Background:

  1. 1By written submission filed with the Court Clerk's Office at 12:56 hours on May 22, 2023, the petitioner filed a writ of amparo against the Municipalidad de Paraíso. She states that her right to water, and that of the residents of the southern sector of Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz, and La Castilla), is being violated by the respondent municipality. She explains that in December 2021, when she moved into her home, she began to experience periods of several hours during the day and on Saturdays without water service, a situation that has worsened over time to the point that during Holy Week of 2022 (Thursday, Friday, and Saturday) the service was not provided at all, due to the construction of phases II and III of Sociedad Veca y Veja SA. She further states that, by means of resolution No. Rest-DEUR-418-2022, they were informed that: "Regarding the granting of potable water availability (disponibilidad de agua potable), I clarify that the water supply was approved for the entire project — phases I, II, and III — in session 306 of May 2, 2010, Art 18.The project holds Environmental Viability Resolution No. 2524-2010-SETENA, of October 25, 2010, which is being processed under case file D1588-2010-SETENA." However, despite the response's assertion that the prior studies are in order, the problem described worsened exponentially approximately 4 months ago, which coincides with the commencement of construction of a new condominium located 100 meters east of the Plaza de Deportes del Barrio La Laguna (located 1 km from her home), under building permit No. PC.113-2022-1002418, case file No. D1-17770-2016 SETENA. She alleges that during these months, they have had no water between 07:00 and 20:30 hours, and on weekends from 08:00 to 21:00 hours, reaching the point of going without water for more than 18 hours; when it does return, the quantity is minimal, with the early morning hours being the only time they have adequate access to water. She reports that on May 25, 2023, together with a group of neighbors, they appeared before the respondent Council (Concejo) to report the lack of water, at which time they were promised that a well would be adapted to solve the problem, that pipes would be replaced, and that illegal water connections (tomas ilegales) would be inspected, among other measures.However, she alleges that the situation cannot wait and worsens with each passing day, compounded by the fact that many families do not have the resources to invest in a water storage tank, and those who do have one are sometimes unable to fill it. She claims that working individuals are forced to sacrifice rest time in the early morning hours to complete household tasks, generating disturbances from the noise of home appliances and limiting water for hygiene activities. On many occasions, people have been unable to go to work or children to school, because those who do not collect water in the early morning hours will have none at all. She notes that during the mornings and afternoons, a water tanker (cisterna) is sent to them — one that has at times delivered dirty water — but this can only be used for certain activities, and many working people who return home late are unable to collect the water.They criticize the fact that, despite these deficiencies, they are charged monthly for a service they are not receiving. She argues that the lack of water is due to the respondent authorities' failure to plan, as potable water availability has continued to be granted even when that availability does not exist. For the foregoing reasons, she brings this matter before the Sala in protection of her fundamental rights and those of the other residents, and requests that the writ be granted.
  2. 2By resolution issued at 16:33 hours on May 29, 2023, the Mayor (Alcalde), the President of the Council, and the Head of the Municipal Water Utility (Acueducto Municipal) Department, all of the Municipalidad de Paraíso, were requested to submit a report on the facts alleged in the writ.
  3. 3By written submission incorporated into the Sala's digital case file at 15:40 hours on June 6, 2023, Carlos Ramírez Sánchez, in his capacity as Municipal Mayor of Paraíso, reported under oath that: "(…) Background: 1. Flow measurements (aforos) conducted on the springs (nacientes) that supply water to the southern sector of Paraíso have determined that the output of those springs has decreased by approximately 68% from January of this year to date. 2. Additionally, regarding the flow rate (caudal) coming from the Orosi project, although the Municipalidad de Paraíso is entitled to a flow rate of 50 liters per second from the water treatment plant (planta potabilizadora) located in Cartago, we are currently receiving a flow rate of no more than 32 liters per second, which has made it impossible to maintain sufficient potable water storage capacity to meet peak-hour demand. 3. Although the petitioners allege that the water shortage has been aggravated by the construction of a housing development in the area, this Honorable Sala should be aware that the developers themselves filed a writ of amparo, known under case file number 23-009595-007-CO, seeking connection of potable water to that project — meaning that, as of today, the project is not connected to the distribution network (red de distribución) and is not the cause of the potable water shortage.Proposed improvements: 1. To require the Instituto Costarricense de Alcantarillados (ICAA), the operator of the Orosi project water treatment plant, to supply the Municipalidad de Paraíso with the 50 liters per second to which it is entitled, since we are currently receiving only 18 liters per second of what belongs to us. 2. The municipality, through procurement process No. 006620200000100036 in the SICOP system, contracted for the drilling of a deep potable water well with a production capacity of 9 liters per second; it is estimated to be operational within one month, as the only remaining step is the electrical connection with JASEC. 3. Additionally, 150 meters of the supply line from the water treatment plant located in Cartago — which serves several systems of the municipal water utility, including the pressure zone (zona de presión) "Paraíso Sur" — will be replaced, in order to remove the old pipe from an inspection chamber belonging to the Municipalidad de Cartago water utility and to achieve a better flow rate at the plant's outlet. 4. Other improvements made at the network level included uncovering valves that had been buried by road repairs, and the discovery of a blockage in a 3-inch pipe line caused by a stone (…)".
  4. 4By means of a written statement added to the digital case file at 13:37 hours on June 6, 2023, Julio Sánchez Soto, in his capacity as President of the Municipal Council of Paraíso, reports under oath that "(…) 1- Up until April 25, 2023 — the date on which the petitioning residents (recurrentes) appeared at the Municipal Council chamber during ordinary session No. 240 — this collegial body had no record in its correspondence or municipal minutes that these residents were affected by a lack of potable water that the municipal water system (acueducto municipal) was obligated to supply. 2- Since March, as has been the case throughout the country, the water system of Paraíso has been affected by a decline in water production at its springs (nacientes), and in addition to the 50 l/s that must be supplied from AyA's water treatment plant (planta potabilizadora) in Cartago, only 30 to 35 l/s of outflow has been recorded in recent months. 3- This situation has caused several sectors of the population to not receive the service on a continuous basis. 4- At ordinary session No. 240 on April 25, 2023, at which the petitioning residents were received, the Municipal Council adopted the following resolution: "RESOLUTION 5: It is agreed unanimously to waive referral to committee.It is agreed unanimously to authorize Engineer Carlos Ramírez Sánchez, Municipal Mayor, to sign a water purchase agreement with the Municipality of Cartago and to inject water into the pipeline of the southern zone. That work be carried out on the connection of the Laguna well as planned. That an investigation be conducted into illegal water connections (tomas ilegales) and irregular developments (urbanizaciones irregulares) in the area, and that water system personnel, the Water System Chief, and the Mayor appear the following day in the affected zone to be received by a residents' commission. RESOLUTION FINAL AND DEFINITIVELY APPROVED. 5- It is on record, through verbal reports by the municipal mayor in subsequent sessions, that municipal personnel appeared in the area the day after to carry out works aimed at improving the service, and that actions are being taken to connect the well to the network serving this sector.These are matters that the municipal administration is responsible for reporting on. 6- At ordinary session No. 245, residents of that sector of the central district appeared — petitioners in this case — were received, and the Municipal Council adopted the following resolutions: Upon a motion presented by council member (Regidor) Rodríguez Araya. "RESOLUTION 8: With five votes in favor and two votes against (council members Sánchez Soto and Solano Moya), it is agreed to request Engineer Carlos Ramírez Sánchez, Municipal Mayor, that beginning the following day he contract water tanker trucks (cisternas) certified by the Ministerio de Salud to distribute water to the population. RESOLUTION FINAL AND DEFINITIVELY APPROVED. Upon a motion presented by council member Sánchez Soto RESOLUTION 9: It is agreed unanimously to approve the motion presented by council member Sánchez Soto. THEREFORE: that the municipal administration: 1- Adequately reinforce the distribution of water by means of water tanker trucks so as to promptly serve the population that requires it. 2- Carry out the work that is its responsibility so that the institution may have access, during extraordinary hours, to the services of Engineer Juan Carlos Porras, chief of the Municipal Water System department, the only engineer and with nearly three years of service with the water system, being the most suitable person to manage the difficult situation the water system is experiencing.RESOLUTION FINAL AND DEFINITIVELY APPROVED. And upon a motion by council member Rodríguez Araya, regarding the water shortage from the AyA water treatment plant: It is agreed unanimously to approve the motion presented by council member Rodríguez Araya. THEREFORE: First, that the Mayor proceed with the technicians to install a flow meter (flujómetro) at the water outlet. Second, to authorize the Mayor to hire a hydraulic engineer, through special or professional services (Servicios Especiales o Profesionales), to provide a report on what must be done at the plant and whether the works carried out meet this municipality's requirements. Third, to authorize the Mayor to proceed with replacing the conveyance pipeline from the plant to what is known as the "platanera." Fourth, to authorize the Mayor to request the necessary resources for the pipeline replacement as quickly as possible, and that the works be carried out under the emergency procurement (contratación de urgencia) modality, pursuant to artículo 66 of the Ley de Contratación Administrativa.A detailed justification must be incorporated into the file explaining why the use of this special procedure was deemed necessary, as well as the mechanism for selecting the contractor. Fifth, to proceed immediately with the replacement of the pipeline from the treatment plant toward Paraíso. Sixth, the Mayor shall have a period of 30 calendar days to provide the first report. Seventh, to request that the Mayor present at the next session a special report on the works carried out at the plant, with technical explanations to be assessed by a Hydraulic Engineering professional from a Government Institution. Eighth — given the gravity of the facts — the Mayor shall proceed to conduct an audit of the water systems department in which the relevant matters are evaluated. Ninth — that the water systems department conduct a study to verify the existence of project files and information relating to the distribution network, water intakes, tariff studies for the service, and the Water System Regulations.Tenth — to identify the situations affecting the internal control system of the Water System, as well as others that have an impact on the achievement of the water systems department's objectives. Eleventh: So that all information of the water system, studies, etc., may be safeguarded by the Municipality of Paraíso on its server so that it may be consulted by the professionals on duty and the Mayor. Twelfth: All department personnel shall use institutional computers, and it is prohibited to keep information belonging to this municipality on private computers; such information shall be available for use by water system professionals, who may access and consult it — this function shall be the responsibility of the municipality's IT (TI) department, which shall proceed to request the information and make it available to all personnel. Thirteenth, given that the department chief is the one who manages the budget, that he proceed to purchase the software licenses required for his work, as well as the computer equipment needed to run the required programs.Fourteenth — Any official who refuses to hand over information that is the property of this municipality shall be considered to have committed a serious misconduct (falta grave), and shall be sanctioned in accordance with our legal system. Fifteenth: All officials who have been working at this institution for fewer than 10 years shall be required to make their respective clock-in entries on a time clock that the Mayor shall proceed to put into operation within 48 hours, under penalty of being reported by this Council. With the amendment that the Mayor be authorized to hire, through special or professional services contracts, the engineers required by the Municipal Water System. RESOLUTION FINAL AND DEFINITIVELY APPROVED (…)". He requests that the writ be dismissed.
  5. 5By means of a certificate dated June 22, 2023, it is noted that there is no record of the Chief of the Municipal Water System Department of the Municipality of Paraíso having submitted the report requested before this Chamber.
  6. 6The legal requirements have been observed in the proceedings conducted.

The opinion is drafted by Justice Araya García; and,

Considering:

I.Preliminary matter. In view of the fact that the Chief of the Municipal Water System Department of the Municipality of Paraíso failed to submit the report within the deadline set by this Tribunal in the resolution of 16:33 hours on May 29, 2023, and in accordance with artículo 45 of the Ley de la Jurisdicción Constitucional, the facts are deemed established with respect to that official, and the constitutional analysis proceeds on the basis of what was set forth by the petitioner (recurrente) and what was reported by the other authorities.

II.Subject matter of the writ. The petitioner considers her fundamental rights (derechos fundamentales) to have been violated, alleging that she and the protected parties (amparados) are residents of the southern sector of Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz, and La Castilla) and that all of them face a problem due to the lack of potable water supply. She asserts that this is attributable to the construction of a new condominium near their homes and that, as a result, they have approached the authorities of the Municipality of Paraíso requesting assistance with the water problem they face, without any action having been taken to help them to date. She maintains that they require potable water to meet their basic needs.

III. Proven facts. The following facts are deemed duly established as relevant to the decision in this matter

  • 1)The petitioner and the protected parties are residents of the southern sector of Paraíso de Cartago (Residencial Vistas del Valle, Las Vicentinas, El Caíz, and La Castilla) (uncontested fact).
  • 2)The production of the springs (nacientes) supplying water to the southern sector of Paraíso decreased by 68% from January 2023 (see report submitted under oath by the respondent authority).
  • 3)The flow rate (caudal) originating from the Orosi project — notwithstanding that the Municipality of Paraíso is entitled to 50 liters per second from the water treatment plant located in Cartago — as of June 2023 was receiving a flow of no more than 32 liters per second, which has made it impossible to maintain potable water storage capacity sufficient to meet demand during peak hours (see report submitted under oath by the respondent authority).
  • 4)At ordinary session No. 240 on April 25, 2023, the Municipal Council adopted the following resolution: "RESOLUTION 5: It is agreed unanimously to waive referral to committee. It is agreed unanimously to authorize Engineer Carlos Ramírez Sánchez, Municipal Mayor, to sign a water purchase agreement with the Municipality of Cartago and to inject water into the pipeline of the southern zone. That work be carried out on the connection of the Laguna well as planned. That an investigation be conducted into illegal water connections and irregular developments in the area, and that water system personnel, the Water System Chief, and the Mayor appear the following day in the affected zone to be received by a residents' commission. RESOLUTION FINAL AND DEFINITIVELY APPROVED" (see report submitted under oath by the respondent authority).
  • 5)In ordinary session No. 245 of May 23, 2023, the Municipal Council adopted the following resolutions: "(…) Upon a motion presented by Council Member Rodríguez Araya. 'RESOLUTION 8: By a vote of five in favor and two against (Council Members Sánchez Soto and Solano Moya), it is resolved to request that Eng. Carlos Ramírez Sánchez, Municipal Mayor, effective as of tomorrow, contract water tankers (cisternas) certified by the Ministry of Health for water distribution to the population. RESOLUTION IN FORCE AND DEFINITIVELY APPROVED (…) Upon a motion presented by Council Member Sánchez Soto. RESOLUTION 9: It is unanimously resolved to approve the motion presented by Council Member Sánchez Soto. POR LO TANTO: that the municipal administration: 1- Duly reinforce water distribution by means of cistern tanks (tanques cisterna) so that it may promptly serve the population that requires it. 2- Take the steps necessary for the institution to have the overtime services of Engineer Juan Carlos Porras, Head of the Municipal Water Supply System Department (departamento del Acueducto Municipal), the sole engineer and one who has worked for the water supply system (acueducto) for almost three years, making him the most qualified person to manage the difficult situation currently facing the water supply system.

RESOLUTION IN FORCE AND DEFINITIVELY APPROVED. (…) And upon a motion by Council Member Rodríguez Araya, concerning the water shortage at the AyA water treatment plant (planta potabilizadora): It is unanimously resolved to approve the motion presented by Council Member Rodríguez Araya. POR LO TANTO: First, that the Mayor, together with the technical staff, shall install a flow meter (flujómetro) at the water outlet. Second, to authorize the Mayor to contract a hydraulic engineer through Special or Professional Services to provide a report on what must be done at the plant and whether the works performed meet this municipality's requirements. Third, to authorize the Mayor to replace the conveyance line (línea de conducción) from the plant up to the area known as the "platanera." Fourth, to authorize the Mayor to request the resources necessary for the pipe replacement as quickly as possible, and for the works to be carried out under the emergency contracting (contratación de urgencia) modality, pursuant to Article 66 of the Ley de Contratación Administrativa.

A detailed justification must be incorporated into the file explaining why this special procedure was determined to be necessary, as well as the mechanism for selecting the contractor. Fifth, to proceed immediately with the replacement of the piping from the treatment plant toward Paraíso. Sixth, the Mayor shall have 30 calendar days to submit the first report. Seventh, to request that the Mayor present at the next session a special report on the works carried out at the plant, with technical explanations to be assessed by a Hydraulic Engineering professional from a Governmental Institution. Eighth — given the gravity of the facts, the Mayor shall proceed to conduct an audit of the water supply department in which the following shall be evaluated. Ninth — For the water supply department to carry out a study to verify the existence of project files as well as information regarding the distribution network, water catchments, rate studies for the service, and the Reglamento del Acueducto.

Tenth — to identify the situations affecting the system of internal controls of the water supply system, as well as others that bear on the achievement of the objectives of the water supply department. Eleventh: For all information of the water supply system, studies, etc., to be safeguarded by the Municipality of Paraíso on its server so that it may be consulted by the professionals on duty and the Mayor. Twelfth: All employees of the department shall use Institution-owned computers, and keeping information belonging to this municipality on private computers is prohibited; such information shall be available to the water supply professionals, who may access and consult it, and this function shall be handled by the IT department of this municipality, which shall proceed to request the information and make it available to all employees. Thirteenth, given that it is the head of the department who manages the budget, he or she shall proceed to purchase the software licenses required for his or her work, as well as the computer equipment needed to run the necessary programs.

Fourteenth — Any employee who refuses to provide information owned by this municipality shall be deemed to have committed a serious offense and shall be sanctioned in accordance with our legal framework. Fifteenth: All employees who have worked at this institution for fewer than 10 years shall be required to clock in and out on a time clock that the Mayor shall put into operation within 48 hours, under penalty of being reported by this Council. With the amendment that the Mayor be authorized to contract, through special or professional services, the Engineers required by the Municipal Water Supply System. RESOLUTION IN FORCE AND DEFINITIVELY APPROVED (…)'" (see report given under oath by the respondent authority).

  • 6)The municipality, through public tender (licitación) process No. 006620200000100036 in the SICOP system, carried out the contracting for the drilling of a deep well (pozo profundo) of drinking water with a yield of 9 liters per second, which only requires an electrical connection with JASEC to begin operations (see report given under oath by the respondent authority).
  • 7)Among the improvements carried out by the municipality are: 1) 150 meters of the conveyance line of the water treatment plant located in Cartago — which supplies several systems of the municipal water supply system, including the pressure zone (zona de presión) "Paraíso Sur" — will be replaced, with the purpose of removing the old pipe from an inspection chamber (caja de registro) belonging to the municipal water supply system of Cartago and achieving a better water flow at the plant's outlet; and 2) uncovering valves that had been buried by road repairs, in addition to the discovery of a blockage of a 3-inch pipe caused by a stone (see report given under oath by the respondent authority).
  • 8)On May 31 and June 2, both of 2023, the respondent authorities were notified of the ruling initiating this proceeding (see notification records).

III.On the Merits. The jurisprudence of the Chamber, in matters of drinking water supply, has been directed fundamentally toward the protection of the right to life and to health of natural persons. These rights entail the ability to demand certain services from the State, a sphere in which the State is compelled to provide certain public services, particularly those that are essential for maintaining sanitary conditions favorable to the preservation of the life and health of persons. Accordingly, guaranteeing the purity of water for human consumption, as well as continuity of its supply, forms part of a proper and efficient service to the subscriber (abonado) and, at the same time, safeguards their most basic fundamental rights (ruling no. 04253-2014 of 09:15 hrs. of March 28, 2014). Additionally, regarding drinking water supply shortages, the Chamber has held that, insofar as the respondent authorities demonstrate that they have acted within their material capabilities to achieve adequate supply, fundamental rights are not violated if such supply is provided with some irregularities in flow rate (caudal) or supply schedule (see, in this regard, the criterion of this Chamber in rulings Nos. 2008-9714 of 10:39 hrs. of June 13; 2009-12511 of 17:59 hrs. of August 11, 2009, 2010-15448 of 12:15 hrs. of September 17, 2010, 2011-006603 of 11:50 hrs. of May 20, 2011, 2013-004338 of 14:30 hours of April 2, 2013, 2020-011749 of 9:05 hours of June 26, 2020).

IV.On the Specific Case. In the sub examine, the petitioner considers her fundamental rights to have been violated, alleging that she and the co-petitioners (amparados) are residents of the southern sector of Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz, and La Castilla) and all face a problem arising from the lack of drinking water supply. She asserts that this is due to the construction of a new condominium near their homes and that, consequently, they have approached the authorities of the Municipalidad de Paraíso to request assistance with their water problem, without any action having been taken to date to help them. She maintains that they require drinking water to meet their basic needs.

In this regard, it is deemed proven that the petitioner and the co-petitioners are residents of the southern sector of Paraíso de Cartago (Residencial Vistas del Valle, Las Vicentinas, El Caíz, and La Castilla). It has likewise been verified that there are a series of problems with the water supply in the canton (cantón) of Paraíso, specifically in the area known as Paraíso Sur. However, it has been established that this situation does not stem from arbitrary or capricious decisions by the Municipalidad de Paraíso, but rather from various causes, including: a) a 68% reduction in the output of the springs (nacientes) supplying water to the southern sector of Paraíso since January 2023, b) a flow rate of no more than 32 liters out of the 50 liters they are entitled to receive from the water treatment plant located in Cartago, c) valves that had been buried by road repairs and a blockage of a 3-inch pipe caused by a stone, among other factors, all of which have contributed to the situation complained of by the petitioner.

Notwithstanding the foregoing, and contrary to what was alleged in the filing, it has been verified that the authorities of the Municipalidad de Paraíso are aware of the facts, and that, prior to notification of the writ, they had already carried out a series of actions aimed at resolving the matter and providing adequate assistance to the residents of the area, such as: a) replacing 150 meters of the conveyance line of the water treatment plant located in Cartago, which supplies several systems of the municipal water supply system, including the pressure zone "Paraíso Sur," with the purpose of removing the old pipe from an inspection chamber belonging to the municipal water supply system of Cartago and achieving a better water flow at the plant's outlet; b) uncovering valves that had been buried by road repairs, in addition to the discovery of a blockage of a 3-inch pipe caused by a stone; c) contracting for the drilling of a deep well of drinking water with a yield of 9 liters per second, which only requires an electrical connection with JASEC to begin operations; and d) reinforcing water distribution by means of water tankers to serve the population that requires it.

In light of the foregoing, and taking as the applicable standard the above-cited jurisprudential criterion, this Court finds that the conduct at issue in the present matter does not constitute an illegitimate or arbitrary act. In this regard, it is established as proven that the disruptions and water rationing (racionamiento de agua) conditions in the southern sector of Paraíso arose from objective causes, and that the municipal authorities had been working to restore the normal supply of drinking water to the population even before this writ was filed and before the order to proceed was served. Accordingly, the actions described in the preceding paragraph demonstrate that the municipality initiated the necessary coordination to address the problem affecting the population. It was further established that, at all times, water was provided to local residents through the deployment of a water tanker truck. Consequently, since no action or omission on the part of the respondent authorities has been verified with respect to the facts alleged in the writ, the appropriate ruling is to dismiss it, as is hereby ordered.

V.Documentation submitted to the case file (expediente). The parties are hereby put on notice that if any documents in paper form, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, have been submitted, these must be retrieved from the court office within a maximum period of thirty business days (días hábiles) counted from the notification of this judgment. Failing that, all material not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at Session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on May 3, 2012, Article LXXXI.

Therefore:

The writ is dismissed.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala a las 12:56 horas de 22 de mayo de 2023, la recurrente interpone recurso de amparo contra la Municipalidad de Paraíso. Manifiesta que a ella y a los vecinos del sector Sur de Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz y La Castilla) se les está vulnerando el derecho al agua, por parte de la municipalidad recurrida. Explica que en diciembre de 2021 cuando se mudó a su vivienda, empezó a experimentar que durante varias horas del día y los sábados no llegaba agua, situación que ha ido empeorando con el pasar del tiempo, al grado que durante la Semana Santa del año 2022 (jueves, viernes y sábado) no se le brindó ese servicio, debido a la construcción de las II y III de la Sociedad Veca y Veja SA. Agrega que mediante resolución No. Rest- DEUR-418-2022, se les indicó que: "Con respecto al otorgamiento de la disponibilidad de agua potable aclaro que el abastecimiento de agua se aprobó para todo el proyecto etapas I, II y III en sesión 306 del 02 de mayo de 2010, Art 18.El proyecto cuenta con Viabilidad Ambiental Resolución N0 2524-201 0-SETENA, del 25 de octubre de 2010. La cual se tramita en expediente D1588-2010-SETENA". Sin embargo, pese a que en la respuesta se arguye que cuentan con los estudios previos, la problemática indicada se agravó exponencialmente hace aproximadamente 4 meses, lo cual coincide con el inicio de las obras de un nuevo condominio ubicado 100 metros al este de la Plaza de Deportes del Barrio La Laguna (ubicado a 1 km de su casa), bajo el permiso de construcción No. PC.113-2022-1002418, expediente No. D1-17770-2016 SETENA. Alega que, en estos meses, no han recibido agua entre las 07:00 horas y las 20:30 horas, y los fines de semana desde las 8:00 horas hasta a las 21:00 horas, llegando al grado de estar sin agua durante más de 18 horas, y cuando regresa es mínima la cantidad, siendo la madrugada el único momento en que tienen acceso suficiente al agua.Refiere que el 25 de mayo del 2023, en conjunto con un grupo de vecinos acudieron al Concejo accionado, a denunciar la falta de agua, ocasión en la que les prometieron adecuar un pozo que solucionará el problema, cambiar tuberías, inspeccionar tomas ilegales entre otras acciones. Sin embargo, alega que esta situación no puede esperar, y conforme pasan los días se agrava, aunando al hecho que muchas familias no cuentan con los recursos para invertir en una instalación de tanque de agua, y quienes lo tienen en ocasiones no logran llenarlo. Reclama que las personas que trabajan tienen que sacrificar el tiempo de descanso en las madrugadas para cumplir con tareas de hogar, generar molestias por sonidos de electrodomésticos y limitar el agua para actividades de aseo. En muchas ocasiones las personas no han podido asistir a sus trabajos o los menores al centro educativo, porque quien no se abastece en la madrugada no tendrá el recurso.Comenta que durante las mañanas y en las tardes les envían una cisterna (que ha traído agua sucia), pero esta solo se puede utilizar para ciertas actividades; y muchas personas trabajadoras que regresan tarde a sus hogares, no pueden recolectar agua. Critican que, pese a dichas deficiencias, mensualmente les cobran por un servicio que no están recibiendo. Acusa que la falta de agua se debe a la falta de planificación de las autoridades recurridas, pues se ha seguido brindando disponibilidad de agua, cuando esta no existe. Por lo expuesto, acude a la Sala en protección de sus derechos fundamentales y de los demás vecinos y solicita que se declare con lugar el recurso.
  2. 2En resolución de las 16:33 horas de 29 de mayo de 2023, se le solicita informe al Alcalde, el Presidente del Concejo, el Jefe del Departamento del Acueducto Municipal, todos de la Municipalidad de Paraíso, sobre los hechos alegados en el recurso.
  3. 3Mediante escrito incorporado al expediente digital de la Sala a las 15:40 horas de 6 de junio de 2023, informa bajo juramento Carlos Ramírez Sánchez, en su condición de Alcalde Municipal de Paraíso, que “(…) Antecedentes 1. En los aforos que han venido realizando en las fuentes que dotan de agua al sector sur de Paraíso se ha podido determinar que la producción de dichas nacientes de enero de este año a la fecha ha disminuido en alrededor del 68% de producción. 2. Adicionalmente el caudal que proviene del proyecto Orosi a pesar de que a la Municipalidad de Paraíso le corresponde un caudal de 50 litros por segundo de la planta potabilizadora ubicada en Cartago, actualmente nos están entregando un caudal no mayor a 32 litros por segundo lo que ha imposibilitado tener capacidad del Almacenamiento de Agua Potable para satisfacer la demanda durante las horas pico. 3. A pesar que los recurrentes alegan que la situación de del faltante de agua se ha agravado por la construcción de un proyecto urbanístico en la zona, tenga presente esta Honorable Sala que los mismos desarrolladoras interpusieron un recurso de amparo conocido en el expediente numero 23-009595-007- CO, con el fin de que sea conectado el agua potable a dicho proyecto, es decir, al día de hoy el proyecto no está conectado a la red de distribución y no es el proyecto que ha producido el faltante de agua potable.Propuestas de mejora: 1. Obligar al Instituto Costarricense se Alcantarillados operador de la planta potabilizadora de agua del proyecto Orosi a dotar a la municipalidad de Paraíso de los 50 litros por segundo que nos pertenecen, pues al día de hoy recibimos 18 litros por segundo de lo que nos pertenece. 2. Que la municipalidad mediante el número de proceso número de licitación 006620200000100036 en el sistema SICOP realizo la contratación para la perforación de un pozo profundo de agua potable que tiene una producción de 9 litros por segundo y en plazo estimado de un mes estará operando pues solo hace falta realizar la conexión de electricidad con la JASEC. 3. Adicionalmente se sustituirán 150 metros de la línea de conducción de la planta potabilizadora ubicada en Cartago, la cual suple varios sistemas del acueducto municipal, incluida la zona de presión “Paraíso Sur” esto con el fin de remover la tubería vieja de una caja de registro perteneciente al acueducto municipal de Cartago y tener un mejor flujo de agua a la salida de la planta 4.Otras mejoras realizadas a nivel de red fueron descubrir válvulas que se encontraban sepultadas por reparaciones de carreteras, además de que se descubrió un bloqueo de una línea de tubería de 3 pulgadas causado por una piedra (…)”.
  4. 4Por medio de escrito agregado al expediente digital a las 13:37 horas de 6 de junio de 2023, informa bajo juramento Julio Sánchez Soto, en su condición de Presidente del Concejo Municipal de Paraíso, que “(…) 1- Hasta el día 25 de abril del año 2023, que en la sesión ordinaria No. 240, se presentan los vecinos recurrentes al salón de sesiones del Concejo Municipal, este ente colegiado no tiene en su correspondencia o actas municipales constancia de que a estos vecinos los aqueja la falta de agua potable que deba suministrarle el acueducto municipal. 2- Desde el mes de marzo, al igual que en todo el país, el acueducto de Paraíso se ha visto afectado por la baja en la producción de agua en sus nacientes, además de los 50 l/s que se deben suministrar de la planta potabilizadora de AyA en Cartago, se han estado contabilizando apenas de 30 a 35 l/s de salida en los últimos meses. 3- Esta situación ha causado que varios sectores de la población no reciban el servicio en forma continua. 4- En la sesión ordinaria No. 240 del 25 de abril del 2023, que se atiende a los vecinos recurrentes, el Concejo Municipal tomó el siguiente acuerdo : “ACUERDO 5: Se acuerda por unanimidad Dispensar de Trámite de Comisión.Se acuerda por unanimidad autorizar al Ing. Carlos Ramírez Sánchez, Alcalde Municipal, a firmar un convenio de compra de agua a la Municipalidad de Cartago y se inyecte a la tubería de la zona sur. Que se trabaje en la conexión del pozo de la Laguna como se está previsto. Que se haga una investigación de las tomas ilegales y de urbanizaciones irregulares en la zona y que se presente el día de mañana personal del Acueducto, el Jefe de Acueducto y el señor Alcalde a la zona afectada, para ser recibidos por una comisión de vecinos. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. 5- Consta, por informes verbales del señor alcalde municipal en las siguientes sesiones, que personal municipal se presentó a la zona un día después para realizar trabajos a fin de mejorar el servicio y se realizan acciones para la conexión del pozo a la red de este sector. Gestiones que corresponde informar a la administración municipal. 6- En la sesión ordinaria No. 245, vecinos de ese sector del distrito central se presentan, recurrentes en este caso, son atendidos y el Concejo Municipal toma los siguientes acuerdos: Ante moción presentada por el Regidor Rodríguez Araya.“ACUERDO 8: Con cinco votos positivos y dos votos negativos (regidores Sánchez Soto y Solano Moya) se acuerda solicitar al Ing. Carlos Ramírez Sánchez, Alcalde Municipal, que a partir de mañana contrate cisternas certificadas por el Ministerio de Salud para repartir agua a la población. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. Ante moción presentada por el regidor Sánchez Soto ACUERDO 9: Se acuerda por unanimidad aprobar la moción presentada por el regidor Sánchez Soto. POR LO TANTO: que la administración municipal: 1-Refuerce debidamente el reparto de agua por medio de tanques cisterna para que pueda atender con prontitud a la población que lo requiera. 2- Realice la labor que le corresponde realizar para que la institución pueda contar con los servicios en tiempo extraordinario del Ingeniero Juan Carlos Porras, jefe del departamento del Acueducto Municipal, único ingeniero y con casi tres años de laborar para el acueducto, siendo la persona más adecuada para que maneje la difícil situación por la que atraviesa el acueducto.ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. Y ante moción del regidor Rodríguez Araya, sobre el faltante de agua de la Planta potabilizadora de AyA: Se acuerda por unanimidad aprobar la moción presentada por el regidor Rodríguez Araya. POR LO TANTO: Primero, que el señor Alcalde proceda con los técnicos a colocar un flujómetro en la boca de salida del agua. Segundo, autorizar al señor Alcalde a contratar a un ingeniero hidráulico, por la vía de Servicios Especiales o Profesionales, para que nos brinde un informe sobre lo que se debe hacer en la planta y si los trabajos realizados cumplen con los requisitos de esta municipalidad. Tercero, autorizar al señor Alcalde para que proceda a cambiar la tubería de conducción de la planta hasta lo que se denomina la “platanera”. Cuarto, autorizar al Alcalde a solicitar los recursos necesarios para el cambio de tubería de la manera más rápida posible, y que los trabajos se realicen bajo la modalidad de contratación de urgencia, según el artículo 66 de la ley de contratación administrativa.Debe incorporar al expediente una justificación detallada que explique por qué se determinó la necesidad de utilizar este procedimiento especial, así como el mecanismo para seleccionar al contratista. Quinto, proceder de inmediato al cambio de la tubería de la planta de tratamiento hacia Paraíso. Sexto, el Alcalde tendrá un plazo de 30 días calendario para brindarnos el primer informe. Séptimo, solicitar al señor Alcalde que presente en la próxima sesión un informe especial sobre los trabajos realizados en la planta, con explicaciones técnicas que serán valoradas por un profesional en Ingeniería Hidráulica de una Institución Gubernamental. Octavo-por la gravedad de los hechos, proceda el señor Alcalde a realizar una auditoria en el departamento de acueductos en donde se valora. Noveno-Para que el departamento de acueductos realice un estudio para comprobar la existencia de expedientes de proyectos como de información referente a la red de distribución, captaciones de agua, estudios tarifarios del servicio y el Reglamento del Acueducto.Decimo-para determinar las situaciones que afectan el sistema de control interno del Acueducto, así como otras que tiene incidencia sobre el logro de los objetivos del departamento de acueducto Decimoprimero: Para que toda la información del acueducto, estudios, etc. sean protegidos por la municipalidad de Paraíso en su servidor para que sea consultado por los profesionales de turno y el señor Alcalde. Décimo segundo: Todos los funcionarios del departamento utilizaran computadoras de la Institución, y se prohíbe mantener información de esta municipalidad en computadoras privadas, dicha información estará al servicio de los profesionales de acueductos, pudiendo acceder a la misma y consultarla de esta función se ocupará el TI de esta municipalidad quien procederá a solicitar la información y tenerla disponible para todos los funcionarios. Décimo Tercero, siendo que, el Jefe del departamento es el que utiliza el presupuesto, que proceda a comprar las licencias para programas de computación que demande para su trabajo, así como el equipo de cómputo requerido para correr los programas que se requieran.Décimo Cuarto-Aquel funcionario que se niegue a entregar la información de la que es propietaria esta municipalidad, se considerara, falta grave, y se sancionará según lo establecido en nuestro ordenamiento jurídico. Décimo Quinto: Todos los funcionarios que tengan menos de 10 años de trabajar en esta institución estarán obligados a realizar sus marcas respetivas en reloj que un plazo de 48 horas el señor Alcalde procederá ponerlo a funcionar so pena de ser denunciado por este Concejo. Con la enmienda que se faculte al señor Alcalde para que contrate por servicios especiales o profesionales los Ingenieros que se requieran en el Acueducto Municipal. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO (…)”. Solicita se declare sin lugar el recurso.
  5. 5Mediante constancia de 22 de junio de 2023, se indica que no consta que el Jefe del Departamento del Acueducto Municipal de la Municipalidad de Paraíso rindiera el informe solicitado ante esta Sala.
  6. 6En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Cuestión preliminar. En vista de que el Jefe del Departamento del Acueducto Municipal de la Municipalidad de Paraíso omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de 16:33 horas de 29 de mayo de 2023, y de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional, se tienen por ciertos los hechos en cuanto a ese funcionario y se procede a analizar la constitucionalidad con base en lo expuesto por el recurrente y lo informado por las demás autoridades.

II.Objeto del recurso. La recurrente considera lesionados sus derechos fundamentales, toda vez que acusa que ella y los amparados son vecinos del sector Sur de Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz y La Castilla) y todos cuentan con un problema en virtud de la falta de suministro de agua potable. Asegura que esto se debe a la construcción de un nuevo condominio cercano a sus viviendas y que, por ello, han acudido ante las autoridades de la Municipalidad de Paraíso a solicitar que les brinden colaboración con el problema de agua que tienen, sin que a la fecha se haya realizado acción alguna para ayudarles. Sostiene que requieren de agua potable para satisfacer sus necesidades básicas.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)La recurrente y los amparados son vecinos del sector Sur de Paraíso de Cartago (Residencial Vistas del Valle, Las Vicentinas, El Caíz y La Castilla) (hecho incontrovertido).
  • 2)La producción de las nacientes que dotan de agua al sector sur de Paraíso disminuyó en un 68% desde enero de 2023 (ver informe rendido bajo juramento por la autoridad recurrida).
  • 3)El caudal que proviene del proyecto Orosi -a pesar de que a la Municipalidad de Paraíso le corresponde un caudal de 50 litros por segundo de la planta potabilizadora ubicada en Cartago-, para junio de 2023 les estaba entrando un caudal no mayor a 32 litros por segundo, lo que ha imposibilitado tener capacidad del almacenamiento de agua potable para satisfacer la demanda durante las horas pico (ver informe rendido bajo juramento por la autoridad recurrida).
  • 4)En la sesión ordinaria No. 240 del 25 de abril de 2023, el Concejo Municipal tomó el siguiente acuerdo: “ACUERDO 5: Se acuerda por unanimidad Dispensar de Trámite de Comisión. Se acuerda por unanimidad autorizar al Ing. Carlos Ramírez Sánchez, Alcalde Municipal, a firmar un convenio de compra de agua a la Municipalidad de Cartago y se inyecte a la tubería de la zona sur. Que se trabaje en la conexión del pozo de la Laguna como se está previsto. Que se haga una investigación de las tomas ilegales y de urbanizaciones irregulares en la zona y que se presente el día de mañana personal del Acueducto, el Jefe de Acueducto y el señor Alcalde a la zona afectada, para ser recibidos por una comisión de vecinos. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO” (ver informe rendido bajo juramento por la autoridad recurrida).
  • 5)En la sesión ordinaria No. 245 de 23 de mayo de 2023, el Concejo Municipal toma los siguientes acuerdos: “(…) Ante moción presentada por el Regidor Rodríguez Araya. “ACUERDO 8: Con cinco votos positivos y dos votos negativos (regidores Sánchez Soto y Solano Moya) se acuerda solicitar al Ing. Carlos Ramírez Sánchez, Alcalde Municipal, que a partir de mañana contrate cisternas certificadas por el Ministerio de Salud para repartir agua a la población. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO (…) Ante moción presentada por el regidor Sánchez Soto. ACUERDO 9: Se acuerda por unanimidad aprobar la moción presentada por el regidor Sánchez Soto. POR LO TANTO: que la administración municipal: 1-Refuerce debidamente el reparto de agua por medio de tanques cisterna para que pueda atender con prontitud a la población que lo requiera. 2- Realice la labor que le corresponde realizar para que la institución pueda contar con los servicios en tiempo extraordinario del Ingeniero Juan Carlos Porras, jefe del departamento del Acueducto Municipal, único ingeniero y con casi tres años de laborar para el acueducto, siendo la persona más adecuada para que maneje la difícil situación por la que atraviesa el acueducto.

ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. (…) Y ante moción del regidor Rodríguez Araya, sobre el faltante de agua de la Planta potabilizadora de AyA: Se acuerda por unanimidad aprobar la moción presentada por el regidor Rodríguez Araya. POR LO TANTO: Primero, que el señor Alcalde proceda con los técnicos a colocar un flujómetro en la boca de salida del agua. Segundo, autorizar al señor Alcalde a contratar a un ingeniero hidráulico, por la vía de Servicios Especiales o Profesionales, para que nos brinde un informe sobre lo que se debe hacer en la planta y si los trabajos realizados cumplen con los requisitos de esta municipalidad. Debe incorporar al expediente una justificación detallada que explique por qué se determinó la necesidad de utilizar este procedimiento especial, así como el mecanismo para seleccionar al contratista. Decimo-para determinar las situaciones que afectan el sistema de control interno del Acueducto, así como otras que tiene incidencia sobre el logro de los objetivos del departamento de acueducto Decimoprimero: Para que toda la información del acueducto, estudios, etc. sean protegidos por la municipalidad de Paraíso en su servidor para que sea consultado por los profesionales de turno y el señor Alcalde. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO (…)” (ver informe rendido bajo juramento por la autoridad recurrida).

  • 6)La municipalidad mediante el número de proceso de licitación No. 006620200000100036 en el sistema SICOP, realizó la contratación para la perforación de un pozo profundo de agua potable que tiene una producción de 9 litros por segundo, al cual sólo le hace falta realizar la conexión de electricidad con la JASEC para iniciar operaciones (ver informe rendido bajo juramento por la autoridad recurrida).
  • 7)Dentro de las mejoras realizadas por el municipio se encuentran: 1) se sustituirán 150 metros de la línea de conducción de la planta potabilizadora ubicada en Cartago, la cual suple varios sistemas del acueducto municipal, incluida la zona de presión “Paraíso Sur”, esto con el fin de remover la tubería vieja de una caja de registro perteneciente al acueducto municipal de Cartago y tener un mejor flujo de agua a la salida de la planta; y 2) descubrir válvulas que se encontraban sepultadas por reparaciones de carreteras, además de que se descubrió un bloqueo de una línea de tubería de 3 pulgadas causado por una piedra (ver informe rendido bajo juramento por la autoridad recurrida).
  • 8)El 31 de mayo y el 2 de junio, ambos de 2023, se notificó a las autoridades recurridas la resolución de curso de este proceso (ver actas de notificación).

III.Sobre el fondo. La jurisprudencia de la Sala, en materia de suministro de agua potable, se ha dirigido, fundamentalmente, a la protección del derecho a la vida y a la salud de las personas físicas. Esos derechos implican la posibilidad de exigir ciertas prestaciones del Estado, ámbito en el cual el aquel se ve obligado a proporcionar algunos servicios públicos, sobre todo los que resultan esenciales para mantener condiciones sanitarias favorables a la preservación de la vida y la salud de las personas. De este modo, garantizar la pureza del líquido para consumo humano, así como la continuidad en el suministro de éste, forman parte de un debido y eficiente servicio al abonado y, a su vez, garantiza sus derechos fundamentales más elementales (sentencia no. 04253-2014 de las 09:15 hrs. de 28 de marzo de 2014). Adicionalmente, en relación con los problemas de abastecimiento de agua potable, la Sala ha sostenido que, en el tanto las autoridades recurridas demuestren que se ha actuado dentro de sus posibilidades materiales para lograr un adecuado abastecimiento, no quebranta los derechos fundamentales de las personas si este se ofrece con algunas irregularidades de caudal u horario de suministro (ver, al respecto, el criterio de esta Sala en las sentencias Nos. 2008-9714 de las 10:39 hrs. de 13 de junio; 2009-12511 de las 17:59 hrs. de 11 de agosto de 2009, 2010-15448 de las 12:15 hrs. de 17 de setiembre del 2010, 2011-006603 de las 11:50 hrs. de 20 de mayo de 2011, 2013-004338 de las 14:30 horas del 2 de abril de 2013, 2020-011749 de las 9:05 horas del 26 de junio de 2020).

IV.Sobre el caso concreto. En el sub examine, la recurrente considera lesionados sus derechos fundamentales, toda vez que acusa que ella y los amparados son vecinos del sector Sur de Paraíso (Residencial Vistas del Valle, Las Vicentinas, El Caíz y La Castilla) y todos cuentan con un problema en virtud de la falta de suministro de agua potable. Asegura que esto se debe a la construcción de un nuevo condominio cercano a sus viviendas y que, por ello, han acudido ante las autoridades de la Municipalidad de Paraíso a solicitar que les brinden colaboración con el problema de agua que tienen, sin que a la fecha se haya realizado acción alguna para ayudarles. Sostiene que requieren de agua potable para satisfacer sus necesidades básicas.

Al respecto, se tiene por acreditado que, la recurrente y los amparados son vecinos del sector Sur de Paraíso de Cartago (Residencial Vistas del Valle, Las Vicentinas, El Caíz y La Castilla. Asimismo, también se pudo verificar que existen una serie de problemas con el abastecimiento de agua en el cantón de Paraíso, específicamente, en la zona conocida como Paraíso Sur. Sin embargo, se tuvo por acreditado que esta situación no obedece a decisiones antojadizas ni arbitrarias de la Municipalidad de Paraíso, sino que, se ocasionó por diversas razones, entre ellas: a) disminución de la producción de las nacientes que dotan de agua al sector sur de Paraíso en un 68% desde enero de 2023, b) caudal no mayor a 32 litros de los 50 litros que les corresponden provenientes de la plata potabilizadora ubicada en Cartago, c) válvulas que se encontraban sepultadas por reparaciones de carreteras y un bloqueo de una línea de tubería de 3 pulgadas causado por una piedra, entre otras cosas, lo cual ha incidido en la situación reclamada por la recurrente.

No obstante lo anterior, contrario a lo alegado en el escrito de interposición, se pudo verificar que, las autoridades de la Municipalidad de Paraíso tienen conocimiento de los hechos, y de previo a la notificación del recurso, ya habían realizado una serie de acciones con el fin de solucionarlo y darle una atención adecuada a los vecinos de la zona, tales como: a) sustituir 150 metros de la línea de conducción de la planta potabilizadora ubicada en Cartago, la cual suple varios sistemas del acueducto municipal, incluida la zona de presión “Paraíso Sur”, esto con el fin de remover la tubería vieja de una caja de registro perteneciente al acueducto municipal de Cartago y tener un mejor flujo de agua a la salida de la planta; b) descubrir válvulas que se encontraban sepultadas por reparaciones de carreteras, además de que se descubrió un bloqueo de una línea de tubería de 3 pulgadas causado por una piedra; c) contratación para la perforación de un pozo profundo de agua potable que tiene una producción de 9 litros por segundo, al cual sólo le hace falta realizar la conexión de electricidad con la JASEC para iniciar operaciones y; d) reforzar el reparto de agua por medio de tanques cisterna para atender a la población que lo requiera.

Por lo expuesto, teniendo como parámetro de actuación el criterio supra jurisprudencial señalado, esta Sala descarta que en el presente asunto se esté ante una actuación ilegítima o arbitraria. En este sentido, se tiene por acreditado que las afectaciones y las condiciones de racionamiento de agua en el sector sur de Paraíso se han producido por causas objetivas y que han sido combatidas por las autoridades municipales para restablecer el suministro normalizado de agua potable a la población desde antes de la interposición de este recurso y la notificación de la resolución de curso. De esta forma, las actuaciones descritas en el párrafo anterior dan cuenta de que la municipalidad instó las coordinaciones necesarias para atender el problema que estaba afectando a la población. Además, se comprobó que, en todo momento se ha brindado a los vecinos del líquido mediante la distribución de un camión cisterna. En consecuencia, al no verificarse acción u omisión alguna por parte de las autoridades recurridas en cuanto a los hechos acusados en el recurso, lo procedente es declararlo sin lugar, como en efecto se dispone.

V.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara sin lugar el recurso.
