session number 43-12 held on 3 de mayo de 2012, article LXXXI.
THEREFORE:
The petition is granted. Jorge Luis Fonseca Fonseca and Kimberly Madrigal Rodríguez, in their respective capacities as mayor and director of the Health Governing Area, both of Santo Domingo de Heredia, or whoever may hold those offices, are ordered to make and coordinate the necessary arrangements so that, within TWO MONTHS from notification of this judgment, the environmental problem reported by the petitioner is definitively resolved in accordance with the law. The respondents are advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Municipalidad de Santo Domingo and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction. Let notice be given.

“(…) a) Que tal y como consta en el Acta de la Sesión Ordinaria N°20-2021 realizada el día 6 de abril del 2021, bajo el Artículo I, se atendió por parte del Concejo Municipal, en audiencia al Ingeniero Carlos Martí, Director Técnico de Circunvalación Norte, (PROYECTO: CIRCUNVALACIÓN NORTE CONSORCIO: [Nombre 002] TEMA: ESCOMBRERA TAJO MONTANO). Que en dicho acto se procedió a realizar una presentación formal del citado proyecto, tal y como se desprende del Acta de cita y de la presentación que se adjunta como prueba de este informe; dicha presentación efectivamente verso sobre la utilización por parte de dicha Empresa adjudicataria, del terreno propiedad del Ministerio de Obras Públicas (ESCOMBRERA TAJO MONTANO), para depositar el material que provendría y proviene actualmente de la construcción del anillo de la Circunvalación Norte. Que en referencia a esta presentación consta la intervención del Alcalde Municipal y de la Presidencia del Concejo Municipal de ese periodo (…) b) Que con base a los antecedentes transcritos y los hechos que alega la recurrente se tiene lo siguiente: • Es cierto que el Concejo Municipal atendió en audiencia en la Sesión Ordinaria N°20-2021 realizada el día 6 de abril del 2021, bajo el Artículo I, Ingeniero Carlos Martí, Director Técnico de Circunvalación Norte. • PARCIALMENTE CIERTO.
Que la Municipalidad por medio del Departamento de Catastro, como órgano “(…) Me opongo al recurso interpuesto. El asunto que refiere la recurrente fue una actuación de buena fe mediante la cual se informó a la Municipalidad de las actividades por realizar por parte del Estado en dicha propiedad y relacionada al Proyecto de Circunvalación Norte de todos conocido. Lo cierto del caso es que no existe convenio ni acuerdo municipal en favor de alguna empresa privada. Lo que hay es que el Estado (MOPT) tiene un terreno matrícula dónde según informó el Departamento de Catastro Municipal mediante correo electrónico de fecha 3 de junio de los corrientes, dicho terreno estuvo afectado por actividad de TAJO dónde sacaron bastante material y en el 2021 solicitaron uso de suelo para relleno y escombrera que es prácticamente proceso inverso. En dicho correo adjuntó el uso de suelo 343-21 que indica que el uso de escombrera en el sitio donde se ubica la propiedad dicha, ES CONFORME.
En este sentido la actividad es posible realizarla por razones de zonificación por lo que solamente debe contar con las autorizaciones del Ministerio de Salud y SETENA según sus competencias tal como el mismo documento de USO DE SUELO indica. En el trámite del Uso de Suelo se adjuntó el Permiso Ambiental de SETENA para el proyecto Circunvalación Norte que contiene como actividades secundarias la disposición de escombros RESOLUCIÓN 734- 2020-SETENA de las 13 horas 25 minutos del 22 de abril del 2020. La recurrente había solicitado que se le informara al respecto, y lamentablemente a pesar de que a lo interno se estuvo revisando el caso y obteniendo información se había omitido enviarle respuesta formal con los documentos incautados y de los que se ha hecho referencia a la recurrente propiamente. Se le envió por parte de la Contraloría de Servicios al señor Luis Paulino Madrigal Rodríguez (quien forma parte de la misma organización comunal) pero no así a la recurrente.
En todo caso se informa que dicha respuesta fue realizada el día de hoy al haberse así instruido a la inmediatez y se adjunta la prueba del caso. Finalmente, el día de hoy al recibir respuesta por parte de oficina de SALUD en Santo Domingo de que en la propiedad Nombre02 no existe permiso sanitario de funcionamiento dejamos presentada formalmente la denuncia dicha autoridad para que proceda de conformidad a sus competencias según la Ley General de Salud a clausurar el establecimiento sin permiso sanitario. (…)”.
Solicita se declare sin lugar el recurso.
“(…) Me opongo al recurso interpuesto. (…)”.
7. Por resolución de las 22:23 horas de 3 de julio de 2024, se tuvo por ampliado el recurso, contra el Área Rectora de Salud del Santo Domingo de Heredia.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
La persona recurrente refiere que desde el 6 de abril de 2021, la Municipalidad de Santo Domingo de Heredia, en su sesión virtual ordinaria 20- 2021, otorgó permiso y uso de suelo a la empresa [Nombre 002], para depositar desechos provenientes del proyecto Circunvalación Norte, en un terreno que es propiedad del Ministerio de Obras Públicas y Transportes, que se denomina Escombrera Montano, que se ubica en el Dirección01, en Santa Rosa de Santo Domingo de Heredia y que colinda con la cuenca del río Virilla. Arguye que dicho terreno tiene un cierre sanitario por parte del Ministerio de Salud desde el 2014, para controlar el vertedero ilegal de escombros y residuos de la región y fue reabierto para el depósito de nuevos escombros, por lo que pasan cerca de 60 y 80 vagonetas diarias, la cuales producen congestionamiento vial y contaminación y afecta a la población.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En la especie, la persona recurrente refiere que desde el 6 de abril de 2021, la Municipalidad de Santo Domingo de Heredia, en su sesión virtual ordinaria 20- 2021, otorgó permiso y uso de suelo a la empresa [Nombre 002], para depositar desechos provenientes del proyecto Circunvalación Norte, en un terreno que es propiedad del Ministerio de Obras Públicas y Transportes, que se denomina Escombrera Montano, que se ubica en el Dirección01, en Santa Rosa de Santo Domingo de Heredia y que colinda con la cuenca del río Virilla. Arguye que dicho terreno tiene un cierre sanitario por parte del Ministerio de Salud desde el 2014, para controlar el vertedero ilegal de escombros y residuos de la región y fue reabierto para el depósito de nuevos escombros, por lo que pasan cerca de 60 y 80 vagonetas diarias, la cuales producen congestionamiento vial y contaminación y afecta a la población.
Conviene, en primer término, advertir que en lo que respecta a la clausura del Nombre02 como vertedero ilegal de escombros y residuos, lo planteado no tiene relación alguna con la discusión de este proceso, pues, según se colige del informe del Área Rectora de Salud de Santo Domingo, esos hechos están referido al uso del inmueble por parte de terceros, quienes realizaban el vertido y quema de desechos en el lugar. En este sentido, véase que mediante la Orden Sanitaria no. 077-2016, se ordenó al ministerio recurrido, lo siguiente: “Implementar las acciones inmediatas a fin de impedir la descarga de basuras en las márgenes del rio Virilla y en las inmediaciones de los terrenos que ocupa el Tajo El Montano. Delimitar el ingreso a dicha finca, a efectos de impedir el ingreso de vehículos y personas que quieran botar basuras en dichos terrenos. Delimitar los linderos de la propiedad y evitar con ello que las personas invadan dichos terrenos por considerarlos baldíos”. Desde esa perspectiva, es innecesario pronunciarse sobre el particular.
En lo que respecta propiamente al tema en discusión, consta que el Ministerio de Obras Públicas y Transporte, es propietario del inmueble inscrito en el partido de Heredia bajo sistema de folio real matrícula , que se ubica en Santa Rosa de Santo Domingo de Heredia. Además, se constató que fue en la inspección que realizó el área rectora de salud recurrida en el lugar denunciado el 23 de marzo de 2021, que se informó a los funcionarios del Ministerio de Salud, que se estaba valorando utilizar el sitio como escombrera, a lo que se les expresó que en vista de que esto es una actividad nueva, se debía contar con los permisos respectivos. Además, no solo se corroboró que en el año 2021, el Departamento de Catastro de esa Municipalidad, otorgó un Certificado de Uso de Suelo Conforme para realizar la actividad de relleno y escombrera, sino que dicha actividad se había venido realizando, sin cumplir con la normativa legal y reglamentaria dispuesta.
El hecho que el proyecto de Circunvalación Norte contara con Viabilidad Ambiental y Exclusividad, no implicaba que el Ministerio pudiera soslayar el cumplimiento de dichas exigencias para ejercer la actividad reclamada, máxime que habían sido previamente apercibido en ese sentido. De ahí que al margen de que con ocasión de este recurso, el ente local recurrido planteara formalmente una denuncia procurando la clausura del establecimiento por carecer de los requisitos legales, consintió la actividad por muchos meses. Bajo esta inteligencia, estima la Sala que se produjo la infracción acusada.
En lo que atañe al Área Rectora de Salud de Santo Domingo de Heredia, echa de menos la Sala el seguimiento oportuno de la noticia dada por funcionarios del ministerio recurrido, en cuanto a que se estaba valorando utilizar el Nombre02 como escombrera, puesto que lo único que se indicó sobre el particular fue que, dado que se consideraba esta una actividad nueva, se debía contar con los permisos respectivos. En este particular, el hecho que no existiera denuncia alguna o solicitud de permiso para realizar la actividad, no le eximía de iniciar las acciones que echa de menos la parte actora, para garantizar su derecho a un ambiente sano y ecológicamente equilibrado, máxime que por oficio No. MS-DRRSSCN-DARSSD-IT-429-2021 de 26 de marzo de 2021, se notificó al Ministerio de Obras Públicas y Transportes que debería solicitar el permiso de funcionamiento al Ministerio de Salud y a la Municipalidad de Santo Domingo, gestión que nunca realizó.
En este sentido, si bien con ocasión de las gestiones del ente local recurrido que se previno nuevamente al ministro de Obras Públicas y Transportes, que pusiera en regla la actividad y aportara el Permiso Sanitario de Funcionamiento, ese proceder no es más que una muestra de la desatención reclamada, pues no solo se produjo mucho tiempo después de la primera prevención, sino que permite acreditar que las acciones correctivas reclamadas no se tomaron oportunamente como se ameritaba. Así las cosas, en lo que a esta dependencia concierne, también estima la Sala que se produjo el agravio reclamado.
Finalmente, tome nota la parte actora que en lo que atañe al memorial de 19 de julio de los corrientes, es improcedente ordenar la ampliación del recurso, pues la discusión que pudiere formularse respecto de la existencia del título habilitante que echan de menos y sus alcances, son temas de legalidad ordinaria y no de constitucionalidad. En este particular, no es en esta vía especializada donde debe discutirse si el Ministerio de Obras Públicas y Transportes, podía o no autorizar el uso del Nombre02 como escombrera y si la empresa adjudicada para realizar el proyecto Circunvalación Norte, podía o no darle un uso distinto a ese inmueble del aprobado, tal y como se denuncia.
En suma, se impone acoger el recurso, conforme se dirá.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Jorge Luis Fonseca Fonseca y a Kimberly Madrigal Rodríguez, en su condición de alcalde y de directora del Área Rectora de Salud, ambos de Santo Domingo de Heredia, o a quienes ejerzan esos cargos, que dispongan y coordinen lo necesario a efecto que en el plazo de DOS MESES, contado a partir de la notificación de esta sentencia, se resuelva de forma definitiva y como en derecho corresponda el problema ambiental reclamado por la recurrente. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Santo Domingo y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
