Writ of amparo (recurso de amparo) being processed under expediente nro. 24-014638-0007-CO, filed by [Nombre01 001], identity card [CED01], in their capacity as president of the [...], Nombre02, against BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI) and MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Facts:
He adds that, by suspending the housing application process in their communities, the respondent bank has left hundreds of children, women, men, and elderly persons unprotected, failing to fulfill its duties and violating their rights and access to adequate housing.” BANHVI’s Response: It is important to emphasize that, through the issuance of official letter (oficio) BANHVI-SGO-CI-0002-2024, as previously indicated, indigenous peoples are in no way being denied the right to a housing subsidy (bono de vivienda). They may continue applying through authorized entities, and the construction materials for the homes may include masonry, lightweight materials, imported wood, among others, provided that the applicable construction standards are met. The fact that BANHVI informed them that applications involving wood harvested within indigenous territory could temporarily no longer be processed is attributable to the fact that the indigenous community itself filed the appeal against decreto ejecutivo 27800-MINAE concerning the use of indigenous forest resources (recurso forestal indígena); at present, there are no regulations that do not conflict with environmental laws, and therefore developing projects using domestically sourced indigenous wood would cause us to be in contempt of a ruling issued by the Sala Constitucional itself.
This bank has already submitted the corresponding inquiry to the Ministerio de Ambiente y Energía so that it may determine under which regulations the use of wood from indigenous territories may be resumed. 4. “He states that, by issuing this instruction, the bank also left many families without work and without the possibility of earning an income, since his community works hand in hand with the companies that build their homes, thereby obtaining income that is important for their subsistence, causing evident collateral harm and also violating their constitutional right to work.” BANHVI’s Response: One of the collateral benefits of housing construction nationwide is the creation of economic linkages and sources of employment; however, it is important to clarify, as previously stated, that this suspension does not affect the construction of homes using other construction systems and that the hiring of labor or purchase of wood is a private contractual relationship over which the Bank has neither authority nor involvement.
Conclusion: This Bank issued the decision to suspend the processing of Family Housing Subsidies (Bonos Familiares de Vivienda, BFV) for homes intended to be built using wood from indigenous territories as raw material. This measure is temporary and has the sole purpose of obtaining a response from MINAE as to whether there is a current and effective regulation permitting the use of this construction resource. Should MINAE clarify that such a regulation exists, official letter BANHVI-SGO-CI-0002-2024 will immediately be rendered ineffective, while always acting in accordance with the principle of legality (principio de legalidad) governing public service. Attached to this official letter is Sala Constitucional Decision 5620-2016 of April 27, 2016.”
I hereby inform you that I have no information in this regard; however, I will submit the inquiry to the central level so that your request may be properly routed.” The foregoing was done as evidenced by official letter SINAC-ACLAC-DR-0446-2024 of 17 de mayo del 2024, whereby I forwarded the request for information to Mr. Juan José Jiménez Espinoza, Head of the Citizen Participation and Governance Department, in connection with the matters stated in official letter BANHVI-SGO-CI-0002-2024. Whereas section 7 of Ley Indígena N° 6172 expressly provides that: “Lands located within the reserves that are suitable for forestry use (vocación forestal) must retain that status so as to preserve the hydrological balance of the watersheds and conserve the wildlife of those regions. Renewable natural resources must be used rationally. Forestry programs may be carried out only by State institutions that guarantee the permanent renewal of forests, subject to the authorization and oversight of CONAI.
The indigenous reserve guards appointed by the Government shall be responsible for protecting and monitoring the forests. CONAI is expressly empowered to revoke or suspend permits issued at any time when it determines that the resources are being overexploited or that the ecological balance of the region is being endangered.” (Emphasis added) Accordingly, resource use (aprovechamiento) in indigenous reserves must be governed by a standard of reasonableness, an obligation imposed on the competent entities within the framework of their statutory powers. This point was emphasized in resolution 2022010550 of 11 de mayo del 2022 of the Sala Constitucional, which stated: “IV.- The petitioner is advised that, irrespective of whether decreto ejecutivo n.º 27800-MINAE remains in force, the competent State bodies, including MINAE and CONAI, must safeguard the country’s forests and natural wealth in compliance with the applicable legal obligations.
Moreover, it should be noted that regulatory provisions cannot render legally established protections ineffective. In this regard, section 7 of Ley Indígena provides for the preservation of forest resources located within indigenous reserves: (…) It follows from the provision that the forest cover (cobertura boscosa) of indigenous reserves must invariably be maintained and that any potential forest utilization (aprovechamiento forestal) must respect the designated use of the area or zone concerned, so that the ecological balance remains unaltered. The Sala underscores that the obligation to ensure a healthy and ecologically balanced environment (section 50 of the Constitution) applies throughout our legal system. For this reason, no public or private party may consider itself exempt from safeguarding that balance. Compliance with such protection must unquestionably be enforced by the competent State bodies.” (Emphasis added) Whereas, in opinion number PGR-C-253-2021 of 06 de setiembre del 2021, issued in response to an inquiry from Sistema Nacional de Áreas de Conservación, Procuraduría General de la República stated as follows: “At this point, it is important to note that Article 7° of Ley N° 6172, Ley Indígena, contains regulations concerning lands suitable for forestry use that are located within an indigenous reserve, providing that such lands must retain that status so as to preserve the hydrological balance of the watersheds and conserve the wildlife of those regions.
Renewable natural resources must be used rationally. Forestry programs may be carried out only by State institutions that guarantee the permanent renewal of forests, subject to the authorization and oversight of CONAI. This section states: ‘Article 7º.- Lands located within the reserves that are suitable for forestry use must retain that status so as to preserve the hydrological balance of the watersheds and conserve the wildlife of those regions. Renewable natural resources must be used rationally. Forestry programs may be carried out only by State institutions that guarantee the permanent renewal of forests, subject to the authorization and oversight of CONAI. The indigenous reserve guards appointed by the Government shall be responsible for protecting and monitoring the forests. CONAI is expressly empowered to revoke or suspend permits issued at any time when it determines that the resources are being overexploited or that the ecological balance of the region is being endangered.’ It follows from the foregoing that any program SINAC intends to carry out in these areas must be conducted under the authorization and oversight of CONAI.
Furthermore, any State measure intended to administer or limit the exploitation of natural resources located within indigenous reserves must be submitted for consultation with the indigenous population, in compliance with the international commitments undertaken by the country to protect these communities (decisions 2008-13832 at 8:38 hours on 11 de setiembre de 2008, 17058-2012 at 16:00 hours on 5 de diciembre de 2012, and 5620 – 2016 at 11:53 hours on 27 de abril de 2016 of the Sala Constitucional). Consequently, any determination or regulation that the governing authority intends to implement for environmental conservation within indigenous reserves must first be submitted for consultation with the indigenous people and authorized by CONAI because—as already noted—the exploitation of natural resources located in indigenous territories is a right recognized internationally for this population as part of the effective exercise of its traditions, customs, and culture (Articles 14 and 15 of Convenio No.169 sobre Pueblos Indígenas y Tribales en Países Independientes).” (Emphasis in the original) Whereas the inquiry conducted in Nombre06 confirmed that Decreto Ejecutivo N° 27800-MINAE was repealed by judgment number 5620 of the Sala Constitucional dated 27 de abril del 2016, which stated: “The action is granted.
Consequently, Decreto Ejecutivo Nº 27800-MINAE, entitled Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, published in La Gaceta Nº 79 of 29 de abril de 1999, is declared unconstitutional for violating Articles 6 subsection 1.a and 7 subsections 1 and 4 of Convenio Nº 169 de la OIT, because the mandatory prior consultation with Indigenous Peoples was omitted before its issuance. Pursuant to section 91 of Ley de la Jurisdicción Constitucional, and in order to prevent serious and irreparable environmental harm, the effects of this judgment are limited such that it is rendered without prejudice to rights acquired in good faith, and the challenged decree shall remain in force for a period of 4 years from publication of the summary of this judgment in Diario Oficial La Gaceta, within which period Poder Ejecutivo must conduct the corresponding consultation with the Indigenous Peoples, either to extend the validity of this same decree or to amend it.
Notice shall be served on the petitioner, Procuradora General de la República, Presidente de la República, Ministro de Ambiente y Energía, and Presidente de la Junta Directiva de la Comisión Nacional de Asuntos Indígenas. The judgment shall be published in full in Boletín Judicial, and a summary shall be published in Diario Oficial La Gaceta. Magistrada Hernández López provides additional reasons. Magistrado Hernández Gutiérrez dissents and would deny the action.” Whereas the limitation of the judgment’s effects provides for the possibility that Poder Ejecutivo may extend the validity of decreto ejecutivo número 27800-MINAE (beyond the 4 years granted by the Sala Constitucional) or amend it, following the corresponding prior consultation with the indigenous peoples. Whereas, according to the records of Direccion Ejecutiva del Sistema Nacional de Áreas de Conservación, there is no pending submission awaiting a response to Nombre01 from Mr. [Nombre01 001] concerning the matters set forth in the amparo petition (recurso de amparo).
It should be clarified that, as previously stated in this report, on 17 de mayo del 2024 Mr. [Nombre01 001] requested a meeting with Ms. Maylin Mora Arias in connection with note BAHNVI-SGO-CI-0002-2024 issued by Banco Hipotecario de la Vivienda, for which the regional office requested the corresponding advice, as recorded in item 2 of this report and official letter SINAC-ACLAC-DR-0446-2024.¨ Conclusion Therefore, Article 7° of Ley N° 6172, Ley Indígena, contains regulations concerning lands suitable for forestry use located within an indigenous reserve, providing that such lands must retain that status so as to preserve the hydrological balance of the watersheds and conserve the wildlife of those regions. Renewable natural resources must be used rationally. Forestry programs may be carried out only by State institutions that guarantee the permanent renewal of forests, under Comisión Nacional de Asuntos indígenas (CONAI), created by Ley N° 5251 of 11 de julio de 1973, which must oversee the existing natural resources and authorize any measure that MINAE, as the governing authority, seeks to issue.
The record establishes that Decreto Ejecutivo N° 27800-MINAE was repealed by judgment number 5620 of the Sala Constitucional dated 27 de abril del 2016, which stated: ¨The action is granted. Consequently, Decreto Ejecutivo Nº 27800-MINAE, entitled Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, published in La Gaceta Nº 79 of 29 de abril de 1999, is declared unconstitutional for violating Articles 6 subsection 1.a and 7 subsections 1 and 4 of Convenio Nº 169 de la OIT, because the mandatory prior consultation with Indigenous Peoples was omitted before its issuance. Pursuant to section 91 of Ley de la Jurisdicción Constitucional, and in order to prevent serious and irreparable environmental harm, the effects of this judgment are limited such that it is rendered without prejudice to rights acquired in good faith, and the challenged decree shall remain in force for a period of 4 years from publication of the summary of this judgment in Diario Oficial La Gaceta, within which period Poder Ejecutivo must conduct the corresponding consultation with the Indigenous Peoples, either to extend the validity of this same decree or to amend it.

Magistrado Hernández Gutiérrez dissents and would deny the action.” In accordance with the foregoing, the limitation of the judgment’s effects provides for the possibility that Poder Ejecutivo may extend the validity of Decreto ejecutivo número 27800-MINAE (beyond the 4 years granted by the Sala Constitucional) or amend it, following the corresponding prior consultation with the indigenous peoples. This authority must be exercised within the framework of the powers established in subsections 3) and 18) of Article 140 of Constitución Política and Articles 25, 27.1, 28.2b of Ley General de Administración Pública N° 6227, sections 5 and 6 of Ley Forestal N° 7575, as well as the principle of legality established in section 11 of the same statutory instrument.
Accordingly, by official letter DM-0244-2022 dated March 16, 2022, the then Minister of Environment and Energy submitted a request to your Honorable Chamber in expediente 15-004211-0007-CO concerning an extension of the validity period (plazo de vigencia) of Decreto Ejecutivo N° 27800-MINAE, stating, insofar as relevant, the following: “In view of the foregoing, I hereby formally request an extension of the validity period of Decreto Ejecutivo N°27800-MINAE until at least the end of 2024, so that we have time to secure the funds and conduct the relevant consultations, as we understand that the process may require two or more calls for participation in order to complete the consultation.” In response to the request, your honorable authority, by ruling 2022010550 dated May 11, 2022, determined that the request should be denied, providing in point III the following relevant grounds: “If the Chamber were to endorse the Minister’s request on the basis that funds will ‘probably’ be available by mid-to-late 2023, this would merely create legal uncertainty, thereby distorting the purpose of the adjustment of effects (dimensionamiento) provided for in section 91 of the Ley de la Jurisdicción Constitucional.” Therefore, following an inquiry made to Nombre06, it is indeed established that Decreto Ejecutivo N°26511 de 10 de junio de 1997 is not in force and cannot be applied, contrary to what the appellant erroneously asserts in point number 5.
(…) It is important to clarify, as indicated in the report submitted by SINAC, that on May 17, 2024, Mr. [Nombre01 001] requested a meeting with Ms. Maylin Mora Arias concerning note BAHNVI-SGO-CI-0002-2024 issued by Banco Hipotecario de la Vivienda, in response to which the regional office requested the corresponding advice pursuant to official letter SINAC-ACLAC-DR-0446-2024. According to the records of the Direccion Ejecutiva del Sistema Nacional de Áreas de Conservación, there is no request from Banco Hipotecario de la Vivienda concerning note BAHNVI-SGO-CI-0002-2024 that remains pending a response. The actions of Banco Hipotecario de la Vivienda under official letter BAHNVI-SGO-CI-0002-2024 are independent of the decision rendered in judgment number 5620 of the Sala Constitucional dated April 27, 2016, in which the Sala Constitucional concluded that Decreto Ejecutivo N° 27800-MINAE was unconstitutional, in addition to the fact that its validity period has expired; this is not as the appellant seeks to portray it.
It is also requested that notice be served at the correct location, and it is important that this honorable authority take the foregoing into consideration; it should also be noted that this matter is being addressed by the competent body of this Ministry.

Considering:
I.Subject matter of the application. The petitioner claims that Banhvi, through official letter no. BANHVI-SGO-CI-0002- 2024 of 9 de mayo de 2024, suspended the construction of Indigenous housing using timber harvested in Indigenous territories. The petitioner asserts that the bank decided to request clarification from MINAE following this Chamber’s repeal of the Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas no. 27800- MINAE. The petitioner states that the suspension violates the rights of Indigenous Peoples.
II.Proven facts (hechos probados). The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondent failed to address them, as directed in the initial order:
Therefore, until responses are received from these two entities, we suggest informing potential beneficiaries that, for the time being, we may process only Indigenous housing cases that use materials other than timber, or timber that does not originate from Indigenous territories. Regarding pending cases, we will inform you of the options provided to us by MINAE.” (Undisputed fact).
At present, as a result of the constitutional challenge (acción de inconstitucionalidad) filed against Decreto Ejecutivo No. 27800-MINAE by Mr. Nombre04, holder of identity card number CED03, who argued before the Chamber that the challenged decree violated due process because it lacked the required formal, prior, and informed consultation with Indigenous Peoples, this Institution has been left without a regulatory framework under which it may authorize the construction of social-interest Indigenous housing using timber harvested from Indigenous territory. It should be recalled that, through judgment N° 2016-5620 issued at 11:53 hours on 27 de abril de 2016 in expediente number 15-004211-0007-CO, the Constitutional Chamber upheld the action and ruled as follows: ‘The action is upheld. Consequently, Decreto Ejecutivo No. 27800-MINAE, entitled Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, published in La Gaceta No. 79 of 29 de abril de 1999, is declared unconstitutional for violating Articles 6, subsection 1.a, and 7, subsections 1 and 4, of ILO Convention No. 169, because the mandatory consultation with Indigenous Peoples was not conducted before its issuance.
Pursuant to section 91 of the Ley de la Jurisdicción Constitucional, and in order to prevent serious and irreparable environmental harm, the effects of this judgment are delimited such that it is rendered without prejudice to rights acquired in good faith, and the challenged decree shall remain in force for a period of 4 years from the publication of a summary of this judgment in the Official Gazette La Gaceta, during which the Executive Branch must conduct the corresponding consultation with Indigenous Peoples, either to extend the validity of this same decree or to amend it. Notice shall be served upon the petitioner, the Procuradora General de la República, the Presidente de la República, the Ministro de Ambiente y Energía, and the Presidente de la Junta Directiva de la Comisión Nacional de Asuntos Indígenas. The judgment shall be published in full in the Boletín Judicial, and a summary shall be published in the Official Gazette La Gaceta.

Justice Hernández Gutiérrez dissents and would dismiss the action.’ Executive Director Rafael Gutiérrez Rojas of the Sistema Nacional de Áreas de Conservación (SINAC), in a submission added to the expediente on 18 de febrero de 2022, requests an extension of the period of validity of Decreto Ejecutivo N° 27800-MINAE because, to date, it has been materially impossible to conduct the consultation with Indigenous Peoples, and requests that the Nombre03 period established in judgment N° 2016-5620 at 11:53 hours on 27 de abril de 2016, which was 4 years, be used as a reference. Given that the 4-year period granted to keep the challenged decree in force has already expired, the decision issued has been analyzed, and it is considered that, because the Constitutional Chamber repealed Decreto Ejecutivo No. 27800-MINAE, no body of regulations exists that would permit us to continue processing housing subsidies where the raw material used for construction is timber from Indigenous reserves.
In conclusion, in order to avoid future judicial contingencies involving the Asociaciones de Desarrollo Integrales de los Territorios Indígenas, and with the primary objective of respecting the applicable national regulations and, above all, of not violating the right of the inhabitants of Indigenous communities to harvest forest resources (aprovechamiento forestal) within their territories, it is of the utmost importance to this Institution that we be informed whether MINAE has issued new regulations or guidelines concerning the consultation process; whether the repealed Decreto is already undergoing public consultation and, if so, the progress thereof; or, conversely, if no progress has been made because of the consultation issue, what regulations or guidelines this institution may apply to authorize the construction of housing using timber harvested from Indigenous reserves, or whether that option remains unavailable until instructions are issued by your agency.” (See report submitted and evidence provided).
The request for an extension stated that one of the main reasons why the preliminary and enabling activities for the consultation, as well as the consultation itself, had not been carried out was the lack of budgetary resources, and particularly that there appeared to be no possibility that SINAC would be able to access the funds to which it was entitled under the World Bank’s REDD+ Emission Reductions Purchase Agreement until mid-2023. For that reason, the consultation was expected to take place in 2024; however, to date SINAC remains unable to use those funds. 2. Regarding the authority to grant forest-harvesting permits (permisos de aprovechamiento forestal) in Indigenous territories (territorios indígenas). In light of the statements in decision N2 2022010550 of 11 de mayo 2022, the Sala Constitucional reiterates the provisions of Ley Indígena N°6172, specifically article N°7 thereof, which provides: (…) At the beginning of 2023, a working group convened by the then Vice Minister of the Environment, Mr.
Rafel Guitérrez, was instructed to follow up on the issue of the forest-harvesting regulations (reglamento de aprovechamientos forestales) in Indigenous territories. Based on the provisions of article N°7 of Ley N° 6172, this working group reached the following conclusions: 1. The forest resources located in Indigenous territories are renewable natural resources. 2. The article clearly provides that authority to approve and oversee forestry programs conducted in Indigenous territories rests with CONAI. 3. CONAI’s authority to approve and oversee forest-harvesting activities within Indigenous territories is reaffirmed where the article states: ‘CONAI is expressly empowered to revoke or suspend issued permits at any time.’ In addition to the provisions of article N°7 of Ley N°6172, it was considered at that time that the framework governing forest harvesting provides no legal basis for the State Forestry Administration (Administración Forestal del Estado) to assume authority to approve forest harvesting in Indigenous Territories because, as collectively owned lands, the provisions established in articles 19, 20, 21, 27, and 28 of Ley Forestal N°7575 could not apply to them, since the scope of those provisions pertains to individual private property.
Based on those findings and under the coordination of the Vice Minister, it was intended that a process of outreach and coordination with CONAI be initiated. That process never materialized because Mr. Gutiérrez left the Viceministerio de Ambiente, after which no further action was taken. At that time, it was considered advisable for each territory, through its legally or culturally recognized representative bodies, to develop its own regulations or community protocols for exercising the collective right to use its own forest resources. Those territorial regulations would have to be approved by CONAI, again pursuant to article N°7 of Ley N°6172. If the territories deemed it appropriate, SINAC, to the extent permitted by its capabilities and resources, could serve as a specialized technical adviser in preparing proposals for the respective regulations or community protocols. 3. Regarding the consultation process for the forest-harvesting regulations in Indigenous territories.
Consistent with the preceding point, it has been considered that, under Leyes N° 6172 and N° 7575, SINAC lacks authority to approve the harvesting of forest resources located on the communally owned lands comprising an Indigenous territory. Accordingly, SINAC cannot act as an interested counterpart in conducting a consultation process to establish measures permitting the administration or restriction of the use of forest resources in Indigenous territories. This is because Ley N° 6172 has delegated that authority to each territory and to CONAI. 4. Regarding the use of timber from Indigenous territories to construct homes financed through the family housing subsidy (bono familiar de vivienda) for Indigenous persons. The undersigned considers that imposing a restriction on the use of timber located within those same territories for the construction of family-housing-subsidy homes for Indigenous persons, such as the measure described in official letter BANHVI-SGO-Cl-0002-2024, could impair the full enjoyment of Indigenous peoples’ collective rights.
It is therefore suggested that the BANHVI authorities seek advice and information from CONAI to enable a better-informed decision on this matter, taking into consideration the provisions of article N°7 of Ley N° 6172.” (See evidence submitted by the petitioner).
III.Regarding the specific case. In the case under review (sub examine), the petitioner alleges that Banhvi, through official letter no. BANHVI-SGO-CI-0002- 2024 of 09 de mayo de 2024, suspended the construction of Indigenous housing using timber extracted from Indigenous territories. The petitioner asserts that the bank made the decision to request clarification from MINAE following this Sala’s repeal of Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas no. 27800- MINAE. The petitioner contends that the aforementioned suspension violates the rights of Indigenous peoples.
Having reviewed the case record, the Chamber found it proven that, by official communication (oficio) BANHVI-SGO-CI-0002-2024 dated May 9, 2024, addressed to the credit directors or heads of the Sistema Financiero Nacional para la Vivienda, Banhvi’s Deputy Operations Manager stated: “We hereby inform you that the ‘Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas N° 27800-MINAE,’ which authorizes the use of timber from indigenous territories, has been repealed by Constitutional Chamber judgment (resolución) N° 5620 dated April 27, 2016, which declared it unconstitutional. In that same judgment, the Ministerio de Ambiente y Energía (MINAE) was granted a period of 4 years to conduct the corresponding consultation with the indigenous peoples, either to extend or amend it. Since the period granted by the Chamber has elapsed and there is still no information that MINAE has conducted that consultation, this Bank decided to request the pertinent clarifications from the Constitutional Chamber, so that it may indicate whether the repeal of Decreto No. 27800 reinstates the application of the prior Reglamento; and from MINAE regarding how to proceed with applications for the family housing subsidy (bono familiar de vivienda) submitted to authorized entities that are undergoing approval and whose purpose is construction using timber extracted from indigenous territory.
Therefore, until we receive a response from these two entities, we suggest informing potential beneficiaries that, for the time being, we can process only indigenous housing cases that use materials other than timber, or timber that does not originate in indigenous territories. With regard to pending cases, we will inform you of the options provided to us by MINAE.” On May 17, 2024, the appellant (recurrente) sent an email to Área de Conservación La Amistad Caribe (ACLAC) of SINAC to inquire about the foregoing official communication. On May 17, 2024, the Regional Director of ACLAC replied to the appellant that she had no information on the matter. Nevertheless, she would make an inquiry at the central level in order to channel his request. By official communication SINAC-ACLAC-DR- 0446-2024 dated May 17, 2024, the Regional Director of ACLAC forwarded the request to the Head of the Departamento de Participación Ciudadana y Gobernanza.
By official communication BANHVI-SGO-OF-0125-2024 dated June 7, 2024, Bahnvi’s Deputy Operations Manager stated to the Minister of Ambiente y Energía: “Please accept cordial greetings from the administration of the Banco Hipotecario de la Vivienda (BANHVI). As you are aware, our institution has a duty to ensure compliance with the constitutional right to decent housing for all citizens of our country, as well as to ensure that the formalization process and subsequent construction of their homes comply with the technical standards and requirements established by the Sistema Financiero Nacional para la Vivienda. We currently face a legal issue in processing family housing subsidy applications for indigenous persons. I will provide a brief explanation: in family subsidy cases in indigenous territories, families are given the option of arranging for the construction of their homes using timber extracted from the indigenous territory, for which BANHVI recognizes payment for the timber as part of the financing.
At present, as a result of the constitutional challenge (acción de inconstitucionalidad) filed against Decreto Ejecutivo No. 27800-MINAE by Mr. Nombre04, bearer of identity card number CED03, who argued before the Chamber that the challenged decree violated due process (debido proceso) because it had not been subjected to the required formal, prior, and informed consultation with indigenous peoples, this Institution has been left without a regulatory framework under which it may authorize the construction of social-interest indigenous housing using timber extracted from indigenous territory. It should be recalled that, by judgment N° 2016-5620 issued at 11:53 a.m. on April 27, 2016, in expediente number 15-004211-0007-CO, the Constitutional Chamber upheld the action and stated as follows: ‘The action is upheld. Consequently, Decreto Ejecutivo No. 27800-MINAE, entitled Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, published in La Gaceta No. 79 on April 29, 1999, is declared unconstitutional for violating Articles 6(1)(a) and 7(1) and (4) of ILO Convention No. 169, because the mandatory consultation with the Indigenous Peoples was omitted prior to its issuance.

Given that the 4-year period granted to keep the challenged decree in force has already expired, the judgment issued has been analyzed, and it is considered that, following the Constitutional Chamber’s repeal of executive decree No. 27800-MINAE, there is no body of regulations that allows us to continue processing housing subsidies where the raw material used for construction is timber from indigenous reserves.
In conclusion, in order to prevent future judicial disputes with the Asociaciones de Desarrollo Integrales de los Territorios Indígenas, and with the overriding objective of respecting the national regulations governing this matter and, above all, of not violating the right of the inhabitants of indigenous communities to forest harvesting (aprovechamiento forestal) in their territories, it is of the utmost importance to this Institution that we be informed whether MINAE has issued new regulations or guidelines concerning the consultation process; whether the repealed Decree is already undergoing public consultation and, if so, how far that process has progressed; or, conversely, if no progress has been made because of the consultation issue, what regulations or guidelines this Institution may apply to authorize the construction of homes using timber extracted from indigenous reserves, or whether that option instead remains unavailable until instructions are issued by your agency.” By official communication SINAC-SE-DPCG-2024 dated June 11, 2024, the Head of the Departamento de Participación Ciudadana y Gobernanza replied to the Regional Director of ACLAC: “As correctly stated in official communication BANHVI-SGO-CI-0002-2024, Decreto N° 27800 — MINAE was repealed by Constitutional Chamber judgment N°5620 dated April 27, 2016; however, the summary of the decision was published in La Gaceta N° 79 on February 28, 2018, and therefore the 4-year period granted to SINAC in that judgment extended until February 28, 2022.
By official communication DM-0244-2022 dated March 16, 2022, the Minister of Ambiente, Ms. Andrea Meza Murillo, requested that the Constitutional Chamber grant an extension through the end of 2024. A response was received in judgment N° 2022010550 dated May 11, 2022, which denied the request submitted by Ms. Meza Murillo, and Decreto N° 27800 — MINAE was therefore repealed. That extension request stated that one of the main reasons why the preliminary and enabling activities for the consultation, as well as the consultation itself, had not been carried out was the lack of budgetary resources, particularly because there appeared to be no possibility that SINAC could access the funds to which it was entitled under the World Bank’s REDD+ emissions purchase agreement until mid-2023. For that reason, it was anticipated that the consultation would be conducted in 2024; however, to date, SINAC remains unable to use those funds. 2.
Authority to grant forest-harvesting permits (permisos de aprovechamiento forestal) in indigenous territories. In light of judgment N2 2022010550 dated May 11, 2022, the Constitutional Chamber reiterates the provisions of Ley Indígena N°6172, specifically Article N°7 thereof, which states: (…) At the beginning of 2023, a working group convened by the then Vice Minister of Ambiente, Mr. Rafel Guitérrez, was instructed to follow up on the issue of regulations governing forest harvesting in indigenous territories. CONAI’s authority to authorize and oversee forest-harvesting activities within indigenous territories is reaffirmed when the Article states: ‘CONAI is expressly empowered to revoke or suspend issued permits at any time.’ In addition to the provisions of Article N°7 of Ley N°6172, it was considered at the time that the framework governing forest harvesting provides no legal basis for the Administración Forestal del Estado to assume authority to authorize forest harvesting in Indigenous Territories, because, since these are collectively owned lands, the provisions governed by Articles 19, 20, 21, 27, and 28 of Ley Forestal N°7575, whose scope applies to individually owned private property, could not be applied to them.
Based on those findings and under the coordination of the Vice Minister, the intention was to begin a process of engagement and coordination with CONAI. That process was never completed because Mr. Gutiérrez left the Viceministerio de Ambiente, after which no further action was taken. At that time, it was considered advisable for each territory, through its legally or culturally recognized representative bodies, to develop its own regulations or community protocols governing the exercise of the collective right to use its own forest resources. Those territorial regulations would have to be authorized by CONAI, once again pursuant to Article N°7 of Ley N°6172; and, if the territories so desired, SINAC could, to the extent permitted by its capacity and resources, serve as a specialized technical adviser in preparing proposals for the respective regulations or community protocols.
3. Regarding the consultation process for the forest utilization regulations in Indigenous territories (territorios indígenas). Consistent with the foregoing point, in which it has been considered that, pursuant to Leyes N° 6172 and N° 7575, SINAC lacks authority to authorize the utilization of forest resources (aprovechamiento de recursos forestales) located on communally owned lands comprising an Indigenous territory, SINAC therefore cannot act as an interested counterpart in conducting a consultation process to establish measures allowing for the management or restriction of the use of forest resources in Indigenous territories. This is because Ley N° 6172 has delegated this authority to each territory and to CONAI. 4. Regarding the use of timber from Indigenous territories to build homes financed through the family housing subsidy (bono familiar de vivienda) for Indigenous persons. The undersigned considers that imposing a restriction on the use of timber located within those same territories for the construction of family housing subsidy homes for Indigenous persons, such as the measure indicated in official letter BANHVI-SGO-Cl-0002-2024, could adversely affect the full enjoyment of the collective rights of Indigenous peoples; BANHVI authorities are therefore advised to request guidance and information from CONAI to better resolve this matter, taking into consideration the provisions of article N°7 of Ley N° 6172.” Now, the Chamber finds that Banhvi suspended the processing of benefits for Indigenous housing involving the use of wood because of the need to conduct consultations regarding the possibility of harvesting that resource, given that the Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas (decree no. 27800-MINAE) was annulled by the Constitutional Chamber.
For that reason, it sent official communications both to this Court and to MINAE. It is understood that, once the legal situation has been clarified, a decision would then be made regarding the processing of those benefits. Subsequently, through official communication BANHVI-SGO-OF-0125-2024 dated 7 de junio de 2024, the deputy operations manager of Bahnvi submitted the corresponding inquiry to the Minister of Environment and Energy. In addition, within SINAC, the Department of Citizen Participation and Governance issued its legal opinion on the matter in question (official communication SINAC-SE-DPCG-2024 dated 11 de junio de 2024).
Upon assessing these elements, the Chamber finds no violation of the rights of the protected party (parte amparada). Indeed, Banhvi conducted an interinstitutional consultation to obtain clarity regarding the sustainable and lawful exploitation of forests. In the interim, it decided to suspend benefits that would entail the exploitation of timber resources. In other words, given the uncertainty regarding potential environmental harm, the Chamber endorses the adoption of preventive measures by state institutions until certainty is obtained regarding the possibility of rationally and sustainably exploiting the natural resource. Likewise, considering that the challenged suspension was imposed through official communication no. BANHVI-SGO-CI-0002-2024 dated 9 de mayo de 2024, the Chamber finds that, when the amparo proceeding (recurso de amparo) was filed (31 de mayo de 2024), an unreasonable period had not elapsed for the respondent bodies to decide the matter. In view of the foregoing, the petition is denied.
IV.The respondent authorities shall take note of the need to promptly address the situation at issue in these proceedings so as to provide legal certainty regarding the challenged legal situation.
V.Documentation submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Notice is given that any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Full Court under Article XXVI of session no. 27-11 held on 22 de agosto de 2011, published in Judicial Bulletin no. 19 dated 26 de enero de 2012, as well as the resolution of the Superior Council of the Judiciary approved under Article LXXXI of session no. 43-12 held on 3 de mayo de 2012.

Recurso de amparo que se tramita en el expediente nro. 24-014638-0007-CO, interpuesto por [Nombre01 001], cédula de identidad [CED01], en su condición de presidente de la [...], Nombre02 el BANCO HIPOTECARIO DE LA VIVIENDA (BANHVI) y el MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. La parte recurrente reclama que el Banhvi, mediante oficio nro. BANHVI-SGO-CI-0002- 2024 de 9 de mayo de 2024, suspendió la construcción de viviendas indígenas en madera extraída en los territorios indígenas. Afirma que ese banco tomó la decisión de solicitar las aclaraciones al MINAE ante la derogación del Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas nro. 27800- MINAE por parte de esta Sala. Indica que la citada suspensión viola los derechos de los pueblos indígenas.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Por lo tanto, y hasta no contar con la respuesta de estos dos entes, sugerimos informarles a los potenciales beneficiarios que de momento solo podríamos tramitar casos de vivienda indígena que utilicen otros materiales distintos a la madera, o que la misma no sea proveniente de los territorios indígenas. En cuanto a los casos en trámite, les estaremos informando de las opciones que nos brinden en el MINAE”. (Hecho incontrovertido).
Actualmente, a raíz de la acción de inconstitucionalidad presentada en contra del Decreto Ejecutivo No. 27800-MINAE, promovida por el señor Nombre04, portador de la cédula de identidad número CED03, quien alegó ante la Sala que el decreto impugnado vulneraba el debido proceso, pues carecía de la debida consulta formal, previa e informada que debe realizarse a los pueblos indígenas; esta Institución ha quedado sin marco normativo para poder autorizar la construcción de viviendas indígenas de interés social con madera extraídas del territorio indígena. Recordemos, que mediante la sentencia N° 2016-5620 de las 11:53 horas del 27 de abril de 2016, dictada dentro del expediente que se tramita bajo el número 15-004211-0007-CO, la Sala Constitucional resolvió declarar con lugar la acción y señaló lo siguiente: “Se declara con lugar la acción. En consecuencia, se declara inconstitucional el Decreto Ejecutivo No. 27800-MINAE, denominado Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, publicado en La Gaceta No. 79 del 29 de abril de 1999, por violentar lo dispuesto en los artículos 6 inciso 1.a y 7 incisos 1 y 4 del Convenio No. 169 de la OIT, al haberse omitido la consulta obligatoria a los Pueblos Indígenas de previo a su emisión.
Con fundamento en el numeral 91 de la Ley de la Jurisdicción Constitucional, y a fin de evitar que se lleguen a producir daños graves e irreparables en el ambiente, se dimensionan los efectos de esta sentencia, en el sentido de que esta se dicta sin perjuicio de los derechos adquiridos de buena fe, y se mantiene la vigencia del decreto impugnado por el plazo de 4 años a partir de la publicación de la reseña en el Diario Oficial La Gaceta de esta sentencia, dentro del cual el Poder Ejecutivo deberá llevar a cabo la consulta respectiva a los Pueblos Indígenas, ya sea para prorrogar la vigencia de este mismo decreto o reformar el mismo. Notifíquese al accionante, a la Procuradora General de la República, al Presidente de la República, al Ministro de Ambiente y Energía y al Presidente de la Junta Directiva de la Comisión Nacional de Asuntos Indígenas. Publíquese íntegramente en el Boletín Judicial y reséñese en el Diario Oficial La Gaceta.

El Magistrado Hernández Gutiérrez salva el voto y declara sin lugar la acción.” El director ejecutivo Rafael Gutiérrez Rojas del Sistema Nacional de Áreas de Conservación (SINAC), en escrito agregado al expediente el 18 de febrero de 2022, solicita la ampliación del plazo de vigencia del Decreto Ejecutivo N° 27800-MINAE, por el motivo de la imposibilidad material hasta la fecha para llevar a cabo la consulta a los Pueblos Indígenas, solicita se tome como referencia el plazo Nombre03 en la sentencia N° 2016-5620 de las 11:53 horas del 27 de abril de 2016 que era de 4 años. Dado que el plazo de 4 años que se otorgó para mantener vigente el decreto impugnado ya se venció, se ha realizado un análisis de la resolución dictada y se considera que al derogar la Sala Constitucional el decreto ejecutivo No. 27800-MINAE no existe un cuerpo normativo que nos permita continuar tramitando bonos de vivienda en donde la materia prima para su construcción sea la madera de reservas indígenas.
En conclusión y con la finalidad de evitar futuras contingencias a nivel judicial entre las Asociaciones de Desarrollo Integrales de los Territorios Indígenas y con el objetivo primordial de respetar la normativa nacional relacionada con la materia y sobre todo no violentar el derecho las habitantes de las comunidades indígenas al aprovechamiento forestal en sus territorios, es de sumo interés para esta Institución, se nos informe si el MINAE ha emitido nueva normativa o directriz sobre la materia de consulta, si el Decreto derogado, ya se encuentra en consulta pública, y de ser así el avance de la misma, o por el contrario, si no se ha avanzado por el tema de la consulta, que normativa o directriz puede aplicar esta institución para autorizar la construcción de las viviendas con madera extraídas de las reservas indígenas o si por el contrario esa posibilidad queda inhabilitada hasta que se giren instrucciones por parte de su dependencia”. (Ver informe rendido y prueba aportada).
En esta solicitud de prórroga se indicaba que una de las principales razones por la cuales no se habían logrado realizar las actividades previas y habilitadoras a la consulta, así como la consulta misma, era la falta de recursos presupuestarios, y especialmente que no se vislumbraba la posibilidad de que el SINAC pudiera acceder a los recursos que le correspondían del acuerdo de compra de emisiones REDD+ del Banco Mundial hasta mediados del 2023, razón por la cual se previa que la consulta se realizaría en el 2024, sin embargo, a la fecha SINAC sigue sin poder hacer uso de esos recursos. 2. Sobre la potestad para otorgar permisos de aprovechamiento forestal en territorios indígenas. A raíz de lo señalado en la resolución N2 2022010550 del 11 de mayo 2022, la Sala Constitucional recuerda lo indicado en la Ley Indígena N°6172, especificamente en su artículo N°7, en el cual señala: (…) Para inicios del 2023, un grupo de trabajo convocado por el entonces Viceministro de Ambiente, Don Rafel Guitérrez fue instruido para darle seguimiento al tema del reglamento de aprovechamientos forestales en territorios indígenas, donde este grupo de trabajo, con base en lo indicado en el artículo N°7 de la Ley N° 6172 llego a las siguientes conclusiones: 1.
Los recursos forestales contenidos en los territorios indígenas, corresponden a recursos naturales renovables. 2. El artículo señala claramente que la competencia para autorizar y vigilar los programas forestales que se desarrollen en los territorios indígenas recae sobre la CONAI. 3. la competencia de la CONAI para autorizar y vigilar las actividades de aprovechamiento forestal a lo interno de los territorios indígenas, se reafirma cuando el artículo señala que: “La CONAI está expresamente facultada para revocar o suspender, en cualquier momento, los permisos extendidos”. En adición a lo indicado en el artículo N°7 de la Ley N°6172, en aquel momento se consideró, que no existe en el marco que regula el aprovechamiento forestal, respaldo jurídico para que la Administración Forestal del Estado asuma la competencia de autorizar los aprovechamientos forestales en Territorios Indígenas, ya que estos al ser tierras colectivas, no podrían aplicársela los aspectos normados en los artículos 19, 20, 21, 27 y 28 de la Ley Forestal N°7575, cuyos alcances corresponden a propiedad privada individual.
Con base en esos hallazgos y bajo la coordinación del señor Viceministro se pretendía iniciar un proceso de acercamiento y coordinación con la CONAI, proceso que no se llegó a concretar dada la salida del señor Gutiérrez del Viceministerio de Ambiente, momento a partir del cual no se le dio seguimiento a este proceso. En aquel momento se estimada conveniente que cada territorio, por medio de las instancias de representación reconocidas legalmente o culturalmente, desarrollaran sus propios reglamentos o protocolos comunitarios para el ejercicio del derecho colectivo del uso de sus propios recursos forestales, normativa territorial que deberá ser autorizada por la CONAI, esto de nuevo, según lo indicado en artículo N°7 de la Ley N°6172, y que si los territorios lo tenían a bien, el SINAC en la medida de sus capacidades y recursos podría servir de asesor técnico especializado, para la elaboración de las propuestas de los respectivos reglamentos o protocolos comunitarios. 3.
Sobre el proceso de consulta al reglamento de aprovechamiento forestal en territorios indígenas. En consecuencia con lo indicado en el punto anterior, donde se ha considera, que según lo regulado por las Leyes N° 6172 y N° 7575, el SINAC no tiene competencia para autorizar el aprovechamiento de recursos forestales existentes en los terrenos de propiedad comunitaria que conforma un territorio indígena, razón por la cual, el SINAC no puede constituirse como contraparte interesada en la realización de un proceso de consulta para establecer medidas, que permitan la administración o limitación del uso de los recursos forestales de los territorios indígenas. Lo anterior por cuanto esta es una competencia que la Ley N° 6172 le ha delegado a cada territorio y a la CONAI. 4. Sobre el uso de madera de los territorios indígenas para la construcción de casas de bono familiar de vivienda para personas indígenas.
Estima el suscrito, que al establecerse una limitación para el uso de madera existente en los mismos territorios para la construcción de casas de bono familiar para personas indígenas, medida como la que se indica en el oficio BANHVI-SGO-Cl-0002-2024, se podría estar estableciendo una afectación al pleno disfrute de los derechos colectivos de los pueblos indígenas, por lo que se sugiere a las autoridades del BANHVI solicitar asesoría y elementos para un mejor resolver sobre este tema a la CONAI, considerando lo indicado en el artículo N°7 de la Ley N° 6172”. (Ver prueba aportada por el recurrente).
III.Sobre el caso concreto. En el sub examine, la parte recurrente reclama que el Banhvi, mediante oficio nro. BANHVI-SGO-CI-0002- 2024 de 09 de mayo de 2024, suspendió la construcción de viviendas indígenas en madera extraída en los territorios indígenas. Afirma que ese banco tomó la decisión de solicitar las aclaraciones al MINAE ante la derogación del Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas nro. 27800- MINAE por parte de esta Sala. Indica que la citada suspensión viola los derechos de los pueblos indígenas.
Analizados los autos, la Sala tuvo por probado que, mediante oficio BANHVI-SGO-CI-0002-2024 del 9 de mayo de 2024, dirigido a los directores o jefes de crédito del Sistema Financiero Nacional para la Vivienda, el subgerente de operaciones del Banhvi comunicó: “Por medio de la presente les informamos que actualmente el “Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas N° 27800-MINAE”, que habilita el uso de madera de los territorios indígenas se encuentra derogado mediante resolución de la Sala Constitucional N° 5620 del 27 de abril de 2016, la cual declaró inconstitucional el mismo. En la misma resolución se le otorga al Ministerio de Ambiente y Energía (MINAE) un plazo de 4 años para realizar la consulta respectiva a los pueblos indígenas ya sea para prorrogar el mismo o reformarlo. Habiendo transcurrido el plazo otorgado por la Sala, sin tener aún noticias de que el MINAE hubiera realizado la consulta dicha; este Banco tomó la decisión de solicitar las aclaraciones pertinentes ante la Sala Constitucional, con el propósito de que se indique si al derogarse el Decreto No. 27800 se retrotrae la aplicación del anterior Reglamento; y ante el MINAE respecto a cómo proceder con las solicitudes de bono familiar de vivienda presentadas ante las entidades autorizadas con trámite de aprobación y cuyo propósito es la construcción con madera extraída del territorio indígena.
Por lo tanto, y hasta no contar con la respuesta de estos dos entes, sugerimos informarles a los potenciales beneficiarios que de momento solo podríamos tramitar casos de vivienda indígena que utilicen otros materiales distintos a la madera, o que la misma no sea proveniente de los territorios indígenas. En cuanto a los casos en trámite, les estaremos informando de las opciones que nos brinden en el MINAE”. El 17 de mayo de 2024, el recurrente remitió un correo a Área de Conservación La Amistad Caribe (ACLAC) del SINAC con el propósito de consultar sobre el oficio anterior. El 17 de mayo de 2024, la directora regional del ACLAC respondió al recurrente que no tenía información al respecto. Empero, haría la consulta a nivel central para canalizar su solicitud. Mediante oficio SINAC-ACLAC-DR- 0446-2024 del 17 de mayo del 2024, la directora regional del ACLAC trasladó la solicitud al jefe del Departamento de Participación Ciudadana y Gobernanza.
Mediante oficio BANHVI-SGO-OF-0125-2024 del 7 de junio de 2024, el subgerente de operaciones del Bahnvi indicó al ministro de Ambiente y Energía: “Reciba un cordial saludo de la administración del Banco Hipotecario de la Vivienda (BANHVI). Como es de su conocimiento, nuestra institución tiene el deber de velar por el cumplimiento del derecho constitucional a una vivienda digna para todos los ciudadanos de nuestro país, así mismo que el proceso de formalización y posterior construcción de sus viviendas sean conforme las normas técnicas y requisitos establecidos por el Sistema Financiero Nacional para la Vivienda. Actualmente contamos con un problema de carácter jurídico que se presenta en la tramitación de las solicitudes de bono familiar de vivienda para personas indígenas. Paso a brindarles una pequeña explicación, para los casos de bono familiares en territorios indígenas se les brinda a las familias la posibilidad de gestionar la construcción de su vivienda con madera extraída del territorio indígena, para lo cual el BANHVI dentro del financiamiento les reconoce el pago de la madera.
Actualmente, a raíz de la acción de inconstitucionalidad presentada en contra del Decreto Ejecutivo No. 27800-MINAE, promovida por el señor Nombre04, portador de la cédula de identidad número CED03, quien alegó ante la Sala que el decreto impugnado vulneraba el debido proceso, pues carecía de la debida consulta formal, previa e informada que debe realizarse a los pueblos indígenas; esta Institución ha quedado sin marco normativo para poder autorizar la construcción de viviendas indígenas de interés social con madera extraídas del territorio indígena. Recordemos, que mediante la sentencia N° 2016-5620 de las 11:53 horas del 27 de abril de 2016, dictada dentro del expediente que se tramita bajo el número 15-004211-0007-CO, la Sala Constitucional resolvió declarar con lugar la acción y señaló lo siguiente: “Se declara con lugar la acción. En consecuencia, se declara inconstitucional el Decreto Ejecutivo No. 27800-MINAE, denominado Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas, publicado en La Gaceta No. 79 del 29 de abril de 1999, por violentar lo dispuesto en los artículos 6 inciso 1.a y 7 incisos 1 y 4 del Convenio No. 169 de la OIT, al haberse omitido la consulta obligatoria a los Pueblos Indígenas de previo a su emisión.
Con fundamento en el numeral 91 de la Ley de la Jurisdicción Constitucional, y a fin de evitar que se lleguen a producir daños graves e irreparables en el ambiente, se dimensionan los efectos de esta sentencia, en el sentido de que esta se dicta sin perjuicio de los derechos adquiridos de buena fe, y se mantiene la vigencia del decreto impugnado por el plazo de 4 años a partir de la publicación de la reseña en el Diario Oficial La Gaceta de esta sentencia, dentro del cual el Poder Ejecutivo deberá llevar a cabo la consulta respectiva a los Pueblos Indígenas, ya sea para prorrogar la vigencia de este mismo decreto o reformar el mismo. Notifíquese al accionante, a la Procuradora General de la República, al Presidente de la República, al Ministro de Ambiente y Energía y al Presidente de la Junta Directiva de la Comisión Nacional de Asuntos Indígenas. Publíquese íntegramente en el Boletín Judicial y reséñese en el Diario Oficial La Gaceta.

Mediante oficio SINAC-SE-DPCG-2024 del 11 de junio de 2024, el jefe del Departamento de Participación Ciudadana y Gobernanza respondió a la directora regional del ACLAC: “Como bien se indica en el oficio BANHVI-SGO-CI-0002-2024, el Decreto N° 27800 — MINAE fue derogado mediante sentencia de la Sala Constitucional N°5620 del 27 de abril del 2016, sin embargo, la reseña del voto fue publicada en La Gaceta N° 79 del 28 de febrero de 2018, con lo cual el plazo de 4 años concedido al SINAC en dicha sentencia se extendía hasta el 28 de febrero del 2022. Mediante oficio DM-0244-2022 del 16 de marzo del 2022 la señora Ministra de Ambiente Doña Andrea Meza Murillo, solicita a la Sala Constitucional prórroga hasta finales del 2024, obteniéndose respuesta mediante resolución N° 2022010550 del 11 de mayo 2022, en la que se resuelve no acoger la solicitud planteada por la señora Meza Murillo, con lo cual el Decreto N° 27800 — MINAE fue derogado.
En esta solicitud de prórroga se indicaba que una de las principales razones por la cuales no se habían logrado realizar las actividades previas y habilitadoras a la consulta, así como la consulta misma, era la falta de recursos presupuestarios, y especialmente que no se vislumbraba la posibilidad de que el SINAC pudiera acceder a los recursos que le correspondían del acuerdo de compra de emisiones REDD+ del Banco Mundial hasta mediados del 2023, razón por la cual se previa que la consulta se realizaría en el 2024, sin embargo, a la fecha SINAC sigue sin poder hacer uso de esos recursos. 2. Sobre la potestad para otorgar permisos de aprovechamiento forestal en territorios indígenas. A raíz de lo señalado en la resolución N2 2022010550 del 11 de mayo 2022, la Sala Constitucional recuerda lo indicado en la Ley Indígena N°6172, especificamente en su artículo N°7, en el cual señala: (…) Para inicios del 2023, un grupo de trabajo convocado por el entonces Viceministro de Ambiente, Don Rafel Guitérrez fue instruido para darle seguimiento al tema del reglamento de aprovechamientos forestales en territorios indígenas, donde este grupo de trabajo, con base en lo indicado en el artículo N°7 de la Ley N° 6172 llego a las siguientes conclusiones: 1.
Los recursos forestales contenidos en los territorios indígenas, corresponden a recursos naturales renovables. 2. El artículo señala claramente que la competencia para autorizar y vigilar los programas forestales que se desarrollen en los territorios indígenas recae sobre la CONAI. 3. la competencia de la CONAI para autorizar y vigilar las actividades de aprovechamiento forestal a lo interno de los territorios indígenas, se reafirma cuando el artículo señala que: “La CONAI está expresamente facultada para revocar o suspender, en cualquier momento, los permisos extendidos”. En adición a lo indicado en el artículo N°7 de la Ley N°6172, en aquel momento se consideró, que no existe en el marco que regula el aprovechamiento forestal, respaldo jurídico para que la Administración Forestal del Estado asuma la competencia de autorizar los aprovechamientos forestales en Territorios Indígenas, ya que estos al ser tierras colectivas, no podrían aplicársela los aspectos normados en los artículos 19, 20, 21, 27 y 28 de la Ley Forestal N°7575, cuyos alcances corresponden a propiedad privada individual.
Con base en esos hallazgos y bajo la coordinación del señor Viceministro se pretendía iniciar un proceso de acercamiento y coordinación con la CONAI, proceso que no se llegó a concretar dada la salida del señor Gutiérrez del Viceministerio de Ambiente, momento a partir del cual no se le dio seguimiento a este proceso. En aquel momento se estimada conveniente que cada territorio, por medio de las instancias de representación reconocidas legalmente o culturalmente, desarrollaran sus propios reglamentos o protocolos comunitarios para el ejercicio del derecho colectivo del uso de sus propios recursos forestales, normativa territorial que deberá ser autorizada por la CONAI, esto de nuevo, según lo indicado en artículo N°7 de la Ley N°6172, y que si los territorios lo tenían a bien, el SINAC en la medida de sus capacidades y recursos podría servir de asesor técnico especializado, para la elaboración de las propuestas de los respectivos reglamentos o protocolos comunitarios. 3.
Sobre el proceso de consulta al reglamento de aprovechamiento forestal en territorios indígenas. En consecuencia con lo indicado en el punto anterior, donde se ha considera, que según lo regulado por las Leyes N° 6172 y N° 7575, el SINAC no tiene competencia para autorizar el aprovechamiento de recursos forestales existentes en los terrenos de propiedad comunitaria que conforma un territorio indígena, razón por la cual, el SINAC no puede constituirse como contraparte interesada en la realización de un proceso de consulta para establecer medidas, que permitan la administración o limitación del uso de los recursos forestales de los territorios indígenas. Lo anterior por cuanto esta es una competencia que la Ley N° 6172 le ha delegado a cada territorio y a la CONAI. 4. Sobre el uso de madera de los territorios indígenas para la construcción de casas de bono familiar de vivienda para personas indígenas.
Estima el suscrito, que al establecerse una limitación para el uso de madera existente en los mismos territorios para la construcción de casas de bono familiar para personas indígenas, medida como la que se indica en el oficio BANHVI-SGO-Cl-0002-2024, se podría estar estableciendo una afectación al pleno disfrute de los derechos colectivos de los pueblos indígenas, por lo que se sugiere a las autoridades del BANHVI solicitar asesoría y elementos para un mejor resolver sobre este tema a la CONAI, considerando lo indicado en el artículo N°7 de la Ley N° 6172”.
Ahora bien, la Sala determina que el Banhvi suspendió la tramitación de beneficios para vivienda indígena con uso de madera, debido a la necesidad de efectuar consultas con respecto a la posibilidad de aprovechar tal recurso, visto que el Reglamento para el Aprovechamiento del Recurso Forestal en las Reservas Indígenas (decreto nro. 27800-MINAE) fue anulado por la Sala Constitucional. Por ese motivo, dirigió oficios tanto a este Tribunal como al MINAE. Se entiende que, una vez que exista claridad sobre la situación legal, entonces se decidiría sobre el trámite de tales beneficios. Posteriormente, mediante oficio BANHVI-SGO-OF-0125-2024 del 7 de junio de 2024, el subgerente de operaciones del Bahnvi efectuó la consulta respectiva al ministro de Ambiente y Energía. Además, a lo interno del SINAC, el Departamento de Participación Ciudadana y Gobernanza expresó su criterio jurídico con respecto al tema en cuestión (oficio SINAC-SE-DPCG-2024 del 11 de junio de 2024).
Al valorar estos elementos, la Sala no observa una lesión a los derechos de la parte amparada. En efecto, el Banhvi realizó una consulta interinstitucional con el propósito de tener claridad con respecto a la explotación sostenible y legal de los bosques. En el ínterin, decidió suspender los beneficios que significaran la explotación del recurso maderero. Es decir, ante la incertidumbre con respecto a un posible daño ambiental, la Sala avala que las instituciones estatales tomen medidas preventivas hasta adquirir certeza con respecto a la posibilidad de explotar de manera racional y sostenible el recurso natural. Asimismo, si se toma en cuenta que la suspensión reclamada se dio mediante oficio nro. BANHVI-SGO-CI-0002-2024 de 9 de mayo de 2024 la Sala estima que, al momento de interposición del amparo (31 de mayo de 2024) no había transcurrido un plazo irrazonable para que las instancias accionadas resolvieran sobre el tema. En virtud de lo expuesto, se declara sin lugar el recurso.
IV.Tomen nota las autoridades accionadas de la necesidad de atender con prontitud la situación objeto de este proceso, de manera que se brinde certeza a la situación jurídica reclamada
V.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso. Tomen nota las autoridades recurridas de lo indicado en el considerando IV de esta sentencia.
